NORTH PENDER ISLAND LOCAL TRUST COMMITEE 
LAND USE BYLAW NO. 224, 2022 
 
 
A Bylaw to establish regulations and requirements respecting the use of land, including the surface of water, the 
use, siting and size of buildings and structures, the provision of parking, landscaping and screening and the 
subdivision of land within the North Pender Island Local Trust Area. 
 
 
WHEREAS the North Pender Island Local Trust Committee is the Local Trust Committee having jurisdiction on and in 
respect of the North Pender Island Local Trust Area, pursuant to the Islands Trust Act; 
 
AND WHEREAS the North Pender Island Local Trust Committee wishes to adopt a Land Use bylaw and other 
development regulations and to show by map the boundaries of the zones; 
 
AND WHEREAS the North Pender Island Local Trust Committee has held a Public Hearing; 
 
NOW THEREFORE the North Pender Island Local Trust Committee enacts in open meeting assembled as follows: 
 
1.   This Bylaw may be cited for all purposes as the “North Pender Island Land Use Bylaw No. 224, 2022”. 
 
2. The following schedules attached hereto are hereby made part of this Bylaw and adopted as the Land Use 
Bylaw for that part of the North Pender Island Local Trust Area as shown on Schedule C: 
(1) Schedule A (Land Use Bylaw Text) 
(2) Schedule B (Zoning Map) 
 (3) Schedule C (Bylaw Area Map) 
 (4) Schedule D (Detailed Plans – R(b) Siting Plan) 
 (5) Schedule E (Detailed Plans – W3(a) Seawall Plan) 
 (6) Schedule F (Comprehensive Development Zones – Plan CD1(a)) 
 
3. If any provision of this Bylaw is for any reason held to be invalid by a decision of any Court of competent 
jurisdiction, the invalid provision must be severed from the Bylaw and the decision that such provision is invalid 
must not affect the validity of the remaining provisions of the Bylaw. 
 
4.  Bylaw No. 103 cited “North Pender Island Land Use Bylaw 103, 1996” and all of its amendments are repealed.
