[0:02:31] Trustee Bernardo (probable): work here and be here in this place, which is rich with cultural history.

[0:02:37] Trustee Bernardo (probable): There's stories and things to learn about places and the people that have been here since the big time in Memorial and encourage everybody to take that opportunity to learn about that and particularly learn about some of the significant difficulties that have been

[0:02:56] Trustee Bernardo (probable): that nations have had to live under through colonialism and the Islands Trust is committed to working hard come to understand that and account for that in our work and

[0:03:05] Trustee Bernardo (probable): and through the process, which is commonly called reconciliation. So enjoy the opportunity to be

[0:04:51] Trustee Stamford: so I'm not going to go into the gory details

[0:04:54] Trustee Stamford: of all the things that i've been attending but um i enjoyed our trust council meeting um

[0:05:01] Trustee Stamford: the weekend of march or the week of march 12th in nanaimo um we passed our budget it was it was a

[0:05:09] Trustee Stamford: good meeting um i felt like we um did well i think through those few days um i attended the

[0:05:19] Trustee Stamford: the House Uncommuted Forum on April 12th.

[0:05:21] Trustee Stamford: A lot of that has to do with marine.

[0:05:24] Trustee Stamford: It's quite a lot of dense information that we receive

[0:05:28] Trustee Stamford: at the House Uncommuted Forum.

[0:05:30] Trustee Stamford: We also said goodbye to two MLAs

[0:05:32] Trustee Stamford: who are no longer running again.

[0:05:35] Trustee Stamford: MLA Jordan Sturdy for Sea to Sky,

[0:05:39] Trustee Stamford: and then also MLA Nicholas Simons for the,

[0:05:43] Trustee Stamford: our area, which is Sunshine Coast.

[0:05:46] Trustee Stamford: coast

[0:05:47] Trustee Stamford: I also that same day I attended uh the association of Vancouver Island community

[0:05:56] Trustee Stamford: and coastal community uh association and I was there with chair Luckham um I was there as a

[0:06:05] Trustee Stamford: member of the Sunshine Coast Regional District but I did speak to a motion that is it does have

[0:06:14] Trustee Stamford: an effect on islands and that was a request to the provincial government that they provide

[0:06:20] Trustee Stamford: financial and strategic support for um important dock structures up and down the coast that are

[0:06:28] Trustee Stamford: being threatened by lack of funding and administrative support so um that was something

[0:06:36] Trustee Stamford: i did as part of the island's trust as well i guess um uh one of the things we've been doing

[0:06:42] Trustee Stamford: over the last few months on the community in the community the gambier island community

[0:06:46] Trustee Stamford: has been working with the rural economic development initiative project

[0:06:52] Trustee Stamford: and i worked with the planners from ubc who came to the island for a day with the community

[0:07:00] Trustee Stamford: we had a great um few hours of working with um the the planners and their students so

[0:07:07] Trustee Stamford: So they're really not only are they knowledgeable, but they're really excited about the direction they're going.

[0:07:13] Trustee Stamford: And you can see this whole generation of new planners coming up and the opportunities they see.

[0:07:20] Trustee Stamford: It was a fascinating process.

[0:07:22] Trustee Stamford: But I've also been editing their information, the reports that they're being collating for the community.

[0:07:32] Trustee Stamford: they're not out yet but as soon as that report is available for the public um i can talk to the

[0:07:38] Trustee Stamford: planners about incorporating that information into how we can use it at the islands trust as well

[0:07:44] Trustee Stamford: so a benefit both ways um uh i think i'm going to leave it at that for my trustee report

[0:08:14] Trustee Bernardo (probable): Trust Council on Salt Spring Island in June. There's lots of work ongoing on policy and

[0:08:19] Trustee Bernardo (probable): governance. And I also attended the ABICC in Victoria, and there was lots of really great

[0:08:26] Trustee Bernardo (probable): sessions associated with good governance, civility within our communities and within our boards.

[0:08:35] Trustee Bernardo (probable): And there'll be a report that actually comes out from those that have been engaged in that

[0:08:41] Trustee Bernardo (probable): activity. And I don't know, Kate, if you've been invited to submit something to that reporting.

[0:08:47] Trustee Bernardo (probable): Toby Elliott, the Vice Chair, is coordinating that for us. And any input you have to add to

[0:08:53] Trustee Bernardo (probable): so that would be very kindly received.

[0:09:03] Trustee Stamford: I had spoken to him about it.

[0:09:23] Trustee Stamford: pattern that is developing um uh speaking to the docs at avicc uh i also have had the opportunity

[0:09:33] Trustee Stamford: to meet with the president of bc ferries nicholas jiminez spoke to him about new brighton doc and

[0:09:41] Trustee Stamford: the issues that the long-term issues we're experiencing with that um also had an opportunity

[0:09:47] Trustee Stamford: to meet with minister cullen um again regarding new brighton dock and also he was in conjunction

[0:09:53] Trustee Stamford: with water supply issues that we're having on the sunshine coast and uh met with minister

[0:10:01] Trustee Stamford: minister of state dan coulter for um transportation infrastructure uh again about

[0:10:08] Trustee Stamford: roads but not so much on the islands but again about the dock so you can see there

[0:10:13] Trustee Stamford: i'm working on the dock quite a bit um uh what else wednesday um oh on wednesday i'll be

[0:10:24] Trustee Stamford: participating in a community meeting about um hopkins landing which is a dock that's on the

[0:10:32] Trustee Stamford: mainland but islanders use quite a bit it's currently closed and we're looking at a way to

[0:10:38] Trustee Stamford: to renovate it and renew it

[0:10:42] Trustee Stamford: because it needs a lot of work on it.

[0:10:45] Trustee Stamford: So I think I'll just leave it at that.

[0:10:47] Trustee Stamford: You can see where my work has been

[0:10:50] Trustee Stamford: and where my focus has been

[0:10:51] Trustee Stamford: in terms of island interest.

[0:10:54] Trustee Stamford: It's definitely around the docks and infrastructure.

[0:12:09] Voice 7: Just one piece of information, and then one thing I'd like to

[0:12:13] Voice 7: comment on in terms of the

[0:12:17] Voice 7: agenda. First, I thought you might be interested to know that

[0:12:20] Voice 7: because it is an Islands Trust Conservancy property

[0:12:25] Voice 7: that the work continues on the Sandy Beach Nature Reserve, and we had

[0:12:29] Voice 7: a very good work party last Saturday in the rain

[0:12:32] Voice 7: with over a dozen people there cleaning up what we found was a very large garbage pile

[0:12:39] Voice 7: and on the nature reserve and also cleaning out invasives and creating a new trail so that's

[0:12:45] Voice 7: that seems to be that's the Keats Island Conservation Society that's working on

[0:12:49] Voice 7: on this on the Isles Trust Conservancy Nature Reserve so that's just a piece of information

[0:12:56] Voice 7: and I want to just comment on the as I have done a number of times on the Keats Island foreshore

[0:13:04] Voice 7: project and I want to simply say this I want to thank you all for all the work on that project

[0:13:13] Voice 7: and particularly the staff I have read the staff report and I want to just urge you to please send

[0:13:20] Voice 7: send this to public hearing. Well, the historical background of the project is interesting and it

[0:13:34] Voice 7: is not complete. The project's been going on for about six years. It started in the last year of

[0:13:42] Voice 7: of my first term, which would have been about 2017

[0:13:46] Voice 7: or early 2018.

[0:13:48] Voice 7: It has probably had more community consultation

[0:13:52] Voice 7: than any application or project that I can remember

[0:13:57] Voice 7: in my eight years as a trustee and as a vice chair

[0:14:00] Voice 7: with the Islands Trust.

[0:14:03] Voice 7: I appreciate there are a couple of issues still outstanding

[0:14:06] Voice 7: and I support the staff report

[0:14:08] Voice 7: and the recommendations there,

[0:14:10] Voice 7: But please, I urge you to get this project to the finish line, at least the public hearing stage, to that stage, to make any final decisions or decisions related to this.

[0:14:23] Voice 7: To be frank, my sense is that as this project, while it felt like it was cutting edge or leading edge six years ago when we started it, I'm quite aware that, for example, on the Sunshine Coast and other jurisdictions, the proposals and the amendments and the work being done on foreshore work is actually becoming more passing what the work is and being proposed in these bylaws.

[0:16:02] Voice 3: area trust regarding bylaw changes or um process changes related to up in renewal of tenure on

[0:16:11] Voice 3: water lots and we do own our parcel land upland of our marina which is our outstation so that's

[0:16:22] Voice 3: really why I'm here I'm viewing some of the documentation in the package related to the

[0:16:30] Voice 3: consultation with the Squamish First Nation and the draft how sound biosphere dock management plan

[0:16:39] Voice 3: so I'm just that's really our interest in just keeping tabs with what you guys are working on

[0:18:34] Trustee Stamford: minutes is something that is deliberate or is just growing out of the discussions and work that

[0:18:42] Trustee Bernardo (probable): I don't have any way to comment on that, it took a more recent set of meeting minutes.

[0:18:55] Trustee Bernardo (probable): It's always good to be conscious of where the fine line is between enough information

[0:19:01] Trustee Stamford: there's a few things I just kind of had to rethink about, but nothing that I want

[0:19:07] Trustee Stamford: But I've just noticed they're growing in detail and that sometimes we suddenly abruptly switch back to a very bare bones minutes in order to present a more objective presentation of our meetings.

[0:23:55] Planner Zupanec (probable): as well as some potential looking forward into the fall and winter and identifying how you would

[0:24:02] Planner Zupanec (probable): like to engage with the chief and council for Squamish nation to identify reporting back in

[0:24:09] Planner Zupanec (probable): terms of implementation because there there is a strong interest on the nation's part

[0:24:12] Planner Zupanec (probable): to be apprised of how you will be deciding to implement these recommendations in this project

[0:24:19] Planner Zupanec (probable): or in any other projects related to your Gambier Local Trust area, which encompasses all the

[0:24:26] Planner Zupanec (probable): islands. So with that, I think I'll just verbally summarize the nation's perspective, the staff's

[0:24:34] Planner Zupanec (probable): perspective at the nation on the engagement so far. Before I dive in, that wasn't available to

[0:24:39] Planner Zupanec (probable): us until friday it was just emailed to me so i'll just give you a brief summary of what was

[0:24:46] Planner Zupanec (probable): sent to us um from the nation's staff on so this is just i'm just reading it straight out of the

[0:24:54] Planner Zupanec (probable): email on the referral team's behalf we'd like to state that the gambier island official community

[0:24:59] Planner Zupanec (probable): plan engagement process has been very thorough transparent and communicative there was time

[0:25:05] Planner Zupanec (probable): time spent with individual teams to understand Squamish Nation's concerns with regards to impacts

[0:25:10] Planner Zupanec (probable): and their feedback was registered appropriately. The process was very open and understanding of

[0:25:16] Planner Zupanec (probable): the Nation's processes and comments and we are interested to see how our feedback is incorporated

[0:25:21] Planner Zupanec (probable): into your final strategy and official community plan. Please keep us informed with updates

[0:25:26] Planner Zupanec (probable): as the project stages ahead and advise us that the Nation's input is required in further steps.

[0:25:32] Planner Zupanec (probable): so that's just to give you a sense of how your endorsement of this engagement landed with the

[0:25:41] Planner Zupanec (probable): staff so there are other opportunities to collaborate with them I understand from other

[0:25:47] Planner Zupanec (probable): correspondence with them that they are formalizing their processes with local governments for these

[0:25:52] Planner Zupanec (probable): types of projects whether or not that was a initiative that was parallel to what we were

[0:25:58] Planner Zupanec (probable): doing or whether it's this project has actually helped them formalize that for the next opportunity

[0:26:04] Planner Zupanec (probable): when they're working with local governments i'm not sure but either way i think there is ample

[0:26:10] Planner Zupanec (probable): room to to work more collaboratively together on related projects are there any questions about

[0:27:00] Trustee Stamford: Yeah, in addition to that, I just want to note that at the Houson Community Forum, I met with both the staff manager of the rights and titles, as well as one of the councillors.

[0:27:13] Trustee Stamford: They both took the time to come and talk to me about how appreciative they are of the process to date and the excellent work that Alamstra staff have done just reaching out and the way it's being done.

[0:27:27] Trustee Stamford: So I hope we can keep following through with that, because just a general sense of this process, it's ongoing. This isn't just a one-off. I see this happening throughout all the work we do now, is this style of response and level of work. So thank you. It was noticed.

[0:28:33] Planner Zupanec (probable): with this project the project charter is a tool that's critical in terms of the local trust

[0:28:39] Planner Zupanec (probable): committee's stated intent for the objectives of this project what's in scope what's out of scope

[0:28:44] Planner Zupanec (probable): scope, how long it takes, where the budget's coming from. This is like the recipe for staff

[0:28:49] Planner Zupanec (probable): to follow in fine detail. So it needs to be updated. There are suggested annotations in

[0:28:56] Planner Zupanec (probable): the agenda package from staff identified in the track changes and in the comments

[0:29:00] Planner Zupanec (probable): for the local trust committee to consider today. It's very important that I have

[0:29:04] Planner Zupanec (probable): a sense of what direction this project is going in order to implement next steps. So we'll start

[0:29:40] Planner Zupanec (probable): As you know, there are no major project funds associated with this any longer, so we do need to focus on the bylaw drafting and any other activities as part of this project or research, the funds would need to be secured.

[0:30:00] Planner Zupanec (probable): from a minor project budget. So we're suggesting that once your Keech Shoreline Protection Project

[0:30:05] Planner Zupanec (probable): is completed, you will be able to qualify to access additional minor project funds,

[0:30:09] Planner Zupanec (probable): but not until that public hearing is concluded, which is the bulk of the expense for a minor

[0:30:16] Planner Zupanec (probable): project. So let me just point out a few pieces. It's pretty self-explanatory in terms of the

[0:30:28] Planner Zupanec (probable): changes so maybe it's more important to um open the floor to any questions that you have about

[0:30:34] Planner Zupanec (probable): the first page of the project charter which is really the stated purpose objectives

[0:30:40] Planner Zupanec (probable): deliverables before we look into at the work plan right

[0:30:56] Trustee Bernardo (probable): I have one comment on this first page, but before I make the comment about an editing suggestion, it comes from a larger issue I have or question or perspective, which is there's a lot in these recommendations.

[0:31:15] Trustee Bernardo (probable): I mean, that's reflective of just the sheer amount of effort that was put into it between our staff and Squamish Nation.

[0:31:24] Trustee Bernardo (probable): There's just a lot there.

[0:31:25] Trustee Bernardo (probable): there and um uh i see us needing to do a lot of work to understand what these recommendations are

[0:31:35] Trustee Bernardo (probable): some are transparently obvious and straightforward but some of the high priority ones are not in my

[0:31:42] Trustee Bernardo (probable): view particularly um well they are so large in scope it's hard for i don't really understand

[0:31:51] Trustee Bernardo (probable): understand what is meant by them completely i i see the direction and i don't disagree with the

[0:31:58] Trustee Bernardo (probable): direction of most of them uh but i don't have a grasp of what the practical significance of most

[0:32:06] Trustee Bernardo (probable): of them of most of the the high priority months would be and somewhere in there in the um in the

[0:32:15] Trustee Bernardo (probable): staff's recommendations among the six recommendations there's some language in there

[0:32:19] Trustee Bernardo (probable): about authorizing staff to start preparing draft implementation language and reflective of what

[0:32:27] Trustee Bernardo (probable): I'm trying to say here is I think it's premature to start drafting language before you really

[0:32:31] Trustee Bernardo (probable): understand the full scope of what some of these recommendations are all about and how far we want

[0:32:39] Trustee Bernardo (probable): to go and so staying and we can get into that in more detail later but that that's that general

[0:32:46] Trustee Bernardo (probable): general perspective is going to color all of my comments here really um and i'm unconscious

[0:32:54] Trustee Bernardo (probable): that you know it's likely to fulfill people's expectations of me as a foot dragger about these

[0:33:02] Trustee Bernardo (probable): things but i do want to sort of proceed in a deliberative fashion and when i look at the

[0:33:08] Trustee Bernardo (probable): project charter here where the changes language and policies that reflect first nations perspectives

[0:33:13] Trustee Bernardo (probable): perspectives uh i don't think it's incumbent on i don't think it's appropriate i mean it's

[0:33:20] Trustee Bernardo (probable): it's necessary for us to understand first nations perspectives but we don't we have to deliberate on

[0:33:26] Trustee Bernardo (probable): we can't just simply hop into saying okay we're going to change everything to reflect them

[0:33:31] Trustee Bernardo (probable): i think we need language and policies are responsive to first nations perspectives

[0:33:38] Trustee Bernardo (probable): but that's not the same as reflecting uh if you understand what i'm getting at here

[0:33:43] Trustee Bernardo (probable): So I've taken up a lot of airtime here, but I want us to be a bit more cautious, I'm afraid, about how we proceed with this so that we work out how far we want to go with some of these recommendations,

[0:33:57] Trustee Bernardo (probable): whether we really are prepared to endorse them as is or whether we need to work through them or whether, in fact, we need more information.

[0:34:07] Trustee Bernardo (probable): I'll leave it at that for now.

[0:34:10] Planner Zupanec (probable): through the chair, if I can respond to that, then that first bullet of the in scope could quite simply be amended to say language and policies that respond to the First Nations engagement summary recommendations or something along those lines.

[0:34:34] Planner Zupanec (probable): amendment that you're considering, because we can't contemplate that at the beginning

[0:34:38] Planner Zupanec (probable): of a project, but we do need to categorize in general terms that you do have a commitment

[0:34:43] Planner Zupanec (probable): to incorporate language and policies and regulations that respond to this engagement summary that

[0:34:50] Planner Zupanec (probable): you've requested be completed otherwise what's the point of having done that work i appreciate that

[0:34:57] Trustee Bernardo (probable): and uh something i should have said before that um are responsive and respectful of first nations

[0:35:03] Trustee Bernardo (probable): perspectives um but you know i won't repeat what i said before right i want to we need to deliberate

[0:35:11] Trustee Bernardo (probable): on these things and i think if we have a language change along those lines that that would be

[0:35:15] Trustee Bernardo (probable): appropriate and helpful so thank you for that sonia

[0:35:38] Trustee Stamford: the project charter without getting into the detail of what is outlined in the response from

[0:35:46] Trustee Stamford: Squamish Nation. This does fit with how we've viewed this project so far. I see that this works

[0:35:58] Trustee Stamford: with what we're looking at with the further document, but I agree there's a lot of detail

[0:36:04] Trustee Stamford: that we really don't know what the consequences or the, not consequences, but the overall scope

[0:36:12] Trustee Stamford: of what is being asked in the First Nations response.

[0:36:18] Trustee Stamford: And I think some of it is related

[0:36:21] Trustee Stamford: to the official community plan,

[0:36:22] Trustee Stamford: but others are simply actions within the community.

[0:36:26] Trustee Stamford: And so I'd like to parse those out

[0:36:29] Trustee Stamford: and then work with a priority list from there.

[0:36:34] Trustee Stamford: I didn't really see anything that was so far out

[0:36:37] Trustee Stamford: of what I expected and that it doesn't completely

[0:36:40] Trustee Stamford: go against the direction the community plan is going in.

[0:36:45] Trustee Stamford: I am more concerned about the operational side of this,

[0:36:50] Trustee Stamford: that how much engagement,

[0:36:53] Trustee Stamford: this is stretched over such a long time already

[0:36:58] Trustee Stamford: that much of the engagement that occurred,

[0:37:01] Trustee Stamford: excuse me, just like,

[0:37:06] Trustee Stamford: much of the engagement that occurred before,

[0:37:09] Trustee Stamford: for I think isn't as front and center

[0:37:13] Trustee Stamford: for the community as it could be.

[0:37:16] Trustee Stamford: There are, we've looked here just like one community event

[0:37:23] Trustee Stamford: before putting out the first draft

[0:37:26] Trustee Stamford: and I don't think it's enough.

[0:37:29] Trustee Stamford: And I am concerned that we say,

[0:37:31] Trustee Stamford: well, we don't have any funds associated with this yet.

[0:37:36] Trustee Stamford: That's more problematic

[0:37:38] Trustee Stamford: and that's where my concern is and I'm not sure how to get this to a point where it gets the

[0:37:44] Trustee Stamford: attention it needs in terms of funding and staff support. I wasn't aware there was not going to be

[0:37:51] Trustee Stamford: any funding for it and that's my fault of being clear on that when we looked at the budget but I

[0:37:57] Trustee Stamford: thought that this was going to be funded for several years and didn't think to look at

[0:38:06] Trustee Stamford: minor or major project funding for it. So that's sort of where I'm coming through on it. I do want

[0:38:13] Trustee Stamford: to see some potential wording because right now I don't even know how this wording would be

[0:38:19] Trustee Stamford: reflected. So I can't even think about what interpretations and things like that until I

[0:38:26] Trustee Stamford: see some wording. So that's sort of where I'm at right now.

[0:39:40] Trustee Stamford: community input included where appropriate into our ocp deliberations i think it's all helpful

[0:39:48] Trustee Stamford: and they had an opportunity to provide more engagement and input that frankly the community

[0:39:56] Trustee Stamford: understood a bit more than what we were able to provide during COVID because that was a very

[0:40:01] Trustee Stamford: stretched out process in the previous term so um does that make sense yeah

[0:40:13] Trustee Bernardo (probable): um i i just wanted i also wanted to ask trustee stanford a point of clarification because

[0:41:02] Trustee Stamford: gambier island um we had we had brought in consultants to do a survey as well as a community

[0:41:10] Trustee Stamford: information meeting uh it was during covid um it was limited in inability to

[0:41:19] Trustee Stamford: really engage with enough of the community that there was some pushback um it was just

[0:41:27] Trustee Stamford: where we were at at the time unfortunately um and it's not that the information's stale

[0:41:34] Trustee Stamford: but I don't get the sense from community members that they really felt that they were heard.

[0:41:42] Trustee Stamford: And I think given that we've had other opportunities to look at similar surveys,

[0:41:50] Trustee Stamford: similar engagement processes that weren't defined as public government is constrained to,

[0:41:59] Trustee Stamford: um there has been more opportunity to get feedback and i want to keep encouraging them

[0:42:05] Trustee Stamford: um i think we're in a better space now so i think it'll be good to move forward on this

[0:42:13] Trustee Stamford: uh but have more engagement moving forward and it's just the idea of just having one in-person

[0:42:20] Trustee Stamford: meeting is not going to be enough so that's sort of where i was coming from on that

[0:42:24] Trustee Stamford: And

[0:42:25] Trustee Bernardo (probable): is the further engagement, is that something you would like to see happening before there's a first draft, a first reading, or in conjunction with it?

[0:43:33] Trustee Bernardo (probable): be provided before the formality of the first meeting, some kind of draft, I think that would

[0:46:01] Planner Zupanec (probable): beyond um so that's also the intent of this project i just want to confirm that the local

[0:47:47] Planner Zupanec (probable): And of course, that's not closing the door on further public comment, but you do need to have a starting point. [1:11:49] Planner Zupanec (probable): What I'm understanding is that all the local governments and levels of government within their territory to please cooperate by ensuring that they receive these referrals, not because they're suddenly going to be vetoing the local government's approval processes,

[1:12:18] Planner Zupanec (probable): territory unless we cooperate with them and those referrals are key in order to build their data

[1:12:30] Planner Zupanec (probable): rights and title permitting processes to ensure that the applicants understand that they're very

[1:12:48] Planner Zupanec (probable): vetted by the local government, in this case, your staff who are doing the referrals and preparing

[1:13:39] Planner Zupanec (probable): standardized for the nations to participate in this because there are impacts associated with

[1:36:06] Trustee Stamford: this is where the Squamish nation are this is how it all compiles together does this roughly

[1:36:13] Trustee Stamford: move us in the direction that you would like to see our OCP so it's not a question of going back

[1:36:26] Trustee Stamford: that reviews everything to date I think the only thing that's missing

[1:36:34] Trustee Stamford: would be the addition of the work that's been done over the past year

[1:36:41] Trustee Stamford: The Reddit report is definitely much more focused on very specific,

[1:36:46] Trustee Stamford: almost service specifics, for instance, towards better transport access,

[1:37:00] Trustee Stamford: but there may be elements in it that support um the ocp in a more precise way so i just if we

[1:43:34] Planner McCargar: through a number of edits and ltc discussion that happened primarily in the fall of 2023

[1:43:40] Planner McCargar: Since late November 2023, the project has been put on hold to focus on another LTC priority, which was the Keats Island Marine General Zone Amendment Project, which has now been wrapped up.

[1:43:51] Planner McCargar: And therefore, staff are bringing back the proposed bylaws forward for LTC endorsement and hopefully second reading.

[1:43:59] Planner McCargar: Staff are recommending that the LTC review proposed bylaw number 154 as shown in attachment 2 and endorse the final changes for second reading as amended.

[1:44:11] Planner McCargar: And then also staff are recommending that the bylaw obtain a legal review and proceed to public hearing in the summer of 2024.

[1:44:19] Planner McCargar: So there were two remaining issues that I've highlighted in the report that the LTC had tabled for further discussion back in November.

[1:44:28] Planner McCargar: and those were dock materials the guideline around dock materials and then the second was

[1:44:36] Planner McCargar: adding an exemption for additions in the development permit area particularly for

[1:44:41] Planner McCargar: additions in the seven and a half to 15 meter dpa area so if the ltc could make a decision

[1:44:48] Planner McCargar: regarding these two items tonight that would be really helpful to move this project along

[1:44:54] Planner McCargar: long. The next steps, I did provide a timeline there. The next steps, if the LTC concurs with

[1:45:01] Planner McCargar: staff recommendations, the staff will obtain a legal review and subsequently schedule a public

[1:45:08] Planner McCargar: hearing for the summer of 2024. If there's preference to something on Keats or in person

[1:45:17] Planner McCargar: or electronic, we can also discuss that as well. But for now, I think turning our mind to

[1:45:24] Planner McCargar: to the proposed bylaw and all the changes that have been reflected there.

[1:49:04] Trustee Bernardo (probable): And so to the extent that there's already some building has some portion or a portion of the building is already within the DPA, an alteration there is no different than, in my view, it's no different than the exemption we've already agreed to for repairs within it.

[1:55:30] Trustee Bernardo (probable): We could obviously rescind second reading and then make those amendments and then re-endorse second reading and continue with a planned date for, let's say, a month, like the end of July or May, June, whatever it happens to be, July, say, end of July, that we'd still be able to meet that objective.

[1:55:49] Trustee Bernardo (probable): And we'd have that sort of, I like the analogy of the train, except my view is a little different, is that we're going to figure out where the stations are that we're going to stop on the journey. And so, Planner McCartney, is that a possibility? And then I'd look to the trustees to see if that seems like a reasonable middle ground to provide the opportunity to have a discussion on our May 28th meeting.

Communities convention and, as a representative of the Sunshine Coast Regional 
District, spoke to a motion requesting the provincial government to provide 
financial and strategic support for important dock structures in coastal waters; and

  Chair Luckham reported the following: 
 He is preparing for the June, 2024 Trust Council meeting being held on Salt Spring 
Island; and 
 He attended the Association of Vancouver Island and Coastal Communities 
convention held in Victoria.  
3.3 Electoral Area Director's Report 
Electoral Area Director Stamford highlighted the following: 
 She attended the Association of Vancouver Island and Coastal Communities 
convention and spoke about the importance of maintaining important dock 
structures; 
 She met with the President of BC Ferries and spoke with him about the long-term 
issues associated with the New Brighton dock; 
 She met with Minister Cullen and spoke with him about the New Brighton dock and 
the Sunshine Coast water supply issues; 
 She met with Transportation and Infrastructure Minister Coulter about roads and  
the New Brighton dock; and 
 She will be participating in an upcoming community meeting about the Hopkins 
Landing dock, which is currently closed, and in need of renovation. 
4. DELEGATIONS - none 
5. PUBLIC COMMENTS 
A member of the public stated that there had been a work party held at the Keats Island Sandy 
Beach Nature Reserve during which garbage and invasive plants were removed and a new trail 
was created. He also noted that the Keats Island Foreshore Project had been worked on for a 
number of years, and he urged the Local Trust Committee to come to a completion on this 
project, or at minimum move it to the public hearing stage. 
 
The Outstation Director for the West Vancouver Yacht Club noted the club’s outstation is 
located in Center Bay. He indicated he is attending the Local Trust Committee meeting in order 
to familiarize himself with any bylaw, or process, changes related to tenure on water lots.

9.1 Major Project: Gambier Island Official Community Plan Review Project - Staff Report 
Planner Zupanec spoke about the Squamish Nation referral and engagement process 
and made the following comments: 
 Staff have been working for several months to engage Squamish Nation staff in the 
Intergovernmental Rights and Title department regarding the Gambier Island 
Official Community Plan and Land Use Bylaw review; 
 She thanked the Local Trust Committee for endorsing the approach to reach out to 
the Squamish Nation in order to identify and collaborate on the priories of both 
parties; and 
 She read an email, which summarized the Squamish Nation’s perspective on the 
engagement process, which stated, in part, that they are interested to see how their 
feedback will be incorporated into the final strategy and Official Community Plan. 
 
The Chair and Trustees thanked staff for the positive engagement work that staff had 
undertaken. 
Planner Zupanec reviewed the Project Charter and the suggested amendments. 
Discussion ensued and the Trustees made the following points:

 There are a number of recommendations from both staff and the Squamish Nation 
and it is important to thoroughly understand the meaning of the recommendations; 
 It is potentially premature to prepare draft bylaw language before Trustees 
understand the full scope of the recommendations; 
 There has only been one community information session and this does not seem 
sufficient; and 
 There should be further opportunities to obtain community feedback prior to the 
first reading of the bylaw; 
 
The Planner responded as follows: 
 The draft bylaws would be prepared so that the Squamish Nation could see how 
their recommendations were being implemented, for the information of the local 
community, and for the purpose of referral to the Advisory Planning Commission; 
 There has been sufficient input to date to allow staff to proceed to the draft bylaw 
stage, and 
 The Local Trust Committee can seek community engagement regarding the draft 
bylaws.

Trustee Bernardo indicated that he would like Staff to report back on the implications of 
implementing C2 as there may be large legal and socio-economic issues related to 
moving to a dual approval process, and that this needs to be discussed prior to 
implementation.  
 
The Planner replied that the recommendations are advocacy and action items that have 
been identified as high priorities through both community and Squamish Nation 
consultation.

options and implications to implement Squamish Nation Engagement Summary

schedule an elected officials meeting with Squamish Nation in the fall/winter of 2024 to 
discuss the status of the implementation of Squamish Nation engagement 
recommendations.

Planner Zupanec summarized the need for a supplemental report to address the high 
priority recommendations and to help identify a range of options through policy and 
regulations. This report would provide a template of options for discussions and 
deliberations.

report including options and implications of draft bylaw language to amend and update 
the Official Community Plan (OCP) and Land Use Bylaw (LUB) based on the general 
recommendations of the 2023 Public Engagement Summary and twenty 
recommendations from the 2024 Squamish Nation Engagement Summary (A1-A5; B1-
B9; C1, C3, C4; D1, D3, D5) identified as high priority Official Community Plan and Land 
Use Bylaw amendments.

9.2 Minor Project: Keats Shoreline Protection Project - Staff Report 
Planner McCargar summarized the staff report and indicated that there were two 
remaining issues that the Local Trust Committee has tabled for discussion including 
guidelines around dock materials and adding exemptions in the Development Permit 
Area. She stated that, if the Local Trust Committee concurs with the staff 
recommendations, then, staff will proceed with a legal review and schedule a public 
hearing. 
Trustee Bernardo stated he would like to defer this item to the next meeting as he 
would like time to read the entire report again, and to determine how much he is 
prepared to compromise in order to support the bylaw.  
Discussion ensued and alternative suggestions were made. It was determined that 
further discussion regarding this item would be deferred to the end of the meeting.

11.1 Logging in Settlement Residential Zone - Trustee Stamford Verbal Discussion 
Trustee Stamford made the following comments: 
 The Gambier Island Rural Residential zoning allows forestry while the Settlement 
zoning does not; 
 When land is cleared in the Settlement zone the logs are often sold, and this would 
appear to be a forestry activity; and 
 If logging means that you sell your logs, then, there is a potential problem occurring 
on properties zoned Settlement.

Chair Luckham reconvened the meeting on May 14, 2024 at 10:02 am. He acknowledged that 
the meeting was being held on the territory of the Coast Salish First Nations. 
16.1        Minor Project: Keats Shoreline Protection Project - Staff Report 
Chair Luckham acknowledged a memo, which outlined Trustee Bernardo’s suggested 
edits and exemptions to proposed Bylaw 154. The Planner confirmed that the memo 
had been received and that it was posted on the website.  
The Planner stated that the final bylaw language would be submitted for legal review 
prior to adoption.  
Minor edits for clarity and consistency were suggested and accepted. 
Discussion ensued regarding dock materials and Trustees made the following 
comments: 
 Docks cannot be built with biodegradable materials; 
 The term ‘water quality’ should be replaced with ‘marine ecosystem’; 
 There is a preference that unenclosed plastic foam not be used; and 
 There is agreement that creosote pilings should not be used.

Discussion ensued regarding construction and alterations within the Development 
Permit Area (DPA). 
 
Trustee Bernardo noted the following: 
 The scope of the DPA requirements in section 9.3.1 of the bylaw has the effect of 
limiting property owners’ enjoyment of their property and limits the work they can 
do on it; 
 The setback from the foreshore has been 7.5 metres and is now being proposed as a 
15 metre setback; 
 There are many properties that already have structures close to the water that will 
now be within the boundaries of the DP and the property owners will now be 
required to get a development permit to do any work on structures or land 
alterations; 
 The bylaw is going to cover activities over areas that residents have used for 
decades; 
 Protecting the undisturbed ecosystem is important but there should not be 
unnecessary interference with existing property owners to use their property as 
they wish;  
 It is reasonable to allow residents to make alterations to their land within the same 
footprint; 
 Home owners should not be restricted when doing minor alterations when they are 
substituting one use of developed land for another use; and 
 The residents of Keats Island have a history of stewardship and not reckless 
development. 
 
Trustee Stamford noted the following: 
 There is an extensive list of exemptions already included in the proposed bylaw; 
 She recognizes that these areas are within the foreshore and, even though they 
have already been disturbed, they might still be considered ecosystems; 
 There may be construction options that are reasonable and others that may disturb 
the ecosystem whereby a development permit might be required; 
 Improvements within the same foot print are acceptable but adding a building 
within the foreshore area where there was not one before is development; 
 While the bylaw might affect existing property owners it serves as a mitigation tool 
for developers and new owners; and 
 She is not inclined to include the additional exemptions as proposed

Discussion ensued regarding additions within the Development Permit Area (DPA). 
Trustee Bernardo said that his suggested language regarding additions would allow 
homeowners to make a small addition to the home provided the conditions he listed 
apply.

Trustee Stamford noted the following: 
 It is due diligence to require notification for any kind of development; 
 There are potential underground archeological considerations; and 
 If someone wants to expand the footprint of a building, there should be an extra 
layer of supervision. 
 
The Trustees acknowledged that there has been positive discussion and debate 
throughout the process of amending the bylaw and it is important to get second reading 
of the bylaw in order to schedule a Public Hearing. Trustee Bernardo indicated that he 
would like to communicate to the community members his position on the outstanding 
issue of allowing additions within the development permit area.

That the Gambier Island Local Trust Committee Bylaw No. 154 cited as “Keats Island 
Land Use Bylaw, 2002, Amendment No. 1, 2021” as shown in Attachment 2 of the staff 
report dated April 29, 2024, be amended as follows: 
a) 9.3 DP-3 SHORELINE. .2 Exemptions the following be added after item (a):  
Alterations of previously disturbed land and to pre-existing buildings, structures and 
utilities located between 7.5 meters and 15 meters from the natural boundary of 
the sea, provided always that the alteration: 
 takes place entirely within the perimeter of previously disturbed land or within 
the footprint of a pre-existing building, structure, or utility; 
 does not alter, disturb or otherwise harm previously undisturbed land or native 
vegetation anywhere within DP3; and 
 does not result in environmental degradation of any kind anywhere within DP3 
or to the ecology of the foreshore. 
b) 9.3 DP-3 SHORELINE. .3 General Guidelines, item “h” the words “water quality” be 
replaced with “the marine ecosystem”. 
c) 9.3 DP-3 SHORELINE. .4 Guidelines - Construction and Replacement of Docks and 
Ramps, item “f” be replaced in its entirety with, “Docks should be constructed of 
stable materials that do not have the potential to degrade the marine ecosystem or 
the ecology of the foreshore over time.” 
d) 9.3 DP-3 SHORELINE. .5 Guidelines – Shoreline Modifications, item “c” subsection 
“iv” the words “water quality” be replaced with “the marine ecosystem”. 
e) 9.3 DP-3 SHORELINE. .5 Guidelines – Shoreline Modifications, item “f” subsection 
“iv” should be deleted in its entirety.
