[0:00:28] Voice 2: i'm elected on the skeedy island chair of the hornby island local trust committee and i'm with

[0:00:34] Voice 2: the local trustees of grant scott alex allen our meeting coordinator elise ballard and uh planner

[0:00:41] Voice 2: uh saudi so um the first part of the meeting carried on while i was waiting to get here

[0:00:49] Voice 2: and um but we're gonna just back up a bit i have a short chairs report we'll start with that and

[0:00:55] Voice 2: then we'll go back to uh section seven of the agenda um so as we last met on november 1st

[0:01:04] Voice 2: trust councils held three committee of the whole meetings to continue working on the draft policy

[0:01:08] Voice 2: statement and at the trust council regular meeting in december council voted to adopt a

[0:01:15] Voice 2: bi-monthly schedule for those meetings to help us meet our desired timelines um i'm going to try and

[0:01:21] Voice 2: complete the review of the new policy statement before the end of term much of the december trust

[0:01:27] Voice 2: council meeting was focused on the preliminary review of the 2025-26 draft budget we were joined

[0:01:34] Voice 2: Joined for dinner by the Minister of State, Brittany Anderson, and former Trust Council Chair,

[0:01:39] Voice 2: Kermit Amalayan, Minister of Development and Poverty Reduction, Sheila Malcolmson,

[0:01:47] Voice 2: Bowen Island Mayor, Andrew Leonard, presented a delegation and spent a lot of the week with us.

[0:01:52] Voice 2: And San Juan County Chair, Jane Fuller, met with us on the Thursday afternoon for an informative exchange of ideas

[0:02:00] Voice 2: and different approaches to issues that are similar in both jurisdictions.

[0:02:05] Voice 2: It was also the first Trust Council meeting for our new administrative officer, Ruben Broney, and we look forward to working together over the next couple of years.

[0:02:16] Voice 2: Also agreed to hold Committee of the Whole meetings for a review of the 2022 governance report and to review the standards of conduct policy with an eye to updating it.

[0:02:27] Voice 2: and financial planning committee continues to meet in preparation for the budget finalization

[0:02:32] Voice 2: at the march trust council meeting in nine so uh in section seven of the agenda we have the

[0:02:43] Voice 2: follow-up action list uh starting on page 30 and i'll turn to staff to see if there's

[0:02:49] Voice 2: any updates on any of those items sorry

[0:03:45] Planner Zupanec (probable): stated that a CHIP outage permit is not required for that particular application. So

[0:03:51] Planner Zupanec (probable): staff is going to provide you with that update today.

[0:07:04] Planner Zupanec (probable): this particular report, your Denman, neighbor Denman Island Local Trust Committee has considered

[0:07:11] Planner Zupanec (probable): Fox and Flones Trials 176 and 177. In their referral response that we just received this

[0:07:17] Planner Zupanec (probable): week, it was that there is no issue, no comment related. So that's new from what's currently

[0:07:24] Planner Zupanec (probable): on your table here. There are six recommendations for you to consider today during this business

[0:07:31] Planner Zupanec (probable): meeting in terms of leaving as much room as possible for discussion around questions that

[0:07:36] Planner Zupanec (probable): you have about the content of the staff report in the minutes of the advisory planning commission

[0:07:41] Planner Zupanec (probable): you have representation of your apc here today as well to speak to the minutes and to the

[0:07:47] Planner Zupanec (probable): recommendations you've received public correspondence by email that has also been

[0:07:52] Planner Zupanec (probable): posted to the project website so that can also form part of your deliberations today and how

[0:07:57] Planner Zupanec (probable): you wish to proceed so um i can just quickly summarize these recommendations uh but the stock

[0:09:10] Voice 6: input back into that draft from the first nations from this project from the water project

[0:09:15] Voice 6: from the different so it but it seems to keep moving along so i just wondered

[0:09:20] Voice 6: what the implications of number one are for the process of i really wonder whether we even need

[0:09:27] Voice 6: of if we did that the other way if you don't know what i'm getting at yeah

[0:09:34] Planner Zupanec (probable): if you gave second reading today to the bylaws either amended or as presented that you would

[0:10:23] Planner Zupanec (probable): characterize how um how the flow of the bylaws is working right now they've already been referred

[0:10:32] Planner Zupanec (probable): to all the first nations and that's that's characterized in the staff report let's not

[0:10:37] Planner Zupanec (probable): worry about stations responses plus um the suggestion from comox that they're going to

[0:10:42] Planner Zupanec (probable): defer consideration until they meet with the suitable land analysis team in february so

[0:10:47] Planner Zupanec (probable): they're just setting up that date as well they're having a separate meeting uh to go over the data

[0:10:51] Planner Zupanec (probable): for Denman and Hornby and their intention was to provide a formal response. So it's not that after

[0:10:59] Planner Zupanec (probable): second reading you're going to receive more information because the referrals have already

[0:11:02] Planner Zupanec (probable): been sent out and this report summarizes the comments that you've received to date. The idea

[0:11:08] Planner Zupanec (probable): that your community would have an opportunity to have a like the traditional

[0:11:13] Planner Zupanec (probable): community information meeting that we typically hold it's either digital or hybrid in-person

[0:11:18] Planner Zupanec (probable): and digital so that we can present all the referral responses that have been received to

[0:11:24] Planner Zupanec (probable): date and as much data as possible to support the types of changes that you're recommending or that

[0:11:31] Planner Zupanec (probable): you think that you're going to be making to those bylaws in preparation for a public hearing so that

[0:11:37] Planner Zupanec (probable): the public understands how did you get to this point how did you consider the referral responses

[0:11:42] Planner Zupanec (probable): and what did you do with those responses did you incorporate those changes or not and that's the

[0:11:47] Planner Zupanec (probable): point in time in which the community then is advised here's the status of the bylaws to date

[0:11:54] Planner Zupanec (probable): and then you hear back as to whether or not there should be additional changes or considerations

[0:12:00] Planner Zupanec (probable): before a public hearing schedule or else you're satisfied that a public hearing can be scheduled

[0:12:05] Planner Zupanec (probable): because there's general support for the types of changes that you've made based on your advisory

[0:12:11] Planner Zupanec (probable): planning commission's recommendations or the referral responses from agencies and other

[0:12:16] Planner Zupanec (probable): governments. So, a reading today would signify that you're very comfortable giving specific

[0:12:24] Planner Zupanec (probable): direction to the amendments that you want to see in the bylaws. And if those are significant,

[0:12:30] Planner Zupanec (probable): I would say you're not ready to do that today. If there's significant changes to the bylaws,

[0:12:35] Planner Zupanec (probable): as presented in the staff report, that you would want to see those changes before giving

[0:12:39] Planner Zupanec (probable): second reading. If they're minor, then those are easier to do and to encapsulate in a resolution

[0:12:46] Planner Zupanec (probable): and direct staff to amend the bylaw by small things.

[0:12:51] Planner Zupanec (probable): What you're hearing back from the referral responses

[0:12:54] Planner Zupanec (probable): by the advisory planning commission

[0:12:57] Planner Zupanec (probable): from Comox specifically as well,

[0:12:59] Planner Zupanec (probable): is that there might be room for you

[0:13:01] Planner Zupanec (probable): to defer consideration of changes today.

[0:13:03] Planner Zupanec (probable): And that's what staff's recommending

[0:13:06] Planner Zupanec (probable): because you might want to consider

[0:13:08] Planner Zupanec (probable): a little bit more information

[0:13:10] Planner Zupanec (probable): so that when you do make amendments to the bylaw,

[0:13:12] Planner Zupanec (probable): if you choose to make amendments,

[0:13:14] Planner Zupanec (probable): is you're doing it at once instead of a more piecemeal approach which is you could do some

[0:13:21] Planner Zupanec (probable): changes today you could direct staff to go away bring those changes back and see them before you

[0:13:26] Planner Zupanec (probable): give a reading uh in february but ideally we're orchestrating the bylaw changes in a way that

[0:13:34] Planner Zupanec (probable): is documented makes sense to everybody who's following this process as to what the rationale

[0:13:39] Planner Zupanec (probable): and that you're advised to consider the fact that we've had this parallel project the suitable land

[0:13:48] Planner Zupanec (probable): analysis that we weren't sure how quickly it was going to roll out and dovetail with this so that's

[0:13:56] Planner Zupanec (probable): why we weren't actually referring to it at all because we did not understand that they were

[0:14:00] Planner Zupanec (probable): this close to presenting data which is within the fiscal this fiscal and now the planners have been

[0:14:06] Planner Zupanec (probable): advised actually the contractors ready to go and present the data to the local trust committees

[0:14:11] Planner Zupanec (probable): we have to as professional planners advise you to consider that data and consider that analysis

[0:14:18] Planner Zupanec (probable): because it may have implications it may not but it may have implications and your community may

[0:14:24] Planner Zupanec (probable): wish to also consider that data in their deliberation of whether or not they support

[0:14:29] Planner Zupanec (probable): the changes that you currently have in the bylaws so it just seems like it would be very inappropriate

[0:14:35] Planner Zupanec (probable): appropriate to ignore that statement for another round of amendments in the future when in fact

[0:14:41] Planner Zupanec (probable): there's no point in proceeding to a public hearing until the bylaws are as close as possible to what

[0:14:48] Planner Zupanec (probable): you feel you would be confident adopting and that gives the community some sense of assurance as

[0:14:54] Planner Zupanec (probable): well that you're not rushing to a public hearing only to then make significant changes to use for

[0:14:59] Planner Zupanec (probable): density or any of the other provisions that are currently being contemplated.

[0:15:07] Planner Zupanec (probable): So yeah that was sort of a long-winded way to describe how typically we want to advance bylaws.

[0:15:16] Voice 6: What I don't understand is in November we thought we were going to get what you just described

[0:15:25] Voice 6: today. That was my assumption. We were going to have the APC's

[0:15:31] Voice 6: work in the

[0:15:38] Voice 6: change bylaws today.

[0:15:41] Voice 6: So I understand, as you pointed out, this new

[0:15:46] Voice 6: permeable land analysis project came along.

[0:15:49] Voice 6: I don't remember hearing about that in November.

[0:15:58] Planner Zupanec (probable): in November you receive in any project you are going to receive the recommendations of it and

[0:16:04] Planner Zupanec (probable): of the advisory planning commission in the form of minutes that you then consider at your next

[0:16:10] Planner Zupanec (probable): possible meeting which is today but

[0:16:16] Planner Zupanec (probable): direction from your advisory planning commission to make amendments to the bylaws you have to

[0:16:37] Planner Zupanec (probable): ones you're going to be supportive of i can only make recommendations at this point i'm deferring

[0:16:43] Planner Zupanec (probable): making recommendations about all of this because i feel like there's one more piece that you would

[0:16:48] Planner Zupanec (probable): benefit from uh participating in in february which is not far off um to then provide some

[0:16:56] Planner Zupanec (probable): some analysis if you desire around,

[0:16:58] Planner Zupanec (probable): okay, how do we proceed from this?

[0:17:00] Planner Zupanec (probable): But you have a project charter that specifies

[0:17:04] Planner Zupanec (probable): that the advisory planning commission's recommendations

[0:18:08] Voice 6: and then we can massage it to come up with what the final might look like. Otherwise what are we

[0:18:14] Voice 6: doing looking at all these different pieces trying to figure out, in other words I should have done,

[0:18:18] Voice 6: I should have rewritten the OCP and land use bylaws four years ago, I could have. So I don't understand

[0:18:28] Voice 6: I thought I understood the process, but no, I'm not.

[0:18:31] Planner Zupanec (probable): You've asked the Advisory Planning Commission to provide you with input based

[0:18:35] Voice 6: on those draft files,

[0:18:37] Planner Zupanec (probable): and they've conducted that work in the form of the minutes and a supplementary document,

[0:18:42] Planner Zupanec (probable): which is very helpful, which is not a requirement for an APC to do that.

[0:18:46] Planner Zupanec (probable): They provided a discussion document, like a rationale document, to further clarify the minutes,

[0:18:55] Planner Zupanec (probable): because the minutes are difficult to pick through the recommendations and the discussion and how it

[0:19:01] Planner Zupanec (probable): led to those recommendations those are for you those are not for me so now that you've received

[0:19:08] Planner Zupanec (probable): those today is the meeting at which you consider that plus the staff report analysis of the other

[0:19:13] Planner Zupanec (probable): referral responses to further clarify that the ltc is on track with the bylaws as presented or that

[0:19:21] Planner Zupanec (probable): that you see that there's need for changes.

[0:19:24] Planner Zupanec (probable): And the scope of those changes are fully

[0:19:26] Planner Zupanec (probable): within your jurisdiction to identify and articulate today.

[0:19:29] Planner Zupanec (probable): And staff can do that work.

[0:19:31] Planner Zupanec (probable): We are the ones that then amend the bylaw

[0:19:33] Planner Zupanec (probable): based on the direction of the local trust committee.

[0:19:37] Planner Zupanec (probable): If you're not comfortable doing that work today,

[0:19:40] Planner Zupanec (probable): that's understandable because we're also saying

[0:19:44] Planner Zupanec (probable): that you might want to consider in February

[0:19:49] Planner Zupanec (probable): this is the type of amendments that we want to see in this bylaw for the ocp and these are the

[0:19:54] Planner Zupanec (probable): types of regulatory changes we want to see in the land use bylaw and staff can bring back

[0:20:00] Planner Zupanec (probable): if they're small we can do that right in the meeting if there are larger

[0:20:05] Planner Zupanec (probable): amendments then we need to actually do that work and show you what those changes look like and then

[0:20:11] Planner Zupanec (probable): you can give second reading if you're confident that you're ready and then there's a community

[0:20:17] Planner Zupanec (probable): that's usually how we dovetail that, is at that point in time you're saying to the community we've considered all this data and communications and correspondence to date and now we're having a community information meeting to see what have we missed before we go to public hearing.

[0:20:47] Voice 5: that we had not any about it and now it's a little curveballs and delayed things again and

[0:20:54] Voice 5: if I understand you said it's been a year and happening so I'd like to know why we haven't been

[0:21:01] Voice 5: a privy to that and then we could have known that it would be delayed suddenly because this is

[0:21:07] Voice 5: seems like very brand new material being around for a year or so it hasn't been

[0:21:11] Voice 5: around um okay so

[0:21:14] Voice 5: yeah so yeah so anyway it's sort of like oh so it's kind of like when the riparian appeared it's

[0:21:19] Voice 5: like so now we're back so

[0:21:26] Planner Zupanec (probable): and this is all part of how we're trying to coordinate at the regional planning level

[0:21:31] Planner Zupanec (probable): there's some great work and money that's being used to do work that benefits multiple local

[0:21:36] Planner Zupanec (probable): trust areas and this was

[0:21:37] Planner Zupanec (probable): one of those projects that was identified for main island and i think

[0:21:41] Planner Zupanec (probable): galliano at the time and then the contractor was able to they had extra capacity to do more islands

[0:21:48] Planner Zupanec (probable): and at the regional level we identified that we're doing these projects for these local trust areas

[0:21:53] Planner Zupanec (probable): that are all looking at increasing the user density of the islands through housing initiatives

[0:21:58] Planner Zupanec (probable): and projects so i had identified hornby has a project where this data could be quite relevant

[0:22:04] Planner Zupanec (probable): if there's capacity for the analysis to happen could the contractor do this and it was only late

[0:22:10] Planner Zupanec (probable): last year that we were advised actually yes they can see part of the endowment into that and

[0:22:16] Planner Zupanec (probable): gabriela and possibly have something ready by march so that would mean in february the local

[0:22:21] Planner Zupanec (probable): trust committees would actually get a primer like a presentation to say this is how this analysis is

[0:22:27] Planner Zupanec (probable): being done this is how this data can be used you may choose not to use it you may choose to use it

[0:22:33] Planner Zupanec (probable): And because we actually have bylaws that are, like, this close to moving towards another reading, it's actually not a significant delay, I would say.

[0:57:57] Voice 4: So basically, you know, Heisig has this ongoing concern that a major shift in the vacation rental

[0:58:06] Voice 4: policies will be damaging to the economy, and it would affect the artists, it would affect

[0:58:12] Voice 4: obviously retailers, cafes, anybody who is counting on visitors that come and stay

[0:58:19] Voice 4: to for their livelihood. It also in a broader picture of society, it would affect the ability

[0:58:27] Voice 4: of people to come here and rest and recharge, which Hornby is well known for. So the concern

[0:58:35] Voice 4: is Hornby related, but it's also bigger picture related. So in this letter that we wrote,

[0:58:43] Voice 4: vote, we recommended or asked the Trust Council, you three particularly, what has happened

[0:58:54] Voice 4: with your motion from February 2nd, 2024, which directed staff to explore the potential

[0:59:00] Voice 4: for business licensing with vacation rentals with the regional districts. As the provincial

[0:59:06] Voice 4: government indicated as the direction to go when they made regional districts a business

[0:59:12] Voice 4: business licensing authority. We don't know why they didn't make finance trust have that tool in

[0:59:17] Voice 4: their toolkit but many of us in the community for many years have been saying business licensing

[0:59:24] Voice 4: is the correct way to regulate this section of our economy. So you moved a year ago that this

[0:59:32] Voice 4: was going to be investigated and a request for a feasibility study around how it could happen

[0:59:36] Voice 4: and that's a year and nothing's happened so the question is why hasn't anything happened

[0:59:45] Voice 4: and an update really on that I guess there is a concern mentioned in the letter about

[0:59:54] Voice 4: of course unintended consequences the unintended consequences being

[1:00:00] Voice 4: there is a heavy bureaucratic expectation, people apply, have

[1:00:06] Voice 4: to apply for temporary use permits, that the finance staff

[1:00:10] Voice 4: will be overwhelmed and unable to act in a reasonable turnaround

[1:00:15] Voice 4: time, which partly that is because you'll meet every two

[1:00:20] Voice 4: months, and if you ask them to do something, it's usually

[1:00:22] Voice 4: and that there is at the time when this letter was written there was 10 postings for staff

[1:00:32] Voice 4: positions at the animals trust on their website and so they are understaffed overwhelmed there's

[1:00:39] Voice 4: been we saw it earlier today in one of the applications uh planner cox but is off on leave

[1:00:45] Voice 4: his whole files get assigned to someone else which slows down the bureaucratic process

[1:00:50] Voice 4: So business licensing go with the person. So it's individual accountability. Temporary use permits go with the land, which means once it's given, that property gets extra value because it can be sold as a vacation rental.

[1:01:04] Voice 4: If it's business licensing, if the property was to sell, the new owner has to commit to fall within the rules and regulations as they've been outlined.

[1:01:14] Voice 4: point the unintended consequences that we're concerned about are that people will just go

[1:01:20] Voice 4: underground if it gets onerous people just don't do it and so that means that there's no way to

[1:01:26] Voice 4: regulate people if they're family and friends only and they can do that all they have to do

[1:01:31] Voice 4: is quit advertising and they will avoid scrutiny from any enforcement that the province is

[1:01:36] Voice 4: contemplating at this point province has already told us they're going to be just looking to

[1:01:40] Voice 4: advertising platforms so that would be a very unintended consequence in our community if that

[1:01:46] Voice 4: were to happen. We believe that Hornby Island can do something that's grassroots, homegrown

[1:01:53] Voice 4: and specific to Hornby and the needs of our most remote of 13 islands except Gambier possibly

[1:01:59] Voice 4: and that we need to react at a local level and not at a trust-wide level as a policy on

[1:02:06] Voice 4: on vacation rentals and the importance to our economy.

[1:02:11] Voice 4: We, unfortunately, many, many years ago made the decision

[1:02:14] Voice 4: that we did not want big commercial operations here

[1:02:18] Voice 4: and that we wanted the money from the visitor economy

[1:02:21] Voice 4: to go grassroots into individual people's pockets

[1:02:25] Voice 4: as opposed to big corporations running hotels, resorts,

[1:02:28] Voice 4: motels, that kind of thing.

[1:02:30] Voice 4: And that has worked well.

[1:02:33] Voice 4: Some caveats around that, of course.

[1:02:36] Voice 4: when the trust said regulate that industry certainly that industry formed with high

[1:02:42] Voice 4: six support uh formed the short-term rental association they're doing a fabulous job

[1:02:48] Voice 4: they're providing guidance they're providing standards gold standards to people that are

[1:02:53] Voice 4: renting their homes and um for their members but for the whole industry as well so i think we've

[1:02:59] Voice 4: I think there's been a good job done with working with the trust and at the trust's direction.

[1:03:07] Voice 4: So basically, the letters really about Islands Trust indicated that they were going to be collaborating with the regional district.

[1:03:16] Voice 4: The question is, why not? Why hasn't that happened?

[1:03:20] Voice 4: And why are we going in a different direction?

[1:03:22] Voice 4: Why would we even contemplate making vacation rentals illegal in our zone?

 Attended Trust Council in December and noted discussion about code of 
conduct and decorum in response to tensions amongst meeting attendees; 
 Acknowledged recent passing of past Trustee Elspeth Armstrong; and 
 Attended one-to-one meeting with new Chief Administrative Officer Rueben 
Bronee. 
 
Trustee Scott reported the following: 
 Welcomed new Chief Administrative Officer Rueben Bronee whom he will be 
having a meeting with in the coming weeks;

Chair Peterson provided his report when he arrived at the meeting and noted the 
following: 
 Committee of the Whole is meeting twice per month to advance draft Policy 
Statement work and will be reviewing the 2022 Governance Report and the 
Standards of Conduct Policy; 
 Financial Planning Committee continues to meet in preparation for the 
upcoming Trust Council meeting being held in Nanaimo in March; and 
 Attended Trust Council meeting in December and highlighted focus on draft 
budget for the 2025/26 fiscal year, Bowen Island Mayor Andrew Leonard’s 
delegation presentation; and session with representatives of San Juan 
County. 
4.3 Electoral Area Director's Report - None 
5. PUBLIC COMMENTS 
A speaker inquired about the status of the Housing Needs Assessment. 
The Planner noted Islands Trust is undertaking a federation-wide housing needs 
assessment and the data collected will be complied into a report which will be 
made available to the public. 
 
A member of the public asked if the new Chief Administrative Officer has provided any 
input on how procedures, and conduct, at Trust Council could be improved. 
Trustees noted the Official Community Plan and Land Use Bylaw review process 
has taken several years and they would like the Chief Administrative Officer to be 
aware of the lengthy timelines, and they believe Trust Council issues are related 
to decorum and Chair management.  
 
A member of the public spoke to delays in the approval process for the application 
related to the Co-op development which is affecting surrounding businesses. They 
referred to a local business owner who is experiencing barriers and hurdles which might 
affect their ability to operate this summer, resulting in a potential inability to continue to 
remain open in the future. 
The Planner noted the public comments period is intended for open discussion; 
however, the speaker is not the applicant and the Planner that has been 
assigned to the file has been in touch with the applicant directly. 
 
An individual stated that Islands Trust takes too long to process bylaws, staff seem to 
manage the operations, and they would like Islands Trust to be more efficient.

7.1 Follow-up Action List Report dated January 17, 2025 
The Planner provided the following updates: 
 K’omoks First Nation provided a response pertaining to 5875 Central Road 
indicating a Cultural Heritage Investigation Permit is not required for the 
application; 
 The status of providing parking covenant EG107386 release will be reviewed 
and the Follow Up Action list updated accordingly; and 
 The Planner noted that all of Planner Cox’s files have been reassigned during 
his leave and applicants can contact Islands Trust Northern Office to be 
referred to the Planner that has been assigned the file.

10.1 Major Project: Hornby Island Official Community Plan and Land Use Bylaw 
Review - Summary of Referral Responses for Proposed Bylaw Nos. 176 
(OCP) and 177 (LUB) - Staff Report 
The Planner noted the following: 
 The Denman Island Local Trust Committee has considered proposed Bylaws 
No. 176 and 177 and stated their interests are unaffected;

 Recommendations for consideration are outlined in the staff report; 
 Representatives of the Advisory Planning Commission are present to answer 
questions related to their meeting minutes; and 
 Public correspondence has been received by email, posted to the project 
website, and it can form part of the Local Trust Committee’s deliberations. 
 
A Trustee suggested moving the proposed bylaws to second reading so referrals 
could go out and public commentary could begin while the Suitable Land 
Analysis data could be incorporated at a later date. They indicated that they 
thought the recommendations from the Advisory Planning Commission would be 
included in the recommendations in the staff report. 
The Planner clarified the following: 
 The referral process had been completed and a summary of First 
Nations responses were outlined in the staff report provided; 
 K’omoks First Nation had indicated they will defer consideration until 
they meet with the Suitable Land Analysis team to review data; 
 A Community Information Meeting could be scheduled once the Local 
Trust Committee considers the referral responses, Advisory Planning 
Commission recommendations, and all available data that supports 
the types of changes to the bylaw that are being proposed; 
 If there are significant changes to the proposed bylaws amendments 
should be made prior to second reading; 
 The Local Trust Committee would proceed to a Public Hearing when 
they are confident all information received to date has been 
considered and the bylaws are close to final adoption; 
 The Advisory Planning Commission recommendations are for 
consideration of the Local Trust Committee, and the Local Trust 
Committee directs staff which recommendations, or version of them, 
are to be incorporated into the bylaws; and 
 The Suitable Land Analysis data is another piece of information that 
might, or might not, inform decisions regarding bylaw amendments. 
 
The meeting was recessed for a break at 12:50 p.m. and reconvened at 1:15 p.m. 
 
During the public comments’ session, a member of the public had requested to 
speak to the Official Community Plan and Land Use Bylaw Review project when 
the Chair was in attendance. The Chair invited the member of the public to speak 
and the following comments were noted: 
 A major shift in vacation rental policies will damage the local economy; 
 The Local Trust Committee made a motion February 2, 2024 which directed 
staff to explore potential vacation rental business licensing with Comox Valley 
Regional District; 
 If Temporary Use Permits are required, the volume of applications, and 
shortage of staff, might result in processing delays; 
 The community wants tourism revenue to go to community members and not 
large hotel chains; and 
 Would like to know why making vacation rentals illegal is under consideration.  
The Planner noted staff met with Comox Valley Regional District to 
discuss the issue and the Regional District deferred the matter by

indicating they wanted to first see how the Local Trust Committee 
determined how to regulate vacation rentals.

special electronic meeting in February 2025 to: 
i.  Review and discuss preliminary data and mapping from the 
“Hornby Island Suitable Land Analysis Project”;  
ii.  discuss implications of the land analysis data on possible 
amendments to proposed Bylaw Nos. 176 (Official Community 
Plan) and 177 (Land Use Bylaw), and 
iii Consider any applications ready for LTC discussion.
