[0:00:17] Voice 7: skidi island i'm the chair of the galliano ltc and with us today our local trustees ben maverly
[0:00:25] Voice 7: Lisa Gavreau, our planner Tim Stockdale, and online is our meeting administrator Lisa Millard.
[0:00:34] Voice 7: I want to begin our meeting today by acknowledging that we're grateful to be gathering today
[0:00:39] Voice 7: in the territories of Coast Salish peoples and specifically here in the territory of the
[0:00:45] Voice 7: Connecticut Tribe, the keepers of these lands and waters since time immemorial.
[0:00:52] Voice 7: First Nations Leadership Council released a priorities paper on the United Nations Declaration Act National Action Plan in May of 2023, and I'm going to quote from it here.
[0:01:08] Voice 7: While all First Nations in Canada have been subjected to oppression and colonization, some of the historic expressions of colonization have been distinct in different regions.
[0:01:19] Voice 7: Most fundamental in this regard is that, unlike much of Canada, in British Columbia there are few treaties.
[0:01:26] Voice 7: The pre-Confederation treaties on Vancouver Island, part of Treaty 8, and a handful of modern treaties.
[0:01:33] Voice 7: Given this reality, in British Columbia, a primary focus of First Nation-Crown relations has been, and continues to be,
[0:01:40] Voice 7: completing the unfinished work of structuring proper relations that respect First Nation sovereignty,
[0:01:45] Voice 7: sovereignty, including their governments, laws, jurisdiction, and inherent title and rights.
[0:01:52] Voice 7: This necessarily requires some different actions and approaches than the work that is required in
[0:01:58] Voice 7: other areas of Canada. That's just some context from the First Nations Leadership Council on
[0:02:03] Voice 7: situations here in BC. Land and territory acknowledgements are important today because
[0:02:11] Voice 7: colonialism is not just a historical problem it's an ongoing and present day first nations title
[0:02:17] Voice 7: although recognized in canadian law has yet to significantly shape first nation canadian
[0:02:24] Voice 7: relationships in many areas um encourage you to pursue further education in pre-colonial first
[0:02:31] Voice 7: nations first first nations culture the exploitation of first nations people through
[0:02:37] Voice 7: colonialism and the structured oppression enacted through the indian act and the 500 plus years
[0:02:44] Voice 7: of first nations and indigenous resistance to colonialism that is still very active
[0:02:48] Voice 7: across canada and internationally and so with that i will turn to our agenda today
[0:02:57] Voice 7: um trustees anything to amend the agenda with
[0:03:01] Voice 9: nothing
[0:03:03] Voice 7: okay not seeing any i'll take it by
[0:03:06] Voice 7: general consent to adopt the agenda as presented and uh the next section is trustee reports who'd
[0:03:13] Voice 7: like to go first lisa thank
[0:03:16] Voice 5: you everyone uh november 8th is national indigenous veterans day
[0:03:22] Voice 5: uh day of remembrance and commemoration for the contributions of indigenous veterans to the first
[0:03:28] Voice 5: second world wars and the korean war uh indigenous veterans day on on this day we'd like to express
[0:03:34] Voice 5: our gratitude for the contributions indigenous veterans have made to the world and thank you for
[0:03:42] Voice 5: everything. I'm quite sad to share the news that Murray Sinclair, former senator and judge, has
[0:03:51] Voice 5: passed away, aged 73, after months in the hospital. Murray made
[0:03:56] Voice 5: history in 1988 as Manitoba's first
[0:04:00] Voice 5: Indigenous judge and went on to lead the Truth and Reconciliation Commission, bringing Canada's
[0:04:08] Voice 5: residential school legacy into the light and urging a nation to face it. That's changed that conversation
[0:04:15] Voice 5: in Canada and has inspired so many. Marie Sinclair's legacy of courage and compassion
[0:04:23] Voice 5: will not be forgotten. Rest in the power of Justice Sinclair. The sacred fire has been lit in the
[0:04:29] Voice 5: in the Manitoba legislature.
[0:04:33] Voice 6: In other
[0:04:33] Voice 6: news, the Alex
[0:04:34] Voice 5: Trust has announced
[0:04:35] Voice 5: that Ruben Lebroni, is that right?
[0:04:39] Voice 5: Has been hired as the new CAO of the Alex Trust.
[0:04:42] Voice 5: He comes to position from many years
[0:04:45] Voice 5: of executive experience within the provincial government.
[0:04:49] Voice 5: Most recently, he's the Assistant Deputy Minister
[0:04:52] Voice 5: with the DC Public Services Agency.
[0:04:56] Voice 9: We have been
[0:04:57] Voice 5: fortunate for the past month
[0:05:00] Voice 5: to have our Director of Administrative Services, Julia Hobbs, as Interim CAO.
[0:05:07] Voice 5: She has done an amazing job covering both of those roles for this period.
[0:05:15] Voice 5: It's been a very busy week for me.
[0:05:17] Voice 5: I attended a Governors Community Meeting on Tuesday, I had one session of the Community
[0:05:23] Voice 5: Level Meeting for the Trust Council to discuss the Trust Policy Statement and the project.
[0:05:28] Voice 5: and then last night i had the inaugural meeting for the accessibility committee
[0:05:34] Voice 5: lastly i wanted to highlight that our coming trust council meeting the beginning of december
[0:05:39] Voice 5: and victoria will begin discussions around the 2025-26 budget so it's a good time to begin
[0:05:46] Voice 5: thinking about an honest one with the trustees or the trust council um you could always reach
[0:05:52] Voice 5: me during my office hours which are monday from 9 12.
[0:05:58] Voice 4: thank you trustee gabriella thank you um
[0:06:01] Voice 4: yeah i was going to give a shout out to murray sinclair as well um i think if you look at the
[0:06:07] Voice 4: work that he did with the truth and reconciliation commission and all of the things that advanced
[0:06:13] Voice 4: from that process to today um he's going to be missed it was a big fog in that wheel and
[0:06:20] Voice 4: And so thanks, Lisa, for that.

[0:06:26] Voice 4: The only thing I will say is I attended over the last couple of weeks
[0:06:30] Voice 4: a couple of little floodings and both certain snatches,
[0:06:35] Voice 4: they were due to clogged drainage.
[0:06:38] Voice 4: And what I would say is it's November.
[0:06:42] Voice 4: It's the wettest month of the year.
[0:06:45] Voice 4: And for anybody who's listening, get the gutters clean
[0:06:48] Voice 4: and make sure that your drainages are clean too.
[0:06:51] Voice 4: there's a lot of leaves have fallen in the last month and uh that was the reason for both of these
[0:06:56] Voice 4: or little floodings that had happened but uh so just for everybody to remember um for this month
[0:07:04] Voice 4: to make me get that stuff done apart from that i'm good thank
[0:07:09] Voice 7: you trustee maverly uh next up is the
[0:07:12] Voice 7: chair's report uh appreciate um both the local trustees uh recognizing uh passing up the very
[0:07:21] Voice 7: so claire um certainly a iconic figure in indigenous canada for sure and canada at large i
[0:07:29] Voice 7: think um let's see so and then trustee gavreau has covered uh the hiring of the new uh chief
[0:07:39] Voice 7: administrative officer um i just would reiterate what an excellent job our director of administrative
[0:07:46] Voice 7: services julian romps has done um covering that position at our own position over the last few
[0:07:51] Voice 7: months and uh mr brony is expected to start work at the end of this month so uh i believe we'll
[0:07:59] Voice 7: see him at december trust council um so we're all looking forward to that uh let's see what else i
[0:08:08] Voice 7: I wanted to mention the Southern Gulf Islands Forum,
[0:08:14] Voice 7: which had been originally convened by MLA Adam Olson.
[0:08:19] Voice 7: We had planned initially to have a November 12th meeting,
[0:08:25] Voice 7: but the new MLA Rob Bottrell,
[0:08:28] Voice 7: who's is gonna be sworn in on that day.
[0:08:32] Voice 7: So we're looking at different dates
[0:08:34] Voice 7: for the new round of the Southern Gulf Islands Forum.
[0:08:38] Voice 7: It's been, I think, very useful for me,
[0:08:44] Voice 7: especially in my role as chair of Salt Spring and Galliano
[0:08:48] Voice 7: local trust committees, to have a way to connect
[0:08:52] Voice 7: with both area trustees in the Southern Gulf Islands
[0:08:56] Voice 7: and the MLA and MP Elizabeth May.
[0:09:00] Voice 7: And we've had some good discussions, I think,
[0:09:02] Voice 7: ranging from uh everything from uh affordable housing marine issues um indigenous uh issues
[0:09:11] Voice 7: reconciliation marine um marine authority and lots of different stuff and i'm looking forward
[0:09:20] Voice 7: to meeting uh mla bottle and and i'm hoping that the the forum going ahead is is as good or maybe
[0:09:29] Voice 7: even better as that exchange of ideas and information across the three jurisdictions
[0:09:37] Voice 7: and that keeps going forward so we'll be looking forward to that either the end of this month or
[0:09:45] Voice 7: in december we haven't the new date hasn't been set yet because of the swearing in
[0:09:51] Voice 7: um yeah i also wanted to mention uh as it was reported in the driftwood the executive committee
[0:09:58] Voice 7: committee decided the October 30th meeting to remove video
[0:10:03] Voice 7: of September press council from the website
[0:10:06] Voice 7: over safe workplace concerns.
[0:10:11] Voice 7: I supported that resolution to remove the recording.
[0:10:14] Voice 7: I think it was the right thing to do.
[0:10:17] Voice 7: However, where executive committee really dropped the ball
[0:10:22] Voice 7: was getting notification to trustees and the public
[0:10:25] Voice 7: about that decision and providing a rationale.
[0:10:29] Voice 7: and uh um for my own part i apologize for for the failure to recognize and make sure that we
[0:10:38] Voice 7: did that um you
[0:10:40] Voice 7: know it's collective like i don't want to take responsibility for my part of that
[0:10:44] Voice 7: um we'll be having discussion about about that decision at december trust council for sure uh
[0:10:51] Voice 7: the
[0:10:51] Voice 9: recording
[0:10:52] Voice 7: of the september trust council meeting
[0:10:58] Voice 7: City. As Trustee Gavreau mentioned, Trust Council will be in Victoria in December, and
[0:11:06] Voice 7: in addition to discussing that decision of Executive Committee and covering the first
[0:11:12] Voice 7: draft of the 2026 fiscal year budget, there'll be a number of items that were deferred from
[0:11:17] Voice 7: September's meeting, including a strategic planning session and consideration on updating
[0:11:24] Voice 7: updating our code of conduct and so I'll leave that there for now and we'll move on with the
[0:11:32] Voice 7: rest of the agenda um don't believe we have uh our electoral area director is not here to report uh
[0:11:43] Voice 7: anything um for First Nations Court today
[0:11:46] Voice 8: everybody's away and busy fair
[0:11:50] Voice 7: enough we'll all
[0:11:53] Voice 7: All have busy lives.
[0:11:56] Voice 7: Okay, moving on then,
[0:11:57] Voice 7: next is the town hall and questions section.
[0:12:02] Voice 7: It's an opportunity to address the local trust committee
[0:12:05] Voice 7: matters relevant to local trust committee business
[0:12:10] Voice 7: and ideally things, items on the agenda,
[0:12:13] Voice 7: but failing that then at least within our jurisdiction
[0:12:16] Voice 7: is good to remind everyone
[0:12:20] Voice 7: to address the local trust committees,
[0:12:22] Voice 7: not other members of the public or staff and to keep your comments respectful and focus on the
[0:12:30] Voice 7: issues not individual personalities and in the interest of time I will call for show of hands
[0:12:39] Voice 7: and see if we need to limit the time that we allot to speakers today so I see one one two three
[0:12:48] Voice 7: So I think I could be pretty generous around that.

[0:13:07] Voice 8: please clarify what that executive decision
[0:13:11] Voice 4: was about

[0:13:27] Voice 4: Firstly, I would support moving forward on the Harris application,
[0:13:34] Voice 4: largely in part due to the
[0:13:36] Voice 2: good and informative staff report that sets out the context,
[0:13:41] Voice 2: the issues, and helps create a
[0:13:44] Voice 4: path towards more affordable housing on the island.
[0:13:49] Voice 4: certainly like to see that move forward as quickly as possible however uh i cannot say
[0:13:57] Voice 4: the same for the staff report on the groundwater sustainability violence the post-public hearing
[0:14:03] Voice 4: report yeah
[0:14:05] Voice 5: we
[0:14:07] Voice 4: are post-public hearing i realize that but i'm not introducing any more information
[0:14:12] Voice 4: information I'm talking about, I would like to talk about the report and what it did not
[0:14:18] Voice 4: include.
[0:14:20] Voice 4: I've seen it.
[0:14:22] Voice 4: The material that appeared in this information package, the material that appeared
[0:14:28] Voice 4: in the community information meeting, and the public hearing report itself, there were
[0:14:34] Voice 4: elements that seemed to have been missed that were not carried forward into the staff report.
[0:14:40] Voice 4: report can i just give you an example i mean i left
[0:14:45] Voice 8: the staff here
[0:14:46] Voice 5: yes we have received your
[0:14:47] Voice 5: letter and that was circulated to the rpm and the director of planning but if you feel as though
[0:14:52] Voice 5: you'd like to submit an administrative uh fairness complaint that would be the best route for this
[0:14:58] Voice 5: rather than explaining it to the ltc because they are personally hearing that's the best way forward
[0:15:04] Voice 4: okay well uh i'm trying to adhere by the rules set out that there's no new information
[0:15:15] Voice 4: i guess what i'm just trying to say is that i hope trustees will go beyond the incomplete and
[0:15:25] Voice 4: misleading staff report that's to the information that was presented during the cia okay

[0:15:35] Voice 7: just ask you to not um frame your disappointment in a way that doesn't uh doesn't impugn anyone
[0:15:45] Voice 7: and and so i stopped and uh just one point of clarification if
[0:15:51] Voice 2: there is if somebody has uh
[0:15:54] Voice 2: is dissatisfied with the
[0:15:57] Voice 4: a the process as it unfolded is there there is an administrative
[0:16:03] Voice 4: rate of complaint yeah resolution area correct i'll check with staff later to get that

[0:16:37] Voice 2: ruth and i'd like to make comments on the harris staff report um we have been residents uh on
[0:16:46] Voice 2: galliano for 15 years our property is adjacent to the film school property um we're referred to as
[0:16:55] Voice 2: block one was actually one block intervening between ourselves and the film school so i'm
[0:17:02] Voice 2: here to make a few comments and i have a few questions the current report clearly acknowledges
[0:17:11] Voice 2: the use at hand right now is illegal the current zoning is c7 commercial private film school all
[0:17:23] Voice 2: All other uses are prohibited.
[0:17:27] Voice 9: There
[0:17:27] Voice 2: is no ambiguity in the language of commercial C7.
[0:17:34] Voice 2: On this matter in front of us,
[0:17:36] Voice 2: I now understand that Harris has taken it upon himself
[0:17:41] Voice 2: to ignore the audience trust in this zoning
[0:17:45] Voice 2: for several years.
[0:17:47] Voice 2: As neighbors, this has become a complete surprise to us,
[0:17:54] Voice 2: even though we know there's activity on the property we're within earshot of the property
[0:18:03] Voice 2: my first set of questions i would like to understand in a future report when did the
[0:18:09] Voice 2: staff become aware of the illegal use that's underway right now i'd like to understand
[0:18:14] Voice 2: that staff had any communication with the capital regional district on the current use of the harris
[0:18:23] Voice 2: property staff understand how many residents are living on the property right now staff
[0:18:34] Voice 2: made a statement in the report we visited the property june of 2023 and october 29 of 2024.
[0:18:43] Voice 2: i would like to understand what the purpose of the visits were presumably the staff prepared
[0:18:49] Voice 2: reports on their observations and are these reports available what did they see what did
[0:18:56] Voice 2: they observed and what was important the previously used film school buildings according to their
[0:19:05] Voice 2: staff reports have now been converted into five housing units each with their own this is clearly
[0:19:13] Voice 2: stated in the report did staff review or examine capital regional district approvals for these
[0:19:20] Voice 2: conversions in other words do we have occupancy permits for these conversions and were these
[0:19:29] Voice 2: conversions approved by the capital regional district otherwise how can staff conclude
[0:19:37] Voice 2: that this is suitable approved housing in place right now referred to as occupants or housing
[0:19:46] Voice 2: units furthermore the applicant's proposal is to resolve the property to allow for use of the total
[0:19:55] Voice 2: density for 12 housing units, that's clearly stated, 12 housing units.
[0:20:02] Voice 2: This would be an increase of 7 units from the current 5.
[0:20:10] Voice 2: Has staff estimated the occupancy density?
[0:20:14] Voice 2: Is this lot size appropriate for such density?
[0:20:18] Voice 2: Are there other imperative lot densities on Galliano?
[0:20:22] Voice 2: It seems to me this would be one of the most dense, dense and populated lots on Galliana.
[0:20:31] Voice 2: I cannot think of another lot of this size with this proposed density.
[0:20:38] Voice 7: I'm just going to interrupt you for a moment just to ask you to wrap it up.
[0:20:43] Voice 7: Soon here, we're over seven minutes now.
[0:20:49] Voice 2: Okay, I will wrap it up. There is errors in the report itself. There is errors in the report.
[0:20:59] Voice 2: The report says it's currently zoned for community housing. The report is in error. However, quickly I will wrap up.
[0:21:07] Voice 2: the Galliano Island Trust has a process for rezoning and a bylaw approval and it starts with
[0:21:17] Voice 2: an application and there's a chart and in this application it has detailed requirements
[0:21:25] Voice 2: and there are several of these detailed requirements that have not been met so I'd
[0:21:33] Voice 2: like to have this documented for the record the application requirements are quite significant
[0:21:39] Voice 2: And at this meeting, the staff is already proposing a bylaw and to move ahead, a bylaw
[0:21:53] Voice 2: to move ahead.
[0:21:55] Voice 2: And I don't understand this.
[0:21:57] Voice 2: According to the Iowa's trust process, they're jumping well ahead of what should be.
[0:22:07] Voice 2: They're already talking about an agreement, a bylaw.
[0:22:10] Voice 2: If you follow the chart, if you follow the detailed requirements, these simply have not
[0:22:15] Voice 2: been met.
[0:22:17] Voice 2: I'm over my time.

[0:22:57] Voice 4: advertised but yeah so yeah it
[0:22:59] Voice 2: can be heard it has documents clear um where i think our issues

[0:23:45] Voice 5: If you had questions about this, it's advising you contact staff, not an LTC, because then the LTC is hearing this.
[0:23:55] Voice 5: So it's best just or if you have a question about it during perhaps a break, pull me aside and we can chat about it.
[0:24:01] Voice 5: but yes um number three in the staff report if received for information is that your that's
[0:24:08] Voice 5: exactly what
[0:24:10] Voice 9: it means just to receive this for
[0:24:11] Voice 5: information and no decision to be made today

[0:24:26] Voice 5: just like to comment on what the gentleman, I'm sorry, has just said.
[0:24:33] Voice 5: And I think it's often a very confusing situation for residents when suddenly an application
[0:24:40] Voice 5: appears in the agenda with a move to draft bylaws before the required reports and a full
[0:24:51] Voice 5: sort of um all the full supportive documentation has been received on an application and
[0:24:59] Voice 5: i felt very much in that position um previously and while i was told that the process is not
[0:25:09] Voice 5: necessarily carved in stone i think it's really um somewhat misleading and difficult for residents
[0:25:18] Voice 5: to understand the process when it isn't followed as it's described.
[0:25:24] Voice 5: And I can see what the gentleman who spoke has in terms of documentation.
[0:25:29] Voice 5: So I'd just like to raise that as an issue that I think people feel quite blindsided
[0:25:35] Voice 5: when suddenly it appears as an application and you read the staff report,
[0:25:39] Voice 5: it appears there's an intention to move ahead to drafting bylaws.
[0:25:45] Voice 5: And even though I know in the staff report, it says there are other reports that have to be completed and received.
[0:25:52] Voice 5: But I think that's very often a kind of surprising thing for people.
[0:25:59] Voice 5: So just as a, I guess, a point to note in terms of understanding and engagement.
[0:26:07] Voice 5: Thank
[0:26:08] Voice 7: you for that.
[0:26:10] Voice 7: And I mean, I do understand for those of us who are engaged in this work on a regular basis and understand the process, it's fairly straightforward.
[0:26:26] Voice 7: And we understand that, for example, drafting bylaws doesn't mean that even a first reading is going to happen and that a first reading is not necessarily.
[0:26:37] Voice 7: I have a quote that I really like from one of my colleagues.
[0:26:40] Voice 7: It says, in local government, first reading is used to introduce an idea or a plan that
[0:26:46] Voice 7: activates a legislative process for further review, potentially including public hearing
[0:26:52] Voice 7: information meeting, advisory planning commission referral.
[0:26:55] Voice 7: And it does not mean a decision favorable or unfavorable about the proposal has been

[0:38:33] Voice 5: and then I'm happy to answer any questions the LTC may have.
[0:38:37] Voice 5: So this is a preliminary staff report to provide basic information to the LTC
[0:38:43] Voice 5: on this redoning application.
[0:38:45] Voice 5: And the purpose of this staff report is to seek direction from the LTC,
[0:38:49] Voice 5: to proceed with the application, to not proceed with the application,
[0:38:54] Voice 5: and or preparing a draft bylaws and a draft housing agreement.
[0:39:00] Voice 5: So the subject property was originally zoned rural residential,
[0:39:05] Voice 5: which is the zone that surrounds the property,
[0:39:10] Voice 5: and was rezoned successfully back in 2002 to a commercial setting
[0:39:16] Voice 5: that permitted the commercial film school use.
[0:39:21] Voice 5: And that was in operation for about 20 years.
[0:39:25] Voice 5: The applicant has stated that in the last few years, the buildings that were originally their housing students have now been used as affordable housing units.
[0:39:39] Voice 5: And the applicant's or property owner is coming forward to now legalize that use.
[0:39:44] Voice 5: use the applicant has provided a rational letter which is attached to this staff report
[0:39:53] Voice 5: although the staff report states that the intent was to report the intent was to resume to a
[0:40:00] Voice 5: affordable rental use the applicant has just mentioned that there may be an amendment to
[0:40:07] Voice 5: that request to potentially for a co-op ownership so there's still some changes that may be happening
[0:40:15] Voice 5: so those are so the affordable rental use may be changed as the application proceeds
[0:40:23] Voice 5: so as stated in the applicant's rationale the property or there is a significant water license
[0:40:30] Voice 5: right now for people as well as a sewage system and there has been some repair and upgrades to
[0:40:41] Voice 5: the existing buildings which are stated there in the staff report. The current OCP land designation
[0:40:48] Voice 5: for the property is split with commercial and rural residential. The reason why the upper
[0:40:54] Voice 5: proportion of that property is, has the OCP designation of rural
[0:40:59] Voice 5: residential and also the zoning was that it was involved in
[0:41:02] Voice 5: adjustment. And so that created the split zone. So if this
[0:41:07] Voice 5: application does move forward, we're hoping then to remove that
[0:41:11] Voice 5: split zone split land use destination to one land use
[0:41:15] Voice 5: destination. I've also included or highlighted some of the OCP
[0:41:20] Voice 5: policies and how this application complies with those. So I'm happy to answer any specific
[0:41:28] Voice 5: questions about that. But to highlight it, the property would be zoned to only allow affordable
[0:41:34] Voice 5: housing. There would be a housing agreement required as a condition of zoning. There will
[0:41:41] Voice 5: also be a groundwater assessment required to ensure that the existing well has sufficient
[0:41:47] Voice 5: quality and quantity of water for the proposed use.
[0:41:51] Voice 5: As mentioned, the rezoning would remove the split zone
[0:41:56] Voice 5: and would rezone the property
[0:41:58] Voice 5: to a site-specific community housing zone.
[0:42:04] Voice 5: The housing agreement, the staff report lays out
[0:42:09] Voice 5: the basic parameters of the housing agreement,
[0:42:12] Voice 5: but the housing agreement authorizes the LTC
[0:42:16] Voice 5: to enter into this document,
[0:42:19] Voice 5: which defines terms and conditions agreed to by the LTC and the property owner regarding
[0:42:25] Voice 5: competency, rents and tenure of the housing units. So the primary purpose of the housing
[0:42:32] Voice 5: agreement is to ensure that the development provides affordable rentals or affordable
[0:42:37] Voice 5: housing in perpetuity. So there is a terms of reference attached to the staff report.
[0:42:46] Voice 5: And so if the application does proceed,
[0:42:49] Voice 5: the items including the terms of reference
[0:42:52] Voice 5: will be the requirement for the applicant to provide.
[0:42:55] Voice 5: So there's four items.
[0:42:57] Voice 5: The first is a groundwater assessment,
[0:42:59] Voice 5: a wastewater assessment, a housing agreement.
[0:43:03] Voice 5: And I've realized the fourth there,
[0:43:05] Voice 5: it's not included in the terms of reference,
[0:43:07] Voice 5: but will be, is confirmation from the CRD,
[0:43:10] Voice 5: the building department to ensure the existing buildings
[0:43:13] Voice 5: meet the BC building code.
[0:43:15] Voice 5: and potentially uh the requirement for an occupancy permit that would be based on the
[0:43:20] Voice 5: series of recommendations i want to thank those community members who noted an error in the
[0:43:27] Voice 5: referral list yes i have changed that if this application moves forward it will be referred
[0:43:34] Voice 5: to the north um galliano fire hall so that's been included staff have provided a recommendation to
[0:43:42] Voice 5: the ltc to move forward with the application in order to drop our loans and also to drop the
[0:43:48] Voice 5: housing agreement i also appreciate there has there is an error on page 28 of the staff report
[0:43:55] Voice 5: at the very top it says that the proposed land is consistent with the policies of the island's
[0:44:03] Voice 5: trust policy statement and the ocp and subject property is already designated zone for community
[0:44:08] Voice 5: housing that is incorrect and i apologize for that error so that will be taken away from the staff
[0:44:14] Voice 5: report and in the alternatives for the ltc to consider um referencing an incorrect um so many
[0:44:22] Voice 5: application members i was really on fire with this one i apologize for that um i i as we heard from
[0:44:29] Voice 5: community members the alternatives there's three there but the ltc can also consider a community
[0:44:34] Voice 5: community information meeting. So to gather further information from community members
[0:44:40] Voice 5: and the applicant also there to answer any specific questions. I also wanted to answer
[0:44:49] Voice 5: some of the questions I heard during town hall. So first was, is there any occupancy
[0:44:54] Voice 5: permits, as mentioned, that will be a requirement in terms of reference. So that is something
[0:45:00] Voice 5: that we'll be looking for we'll be speaking with the crd in terms of if an occupancy permit is
[0:45:06] Voice 5: required or what they would require to ensure that the links are brought up to that standard
[0:45:11] Voice 5: for community housing if it moves forward when did staff find out of the illegal use that was
[0:45:17] Voice 5: last year the first um site visit were there reports from the site visits and stuff um
[0:45:24] Voice 5: the staff prepared no it was just a site visit where i took some picture and discussed with the
[0:45:29] Voice 5: applicant the first time i met the applicant on site the discussion was to apply for reserving
[0:45:35] Voice 5: to legalize these pieces and i mentioned the errors in the staff reports as well
[0:45:41] Voice 5: um so i'm going to leave it at that unfortunately i don't see the applicant
[0:45:46] Voice 5: online so i'm happy to answer any questions i can um and the ltc has the option to defer this

[0:46:31] Voice 5: to consider further information
[0:46:33] Voice 5: from environmental assessments, agency referrals,
[0:46:37] Voice 5: and public feedback.
[0:46:39] Voice 5: Furthermore, the planner's recommendations
[0:46:42] Voice 5: prior applies to transparency
[0:46:44] Voice 5: and offering the public structured opportunities
[0:46:49] Voice 5: for input.
[0:46:49] Voice 5: but so i'll be voting favorably

[0:47:04] Voice 4: you're having to make a decision about putting density into a residential neighborhood there's

[0:47:26] Voice 4: that's a significant increase in density um i think i'm not opposed to proceeding because it's
[0:47:37] Voice 4: only with proceeding that we get answers so um you know i don't think there's i don't think we serve
[0:47:48] Voice 4: the public well if we don't at least explore the options right um i have i have concerns as well i
[0:47:58] Voice 4: you know when i read through it um is how do you how do you in a in a fairly small
[0:48:06] Voice 4: section of the neighborhood like that put up a portable housing project and so
[0:48:14] Voice 4: So you're going to need a ton of community input, right,
[0:48:18] Voice 4: especially local community input.
[0:48:23] Voice 4: You're going to have to really have a very good rationale
[0:48:27] Voice 4: for why this should be where it is.

[0:48:53] Voice 4: is housing people who need it. And so, you know, I'm in favour of exploring the options
[0:49:04] Voice 4: anyways. I'm in favour of having the community have input into all the questions that are
[0:49:10] Voice 4: going to be raised. If you look at the terms of reference, there's a huge amount of work
[0:49:14] Voice 4: to do. I designate the site and you know just a site plan sort of gives you then some context
[0:49:24] Voice 4: you know you can start to develop in your mind what this would look like and
[0:49:31] Voice 4: how it could proceed or not right and so while it would appear that moving ahead with draft bylaws
[0:49:45] Voice 4: might seem like we're jumping ahead we're really not we're just we saw this today

[1:02:57] Voice 5: exemptions as it stands now if the dpa were to be adopted on the cutting removal of trees with
[1:03:07] Voice 5: a trunk diameter less than um for me five trees per hectare with a diameter greater than 20
[1:03:15] Voice 5: centimeters would be exempt but smaller trees wouldn't be exempt so if a property owner was
[1:03:22] Voice 5: going to go and remove one small tree it would require a development permit so there is a new
[1:03:28] Voice 5: exemption the ltc could consider which states that cutting and removal of trees with a trunk
[1:03:34] Voice 5: diameter less than 27 meters measured 1.5 meters above the ground so really the intention of the
[1:03:40] Voice 5: development permit area is to initiate or kick in when a property owner is going to be removing six
[1:03:49] Voice 5: larger trees or more not to require a development permit for smaller trees or five or less bigger
[1:04:00] Voice 5: The second item there is there was a mapping error in the DPA map, which I mentioned in
[1:04:07] Voice 5: previous staff reports.
[1:04:08] Voice 5: So that would be just amending the DPA map.
[1:04:14] Voice 5: In terms of bylaw 284, which is the land use bylaw amendment, replacing the word property
[1:04:21] Voice 5: throughout the bylaw with lot, land use bylaws we always refer to a lot rather than a property,
[1:04:27] Voice 5: that's just for consistency and also removing the regulation that requires cisterns it's
[1:04:36] Voice 5: tucked in our subdivision regulation which really isn't clear for those reviewing the land use
[1:04:42] Voice 5: bylaw generally those regulations are found in the beginning of the bylaw general regulations
[1:04:48] Voice 5: so just for clarity staffers were recommending moving that regulation to the front of the bylaw
[1:04:56] Voice 5: So in terms of the process of public hearing, at this point, the LTC consider amending the
[1:05:05] Voice 5: bylaws and then giving second reading as amended, then giving third reading.
[1:05:11] Voice 5: After third reading, the LTC should then forward the bylaws to executive committee and then
[1:05:21] Voice 5: after that forward the ocp bylaw to the ministry for approval um so there are alternatives for the
[1:05:29] Voice 5: ltc to consider um i have listed three there the first is in regards to the exemption p which has
[1:05:37] Voice 5: been the majority of the discussion that we have so there is a motion
[1:05:41] Voice 5: there if the ltc wanted to
[1:05:43] Voice 5: remove that exemption the ltc also has the option to change the wording of exception p and you'd be
[1:05:51] Voice 5: using a similar draft motion that you see on page 44. So just as I quickly go over the long list of
[1:06:01] Voice 5: recommendations on page 44 of the staff reports, the first section would be amending the OCP
[1:06:07] Voice 5: 283 by-law. The second one then would be giving the by-law second reading as amended. The third
[1:06:14] Voice 5: is amending the land use bylaw fourth is amended or is giving it second reading as amended and it
[1:06:21] Voice 5: almost heard the third reading bylaws and executive approval and the ministry of municipal affairs for
[1:06:28] Voice 5: the ocb bylaw um i also wanted to mention that we have received a

[1:06:36] Voice 5: members um post public hearing and as we know the ltc cannot hear any further information post

[1:08:39] Voice 4: have less options i guess um i mean i i think uh first of all the amount of work that um
[1:08:47] Voice 4: Brad Smith and Orissa Chadwick and Kim Stockdell put into this to come up with a document that
[1:08:54] Voice 4: addresses groundwater sustainability.
[1:09:02] Voice 4: I frankly believe in the requirements around water storage.
[1:09:07] Voice 4: I think that's an important part of a water plan.
[1:09:11] Voice 4: The unfortunate thing with this project, this DP, is that there's so much exempted land,
[1:09:23] Voice 4: as William Shuba put it, it's probably the effect of the DP is minimal at best.
[1:09:33] Voice 4: The reality is that you exempt all the residential lots, the ARLR lands, the MFL lands, all the
[1:09:41] Voice 4: parks and conservancy lands there's not a whole lot left over after that if you look at exemption
[1:09:49] Voice 4: p all of the first nations land at this point is already attempted right um there was a lot of work
[1:09:57] Voice 4: going on with staff and uh to come up with the wording of that exemption and um and then you
[1:10:06] Voice 4: know when we had public hearing and Chief Jack spoke she reminded us of the importance of
[1:10:16] Voice 4: including Indigenous peoples in our bylaws right if we're serious about reconciliation
[1:10:26] Voice 4: then those words should mean something and and so I'm at a point where I don't see
[1:10:35] Voice 4: we're not really looking at anything if we're discussing this except exemption p
[1:10:41] Voice 4: And I'm comfortable moving ahead with this project, completing this project with Exemption B in there.

[1:34:22] Voice 4: the drafting of documents that affects their territories and so um talking about advertising

[1:58:54] Voice 4: mechanism, and it's probably going to be very difficult, but to involve an advocate in ongoing

[1:59:06] Voice 7: And my thought on that would be it would have a lot to do with do they have the interest?
