[0:00:34] Voice 8: in the territory of Coast Salish peoples, and we respectfully acknowledge that Hornby Island
[0:00:40] Voice 8: is the unceded traditional territory of the Comox First Nation, the traditional keepers of this land.
[0:00:47] Voice 8: Just reflecting, I think it's been a big year for Comox.
[0:00:51] Voice 8: Um, they ratified, um, uh, treaty on their end of things.
[0:00:57] Voice 8: And so that work is progressing and I, I hope that continues in a positive vein.

[0:01:05] Voice 8: I'm elected on Laskete Island and I'm the chair of the Hornby Island local trustee,

[0:01:11] Voice 8: Um, I'm joined today by, uh, Hornby Island local trustee, uh, Alex Allen.
[0:01:18] Voice 8: and we're hoping that trustee Grant Scott joins us shortly.
[0:01:24] Voice 8: Also with us today is Planner Sonia Zupanek and Lisa Millard is our administrator and
[0:01:37] Voice 8: minute taker, bylaw enforcement manager, Warren Dingman is with us, and Lisa Govro, the chair
[0:01:46] Voice 8: Chair of the Islands Trust Conservancy has also joined us today and will be giving us an update on the Islands Trust Conservancy fairly soon.
[0:01:59] Voice 8: This meeting is an official forum for the local trust committee to make decisions about land use planning and discuss relevant business.
[0:02:07] Voice 8: And I want to add that this is a place of employment.
[0:02:09] Voice 8: And despite the fact that some staff may be in their homes, our staff have the right to a safe and respectful workplace.
[0:02:20] Voice 8: So with that, we have an agenda before us and look to see if there are any amendments to the agenda desired.

[0:02:53] Voice 4: I guess I'll say that I attended the Trust Council on South Spring Island.
[0:03:00] Voice 4: I had to leave as usual earlier on Thursdays.
[0:03:03] Voice 4: But I will say the delegations are always pretty good, the highlights.
[0:03:09] Voice 4: and then, I can't pronounce his middle name,
[0:03:15] Voice 4: Terrell Peterson, but Jared Williams' presentation
[0:03:19] Voice 4: was excellent.
[0:03:22] Voice 4: I think I'll just highlight in terms of,
[0:03:27] Voice 4: he's known on Horme Island.
[0:03:29] Voice 4: He's done a lot of presentations through Arts Council
[0:03:31] Voice 4: and various other venues.
[0:03:33] Voice 4: But it was really interesting in terms of how they name,
[0:03:36] Voice 4: their place names versus colonial settlers,
[0:03:40] Voice 4: Settlers, all about them, all about their names.
[0:03:43] Voice 4: And First Nations names, it's all about what happens there.
[0:03:47] Voice 4: So that's why Hornby Island is the outer island,
[0:03:49] Voice 4: and that's why Denman is the inner island.
[0:03:50] Voice 4: That's what we're called.
[0:03:52] Voice 4: We're not called, you know, after somebody who happened,
[0:03:55] Voice 4: somebody's bosun's sons, whatever.
[0:04:01] Voice 4: Anyways, it was a nice presentation from him.
[0:04:04] Voice 4: And as well, we're continually trying to explore good conduct
[0:04:09] Voice 4: to Trust Council and so we had
[0:04:13] Voice 4: 9 to 11.30

[0:04:16] Voice 4: a huge amount of time presented to
[0:04:18] Voice 4: deal with the behavior
[0:04:21] Voice 4: at Trust Council. My biggest thing is those phones,
[0:04:23] Voice 4: those so-called smartphones.
[0:04:25] Voice 4: Turn them off. I go on and on about that.
[0:04:27] Voice 4: But I think we're
[0:04:28] Voice 4: getting there. There wasn't so
[0:04:31] Voice 4: many point of orders this last

[0:04:42] Voice 8: And in the absence of Trustee Scott, we'll move on to the Chair's report.
[0:04:48] Voice 8: So I also wanted to share some highlights from the Trust Council meeting.
[0:04:53] Voice 8: The Policy Statement Amendment Project was decided that Trust Council will have a special electronic committee,
[0:05:01] Voice 8: the whole meeting, July 9th, to review the current draft.
[0:05:06] Voice 8: And then we're going to schedule a special electronic meeting of Trust Council for 29th of July to consider first reading.
[0:05:19] Voice 8: Trust Council adopted Bylaw 197, which is the Local Trust Committee Meeting Procedures Bylaw.
[0:05:25] Voice 8: and this bylaw will now supersede the meeting procedures bylaws
[0:05:32] Voice 8: that were in a variety of formats throughout the trust area
[0:05:38] Voice 8: and that's a new direction.
[0:05:44] Voice 8: Not radically different, I would say, the Hornby meeting procedures bylaw
[0:05:49] Voice 8: and the one coming to us from Trust Council,
[0:05:52] Voice 8: But that new one will be superseding the previous one.
[0:05:58] Voice 8: I also had a note on Jared Costanahan-Williams' presentation.
[0:06:05] Voice 8: Just always a fascinating speaker, sharing oral traditions and stories and concepts of traditional concepts around land ownership,
[0:06:18] Voice 8: partnerships um rights to harvesting areas and use of shared spaces and uh he's really interested
[0:06:27] Voice 8: in uh creating opportunities to revitalize traditional indigenous food systems and
[0:06:33] Voice 8: reconnecting through the land um and uh culturally grounded practices and his he's just a he's just
[0:06:42] Voice 8: a very captivating speaker and i absolutely love his storytelling um also of note uh yesterday our
[0:06:51] Voice 8: member of parliament gordon johns came to liskiti for a visit and to i went with him to wish uh
[0:06:58] Voice 8: a happy 100th birthday to our oldest resident a long time ndp supporter but also had an
[0:07:06] Voice 8: opportunity to chat with him uh about issues um of interest to liskiti and also as the chair of
[0:07:13] Voice 8: hornby uh local trust committee i we spoke a little bit about some of the uh uh issues before
[0:07:19] Voice 8: the local trust committee on hornby so i thought that would be good to share with you
[0:07:23] Voice 10: all and
[0:07:26] Voice 8: i see
[0:07:27] Voice 8: trustee scott has joined us glad to see you sir thank you can you hear me i can and uh do you have
[0:07:35] Voice 8: anything you would like to share as a trustee report today yeah

[0:07:43] Voice 6: i go on the co-op or around and about i hear about short-term vacation rentals uh the good the bad
[0:07:51] Voice 6: and the ugly i mean a lot of people highly support them and i think the general consensus i'm hearing
[0:07:57] Voice 6: is we absolutely need them it's part of our uh island economy it's part of our character so
[0:08:03] Voice 6: So I think that it's going to be essential we move that along quickly early in the fall and get it going.
[0:08:11] Voice 6: I've also heard some issues around rugby pitch and what's going on there, but that's going to come up a little later in the agenda.
[0:08:19] Voice 6: So I think we're going to leave it at that.

[0:08:29] Voice 8: And next, helping us to acknowledge the 35th anniversary of the Islands Trust Conservancy,
[0:08:37] Voice 8: We have Alistair's Conservancy Chair, Lisa Govero, joining us.

[0:08:44] Voice 10: Good morning. Good morning. It's good to see everybody.
[0:08:49] Voice 10: Great. Yes, my name is Lisa Govero.
[0:08:53] Voice 10: I'm elected over on Galliano Island, where the sun is shining and where I'm zooming in from today.
[0:09:00] Voice 10: Galliano is in the core territory of the Penelope tribe.
[0:09:04] Voice 10: I'm here as the chair of the Island Trust Conservancy, and I'd like to begin by recognizing the people who make up our board.
[0:09:11] Voice 10: Tanner Timothy is our vice chair. He's a provincial appointee to our board.
[0:09:17] Voice 10: Dr. Risa Smith is also a provincial appointee and also an accomplished conservation biologist.
[0:09:24] Voice 10: Trustee Charles Kahn, who's based on Salt Spring, and he's our third provincial appointee.
[0:09:29] Voice 10: trustee Susan Yates is elected over on Gabriela Island and Toby Elliott is our executive committee
[0:09:36] Voice 10: liaison. We're also supported by our outstanding staff. Our team lead is acting manager Wendy
[0:09:44] Voice 10: Tyrrell. Catherine Martel is our ecosystems protection specialist. Gemma Green is a covenant
[0:09:52] Voice 10: management and outreach specialist. Nuala Murphy property management specialist and Mike Richards
[0:09:59] Voice 10: who is a strategic fund development specialist, Erica Wheeler, a species at-risk coordinator,
[0:10:07] Voice 10: and our administrative assistant, the wonderful Coraline Strachan. And then the communication
[0:10:12] Voice 10: specialist is Michaela Yanni, who's been very instrumental in helping us celebrate our 35-year
[0:10:19] Voice 10: milestone. Our work is also supported by Director Freider of Trust Area Services. We're a small but
[0:10:26] Voice 10: but a very mighty team.
[0:10:27] Voice 10: As I mentioned, this year marks our 35th anniversary
[0:10:30] Voice 10: and we've launched a wide ranging campaign
[0:10:34] Voice 10: to share our story and celebrate the lands that we protect.
[0:10:37] Voice 10: And in order to connect more deeply
[0:10:40] Voice 10: with the communities across the trust area.
[0:10:43] Voice 10: Since 1990, Balanced Trust Conservancy
[0:10:46] Voice 10: has worked very closely with landholders,
[0:10:48] Voice 10: communities and conservation partners
[0:10:50] Voice 10: to protect the other places that we all love.
[0:10:52] Voice 10: To date, the ITC protects 115 properties, including 34 nature reserves and 81 conservation covenants,
[0:11:01] Voice 10: totaling more than 1,385 hectares of ecologically significant land.
[0:11:07] Voice 10: As part of our 35th anniversary campaign, we've launched the 35th anniversary logo,
[0:11:13] Voice 10: which I haven't figured out how to put into my Zoom yet. You'll see it up here soon.
[0:11:17] Voice 10: soon um um we also uh had big media release back in january uh we celebrated our social
[0:11:26] Voice 10: with our social media campaign we reached over 40 000 individuals so far with that
[0:11:30] Voice 10: um yeah we're promoting our anniversary in newspapers we've scheduled time at booths
[0:11:38] Voice 10: at different fairs uh pender and salt spring and on gabriola um and pretty much attending as many
[0:11:45] Voice 10: community events as we can over the summer. We also launched the Islands Trust Conservation
[0:11:51] Voice 10: Journal. It's on our website and it's a new blog where we're collecting or featuring stories
[0:11:57] Voice 10: and reflections across the islands. We invite everyone to check it out and share your stories.
[0:12:04] Voice 10: There's an online link to SurveyMonkey where you can upload photos and tell us your story.
[0:12:13] Voice 10: Last month, we also released our spring edition of the Herring Newsletter.
[0:12:18] Voice 10: Both the summer and the fall editions will continue to celebrate the 35th anniversary.
[0:12:24] Voice 10: And you can see the newsletter. It's on page 90 of this agenda.
[0:12:28] Voice 10: But the real big news this year, and I'm really thrilled to share with all of you today,
[0:12:35] Voice 10: is that the Allen Stress Conservancy has received a $1.15 million donation from an anonymous donor,
[0:12:44] Voice 10: one of the largest private gifts in our history. The donation was made through the Shore Peak
[0:12:51] Voice 10: Gen Fund at the Vancouver Foundation. Of this gift, $1 million will go into our Opportunity Fund
[0:12:58] Voice 10: and help us to restore the land protection opportunities as they arise.
[0:13:03] Voice 10: um sometimes conservancies need money quickly and there's items that are hard to fundraise for
[0:13:11] Voice 10: surveys for example um and the additional one hundred and fifty seven thousand three hundred
[0:13:18] Voice 10: dollars is dedicated to our project um it supports ongoing care um nature reserves
[0:13:26] Voice 10: through trail maintenance and evasive species removal and ecosystem restoration
[0:13:30] Voice 10: This gift could not have come at a better time, land prices are rising, ecological threats are mounting, and conservation has never been more urgent.
[0:13:42] Voice 10: We're incredibly grateful to this generous vision, which has helped us deepen our partnerships with First Nations, support local groups, and to protect more of what makes these lands extraordinary.
[0:13:56] Voice 10: extraordinary, heartfelt thank you to our anonymous donor, and thank you to everyone here
[0:14:02] Voice 10: that has come before me who makes this kind of work possible. I have a few highlights from our

[0:14:22] Voice 10: highlights from our last meeting under land transfers and policy development, things that
[0:14:27] Voice 10: we're working on. ITC staff have met with the Ministry of Housing and Municipal Affairs
[0:14:32] Voice 10: to discuss the deposition of land to Indigenous governing bodies. And the ministry recommends
[0:14:39] Voice 10: that the ITC develop formal policy that we included into our five-year plan. Under joint
[0:14:45] Voice 10: planning, we've done some work to kind of straighten our relationship between the Conservancy
[0:14:51] Voice 10: and other trust bodies.
[0:14:53] Voice 10: Chair Patrick joined us at a meeting
[0:14:55] Voice 10: to help shape an agenda
[0:14:56] Voice 10: for an upcoming executive committee
[0:14:59] Voice 10: and ITC meeting.
[0:15:01] Voice 10: These meetings are held three times a year
[0:15:03] Voice 10: and focus primarily on alignment
[0:15:06] Voice 10: across these organizations,
[0:15:08] Voice 10: ensuring that the priorities of the Conservancy,
[0:15:12] Voice 10: especially around conservation planning,
[0:15:15] Voice 10: Indigenous engagement,
[0:15:17] Voice 10: sustainable funding,
[0:15:18] Voice 10: are better integrated with trust-wide initiatives and governance and vice versa.
[0:15:24] Voice 10: Our next meeting, the ECITC meeting, is later this month on July 22nd,
[0:15:30] Voice 10: where we'll have two representatives from the Cowichan tribes
[0:15:34] Voice 10: who will make a presentation focused on co-governance models
[0:15:38] Voice 10: and particularly with an emphasis on what's working,
[0:15:42] Voice 10: key learnings and principles that make co-governance effective
[0:15:47] Voice 10: effective and meaningful. Look forward to that meeting. Under budget and reporting we approved
[0:15:54] Voice 10: the 2024 audit financial statements as most did, most bodies did, and referred to the Trust Council.
[0:16:02] Voice 10: We also submitted our ITC annual report to be shared with the Minister of Housing and Municipal
[0:16:10] Voice 10: Affairs as part of the Trust Council submission and requested our staff to begin preparing our
[0:16:17] Voice 10: 2026-27 budget requests. In addition to the budget on land management and governance that
[0:16:25] Voice 10: I mentioned earlier, the boards also reviewed and responded to many planning referrals from
[0:16:30] Voice 10: local trust committees. ITC confirmed it had no concerns regarding the Salt Spring By-law
[0:16:35] Voice 10: number 451. Also received the North Pender By-law 235, which prompted an update from our
[0:16:44] Voice 10: species at risk coordinator. We recommended to refresh the raptor and herring nesting habitat
[0:16:50] Voice 10: mapping to better align with the current data and habitat conditions. This work aligns with
[0:16:56] Voice 10: North Pender's ongoing review of their raptor and herring nesting development permit review
[0:17:05] Voice 10: and it's a positive step towards updating environmental protections.
[0:17:08] Voice 10: This kind of referral work might seem extremely technical at times but it's one of the ways that
[0:17:13] Voice 10: the Conservancy contributes its expertise to local land use decisions. And looking ahead,
[0:17:21] Voice 10: as always, our work is rooted in relationships with landholders, communities, Indigenous nations,
[0:17:28] Voice 10: and all of you listening today. As we mark the 35th anniversary, we are looking ahead.
[0:17:35] Voice 10: Our vision remains clear, protect diversity and nature systems in the Trust Area. The next 35
[0:17:42] Voice 10: five years will bring new challenges but it'll also bring new allies and new stories uh and new
[0:17:48] Voice 10: legacies and you're all invited to be a part of it whether it's a donor as a volunteer landholder
[0:17:54] Voice 10: or simply a good caring neighbor uh thank you for inviting me to speak today i'm always happy to

[0:18:24] Voice 8: as a very valuable piece of work within the greater islands trust
[0:18:28] Voice 8: organization, the work of your body.

[0:18:54] Voice 10: Well, as the million dollars is dedicated, the donors requested that that money goes into that fund.
[0:19:01] Voice 10: And that fund is applied for by different conservancies or different groups that are looking for acquisitions of lands.

[0:19:20] Voice 4: So, for instance, if there's community members on various islands that say, there's this land we really think should be part of our conservancy, they could approach conservancy and...

[0:19:30] Voice 10: Absolutely. It's meant to be ready, ready money as well.
[0:19:34] Voice 10: So something might be kind of waiting in the wings and the opportunity is now.
[0:19:38] Voice 10: And that's why this fund was created initially,
[0:19:40] Voice 10: so that we'd have access to moving forward with those impromptu sudden in the
[0:19:48] Voice 10: moment acquisitions. Yes.

[0:22:21] Voice 12: And I think they're both on the agenda, but I'm not quite sure.
[0:22:24] Voice 12: one is about the secondary suites with people who are maybe living there illegally and i know
[0:22:33] Voice 12: there's a moratorium i just really want to encourage that to remain in place and that
[0:22:38] Voice 12: moving forward the trust really look carefully and hard at how to protect those homes so that
[0:22:46] Voice 12: they don't increase our our number of folks who are not having a roof over their head that's
[0:22:53] Voice 12: really important that that um be looked at as part of this whole bylaw and land use uh review
[0:23:00] Voice 12: um and my second one is is on the stvr um issue i've met with um history a couple of times now
[0:23:08] Voice 12: and i'd really like to support most of the letter that they've sent in to the to the trust um i do
[0:23:15] Voice 12: think that there needs to be a cap sooner than later and i think that it's important that
[0:23:21] Voice 12: permanent residents who operate STVRs are included in that cap. My concern is that if
[0:23:28] Voice 12: they're excluded, which I appreciate the attempt to give them priority, is that it just opens it
[0:23:34] Voice 12: up for more non-year-round residents to operate an STVR here. So I'd like permanent residents
[0:23:42] Voice 12: who operate STVRs to be included in that cap. And I'd like it to move as soon as possible,

[0:24:53] Voice 2: are that april was talking about that we've reviewed with her um and that we have raised
[0:24:58] Voice 2: there is one new one in the list which will come in a letter that's coming so there's seven things
[0:25:03] Voice 2: one is enabling a cap through a community um consultation process um the new thing is uh we
[0:25:12] Voice 2: We think that probably it should be included that one TUP per person or business or family group, et cetera, at a time be included in it.
[0:25:27] Voice 2: that there be specific reference to the fact
[0:25:30] Voice 2: that TUPs can be reapplied for after the six-year cycle
[0:25:34] Voice 2: because that is, it's an accepted process,
[0:25:38] Voice 2: but it's not actually written in the provincial bylaw.
[0:25:45] Voice 2: Allowing people to reapply kind of within six months
[0:25:49] Voice 2: of the end of their TUP to spread out the work for staff,
[0:25:52] Voice 2: staff, enabling the potential to move to a CVRD licensing program if a program exists and it's
[0:26:00] Voice 2: reasonable, making some provisions for permanent residents. And obviously there's some difference
[0:26:06] Voice 2: on whether they should or should not be included in the cap. Our recommendation would be exempt
[0:26:11] Voice 2: them from the cap, but then the cap would be determined based on the number of part-time
[0:26:18] Voice 2: people offering uh strs um or consider um consider the tup for fee deferrals um and allow them to
[0:26:30] Voice 2: stay on site when their home is rented which currently isn't allowed and the last one is
[0:26:35] Voice 2: making sure that our bylaws define short term as under 30 days because at this point the provincial
[0:26:41] Voice 2: financial bylaw says it's under 90 days and without specific reference to that change the
[0:26:48] Voice 2: 90-day application the 90-day definition will apply. So that's it and those seven things are
[0:26:54] Voice 2: pretty much we think pretty widely supported. We do think that there needs to be some work on how
[0:27:02] Voice 2: the TUP is going to be operated. We would very much like to work with the staff and any other
[0:27:09] Voice 2: community group that you think is viable to help make uh the processes around water and septic
[0:27:16] Voice 2: um etc um workable um affordable and reflect the intention of the addition in the bylaw

[0:51:38] Voice 9: consider and they're considered non-residential commercial style uses so they fall outside the
[0:51:44] Voice 9: permitted agricultural residential uses for the property the initial event that the applicant is
[0:51:51] Voice 9: planning for is a hornby island community fund fundraiser on july 27th with anticipated
[0:51:57] Voice 9: attendees of 120 members the site context is very comprehensive in this application the property is
[0:52:07] Voice 9: 32 just over 32 hectares owned agriculture and it's within the agricultural land reserve the
[0:52:15] Voice 9: tup would be valid for three years and renewable once before a new application would need to be
[0:52:20] Voice 9: made the applicant's rationale for this application is that they will be making
[0:52:26] Voice 9: agricultural improvements
[0:52:27] Voice 9: to the property including fencing irrigation grazing agreements restoration they're planning
[0:52:34] Voice 9: for agritourism and community events to support farm viability in this case.
[0:52:41] Voice 9: And the events are intended to be low impact and community focused.
[0:52:46] Voice 9: So a summary of some of these issues and opportunities in the staff report include
[0:52:51] Voice 9: that farm status has been applied for, but is not currently in effect.
[0:52:56] Voice 9: It is expected by October 2025.
[0:53:00] Voice 9: The events would all have to comply with the Agricultural Land Reserve regulations
[0:53:04] Voice 9: stipulations which allows a maximum of 10 events per year but there's currently no fixed number
[0:53:11] Voice 9: listed in the draft temporary use permit in your agenda package the ALR regs also stipulate a
[0:53:17] Voice 9: maximum attendance of 150 people per event there are potential impacts regarding noise traffic
[0:53:24] Voice 9: parking the natural environment there are noise controls proposed that the events would all be
[0:53:34] Voice 9: ending by midnight and comply with regional noise bylaw there is parking off-road proposed in
[0:53:40] Voice 9: hayfield and the applicant proposes waste management and recycling and composting
[0:53:48] Voice 9: as you are aware there's been a number of correspondence pieces of correspondence received
[0:53:55] Voice 9: prior to this agenda being finalized and they've all been posted to the application website
[0:54:02] Voice 9: site. So they're up to date as of this morning, I believe, as well, in support, as well as
[0:54:12] Voice 9: addressing very specific concerns and non-support for issuance of this TUP. Their notices were sent
[0:54:19] Voice 9: to neighbours and advertised twice in the local paper. There is the option for the LTC to refer
[0:54:24] Voice 9: this to the Advisory Planning Commission should you wish to receive recommendation from the APC
[0:54:30] Voice 9: prior to consideration of the temporary use permit and the ltc's advise that you are able to
[0:54:36] Voice 9: make amendments to this temporary use permit today prior to issuance some possible amendments
[0:54:41] Voice 9: could be stipulations around the timing of events needing to end earlier or later times or not at
[0:54:49] Voice 9: all from the midnight number currently proposed limiting the number
[0:54:55] Voice 9: of events per year so less
[0:54:58] Voice 9: than the 10 events that's currently permitted under the ALR regulations. The TUP does align
[0:55:05] Voice 9: with the ALR regulations and ALC policies. The potential impacts can be mitigated by
[0:55:12] Voice 9: the temporary use permit conditions. It does seem to support community and economic
[0:55:19] Voice 9: vitality without adverse impacts on agricultural use. There are a number of alternatives the LTC
[0:55:27] Voice 9: can consider today, including the referral to your advisory planning commission, requesting
[0:55:32] Voice 9: more information from the applicant, adding specific conditions to the temporary use permit,
[0:55:38] Voice 9: or amending the ones that are already there, or denying the application. If you have any specific
[0:55:44] Voice 9: questions, I'd be happy to try to answer them at this time. And I'm not sure if the applicant is
[0:55:49] Voice 9: in attendance, but they should be offered an opportunity to speak as well.

[0:57:09] Voice 11: But one of the issues that was raised in the letter is that we are non-residents of Hornby.

[0:57:32] Voice 11: A second erroneous statement is that we purchased this property just for our own activities.

[0:57:43] Voice 11: We've offered the field as a home field for the school because they don't have a full sports field.
[0:57:49] Voice 11: So we would love for the school to take advantage of that.
[0:57:53] Voice 11: We've also been approached by many community members about hosting different things.
[0:57:59] Voice 11: One being a classical night, classical music night.
[0:58:02] Voice 11: And so we're open to many suggestions.
[0:58:05] Voice 11: The property had been a residence for 34 years, not farmed.
[0:58:11] Voice 11: When we purchased the property a few years ago, we cleared the trees that lined the road,
[0:58:18] Voice 11: central road so that people could actually see into the property again that was the request that
[0:58:23] Voice 11: was made to us and we've gotten so much positive feedback about just being able to to view the
[0:58:29] Voice 11: beauty of the property um i guess there's lots of parking yeah so one concern we all have on hornby
[0:58:39] Voice 11: our cars being parked along the roads which and the roads are small to begin with so that's
[0:58:44] Voice 11: That's obviously a valid concern.
[0:58:46] Voice 11: We have a ton of parking on the property.
[0:58:50] Voice 11: So we would not be impeding access along Central Road.
[0:58:55] Voice 11: Another issue is the impact that we may have on the aquifer.
[0:59:01] Voice 11: We have built with the help of Eben,
[0:59:07] Voice 11: wonderful local, I guess, man of all trades,
[0:59:12] Voice 11: we build a pond that's 300 000 gallons that would be used that's filled naturally right now it's
[0:59:20] Voice 11: filled to the brim that would be used um for water purposes and we would be purchasing water for any
[0:59:25] Voice 11: events that we have so we have we plan to have no impact on the aquifer because i know that is a
[0:59:31] Voice 11: valid concern um and the third issue the last issue i wanted to raise oh i'm sitting here with
[0:59:39] Voice 11: my friend, of course I cannot remember. I know I read somewhere from one community member that she
[0:59:48] Voice 11: was concerned that rugby players would be transported onto the property by way of
[0:59:53] Voice 11: helicopter and private planes. Nothing could be further from the truth. That is not the plan.
[1:00:00] Voice 11: to include something in there that you know she's requested that the TPU specifically states that
[1:00:05] Voice 11: that is fine it's it's a non-issue but if it's raised it's it's raised the concern and oh the
[1:00:14] Voice 11: last thing I'd want to say so in BC we have a club called a Thunder Indigenous Youth Rugby Club
[1:00:21] Voice 11: and it is a rugby club that spans right across right across the province excuse me and it's
[1:00:29] Voice 11: comprised of indigenous youth coaches management staff they they've not had a clubhouse because
[1:00:37] Voice 11: of logistics um just first of all the cost of doing that second of all because all the players
[1:00:43] Voice 11: are from all over the province and we've attacked we've opposed john lyle who is the director of
[1:00:49] Voice 11: rugby at thunder and offered the clubhouse as a thunder indigenous official rugby clubhouse
[1:00:56] Voice 11: and symbolic but it does allow them to have a place where they could put like their trophies and
[1:01:03] Voice 11: um they have you know special items that they have no place to host them so that is a sense
[1:01:11] Voice 11: of pride for us that they've actually agreed that they would use our clubhouse as their official

[1:04:35] Voice 9: because it's anticipated, I think, that the applicant would not be using their septic or their
[1:04:38] Voice 9: on-site water for those services but bringing them in so perhaps they could provide that
[1:04:43] Voice 9: clarification for you um but that if the applicant's characterization of the use of the
[1:04:53] Voice 9: property for sporting events and a sporting clubhouse of any nature uh is intended to be
[1:05:00] Voice 9: included in this tup then yes that's a significant amendment that staff would need to go back to
[1:05:04] Voice 9: to consider whether or not that's aligned with the ALR regulations
[1:05:11] Voice 9: before giving you further advice.

[1:42:50] Manager of Bylaw Compliance and Enforcement: and consideration by the committee and the proposal is to incorporate all current standing
[1:42:54] Manager of Bylaw Compliance and Enforcement: resolutions for compliance enforcement into a single document and to provide comprehensive
[1:42:59] Manager of Bylaw Compliance and Enforcement: policies around how we attain to our business. We try to gain compliance and enforcement on
[1:43:07] Manager of Bylaw Compliance and Enforcement: Hornby. Last fall, the local trust committee amended its Bend by-law and as a part of that
[1:43:15] Manager of Bylaw Compliance and Enforcement: review and amending of the Bend by-law, local trust committees are asked to review their
[1:43:19] Manager of Bylaw Compliance and Enforcement: compliance and enforcement policies, including their screening officer policies for disputed
[1:43:25] Manager of Bylaw Compliance and Enforcement: by-law violation notices. With this policy, it will contain a policy regarding vexatious
[1:43:35] Manager of Bylaw Compliance and Enforcement: complaints something that hasn't been present before either at the trust council level or at
[1:43:41] Manager of Bylaw Compliance and Enforcement: the LTC level so the language in the proposed policy will allow some discretion by staff to
[1:43:48] Manager of Bylaw Compliance and Enforcement: not pursue complaints if they are deemed to be vexatious so with the policy it goes through
[1:43:59] Manager of Bylaw Compliance and Enforcement: So there are two parts to it.
[1:44:00] Manager of Bylaw Compliance and Enforcement: Part A are the general policies.
[1:44:03] Manager of Bylaw Compliance and Enforcement: Part B is the screening officer policy for your BIN bylaw.

[1:44:14] Manager of Bylaw Compliance and Enforcement: Within the priorities section four, it lists what the LTC wants as a priority for proactive enforcement
[1:44:27] Manager of Bylaw Compliance and Enforcement: or what policies or bylaws it wishes to defer enforcement on.
[1:44:32] Manager of Bylaw Compliance and Enforcement: So you have by standing resolution previously established a proactive
[1:44:36] Manager of Bylaw Compliance and Enforcement: enforcement policy for short-term vacation rentals.
[1:44:40] Manager of Bylaw Compliance and Enforcement: So that is all listed within section 4.1.
[1:44:45] Manager of Bylaw Compliance and Enforcement: And in 4.2, there is the deferment of enforcement against non-permitted dwellings.
[1:44:54] Manager of Bylaw Compliance and Enforcement: As it states there, there's a complaint against, you know, unless the following conditions apply, complaints from immediate neighbors, referral from agencies regarding health and safety, or if there's more than one unlawful dwelling on a lot.
[1:45:08] Manager of Bylaw Compliance and Enforcement: Within this, if the LTC is going to consider adoption today, what's missing from section 4 here is a section referencing the farm stands and deferment enforcement against farm stands.
[1:45:26] Manager of Bylaw Compliance and Enforcement: That was not adopted as a standing resolution. It was adopted as a regular resolution, so that's why I didn't include it initially in here.
[1:45:34] Manager of Bylaw Compliance and Enforcement: But this policy could be amended before it's adopted, and you could add a 4.3 referencing deferment enforcement for farm stands, if that's what the local trust committee would like to proceed on.
[1:45:50] Manager of Bylaw Compliance and Enforcement: You have within the inspection section a requirement to give those subject to enforcement 24 hours notice unless there's issues of health and safety or irreversible damage to the environment.
[1:46:07] Manager of Bylaw Compliance and Enforcement: and what is contained within this document is for the most part standard
[1:46:14] Manager of Bylaw Compliance and Enforcement: throughout all of the local trust areas and the unique parts are really for each

[1:46:26] Manager of Bylaw Compliance and Enforcement: it as much as possible so it's consistent throughout but each local
[1:46:31] Manager of Bylaw Compliance and Enforcement: The local trust committee will have its own set of priorities and input regarding inspections, the amount of time that someone's notice is given.

1. CALL TO ORDER
Chair Peterson called the meeting to order at 11:31 a.m.
2. TERRITORIAL ACKNOWLEDGEMENT
Chair Peterson acknowledged that the meeting was held on the territory of the Coast Salish
Peoples and recognized Hornby Island is the unceded territory of the K’omoks First Nation.
3. APPROVAL OF AGENDA
By general consent, the agenda was approved as presented.
4. REPORTS
4.1 Trustee Reports
Trustee Allen reported attendance at the June Trust Council meeting and
highlighted the presentation by Indigenous Foods Educator Jared “Qwustenuxun”
Williams about traditional concepts of land ownership and the importance of
revitalizing traditional food systems.
Trustee Grant arrived to the meeting at 11:38 a.m.
Trustee Grant reported ongoing community conversation regarding the short-term
vacation rental bylaw.
4.2 Chair's Report
Chair Peterson reported the following:

• Attended Trust Council and noted the adoption of the new Local Trust
Committee Meeting Procedures Bylaw and highlighted the presentation given by
Jared “Qwustenuxun” Williams;
• Continued participation in Trust Policy Statement amendment work which will
be discussed at an upcoming Committee of the Whole meeting and Trust
Council Special Meeting in July to consider First Reading; and
• Met with Member of Parliament Gord Johns during the MP’s recent visit to
Lasqueti Island.
4.3 Electoral Area Director's Report - none
4.4 Islands Trust Conservancy Report
The Islands Trust Conservancy Board Chair reported the following:
• Islands Trust Conservancy is celebrating its 35
th
Anniversary this year and
presently protects 115 properties, including 34 nature reserves and 81
conservation covenants;
• The Conservancy recently received a $1,150,000 donation from an anonymous
donor with $1,000,000 designated to the Opportunity Fund and the balance to
the Property Management Fund which supports trail work, invasive species
removal, and restoration efforts;
• Conservancy staff met with the Ministry of Housing & Municipal Affairs regarding
land transfers;
• The next board meeting will be held July 22 and will include a joint meeting with
Executive Committee; and
• Details and highlights of recent Conservancy work.
5. PUBLIC COMMENTS
A member of the public encouraged the Local Trust Committee to continue to uphold non-
enforcement of illegal dwellings to provide housing security for those living in the units.
They also expressed support of a cap on short-term vacation rentals and noted that
permanent residents operating short-term rentals should be included in the cap.
A member of the public provided a summary of recommendations that the Hornby Island
Short Term Rental Association will be presenting to the Local Trust Committee as follows:
• The cap should be enabled through a community consultation process;
• A limit of one Temporary Use Permit per person, business, or family group;
• Include a reference in the bylaw that one can reapply for a Temporary Use Permit at the
end of the six-year cycle;
• Enable the potential to move to a Comox Valley Regional District licensing program
should one be implemented;
• Include provisions for permanent residents residing in a dwelling that also offers a
short-term rental; and
• Ensure the bylaws define short-term as a period under 30 days as, without specific
reference, the 90-day provincial definition will apply.

7.1 Follow-up Action List Report dated June 26, 2025
Discussion ensued about the status of a letter that was to be sent to K’omoks First
Nation following the Nation’s elections to request a meeting and the Planner
indicted the Local Trust Committee is scheduled to meet with Chief and Council in
early September and will follow up to confirm the date.

that the Hornby Island Local Trust Committee request staff to remove
Follow Up Action List Item No. 4 dated March 21, 2025 that reads “the Local
Trust Committee request staff to prepare a letter to K’omoks Chief and
Council congratulations on election, ratification of the treaty vote and
request leadership to leadership meeting”.

A Trustee asked about a briefing to be provided regarding farmstand regulations on
other islands in the Trust area and Chair Peterson clarified the Local Trust
Committee requested the briefing in response to concerns about farmstand uses
that might be impeded by bylaw enforcement and they sought information to
provide guidelines to amending Hornby regulations to ensure they are reasonable
and fair and, in the interim, the Local Trust Committee had deferred enforcement.

9. APPLICATIONS AND REFERRALS
9.1 Denman Island Bylaw No. 255 Referral - for Response
Discussion ensued regarding the absence of a referral response from K’omoks First
Nation and the Planner clarified the Local Trust Committee is being asked if their
interests are affected by the bylaw.

Island Bylaw No. 255 until K’omoks First Nation has responded to any
concerns.

9.2 PL-TUP-2025-0114 (Savour Group Ltd.) - Staff Report
The Planner summarized the staff report and highlighted the following:

• The application seeks a Temporary Use Permit to enable occasional,
community-oriented events on the subject property;
• The permit is required as these types of events may involve amplified music, a
larger number of attendees that one would normally associate with commercial
uses, and they fall outside of the agricultural and residential uses for which the
property is zoned;
• The property is just over 32 hectares in size and located within the Agricultural
Land Reserve;
• The applicant has indicated they will be making agricultural improvements to
the property including fencing, irrigation, and grazing agreements and are
planning agritourism and community events to support farm viability;
• Farm status has been applied for but is not currently in effect;
• If a permit is issued, any activity would be required to comply with the
Agricultural Land Reserve regulations, which stipulate a maximum number of 10
events per year with up to 150 attendees per event; and
• Several items of correspondence have been received both in support and
opposition of the application.
The applicant was in attendance and stated that: additional letters of support had
been received prior to the deadline; many of the proposed improvements to the
property have been made; use of the field has been offered to the local school for
sports activities; event parking would not impede road access; water will be
supplied by a 300,000-gallon pond and brought on site if needed, and they have
offered clubhouse space to an Indigenous youth rugby club.
Discussion ensued and the following comments and clarifications were noted:
• The proponents are required to have farm status before they are granted the
ability to offer events under Agricultural Land Reserve regulations;
• The events included in the Temporary Use Permit align with Agricultural Land
Reserve regulations; however, sports field and clubhouse use do not comply
and have also not been included in the Temporary Use Permit application;
• Letters of support are not from immediate neighbours;
• There may be difficulty in capping attendance at events;
• Trucking water in is not environmentally sound; and
• The uses are not farm or agritourism related.
The meeting was recessed for a break at 12:48 p.m. and reconvened at 1:02 p.m.

that the Hornby Island Local Trust Committee deny application PL-TUP-
2025-0114 for the following reasons:
1. Given concerns raised in the community; this is high impact not low-
impact.
2. Not consistent with Agricultural Land Reserve regulations; not a
permitted farm use.
3. Not consistent with the Hornby Island community plan for farming and
food security.

primary farm use.
8. Applied for farm use status after bylaw enforcement indicating that the
applicant's intent was on a rugby field before haying and cattle.

13.1 Proposed Hornby Island Bylaw Compliance and Enforcement Policy - Staff
Report
The Bylaw Compliance and Enforcement Manager summarized the staff report and
highlighted the following:
• The proposed policy incorporates all current standing resolutions for
compliance enforcement into a single document to provide comprehensive
policies;
• The policy will address vexatious complaints and provide staff some discretion
to not pursue these types of complaints;
• Section 4 lists Local Trust Committee priorities for proactive and deferred
enforcement; and
• The document standardizes policies across the Trust area while allowing Local
Trust Committees ability for customization.
Discussion ensued and the following comments were noted:
• There is desire to include language regarding deferred enforcement on
farmstands;
• Item 5.5 refers to maximum flexibility for Bylaw and Compliance Officers to
enter a property violating terms of a Temporary Use Permit with no notice
provided;
• Item 7.1 refers to anonymous complaints which are not investigated; and
