[0:00:16] Voice 15: Local Trust Committee. I want to begin the meeting by acknowledging that we're fortunate

[0:00:20] Voice 15: to be able to gather today in locations across the territory of the Coast Salish people.

[0:00:24] Voice 15: I'm David Bond, elected the main island chair of the Dem and Island Local Trust Committee.

[0:00:27] Voice 15: meeting. I'm joined today by our Deminam Global Trustees, David Grant and Sam Forswick. Together

[0:01:36] Voice 15: have a request from staff to reorganize them to think uh 10.1 a planner chat would like to um

[0:01:51] Voice 15: um that will offer to basically um you know with the necessity we're unforeseen but uh i'm sure

[0:03:07] Trustee Borthwick: a tremendous amount prepared for this as a report the summer is coming um it's been very busy um

[0:03:18] i've sort of i think the big thing that's

[0:03:22] Trustee Borthwick: sort of been on my mind in as sort of an auxiliary

[0:03:24] Trustee Borthwick: uh component of being trustee is sitting on the fac which is now defunct as of uh the end of april

[0:03:32] Trustee Borthwick: it's a fairy advisory committee yes fairy advisory committee um and yeah i mean i was involved uh

[0:03:39] Trustee Borthwick: fairly you know i tried to keep myself pretty involved in the engagement process of that uh

[0:03:45] Trustee Borthwick: you know sort of a little bit bloody mindedly um it's a frustrating process to be a part of

[0:03:51] Trustee Borthwick: um but i thought i would give it a go um at this point i mean i'm still going to be sort of

[0:03:59] watching those things they've they've assured us

[0:04:00] Trustee Borthwick: that as an alternative to the FAC they're going

[0:04:03] Trustee Borthwick: to maintain a list of people that they'll reach out to on specific topics so there won't be an

[0:04:09] opportunity to bring up anything that they don't want to talk about but they will assemble special

[0:04:13] uh panels for when they have a specific thing that they want to talk about

[0:04:17] Trustee Borthwick: um so I am currently on

[0:04:20] Trustee Borthwick: their list for those things um but I'm frankly extremely disinclined to do any additional stuff

[0:04:27] Trustee Borthwick: I've looked at the surveys they've put out recently, but I'm not actually feeling very optimistic about putting into them.

[0:04:34] Trustee Borthwick: And I'm, yeah, it's a bit cynical, but it's very frustrating.

[0:04:38] And I think especially this year, we're going to see an absolute bumper crop of travelers.

[0:04:45] It's going to be COVID, but more because people will be traveling even more.

[0:04:51] And no one is going south.

[0:04:53] So I

[0:04:54] Trustee Borthwick: think that's going to be a big year for that.

[0:04:58] Trustee Borthwick: So I hope I hope that something else comes down the line in the future, but we'll we'll see what we get to you.

[0:05:09] Last week was very busy.

[0:05:12] A lot of the work of the trust is done through trust committees, and there were four committee meetings last week, one right after

[0:05:18] Trustee Graham: the other, including a special day for them.

[0:05:20] Trustee Graham: and just say just to prepare for this trip.

[0:05:26] Trustee Graham: And then we did a lot of weekend.

[0:05:30] Trustee Graham: It's really always a pain to me.

[0:05:31] Trustee Graham: So that's okay.

[0:05:35] Trustee Graham: And we've got a trust council on September.

[0:05:41] Trustee Graham: On, so it's like in June, and that's coming up.

[0:05:47] Trustee Graham: That's where our quarter begins.

[0:05:49] Trustee Graham: And I'm actually gonna attempt to alternate

[0:05:51] Trustee Graham: to try and save money in the budget because i can't it's my fellow trustees to do all this work

[0:05:57] Trustee Graham: anyway that's right yes

[0:06:02] Voice 15: trust council coming up that's uh going to be a big one

[0:06:05] Voice 15: it's amazing how much we can cram into three days we get it done sometimes you know

[0:06:14] Voice 15: um i think from the larger trust perspective we received a letter back from the minister

[0:06:24] Voice 15: um turning down a request for a review which was um exceptionally disappointing um i can

[0:06:33] Voice 15: leave it at that because i'm gonna get myself in trouble um that makes challenges for sure

[0:06:39] um as professor borfolk noted the very advisory commission's committees have been extinguished

[0:06:44] um which for island

[0:06:46] Voice 15: communities is very disappointing um were their plans for

[0:06:55] Voice 15: re-engagement i think i'm not optimistic i just not they're going to have to rehash this again

[0:07:04] because the amount of feedback the amount of contributions that came from the federal

[0:07:10] Ferry Advisory Committee

[0:07:10] Voice 15: for free was outstanding. I know in our area, we did so much for them.

[0:07:21] They had, from the Southern Gulf Islands, basically there's five ferries on three routes

[0:07:27] Voice 15: interconnecting everything. It's a really, really complicated schedule.

[0:07:31] Voice 15: They spent a massive amount of money a couple of years ago rejigging that schedule. Went to the

[0:07:37] Voice 15: very advisory committee her advisory committee looked at said it won't work and they go what do

[0:07:43] you mean this is well the way you've got things there you're going to overload every day on every

[0:07:48] app because you've messed up with it and they're going oh how do you know that so well look at your

[0:07:54] traffic figures well what do you mean so one of our magical people spent like a week going through

[0:08:01] through all their data for traffic,

[0:08:04] and produces a great big Excel spreadsheet

[0:08:06] that showed the schedule didn't work.

[0:08:09] So they showed, they spent over a million dollars

[0:08:13] and the volunteer committee in a week

[0:08:16] showed them that the schedule didn't work.

[0:08:19] So I

[0:08:20] Voice 15: basically say, you know,

[0:08:22] Voice 15: you got good value out of those committees.

[0:08:25] Voice 15: And it's very disappointing.

[0:08:27] Voice 15: So that's sad.

[0:08:28] Voice 15: And yes, we have press council coming up in June,

[0:08:30] Voice 15: which is just we've got a lot of stuff um i think particular highlights could be emily

[0:08:36] bottle is going to be making a presentation

[0:08:38] Voice 15: um he was the mla who made a contrary opinion

[0:08:42] Voice 15: um saying that it's not time for a review which is disappointing but it is what it is um

[0:08:51] Voice 15: so it's going to be three action-packed fun days on salt springs so i think i'll leave it at that

[0:09:39] Voice 15: true enough and he is very responsible the guy knows them rice him and even or something he's

[0:09:43] Voice 15: always quite back so it's uh he's doing a good job we would like to see his face um all righty so now

[0:09:55] Voice 15: this is an opportunity if you have any questions or comments

[0:09:59] um to local trust committee um we have a few applications for us um if you're not the applicant

[0:10:04] this is time to speak to those applications because when we're considering it it will be

[0:10:09] between the ldc and the applicant themselves um so if you have anything raise your hand

[0:10:22] Voice 13: the demo and certainty board has asked me to ask you to do first and second readings on our

[0:10:35] Voice 13: by law change our rezoning um because we kick out if we if we do first and second readings we kick

[0:10:44] Voice 13: out a whole section of the schedule that we can maybe shorten the time frame to get that all done

[0:10:53] Voice 13: so one of the recommendations from the planners was to do first and second readings um an alternate

[0:11:00] Voice 13: it so i don't um i don't know that there's any problem with that so i just thought i asked you

[0:11:15] Voice 15: the path is there so it's not like we're going to say no we can't do it because obviously it's

[0:13:03] Voice 15: makes a lot of sense um i read through it it's long but i couldn't find anything that

[0:13:11] popped out at me as being of an issue so um our thanks to staff for that

[0:13:22] Voice 15: um it's it's amazing because there was a lot of people battling a lot of times there you know

[0:14:16] Planner Chadwick: you chair mod and and thanks for um thanks for the uh um schedule shift i

[0:14:21] Planner Chadwick: really appreciate that um so we're just following up on the meeting that we had on the 8th which

[0:14:27] Planner Chadwick: was a very um focused and and productive meeting um focusing looking at the next steps with the

[0:14:34] Planner Chadwick: housing project so again um just a bit of a revision there um we had uh organized the special

[0:14:42] Planner Chadwick: meeting um and it was and sort of the options moving forward were informed um about by the

[0:14:50] Planner Chadwick: community the interest that was very clearly expressed at the the march meeting for um for

[0:14:58] Planner Chadwick: for more understanding of the project and ability to contribute ideas to the next phase of this project and where it goes.

[0:15:08] Planner Chadwick: And there was particular interest. There were a number of key themes that kind of emerged where there was interest in providing some, having some conversation.

[0:15:23] Planner Chadwick: And, I mean, what was interesting is that there seemed to be a lot of agreement that, in a general sense, of the vision for the island being, yes, nobody's against affordable housing, but we want to do it in the right way where we are preserving and protecting the environmental values of the island.

[0:15:47] Planner Chadwick: and also considering the Comox interest in all of this as well.

[0:15:52] Planner Chadwick: So it was clear that we need some engagement to take it to the next place

[0:15:59] Planner Chadwick: so that the community members feel that they've got the information that they need

[0:16:04] Planner Chadwick: to be able to effectively engage and the opportunity to effectively engage in the process

[0:16:11] Planner Chadwick: prior to bylaws coming forward for readings.

[0:16:14] Planner Chadwick: So, that's what this report is about, looking at what that engagement plan could be.

[0:16:23] Planner Chadwick: We've attached an engagement plan, and we've also noted that it'll be, because we don't,

[0:16:32] Planner Chadwick: the next Denman meeting is not until July, we will need to, for us to be able to move

[0:16:41] Planner Chadwick: forward with engagement materials, we'll need to have another special meeting to get confirmation

[0:16:51] Planner Chadwick: from the LTC on the information that we put out. So there were four key themes that sort of came

[0:16:58] Planner Chadwick: out of the conversation in March and have also been coming in through letters to the LTC,

[0:17:04] Planner Chadwick: conversations with staff and and these key themes are the density bank increasing permissions for

[0:17:13] Planner Chadwick: secondary dwellings proactively zoning for multi-unit cluster housing that's the coho model

[0:17:20] Planner Chadwick: more cohos is a big a big message that that that's being heard out there and and this idea around

[0:17:28] Planner Chadwick: floor area and and lot coverage limits so those were the the four that staff have kind of

[0:17:34] Planner Chadwick: identified and um you know putting it also out to ltc if there are other other key themes that you

[0:17:40] Planner Chadwick: you think we should be looking at for providing information and options for discussion um so

[0:17:49] Planner Chadwick: the um the basic objectives of the of the uh engagement plan like i've sort of been noting

[0:18:00] Planner Chadwick: is to inform the the community about the project scope what's happening provide

[0:18:08] Planner Chadwick: some some clear background information on the on the different type of on the

[0:18:15] Planner Chadwick: key areas I think where there's a little bit of need for some conversation and

[0:18:19] Planner Chadwick: and to receive that feedback to inform policy development and and I will also

[0:18:25] Planner Chadwick: note that while we may be doing while we'll be doing this engagement LTC has

[0:18:31] Planner Chadwick: already endorsed a number of changes related to this project so staff will be

[0:18:39] Planner Chadwick: working to to write up those bylaw amendments so so you know a good portion

[0:18:48] Planner Chadwick: of the of the of the amendments will be written and we'll have the opportunity

[0:18:55] Planner Chadwick: to share what those what those are as well um as part of this process so really i you know

[0:19:03] Planner Chadwick: the component parts here are um a uh having a community um conversation we talked about that a

[0:19:12] Planner Chadwick: bit um during our meeting on the 8th and there was interest in having information at markets

[0:19:20] Planner Chadwick: at the market and trustees were offering themselves as their time to do that.

[0:19:29] Planner Chadwick: We can certainly do up information on the key areas and the process, etc.

[0:19:35] Planner Chadwick: We've suggested an online community meeting to provide an opportunity

[0:19:42] Planner Chadwick: for a recorded sort of overview of the process

[0:19:47] Planner Chadwick: and what some of the options are

[0:19:50] Planner Chadwick: so that people can engage in that way as well.

[0:19:54] Planner Chadwick: And there's a number of things

[0:19:58] Planner Chadwick: that have been suggested here

[0:20:00] Planner Chadwick: in terms of accessing the information.

[0:20:04] Planner Chadwick: We can set up a webpage.

[0:20:06] Planner Chadwick: We've done that for Gabriel.

[0:20:08] Planner Chadwick: We've had a very good experience with Gabriel.

[0:20:10] Planner Chadwick: It's a template.

[0:20:10] Planner Chadwick: It's not a lot of work

[0:20:11] Planner Chadwick: now that we've kind of done it once.

[0:20:15] Planner Chadwick: And then looking at opportunities for people to be able to bring to provide feedback. We've talked to Morgana, our communications specialist, and she's identified a few different ways that people can

[0:20:30] Planner Chadwick: comment via online and we can also provide the opportunity for

[0:20:36] Planner Chadwick: There's always the opportunity for community members to write to the LTC directly, and we can also provide opportunities for sort of in-person information collecting.

[0:20:51] Planner Chadwick: So I'll leave that with you as my introduction and see if you've got any questions, comments on what's being proposed.

[0:21:10] Trustee Graham: I'm going to jump to page 126 where you've got a couple of potential agendas for the

[0:21:17] Trustee Graham: community conference.

[0:21:18] Trustee Graham: I think one kind of aimed at the person and the other at the online community meeting.

[0:21:24] Trustee Graham: I actually don't want to have a potential agenda that you've suggested for the community

[0:21:29] Trustee Graham: population session but i really like the one that you've suggested for the online community meeting

[0:21:34] Trustee Graham: and being the difference being the suggested potential potential agenda that you've suggested

[0:21:39] Trustee Graham: the online is very direct to the four or five changes that we're asking feedback from our

[0:21:47] Trustee Graham: community whereas the one that you've suggested for community conversation is more like an

[0:21:52] Trustee Graham: introduction to a housing review having guest groups like coho and the land conservancy and

[0:21:59] Trustee Graham: devon residence um i don't i want i don't want to i want to really focus our engagement with

[0:22:06] Trustee Graham: our community on the things that we're proposing um to to address particularly

[0:22:11] Trustee Graham: our official community plan policy support for housing options but we've been talking an awful

[0:22:18] Trustee Graham: lot about affordable housing i think we know at this point that affordable housing is set in the

[0:22:24] Trustee Graham: purview of our volunteer organization dental housing we can administer housing agreements

[0:22:31] Trustee Graham: on individual properties and so all of our affordable housing has to be provided

[0:22:37] Trustee Graham: through the society that works so hard providing affordable housing options

[0:22:41] Trustee Graham: but we have an artificial community plan policy support for housing options and we really are

[0:22:47] Trustee Graham: are missing that in our current housing um supply we have single family dwellings which are

[0:22:56] Trustee Graham: you know restricted and we have a tiny number of rentals posted which probably were created

[0:23:05] Trustee Graham: when the window to have a secondary dwelling was open on them and way back before my time

[0:23:16] Trustee Graham: I don't

[0:23:17] Voice 4: even remember what I ate from breakfast.

[0:23:20] Trustee Graham: It's a small window, and some people responded, and they built themselves cottages or secondary buildings.

[0:23:27] And those became our rental pool, a very, very small number.

[0:23:32] My co-trustee who's struggling to find a

[0:23:34] Trustee Graham: place to rent will attest, there is nothing to rent on this island.

[0:23:38] Trustee Graham: It's even close to being a port.

[0:23:40] Trustee Graham: so we have a big gap there so that's just my suggestion i don't know if i'm supported by my

[0:23:45] Trustee Graham: coach trustees and our chair here but i like the the focused potential agenda talking about

[0:23:52] Trustee Graham: density bank that was a big red flag in our last meeting and we definitely um i missed the

[0:23:58] Trustee Graham: community concerned with that particular thing that we have so yes we need to address that right

[0:24:04] Trustee Graham: off the bat uh secondary dwelling units which are that's the suggestion coming from our housing

[0:24:10] Trustee Graham: advisory planning commission and supported by the local trust committee that that on large

[0:24:15] Trustee Graham: parts of the property we should be able to look at people having the ability to build a small

[0:24:19] Trustee Graham: well it can't subdivide we can't use it for short-term rentals so it would absolutely fall

[0:24:25] Trustee Graham: under housing options and then the small multi-unit housing that's the affordable housing

[0:27:17] Trustee Graham: We've continued it, making it's very important work to be done and I'm being assured by

[0:27:24] Trustee Graham: Planner Chadwick and Planner Targar that we can get these through in this term. I'm so hopeful that we

[0:27:30] Trustee Graham: can do that. But you know what, we're not going to rush it. If things pop up about a community that we

[0:37:22] Planner (probable): You've seen one of these bylaws before and already given a first reading, and there's

[0:37:26] Planner (probable): two that you haven't seen yet, so they're just drafts.

[0:37:28] Planner (probable): The goal of the application is to facilitate the development of 19, well, 19, 20, 20, 20,

[0:37:33] Planner (probable): of an additional uh four units four units to bring the total to 19 dwelling units with associated

[0:37:39] Planner (probable): secondary suites with encouraging long-term affordability through an updated housing

[0:37:46] Planner (probable): agreement so today staff are recommending first and second readings of draft bylaws 254 and 255

[0:37:54] Planner (probable): which is the ocp and housing agreement and second reading of the proposed bylaw 250 which is the

[0:38:01] Planner (probable): Land Use By-law Amendment. The rezoning application was first initiated in February of 2024 with

[0:38:08] Planner (probable): a preliminary direction provided in June of 2024. In October the LNC gave first reading

[0:38:16] Planner (probable): to proposed By-law 250, the Land Use Amendment, and sent it out for referral. Originally it

[0:38:23] Planner (probable): was anticipated that an OCP amendment would not be necessary due to another parallel project

[0:38:29] Planner (probable): to eliminate the density bank entirely, however that initiative did not proceed, so as a result

[0:38:35] Planner (probable): the current application now requires an OCP amendment to remove four densities from the

[0:38:40] Planner (probable): density bank, which is a change in the scope of earlier assumptions.

[0:38:45] Planner (probable): Just a quick summary, so for by-law 255, the OCP amendment, this removes four densities

[0:38:51] Planner (probable): from the density bank to enable the proposed development. No redesignation is required

[0:38:56] Planner (probable): as land is already designated as sustainable resource and agriculture, and that won't be

[0:39:02] Planner (probable): changing with this application.

[0:39:04] Planner (probable): And then file on number 254 is an updated housing agreement.

[0:39:08] Planner (probable): So it replaces the original 2008 housing agreement.

[0:39:12] Planner (probable): It regulates the affordability and occupancy for 19 units in their secondary suites.

[0:39:17] Planner (probable): It includes some updated definitions, including a family member will now include children

[0:39:23] Planner (probable): and family, there's affordability criteria and clarity on how secondary suites must be managed.

[0:39:32] Planner (probable): So there is in the 2008 agreement the cooperative's internal rules and governance

[0:39:38] Planner (probable): documents were attached. The applicant now requests that these not be included in the

[0:39:43] Planner (probable): updated agreement stating that the housing agreement should focus only on matters relevant

[0:39:49] Planner (probable): to the LTC's jurisdiction and interests.

[0:39:52] Planner (probable): So this raises an important question for the LTC.

[0:39:55] Planner (probable): Do changes to those documents have the potential

[0:39:58] Planner (probable): to affect obligations under the housing agreement?

[0:40:01] Planner (probable): So staff have provided some options

[0:40:03] Planner (probable): for the LTC to consider.

[0:40:05] Planner (probable): You can attach the current versions

[0:40:07] Planner (probable): of the cooperative rules and policies

[0:40:10] Planner (probable): as schedules to the agreement as proposed

[0:40:12] Planner (probable): and included in the draft.

[0:40:14] Planner (probable): draft. You cannot attach but define cooperative rules and policies in the housing agreement

[0:40:21] Planner (probable): to refer to the version in effect at the time the agreement is signed. Or you could require

[0:40:27] Planner (probable): LTC consent for any future changes that could affect the co-op's obligations without requiring

[0:40:33] Planner (probable): a full amendment to the agreement. For by-law 250, the LUB amendment staff have, or the

[0:40:43] Planner (probable): LTC has already given first reading so staff are recommending second reading now just to keep this

[0:40:49] Planner (probable): file aligned with the OCP and housing processes and we have received referral feedback responses

[0:40:55] Planner (probable): have been received from several agencies and are included in a chart so the ministry of agriculture

[0:41:03] Planner (probable): ministry of housing municipal affairs the health authority the agricultural land commission

[0:41:09] Planner (probable): for Vianna LTC and Comox First Nation have all provided responses, Comox First Nation

[0:41:19] Planner (probable): responses included as an attachment, but you'll see no concerns are noted.

[0:41:25] Planner (probable): So if the recommendations are approved by the LTC, staff will send out another set of

[0:41:31] Planner (probable): referrals for the OCP by-law with a 90-day response window, and we'll plan for a community

[0:42:53] Voice 12: may seem like odd idiosyncrasies but they're really core to the affordability and the functioning

[0:42:59] Voice 12: functioning of the of the project and and i think that this responded to them so uh like

[0:43:05] Voice 12: what's quite happened with everything that's here i wanted to see it go ahead and then this piece so

[0:43:11] Voice 12: what what this has to do with is called the rules of um cooperative rules and rules of association

[0:43:18] Voice 12: as governed by the co-op act it's like our constitution and there's actually two pieces

[0:43:23] Voice 12: there's a memorandum of understanding which is very short which is just like

[0:43:27] Voice 12: kind of this it's saying that the organization exists and why which is to provide uh cooperatively

[0:43:35] Voice 12: managed affordable housing and then the rules of association which is very much like the

[0:43:40] Voice 12: constitution when you ask you know things about our shares and that kind of thing and the main

[0:43:44] Voice 12: reason we like not to be attached well one is that from my review of other housing agreements

[0:43:51] Voice 12: that this isn't something that exists elsewhere in the trust and it just gets complicated when

[0:43:57] Voice 12: we if we would want to change it which we've actually only done once you know since we existed

[0:44:02] Voice 12: um and it's done by special resolution um according to the co-op act um it's like then

[0:44:09] Voice 12: do we need permission do we need to let the lcc know and then in which case does the housing

[0:44:16] Voice 12: agreement need to be amended like it just it seems complicated to us for something that's

[0:44:21] Voice 12: really internal and when i look through it in terms of the pieces that regulate affordability

[0:44:26] Voice 12: those are all like handily covered in the zoning and the housing agreement just things like the

[0:44:33] Voice 12: purpose and the the you know the actual affordability of it and would be you know we

[0:44:39] Voice 12: are required to do a statutory declaration when uh you change his hands and that shows that the

[0:44:46] Voice 12: housing agreement has been followed and we've been working with a lawyer for that and you guys have

[0:44:49] Voice 12: received them and everything seems to be in order um so i don't see any benefit like i think the

[0:44:56] Voice 12: communities desire and need to know that there's oversight around affordability i think that's the

[0:45:03] Voice 12: main goal here i don't think that having our cooperative association attached will further

[0:45:09] Voice 12: that in any way and it just can tangle things up and and possibly tangle things up at your end um

[0:45:17] Voice 12: whereas i actually think things are working really well and we'll keep working really well even

[0:45:23] Voice 12: even better with the the uh improved housing event so um that would be my only sort of request is and

[0:45:32] Voice 12: you know it won't be the end of the world like you know i won't walk away for it no one would

[0:45:36] Voice 12: go home or boycott the trust anymore than some people do but oh but i'll not be um but um

[0:45:45] Voice 12: yeah if you change your

[0:45:47] Planner Chadwick: mind again otherwise i guess

[0:45:48] Voice 12: i just want to say you know this that we

[0:45:50] Voice 12: if we have people waiting we have people contacting us when do you think your new

[0:46:39] assignments, local trust committee can assign

[0:46:42] Trustee Graham: the administration of a housing agreement to a third party.

[0:46:45] Trustee Graham: We talked a little bit about the trust's inability to manage housing agreements on individual

[0:46:51] Trustee Graham: properties because it's an administrative nightmare.

[0:46:53] Trustee Graham: Well, if we had a housing society on Devon that was willing to take on that administration

[0:46:59] Trustee Graham: of those housing agreements, we could assign an administration of those kinds of agreements

[0:47:04] Trustee Graham: to that housing organization, and we could tie affordability to people who wanted maybe

[0:47:11] Trustee Graham: be more than one something like just something to think about so i was like oh we can assign

[0:47:19] these documents

[0:47:19] Trustee Graham: the administration of these documents but other than that um you know the

[0:47:25] Trustee Graham: coho triple rock whatever you guys call yourself we don't call ourselves

[0:47:29] Trustee Graham: i really i have to say what your group have done over the past 20 years with your

[0:47:39] Trustee Graham: you're 10 years of meetings and then you're more than 10 years of living on the land.

[0:47:42] Trustee Graham: And I'm a neighbor, so I know the party on the land well.

[0:47:45] Trustee Graham: I mean, there are a real bunch of family-oriented people who are sharing the land so responsibly.

[0:47:52] Trustee Graham: And I think we're very fortunate on them in how to go with standard development.

[0:47:56] Trustee Graham: Like, and other groups, if they want to do this type of cooperative,

[0:48:00] Trustee Graham: they should be asking you tons of questions and just taking your blueprint and saying,

[0:48:03] Trustee Graham: we want to do this just like we did.

[0:48:07] Trustee Graham: That's huge.

[0:48:09] Trustee Graham: So they didn't have to wait for CMHC or DC Housing to give them the big fat check.

[1:03:04] Planner (probable): So, bylaw number 256, which is an OCP amendment, it changes the designation from Sustainable

[1:03:11] Planner (probable): Resource to Conservation Recreation for three full parcels and part of a fourth parcel.

[1:03:19] Planner (probable): The agriculture designation on the portion in the ALR remains unchanged as per ALC recommendations.

[1:03:26] Planner (probable): A key component of this application is the proposed addition of four residential densities

[1:03:33] Planner (probable): to the OCP Density Bank, so they'd be adding four.

[1:03:42] Planner (probable): Under Appendix D Policy 1 of the OCP, the LTC may add unused densities to the density

[1:03:48] Planner (probable): bank under certain circumstances, such as the rezoning removes residential density from

[1:03:55] Planner (probable): lots with subdivision potential, applications involving donations of land for conservation

[1:04:00] Planner (probable): of park use, LTC initiated rezonings resulting in unused density. So staff are recommending that

[1:04:08] Planner (probable): the LTC look at a broad interpretation of this policy because the land in question is not being

[1:04:14] Planner (probable): formally donated. Staff are recommending a broad interpretation because the Conservancy is

[1:04:20] Planner (probable): is voluntarily giving up development rights.

[1:04:23] Planner (probable): The land is permanently being protected through rezoning

[1:04:26] Planner (probable): and it results in a clear and lasting public benefit,

[1:04:30] Planner (probable): which aligns with the intent of the density bank policy.

[1:06:50] Planner (probable): reserves are resource intensive. ITC is currently prioritizing on protected half priority lands

[1:06:56] Planner (probable): for covenant work, so they didn't recommend making that a condition of the rezoning.

[1:07:02] Planner (probable): However, that staff feedback and as part of the formal referral process, this would go

[1:07:07] Planner (probable): to the board, but it wouldn't be anticipated that that would be something that would be

[1:07:12] Planner (probable): And then the Agricultural Land Commission objected to rezoning the ALR portion from

Trustee Graham reported attendance at recent Committee meetings and upcoming 
attendance at the June Trust Council meeting.

The Planner summarized the staff report and highlighted the following: 
• The application seeks a Siting and Use Permit to construct a dwelling, workshop, 
accessory building, boathouse, septic system, garden beds, driveway, and 
retaining walls; 
• The request has been made pursuant to a covenant that is registered on title 
which prohibits the proposed development unless there is prior written consent 
of the Local Trust Committee; 
• The property owner has obtained a Heritage Conservation Permit and Site 
Alteration Permit from the Province and two Cultural Heritage Investigation 
Permits from K’omoks First Nation; and 
• The Siting and Use Permit will ensure that the development complies with the 
Denman Island Land Use Bylaw.

9.2 DE-RZ-2024.1 (Triple Rock Land Cooperative) - Staff Report 
The Planner summarized the staff report and highlighted the following: 
• The rezoning application seeks to develop 4 additional dwelling units, to bring 
the total to 19 dwelling units with associated secondary suites, while 
encouraging long-term affordability through an updated housing agreement; 
• The Local Trust Committee gave First Reading to proposed Bylaw No. 250 in 
October, 2024 and referral responses are included in the staff report; 
• The application requires an amendment to the Official Community Plan to 
remove 4 densities from the density bank; and 
• Bylaw No. 254 represents an updated housing agreement to replace the original 
2008 agreement which regulates the affordability and occupancy for the 
dwelling units and secondary suites. 
 
The applicant was in attendance and spoke to the reasoning for the request to not 
include the Cooperative’s rules and governance documents as part of the updated 
agreement stating that, if included, any changes to said rules could precipitate a 
need for consultation and amendments which are otherwise unnecessary. 
Trustees had no questions for the Planner or applicant and stated agreement that it 
would not be necessary to include the schedules in the housing agreement.

 The Planner summarized the staff report and highlighted the following: 
• The goal of the application is to formalize the applicant’s current conservation 
focused land use which prioritizes environmental protection; 
• One of the parcels is split zoned and includes land in the Agricultural Land 
Reserve; 
• The Official Community Plan amendment would change the designation from 
Sustainable Resource to Conservation Recreation for 3 parcels of land with the 
Agricultural designation on the parcel within the Agricultural Land Reserve 
remining unchanged as per the recommendation received from the Agricultural 
Land Commission; 
• The application proposes the addition of 4 residential densities to the Official 
Community Plan density bank which permits unused densities to be added 
under specific conditions; 
• Staff recommend the Local Trust Committee either consider a broad 
interpretation of the density bank donation policy, as the conservancy is 
voluntarily giving up development rights and the land will be permanently 
protected through rezoning, or amend the draft bylaw to explicitly include these 
densities; and 
• Islands Trust Conservancy provided referral feedback which indicated that they 
are currently prioritizing unprotected lands for covenant work over covenants on 
already protected lands. 
Discussion ensued and the following comments were noted: 
• If amendments to the density bank policy in Official Community Plan for the 
density transfer are required, they would be included as part of the current 
amendment project; and 
• The density bank policy was not to restrict it to parcels that are rezoned or 
donated and the density donation would fall within the intent of the policy.

• The Chief Councillor of K’omoks First Nation has requested a Preliminary Field 
Reconnaissance as noted in the public statement attached to the memorandum 
detailing rationale for support of the Preliminary Field Reconnaissance; and 
• An update on the progress of the file was provided and staff will continue to 
process the application as per previous direction provided by the Local Trust 
Committee. 
 
Discussion ensued and the following comments were noted: 
• It is presumed that Komas Ranch Ltd. are prepared to consider that the 
Preliminary Field Reconnaissance will proceed; 
• The original Land Use Contract was specific about the permitted size of 
secondary dwellings and some of the secondary cottages are over the size 
allowance; and 
• The application seeks rezoning to permit what was allowed in the Land Use 
Contract; therefore, when draft bylaws are brought forward, the Local Trust 
Committee can address site specific zoning for the secondary cottages that are 
oversize. 
10. LOCAL TRUST COMMITTEE PROJECTS 
10.1 Major Project: Denman Housing (Official Community Plan and Land Use Bylaw) 
Review Project: Engagement Plan - Staff Report 
The Planner summarized the staff report and highlighted the following: 
• Options for moving the project forward were informed by public input received in 
March and the key themes for engagement that emerged include the density 
bank, increasing permissions for secondary dwellings, proactively zoning for 
multi-unit cluster housing, and floor area and lot coverage limits; 
• The objectives of the engagement plan are to inform the community of the 
scope of the project, provide background information on the key areas, and 
receive feedback to inform policy development; 
• The Local Trust Committee has already endorsed a number of changes related 
to the project and staff will use that information to prepare draft bylaw 
amendments; and 
• Engagement options include Trustees providing information at summer markets, 
an online community meeting to provide an overview of the process, a 
dedicated webpage, and a means of receiving online communication. 
Discussion ensued and the following comments were noted: 
• There is support to focus community engagement on items that are being 
proposed to address Official Community Plan policies that support housing 
options; 
• There has been a lot of broad engagement and it will be helpful to focus the 
discussion; 
• One trustee will attend some of the summer markets to provide information and 
gather feedback; and 
• There is support for electronic and in-person sessions leading up to a public 
hearing.

  Trustee Graham noted the following: 
• The bylaw to remove the Temporary Use Permit from accessory dwelling units 
while not removing the density bank will be discussed as part of the overall 
housing review; 
• The density bank was created for affordable housing; 
• The densities have financial value and should be used as affordable housing 
tools and not for general densities; 
• The Official Community Plan currently does not support multi-housing options 
which are specific to affordable housing; and 
• The ability for the Local Trust Committee to administer housing agreements 
should be looked into. 
 
Staff indicated they can bring back options as part of the density bank discussion.
