[0:00:22] Voice 5: And I want to begin the meeting by acknowledging we are fortunate to be able to gather today in locations across the traditional territory of the Coast Salish peoples,
[0:00:31] Voice 5: in particular, uh, Penelakut Tribes and Laiaksin First Nation.
[0:00:36] Voice 5: And Coast Salish families have deep relationship
[0:00:39] Voice 5: to these islands and waters.
[0:00:41] Voice 5: They have cared for and stewarded the abundance
[0:00:45] Voice 5: in these territories since time immemorial.
[0:00:48] Voice 5: So I want us to keep in mind that Indigenous peoples'
[0:00:52] Voice 5: management of the land, the waters, the salmon,
[0:00:55] Voice 5: the clam beds, the eelgrass, the deer, the camas,
[0:00:59] Voice 5: the Gary oak meadows all the beings they have shaped and co-created all that we see and benefit
[0:01:06] Voice 5: from here and so as we do our work we will seek to uphold principles of respect reciprocity
[0:01:14] Voice 5: relationship reconciliation and resurgence for indigenous peoples in their territories so we're

[0:02:56] Trustee Luckham: okay i'm jumping
[0:02:57] Trustee Luckham: I'm very grateful to be here and looking out the window this morning here, the Gary Elk
[0:03:10] Trustee Luckham: Inquiry System, which I'm privileged to live in.
[0:03:13] Trustee Luckham: And of course, here I am living in Coast Salish Territory, that of the Lackson and Penelope
[0:03:17] Trustee Luckham: peoples predominantly in this geographic area.
[0:03:21] Trustee Luckham: you. I don't know how many of you have been in or around longhouses, but I'm thinking this morning
[0:03:29] Trustee Luckham: about how much firewood it actually takes to heat a longhouse. And so just reflecting on that wood
[0:03:36] Trustee Luckham: primary heat, large buildings, big families in these buildings gathering, and blankets and warmth
[0:03:43] Trustee Luckham: on a day like today or in this time of year would be challenging, but it takes a lot of firewood to
[0:03:50] Trustee Luckham: to eat long. That's just my reflection. So grateful to be able to know and be conscious of
[0:03:57] Trustee Luckham: the people that have been on this coast since time immemorial. I'm going to note,
[0:04:02] Trustee Luckham: Toby Elliott, you started off there indicating that you were grateful that we all had power.
[0:04:07] Trustee Luckham: And I'm grateful that we all have power and it isn't just electricity. And we are privileged
[0:04:14] Trustee Luckham: to be able to make decisions
[0:04:15] Trustee Luckham: and to use our personal power
[0:04:18] Trustee Luckham: to advance good work.
[0:04:21] Trustee Luckham: And I want to recognize today,
[0:04:25] Trustee Luckham: whoops, where's my mouse gone?
[0:04:27] Trustee Luckham: Rosa Louise Macaulay Parks,
[0:04:30] Trustee Luckham: born in 1913 on February the 4th,
[0:04:34] Trustee Luckham: was identified as the first lady of civil rights
[0:04:39] Trustee Luckham: and the mother of the freedom movement.
[0:04:41] Trustee Luckham: movement actually as a young woman uh protested that she was told by the bus driver to give up
[0:04:48] Trustee Luckham: her seat to a white passenger because all the seats in the white section of the bus were occupied
[0:04:55] Trustee Luckham: anyway um that's a an amazing demonstration of personal power and so um thank you for that
[0:05:05] Trustee Luckham: segue into speaking about personal power and recently of course all of us are very concerned
[0:05:15] Trustee Luckham: about that power both across the border and the power that's being exerted in Canada and proudly
[0:05:21] Trustee Luckham: Canadian and encourage everybody to buy shop and support Canadians and Canadian businesses
[0:05:27] Trustee Luckham: Thank you.

[0:05:33] Voice 5: Trustee Hunter, do you have an update?
[0:05:37] Voice 7: My main concern, well, it's not a concern.
[0:05:40] Voice 7: I was just following the excavation of vehicles and such over at Block 88,
[0:05:47] Voice 7: and I was hoping that maybe Warren's here to give us an update on that perhaps.
[0:05:53] Voice 7: Yeah, otherwise pretty quiet on Cetus in the wintertime.
[0:05:57] Voice 7: We just hope that those fur bows are holding out and see if we can keep the power going all day.
[0:06:07] Voice 7: Thank you.
[0:06:10] Voice 5: And I neglected to mention, of course, everyone is aware of the tragedy of the fire
[0:06:18] Voice 5: on Penelakut, where a five-unit housing complex was totally destroyed on January 16th. And
[0:06:28] Manager of Bylaw Compliance and Enforcement: And
[0:06:28] Voice 5: Penelakut Chief Pam Jack did say that everyone escaped safely, but there has been severe impacts for the families that were displaced.
[0:06:41] Voice 5: So there is a fundraising campaign still underway.
[0:06:45] Voice 5: way um i know our senior indigenous relations advisor joe elliott had sent out a notice to
[0:06:52] Voice 5: all trustees um that uh if anyone wants to transfer contributions there's an email there
[0:06:59] Voice 5: or donate to the gofundme and uh they're going to be looking for securing housing for the displaced
[0:07:06] Voice 5: members so um just wanted to acknowledge that that while we are comfortable and housed um
[0:07:12] Voice 5: Yeah, the recent tragedy. We need to look after everyone in our community and those in Penelakut as well. So our hearts go out to everyone there. I'm glad that they're safe.

[0:07:30] Voice 5: so we'll open for public comment now members of the public who wish to address the local
[0:07:37] Voice 5: trust committee on matters within the local trust area jurisdiction first and then trust-wide
[0:07:44] Voice 5: secondly please keep your comments to topics that are relevant and be respectful and mindful
[0:07:52] Voice 5: that this is a workplace and all the standards of um safe workplaces um are in place i see your hand

[0:08:03] Voice 4: morning chair um just to note i just received um an update that there was um a member
[0:08:11] Voice 4: of the community um looking to share some information about a upcoming proposal they'd
[0:08:16] Voice 4: like to make so they're unable to make it today due to the inclement weather but you do have the
[0:08:21] Voice 4: information um shared with the local trust committee and that will be added as correspondence
[0:08:27] Voice 4: afterwards to the agenda for information okay
[0:08:29] Voice 5: that's great so we can add that as correspondence
[0:08:33] Voice 5: and we'll look for the um the application and any other material trustees did you get that
[0:08:43] Voice 5: uh letter it was just forwarded i think this morning yeah
[0:08:47] Trustee Luckham: it was last night i did receive it
[0:08:50] Trustee Luckham: it. I've also engaged quite a bit with Doug on this property. I've done a site visit over there
[0:08:56] Trustee Luckham: well in advance of the application. He's interested in seeing whether or not there's
[0:09:02] Trustee Luckham: opportunities for sponsorship at the application on that property. So it's worth looking at that
[0:09:08] Trustee Luckham: closely. And it's a Green Shores project essentially. And so we can certainly consider
[0:09:16] Trustee Luckham: to that one that gets before us

[0:09:26] Voice 7: i just i read it this morning
[0:09:27] Voice 7: um i had i had no other knowledge of it previous to that but um certainly willing to look at
[0:09:35] Voice 7: anything that helps the shoreline because it is eroding away
[0:09:44] Voice 5: yeah and i guess is there some discussion that this could be a model um project and replicable
[0:09:50] Voice 5: and what sponsorship could look like if this was perhaps a minor project of the LTC.
[0:09:57] Voice 5: I don't know if we can have that conversation, but we'll have to wait and see as the application goes forward.

[0:11:19] Voice 4: from July 2nd this is on page 16 of the agenda and this is regarding bylaws 113 and 114
[0:11:30] Voice 4: the adopted bylaws for the marine areas project review and there's there's an additional item so
[0:11:37] Voice 4: those that project or those bylaws are adopted so that's done there's a follow-up action to that
[0:11:43] Voice 4: to say to prepare a letter to the Ministry of Environment written and
[0:11:51] Voice 4: including a cover letter written by the chair staff just wanted to get a little
[0:11:56] Voice 4: bit more clarity on what the letter what the LTC would like the letter to say if
[0:12:04] Voice 4: you'd like staff to assist in drafting it or if the chair would draft it just
[0:12:09] Voice 4: some clarity there so we can um we can see what what uh what support you need to do that
[0:12:18] Voice 9: right
[0:12:19] Voice 9: perhaps i could speak to that
[0:12:21] Voice 9: is that
[0:12:24] Trustee Luckham: right chair yes please do
[0:12:26] Trustee Luckham: yeah thanks for raising that um
[0:12:32] Trustee Luckham: i guess uh the rationale for writing um because we have new ministers um both uh with the island
[0:12:44] Trustee Luckham: trust and presumably also within the Ministry of Environment, that application was rejected
[0:12:51] Trustee Luckham: and the, as indicated in the follow-up action list, but of course the tentative lease that
[0:12:58] Trustee Luckham: was offered to the applicant in advance of the local government considering the zoning
[0:13:06] Trustee Luckham: for that. Without any other knowledge, that license is still pending. And we wrote to the
[0:13:19] Trustee Luckham: minister at the time that we wanted that application withdrawn or canceled, whatever
[0:13:28] Trustee Luckham: whatever their process is.
[0:13:30] Trustee Luckham: And, of course, the election arose in that period.
[0:13:37] Trustee Luckham: I had had some conversation with some ministry staff
[0:13:41] Trustee Luckham: and our ministry staff just by circumstance at UBCM,
[0:13:47] Trustee Luckham: and there was some communication,
[0:13:49] Trustee Luckham: but it became apparent that there was going to be no decision
[0:13:52] Trustee Luckham: or comments or remarks from the ministry in that interregnum period.
[0:13:58] Trustee Luckham: Clearly, we're on a new path now, and it does seem that we should pursue closing that file, because I don't believe it's closed until that permit is canceled, for want of a better phrase.
[0:14:17] Trustee Luckham: there may be different language so i'm happy to work with staff to capture that but essentially
[0:14:25] Trustee Luckham: it's a rewrite of the letter or a follow-up on the letter that was sent back in i don't know
[0:14:33] Trustee Luckham: when that was august september maybe quite a while ago and i unless you have other information for us
[0:14:41] Trustee Luckham: I don't believe we've heard back.
[0:14:45] Voice 5: So providing an update and requesting that the tentative lease, you said, or that the permit, like, have they been issued a permit?
[0:14:53] Trustee Luckham: Well, it's a funny process that they do and that they, and maybe Renee might be able to speak to it,
[0:14:58] Trustee Luckham: but they sort of issue a permit pending a confirmation that the use is compliant with the zoning.
[0:15:12] Trustee Luckham: And, of course, it wasn't.
[0:15:13] Trustee Luckham: And so there we are.
[0:15:21] Voice 4: Through the chair, I don't have any more information to share on this particular license and tentative lease,
[0:15:28] Voice 4: but that could be something we just we clarify maybe in the letter so I can work with trustee

[0:16:24] Voice 4: action item where there's an invitation to happen to Ken Thomas or another elder to open a future
[0:16:33] Voice 4: LTC meeting. So we just wanted to follow up to see if that's something that's still desired and
[0:16:40] Voice 4: And we can add that update, and I can update staff on that one as well, that action item.
[0:16:49] Trustee Luckham: Yeah, I think that I was taking some responsibility for that.
[0:16:53] Trustee Luckham: It says that there.
[0:16:54] Trustee Luckham: And the timing hasn't been perfect.
[0:16:58] Trustee Luckham: I want this to be a genuine opportunity for engagement.
[0:17:02] Trustee Luckham: engagement, and actually I'm reflecting on the request that we got from the Valdez Conservancy
[0:17:12] Trustee Luckham: that maybe there's an opportunity to bring LACs and leadership and Penelope leadership together
[0:17:20] Trustee Luckham: on a visit to Valdez, but I'm getting ahead of myself.
[0:17:27] Voice 5: No, I think that would be, I think there's
[0:17:30] Voice 5: been some stuff happening in the background that we need to work on and i think figuring out the
[0:17:37] Voice 5: appropriate timing is definitely the right tactic right now and
[0:17:42] Trustee Luckham: there's been significant engagement
[0:17:44] Trustee Luckham: with the galliano ltc uh with penelakut um with respect to the lands on penelakut uh or on galliano
[0:17:51] Trustee Luckham: that are um is really great uh i overall islands trust relationship building so um and of course
[0:17:59] Trustee Luckham: the tragedy that happened with the house fires and and it is winter time and so let's make sure
[0:18:05] Trustee Luckham: we pick this thread up okay

[0:21:16] Planner Thomaidis (probable): currently listed on the LTC's future projects list as potential minor projects. The LTC can
[0:21:23] Planner Thomaidis (probable): select any of these projects or another project to become a minor project subject to funding
[0:21:30] Planner Thomaidis (probable): through LTC resolution. Staff are suggesting to combine a number of proposed minor projects into
[0:21:37] Planner Thomaidis (probable): into one minor land use by law amendment project.
[0:21:41] Planner Thomaidis (probable): This presents an opportunity to ensure better integration
[0:21:45] Planner Thomaidis (probable): and efficiency in achieving multiple LTC objectives
[0:21:49] Planner Thomaidis (probable): within the next year, within the next fiscal year.
[0:21:53] Planner Thomaidis (probable): And yeah, the LTC is being asked to review
[0:21:57] Planner Thomaidis (probable): these potential minor projects,
[0:22:01] Planner Thomaidis (probable): confirm the next minor project priority

[0:22:15] Planner Thomaidis (probable): facilities sort of following up from
[0:22:16] Planner Thomaidis (probable): previous LTC discussion and direction.
[0:22:20] Planner Thomaidis (probable): I think it was determined that staff
[0:22:23] Planner Thomaidis (probable): recommend that anyone interested in
[0:22:25] Planner Thomaidis (probable): operating an on island compost facility
[0:22:28] Planner Thomaidis (probable): on Thetis must apply for a site
[0:22:30] Planner Thomaidis (probable): specific rezoning with the LTC.
[0:22:32] Planner Thomaidis (probable): And then this was also looking at whether a soil deposit and removal by-law is appropriate.
[0:22:40] Planner Thomaidis (probable): I think at the time of a site-specific rezoning application, it could be assessed whether
[0:22:46] Planner Thomaidis (probable): a soil deposit and removal by-law would be recommended as well, whether it would be appropriate.
[0:22:52] Planner Thomaidis (probable): Staff generally advise against the LTC allowing for compost manufacturing facilities outright
[0:22:59] Planner Thomaidis (probable): right in all residential and or agricultural zones um so yeah that this report also just
[0:23:06] Planner Thomaidis (probable): provided a quick update on all of that um happy to answer questions if you have them and staff
[0:23:13] Planner Thomaidis (probable): recommend that the thetis island local trust committee request staff prepare a project charter
[0:23:20] Planner Thomaidis (probable): for the targeted lub amendment updates including rainwater fences and derelict vehicles as a minor
[0:23:28] Planner Thomaidis (probable): project with scope and objectives as defined by the local trust committee thank you excellent

[0:23:51] Trustee Luckham: the conversation that i had with you and certainly although i might have uh if i was feeling more
[0:23:57] Trustee Luckham: ambitious i might like to tackle a few other things however i think focusing on what we can do
[0:24:06] Trustee Luckham: readily this term has resulted in this short list and so i'm in support of the recommendation
[0:24:14] Trustee Luckham: that's there and i'll just speak maybe to those three things that the these days with climate
[0:24:21] Trustee Luckham: change and water shortages rainwater catchment has been a conversation for a very long time
[0:24:26] Trustee Luckham: and and often it's rejected because of the cost associated with a tank well as
[0:24:33] Trustee Luckham: houses strangely enough to build a new house reaches a million dollars in some
[0:24:40] Trustee Luckham: cases and even hundreds of thousands of dollars in the most smallest type of
[0:24:45] Trustee Luckham: dwelling the extra few thousand dollars associated with putting water storage on
[0:24:50] Trustee Luckham: site for non potable water usages gardening fire suppression cleaning and
[0:24:56] Trustee Luckham: maintenance around your property seems like a reasonable thing to do. So I would like to
[0:25:01] Trustee Luckham: focus on that. Fences came up a couple of years ago now, when somebody built a fence from one
[0:25:08] Trustee Luckham: end of the property all the way down to the waterline. And that seemed to be objectionable
[0:25:14] Trustee Luckham: to some. And that turns out there are no regulations or control or management associated
[0:25:20] Trustee Luckham: with fences. So I think we can look at that and determine whether or not it's appropriate or not.
[0:25:25] Trustee Luckham: But creating a limitation that the fence ends outside of the setback to the sea, I think, is at a minimum reasonable.
[0:25:36] Trustee Luckham: But perhaps we might also consider setting, for instance, a maximum height of six feet or something like that, whatever the number might be.
[0:25:44] Trustee Luckham: There is no height, and this one particular fence is 12 or 14 feet at one particular location.
[0:25:53] Trustee Luckham: So, worthy of consideration. And then the derelict vehicles was raised in the bylaw enforcement activity on the lot 188, the PEG property, that the difficulty with them and the time that is taken to assert remediation of that property has been associated with the language in the LUB and the definition of a derelict vehicle.
[0:26:18] Trustee Luckham: And so I think it would help everybody to remedy that. And I would look forward to Warren Dingman's advice on the wording for that so that there is better potential for us to act when there's a blatant violation of the bylaws.

[0:41:13] Trustee Luckham: Quite frankly, I'm not likely to sign such a thing, a cap the tax, because I don't really know what it means and how that would be implemented.

[0:41:28] Trustee Luckham: member on the financial planning committee we are diligent with attempting to keep taxes to
[0:41:37] Trustee Luckham: the absolute lowest possible we continue to cut projects and programs in order to do that
[0:41:43] Trustee Luckham: And so we are doing our utmost best to minimize tax increases to what, at the end of the day, turns out to be doable, rather than fixing a number to cap the tax at.
[0:42:02] Trustee Luckham: Certainly, we can see that the capital or Cowichan Valley regional tax rates are very different to our own.
[0:42:10] Trustee Luckham: And certainly it's interesting to consider that you might use inflation as a measure, but I don't find that the inflationary numbers that are provided by the government, other government, levels of government, with respect to what inflation is, reflects my grocery bills or other expenses associated with living and associated with running a business and operating a local government.
[0:42:34] Trustee Luckham: it. So we're doing our best, Paul, and appreciate all your work. And I will continue to do my best
[0:42:41] Trustee Luckham: to do what is reasonable in terms of financial requests. And we're hoping that the number will
[0:42:47] Trustee Luckham: be continue to be low as it has been over the years at the Islands Trust, as low as possible
[0:42:53] Trustee Luckham: anyway. So just those are my remarks and want to thank Paul for it.

[0:43:35] Voice 5: take on a commitment to cap the tax at a certain level unless there was you know a large movement
[0:43:43] Voice 5: and and people just said we simply don't want to pay anything for and so you know there there
[0:43:51] Voice 5: There would definitely be a conversation there, but I don't see evidence yet that constituents aren't getting value for the tax dollars they are paying.
[0:44:03] Voice 5: And Thetis is, I recognize the numbers seem large, especially when you're funding community projects and endeavors.
[0:44:14] Voice 5: Capriola as well we funded a multi-million dollar health clinic and integrated health clinic because
[0:44:21] Voice 5: we needed that and that's what communities we just we determine our priorities and
[0:44:28] Voice 5: figure out a way to make it happen but local governments are here to serve and I don't think
[0:44:33] Voice 5: we can necessarily restrict that to a certain percentage point every year because it's going
[0:44:40] Voice 5: to change so i look forward to further conversation um do we need to respond to mr duncan or just
[0:44:48] Voice 5: receive this for information and thank him for his engagement on the issue yes trustee luckham
[0:44:57] Trustee Luckham: i would suggest we receive it for information paul does observe our meetings
[0:45:03] Trustee Luckham: i know so and i can certainly express to him thanks personally when i see him um but i just
[0:45:11] Trustee Luckham: I just want to note and acknowledge what you made me think that is worthy of mention is about the fundraising on your own island associated with community interests and facilities and like.
[0:45:25] Trustee Luckham: And really, the announcement that we're back into the black with our own community center here, which was an amazing and significant fundraising process, where it became apparent in this process that there is so little funding available to do this kind of thing in community.
[0:45:47] Trustee Luckham: And it was, I would say it was pretty painful. It was a lot of years work. But what a celebration that this community was able to secure funding where it was available to us.
[0:45:58] Trustee Luckham: And, and that generosity of individuals has facilitated the, this new building.
[0:46:07] Trustee Luckham: and what that will last us for a very very long time but indeed the mechanisms to fund
[0:46:13] Trustee Luckham: things like this need to change as much as we need to keep our taxes down certainly but
[0:46:20] Trustee Luckham: opportunities to do the important work um on in terms of community infrastructure and services
[0:46:27] Trustee Luckham: is um critically important and the islands trust does get itself caught between a rock and a hard
[0:46:34] Trustee Luckham: place often and that some of the funding is not available because we're not a regional district

[0:49:05] Voice 5: think surveys were done up until 2022 but they went out so late that it you
[0:49:13] Voice 5: know we'd already viewed the budget two or three drafts and there wasn't much
[0:49:18] Voice 5: wiggle room so we've been developing a survey and public engagement that will
[0:49:25] Voice 5: be scheduled for May 2025 and that will give ample time for input on budget
[0:49:31] Voice 5: development and priorities for the following fiscal 2627 policy statement
[0:49:38] Voice 5: amendment project we are trying to proceed more quickly through reviewing
[0:49:43] Voice 5: the draft through bi-week bi-monthly meetings but we didn't reach quorum at
[0:49:50] Voice 5: our last meeting so bi-monthly meetings are not going to be a success unless at
[0:49:54] Voice 5: least 14 trustees show up so please folks attend these meetings or we're
[0:49:59] Voice 5: gonna have to figure out another way to do it and finally our new CEO Ruben
[0:50:05] Voice 5: Brawny has been in the role for approximately two months he's been
[0:50:09] Voice 5: meeting with each trustee and of course staff to gain a sense of local interests and challenges
[0:50:16] Voice 5: he seems very open to hearing and integrating all the different many challenges we we all face so
[0:50:25] Voice 5: i think he's embracing the the new role and um i've been pleased with what we've seen and the
[0:50:32] Voice 5: advice we've gotten so far so and just a tiny little note the technical group on the tiny house
[0:50:41] Voice 5: project is going to meet in about 10 days so this has been initiative through the regional planning
[0:50:49] Voice 5: committee to look at legalizing or developing a regulatory framework to legalize tiny homes on
[0:50:56] Voice 5: wheels in the trust area we're focused on um basically gabriola because the regional district
[0:51:03] Voice 5: of nanaimo is already has political direction to explore tiny homes on wheels they're advancing
[0:51:11] Voice 5: another resolution to avicc and ubcm and their staff are very keen to work on this so the
[0:51:17] Voice 5: building inspector long-range planner three tiny hosts manufacturers and uh some wastewater and
[0:51:27] Voice 5: servicing experts and our islands trust planners are getting together for a technical working group
[0:51:35] Voice 5: february 13th and they will try to crack the problem provide recommendations uh by march 31st
[0:51:43] Voice 5: So, and those will be presented to AVICC. Even if there isn't a straightforward regulatory framework, we're going to at least have a path of what needs to be done to make this possible. So lots of interest. I even got an email from Squamish. Everybody's talking about more advocacy to the province on this topic.

[0:57:24] Trustee Luckham: The scope does not include Valdez, but does include a memorandum of understanding with Chimayness Nation for a stakeholder process regarding Butte and Dunsmuir Island.
[0:57:35] Trustee Luckham: And so, indeed, when we did the OCPA and WB so many years ago now, it became apparent late in the process that the amount of consultation that we had done with Chimayness First Nation regarding Butte and Dunsmuir Islands was inadequate.
[0:57:56] Trustee Luckham: And so rather than stall the other elements of the OCP and LWB at that time, we advanced that.
[0:58:06] Trustee Luckham: And this was actually post, this was all done in camera with staff, which the trustees were not a participant in because it all became apparent after public hearing.
[0:58:16] Trustee Luckham: And so at the end of the day was agreed that we would not include those two islands and commit to engaging with Chimaynas in the future.
[0:58:28] Trustee Luckham: And we've not done that. And I just don't want to lose the part of the preserve and protect mandate of the Islands Trust in working with others,
[0:58:37] Trustee Luckham: and particularly First Nations in this case, is to preserve and protect the islands.
[0:58:42] Trustee Luckham: And Butte and Dunsmuir Island, I believe, remain vulnerable to development because there's inadequate protection on them.
[0:58:53] Trustee Luckham: And I can say that in conversations I've had with Chimayna's elders, that they are also concerned.
[0:59:01] Trustee Luckham: But somehow we have to find the opportunity to engage.
[0:59:04] Trustee Luckham: And that seems to be the biggest challenge.
[0:59:06] Trustee Luckham: But I don't want to lose track of it.
[0:59:07] Trustee Luckham: So I'm saying that now.
[0:59:09] Trustee Luckham: Now, this this list is a
[0:59:12] Voice 5: very ineffective way, I think, of tracking various projects and why they're there or what gave rise to them being on the list.

So the TUPs to include non-tourist accommodation, there's, you know, there's a standing resolution about exploring TUPs to permit temporary non-tourist accommodation use. So there's reasons for each one.

CALL TO ORDER Chair Elliott called the meeting to order at 9:30 a.m. 2. TERRITORIAL ACKNOWLEDGEMENT Chair Elliott acknowledged that the meeting was held on the territory of the Coast Salish First Nations and spoke to upholding the principles of respect, reciprocity, relationship, reconciliation, and resurgence for Indigenous Peoples in their territories. 3. APPROVAL OF AGENDA By general consent, the agenda was approved as presented. 4. REPORTS 4.1 Trustee Reports Trustee Hunter reported the removal of derelict vehicles on Lot 88. Trustee Luckham recognized Rosa Louise McCauley Parks as the first lady of civil rights and mother of the freedom movement and acknowledged her demonstration of personal power to make change, and he encouraged support of Canadians and Canadian businesses. 4.2 Chair's Report Chair Elliott reported the following: • Acknowledged tragedy of the recent fire on Penelakut Island and impacts to the displaced families, and noted that fundraising campaign information was shared by Senior Indigenous Advisor Joe Elliott; • Financial Planning Committee will undertake public engagement on budgetary processes for the 2026/27 fiscal year; ADOPTED Thetis Island Local Trust Committee Minutes February 4, 2025 ADOPTED 2 of 6 • Attendance at Committee of the Whole meetings to continue work on draft Policy Statement; • New Chief Administrative Officer Rueben Bronee has been meeting with Trustees on an individual basis; and • Technical group for the tiny house project will be meeting soon to explore regulations to facilitate the legalization of tiny homes on wheels and provide recommendations to be made at the upcoming Association of Vancouver Island and Coastal Communities meeting. 4.3 Electoral Area Director's Report - none 5. PUBLIC COMMENTS There were no members of the public present. The Regional Planning Manager noted a member of the public planned to attend the meeting to share information about an upcoming proposal they would like to make; however, they were unable to attend due to inclement weather and forwarded an email for information. BUSINESS ARISING FROM MINUTES 7.1 Follow-up Action List dated January 28, 2025 The following updates were provided: • Bylaws No. 113 and 114 have been adopted; • Trustee Luckham clarified the letter to be sent to the Ministry of Environment is a follow-up to a letter sent to the previous Minister regarding a provincially issued tentative foreshore lease that was offered to an applicant in advance of the local government considering zoning, and the purpose of the follow-up letter it to pursue closing that file. 8. APPLICATIONS AND REFERRALS 9.1 Salt Spring Island Local Trust Committee Bylaw No. 541 Referral Form TH-2025-001 It was MOVED and SECONDED, ADOPTED Thetis Island Local Trust Committee Minutes February 4, 2025 ADOPTED 3 of 6 that Thetis Island Local Trust Committee advise Salt Spring Island Local Trust Committee that Bylaw No. 541 does not affect the interests of Thetis Island Local Trust Committee. CARRIED 10. LOCAL TRUST COMMITTEE PROJECTS 10.1 Minor Project Prioritization and Selection - Staff Report The Planner summarized the staff report and highlighted the following: • The report outlines all items currently listed on the Future Projects List as potential minor projects; • Several of the proposed minor projects could be combined into one minor Land Use Bylaw amendment project; and • The report includes an update on the proposed Soil Deposit and Removal Bylaw project. Discussion ensued and the following comments were noted: • Rainwater catchment requirements have often been rejected due to costs associated with equipment; however, with climate change and water shortages, the consideration of a requirement of catchment for new development seems reasonable; • Fences are not regulated and consideration of setbacks to the sea and height maximums could be undertaken; • The definition of a derelict vehicle in the Land Use Bylaw is “a vehicle which would have to be licensed under the Motor Vehicle Act to operate on a highway and has not been so licensed for a period of 5 years and is not in a garage, carport or other building”, and adjusting the definition could result in improved potential to act on violations; • The requirement for mandatory water tanks necessitates further discussion and public consultation to determine if rainwater catchment is desired prior to drafting bylaw amendment language; and • Staff will provide a proposed Project Charter for the minor project for the Local Trust Committee’s consideration. TH-2025-002 It was MOVED and SECONDED, that Thetis Island Local Trust Committee request staff prepare a project charter for the ‘Targeted LUB Amendment Updates – Rainwater, Fences, and Derelict Vehicles’ minor project, with scope and objectives as defined by the Local Trust Committee. CARRIED Discussion ensued about the notation on the Future Projects Report to develop a new Official Community Plan and Land Use Bylaw to replace Cowichan Valley Regional District’s Bylaw No. 110 with the scope excluding Valdes Island and establishing a Memorandum of Understanding with the Stzuminus Nation for a stakeholder process regarding Bute and Dunsmuir Islands and the following comments were noted: • Engagement with Stzuminus Nation had not been undertaken; • Bute and Dunsmuir Islands remain vulnerable to development due to inadequate protections; • The information remains on the Future Projects Report as a notation, rather than a project, to ensure the intent is not lost; ADOPTED Thetis Island Local Trust Committee Minutes February 4, 2025 ADOPTED 5 of 6 • Collecting legacy information from current Trustees at the end of a term to provide incoming Trustees with a record of discussions could be considered at a future meeting. Bylaw Compliance and Enforcement Manager Dingman provided an update on the work completed on Lot 88 and the following comments were recorded: • Public tender contract work began in early December; • Multiple site visits have been undertaken and the property is now considered clear; • Small structures remain on the property because the court order did not allow for their removal; • All derelict items and salvage garbage has been removed; • The Local Trust Committee can pursue cost-recovery options; and • A communication to update the public should be considered. TH-2025-004 It was MOVED and SECONDED, that Thetis Island Local Trust Committee request staff to create a press release for the Thetis Community subscribers regarding clean up of Lot 88. CARRIED 15.
