[0:00:37] Voice 8: for the South Pender Island LTC. I apologize for being digitally today. I was transportation
[0:00:46] Voice 8: thwarted but my heart is with you and I'm very grateful to the local trustees for setting things
[0:00:53] Voice 8: So that we could still hold our meeting. This has been converted to a webinar to allow those who want to participate online to be able to do so. And that's because of the DIP challenge, making it maybe difficult for those who live in the North End to be able to get there.
[0:01:15] Voice 8: so i'll just start as always um the land acknowledgement and this area as we know
[0:01:22] Voice 8: sadeas uh now known as south pender island has been home to the wasanich peoples who are central
[0:01:29] Voice 8: coast salish peoples and sinchothin speaking people since time immemorial and they've been
[0:01:36] Voice 8: stewarding and caring for these lands and waters and uh and have a deep and abiding relationship
[0:01:42] Voice 8: to them. And we want to respectfully conduct our work in all that we do with regard for that
[0:01:51] Voice 8: relationship. So we recognize not only is this their traditional territory, but this is an
[0:01:57] Voice 8: ongoing relationship for the Wissanich and Sinchaltan speaking people to these lands and
[0:02:03] Voice 8: waters. And so with that, I'll open the meeting and call the meeting to order. And I'll ask for
[0:02:11] Voice 8: the approval of the agenda, is there anything to be added or amended in our agenda today?

[0:02:35] Voice 11: I can. I don't really have a report. Just a couple of questions or things I want to
[0:02:42] Voice 11: um spring to our attention is um the uh the this is further on the agenda but um just want to make
[0:02:52] Voice 11: sure that the comment letters are included um in the summaries that we talk about today not just
[0:02:58] Voice 11: the meetings and not just the meeting minutes but anyway we'll cover that later on i think

[0:03:06] Voice 11: as well. And also just, I noted on our website that the summary of our meetings that Christina

[0:03:23] Voice 11: of my spreadsheet summary. So you have to, maybe that can be corrected. I don't know,

[0:03:45] Voice 11: that's kind of all i wanted to say except i'm thankful that we've come this far in the process
[0:03:50] Voice 11: and i think we've done well so far and i hope that we can continue with our deliberations in
[0:03:56] Voice 11: a respectful way that we have had and experienced so far and i'm feeling optimistic that we're
[0:04:01] Voice 11: making headway and that we're going to end up with a better product you know better outcome
[0:04:06] Voice 11: outcome than we have currently which is kind of yeah people on all sides of it kind of thing so
[0:04:13] Voice 11: i think we're going to be more cohesive at the end of this so not not necessarily this meeting
[0:04:17] Voice 11: but the process of the minor project that's it for me thank
[0:04:22] Trustee Evans: you um okay for me i apologize to
[0:04:26] Trustee Evans: everyone i've been trying to get um my articles into the pender post every month and i missed
[0:04:31] Trustee Evans: the deadline last last time um so i'm currently working on my next kind of post article so that'll
[0:04:37] Trustee Evans: cover the last two months um so as a brief update on that we've had a number of the cao higher end
[0:04:47] Trustee Evans: committee meetings and um we're currently in negotiations so once that's finalized there
[0:04:54] Trustee Evans: will be a public announcement um with a financial committee i think so progressing along there
[0:05:02] Trustee Evans: starting the process again. Trust programs, we dealt with the secretariat fund. So those
[0:05:14] Trustee Evans: organizations that had applied for secretariat funding got their allocations sorted out.
[0:05:24] Trustee Evans: I'm trying to think what other things I've been doing. Anything that I've missed will be in my
[0:05:32] Trustee Evans: my kind of post article. So that's about it.
[0:05:39] Voice 8: Thank you, trustees. I'll provide a few remarks
[0:05:43] Voice 8: for my chair's update. Just following along what you said, Trustee Evans, about the CAO
[0:05:50] Voice 8: hiring committee, just to clarify that we're finalizing a contract with the search firm,
[0:05:58] Voice 8: not with a candidate. I think you sort of said we're in the process, so we're not yet close.
[0:06:05] Voice 8: finding a candidate yet so there's a little ways out and uh some more process uh for that piece
[0:06:10] Voice 8: um i attended the association of vancouver island coastal communities
[0:06:16] Voice 8: um convention earlier in april and that is one of the hub um area association
[0:06:24] Voice 8: conventions that leads up to ubcm so it's a lot of uh networking and information sharing sessions
[0:06:35] Voice 8: specific for coastal communities but not just gulf not just islands the two seminars that i
[0:06:41] Voice 8: attended and i'm i'll be sharing um that in written form well all of the trustees who went
[0:06:48] Voice 8: were collating our notes and there'll be a written report in the upcoming agenda for trust council
[0:06:54] Voice 8: but i just wanted to say that there's some really cool work being done by the pacific salmon
[0:07:00] Voice 8: Foundation working with the UBC's Strait of Georgia Data Center. And it's around collecting
[0:07:07] Voice 8: and visualizing near shore and marine data. And they're creating this amazing marine reference
[0:07:15] Voice 8: guide that's really going to support mapping and showing the extent of coastal modification
[0:07:22] Voice 8: across the east coast of Vancouver Island and the southern Gulf Islands, actually all the Gulf
[0:07:28] Voice 8: islands um so something i learned is that they are um doing a lot of citizen and community
[0:07:35] Voice 8: workshops uh for instance shoreline mapping workshops for citizens uh they take people
[0:07:42] Voice 8: regular folks and not just planners through the green shores accreditation it's a free course
[0:07:48] Voice 8: learning how to address, you know, storm surges and everything through green, ecologically based methods rather than hard armoring, which is illegal in the foreshore.
[0:08:05] Voice 8: and they're also doing a lot of mapping all along the coast for where are the um the hard
[0:08:13] Voice 8: armory where is the armoring happening and how is that affecting salmon habitat and and everything
[0:08:19] Voice 8: else so that was really cool um if you check out the marine reference guide and that is available
[0:08:25] Voice 8: to be used by planners and i think in a limited way members of the public so so things like that
[0:08:31] Voice 8: presented at the Association of Vancouver Island Coastal Communities, really key to be there and
[0:08:36] Voice 8: learn what are the advances being made in other sectors, not just that local governments can then
[0:08:42] Voice 8: jump in with. So Regional Planning Committee, not much to report there. But the other item of
[0:08:52] Voice 8: of interest would be the MOTI Islands Trust and CRD meeting that happened, I think, last week.
[0:09:00] Voice 8: I wasn't there in person, but I got to listen in. And so this was really focused on the Ministry
[0:09:06] Voice 8: of Transportation. It was their invitation, hosted at the CRD offices, to really develop
[0:09:13] Voice 8: some relationship and regular communication on transportation issues in the Southern Gulf Island.
[0:09:19] Voice 8: And so there was talk of revamping a multi-joint task force, which would probably be involving staff, and focused on, you know, what are the critical areas that we want to address ahead of time, safe boat access, road shoulders, parking for ferries, ferries themselves.
[0:09:43] Voice 8: And so really working on collaboratively addressing stuff before it becomes a hot topic. So that was really helpful. And I think we're going to have hopefully more meetings in each area. So the South might have a focus group and the Central and then the North, because that's how MOTI splits their work.
[0:10:05] Voice 8: And there was also a collaboration meeting on marine issues in the CRD, which I missed because I had another meeting, but I'm looking forward to that. Anchorages are something that we are all going to need to address in the Southern and Northern Gulf Islands.
[0:10:23] Voice 8: so looking forward to see what partnerships and collaborative approaches we can develop
[0:10:31] Voice 8: and i think that's about it for my chair's update can
[0:10:38] Trustee Evans: i just add one quick thing that i forgot
[0:10:40] Trustee Evans: for sure um so i i was talking to one of the dynamite construction uh people and i've asked
[0:10:47] Trustee Evans: them to text me if the dip is going to be open within the 10 to 2 and then i'll post it on the
[0:10:55] Trustee Evans: forum so if i get those texts i will as soon as practicable get it get it on the on the forum

[0:11:15] Voice 8: no no okay so we don't have an electoral area director report i haven't seen anything by email
[0:11:22] Voice 8: uh paul brent is always busy so hopefully he's advocating for something great for our communities
[0:11:30] Voice 8: So with that, we'll move into town hall and questions. As always, I just want to remind the public that this is a business or a place of work. And so we ask that you abide by all the workplace policies of keeping your tone and your comments respectful, direct your questions to trustees.

[0:12:01] Voice 8: personalities so prefer that you not go back and forth with people in the room and just expressing
[0:12:08] Voice 8: your own personal point of view would be preferred but any information you want to give us the floor

[0:12:18] Voice 4: John, I just have three questions. The first one is
[0:12:23] Voice 4: relative to emergency preparedness week. The cold snap that we had earlier in the year caused the die-off of a lot of well-established
[0:12:35] Voice 4: plant material and the gorse along the road allowance, there's a lot of dead gorse now and it's highly flammable and I'm
[0:12:46] Voice 4: wondering if, I know that every year they do a bit of a trim, but I'm wondering if
[0:12:52] Voice 4: there is a plan this year to deal with that aspect because it is there's a lot of fire level
[0:12:59] Voice 4: so that's my first first can
[0:13:03] Trustee Evans: i can we maybe address them on it sure okay thank you
[0:13:06] Trustee Evans: so for
[0:13:07] Trustee Evans: the first one that is outside of the jurisdiction of your trustees that would be a multi-issue
[0:13:11] Trustee Evans: because they're the ones that are looking after the road now there is groom bashing going on at
[0:13:16] Trustee Evans: the moment but that's transporting it across the island i don't recommend transporting gorse
[0:13:22] Trustee Evans: across the island because that obviously increases spread you can talk to the fire department and get
[0:13:31] Trustee Evans: a burn permit if you want to do small burns of the gorse of the items that are dead we can also
[0:13:37] Trustee Evans: privately organize something that we can do ourselves but as far as trustees go that is
[0:13:45] Trustee Evans: not a trustee issue that is a community thing that we can we can organize and i was thinking
[0:13:51] Trustee Evans: on the same lines anyways we can have a chat after tonight so
[0:13:54] Voice 4: it's uh i was wondering if it wasn't i
[0:13:57] Voice 4: know they do a maintenance thing but about plants it's quite often late in the summer yeah okay and
[0:14:07] Trustee Evans: the other people that you can talk to which i do recommend this will be the conservancy
[0:14:12] Trustee Evans: okay so they might
[0:14:13] Trustee Evans: have something organized
[0:14:14] Voice 8: trustees could you repeat what the the speaker
[0:14:19] Voice 8: said in a very short way because we are having trouble hearing so
[0:14:23] Trustee Evans: the question was uh because
[0:14:24] Voice 8: we
[0:14:25] Trustee Evans: had a cold snap earlier this year it caused a lot of the gorse to die it's highly flammable
[0:14:31] Trustee Evans: and he was wondering if we can uh like resolve that with the annual clearing of the ditches that
[0:14:38] Trustee Evans: happen but
[0:14:39] Trustee Evans: that's outside of our jurisdiction because that's a mighty issue that's a road
[0:14:43] Trustee Evans: maintenance so that is not something that we deal with but we're saying that as a community we can
[0:14:48] Trustee Evans: coordinate a private community event or coordinate with the conservancy but sitting up here as
[0:14:54] Trustee Evans: trustees. That is not land use planning per se. That's sort of more land maintenance and
[0:15:00] Trustee Evans: conservation.
[0:15:02] Voice 11: Can I suggest here, maybe the speakers, as you speak, would you be willing
[0:15:09] Voice 11: to walk up here and stand here? Because
[0:15:11] Voice 11: then the microphone will pick it up and then it'll be

[0:15:36] Voice 4: I haven't seen a big abundance of debris, but it's something that I'm sure that if you look behind the logs, there's probably styrofoam.
[0:15:45] Voice 4: So I was wondering about that.
[0:15:47] Voice 4: There's been any talk of it.
[0:15:48] Trustee Evans: same thing that is a community driven event not necessarily trustees that's private so yes i did
[0:15:54] Trustee Evans: privately organize that last year um and earth day i think was april 20 22nd this year so that
[0:16:02] Trustee Evans: that that is the organized event for beach cleaning that anyone can
[0:16:06] Voice 11: join both vendors
[0:16:09] Trustee Evans: it's all gulf islands oh
[0:16:11] Voice 11: it's all gulf yeah okay all
[0:16:13] Trustee Evans: right so um if if we want to again that's
[0:16:16] Trustee Evans: something that can be organized privately and it doesn't have to be done by us it can be done by
[0:16:20] Trustee Evans: anyone in the community um if you and the only reason why i wasn't able to do it this year
[0:16:24] Trustee Evans: i've been extremely busy with the number of committees that i'm on so it's just been
[0:16:30] Trustee Evans: overloading for me and i haven't had um but
[0:16:34] Voice 11: yeah the conservancy is very involved or yeah they're
[0:16:38] Voice 11: definitely involved
[0:16:38] Voice 4: so they are the coordinators for it so yeah

[0:16:42] Voice 4: my third one and this could be
[0:16:44] Voice 4: quite controversial. I'm wondering if there would be support for lobbying highways to
[0:16:58] Voice 4: reduce the posted speed from Hakes to Gowland. And the reason I raise that is that I see
[0:17:05] Voice 4: a lot of people leaving the beach at Gowland and stepping on the gas to go down and there's
[0:17:10] Voice 4: so many people walking around and dogs and everything else it seems like it's a really bad
[0:17:14] Voice 4: yes so i can
[0:17:17] Trustee Evans: answer that to where sorry i
[0:17:18] Trustee Evans: take pigs
[0:17:19] Voice 4: down to gallon i
[0:17:20] Trustee Evans: can answer that i've been
[0:17:22] Trustee Evans: working on that for the past year maybe two years again it's an issue it's not a trustee issue
[0:17:28] Trustee Evans: um there are a number of road roadblocks in the way i've been speaking to somebody at mochi it's
[0:17:36] Trustee Evans: It's not necessarily a multi-issue.
[0:17:37] Trustee Evans: It's normally a municipality issue
[0:17:39] Trustee Evans: because we're not a municipality.
[0:17:40] Trustee Evans: We don't have the authority.
[0:17:42] Trustee Evans: So it's very circular.
[0:17:43] Trustee Evans: And the consensus is reducing the speed limit
[0:17:46] Trustee Evans: is not going to cause people to reduce their speed.
[0:17:49] Trustee Evans: So I have been working on having,
[0:17:52] Trustee Evans: you know how you have the suggested speed
[0:17:54] Trustee Evans: along with share the road signs,
[0:17:57] Trustee Evans: share the road with pedestrians and cyclists
[0:17:59] Trustee Evans: and having those posted throughout PENDA,
[0:18:03] Trustee Evans: not just that point
[0:18:05] Trustee Evans: so that people are aware so that's something i've been working on i haven't made much headway
[0:18:10] Trustee Evans: again that's something that i do when i can as i can and yeah again you're more than welcome to

[0:18:18] Voice 4: they're thinking that even if you put up a sign that says 30k or 25k that people aren't

[0:18:23] Trustee Evans: it they're not respecting the 50 they're not going to respect the 30 in fact
[0:18:27] Trustee Evans: fact the studies show that when you do that a lot of people will see more so um speaking with
[0:18:37] Trustee Evans: modi they're like we we don't want to do that this is a rural island and it's you drive for
[0:18:42] Trustee Evans: the conditions of the road so there's there's actually a lot of other things behind it so
[0:18:46] Trustee Evans: let's take this conversation offline because this is not a trustee related issue they're happy to
[0:18:50] Trustee Evans: talk with anyone that wants to know about it after that's

[0:19:48] Voice 13: um a couple things i was looking at the summary of the bylaw 142 where we're at
[0:19:58] Voice 13: what might be referred to the HCC, etc. So just looking at that. And you probably be covering this
[0:20:05] Voice 13: in your discussion. But because this is our only chance to talk, I'm just going to throw it out
[0:20:09] Voice 13: there just in case you want. So one of the first things I saw in there was definition of floor
[0:20:15] Voice 13: area, and it says no change. And from the discussions I've heard so far, and some of the
[0:20:20] Voice 13: things that have come up. That definition includes things like a garage so I would think that
[0:20:25] Voice 13: definition is likely going to change if we consider garages more often part of the floor area.
[0:20:31] Voice 13: Also things like the height of because that's also included in the floor area so I just it just says
[0:20:38] Voice 13: no change at this point so I just did I wanted to alert and I don't know if you're thinking about
[0:20:42] Voice 13: that or not so that's one of the things and a couple of other things that the summary does it's
[0:20:48] Voice 13: It does talk about referring the house size and setbacks to the APC on there,
[0:20:57] Voice 13: but the one thing that doesn't seem clear on there,
[0:21:00] Voice 13: maybe it's just at the start of what's going on.
[0:21:03] Voice 13: Things like that were discussed that could be options that may relate to house size
[0:21:08] Voice 13: or things like where does the suggestion about adding secondary suites come in
[0:21:14] Voice 13: because that does affect house size or could affect house size.
[0:21:18] Voice 13: also there was talk about provisions and maybe there was a consideration for
[0:21:23] Voice 13: adding the cottage size where a cottage is permitted to the dwelling size and could that
[0:21:29] Voice 13: so where I just don't know if those things would fit in in a discussion with the AGC and also
[0:21:35] Voice 13: things like the footprint rather than dwelling size where before we used to consider the
[0:21:41] Voice 13: equipment of a building versus the way we have the
[0:21:45] Voice 13: definition. So I'm just mentioning those because I
[0:21:49] Voice 1: didn't
[0:21:49] Voice 13: know how this would play out in terms of what
[0:21:51] Voice 13: eventually gets through to the APC and all the
[0:21:54] Voice 13: suggestions and comments that have been made of how
[0:21:57] Voice 13: they would fit into what's how the summary goes to
[0:22:00] Voice 13: the APC. That's it.
[0:22:02] Trustee Evans: I think I think the point that we're going to be
[0:22:04] Trustee Evans: trying to do during that conversation is to have a
[0:22:07] Trustee Evans: conversation around what's going to go to the APC and
[0:22:09] Trustee Evans: how it's going to go to the APC. So and there will
[0:22:11] Trustee Evans: be a town hall at the end of the meeting as well so we'd only like to have one in the beginning and
[0:22:15] Trustee Evans: at the end now so that that is a change that that we brought in um
[0:22:21] Voice 13: go ahead all right so heather
[0:22:23] Voice 13: i just have one comment about the um report to the trustees um and i just want to make sure that you
[0:22:35] Voice 13: you are aware, and you must be, that almost two paragraphs were devoted, out of three,
[0:22:42] Voice 13: and the bottom one being very short, talking about what was said at the workshops.
[0:22:49] Voice 13: There's very little said about anybody wanting to have a little bit of an increase in health
[0:22:55] Voice 13: size, or very little at all about anything other than what some people wanted, which
[0:23:01] Voice 13: probably is taking up too much of the field.
[0:23:08] Voice 13: Anyway, if they read it.
[0:23:11] Voice 13: Thank you.

[0:23:31] One is I want to thank the staff for updating the staff report on legally
[0:23:38] Voice 5: conforming.
[0:23:40] Voice 5: And my reading of that is that there's just a few minor changes that I guess clarify what that means.
[0:23:51] Voice 5: But the bottom line, as I understand it, is that all properties as of September 15, 2022, are now legally conforming, those that were legal prior to that date.
[0:24:06] Voice 5: So that for house size and setbacks, that the legally nonconforming issue has been resolved.
[0:24:13] Voice 5: So I'd like some confirmation if staff are available at today's meeting that that's the case.
[0:24:18] Voice 5: But the second thing is, and I guess what I'll do is just thank Trustee Falk for confirming that there will be a change to include the correspondence in the referral to the ABC.
[0:24:33] Voice 5: There was no reference in the staff report to the 50 letters that have come in so far.

[0:39:24] Voice 11: makes it formal and so it's a very encouraging trend that's happening at
[0:39:29] Voice 11: Trust Council level and at some point I'm going to be exploring whether or not
[0:39:35] Voice 11: we can use that committee of the whole feature of our meetings at our local
[0:39:43] Voice 11: trust committee meetings because it might be useful for us as well but I

[0:47:56] Voice 6: Yeah, essentially there's limited industrial land on Maine like there is on most islands and to try and accommodate small scale contractors, it's an amendment to their home occupation or home business regulations so that contractors can have vehicles and equipment and so on stored on their property under certain conditions and with certain regulations.

[0:48:31] Voice 6: Yeah, a few other changes, sort of technical amendments or really minor amendments to the bylaw that have been noted over the past couple of years.
[0:48:42] Voice 6: There were a few temporary use permits that had been issued that are being incorporated into the land use bylaw as permanent uses.
[0:48:49] Voice 6: As they go through the temporary use process, three years renewed in some instances with no issues, so they are being incorporated into the Land Use By-law as outright permitted permanent potential uses.

[0:49:14] Voice 6: um oh some amendment an amendment they have a single a single lot in a zone that was uh zoned

[0:52:56] Voice 2: is to provide a summary of the community input to date and also to provide a recommendation to
[0:53:05] Voice 2: send a referral to the south pender island planning advisory committee also known as the apc
[0:53:13] Voice 2: so in the staff report i did go over the summaries of the trustee-led workshops and highlighted some
[0:53:22] Voice 2: of the discussions and comments in addition to that i also provided a bit of a summary
[0:53:28] Voice 2: from the community information meetings that were held in april the minutes for the community
[0:53:34] Voice 2: information meetings um are posted on the ltc website as well as the or as part of me the
[0:53:43] Voice 2: trustee-led workshops the summaries from the trustees that attended those workshops are also
[0:53:51] Voice 2: posted to the website. Based on the information that staff have reviewed, staff put together
[0:54:00] Voice 2: a chart and summarized each amendment in bylaw number 122 and made comments or recommendations
[0:54:11] Voice 2: if that amendment should be potentially retained, removed, amended, or where further discussion is
[0:54:20] Voice 2: is required. I do want to mention that for the items that where staff have identified where
[0:54:28] Voice 2: further information is required are really the three main topics that we've been discussing for
[0:54:34] Voice 2: quite some time and what we hear from the community to date. Those three comments or pardon me topics
[0:54:39] Voice 2: are the setback from the natural boundary of the sea, the total floor area and maximum floor area
[0:54:48] Voice 2: for dwellings in addition to the interior side lot line setbacks for dwellings and cottages in
[0:54:56] Voice 2: the rural residential zone. So as stated in the project charter and the timeline it states that
[0:55:08] Voice 2: an APC referral should be going out during the summer months and then a review of the APC
[0:55:16] Voice 2: comments and further direction from the ltc is required for the september ltc agenda so in this
[0:55:24] Voice 2: staff report i've put together some recommendations for a referral to the south pender apc
[0:55:33] Voice 2: highlighting or hoping that the apc will discuss those three major topics the setback from the
[0:55:41] Voice 2: natural boundary of the sea the total flare floor area and maximum floor area for dwellings as well
[0:55:47] Voice 2: as the setbacks from the interior lot line I've included some information that will be forwarded
[0:55:54] Voice 2: to the APC and you can see those in the staff report I have made note that about the correspondence
[0:56:01] Voice 2: that has been received to date yes so all correspondence is posted to the project webpage
[0:56:07] Voice 2: page and that web page that link will actually be forwarded to the apc so if the apc wishes
[0:56:14] Voice 2: they have that opportunity to review all the correspondence to date
[0:56:20] Voice 2: as trustee evans had mentioned this is a referral sent to an apc and the apc provides
[0:56:28] Voice 2: their recommendations back to the ltc the ltc is the decision-making authority
[0:56:38] Voice 2: I will also include in that document,
[0:56:40] Voice 2: the frequently asked questions document
[0:56:43] Voice 2: that we put together.
[0:56:44] Voice 2: I really appreciate there was a few community members
[0:56:48] Voice 2: that pointed out errors in that first draft.

[0:56:55] Voice 2: is currently on the webpage.

[0:57:06] Voice 2: The recommendation that staff is putting forth to the LTC based on the timeline in the project charter is a referral to the South Pender APC regarding the minor land use bylaw amendment project to specifically comment on those three major topics that require further discussion, which I've outlined in the staff report.
[0:57:30] Voice 2: So there is a draft motion on page 19 of the staff report, and there also are alternatives that the LTC may consider, and those start on page 23 of the agenda.

[0:59:31] Trustee Evans: And in your comments, it says, dependent on the decision of Section 2.10, the LTC recommends to retain regulation or amend the maximum floor area and total area, then staff recommends to retain this regulation.
[0:59:45] Trustee Evans: Part of the discussion, again, I need my notes, part of the discussion within this total floor area was house height and whether or not the garage was going to be included or excluded.
[0:59:57] Trustee Evans: So if that can be added there as well as.
[1:00:00] Trustee Evans: part of the discussion that would be great and the other thing i was going to ask we've had a
[1:00:06] Trustee Evans: number of ideas blow out of the community but i don't see a table of the ideas is it is part of
[1:00:14] Trustee Evans: the package to the apc just going to be the ideas like the new ideas so we already like if we exclude
[1:00:22] Trustee Evans: stay where we are and flip it back if those two things are excluded and we just look at the new
[1:00:27] Trustee Evans: new ideas. Can we get a table of new ideas to help simplify how the APC is looking at these,
[1:00:36] Trustee Evans: so that it's ideas that have come from the community, just have those in a table to
[1:00:43] Trustee Evans: consider, rather than having to go through, I think somebody said there's over 50 letters,
[1:00:49] Trustee Evans: that's going to be an awful lot to sift through, and then them to start making that table. So is
[1:00:57] Trustee Evans: Is it possible to do that?
[1:00:58] Trustee Evans: And I'm referring this over to Kim, because I know

[1:01:27] Voice 2: And going through, planning staff could go through all the comments and pull out new ideas, but that's also very subjective, hard to determine which is a new idea, which is an idea that's been discussed for the last three, four or five years.

[1:01:45] Voice 2: begs the question of exactly what information we want to send to the APC and what you want to hear back.
[1:01:53] Voice 2: It sounds as though you'd like the APT to review all these new ideas and provide comments on them.
[1:02:01] Trustee Evans: What I'm trying to get at is like the photos that I took of the flip charts of the ideas that were there.
[1:02:10] Trustee Evans: Those were the new ideas that came out of those meetings.
[1:02:13] Trustee Evans: So that's fairly straightforward.
[1:02:15] Trustee Evans: Those were new ideas from those workshops.
[1:02:18] Trustee Evans: And I think there's been a couple of other ideas that have come in correspondence.
[1:02:22] Trustee Evans: So it's really just the topic. It's not so much, this is what one person said about this idea, this is what another person said about this idea. The idea is maybe we exclude garages. Maybe we put the cottage and the house size together in certain areas.
[1:02:40] Trustee Evans: maybe we look at sub zones for setbacks it's just having having a list of topics
[1:02:48] Trustee Evans: um and then allowing it for discussion i
[1:02:56] Voice 2: did put together um the document which is found on the
[1:03:01] Voice 2: trustees corner um from your discussion on february 10th of all the new ideas so i could
[1:03:08] Voice 2: provide the APC with that and if there's any additional ones the trustees believe I should
[1:03:15] Voice 2: include I can certainly do that as well that might be the best way.
[1:03:18] Trustee Evans: Okay so then Doug and I can go
[1:03:20] Trustee Evans: away and we can just come up with a list of all the ideas that came out of those meetings and we
[1:03:28] Trustee Evans: can go through the correspondence ourselves and pull out the ideas the APC will still have full
[1:03:33] Trustee Evans: access to all the correspondence and I know that they're going to be thorough and go through them
[1:03:37] Trustee Evans: all as well but then at least there is and that's really yeah

[1:05:32] Voice 11: an accurate recorder of any kind but my spreadsheet which is kind of my serves as my summary of my
[1:05:39] Voice 11: meetings but it also includes all the written comments to uh pretty much to date and my my
[1:05:47] Voice 11: spreadsheet has a column called proposed solutions and that's where all the ideas will be captured
[1:05:53] Voice 11: not every one of them is an idea but most of them are and so because for me myself i needed to see
[1:06:00] Voice 11: what are all the ideas what are all the problems or you know what are the
[1:06:03] Voice 11: potential problems that we want to solve and what are the ideas about how to
[1:06:07] Voice 11: solve that and so that's what I needed to see in one place so I could kind of
[1:06:12] Voice 11: go through it and so that's available and that will be referred to and again I
[1:06:17] Voice 11: wanted to point out that the location on the website of my summary is incorrect
[1:06:21] Voice 11: on on the project page it's my earliest version of it which was like a
[1:06:27] Voice 11: a screenshot of a spreadsheet with and you all know that screenshots of spreadsheets don't work
[1:06:36] Voice 11: because the text becomes like minuscule and that was an earlier version so that's not where it is
[1:06:41] Voice 11: so the real spreadsheet where you can go in and follow the lines and maneuver around it

[1:16:09] Voice 11: becomes very clear it clarifies for all of us what's got higher priority so if we do that and

[1:16:24] Voice 11: for how it could look so we for instance if we're looking at the house size or the environment

[1:57:32] Trustee Evans: head into the next section let's make sure that we're actually staying on top because the other

[1:57:44] Trustee Evans: within 14 days of our meetings, and that seems to have lapsed again. So I just want to make sure that

[1:57:59] Voice 8: ongoing government-to-government dialogue with First Nations, for instance, with the Policy

[1:58:12] Voice 8: these staff-to-staff conversations, but what I have heard in the North Office, and this may be
[1:58:21] Voice 8: something to consider for the South Office if they have capacity, is a First Nations
[1:58:27] Voice 8: sort of a report out, and actually a formal report. So, for instance, on the Gabriola Agenda,
[1:58:35] Voice 8: we have two sections we've got um earlier uh an opportunity for a first nation in our trust area
[1:58:45] Voice 8: to provide a report if they wish to of sort of their activities and what what they have been up
[1:58:53] Voice 8: to so there's a section reserved in our agenda for that and then there's a second section just like
[1:58:58] Voice 8: Like this report section here, actually 15.6 is what this actually refers to, the Reconciliation First Nation Relationship Building Report.
[1:59:08] Voice 8: So as the islands trust, our report on how is that relationship going, what activities are we undertaking?
[1:59:16] Voice 8: and just anecdotally i'll share that the north office is going to be producing a bit of a report

[1:59:28] Voice 8: north uh trust areas um it just has been sort of getting that together it hasn't i don't think

[1:59:49] Voice 8: having you know government to nation dialogue on either processes or specific projects or
[1:59:54] Voice 8: applications um there is a privilege reserved for
[2:00:00] Voice 8: um first nations to have those um not be part of a public agenda so staff would be very um they'd
[2:00:10] Voice 8: share probably broad summaries of you know we've had dialogue with this nation on sort of these
[2:00:16] Voice 8: general topics but they might not get into the nitty-gritty so it would be great if we could
[2:00:22] Voice 8: have that from the islands trust for the south um for the southern gulf islands i don't know what
[2:00:30] Voice 8: the capacity of staff is to do that but i think as our new senior indigenous relations advisor
[2:00:37] Voice 8: um becomes more active and sort of takes on his role we may see some some changes there so i'm
[2:00:45] Voice 8: hopeful that uh we'll see more of the sharing out happening because i know there is things happening
[2:00:51] Voice 8: but like i said the south pender or sadeas community has been very active with the
[2:00:57] Voice 8: leadership board and that's why i'd asked paul petrie who's um the picture is very connected to
[2:01:03] Voice 8: the there's initiatives to share on a community level what is happening so that we have that
[2:01:08] Voice 8: information so um that's why i'd asked him to share item 12.6 and prepare a bit of a

[2:07:09] Voice 5: Thank you Chair Elliott. The Community Resources Center on North Pender has co-sponsored various projects and one of the projects was called the Trepachas Revitalization Project that we completed a year ago that involves creating four videos with First Nations elders speaking about their long history on the islands and really putting into context.
[2:07:40] Voice 5: what their relationship to the islands are and I won't go into the details of that. It's very
[2:07:46] Voice 5: compelling and in some ways complex but what I will say is that we completed that project
[2:07:53] Voice 5: a year ago. The videos are out. The videos are being shown. They're owned by the percentage
[2:08:00] Voice 5: school board and they're being shown to students at the school as part of their curriculum. They're
[2:08:10] Voice 5: to report today is that that project has been identified as one of the four finalists for the
[2:08:20] Voice 5: every two years the real estate foundation of bc has land awards and so that project has been
[2:08:27] Voice 5: identified as a finalist for that so it's it's good recognition for the work of our communities
[2:08:34] Voice 5: these both North and South Pender Island that that's happening. To emphasize that is a community
[2:08:40] Voice 5: to community relationship. And that's the distinction you made, Chair Elliott, in introducing
[2:08:45] Voice 5: this issue. And I know that Trust Council itself deals more with the government to government
[2:08:50] Voice 5: relationship. And so this is really something that the local trust committee can take some
[2:08:57] Voice 5: involvement in. And the last thing to say is that we now have an application before the Real Estate
[2:09:02] Voice 5: foundation for funding for a follow-up that is emphasizing installation of First Nations
[2:09:10] Voice 5: or signage to recognize First Nations relationship the land there's a major project at the community
[2:09:18] Voice 5: hall that's proposed for North Bender in consultation with the community hall society
[2:09:24] Voice 5: Society. There's also a project with Poets Cove Resort to expand on the 13 million calendar
[2:09:35] Voice 5: installation that's down there to recognize the ancient village of Quinnen, which Poets Cove
[2:09:41] Voice 5: Resort is built on top of that location, and the reef net. So there's much happening around these
[2:09:48] Voice 5: issues. We haven't yet heard on that application, but having been recognized as a finalist for
[2:09:54] Voice 5: the land awards, I think that bodes well for approval of that funding. So things are happening

[2:10:53] Voice 8: being on health leave. Definitely, this is a helpful overview. I sit on the Conservancy
[2:11:01] Voice 8: board. So if anybody has any questions, happy to answer to the best of my ability.
[2:11:09] Voice 8: We have made one significant policy change. I'm not sure I saw it listed.
[2:11:17] Voice 8: yeah it we reported out at executive committee but um it may not have made this let me just check
[2:11:30] Voice 8: i don't want to speak out of turn i don't think it's an encamera no it's a change to policy
[2:11:34] Voice 8: um so before according to policy discussion around uh naptep covenants and
[2:11:45] Voice 8: And donations of land into nature reserves or into the conservancy did not require a consultation with First Nations.
[2:11:57] Voice 8: And this is because all of those types of discussions are typically confidential and in camera until they're disclosed.
[2:12:10] Voice 8: You know, there's lots of, you know, ownership issues to discuss.
[2:12:14] Voice 8: and a potential donor would need to agree to waive confidentiality in order to do some early
[2:12:25] Voice 8: engagement with the First Nation in whose territory that they were their land is or that
[2:12:31] Voice 8: they wanted to donate or put a NAPTEP covenant on and so it wasn't a requirement that they waive
[2:12:37] Voice 8: of confidentiality and so it's been a very recent change I think in February March this year that
[2:12:45] Voice 8: we've got a policy revision to address that and so it is now a requirement to engage with First
[2:12:53] Voice 8: Nations before considering a donation to the Conservancy so I think that's going to be quite
[2:13:03] Voice 8: significant and i'm sure everyone knows that uh by now that the minister minister of municipal
[2:13:11] Voice 8: affairs did not approve the interim three-year plan that the itc conservancy had uh had proposed
[2:13:19] Voice 8: and uh and so the work really right now is engaging with nations and what does the future
[2:13:24] Voice 8: of conservation work look like in the islands trust area and getting their input on um working
[2:13:32] Voice 8: together, management of lands, and that's basically going to be the work for the next year. I'm really
[2:13:39] Voice 8: excited about it. So some big changes. They seem small, but I think they're quite fundamental
[2:13:45] Voice 8: to how the Conservancy works. So we do have two items of new business. 16.1 is consideration of
[2:13:55] Voice 8: of the text for 2023-24 annual reports.

[2:17:01] Voice 6: currently in the official community plan.
[2:17:05] Voice 6: The second option is to consider OCP LEB amendments.

[2:17:12] Voice 6: You would review the options around vacation rentals.

[2:17:30] Voice 6: to potentially limit enforcement only to those operations with significant
[2:17:36] Voice 6: impacts for example this wouldn't legalize the vacation rentals and over
[2:17:46] Voice 6: time operators who did want to continue and become legal would have that path by
[2:17:51] Voice 6: applying for temporary use permits the recommendation mr. request staff is
[2:17:57] Voice 6: option two um request staff to report back with an enforcement policy to defer enforcement um
[2:18:04] Voice 6: until a review is completed by um the local trust committee thank

[2:19:34] Trustee Evans: are none on south currently means that all stvrs that are operating right now are illegal so my
[2:19:48] Trustee Evans: My preference would be to I want us to look into the options and to put something in place
[2:19:53] Trustee Evans: that defers any, any enforcement until we've had a chance to review this as the next project.

[2:21:19] Voice 8: are a few TUPs that were approved fairly recently that the owners are actually going to scramble
[2:21:27] Voice 8: to make the address that they were running their SDVR as their principal residence, and
[2:21:34] Voice 8: it hadn't been.
[2:21:35] Voice 8: And so I will note, just as my own, we're learning from this process, we're going to see how it rolls out. If there's a massive pushback, we do have the option to opt back out again.
[2:21:50] Voice 8: But what I think it does, and I know Trustee Yates is with me on this, that it curbs the potential of an off-island, someone purchasing a lot from off-island who isn't going to choose to live here and just wants to create a commercial rental.
[2:22:14] Voice 8: So it prevents that from happening. And so we're seeing more people choosing to live here as a result or making that their principal residency. So I know it's not really the issue here.
[2:22:27] Voice 8: year. So I would just caution the LTC maybe against committing to a future project in the
[2:22:38] Voice 8: next interim. I'm just flagging it as you may think that this is the right choice for your
[2:22:48] Voice 8: next minor project, but something else may come up as a higher priority. And then you have a
[2:22:54] Voice 8: a standing resolution on the books that yes can be rescinded at any time but in effect you're
[2:23:00] Voice 8: saying we're not going to act until we can deal with this through a project and there's no guarantee

[2:43:51] Voice 10: which are down to, in some cases, 1% of their original range. For instance, especially Gary
[2:43:59] Voice 10: Gary Oak and Arbutus, in a number of conversations I've had with a variety of islanders and off-islanders,
[2:44:08] Voice 10: North Pendrates, have expressed some alarm that we don't have any protections, for instance,
[2:44:14] Voice 10: on Arbutus and Gary Oak on the foreshore.
[2:44:17] Voice 10: I think it would be a good project to look at, not necessarily restrictive bylaws,
[2:44:25] Voice 10: but empowering more ecosystem protection, especially for those endemic
[2:44:33] Voice 11: species.
[2:44:35] Voice 11: Thank you for the clarification. Yeah, I will study up on the Declaration on Climate Change that was made, so I understand that.
[2:44:44] Voice 10: The United States has declared a climate emergency as well as the province of British Columbia, Canada and the United Nations.

[2:44:52] Trustee Evans: think there's any person that can say that there isn't yeah yeah we're not disputing

[2:45:17] Voice 11: I'll agree to that now, but I want to look at the details because there might be tweaks to like some more priority here than there.
[2:45:24] Voice 11: Like, for instance, when you talk about species extinction threats, I don't know if the overpopulation of deer on our island is included in the Declaration of Climate Change.
[2:45:40] Voice 11: I'm not sure if that's different. If it's different, I don't want to lose that as a priority to address.

[2:45:48] Trustee Evans: and again it depends on you know when we come to when we're sitting in this room looking
[2:45:53] Trustee Evans: at what are going to be the next projects so much can change between now and then so i don't want
[2:45:59] Trustee Evans: to sit here and say yes that should be our next project the same as like i think stbrs is an
[2:46:04] Trustee Evans: important thing that we need to address it's going to be dangling there um and there's we've got we've
[2:46:10] Trustee Evans: got like seven or eight future projects already sitting dangling that we have to we have to take
[2:46:16] Trustee Evans: a look at them in their entirety to figure out which one are we going to deal with next. Is it
[2:46:21] Trustee Evans: going to be one that we can handle in a swift manner that's going to have great effect, positive
[2:46:28] Trustee Evans: effect on the island or again when we get to that point.
[2:46:32] Voice 11: Yeah I don't think that you were suggesting
[2:46:33] Voice 11: that it would be a project or you were suggesting is it a lens that we would look at projects

[2:46:45] Voice 8: perspective on this um because i sit on regional planning committee and the conservancy and
[2:46:50] Voice 8: executive committee and climate change has been a discussion lately on by all three bodies so would
[2:46:56] Voice 8: it help to give a little bit of information here i
[2:47:00] Voice 11: think it would the
[2:47:01] Voice 8: questioner okay um so
[2:47:05] Voice 8: climate change is one of the top three items that um the islands trust conservancy together with the
[2:47:12] Voice 8: executive committee we're having joint meetings every three months to really start collaborating
[2:47:21] Voice 8: and figuring out a plan or an approach that we could present to both our bodies trust council
[2:47:27] Voice 8: and um the conservancy for how to address so reconciliation and working with first nations
[2:47:34] Voice 8: is another one um at our april 24th meeting so we're having more regular joint meetings just
[2:47:42] Voice 8: just one hour meeting at the end of executive committee,
[2:47:45] Voice 8: we did have a really strong discussion on climate change
[2:47:49] Voice 8: and the fact that, you know, what are we doing to address the climate crisis
[2:47:53] Voice 8: that was declared by the Islands Trust and many other local governments.
[2:47:59] Voice 8: I would say that the chair of the Conservancy, Dr. Risa Smith,
[2:48:05] Voice 8: is a climate change scientist and sits on many international
[2:48:12] Voice 8: agencies and boards and is keenly interested in this. There's a lot of money coming from the
[2:48:18] Voice 8: province and the feds for protection of biodiversity. There's a lot of granting
[2:48:23] Voice 8: opportunities. It's too big for one LTC to address. This should be a trust-wide project
[2:48:33] Voice 8: and a priority for all of the trust. So that's from the perspective of the Conservancy,
[2:48:39] Voice 8: We're very aware and sensitive to the fact that we are, you know, losing ground on red listed species, species at risk.
[2:48:48] Voice 8: But the Conservancy work has protected quite, you know, quite a lot of areas.
[2:48:53] Voice 8: But I think where we're going to have to turn our focus to next, this has been my personal take since being elected, is shorelines and shoreline protection and the marine environment.
[2:49:04] Voice 8: As the waters are warming and as storm surges are affecting the foreshore, we don't have mitigation or measures to address this. But again, it's too big for one local trust committee to address. I think this has to be a regional committee project.
[2:49:22] Voice 8: And right now we've got three priorities. One is the bylaw enforcement procedures and policies review that the ombudsperson's office recommended a bunch of changes. That's one of them. The housing strategy is an ongoing one, and I've forgotten the third.
[2:49:41] Voice 8: But it is my intention as a member of this LTC and sitting on these other bodies to actually advocate for marine shoreline, a whole raft of measures.
[2:49:58] Voice 8: We need to come up with a suite of strategies.
[2:50:01] Voice 8: Some of those are development permit areas.
[2:50:04] Voice 8: And I think it was suggested in the planners report that the setbacks from the sea consideration might be bigger than just, you know, deciding how far back to build.
[2:50:15] Voice 8: We might have to put in some DPAs to protect the foreshore and that could be a separate project.
[2:50:21] Voice 8: So I'm going to be working to see if we can address this with other interagency partners. There's a lot of money, like I said, it's applying for the right grants and having the capacity to do this in a coordinated way that's going to function for all LTCs.
[2:50:39] Voice 8: there just doesn't seem to be a clear path yet but the priority is there the conversations are
[2:50:44] Voice 8: being had and and i personally do feel a sense of urgency especially when it comes to marine
[2:50:49] Voice 8: foreshore protection so just thought i'd put that out there i
[2:50:54] Trustee Evans: was just thinking like because you
[2:50:55] Trustee Evans: were bringing up about the gary oaks and the arbutus and and the threatened tree species
[2:51:00] Trustee Evans: so that that conversation that that speech that we were listening to by jared williams
[2:51:07] Trustee Evans: was he he raised some like absolutely if you ever get to listen to him he's fantastic um
[2:51:16] Trustee Evans: but we would he was talking about like the gary oaks and how they needed like how how
[2:51:26] Trustee Evans: their previous knowledge on keeping back other species in order to allow the gary oaks to
[2:51:32] Trustee Evans: flourish so it's not just about putting the protection on the tree itself but it's about
[2:51:36] Trustee Evans: putting the protection on how to allow it to thrive and um i'd asked him in the meeting like
[2:51:46] Trustee Evans: because he'd recommended a couple of different groups to work with um and i've i spoke to paul
[2:51:52] Trustee Evans: about this as well like getting some of these groups because he's on the um pika um i think it
[2:51:57] Trustee Evans: is and like on some of these conservancy areas making sure that some of these matters that we've
[2:52:01] Trustee Evans: had that are being swallowed up by other trees are actually getting getting the protections that they
[2:52:09] Trustee Evans: need not just being left alone because they're getting swallowed out so there's there's there's
[2:52:14] Trustee Evans: maybe a little shift in how we're looking at protection because protection doesn't mean
[2:52:21] Trustee Evans: hands-off protection sometimes means looking after it in a different manner so there are groups up
[2:52:29] Trustee Evans: there and and like i said i've i've had one conversation i'm hoping to have a few more
[2:52:33] Trustee Evans: because i know that there are some areas on on south panda that you know it'd be great if we
[2:52:39] Trustee Evans: could sort of reclaim back to where they were and how they were like yeah anyway i'm going to stop
