[0:03:50] Voice 1: introduction, my name's Peter Thicke. I've recently joined the Islands Trust, as Mr. Hutton mentioned,

[0:03:56] Voice 1: as the island planner. I believe I've been charged primarily with trying to carry the OCP LUB project

[0:04:03] Voice 1: forward, but also be supporting with a lot of current planning and just other various issues

[0:04:07] Voice 1: that the Salt Spring LTC sees fit for me to work on.

[0:04:14] Voice 1: I recently, most recently,

[0:04:16] Voice 1: I've worked kind of in the private sector

[0:04:17] Voice 1: doing more development management.

[0:04:19] Voice 1: But prior to that,

[0:04:20] Voice 1: I was involved in the planning department

[0:04:21] Voice 1: for several years with the District of Tofino

[0:04:23] Voice 1: and some other small municipalities

[0:04:25] Voice 1: and regional districts prior to that.

[0:04:28] Voice 1: So I'm excited to be here.

[0:04:29] Voice 1: Happy to try to move projects forward

[0:04:33] Voice 1: and help out with Salt Spring.

[0:04:35] Voice 1: I have a good amount of experience living in smaller communities

[0:04:40] Voice 1: with various interest groups and needs and those kinds of things.

[0:09:43] Voice 3: certain that we there won't be any public consultation well will or won't i can say

[0:09:49] Voice 3: for certain that there will not be any public consultation in march on the ocp uh we do want

[0:09:56] to bring back uh the the report and there will certainly be i i can't tell in the scenario where

[0:10:02] is not further public consultation prior to advancing a draft or cp

[0:10:08] Voice 3: so there's more conversation

[0:10:10] Voice 3: to be had so long as that project advances yeah thank

[0:10:26] Voice 9: is peter lloyd jones president of the social accommodation group and i'm here ready

[0:10:31] Voice 9: to address the issue of the revising by law 355

[0:10:36] Voice 9: in relation to the BNBs and vacation rentals.

[0:10:40] Voice 9: So we've had two roundtable meetings,

[0:10:43] Voice 9: one in January 2025,

[0:10:46] Voice 9: and then another one recently in January 2026,

[0:10:49] Voice 9: which were very positive meetings.

[0:10:51] Voice 9: It included all the local stakeholders

[0:10:54] Voice 9: and governance of Islands Trust, CRD, LCC,

[0:10:57] Voice 9: Chamber of Commerce, industry,

[0:10:58] Voice 9: industry, 19 participants at the last meeting in January. They're very positive in support

[0:11:03] Voice 9: of modernization of the by-law. So the following next steps were proposed at the last meeting

[0:11:08] Voice 9: in January. Clarify and modernize the land use by-law that regulates SDRs, keeping it

[0:11:15] Voice 9: simple and enforceable, establishing a working group, LCC, trust, industry, housing, accepted

[0:11:20] Voice 9: a drive, timely progress. Consider implementing business licenses after land use by-laws

[0:11:24] Voice 9: as clarified, is established and in conjunction with a proactive enforcement.

[0:11:29] Voice 9: And then invest in shoulder season activities and explore new revenues, tools, etc.

[0:11:34] Voice 9: The reason I'm here is really that there's really just been no progress.

[0:11:37] Voice 9: It's been over a year now since the meetings, zero progress we've made on this file.

[0:11:42] Voice 9: No working group has been established, despite this being said that we're going to do that.

[0:11:47] Voice 9: A proposed budget of $40,000 has been put in the budget for 2027 CID to look into business

[0:11:52] Voice 9: licensing. But I understand that that issue has also been put on hold. I understand also that

[0:11:58] Voice 9: this issue was included in the IT sector meetings, but this too has been put on hold.

[0:12:04] Voice 9: It's been over a year, so we're getting frustrated. And there's been zero progress. I'd like to know

[0:12:09] Voice 9: why it's being stalled. Simple question. Why are we still sitting here? Why are we discussing that?

[0:12:16] Voice 9: Because I foresee that in a year's time, we'll be in the same position again. And I don't think

[0:12:20] Voice 9: be a good idea so that's it my question thank you thank

[0:12:24] Voice 7: you i think that's wrapped up with the ocp

[0:12:27] Voice 7: project which we are now expecting to report in april yeah

[0:12:31] Voice 3: so

[0:12:37] Voice 3: i mean this standalone project it would be probably a much uh more straightforward project

[0:12:42] Voice 3: um unfortunately if this the ocp iab project does um monopolize our our project standard

[0:12:49] with this point um so we're not able to get a little bit in line with

[0:12:54] Voice 3: that so working group

[0:12:54] Voice 3: cannot be established in these tunnels don't you say there's there's no project for a working group

[0:13:03] within

[0:13:03] Voice 3: the island's trust at this time except under the ocp

[0:13:07] Voice 3: approach yeah that

[0:13:08] Voice 7: was the intent

[0:13:11] Voice 7: we'll know more april where we can ask stuff what's coming next so thank you thank you okay

[0:13:37] Voice 15: I'll keep it short. We just had a, for anybody who's,

[0:13:40] Voice 15: well for everybody here that's listening, but I'm not confident.

[0:13:46] Voice 15: interesting to know if anybody actually watches the videos of this we just had a trust council

[0:13:53] Voice 15: meeting last week very interesting and a lot of it to me is was very alarming just as a lot of

[0:14:07] Voice 15: this whole term has been alarming as far as what's coming down the pipe for a better word

[0:14:17] Voice 15: what's coming down the pipe for salt spring island and development or just movement positively in any

[0:14:24] Voice 15: fashion i'm really concerned that um just as i have been this whole term that we're not going

[0:14:36] Voice 15: to see any uh improvement to some of the social and economic issues we have here on the island by

[0:14:44] Voice 15: housing homelessness or with what's coming down the pipe with the policy statement and some of

[0:14:51] Voice 15: the language that you're coming from trust council and it's very troubling to me that we have people

[0:15:00] Voice 15: from other islands dictating what we will be able to or not be able to do here on soul spring

[0:15:09] Voice 15: also trust council just passed a motion to raise the the wages of trustees i voted against it there

[0:15:26] Voice 15: There was a few other trustees that voted against it.

[0:15:29] Voice 15: There was a thing prior, a week or two, with the Governance Committee,

[0:15:33] Voice 15: which I'm vice chair of, where that raise in wages for trustees was proposed,

[0:15:39] Voice 15: and I opposed it there as well.

[0:15:40] Voice 15: I didn't even want to bring it to Trust Council.

[0:15:42] Voice 15: One of my main issues with that was that, as we all know,

[0:15:51] Voice 15: Salt Spring pays the lion's share of the taxes to the Islands Trust organization,

[0:15:55] Voice 15: organization. And, you know, it's already difficult for us to do anything around here.

[0:16:01] Voice 15: We do have another credit representation issue, which is Glare. And there was no way I could

[0:16:06] Voice 15: be in favor of giving trustees on, you name the item, Mesquite, Denman, wherever it may be,

[0:16:13] Voice 15: more money or taxpayers' money from Salt Spring for them to dictate to us what we can or can't do.

[0:16:20] Voice 15: But that motion ended up passing. And there was a few that voted against it. I forget

[0:16:27] Voice 15: I forget who in particular, but at least there was a couple.

[0:16:31] Voice 15: And to me, it's very troubling.

[0:16:33] Voice 15: And then the language I'm hearing, you know, I hear language of decolonization.

[0:16:39] Voice 15: I've heard language of stolen land, colonial construct, another word being tossed around.

[0:16:50] Voice 15: And I don't see how that in any way, shape or form is positive language to be putting towards community.

[0:16:57] Voice 15: community, hoping to move forward in a positive fashion without division, because I think

[0:17:06] Voice 15: it's more divisive, just as many of the things the MS Fest has done, in my view, over the

[0:17:12] Voice 15: years, and it hasn't gotten any better.

[0:17:15] Voice 15: So I guess that's my report.

[0:17:17] Voice 15: Sorry to drone off, but I could probably talk for days on the subject.

[0:17:28] Voice 7: there's always sad times with Salt Spring here,

[0:17:32] Voice 7: lost a number of elders on the island recently.

[0:17:35] Voice 7: And I really wanted to pay tribute to Dr. Hugh Greenwood,

[0:17:41] Voice 7: has left us his amazing work.

[0:17:46] Voice 7: He did a geologic map of Salt Spring himself.

[0:17:53] Voice 7: It's just an amazing piece of work that he had done

[0:17:58] Voice 7: to create this map, and we are the only island in all of the Gulf Islands to have a geologic map of this magnitude,

[0:18:09] Voice 7: and it was all because of his own fortitude and his own efforts to come over this island

[0:18:16] Voice 7: and try to record the geologic record on this island, and that will be forever a gift from him for this island,

[0:18:24] Voice 7: and we will be grateful for that.

[0:18:28] Voice 7: As usual, I attend numerous, numerous meetings.

[0:18:32] Voice 7: I may have the governance committee, the finance committee

[0:18:34] Voice 7: and the executive committees.

[0:18:36] Voice 7: So since our last meeting

[0:18:37] Voice 7: and also chaired Gabriela local trust committee,

[0:18:44] Voice 7: attended responding to indigenous specific racism training.

[0:18:50] Voice 7: Also attended Bowen Island municipality meeting

[0:18:53] Voice 7: meeting along with our CAO and our Director of Finance and Human Resources Services, attended

[0:19:02] Voice 7: the joint local trust committee, local community commission meeting we had here, the Salt Spring

[0:19:12] Voice 7: Foundation funders table attended. I was really excited because the guest speaker this month

[0:19:19] Voice 7: was my daughter. So I was thrilled to have her, to be able to introduce her as a speaker and I

[0:19:26] Voice 7: think she inspired a lot of people with the ideas of philanthropy and being for community, rural

[0:19:35] Voice 7: community funding needs. Went to the ABICC, had a housing webinar on methods of, again,

[0:19:46] Voice 7: And with the money that is missing for being directed toward housing in rural areas,

[0:19:53] Voice 7: there's a lot of work going to how communities can raise that money, manage that money.

[0:19:58] Voice 7: And that's going to continue to be a conundrum for us in the little Gulf Islands, I'll say,

[0:20:08] Voice 7: because our projects are so small compared to urban areas.

[0:20:10] Voice 7: and I think there's a great opportunity for all the islands to work more strongly together to

[0:20:18] Voice 7: get that magnitude of combining all our projects into one project, so to speak, to be more

[0:20:26] Voice 7: attractive from a funding perspective. But we've got to get more agile in that area and I think

[0:20:33] Voice 7: there's lots of talk in that area, so excited. There was also the webinar on working toward

[0:20:39] Voice 7: a deer strategy it was really focused on uh main island but it's uh very applicable to all of our

[0:20:45] Voice 7: islands have an over abundance of deer and uh working with the community and the education

[0:20:51] Voice 7: needed to help communities understand that uh controlling the deer population is is a necessity

[0:20:58] Voice 7: the southern gulf island forum held their meeting uh this afternoon is the uh sanch island round

[0:21:05] Voice 7: Roundtable. I talked my husband into attending since we're here, and it's always a good time to get everybody together for the Santa Child Inlet.

[0:21:14] Voice 7: Just a reminder that Salt Spring's local trust area extends all the way down the Santa Child Inlet, down to its very southern point, up to the high water mark, all along those areas.

[0:21:25] Voice 7: So it's a vast area that we have within our jurisdiction.

[0:21:30] Voice 7: And that's my report.

[0:29:04] Voice 14: the footprint of the existing or proposed structures. In addition, the property is also

[0:29:10] Voice 14: situated within an area subject to seasonal flooding. The condition further underscores

[0:29:20] Voice 14: zoning application and that was the reason that as a staff we asked the applicant to

[0:29:25] Voice 14: provide the stormwater management report for the rezoning application but uh the applicant

[0:29:34] Voice 14: opposed to this opposed to this requirement and wanted tltc to consider the requirement for the

[0:29:41] Voice 14: report why don't we

[0:31:20] Voice 10: Some people in the trust are thinking, okay, it's a temporary use permit for temporary buildings.

[0:31:25] Voice 10: You can't build a temporary building in Salisbury Island and get an occupancy permit, okay?

[0:31:32] Voice 10: You have to do foundations, you're building permits, occupancy permits, everything like that, okay?

[0:31:37] Voice 10: And so that infrastructure has to go into the ground at that stage, okay?

[0:31:45] Voice 10: And so I went and got all my permits, did everything, put all my infrastructure in the ground and dug up.

[0:31:52] Voice 10: Now, your own regulations say before you can get an occupancy permit for commercial building or temporary use, you have to have all your landscaping done.

[0:32:02] Voice 10: And you have to have the parking lot finished and everything, okay?

[0:32:05] Voice 10: So now you're asking that I get an engineer to sign off on a system that I didn't have to do.

[0:32:13] Voice 10: Nobody's going to sign off on it, okay?

[0:32:15] Voice 10: But this is the third project I've done in Ganges, okay?

[0:32:19] Voice 10: came the first project i didn't have to do anything but i did the same system because i

[0:32:26] Voice 10: felt it was the right thing to do i know the water level was high there it's worked perfectly

[0:32:36] Voice 10: designed by an engineer and water studies were done before and after and all the rest of it

[0:32:50] Voice 10: It did my own system at the other place, which I didn't feel I had to get an engineer to do or sign off or anything because it was so it didn't.

[0:33:45] Voice 10: And I have put in inspection ports for the last discharge of the whole system.

[0:33:52] Voice 10: And even in a very heavy rain, there's just a trickle coming through.

[0:33:56] Voice 10: I mean, it goes into a gravel pit, and then eventually it goes out to the culvert on the road,

[0:34:02] Voice 10: which I installed at my own expense.

[0:34:04] Voice 10: fence so i could do the sidewalk and uh i know when i put in the extra culvert

[0:34:11] Voice 10: adjoining my driveway i picked up a huge amount of water that was running from the parts store

[0:34:15] Voice 10: which came down across the lot next door and now that goes in to the drain you know into the

[0:34:23] Voice 10: culvert and then goes down you know and so now that water is not coming onto my property at all

[0:34:28] Voice 10: um the area where they say there was flooding i agree it was wet there the the grasses that

[0:34:38] Voice 10: that grew there it was it was a no-brainer it was wet so backing up a little bit uh that property

[0:34:45] Voice 10: was rented by the uh for the library for quite a few years okay and that's where all the parking

[0:34:51] Voice 10: was at the bottom okay so rather than digging it out like i did down to now they put geocache

[0:34:58] Voice 10: off down put three-quarter minus on top compacted it and that was the parking lot okay so now they

[0:35:05] Voice 10: created a surface that doesn't drain okay and so that's why all the water was pooling there

[0:35:10] Voice 10: so i dug all that out it took a beautiful top so i'll put it at the top made a an orchard at

[0:35:16] Voice 10: the top for the apple for apple trees and then put in three inch three inch shot rock and then

[0:35:23] Voice 10: compacted it and put a whole proper drainage in that whole area there there's no problem with any

[0:35:29] Voice 10: water anymore and then all the waffle roof waters off the roofs goes into what they call storm texas

[0:35:38] Voice 10: which is a Dutch company, and it just works phenomenally well.

[0:35:45] Voice 10: I mean, the water just – and then there's water going into two 1,000-gallon tanks

[0:35:51] Voice 10: for irrigation, so that water is – so I wouldn't be standing in front of you

[0:35:59] Voice 10: if I thought there was a problem.

[0:36:03] Voice 10: It's dry as a bone.

[2:34:30] Voice 2: Number five, you have things such as 5.3, where the officer will try and arrange a mutually agreeable time to arrange site inspection and provide one week's notice before attending the property.

[2:34:46] Voice 2: There are, of course, there will be exceptions to that for environmental issues or health and safety, you know, and also to provide some discretion and some flexibility for the bylaw officers.

[2:35:02] Voice 2: So if a respondent has indicated they'll work towards compliance, we can work on time to comply and there's no need for site inspections.

[2:35:11] Voice 2: Or, for example, if they want to provide evidence such as surveys, professional reports, site inspections are not required.

[2:35:18] Voice 2: required we have also added within these local trust committee policies expanded on

[2:35:25] Voice 2: frivolous repeated vexatious complaints in order to provide discretion to close files when we

[2:35:35] Voice 2: discover that the complaint may be vexatious and within the policy also have for the bend by law

[2:35:44] Voice 2: and part b you have the screening officers powers and duties policy identifies who can be screening

[2:35:51] Voice 2: officers and it also defines what role they can have within the screening officer process

[2:35:58] Voice 2: and you have a list of authorized reasons to cancel bylaw violation notices. So in the end

[2:36:08] Voice 2: the recommendation to adopt this policy is that you know local governments throughout British

[2:36:15] Voice 2: Columbia have policy documents to provide direction to staff on how bylaw compliance

[2:36:20] Voice 2: will be sought and how enforcement will be conducted and establishing the policies into

[2:36:25] Voice 2: one document that could be readily accessed by staff and the general public should ensure more

[2:36:30] Voice 2: efficient and open and transparent and more transparent access to information and policies

[2:36:36] Voice 2: and a better better understanding of how bylaw compliance and enforcement is conducted

[2:36:42] Voice 2: so the main recommendation that you do have is that you adopt the policy as drafted of course

[2:36:50] Voice 2: you can make amendments or the alternatives are you ask for more information before you implement

[2:36:55] Voice 2: such a policy or that you state that you wish to proceed no further i will note in the recommendation

[2:37:02] Voice 2: number two uh the one of the standing resolutions referenced is referenced as ss 2021-214 it should

[2:52:11] Voice 7: that some landlords will say okay i'll shut it down i'll shut it down tomorrow just by getting

[2:52:15] Voice 7: the letter playing and you've got a person that's in a bad situation so trying to come up with a

[2:52:23] Voice 7: more compassionate approach is what i was a team approach to these complaints on some of these

[2:52:28] Voice 7: situations.

[2:52:35] Voice 15: that we have a standing resolution

[2:52:37] Voice 15: that said we won't enforce

[2:52:39] Voice 15: unless there's an open sewage

[2:54:43] Voice 2: take to non-compliant dwellings as then here's the alternative approach as opposed to a traditional

[2:54:50] Voice 2: bylaw enforcement approach to non-permitted dwellings that can be added to the policy

[2:54:57] Voice 2: document for review by the local trust committee at a future meeting if you

[2:55:03] Voice 2: decide to proceed with considering the policy document

[2:55:39] and health authorities to do that work.

[2:55:46] Voice 3: which includes sewage and septic systems or sewerage systems.

[2:55:51] Voice 3: In the case of the sewer system on Salt Spring Island, that's overseen by that authority.

[2:55:59] Voice 3: In the case of septic systems, we have registered customers that install them under the guidance

[2:56:04] Voice 3: of the Island Health Agency, so I would suggest that you rely on those partners that you have

[2:56:11] Voice 3: in the community and not caution against any forays in to adjudicate severity of what can

[2:56:20] Voice 3: be a serious public health risk right

[2:56:22] Voice 15: by the ltc understood uh trustee that's a really good point

[2:56:26] Voice 15: um that's that was just brought up and um you know when i first think about that i wonder

[2:56:36] Voice 15: why are we enforcing on that at all it's not really our uh our wheelhouse and uh you know

[3:27:12] Voice 7: moving toward a phased and potential further release once the new plant is built and the

[3:27:23] Voice 7: system is co-mingled I guess from the north and south of the two lakes

[3:27:27] Voice 7: and I'm concerned that every delay that we have is not to the community's benefit that

[3:27:40] Voice 7: we did reach out to the province we asked the province or recommended to the province that they

[3:27:45] Voice 7: opened the letters patent for north salt spring and give them the right to prioritize connections

[3:27:51] Voice 7: and the province declined we know the province has a policy that it's not supporting or helping

[3:27:57] Voice 7: improvement districts that's the province's choice um i've been spending time rereading

[3:28:07] Voice 7: our act again and then have brought new eyes again to section 35 is in part five of the

[3:28:16] Voice 7: items trust act under municipalities and regional districts part 35 says that the board of a

[3:28:22] Voice 7: regional district all or part of which is in the trust area must not adopt a bylaw respecting the

[3:28:28] Voice 7: trust area issue a permit respecting the trust area or undertake work respecting the trust area

[3:28:34] Voice 7: if the bylaw or permit is contrary to where it variants with a bylaw from a local trust committee.

[3:28:42] Voice 7: The Trust Act also says that we're supposed to cooperate with improvement districts,

[3:28:47] Voice 7: which is to cooperate with improvement districts, municipalities, and regional districts.

[3:28:52] Voice 7: But the Act is silent on what cooperation with improvement districts is.

[3:28:57] Voice 7: I think it's quite reasonable for us to interpret that services provided by a regional district

[3:29:04] Voice 7: are similar to those services provided by improvement districts.

[3:29:08] Voice 7: So I think Section 35, we could argue, applies to improvement districts just as much.

[3:29:14] Voice 7: So I've put together my recommendation here is, you know,

[3:29:20] Voice 7: North Saanich recently was appointed a housing advisor,

[3:29:25] Voice 7: an independent housing advisor under the Housing Supply Act to help them identify

[3:29:32] Voice 7: to identify more solutions for the housing supply.

[3:29:36] Voice 7: Yes, North Saanich has to have targets

[3:29:40] Voice 7: and the province uses its targets to decide

[3:29:43] Voice 7: whether or not they appoint independent housing advisors.

[3:29:48] Voice 7: We are exempt from that.

[3:29:50] Voice 7: A local trust committee is exempt

[3:29:52] Voice 7: from those sections of the housing supply act.

[3:29:57] Voice 7: But I think it's worth asking the province.

[3:30:00] Voice 7: If they won't help us remove the letters patent or open up the letters patent to help North Salisbury, our project is delayed.

[3:30:08] Voice 7: Water is critical.

[3:30:10] Voice 7: Connecting water to the housing that this island needs is critical.

[3:30:15] Voice 7: Delays in getting those solutions brought in place aren't to our advantage.

[3:30:24] Voice 7: So I'm, I'm suggesting we ask the province to appoint an independent advisor to help us with the work that we're doing on the equitable housing options, but in particular, helping us identify policy and tools that will align the water surfacing allocations to critical housing needs.

[3:30:47] Voice 7: needs. This is a desperate move, I will admit. I wish that we had been making the progress

[3:30:59] Voice 7: that we had hoped to be making, and we've been bringing those solutions in place quicker.

[3:31:08] Voice 7: So I'm looking at this as not in any way criticism of our staff. I look at this as respecting

[3:31:16] Voice 7: our current staff capacity and ongoing work,

[3:31:19] Voice 7: and that it's just about augmenting it.

[3:31:23] Voice 7: asking for regulatory interference.

[3:32:37] Voice 15: the term, we needed to address the housing crisis. And I pushed at that time to pass bylaw 537,

[3:32:44] Voice 15: 7th which was created by a housing task force that was created the term before and it was well

[3:32:52] Voice 15: within the local trust committee's purview of power to do that to pass by law 537 i was prepared

[3:32:57] Voice 15: to do it we couldn't have did it um and on top of that at the same time i proposed we create zoning

[3:33:03] Voice 15: that would allow for workforce ownership housing projects like they have in whistler topino and

[3:33:08] Voice 15: cowichan all neighboring jurisdictions very similar geographically socially and economically

[3:33:12] Voice 15: economically and that the ltc amend the housing portion of the ocp at the same time in conjunction

[3:33:18] Voice 15: with all the stuff going on um which was also in the purview of the ltc's power staff also

[3:33:25] Voice 15: concurred at the time it would only take two months to amend the housing from uh the housing

[3:33:30] Voice 15: section of the ocp procedurally so we're over three years into this and still nothing we could

[3:33:36] Voice 15: have did this um at the beginning of the term in two or three months the zoning could have been

[3:33:39] Voice 15: done in six for workforce ownership housing projects. I was opposed at that time to this

[3:33:47] Voice 15: official community plan or OPC, OCP rather, LUB project for the reason that I could easily see

[3:33:54] Voice 15: it was going to take the whole term maybe longer and I've been proven right time and time and time

[3:33:58] Voice 15: again and I'm proven right again today as it's been delayed again and so then from the beginning

[3:34:04] Voice 15: of the term fast forward into the bill 44 the province implemented in salt spring was excluded

[3:34:09] Voice 15: i proposed at the time that we asked to be included the ltc sent a letter to the province

[3:34:18] Voice 15: ourselves and that was that it was within our purview of the ltc's power to take care of it

The Regional Planning Manager stated that Chair Peterson was delayed and in accordance 
with Salt Spring Island Meeting Procedures Bylaw No. 197 he called the meeting to order at 
9:30 a.m. The Trustees agreed that Trustee Patrick shall act as Chairperson. 
Acting Chair Patrick acknowledged that the Local Trust Committee is meeting in the 
territory of the Coast Salish First Nations. 
2. APPROVAL OF AGENDA 
The following additions and amendments to the agenda were presented for consideration:

3. PUBLIC PARTICIPATION 
Acting Chair Patrick reminded the public that the Public Hearing for the Proposed Bylaws 
544, 545 & 546 have been held and as per Meeting Procedure Bylaw No. 197, the Local 
Trust Committee must not permit a delegation to address a meeting of the Committee 
regarding a bylaw in respect of which a public hearing has been held.

A member of the public asked if there will be public consultation on the OCP in March. 
The Regional Planning Manager stated there will not be any public consultation on 
the Official Community Plan in March. 
A member of the public spoke to the issue of amending Bylaw No. 355 in relation to 
vacation rentals and noted there had been two round tables meetings with local 
stakeholders which indicated support of updating the bylaw. The speaker listed 
recommended steps previously provided and noted there had been no progress on the file, 
a working group had not been established, and a proposal to look into licensing has been 
put on hold. They asked why the project is being stalled. 
The Acting Chair noted the bylaw amendment is tied into the Official Community 
Plan and Land Use Bylaw project and not a stand-alone project and a report on the 
OCP LUB Project would be coming forward in April. 
4. DELEGATIONS - None 
5. TRUSTEE REPORTS 
Trustee Harris reported attendance at Trust Council and stated concern that decisions 
made at Trust Council do not support the social and economic needs of Salt Spring Island 
residents and noted he opposed a motion put forward to increase trustee remuneration. 
6. CHAIR'S REPORT 
Acting Chair Patrick reported the following: 
 Recognized Dr. Hugh Greenwood’s recent passing and his work on a geologic map of 
Salt Spring Island; 
 Attended Governance Committee, Financial Planning Committee, Executive 
Committee, Trust Council, and Gabriola Local Trust Committee meetings; 
 Attended Indigenous specific racism training; 
 Attended Association of Vancouver Island Coastal Communities housing webinar and a 
webinar on the fallow deer strategy; 
 Attended Bowen Island Municipality meeting with Islands Trust Chief Administrative 
Officer and Director of Financial and Employee Services and the Southern Gulf Islands 
Forum.

 Planner Panahifar noted that staff had requested a stormwater management report 
for the correspondent’s rezoning proposal and the applicant indicated they wanted 
the Local Trust Committee to reconsider the request to include the stormwater 
management report as part of the terms of reference of the rezoning application. 
The applicant was in attendance, summarized the correspondence, and noted the 
request for a stormwater management report was not brought forward at a pre-
application meeting nor when an application for a Temporary Use Permit was made. 
They outlined the drainage work done and spoke to the difficulty with arranging to 
have an engineer sign off on a system that was not requested. 
9.2 K. Clemson to LTC Email – dated February 8, 2026 – Request for Review and 
Improvement of Public Lake Access and Parking Safety on Salt Spring Island.

10. BUSINESS ARISING FROM MINUTES 
10.1 Follow-Up Action List 
The Regional Planning Manager spoke to the Blackburn Road rezoning application 
and noted that a referral response had been received post public hearing and the 
Local Trust Committee has the option to request a staff report regarding the 
response. It was clarified that receipt of a report would be considered new 
information which would result in the requirement of a new Public Hearing.

The Planner summarized the staff report and highlighted that the application seeks 
to rezone a split-zoned property to a commercial zone variant with commercial and 
current uses as outlined, amendments to the siting regulations applicable to the 
subject property, and the removal of a covenant registered on title of which the 
requirements have been met. 
The applicant was in attendance and stated they had not indicated they would build 
a single-story structure as noted in the staff report and that they had removed the 
request to increase lot coverage to 66%.

The planner summarized the staff report and noted the property was subject to a 
subdivision application that was referred to the Local Trust Committee and Islands 
Trust policy requires the applicant to provide a covenant to ensure compliance with 
section 514 of the Local Government Act. 
Discussion ensued and it was confirmed that the applicant can apply to remove the 
covenant after 5 years and it is required as a condition of subdivision as per the 
Local Government Act.

16. NEW BUSINESS  
16.1 Salt Spring Island Compliance and Enforcement Policy – Staff Report 
The Bylaw Compliance and Enforcement Manager summarized the staff report and 
highlighted the following: 
 The purpose of the policy is to incorporate all current standing resolutions for 
compliance and enforcement into a single document and these resolutions 
have been included as priorities listed in section 4; 
 The inspection section details when a Bylaw and Compliance Officer can attend 
a property, notice requirements, and when site inspections are not required; 
 The policy addresses frivolous, repeat, and vexatious complaints; 
 The policy identifies who can be screening officers and provides a list of 
authorized reasons bylaw notices can be cancelled. 
Discussion ensued and the following comments were noted: 
 The Purpose speaks to local community standards which are undefined; 
 Bylaw Officers looks at definitions within the Land Use Bylaw first and then 
within the policy document; 
 The Local Trust Committee can define what is considered a minor structure; 
 The references section includes regulatory bylaws of which the Land Use Bylaw 
is considered; 
 The vacation rental section should make reference to the home-based business 
aspect; 
 Section 4.4 requires updated wording to “approved septic system” instead of 
“approved septic or sewage disposal system”; 
 The Local Trust Committee can set how much notice is given for a site 
inspection without consent and if this section is removed then the notice period 
defers to the Trust Council Policy; 
 A Trustee noted section 4.4 states “except in the following circumstances” and 
lists points (a) through (g) and as these points can possibly be interpreted in 
different ways consideration of removing them should be taken; 
 Language can be revised to state “significant” risk to health and safety;

 A section could be added to outline an approach to non-permitted dwellings; 
 There is need to rely on authorities that have responsibility in the area of 
determining what constitutes a risk regarding septic disposal; 
 If waste is not going into approved septic system, it is a contravention of the Salt 
Spring Island Land Use Bylaw; 
 Significant risk would be considered raw sewage being disposed on the land; 
 Section 4.4 (d) should use the word “evidence” versus “concerns”; 
 The policy can state it does not apply to any new build construction. 
The meeting was recessed for a break at 1:13 p.m. and reconvened at 1:25 p.m. 
16.2 Request for Provincial Appointment of an Independent Housing Advisor - 
Discussion 
Trustee Patrick introduced the discussion and the following points were noted: 
 There is a need to align housing policy with water servicing; 
 There is currently no framework to ensure that new water connections are 
directed toward the housing types most urgently needed; 
 North Saanich was recently appointed a housing advisor to identify solutions for 
housing supply; 
 A Local Trust Committee is exempt from Housing Supply Act and the scale and 
urgency of local housing need is clear; 
 Due to delays in the Official Community Plan work, and continued need to 
address water servicing issues, the approach allows the Local Trust Committee 
to move forward to address the water supply issue. 
A trustee outlined the reasons they are not in support of the proposal noting the 
Local Trust Committee was elected to address housing issues, rezoning could have 
been undertaken, and the Official Community Plan project has failed to move 
forward or address these issues. 
Trustee Harris left the meeting at 1:34 p.m. 
 The meeting was recessed for a break at 1:34 and reconvened at 1:37 
A Trustee noted the OCP/LUB project was the correct project to put forward to 
address the issues but due to staff capacity related to staffing shortages progress 
on the project has been slow.

British Columbia to appoint an independent housing advisor under the 
Housing Supply Act to work with the LTC to review actions to date and
