[0:00:12] Voice 8: to gather today in locations across the territory of the coast salish people we respectfully

[0:00:18] Voice 9: acknowledge that hornby island is the unceded traditional territory of the komox first nation

[0:00:24] Voice 8: the traditional keepers of this land of course coming up to the end of the month we have the

[0:00:31] Voice 8: national day of recognition orange shirt day and uh we know with our now that we're building

[0:00:40] Voice 8: relationships specifically especially with the comox nation but other nations

[0:00:49] Voice 8: respecting the long history of first nations people on hornby and islands all throughout

[0:00:55] Voice 8: the island's trust area my

[0:00:58] Voice 9: name is tim peterson i'm elected on the skidi island and i'm the chair

[0:01:04] Voice 8: with me today are local trustees alex allen

[0:02:01] Voice 8: okay uh this meeting is an official forum for your local trust committee to make decisions

[0:02:09] Voice 8: about family use planning matters and to discuss relevant business and i also want to add that

[0:02:14] Voice 8: this is a place of employment and despite fact some staff may be in their homes our staff have

[0:02:19] Voice 8: have a right to a safe and respectful workplace.

[0:02:24] Voice 8: So with that, we have an agenda before us,

[0:02:29] Voice 8: and I'll just look to trustees to see if there's any

[0:02:33] Voice 8: amendments to the agenda today.

[0:02:35] Voice 8: I see the business.

[0:02:37] Voice 8: Okay, what do you want to call it?

[0:02:41] Voice 8: An advocacy letter for the foreign land trust

[0:02:44] Voice 8: and Marilyn Manson's here representing the foreign land

[0:02:53] Voice 8: trust and she's asking that she can go ahead because she said okay well maybe we can hear

[0:03:00] Voice 8: from her when we're going to hit the public comments shortly here so let's add that

[0:03:08] Voice 8: under new business at 11.3 and i'll just mention there's a couple items

[0:03:14] Voice 8: depending on how long we run and how much we discuss there's a couple things that we might

[0:03:20] Voice 8: considered referring um today to another meeting uh possibly 9.1 and 11.1 may not be as time

[0:03:30] Voice 8: sensitive as some of the others so we'll just keep that in mind as we go along and other than that

[0:03:36] Voice 8: i'll take it by general consent we'll approve the agenda as amended and start our trustee reports so

[0:03:44] Voice 8: So we'd like to go first.

[0:03:46] Voice 8: I have just a little wee one because I haven't done much since last week.

[0:03:54] Voice 8: I'm on the Trust Programs Committee and we're going to be doing some more stewardship webinars

[0:04:02] Voice 8: based on what farmers have wanted to see and learn about.

[0:04:08] Voice 8: So we're going to be doing one on living with fire and saltwater intrusion and really based

[0:04:14] Voice 8: the species and native plant and um i actually sent a lot of our local um we have a lot of people

[0:04:25] Voice 8: that know a lot about these plants and fires and whatnot sort of forwarded fire chief and

[0:04:33] Voice 8: the basic community so they might be part of these webinars too so those will be coming

[0:04:38] Voice 8: the new

[0:04:39] Voice 6: year because

[0:04:41] Voice 8: everybody i remember everybody would like to win willing and

[0:04:43] Voice 8: shoe boat is the um the water report groundwater was well received and hopefully these webinars

[0:04:50] Voice 8: will be well received so um before people when we get closer to launch so that's why

[0:04:57] Voice 8: thank you uh one issue that's on the island is the uh controversy over the 3d park and uh

[0:05:08] Voice 8: And I supported what they've done in parts of it, but I thought it would be a really good solution to what's going on.

[0:05:19] Voice 8: They are cutting it down from 160 to 120 sites.

[0:05:24] Voice 8: They're putting 40 of them on the other side of the road.

[0:05:29] Voice 8: And there's one thing that I think people are missing is that that's a BC park.

[0:05:37] Voice 8: it's for the use and benefit of the people of british columbia it's not a country it's not a

[0:05:42] Voice 8: conservancy it's not to be not logged not used but a park you don't log it apart but so i think

[0:05:50] Voice 8: that's something that people are missing and i can i went to the open house i've read all five

[0:05:56] Voice 8: reports that dc parks did the environmental reports well where the wetlands are about

[0:06:03] Voice 8: probably the issues that were pertinent to what people they moved to and just seeing the people

[0:06:16] Voice 8: in the summer going up to the ringside the kids going they're going to have an ice cream the

[0:06:21] Voice 8: people go together we're going to have a a coffee and going down to the beach it's such a perfect

[0:06:26] Voice 8: location for the use and benefit of the people of the province to be able to come here you know and

[0:06:32] Voice 8: and i've been involved with conservancies up in the mid coast to bring their rainforest and i know

[0:06:37] Voice 8: what a conservancy is and i just think that's a perfect place to have that expansion to that park

[0:06:45] Voice 8: and it really isn't an expansion with people it's making them operate user friendly people are going

[0:06:49] Voice 8: to be able to push their bikes in there and they're going to be able to push walkers in there

[0:06:54] Voice 8: and that's that's why those trails are you know and it sounds like a terrible amount of gravel

[0:06:59] Voice 8: but if you just look at the trucks that just went in recently, they wouldn't do a great lot of

[0:07:05] Voice 8: gravel in there it takes a lot of gravel to do these things so it kind of saddens me that there's

[0:07:10] Voice 8: that sign on the road that says protect tribute park from bc parks because i just find that's

[0:07:17] Voice 8: that's a real travesty on what hard work people you know you go to that open house you see all

[0:07:20] Voice 8: those young people from bc parks i mean they really do love what they're doing and love

[0:07:26] Voice 8: of Eastern Park.

[0:07:27] Voice 8: So anyway, it's a controversy on the island.

[0:07:30] Voice 8: I understand that there's big trees in there,

[0:07:32] Voice 8: but the reason the big trees are left in there

[0:07:35] Voice 8: is because it's never, they were there

[0:07:37] Voice 8: because of one reason only, it's been logged twice.

[0:07:41] Voice 8: They're there because they're rotten

[0:07:43] Voice 8: or there's something wrong with them.

[0:07:44] Voice 8: So those big old down in the square trees

[0:07:46] Voice 8: are great to see, they're great there,

[0:07:48] Voice 8: but the cedar and the hemlock,

[0:07:50] Voice 8: and the, not the hemlock, the cedar and the balsam

[0:07:53] Voice 8: that are in there are very stressed

[0:07:54] Voice 8: from right and that's the ones you kind of take up they don't kind of take money and they don't

[0:07:59] Voice 8: go through there and put the trails in with the space so i i think it's a compromise i

[0:08:05] Voice 8: think it's not perfect i think there's some other things they could have done but i think it's a

[0:08:08] Voice 8: really good solution so can we leave it at that okay thank you next is chairs report so uh was

[0:08:17] Voice 8: mentioned on august 22nd press council met uh as committee of the whole to further consideration

[0:08:24] Voice 8: to the draft policy statement, which we're reviewing.

[0:08:29] Voice 8: Trustee Allen mentioned the webinars coming out of the Trust Programs Committee.

[0:08:34] Voice 8: The Governance Committee met Monday and advanced a request for decision

[0:08:41] Voice 8: to Trust Council regarding a request to the province for a review of Lyons Trust.

[0:08:49] Voice 8: The Chief Administrative Officer Hiring Committee continues to meet

[0:08:54] Voice 8: and work on this uh selection of candidates for the job um winning the numbers though got actually

[0:09:02] Voice 8: a really good response i think uh hiring the um hiring the uh the search firm so it was a good

[0:09:10] Voice 8: idea we had really high caliber uh candidates and in fact winning those numbers down hasn't been as

[0:09:16] Voice 8: easy as it

[0:09:17] Voice 8: might have been but uh really good caliber candidates i'm confident we'll come up

[0:09:23] Voice 8: with uh uh good choice in the end that committees formed of uh all of the executive committee and

[0:09:30] Voice 8: and all the uh chairs of all the council committees um executive committee met

[0:09:38] Voice 8: this week mostly focused on preparation for the september council meeting in two weeks

[0:09:45] Voice 8: um we uh requesting the trust council establishes a chief administrator officer

[0:09:51] Voice 8: officer performance evaluation policy and trust council is going to publicly revisit

[0:09:57] Voice 8: the interpretation of the islands trust act section three and uh we will go into the whole

[0:10:07] Voice 8: or another session on the policy statement review for that meeting executive committee

[0:10:12] Voice 8: also spent some time this week in preparation for the union bc municipalities convention

[0:10:18] Voice 8: next week we'll be meeting with some ministry staff to match some of the

[0:10:26] Voice 8: advocacy positions that are important across the trust area and executive

[0:10:33] Voice 8: committee also requested staff to organize a way to take the ski

[0:10:38] Voice 8: archaeology project presentation trustees and staff find that very

[0:10:42] Voice 8: interesting, really amazing to see what the archaeological record shows in terms of the

[0:10:51] Voice 8: settlement patterns on Mesquite over a really extended period of time. That has been done

[0:10:57] Voice 8: right from the get-go in partnership with Indigenous partners from First Nations in the

[0:11:04] Voice 8: who have any interest in these parts so I'm not sure when that's going to roll up but

[0:11:11] Voice 8: I did get to see an earlier version of it it's really interesting really informative there

[0:11:18] Voice 8: we're looking at well the head archaeologist who lives on the ski but it's a SFU

[0:11:26] Voice 8: professor um they're looking at uh getting a first nations uh elder or or advisor to

[0:11:36] Voice 8: be part of the presentation and to be there for the question and answer section um so moving on

[0:11:43] Voice 9: uh next we have the public comment um section let's remind members of

[0:11:50] Voice 8: the public to

[0:11:51] Voice 8: speak to the issues not personalities um use respectful language and to please keep your

[0:11:59] Voice 8: comments uh concise and to the point and i'll look for sure hands judith uh

[0:12:06] Voice 5: just listening to

[0:12:07] Voice 5: you we're going through a musical and a thing and i've been really noticing everybody's changing

[0:12:13] Voice 5: speaking at Victoria, Sam, and others and I think that's an issue here on Hornby Island

[0:12:22] Voice 5: and I would like to see that looked at at that meeting if you don't mind saying thank you very

[0:12:27] Voice 5: much.

[0:12:28] Voice 8: Yeah I don't think we got that meeting with um with uh minister of transport but that's

[0:12:35] Voice 8: certainly something that the local trust committee could consider some advocacy around.

[0:12:39] Voice 5: I have learned

[0:12:40] Voice 5: one thing that the municipal level

[0:12:42] Voice 5: has a say, and that's

[0:12:44] Voice 5: what Victoria and Sam and all of them

[0:12:46] Voice 5: are saying. They have the right

[0:12:48] Voice 5: to change the limit, which I've always

[0:12:50] Voice 5: been told that isn't the case,

[0:12:52] Voice 5: but it actually is.

[0:12:53] Voice 5: It wasn't from you guys.

[0:12:56] Voice 5: Yeah,

[0:12:57] Voice 9: well, and of course

[0:12:59] Voice 9: municipalities

[0:13:00] Voice 9: have certainly more

[0:13:02] Voice 9: control over

[0:13:04] Voice 8: roads than we do as

[0:13:06] Voice 8: Island Trust.

[0:13:09] Voice 5: Yeah,

[0:13:10] Voice 8: no, for sure. And I would just also mention that I know parts of Salt Spray are

[0:13:18] Voice 8: looking at reducing their speed limits because people are just roaring into the Ganges corner

[0:13:25] Voice 8: at these crazy rates of speed. So they're trying to spread the slower speed out a little

[0:13:31] Voice 8: bit further on each side. So I think that's a worthy consideration.

[0:13:34] Voice 8: direction. Anyone else?

[0:13:38] Voice 7: Oh, yeah, yeah, sure. Great. Great.

[0:13:41] Voice 7: Okay, I'm here representing China. You know, I'm

[0:13:46] Voice 7: representing

[0:13:47] Voice 7: the Farmland Trust Society. And just a little background, you

[0:13:50] Voice 7: probably already know about the building that's being erected on

[0:13:53] Voice 7: Solon's Road at 1350. And basically, it is a what I'm

[0:14:02] Voice 7: looking for, we're looking for support because we're going for

[0:14:05] Voice 7: grant that's going to complete that building. Right now it's almost locked up

[0:14:10] Voice 7: and what we're

[0:14:12] Voice 7: looking for is support to actually furnish it and actually bring it into production what it's

[0:14:17] Voice 7: supposed to be and what it is supposed

[0:14:18] Voice 7: to be is it's supposed to be something that's going to

[0:14:23] Voice 7: help we're calling it the shed after really this whole the idea of saving a food shed just if you

[0:14:30] Voice 7: want to save a you know you want to maintain a a vibrant watershed we want to maintain a vibrant

[0:14:38] Voice 7: food shed here on harvey island um and part of that would be in um it was going it's going to

[0:14:43] Voice 7: operate for goal is for it to operate as a storage and um so on the main level will be a root cellar

[0:14:52] Voice 7: a seed by the seed saving library a resource center as well as um and there's five cold

[0:14:59] Voice 7: cold rooms for storing food in different temperatures, as well as a curing room for people who want

[0:15:06] Voice 7: to do salami and meat curing.

[0:15:10] Voice 7: And then also on that level, we're anticipating having more equipment that would extend the

[0:15:17] Voice 7: lack of food, such as dehydrators, a vacuum sealer, and a walk-in freezer.

[0:15:21] Voice 7: And this is going to be available for the community to use for food printers and also

[0:15:28] Voice 7: for local farmers and gardeners.

[0:15:32] Voice 7: Then on the upper level, the plan is to create a commissary kitchen that will be for use

[0:15:38] Voice 7: for the, there's quite a few, really a sufficient commercial, you know, health board regulated

[0:15:48] Voice 7: related kitchen on Farm Redef, the local people who would like to be getting into food business

[0:15:54] Voice 7: and the caterers would, you know, are able to use at all times.

[0:15:57] Voice 7: So this is a project that we want, we're looking to do, and that would be as well as a place

[0:16:03] Voice 7: where we could have educational classes around food and workshops.

[0:16:10] Voice 7: And so it's going to require a bit of money.

[0:16:12] Voice 7: so we're going to find a way to read it and we would appreciate having the support of the local

[0:16:19] Voice 7: alliance trust on this that

[0:16:22] Voice 8: of course good questions now i just want to say it's really

[0:16:26] Voice 8: it's an exhibiting of what communities can do on their own grassroots level it's amazing

[0:16:32] Voice 7: you know the deaf and peter governance you guys are just great well we are and what we

[0:16:37] Voice 7: interesting is like the last board they've worked their tails off gary mancer he was the spearhead

[0:16:43] Voice 7: of the project with several other board members they have since retired other than um one of our

[0:16:49] Voice 7: board members i think is walking on to be the transitional guy and then there's um myself who

[0:16:55] Voice 7: comes from a food back catering food background food industry built restaurant built gave commercial

[0:17:00] Voice 7: kitchens before background as

[0:17:03] Planner Zupanec (probable): well as an architect

[0:17:04] Voice 7: kathleen roman who's well well placed in the

[0:17:07] Voice 7: the organization, Sheila McDonald, and Jamie McVitie, who's also in the food industry to

[0:17:13] Voice 7: take this to the next level. And so in order to, we've also, yeah, yeah, so we're working

[0:17:20] Voice 7: hard at that, and we just really, really appreciate that support.

[0:17:23] Voice 8: Very much appreciate your support in this community-wide effort.

[0:17:37] Voice 7: um it's the well the grant the funding that we're going for is um the regional economic

[0:17:45] Voice 7: diversification and development piece and i could send you all i could send you i'll send

[0:17:57] Voice 7: who was committing okay but can i just um is there a timeline yes

[0:18:02] Voice 7: yes um well we're actually

[0:18:05] Voice 7: going for other funding too like little pieces there's like united way is really interested in

[0:18:10] Voice 7: funding climate change um food security through climate resilience and so we're thinking you know

[0:18:17] Voice 7: one of the programs we're looking at for that for small funding united way would be to do a rainwater

[0:18:22] Voice 7: collection and system that because currently there's a well i should imagine this because

[0:18:28] Voice 7: this land was donated was given to the farmland trust to use by a um a um it was by a man named

[0:18:37] Voice 7: donnie bears who passed away and this is and then what was created was a beautiful community garden

[0:18:42] Voice 7: where people come and they there's quite about there's about 50 plots there now and it's um

[0:18:47] Voice 7: currently right now they're operating off of the water from the well as well as the pond it's a

[0:18:52] Voice 7: pond where i have to use the well water but what we're wanting to do is create a separate system

[0:18:56] Voice 7: for the garden that is rainwater and so that's we're going to go for the underweight grant for

[0:19:01] Voice 7: that we're just kind of piecing up all these little funding opportunities yes could you draft

[0:19:07] Voice 8: the letter yeah

[0:19:08] Voice 7: i can drop the letter i can do some if you'd like it i can do point forms you

[0:19:11] Voice 7: could tweak it a bit i'm like you know just bullet points because i really you know i think if you

[0:20:42] Voice 9: and if there's multiple and they're different deadlines um maybe let us know what the first

[0:20:47] Voice 9: deadline is and then let us know when the other ones are coming up and then we can if we didn't

[0:20:52] Voice 8: need to send out more than one copy address to different agencies we could do that okay

[0:20:56] Voice 7: and you could actually send us we'll attach them to our office sure absolutely

[0:21:09] Voice 8: end of september it's better than the point of development but it's for a federal application

[0:21:14] Voice 8: for a self-perpetuating uh 360 day a year greenhouse that could allow us to grow

[0:21:24] Voice 8: veggies for example 12 months a year right into the donny fair's farm cool that sounds like a

[0:21:31] really exciting project okay

[0:21:33] Voice 8: so i'm the salon as if there's

[0:21:36] Voice 8: anybody else that wants to address the

[0:21:38] Voice 8: local trust committee today your folks just

[0:21:40] Voice 11: a question um

[0:21:40] Voice 5: when you're talking about the project

[0:21:43] Voice 5: looking at the settling patterns on the sea is there something for harvey coming up is it

[0:21:48] Voice 5: something oh

[0:21:49] Voice 9: in terms of the archaeology um i know that the uh the head archaeologists there

[0:21:58] Voice 9: have done a couple different ones and i think that this one i was just talking about is intended to

[0:22:05] Voice 9: be for trustees and staff um and sort of interface with the local government responsibilities and

[0:22:13] Voice 9: stuff so i don't think this will be open to the public but i will check with with dana and find

[0:22:17] Voice 9: out if she's got more public facing ones when

[0:22:20] Voice 11: the same kind of project right and

[0:22:25] Voice 9: i know in terms of

[0:22:26] Voice 9: the actual archaeological work um it takes some time i i know that she has done uh archaeology

[0:22:35] Voice 9: with other first nations in bc i'm not aware um what her next or next projects are specifically

[0:22:44] Voice 9: but i also know there's uh for example i know komox's has an archaeologist and i'm not sure

[0:22:50] Voice 9: where

[0:22:51] Voice 8: they're at. I'll do a little looking and digging into that.

[0:22:54] Voice 6: I had a dialogue with Jesse

[0:22:56] Voice 6: Warren,

[0:22:57] Voice 8: the archaeologist from KFC last term and then COVID and everything else got in the way and

[0:23:04] Voice 8: so it's been on hold but I'm definitely not bringing it up again because he was going to

[0:23:09] Voice 8: he was going to do he's already on

[0:23:11] Voice 8: board. And is that a trust initiative project or

[0:23:14] Voice 8: is it the archaeologist has kind of said oh we'll do this? It's a bit of both yeah

[0:23:18] Voice 8: yeah because i think

[0:23:20] Voice 9: yeah and there may be within our within our reconciliation plan there may be

[0:23:26] Voice 9: some funding available for that kind of

[0:23:28] Voice 8: thing like to put on our errands and stuff so if they've done

[0:23:31] Voice 8: a lot of the work we might be able to you know pass resolutions and request funding to you know

[0:23:37] Voice 8: sort of pay for them to do the presentation type thing but i'll look into that yeah

[1:06:36] Planner Zupanec (probable): At this time, the issues are cross-jurisdictional, and it makes a lot of sense to be discussing the issues that apply to both those islands at the same time versus separating them out the way we do with our projects and decision makings.

[1:06:49] Planner Zupanec (probable): So at all times, we're discussing issues that are relevant to both island local trust areas, just so you're aware.

[1:06:57] Planner Zupanec (probable): So the data sharing agreements have finalized, been finalized.

[1:07:26] Planner Zupanec (probable): So that they were able to spend the time on the ground to determine the priority areas for both those islands and the mitigation options that they're looking for us to review as part of the OCP LUB review project so that when we finalize those recommendations with them and they come back to you, you are confident that those recommendations have been legally vetted and are implementable.

[1:07:51] Planner Zupanec (probable): So this paper is the first opportunity for them to formally provide you with their top

[1:08:48] Planner Zupanec (probable): chip program and chip is the acronym for the cultural heritage impacts uh permit that we

[1:08:55] Planner Zupanec (probable): administer in their support in um redirecting applicants to obtain when they're doing any land

[1:09:03] Planner Zupanec (probable): alterations on denman or hornby island so they've asked if they can attend your next meeting on

[1:09:09] Planner Zupanec (probable): November the 1st as part of that public presentation instead of doing it as a separate

[1:09:13] Planner Zupanec (probable): date or time that perhaps because this is recorded it's then accessible available to anybody on the

[1:09:20] Planner Zupanec (probable): island and they can duplicate the information specific to Hornby even though there's not a lot

[1:09:26] Planner Zupanec (probable): of subtle nuances for them to sort out there it's very relevant across their entire territory so

So we're trying to keep that dialogue open and flowing so that we can find short term solutions to that in our regional planning managers at the helm of that, because that's not actually within the scope of the project that I'm managing on your behalf.

[1:11:00] Planner Zupanec (probable): technical analysis of the heritage conservation areas tool in the local government act and how

[1:38:00] Manager of Bylaw Compliance and Enforcement: common stands and my recommendation would be to the local trust committee that they should

[1:38:07] Manager of Bylaw Compliance and Enforcement: consider adopting some amendment to their land use bylaw where it would explicitly state that

[1:38:15] Manager of Bylaw Compliance and Enforcement: the agriculture or farm stands are permitted you know put size limits on them and you know reduce

[1:38:22] Manager of Bylaw Compliance and Enforcement: the setback for them uh so that you know all this use this common use can be accommodated

 Has read reports and attended an open house about work being done in Tribune 
Bay Provincial Park and noted it is a provincial park not a conservancy, the plan to

create 160 new camping sites has been reduced to 120 sites, and tree removal will

Chair Peterson reported the following: 
 Trust Council Committee of the Whole continues to meet to consider draft Policy 
Statement revisions; 
 Governance Committee will be asking Trust Council to request a governance review; 
 CAO Hiring Committee working towards final stages of hiring process; 
 Executive Committee met to prepare for upcoming Trust Council meeting;  
 Preparing for Union of BC Municipalities conference during which Islands Trust will 
be advancing several advocacy items; and 
 Noted Lasqueti Archaeology Project work continues. 
3.3 Electoral Area Director's Report – none (Director Daniel Arbour sends regrets) 
4. PUBLIC COMMENTS 
 Member of the public stated they would like the topic of reduced speed limits addressed at 
the Union of BC Municipalities meeting. 
o Chair noted they will not be meeting with Ministry of Transportation and 
Infrastructure. 
 
 Member of the public, representing Farmland Trust Society spoke to work being done to 
build a food shed with food storage, root cellar, cold rooms, curing room, preservation 
equipment, seed-saving library, resource center, and commercial kitchen. The Society will 
be applying for various grants and requested support from the Local Trust Committee in 
application for funding with a deadline of September 29, 2024. 
o Trustees expressed support for the project and asked the speaker to draft a 
letter and forward it to the Local Trust Committee and staff for vetting and 
signature. 
 
 Member of the public asked if there is an archaeology project happening on Hornby 
Island similar to the Lasqueti project.  
o Chair noted the project on Lasqueti is spearheaded by Simon Fraser University 
and results will be available for use by Islands Trust staff.  
o Staff noted that K’ómoks First Nation is currently undergoing an extensive 
archaeological project on Hornby which will likely  inform the LTC’s OCP/LUB 
Major Project in some capacity; more information will be available as it is known 
and at K’ómoks’ direction.

 Original covenant required a green roof on all of the buildings; 
 Applicant could not install a green roof on the wood structure due to insurance 
reasons but could increase the amount of green roof installed on the other 
structures;  
 Area of the development site where a pub and restaurant are to be built is directly 
on top of the archeological site; and 
 The archeological research work likely needs to be completed before the applicant 
can look at building in that area.

the next fiscal year if they remain unspent;  
 Trust Policy 6.5.2 allows a Local Trust Committee discretion to reallocate funds; and 
 Funds could be reallocated to the current Official Community Plan and Land Use 
review project to enhance technical and legal review aspects with First Nations.

Nations, and take all necessary steps to execute the reallocation of funds.

11.2 Land Use Bylaw Setback Regulations for Temporary Farm Stands - Verbal Discussion - 
Warren Dingman, Manager of Bylaw Compliance & Enforcement  
Bylaw Compliance & Enforcement Manager Dingman provided the following 
information: 
 Hornby Island Land Use Bylaw does not provide any regulations permitting farm or 
produce stands; 
 Other Local Trust Committees’ Land Use Bylaws permit farm stands; 
 Farm stands are considered a structure that would be required to be set back from a 
lot line unless there is an exemption in the Land Use Bylaw;  
 Director of Planning Services indicated a farm stand would be a minor contravention 
of the Land Use Bylaw and there would be no interest in enforcement of said 
contravention; 
 Stands would need to be located on an actual lot and not within the Ministry of 
Transportation and Infrastructure right of way; and 
 The Local Trust Committee might choose to consider allowing use and establishing 
setbacks. 
 
Discussion ensued and Trustees asked whether this item can be included in the Land 
Use Bylaw review project. The Planner clarified it would need to be included in the 
project charter and added to the in-scope items. Bylaw Compliance and Enforcement 
Manager Dingman indicated the Local Trust Committee could consider a standing 
resolution deferring enforcement on produce and farm stands until such time as the 
Land Use Bylaw could be amended.

13.1 Active Projects Report dated September 6, 2024 
The Planner provided a verbal update and highlighted the following: 
 Regional planning team met with K’omoks First Nation staff on September 11; 
 Issues discussed are relevant to both Hornby and Denman Local Trust Areas as 
issues are cross-jurisdictional; 
 Data sharing agreement has been finalized; 
 Local Trust Committee has received confidential report written by the archeologist 
and K’omoks First Nation staff on mitigation of impacts on cultural heritage sites on 
Denman and Hornby Islands and this report identifies priority areas of mitigation 
options; 
 K’omoks First Nation are hosting a presentation and question and answer period 
with the Denman Island Conservancy group in November and staff are working on 
dates for K’omoks First Nation to provide a similar presentation to both the Denman 
and Hornby Local Trust Committees at their next regular business meetings; 
 Staff are working on a technical analysis of the provincial heritage conservation 
legislation and will be providing a summary on how this tool could work at the local 
government level; and 
 Capacity funding that was provided to K’omoks First Nation has been instrumental 
in bringing the parties to the table to allow for open dialogue and workflow. 
 
The Planner provided the following information in response to questions from Trustees: 
 Place signage at Buckley Bay can be added to the list of discussion topics with 
K’omoks First Nation for consideration of prioritization; 
 Other issues identified in the Official Community Plan review project, such as 
housing and short-term vacation rentals, have been sent to agencies for referral; 
 Regional Planning Manager is looking into Community to Community funding to 
coincide with work being done with K’omoks First Nation and will be reporting 
details back to the Local Trust Committee.
