[0:00:26] Voice 3: in locations across the territory of the Coast Salish people and we respectfully acknowledge
[0:00:32] Voice 3: that the land we gather on is the unceded territory of the Comox First Nation traditional
[0:00:39] Voice 3: keepers of this land which applies to Hornby although and also I believe somewhat to where
[0:00:45] Voice 3: where I am located today on Lasketea Island.

[0:00:52] Voice 3: I'm elected on Lasketea Island,
[0:00:54] Voice 3: and I'm the chair of the Hornby Island Local Trust Committee.

[0:01:03] Voice 3: and together we make up the Hornby Island Local Trust Committee.

[0:01:38] Voice 3: on our behalf um today's meeting is uh specifically to plan ahead um for the expected
[0:01:51] Voice 3: Rejected referral from the province, British Columbia, for Rogers Communications Tower proposal.
[0:02:00] Voice 3: We do have an agenda before us, and I'll just check with trustees to see if there's anything that you feel is missing here today.

[0:02:39] Voice 3: items in we'll start with item 3.1 which is the local Trust Committee's response
[0:02:44] Voice 3: when receiving a referral from the province of British Columbia for the
[0:02:49] Voice 3: rogers communications tower proposal um just to outline we were advised at our last regular
[0:02:56] Voice 3: meeting that uh that referral may be coming soon and that sometime the response window is um
[0:03:05] Voice 3: not necessarily uh very long and given our our meeting schedule i didn't want us to get into a
[0:03:13] Voice 3: a place where we're scrambling to try and put our minds
[0:03:17] Voice 3: to what that response might be.
[0:03:22] Voice 3: And so this is essentially pre-planning for that response.
[0:03:29] Voice 3: So to that end, I did put together a potential motion
[0:03:37] Voice 3: would be that the Hornby Local Trust Committee direct staff
[0:03:41] Voice 3: to include in any response to a referral from the province
[0:03:44] Voice 3: regarding the Rogers Tower proposal the following points ABCD and such so we can
[0:03:50] Voice 3: discuss what those points should be I think I'll open the floor just a moment
[0:03:59] Voice 3: here I'll ramble on just a slight slight a slight bit more there and just say
[0:04:07] Voice 3: that it's clear I double-checked on the maps they the the location that's
[0:04:15] Voice 3: proposed and the location that was proposed by high seek certainly look to
[0:04:23] Voice 3: be the same and so I'll just go ahead and open the floor and let's hear
[0:04:28] Voice 3: trustees for me your thoughts on what should what should be included in a
[0:04:33] Voice 3: referral response all
[0:04:38] Trustee Allen (probable): right well I kind of feel I'll tell you all this is to
[0:04:43] Trustee Allen (probable): share my kind of confusion here because we've already we have having new
[0:04:50] Trustee Allen (probable): new information regarding obviously the Crown land being looked at as housing options, but
[0:04:56] Trustee Allen (probable): that's still been sort of out there. So in terms of responding, this is where I'm confused.
[0:05:02] Trustee Allen (probable): It's like, how do we respond? Are you talking about future? We're just talking about this
[0:05:06] Trustee Allen (probable): particular application only. Is that clear? Because it's, I'm getting lots of questions
[0:05:11] Trustee Allen (probable): from the community going, sorry, I'm just going to put this up. So response from receiving
[0:05:19] Trustee Allen (probable): receiving a referral we've already had the referral so we're in the middle of this referral
[0:05:24] Trustee Allen (probable): is that correct so no we
[0:05:29] Voice 3: have not received the referral from the province yet we're we're
[0:05:35] Voice 3: planning ahead for when we receive that referral from the province and it is about the rogers um
[0:05:42] Voice 3: communications tower or proposed tower yeah that's that's the referral we're expecting from the
[0:05:48] Voice 3: the province okay
[0:05:49] Trustee Allen (probable): it's probably the wording yeah it's the wording that's getting me all right
[0:05:53] Trustee Allen (probable): so basically we're looking at you know adding i'm thinking obviously the housing i seeks looking at
[0:06:00] Trustee Allen (probable): that that's number one i mean that is actually number one is that this location is probably
[0:06:07] Trustee Allen (probable): probably the only other location we could ever have in terms of a community housing option
[0:06:14] Trustee Allen (probable): so this has to be included within that they have to know this the province that this is a
[0:06:19] Trustee Allen (probable): this is a priority of our tower community housing workforce housing okay big silence there okay do
[0:06:35] Voice 3: you have other things to add or and if not then we can we can do this iteratively we can go back
[0:06:41] Voice 3: and forth a bit but i saw trustee scott put his hand up but uh yeah

[0:06:48] Voice 3: we just start with that yes okay go ahead trustee scott well

[0:06:55] Voice 4: a lot of conversation talking to a lot of people on the island old young new um my take on it is
[0:07:04] Voice 4: that is not an appropriate location for a cell tower on Ormby Island for the following reasons
[0:07:10] Voice 4: number one it's too close to public facilities it's too close to some residences and it's too
[0:07:20] Voice 4: close to the potential housing site or public housing or whatever the right wording is for
[0:07:31] Voice 4: that. So that's my general take on it. I'm not saying no cell tower period on Runby Island.
[0:07:38] Voice 4: I'm saying not that location for the following reasons.
[0:07:45] Voice 3: Okay. Yeah, that's fair. And I think that's a reasonable approach. I'm just going to
[0:07:53] Voice 3: weigh in here um i made a couple of notes for myself um one is that we've certainly the ltc
[0:08:02] Voice 3: has certainly heard substantial community opposition to the uh to the proposal for for
[0:08:12] Voice 3: the tower um at this location um so i think that's something we can uh say um my reading of the
[0:08:24] Voice 3: zoning um and i'll look to staff for some con for confirmation on that but my reading of the zoning
[0:08:32] Voice 3: is that it contains some restrictions on use that does not include communication towers um
[0:08:41] Voice 3: and uh it doesn't include it at all that was when i was looking yeah so i i i think that's
[0:08:49] Voice 3: a point we might want to make um and yeah that of course the high seek is is uh we're we're aware
[0:09:01] Voice 3: that they're preparing an application for much needed community housing essentially at the same
[0:09:07] Voice 3: location so those are the it sounds like it sounds like those are sort of the main points
[0:09:17] Voice 3: and i'll just check back in with uh with trustees and see if there's anything further
[0:09:23] Voice 3: well
[0:09:27] Trustee Allen (probable): we can obviously not delve that deeply but um i have concerns i know that they're not concerned
[0:09:32] Trustee Allen (probable): with property values they're not concerned with safety code six but i have noted that they are
[0:09:40] Trustee Allen (probable): concerned every now and then with wildlife the effect on wildlife and there's no there's no
[0:09:48] Trustee Allen (probable): no actually studies at all
[0:09:50] Trustee Allen (probable): on the effect of wildlife. And this is like right next
[0:09:52] Trustee Allen (probable): to a park. Owls,
[0:09:54] Trustee Allen (probable): all sorts of
[0:09:56] Trustee Allen (probable): endangered, frankly, endangered species
[0:10:00] Trustee Allen (probable): dwell in that
[0:10:01] Trustee Allen (probable): forest. And
[0:10:03] Trustee Allen (probable): I think that should be
[0:10:06] Trustee Allen (probable): added to our
[0:10:07] Trustee Allen (probable): concerns.
[0:10:09] Trustee Allen (probable): The ones that can't speak up for themselves.
[0:10:13] Trustee Allen (probable): And as the fact that they can
[0:10:15] Trustee Allen (probable): also make it taller, they can add
[0:10:17] Trustee Allen (probable): more co-locators on it,
[0:10:19] Trustee Allen (probable): which is even going to have
[0:10:21] Trustee Allen (probable): have more impact on wildlife migratory birds etc that's
[0:10:32] Voice 3: okay and uh just before we move on
[0:10:37] Voice 3: to anything else um i could planner cox could could you just confirm for me um around the the
[0:10:47] Voice 3: permitted uses on that on that uh public use zone yeah
[0:10:52] Voice 9: so i would say if the trust committee wants
[0:10:55] Voice 9: wants to um i mean whatever comments uh staff will include um whatever you direct us to do
[0:11:00] Voice 9: will include that um the health concerns and all that is something that you know um generally is
[0:11:07] Voice 9: is is intended to be covered by the public health act not but in terms of the land use bylaw
[0:11:12] Voice 9: and whether it's permitted or not um tell me if you can see this this is your this is the land
[0:11:21] Voice 9: use bylaw okay um so this is the beginning of the bylaw in the general regulations
[0:11:30] Voice 9: and uses that are permitted in all zones includes public service use so that means in addition to
[0:11:39] Voice 9: the stuff that's permitted in each zone listed as principal or accessory uses these things are
[0:11:48] Voice 9: permitted in all zones unless otherwise prohibited so we look at this public service uses okay and
[0:11:56] Voice 9: then we look to the definition in your bylaw of public service use and this is what how it's
[0:12:04] Voice 9: defined i'll give you a second to to read this can you see that okay is it large enough yeah no it's
[0:12:10] Voice 4: good okay okay
[0:12:28] Voice 3: now uh my so my question is around and this was pointed out of um through the
[0:12:36] Voice 3: communication from high seek um there's
[0:12:42] Voice 2: section oh there's section
[0:12:47] Voice 3: i think it was 8.2 which lists
[0:12:50] Voice 3: the number of uses and then there's a section following that sure i can go to
[0:12:57] Voice 9: that this is
[0:12:58] Voice 3: notwithstanding yeah
[0:13:00] Voice 9: um just to be just to sort of clarify this piece what i just put up there
[0:13:08] Voice 9: the general the use is permitted in all zones general regs and then this public service use
[0:13:13] Voice 9: definition that would form part of like just the technical land use bylaw review by staff on a
[0:13:20] Voice 9: referral from the province okay so we're saying this land use bylaw says this about this there
[0:13:25] Voice 9: has been discussion in the community as we've heard as you have heard that this clause about
[0:13:30] Voice 9: serving only the hornby island community is something that has been raised as to whether
[0:13:35] Voice 9: the tower uh is a benefit to hornby island only or whether it's going to better others that's
[0:13:40] Voice 9: another discussion but but as it stands it would appear unless the unless the you know local trust
[0:13:48] Voice 9: trust committee like we're to feel like we want to delve into this particular uh piece of this
[0:13:56] Voice 9: definition um that it would appear that the um you know telephone uh services under the radio
[0:14:05] Voice 9: communication act is permitted in all zones unless either is prohibited so that's just that
[0:14:10] Voice 9: technical piece aside from whatever the local trust committee wants to
[0:14:13] Voice 8: add
[0:14:14] Voice 9: as comment to the
[0:14:15] Voice 9: technical review so i'll go to section um the public you're speaking chair about the public
[0:14:23] Voice 9: use zone correct correct
[0:14:25] Voice 2: yes okay
[0:14:26] Voice 9: so we'll go there uh just give me one second oh not there
[0:14:31] Voice 9: where are you 8.2 8.2 why is it 0

[0:15:01] Voice 9: to show you know what first i'm going to show you the zoning map um and let's see if can you
[0:15:16] Voice 9: see the zoning map yes okay so what the letter from high c what the communication from high
[0:15:26] Voice 9: is talking about is that the fact that this northern northeastern um portion is pu generally
[0:15:35] Voice 9: public use and and the on the other side of the road is pua which is a site-specific zone
[0:15:41] Voice 9: so then when we go to the bylaw and this is pardon me this this area here
[0:15:47] Voice 9: is where the generally where the proposed the housing proposal is um well yeah it is on that
[0:15:56] Voice 9: portion so if we then look at the bylaw the the public use zone on the northern portion allows
[0:16:03] Voice 9: all of these uses including community housing and then the site-specific zoning which applies to the
[0:16:14] Voice 9: other portion as in the proportion the portion that's that's that that high c uh is proposing
[0:16:21] Voice 9: to do the project on states despite all those other uses in the PUA site
[0:16:29] Voice 9: specific zone only these permitted uses are allowed right
[0:16:35] Voice 3: and so thank you for
[0:16:38] Voice 3: that because because what I was trying to get at is that this part the PUA does
[0:16:44] Voice 3: does not list the telecommunications part, right?
[0:16:50] Voice 3: It's very, very, so my
[0:16:52] Voice 9: reading of it.
[0:16:53] Voice 9: But the interpretation would be that in any zone,
[0:16:59] Voice 9: public service use is permitted,
[0:17:03] Voice 9: and that includes those items that were listed in the definition.
[0:17:07] Voice 4: Okay.
[0:17:10] Voice 4: So can I ask you, so that PUA.
[0:17:14] Trustee Allen (probable): I've had my hand up.
[0:17:17] Voice 3: yeah so that's true um so i'll go to trustee allen and then trustee scott will come back to you
[0:17:24] Trustee Allen (probable): sorry well in terms of definitions there's public service use and there's public use
[0:17:31] Trustee Allen (probable): and so i don't look at this as a public service zone i look at it as a public use zone and i
[0:17:37] Trustee Allen (probable): interpret that um the pua i interpret that as pua as in terms of the fire hall a under 8.21
[0:17:50] Trustee Allen (probable): So I think we're talking apples and apples and eggplants here because we're talking about a public use, not public service use.
[0:18:01] Trustee Allen (probable): Those are two separate things and they're indicated as separate things and separate definitions.
[0:18:07] Trustee Allen (probable): And I don't think we should agree in bringing up the public service use.
[0:18:11] Trustee Allen (probable): This is a public use.

[0:18:38] Voice 4: utility storage yard highways maintenance and recycling so that implies that is the
[0:18:45] Voice 4: does that mean that's the only permitted uses in pua because

[0:18:57] Voice 9: confused there's a couple of uh as far as i see there's a couple things going on do you are you
[0:19:01] Voice 9: The trustee is asking about whether or not the bylaw would appear to permit telecom towers in the zone or the housing piece.
[0:19:17] Voice 9: I'm a bit confused at the moment as to which discussion.
[0:19:21] Voice 3: Correct.

[0:19:22] Voice 3: whether it would permit telecom towers.

[0:21:13] Trustee Allen (probable): was to do with the radio tower to allow the radio station to be in that zone frankly um

[0:21:28] Voice 9: whether or not the land use bylaw permits it does not necessarily mean that um for some reason the
[0:21:34] Voice 9: province would outright permit it just because you know that's not you know the point of the
[0:21:39] Voice 9: response to crown lands at some point is to provide the local government's um response and
[0:21:44] Voice 9: questions and concerns so i'll leave
[0:21:47] Voice 3: that out there yeah

[0:21:50] Voice 3: and and just just to clarify
[0:21:51] Voice 3: where where i was coming from uh just because that i felt that was from my reading i i felt
[0:21:57] Voice 3: there was a little ambiguity there so i just wanted to get um staff perspective on that so
[0:22:03] Voice 3: which is that it's not um prohibited there so staff doesn't
[0:22:08] Voice 3: feel that it's prohibited no
[0:22:10] Voice 3: uh so okay great so i'm clear on that so that's um so i would just sort of suggest that we stick to
[0:22:17] Voice 3: um we stick to uh things that we've already mentioned about the community aspirations
[0:22:26] Voice 3: for the housing there about the location being uh not considered to be uh suitable by proximity to
[0:22:35] Voice 3: all of those other things and and and uh but based on staff's interpretation then i don't think
[0:22:44] Voice 3: um we want to try and make any claim about that but you know that the use wouldn't be permitted
[0:22:56] Voice 3: um so i think what they might be helpful right now and um is if maybe i could get uh ian maybe
[0:23:08] Voice 3: Maybe I could get you to do a share screen and we can just make a little list of the of the items that we've talked about and sort of see if we all generally agree on those items that we feel should be part of the response.

[0:23:34] Voice 3: what I certainly heard from everybody is that there's a potential or we're aware of an application from the community group for much needed community housing in the same area.

[0:24:14] Voice 9: uh chair are you such or um is it that the ltc recognizes the general need for housing on
[0:24:24] Voice 9: the island or that specifically um it has well that indication that there is a forthcoming
[0:24:31] Voice 9: proposal or something to that effect like
[0:24:33] Voice 3: yeah yeah that
[0:24:34] Voice 3: we we've been informed that there is
[0:24:37] Voice 3: Is a proposal coming from HI-SEEK for community housing in that same parcel?
[0:25:06] Voice 9: Sort of type way, but I guess, yeah.
[0:25:09] Voice 9: That's okay.
[0:25:10] Voice 9: As we informed, well.
[0:25:18] Voice 4: I think you can just say community housing is forthcoming.

[0:25:32] Voice 3: and i would say we could be a little bit more specific and say on that parcel but

[0:26:27] Trustee Allen (probable): does not allow that, because apparently it does.
[0:26:33] Voice 3: Yeah, correct. That's why I wanted to sort that interpretation out

[0:26:43] Trustee Allen (probable): Well, mine was the wildlife, the insubstantial
[0:26:47] Trustee Allen (probable): studies on the effect on wildlife.
[0:26:50] Trustee Allen (probable): It's abutting a park, a regional park
[0:26:57] Trustee Allen (probable): concerns the public.
[0:26:59] Trustee Allen (probable): now over the sorry
[0:27:05] Voice 9: i was just anticipating you may just want to i'm not sure if you just want
[0:27:09] Voice 9: to mention um the environment and um like non-human yeah
[0:27:16] Trustee Allen (probable): beings or if you want to mention
[0:27:18] Voice 9: human and okay
[0:27:19] Trustee Allen (probable): concerns over the effect sorry

CALL TO ORDER “Please note, the order of agenda items may be modified during the meeting. Times are provided for convenience only and are subject to change.” Chair Peterson called the meeting to order at 3:00 p.m. He acknowledged that the meeting was held on the territory of the Coast Salish First Nations. 2. APPROVAL OF AGENDA By general consent the agenda was approved as presented. 3. BUSINESS ITEMS 3.1 Local Trust Committee's Response When Receiving a Referral from the Province of British Columbia for Rogers Communications Tower Proposal Discussion ensued and Trustees made the following comments: The subject property is one of the only sites available for community housing; Housing has priority over a cell tower; The location is not appropriate due to proximity to public facilities, residences, and the potential public housing site; The community has voiced substantial opposition to a cell tower to be located on the proposed site; and There are no studies on the affects of a tower on wildlife. ADOPTED Hornby Island ADOPTED 2 Local Trust Committee Special Meeting Minutes May 22, 2024 The Planner clarified that the Hornby Island Land Use Bylaw specifies that public service uses are allowed in all zones. The bylaw defined public service as “the provision of water, gas, electrical, telephone, television or emergency services by a government body or agency or by a company regulated by the Utilities Commission Act or the Radiocommunication Act of Canada, serving only the Hornby Island local community. HO-2024-016 It was MOVED and SECONDED that the Hornby Island Local Trust Committee direct staff to include in any response to the referral from the Province of BC regarding the Rogers Communications tower proposal, the following concerns that: a) the Local Trust Committee supports the proposal for community housing forthcoming from the Hornby Island Community Economic Enhancement Corporation in this location; b) the Local Trust Committee has received substantial community opposition to a communications tower in this location; c) the Local Trust Committee has concerns over the effects of the tower on wildlife, given the location in close proximity to the adjacent park which is home to wildlife and migratory bird routes; d) the location is too close to public facilities (school, playground, health clinic, ball park, etc.); and e) the location is too close to existing housing. CARRIED 3.2 Local Trust Committee's Response to the Hornby Island Community Economic Enhancement Corporation (HICEEC) and the Local Housing Society's Request to Amend the Bylaws Governing the Public Use Zone It was noted that the application to amend the bylaw would be received in approximately one week. HO-2024-017 It was MOVED and SECONDED that the Hornby Island Local Trust Committee request that a letter of support be drafted to the Hornby Island Community Economic Enhancement Corporation (HICEEC), stating its intent to consider amendments to the Hornby Island Land Use Bylaw No. 150 to support inclusion of community housing as a permitted use in the Public Use - PU(a) Zone site specific regulations.
