[0:00:11] Trustee Maude: I want to begin the meeting by acknowledging that we're fortunate to be able to gather today in locations across the territory of the Coast Salish people.

[0:00:18] Trustee Maude: I'm David Maude, elected on the main island, the chair of the North Pender Island Local Trust Committee.

[0:00:23] Trustee Maude: I'm joined today by your two North Pender Island trustees, Aaron Campbell and Deb Morrison.

[0:00:30] Trustee Maude: Together, we make up the North Pender Island Local Trust Committee.

[0:00:33] Trustee Maude: This meeting is being live streamed and recorded for those who are unable to attend in person today.

[0:00:37] Trustee Maude: The recording will be posted on the Islands Trust website for future viewing.

[0:00:53] Trustee Maude: And we have Warren Dingman, our Manager of Biola Enforcement.

[0:00:58] Trustee Maude: and of course we have Lisa Millard who is our master behind the scenes that is our minute taker

[0:01:04] Trustee Maude: and the manager of our Zoom and very much appreciated for all the efforts that she

[0:01:09] Trustee Maude: brings to us because sometimes it is truly magical. With that I'll just say that this

[0:01:15] Trustee Maude: meeting is official forum for local trust me to make decisions about land use planning matters

[0:01:20] Trustee Maude: and discuss relevant business.

[0:01:24] Trustee Maude: So with that, we have an agenda before us.

[0:01:28] Trustee Maude: Is there any additions or questions about the agenda that we have?

[0:01:34] Trustee Maude: If not, by general consent, we will adopt the agenda that we have.

[0:01:38] Trustee Maude: And we move right into trustee reports.

[0:01:40] Trustee Maude: So who would like to be first?

[0:01:52] Voice 3: since the last meeting um uh yeah been very busy with the farm and uh obviously i had trust council

[0:02:01] Voice 3: uh tucked in there and off to salt spring for a few days and um i think it was it was pretty

[0:02:13] Voice 3: you know not not a ton came out of that one it was a pretty quiet meeting uh with the budget and

[0:02:19] Voice 3: stuff having been decided and uh yeah i i feel like i have mostly been fielding uh requests for

[0:02:29] Voice 3: information from people about things that have absolutely nothing to do with us which has been

[0:02:34] Voice 3: super how high the grass is on the side of the road um yeah so it's just it's it's just been a

[0:02:43] Voice 3: it's summertime in the gulf islands and and everybody's got something better to do than

[0:02:47] Voice 3: and then bug a trustee I guess so it's uh it's been good yeah

[0:02:53] Trustee Morrison (probable): I think um the one thing that

[0:02:55] Trustee Morrison (probable): sort of came out and is also sort of percolating within trust council just to be aware of

[0:03:01] Trustee Morrison (probable): is the um trust policy statement is coming sort of forward in different ways David maybe you can

[0:03:09] Trustee Morrison (probable): say more about that where that's at um but that's just something to know um and to keep aware of

[0:03:17] Trustee Morrison (probable): it would be really helpful if as people engage with that they can actually engage with it through

[0:03:22] Trustee Morrison (probable): the process instead of like just jump on it and think what they think it is like actually read it

[0:03:28] Trustee Morrison (probable): and like understand it a little bit would be super helpful um and i think yeah it's been pretty quiet

[0:03:36] Trustee Morrison (probable): since we our last meeting was on may 30th it's been pretty quiet other than trust council related

[0:03:41] Trustee Morrison (probable): related things um so yeah looking forward to uh you know a month or two a month and a half or

[0:03:48] Trustee Morrison (probable): whatever it is of just some like personal breather space um so love to chat with people in august but

[0:03:57] Trustee Morrison (probable): uh and uh yeah looking forward to the fall fair thank

[0:04:02] Trustee Maude: you yeah um so i get a couple things um

[0:04:06] Trustee Maude: So the non-business item of grass at the side of the road got an update.

[0:04:12] Trustee Maude: I see a Saturnia yesterday.

[0:04:13] Trustee Maude: Apparently the mower is broken.

[0:04:16] Trustee Maude: So there was a lengthy email that was provided to Saturnia.

[0:04:21] Trustee Maude: I'll forward that when I get a chance.

[0:04:24] Trustee Maude: So for some reason, ENCOM, I guess they contract up to another party for the mowing.

[0:04:30] Trustee Maude: And I guess their mower is having mechanical problems, which has caused a delay on the southern Gulf Islands.

[0:04:36] Trustee Maude: My only comment yesterday was it's kind of surprising because, you know,

[0:04:40] Trustee Maude: it's not like there's only one mower around or one contractor.

[0:04:43] Trustee Maude: So I don't understand sort of what's going on,

[0:04:47] Trustee Maude: but we've been kind of assured that the ministry's on it.

[0:04:50] Trustee Maude: So hopefully we will all be seeing some mowing because it is a problem.

[0:04:55] Trustee Maude: Although I must say Maine less so because we are blessed with an abundance of

[0:05:00] Trustee Maude: deer who have kept the side of the shoulders of the road actually quite low.

[0:05:04] Trustee Maude: As I was over on Salt Spring,

[0:05:05] Trustee Maude: I think it was last week, and the grass is extremely high

[0:05:08] Trustee Maude: on the side of the road, with Main Island maybe six inches high.

[0:05:13] Trustee Maude: So I have an open off, and I made it to Saturna.

[0:05:16] Trustee Maude: They weren't interested, but if you want any deer,

[0:05:18] Trustee Maude: we can get them on a barge and get them over to you guys,

[0:05:21] Trustee Maude: and it will help the situation in a good, wholesome, and natural way.

[0:05:24] Trustee Maude: So that's my offer.

[0:05:27] Trustee Maude: Trustpology statement, yes, on Tuesday we are having a meeting

[0:05:33] Trustee Maude: that is actually scheduled for seven hours i'm hoping it'll be seven minutes um the anticipation

[0:05:41] Trustee Maude: is that we'll be able to give the policy statement first reading on on tuesday um we've as you both

[0:05:48] Trustee Maude: know we have spent an extensive amount of time um in committee of the whole and trust council

[0:05:55] Trustee Maude: um evolving the document to a point where a majority of trustees are comfortable doing

[0:06:01] Trustee Maude: first reading, which is basically the next step. It's not the final step. If it receives first

[0:06:09] Trustee Maude: reading on Tuesday, we now go out to a very extensive consultation process with Indigenous

[0:06:16] Trustee Maude: Nations, government bodies, and the public. From the public process, there will be a mailer going

[0:06:24] Trustee Maude: going out to every mailbox within the trust area.

[0:06:28] Trustee Maude: So full circulation on that.

[0:06:32] Trustee Maude: And then there will be a survey,

[0:06:35] Trustee Maude: of course, online that we always do and all that,

[0:06:38] Trustee Maude: but also a hard copy survey

[0:06:41] Trustee Maude: with a self-addressed return or stamped return envelope

[0:06:46] Trustee Maude: that will be on all the islands.

[0:06:48] Trustee Maude: I'm assuming places like libraries and such.

[0:06:51] Trustee Maude: So people who are not on the internet

[0:06:53] Trustee Maude: or not active in those electronic mediums can participate in the old-fashioned use of a pencil

[0:07:02] Trustee Maude: and fill out the form and mail it to us so we're trying our best to get it get the engagement out

[0:07:07] Trustee Maude: there get the feedback so once again we can have a whole bunch more long meetings to finally

[0:07:12] Trustee Maude: hopefully finish a document and get it done our goal is to have it done by the end of this term

[0:07:19] Trustee Maude: which is just over a year from now fingers crossed we'll get her done but

[0:07:26] Trustee Maude: until we get it out there after first reading we just don't know how

[0:07:31] Trustee Maude: successful it will be but very much fingers crossed as mentioned we went

[0:07:36] Trustee Maude: through a Trust Council in general on Salt Spring some very very interesting

[0:07:41] Trustee Maude: presentations fascinating indigenous knowledge was was given to us

[0:07:50] Trustee Maude: Um, we, we continue to learn and grow. Um, I keep telling people we're trying our best.

[0:08:00] Trustee Maude: Sometimes we don't get it right. We try our best. So we have so many blessed people sitting around

[0:08:09] Trustee Maude: our table that so knowledgeable, so bound with our, our communities. We have 26 wonderful trustees

[0:08:18] Trustee Maude: with violence trust and we try to achieve miracles sometimes it happens sometimes it's

[0:08:25] Trustee Maude: frustrating but you know we're all trying to do the best things for our community i don't think

[0:08:30] Trustee Maude: anybody brings a personal agenda and i do sincerely appreciate what everybody brings to the table so

[0:08:36] Trustee Maude: there's sort of they're great opportunities and i do enjoy them

[0:08:38] Trustee Morrison (probable): trustee mod one other thing i just

[0:08:40] Trustee Morrison (probable): wanted to share um and this is on non-trust related issues but i think it's important just

[0:08:45] Trustee Morrison (probable): to name it here um if folks are watching the recording so um bats have been um on salt spring

[0:08:53] Trustee Morrison (probable): have been tested for rabies um so make sure your pets are vaccinated and just be aware that they're

[0:09:00] Trustee Morrison (probable): suggesting we restrict access to pets at night out into areas where they can be in contact with bats

[0:09:06] Trustee Morrison (probable): so just be aware of that most

[0:09:08] Trustee Maude: definitely and the and the other thing that's been brought to my

[0:09:11] Trustee Maude: attention because i am the parent of some cats is um ticks apparently are quite active right now

[0:09:18] Trustee Maude: um so i i believe it was saturn and if i'm not mistaken self pender just recently they had um

[0:09:24] Trustee Maude: quite a few instances of ticks on pets so that's another it's an easy little application to the to

[0:09:31] Trustee Maude: our our loving friends and a good thing so all righty um so with that um we can move on um um

[0:09:43] Trustee Maude: i see director brent hasn't joined us today and i he missed the saturn yesterday also i

[0:09:49] Trustee Maude: understand he's just phenomenally busy and and when i talk to him on the ferry i know he is

[0:09:56] Trustee Maude: busy so hopefully we'll get him at the next meeting um so we're from here we move on to town

[0:10:03] Trustee Maude: hall we have a couple of attendees um in the meeting so if people have interested in and

[0:10:11] Trustee Maude: in making any comments to the local trust committee

[0:10:15] Trustee Maude: with regards to any matters.

[0:10:17] Trustee Maude: If you're an applicant,

[0:10:18] Trustee Maude: you'll be able to speak to your application at the time

[0:10:22] Trustee Maude: it is before local trust committee.

[0:10:23] Trustee Maude: But if you're a member of the public

[0:10:24] Trustee Maude: who wants to comment on an application,

[0:11:23] Trustee Maude: wanted to address in those minutes? Or do you feel that they're accurate? We see nodding heads.

[0:11:30] Trustee Maude: So by general consent, we'll adopt those minutes, and we will move on, as I've lost my place on the agenda, as one does.

[0:11:44] Trustee Maude: We have resolutions about meeting a report dated July 2025, just for your information.

[0:11:53] Trustee Maude: Moving down to page 15, we have the follow-up action list for July.

[0:11:59] Trustee Maude: um any questions or comments on those other

[0:12:39] Trustee Maude: local trust committee referral for proposed bylaw number 129, which is attached. I'm not sure if

[0:12:48] Trustee Maude: you feel your interests are affected or not, but over to you, trustees.

[0:12:56] Trustee Morrison (probable): I mean yeah I mean generally I've said not affected South Pender is a little bit

[0:13:01] Trustee Morrison (probable): closer affiliation um I assume that they know what they're doing there yeah

[0:13:13] Trustee Maude: referrals if somebody one day wants to see or say that your interests are affected I would

[0:13:17] Trustee Maude: enjoy that because it would make it feel that this is a worthwhile exercise but yeah motion to um

[0:13:31] Trustee Morrison (probable): I was really interested to see, just as a comment, that they reduced the maximum floor area regulation.

[0:13:38] Trustee Morrison (probable): I thought that was interesting because I thought that had been contentious on South Pender at one time.

[0:13:42] Trustee Morrison (probable): So the fact that they feel like they can go ahead and do that now is interesting.

[0:13:45] Trustee Morrison (probable): interesting um

[0:13:47] Trustee Maude: see uh lisa has two steps ahead of us and she has a resolution thank

[0:13:55] Trustee Morrison (probable): north pender island local trust committee interests are unaffected by the south pender island local

[0:13:58] Trustee Morrison (probable): trust committee draft bylaw number 129 executive

[0:15:28] Trustee Maude: So moving on page 25, we have PLDP 2025-0171 Ferguson over to Planet Belcher.

[0:15:42] Voice 2: Yes, this is a new development permit application for the addition to an existing house, a deck addition, driveway expansion, and shed relocation within the Woodland Ecosystems Development Permit Area, which is Development Permit Area 1.

[0:16:00] Voice 2: The subject property is 2705 Yall Lane, which is mostly within DPA 1.

[0:16:07] Voice 2: The proposal involves developing mostly disturbed land within the DPA, as well as the removal of one mature Douglas fir tree to facilitate the driveway expansion.

[0:16:20] Voice 2: Given the conditions set out in the environmental assessment, the authoring registered professional biologists concluded that any detrimental impacts to the woodland ecosystems on the property can be minimized and the ecological integrity can be enhanced to promote resilience and biodiversity.

[0:16:39] Voice 2: diversity. The draft permit has included the biologist's recommendations, which include

[0:16:46] Voice 2: measures for managing the construction, preventing spills, construction timing,

[0:16:54] Voice 2: erosion and sediment control, site restoration and planting, and then environmental monitoring

[0:17:00] Voice 2: following completion. Staff consider that the objectives and the guidelines for the woodland

[0:17:06] Voice 2: land ecosystems DPA have been met, and the conditions within the permit are based on

[0:17:11] Voice 2: the environmental assessment completed by the registered professional biologist and

[0:17:15] Voice 2: supported by staff.

[0:17:17] Voice 2: Implementation, restoration, and monitoring conditions in the development permit will

[0:17:22] Voice 2: ensure that there is protection and enhancement of the sensitive ecosystem.

[0:17:29] Voice 2: So based on this, staff recommend that the North Bender Island Local Trust Committee

[0:17:33] Voice 2: approve issuance of development permit PLDP

[0:17:39] Voice 2: 2025-0171. Thanks.

[0:17:52] Trustee Maude: right. So we know

[0:17:55] Trustee Maude: that they're available if you have any questions.

[0:17:58] Trustee Maude: So, Trustee, turn it over to you. Any questions or concerns about this

[0:18:04] Voice 3: think go ahead um the only real question i had i guess is more process um for

[0:18:15] Voice 3: these kind of applications in general um how what what sort of oversight is given when the majority

[0:18:24] Voice 3: of the work is being done in a in a dpa um and the uh i appreciate the report and and sort of

[0:18:34] Voice 3: count was laid out um and and that there'll be an enhanced area um there but what kind of oversight

[0:18:45] Voice 3: is there while the process is going on just so that we know that at the end of the project

[0:18:52] Voice 3: all those boxes have been checked um

[0:18:57] Voice 2: so there is in so the monitoring during and following

[0:19:02] Voice 2: completion of the project would be how we would ensure that all the conditions

[0:19:07] Voice 2: are met as well there is a restoration plan which would which outlines what

[0:19:12] Voice 2: needs to be planted and where it needs to be planted so we would follow up with

[0:19:18] Voice 2: that following the construction and make sure that all the conditions are are

[0:19:23] Voice 2: being met by the by the applicant so

[0:19:27] Voice 3: that's the island's trust does that not

[0:19:30] Voice 3: the biologist who wrote the report uh

[0:19:33] Voice 2: so i believe in this one we have monitoring with for the

[0:19:38] Voice 2: biologist um who would provide us with uh either a report or some kind of letter saying that the

[0:19:45] Voice 2: all the conditions have been met and then we could also we also do do um uh site visits and

[0:19:52] Voice 2: and confirmation that the work's being done i

[0:19:56] Voice 3: just noted like that for whatever reason it seemed more

[0:19:59] Voice 3: more detailed to me than some of the other application reports that we've

[0:20:03] Voice 3: gotten. And I was just kind of curious. I was like, well,

[0:20:06] Voice 3: how do we really follow up on this stuff when we do approve one and it gets

[0:20:10] Voice 3: built out and making sure that we end up at a place where it's a positive

[0:20:15] Voice 3: impact at the end. So, yeah, thank you.

[0:20:20] Trustee Morrison (probable): And I have kind of a related question to that.

[0:20:23] Trustee Morrison (probable): Is there a process for, and I don't know if this is a thing,

[0:20:27] Trustee Morrison (probable): but for closing a development permit like that it is completed all the work that was named on it

[0:20:33] Trustee Morrison (probable): like the development permit application uh

[0:20:37] Voice 2: so i guess once once all the once we've just confirmed

[0:20:41] Voice 2: that i mean technically the the permit is we've actually like closed the file on our end once

[0:20:47] Voice 2: it's issued but we do complete the monitoring um where we have it open for monitoring following

[0:20:54] Voice 2: Following the issuance. So yeah, once we have confirmed that everything is in accordance with the issued permit, then we would note that and then there would be no need to follow up with further monitoring.

[0:21:11] Trustee Morrison (probable): and this might be something um trustee mod it would be good if we just sort of

[0:21:16] Trustee Morrison (probable): noted for like ongoing conversation at trust council level like in our bylaw compliance and

[0:21:24] Trustee Morrison (probable): enforcement because i had i think one of the first um development permits on the riparian

[0:21:29] Trustee Morrison (probable): new riparian rules and not a soul has ever checked to see if we did the things on that permit not

[0:21:35] Trustee Morrison (probable): Not that, like, initially, like, when it was issued, we complied with everything in there, but nobody followed up to see if it was done after the fact.

[0:21:44] Trustee Morrison (probable): So, and I just don't really understand how that is.

[0:21:48] Trustee Maude: I see Planner Spokane's waving his hands.

[0:21:50] Planner: Yeah, can I?

[0:21:51] Planner: So, just let me jump to the other screen here now.

[0:21:56] Planner: So, on page 138 of your package, there are environmental monitoring conditions built into the actual permit.

[0:22:05] Planner: de or double d double e and double f i would recommend that uh double e says should and it

[0:22:12] Planner: really should say shall shall complete over the route so i would recommend that um the ltc uh

[0:22:19] Planner: amend that permit condition to state shall so that you do get

[0:22:23] Planner: uh and uh that's one recommendation

[0:22:27] Planner: i would make just looking at the permit uh and then in terms of uh just to help uh with

[0:22:33] Planner: with your question of follow-ups.

[0:22:36] Planner: So like Bruce said, all permits have these kinds

[0:22:40] Planner: of environmental monitoring and reporting conditions.

[0:22:44] Planner: And we follow up, we close the permit when it's approved

[0:22:49] Planner: in terms of the file being closed,

[0:22:52] Planner: but we do document the monitoring requirements

[0:22:54] Planner: and we track those.

[0:22:55] Planner: So for example, if it's within a year,

[0:22:57] Planner: we set up in our system three months prior to that,

[0:31:48] Planner: But certainly, I think there's also some rationale you could create around maybe in Trincomalee to lessen some of the confusion around those seasonal buffers.

[0:32:08] Planner: Some of those activities that might otherwise require a permit would be exempt in the current drafting.

[1:06:19] Manager of Bylaw Compliance and Enforcement: bylaw used. It would also outline and update the screening officer's duties and abilities to cancel

Planner Belcher summarized the staff report and highlighted the following: 
• The application is for a Development Permit to authorize a garage addition, deck 
addition, driveway expansion, and relocation of an existing shed within 
Development Permit Area 1 – Woodland Ecosystems 
• The work proposed involves altering previously disturbed land as well as the 
removal of one mature Douglas-fir tree 
• A report received by a Registered Professional Biologist concluded any 
detrimental impacts on the property can be minimized 
• The Development Permit Area guidelines have been met and include 
recommendations made by the biologist 
 
Discussion ensued and the following comments were noted: 
• Oversight of work done within the Development Permit Area is achieved through 
monitoring provided by the biologist during the project and Islands Trust staff 
can also conduct site visits during and after the work process 
• An application file is closed once the permit is issued and any requirements for 
monitoring are tracked until all conditions of the permit are met 
• Requirements that the biologist submit written confirmation of compliance with 
all conditions of the permit have been specified in the draft permit

15.2 Housing Access and Affordability Project – Staff Report  
Island Planner Smith summarized the staff report and highlighted the following: 
• The project timelines are on track 
• Work is focussing on finalizing the suitable land and build out analysis, the 
development of options for legislative amendments, and project outreach and  
communications 
• An informational pamphlet is being developed with input from the Advisory 
Planning Commission and Communications staff 
• The Advisory Planning Commission is interested in reviewing the Housing Action 
Plan actions around potential bylaw amendments 
 
Discussion ensued and the following comments were noted: 
• There is interest in having a table at the market or fall fair to answer questions 
about the Housing Action Plan 
• Trustees will look into availability and the Planner will  contact the Advisory 
Planning Commission to gauge interest in participating at the table 
• Once a date has been established it can be advertised in the mail out 
• There is interest in scheduling a Community Information Meeting in mid to late 
October once new information is available to present to the public and the input

17.4 North Pender LTC Bylaw Enforcement Notification Draft Bylaw No. 230 - Staff 
Report 
The Manager of Bylaw Compliance and Enforcement summarized the staff report 
and highlighted the following: 
• The proposed bylaw amends Bylaw Enforcement Notification Bylaw No. 188 as 
Land Use Bylaw No. 103 was rescinded and the new Land Use Bylaw No. 224 
was adopted 
• The schedules contained within the Bylaw Enforcement Notification Bylaw need 
to reference the new Land Use Bylaw 
• The contravention and surcharge schedules have been amended and updated 
• A contravention has been added for failing to obtain a Development Permit with 
the goal to allow Bylaw Officers to issue a penalty if a property owner does work 
in a Development Permit Area without the required permit 
Discussion ensued and the following comments were recorded: 
• The Regional Planning Committee is reviewing Trust Council policy for bylaw 
enforcement which does not affect the Bylaw Enforcement Notification Bylaw 
• The Local Trust Committee can develop and adopt policies and procedures for 
use of the Bylaw Enforcement Notification Bylaw which will guide the manner in 
which Bylaw Officers conduct investigations and implement the bylaw within 
their Local Trust Area 
• A policy for North Pender Island been prepared and can be presented to the 
Local Trust Committee to aid in developing their policy
