[0:09:28] Trustee Patrick: So with that, we're returning to this item that we had initiated yesterday.

[0:09:32] Trustee Patrick: I'm going to return to Director Marler to remind us where we left off

[0:09:36] Trustee Patrick: and we'll carry on the conversation.

[0:09:41] Voice 11: are on page 269, which was the request for decision

[0:09:44] Voice 11: regarding draft by law 199 which is the amendments to your meeting procedure by law for petitions and

[0:09:53] Voice 11: delegations the discussion was around some of the provisions in the draft by law and I believe one

[0:10:02] Voice 11: of them was around the appeal process so I think that's what we left off that you're just having a

[0:10:08] Voice 11: discussion generally about some of the provisions and there was concern raised that the appeal

[0:10:14] Voice 11: process listed in here isn't it doesn't quite meet the request of council so if you want any

[0:10:20] Voice 11: amendments to that you can certainly consider it you could do an amendment and then give first

[0:10:26] Voice 11: second third readings or if you want me to go away and do something you could ask me to do that as

[0:10:40] Voice 3: to address the appeal process, and I did discuss it with Director Mahler as well.

[0:10:53] Trustee Patrick: If you could explain to us, perhaps, before we go into the motion, what you're solving with this motion.

[0:10:59] Voice 3: Okay. So, on page 270, where we had the resolution, item number 6, it says,

[0:11:05] Voice 3: provide clear criteria for rejection of delegations with a clear appeal process to

[0:11:10] Voice 3: trust counsel. The clarity regarding the appeal was not present in 5.9.a, where it doesn't specify

[0:11:18] Voice 3: that this is actually an appeal process. So my motion is to address that.

[0:11:30] Voice 8: If I could, as this is the first time that we're really looking at this particular document,

[0:11:36] Voice 8: I would love it if we could take the motion into, like, just to refer it to staff for considering how to revise this and give us until next Trust Council to be able to look at this and talk to our community, because there may be other feedback and whatever to incorporate, and it seems more timely and efficient to do it that way.

[0:12:50] Voice 2: make it so that we won't be able to dispose of delegations at a trust council where the

[0:13:25] Voice 11: that council would ask either the chair or the executive committee to respond.

[0:13:31] Voice 11: So council could dispose of it, but it would be more measured.

[0:13:39] Voice 2: Yeah, I hear where that's going, and I don't like that.

[0:13:44] Voice 2: you you know something is uh you know for one who defines what is um makes it um you know time of

[0:13:51] Voice 2: the essence or whatever but um the other you know if trustees want to deal with something if it's

[0:13:55] Voice 2: something that's um you know worthwhile then it should be up to uh the trustees to deal with it

[0:14:01] Voice 2: at the time and not have um it possibly get you know the message changed or whatever it may be

[0:14:07] Voice 2: um so i don't see anything wrong with the uh with the way things are i know that if this was in

[0:14:14] Voice 2: or some other delegations that have been brought forward during this term

[0:14:18] Voice 2: the outcome may have been completely different um so i'm not in favor of this and i would much

[0:14:24] Voice 2: rather prefer that this gets shuffled down down the road to possibly the next trust council

[0:14:31] Voice 2: so we can have more time to formulate arguments and um and also when we have the rest of the

[0:14:35] Voice 2: trustees here thank you thank

[0:14:38] Trustee Patrick: you so trustees how would you like to proceed we have a draft motion

[0:14:42] Trustee Patrick: to either appeal to address the appeal or a direct staff to do more work trustee fast i'd

[0:15:27] Voice 14: but in kind of uh subtle language it seemed it does seem to be saying um it's not going to decide

[0:15:36] Voice 14: anything right then and there that uh disposition requests will allow time for staff to provide

[0:15:43] Voice 14: provide written advice. So it does look like we're not going to have instant solutions immediately

[0:15:48] Voice 14: after hearing a delegation. Could you please explain, excuse me, the rationale?

[0:16:01] Voice 14: Sorry about that. If you could explain the rationale behind that proposal.

[0:16:08] Voice 11: Yeah, so the rationale is you get a delegation that comes to you, and it could be, you know,

[0:16:16] Voice 11: know really heartfelt and really important and it gets the attention of council and it could have

[0:16:25] Voice 11: some implications for work that you're doing that we haven't had the ability to provide that

[0:16:30] Voice 11: information to you so with a delegation you're getting one side of the story generally you're

[0:16:35] Voice 11: getting what they would like you to hear there could be a history behind it that you're not

[0:16:40] Voice 11: aware of or there could be other work that's already been done or already underway and

[0:16:45] Voice 11: And if you were to do what the delegate requested, it could lead to complications.

[0:16:52] Voice 11: It might contradict something that counsel's already said, or there may be another nuance that you're just not aware of, that if you were aware of it, you might actually support it differently or want to take a different approach.

[0:17:07] Voice 11: So it's really just making sure that counsel's fully informed before it makes a decision.

[0:17:12] Voice 11: I think that's probably a tenet of good governance.

[0:17:19] Voice 11: So it's not intended to stop you.

[0:17:22] Voice 11: I mean, the word will could be changed to should.

[0:17:24] Voice 11: As an example, you then can just say, well, actually, in this case, we want to do this.

[0:17:30] Voice 11: We're not concerned about that.

[0:17:32] Voice 11: So that's one option.

[0:17:33] Voice 11: And 5.18 is intended to allow you to address things where you can't wait for your next council meeting.

[0:17:41] Voice 11: meeting so presumably with a delegation you would say yeah we want to deal with this so let's ask

[0:17:47] Voice 11: staff to come back with some recommendations on how we can respond to that delegation and you get

[0:17:53] Voice 11: those recommendations back at the next meeting and then do whatever it is you want to do if times of

[0:18:00] Voice 11: the essence then you could say yeah i want to do something let's ask the executive committee to

[0:18:05] Voice 11: deal with this or the chair will we will authorize the chair to write this letter and work with staff

[0:18:12] Voice 11: on the wording of that letter so that's really intent is just to make sure that you're fully

[0:18:17] Voice 11: informed before taking a position on a delegation that has come to you in the same meeting that you're

[0:18:24] Voice 11: making a decision thank you

[0:18:26] Trustee Patrick: trustee worthwick uh

[0:18:30] Voice 10: thank you chair um yeah i similarly uh to trustee

[0:18:35] Voice 10: bernardo wanted to sort of uh you know hone in on that that language around will provide time

[0:18:41] Voice 10: because i i appreciate uh tracy harris's concern that this you know may fetter our our our discretion

[0:18:49] Voice 10: as a as a body to respond uh directly um however my and my my interpretation of this and and as

[0:18:57] Voice 10: director marla was just saying um i you know i think there is still language in here that puts

[0:19:02] Voice 10: that at this at the discretion of trust council if it is something that we feel is really important

[0:19:08] Voice 10: we're not being barred from from disposing of delegations in the moment um you know we're

[0:19:14] Voice 10: being encouraged through through this to uh you know allow for some time and some consideration

[0:19:20] Voice 10: as director marler is saying um i i would similarly you know question that specific

[0:19:28] Voice 10: will. But my, you know, broadly, I think it's important that this body's discretion to deal

[0:19:37] Voice 10: with those delegations is not unduly fettered. And I, you know, I can absolutely understand

[0:19:42] Voice 10: the hesitation of, you know, the appearance of wanting to delegate all of that response back to

[0:19:50] Voice 10: the executive. You know, there are oftentimes when there's discussions that are worth having

[0:19:55] Voice 10: or with the trust council around how we don't you know respond to those delegations that said i don't

[0:20:01] Voice 10: see that this overall bylaw precludes that um i think it it's also on us we don't have to take

[0:20:09] Voice 10: our lead entirely from the bylaw it's also our responsibility as trustees to take a moment of

[0:20:14] Voice 10: leadership in that moment and decide that if there's something important that we want to talk

[0:20:18] Voice 10: about that we do that and also that we are aware that we should take the time and we shouldn't

[0:20:24] Voice 10: be rash. We should respond in a timely manner and make sure that we have

[0:20:28] Voice 10: the facts.

[0:20:29] Trustee Patrick: All right. Trustee Peterson, then Morrison.

[0:20:33] Voice 13: So speaking as the trustee that

[0:20:36] Voice 13: has been pushing this for a couple of years, I'd prefer

[0:20:41] Voice 13: if we go at it today and let's fix it if

[0:20:45] Voice 13: it's not right. But some of the rationale is, from my end,

[0:20:50] Voice 13: is when we do the work of

[0:20:52] Voice 13: disposition, doing our due diligence so that we're aware if a response is going to consume staff

[0:21:02] Voice 13: time, potentially disrupt workflow, and if there's financial implications. And those are the two

[0:21:10] Voice 13: biggies from my perspective. In terms of time being of the essence, I think there's things like

[0:21:18] Voice 13: a letter of support that needs to be uh delivered by a certain date that's well before the next

[0:21:25] Voice 13: trust council for example um and then i don't see anything in 5.18 that would restrict the ability

[0:21:34] Voice 13: of trust council to give some direction um to the executive or the chair about what the response

[0:21:41] Voice 13: should include. So I'm actually quite comfortable with this. I think this is an improvement to,

[0:21:48] Voice 13: again, I think Trustee Borthwick said to encourage us to consider financial and staff

[0:21:54] Voice 13: workflow implications and to take pause rather than, this comes out of my past experience of

[0:22:02] Voice 13: seeing responses to delegations that did have implications on staff workflow, that did have

[0:22:11] Voice 13: have implications financially that weren't really we didn't wade through that at all

[0:22:16] Voice 13: at trust council we just went ahead made the decision and to me that was problematic so i

[0:22:21] Voice 13: think this is a vast improvement i feel like there's enough flexibility within 5.18 um

[0:22:28] Voice 13: uh to for council to as i said to really give some direction on what aspects should be

[0:22:37] Voice 13: considered by any responses delegated to EC or the Chair. Thank you.

[1:08:13] Voice 11: There is an attachment to the policy 2.5.1, which is a chief administrative officer's policy for evaluation, and that attachment is the timeline, the work that the committee will do.

[1:08:37] Voice 11: policy this committee will by april i believe meet to determine how it's going to meet through

[1:08:44] Voice 11: the year and what it's going to do and how it's going to interact with trust council

[1:08:56] Voice 11: little bit different on dates and it didn't seem to make sense to have to come to council to update

[1:26:14] Voice 15: Well, what is happening there now is so exciting and so innovative.

[1:26:54] Voice 7: that they immediately provide a short summary to everyone.

[1:26:58] Voice 7: And then that can be compiled for Trust Council so that people aren't scrambling around.

[1:27:04] Voice 7: I mean, the immediacy of, like, I went to the house sound, whatever, and here's what happened would be, I think, quite helpful.

[1:27:35] Voice 17: like how much business we had to get through versus how many substantive discussion pieces.

[1:27:43] Voice 17: And I think, like, yesterday we had, like, one good solid roundtable with lots of time to talk about our views on the matter.

[1:27:52] Voice 17: So if in our feedback, if you can, maybe we can have a question about, you know,

[1:27:57] Voice 17: how many discussion items can we handle in a three-day stretch?

[1:28:00] Voice 17: and was this agenda an achievable amount of business

[1:28:04] Voice 17: that would help us for planning the next?
