[0:03:11] Voice 8: So, yes, welcome to the Community Information Meeting for Proposed Bylaws

[0:03:15] Voice 8: number 321 and 322 related to bylaw amendment application PLRZ 2024-0091

[0:03:24] Voice 8: one for Mid-Island Co-op and specifically for the property at 793 Lock and Bar Lane.

[0:03:32] Voice 8: The purpose of this meeting is to provide an overview of the proposed bylaws

[0:03:39] Voice 8: in advance of the public hearing which is scheduled for Thursday February 19th at 10 35 a.m.

[0:03:46] Voice 8: and the public hearing is the opportunity for members of the public to share their views about

[0:03:51] Voice 8: the bylaw. That's not the purpose of today's meeting, it's to understand the bylaws better

[0:03:55] Voice 8: and be able to ask questions to the planners, the LTC and the applicant as well. So I'll provide a

[0:04:03] Voice 8: brief presentation on these bylaws which will be followed by a time to seek clarity from staff,

[0:04:07] Voice 8: the applicant or the LTC. So both proposed bylaws number 321 and 322 would apply specifically to

[0:04:19] Voice 8: 793 Lockenvar Lane.

[0:04:21] Voice 8: Presently, this property is within the institutional land use designation and is zoned institutional

[0:04:26] Voice 8: too.

[0:04:27] Voice 8: The existing zoning permits the principal uses of public schools, emergency services,

[0:04:32] Voice 8: library, post office, medical laboratory, government offices, highway workyards, urgent

[0:04:38] Voice 8: care medical clinic, and child care center and preschool, along with the accessory use

[0:04:45] Voice 8: of limited public market.

[0:04:46] Voice 8: it. The property currently has a vacant building on it and is used for overflow staff parking.

[0:04:57] Voice 8: The proposed bylaw number 321 is an amendment to the official community plan bylaw and it would

[0:05:03] Voice 8: have the effect of changing the land use designation from local commercial to, I believe

[0:05:10] Voice 8: from institutional, apologies, to village commercial. It would also include the subject

[0:05:16] Voice 8: property within this village center development permit area which establishes guidelines for the

[0:05:22] Voice 8: form and character of commercial development to promote water conservation and to promote

[0:05:26] Voice 8: the reduction of greenhouse gas emissions. Proposed bylaw number 322 is an amendment

[0:05:36] Voice 8: to the land use bylaw. It would have the effect of changing the zoning from institutional 2 to

[0:05:41] Voice 8: a site-specific zone called village commercial 4. The new zone would allow all of the existing uses

[0:05:48] Voice 8: and it would also allow the additional use of propane storage and the proposed bylaw includes

[0:05:54] Voice 8: a new definition of propane storage which it might be a little small there but I can read it

[0:05:59] Voice 8: it is propane storage which is the use of land buildings or structures for the bulk storage

[0:06:06] Voice 8: containment or handling of propane gas whether in liquid or gaseous form in above ground or

[0:06:12] Voice 8: underground tanks cylinders or containers and this includes facilities for the distribution or

[0:06:17] Voice 8: sale of propane to the public or commercial entities. All propane storage must comply with

[0:06:23] Voice 8: applicable federal and provincial legislation and regulations, including but not limited to

[0:06:28] Voice 8: safety, environmental, and transportation standards. This bylaw would also include the

[0:06:34] Voice 8: following conditions of use for propane storage, which is compliance with all federal and provincial

[0:06:40] Voice 8: regulations and receipt of all those permits that are needed. Outdoor lighting is required to be

[0:06:46] Voice 8: shield and shielded and directed downwards the preparation of an emergency response and spill

[0:06:53] Voice 8: containment plan and the screening of propane tanks so referrals were sent in february of 2025

[0:07:02] Voice 8: to the following first nations provincial ministries regional agencies and a couple

[0:07:10] Voice 8: of non-agency referrals as well and we did receive referral responses from a number so

[0:07:18] Voice 8: So from Sonamik First Nation, who deferred comment on the referral, but noted that if

[0:07:24] Voice 8: activities associated with zoning amendment application require ground disturbance, Sonamik

[0:07:29] Voice 8: should be engaged as an archaeological assessment may be required.

[0:07:34] Voice 8: And as well, just noted that if the applicant observes any cultural material within the

[0:07:38] Voice 8: subject area, that work must stop and Sonamik First Nation be notified immediately.

[0:07:43] Voice 8: Immediately, Cowichan tribes deferred to Sonamik First Nation, Suqbasset First Nation deferred to any directly affected First Nations.

[0:07:54] Voice 8: The Gabriola Volunteer Fire Department responded, indicating that access to the property for fire apparatus is good and that there is a suitable turnaround area at the end of Tenkan Alley.

[0:08:06] Voice 8: that must be a typo there but um a water source uh is within two kilometers and the fire hall

[0:08:14] Voice 8: within one kilometer um school district number 68 uh responded to say no comment on the referral

[0:08:21] Voice 8: uh vancouver island health authority uh did not have any objection to the rezoning and noted that

[0:08:27] Voice 8: if water or septic systems are needed uh they would you know require um they would be they

[0:08:34] Voice 8: that it would be applicable to certain regulations.

[0:08:39] Voice 8: The Gabriola Advisory Planning Commission also responded to a referral.

[0:08:44] Voice 8: Oh, and I see a raised hand by Trustee Yates that I can pause if you'd like me to.

[0:08:51] Voice 1: I did wonder about the turnaround at the end of Tin Can Alley,

[0:08:56] Voice 1: because Tin Can Alley is between the fire department and where the co-op is located.

[0:09:03] Voice 1: it seems an odd place to need a turnaround i

[0:09:46] Voice 8: One that they consider the impact on the neighborhood and neighbors, consider the impact on future developments in the village core and how this change might constrain future uses.

[0:09:57] Voice 8: and that the additional safety risks, specifically fire, be considered.

[0:10:03] Voice 8: They also recommended an additional referral to the Gabriel Fire Protection and Improvement District,

[0:10:09] Voice 8: requested the proponent provide their expert in fire and risk at any community discussion that is scheduled,

[0:10:16] Voice 8: and they also requested the LTC consider establishment of a light industrial zone.

[0:10:25] Voice 8: So that's all I had prepared in this presentation.

[0:10:29] Voice 8: I'll turn it back to the chair for an opportunity to ask questions.

[0:10:34] Voice 8: And just a reminder as well that the public hearing is scheduled for February 19th at 10.35 a.m.

[0:11:52] Voice 2: on the neighborhood, the neighbors of the proponent,

[0:11:55] Voice 2: and that be specifically considered we did discuss that with staff and they indicated that

[0:12:02] Voice 2: notice would be given to all the neighboring property owners about this community information

[0:12:08] Voice 2: meeting is there any more efforts to connect with neighboring property owners and advise them of

[0:12:16] Voice 2: their of you know the proposed development and the chance to weigh in is

[0:12:30] Voice 8: that a question for staff

[0:12:31] Voice 8: just about the notification for the public hearing yeah

[0:12:34] Voice 2: yes yeah yeah

[0:12:36] Voice 8: so the the public

[0:12:38] Voice 8: hearing will be advertised in the gabriela sounder um and as well a mail out is sent to

[0:12:43] Voice 8: all neighboring property owners within 100 meters of the subject property and and anybody who who

[0:12:54] Voice 8: feels are interested or are affected can attend the public hearing and if they wish to send in

[0:13:00] Voice 8: submissions ahead of time as well that's also possible through our our email which is um i

[0:13:05] Voice 8: believe it is let me pull it up so that i can give you the right one is north ph sub at islands

[0:13:12] Voice 8: trust.bc.ca that's another way to um to provide input planner

[0:14:48] Voice 3: Bert Fiddler here. I'm a member of the advisory committee for the Local Islands Trust. I do

[0:14:59] Voice 3: remember and I saw in your list there that it was indicated that one of the recommendations

[0:15:06] Voice 3: of the advisory committee was that this,

[0:15:10] Voice 3: we'd asked for these proposed bylaws to be sent

[0:15:16] Voice 3: to the Gabriel of fire protection improvement district.

[0:15:22] Voice 3: I wonder if that has any effort has been made

[0:15:25] Voice 3: to ask them for some input.

[0:15:28] Trustee Patrick (probable): Thank you, go over to Planner Bo.

[0:15:34] Voice 8: Well, yeah, so I can respond to say that a referral

[0:15:37] Voice 8: was made to the Gabriela Volunteer Fire Department.

[0:15:47] Voice 8: Yeah,

[0:15:47] Voice 3: but that's not the same group.

[0:15:49] Voice 3: There may be some confusion there.

[0:15:53] Voice 3: The Fire Protection Improvement District is the group that oversees

[0:15:57] Voice 3: and provides guidance to the fire department.

[0:16:01] Voice 3: I know you got a response from the fire chief,

[0:16:04] Voice 3: but I'm wondering if the people that he works for are aware of this proposal.

[0:16:12] Voice 3: And I think the concern, if I can speak to what I remember happening in the advisory committee,

[0:16:16] Voice 3: was that a couple of the members of that committee were former firefighters.

[0:16:21] Voice 3: They had some concerns about, you know, the worst case scenario of a propane leak and possibly a fire.

[0:16:30] Voice 3: And what I mean, the reality is, hopefully nothing like that ever happens.

[0:16:35] Voice 3: The likelihood of it ever happening is probably minimal.

[0:16:39] Voice 3: but the very first people that would respond

[0:16:43] Voice 3: to such an event would have to be our local firefighters.

[0:16:46] Voice 3: It doesn't matter what the plan is that's in place.

[0:16:49] Voice 3: The reality is they're going to be the ones

[0:16:50] Voice 3: who are going to be right on site first.

[0:16:53] Voice 3: And our concern was the safety of those people

[0:16:56] Voice 3: and was there a complete understanding

[0:16:59] Voice 3: on the part of the Gabriel of fire protection

[0:17:05] Voice 3: improvement district and the fire department

[0:17:08] Voice 3: on on the risks that might be involved in that in that situation because i read the report and

[0:17:14] Voice 3: you know it fits all of the um the the regulations federally and provincially etc

[0:17:21] Voice 3: um and yes there is a plan in place in case something like that happens but the reality is

[0:17:27] Voice 3: there are local people who are going to be on the ground that would be affected so that was that was

[0:17:31] Voice 3: the concern there i i go to those meetings of the fire protection group and there's never been any

[0:17:39] Voice 3: mention of it so far they haven't addressed it they haven't as far as i know it's not on their

[0:17:43] Voice 3: radar all

[0:18:02] Voice 7: that APC recommendation is an option for the LTC

[0:18:05] Voice 7: to refer the bylaws to the improvement district

[0:18:10] Voice 7: as an option.

[0:18:11] Voice 7: But my understanding just from having just got back,

[0:18:14] Voice 7: I didn't believe that that resolution was passed,

[0:18:18] Voice 7: but it is an option in the staff report.

[0:18:21] Voice 7: So that's where that's sitting.

[0:18:27] Voice 7: see um but um perhaps um the trustees could respond to that um i like i said i wasn't present

[0:18:35] Voice 7: at that meeting um uh but i don't believe that that recommendation was passed i believe it would

[0:18:44] Voice 7: still be an option um uh as we still have to uh you know to to send these bylaws to the ministry

[0:20:39] Voice 8: So through the chair, if the LTC did want to send a referral, they should pass a resolution, and I agree with Planner Cox's comments about timing, and whether or not a response prior to the public hearing might be possible, I don't know.

[0:21:00] Voice 7: And generally, you want all your responses in before that, because if it's not that you, I mean, if anything were to substantially change because of a referral response you received, then, you know, you'd have to redo the public hearing and that's how that goes.

[0:21:58] Voice 1: It was a very thorough response.

[0:22:01] Voice 1: And so was all of the material we got from Mid-Island Co-op.

[0:22:05] Voice 1: You know, it took me a couple hours to read through that.

[0:22:09] Voice 1: And it was very extensive.

[0:22:11] Voice 1: So I really appreciate that.

[0:22:12] Voice 1: I don't think that it is essential that we have a referral from the Improvement District Board.

[0:22:19] Voice 1: And certainly we should, they should know that the public hearing is upcoming, but I don't want to delay it for just for that reason. Thank you.

1. CALL TO ORDER
Chair Patrick called the meeting to order at 2:30 p.m.

2. TERRITORIAL ACKNOWLEDGMENT
Chair Patrick acknowledged that the meeting was held on the territory of the Coast Salish First Nations.

3. APPROVAL OF AGENDA
By general consent the agenda was approved as presented.

4. BUSINESS ITEMS
4.1 Planner Presentation on Proposed Bylaw Nos. 321 and 322
The Planner provided a presentation and highlighted the following:
- The subject property is zoned Institutional 2 and is currently used for staff parking with a vacant building on the lot;
- Amendments to proposed Bylaw No. 321 (Official Community Plan) would change the property designation from Institutional to Village Commercial and include the property in the Village Center Development Permit Area.
- Amendments to proposed Bylaw No. 322 (Land Use Bylaw) would maintain the existing uses listed in the IN2 zone and include the additional use of propane storage as a principal permitted use;
- Propane storage must comply with federal and provincial regulations;

• Referrals were sent to First Nations, other local and provincial agencies, and the Gabriola Advisory Planning Commission;
• The referral responses were summarized.

4.2 Question & Answer Period

• A Trustee noted the Advisory Planning Commission recommended the Local Trust Committee consider the impact of neighbours and staff indicated notice would be given to all neighbouring property owners about the Public Hearing.
  ◦ The Public Hearing will be advertised in the Gabriola Sounder and notice sent to all property owners within 100 metres of the property. Community members can attend the public hearing being held February 19 at the Gabriola Community Hall and written submissions can be sent in advance of the Public Hearing.

• A member of the public who was on the Advisory Planning Commission, stated that one of the recommendations from the Advisory Planning Commission was that the proposed bylaws be sent to the Gabriola Fire Protection Improvement District Board in addition to the referral that was sent to the Fire Chief, and asked if that had occurred as this is not the same group as the Gabriola Volunteer Fire Department.
  ◦ Staff noted a referral was made to the Gabriola Volunteer Fire Department and the Advisory Planning Commission report indicated the referral to the Fire Protection Commission was listed as an option but not as a recommendation.

• A Trustee noted that the Gabriola Fire Protection District Board is aware of the application and they should be informed of the Public Hearing, that the response received from the Fire Department was thorough, and they do believe it essential to have a referral from the Board.
  ◦ The Planner noted the turn around time was short for a referral.

• A Trustee asked if a full plan for mitigation of fire risk will be presented at the Public Hearing.
  ◦ The Planner replied this information will be included in the Public Hearing binder.
