[0:00:13] Voice 3: the Coast Salish people. I'm David Maude, elected on Main Island and chair of the North Pender Island

[0:00:18] Voice 3: Local Trust Committee. I'm joined today by your two North Pender Island trustees, Aaron Campbell

[0:00:24] Voice 3: and Deb Morrison. Together we make up the North Pender Local Trust Committee.

[0:01:14] Voice 3: Just to let you know, this meeting is an official forum for your local trust to make decisions about land use, planning matters, and discovery of a business.

[0:01:55] Voice 6: that it seems like it was a short felt like a short turnaround from the last meeting that we

[0:02:00] Voice 6: had and um i think folks have settled into graduation plans and and uh and um so it's

[0:02:09] Voice 6: just been been a few a few conversations about uh the the applications that we've got today

[0:02:16] Voice 6: generally all pretty positive and um uh chatting with folks about that but it's uh yeah it's been a

[0:02:25] Voice 6: a relatively not to jinx anything but uh in a calm little time hopefully summer will be uh

[0:02:31] Voice 6: we'll just stay on course indeed yeah i would

[0:02:38] Voice 2: i would echo that it does feel like it's been a very

[0:02:42] Voice 2: uh chill sort of just things percolating along which you know thinking back to you know almost

[0:02:48] Voice 2: eight years ago i was like this is so much nicer than like having waste management like fights in

[0:02:54] Voice 2: You know, like, so really grateful for all the work that, you know, everyone's done over the past, you know, eight years that I've been involved with the trust because it feels like things are a lot more just orderly and like mellow, you know, and of course we always have challenges in the community but I think we're finding better ways to work through them collectively so that's great.

[0:03:18] Voice 3: thank you. From my end, yeah, I'll echo that it has been a relatively peaceful and prosperous summer. I guess I did report last time that the trust policy statement won't get concluded this time. We're still doing some housekeeping stuff.

[0:03:37] Voice 3: stuff. There's a Committee of the Whole meeting scheduled, I believe, is it next week or the week

[0:03:43] Voice 3: after, just to sort of deal with a couple of small details on that front. We had Trust Council in

[0:03:51] Voice 3: June, which was electronic, which was one of those things is that it should have been 26 trustees

[0:03:58] Voice 3: there all day, every day. Unfortunately, we didn't have that, but sometimes we even struggled to keep

[0:04:04] Voice 3: quorum so um i think that the executive committee will be looking into that and seeing if there's

[0:04:11] Voice 3: anything that we can do um i i think the the one thing i can point to is the new compensation

[0:04:18] Voice 3: um package that was rolled out includes that you know every day of trust council if you do not

[0:04:25] Voice 3: attend for the majority of the day um you are going to get docked pay and i think that will

[0:04:30] Voice 3: be a bit of an incentive um for people to attend a little bit more um other than that i think we're

[0:04:38] Voice 3: going to celebrate some sunshine and happiness and get out with the meeting um so um i don't

[0:04:45] Voice 3: see director brett with us um so next up is public decision period um if anybody wishes to address

[0:04:54] Voice 3: trust the local trust committee um if you're an applicant um when your application comes forward

[0:05:01] Voice 3: that will be the time for you to speak um however if you're a member of the public and you wish to

[0:05:07] Voice 3: speak to an application um and this is the time um to um raise any uh things any of the issues

[0:05:16] Voice 3: before us um otherwise um if any other issues people want to raise their hands we generally

[0:05:21] Voice 3: only give two to three minutes um and just ask that you put your hand up digitally um which in

[0:05:28] Voice 3: our world is the at the bottom of the of the taskbar you should see a raise hand emoji you

[0:05:41] Voice 3: and with all that i don't see any hands going up so i will assume that we can move forward

[0:05:50] Voice 3: work um so um we have on page three local trust committee minutes dated may 29th 26th for adoption

[0:06:14] Voice 3: um we have at page 12 uh section 26 resolution without meanings report for your information

[0:06:22] Voice 3: and at 10.3 on page 13 we have the advisory planning commissioning minutes dated may 27th

[0:06:30] Voice 3: 26th um once again very impressive work um you know it's it's amazing what comes out of this

[0:06:40] Voice 3: this committee um and and certainly appreciate uh planner smith supporting that committee um in in

[0:06:47] Voice 3: the off hours um it's uh it's really good work being done there um so any questions or anything

[0:07:42] Voice 4: review of housing agreements and recommendations

[0:07:45] Voice 4: around that. And I've pointed them to the Galliano Islands

[0:07:48] Voice 4: and housing agreements that were agreed to last term

[0:07:52] Voice 4: and I think have a lot of the same principles

[0:07:54] Voice 4: and rent structure pieces

[0:07:58] Voice 4: that would be helpful for them to look at.

[0:08:01] Voice 4: and they haven't scheduled another meeting yet,

[0:08:34] Voice 3: 2026-0231 Kerfoot, and

[0:08:38] Voice 3: I believe, if I'm not mistaken,

[0:08:43] Voice 3: that's Planner Belcher.

[0:08:47] Voice 9: Morning, everybody. Yes, this is a new development permit application

[0:08:52] Voice 9: within the commercial and industrial form and character DPA

[0:08:55] Voice 9: for the construction of three new commercial vacation rental cottages

[0:09:00] Voice 9: as part of the Tides Cottages vacation rental business,

[0:09:05] Voice 9: which is located at 1329 McKinnon Road.

[0:09:09] Voice 9: The proposal is to construct two identical two-bedroom cottages

[0:09:13] Voice 9: and one one-bedroom cottage,

[0:09:16] Voice 9: along with a new parking lot for the new buildings.

[0:09:19] Voice 9: buildings. The new work will take place on the east side of the property and extend from

[0:09:24] Voice 9: the existing driveway, and one tree is proposed to be removed due to safety concerns related

[0:09:31] Voice 9: to the proximity to the new central two-bedroom cottage. And much of the southern part of

[0:09:39] Voice 9: the proposed construction site is also covered in thick bramble, which will be removed prior

[0:09:45] Voice 9: prior to construction.

[0:09:46] Voice 9: The area will be planted in accordance

[0:09:49] Voice 9: with the landscaping plan,

[0:09:51] Voice 9: which is attached to the draft permit,

[0:09:55] Voice 9: which involves some native planting along the property line

[0:09:58] Voice 9: as well as some limited potted plants

[0:10:03] Voice 9: around the proposed buildings.

[0:10:05] Voice 9: And this also includes a landscaping security of $2,500,

[0:10:10] Voice 9: which is included as part of the draft permit

[0:10:12] Voice 9: and will be required prior to the permit issuance.

[0:10:18] Voice 9: Staff consider that the proposal has

[0:10:20] Voice 9: been designed to minimize impacts on adjacent properties

[0:10:23] Voice 9: by maintaining much of the existing screening

[0:10:26] Voice 9: and the conditions within the draft permit

[0:10:29] Voice 9: ensure that the development meets the official community

[0:10:32] Voice 9: plan guidelines.

[0:10:35] Voice 9: So therefore, staff recommends that the North Bender Local

[0:10:38] Voice 9: Trust Committee approve issuance of development permit,

[0:10:42] Voice 9: permit PLDP-2026-0231. Thanks.

[0:10:55] Voice 3: the applicant is with us. So do you have any questions for the applicant or if the applicant

[0:11:00] Voice 3: wishes to make a statement at all?

[0:11:04] Voice 2: I'm happy to do whichever order you want, but I do have a

[0:11:07] Voice 3: question. Well, go ahead with your question. That'd be a good start.

[0:11:11] Voice 2: So I had a question

[0:11:13] Voice 2: related to water because I didn't see anything from our water study in terms of the information

[0:11:21] Voice 2: that was provided in the permit. And that confused me a little bit because I thought the purpose of

[0:11:27] Voice 2: the water study was to help provide information with each application about where the applicant

[0:11:32] Voice 2: sits in the context of water scarcity or needs in the island. This is more for the planner, I think.

[0:11:38] Voice 2: Uh,

[0:11:40] Voice 9: so there isn't any water study associated with a development permit for this

[0:11:46] Voice 9: property, given that they're zoned for the permitted, they're within their density.

[0:11:52] Voice 9: So I'm not sure if there's a separate thing you're referencing.

[0:11:58] Voice 2: No,

[0:11:58] Voice 9: we're referencing

[0:11:59] Voice 2: the water study that we did across the Ollapender,

[0:12:02] Voice 2: and just like how that information gets used when we see a development permit or when we see

[0:12:08] Voice 2: So maybe Brad, I don't know.

[0:12:11] Voice 2: Through

[0:12:11] Voice 4: the chair, Planner Belcher.

[0:12:14] Voice 4: So the development permit guidelines are largely around form and character.

[0:12:19] Voice 4: And so that's what the focus of the development permit is, is the design meeting the form and character that's intended for the island.

[0:12:31] Voice 4: And it doesn't include considerations around water.

[0:12:36] Voice 4: uh that said like spruce or like planner belcher said the the property is zoned for that

[0:12:44] Voice 4: uh and uh and as a commercial use they would need a commercial water license for that use so

[0:12:50] Voice 4: um um i think it's kind of a little bit out of scope of what the intent of the dps versus if it

[0:13:00] Voice 4: it was a riparian or an ecological dp um like they already have the right to have those cottages

[0:13:11] Voice 4: now they're just meeting this development permit requirement around form and character okay so

[0:13:19] Voice 2: maybe the question is slightly different when they go for the building permit for those cottages

[0:13:23] Voice 2: they'll have to show proof of water correct correct

[0:13:27] Voice 4: if they're having water in those they

[0:13:29] Voice 4: They would need to show proof of water, and as a commercial use,

[0:13:32] Voice 4: they would also need a commercial water license under the Provincial Water License Act

[0:13:39] Voice 4: or under the Provincial Water Act.

[0:13:42] Voice 4: So I would say that water will be well considered in other processes

[0:13:49] Voice 4: and that this permit is really around, is the forming character within the

[0:14:00] Voice 4: the intent of the guidelines okay anything

[0:14:03] Voice 4: else to advert i'm sure or planner belcher

[0:14:07] Voice 4: no that sounds that's that sounds right yeah so

[0:14:10] Voice 2: then maybe just the last sort of comment or

[0:14:12] Voice 2: question about that is like when we get a referral i assume we'll get a referral related to the

[0:14:17] Voice 2: building permit for this property i just know that water has been a community concern in this area

[0:14:22] Voice 2: and so it would be good if we replied with our water maps like to the thing and i don't know how

[0:14:31] Voice 2: to yes or if that's just a default thing that happens or whatever what

[0:14:37] Voice 4: i would say to that is

[0:14:39] Voice 4: it's not going to influence the building inspector's decision on whether they give

[0:14:45] Voice 4: of occupancy or not it's it's more does the pump does the does the well provide that water is what

[0:14:54] Voice 4: test they would be looking for and the and the and the same with like the but the province when

[0:15:01] Voice 4: issue when the province when issuing or amending a water license to consider this use they would

[0:15:07] Voice 4: certainly look at all the sustainability aspects and that's where uh perhaps those maps and we do

[0:15:14] Voice 4: share those maps when we receive water license referrals which we do receive i'm not sure in

[0:15:23] Voice 4: this case if they already have a water license in place for that volume which i assume they do

[0:15:27] Voice 4: and in that case it's been there's not a lot we could do anyways so

[0:15:51] Voice 5: this um because obviously that is a question um and it's something that obviously we have

[0:15:56] Voice 5: considered in in great thought um so the conception on mckinnon road is there isn't water

[0:16:03] Voice 5: um but we have a lot we have historically we've run our resort for five years and never had an

[0:16:09] Voice 5: issue with water we also have a unique uh scenario here where we have a shallow well um that produces

[0:16:15] Voice 5: is a ton of water all year um so we're very lucky to have that on an aquifer um that benefits us

[0:16:22] Voice 5: greatly um going also going forward is we have redone all of our water systems already

[0:16:29] Voice 5: new filtration new everything um and massive storage capacity um we have currently added

[0:16:35] Voice 5: 5600 gallon tanks on every one of our systems and we are going to add more before the development

[0:16:40] Voice 5: development so we can pump up during the winter and a 56 gallon tank right now in our current

[0:16:45] Voice 5: lasts us about three weeks so you know we can sit on like i can sit on four of them and not even

[0:16:52] Voice 5: pump a drop of water up in august and september um which is our plan we were planning to sip on

[0:16:58] Voice 5: our wells in the down season just so we don't put pressure on our wells and our neighboring wells

[0:17:02] Voice 5: like we live next door i don't want to put pressure on my own well i need water in my house so um

[0:17:06] Voice 5: Um, so yeah, we have also rainwater catchment tanks going in on the new builds.

[0:17:11] Voice 5: Uh, that'll be for all the irrigation around the, the cottages.

[0:17:14] Voice 5: We may even plumb those into toilets.

[0:17:16] Voice 5: We're just not quite sure on that yet.

[0:17:18] Voice 5: Um, and yes, to the water license, we do have our water license, uh, for this site.

[0:17:23] Voice 5: Cause this site used to service up to 50 people.

[0:17:25] Voice 5: So, um, back

[0:17:26] Voice 5: way back in the day, um, and it had a restaurant next door.

[0:17:29] Voice 5: So, um, anyways, so yeah, we're, we're on it.

[0:17:33] Voice 5: Uh, we're not just blindly pulling water out of the ground.

[0:17:36] Voice 5: we are being strategic and making sure that we do this right to our neighbors and

[0:17:40] Voice 5: make sure we're sustainable in the process of doing this no

[0:17:45] Voice 2: talked about this when this the zoning work had gone through so thanks i just want to make sure

[0:20:38] Voice 4: rezoning application here a preliminary report from the Pender Island Golf Club Society seeking

[0:20:44] Voice 4: to uh rezone the property uh the primary purpose is to allow development on site one which is

[0:20:51] Voice 4: as indicated on page 48 of your agenda package

[0:20:59] Voice 4: to permit the development of a new maintenance area,

[0:21:06] Voice 4: maintenance building and potentially one or two buildings

[0:21:10] Voice 4: with the maintenance and storage capacity

[0:21:14] Voice 4: in the corner of the lot that is currently zoned rural

[0:21:17] Voice 4: and would not currently permit that development as a golf course use.

[0:21:24] Voice 4: So that's the primary driver of why they're coming to the local trust committee for rezoning.

[0:21:30] Voice 4: But as described on page 47 of your staff report,

[0:21:37] Voice 4: there are a number of other issues with the current existing zoning on the property.

[0:21:43] Voice 4: The property is two parcels as shown in figure three there

[0:21:49] Voice 4: and also figure two and one above.

[0:21:56] Voice 4: And both those properties are split zoned.

[0:21:59] Voice 4: One of them is zoned Ag B, which is a site specific zoning,

[0:22:03] Voice 4: which permits the golf course on a portion of a lot F.

[0:22:11] Voice 4: As you can see in figure three, there's also a portion over to the left, which is zoned rural.

[0:22:21] Voice 4: There's also a historic issue with the zoning where a portion of lot A, and it's hard to get all this clear, but a portion of lot A is zoned.

[0:22:31] Voice 4: sorry, a portion of lot F is zoned egg right now

[0:22:36] Voice 4: in that when a previous rezoning was done,

[0:22:40] Voice 4: a map error created that.

[0:22:43] Voice 4: So in summary, they're seeking to replace

[0:22:48] Voice 4: the maintenance shed with a new one in site one,

[0:22:53] Voice 4: seeking a higher maximum height for that,

[0:22:57] Voice 4: seeking to reconcile the many accessory buildings

[0:23:01] Voice 4: on the current lot as well as reconcile some of the buildings

[0:23:07] Voice 4: are in setbacks.

[0:23:07] Voice 4: So removing the internal setbacks

[0:23:10] Voice 4: for those golf course buildings.

[0:23:12] Voice 4: And at this point, I would say there is some work

[0:23:17] Voice 4: to still be done to clarify their plans.

[0:23:21] Voice 4: But at this preliminary stage,

[0:23:25] Voice 4: staff are recommending that the LTC move forward

[0:28:59] Voice 8: And we're also short on equipment storage.

[0:29:02] Voice 8: So the existing building is located really beside a watershed, a stream with ponds there.

[0:29:12] Voice 8: It's not a good location.

[0:29:14] Voice 8: So we're looking at a place which is going to be less environmentally sensitive.

[0:29:19] Voice 8: And initially our plans were for one building.

[0:29:22] Voice 8: The problem with it is that the standards we're looking for for maintenance, heated facilities, insulation, stuff like that, kind of drives what happened with the storage, the equipment storage, which is a higher standard than we would like.

[0:29:46] Voice 8: complex, but it might

[0:29:48] Voice 8: be that we'll save money by having two buildings as opposed to one.

[0:44:57] Voice 4: needed for the buildings under the bc building code because that's your bread and butter but

[0:45:01] Voice 4: tell us are the activities is is there impacts to surface potential impacts to surface water

[0:45:09] Voice 4: uh if there are what are the you know remediation options including is a separator something that

[0:45:16] Voice 4: should be looked at and instead of them really analyzing if there's real impacts they just left

[0:45:20] Voice 4: to like okay let's make them do an oil separator like because they just they don't they didn't want

[0:45:27] Voice 4: want to do that work right they didn't want to do that hard engineering work so this new firm might

[0:45:31] Voice 4: have a completely different perspective but i'll have you know to be honest to be blunt i'll have

[0:45:36] Voice 4: way more confidence in the results of this engineer so he's working on that he's got a

[0:45:45] Voice 4: the itc had a bunch of concerns and he's had his rp bio address those so he has a letter that i

[0:45:51] Voice 4: need to look at but that will be provided to you and included an addendum letter from his

[0:45:55] Voice 4: professional biologists to address some of those concerns that the itc raised and the north pender

[0:46:02] Voice 4: conservancy continues to raise and then there's potential i think the say out and couch and would

[0:46:10] Voice 4: probably want an aia archaeological impact assessment completed and determining the scope

[0:46:17] Voice 4: of whether that's just on his bottom portion of lot or extending all the way up to his

[0:46:22] Voice 4: this upland portion is kind of, I think,

[0:46:25] Voice 4: what we're waiting for in terms of what they are recommending

[0:46:28] Voice 4: versus obviously the scope of the cost

[0:46:31] Voice 4: and effort to do upslope of all that.

[0:46:34] Voice 4: So that's where he's at with all that stuff.
