I want to begin the meeting by acknowledging that we're fortunate to be able to gather the locations across the Territory, the Coast Salish people.

[0:00:17] Voice 8: people um just to begin i have a brief statement from trustee morrison she asked me to write to

[0:00:23] Voice 8: read out the beginning of the meeting um and that is i'm sorry to miss yet another meeting uh the

[0:00:29] Voice 8: combination of work challenges in a family emergency in the past few months have unfolded

[0:00:35] Voice 8: uh that has caused me to disruptions in my commitments to the islands trust yesterday i

[0:00:41] Voice 8: returned home from mexico with my father who's having a mental health crisis i have to be with

[0:00:46] Voice 8: him today through doctor's appointments to figure out our next steps are i apologize for being

[0:00:51] Voice 8: delayed in all sorts of responses to the community and and we'll work to pick up the pieces during

[0:00:57] Voice 8: february thanks to aaron and david for continuing the important work that we have here um and i

[0:01:03] Voice 8: trust our thoughts are with um trustee morris and her family and she goes through this so

[0:01:08] Voice 8: thank you all right so i'm joined today by um your north island uh pendrion trustee aaron campbell

[0:02:37] Voice 12: folks might know i'm away at the moment um somewhere hot and warm uh but uh it's been it's

[0:02:46] Voice 12: been an oddly uh busy um being away we've had had a few uh rpc had an rpc meeting and

[0:02:55] Voice 12: and a trust council since our since our last uh local local meeting and um not a ton uh

[0:03:05] Voice 12: came out of the Trust Council

[0:03:08] Voice 12: as far as local feedback from folks were concerned.

[0:03:13] Voice 12: But oddly, there's been a lot of people

[0:03:17] Voice 12: contacting about different zoning possibilities

[0:03:22] Voice 12: on Pender with, it seems like there's a lot of folks

[0:03:26] Voice 12: who this winter has sort of jogged ideas

[0:03:30] Voice 12: in their head of things that they might like to do

[0:03:33] Voice 12: on Pender and have come forward with a lot of questions about where they could do things.

[0:03:40] Voice 12: And some of it is related to the ongoing process, not process, the work that we're doing on

[0:03:53] Voice 12: um tiny houses and and uh and future housing ideas um but also about uh folks looking to do

[0:04:03] Voice 12: just more on the island and how we can offer or they can offer different services on the island

[0:04:12] Voice 12: so that's been uh an interesting thing to start to dig into because as many people know on pender

[0:04:19] Voice 12: Pender does not own really any land, so where you would maybe be able to get a permit to operate a coffee cart or a hot dog stand or any of those things, we don't have that land to license somebody to go and park their cart.

[0:04:40] Voice 12: So I feel like I've had the same conversation about six or eight times and circularly trying to explain to people the challenges of it and troubleshoot and come up with ideas for where there might be opportunities to do stuff like that.

[0:04:59] Voice 12: But it sounds like into spring and this summer, folks are really looking to do some stuff on Pender.

[0:05:06] Voice 12: So it'll be interesting to see how we can work through some of that stuff.

[0:05:14] Voice 8: okay thank you very much um uh from i'll just keep it brief today because we have a very full agenda

[0:05:21] Voice 8: i guess the two things to highlight um is we're getting to the end of the public feedback period

[0:05:27] Voice 8: for the trust policy statement um uh it's there's been a lot of stuff come in um certainly off of

[0:05:35] Voice 8: the offenders um and encourage people to continue um if you can go online um it's right at the

[0:05:43] Voice 8: beginning of the island's trust website um all of the feedback is posted there we encourage if you

[0:05:49] Voice 8: haven't done the survey to fill out the survey online um there also there should be at your local

[0:05:56] Voice 8: library there should be hard copies with self-adjusted stamped envelopes if you just want

[0:06:01] Voice 8: to do it the old-fashioned way and fill out a form by survey by hand and mail it in um you can do that

[0:06:07] Voice 8: that and um every piece of feedback is valued and appreciated so um just want to keep reminding

[0:06:14] Voice 8: people that I think it's the end of next week is the end of the response period um other than that

[0:06:21] Voice 8: I think the the big thing of course at this time of year is budget time um we've had many many

[0:06:27] Voice 8: meetings on the budget we have another meeting coming up in a couple of weeks of the committee

[0:06:31] Voice 8: of the whole. At this point in time, the budget, I believe, is at 13.1% proposed increase to the

[0:06:41] Voice 8: budget. The difficulty is with the trust is we have two big factors this year. One is we've had

[0:06:52] Voice 8: a decrease in government grants and funding, which I understand is resulting in a 4.5% budget

[0:06:59] Voice 8: budget increase there. And also, of course, the recent BCGU labor negotiations have bumped things

[0:07:08] Voice 8: up. I believe the number was 2.8% of our budget. So both of these things somewhat out of our

[0:07:15] Voice 8: control. And beyond that, of course, we have the normal increasing costs across the board

[0:07:23] Voice 8: and wanting to do better things for the public of the Islands Trust,

[0:07:30] Voice 8: which more services is more costs.

[0:07:34] Voice 8: That said, at the last financial planning committee,

[0:07:37] Voice 8: there was a request put back to staff and senior management

[0:07:40] Voice 8: to do everything they can to bring back recommendations

[0:07:43] Voice 8: for any possible reductions in their budgets for next year.

[0:07:47] Voice 8: And we'll be discussing that at the committee as a whole.

[0:07:49] Voice 8: So hopefully it won't be 13.1, and rest assured, every trustee is sharpening their pencil and putting their attention to this.

[0:08:00] Voice 8: So best efforts, we'll see what we come out with.

[0:08:02] Voice 8: So thank you.

[0:08:05] Voice 8: So beyond that, we don't have our electoral director, Paul Brandt, isn't attending today, so we can pass by that.

[0:08:27] Voice 8: applicant um the uh when we discuss your individual application um that would be your

[0:08:34] Voice 8: time to participate but if anybody um has any questions or comments about any of the applications

[0:08:41] Voice 8: this is the time to comment because we we don't have room within the meeting to do it back and

[0:08:47] Voice 8: forth when the applications are being considered um ask that you um raise your hand um uh when

[0:08:55] Voice 8: you're called on um keep it hopefully to sort of like three minutes we're not really firm on this

[0:09:01] Voice 8: but uh it's a long meeting we've got a lot of stuff before us so we don't really have a lot

[0:09:42] Voice 1: is my only opportunity to speak and I wanted to speak as a resident of North Pender we are at

[0:09:50] Voice 1: at 1601 Schooner Way, and we have no fewer than three short-term rentals around our property.

[0:09:59] Voice 1: One of the 1602 Schooner Way has applied, and we got a letter from the one on the other side,

[0:10:12] Voice 1: 1602, but no letter for 1601. I just wanted to say, or 1602, I did want to say,

[0:10:20] Voice 1: that we are in favor of these short-term rentals

[0:10:24] Voice 1: and we are the people most affected by this.

[0:10:28] Voice 1: We have developed a close friendship with our neighbors

[0:10:33] Voice 1: and they have helped us out in situations

[0:10:37] Voice 1: which have saved both the island and us

[0:10:41] Voice 1: considerable grief and expense.

[0:10:45] Voice 1: And so I just wanted to say

[0:10:47] Voice 1: I have sent in a letter in support of their application.

[0:10:51] Voice 1: And Ian and I, my husband and I, are in support of these short-term rentals

[0:10:57] Voice 1: and see no reason why they cannot continue.

[0:11:48] Voice 5: Schooner. We'd like to say that they've been most conscientious about us and the type of clientele

[0:11:58] Voice 5: they they get and we've never had an issue so we're quite supportive of that in terms of impact

[0:12:08] Voice 5: their property rises above ours so they look down on us um and beside them they would have a

[0:12:17] Voice 5: empty lot so really we're the only ones that would be affected by their guests if they were

[0:12:25] Voice 5: an issue which they haven't been so and we've never been impacted negatively if anything it's

[0:12:32] Voice 5: been positive so we support their ask to maintain their license for short-term rentals okay thank

[0:16:36] Voice 12: by the goose canada goose population um i probably should i'm just wondering about

[0:16:47] Voice 12: um sort of the the term that they're hoping for and the fact that we've got elections in october

[0:16:57] Voice 12: so um i would not i would not be a an island's trust representative come uh uh october um

[0:17:10] Voice 12: yeah depending on uh future decisions i guess so i'm i am yeah i don't know if it's is okay to

[0:17:26] Voice 8: but i would suggest to be fair everybody in the political spectrum is

[0:17:30] Voice 8: sit sort of in the same boat so yeah they

[0:17:39] Voice 12: completely sure if i needed to respond back through uh officially through the islands trust

[0:17:46] Voice 12: to express my interest or if i just needed to do that personally would be my only question about it

[0:18:19] Planner Smith: membership to this group

[0:18:24] Planner Smith: have uh 10 months left in your term so that's lots of time to provide your input and you also

[0:18:30] Planner Smith: bring the context of a local farmer so i think you'd be a good fit trustee campbell if you're

[0:18:36] Planner Smith: interested and so uh either you could extend your interest uh directly through the that email trail

[0:18:44] Planner Smith: or uh i can add it to our follow-up action list and staff will respond to them to please start

[0:18:50] Planner Smith: start including trustee Campbell and then you know whatever happens at the election that can

[0:18:55] Planner Smith: be dealt with at that time yeah

[0:21:32] Voice 12: I don't know if it's happening for everybody, but I'm having a tough time navigating through some of the, it seems really slow.

[0:21:47] Voice 8: Yeah, I was having some issues this morning also downloading everything.

[0:21:55] Planner Smith: so in respect of stvrs the uh you learned at trust council last time a lot more

[0:22:01] Planner Smith: information about the provincial uh regulations and how they might impact uh islands uh i think

[0:22:10] Planner Smith: some of the main considerations uh would be that uh if you opted in uh one you could no longer have

[0:22:18] Planner Smith: FTPs, they would just go away altogether. And two, it would alter your ability for anyone who's not

[0:22:27] Planner Smith: a non-permanent resident operating an STVR on Pender through home occupation regulations to

[0:22:34] Planner Smith: have to cease operating. For example, if you had a property owner who was off island and they had

[0:22:40] Planner Smith: had their house rented long term to a tenant and then that tenant was operating an STBR in the

[0:22:48] Planner Smith: cottage. You could no longer do that because of the principal residence requirement.

[0:22:55] Planner Smith: So that's that part. And then you do have a standing resolution that says you are not going

[0:23:03] Planner Smith: to approve any new STBRs that you did pass relatively recently, probably six months ago.

[0:23:10] Planner Smith: Uh, uh, you do have two STVR applications, uh, before you, uh, to consider today, both from,

[0:23:18] Planner Smith: uh, you know, long-term, uh, by the sounds of it, pretty effective operators. Uh, so, uh, I guess

[0:23:26] Planner Smith: you'll have to consider today how those stand up against that standing resolution and, uh, whether

[0:23:33] Planner Smith: you are interested in opting in or not. My advice would be to, to not at this time. I don't think

[0:23:39] Planner Smith: that stvr is a huge issue on your island especially post-covet it seems to have really altered that

[0:23:45] Planner Smith: landscape and the regulations do you know require much more rigor in that all operators still need

[0:23:54] Planner Smith: to register with the province and even your home occupation operators and so uh uh that's one

[0:24:01] Planner Smith: choice you need to make if you choose not to opt in then uh i guess it's up to you what you want

[0:24:07] Planner Smith: to do with your stvr guidelines and uh your your apc and their housing report one of the actions

[0:24:14] Planner Smith: was to review your guidelines uh and the your apc advised you to uh not opt in but to uh remove uh

[0:24:25] Planner Smith: basically phase out your existing tups so that's my spiel i'll leave it to you guys to figure out

[0:24:33] Planner Smith: out from there where you want to go thanks perfect

[0:24:36] Voice 12: thank you very much yeah

[0:24:37] Planner Smith: i

[0:24:39] Voice 12: i uh i guess i just i

[0:24:40] Voice 12: sort of wanted to give a comment as to where my brain is at uh with it as well before we started

[0:24:47] Voice 12: um talking about these uh two applications that we've got today and i know that because of the

[0:24:54] Voice 12: way that our term has run that there should be a few more coming up in the next i think two or

[0:25:01] Voice 12: or three meetings i i would imagine because i know that there was a chunk of them uh that came

[0:25:07] Voice 12: forward right at the beginning of our term um but uh my a big part of why i was uh considering the

[0:25:19] Voice 12: um the opt-in um over this last year was that i had had hoped that maybe it would be a

[0:25:29] Voice 12: The province would take some of the pressure off of our bylaw enforcement having to regulate the applications and the non-TUP'd STVRs.

[0:25:53] Voice 12: Uh, and after, uh, listening to the, to the presenter, uh, in March there, um, or sorry,

[0:26:02] Voice 12: in December, um, it really didn't sound like that was going to, um, be the case at all.

[0:26:11] Voice 12: And then sort of further, um, reinforced by Warren, uh, manager Dingan, um, that, uh,

[0:26:19] Voice 12: it wouldn't really change their workload at all.

[0:26:21] Voice 12: And so there doesn't seem to be an actual benefit to Pender as far as taking any pressure off.

[0:26:34] Voice 12: And in fact, it would immediately negate all of the temporary use permits that we do have.

[0:26:41] Voice 12: The presenter actually even referenced that in the presentation, saying that the use of temporary use permits was a much better tool for the islands to navigate STVRs.

[0:26:57] Voice 12: And so sort of in understanding that and understanding some of the applications that are going to come forward really are not houses that fit into any sort of a potential rental stock.

[0:27:15] Voice 12: We, you know, the outstanding TUPs that we have really are on houses that would never be suitable for workforce housing.

[0:27:33] Voice 12: They're just not even designed by it.

[1:05:13] Voice 11: point that tree becomes dangerous and needs to be taken down. But we don't know if that tree needs

[1:11:39] Voice 9: east, which is 1329 McKinnon Road. And through conversations with their neighbor to the west,

[1:11:46] Voice 9: They've decided to include a variance to the 6.1 meter interior side lot line to locate the cottages a little bit further towards the property that they own, 1329, from the neighbor to lower the visual impacts and lower the impacts on that neighbor.

[1:12:07] Voice 9: The eastern cottage would be sited 2.4 meters from that interior lot line as a result, and that variance is included within the development permit since it is leading to greater adherence to the official community plan guidelines.

[1:12:31] Voice 9: consistent with the OCP guidelines and a landscaping

[1:12:35] Voice 9: plan with basic planting is included along with a security

[1:25:10] Planner Smith: and removal of water from those structures, which is good, and we've accepted that.

[1:25:19] Planner Smith: But we've also asked that the engineer spend some time assessing overall water movement across the site

[1:25:29] Planner Smith: and if there's any risk of contaminants leaving that site and entering surface water systems.

[1:25:37] Planner Smith: systems and if there is risk of that then how would that be mitigated uh i don't think that

[1:25:43] Planner Smith: any of i uh whatever those conclusions are i don't see them impacting the the uses in the draft bylaw

[1:25:51] Planner Smith: a mitigation approach could be like some kind of oil separator or something like that but

[1:25:57] Planner Smith: uh given uh what we've observed this winter uh both you know myself being over the island a

[1:26:06] Planner Smith: number of times and the documentation that braden has provided uh uh it's surprising how little water

[1:26:13] Planner Smith: actually flows through his site uh uh like even in that major freshet event which was a huge

[1:26:19] Planner Smith: you know one in whatever storm event uh water was not really uh ripping through that site like it

[1:26:28] Planner Smith: was in many other places on the island and even a few days after on on the island i was over last

[1:26:35] Planner Smith: last week a few days after just normal rains and a lot of the dishes were still ripping and

[1:26:39] Planner Smith: his were completely dry so uh it does seem like a lot of the water movement coming off of that slope

[1:26:46] Planner Smith: moves uh deeper into the groundwater uh farther up uh as is also evidenced by that slope he has

[1:26:55] Planner Smith: they're not really you know having a major amount of spillover or or or water cascading off that

[1:27:03] Planner Smith: even in those major rain events so uh so that's where we are that with that piece of work and

[1:27:10] Planner Smith: so i think it's appropriate to get these bylaws out for referral uh and uh bringing that information

[1:27:16] Planner Smith: back likely at the next meeting with the more finalized draft report for consideration of ltc

[1:27:23] Planner Smith: and then i think the the only other real concern that staff would have or or that i think the

[1:27:31] Planner Smith: community continues to raise is you know the footprint on the road and how maybe that could be

[1:27:37] Planner Smith: addressed uh in terms of a more efficient way of maybe operating within his site uh that would

[1:27:46] Planner Smith: allow for a little less uh uh of traffic and activity of his business on the road

[1:27:54] Planner Smith: also recognizing it's an active corridor with all sorts of industrial activity as that's kind of

[1:28:00] Planner Smith: of its intended land use designation.

[1:28:48] Voice 12: Um, and so, uh, sort of one of the, one of the concerns that had come up was that there over the years, it's been used as a storage yard for like, like rent, uh, rentable storage kind of a thing.

[1:29:04] Voice 12: And I'm just wondering if this sort of like contract yard, storage handling, and wholesale of aggregates, is this on top of another set of uses for the property?

[1:29:24] Voice 12: Or is this what the change in zoning to industrial creates?

[1:29:37] Planner Smith: can speak to that so you're zoning for uh general and industrial pretty much

[1:29:44] Planner Smith: all the parcels have site-specific zoning so you you do have a general list of uses but then all

[1:29:51] Planner Smith: of the actual general industrial zoned properties on north pender typically have a subset of those

[1:29:59] Planner Smith: uses

[1:30:00] Planner Smith: and in some cases have a special use that's not included on that and so uh uh just let me just

[1:30:08] Planner Smith: jump around here for a second a contractor yard is pretty broad it means the use of land buildings

[1:30:20] Planner Smith: or structures for the storage of materials equipment and vehicles for a building construction

[1:30:25] Planner Smith: construction, landscaping, business, or other trades.

[1:30:29] Planner Smith: And so both Grimmer and Braden's property

[1:30:34] Planner Smith: are proposing that use,

[1:30:37] Planner Smith: which would not only provide use

[1:30:40] Planner Smith: for what the current business is,

[1:30:42] Planner Smith: but would also recognize that

[1:30:44] Planner Smith: now you have a zoned piece of property

[1:30:47] Planner Smith: in a designated industrial use.

[1:30:51] Planner Smith: It might not always be these landowners

[1:30:54] Planner Smith: or these businesses operating on it.

[1:30:56] Planner Smith: So you want to try to give some zoning latitude

[1:30:58] Planner Smith: to allow other things to occur.

[1:31:12] Planner Smith: wholesale and retail sales of building,

[1:31:19] Planner Smith: to just the aggregate that he's all permitted there.

[1:31:23] Planner Smith: Auto-bottle repair is restricted.

[1:31:25] Planner Smith: Indoor storage is restricted.

[1:31:27] Planner Smith: Storage of motor vehicles, recreational vehicles, and boats and trailers is restricted.

[1:31:32] Planner Smith: Storage and handlings and goods and materials like motor vehicle parts or scrap is restricted.

[1:31:40] Planner Smith: An accessory dwelling.

[1:31:41] Planner Smith: So in fact, it's quite a narrow number of uses that is defined on this property relative to what wide range of uses could potentially generally be acceptable in a general industrial zone.

[1:32:01] Planner Smith: So your other parcels on North Pender are site specific, and some of them allow those things.

[1:32:08] Planner Smith: is uh the waste transfer facility on grimmers site specific to allowing just that so it's

[1:32:16] Planner Smith: despite general permitted uses uh it's allowed a waste transfer facility so that's how

[1:32:25] Planner Smith: these evolve uh over time or these site-specific zoning that yeah and then and

[1:32:33] Voice 12: That then answers the question that was being posed is that I think they're lumping, it was coming from the idea that they're lumping all of the general industrial usages in and then adding on top.

[1:32:58] Voice 12: and so with approval of this it is going forward to uh out for referral to all the other

[1:33:13] Planner Smith: draft bylaw right basically saying yeah we're ready to at least consider it and a first step

[1:33:21] Planner Smith: And that is us sending it out to agencies for 60 day referral and First Nations to receive any comments and input back that those agencies and nations might have on the applications, which is typically done or it's best to be done at this draft stage so that you can catch any early kind of obstacles or clangers in your draft bylaw before you advance it too far through.

[1:33:49] Planner Smith: through. So potentially Braden's is ready to go because it's so we would have this. So potentially

[1:34:01] Planner Smith: you could have a referral complete by your next meeting and seeking direction for first reading

[1:34:09] Planner Smith: and scheduling of a public hearing potentially would be if that water management plan is also

[1:34:15] Planner Smith: so it meets the satisfaction of staff

[1:34:17] Planner Smith: and addresses our concerns.

A member of the public indicated they live in close proximity to three short-term vacation 
rentals on Schooner Way and they are in support of each of the Temporary Use Permit 
applications related to the rentals.  
A member of the public spoke in support of the issuance of a Temporary Use Permit for a 
short-term vacation rental operating at 1603 Schooner Way and noted they have not had 
any issues or concerns with the operation that is located above the speaker’s property.

18. NEW BUSINESS 
18.1 Short Term Rental Accommodation – Principal Residence Opt-In – Briefing 
Island Planner Smith summarized the briefing and highlighted the following: 
• The Local Trust Committee was in attendance during a presentation provided at 
Trust Council regarding provincial regulations and how they might affect the 
island communities 
• If the Local Trust Committee opted in to the provincial regulation Temporary Use 
Permits for short-term vacation rentals would be eliminated and the principal 
residency requirement would come into affect 
• The Local Trust Committee has a standing resolution to not approve any new 
short-term vacation rentals 
• The Advisory Planning Commission recommended to not opt-in to the provincial 
regulations but phase out existing Temporary Use Permits 
 
Discussion ensued and the following comments were noted: 
• Following the presentation received at Trust Council and discussions with bylaw 
compliance and enforcement staff it was determined that opting in to the 
provincial regulations would not alleviate bylaw enforcement staff workload 
when dealing with non-compliant short-term rentals 
• There is concern that opting in would negate Temporary Use Permits that are in 
effect 
• The Temporary Use Permit is a better tool for Local Trust Committees to 
navigate short-term rental applications 
• Some of the houses used for vacation rentals are not suited for rental stock or 
workforce housing 
• In order to approve Temporary Use Permit applications that are coming forward 
from long-term operators it is necessary to rescind the standing resolution 
 
NP-2026-001

that North Pender Island Local Trust Committee rescind Standing 
Resolution No. 2025026 with regard to short-term vacation rentals.

15.1 Mayne Island Local Trust Committee Referral for Proposed Bylaw No. 200 (for 
Response)

that North Pender Island Local Trust Committee respond to the Mayne 
Island Local Trust Committee that interests are unaffected by draft Bylaw 
No. 200.

15.2 NP-PL-TUP-2025-0430 (O’Malley) – Staff Report 
Planner Belcher summarized the staff report and highlighted the following: 
• A Temporary Use Permit renewal can be issued for up to 3 years but no changes 
to the permit can be made 
• The permit allows up to 90 rental days per year and up to 11 guests and both of 
the permissions are above the Official Community Plan guidelines 
• The applicants have received letters of support from adjacent neighbours as 
well as feedback that  parking has occurred off site 
 
The applicant was in attendance and noted they have complied with all licensing 
requirements since the operation commenced, they only rent to families,  and they 
screen bookings in advance. 
 
A Trustee noted the location has off street parking and asked the applicant to 
ensure compliance and indicated the operation is an established short-term 
vacation rental operating in good faith. 
 
NP-2026-003 
It was MOVED and SECONDED, 
that North Pender Island Local Trust Committee approve issuance of 
renewal Temporary Use Permit PL-TUP-2025-0430 for a period of three (3) 
years.

15.3 NP-PL-TUP-2025-0511 (Hepburn) – Staff Report 
Planner Belcher summarized the staff report and highlighted the following: 
• The application seeks a new Temporary Use Permit for a short-term vacation 
rental that has been authorized to operate through 4 different permits since 
2018 
• The application maintains the same general conditions as previous 
• There has been a raptor nest identified in the area and this can be included in 
the permit as a condition requiring the operator to identify the raptor nest 
development permit area and let renters know of any conditions related to the 
site 
• There have been no complaints received related to the rental operation 
• It was noted that the applicant was in attendance 
 
The Local Trust Committee had no questions for the Planner and discussed the 
options related to including a guideline to identify the raptor nest development 
permit area. 
 
NP-2026-004 
It was MOVED and SECONDED 
that North Pender Local Trust Committee request staff add a condition to 
Temporary Use Permit PL-TUP-2025-0511 that requires communication 
about the location of the raptor nest development permit to guests.

Temporary Use Permit PL-TUP-2025-0511 for a period of three (3) years as 
amended

15.4 NP-PL-DVP-2025-0489 (McDonald) – Staff Report 
Planner Belcher summarized the staff report and highlighted the following: 
• The application seeks a Development Variance Permit to allow a secondary 
suite to be over the 40% maximum percentage of the total floor area of the main 
total building which comprises the main floor 
• The property is zoned to permit a secondary suite 
• The suite will comprise the second floor of the building 
 
Discussion ensued and it was clarified that the bylaw allows a secondary suite to be 
40% maximum of the total floor area of the building as the province initially set 40% 
as the maximum requirement when secondary suite rules were established; 
however, the province has since rescinded the maximum and the Local Trust 
Committee could consider doing the same as part of their current project. 
 
NP-2026-006 
It was MOVED and SECONDED, 
that North Pender Island Local Trust Committee approve issuance of PL-
DVP-2025-0489.

15.5 NP-PL-DP-2025-0483 (MacLean) - Staff Report 
Planner Belcher summarized the staff report and highlighted the following: 
• The application seeks a Development Permit to enable the construction of a 
house, float, and a ramp that is within the Development Permit Area 
• A streamside protection enhancement area was established by the registered 
professional biologist hired by the applicant which established a 15-metre 
boundary from the natural boundary of Magic Lake 
• No construction aside from the float ramp will be located within the 15-metre 
area 
• The draft Development Permit establishes conditions for the protection of trees, 
vegetation, nesting birds, and aquatic areas as well as construction 
management, sediment and erosion control, stormwater management, and 
environmental monitoring 
 
The applicant was in attendance and spoke to the application. 
 
  Discussion ensued and the following comments and clarifications were noted: 
• The construction is 1-metre outside of the protected area which appears tight

• The building will be constructed over the existing footprint, construction 
protection will be installed, and the only thing that comes close to the protected 
area is the edge of the deck which is cantilevered over its footing 
• The zoning does permit the dock as the property boundary extends into the lake 
and a crown lease tenure is not required 
• The lot lines were in place before the flooding of the lake occurred which 
created a unique situation of private land extending into the lake 
 
NP-2026-007

that North Pender Island Local Trust Committee approve issuance of 
Development Permit PL-DP-2025-0483.

15.6 NP-PL-DP-2025-0499 (Kerfoot) – Staff Report 
Planner Belcher summarized the staff report and highlighted the following: 
• The application seeks a Development Permit for the construction of two new 
900 square foot commercial tourist rental cottages and an 83.6 metre squared 
parking lot as part of the Tides Cottages commercial vacation rental business 
• A 6.1 interior lot line variance is being sought to locate the cottages closer to an 
adjacent property that the applicant owns in order to lower the visual impact on 
a neighbouring property 
• The existing screening between adjacent parcels is adequate and the new 
cottages would not be visible from the road 
 
A Trustee noted the property is already zoned to allow more than the number of 
units under consideration and the applicant has spoken to neighbours and taken 
into consideration their concerns through the setback variance request. 
 
NP-2026-008 
It was MOVED and SECONDED, 
that North Pender Island Local Trust Committee approve issuance of 
Development Permit PL-DP-2025-0499.

15.7 NP-RZ-2024.1 (Grimmer) – Staff Report 
Island Planner Smith provided an update on the status of the application and noted 
the following: 
• A monitoring well is being installed on the property 
• A septic report has been submitted 
• The finalized site plan showing the proposed location of all structures and the 
area of use remains outstanding with an outline provided in the interim 
• An environmental assessment report remains outstanding 
 
The applicant was in attendance and noted they anticipate submitting the remaining 
reports by the end of March.

2007, Amendment No. 1, 2024”, and directs staff to initiate bylaw referrals, 
subject to submission of an updated site plan from the applicant with 
accurate proposed area of use map boundaries to include in the draft 
bylaw.

subject to submission of an updated site plan from the applicant with 
accurate proposed area of use map boundaries to include in the draft 
bylaw.

15.8 NP-PL-RZ-2024-0110 (Bigham) – Staff Report 
Island Planner Smith provided an update on the application and the following 
comments were noted: 
• The applicant is working on a storm water management plan 
• The engineer has provided a stormwater management design for the buildings 
and structures that are being proposed that meets provincial building code 
standards and has been further asked to assess overall water movement across 
the site to determine if there is any risk of contaminants leaving the site and 
entering surface water systems, and if so to develop a mitigation approach 
• The footprint on the road might be addressed through a more efficient way of 
operating within the site that would allow for less traffic and activity of the 
business on the road 
• The site is located in an area of active industrial use 
 
  Discussion ensued and the following comments and clarifications were noted: 
• The number of uses that occur on the property seems to be higher than the uses 
listed 
• The Planner indicated the zoning is for general and industrial use and the 
contractor yard use is quite broad  
• Restricted uses include autobody repair, indoor storage, storage of motor 
vehicles, recreational vehicles, and boats and trailers, storage and handling of 
goods and materials such as motor vehicle parts which could be included uses 
in a general industrial zone

Island Planner Smith summarized the staff report and highlighted the following: 
• The report provides update on the Housing Action Plan and staff are working on 
draft amending bylaws based on recommendations made at the last Local Trust 
Committee meeting 
• The Advisory Planning Commission is reviewing the build-out analysis and 
suitable land analysis mapping and their recommendations will come to the 
Local Trust Committee at the next meeting 
• Draft bylaws will also come forward for discussion at the next meeting which 
will be followed by a Community Information Meeting 
 
Discussion ensued and Saturday May 2 was identified as a date for a potential date 
to hold a Community Information Meeting starting at 12:00 p.m. with a location to 
be determined.
