[0:02:43] Voice 3: Good morning, Ms. Chair. I'm Chris Hutton. I'm the regional planning manager of the Salisbury
[0:02:51] Voice 3: World Trust Committee. We'll be today in the lifetime of the car, which is our Planet One.
[0:02:56] Voice 3: He'll be operating our online world today. If I'm not mistaken, we've got Peter on the Zoom here.
[0:03:10] Voice 3: I wanted to take a chance today, this morning, to allow me, I'm going to introduce Peter.
[0:03:14] Voice 3: Peter Thicke. Peter is our new Island Planner. He just started with us, I think this is week
[0:03:19] Voice 3: three. That started week three for you, Peter? Or maybe week two, I don't know.
[0:03:24] Voice 3: Peter Thicke Week two.
[0:03:25] Voice 3: So Peter, I'll invite you to introduce yourself if you wanted to say anything.
[0:03:30] Voice 3: Meet trustees Patrick and Harris. Unfortunately, Chair Peterson was late this morning, but
[0:03:35] Voice 3: we'll look forward to having you in the future.
[0:03:39] Voice 1: Thanks. Thanks, Chris. Yeah, and I apologize in advance. I'm fairly familiar with
[0:03:45] Voice 1: Robert's rules, so I apologize in advance if I do something out of line here. But just by way of
[0:03:50] Voice 1: introduction, my name's Peter Thicke. I've recently joined the Islands Trust, as Mr. Hutton mentioned,
[0:03:56] Voice 1: as the island planner. I believe I've been charged primarily with trying to carry the OCP LUB project
[0:04:03] Voice 1: forward, but also be supporting with a lot of current planning and just other various issues
[0:04:07] Voice 1: that the Salt Spring LTC sees fit for me to work on.
[0:04:14] Voice 1: I recently, most recently,
[0:04:16] Voice 1: I've worked kind of in the private sector
[0:04:17] Voice 1: doing more development management.
[0:04:19] Voice 1: But prior to that,
[0:04:20] Voice 1: I was involved in the planning department
[0:04:21] Voice 1: for several years with the District of Tofino
[0:04:23] Voice 1: and some other small municipalities
[0:04:25] Voice 1: and regional districts prior to that.
[0:04:28] Voice 1: So I'm excited to be here.
[0:04:29] Voice 1: Happy to try to move projects forward
[0:04:33] Voice 1: and help out with Salt Spring.
[0:04:35] Voice 1: I have a good amount of experience living in smaller communities
[0:04:40] Voice 1: with various interest groups and needs and those kinds of things.
[0:04:44] Voice 1: So I'm happy to be here and happy to try to contribute.
[0:04:48] Voice 1: And yeah, thank you very much for having me.
[0:04:51] Trustee Patrick (probable): Thank you and welcome to the Salt Spring team.
[0:04:54] Trustee Patrick (probable): It's great to have you here.
[0:04:56] Trustee Patrick (probable): And don't worry too much about the rabbit and rabbit's rules there.
[0:04:59] Trustee Patrick (probable): When we get in a pinch being on the islands,
[0:05:01] Trustee Patrick (probable): we try to kind of marry that formality with informality
[0:05:05] Trustee Patrick (probable): so that we stay friendly and inviting.
[0:05:10] Trustee Patrick (probable): All right.
[0:05:12] Trustee Patrick (probable): With that, I'm going to turn back on.
[0:05:17] Voice 3: If you may, Chair, I'll just lastly introduce Lisa Millard.
[0:05:24] Of course, I'm like taking notes.
[0:05:27] She'll be in
[0:05:28] Voice 3: the background as a minute maker.
[0:05:30] Voice 3: It's important.
[0:05:33] Trustee Patrick (probable): Great.
[0:05:33] Trustee Patrick (probable): My computer just crashed.
[0:05:35] Trustee Patrick (probable): I'll start up in a minute again.
[0:05:37] Trustee Patrick (probable): This is going to be one of those days, I can tell already. Here it comes back up again.
[0:05:43] Trustee Patrick (probable): All right. So this is an official forum for your local press committee to make decisions.
[0:05:51] Trustee Patrick (probable): And there will be an opportunity to speak in a moment.
[0:06:06] Trustee Patrick (probable): It'll be open in a minute here.
[0:06:16] Trustee Patrick (probable): No, I'm just trying to get it all back open again. My computer decided to close down on
[0:06:22] Trustee Patrick (probable): its own. I didn't have it. It's created. I don't know why it's doing that. All right.
[0:06:34] Trustee Patrick (probable): Well, I'm waiting for this to get back up and running. We have an agenda before us.
[0:06:38] Trustee Patrick (probable): are there any additions and changes to the uh agenda i had go ahead uh
[0:06:44] Voice 3: i just wanted to note um
[0:06:47] Voice 3: item 18.1 is the ocp report um we are wanting to um get us to uh we do want to get you to that
[0:06:57] Voice 3: third report and the new planner coming on a little forward to having that to you in april
[0:07:01] Voice 3: um this turn this time all
[0:07:07] Trustee Patrick (probable): right um i did have one item that i'd like to add i was going to
[0:07:10] Trustee Patrick (probable): added 15.1 but they could be added to the business is a briefing note on um an independent housing
[0:07:18] Trustee Patrick (probable): advisor um is that all right that'd be added to new business uh
[0:07:24] Voice 15: i'm opposed to uh i'm opposed to
[0:07:32] Voice 15: the uh for the motion uh
[0:07:34] Trustee Patrick (probable): can we add the item under new business discuss it there okay that's right
[0:07:39] Trustee Patrick (probable): Okay, so we'll add that to new business, which is 16.
[0:07:48] Trustee Patrick (probable): Okay, can we then approve the agenda as amended through general consent?
[0:07:53] Trustee Patrick (probable): All right, well, this is the public participation area.
[0:08:03] Trustee Patrick (probable): Just a reminder to everyone that we are post a public hearing on proposed bylaws 544, 545,
[0:08:09] Trustee Patrick (probable): 5 and 546, so please do not raise those. If you do, I'll have to ask you to
[0:08:18] Trustee Patrick (probable): to not continue a conversation on it. So just a reminder, it's our responsibility to make sure
[0:08:25] Trustee Patrick (probable): this meeting space is respectful and inclusive and a culturally safe place. We'll speak respectfully,
[0:08:32] Trustee Patrick (probable): acknowledge concerns and questions without causing harm, uphold cultural safety, and we'll keep the
[0:08:37] Trustee Patrick (probable): conversation constructive. I know that it will be respectful and, and if anyone wishes to address us,
[0:08:49] Trustee Patrick (probable): all right, just state your name.
[0:08:52] Voice 11: Maxine Leichter. I first have a request.
[0:08:57] Voice 11: Could you please speak up because you have no mics. I'm getting hearing aids.
[0:09:04] Voice 11: in a few weeks i'll be able to hear better um all right so i have a question and the question is
[0:09:15] Voice 11: will there be any public uh consultation on the ocp in march and i know i know all the evidence
[0:09:25] Voice 11: looks like there won't but i've been asked by others to be absolutely sure and so i would like
[0:09:34] Voice 11: an answer yes or no or if you really don't know don't know that that's all i have i can say for
[0:09:43] Voice 3: certain that we there won't be any public consultation well will or won't i can say
[0:09:49] Voice 3: for certain that there will not be any public consultation in march on the ocp uh we do want
[0:09:56] to bring back uh the the report and there will certainly be i i can't tell in the scenario where
[0:10:02] is not further public consultation prior to advancing a draft or cp
[0:10:08] Voice 3: so there's more conversation
[0:10:10] Voice 3: to be had so long as that project advances yeah thank
[0:10:16] Trustee Patrick (probable): you anyone else that wishes to address us
[0:10:19] Trustee Patrick (probable): today please go ahead thank you you might want to just step up closer to the mic this room sort of
[0:10:25] Trustee Patrick (probable): my name
[0:10:26] Voice 9: is peter lloyd jones president of the social accommodation group and i'm here ready
[0:10:31] Voice 9: to address the issue of the revising by law 355
[0:10:36] Voice 9: in relation to the BNBs and vacation rentals.
[0:10:40] Voice 9: So we've had two roundtable meetings,
[0:10:43] Voice 9: one in January 2025,
[0:10:46] Voice 9: and then another one recently in January 2026,
[0:10:49] Voice 9: which were very positive meetings.
[0:10:51] Voice 9: It included all the local stakeholders
[0:10:54] Voice 9: and governance of Islands Trust, CRD, LCC,
[0:10:57] Voice 9: Chamber of Commerce, industry,
[0:10:58] Voice 9: industry, 19 participants at the last meeting in January. They're very positive in support
[0:11:03] Voice 9: of modernization of the by-law. So the following next steps were proposed at the last meeting
[0:11:08] Voice 9: in January. Clarify and modernize the land use by-law that regulates SDRs, keeping it
[0:11:15] Voice 9: simple and enforceable, establishing a working group, LCC, trust, industry, housing, accepted
[0:11:20] Voice 9: a drive, timely progress. Consider implementing business licenses after land use by-laws
[0:11:24] Voice 9: as clarified, is established and in conjunction with a proactive enforcement.
[0:11:29] Voice 9: And then invest in shoulder season activities and explore new revenues, tools, etc.
[0:11:34] Voice 9: The reason I'm here is really that there's really just been no progress.
[0:11:37] Voice 9: It's been over a year now since the meetings, zero progress we've made on this file.
[0:11:42] Voice 9: No working group has been established, despite this being said that we're going to do that.
[0:11:47] Voice 9: A proposed budget of $40,000 has been put in the budget for 2027 CID to look into business
[0:11:52] Voice 9: licensing. But I understand that that issue has also been put on hold. I understand also that
[0:11:58] Voice 9: this issue was included in the IT sector meetings, but this too has been put on hold.
[0:12:04] Voice 9: It's been over a year, so we're getting frustrated. And there's been zero progress. I'd like to know
[0:12:09] Voice 9: why it's being stalled. Simple question. Why are we still sitting here? Why are we discussing that?
[0:12:16] Voice 9: Because I foresee that in a year's time, we'll be in the same position again. And I don't think
[0:12:20] Voice 9: be a good idea so that's it my question thank you thank
[0:12:24] Trustee Patrick (probable): you i think that's wrapped up with the ocp
[0:12:27] Trustee Patrick (probable): project which we are now expecting to report in april yeah
[0:12:31] Voice 3: so
[0:12:32] Voice 4: that's
[0:12:36] Voice 3: that's pretty much it
[0:12:37] Voice 3: i mean this standalone project it would be probably a much uh more straightforward project
[0:12:42] Voice 3: um unfortunately if this the ocp iab project does um monopolize our our project standard
[0:12:49] with this point um so we're not able to get a little bit in line with
[0:12:54] Voice 3: that so working group
[0:12:54] Voice 3: cannot be established in these tunnels don't you say there's there's no project for a working group
[0:13:03] within
[0:13:03] Voice 3: the island's trust at this time except under the ocp
[0:13:07] Voice 3: approach yeah that
[0:13:08] Trustee Patrick (probable): was the intent
[0:13:11] Trustee Patrick (probable): we'll know more april where we can ask stuff what's coming next so thank you thank you okay
[0:13:18] Trustee Patrick (probable): Okay. Anyone else
[0:13:19] Trustee Patrick (probable): that wishes to address this today?
[0:13:21] Trustee Patrick (probable): A couple of comments. All right. Well, thank you.
[0:13:24] Trustee Patrick (probable): Your comments are important and we will of course take them into
[0:13:30] Trustee Patrick (probable): consideration. Okay. We're over to a trustee reports.
[0:13:34] Trustee Patrick (probable): Trustee Harris, do you have any?
[0:13:36] Trustee Patrick (probable): Well,
[0:13:37] Voice 15: I'll keep it short. We just had a, for anybody who's,
[0:13:40] Voice 15: well for everybody here that's listening, but I'm not confident.
[0:13:44] Voice 15: There's people online listening.
[0:13:46] Voice 15: interesting to know if anybody actually watches the videos of this we just had a trust council
[0:13:53] Voice 15: meeting last week very interesting and a lot of it to me is was very alarming just as a lot of
[0:14:07] Voice 15: this whole term has been alarming as far as what's coming down the pipe for a better word
[0:14:17] Voice 15: what's coming down the pipe for salt spring island and development or just movement positively in any
[0:14:24] Voice 15: fashion i'm really concerned that um just as i have been this whole term that we're not going
[0:14:36] Voice 15: to see any uh improvement to some of the social and economic issues we have here on the island by
[0:14:44] Voice 15: housing homelessness or with what's coming down the pipe with the policy statement and some of
[0:14:51] Voice 15: the language that you're coming from trust council and it's very troubling to me that we have people
[0:15:00] Voice 15: from other islands dictating what we will be able to or not be able to do here on soul spring
[0:15:09] Voice 15: also trust council just passed a motion to raise the the wages of trustees i voted against it there
[0:15:26] Voice 15: There was a few other trustees that voted against it.
[0:15:29] Voice 15: There was a thing prior, a week or two, with the Governance Committee,
[0:15:33] Voice 15: which I'm vice chair of, where that raise in wages for trustees was proposed,
[0:15:39] Voice 15: and I opposed it there as well.
[0:15:40] Voice 15: I didn't even want to bring it to Trust Council.
[0:15:42] Voice 15: One of my main issues with that was that, as we all know,
[0:15:51] Voice 15: Salt Spring pays the lion's share of the taxes to the Islands Trust organization,
[0:15:55] Voice 15: organization. And, you know, it's already difficult for us to do anything around here.
[0:16:01] Voice 15: We do have another credit representation issue, which is Glare. And there was no way I could
[0:16:06] Voice 15: be in favor of giving trustees on, you name the item, Mesquite, Denman, wherever it may be,
[0:16:13] Voice 15: more money or taxpayers' money from Salt Spring for them to dictate to us what we can or can't do.
[0:16:20] Voice 15: But that motion ended up passing. And there was a few that voted against it. I forget
[0:16:27] Voice 15: I forget who in particular, but at least there was a couple.
[0:16:31] Voice 15: And to me, it's very troubling.
[0:16:33] Voice 15: And then the language I'm hearing, you know, I hear language of decolonization.
[0:16:39] Voice 15: I've heard language of stolen land, colonial construct, another word being tossed around.
[0:16:50] Voice 15: And I don't see how that in any way, shape or form is positive language to be putting towards community.
[0:16:57] Voice 15: community, hoping to move forward in a positive fashion without division, because I think
[0:17:06] Voice 15: it's more divisive, just as many of the things the MS Fest has done, in my view, over the
[0:17:12] Voice 15: years, and it hasn't gotten any better.
[0:17:15] Voice 15: So I guess that's my report.
[0:17:17] Voice 15: Sorry to drone off, but I could probably talk for days on the subject.
[0:17:22] Voice 15: Thank you.
[0:17:23] Trustee Patrick (probable): Thank you, Justin Harris.
[0:17:26] Trustee Patrick (probable): My report, I'm just going to open this.
[0:17:28] Trustee Patrick (probable): there's always sad times with Salt Spring here,
[0:17:32] Trustee Patrick (probable): lost a number of elders on the island recently.
[0:17:35] Trustee Patrick (probable): And I really wanted to pay tribute to Dr. Hugh Greenwood,
[0:17:41] Trustee Patrick (probable): has left us his amazing work.
[0:17:46] Trustee Patrick (probable): He did a geologic map of Salt Spring himself.
[0:17:53] Trustee Patrick (probable): It's just an amazing piece of work that he had done
[0:17:58] Trustee Patrick (probable): to create this map, and we are the only island in all of the Gulf Islands to have a geologic map of this magnitude,
[0:18:09] Trustee Patrick (probable): and it was all because of his own fortitude and his own efforts to come over this island
[0:18:16] Trustee Patrick (probable): and try to record the geologic record on this island, and that will be forever a gift from him for this island,
[0:18:24] Trustee Patrick (probable): and we will be grateful for that.
[0:18:28] Trustee Patrick (probable): As usual, I attend numerous, numerous meetings.
[0:18:32] Trustee Patrick (probable): I may have the governance committee, the finance committee
[0:18:34] Trustee Patrick (probable): and the executive committees.
[0:18:36] Trustee Patrick (probable): So since our last meeting
[0:18:37] Trustee Patrick (probable): and also chaired Gabriela local trust committee,
[0:18:44] Trustee Patrick (probable): attended responding to indigenous specific racism training.
[0:18:50] Trustee Patrick (probable): Also attended Bowen Island municipality meeting
[0:18:53] Trustee Patrick (probable): meeting along with our CAO and our Director of Finance and Human Resources Services, attended
[0:19:02] Trustee Patrick (probable): the joint local trust committee, local community commission meeting we had here, the Salt Spring
[0:19:12] Trustee Patrick (probable): Foundation funders table attended. I was really excited because the guest speaker this month
[0:19:19] Trustee Patrick (probable): was my daughter. So I was thrilled to have her, to be able to introduce her as a speaker and I
[0:19:26] Trustee Patrick (probable): think she inspired a lot of people with the ideas of philanthropy and being for community, rural
[0:19:35] Trustee Patrick (probable): community funding needs. Went to the ABICC, had a housing webinar on methods of, again,
[0:19:46] Trustee Patrick (probable): And with the money that is missing for being directed toward housing in rural areas,
[0:19:53] Trustee Patrick (probable): there's a lot of work going to how communities can raise that money, manage that money.
[0:19:58] Trustee Patrick (probable): And that's going to continue to be a conundrum for us in the little Gulf Islands, I'll say,
[0:20:08] Trustee Patrick (probable): because our projects are so small compared to urban areas.
[0:20:10] Trustee Patrick (probable): and I think there's a great opportunity for all the islands to work more strongly together to
[0:20:18] Trustee Patrick (probable): get that magnitude of combining all our projects into one project, so to speak, to be more
[0:20:26] Trustee Patrick (probable): attractive from a funding perspective. But we've got to get more agile in that area and I think
[0:20:33] Trustee Patrick (probable): there's lots of talk in that area, so excited. There was also the webinar on working toward
[0:20:39] Trustee Patrick (probable): a deer strategy it was really focused on uh main island but it's uh very applicable to all of our
[0:20:45] Trustee Patrick (probable): islands have an over abundance of deer and uh working with the community and the education
[0:20:51] Trustee Patrick (probable): needed to help communities understand that uh controlling the deer population is is a necessity
[0:20:58] Trustee Patrick (probable): the southern gulf island forum held their meeting uh this afternoon is the uh sanch island round
[0:21:05] Trustee Patrick (probable): Roundtable. I talked my husband into attending since we're here, and it's always a good time to get everybody together for the Santa Child Inlet.
[0:21:14] Trustee Patrick (probable): Just a reminder that Salt Spring's local trust area extends all the way down the Santa Child Inlet, down to its very southern point, up to the high water mark, all along those areas.
[0:21:25] Trustee Patrick (probable): So it's a vast area that we have within our jurisdiction.
[0:21:30] Trustee Patrick (probable): And that's my report.
[0:21:31] Trustee Patrick (probable): report. So moving on, the chair is not here. We'll keep going. And the CRD is not here
[0:21:41] Trustee Patrick (probable): because the local community commission's meeting at exactly the same time. Hopefully next year
[0:21:47] Trustee Patrick (probable): they organize that differently. So we're going to move on to 8.1.1, which is the draft minutes
[0:21:53] Trustee Patrick (probable): from February 12th's regular meeting. Are there any additions or changes to those minutes?
[0:22:00] Trustee Patrick (probable): Do you have any, Trustee Harris?
[0:22:02] Voice 15: No additions, thank you.
[0:22:03] Voice 15: okay
[0:22:03] Trustee Patrick (probable): so can we approve the uh february 12th minutes through general consent
[0:22:09] Trustee Patrick (probable): excellent um there's a resolutions without meeting report here for information page 19
[0:22:18] Trustee Patrick (probable): and there is the local community uh the local trust committee public hearing record from
[0:22:25] Trustee Patrick (probable): february 12th is here on page 20 uh for our receipt um do we have to have a motion to
[0:22:33] Trustee Patrick (probable): receive that i guess i'd look to uh yeah
[0:22:37] Voice 3: we can do a motion or
[0:22:38] Trustee Patrick (probable): general consent or motion
[0:22:40] Voice 3: yeah it
[0:22:41] Trustee Patrick (probable): should be a motion oh
[0:22:43] Voice 3: that motion would be uh preferred yep
[0:22:46] Trustee Patrick (probable): uh so on item 8.4 on page
[0:22:53] Trustee Patrick (probable): indeed let's get that for us here um so we would need that the salt spring island local trust
[0:23:02] Trustee Patrick (probable): Committee receive the record of public hearing for proposed bylaw 546 dated February 12,
[0:23:16] Trustee Patrick (probable): 2026? I guess, Lisa, does that look to
[0:23:26] Trustee Patrick (probable): you for a readback?
[0:23:28] Voice 13: I'll read that back to you, Chair Patrick, that the Salt Spring Island Local Trust Committee
[0:23:33] Voice 13: received the record of public hearing for proposed bylaw number 546 dated February 12th, 2026.
[0:23:44] Trustee Patrick (probable): Adequate. Chris? That was a good read.
[0:23:47] Trustee Patrick (probable): All right. I guess I'm making that motion. Is there a second?
[0:23:51] Voice 15: Can you please repeat the motion?
[0:23:53] Trustee Patrick (probable): Okay. Could you read that back one more time, Lisa?
[0:24:01] Voice 13: That the Salt Spring Island Local Trust Committee received the record of public hearing for
[0:24:06] Voice 13: proposed bylaw number 546 dated february 12 2026. so
[0:24:13] Trustee Patrick (probable): your second seconded by uh trustee harris
[0:24:16] Trustee Patrick (probable): uh any discussion i'll call about all those in favor that carries sorry here we go okay um
[0:24:31] Trustee Patrick (probable): moving on we have two pieces of correspondence we have item 9.1
[0:24:40] Trustee Patrick (probable): What will be to the local trust committee on 16 Jackson Avenue for, it says for reconsideration.
[0:24:49] Trustee Patrick (probable): So to you.
[0:24:52] Trustee Patrick (probable): Yeah.
[0:24:56] Voice 14: We requested the stormwater management report for the rezoning proposal on 16 Jackson Avenue.
[0:25:03] Voice 14: And the applicant wanted TLTC to reconsider the request for the stormwater management
[0:25:14] Voice 14: report as a term of reference for the rezoning application.
[0:25:19] Voice 14: The applicant, Mr. Ogbibi, is also here and he requests for reconsideration.
[0:25:30] Voice 14: Okay.
[0:25:33] Voice 6: The
[0:25:34] Voice 14: property is located on seasonally flooded land and the rezoning proposal is to
[0:25:42] Voice 14: have commercial uses on the property currently zoned R6 and R16. So yeah, that's the reason.
[0:25:51] Voice 14: And the applicants logic for the reconsideration of that request
[0:26:00] Voice 14: is on their returned comment provided to the LTC on page 24.
[0:26:11] Trustee Patrick (probable): So is this something we would then
[0:26:13] Trustee Patrick (probable): consider
[0:26:14] Voice 6: during that report?
[0:26:15] Voice 6: Is that for?
[0:26:17] Voice 14: So as ILATS does the staff, we sometimes
[0:26:21] Voice 14: times ask applicants to prepare or provide further reports for the rezoning proposal
[0:26:27] Voice 14: or for the development term proposals, and the applicants have the right to ask for reconsideration
[0:26:33] Voice 14: of those recommendations from the LTC, and it's the LTC who decides if the report is
[0:26:40] Voice 14: necessary or not.
[0:26:41] Voice 14: I understand.
[0:26:43] Voice 3: Just to clarify, proceeding with the preliminary report today and those recommendations,
[0:26:52] Voice 3: Does not necessarily have to be tied to the outcome of this decision, so they're not entirely connected. However, if LPC wishes to wait until that application is considered, we can certainly discuss it in the context of that item.
[0:27:09] Voice 3: So
[0:27:14] Trustee Patrick (probable): I'm just trying to clarify. So this is this reconsideration is, but is it part of the requirements for the rezoning that this was identified?
[0:27:30] Voice 3: Because there are multiple reports and readings of a bylaw, we can wait until that a later date.
[0:27:38] Voice 3: So if you were to decide to affirm staff's request today, they would produce the report,
[0:27:45] Voice 3: we would advance the rezoning and refer it out, and it would just be updated as we go
[0:27:53] Voice 3: through the amendment process.
[0:28:10] Voice 5: So
[0:28:10] Voice 14: the previous temporary use permit was limited in scope and did not contemplate permanent
[0:28:15] Voice 14: structures.
[0:28:16] Voice 14: Therefore, the stormwater management plan was not required at that time.
[0:28:21] Voice 14: The current proposal, however, involves longer-term site modifications.
[0:28:25] Voice 14: As a result, professional reports are required to assess drainage conditions on the property.
[0:28:30] Voice 14: The TUPE report previously issued clarified that approval of temporary reuse would not
[0:28:36] Voice 14: preclude the requirement of stormwater management works under the current or any future development
[0:28:43] Voice 14: application.
[0:28:46] Voice 14: The applicant has submitted photographs indicating that the presence of an existing stormwater
[0:28:52] Voice 14: water management system of property. However, as a staff we are unable to verify the operational
[0:28:58] Voice 14: effectiveness of the system or confirm that the stormwater infrastructure is not located beneath
[0:29:04] Voice 14: the footprint of the existing or proposed structures. In addition, the property is also
[0:29:10] Voice 14: situated within an area subject to seasonal flooding. The condition further underscores
[0:29:15] Voice 14: the importance of thoroughly assessing the stormwater management as part of the current
[0:29:20] Voice 14: zoning application and that was the reason that as a staff we asked the applicant to
[0:29:25] Voice 14: provide the stormwater management report for the rezoning application but uh the applicant
[0:29:34] Voice 14: opposed to this opposed to this requirement and wanted tltc to consider the requirement for the
[0:29:41] Voice 14: report why don't we
[0:29:43] Voice 6: hear uh trustee
[0:29:44] Trustee Patrick (probable): harris go ahead so
[0:29:52] Voice 10: first of all i would like to thank
[0:29:55] Voice 10: I thank Milam very much for getting to this stage so that they, you know.
[0:30:00] Voice 10: And he's the only planner that's ever come to my property, like, and taken an interest in it multiple times, you know, and that's special because he got out of the office and he came and he saw first hand, okay?
[0:30:13] Voice 10: So the reason I'm disputing that I have to have this drain water study done is because your regulations here, it's nowhere near the criteria to activate it, okay?
[0:30:26] Voice 10: I mean, it's less than 10% that I've created, even with the new building I'm proposing, if I get the lot line setbacks.
[0:30:36] Voice 10: But back me up a little bit.
[0:30:38] Voice 10: This was never brought forward.
[0:30:41] Voice 10: And OK, before I started anything, I went and had a meeting with a planner that's not here now.
[0:30:46] Voice 10: Excellent meeting.
[0:30:47] Voice 10: He detailed exactly what I had to do, all the rest of it, to deal with the sidewalk out the front, all the rest of it.
[0:30:56] Voice 10: And there was no mention about draining water study or floodplains or anything like that, okay?
[0:31:05] Voice 10: And so I did what I had to do to get a temporary use permit in place to build two buildings and bring in a food truck and stuff, okay?
[0:31:16] Voice 10: All temporary use permits and everything.
[0:31:20] Voice 10: Some people in the trust are thinking, okay, it's a temporary use permit for temporary buildings.
[0:31:25] Voice 10: You can't build a temporary building in Salisbury Island and get an occupancy permit, okay?
[0:31:30] Voice 10: You have to go through the whole process.
[0:31:32] Voice 10: You have to do foundations, you're building permits, occupancy permits, everything like that, okay?
[0:31:37] Voice 10: And so that infrastructure has to go into the ground at that stage, okay?
[0:31:42] Voice 10: At the temporary permit stage, okay?
[0:31:45] Voice 10: And so I went and got all my permits, did everything, put all my infrastructure in the ground and dug up.
[0:31:52] Voice 10: Now, your own regulations say before you can get an occupancy permit for commercial building or temporary use, you have to have all your landscaping done.
[0:32:02] Voice 10: And you have to have the parking lot finished and everything, okay?
[0:32:05] Voice 10: So now you're asking that I get an engineer to sign off on a system that I didn't have to do.
[0:32:13] Voice 10: Nobody's going to sign off on it, okay?
[0:32:15] Voice 10: But this is the third project I've done in Ganges, okay?
[0:32:19] Voice 10: came the first project i didn't have to do anything but i did the same system because i
[0:32:26] Voice 10: felt it was the right thing to do i know the water level was high there it's worked perfectly
[0:32:30] Voice 10: and one one one where actually it was behemoth consignment that was a full system that was
[0:32:36] Voice 10: designed by an engineer and water studies were done before and after and all the rest of it
[0:32:41] Voice 10: Much, much better law. And I did that. And so I extrapolated all that information and everything.
[0:32:50] Voice 10: It did my own system at the other place, which I didn't feel I had to get an engineer to do or sign off or anything because it was so it didn't.
[0:32:58] Voice 10: It wasn't needed by the regulations, but I did it because I thought it was the right thing to do and I didn't want to create any
[0:33:05] Voice 4: more problems.
[0:33:07] Voice 10: okay and so so e 0.1 0.10 0.1 doesn't apply because of my build-out so less than 10 percent
[0:33:18] Voice 10: and um and so i have complied in the sense of e 10.2 um with my stormwater draining system which i
[0:33:28] Voice 10: um there's all the there's pictures there showing the whole system there's pictures showing that
[0:33:35] Voice 10: And none of the infiltrators are under buildings.
[0:33:41] Voice 10: And it shows exactly where everything is going.
[0:33:45] Voice 10: And I have put in inspection ports for the last discharge of the whole system.
[0:33:52] Voice 10: And even in a very heavy rain, there's just a trickle coming through.
[0:33:56] Voice 10: I mean, it goes into a gravel pit, and then eventually it goes out to the culvert on the road,
[0:34:02] Voice 10: which I installed at my own expense.
[0:34:04] Voice 10: fence so i could do the sidewalk and uh i know when i put in the extra culvert
[0:34:11] Voice 10: adjoining my driveway i picked up a huge amount of water that was running from the parts store
[0:34:15] Voice 10: which came down across the lot next door and now that goes in to the drain you know into the
[0:34:23] Voice 10: culvert and then goes down you know and so now that water is not coming onto my property at all
[0:34:28] Voice 10: um the area where they say there was flooding i agree it was wet there the the grasses that
[0:34:38] Voice 10: that grew there it was it was a no-brainer it was wet so backing up a little bit uh that property
[0:34:45] Voice 10: was rented by the uh for the library for quite a few years okay and that's where all the parking
[0:34:51] Voice 10: was at the bottom okay so rather than digging it out like i did down to now they put geocache
[0:34:58] Voice 10: off down put three-quarter minus on top compacted it and that was the parking lot okay so now they
[0:35:05] Voice 10: created a surface that doesn't drain okay and so that's why all the water was pooling there
[0:35:10] Voice 10: so i dug all that out it took a beautiful top so i'll put it at the top made a an orchard at
[0:35:16] Voice 10: the top for the apple for apple trees and then put in three inch three inch shot rock and then
[0:35:23] Voice 10: compacted it and put a whole proper drainage in that whole area there there's no problem with any
[0:35:29] Voice 10: water anymore and then all the waffle roof waters off the roofs goes into what they call storm texas
[0:35:38] Voice 10: which is a Dutch company, and it just works phenomenally well.
[0:35:45] Voice 10: I mean, the water just – and then there's water going into two 1,000-gallon tanks
[0:35:51] Voice 10: for irrigation, so that water is – so I wouldn't be standing in front of you
[0:35:59] Voice 10: if I thought there was a problem.
[0:36:02] Voice 10: There is no problem there.
[0:36:03] Voice 10: It's dry as a bone.
[0:36:05] Voice 10: The system works well.
[0:36:07] Trustee Patrick (probable): Any questions?
[0:36:10] Voice 15: Well, yeah, maybe I'd ask a question. Martin, it's, you know, clear that you've done other, you know, developments and done an amazing job.
[0:36:22] Voice 15: And what you've done has been positive, you know, in Ganges. It's a good thing.
[0:36:27] Voice 15: Would you concur that the old drainage systems that are currently still working or, if you want to use that term loosely, semi-working in Ganges, those are far inferior to what you have installed today compared to something that's been there for four years or more?
[0:36:54] Voice 10: I know this sounds like I'm boasting, but there's no other project I know in Ganges that's done the level of collecting this water.
[0:37:04] Voice 10: And even the building inspector, he asked me, he said, why are you doing all this?
[0:37:09] Voice 10: You don't have to do this.
[0:37:10] Voice 10: I said, no, it's the right thing to do.
[0:37:11] Voice 10: And I said, I know that it's going to become an issue maybe, and I just want to do it right in the beginning.
[0:37:17] Voice 10: He wouldn't notate it on the permit that I had done this, but he was quite impressed.
[0:37:27] Voice 15: Thank you.
[0:37:29] Voice 15: Because it's not a secret to people that are in the business or that are involved with movement of water and infrastructure underneath Ganges that the old stuff is failing and there's actually a nightmare scenario kind of happening.
[0:37:43] Voice 15: But we have new stuff going on.
[0:37:44] Voice 15: and i and personally i think that it's not right that um mr oak will be made to jump through these
[0:37:51] Voice 15: hoops when clearly you know what's he's got going on is more than on the up and up and we should
[0:37:58] Voice 15: really be thankful to him thank
[0:38:00] Voice 10: you if
[0:38:01] Voice 15: there's a motion that um i'd be more than willing to do a
[0:38:05] Voice 15: motion if the chair would accept it to have the ltc waive the requirement mr oak will be to um
[0:38:13] Voice 15: to have consulting professional certified storm drainage system
[0:38:16] Voice 15: to
[0:38:17] Trustee Patrick (probable): stop for the wording of a resolution to waive this requirement
[0:38:25] Voice 6: we
[0:38:28] Voice 5: could we could bring it back you
[0:38:29] Trustee Patrick (probable): could bring us a draft motion
[0:38:32] Trustee Patrick (probable): so uh would that be all right trustee harris if the motion came back on item 14.1 which is the
[0:38:37] Trustee Patrick (probable): considerations resulting i have to ask staff to bring us a motion to uh leave that today yes yep
[0:38:42] Trustee Patrick (probable): Yeah. Yeah. All right. So we'll reconsider this. Reconsider the reconsideration at 14.1. That's
[0:38:50] Trustee Patrick (probable): okay. Okay. So the next piece of correspondence is 9.2, which was a request for review of
[0:38:58] Trustee Patrick (probable): improvement of public lake access and parking safety on Salt Spring on page 38 of the agenda
[0:39:05] Trustee Patrick (probable): the package i
[0:39:07] Voice 15: apologize but did you say page 38 yes i
[0:39:23] Trustee Patrick (probable): know i i'd be for i think this is uh this
[0:39:28] Trustee Patrick (probable): is a topic of uh uh i think you know i agree our lake accesses are getting incredibly crowded in
[0:39:37] Trustee Patrick (probable): the summer and and uh it's frightening to drive past uh with the number of people that are using
[0:39:44] Trustee Patrick (probable): them but i think this is a joint issue i would suggest we ask that this be added to a future
[0:39:49] Trustee Patrick (probable): or lcc ltc joint meeting agenda trustee harris i don't know because uh if they have the parks and
[0:39:58] Trustee Patrick (probable): recreation service um however land planning is important for number of accesses and things of
[0:40:08] Trustee Patrick (probable): that nature so it's kind of a joint activity is
[0:40:13] Voice 15: it a joint activity though or is it just part crd
[0:40:17] Trustee Patrick (probable): it's it's primarily the crd but in regard to future accesses and so forth would be zoning
[0:40:24] Trustee Patrick (probable): how do we how do we zone for you know future access um
[0:40:32] Voice 15: well at this point to me it just seems
[0:40:35] Voice 15: like it's kind of out of our jurisdiction and i would encourage um this is uh or miss funson to
[0:40:41] Voice 15: petition the crd and bring it up within the community and the crd but um you know i don't
[0:40:50] Voice 15: to see muddying the waters for the island's trust and staff and we're already taxed
[0:40:58] Voice 15: for lack of a better word i'm you know pretty thin with staff time to uh to just maybe take
[0:41:07] Voice 15: this as information and not you're suggesting well
[0:41:14] Trustee Patrick (probable): it's fine i mean uh this piece of correspondence
[0:41:17] Trustee Patrick (probable): was sent to uh parks oh
[0:41:20] Voice 15: well great i'm very happy to hear that
[0:41:22] Trustee Patrick (probable): so we can just proceed for
[0:41:24] Trustee Patrick (probable): information i
[0:41:25] Voice 12: would be more than happy to listen okay
[0:41:27] Trustee Patrick (probable): that brings us to then item 10.1 which is
[0:41:34] Trustee Patrick (probable): the follow-up action list on page 40 of the agenda i'll turn to uh planning manager
[0:41:41] Trustee Patrick (probable): button for any items to bring to our attention
[0:42:13] Trustee Patrick (probable): It's an item, we're at 10.1 on page 40.
[0:42:23] Voice 3: So I did want to note there's a couple of items that have been met, mainly the First Nations OCP budget refinement, as we've not completed the budget for the year.
[0:42:37] Voice 3: We're continuing to work with nations.
[0:42:41] Voice 3: I also wanted to note that a lot of the requests that we have, a lot of the fuel, I think,
[0:42:46] Voice 3: was in the open application report, but in the 355 Blackburn Road application, LTC had
[0:42:54] previously requested that staff
[0:42:56] Voice 3: report back on whether or not to keep our additional information
[0:43:01] after follow-up with certain different partners.
[0:43:04] what we have found in our
[0:43:07] Voice 3: our early discussions at this stage um we just believe that lpc ought
[0:43:11] Voice 3: to receive that information it's our recommendation that lpc advise that they are willing to hear
[0:43:17] Voice 3: additional information understanding that that commission would essentially mean
[0:43:21] Voice 3: that it is then their obligation to either advance the bylaw to a second public hearing
[0:43:28] Voice 3: hearing at some point before adopting the by-law, or to decline the application to the
[0:43:37] Voice 3: office, we would not be able to proceed without a second public hearing with that information
[0:43:45] Voice 3: turned.
[0:43:52] Trustee Patrick (probable): Do you need that indication from us now, or would you schedule it on the agenda for a
[0:43:59] Trustee Patrick (probable): future meeting?
[0:44:00] Voice 3: If LCC were to advise that they are willing to hear additional information, we would bring
[0:44:06] Voice 3: report in april uh for the lpc's consideration uh with recommendations for next steps any questions
[0:44:17] Voice 15: if we don't request further information what happens to this uh
[0:44:24] Voice 3: at that point uh you can
[0:44:25] Voice 3: either advance um you can proceed with adopting bylaw that was adoption give a third reading and
[0:44:33] referred to the executive committee um or you could um decline
[0:44:39] Voice 5: the option i
[0:44:49] Trustee Patrick (probable): know i would um
[0:44:52] Trustee Patrick (probable): if we specifically asked to have that verified from those earlier reports i think this information
[0:44:58] Trustee Patrick (probable): is important to see especially in building relationships with first nations um so i
[0:45:06] Trustee Patrick (probable): I would want to receive a report from you at our next meeting.
[0:45:13] Trustee Patrick (probable): Trustee Harris?
[0:45:17] Voice 15: Well, I'm concerned with where this is all going, honestly.
[0:45:23] Voice 5: And
[0:45:30] Voice 15: I'd be happy not to hear any more about it.
[0:45:37] Voice 15: So I don't know if I'm really in a position to want to ask for more information in April.
[0:45:48] Voice 15: rule my
[0:45:52] Trustee Patrick (probable): feeling that the strongest position for the for the applicant is that we receive that
[0:45:57] Trustee Patrick (probable): information as we'd be at risk of denying third reading which would require them to begin the
[0:46:04] Trustee Patrick (probable): whole application process again which would be quite expensive so i think having all information
[0:46:13] Trustee Patrick (probable): before us allows us to make the best decision and in best interest of the applicant to keep the
[0:46:20] Trustee Patrick (probable): process moving forward sounds
[0:46:21] Voice 4: good do
[0:46:23] Trustee Patrick (probable): you need a motion from us or would you just do that yeah
[0:46:30] Voice 3: motion would probably be invested um staff here to report back on the status of the
[0:46:38] Voice 3: resuming application 355 blackburn lisa
[0:46:44] Trustee Patrick (probable): can you hear chris could
[0:46:51] Voice 13: you repeat the address please
[0:46:54] Voice 6: 355 blackburn i'll
[0:47:00] Voice 13: read back what i have that the saltsburg island local trust committee
[0:47:04] Voice 13: request staff report back on the status of the application of 355 blackburn road saltsburg
[0:47:10] Voice 13: island um
[0:47:12] Voice 3: we'll just call it um we changed it by blackburn uh lisa to the um to application
[0:47:19] Voice 3: application number PLRZ-2024-0021.
[0:47:27] Voice 13: Affirmative, I have that.
[0:47:29] Trustee Patrick (probable): All right, Trustee Harris, are you seconding?
[0:47:34] Trustee Patrick (probable): Yes.
[0:47:34] Trustee Patrick (probable): Okay, so I'm making the motion
[0:47:36] Trustee Patrick (probable): and Trustee Harris is seconding.
[0:47:38] Trustee Patrick (probable): Is there any discussion?
[0:47:41] Trustee Patrick (probable): I'll call the vote.
[0:47:42] Trustee Patrick (probable): All those in favor?
[0:47:43] Trustee Patrick (probable): That carries.
[0:47:45] Trustee Patrick (probable): Any other items on the follow-up action list
[0:47:48] Trustee Patrick (probable): from staff's perspective?
[0:47:51] Voice 3: Nothing so much.
[0:47:52] Voice 3: to
[0:47:53] Trustee Patrick (probable): hear us any questions on the follow-up action list thank
[0:47:55] Voice 3: you i
[0:47:58] Trustee Patrick (probable): don't either i think at some
[0:48:00] Trustee Patrick (probable): point we should probably make sure we schedule time early in the summer to really do a housekeeping
[0:48:08] Trustee Patrick (probable): on this list to you know make sure everything that's on it is still
[0:48:17] Voice 3: with the uh follow-up action list yeah yeah we certainly um so we would have a um
[0:48:34] Trustee Patrick (probable): I would suggest we make sure we have some adequate time planned on the agenda and spend
[0:48:38] Trustee Patrick (probable): some time on it if we do some deep consideration of whether or not these items are still necessary.
[0:48:49] Trustee Patrick (probable): Okay.
[0:48:49] Trustee Patrick (probable): Okay then moving on we have the action active projects list here on page 45.
[0:48:58] Trustee Patrick (probable): Active is probably a place it is active so our understanding is the report on the OCP
[0:49:05] Trustee Patrick (probable): project is coming in our OCP land use bylaw update project is coming in April.
[0:49:11] Trustee Patrick (probable): Future projects list is also here for your information on page 50.
[0:49:16] Trustee Patrick (probable): um with that um we're either where are we we're actually we either recess the meeting now and
[0:49:28] Trustee Patrick (probable): come back at noon um
[0:49:35] Voice 5: or
[0:49:41] Trustee Patrick (probable): is there what items would you want to move forward
[0:49:51] Trustee Patrick (probable): that's well i guess we i
[0:49:53] Voice 3: believe we do have a camera meeting today
[0:49:59] Voice 3: that's true
[0:50:00] Voice 3: there's maybe an opportune time to discuss that
[0:50:02] Voice 3: or would you wait for trustee
[0:50:05] Voice 3: Peterson certainly
[0:50:06] Voice 3: at your discretion to
[0:50:08] Voice 3: simply break until noon
[0:50:11] Trustee Patrick (probable): yeah I'd rather hold because
[0:50:13] Trustee Patrick (probable): we advertise the
[0:50:14] Trustee Patrick (probable): applications beginning at noon so we do try
[0:50:17] Trustee Patrick (probable): to hold those off to begin at noon
[0:50:18] Trustee Patrick (probable): people want to listen in for those
[0:50:21] Trustee Patrick (probable): applications
[0:50:23] Trustee Patrick (probable): so trustee Harris would you like
[0:50:25] Trustee Patrick (probable): to proceed with the closed meeting then
[0:50:26] Trustee Patrick (probable): and the recess
[0:50:27] Trustee Patrick (probable): okay so we're going to go into closed meeting and then we'll reconvene again
[0:50:31] Trustee Patrick (probable): at noon publicly all right trust harry's going to make the motion that's item 18.1
[0:50:37] Trustee Patrick (probable): uh
[0:50:38] Voice 12: i moved with the ltc here it is
[0:50:40] Voice 12: i move
[0:50:46] Voice 15: that the meeting be close to the public and support
[0:50:52] Voice 15: that's 91 for the purpose of considering it's on of course
[0:50:59] Voice 15: terms council consider that just over here um i'll
[0:51:10] Trustee Patrick (probable): second any discussion i'll call and i think it's
[0:51:14] Trustee Patrick (probable): and staff be invited to stay um remain um but um yeah
[0:51:21] Voice 12: so
[0:51:23] Trustee Patrick (probable): let's uh all those in
[0:51:26] Trustee Patrick (probable): favor and that
[0:51:27] Trustee Patrick (probable): carries so we'll wait for our staff to secure thank
[0:51:30] Voice 6: you for coming and we'll see some of you
[0:51:32] Trustee Patrick (probable): you back at noon.
[2:01:55] Voice 5: Good
[2:01:55] Trustee Patrick (probable): afternoon. I just wanted to rise and report that we approved the minutes of the December 11th in-camera meeting in our meeting minutes in our in-camera.
[2:02:13] Trustee Patrick (probable): We are at item 14 of our agenda.
[2:02:20] Trustee Patrick (probable): Our chair, Jim Peterson, should be joining us momentarily.
[2:02:26] Trustee Patrick (probable): but we'll get started uh so the first item is 14.1 this is a rezoning application 2026
[2:02:35] Trustee Patrick (probable): 0013 on 116 jackson avenue it's on page 53 of the agenda package and i believe that will be planner
[2:02:48] Voice 15: so okay and also if i may um we need to address the motion that was proposed earlier this morning
[2:02:55] Voice 15: in regards to probably before we do the zoning he'll
[2:02:59] Trustee Patrick (probable): he'll cover that as report so thank
[2:03:01] Voice 15: you go
[2:03:02] Trustee Patrick (probable): ahead thank
[2:03:04] Voice 14: you mr chair and this preliminary report six direction are preparing a draft by
[2:03:10] Voice 14: law to amend land use by now number 355 the amendment which is almost bid zone property
[2:03:16] Voice 14: property, County Zone R6 and R6B, Variant B, Residential 6,
[2:03:22] Trustee Patrick (probable): to a
[2:03:27] Trustee Patrick (probable): commercial zone variant
[2:03:36] Voice 14: in order to permit the uses outside any staff report for a 0.08 hectare property located
[2:03:44] Voice 14: at 116 Jackson Avenue.
[2:03:47] Voice 14: If approved, the rezoning would also include
[2:03:50] Voice 14: amendment to siting regulation.
[2:03:54] Voice 14: Additionally, the applicant has requested the discharge
[2:03:56] Voice 14: of a restricted covenant registered on title
[2:03:59] Voice 14: originally required of you.
[2:04:02] Voice 14: Chair
[2:04:03] Voice 5: Patrick.
[2:04:15] Voice 13: Yes.
[2:04:17] Voice 13: The audio was lost for a moment there.
[2:04:22] Voice 13: Can
[2:04:23] Voice 14: you hear me well now?
[2:04:24] Voice 14: Yes,
[2:04:25] Voice 13: I can hear you now. Thank you. And I've got video back.
[2:04:28] Voice 14: Okay, carry on.
[2:04:31] Voice 14: The applicant has also requested the discharge of a restricted covenant registered on title originally as a condition of a subdivision.
[2:04:41] Voice 14: As part of that condition, the owner provided a security deposit for the construction of a sidewalk.
[2:04:48] Voice 14: Funds are currently held by the CRD and are intended to contribute toward future pass
[2:04:54] Voice 14: pay or sidewalk construction around Jacksonville.
[2:04:58] Voice 14: In accordance with Part 10 of the Covenant, the owner may request this short fund confirmation
[2:05:03] Voice 14: that the requirements have been met.
[2:05:06] Voice 14: Overall, the proposed proposal appears to be consistent with the policies of South Spring
[2:05:13] Voice 14: Island Official Committee Plan No. 434, as well as the Islands Trust Policy Statement.
[2:05:21] Voice 14: Accordingly, staff recommend that the Local Trust Committee direct staff to
[2:05:24] Voice 14: proceed with the application and prepare a draft by-law to amend land use by-law No. 355.
[2:05:32] Voice 14: Staff further recommend that the Committee direct staff to schedule the Community Information
[2:05:37] Voice 14: information meeting, and refer the application to the Advisory Planning Commission, First
[2:05:42] Voice 14: Nations, and relevant external agencies for input.
[2:05:47] Voice 14: Staff also recommend that the Committee support the discharge of restrictive covenant, Covenant
[2:05:52] Voice 14: No. CA-881-3681.
[2:05:57] Voice 14: Alternatively, the Committee may wish to request revision to the proposal, proceed without
[2:06:03] Voice 14: without holding public processes or denying the application
[2:06:07] Voice 14: and or the covenant discharge.
[2:06:10] Voice 14: Additionally, as approved in the correspondence section
[2:06:13] Voice 14: earlier today, we added the recommendation
[2:06:15] Voice 14: to waive the storm water management requirements
[2:06:18] Voice 14: pursuant to bylaw number 175
[2:06:21] Voice 14: for development approval information.
[2:06:24] Voice 14: Thank you, Justice.
[2:06:25] Voice 14: Thank you.
[2:06:25] Voice 14: Thank you.
[2:06:27] Trustee Patrick (probable): So any, I guess, sorry, invite the applicant
[2:06:32] Trustee Patrick (probable): to uh add some words okay um
[2:06:35] Voice 10: a few minor little comments okay nothing serious but i just want to
[2:06:40] Voice 10: make sure that there's no misunderstanding okay so e.1.4.10 um single small single story
[2:06:51] Voice 10: commercial buildings proposed to be built on the third tier um i never said a single story
[2:06:57] Voice 10: I said small in footprint and asked if you're going up a story, if it increased the lot coverage ratio, and I was told no.
[2:07:05] Voice 10: So I will probably be building two stories if I get a setback relaxation on the top tier.
[2:07:15] Voice 10: And then E.1.10.1, applicant has requested an increase in lot coverage from 33% to 66%.
[2:07:27] Voice 10: Okay. Upon, well, as good advice, I dropped this request, but I'm pretty sure that the 66% increase had a mitigating factor in them trying to get this groundwater study done and drainage system and everything, because potentially I was doubling the surface area or land ratio area there that could become impervious.
[2:07:55] Voice 10: So now I'm down to what it originally is zoned for right now, okay?
[2:08:01] Voice 10: And that's it.
[2:08:03] Voice 10: Everything else I agree with and what I've asked for.
[2:08:06] Voice 10: And thank you.
[2:08:08] Trustee Patrick (probable): Any questions of staff with those changes captured?
[2:08:11] Trustee Patrick (probable): Yeah,
[2:08:12] Voice 14: those changes are captured.
[2:08:13] Voice 14: The bond story is for the section that we are assessing the policies regarding the development period of bond, and we are assessing as built.
[2:08:23] Voice 14: But if they are proposed to make changes like to go for a two-story building, they would still need to apply for a development building.
[2:08:30] Voice 14: And this would be considered then. And other than that, yeah, that's all good.
[2:08:36] Voice 14: Does
[2:08:38] Trustee Patrick (probable): that make sense to you?
[2:08:43] Voice 10: I think so.
[2:08:45] Voice 10: In all honesty, this is still advanced. It's quite difficult to understand you sometimes.
[2:08:50] Voice 10: times, okay? Okay,
[2:08:51] Voice 14: may I? But
[2:08:53] Voice 10: the thing is that you and me have had meaningful dialogue over this
[2:08:57] Voice 10: and any concerns we have, and so, yeah.
[2:09:01] Voice 14: Yeah, so in the policy analysis document that you provided,
[2:09:07] Voice 14: we selected that section of the policy as supported, which means the policy supports
[2:09:12] Voice 14: the proposal, so it was not against the proposal. Any questions?
[2:09:19] Voice 15: Yes, do we need to
[2:09:20] Voice 15: um waive the um requirement for the stormwater thing before we do anything else i
[2:09:25] Voice 14: also sent it
[2:09:27] Voice 14: sent the uh motion to lisa because lisa can't read that section funds too but the other
[2:09:36] Voice 14: recommendations are right
[2:09:38] Trustee Patrick (probable): here alternatives deal with that one first then lisa oh that's on the
[2:09:44] Trustee Patrick (probable): screen thank you lisa i
[2:09:45] Voice 15: move that the salt ground and local trust committee waive the requirement
[2:09:48] Voice 15: for stormwater management report pursuant to bylaw number 175.
[2:09:54] Trustee Patrick (probable): right okay and i'll i'll second that
[2:09:58] Trustee Patrick (probable): is there any discussion not
[2:10:01] Voice 15: if as long as this covers it and then it's kind of special for me
[2:10:06] Trustee Patrick (probable): forwarded that motion so i mean i assume it's boarded right so i'll call the vote then all
[2:10:11] Trustee Patrick (probable): those in favor and that carries um exactly that doesn't change any of these other recommendations
[2:10:22] Trustee Patrick (probable): I
[2:10:22] Voice 15: would, you know, all this clearly is in order. And I honestly, I like one of the alternatives here that says to proceed without holding public processes, just to get this moving, because it's been a long time coming.
[2:10:38] Voice 15: And I'd be happy to read those motions if the chair would hear it.
[2:10:42] Trustee Patrick (probable): I'd like to understand, I think.
[2:10:51] Trustee Patrick (probable): can we proceed without public process on this one because
[2:10:55] Voice 14: we can't proceed without
[2:10:56] Voice 14: holding the public process because it's uh we're not making changes to the public to the
[2:11:02] Voice 14: offshore public processes so we can't proceed without holding public processes but it's the
[2:11:08] Voice 14: local trust committee who can decide on we are proceeding without holding the public processes
[2:11:14] Voice 14: My
[2:11:15] Voice 15: reasoning for that is that the local trust committee is for this.
[2:11:21] Voice 15: This is a good thing that's happening for the community.
[2:11:24] Voice 15: The people that are involved there are for this.
[2:11:26] Voice 15: I haven't heard anybody complain and Mr. Ogilvie clearly has set a great example with other
[2:11:34] Voice 15: developments he's done in the Ganges core and I feel 100% comfortable and prepared to
[2:11:41] Voice 15: move ahead with this now.
[2:11:44] Voice 15: i
[2:11:47] Trustee Patrick (probable): mean i i generally agree but i also cognizant of um being consistent with first nations referrals
[2:11:57] Trustee Patrick (probable): did we refer the primary use permit
[2:11:59] Voice 3: that doesn't affect that this in fact there is one
[2:12:04] Voice 3: gcp um analysis and checklist that actually keeps its requirement we need we need to refer to the
[2:12:11] Voice 3: crd in order to determine that the sewer capacity is sufficient of course um like it is but um but
[2:12:18] Voice 3: We are not in a position to make that statement.
[2:12:22] Voice 3: So we would still need to go through the referral process.
[2:12:26] Voice 3: The alternative proposed forgoes the hearing information
[2:12:30] as well as does it propose to waive the receipt
[2:12:35] without public hearing?
[2:12:37] Voice 14: Public hearing would be after the first,
[2:12:39] Voice 14: you know, the first reading.
[2:12:40] Voice 14: We will go with the motions for the public hearing
[2:12:43] Voice 14: in the first reading.
[2:12:44] Voice 14: But currently, we have recommendations
[2:12:45] Voice 14: recommendations for the community information.
[2:12:48] Voice 3: They would also need to, when they are asked us to prepare
[2:12:51] Voice 3: bylaws, they would also need to ask us if she knows of
[2:12:57] potential reason for respect.
[2:13:01] Voice 3: I would not recommend pursuing the alternative, which is why
[2:13:04] Voice 3: it's not recommended.
[2:13:06] Voice 3: Really more for the question of optics and
[2:13:09] Voice 3: if you trust if it's a, and I do want to, if I could note
[2:13:15] Voice 3: here we've noted that in the last couple public hearings the practice of holding a community
[2:13:19] Voice 3: information meeting too late before the public hearing is not working and you'll see that in
[2:13:23] Voice 3: rickson is going forward we're asking you to with the intent of preparing those files referring them
[2:13:28] Voice 3: we have a referral period and then about two weeks before we come back with the bylaws
[2:13:33] Voice 3: we would hold that cim so you're not blindsided later on down the road is that possible
[2:13:38] Trustee Patrick (probable): thank you
[2:13:39] Trustee Patrick (probable): yes i i'm a great proponent of having space between those because um that does help um
[2:13:46] Trustee Patrick (probable): nobody pays attention to the end so if you don't wake them up then then we get surprises so
[2:13:54] Trustee Patrick (probable): um yeah i i support following process i think that's the best best way to go so we should see
[2:14:00] Trustee Patrick (probable): i don't
[2:14:02] Voice 15: see how we can't still follow the process but just weigh the requirement to hold the
[2:14:06] Voice 15: community information because there's still the referrals and all the rest of it that goes on
[2:14:11] Voice 15: and uh it's all in the up and up like there's no surprises it's not like something's gonna again
[2:14:17] Voice 15: mr obby has a a stellar history uh with development against his core i
[2:14:23] Trustee Patrick (probable): i yeah i don't
[2:14:25] Trustee Patrick (probable): disagree but i think it's just allowing the community to keep on board and follow the process
[2:14:28] Trustee Patrick (probable): it just um
[2:14:30] Voice 15: i've said my piece um
[2:14:34] Trustee Patrick (probable): so do you want to start making those motions i'll let you make
[2:14:40] Trustee Patrick (probable): the motions okay i move that salt spring island local trust video request staff proceed with the
[2:14:46] Trustee Patrick (probable): application klr z20260013 seconded by trustee harris any discussion i'll call the vote all
[2:14:57] Trustee Patrick (probable): All those in favor?
[2:14:58] Trustee Patrick (probable): That carries.
[2:15:00] Trustee Patrick (probable): I move that the Salt Spring Island Local Trust Committee
[2:15:03] Trustee Patrick (probable): request staff to schedule a community information meeting
[2:15:05] Trustee Patrick (probable): for the commercial rezoning proposal.
[2:15:09] Trustee Patrick (probable): Seconded by Trustee Harris.
[2:15:10] Trustee Patrick (probable): Discussion?
[2:15:11] Trustee Patrick (probable): All those in favor?
[2:15:13] Trustee Patrick (probable): That too carries.
[2:15:16] Trustee Patrick (probable): Oh, did
[2:15:17] Voice 6: we have the motion for waiving?
[2:15:22] Voice 5: We did that.
[2:15:23] Voice 6: Oh, we did that.
[2:15:23] Voice 5: Thank you.
[2:15:25] Trustee Patrick (probable): I'm not awake.
[2:15:27] Trustee Patrick (probable): I move that the Salt Spring Island local trust committee request staff prepare a draft bylaw to amend Salt Spring Island land use bylaw number 355-1999 to rezone lot 2, section 1, range 3 east, North Salt Spring Island, Cowichan District, plan EPP 99513 from residential 6 and residential 6B to a commercial zone variant to allow the land use bylaw to be amended.
[2:15:58] Trustee Patrick (probable): uses specified in staff report dated march 19 2026. oops seconded by trustee harris i think
[2:16:10] Trustee Patrick (probable): our chair has arrived any discussion call the vote all those in favor that carries oh our chair is
[2:16:19] Trustee Patrick (probable): here
[2:16:19] Voice 8: should
[2:16:25] Voice 15: we just finish this um application sure
[2:16:29] Trustee Patrick (probable): i'll finish this one and then we've got
[2:16:32] Trustee Patrick (probable): the chair uh peterson in a moment so uh we're on our first uh rezoning application 14.1 so i
[2:16:39] Trustee Patrick (probable): moved the salt spring island local trust committee request staff to refer and seek input from the
[2:16:44] Trustee Patrick (probable): advisory planning commission first nations and other uh applicable agencies that an application
[2:16:50] Trustee Patrick (probable): has been received to amend salt spring island land use file number 355 1999. second by trustee harris
[2:16:57] Trustee Patrick (probable): any discussion go ahead um
[2:17:00] Voice 15: yeah i'd just like to add i don't find that um the treasury planning
[2:17:04] Voice 15: commission or the referrals um to first nations uh in any way um advantageous and i think that it's
[2:17:13] Voice 15: It's starting to get out of control, and I hope that it reverses sometime soon.
[2:17:22] Voice 15: But with that, I'm prepared to go in favor of the behavior.
[2:17:28] Trustee Patrick (probable): All right.
[2:17:29] Trustee Patrick (probable): I'm going to call the vote then.
[2:17:30] Trustee Patrick (probable): All those in favor?
[2:17:32] Trustee Patrick (probable): That carries.
[2:17:33] Trustee Patrick (probable): And I move that Salt Spring Island Local Trust Committee support the release of restrictive
[2:17:38] Trustee Patrick (probable): of covenant ca 8813681 from lot 2 section 1 range 3 east north salt spring island cowichan district
[2:17:48] Trustee Patrick (probable): plan epp 99513 seconded by trustee harris discussion call the vote all those in favor
[2:17:58] Trustee Patrick (probable): that carries and i am happy to turn the chair roll over to uh trustee peterson when you're
[2:18:03] Trustee Patrick (probable): prepared to move forward all
[2:18:04] Voice 4: right and we are 14-2 14-2 my apologies thank
[2:18:11] Voice 6: you my
[2:18:13] Voice 4: apologies
[2:18:14] Voice 4: for my tardiness i complete and of course i realized on my way here that uh marilyn
[2:18:23] Voice 4: canceled on what they saw mr bond here so that is so 14.2 uh we have a staff report
[2:18:34] Voice 4: uh beginning on page 130 and i'll pass it over to honor product here
[2:18:40] Voice 4: thank
[2:18:41] Voice 14: you mr chair the purpose of this report is to present a draft section 219 covenant personal
[2:18:48] Voice 14: to section 514 of the local government act for consideration by the contrast committee
[2:18:54] Voice 14: And to request that the chair be designated to sign the colonnade, this would facilitate a two-dot subdivision to allow for a relative's residence in accordance with the applicable requirements.
[2:19:08] Voice 14: The property is zoned Rural Plan 1, Variant C, which permits a maximum density of one single-family dwelling per lot.
[2:19:17] Voice 14: A seasonal cottage is also permitted, subject to compliance with section 3.14 of the Land Use By-law.
[2:19:26] Voice 14: The property is located within the riparian development permit area and the applicant has obtained a unified development permit.
[2:19:35] Voice 14: Staff supports the computation as the rationale for the request is reasonable and the draft code meets the island's trust requirements for the subdivision application.
[2:19:44] Voice 14: Commission. Accordingly, a staff recommend that the local trust committee authorize the chair for
[2:19:50] Voice 14: signing the covenant. Alternatively, the committee may request additional information or deny the
[2:19:56] Voice 14: request. Thank you, Texas.
[2:19:59] Voice 4: Any questions for the planner? I
[2:20:02] Trustee Patrick (probable): just have one, just trying to
[2:20:04] Trustee Patrick (probable): understand the referral response on page 144 and 145. We have one section that says prior to
[2:20:16] Trustee Patrick (probable): subdivision approval which is three and four and then there's one section says prior to construction
[2:20:21] Trustee Patrick (probable): five six seven eighty nine but then at the bottom it says prior to final approval you must achieve
[2:20:30] Trustee Patrick (probable): everything above so all of those items have to be undertaken before subdivision for the subdivision
[2:20:36] Voice 14: yeah those are the uh conditions for the subdivision uh i must trust uh which are
[2:20:41] Voice 14: the subdivisions i just
[2:20:44] Trustee Patrick (probable): didn't understand the prior description reference
[2:20:48] Voice 3: oh the product construction is it's construction for both primary installation of like a septic
[2:20:55] Voice 3: system or if it works associated so trustee
[2:21:04] Voice 15: Harris could you please explain the template
[2:21:09] Voice 15: covenant to me in greater detail
[2:21:11] Voice 14: so as part of the local government act section 514 applicants
[2:21:19] Voice 14: are allowed to subdivide property for relatives if they have already lived there for five
[2:21:27] Voice 14: years and if the minimum size requirement is not met, the Island Trust Land Use By-law
[2:21:33] Voice 14: puts the minimum size for that as eight hectares. So for the covenant conditions, we have the
[2:21:45] Voice 14: the ownership requirement to be like the five years prior to applying for the subdivision
[2:21:56] Voice 14: and that the use remained the same for two years, I guess, the use remained the same
[2:22:05] Voice 14: for five years. So the use of the land should not be changed for five years after the covenant
[2:22:14] Voice 14: being registered on title okay
[2:22:16] Voice 12: uh
[2:22:19] Voice 5: anything further entertain the motion i
[2:22:29] Trustee Patrick (probable): moved that
[2:22:30] Trustee Patrick (probable): salt spring island local trust committee accept the section 219 draft covenant pursuant to section
[2:22:35] Trustee Patrick (probable): 514 of the local government act provided as attachment to the march 9 2026 report
[2:22:43] Trustee Patrick (probable): for minor counterpart for SS subdivision 2022.4.
[2:22:51] Voice 4: Seconded by Trustee Harris, any discussion?
[2:22:55] Voice 15: Yes, Trustee Harris.
[2:22:57] Voice 15: So the draft covenant isn't a restrictive covenant
[2:23:04] Voice 15: that's put on into perpetuity.
[2:23:06] Voice 14: It's somehow restricted, but like after five years
[2:23:09] Voice 14: they can apply to release the governor from the title okay they're not allowed to apply for a
[2:23:16] Voice 14: rezoning for instance for like make it commercial okay to remain residential so
[2:23:24] Voice 15: is that that's
[2:23:25] Voice 15: needed that
[2:23:28] Voice 14: is needed as a condition for the subdivision and
[2:23:32] Voice 15: that's from not from the analyst
[2:23:36] Voice 14: That's INAX's trust requirement. We have that in our land refiner.
[2:23:41] Voice 14: It's a local government act.
[2:23:42] Voice 14: Right.
[2:23:44] Voice 15: I'm highly opposed to covenants, just to be clear. This, at least, is not a length, you know, a forever type of covenant.
[2:23:58] Voice 15: so but at the same time um you know it's a to me it's a bad word uh i won't get into all the
[2:24:08] Voice 15: details about um how companies are harmful to the community but um anyways thank you for answering
[2:24:14] Voice 15: that okay
[2:24:17] Voice 4: anything else well i'll call the question then all those in favor and then that
[2:24:24] Voice 4: carries i
[2:24:26] Trustee Patrick (probable): move the south spain island local trust committee designated member of the local trust
[2:24:29] Trustee Patrick (probable): committee or designate that can we just say any member or do we have to put the name
[2:24:37] Voice 12: okay
[2:24:37] Trustee Patrick (probable): so we so designate any member of the local cross committee to sign a covenant pursuant
[2:24:43] Trustee Patrick (probable): to section 514 of the local government act similar to attachment one in the march 9 2026
[2:24:50] Trustee Patrick (probable): sixth report of plan panafar for subdivision 2022.4 moved
[2:24:56] Voice 4: seconded and any discussion
[2:25:02] Voice 4: not seeing any i'll call the question all those in favor and carrots okay next we have some bylaw
[2:25:11] Voice 4: referrals from adjacent local trust committees starting on page 153 we have the north pender
[2:25:18] Voice 4: draft bylaw 242 for referral it's laid out there for us i just wanted to mention i know that we had
[2:25:32] Voice 4: director planning had agreed to set up recommended recommended motions for these
[2:25:47] Voice 4: type of referrals um just in just in the uh in the interest of expediency um so that ltcs are
[2:25:57] Voice 4: forming formulating these motions on the fly i don't see the needs but uh maybe you could make
[2:26:02] Voice 4: a note to check in and see where that sits trust in paris can we
[2:26:08] Voice 15: not just use the um response form
[2:26:10] Voice 15: type of deals let's see yeah
[2:26:12] Voice 4: what do you see is interest aren't affected by the bylaw we totally
[2:26:15] Voice 4: totally can and it's the the the uh request of the director of planning is just to have it written
[2:26:21] Voice 4: out as a motion for us in advance so that you um so that it's just that moment moment or time simpler
[2:26:29] Trustee Patrick (probable): i'll just go ahead and wing it then i move that salt spring island local trust committee's
[2:26:33] Trustee Patrick (probable): interests are unaffected for north pender um island local trust committee's bylaw 242
[2:26:43] Trustee Patrick (probable): moved
[2:26:44] Voice 4: seconded by trustee harris any discussion i'm singing i will call the question all those
[2:26:50] Voice 4: in favor that carries and next we have a galliano island
[2:26:55] Voice 4: local trust uh bylaw 300 for referral
[2:27:01] Voice 4: starting on page 159 trustee patrick my
[2:27:07] Trustee Patrick (probable): only comment here is especially with the associated
[2:27:10] Trustee Patrick (probable): Islands. I feel they are, they
[2:27:19] Voice 6: receive little attention. I was trying to find a good word
[2:27:21] Voice 6: across the
[2:27:23] Trustee Patrick (probable): Islands Trust that we have hundreds of associated islands. And when one local
[2:27:33] Trustee Patrick (probable): trust area advances some work in the associated islands, I think that work is pertinent to
[2:27:39] Trustee Patrick (probable): the other associated islands that are that are out there. So that's my only comment that I'd
[2:27:47] Trustee Patrick (probable): like just to make sure that you know we have the same concerns and issues with the associated
[2:27:56] Trustee Patrick (probable): islands throughout the area. You can see it and the pressure I think is getting greater.
[2:28:02] Trustee Patrick (probable): You know there's one right
[2:28:03] Trustee Patrick (probable): now advertised for sale in the news all over for Ganges
[2:28:08] Trustee Patrick (probable): harbour so there's a lot of attention to little islands. And I think one of
[2:28:15] Voice 5: the islands still
[2:28:16] Voice 5: has the
[2:28:16] Trustee Patrick (probable): 1971 land use by-law is all that's in place on those islands and that to me is
[2:28:23] Trustee Patrick (probable): lucky then.
[2:28:24] Trustee Patrick (probable): Well it's actually they're not finding it lucky because it's very restrictive in many
[2:28:30] Trustee Patrick (probable): ways. So it's frustrating that we're not dealing with these little islands a bit more aggressively
[2:28:37] Trustee Patrick (probable): And when this happened, I think we're losing opportunities to clean up
[2:28:42] Trustee Patrick (probable): some of these old
[2:28:43] Trustee Patrick (probable): regulations.
[2:28:43] Trustee Patrick (probable): So that's my answer.
[2:28:45] Trustee Patrick (probable): It's good for Galliano that they're moving forward, but it's frustrating that Salisbury's
[2:28:49] Trustee Patrick (probable): group of islands and North Bender's group of islands, which I think North Bender has
[2:28:53] Trustee Patrick (probable): the most, are falling behind.
[2:28:59] Voice 4: Yeah, I'd just identify, as I said, the chair of the Galliano Local Trust Committee, Galliano
[2:29:07] Voice 4: has undertaken as a as a project to review um dissociated islands it didn't happen as quickly
[2:29:16] Voice 4: as many of those landowners would have liked uh it was essentially just started in september of
[2:29:23] Voice 4: this term we've been hearing about it at the term for sure but uh again it's uh it's an issue of
[2:29:30] Voice 4: ltc priority and the realities around our staff capacity no
[2:29:35] Trustee Patrick (probable): but i think this is an area that we
[2:29:36] Trustee Patrick (probable): really the federation should do more work here is what i'm saying yeah
[2:29:40] Voice 4: and i can see that there's um
[2:29:44] Voice 4: there's a certainly a good chance that there's some applicability that could be shared across
[2:29:51] Voice 4: the ltas and provide some efficiencies so no not meaning to say that but to actually get action on
[2:30:00] Voice 4: it was it was had to be identified in the project
[2:30:03] Trustee Patrick (probable): i understand that yes we're never going to touch
[2:30:07] Trustee Patrick (probable): ours all right i move that salt spring island local trust committee's interests are unaffected
[2:30:12] Trustee Patrick (probable): by galliano island trust area uh areas by law number 300.
[2:30:20] Voice 4: moved to second by trustee harris
[2:30:22] Voice 4: anything further not seeing any i'll call the question all those in favor curious and then
[2:30:29] Voice 4: on to north pender island local trust committee bylaws uh 236 and 237 starting on page 169.
[2:30:38] Voice 4: i
[2:30:42] Trustee Patrick (probable): think i know this property well this was all from the last term when i was chair
[2:30:45] Trustee Patrick (probable): um i moved that salt spring island local trust committee's interests are unaffected
[2:30:52] Trustee Patrick (probable): by north pender island local trust area bylaws bylaw numbers 236 and 237.
[2:31:00] Voice 4: moved second by trustee harris uh any further discussion
[2:31:05] Voice 4: not singing i would call the question all those in favor and that carries and that then brings us
[2:31:14] Voice 4: on to section 15. there is there is no report today uh so under section 16 we have salt spring
[2:31:25] Voice 4: Island compliance and enforcement policy starting on page 179 and I believe that will be manager
[2:31:34] Voice 4: Damon joining us there he is on screen over to you sir good
[2:31:39] Manager of Bylaw Compliance and Enforcement: afternoon chair and committee of
[2:31:46] Manager of Bylaw Compliance and Enforcement: presenting you with a report and a draft compliance and enforcement policy
[2:31:52] Manager of Bylaw Compliance and Enforcement: policy, one that is specific to Salspring. These policies have been adopted by, I believe,
[2:32:03] Manager of Bylaw Compliance and Enforcement: six other local trust committees. And the overall purpose is to incorporate all current
[2:32:11] Manager of Bylaw Compliance and Enforcement: standing resolutions for compliance enforcement into a single document instead of having the
[2:32:16] Manager of Bylaw Compliance and Enforcement: standalone resolutions. We have just gone through at Trust Council a review and approval
[2:32:26] Manager of Bylaw Compliance and Enforcement: of trust council policies and as next start next step in the process for salt spring would be for
[2:32:35] Manager of Bylaw Compliance and Enforcement: the salt spring local trust committee to consider uh the the attached draft policy to address
[2:32:42] Manager of Bylaw Compliance and Enforcement: specific salt spring issues there are several reasons to have a local trust committee policy
[2:32:52] Manager of Bylaw Compliance and Enforcement: uh to deal with such issues well one you have uh you are the enforcement authority for the land
[2:32:59] Manager of Bylaw Compliance and Enforcement: use bylaw, and you have a BEN bylaw, and part of the policy, it has policies on how to use
[2:33:11] Manager of Bylaw Compliance and Enforcement: that BEN bylaw as far as time limits and giving periods of time to comply before any
[2:33:24] Manager of Bylaw Compliance and Enforcement: bylaw violation notice would be issued. Within the policy itself, it gives 90 days
[2:33:32] Manager of Bylaw Compliance and Enforcement: or time to comply, as an example, before any further enforcement action would take place.
[2:33:40] Manager of Bylaw Compliance and Enforcement: Within the document itself, Section 4 has a list of the priorities for the local trust committee,
[2:33:48] Manager of Bylaw Compliance and Enforcement: and the standing resolutions have been incorporated into the policy under the priorities.
[2:33:55] Manager of Bylaw Compliance and Enforcement: So, for example, this issue of portable sawmills,
[2:34:00] Manager of Bylaw Compliance and Enforcement: Mills enforcement would be deferred until the local trust committee has
[2:34:04] Manager of Bylaw Compliance and Enforcement: considered amendments to land use bylaw.
[2:34:06] Manager of Bylaw Compliance and Enforcement: That is one of the standing resolutions that are currently in place and that
[2:34:12] Manager of Bylaw Compliance and Enforcement: you would be asked to receive are being asked to rescind within 4.4.
[2:34:17] Manager of Bylaw Compliance and Enforcement: You have the deferment enforcement on non-compliant dwellings with the list of
[2:34:23] Manager of Bylaw Compliance and Enforcement: exceptions that are in place within the inspection section.
[2:34:30] Manager of Bylaw Compliance and Enforcement: Number five, you have things such as 5.3, where the officer will try and arrange a mutually agreeable time to arrange site inspection and provide one week's notice before attending the property.
[2:34:46] Manager of Bylaw Compliance and Enforcement: There are, of course, there will be exceptions to that for environmental issues or health and safety, you know, and also to provide some discretion and some flexibility for the bylaw officers.
[2:35:02] Manager of Bylaw Compliance and Enforcement: So if a respondent has indicated they'll work towards compliance, we can work on time to comply and there's no need for site inspections.
[2:35:11] Manager of Bylaw Compliance and Enforcement: Or, for example, if they want to provide evidence such as surveys, professional reports, site inspections are not required.
[2:35:18] Manager of Bylaw Compliance and Enforcement: required we have also added within these local trust committee policies expanded on
[2:35:25] Manager of Bylaw Compliance and Enforcement: frivolous repeated vexatious complaints in order to provide discretion to close files when we
[2:35:35] Manager of Bylaw Compliance and Enforcement: discover that the complaint may be vexatious and within the policy also have for the bend by law
[2:35:44] Manager of Bylaw Compliance and Enforcement: and part b you have the screening officers powers and duties policy identifies who can be screening
[2:35:51] Manager of Bylaw Compliance and Enforcement: officers and it also defines what role they can have within the screening officer process
[2:35:58] Manager of Bylaw Compliance and Enforcement: and you have a list of authorized reasons to cancel bylaw violation notices. So in the end
[2:36:08] Manager of Bylaw Compliance and Enforcement: the recommendation to adopt this policy is that you know local governments throughout British
[2:36:15] Manager of Bylaw Compliance and Enforcement: Columbia have policy documents to provide direction to staff on how bylaw compliance
[2:36:20] Manager of Bylaw Compliance and Enforcement: will be sought and how enforcement will be conducted and establishing the policies into
[2:36:25] Manager of Bylaw Compliance and Enforcement: one document that could be readily accessed by staff and the general public should ensure more
[2:36:30] Manager of Bylaw Compliance and Enforcement: efficient and open and transparent and more transparent access to information and policies
[2:36:36] Manager of Bylaw Compliance and Enforcement: and a better better understanding of how bylaw compliance and enforcement is conducted
[2:36:42] Manager of Bylaw Compliance and Enforcement: so the main recommendation that you do have is that you adopt the policy as drafted of course
[2:36:50] Manager of Bylaw Compliance and Enforcement: you can make amendments or the alternatives are you ask for more information before you implement
[2:36:55] Manager of Bylaw Compliance and Enforcement: such a policy or that you state that you wish to proceed no further i will note in the recommendation
[2:37:02] Manager of Bylaw Compliance and Enforcement: number two uh the one of the standing resolutions referenced is referenced as ss 2021-214 it should
[2:37:12] Manager of Bylaw Compliance and Enforcement: should be 213, 213 instead of 214.
[2:37:18] Manager of Bylaw Compliance and Enforcement: So, Chair, are there any questions?
[2:37:21] Voice 12: Any questions for the Medicare trustee factor?
[2:37:26] Trustee Patrick (probable): I have a few.
[2:37:28] Trustee Patrick (probable): Right in the purpose, it says reasonable and consistent
[2:37:31] Trustee Patrick (probable): with local community standards.
[2:37:36] Trustee Patrick (probable): What's a local community standard?
[2:37:41] Manager of Bylaw Compliance and Enforcement: So which section are you referencing?
[2:37:43] Trustee Patrick (probable): Purpose, right at the top.
[2:37:51] Manager of Bylaw Compliance and Enforcement: In the end, local community standards are going to be decided
[2:37:54] Manager of Bylaw Compliance and Enforcement: added by the local trust committee uh the purpose of this you have within it comes to deferred
[2:37:59] Manager of Bylaw Compliance and Enforcement: enforcement under your priorities um it's up to the local trust committee to determine whether
[2:38:05] Manager of Bylaw Compliance and Enforcement: or not they want to enforce certain sections of their bylaw so as the local trust committee has
[2:38:12] Manager of Bylaw Compliance and Enforcement: passed a resolution before say not to enforce on non-permitted dwellings that's what i would
[2:38:20] Manager of Bylaw Compliance and Enforcement: interpret as a local community standard as far as what policies you want to follow when proceeding
[2:38:29] Manager of Bylaw Compliance and Enforcement: with enforcement on any compliance and enforcement on any complaint that we've received and are
[2:38:34] Manager of Bylaw Compliance and Enforcement: investigating my
[2:38:42] Trustee Patrick (probable): it just seems like an undefined term community standards but under your definitions
[2:38:49] Trustee Patrick (probable): and abbreviations is there a reason why we don't reference is the land use bylaw intended to be
[2:38:57] Trustee Patrick (probable): sort of the definition bank or the the kind of the source of definitions because now we've
[2:39:07] Trustee Patrick (probable): introduced like minor structure where the land use bylaw has a definition of structure
[2:39:15] Trustee Patrick (probable): aren't they kind of they need to be sort of together somewhat when
[2:39:21] Manager of Bylaw Compliance and Enforcement: it comes to in in the
[2:39:23] Manager of Bylaw Compliance and Enforcement: end yes when bylaw officers are looking at the definitions the first definitions that they're
[2:39:27] Manager of Bylaw Compliance and Enforcement: They're going to look at those within the land use bylaw.
[2:39:30] Manager of Bylaw Compliance and Enforcement: And then within the policy document, the LTC can determine,
[2:39:36] Manager of Bylaw Compliance and Enforcement: you can leave that minor structure definition in,
[2:39:39] Manager of Bylaw Compliance and Enforcement: you can change it, or you can remove it.
[2:39:42] Manager of Bylaw Compliance and Enforcement: There are certain structures that are minor in nature
[2:39:48] Manager of Bylaw Compliance and Enforcement: and we probably shouldn't be enforcing against.
[2:39:51] Manager of Bylaw Compliance and Enforcement: That's a consensus of staff and the director of planning,
[2:39:56] Manager of Bylaw Compliance and Enforcement: say around things like farm stands.
[2:39:58] Manager of Bylaw Compliance and Enforcement: stands. A farm stand is generally a minor structure. Now, it may not be lawful under the
[2:40:05] Manager of Bylaw Compliance and Enforcement: land use bylaw, but under a policy, we can say, okay, we don't want to enforce on such a minor
[2:40:14] Manager of Bylaw Compliance and Enforcement: structure. You have limited time and resources for bylaw enforcement, and maybe that's something
[2:40:21] Manager of Bylaw Compliance and Enforcement: you shouldn't pursue. Within the trust council policies, the director of planning services and
[2:40:27] Manager of Bylaw Compliance and Enforcement: And the bylaw manager can concur and say, okay, this is a minor structure.
[2:40:32] Manager of Bylaw Compliance and Enforcement: This is a minor infraction or structure that we shouldn't enforce on.
[2:40:40] Manager of Bylaw Compliance and Enforcement: So that's within the trust council policies, the main policies,
[2:40:43] Manager of Bylaw Compliance and Enforcement: but we've also put it within these local trust committee policies just to give
[2:40:51] Manager of Bylaw Compliance and Enforcement: the local trust committee, you know,
[2:40:54] Manager of Bylaw Compliance and Enforcement: a way to have a say in what do you consider a minor structure?
[2:40:58] Manager of Bylaw Compliance and Enforcement: If you wish, you don't have to leave that in there.
[2:41:03] Trustee Patrick (probable): I just find that the connection with the land use bylaw, because even under references, we don't reference the land use bylaw.
[2:41:11] Trustee Patrick (probable): So shouldn't under references, we reference the land use bylaw?
[2:41:18] Trustee Patrick (probable): I'm just trying to make it practical for people to understand as well as trustees.
[2:41:25] Manager of Bylaw Compliance and Enforcement: Entirely at the discretion of the local trust committee.
[2:41:27] Manager of Bylaw Compliance and Enforcement: When we reviewed this before with the Director of Planning Services and our PMs, these are
[2:41:33] Manager of Bylaw Compliance and Enforcement: the basic references that we thought would be included.
[2:41:38] Manager of Bylaw Compliance and Enforcement: We didn't believe we needed a reference to the Land Use By-law, but you can certainly
[2:41:44] Manager of Bylaw Compliance and Enforcement: add it.
[2:41:45] Voice 3: Yeah.
[2:41:46] Voice 3: Mr. Chair, the Part A, Section 1 does say the application policy will apply to the Salisbury
[2:41:52] Voice 3: Island Local Trust area and the enforcement of all fiscal regulatory by-laws as a regulatory
[2:41:56] Voice 3: by-law.
[2:41:57] Voice 3: our land use follow-up would be covered under that so it's just it's under a big umbrella um
[2:42:04] Voice 3: and i it's i know in a previous sort of file enforcement scheme a little bit of necessity
[2:42:11] Voice 3: to get into what we need in terms of this this section of enforceability and all of that but
[2:42:18] Voice 3: this is that's the intent okay so um we have clarity within our structure of what is not
[2:42:30] Voice 3: I think I would say that I feel comfortable that this applies to the LEB.
[2:42:38] Trustee Patrick (probable): That's good. I just wanted to, I just felt it wasn't totally explicit. That's all right. It's there. And you're right. If it's a local trust area, then there are other land use bylaws that apply.
[2:42:48] Trustee Patrick (probable): Yes. Even though they're out of date.
[2:42:49] Trustee Patrick (probable): There's more than one.
[2:42:52] Trustee Patrick (probable): Okay.
[2:42:52] Trustee Patrick (probable): Okay. Again, for under the priorities, the vacation rental priority, again, we're saying
[2:43:02] Trustee Patrick (probable): just the resident owner operator. I think we need to make reference to the home-based
[2:43:11] Trustee Patrick (probable): business aspect of it too just to be stronger but um for that one for 4.4
[2:43:25] Trustee Patrick (probable): uh i think we have to update the wording because now we've defined approved septic system
[2:43:32] Trustee Patrick (probable): so i think that language now we've got approved septic or sewage disposal system
[2:43:36] Trustee Patrick (probable): the wording in that 4.4 section i think those should be updated just to say
[2:43:42] Trustee Patrick (probable): approved septic system instead of approved septic or sewage disposal system since we defined the
[2:43:48] Trustee Patrick (probable): term um there's one of our standing resolutions uh that's on page 194 of our current agenda package
[2:44:01] Trustee Patrick (probable): on housing and commercial housing um i can understand us updating that but it's not in
[2:44:08] Trustee Patrick (probable): here so is that something we need to revisit separate um i'm
[2:44:16] Voice 3: sorry i missed that it's on page
[2:44:17] Trustee Patrick (probable): 194 there's another standing resolution um sorry on oh sorry it's on page 195 uh the one at the
[2:44:40] Trustee Patrick (probable): top of the page residential use and commercial accommodations some of these are
[2:44:58] Trustee Patrick (probable): old and probably
[2:44:59] Trustee Patrick (probable): probably need to be thought about again, but it's just.
[2:45:09] Voice 3: If it's not already on the list, Mr.
[2:45:14] Voice 3: Damon is
[2:45:14] Voice 4: one that we ought to.
[2:45:16] Voice 4: I believe he's didn't, he just mentioned at the beginning that 213.
[2:45:20] Voice 4: It's misnumbered.
[2:45:22] Voice 4: It's misnumbered at the resolution. It should be 213,
[2:45:26] Voice 4: which is what you've identified rather than 214.
[2:45:29] Voice 4: Is that the one that's the one you're talking about, Mr.
[2:45:32] Voice 4: statement yeah yes
[2:45:35] Manager of Bylaw Compliance and Enforcement: this this is a different this reference resolution number i believe is wrong on
[2:45:40] Manager of Bylaw Compliance and Enforcement: your document here i don't believe it's 113. i believe this is the one that's 114. it's it's
[2:45:48] Voice 3: two four two
[2:45:48] Voice 4: two thirteen is the one that is in our standing resolution list that trustee patrick's
[2:45:54] Voice 4: mentioned we
[2:45:55] Voice 3: played this last week i know that um that was not on standing resolution in the way
[2:46:00] Voice 3: way, Mr. Dingman and Edward, this report, when we later checked. So the standing resolution
[2:46:06] Voice 3: report says 213. Our official resolution rule does identify this as 214. So you've essentially
[2:46:13] Voice 3: been looking at a misnumbered resolution since I've been here. I would say that Mr. Dingman's
[2:46:23] Voice 3: report is correct, that it's 214, that won't appear.
[2:46:26] Voice 4: So this is actually 214, even though
[2:46:29] Voice 4: it says 213 here yes okay so it has been captured in the resolution but
[2:46:35] Trustee Patrick (probable): okay so
[2:46:37] Manager of Bylaw Compliance and Enforcement: here's how i would
[2:46:38] Manager of Bylaw Compliance and Enforcement: define that as far as the enforcement policy goes i would think for me deferment on non-permitted
[2:46:49] Manager of Bylaw Compliance and Enforcement: dwellings is already captured i don't know that we need a specific reference to residential use
[2:46:56] Manager of Bylaw Compliance and Enforcement: and commercial accommodations, that would be a non-permitted dwelling
[2:47:01] Manager of Bylaw Compliance and Enforcement: and captured in the existing policy that was for 213.
[2:47:09] Manager of Bylaw Compliance and Enforcement: But it can be amended, and we can clarify that,
[2:47:13] Manager of Bylaw Compliance and Enforcement: but I would interpret that covered under the unlawful dwelling deferment.
[2:47:20] Trustee Patrick (probable): All right. I could see that. That's why I was questioning that.
[2:47:23] Trustee Patrick (probable): Then my final question is for, you know, we just passed the new policy last week at Trust Council.
[2:47:33] Trustee Patrick (probable): I did not go and read word for word, compare to compare.
[2:47:38] Trustee Patrick (probable): But for providing notice and all of that, it doesn't appear that it's the same wording?
[2:47:48] Manager of Bylaw Compliance and Enforcement: No, it would not be.
[2:47:49] Manager of Bylaw Compliance and Enforcement: So the question that was raised to Trust Council is what is LTC's, their policies, how do they coexist with Trust Council policies, the overall policy of 551?
[2:48:05] Manager of Bylaw Compliance and Enforcement: It is local trust committees who can set how much notice you want to give to a property owner before there is a site inspection without consent.
[2:48:16] Manager of Bylaw Compliance and Enforcement: So you have the overall policy on here's what will happen, you know, entry with notice, entry without notice, or entry with notice.
[2:48:26] Manager of Bylaw Compliance and Enforcement: And then the local trust committee here, I've suggested that you set it at one week's notice.
[2:48:33] Manager of Bylaw Compliance and Enforcement: Saturna, for example, has adopted a 30-day notice policy.
[2:48:37] Manager of Bylaw Compliance and Enforcement: Gabriola has a 90-day notice policy.
[2:48:41] Manager of Bylaw Compliance and Enforcement: So, it's at the discretion of the local trust committee at how much notice you wish to give, or if you wish to just leave it with what, you know, you could remove this section, and then we would just follow trust council policy.
[2:49:04] Voice 12: I like a
[2:49:06] Voice 15: lot of this. Most of it. I'm not prepared to be in favor of it at this point,
[2:49:20] Voice 15: mostly because of 4.4. While I like the enforcement or non-compliant bill to be deferred until
[2:49:29] Voice 15: until there are safe, secure, and affordable
[2:49:32] Voice 15: rural demographics and household types
[2:49:34] Voice 15: and opportunity, except in the following circumstances.
[2:49:37] Voice 15: It's this except in the following circumstances
[2:49:41] Voice 15: that concerns me because it's pretty,
[2:49:47] Voice 15: those, all those points, A through G,
[2:49:54] Voice 15: can be interpreted in different ways, possibly.
[2:49:59] Voice 15: And I think that I can't be for this because of this section, 4.4, and the except in the
[2:50:15] Voice 15: following circumstances.
[2:50:17] Voice 15: If this were to say something along the lines of just take the except in the following circumstances
[2:50:28] Voice 15: stances. And then, you know, the LTC should be, in my view, you know, notified before there's
[2:50:39] Voice 15: an enforcement action and to decide on that. But honestly, I like a lot of this stuff. This is
[2:50:51] Voice 15: great. The sawmills, that's good news. So basically, that's where I'm at, at this point.
[2:51:10] Voice 6: I
[2:51:11] Trustee Patrick (probable): mean, I think you have to give some guidance, and this has been our standing resolution for some time to staff.
[2:51:20] Trustee Patrick (probable): My only concern is as we move forward, we still have that unadvanced from the follow-up action list regarding working with other jurisdictions
[2:51:29] Trustee Patrick (probable): jurisdictions about a a more compassionate approach to uh complaints on illegal housing
[2:51:38] Trustee Patrick (probable): understanding that you know there are people living in those units that may need help um
[2:51:46] Trustee Patrick (probable): and uh and that you know our our approach is is not necessarily you know it's it can put a
[2:51:55] Trustee Patrick (probable): vulnerable person into a more vulnerable situation and that's just my concern here on salt spring is
[2:52:01] Trustee Patrick (probable): um you know there are all kinds of landlords um and you know you suddenly give notice to somebody
[2:52:11] Trustee Patrick (probable): that some landlords will say okay i'll shut it down i'll shut it down tomorrow just by getting
[2:52:15] Trustee Patrick (probable): the letter playing and you've got a person that's in a bad situation so trying to come up with a
[2:52:23] Trustee Patrick (probable): more compassionate approach is what i was a team approach to these complaints on some of these
[2:52:28] Trustee Patrick (probable): situations.
[2:52:32] Voice 15: For some reason, I remember
[2:52:35] Voice 15: that we have a standing resolution
[2:52:37] Voice 15: that said we won't enforce
[2:52:39] Voice 15: unless there's an open sewage
[2:52:41] Voice 15: or a pipe dumping
[2:52:43] Voice 15: out onto the ground or an open pit,
[2:52:45] Voice 15: something along those lines. Is that
[2:52:47] Voice 15: correct, Mr. Dingman?
[2:52:52] Manager of Bylaw Compliance and Enforcement: Yes, it is. That's
[2:52:53] Manager of Bylaw Compliance and Enforcement: really the policy, the
[2:52:55] Manager of Bylaw Compliance and Enforcement: standing resolution that exists and what's
[2:52:57] Manager of Bylaw Compliance and Enforcement: been incorporated into this policy
[2:52:59] Manager of Bylaw Compliance and Enforcement: document.
[2:53:02] Manager of Bylaw Compliance and Enforcement: unless there's some obvious dumping of sewage we're not going to be enforcing against the
[2:53:10] Manager of Bylaw Compliance and Enforcement: non-compliant dwelling if there's no health and safety issue or risk then we're not enforcing
[2:53:17] Manager of Bylaw Compliance and Enforcement: against it and that i believe that's what's captured in the policy well
[2:53:20] Voice 15: that's where i i
[2:53:22] Voice 15: get confused because in b it says there are concerns that sewage is not being disposed of
[2:53:31] Voice 15: than just an open pit or just out onto the ground.
[2:53:37] Voice 15: You know, it seems to encompass more
[2:53:39] Voice 15: than what the standing resolution encompasses.
[2:53:43] Voice 15: That's my big concern there.
[2:53:46] Voice 15: And then A, again, can be quite broad, broadly interpreted.
[2:53:54] Voice 15: That's why I have this, you know, this exception.
[2:53:57] Manager of Bylaw Compliance and Enforcement: Through the chair, we could amend the policy.
[2:54:00] Manager of Bylaw Compliance and Enforcement: I can take all of the questions and recommendations here
[2:54:03] Manager of Bylaw Compliance and Enforcement: and revise the policy and refine the language to address these issues
[2:54:07] Manager of Bylaw Compliance and Enforcement: and to make the language more specific about,
[2:54:11] Manager of Bylaw Compliance and Enforcement: as they did at Trust Council, we're not proceeding, of course,
[2:54:15] Manager of Bylaw Compliance and Enforcement: there is the Trust Council policy that has been revised to state
[2:54:18] Manager of Bylaw Compliance and Enforcement: there needs to be a significant risk to health and safety.
[2:54:25] Manager of Bylaw Compliance and Enforcement: So we can revise the language, we can review the Trust Council policies again
[2:54:31] Manager of Bylaw Compliance and Enforcement: gain and ensure that they reflect are reflected in this document uh to address those concerns
[2:54:37] Manager of Bylaw Compliance and Enforcement: and we can even add a sec a section regarding specifically here's the approach that we will
[2:54:43] Manager of Bylaw Compliance and Enforcement: take to non-compliant dwellings as then here's the alternative approach as opposed to a traditional
[2:54:50] Manager of Bylaw Compliance and Enforcement: bylaw enforcement approach to non-permitted dwellings that can be added to the policy
[2:54:57] Manager of Bylaw Compliance and Enforcement: document for review by the local trust committee at a future meeting if you
[2:55:03] Manager of Bylaw Compliance and Enforcement: decide to proceed with considering the policy document
[2:55:06] Voice 4: thank you for that I was
[2:55:10] Voice 4: the word significant that added was added into sections of the trust council
[2:55:15] Voice 4: policy it was the question I was going to raise go ahead Mr.
[2:55:18] Voice 3: Chair I would suggest that we
[2:55:19] Voice 3: we amend this wording but I would suggest that you you focus the wording
[2:55:24] Voice 3: on not taking on the responsibility of determining what is and is not safe.
[2:55:29] Voice 3: It is not the goal of LTC to determine whether a septic system
[2:55:35] Voice 3: can be properly installed and rely on registered professionals
[2:55:39] and health authorities to do that work.
[2:55:41] And this amendment, I would suggest,
[2:55:44] it would say that the
[2:55:44] Voice 3: wastewater coming off-site,
[2:55:46] Voice 3: which includes sewage and septic systems or sewerage systems.
[2:55:51] Voice 3: In the case of the sewer system on Salt Spring Island, that's overseen by that authority.
[2:55:59] Voice 3: In the case of septic systems, we have registered customers that install them under the guidance
[2:56:04] Voice 3: of the Island Health Agency, so I would suggest that you rely on those partners that you have
[2:56:11] Voice 3: in the community and not caution against any forays in to adjudicate severity of what can
[2:56:20] Voice 3: be a serious public health risk right
[2:56:22] Voice 15: by the ltc understood uh trustee that's a really good point
[2:56:26] Voice 15: um that's that was just brought up and um you know when i first think about that i wonder
[2:56:36] Voice 15: why are we enforcing on that at all it's not really our uh our wheelhouse and uh you know
[2:56:48] Voice 15: what about that why are why are we even delving into it at all why are we looking at septic as a
[2:56:57] Voice 15: as a deal as far as providing
[2:57:00] Voice 3: housing mr chair i think it's it's incumbent on us to ensure that
[2:57:04] Voice 3: that we're approving uh water in this case not uh disapproving of uh housing that's you know
[2:57:13] Voice 15: than to say
[2:57:14] Voice 15: um but we can't determine
[2:57:16] Voice 15: it like you just said we shouldn't be determining which
[2:57:19] Voice 15: is and which isn't so it kind of contradicts what you just we we rely on we rely on out of health
[2:57:24] Voice 15: for our for the ROVP or for the CRE um as the owners
[2:57:30] Voice 3: of that risk uh to
[2:57:32] Voice 15: provide us that assurance
[2:57:34] Voice 15: so so what I'm picking up is that we ought not be really trying to determine what is and what
[2:57:40] Voice 15: isn't but if we see something like we have is it our standing resolution if we see a pipe that's
[2:57:45] Voice 15: spewing sewage or an open pit sewage is going into well yeah then but otherwise we shouldn't
[2:57:51] Voice 15: even be looking at that and not enforcing against something trying to say well hey your subject is
[2:57:55] Voice 15: can't be right here if
[2:57:57] Voice 3: the septic system is not registered like and they have been registered
[2:58:02] for a long time um so if they haven't been registered then we really don't know
[2:58:07] Voice 3: and if that's not done, it's not our business.
[2:58:10] Voice 3: We would ideally, and that's again our business system
[2:58:14] Voice 3: of working collaboratively with other governments.
[2:58:18] Voice 3: We rely on them and they rely on us
[2:58:20] Voice 3: and we respect each other's regulations.
[2:58:23] Voice 3: I don't think that it's necessarily our role to enforce,
[2:58:26] Voice 3: but it's certainly not our role
[2:58:27] Voice 3: to turn a blind eye to any potential issues.
[2:58:30] Voice 3: We do have land use by-law provisions
[2:58:31] Voice 3: that work within the structures of Island Health
[2:58:34] Voice 3: the CRD and the CIGARDA and so it's whether we're foregoing enforcement of that I would say is that
[2:58:41] Voice 3: it's sort of a binary determination
[2:58:43] Voice 15: that inflects violence. So I'm kind of getting mixed messages so
[2:58:47] Voice 15: you know it's what it's what I'm sort of picking up but which is fine but I'm all for what
[2:58:56] Voice 15: Enforcement Officer Dingman has mentioned about coming back with a more specific explanation
[2:59:02] Voice 15: Explanation or whatever you want to call it, description or definition for low-quite-four and the exceptions that are in it.
[2:59:12] Voice 4: I see Manager Jamin, I see you're having an ad raise. Go ahead, sir.
[2:59:17] Manager of Bylaw Compliance and Enforcement: So, Chair, if someone is on a property, they have a dwelling, and if their waste, any waste is not going, especially the sewage, is not going into an approved septic system, that is a contravention of the Salt Spring Island Land Use By-law.
[2:59:34] Manager of Bylaw Compliance and Enforcement: they are unlawfully disposing of waste on land so yes we can't uh certify what's a lawful system
[2:59:43] Manager of Bylaw Compliance and Enforcement: that is viha's job but if it if they're just dumping raw sewage on the land that
[2:59:50] Manager of Bylaw Compliance and Enforcement: contravenes your land use bylaw and really even if they have do not have an approved
[2:59:56] Manager of Bylaw Compliance and Enforcement: system filed with viha that can also be considered
[2:59:59] Manager of Bylaw Compliance and Enforcement: And so.
[3:00:00] Manager of Bylaw Compliance and Enforcement: an offense but really what we're looking at should be looking at are the significant
[3:00:06] Manager of Bylaw Compliance and Enforcement: uh systems or incidents where there's just raw sewage being dumped on the land
[3:00:10] Manager of Bylaw Compliance and Enforcement: and yes the policy can be amended to introduce sure the same language that's in trust council
[3:00:16] Manager of Bylaw Compliance and Enforcement: is there that it's a significant risk and we can provide additional language such as they
[3:00:22] Manager of Bylaw Compliance and Enforcement: are disposing of waste on the land unlawfully so
[3:00:27] Voice 15: yeah i i really understand that last
[3:00:29] Voice 15: sentence i really understand that last couple sentences the last couple sentences but um i
[3:00:38] Voice 15: i'm leery about the viha deal also mostly because of what um staff has mentioned as far as uh
[3:00:48] Voice 15: something being registered and an old property and there's you know something can be very old
[3:00:54] Voice 15: somebody's you know a house that's been there for god knows 80 years or something and um they
[3:00:59] Voice 15: don't have a they don't have a registered septic system and then we're going to go and you know
[3:01:04] Voice 15: somehow say well maybe this isn't safe and we're going to force against them i i don't i disagree
[3:01:10] Voice 15: with this approved septic or sewage disposal system sentence in b of 4.4 but if it was to
[3:01:18] Voice 15: reflect what you mr tingman have just uh vocalized in the last couple sentences sentences of your
[3:01:26] Voice 15: last statement then I can live with that.
[3:01:36] Voice 4: I had a question around 4.4 about concerns
[3:01:43] Voice 4: of possible contamination of wells or other drinking water sources
[3:01:50] Voice 4: and I guess again it's a little bit it's I'm just not sure how like how would those
[3:02:01] Voice 4: How would those concerns be identified other than, you know, for obvious, as we were just talking about, septic being, you know, discharged on the ground?
[3:02:12] Voice 4: So I just wonder if you could expand on that a little bit.
[3:02:17] Manager of Bylaw Compliance and Enforcement: So, Chair, what some property owners will do is they will test their wells and they'll present us with the evidence that it's contaminated.
[3:02:24] Manager of Bylaw Compliance and Enforcement: contaminated so that's the easiest way to verify that you know the well's been compromised by
[3:02:31] Manager of Bylaw Compliance and Enforcement: usually the dumping of sewage too close to the well i mean some of it will be i would think
[3:02:38] Manager of Bylaw Compliance and Enforcement: obvious if there's sewage dumping within x number of meters of a well but what property owners when
[3:02:45] Manager of Bylaw Compliance and Enforcement: they run into problems they will get the well tested and then they'll show us the report that
[3:02:49] Manager of Bylaw Compliance and Enforcement: there is contamination in their well and that would be the evidence to state that okay
[3:02:55] Manager of Bylaw Compliance and Enforcement: okay, here's the proof of it, and we need to ask for compliance
[3:03:04] Manager of Bylaw Compliance and Enforcement: when it comes to the disposal of waste.
[3:03:06] Voice 4: Yeah, so again, I guess it's just a matter of the wording
[3:03:11] Voice 4: because I think concerns can be interpreted as much more broad than evidence,
[3:03:19] Voice 4: which is the word you just used.
[3:03:21] Voice 4: So I just wanted to just explore that a little bit
[3:03:24] Voice 4: because um again we want we want we want to be doing the right thing certainly protecting um
[3:03:32] Voice 4: against contamination of wealth or or you know not permitting uses with what that happens
[3:03:38] Voice 4: but it's just that again that word concerns seems like it could be interpreted fairly broadly um
[3:03:45] Voice 4: i would concur then whereas evidence i would have i think that would be very clear
[3:04:03] Voice 4: I
[3:04:04] Manager of Bylaw Compliance and Enforcement: agree chair we can that can be uh edited provide more clarification great
[3:04:10] Voice 4: thank you uh
[3:04:11] Voice 4: trustee Patrick yeah
[3:04:12] Trustee Patrick (probable): I'm just wondering I mean our this this enforcement resolution I know we
[3:04:20] Trustee Patrick (probable): they've said we put it in here we we tweaked it but it's been existing for three terms now
[3:04:27] Trustee Patrick (probable): I have noticed, because I do read the CRD when they put notices on title of illegal houses, that we've had some brand new construction.
[3:04:41] Trustee Patrick (probable): People are building a house or cabin, and I don't think that was, that was not really the intent of this to,
[3:04:56] Trustee Patrick (probable): to, have you seen that in your, I guess, inspections
[3:05:00] Trustee Patrick (probable): that some of this is being used
[3:05:03] Trustee Patrick (probable): as for someone just to build something illegally?
[3:05:08] Manager of Bylaw Compliance and Enforcement: So through the chair,
[3:05:09] Manager of Bylaw Compliance and Enforcement: so when the resolution was originally adopted
[3:05:12] Manager of Bylaw Compliance and Enforcement: and we took the interpretation
[3:05:15] Manager of Bylaw Compliance and Enforcement: that this resolution meant you could not build new dwellings,
[3:05:21] Manager of Bylaw Compliance and Enforcement: I would say there was significant pushback
[3:05:23] Manager of Bylaw Compliance and Enforcement: against that interpretation.
[3:05:27] Manager of Bylaw Compliance and Enforcement: So we haven't been enforcing against new dwellings specifically because of the policy, right?
[3:05:38] Manager of Bylaw Compliance and Enforcement: Because of that significant pushback about any of the new stuff.
[3:05:43] Trustee Patrick (probable): Who made
[3:05:44] Trustee Patrick (probable): significant pushback?
[3:05:49] Manager of Bylaw Compliance and Enforcement: The property owners.
[3:05:50] Manager of Bylaw Compliance and Enforcement: owners. There has been significant pushback from property owners about interpreting this
[3:06:00] Manager of Bylaw Compliance and Enforcement: policy as saying you can't build anything new. And we have not pushed back against that.
[3:06:10] Manager of Bylaw Compliance and Enforcement: They have interpreted it broadly as meaning the local trust, it's their interpretation
[3:06:16] Manager of Bylaw Compliance and Enforcement: that they can build new dwellings.
[3:06:19] Trustee Patrick (probable): Okay, but wouldn't we want to make sure we correct that
[3:06:24] Trustee Patrick (probable): in this policy so that it's clear that we're not encouraging people to go build illegal dwellings.
[3:06:31] Trustee Patrick (probable): This was really more about somebody is living in what was a studio and they're now living in it or
[3:06:38] Trustee Patrick (probable): a garage or, you know, they're living in all kinds of things, seasonal cottages that are being lived
[3:06:46] Trustee Patrick (probable): in, you know, instead of, you know, whatever a seasonal cottage is. So should we not be clarifying
[3:06:54] Trustee Patrick (probable): this intent then i
[3:06:56] Manager of Bylaw Compliance and Enforcement: agree 100 that you should explicitly state in this policy that it does
[3:07:01] Manager of Bylaw Compliance and Enforcement: not apply to any new builds trustee
[3:07:07] Voice 15: harris yeah i i don't i don't even know if that's necessary
[3:07:13] Voice 15: i think if somebody's gonna do something illegally they're gonna do it anyway and people are doing it
[3:07:19] Voice 15: and have them doing it.
[3:07:21] Voice 15: I myself built a cabin back in 1999
[3:07:25] Voice 15: that was completely done without any permits
[3:07:28] Voice 15: and no building inspection.
[3:07:30] Voice 15: It was overbuilt.
[3:07:32] Voice 15: The Iowa was harassed.
[3:07:33] Voice 15: The building inspector said, yeah, it's overbuilt,
[3:07:35] Voice 15: but tried to say it's a health and safety thing.
[3:07:38] Voice 15: It was a bunch of BS.
[3:07:39] Voice 15: That thing had no plywood in it, no drywall,
[3:07:43] Voice 15: completely solid wood, all with Alaskan milled lumber.
[3:07:46] Voice 15: and that building is still there today someone's living in it it's existing non-conforming people
[3:07:52] Voice 15: are going to do it whether this is a thing or not um you know i have sold firewood for years i've
[3:07:58] Voice 15: had thousands of firewood customers um i haven't been doing it for a few years now but i've seen
[3:08:04] Voice 15: so many places that i know for i know i've seen them there are dozens of places very similar that
[3:08:11] Voice 15: have been built in the trees nobody can see them there's full-on houses out there that are illegal
[3:08:15] Voice 15: legal. And we're never going to, you know, that's going to happen, whether that's described
[3:08:21] Voice 15: here or not. And people are just trying to put a roof over their head and survive. It's
[3:08:25] Voice 15: called planet Earth. It's a big, bad world out there. And the last thing we want to do
[3:08:30] Voice 15: is, and I've heard somebody use the term, is, you know, be, you know, not taking people
[3:08:36] Voice 15: into consideration. And so I think we need to be a lot more lenient. And I'm all for
[3:08:45] Voice 15: these changes that we're talking about um 4.4 there's probably some other changes that will
[3:08:51] Voice 15: be needed too anyway thank you just Patrick well
[3:08:55] Trustee Patrick (probable): sorry trustee Harris is that
[3:09:02] Trustee Patrick (probable): we have to be very careful the rules are constructed for reasons we don't have to
[3:09:08] Trustee Patrick (probable): like them but um we do have to be careful that we're not creating um a problem and I am concerned
[3:09:17] Trustee Patrick (probable): when I hear an entire house is built
[3:09:19] Trustee Patrick (probable): and someone's not following the requirements
[3:09:24] Trustee Patrick (probable): that are out there.
[3:09:25] Trustee Patrick (probable): They're
[3:09:25] Voice 15: 40 years old and more.
[3:09:27] Trustee Patrick (probable): I'm not questioning what's been done in the past.
[3:09:29] Trustee Patrick (probable): There's no doubt it's been a wild west on this island,
[3:09:32] Trustee Patrick (probable): but we cannot promote that through our regulations.
[3:09:35] Trustee Patrick (probable): We have responsibility and duty
[3:09:37] Trustee Patrick (probable): to put forth rules that are fair.
[3:09:43] Trustee Patrick (probable): And we can't, I mean, like I said,
[3:09:46] Trustee Patrick (probable): that the intent of this was to recognize people are living in all sorts of things,
[3:09:51] Trustee Patrick (probable): but not that they should be out there building new construction
[3:09:56] Trustee Patrick (probable): and that we're turning a mind to it.
[3:10:00] Trustee Patrick (probable): Yeah,
[3:10:01] Voice 15: no, I hear you.
[3:10:01] Voice 15: But I don't think that is what people are taking this as.
[3:10:05] Voice 15: And unfortunately, it's a lot of the fault of the local government
[3:10:10] Voice 15: as to why it is the way it is out there right now.
[3:10:14] Voice 15: and um yeah well it is sort of a wild west still planet earth and people don't realize that
[3:10:21] Voice 15: we walk a fine fine line here from a wild west to uh something even much more uh sinister and
[3:10:30] Voice 15: you know people need to put a roof over their head people are scrambling out there it's getting
[3:10:35] Voice 15: worse and worse by the day here and uh i hate to begrudge somebody the uh you know when i when i
[3:10:43] Voice 15: built that place years ago i couldn't have done it if i hadn't done it without permits couldn't
[3:10:47] Voice 15: have done it wouldn't happen and um i was prepared to go to court whatever it took you know again
[3:10:54] Voice 15: would rather have you living in the ganges under a tent or in a beautiful um building
[3:11:03] Trustee Patrick (probable): can we leave it that the staff come back with uh you know that i understand and i think that this
[3:11:10] Trustee Patrick (probable): we basically just lifted the resolutions as is and put them in here that staff come back with
[3:11:15] Trustee Patrick (probable): what they would recommend for language to help them i mean yeah this
[3:11:19] Trustee Patrick (probable): is uh you know
[3:11:21] Trustee Patrick (probable): manager dingman and his staff are the ones that are out on the on the streets facing these
[3:11:27] Trustee Patrick (probable): things and uh you know we want to make sure we're clear but not you know creating
[3:11:34] Trustee Patrick (probable): more concerns yeah
[3:11:36] Voice 4: and incorporating some of that language that was just amended into the
[3:11:39] Voice 4: trust council policy and before we move on though there was one piece here at the top of page six
[3:11:47] Voice 4: the report 186 the agenda it mentions section three 7.31 and 7.32 um but when i looked at
[3:11:58] Voice 4: section 7.3 i just see 7.3 i don't see a one and two there what's up the bylaw which one
[3:12:11] Trustee Patrick (probable): this is referring to oh
[3:12:14] Voice 4: that's the bylaw sorry my thank you i i didn't make the logical
[3:12:20] Voice 4: jump there i thought i was talking about this policy not the bylaw okay
[3:12:29] Voice 4: Anything else that we want the manager to consider when going over this and bringing back an amended version?
[3:12:45] Voice 4: Not seeing any items.
[3:12:46] Voice 4: Okay.
[3:12:47] Voice 4: All right, then.
[3:12:51] Voice 4: Thank you, Mr. Dingman.
[3:12:53] Trustee Patrick (probable): Does he need any direction?
[3:12:54] Voice 4: Do you need specific direction?
[3:12:56] Voice 4: I think it seems like you took some notes there.
[3:12:59] Manager of Bylaw Compliance and Enforcement: I can proceed on my notes, yes, and bring back an amended version.
[3:13:03] Voice 4: Okay.
[3:13:04] Voice 4: Great.
[3:13:06] Trustee Patrick (probable): we have another piece of new business that was my briefing got added as the
[3:13:10] Trustee Patrick (probable): distance
[3:13:10] Voice 4: okay oh yes your briefing yes uh let's uh go to that
[3:13:13] Voice 4: shall
[3:13:16] Trustee Patrick (probable): i talk about it please do
[3:13:19] Manager of Bylaw Compliance and Enforcement: chair oh
[3:13:20] Voice 4: sorry go ahead there
[3:13:21] Manager of Bylaw Compliance and Enforcement: seems to be
[3:13:22] Manager of Bylaw Compliance and Enforcement: something has cut a feed uh lisa millard was gonna
[3:13:25] Manager of Bylaw Compliance and Enforcement: she had her hand up the main feed from the camera in the room seems to be gone
[3:13:31] ah check
[3:13:36] Manager of Bylaw Compliance and Enforcement: right now the attendees to the meeting are myself chair patrick and
[3:13:41] Manager of Bylaw Compliance and Enforcement: and Lisa Millard.
[3:13:44] Voice 4: Oh, we've
[3:13:46] Voice 4: let some computers
[3:13:47] Voice 4: and drop the
[3:13:49] Voice 4: videos around.
[3:13:52] Voice 4: Is your
[3:13:58] Voice 12: Yeah, let's
[3:13:58] Voice 3: switch over to your
[3:14:02] Voice 3: computer. That might be a more
[3:14:03] Voice 3: reliable approach.
[3:14:06] Voice 4: We can do that. It'll take a moment
[3:14:08] Voice 4: to do that. Maybe we
[3:14:10] Voice 3: could take a five-minute reset. Yeah.
[3:14:12] Voice 4: Let's take, actually, let's just call it
[3:14:14] Voice 4: 10 just in case it takes a bit more than that.
[3:14:16] Voice 4: So let's recess for 10 minutes, and we'll try and get the AV happening here properly.
[3:14:32] Voice 14: Is it working now?
[3:14:33] Voice 5: It's back.
[3:14:36] Voice 3: Let's hook up the tape.
[3:14:38] Voice 12: Yeah,
[3:14:39] Voice 3: so we'll... I suspect the computer.
[3:14:42] Voice 3: It was just like someone...
[3:14:44] Voice 13: It's working now.
[3:14:46] Voice 3: Is it working now?
[3:14:47] Voice 4: Yeah.
[3:14:47] Voice 4: Yes.
[3:14:48] Voice 3: Okay.
[3:14:49] Voice 4: Okay, so it just goes in the machine.
[3:14:51] Voice 3: Yeah.
[3:14:52] Voice 4: That's all they want.
[3:15:31] Voice 5: Can
[3:15:34] Voice 13: somebody mute the laptop, please?
[3:15:37] Voice 3: Oh, yeah, I can do that.
[3:15:38] Voice 13: Thank you.
[3:15:43] Voice 5: Thanks, Lisa.
[3:26:06] Voice 12: Okay, we're unmuted.
[3:26:13] Voice 12: So this is the new item, and I'll turn it over to Trust Patrick.
[3:26:18] Trustee Patrick (probable): All right.
[3:26:20] Trustee Patrick (probable): I'm introducing an item that was brought in as new business.
[3:26:24] Trustee Patrick (probable): I was hoping that this conversation would have been parallel with the stock report on the OCP land use bylaw update project, which is now delayed until April.
[3:26:37] Trustee Patrick (probable): I mean, the delay that we're seeing is challenging.
[3:26:45] Trustee Patrick (probable): One of my biggest concerns is, from the beginning, we've been talking about off-ramps of how
[3:26:54] Trustee Patrick (probable): to accelerate solutions to helping to prioritize connections to North Salt Stream water, in
[3:27:03] Trustee Patrick (probable): particular in the L'Orectorium area that's been released now, but knowing that they're
[3:27:12] Trustee Patrick (probable): moving toward a phased and potential further release once the new plant is built and the
[3:27:23] Trustee Patrick (probable): system is co-mingled I guess from the north and south of the two lakes
[3:27:27] Trustee Patrick (probable): and I'm concerned that every delay that we have is not to the community's benefit that
[3:27:40] Trustee Patrick (probable): we did reach out to the province we asked the province or recommended to the province that they
[3:27:45] Trustee Patrick (probable): opened the letters patent for north salt spring and give them the right to prioritize connections
[3:27:51] Trustee Patrick (probable): and the province declined we know the province has a policy that it's not supporting or helping
[3:27:57] Trustee Patrick (probable): improvement districts that's the province's choice um i've been spending time rereading
[3:28:07] Trustee Patrick (probable): our act again and then have brought new eyes again to section 35 is in part five of the
[3:28:16] Trustee Patrick (probable): items trust act under municipalities and regional districts part 35 says that the board of a
[3:28:22] Trustee Patrick (probable): regional district all or part of which is in the trust area must not adopt a bylaw respecting the
[3:28:28] Trustee Patrick (probable): trust area issue a permit respecting the trust area or undertake work respecting the trust area
[3:28:34] Trustee Patrick (probable): if the bylaw or permit is contrary to where it variants with a bylaw from a local trust committee.
[3:28:42] Trustee Patrick (probable): The Trust Act also says that we're supposed to cooperate with improvement districts,
[3:28:47] Trustee Patrick (probable): which is to cooperate with improvement districts, municipalities, and regional districts.
[3:28:52] Trustee Patrick (probable): But the Act is silent on what cooperation with improvement districts is.
[3:28:57] Trustee Patrick (probable): I think it's quite reasonable for us to interpret that services provided by a regional district
[3:29:04] Trustee Patrick (probable): are similar to those services provided by improvement districts.
[3:29:08] Trustee Patrick (probable): So I think Section 35, we could argue, applies to improvement districts just as much.
[3:29:14] Trustee Patrick (probable): So I've put together my recommendation here is, you know,
[3:29:20] Trustee Patrick (probable): North Saanich recently was appointed a housing advisor,
[3:29:25] Trustee Patrick (probable): an independent housing advisor under the Housing Supply Act to help them identify
[3:29:32] Trustee Patrick (probable): to identify more solutions for the housing supply.
[3:29:36] Trustee Patrick (probable): Yes, North Saanich has to have targets
[3:29:40] Trustee Patrick (probable): and the province uses its targets to decide
[3:29:43] Trustee Patrick (probable): whether or not they appoint independent housing advisors.
[3:29:48] Trustee Patrick (probable): We are exempt from that.
[3:29:50] Trustee Patrick (probable): A local trust committee is exempt
[3:29:52] Trustee Patrick (probable): from those sections of the housing supply act.
[3:29:57] Trustee Patrick (probable): But I think it's worth asking the province.
[3:30:00] Trustee Patrick (probable): If they won't help us remove the letters patent or open up the letters patent to help North Salisbury, our project is delayed.
[3:30:08] Trustee Patrick (probable): Water is critical.
[3:30:10] Trustee Patrick (probable): Connecting water to the housing that this island needs is critical.
[3:30:15] Trustee Patrick (probable): Delays in getting those solutions brought in place aren't to our advantage.
[3:30:21] Trustee Patrick (probable): They're not beneficial to the community.
[3:30:24] Trustee Patrick (probable): So I'm, I'm suggesting we ask the province to appoint an independent advisor to help us with the work that we're doing on the equitable housing options, but in particular, helping us identify policy and tools that will align the water surfacing allocations to critical housing needs.
[3:30:47] Trustee Patrick (probable): needs. This is a desperate move, I will admit. I wish that we had been making the progress
[3:30:59] Trustee Patrick (probable): that we had hoped to be making, and we've been bringing those solutions in place quicker.
[3:31:08] Trustee Patrick (probable): So I'm looking at this as not in any way criticism of our staff. I look at this as respecting
[3:31:16] Trustee Patrick (probable): our current staff capacity and ongoing work,
[3:31:19] Trustee Patrick (probable): and that it's just about augmenting it.
[3:31:21] Trustee Patrick (probable): I also feel that this is not about
[3:31:23] Trustee Patrick (probable): asking for regulatory interference.
[3:31:26] Trustee Patrick (probable): Again, this is about asking the province
[3:31:28] Trustee Patrick (probable): to bring some expertise to the table
[3:31:30] Trustee Patrick (probable): and to help us find a solution
[3:31:33] Trustee Patrick (probable): because this opportunity is going to vaporize,
[3:31:36] Trustee Patrick (probable): use a water pun, if we don't get on it.
[3:31:43] Trustee Patrick (probable): So that's my recommendation is we ask the province
[3:31:46] Trustee Patrick (probable): to appoint an independent housing advisor okay
[3:31:52] Voice 15: questions just to cut uh harris well i'd be 100
[3:31:57] Voice 15: opposed to that at this point for a long list of reasons here honestly when i hear it and when i
[3:32:09] Voice 15: hear terms like we're desperate i start to my blood boils we were desperate at the beginning
[3:32:17] Voice 15: in the term over three years ago. We were desperate on Salt Spring eight years ago.
[3:32:22] Voice 15: But three years ago, just over, I was elected, much to the dismay of
[3:32:28] Voice 15: playing a depot radicals on the island. But one of the big reasons here, so at the beginning of
[3:32:37] Voice 15: the term, we needed to address the housing crisis. And I pushed at that time to pass bylaw 537,
[3:32:44] Voice 15: 7th which was created by a housing task force that was created the term before and it was well
[3:32:52] Voice 15: within the local trust committee's purview of power to do that to pass by law 537 i was prepared
[3:32:57] Voice 15: to do it we couldn't have did it um and on top of that at the same time i proposed we create zoning
[3:33:03] Voice 15: that would allow for workforce ownership housing projects like they have in whistler topino and
[3:33:08] Voice 15: cowichan all neighboring jurisdictions very similar geographically socially and economically
[3:33:12] Voice 15: economically and that the ltc amend the housing portion of the ocp at the same time in conjunction
[3:33:18] Voice 15: with all the stuff going on um which was also in the purview of the ltc's power staff also
[3:33:25] Voice 15: concurred at the time it would only take two months to amend the housing from uh the housing
[3:33:30] Voice 15: section of the ocp procedurally so we're over three years into this and still nothing we could
[3:33:36] Voice 15: have did this um at the beginning of the term in two or three months the zoning could have been
[3:33:39] Voice 15: done in six for workforce ownership housing projects. I was opposed at that time to this
[3:33:47] Voice 15: official community plan or OPC, OCP rather, LUB project for the reason that I could easily see
[3:33:54] Voice 15: it was going to take the whole term maybe longer and I've been proven right time and time and time
[3:33:58] Voice 15: again and I'm proven right again today as it's been delayed again and so then from the beginning
[3:34:04] Voice 15: of the term fast forward into the bill 44 the province implemented in salt spring was excluded
[3:34:09] Voice 15: i proposed at the time that we asked to be included the ltc sent a letter to the province
[3:34:14] Voice 15: now went to the legislature province said uh basically we need to take care of a problem
[3:34:18] Voice 15: ourselves and that was that it was within our purview of the ltc's power to take care of it
[3:34:24] Voice 15: ourselves here there's no better public engagement than an election so we've got this new whatever
[3:34:31] Voice 15: you want to call a task force or whatever you call these people that were appointed which i
[3:34:35] Voice 15: completely was opposed to because we were elected to do something and so once we already asked the
[3:34:42] Voice 15: province to help and they said no we're not going to include you in bill 44 because you need to take
[3:34:46] Voice 15: care of it so now how can i even hold my head up and walk through town and say yeah we're going to
[3:34:51] Voice 15: ask the province again for more help we can do it ourselves we can do it it's in the purview of our
[3:34:57] Voice 15: power we just need to have a backbone and be willing to do it i'm more than prepared to see
[3:35:02] Voice 15: what's good for the community and you know there'll be naysayers sure there'll be naysayers
[3:35:06] Voice 15: to anything um so at this time i'm prepared to halt the ocp lub review and initiate the amending
[3:35:19] Voice 15: of the ocp today to facilitate something identical to bylaw 537 call it bylaw 537 number two we still
[3:35:28] Voice 15: have time in this term to do it and to initiate a blanket zoning for workforce ownership housing
[3:35:34] Voice 15: projects i'm prepared to do it we could do it within the firm otherwise we're going to flail
[3:35:40] Voice 15: around talk to the province they're going to tell us the stuff that you take care of it we've been
[3:35:45] Voice 15: told once already so to me again i hear this my blood boils and i think it's i'm not going to say
[3:35:53] Voice 15: right there done i'm opposed you'll never see me vote for everyone noted
[3:36:02] Voice 4: hey thank you just the heiress appreciate your passion um just patrick did you have a
[3:36:15] Trustee Patrick (probable): well well
[3:36:16] Trustee Patrick (probable): i mean i would love that you know the ocp land use bylaw is the project to update the
[3:36:22] Trustee Patrick (probable): ocp it's a failure that's the process it's a failure you
[3:36:27] Voice 15: guys want to pass that go ahead
[3:36:33] Voice 15: It's a failure. It's the wrong club, sorry.
[3:36:41] Voice 15: We're not even going to discuss it anymore. We could have done something.
[3:36:46] Voice 15: I was prepared at the beginning of the term. Got a giant failure
[3:36:53] Voice 15: on your hands. It's in your lap.
[3:36:58] Voice 15: Call the housing crisis. If it was a perfect
[3:37:02] Voice 15: world, yeah, let's get the OCP in a big conversation with the whole community.
[3:37:05] Voice 15: There's no better engagement than an election. We were elected.
[3:37:10] Voice 15: See you all later.
[3:37:23] Voice 3: We'll be back in just a second here, but I'll just take a five-minute break chair. Yeah, yeah, let's reassess it.
[3:37:33] Voice 3: Okay, we got it up and running or something.
[3:37:39] Voice 12: That's fine. Okay.
[3:37:43] Voice 12: Yeah.
[3:37:44] Voice 5: is yeah okay blankets only for one uh we'll uh we'll start up again now
[3:39:13] Voice 12: apologies
[3:39:13] Voice 4: for the power interruption there um back over to you trustee patrick
[3:39:20] Voice 4: oh
[3:39:20] Trustee Patrick (probable): uh said i said i didn't i i too am disappointed that our project has taken
[3:39:29] Trustee Patrick (probable): in far more time and it's reaching further delay but the project that has been designed to put
[3:39:36] Trustee Patrick (probable): forward was the right project to update the OCP and land use bylaw as we go as we go forward it
[3:39:44] Trustee Patrick (probable): was issues beyond our control
[3:39:46] Voice 6: new
[3:39:47] Trustee Patrick (probable): offices staffing strains excited that we are now fully staffed but
[3:39:53] Trustee Patrick (probable): but we are running out of runway
[3:39:55] Trustee Patrick (probable): with this term.
[3:39:56] Trustee Patrick (probable): There's no question.
[3:39:59] Trustee Patrick (probable): And I hear from staff on thoughts
[3:40:05] Trustee Patrick (probable): of how we're going to be able to move fast enough
[3:40:09] Trustee Patrick (probable): to address this fleeting moment
[3:40:15] Trustee Patrick (probable): with especially the North Salt Spring connections
[3:40:18] Trustee Patrick (probable): and what we can do to shore up our side
[3:40:20] Trustee Patrick (probable): of the policies and regulations
[3:40:24] Trustee Patrick (probable): to support North Salt Spring, who their board has been really appealing to us to get on with it and do what we can.
[3:40:34] Trustee Patrick (probable): It is within our authority to do something. And the delay is just going to cost us more. So, that's my thoughts, sir.
[3:40:53] Voice 3: at this point i don't have um at this point i don't think that there's any possibility
[3:41:00] of completing this project before the end of term i would say regardless of what next steps
[3:41:07] we
[3:41:07] Voice 3: address the issue
[3:41:16] Voice 3: actually generates outcomes we don't want something that sounds good
[3:41:22] Voice 3: we want a product that has buy-in in the community and that's that's a lot of work
[3:41:39] Voice 5: yeah
[3:41:47] Voice 4: i look at this proposal and we have no way of knowing that whether the province would
[3:41:58] Voice 4: respond positively but at the same time it's it's sending a message that i think
[3:42:04] Voice 4: uh thing needs to be said it's unfortunate that our previous pleas have not been met with
[3:42:14] Voice 4: any action from the province in particular around the uh north salt spring uh waterworks uh bit as
[3:42:25] Voice 4: you you mentioned there um because yes that's as as this project
[3:42:33] Voice 4: or any other project um
[3:42:35] Voice 4: when's its way along there's time is ticking there's potential for less connections to be
[3:42:42] Voice 4: available to the types of housing that this ltc has heard or wanted and needed on the island and
[3:42:50] Voice 4: and so i'm yeah i'm inclined to to support the request um here to make the resolution i will
[3:43:01] Voice 4: say um
[3:43:01] Trustee Patrick (probable): well i think you know at least i think minimum we can have a follow-up conversation
[3:43:07] Trustee Patrick (probable): of the Minister of Housing and Municipal Affairs
[3:43:08] Trustee Patrick (probable): who
[3:43:09] Voice 6: came here,
[3:43:10] Trustee Patrick (probable): who saw the island,
[3:43:11] Trustee Patrick (probable): who
[3:43:12] Voice 6: I
[3:43:13] Trustee Patrick (probable): think was, you know, really got a feeling
[3:43:15] Trustee Patrick (probable): for how serious the housing challenge is on this island.
[3:43:21] Trustee Patrick (probable): And so I would hope that I, and I do know North,
[3:43:24] Trustee Patrick (probable): we did have a round table conversation
[3:43:26] Trustee Patrick (probable): with the minister afterwards,
[3:43:28] Trustee Patrick (probable): the chair of the board of North Salt Spring was there.
[3:43:30] Trustee Patrick (probable): We talked specifically about this challenge
[3:43:33] Trustee Patrick (probable): during that meeting.
[3:43:34] Trustee Patrick (probable): So this is not news.
[3:43:37] Trustee Patrick (probable): and I think it would be helpful
[3:43:39] Trustee Patrick (probable): to at least have a conversation.
[3:43:41] Trustee Patrick (probable): So I'll proceed to make the motion.
[3:43:43] Trustee Patrick (probable): I move that Salt Spring Island Local Trust Committee
[3:43:46] Trustee Patrick (probable): request the province of British Columbia
[3:43:47] Trustee Patrick (probable): to appoint an independent housing advisor
[3:43:49] Trustee Patrick (probable): under the Housing Supply Act work with the LTC
[3:43:53] Trustee Patrick (probable): to review actions to date and provide recommendations
[3:43:56] Trustee Patrick (probable): to the Minister of Housing and Municipal Affairs
[3:43:58] Trustee Patrick (probable): on increasing equitable housing options
[3:44:03] Trustee Patrick (probable): within the affordable housing non-market
[3:44:05] Trustee Patrick (probable): to near low market rental and ownership portions of the housing spectrum including the development
[3:44:11] Trustee Patrick (probable): of policy and regulatory tools to help align water servicing allocation with critical housing needs
[3:44:20] Voice 4: i'll second the motion uh anything further no
[3:44:26] Trustee Patrick (probable): i think i think we've said it all
[3:44:30] Voice 4: okay uh not hearing anything i will uh call the question all those in favor and motion carries
[3:44:40] Voice 4: uh um next up we have the report section and i'll just look to steph if there's anything
[3:44:49] Voice 4: policy setting resolutions will be staying the same until
[3:44:57] Voice 4: silence uh the updated bylaw policy comes back to us
[3:45:01] Voice 3: anything
[3:45:02] Voice 4: uh you wanted to highlight
[3:45:05] Voice 3: on the application support today
[3:45:07] Voice 3: No, Mr. Chair. I spoke to the redoning application from Blackburn earlier as I tried to do that update.
[3:45:18] Voice 3: We do have a number of applications. I think we've seen a lot of applications moving forward lately, but I think we continue to see a decent number of applications coming in.
[3:45:30] Voice 3: Some of these are built on our technology station. There's a TUP and 805 that's in this room.
[3:45:38] Voice 3: That you may remember a T&P that was issued a number of years ago regarding cabins next to the Vesuvius Ferry Terminal.
[3:45:48] That application would currently be leaving the applicant to
[3:45:53] Voice 3: have them move that over to a resolving application.
[3:45:56] Voice 3: That was sort of impeding with that previous issue, so we'll work to bring that forward and bring that forward with compliance.
[3:46:08] Voice 3: Otherwise, these applications are all generally just ongoing.
[3:46:13] Voice 3: One note on something that's not on the decree that you played last time around,
[3:46:19] Voice 3: the bylaws application, unfortunately, one of the next steps was to have
[3:46:26] SAO
[3:46:27] Voice 3: endorse that, to sign that covenant in the federal leadership meeting
[3:46:36] They have to cancel their originally planned meeting, but I'm told that they will be
[3:46:43] Voice 3: taking
[3:46:45] Voice 3: things that are going forward in the future, so it's still ongoing, and the finalization
[3:46:50] Voice 3: of those covenants is ongoing, so I do just want to let you know about that, and I'm not
[3:46:55] Voice 3: I'm not too sure where Gisbert's at these days.
[3:46:57] Voice 3: They're awaiting some change in the funding structure.
[3:47:08] Voice 3: So that's just been an annoying thing.
[3:47:11] Voice 3: Otherwise, I think you'll see a lot more of the development applications in the coming months.
[3:47:17] Voice 3: Our full contingent of planners to help back in the country, of course.
[3:47:21] um back uh getting
[3:47:24] Voice 3: up the speed there so um so yeah there's a lot to come um and otherwise
[3:47:34] Voice 4: questions appreciate the update uh we have the expense report on 217 for

A member of the public asked if there will be public consultation on the OCP in March.
The Regional Planning Manager stated there will not be any public consultation on
the Official Community Plan in March.
A member of the public spoke to the issue of amending Bylaw No. 355 in relation to
vacation rentals and noted there had been two round tables meetings with local
stakeholders which indicated support of updating the bylaw. The speaker listed
recommended steps previously provided and noted there had been no progress on the file,
a working group had not been established, and a proposal to look into licensing has been
put on hold. They asked why the project is being stalled.
The Acting Chair noted the bylaw amendment is tied into the Official Community
Plan and Land Use Bylaw project and not a stand-alone project and a report on the

This item was deferred to the April meeting.
16. NEW BUSINESS
16.1 Salt Spring Island Compliance and Enforcement Policy – Staff Report
The Bylaw Compliance and Enforcement Manager summarized the staff report and
highlighted the following:
The purpose of the policy is to incorporate all current standing resolutions for
compliance and enforcement into a single document and these resolutions
have been included as priorities listed in section 4;
The inspection section details when a Bylaw and Compliance Officer can attend
a property, notice requirements, and when site inspections are not required;
The policy addresses frivolous, repeat, and vexatious complaints;
The policy identifies who can be screening officers and provides a list of
authorized reasons bylaw notices can be cancelled.
Discussion ensued and the following comments were noted:
The Purpose speaks to local community standards which are undefined;
Bylaw Officers looks at definitions within the Land Use Bylaw first and then
within the policy document;
The Local Trust Committee can define what is considered a minor structure;
The references section includes regulatory bylaws of which the Land Use Bylaw
is considered;
The vacation rental section should make reference to the home-based business
aspect;
Section 4.4 requires updated wording to “approved septic system” instead of
“approved septic or sewage disposal system”;
The Local Trust Committee can set how much notice is given for a site
inspection without consent and if this section is removed then the notice period
defers to the Trust Council Policy;
A Trustee noted section 4.4 states “except in the following circumstances” and
lists points (a) through (g) and as these points can possibly be interpreted in
different ways consideration of removing them should be taken;
Language can be revised to state “significant” risk to health and safety;

Meeting Minutes
March 19, 2026
A section could be added to outline an approach to non-permitted dwellings;
There is need to rely on authorities that have responsibility in the area of
determining what constitutes a risk regarding septic disposal;
If waste is not going into approved septic system, it is a contravention of the Salt
Spring Island Land Use Bylaw;
Significant risk would be considered raw sewage being disposed on the land;
Section 4.4 (d) should use the word “evidence” versus “concerns”;
The policy can state it does not apply to any new build construction.
The meeting was recessed for a break at 1:13 p.m. and reconvened at 1:25 p.m.
16.2 Request for Provincial Appointment of an Independent Housing Advisor -
Discussion
Trustee Patrick introduced the discussion and the following points were noted:
There is a need to align housing policy with water servicing;
There is currently no framework to ensure that new water connections are
directed toward the housing types most urgently needed;
North Saanich was recently appointed a housing advisor to identify solutions for
housing supply;
A Local Trust Committee is exempt from Housing Supply Act and the scale and
urgency of local housing need is clear;
Due to delays in the Official Community Plan work, and continued need to
address water servicing issues, the approach allows the Local Trust Committee
to move forward to address the water supply issue.
A trustee outlined the reasons they are not in support of the proposal noting the
Local Trust Committee was elected to address housing issues, rezoning could have
been undertaken, and the Official Community Plan project has failed to move
forward or address these issues.
Trustee Harris left the meeting at 1:34 p.m.
The meeting was recessed for a break at 1:34 and reconvened at 1:37
A Trustee noted the OCP/LUB project was the correct project to put forward to
address the issues but due to staff capacity related to staffing shortages progress
on the project has been slow.
SS-2026-036
It was MOVED and SECONDED
that the Salt Spring Island Local Trust Committee request the Province of
British Columbia to appoint an independent housing advisor under the
Housing Supply Act to work with the LTC to review actions to date and
provide recommendations to the Minister of Housing and Municipal Affairs
on increasing equitable housing options within the affordable housing non-
market to near or low market rental and ownership portions of the housing
spectrum, including the development of policy and regulatory tools to help
align water servicing allocation with critical housing needs.
