[0:04:44] Voice 17: locations across the territory of the coach salish peoples and uh the territory in um
[0:04:52] Voice 17: the comox people as as a large um and local locally located uh interests on on hornby island
[0:05:05] Voice 17: my name is uh tim peterson i'm elected on luskete island i'm the chair of the hornby island local
[0:05:10] Voice 17: trust committee i'm joined today by hornby island trustees grant scott and alex allen and together
[0:05:19] Voice 17: we make the hornby island local trust committee this meeting is being live streamed and recorded
[0:05:25] Voice 17: for those who are unable to attend in person and i'd ask everyone in the audience uh oh that's
[0:05:32] Voice 17: actually not relevant today because we're not in the hall um we have staff members joining us today

[0:06:19] Voice 17: to make decisions about land use planning matters and to discuss relevant business
[0:06:24] Voice 17: and i also want to add that this is a place of employment and despite the fact that some staff are
[0:06:29] Voice 17: working in their own homes our staff have the right to a safe and respectful workplace and
[0:06:36] Voice 17: And with that, we have an agenda before us, and I'll look to trustees to see if there are any amendments to the agenda today.
[0:06:49] Voice 17: Not seeing any, I'll take it by general consent, we'll approve the agenda as presented.
[0:06:55] Voice 17: And so to start off, we have trustee reports. Who would like to go first?
[0:07:04] Trustee Allen: I'm going to just be really quick because we're already a few minutes behind.
[0:07:08] Trustee Allen: behind um i've had to make the uh a decision that i had to step down from regional planning
[0:07:16] Trustee Allen: committee unfortunately i just realized like you can't have a full-time job and be on two
[0:07:22] Trustee Allen: committees as well as your local committee so i chose the regional planning because i'm the vice
[0:07:29] Trustee Allen: chair of the programs trust programs committee so um yeah that's my story and it's unfortunate
[0:07:36] Trustee Allen: because i was really enjoying the work on there and uh maybe things will slow down i don't know
[0:07:40] Trustee Allen: maybe they won't know that's the way it is so that's my report very

[0:07:58] Voice 3: say start off by saying at that last meeting in the hall um i made a mistake by making the
[0:08:06] Voice 3: The recommendation that the APC, we used the APC recommendations without a temporary use permit.
[0:08:16] Voice 3: And then I realized after I'd done that, that that had been a mistake.
[0:08:20] Voice 3: It negates the core recommendation of the APC upon which all the others are predicated.
[0:08:25] Voice 3: And it would put the whole process back so far.
[0:08:29] Voice 3: So realizing that was a mistake, that's why we called that RWM.
[0:08:34] Voice 3: Tim? No, am I saying that right? Yeah, without meeting, resolution without meeting to correct
[0:08:42] Voice 3: that. So, and it's something, Tim, maybe you could point out, but it's something used by the
[0:08:47] Voice 3: Islands Trust and other organizations all the time to try to, and we needed to do that to keep
[0:08:52] Voice 3: the process going, or we would have had another month or two if we'd waited till the next meeting.
[0:08:57] Voice 3: So that's why all that was done. So I just want to say that corrected that motion that was made
[0:09:04] Voice 3: at that last meeting so that's now been corrected so we we can we can move ahead so i just want to
[0:09:11] Voice 3: it caused a fair amount of consternation and as you know i tried to correct some of that on the
[0:09:17] Voice 3: on the radio when an earlier a radio broadcast a week before did not clarify that so i tried
[0:09:24] Voice 3: to clarify it so anyway i'll just that's my report thank you thank

[0:09:51] Voice 17: Yeah. So for my chair's report, I'll just mention that the
[0:09:58] Voice 17: hiring committee for the new CAO who is going to retire in June continues to meet.
[0:10:03] Voice 17: We expect to release information. A contract will be awarded for an executive search firm to carry out the search process here shortly.
[0:10:17] Voice 17: We're also realizing that we may not have those candidates in place by the time the CAO does retire.
[0:10:27] Voice 17: So we're also looking at an interim process, both within the organization and externally for an interim CAO that might have a term of three to four months while that other process completes.
[0:10:44] Voice 17: elites. Coming up in May, there's going to be the first Committee of the Whole meeting
[0:10:51] Voice 17: of Islands Trust. Committee of the Whole is deliberative sessions where discussions take
[0:10:58] Voice 17: place but no decisions are made. And that will be focused on the Islands Trust policy
[0:11:08] Voice 17: statement review and update project so we're looking forward to getting our
[0:11:15] Voice 17: eyes on that I'll also mention that on April 29th I'll be heading down to
[0:11:24] Voice 17: Victoria to meet with senior staff at the Ministry of Transportation and
[0:11:29] Voice 17: Infrastructure we have a long-standing agreement a letter of agreement with the
[0:11:37] Voice 17: the ministry that uh has provision for an interagency task force to
[0:11:43] Voice 17: really improve communications um and despite the fact that that's been in place since 1996
[0:11:52] Voice 17: uh that task force has never been struck i'm very hopeful that that will be the main thing that
[0:11:59] Voice 17: comes out of this meeting between uh some some members of violence trust and and the uh and the
[0:12:06] Voice 17: the MOTI staff. So that could be a very positive step forward to have a regular form of communication
[0:12:15] Voice 17: back and forth. So those are the things I wanted to mention there. I didn't see,
[0:12:25] Voice 17: we have a space for a regional director report, but I don't think Daniel Arbour is joining us
[0:12:31] Voice 17: today. I'm just going to double check the participant list and make sure I don't see him
[0:12:36] Voice 17: him here yeah i don't think he's joining us today but we do appreciate when he can come and
[0:12:45] Voice 17: the public comment period is coming up next and i have a couple of notes i'd like to share
[0:12:52] Voice 17: before we get into that um just to preface the discussion with some information uh that may
[0:13:00] Voice 17: may be helpful for everyone so what the local trust committee is discussing today
[0:13:06] Voice 17: day is an amended project charter for the official community plan and today we're going to be
[0:13:13] Voice 17: considering endorsement of that revised project charter on page 67 of our agenda today is the
[0:13:20] Voice 17: work plan overview and it outlines how the process is expected to unfold today as i said
[0:13:29] Voice 17: considering endorsement of the revised project charter and consideration of the issues is an
[0:13:36] Voice 17: ongoing process assuming that the ltc today chooses to proceed with this the recommended
[0:13:46] Voice 17: resolutions we'd be looking at draft bylaws coming in the summer for consideration of first reading
[0:13:52] Voice 17: if that takes place then we'd be looking at referrals to first nations agencies
[0:13:59] Voice 17: Agencies, ABC, community groups, the public.
[0:14:03] Voice 17: The fall or early winter, we'd have a community information meeting and consider a second reading of the housing and vacation rental bylaws.
[0:14:14] Voice 17: And in the winter, we'd have possibly another community information meeting and certainly a statutory public hearing for the bylaws.
[0:14:24] Voice 17: and third reading and forwarding of the bylaws the executive committee and the
[0:14:32] Voice 17: Ministry for approval would happen over the winter it's important to note that
[0:14:38] Voice 17: nothing is final until adoption and that up until the public hearing is complete
[0:14:45] Voice 17: our ears remain open to two comments from the public so as trustee Scott has
[0:14:55] Voice 17: As noted, the resolution made at their last meeting wasn't precisely what the trustees had wanted.
[0:15:03] Voice 17: And so we did have a resolution without meeting process after that.
[0:15:07] Voice 17: And essentially to ensure, as Grant mentioned again, that staff didn't put time into drafting bylaws that might get significantly changed this meeting.
[0:15:16] Voice 17: And we don't want to send them back to the drawing board, waste time and energy and delay the project.
[0:15:22] Voice 17: act and just a little bit about resolutions without meetings um interest council meeting
[0:15:28] Voice 17: proceeding procedures guidelines uh resolutions without meeting the section 2.1 and um sections
[0:15:38] Voice 17: 13 2 3 4 and 26 2 3 and 4 of the island's trust act to provide the authority for resolutions
[0:15:44] Voice 17: without meetings and decisions they're different than meetings they they did
[0:15:57] Voice 17: not allow teleconferencing they don't allow discussion whatsoever so the way
[0:16:05] Voice 17: they work is a trustee proposes a resolution and through staff, staff forwards that to
[0:16:20] Voice 17: the chair. The chair being me in this case, considers that it may be possible to do this
[0:16:32] Voice 17: without discussion given the circumstances and as i mentioned the desire not to um send staff on
[0:16:40] Voice 17: on a work journey that was going to be undone uh we proceeded with that and then it proceeds
[0:16:48] Voice 17: uh to a vote so there is no discussion permitted um within that process and thus
[0:16:56] Voice 17: Thus, resolutions without meetings are generally held on more non-controversial type items.
[0:17:08] Voice 17: In this case, the trustees were both in alignment and no discussion was required.
[0:17:14] Voice 17: And when there is discussion desired, then we cannot use the resolution without meeting process.
[0:17:23] Voice 17: process and I'll just also note the resolution without meeting cannot be used to conduct second
[0:17:28] Voice 17: or third readings of a bylaw and then just briefly uh business licensing has been discussed a fair
[0:17:35] Voice 17: bit around this project the the Comox Regional uh Comox Valley Regional District has agreed to
[0:17:43] Voice 17: consider funding a feasibility study to Institute business licensing for short-term vacation rentals
[0:17:49] Voice 17: on Hornby. But I want to be clear, this does not mean that the study will take place or that the
[0:17:56] Voice 17: CVRD will decide to continue with the business licensing should the study take place. It may
[0:18:02] Voice 17: be that a feasibility study indicates that it's not financially viable or administratively
[0:18:10] Voice 17: burdensome for the regional district. So we just can't know what the feasibility study would say
[0:18:14] Voice 17: if in fact it takes place.
[0:18:18] Voice 17: Business licensing in general is in addition to any zoning
[0:18:22] Voice 17: or permitting of a use in a specific zone
[0:18:25] Voice 17: or the use being authorized through a temporary use permit.
[0:18:31] Voice 17: And the regional district cannot issue a business license
[0:18:34] Voice 17: for land use that isn't otherwise permitted in the OCP
[0:18:38] Voice 17: and LUB, the land use bylaw.
[0:18:42] Voice 17: There are other questions that may be discussed.
[0:18:46] Voice 17: by the CVRD and the Local Trust Committee if and when a feasibility study is initiated
[0:18:53] Voice 17: to explore the options and implications of a licensing regime.
[0:18:57] Voice 17: So that's that bit.
[0:18:58] Voice 17: And then finally, temporary permits are being considered as a way to permit a short-term vacation rental as a land use.
[0:19:08] Voice 17: They will not in and of themselves provide a cap on the numbers.
[0:19:12] Voice 17: numbers. However, the Local Trust Committee can monitor the number of temporary use permits
[0:19:18] Voice 17: for short-term vacation rentals and decide whether or not to entertain further applications
[0:19:25] Voice 17: and thus limit the total number permitted. So it would be looking at the decision of
[0:19:30] Voice 17: the Local Trust Committee on whether to entertain further applications at some point.
[0:19:37] Voice 17: And finally, just a note that the local trust committee, we're enjoying to remain impartial at this stage and ensure that no decisions about the final content are made prior to considering the actual draft bylaws and receiving public input on them.
[0:19:54] Voice 17: So as I mentioned earlier, we'll be we'll be should be receiving the draft bylaws in summer and then receiving public input and then we'll have further consideration at that point.
[0:20:13] Voice 17: So I just wanted to preface the public comment period with all that information.
[0:20:17] Voice 17: I hope it's helpful. And

[0:20:52] Voice 17: for a topic specific reasons and they're not they're not the same as a regular meeting in
[0:21:02] Voice 17: that sense and so the agenda format is different we don't generally entertain such things as

[0:21:18] Voice 17: um type of business that we would do at a regular meeting so i hope that's helpful

[0:22:35] Voice 12: The world is seeing the struggles in every community over how uncontrolled tourism affects
[0:22:41] Voice 12: affects cities, small communities, and the disenfranchised, and many of us here on Hornby
[0:22:47] Voice 12: have come to recognize the need for some form of regulation in this sector. Following is the letter
[0:22:55] Voice 12: to Hornby Island trustees, I think you've received a copy of this already, co-signed by those 51
[0:22:59] Voice 12: residents. We would like to express our support to the Hornby Island Local Trust Committee
[0:23:05] Voice 12: in response to the recent decision to ask the planners to draft language in support of the
[0:23:11] Voice 12: Advisory Planning Commission's recommendations released in March 2022. We, the undersigned,
[0:23:20] Voice 12: those 51 people, representing long-time year-round residents and others, wish to make our collective
[0:23:27] Voice 12: voice heard. We support the local trust committee to stay the course toward enacting temporary use
[0:23:33] Voice 12: permits and therefore the set of recommendations made by the Advisory Planning Commission.
[0:23:40] Voice 12: That's the end of that brief report. Thank you.

[0:24:25] Voice 4: Until now, Hornby's had the most lenient regulations concerning short-term vacation rentals in the entire Island Trust area.
[0:24:34] Voice 4: And I am so glad that we are moving forward.
[0:24:39] Voice 4: It has been difficult to sit through the last two years where I feel that those folks who operate for profit, short-term vacation rental businesses, it has looked from the outside as though they were willing to resist, sabotage, and stall the whole process for as long as possible.
[0:25:04] Voice 4: and it has been hard to listen to the slandering of APC members,
[0:25:11] Voice 4: misconstruing of APC recommendations.
[0:25:14] Voice 4: I am really wanting us to move forward.
[0:25:18] Voice 4: I feel that a lot of time has been given to hear from that particular group
[0:25:26] Voice 4: and they do not speak for Hornby.
[0:25:29] Voice 4: There are many of us who want control to be placed on the number of short-term vacation rentals and how they operate.
[0:25:41] Voice 4: As Mary has said, changes are being made all over the world in this regard.
[0:25:46] Voice 4: And I also want to say community is much more than how we can make the most money.
[0:25:54] Voice 4: And I think we really, really need to bring some balance into this.

[0:32:04] Voice 10: We're here to say that we support the direction on vacation rentals in the project charter with one small amendment to the tone of the statement, but no change to the intent or direction.

[0:45:26] Voice 1: I'm attending today from Victoria, so on the ancestral unceded territories of the Lekwungen
[0:45:31] Voice 1: and WSANIC nations.
[0:45:32] Voice 1: So for those of you that I haven't had the opportunity to meet yet, either in person
[0:45:37] Voice 1: or virtually, my name is Ross Burchall.
[0:45:39] Voice 1: I'm managing partner of WCG.
[0:45:42] Voice 1: We're a management consultancy headquartered here in Victoria, and I'm speaking today on
[0:45:47] Voice 1: behalf of HI-SEEC, who has brought us in to assist in exploring options related to housing.
[0:45:52] Voice 1: housing, that's government relations, community engagement, all of those related components.
[0:45:59] Voice 1: Joining me on the call, I believe, formally is representatives from High Seeker, Karen Ross,
[0:46:04] Voice 1: Executive Director, and Catherine Ronan from the Board of Directors. So I can't see them on the
[0:46:09] Voice 1: call, but I just wanted to acknowledge their presence here today as well. The first item from
[0:46:15] Voice 1: our submission contained in the agenda today is in relation to the Rural Economic Diversification
[0:46:20] Voice 1: infrastructure program or reddit for short which as you'll recall from our
[0:46:26] Voice 1: previous delegation high seeks application to this program with respect
[0:46:31] Voice 1: to a diversified community development proposal was gratefully supported by
[0:46:35] Voice 1: islands trust in the way of a letter of support which ultimately contributed to
[0:46:40] Voice 1: a successful application so there was a recent announcement of $100,000 from
[0:46:46] Voice 1: from that program toward project costs,
[0:46:49] Voice 1: which include the pre-feasibility
[0:46:52] Voice 1: and feasibility components of the project
[0:46:54] Voice 1: and business planning, work related to land use,
[0:46:58] Voice 1: servicing, et cetera.
[0:47:00] Voice 1: So a copy of that proposal was previously provided
[0:47:05] Voice 1: to Islands Trust and High Seek would be pleased
[0:47:07] Voice 1: to provide copies again if needed,
[0:47:09] Voice 1: but the focus is primarily on housing.
[0:47:13] Voice 1: So not only our work, but also previous work by High Seek and other community organizations, through all of that, it's been made clear that safe, inclusive, clean, affordable, attainable housing that meets a diverse set of needs for the Hornby Island community is a priority, and that's what this project is ultimately aiming to address.
[0:47:34] Voice 1: address. Your advocacy in this area did not go unnoticed. So kudos to the local trust committee
[0:47:42] Voice 1: for ushering through that letter of support and staff as well for that application. And I'm
[0:47:48] Voice 1: super pleased to be able to share that good news with you today around the success of that
[0:47:54] Voice 1: application. So we're all hearing about housing these days, one of the really exciting new
[0:48:01] Voice 1: initiatives that we've been closely monitoring on our end and liaising with the provincial
[0:48:06] Voice 1: government on is BCBuilds. You'll likely know that's a housing program delivered by BC Housing
[0:48:14] Voice 1: to speed up the development of new homes for middle-income working people throughout BC,
[0:48:20] Voice 1: including rural communities. And so communicating with program staff, as well as Lisa Helps,
[0:48:26] Voice 1: who is serving as executive lead for bc builds project origination we're working toward having
[0:48:32] Voice 1: hornby island as a partner community and determining what areas of funding and investment
[0:48:37] Voice 1: are available and even applicable from a number of other sources as well to to move this initiative
[0:48:44] Voice 1: ahead um some of which i shared with you in our our previous delegation the likes of fcm cmhc
[0:48:50] Voice 1: those types of programs and funding mechanisms um so as the committee will know uh options are
[0:48:57] Voice 1: limited for for suitable land for the purposes of um of housing in this in this project so
[0:49:03] Voice 1: high seeks goal is to create options rather than uh put all the eggs in in one proverbial basket
[0:49:10] Voice 1: so our firm provided a recommendation to high seeks board that it explore a crown land use
[0:49:18] Voice 1: application in tandem with exploring potential private options as well. And that could include
[0:49:23] Voice 1: partnerships with landowners, potential developers, and to really keep that community
[0:49:30] Voice 1: conversation around possibilities in this area going. And more recently, just yesterday, actually,
[0:49:37] Voice 1: a meeting of the Hornby Island Housing Network was convened. And there, I really emphasize that
[0:49:43] Voice 1: need for continued collaboration amongst community organizations, government, individuals, and
[0:49:50] Voice 1: internally reviewing capacity and creating plans to increase capacity where it may be lacking
[0:49:55] Voice 1: to see projects like this through to fruition. I was encouraged by the response and the
[0:50:03] Voice 1: willingness of the community to do this and keep that going, but I'm also not surprised when that
[0:50:09] Voice 1: call to action is made. Hornby Island residents and committed organizations are there to answer
[0:50:15] Voice 1: that call. High Seek is equally committed to making the continued collaboration and engagement
[0:50:21] Voice 1: efforts a priority. So this is all really positive moving forward. High Seek's working now to prepare
[0:50:27] Voice 1: a formal Crown land use application with the provincial government, which as you likely know
[0:50:32] Voice 1: is a lengthy process. This wouldn't be a true delegation if I didn't ask you for something. So
[0:50:38] Voice 1: So in order to lay the groundwork for a successful application to the province,
[0:50:44] Voice 1: Hi-Seek is proposing an amendment to Land Use By-law 150PUA
[0:50:50] Voice 1: under the site-specific regulations.
[0:50:53] Voice 1: So that currently reads that the only permitted uses are cemetery,
[0:50:59] Voice 1: public utility storage yard, highways maintenance yard, and recycling depot.
[0:51:04] Voice 1: that should tell tell you exactly the parcel of land i'm referring to on hornby but um in order
[0:51:11] Voice 1: to facilitate the application and allow for uh accessible housing that's centrally located
[0:51:17] Voice 1: and in tune with the various needs of hornby um high seeks proposing a single word change
[0:51:24] Voice 1: to read quote despite subsection 8.21 subsection 1 additional permitted uses are end quote so that
[0:51:37] Voice 1: would involve striking through the only permitted uses are and replacing it with additional so this
[0:51:45] Voice 1: would allow site-specific regulations to remain in place and maintain oversight and control from
[0:51:51] Voice 1: island's trust perspective with respect to the land use bylaw but also allow some flexibility
[0:51:56] Voice 1: when it comes to approving other uses for the remaining land such as housing at a later date
[0:52:02] Voice 1: so again just providing that flexibility further direction and and your advice and guidance is
[0:52:09] Voice 1: appreciated of course so if that's including it through your work plan project or even earlier
[0:52:15] Voice 1: to assist this particular aspect
[0:52:17] Voice 1: of the Crown land use application,
[0:52:20] Voice 1: open to hearing options.

[0:53:07] Trustee Allen: and our continuing struggle with anything is our infrastructure. And as you know,
[0:53:13] Trustee Allen: the Beulah Creek, I don't know how many years. It's been so many years.
[0:53:16] Trustee Allen: and um and it's still now it's the water license how um you know speaking of lengthy as you said
[0:53:25] Trustee Allen: so how do you feel this proposal is going to be different or cheaper or you know the cost of
[0:53:30] Trustee Allen: everything is insane um but in particular the um the province doesn't seem to understand
[0:53:37] Trustee Allen: our challenges with infrastructure on in terms of any kind of housing development like bela creek
[0:53:43] Trustee Allen: and what High Seek is proposing.
[0:53:47] Trustee Allen: So can you comment on that?
[0:53:49] Voice 1: Certainly.
[0:53:50] Voice 1: Well, I think certainly politically the appetite has changed
[0:53:53] Voice 1: with respect to housing.
[0:53:55] Voice 1: I think Beulah Creek can certainly serve as a learning experience.
[0:54:00] Voice 1: You know, I obviously can't speak to the intricacies there
[0:54:03] Voice 1: or the ins and outs of how that project has gone.
[0:54:07] Voice 1: You know, we received some updates yesterday.
[0:54:09] Voice 1: You know, that's not my role to share.
[0:54:11] Voice 1: But I think it's encouraging to see that momentum now, and especially with more funding available. I will include just sort of what I shared yesterday with them, though, that just because all these funding mechanisms and programs are in place, it doesn't mean that they're going to do the heavy lifting for us.
[0:54:31] Voice 1: so we need to be uh mindful of that cognizant of that and that's why um we started shifting
[0:54:38] Voice 1: that conversation um from okay we've studied the problem now let's solve the problem what does it
[0:54:44] Voice 1: look like in terms of collaboration so who who's in who's out who's involved what does that look
[0:54:50] Voice 1: like and um and capacity so is that community capacity is that organizational capacity a blend
[0:54:58] Voice 1: end of the two um what does that all look like and so um like i say i was really encouraged uh
[0:55:04] Voice 1: from yesterday's meeting that those conversations are are starting to be had and um i think with uh
[0:55:11] Voice 1: you know many hands makes light work right so i think um having that continued collaboration
[0:55:15] Voice 1: um would uh would be able to see this move forward and i think that uh because that appetite is now
[0:55:22] Voice 1: Now, they're at the provincial and federal government levels that we may see some inroads.
[0:55:29] Voice 1: I hope that provides a bit of clarity.

[0:57:23] Voice 1: know that the the intent there is simply to make uh the language somewhat less restrictive so that
[0:57:29] Voice 1: But again, from those four key pieces, it's allowing the flexibility for a future application to include additional uses.

So they're going to do their checks and balances and see, oh, well, we don't see housing on there or we don't see an ability for housing to be on there. So yeah, as part of that process, that would occur.

[1:01:56] Voice 13: any type of recommendations but i can run through a couple of things um now just for clarity so
[1:02:03] Voice 13: So we have fairly clear direction from bylaw enforcement that the use isn't actually permitted under the current version of the bylaw.
[1:02:14] Voice 13: And so, you know, the options for the LTC to address this, if this is something that you wish to do, would be to, you know, either initiate a minor project, like put it on your projects last.
[1:02:29] Voice 13: list um if you know the desire was to look at ag regulations more generally in the bylaw like a
[1:02:38] Voice 13: broader review of those that that's a much bigger type project and denman has as you know have been
[1:02:44] Voice 13: engaged in their farm plan for many many years and that span multiple uh trustee um um 10 years
[1:02:52] Voice 13: it's been spent multiple LTCs. So that can take a longer period of time. There is the option to
[1:03:02] Voice 13: include it as with a couple of other sort of laundry lists. And I don't mean that in a
[1:03:08] Voice 13: disparaging way, but other items that in the OCPL, you'd be reviewed such as backyard chicken
[1:03:13] Voice 13: cisterns and so forth, which are in the project charter currently. But of course, there's
[1:03:18] Voice 13: implications to adding or amending, you know, the project charter that you're going to get
[1:03:24] Voice 13: pretty quick coming up in this meeting. You know, it adds time and complexity
[1:03:31] Voice 13: to that project, essentially. So especially if it's not just about, you know, looking at one
[1:03:37] Voice 13: specific zone, if it's about a bigger agricultural regulations review. And on that, you know,
[1:03:46] Voice 13: Some of the issues, even though on the face of it, it may look like a fairly simple amendment in a way, there are other things for the LTC to consider.
[1:03:57] Voice 13: Does it want to restrict the number of accommodation units like the ALC and the ALR-10 is permitted unless a local government further restricts, for example?
[1:04:09] Voice 13: example, you know, do you want to restrict the type, the type, like only campsites, no cabins,
[1:04:15] Voice 13: for example, or whatever, whatever it is. So, you know, those are the types of complexities,
[1:04:20] Voice 13: even with what may on the face of it seem like a bit of a smaller issue. And then the other thing
[1:04:28] Voice 13: is that, although this is an option, it's not, it's not always the most advisable. And that
[1:04:36] Voice 13: would be to direct by-law to non-enforcement, some type of non-enforcement on the use.
[1:04:42] Voice 13: Similar to what the LTC has done with standing resolutions for non-enforcement on housing for
[1:04:49] Voice 13: various reasons. But the issue with, and I would just caution that the issue with that is that
[1:04:54] Voice 13: the LTC already has quite a number of standing resolutions in that kind of
[1:04:58] Voice 13: vein and eventually, not to make light of it, but they sort of become their own by-law in a way.
[1:05:05] Voice 13: Like, you know, if you're sort of not enforcing on a bunch of areas of your bylaw, just to be, you know, so that's, so I'll reiterate those options, which is, you know, maybe look at a minor project in the future, include it in the charter that you've already got, or look at an enforcement option.

[2:27:53] Voice 13: the the major project is really the arena the formal engagement process and the primary avenue
[2:27:58] Voice 13: for discussing and addressing Comox's interests and concerns at this time you know without the
[2:28:05] Voice 13: need to necessarily refer this heritage register project to them not that not that in the future
[2:28:14] Voice 13: perhaps other you know community discussion around heritage preservation and and what might
[2:28:20] Voice 13: be added to a heritage register that would include Comox's interests not that that's not possible
[2:28:24] Voice 13: but at this time that you know we're narrowing this this project scope down to something um
[2:28:32] Voice 13: achievable and um you know there's those three sites the schoolhouse the hall and the room to
[2:28:37] Voice 13: grow building that are really being considered as being added at this time that's sort of what's in
[2:28:42] Voice 13: in scope and so this um really allows uh there you'll see the reduction to the budget for the
[2:28:49] Voice 13: project, but that does not mean or not to suggest that this project is going away or being tabled
[2:28:56] Voice 13: at all. It's that I actually will facilitate the expedient resolution to the project,
[2:29:05] Voice 13: hopefully, and also allow the OCP major project to move ahead as well. So if you have questions

[2:49:58] Voice 11: bylaws. So first reading, a community information meeting, the public hearing, those are all

[2:50:11] Voice 11: The website is the primary source of those updates and information, as well as the subscribers list
[2:50:17] Voice 11: that we regularly send updates to so that they understand how far are we from adoption because
[2:50:23] Voice 11: at the point of adoption of those bylaws is when the regulations change the date of adoption
[2:50:31] Voice 11: signifies the date under which those rules are now in effect and so this is a best guess work
[2:50:38] Voice 11: plan in terms of how to advance this i have no control over how long it takes for the minister
[2:50:44] Voice 11: of housing to return a bylaw for confirmation that it's been approved. We have seen months,
[2:50:53] Voice 11: everything from three to eight to 12 months of a delay at the provincial ministry for the official
[2:50:59] Voice 11: community plan bylaws. So this is our best guess that by spring 2025, you may be in a position to
[2:51:07] Voice 11: consider a final adoption. Having said that, the public will be apprised through your regular
[2:51:15] Voice 11: business meetings or your own trustee updates that you use to communicate with your constituents
[2:51:20] Voice 11: about the status of where this is at and of course the closer we are to that stage which is
[2:51:27] Voice 11: post referral to the province the closer we are to formulating from an administrative point of view
[2:51:37] Voice 11: the communications materials are drafting the appropriate materials
[2:51:40] Voice 11: materials that we'll be using to share with the community about next steps. And I can't predict
[2:51:47] Voice 11: what that is because the bylaws haven't been given a reading yet. So right now we know we're looking
[2:51:53] Voice 11: at temporary use permits, which means people would have to apply if they wanted to be operating,
[2:51:58] Voice 11: let's say for next season, 2025 season. The deadlines for applications, the batching of that,
[2:52:05] Voice 11: all those discussions have not been had from an administrative point of view, because again,
[2:52:08] Voice 11: Again, the bylaws have not even been drafted for first reading.

CALL TO ORDER Chair Peterson called the meeting to order at 11:41 a.m. He acknowledged that the meeting was held on the territory of the Coast Salish First Nations. He introduced himself, trustees, staff, recorder, and members of the public; and noted that the meeting was being livestreamed and recorded. 2. APPROVAL OF AGENDA By general consent the agenda was approved as presented. 3. REPORTS 3.1 Trustee Reports Trustee Allen reported on the following: Regret for being over-committed and having to step down from the Regional Planning Committee despite enjoying it; but will remain as Vice-Chair of the Trust Programs Committee. Trustee Scott reported on the following: At the last Hornby Local Trust Committee (LTC) meeting, I mistakenly negated the significance of the Temporary Use Permit, which is a foundation to all the other ADOPTED Hornby Island ADOPTED 2 Local Trust Committee Minutes April 26, 2024 Advisory planning Commission recommendations; so, to correct this, a Resolution Without Meeting (RWM) was called, and a motion was made to correct the previous incorrect motion, rather than wait two months for the next regular meeting which would have stalled the process. 3.2 Chair's Report Chair Peterson reported on the following: The hiring committee for a new Islands Trust Chief Administrative Officer (CAO) will be contracting with an executive search firm shortly; and may need to hire an interim CAO, internally or externally for a term of 3 to 4 months, if a new CAO is not found before the current CAO retires. The first upcoming Islands Trust Committee of the Whole meeting in May 2024, consisting of deliberative discussions without decision making, will focus on the Islands Trust Policy Statement Review Project. Upcoming April 29, 2024 meeting in Victoria to speak with senior staff of the Ministry of Transportation and Infrastructure (MOTI) to revive the longstanding agreement since 1996 for an interagency taskforce to be created for the purpose of regular communications. 3.3 Electoral Area Director's Report None 4. PUBLIC COMMENTS Chair Peterson, for purposes of clarity, advised members of the public on the following: The Hornby LTC would be considering, at the current meeting, the endorsement of a revised Public Charter for the Hornby Island Official Community Plan (OCP) and Land Use Bylaw (LUB) Review as contained on page 67 of the current agenda package; however, this process is a long, ongoing one involving numerous readings, referrals, a community information meeting, a public hearing, and ministerial approval, the last of which might occur in the winter of 2024/2025 at the earliest. The recent resolution made at the Resolution Without Meeting (RWM) was made so that staff did not waste time on tenuous bylaws. Trust Council Meetings Procedures Guidelines Section 2.1; Sections 13.2.; 13.3; and 13.4 and Sections 26.2; 26.3; and 26.4; provide the authority for RWMs. RWMs do not allow discussion: a trustee proposes a resolution and forwards it to staff who forward it to the Chair who considers it for proceeding to a vote. RWMs are used for resolutions that are non-controversial between trustees because, if discussion is required, the regular meeting process must prevail. RWMs cannot be used to conduct second or third readings of a bylaw. The Comox Valley Regional District (CVRD) has agreed to fund a feasibility study for business licensing of short-term vacation rentals (STVR)s on Hornby; however, the study may not take place and its outcome is uncertain. Business Licensing would be in addition to relevant ADOPTED Hornby Island ADOPTED 3 Local Trust Committee Minutes April 26, 2024 zoning permissions or Temporary Use Permits; they cannot override existing OCP and LUB land use permissions. TUPs, as a means of permitting STVRs, can be capped through the LTC declining to consider new applications. Draft Official Community Plan (OCP) and Land Use Bylaw (LUB) should be received by the LTC from staff this summer, followed by further public input. Chair Peterson further clarified that Special Meetings of the LTC, in contrast to regular LTC meetings, are called for topic specific reasons; so, agenda items such as delegations and public comments are excluded. Members of the public asked or spoke on the following: Speaking for 51 long-term residents on Hornby Island who co-signed a recent letter to the LTC expressing support for the LTC supporting the Advisory Planning Commission recommendations of March 2022 for TUPs and other measures to regulate tourism. Hornby has had the most lenient regulations on STVRs in the entire Trust Area. STVR operators have been very vocal but do not speak for all Hornby residents. Community values other than profit need to be upheld. Is anyone aware of a draft Project Charter dated January 2017 regarding home shares on Hornby Island? o The Chair acknowledged severe audio issues with the internet connection of the member of the public. o A trustee noted that a plug in or attachment to the computer may be causing the crackling audio issue. o A trustee invited the member of the public to contact trustees directly. Speaking as a member of the board of the Hornby Island Short Terms Rentals Association, (HISTRA) supports the intent and direction of the proposed new Project Charter, but requests that the phrase “prohibiting vacation rentals as an outright permitted use in residential zones” be rewritten with a more positive tone. Also, can the application and approval of TUPs be added to the timeline of the Project Charter? Also, can staff provide clarity on the upcoming June 2024 meeting at which the first draft bylaws are slated to be reviewed? Also, can the LTC provide a definition of short-term as “less than 30 days” so that workforce housing on Hornby is not jeopardized by the provincial definition of less than 90 days being applied by default? The clarification on RWMs was welcome given that it had created some consternation. Also, how many are on the APC and how are they selected because we need a variety of views so that the whole island is served? Also, I support HISTRA. o The Chair responded that members were appointed by the LTC after a call for expressions of interest. o A planner responded that there were six APC members currently. 5. DELEGATIONS ADOPTED Hornby Island ADOPTED 4 Local Trust Committee Minutes April 26, 2024 5.1 Hornby Island Community Economic Enhancement Corporation regarding Worker Housing Crown Land Application Ross Birchall, Managing Partner of Wellesley Consulting Group (WCG) headquartered in Victoria, provided the following update on various housing initiatives of the Hornby Island Community Economic Enhancement Corporation (HICEEC). 1. Rural Economic Diversification Infrastructure Program (REDIP) Grant Application Update The REDIP application was successful and HICEEC was recently granted $100,000.00 for project costs, such as feasibility studies and business planning, for safe affordable housing on Hornby. Thank you to the Local Trust Committee (LTC) for their letter of support, to Islands Trust staff, and to others who contributed to this successful outcome. 2. BC Builds Program Update BC Builds is a new housing program delivered by BC Housing to speed the development of new homes for middle-income working people in BC including in rural communities. Lisa Helps, the Executive Lead for BC Builds Project Origination, is working with HICEEC toward Hornby Island being a Partner Community; and exploring funding and investment opportunities. 3. Crown Land Use Application Update WCG is advising the HICEEC board on the preparation of a formal Crown land use application to the provincial government and is seeking help from the LTC for an amendment to Land Use Bylaw (LUB) 150 Public Use (PU) (a) section to allow for additional permitted uses so that housing might be permitted on this Crown land in the future. o Planner Cox asked if the request to the LTC was to sponsor a rezoning application. o Ross Birchall responded that the intent was for the language in the bylaw to be less restrictive for a possible future housing application. o The Chair requested further clarification from WCG on the specifics of the rezoning request. HICEEC is also exploring possibilities for private landowner and developer options for affordable housing. Acknowledgement of the commitment of various Hornby organizations to the establishment of local affordable housing. Trustees asked or noted the following: Is the HICEEC proposal going to be fraught with the same sort of continual delays and cost increases as Beulah Creek? Ross Birchall responded that the federal and provincial political momentum for housing has shifted towards housing; but that the increased funding ADOPTED Hornby Island ADOPTED 5 Local Trust Committee Minutes April 26, 2024 mechanisms available must be accessed through the heavy lifting and collaborating of local community groups. There is trustee support for this housing initiative, and there seems to be Advisory planning Commission (APC) support. Chair Peterson thanked Ross Birchall for his presentation and acknowledged the progress made. 6. BUSINESS ARISING FROM MINUTES 7.1 Follow-up Action List Report dated April 19, 2024 Received for information. 7.2 A1 Zone Agri-Tourism Accommodation Use - Staff Verbal Update Planner Cox noted the following regarding A1 zone agri-tourism accommodation: The newly formed Hornby Island Agricultural Association (HIAA) previously requested that such accommodations be allowed. Bylaw Enforcement has advised staff that such accommodation use is not currently permitted. The Local Trust Committee (LTC) could initiate a minor project to review this issue. The LTC could consider a broader view of agricultural regulation such as the Denman Island Farm Plan, which is a major project spanning several years. The LTC could include this issue in the current Official Community Plan (OCP)/Land Use Bylaw (LUB) Review Project in the same way that backyard chickens and cistern issues have been included. Consideration of limiting the number or type of agri-tourism accommodation units adds further complexity. Currently, 10 units are permitted. The LTC could direct non-enforcement of the use through standing resolution. ADOPTED Hornby Island ADOPTED 6 Local Trust Committee Minutes April 26, 2024 HO-LTC-2024-007 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee refer accommodation use in all agricultural zones and further agricultural tourism regulations to the Advisory Planning Commission. CARRIED 7.3 Childcare Budget at Local Trust Committee Meetings - Staff Verbal Update Planner Cox noted that recent discussion with the Regional Planning Manager clarified that childcare at Local Trust Committee meetings is a matter for the Trust Council Executive Committee given current lack of policy direction, and the issues of insurance and selection of childcare providers. Trustees discussed that an informal survey to gauge potential interest and numbers would be helpful going forward. 7.4 Advisory Planning Commission Member Terms and Appointments - Staff Verbal Update Planner Cox noted that the current Advisory Planning Commission (APC) term was ending on May 6, 2024 and that the planning team assistant would be sending notes out thanking members for their service and asking if they would like to serve another term, as well as canvassing the community for other expressions of interest; and that up to seven (7) APC members could be appointed for a two (2) year term. Trustees considered that APC continuity was important for the current ongoing projects; and that a mix of new and current members would be welcome. Planner Zupanec confirmed that APC members could serve a second term for reasons of continuity. 8. APPLICATIONS AND REFERRALS 8.1 HO-DP-2023.2 (Ford's Cove) - Staff Report Planner Cox presented the staff report that recommends that trustees approve the Ford’s Cove development permit for renovations to the rooves and exterior cladding of six (6) guest cabins and a washroom at the site, with no additions to the footprints of the existing buildings. HO-LTC-2024-008 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee approve issuance of HO-DP-2023.2. CARRIED ADOPTED Hornby Island ADOPTED 7 Local Trust Committee Minutes April 26, 2024 8.2 Rogers Cell Tower - Staff Verbal Update Planner Cox updated trustees with the following information regarding the Rogers cell tower proposal: Staff met recently with representatives from Innovation Science and Economic Development Canada (ISED), and a representative from Provincial Crown Lands, which clarified that the Rogers proposal was unusual in involving three levels of jurisdiction; and that the Province has ultimate land use authority over the Crown land, but that they generally do not go against local government zoning regulations. The role of ISED is to manage the process. The LTC should expect a referral from Crown Lands by summer, at which time the LTC could concur or not concur; and the LTC could provide further comment on the referral through the Chair. Staff is expecting further public feedback from Rogers. o A trustee asked if ISED could overrule the Province for national security purposes. o Planner Cox responded no, that ISED was more an intermediary to intervene on impasses of the public engagement process. o A trustee asked how Rogers’ application might conflict with the upcoming Crown land application from the Hornby Island Community Economic Enhancement Corporation (HICEEC). o Planner Cox responded that both Crown land reviews would be technical analyses based on current permitted land uses in the bylaw and that the HICEEC request involves a land use bylaw amendment and may or may not also involve an Official Community Plan (OCP) bylaw amendment. o Karen Ross explained that the HICEEC request was hoping for a bylaw change but that a resolution by the LTC of their strong intention to endorse the Crown land housing use proposal of HICEEC would be welcome. o Trustees noted their previous strong support for the HICEEC Crown land housing proposal. Planner Cox advised that Crown land referral deadlines can be last minute or up to thirty (30) days, though staff can request extensions. By general consent the meeting was recessed at 1:29 pm and reconvened at 2:00 pm. 9. LOCAL TRUST COMMITTEE PROJECTS 9.1 Minor Project: Heritage Register - Staff Report Planner Cox presented the staff report on the Heritage Register that recommends that trustees endorse a revised Project Charter that removes the First Nations engagement portion because First Nations engagement over the next year is already built into the Official Community Plan/ Land Use Bylaw Review Major Project. ADOPTED Hornby Island ADOPTED 8 Local Trust Committee Minutes April 26, 2024 HO-LTC-2024-009 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee endorse the revised Community Heritage Register Project Charter version 2.0, dated April 26, 2024, reflecting a revised work program, timeline, and budget. CARRIED 9.2 Major Project: Hornby Island Official Community Plan and Land Use Bylaw Review - Staff Report Planner Zupanec presented the staff report that recommends that trustees endorse the revised Official Community Plan (OCP)/Land Use Bylaw (LUB) Review Project Charter 2.3; and, that trustees schedule a special meeting in July 2024 to consider draft OCP and LUB bylaw amendments regarding housing and vacation rental regulations. Trustees discussed Advisory Planning Commission (APC) Recommendations and the extent of their inclusion in the current Project Charter. o Planner Zupanec advised that the in-scope column of the current Project Charter contains the APC recommendations that have been previously formally endorsed by trustees; and acknowledged that some recommendations may have been missed; and that the scope of the Project Charter could be expanded or contracted at a future time. o Planner Zupanec advised that it would be presumptuous of the local trust committee to consider future Temporary Use Permit applications before a bylaw is adopted, which conceivably may be no sooner than spring 2025, and may be much later because ministerial approval may take up to a year. o First Nations responses to the initial draft OCP/LUB bylaws would necessitate a new round of amendment discussions. Chair Peterson noted that members of the public had noted a lack of clarity in the Hornby definition of short term, regarding vacation rentals. HO-LTC-2024-010 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee endorse the revised Project Charter v. 2.3, dated April 26, 2024 to reflect the revised in-scope topics, timeline, deliverables and budget of the Official Community Plan and Land Use Bylaw Review project. CARRIED HO-LTC-2024-011 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to schedule a special meeting in July 2024 for the Local Trust Committee to review and consider the draft ADOPTED Hornby Island ADOPTED 9 Local Trust Committee Minutes April 26, 2024 Official Community Plan and Land Use Bylaw amendments pertaining to housing and vacation rental regulations CARRIED HO-LTC-2024-012 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to reach out to the present Advisory Planning Commission members to see if they are interested in staying on; and to publicize to potential new members, interest in the Advisory Planning Commission. CARRIED HO-LTC-2024-013 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee schedule a Special Meeting in May to discuss future usage of the parcel of Crown Land in the Public Use Zone, given the new information received that the land use authority is under three jurisdictions, in order to 1. Respond in a timely manner when we receive referral from the province on the Rogers Cell Tower proposal, 2. Respond to the Hornby Island Community Economic Enhancement Corporation (HICEEC) and the local Housing Society's request to amend the bylaws governing the Public Use Zone given for much needed affordable housing based on the needs of the community, and 3. HO-LTC-2024-014 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee in conjunction with the Denman Island Local Trust Committee invite the Minister of Transportation to discuss ongoing issues of cross-island ferry traffic and road conditions on Denman and Hornby Islands.
