[0:00:23] Voice 13: in a week or so um i want to begin by we're acknowledging that we're gathering here today

[0:00:33] Voice 13: on coach davis territory and specifically the territory of the penelaket nation

[0:00:38] Voice 13: and uh honored today to have chief um and counselors here and uh we're gonna give them some

[0:00:45] Voice 13: space um pretty pretty early in the agenda because i know we have other stuff that they want to do

[0:00:52] Voice 13: today. So very honored to have you join us here and it's important for our journey of reconciliation

[0:01:02] Voice 13: to welcome you to our meeting space and I'm very very pleased that you're here.

[0:01:10] Voice 13: So my name is Tim Peterson, I'm elected on Muskegon and I'm the chair of the Galliano

[0:01:24] Voice 13: trust committee with me our local trustees ben neighbourly uh lisa gavro and uh our planner

[0:01:34] Voice 13: kim stockdale's here and online we have um lisa millard is uh doing our online meeting

[0:01:41] Voice 13: administration and taking our minutes very appreciative for the technology that allows that

[0:01:48] Voice 13: um so yeah this meeting is an official forum for the local trust committee to make decisions about

[0:01:55] Voice 13: land use uh planning matters and discuss relevant business uh just remind everyone

[0:02:01] Voice 13: it's also a place of employment and our staff have the right to a safe and respectful workplace

[0:02:06] Voice 13: um and of course we do have a town hall opportunity here a couple of them as usual so

[0:02:13] Voice 13: um i'll let you know when we're there um but to start with we have uh an agenda and so i'll just

[0:02:22] Voice 13: look to trustees and we're going to reorder the agenda a little bit and give uh chief jock and

[0:02:29] Voice 13: counselors uh some space to speak um but other than that is there are there any other additions

[0:02:36] Voice 13: or amendments to the agenda?

[0:02:50] Voice 10: And since I'm sure there's some people here

[0:02:54] Voice 10: who want to thank them for being here as well.

[0:02:56] Voice 10: So if we went to the Tom Holland questions

[0:02:58] Voice 10: and then maybe put a short break at public hearing,

[0:03:11] Voice 13: that's uh that's perfectly reasonable all right okay so we'll uh we'll approve the agenda as

[0:03:22] Voice 13: adopted then or as amended um and so we'll start out with trustee reports who'd like to go first

[0:03:31] Voice 6: I'll go first. All right. I'll share some updates from our recent quarterly trust council meeting

[0:03:40] Voice 6: which held on Salt Spring Island. Our three-day meeting, trust council participated

[0:03:45] Voice 6: in a strategic planning workshop to develop our plan for 2025 and 2028.

[0:03:52] Voice 6: The session followed an initial workshop we participated in in March. That's where we set

[0:03:59] Voice 6: our priorities the workshop was open to the public ensuring the transparency and community involvement

[0:04:05] Voice 6: and i believe that trustees found some great synergy during these discussions we also approved

[0:04:13] Voice 6: the audited financial statements for the year ending march 31st 2024 these statements show

[0:04:20] Voice 6: an annual surplus of $414,192. The surplus is thanks to increased grant revenue and some

[0:04:31] Voice 6: unspent budgeted funds. This strengthens our financial position and allows us to

[0:04:38] Voice 6: invest in future community projects. We also recognize the retirement of our CAO,

[0:04:45] Voice 6: Russell Keller, and we thank them for his eight years of service.

[0:04:50] Voice 6: Julia Lotz will serve as the intern chief administrative officer while we search for a permanent CAO.

[0:04:57] Voice 6: The Adams Trust chief administrative officer hiring committee is working on this, and it's expected to announce a new CAO later this year.

[0:05:06] Voice 6: uh lastly uh but not least i would like to thank uh carly bilney for taking on the role of secretary

[0:05:13] Voice 6: of the galliano island advisory planning commission uh if any community members are

[0:05:42] Voice 10: When I first saw the agenda, I noticed it was at North End Hall, and I was worried

[0:05:45] Voice 10: that I was not going to be able to find my way up here, and lo and behold, this morning

[0:05:50] Voice 10: we got a yellow line all the way to here.

[0:05:56] Voice 10: Some success on some of the work

[0:05:58] Voice 10: that we're doing with modi it was good to see that i think it's been close to 10 years since

[0:06:02] Voice 10: we've had that yellow line and i was it was a weird feeling this morning when i was on my way

[0:06:07] Voice 10: to the coffee shop because uh for some reason the road seemed wider no idea why it shouldn't seem

[0:06:14] Voice 10: that way but it did so um good to see that uh the second thing is um we've received um sort of

[0:06:21] Voice 10: contractor estimates for parking at montague and now we're in the process of seeing where we can

[0:06:27] Voice 10: find that funding so there's a certain couple updates on um you know some moving it quite a

[0:06:33] Voice 10: quite a bit a few emails on regards to the parking done i want to do i see um we've had a unique

[0:06:38] Voice 10: local solution to the parking down there which all of the parking signs were painted black so

[0:06:43] Voice 10: i guess that solves that problem for a little while

[0:06:49] Voice 10: the other thing was uh i was i was honored to um about a week a little over a week ago

[0:06:56] Voice 10: to be invited to attend

[0:06:58] Voice 10: Connecticut Island and to sit down

[0:07:00] Voice 10: with the Chief of Council.

[0:07:02] Voice 10: I went up there with Jamie Harris, the Trustee from

[0:07:04] Voice 10: Salisbury Island, and it was

[0:07:06] Voice 10: you know, for me it was kind of neat

[0:07:08] Voice 10: because I don't know how many times

[0:07:10] Voice 10: living at the North End and fishing with Edmund Crocker

[0:07:12] Voice 10: and going back and

[0:07:14] Voice 10: forth through the cut, that's

[0:07:16] Voice 10: the first time I tied up at

[0:07:18] Voice 10: Connecticut Island. So it was

[0:07:20] Voice 10: a unique experience and

[0:07:22] Voice 10: it was just great to sit down

[0:07:24] Voice 10: with with the treatment council and have a discussion and talk about whatever so um it

[0:07:30] Voice 10: was great i i thank them for that thank them for the invite and i think that's that's pretty much

[0:07:36] Voice 10: it for me thank

[0:07:38] Voice 13: you for that um and for chair's report uh trustee gabriel mentioned we had uh

[0:07:44] Voice 13: trust council in june on salt spring island um there it was the 50th anniversary of the islands

[0:07:51] Voice 13: trust act and we did we welcomed some past island trust council chairs and former uh salt stream

[0:07:57] Voice 13: trustees as well um mla adam olsen presented uh to trust council on inclusive governance and the

[0:08:04] Voice 13: role and the future of the island's trust which i think was really well received by trustees

[0:08:09] Voice 13: um sadly we heard a couple weeks later that he's announced he's not going to run again

[0:08:14] Voice 13: in the fall election and we know he'll be missed because he has been a strong advocate for the

[0:08:19] Voice 13: islands um also trust council we had a presentation from um ryan greville the manager of the national

[0:08:28] Voice 13: waters protection transport canada speaking about the wreck and hazardous vessels act um

[0:08:36] Voice 13: quite interesting uh trust council appointed uh my fellow lusketeer trustee ronnie to transport

[0:08:43] Voice 13: transport canada's general vessels technical working group um trust council directed staff

[0:08:52] Voice 13: to explore options for making integrated spatial planning part of our strategic planning process

[0:08:58] Voice 13: um yesterday we held our second committee of the whole meeting uh which was shared by vice chair

[0:09:05] Voice 13: maude uh which involved in camera a meeting with legal counsel specifically around the um

[0:09:12] Voice 13: the draft updated version of the policy statement which is

[0:09:17] Voice 13: getting a little old ad i think it was 1994 when it was that version was brought in and uh

[0:09:26] Voice 13: just finally i've been part of the island's trust uh reconciliation learning group um

[0:09:32] Voice 13: reminded me of police of dropping the hoodie from the

[0:09:36] Voice 13: culturally committed group who's who's been uh

[0:09:40] Voice 13: the group's been working doing online community calls and workshops with first nations mentors

[0:09:45] Voice 13: and it's been it's been a really good experience of learning and listening and having the opportunity

[0:09:53] Voice 13: to hear some really powerful speakers on a range of topics everything from traditional food

[0:09:59] Voice 13: education to culturally cultural safety and the lack thereof for example within the health care

[0:10:06] Voice 13: systems really powerful speakers some really good connections there so that's been uh

[0:10:13] Voice 13: it's been an important and positive part of my personal journey um shout out to them there's

[0:10:21] Voice 13: lisa scott hey okay so i don't believe we have uh director brent with us today he would normally

[0:10:30] Voice 13: come next and so that brings us on to the section that we have set aside for the first nations

[0:10:36] Voice 13: report so i'd like to invite um g jack and your counselors um to address us or tell us anything

[0:10:44] Voice 13: you like yeah

[0:10:46] Voice 6: thank you thanks everybody absolutely i

[0:10:53] Voice 14: see you guys rolled up the yellow line for us

[0:11:00] Voice 6: and i felt like a celebrity coming in everybody um

[0:11:20] Voice 6: I just want to say my name is I'm newly elected chief since February of

[0:11:32] Voice 6: I'm from Penelakut Island. My grandmother was, her father was Peter Jack from Penelakut Island.

[0:11:41] Voice 6: Her mother was Cecilia Jim from Sycam and Cecilia's parents were from Semihama.

[0:11:50] Voice 6: My grandmother and my grandfather raised me growing up in Seattle, in Sycam.

[0:12:02] Voice 6: in victoria and all about and then i married an allocate full circle right back to my great

[0:12:09] Voice 6: grandfather's roots and um as i said newly elected as chief there i want to thank my council kenny

[0:12:19] Voice 6: and kurt for being here and we have what i call youth but our up-and-coming generation

[0:12:26] Voice 6: And I really am in a position and grateful to be chief of Connecticut and as I've stated

[0:12:38] Voice 6: to my council, this is our work moving forward.

[0:12:43] Voice 6: This is us jointly doing work together and that I really believe in order for us to prosper,

[0:12:51] Voice 6: for our communities our surrounding communities we need to work together as one what we call that's

[0:12:57] Voice 6: much following um in our language working together as one in harmony and i really believe that the

[0:13:05] Voice 6: partnerships with galliano with the town of germanus with lady smith and nine or surrounding

[0:13:12] Voice 6: communities is really important to be able to move our community forward in a way that

[0:13:20] Voice 6: That is good that our next generation and our next leaders to model that leadership to our younger generation so they're picking up the pieces and they can take it.

[0:13:34] Voice 6: Or as my grandma said, she said, we take care of you so you take care of us when we get older.

[0:13:40] Voice 6: And that's the philosophy I carry with me, the integrity of my grandparents and how they raised me.

[0:13:48] Voice 6: so we've had a discussion um at our table in regards to the islands trust and salt spring

[0:13:57] Voice 6: and galliano and um the direction that i come with from my council i wrote it down and i changed this

[0:14:08] Voice 6: i don't know how many times right up to the second that i left an allocate because i really wanted

[0:14:14] Voice 6: my statement to have meaning

[0:14:16] Voice 6: and my statement to

[0:14:20] Voice 6: carry the

[0:14:21] Voice 6: integrity of my grandparents

[0:14:22] Voice 6: who as I mentioned

[0:14:24] Voice 6: I carry with me

[0:14:28] Voice 6: so I'll just

[0:14:29] Voice 6: read this to you

[0:14:32] Voice 6: esteemed members

[0:14:33] Voice 6: of the community, landowners

[0:14:35] Voice 6: and representatives of the

[0:14:37] Voice 6: island trust

[0:14:38] Voice 6: I humbly come before you today as

[0:14:41] Voice 6: the chief of the people

[0:14:42] Voice 6: people entrusted by my council to deliver a message of utmost importance it is with great

[0:14:52] Voice 6: sincerity that I declare our unwavering interest in accepting the returns of land that rightfully

[0:14:59] Voice 6: belong to the Nalapik Mistimo. I have some of our Nalapik council here our youth here to bear

[0:15:10] Voice 6: witness to the voice of our ancestors to establish that galliano island to establish that galliano

[0:15:17] Voice 6: island which penelope mustimo and elders have long regarded as unseated canal territory

[0:15:25] Voice 6: this is an integrable integral part of our traditional homeland it's our inherent right

[0:15:31] Voice 6: as recognized under Article 10, Article 18, Article 19, Article 26 and 27 of the

[0:15:41] Voice 6: United Nations Declaration of Rights of Indigenous People, to reclaim what has

[0:15:47] Voice 6: been ours for generations. We're not here to oppose or to be pawns in any game,

[0:15:54] Voice 6: rather we come in the spirit of partnership, good faith, seeking to

[0:16:01] Voice 6: work alongside landowners islands trust to ensure that canalicate mustimo mustimo have a strong

[0:16:10] Voice 6: foundation and a foothold on our ancestral lands our goal is not to disrupt or cause conflict but

[0:16:21] Voice 6: to establish a foundation of understanding and cooperation we recognize the importance of

[0:16:29] Voice 6: of maintaining a harmonious relationship

[0:16:32] Voice 6: with all stakeholders.

[0:16:35] Voice 6: And it is in this spirit that we make our declaration

[0:16:39] Voice 6: as Penelaket Mestimok today.

[0:16:43] Voice 6: As chief of the Penelaket Mestimok,

[0:16:45] Voice 6: I assure you that we are committed to working together

[0:16:50] Voice 6: in a manner that respects the interests

[0:16:53] Voice 6: of all parties involved.

[0:16:56] Voice 6: We are ready to engage in open and constructive dialogue

[0:17:38] Voice 6: the Penelope Mestimo. I appreciate the flowers I'm ever so grateful and my grandma taught me

[0:18:01] Voice 6: humility and working together that was one thing that she always said she's a product of

[0:18:10] Voice 6: of the Indian hospitals.

[0:18:13] Voice 6: My grandpa's a product of the residential schools.

[0:18:16] Voice 6: And I had one grandparent that said to protect me,

[0:18:21] Voice 6: he didn't want me to go to school,

[0:18:23] Voice 6: but at the same time, he knew it was important.

[0:18:25] Voice 6: My grandma saying,

[0:18:27] Voice 6: go, you gotta learn how to walk in two worlds.

[0:18:32] Voice 6: And for that, I'm grateful that my grandparents

[0:18:35] Voice 6: have taught me that.

[0:18:36] Voice 6: my background is social work where I met Jane when I worked at Swamish Nation as a social worker.

[0:18:50] Voice 6: My undergrad was child and youth care, my graduate degree is social work. I'm currently

[0:18:55] Voice 6: working on my master's in linguistics, a secondary master's in linguistics and

[0:19:02] Voice 6: And so for that, I'm humbled to meet every one of you guys, and I'm humbled to have my

[0:19:10] Voice 6: council by my side.

[0:19:11] Voice 6: And I just want to state that this isn't my agenda.

[0:19:17] Voice 6: This is a directive from my council and my community, our elders.

[0:19:41] Voice 14: Thank you very much.

[0:20:06] Voice 15: and uh get together at least a few

[0:20:19] Voice 15: meetings because of

[0:20:19] Voice 14: scheduling and things you know i don't want to um talk again with my friends here

[0:21:52] Voice 11: The one concern I have is how far the Trust Council would go against this time in approving

[0:22:01] Voice 11: something like potential rezoning for a cidery type of operation that may be a decade into

[0:22:09] Voice 11: the future.

[0:22:11] Voice 11: I don't know whether or not you need to approve that as a basic tenant, or can you just approve

[0:22:20] Voice 11: something like that in principle until you get some more or more information

[0:22:27] Voice 11: especially information on the water resources. So if there, I don't know what

[0:22:37] Voice 11: staff thinks about that or can you approve something in principle or do you

[0:22:42] Voice 11: have to approve the totality of the application now before you in terms of

[0:22:50] Voice 11: telling them the violence okay

[0:22:55] Voice 13: thank you i

[0:23:01] Voice 3: counselors for coming over here and for your words i think they're very important and i think that

[0:23:09] Voice 3: it's this is a community ready here and

[0:23:20] Voice 4: My name is Suzanne and I've been a resident of the North End for 34 years,

[0:23:27] Voice 4: which is nothing compared to so many people in the room.

[0:23:30] Voice 4: I too would just like to acknowledge the Penelope Chief and House that I thank you so much for attending today.

[0:23:37] Voice 4: It means a very great deal to us.

[0:23:40] Voice 4: I am a member of the Galliano Conservancy which controls or manages about 1,250 acres

[0:23:49] Voice 4: on Galliano and we have spoken to Ken Thomas and we continue to.

[0:23:54] Voice 4: We have an Indigenous Relations Committee and we very much want to move forward and

[0:24:01] Voice 4: do the right thing with you.

[0:24:02] Voice 4: Things were not properly done in the past and even though we own or manage 1,250 acres,

[0:24:09] Voice 4: Not one single acre was ceded or surrendered in law by the Indigenous Entitled Owners.

[0:24:16] Voice 4: So we now accommodate Indigenous people with a hunting program that we're planning to expand to other properties.

[0:24:24] Voice 4: And we hope to have a relationship with Chief and Council going forward.

[0:24:28] Voice 4: So I just, with deep respect, thanks. Thanks for coming.

[0:24:49] Voice 10: we're that's the um that portion finished um there's nobody else um i just personally wanted

[0:25:13] Voice 10: time the time has come and um and there appears to be an appetite on everybody's side

[0:25:42] Voice 10: know the adoption of direct windows sort of things coming through the system um we're going to see a

[0:25:48] Voice 10: lot of changes in probably what we consider a very short period of time and um we really appreciate

[0:25:55] Voice 10: your words towards um cooperation and respect so i thank you for that uh

[0:26:15] Voice 11: because i think it is far it is very very worthwhile for all islanders to see that

[0:31:14] Voice 5: the LTC has received and there is also a recommendation there for the LTC's consideration. The application

[0:31:24] Voice 5: would be amend the land use by-law, Galeano land use by-law and the applicant has requested

[0:31:30] Voice 5: a number of proposed uses, and those are listed on page 11 of the agenda. That is a works yard, a contractor's workshop and yard,

[0:31:40] Voice 5: storage and sale of gravel, soil, and abrogates, sawmilling, cleaning, and manufacturing of wood products, and the production and sales of cider, beer, and wine.

[0:31:51] Voice 5: This is approximately an 8 hectare parcel and it's currently zoned rural too.

[0:32:00] Voice 5: The applicant is currently using the land for farm use, especially tree or fruit tree

[0:32:09] Voice 5: farming and has a temporary sawmill.

[0:32:12] Voice 5: There's no dwelling unit on the lot but there is a driveway that bisects the property that

[0:32:20] Voice 5: access to the farm area and on the eastern edge of the property is a riparian stream

[0:32:28] Voice 5: and a wetland area. The applicant has provided a letter that's attached to the staff report

[0:32:36] Voice 5: and a rationale. The applicant is hoping to, if the application is successful, to have

[0:32:43] Voice 5: a phased approach with the proposed uses. Phase one would be the

[0:32:50] Voice 5: implementation to construct storage phase for the storage and sale of gravel

[0:32:58] Voice 5: soil and aggregates within three years and then potentially within one

[0:33:03] Voice 5: year a small-scale commercial sawmilling with that use increasing over a

[0:33:10] Voice 5: 10-year period. And then phase two, which would potentially be within 7 to 10 years,

[0:33:16] Voice 5: would be a cidery, and cidery would use the produce grown on the property. The applicant

[0:33:23] Voice 5: has provided a rationale stating that this application of proposed uses would allow for

[0:33:31] Voice 5: the continued operation of their excavation and septic business more efficiently. There

[0:33:37] Voice 5: There is currently a zoning scarcity for these proposed or these intended uses, so therefore

[0:33:44] Voice 5: that's why they're requesting these uses.

[0:33:48] Voice 5: Also, for the purpose of small, small, small milling on the property, it would be beneficial

[0:33:55] Voice 5: for Galliano, rather than taking the lumber off-island, to keep it on-island to process

[0:34:01] Voice 5: process those logs locally but also provide some job opportunities potentially or an economic

[0:34:07] Voice 5: boost.

[0:34:10] Voice 5: There is a site plan attached to page 13 of the agenda, please disregard that, that was

[0:34:15] Voice 5: an initial site plan and I mistakenly added that in, so you can disregard that site plan.

[0:34:22] Voice 5: In terms of the official community plan, the subject property is currently designated rural

[0:34:31] Voice 5: and those principal uses are residential and agriculture. So currently it doesn't

[0:34:37] Voice 5: highlight any type of light industrial uses so that's something the LTC has to

[0:34:41] Voice 5: turn their mind to. So an OCP amendment may be required. I did want to highlight

[0:34:47] Voice 5: some of the OCP policies that the LTC should be aware of. Those are that

[0:34:54] Voice 5: is policy 5.4c it states that light industrial uses shall be

[0:35:00] Voice 5: permitted through site-specific zoning and subject to a development permit and

[0:35:05] Voice 5: then it includes a number of guidelines the LTC may want to turn their minds to

[0:35:09] Voice 5: for resulting applications those are on page 15 of the agenda so that's

[0:35:14] Voice 5: something that we'd be highlighting or going over if the application proceeds

[0:35:18] Voice 5: seeds. Also, policy 5.4G, the LTC should consider implementing regulations that would limit

[0:35:27] Voice 5: noise impacts generated by industrial uses and activities. To date, we have received

[0:35:32] Voice 5: one letter from a neighbour, I don't know if it's direct neighbour, but a close neighbour

[0:35:38] Voice 5: to the subject property, and they have listed, or they've expressed concerns of potential

[0:35:42] Voice 5: noise so that's something that we also have to keep in mind as I mentioned

[0:35:49] Voice 5: previously the property is zoned rule 2 so land use bylaw amendment would be

[0:35:55] Voice 5: required to permit those light industrial uses and also the cider use

[0:36:02] Voice 5: the next step with the applications proceeds is for staff to draft a terms

[0:36:08] Voice 5: of reference and this is a letter that outlines items that the applicant needs

[0:36:16] Voice 5: to provide for the application to proceed and some of those items I've

[0:36:21] Voice 5: listed and the terms of reference can also include additional

[0:36:25] Voice 5: information but we'd be requesting a professional site plan, a groundwater

[0:36:32] Voice 5: water assessment and also an ecological overview report by RPBIO. There has

[0:36:39] Voice 5: there is a list of referral agencies and also First Nations that if this

[0:36:46] Voice 5: application proceeds we'd like to send out information to these agencies and

[0:36:51] Voice 5: First Nations for initial comments. I did receive an email from a staff member

[0:36:56] Voice 5: from the CRD and they've requested that the CRD integrated water service area

[0:37:02] Voice 5: and also the Southern Gold Island Community Economic Sustainability

[0:37:07] Voice 5: Commission be added to the list of agencies in this list. On page 18 of the

[0:37:15] Voice 5: staff report I've just highlighted some proposed impacts from the uses and

[0:37:24] Voice 5: And the LTC can read over those, but primarily the potential impacts of the noise and also any type of visual impacts.

[0:37:36] Voice 5: Those could be addressed by increased setbacks and also some type of vegetation requirement or landscaping requirements.

[0:37:46] Voice 5: In terms of the cidery use, there is a number of concerns as well.

[0:37:51] Voice 5: water use, we need further information on that, potential for increased traffic to

[0:37:57] Voice 5: the area, noise and other issues the LTC may want to consider. So staff have made

[0:38:05] Voice 5: the recommendation to, it's on page 11 of the agenda, the recommendation that the

[0:38:14] Voice 5: LTC direct staff to proceed with the application and to prepare draft

[0:38:18] Voice 5: bylaws. I just want to mention to the LTC that staff had made this recommendation

[0:38:24] Voice 5: as putting together draft bylaws allowed not only the LTC but stakeholders,

[0:38:30] Voice 5: agencies for stations and also the applicant to have an idea of what the

[0:38:34] Voice 5: zone could look like or what the OCP designation may look like and it's used

[0:38:40] Voice 5: as a foundation for discussion. So even though the LTC may put this motion

[0:38:44] Voice 5: forward it doesn't necessarily mean yes it's a green light it just continues

[0:38:49] Voice 5: that discussion the LTC may also consider other alternatives those are on

[0:38:56] Voice 5: page 18 of the agenda the first one is to request further

[0:39:02] Voice 5: information from the applicant so if the LTC believes they want to have further

[0:39:07] Voice 1: information

[0:39:07] Voice 5: before any type of draft bylaws are put together, there is a

[0:39:15] Voice 5: motion there the LTC could consider. The LTC may also consider sending this

[0:40:39] Voice 6: area and it is in proximity to a water service area too. So water is going to come up a lot

[0:40:58] Voice 6: Yeah, before I get into that, I had a question for Planner Stockville.

[0:41:16] Voice 6: With a 291 covenant, could that be used for seasonal restrictions on water pertaining

[0:41:24] Voice 6: to exterior maintenance of buildings, structures, landscaping, or including any car surfaces

[0:41:35] Voice 5: Absolutely, a section 219 covenant would be the perfect tool for that, where it goes beyond

[0:41:42] Voice 5: just regulating land use or density, generally LTC in the past has used section 219 covenants

[0:41:56] Voice 5: one thing the LTC can consider is also restricting any uses by a section 219

[0:42:13] Voice 5: ensure that there's not a detrimental impact of this use so section 219's

[0:43:24] Voice 5: important to receive these comments early in the process so the LTC has the

[0:43:29] Voice 5: ability to take those comments into consideration from the very start rather

[0:43:33] Voice 5: than later in the process when we're at public hearing we've done all that work

[0:43:37] Voice 5: and it's great for the applicant to also hear that as well so having a community

[0:43:41] Voice 5: information meeting would be a great idea and then specifically

[0:43:45] Voice 6: inviting those

[0:43:46] Voice 5: neighbors in that area because

[0:43:48] Voice 6: i'm kind of leaving that way i think the having the community aware of

[0:43:52] Voice 6: the scope i'm in the property i have a really uh pretty good idea that some of the details

[0:43:57] Voice 6: that maybe are not in the application but if the neighboring uh the community is more like i said

[0:44:05] Voice 6: aware of what what the whole scope of this project would be then it might be it might get more

[0:44:20] Voice 6: support i think overall and i think that might be a good way to proceed with perhaps a one house

[0:44:28] Voice 6: community permission meeting um because i think if the public is unaware of what

[0:44:34] Voice 6: how much water cidery cidery could use there might be speculation which might uh

[0:44:58] Voice 13: community information meeting is that correct we could have that before first

[0:47:29] Voice 10: of course is the BC Hydro transmission yard right so when I look at the use I go okay that this is

[0:47:39] Voice 10: actually this works right but then i you know as you sort of dig into the application a little bit

[0:47:48] Voice 10: you go okay what what is what is you know um production sale of cider and beer what does

[0:47:55] Voice 10: that look like right um is it you know small microbrewery or is it labatt's brewery right

[0:48:01] Voice 10: i mean it's there's a there's a lot of detail between those two right and so i think getting

[0:48:08] Voice 10: some direction from the applicant on on the uses but not just the uses but the

[0:48:13] Voice 10: siting of those uses as well would be extremely helpful so that we knew where

[0:48:19] Voice 10: the the gravel sales was so you could say okay is it is it sufficiently

[0:48:23] Voice 10: buffered is it how much increased traffic is that going to include are we

[0:48:28] Voice 10: bringing in gravel barges or things like that or is it for you know for

[0:48:35] Voice 10: the contractor's personal use in a sense for his business right um so there's there's a few details

[0:48:42] Voice 10: that that um i think the applicant could could definitely clarify um as we move ahead um like

[0:48:51] Voice 10: i said the location of this property and and the buffers around it certainly i have no problem with

[0:49:00] Voice 10: the the application in general it's just there's a bit of detail to go here

[0:49:06] Voice 10: certainly water issues around the production of beer I don't think it's

[0:49:12] Voice 10: you sort of looked at I looked up that difference between a cidery and a brewery

[1:00:45] Voice 5: There was an information webinar held in 2021 and also an in-person community information held in 2022.

[1:00:53] Voice 5: Since that time staff in the LTC have been working on tweaking the bylaws and there is

[1:01:01] Voice 5: a list or sorry a summary of bylaws 284 and 283 in the agenda.

[1:01:12] Voice 5: One amendment that I want to highlight is exemption P and that would be an exemption

[1:01:20] Voice 5: exemption that would not require a development permit, where land owned by a person with

[1:01:27] Voice 5: federal Indigenous status living in their traditional territory with proof of Indigenous

[1:01:33] Voice 5: family lineage. Staff have met initially with the Penelakut tribe, also the Coast Salish

[1:01:39] Voice 5: peoples of Galliano, and also members of an Indigenous family with historical and cultural

[1:01:44] Voice 5: cultural ties to Gamayano Island and staff feel like it may be the time to send out those

[1:01:50] Voice 5: formal referral of requests so we can get those formal comments not only from nations

[1:01:57] Voice 5: but perhaps sub-agencies too, specifically the CRD as they had some questions. Staff

[1:02:06] Voice 5: have recommended a public hearing to be scheduled for September 10th 2024 but thinking more

[1:02:14] Voice 5: more on that, staff would recommend perhaps scheduling the public hearing for the October

[1:11:39] Voice 8: So I think it's not a good policy to have land together, not only in this application, but in any application.

[1:12:52] Voice 8: hearing, say something. So there is no reason for the community information meeting.

[1:12:58] Voice 8: Not together with the public hearing. That's what I think. I would like to have the community

[1:13:04] Voice 8: information, but I would like it before. Because when you have the public community information,

[1:13:11] Voice 8: information. You don't only listen to your questions, you listen to what are the other

[1:13:16] Voice 8: concerns of other people in the public, in the residence. So you listen to that concern,

[1:13:23] Voice 8: you notice that other people have the same concerns, the same lack of knowledge that

[1:13:30] Voice 8: one has, or many of the same, in order to make it work. I understand that practically

[1:13:42] Voice 8: Practically for you it's better, the two children are done, for the local trust committee, for the staff, but I don't think it's better for us, the resident project.
