STAFF REPORT Islands Trust Staff Report 1 File No.: PL-DP-2025-0499 DATE OF MEETING: January 30, 2026 TO: North Pender Island Local Trust Committee FROM: Bruce Belcher, Planner 2 Southern Team COPY: Robert Kojima, Regional Planning Manager SUBJECT: PL-DP-2025-0499 Applicant: Budd Kerfoot Location: 1325 Mackinnon Rd, North Pender Island RECOMMENDATION 1.That the North Pender Island Local Trust Committee approve issuance of Development Permit PL-DP-2025-0499. REPORT SUMMARY The purpose of this report is to consider a Development Permit (DP) application for construction of two commercial vacation rental cottages and a parking lot within the Commercial and Industrial Form and Character Development Permit Area (DPA) on the property. BACKGROUND The application is preceding a building permit application, as the new construction would require a DP based on the following section within the North Pender Island Official Community Plan No. 171, 2007 (OCP): The following activities shall require a development permit whenever they occur within the DPA, unless specifically exempted below: 1) Construction of, addition to or alteration of a building or other structure. This work is not exempt from the requirement for a DP as a building permit is required. The applicant plans to construct two identical commercial vacation rental cottages to be located at 1325 Mackinnon Rd, as part of The Tides Cottages commercial vacation rental business, which also operates on 1329 Mackinnon Rd. The two new cottages would each have a floor area of 900 ft 2 or about 83.6 m 2 . Additional to the new cottages a new parking lot is also proposed with a capacity of six parking spaces. Through conversations with staff the applicant has proposed to locate the eastern of the two cottages within the 6.1 metre interior side lot line setback to 1329 Mackinnon Rd. Since both properties operate under the same commercial business the applicant’s rationale was to locate the new cottages closer to the existing commercial tourist accommodation operation and away from the neighbour to the west. Since the requested 151 Islands Trust Staff Report 2 variance would result in closer adherence to the guidelines in the DPA the variance is being included within the DP application. The draft development permit is included as Attachment 4. Figure 1: Subject Property Location ANALYSIS Official Community Plan: The entirety of the property is within the Commercial and Industrial Form and Character DPA. The objective of this development permit area is to ensure that new or additional commercial or industrial uses are developed in a manner that is consistent with and enhances rural character and avoids impacts on adjacent properties.
