[0:01:59] Voice 4: homes our staff have a right to a safe and respectful workplace and so with that i will

[0:02:06] Voice 4: go to the agenda um any amendments to the agenda today i know that we do have

[0:02:14] Voice 4: i guess that's for the closed meeting i had that portion coming in so other than that i don't think

[0:03:48] Voice 7: two main meetings we've had since the last one of these which is of course with the

[0:03:53] Voice 6: Comox Valley Regional District

[0:03:54] Voice 7: and it

[0:03:55] Voice 6: was quite interesting one of the two

[0:03:57] Voice 6: main issues that I

[0:03:58] Voice 6: remember Alex a little bit more

[0:03:59] Voice 7: one was the question they're doing a study about uh

[0:04:03] Voice 7: licensing for short-term principles and they're going to delve down into it the question of

[0:04:11] Voice 7: temporary use permits because a big question of ours is which is more advantageous we have

[0:04:21] Voice 7: have temporary use permits already, license it. So there's advantage and disadvantage.

[0:04:24] Voice 7: I won't get into what that means. So that was very interesting. The other thing I found

[0:04:29] Voice 7: really fascinating was PRCMP Sergeant was there, and one of the things we talked about

[0:04:37] Voice 7: was how much Denver resents Hornbyites, you know, speeding, using McFarland, that's a

[0:04:47] Voice 7: 50k zone and going to 80k or 90k trying to beat them you know get ahead of the flying on the slow

[0:04:53] Voice 7: way so i've said a couple of times i thought the best way to deal with that is if they if the rcmp

[0:04:59] Voice 7: simply put a road rock there once in a while you know a camera and and all you got to do is

[0:05:08] Voice 7: hand out a few tickets and the word will go out very very quickly you speed along

[0:05:12] Voice 7: along McFarland that's West Coast, there's a chance you're going to get busted. And if you go 80 or 90 in a 50k zone, you're

[0:05:25] Voice 7: hitchhiking. So they thought that was a pretty good idea, especially coming from somebody from Hornby. But I mean, you know, I

[0:05:37] would feel the same way

[0:05:38] Voice 7: if I hadn't done that

[0:05:39] Voice 7: where people were speeding, right?

[0:05:41] Voice 7: And I don't want my

[0:05:43] Voice 7: everybody guilty, but I wouldn't want

[0:05:45] Voice 7: them to go one way or the other.

[0:05:47] Voice 7: But the other interesting

[0:05:48] Voice 7: meeting we had was we met with the

[0:05:50] Voice 7: Comox First Nation.

[0:05:53] Voice 7: And the big issue that came up there

[0:05:55] Voice 7: was, from their point of view

[0:05:57] Voice 7: and ours, was how

[0:05:59] Voice 7: do I identify the

[0:06:01] Voice 7: First Nation's cultural

[0:06:03] Voice 7: and heritable values on a map

[0:06:05] Voice 7: so that people will

[0:06:08] Voice 7: be able to you know when you go to do a development or you buy a piece of property

[0:06:13] Voice 7: and it's you at least can see whether in my mind it's in a red zone or not this isn't to

[0:06:20] Voice 7: identify specific sites with specific things on it you're not going to say that's a burial site

[0:06:26] Voice 7: and there's a mid there but just to say this is a this is an area that's been identified as a high

[0:06:32] Voice 7: potential so if you are doing a development in that zone you're going to have to go through a

[0:06:38] Voice 7: bunch of hoops so that was that was taken into account and the chief was adamant about they

[0:06:45] Voice 7: didn't want to be the policeman on on every permit that comes to this go all the way to the art all

[0:06:53] Voice 7: the way to them so they were looking for the trust to do that and as i understand there's there's

[0:06:59] Voice 7: something called red maps that we brought for something with you that people can actually

[0:07:04] Voice 7: see you're out there that actually shows some of your stuff so it was very interesting and i thought

[0:07:09] Voice 7: i found both both meetings very helpful thanks thank you um trust the album well i've done

[0:07:20] Voice 7: the tournament was very same meetings

[0:07:21] Voice 9: but i got a few more separate points um so yeah let's see

[0:07:27] Voice 9: The CVR meeting was in June, and Daniel Arbour, our Director of Charities meeting.

[0:07:33] Voice 9: And yeah, so the RCMP, I forget his name, but he comes to the meetings pretty much regularly.

[0:07:39] Voice 9: So we talked about the most common talk to police issues have been traffic and wellness and mental health checks, apparently.

[0:07:50] Voice 7: And that's not Courtney, but that's Cumberland and Black Creek and all the rural areas, and Hornby and Denman.

[0:07:56] Voice 7: and

[0:07:56] Voice 9: um and then another one is the online extortion fraud it's like up 150 percent

[0:08:04] Voice 9: i know there was this one woman on our island that did have somebody call and um

[0:08:11] Voice 9: it was very frightening they she thought her son was in a car accident and uh she was going to send

[0:08:16] Voice 9: money she was this close to doing that and the

[0:08:20] Voice 7: son walked in this type of walking just be very

[0:08:24] Voice 7: aware of that when you pick up the phone so it's a very unpleasant thing um and

[0:08:30] Voice 9: then we talked about

[0:08:30] Voice 9: animal control once again dogs lots of issues here and i am going to put up some sort of survey or

[0:08:35] Voice 9: something in the um the summer edition just to see what's the appetite for revisiting this because

[0:08:42] Voice 9: there has been a lot of dog attacks and chickens and

[0:08:46] Voice 7: we do have a lot of dogs inside and of course

[0:08:49] Voice 7: the visitor dogs as well so we'll find out about that what's the appetite and then yeah i was kind

[0:08:56] Voice 7: of confused

[0:08:57] Voice 9: about the vacation rental business licensing discussion because we've got the

[0:09:02] Voice 9: provincial radio i still i'm still i felt like um they were wanting us to come up with a motion

[0:09:08] Voice 9: frankly to go further whether we want um temporary permits versus getting to explore business

[0:09:15] Voice 9: business licenses. So I wasn't sure where this is going. And I

[0:09:17] Voice 9: did talk to Daniel. And then, yeah, he said his quote was

[0:09:25] Voice 9: partnership is hard. And then also brought up the signage at

[0:09:30] Voice 9: Mount Jeffrey the trails and a lot of people do not like the

[0:09:33] Voice 9: signage is still organic. And everyone is the name of the

[0:09:37] Voice 9: the trail, call

[0:09:38] Voice 7: 911, everyone, call 911, call 911,

[0:09:40] Voice 9: call 911, and that's ridiculous.

[0:09:43] Voice 9: And I did mention that, which I'm going to bring up later in our meeting, about a resolution

[0:09:49] Voice 9: we did about place names was coming up for destinations back in 2017, and I'm going to

[0:09:54] Voice 9: bring that up because

[0:09:55] Voice 7: that should have been part of this before they even put signs on

[0:09:59] Voice 7: the park, frankly.

[0:10:01] Voice 7: and then

[0:10:01] Voice 7: so

[0:10:05] Voice 9: we met with the chief

[0:10:08] Voice 9: councillor Ken Price and

[0:10:09] Voice 9: one councillor Ken

[0:10:12] Voice 9: Newman and then there was

[0:10:14] Voice 9: an archaeology coordinator

[0:10:16] Voice 9: in intergovernmental relations

[0:10:19] Voice 9: and it was

[0:10:19] Voice 9: good I actually thought it was going to be two hours but it was only

[0:10:22] Voice 9: an hour and it's like oh so I didn't

[0:10:24] Voice 9: I thought okay I'll bring that up in the next

[0:10:26] Voice 9: hour and it didn't really happen

[0:10:27] Voice 9: and it wasn't all the signage so I didn't get to really talk about

[0:10:30] Voice 9: that but they did put out

[0:10:32] Voice 9: out that they don't want to hear site and usage, SAP. They

[0:10:41] Voice 9: don't want to hear it after the fact, they want to know before.

[0:10:43] Voice 9: So I thought when Grant and I did pass motions that they're

[0:10:47] Voice 9: going to hear before anytime something comes up to us, we

[0:10:50] Voice 9: will send it to them and then they comment on it. But

[0:10:53] Voice 9: apparently they haven't been receiving that. So we'll deal

[0:10:56] Voice 9: with that. And they feel like we're being real active, not

[0:11:00] Voice 9: proactive regarding our direct obligations um which is declaration of rights of indigenous

[0:11:06] Voice 9: peoples and then you know i mentioned about carrying capacity in terms of looking at ocps

[0:11:12] Voice 9: various other um reviews that they have to do and they said to not you know don't worry we have the

[0:11:19] Voice 9: carrying capacity so we can do it which i was surprised and they basically brought up about

[0:11:24] Voice 9: the cultural heritage policy and how we need to have um way more education the round tables or

[0:11:30] Voice 9: some sort of events on the island and um and they didn't mention they wanted cultural heritage

[0:11:36] Voice 9: signage which i've been pushing for too and then the last one was some they do have really big

[0:11:42] Voice 9: concerns

[0:11:42] Voice 7: about the water running in terms of them they're feeling that the aquifers people

[0:11:48] Voice 7: were prescribed so it was a it

[0:11:50] Voice 9: was an interesting meeting and done and i'll say it was the first in

[0:11:53] Voice 9: person meeting since 2017 for me and uh consulting staff to staff one and then hoping that we had

[0:12:00] Voice 9: important

[0:12:01] Voice 7: politicians politicians so that's my long record sorry thank you for that and so next

[0:12:07] Voice 7: up is the chair of the report i just would say that uh from my perspective the the meeting with

[0:12:13] Voice 7: uh kamak's uh first nation um chief of council

[0:12:16] Voice 4: and staff members was uh was really positive as far as

[0:12:22] Voice 4: that's a sense that everybody's on board to to meet more and to work together and so i think

[0:12:28] Voice 4: that's that's uh beginning of a positive step forward in the

[0:12:33] Voice 7: relationship um i really also

[0:12:37] Voice 7: appreciated the uh the meeting with uh daniel harper and the crd um it was actually both moving

[0:12:44] Voice 4: meetings were joined with um with the denman trustees that was kind of good because we got

[0:12:49] Voice 4: to cover there's a there's i think both from the first nation perspective and from the crd

[0:12:57] Voice 4: perspective

[0:12:57] Voice 7: there's a lot of there's a lot of overlap but we also did get into individual

[0:13:02] Voice 7: island um issues so i thought both were really productive and a good spirit of working together

[0:13:09] Voice 7: that's part of our mandate is in cooperation with other agencies and the first nations so i think

[0:13:16] Voice 7: that was uh positive steps on both of both of those meetings um let's see so trust councils

[0:13:24] Voice 4: next week on salt spring um we'll be marking the 50th anniversary of the islands trust which was

[0:13:31] Voice 4: i think june 5th um so a bit of reflection on that um uh

[0:13:38] Voice 7: the um chief executive officer uh hiring

[0:13:43] Voice 7: committee is i think on the brink of announcing an interim appointment um as the recruiting process

[0:13:50] Voice 7: the process for the placement comes on. Yes, there is an announcement

[0:13:56] Voice 4: has been made. Okay.

[0:13:58] Voice 4: I didn't want to announce anything

[0:14:00] Voice 7: unless it had already been released so that yeah,

[0:14:06] Voice 7: so directed Julia Mobs has been appointed as the interim

[0:14:09] Voice 4: CAO for Islands Trust. And

[0:14:12] Voice 4: I think everyone's feeling pretty positive about that. That's a really solid person to

[0:14:18] Voice 4: have as as the bridge until we get the permanent position in um i'm on that uh hiring committee as

[0:14:26] Voice 4: as a vice chair and we have uh we have selected a an executive search for we're just sort of putting

[0:14:33] Voice 4: the last pieces together for them to go out and start

[0:14:35] Voice 7: getting their recruiting which i think is

[0:14:38] Voice 7: gonna happen really soon but given the the timeline it's important and prudent of us to have

[0:14:45] Voice 7: made a trust council actually made the the appointment i think um you know by consensus

[0:14:51] Voice 7: well-supported decision to to have uh director mobs um interim cao we're all looking forward

[0:14:59] Voice 7: to working with hirsch that are super great attitude really good people person knows the

[0:15:04] Voice 7: numbers knows how everything works so it's going to be a really good bridge for us um at the end

[0:15:10] Voice 7: of may we had our first committee of the whole meeting uh ever at island's trust to uh start

[0:15:16] Voice 7: delving into the draft policy statement and uh and so there's going to be uh more of them as we

[0:15:23] Voice 7: get a little bit deeper into the event so two or three hours anyway not so certainly not enough to

[0:15:30] Voice 7: get fully weighted into but just sort of an initial um initial look and there'll be more uh

[0:15:37] Voice 7: or coming on that and those are generally all going to be open to the public i've been listening

[0:15:42] Voice 10: to

[0:15:42] Voice 7: see this rain today i know how it's

[0:15:45] Voice 7: felt here on corby but we've been feeling a little

[0:15:47] Voice 7: harsh over on the ski so i'm actually very excited for this time of year yes if julia's

[0:15:55] Voice 7: yeah does that mean she cannot be she can apply for the permission yeah absolutely

[0:16:09] Voice 7: Okay, I have to suggest expanding it on one committee, the whole is a slightly less formal

[0:16:17] Voice 7: forum for trust council and it was identified that it could be useful for the policy statement

[0:16:26] Voice 7: review as well as potentially for other subjects.

[0:16:31] Voice 7: yeah a little less formal uh the idea is to have um a bit more free-flowing discussion

[0:16:39] Voice 7: in committee the whole um there are no uh no decisions of trust counselor made so it's really

[0:16:48] Voice 7: about the deliberation of discussion and committee the whole can make recommendations to trust

[0:16:54] Voice 7: council but it's only in a normal trust council that would make decisions so i don't know if that

[0:17:01] Voice 7: made it any clearer or more confusing but that's committee

[0:17:04] Voice 3: of the whole is also

[0:17:04] Voice 7: it's uh sorry

[0:17:07] Voice 7: committee of the whole is is a it's a type of meeting that's used in a lot of local governments

[0:17:13] Voice 7: i think most regional districts um have the whole sessions as well as as the board session so it's

[0:17:21] Voice 7: just a slightly different format intended to improve the discussion portion of it and not be

[0:17:30] Voice 7: quite as fun so i think that's it for my chair's report and that means we can move on to i don't

[0:17:40] Voice 7: think we have anything from director arbor today which is okay um so we have a public comment

[0:17:45] Voice 7: session well i did have one thing sorry sorry go ahead i just wanted to add that there's national

[0:17:52] Voice 7: Indigenous Peoples Day on June 21st, next Friday at Comox First Nations. It's going to do a Comox

[0:17:59] Voice 7: Valley exhibition around 2 to 9pm. So I've never been there, but it's buried in Forty Acres. It's

[0:18:04] Voice 5: amazing.

[0:18:05] Voice 7: I'm at Carters Road, so if anybody, I unfortunately can't participate, but one day I

[0:18:10] Voice 7: will. I think it would be a good thing to do. So this is an opportunity for members of the

[0:18:18] Voice 7: public to address the local trust committee um we request that you direct your comments

[0:18:25] Voice 7: to the local trust committee and not to other individuals or staff be clear concise and

[0:18:32] Voice 7: respectful and with that um i'll look to for sure hands to see who would like to speak today

[0:18:39] Voice 7: okay so i'm gonna actually my timer working try and keep it brief so around three minutes

[0:19:09] Voice 3: This is a question of clarification, probably, and I also want to understand that I am deeply concerned about the Tribune Bay Park Project and the BC Parks.

[0:19:21] Voice 3: I'm wondering, my clarification question is, does Islands Trust have any jurisdiction over

[0:19:27] Voice 3: these parts of the land?

[0:19:29] Voice 3: The reason I am so concerned is the request for proposals have just come out, and in a

[0:19:37] Voice 3: quick look, my understanding is they're talking about bringing in 1,000 to 1,500 truckloads

[0:19:48] Voice 3: of standing alone that your loans alone will be exceeding difficult and for a so-called low impact

[0:19:58] Voice 3: walk-in campsite i'm just appalled i'm just appalled so i'm wondering if there is a place

[0:20:07] Voice 3: where i was trusted okay thank

[0:20:11] Voice 4: you for that and i'm gonna um put that one over to staff

[0:20:17] Voice 4: I don't think we have much jurisdiction, but I'll look to staff if there's any clarification

[0:20:23] Voice 4: on that.

[0:20:29] Voice 5: We've spoken to folks who've called in on inquiries, about inquiries who are also concerned

[0:20:37] Voice 5: And so, I've done some looking around and it appears as though, and this isn't the final

[0:20:45] Voice 5: answer necessarily, but the zone, I mean, we believe that likely, and in previous cases on

[0:20:54] Voice 5: other islands, like I'm taking on North Kender and Edith, there's an example, that they should

[0:21:00] Voice 5: probably be at least submitting like a rezoning application of some kind, because it is zoned a

[0:21:05] Voice 5: certain way, the one portion for example, but that's not, it may not be actually necessary,

[0:21:10] Voice 5: So that's something that also part of that land, as you well know, is in the ALR.

[0:21:16] Voice 5: So there's that consideration as well.

[0:21:19] Voice 5: How the ALC, how the commission legislation interacts with BC Parks legislation is another matter.

[0:21:26] Voice 5: And it's not really a NINUS Trust matter, that particular thing.

[0:21:30] Voice 5: thing. But, but certainly, the zoning is in cases where the

[0:21:40] Voice 5: Crown owns the land, they are understanding that, you know,

[0:21:49] Voice 5: they are able to, to do uses that they wish to do on that

[0:21:57] Voice 5: land. So you want to take that through the

[0:22:03] Voice 7: chair as well. If the work is I'm not familiar with

[0:22:08] Voice 7: the particular kind of work happening typically by PC parks, but if it's work related to the

[0:22:13] Voice 7: maintenance of the camp ground that it's from for the profits to do so it's not related to

[0:22:20] Voice 7: of the land use beyond that extent so you do have to take those into account. It's always a good idea however

[0:22:29] Voice 7: I think the promise follows that best practice to listen to any concerns that are heard from

[0:22:37] Voice 7: the community or or the LTC so I think there's still that that exists but BC Parks does have

[0:22:44] Voice 7: the ability to perform the events um if it is for me but with that said i think they

[0:22:53] Voice 7: won't hear about concerns if there's concerns about trucks and potential concerns

[0:23:03] Voice 7: This is

[0:23:05] Voice 7: a brand new development.

[0:23:07] Voice 5: This particular issue is that

[0:23:14] Voice 7: Justice got me a question.

[0:23:17] Voice 7: Oh, yeah, well, I asked Mark's people impression I got is that they come under separate legislation.

[0:23:28] Voice 7: But I think like what Brene said, I mean, just as a matter of best practices, they should

[0:23:34] Voice 7: be informing the community, whether they do that to the trust or they do that to the Parks

[0:23:40] Voice 7: Committee, which would probably be a more effective way to do it than doing it to the

[0:23:44] Voice 7: trust.

[0:23:44] Voice 7: But legally, as I understand it, they come under a separate jurisdiction.

[0:23:52] Voice 3: I just want to add, when on my taxes and everywhere else, Island's Trust was there.

[0:23:59] Voice 3: there to preserve and protect, and they allowed the land to be sold to the government, does

[0:24:07] Voice 3: that give them the, they now have no responsibility in it?

[1:31:19] Voice 7: got 10 little buggy chains and it's got, so it's gone down from 150 to 120. They've made it less

[1:31:27] Voice 7: and they were very concerned

[1:31:32] Voice 7: increasing the traffic by

Chair Peterson called the meeting to order at 11:30 a.m. He acknowledged that the meeting was 
held on the territory of the Coast Salish First Nations. 
2. APPROVAL OF AGENDA

3. REPORTS 
3.1 Trustee Reports 
Trustee Scott reported the following: 
 Attended a meeting with the Comox Valley Regional District (CVRD) during which 
the CVRD reported that they were doing a study on licensing short-term vacation 
rentals (STVRs); and

 Attended a meeting with the K’omoks First Nations and discussed, in part, how to 
identify areas that might contain First Nation’s cultural and heritage values on a 
map so that property owners would be aware that certain areas might potentially 
hold historical importance related to First Nations culture. 
 
Trustee Allen reported the following: 
 Attended a meeting with the Comox Valley Regional District during which a member 
of the RCMP indicated that the most frequent issues dealt with are traffic incidents 
and mental health checks, and that online extortion had increased; and 
 Attended a meeting with the K’omoks First Nation during which it was noted that 
more education is needed regarding First Nations cultural and heritage sites and 
identification of cultural and heritage place names through the use of signage is 
important. 
3.2 Chair's Report 
Chair Peterson reported the following: 
 Attended the meeting with K’omoks First Nation and felt it was a positive step 
forward toward relationship building;  
 Attended the meeting with the Comox Valley Regional District; 
 Will be attending the Trust Council meeting next week; 
 The CAO Hiring Committee has announced the appointment of an interim CAO; and 
 Attended the first committee of the whole meeting to discuss the Islands Trust Draft 
Policy Statement. 
3.3 Electoral Area Director's Report - None 
4. PUBLIC COMMENTS 
 A member of the public made the following comments: 
 Concerned about the Tribune Bay Provincial Park works project which will (reportedly) bring 
up to 1500 (one thousand five hundred) truck loads of sand and rock onto the site, that this 
volume of material can be harmful to the ecosystem, and that a petition had been signed by 
a large number of community members who opposed the project. They asked if Islands 
Trust has any jurisdiction or ability to intervene. 
o The Planner replied that they have heard community concerns regarding this issue, 
the park and campground are under provincial jurisdiction, the Local Trust 
Committee had not received the petition, and that community members are 
encouraged to notify the Province about their concerns. 
o One of the Trustees pointed out that this is a public park for the use of the people of 
British Columbia and that he believes the trails are being improved for accessibility 
purposes. 
 A member of the public stated that there are regulations in place for short-term vacation 
rentals (STVRs); however, the rules do not appear to be effective as there are a large 
number of STVRs on Hornby Island that are not in compliance with the bylaws and the 
bylaws are not being enforced due to staffing issues. 
o The Bylaw Enforcement and Compliance Manager noted that proactive 
enforcement has been ongoing, that investigations show very few STVRs operating

unlawfully, and that Hornby Island permits STVRs from May to October and if any of 
them are operating outside of the bylaws then the bylaw staff need to be informed. 
 A member of the public asked if the Hornby and Denman Local Trust Committees had a 
meeting to discuss cross-island ferry traffic. 
o The Chair replied that a meeting with the Ministry of Transportation had been 
requested but had not been scheduled yet. 
 A member of the public asked if the Local Trust Committee had sent a letter to the Crown 
regarding the siting of the cell tower. 
o The Chair noted that a special meeting had been held to discuss what the Local 
Trust Committee’s response would be once a referral was received from the 
Province regarding the siting. A Planner stated that the referral had been received 
the day prior and that they would be working on a reply based on the comments 
received from the Local Trust Committee.

6.1 Local Trust Committee Minutes dated April 26, 2024 - for adoption 
By general consent, the Local Trust committee meeting minutes of April 26, 2024 were 
adopted.  
A Trustee asked if Advisory Planning Commission members can serve for a third term 
and it was clarified that there is no limitation on the number of terms that can be 
served. 
6.2 Local Trust Committee Special Meeting Minutes dated May 22, 2024 - for adoption 
By general consent, the Local Trust committee special meeting minutes of May 22, 2024 
were adopted.

7. BUSINESS ARISING FROM MINUTES 
7.1 Follow-up Action List Report dated June 6, 2024 
A Trustee stated that the December 13, 2023 motion did not reflect the intent of the 
discussion and the Planner replied that there were several resolutions made that built 
on previous ones and it is the intention of staff to provide a report summarizing the 
motions with suggestions on how to make the wording and intent more clear. 
8. APPLICATIONS AND REFERRALS 
8.1 HO-RZ-2009.2 (Hornby Island Resort Ltd.) Covenant Variance Request – Memorandum 
The Planner summarized the memorandum and highlighted the following:

 Legal counsel for the property owner requested an alteration to the terms of a 
covenant that was put in place at the time that the property was rezoned; 
 The covenant requires green roofs on  buildings used for accommodation; 
 The new home warranty insurer does not provide insurance for two-storey wood 
frame building with green roofs; 
 The proponent has requested that aspect of the covenant be discharged; 
 The discharge is permitted under another section of the covenant; 
 The proponent has indicated that they can comply with all of the other terms of the 
covenant; and 
 The property owner will increase the percentage of green roof on the commercial 
buildings to make up for the portion of the residential building that will not have a 
green roof. 
 
The proponent was in attendance and spoke to the application. 
 
Discussion ensued and clarifications were provided regarding the overall square footage 
of green roof required and that a larger portion of green roof will be installed on the 
commercial buildings, which are made of metal and concrete. 
 
HO-2024-019 
It was MOVED and SECONDED 
that the Hornby Island Local Trust Committee direct staff to work with the owner’s legal 
counsel to remove the entirety of section 2 of Schedule “A” to Land Title Act Section 219 
Covenant CA2090177 registered to the property title, and to include required plantings 
as a term and bring the draft back to the Local Trust Committee for final review and 
signature subject to doing a comparable area of green roof on a commercial building.

8.2 HO-DVP-2023.2 (McMurtrie) - Staff Report 
The Planner summarized the Staff Report and highlighted the following: 
 The variance request is to reduce the 30.0 metre setback from drinking water wells 
on neighbouring properties to 27.4 metres for a septic disposal field and to reduce 
the setback from the natural boundary of the sea from 15 metres to 12 metres to 
accommodate a septic tank; and 
 Due to constraints of the site, the location of the principal residence, and the 
location of neighbouring wells and septic fields the proposed siting has been 
recommended by a wastewater professional. 
 
The applicant was in attendance and spoke to the application. 
 
The Trustees did not have questions for the applicant.

9.1 Major Project: Hornby Island Official Community Plan and Land Use Bylaw Review - 
verbal update 
The Planner stated that draft bylaws will be prepared for the August 9, 2024 Local Trust 
Committee Special Meeting.

11. NEW BUSINESS 
11.1 Letter to BC Parks Regarding Tribune Bay Works Plan 
The Trustees discussed writing an advocacy letter to address community concerns 
regarding the extent of the work to be done in Tribune Bay Provincial Park and the 
volume of gravel and rock to be trucked onto the island and dispersed in the park. It was 
noted that there is an opportunity for members of the community to contact BC Parks 
directly to present a petition. 
Trustee Scott opposed writing a letter because the work does not extend into the 
wetlands, the campsites have a low impact as they are spread through the forest, it is 
not a conservation area, and the park is for the benefit of the people of British 
Columbia. 
The meeting was recessed for a break at 1:05 p.m. and reconvened at 1:22 p.m. 
The regular meeting was recessed at 1:22 p.m. to go to Item 15: Closed Meeting. 
The regular meeting was recalled to order at 2:10 p.m. 
  Discussion regarding sending a letter to BC Parks continued. 
HO-2024-021

that the Hornby Island Local Trust Committee request staff to send a letter to BC Parks 
to express concerns heard from the public regarding  
1) The process of community consultation; 
2) Changing work plan; 
3) Location of campsites and wetland area;  
4) Volume and number of truckloads of gravel and rocks; and 
5) Additional issues of zoning

A Trustee referred to a 2017 follow up action list, or staff report, which referenced an 
amendment to the Shared Narrative of Place Project Charter to include K’omoks First

Nations signage on island trails and parks. The Planner stated that they will look into the 
details and follow up at a future meeting.  
12. STAFF REPORTS 
12.1 Bylaw Enforcement Notice Amendments - Staff Report 
The Bylaw Compliance and Enforcement Manager summarized the Staff Report and 
made the following comments: 
 The report was initiated because the previous siting and use permit bylaw was 
rescinded and the Local Trust Committee has adopted a new bylaw; 
 If the Local Trust Committee wishes to use the siting and use bylaw, then, 
amendments are required; 
 The schedules have been simplified and a penalty for failure to obtain a 
development permit has been specified; and 
 Standard penalties have been applied and include a $350 penalty for minor 
contraventions and $500 for major contraventions. 
 
Discussion ensued. The Bylaw Compliance and Enforcement Manager provided the 
following clarifications in response to questions from the Trustees: 
 The Province has established that the penalty for a bylaw infraction can be set at a 
maximum of $500; however, a penalty can be issued for every day that an offence 
continues; 
 There is no set limit for a surcharge; 
 Proactive enforcement on short-term vacation rentals is ongoing; 
 Bylaw enforcement staff regularly review vacation rental advertisements; however, 
if the advertisement does not flag any infractions then staff do not have grounds to 
proceed unless a complaint, or further information, is received; 
 Once information is received, bylaw enforcement staff can follow through based on 
the ability to be proactive; 
 Complaints are confidential and individuals can make a complaint anonymously.
