[0:01:45] Trustee Rogers: Main Island Local Trust Committee. That's the first regular meeting.

[0:01:48] Trustee Rogers: We did have our special meeting last week. It's great

[0:01:53] Trustee Rogers: to be here and I want to start the meeting introducing myself. My name is Dan Rogers.

[0:01:58] Trustee Rogers: I'll tell you about myself in a moment. I'm acknowledging that

[0:02:01] Trustee Rogers: we are very privileged and honored to be able to meet on the traditional territories

[0:02:05] Trustee Rogers: of the Coast Salish peoples. And we do

[0:02:09] Trustee Rogers: that, of course, across the Islands Trust, I encourage you, area, I encourage you, if you wish,

[0:02:15] Trustee Rogers: in the chat function to make an acknowledgement as to where you're joining us from. I'm joining

[0:02:21] Trustee Rogers: from the traditional territory of the Musqueam, Tsleil-Waututh, and Squamish peoples. I happen

[0:02:28] Trustee Rogers: to be in Vancouver for the meeting today, and I'm very pleased to be here. And of course,

[0:02:34] Trustee Rogers: if you're on Main Island, you're in the traditional area of the

[0:02:37] Trustee Rogers: as far as the First Nation.

[0:02:40] Trustee Rogers: So thank you very much for that.

[0:02:43] Trustee Rogers: This is our continuation of our electronic meeting process.

[0:02:49] Trustee Rogers: under the provincial public health orders

[0:02:52] Trustee Rogers: and therefore meeting by this Zoom platform.

[0:02:56] Trustee Rogers: We have been doing this now since about April

[0:03:02] Trustee Rogers: and they're continued from time to time

[0:03:05] Trustee Rogers: to be technological issues however we hope that the process is it works today and that everything

[0:03:12] Trustee Rogers: will goes well we're doing our best we put invested a fair amount of human and technological

[0:03:17] Trustee Rogers: resources into making this um to making this work for all of you and for us as well as we do our

[0:03:25] Trustee Rogers: business of the main island local trust committee um if yeah we just trust you'll bear with us as

[0:03:32] Trustee Rogers: As we continue through this technological way of doing things, as the pandemic continues, we're continuing to evolve and hopefully all will be well.

[0:03:47] Trustee Rogers: I actually am elected as a trustee in the Gambier Island Local Trust Area, although I reside on Keats Island, which is Lek Tynes in the Squamish language.

[0:03:58] Trustee Rogers: and I'm also a member of the Executive Committee

[0:04:03] Trustee Rogers: elected by Trust Council and the Vice Chair,

[0:04:06] Trustee Rogers: a former member of the Executive Committee

[0:04:08] Trustee Rogers: and I'm assigned and have the privilege of being assigned

[0:04:11] Trustee Rogers: to be the chair of Maine Island,

[0:04:14] Trustee Rogers: Galliano and Gabriella Island.

[0:04:18] Trustee Rogers: So I am one of three trustees who will be discussing

[0:04:23] Trustee Rogers: the issues that are on our agenda today

[0:04:24] Trustee Rogers: and my role is to be part of,

[0:04:26] Trustee Rogers: to be one of the trustees working their way

[0:04:28] Trustee Rogers: through these issues, as well as to chairing,

[0:04:31] Trustee Rogers: as well as chairing the meeting as we go forward.

[0:05:54] Trustee Rogers: for sure um and how and you are um uh are are not able at that throughout the meeting except when

[0:06:04] Trustee Rogers: specific times arise um you will uh your cameras are not on the screen and you're not on that's

[0:06:12] Trustee Rogers: to keep the screen clear and to allow us to do our work and to put our agendas off, etc.

[0:06:23] Trustee Rogers: applications where the applicant is here and wishes to speak, you will be promoted and

[0:06:30] Trustee Rogers: then you will be, I don't mean allowed, I mean technologically allowed to turn your

[0:06:40] Trustee Rogers: so that when it's appropriate, you will be able to speak.

[0:07:21] Trustee Rogers: week and I was very pleased to be part of that. You know this community is engaged on any number

[0:07:28] Trustee Rogers: of issues. So with that I'm going to turn to the approval of the agenda. I have one item I've

[0:07:37] Trustee Rogers: I've spoken briefly to the planner

[0:07:39] Trustee Rogers: about adding in an applications and referrals.

[0:07:43] Trustee Rogers: There is an issue related to a TUP for that,

[0:07:48] Trustee Rogers: but the application has been filed

[0:07:50] Trustee Rogers: for the daycare on the Island.

[0:07:52] Trustee Rogers: And I'm going to, even though there's no report

[0:07:55] Trustee Rogers: on our Island, we're not going to make any decision

[0:07:57] Trustee Rogers: about the outcome of that application.

[0:07:59] Trustee Rogers: I would like, I think there's some issues to discuss

[0:08:01] Trustee Rogers: about it, so I'm going to propose we put that

[0:08:04] Trustee Rogers: that at 10.1, I don't know what the number is.

[0:08:08] Trustee Rogers: So I'll just put TUP re-daycare.

[0:08:11] Trustee Rogers: I think both of the trustees are okay with that.

[0:11:31] Trustee Rogers: is that this, and I know you've made,

[0:11:34] Trustee Rogers: and this is, I know you've made other submissions

[0:11:37] Trustee Rogers: about other issues, but this one in particular

[0:11:40] Trustee Rogers: is about your concern about the border

[0:11:44] Trustee Rogers: between the application and your piece of land

[0:11:47] Trustee Rogers: where you're doing agriculture.

[0:11:50] Voice 10: Mrakas, Each of our letters have expressed that concern, but this one also is more general as as last week during the affordable housing discussion, the idea of the island being almost built out.

[0:12:03] Voice 10: Mayor Mrakas, same with other Gulf Islands, this is going to be more of an issue as you proceed and you intensify development next to agricultural areas so.

[0:12:12] Voice 10: Mayor Mrakas, it's not just related to this piece of property it's related to how the LTC thinks about development.

[0:12:18] Voice 10: development plans as they relate to or or interface with agriculture so it's it's specifically about

[0:12:26] Voice 10: the the process before us but more a general thing too i think that the ocp isn't very clear on

[0:12:33] Voice 10: on how it can support agriculture and where these different zones intense zones may have an impact

[0:12:42] Voice 10: or may not have an impact on agriculture so it was kind of doing double duty so i just want to

[0:12:47] Voice 10: to draw attention to that.

[0:17:23] Voice 17: discussion about the potential of it being um sort of fast-tracked essentially as it exists

[0:17:32] Voice 17: currently, if we move forward, if there's a decision to be made in terms of being able to

[0:17:38] Voice 17: fast track the application, we can only make, we can only bring it to the February, and this is

[0:17:45] Voice 17: based on, this is, this is based on staff workload and process. So the possibility of bringing it to

[0:17:52] Voice 17: the February meeting, it's possible, but it would require having to move the Costello application to

[0:17:58] Voice 17: to March and so that's a that's an assessment of time that's been that that Robert spent quite a

[0:18:05] Voice 17: bit of time kind of getting a good good handle on so that's that's sort of the the situation in

[0:18:11] Voice 17: terms of providing notice etc there's we still do have time to be able to get it to the February

[0:18:17] Voice 17: agenda but like I said it's really a matter of of workload and timing at this point.

[0:18:57] Trustee Rogers: could tell us what you you've heard the planner say where we're at in terms of our workload issues

[0:19:08] Voice 12: for um thanks for uh letting me join i'm joining for my car i'm at the schwartz bay ferry terminal

[0:19:13] Voice 12: and i have a frozen mouth i was just at the dentist so hopefully you can hear what i'm saying

[0:19:19] Voice 12: i'm not slurring my words um no i wanted to say uh thanks to narissa and to janine and david for

[0:19:26] Voice 12: you know lending so much time to to hear us out and uh and for lending your support and

[0:19:31] Voice 12: And it's really been quite easy to approach the island's trust with this issue.

[0:19:40] Voice 12: The daycare, which has been in operation since 2018, is currently operating at the school.

[0:19:48] Voice 12: And at the moment, well, since September, really, we've been between a rock and a hard place trying to efficiently operate and effectively operate at the school.

[0:20:01] Voice 12: because essentially because of the COVID protocols of the school district

[0:20:07] Voice 12: have really limited our access and raised some health and safety concerns

[0:20:13] Voice 12: in terms of the way that the daycare needs to operate with babies and toddlers

[0:20:17] Voice 12: as opposed to the school with their school children.

[0:20:20] Voice 12: So it's become very difficult for us to operate at the school.

[0:20:23] Voice 12: As a result, we rented a home and entered into a commercial lease agreement

[0:20:29] Voice 12: went with the homeowner um at uh to have to to move our licensed daycare into the home and at

[0:20:37] Voice 12: the time we are consulting with licensing office um and had it given guidance that we that we

[0:20:44] Voice 12: because of a because of a an exemption in the legislation that we wouldn't run into a zoning

[0:20:50] Voice 12: issue so um we didn't anticipate having to apply for a temporary use permit or um or at least we

[0:20:57] Voice 12: we we didn't understand i suppose the process of the temporary use permit um so we've got we've

[0:21:04] Voice 12: got ourselves into the situation now where we're in a lease agreement um and paying money uh we're

[0:21:11] Voice 12: paying double rent and double insurance to operate or to kind of hold both spaces both at the school

[0:21:17] Voice 12: and at this this home um our like i said our ability to operate that at the school has been

[0:21:23] Voice 12: has been compromised to the point where we've we've had to reduce enrollment and put a freeze

[0:21:28] Voice 12: on enrollment so we're really losing money and um being that it's the only it's the only child

[0:21:34] Voice 12: child care option on the island that serves a number of families with a long wait list um

[0:21:39] Voice 12: we're we're quite desperate to um to find a solution to this problem um just we also have a

[0:21:46] Voice 12: we we were given a provincial grant to put to build a child care facility which is very exciting

[0:21:51] Voice 12: for our community and that's um in progress at the community center um but it won't be built at

[0:21:57] Voice 12: least until january next year so in the meantime we really um in order to keep our daycare alive

[0:22:03] Voice 12: we really need a solution and we're hoping that um that we'll be able to um to to to operate out

[0:22:11] Voice 12: of this this home as soon as it's humanly possible a lot of volunteers have worked um

[0:22:17] Voice 12: really hard to set this up and and we've spent significant resources trying to set this

[0:22:24] Voice 12: this home daycare situation up so that's kind of the situation okay

[0:22:31] Trustee Rogers: questions from either of the

[0:22:33] Trustee Rogers: trustees for I'm guessing you guys have had conversations yeah go ahead trust me I don't

[0:28:52] Voice 17: keep it in the family and are looking for an option to generate some revenue so that

[0:29:01] Voice 17: So my colleague Phil Testamel was the planner that went through the application.

[0:29:17] Voice 17: And so I'm presenting on his behalf here.

[0:29:20] Voice 17: um and he he does recommend it goes so so first of all the reason that it is before you as a

[0:29:28] Voice 17: preliminary uh report is because um the ocp while the uh the main island went through a process

[0:29:38] Voice 17: looking at tps for um stvrs there was no sort of ultimate result so the ocp doesn't actually have

[0:29:46] Voice 17: guide guidelines so these are these would be new guidelines that are being presented

[0:29:50] Voice 17: And also, you know, a TEP of this nature has not been put forward to the trustees.

[0:30:00] Voice 17: as i understand or or it's been quite some time um so so so phil uh he went through

[0:30:10] Voice 17: um what had kind of been put forward previously during the process um with with main island and

[0:30:17] Voice 17: it also looked at there are a number of processes um on a number of the island other islands that

[0:30:23] Voice 17: are going forward to review guidelines um etc and so and he looks primarily at uh the guidelines

[0:30:34] Voice 17: uh in the tups for north pender and south pender which are are fairly similar and so that's that's

[0:30:41] Voice 17: where he's generated uh sort of the guidelines that would essentially be related to this

[0:30:46] Voice 17: temporary use permit. And from his perspective, he is supporting the application as it appears

[0:31:00] Voice 17: that it's a reasonable amount of people. The location doesn't seem to be, there doesn't seem

[0:31:11] Voice 17: to any major challenges with the location and the the applicants have done uh their due diligence to

[0:31:18] Voice 17: to contact the the water service and and also have conversations with neighbors um there's

[0:31:24] Voice 17: of course there's there still is the notice um opportunity for neighbors to um to provide um

[0:31:31] Voice 17: further uh further comments on the application should should trustees agree to go forward with

[0:31:38] Voice 17: the application so um that's sort of the the summary um i'm open to questions if anybody

[0:53:11] Voice 17: process to to to you know change any anything at this point um it's really an opportunity to start

[0:53:18] Voice 17: the conversation. And the other recommendation is, you know, previously the recommendation

[0:53:26] Voice 17: was, the resolution was made to schedule a community information meeting prior to

[0:53:34] Voice 17: first reading of the bylaws. And the recommendation here is that that community

[0:53:49] Voice 17: from the applicant. I did provide a little bit of an overview of, there were a number of

[0:53:55] Voice 17: resolutions from the previous meeting relating to this application. And the one was asking that

[0:54:03] Voice 17: we that staff sent a letter to the the owner Dr. McHugh and to see whether he was still interested

[0:54:11] Voice 17: in having the additional lot so the subdivision into two three lots and so he would essentially

[0:54:18] Voice 17: end up with two he did confirm that he is still interested in that additional lot and we there

[0:54:28] Voice 17: were the um there were a number of um requested materials for uh to be received from the the

[0:54:38] Voice 17: applicant and as of yet um we are there are a number we are waiting for a number of them um i i

[0:54:45] Voice 17: understand that they they have received i i did receive the arborist report um this morning and

[0:54:52] Voice 17: i understand that they they have received some other materials and will be um forwarding those

[0:54:57] Voice 17: and i'm sure they'll provide an update um and yeah so basically with with respect to the the draft

[0:55:08] Voice 17: bylaws they have been designed the land use bylaw has been designed to create a new zone which we're

[0:55:16] Voice 17: calling comprehensive development three zone uh that appeared to be the most logical way to go

[0:55:32] Voice 17: It creates a split-zoned lot. It re-zones the portion of the property for multifamily

[0:56:09] Voice 17: And then with respect to the OCP amendment, it essentially designates that the area that would

[0:57:22] Voice 18: 10 feet from my neighbor's you know house wall but because i'm not used to i live in a very rural

[0:57:28] Voice 18: very rural spot so that's something that i think we need to look at i know that there's tight space

[0:57:33] Voice 18: there i'm still a bit concerned about the septic being not on that single lot that you know maybe

[0:57:40] Voice 18: this rigid three acre subdivision maybe should be three and a half so it encompasses a set i just

[0:57:47] Voice 18: just don't know what a good idea that is i have concerns about the septic intruding concerns about

[0:57:52] Voice 18: the setbacks um to the neighbors both on the west side and certainly for both new lots definitely

[0:58:00] Voice 18: concerned that there'd be a significant setback from the neighbors on those edges all of those

[0:58:04] Voice 18: properties around there currently live in very very rural situations so that's one area um

[0:59:55] Trustee Maude: We're in the middle of a process, which is good because we're not at the end of the process.

[1:00:30] Trustee Rogers: but the the approach is is somewhat different as well um but what what i noticed about the

[1:00:38] Trustee Rogers: proposed language that you gave us uh planner chadwick was um it it calls the zone the cd3

[1:00:47] Trustee Rogers: zone a effectively a rental zone um sorry i don't have it in front of me um uh it's a um

[1:00:56] Trustee Rogers: I should have had it before me, but it calls it a multifamily rental housing is the definition.

[1:01:08] Trustee Rogers: That's what's allowed in that zone.

[1:01:11] Trustee Rogers: And it doesn't seem to have any restrictions on it being affordable housing or any kind of reference to affordable housing.

[1:01:23] Trustee Rogers: theoretically as i look at it it could be a for-profit multi-family rental housing zone

[1:01:33] Trustee Rogers: and i i would have thought that we needed to make sure that if we're going to

[1:01:38] Trustee Rogers: allow that kind of density in there because we consider affordable housing to be an amenity

[1:01:43] Trustee Rogers: that we want to make sure that and i know that will be included in the housing agreement

[1:01:47] Trustee Rogers: agreement but what if i but what if we rezone it or the housing agreement stuff i think the zoning

[1:01:52] Trustee Rogers: should also reflect that so there's two approaches we've taken one on galeano one on on gabriola that

[1:02:00] Trustee Rogers: i've been involved in on galeano it's a more definitive definition about what affordable

[1:02:05] Trustee Rogers: housing is and that's still a work impressive process um on gabriola we actually defined

[1:02:13] Trustee Rogers: defined affordable it is an affordable housing zone and it defined the affordable housing as

[1:02:19] Trustee Rogers: housing that's subject to a housing agreement um so there is but it but it actually said

[1:02:26] Trustee Rogers: you know you have to have a housing agreement in order to build here i mean i'm paraphrasing

[1:02:32] Trustee Rogers: that's what it's like i would like would have thought that we would put that in here as well

[1:02:37] Trustee Rogers: that there should be some definition so that this isn't a it couldn't be rezoned and be

[1:02:42] Trustee Rogers: be misinterpreted as a for-profit housing.

[1:02:46] Trustee Rogers: And I know that's not the intent, but that would be.

[1:02:49] Trustee Rogers: And what that did on Gabriel is it provided the applicant

[1:02:54] Trustee Rogers: with more flexibility in terms of what they could develop

[1:03:07] Trustee Rogers: Anyway, those are my comments.

[1:05:49] Voice 4: with Dr. McHugh he'd like to change the boundaries a little bit between lot one and lot two so we'll

[1:05:56] Voice 4: have to prepare and give you another survey and at that point I think we'd be more ready or you'd

[1:06:03] Voice 4: have more information about exactly the size of those lots because they may not be equal

[1:06:09] Voice 4: so I just wanted to bring that up right now about that and a brief update of the recent activities

[1:06:18] Voice 4: And yes, you've been, you've received that, the arborist report.

[1:06:24] Voice 4: And we also met with Robin Anshel.

[1:06:26] Voice 4: So thank you also to the planner for agreeing to let us use the biologist that was recommended

[1:06:32] Voice 4: by Keith Erickson, the ecological, the biologist who provided the ecological report.

[1:06:39] Voice 4: We've met with her just on the weekend, and we hope to have a report from her in about

[1:06:46] Voice 4: two weeks.

[1:06:47] Voice 4: So one of the things that's happening for us is that with the confluence of the Miners Bay Trail and the tree protection zones now that have been identified in the arborist report and the septic siting and the driveway that goes down, we've got a lot of things to rationalize as we're developing the site plan.

[1:07:09] Voice 4: plan. And so we're meeting with the professionals and having them meet with each other to create

[1:07:16] Voice 4: something that works really well in that area. And it's just to bring it up again, that we are

[1:07:24] Voice 4: doing a lot of this work as at the recommendations of the ecological report. And, and the siting of

[1:07:36] Voice 4: of the buildings are in line

[1:07:39] Voice 4: with the ecological recommendations as well.

[1:07:42] Voice 4: And I know that that's been brought up now

[1:07:44] Voice 4: about the setbacks.

[1:07:46] Voice 4: So we are looking forward to having the report

[1:07:51] Voice 4: from the biologist, the wetland specialist

[1:07:56] Voice 4: to find out what she recommends in terms of her assessment

[1:07:59] Voice 4: and her recommendations for remediation.

[1:08:01] Voice 4: And that was a really important piece

[1:08:04] Voice 4: that the trustees I think also wanted to know so I'm just bringing that up again

[1:08:09] Voice 4: about that and we are mindful about the setbacks on the west side we know that we we hear those

[1:08:16] Voice 4: concerns and the other thing that I'd like to bring up if and I'm open to questions too if you

[1:08:27] Voice 4: sometimes that's useful question and answer I'd like to just bring up again that and because it

[1:08:32] Voice 4: it was mentioned in your report, Nerissa, around the chance find protocol and the First Nations

[1:08:39] Voice 4: archaeological concerns. And so we did speak to this last time, but it's in the report again. So

[1:08:43] Voice 4: I just want to mention again that we will abide by the chance find protocol. We have looked at

[1:08:48] Voice 4: the mapping and there is nothing on the maps that indicate that there has been anything showing in

[1:08:55] Voice 4: our particular area. It's quite a ways away, but we will certainly abide by that. And perhaps

[1:09:00] Voice 4: Perhaps the trustees could provide some clarification

[1:09:02] Voice 4: of what else you would like us to do in this regard.

[1:09:28] Voice 1: I'll be very brief, just a very quick comment

[1:09:31] Voice 1: comment on one of Janine's questions that Deborah's just alluded to, and that is setback.

[1:09:37] Voice 1: So yes, we've been very cautious about that. We have certainly looked at that.

[1:09:41] Voice 1: We do intend to provide a buffer. And in the event that there is some buildings that get a

[1:09:48] Voice 1: little closer or if there's exposure, we will provide a privacy screening. So that's already

[1:09:54] Voice 1: been discussed. So there are two reports, and I'm not going to go through the whole report. You've

[1:10:00] Voice 1: you've got that. But just the highlights. Some of these reports come in first as a draft,

[1:10:06] Voice 1: I should say, and then they're tweaked and sent back because the reports do have to reconcile

[1:10:12] Voice 1: with the proposal and also with other reports. So there's some slight adjustment. So the Arborist

[1:10:18] Voice 1: report came in this morning, and you all have that. And the bulleted points on there is that

[1:10:25] Voice 1: But he's followed, Jan, or Jan, I should say, has examined all the trees that are reported in the ecologist Keith Erickson's report.

[1:10:37] Voice 1: He's considered the health, safety and the retention requirements.

[1:10:40] Voice 1: The proposed building site should not affect any of those trees adversely.

[1:10:45] Voice 1: There was also a consultation with Brent Dennis of DWD Engineering regarding the septic system, or at least the septic field.

[1:10:55] Voice 1: and concluded that the septic dispersal field will provide a net positive for tree retention

[1:11:02] Voice 1: because it will also provide some moisture in the summertime. The five large Douglas fir trees

[1:11:10] Voice 1: can be preserved provided the root zones are protected during and after construction and that

[1:11:15] Voice 1: is all detailed and recommended the re-evaluation of them after completion of construction just to

[1:11:23] Voice 1: to make sure there is no damage.

[1:11:25] Voice 1: And it's also essential that the tree protection zones

[1:11:28] Voice 1: around the trees be left intact.

[1:11:31] Voice 1: And the last point is three out of the four wildlife trees

[1:11:34] Voice 1: should be left as wildlife trees

[1:11:37] Voice 1: and providing that the abatement recommendations

[1:11:40] Voice 1: are followed.

[1:11:41] Voice 1: There's one tree that is leaning and is threatening over

[1:12:07] Voice 1: afternoon with her. And she investigated both parcels, both proposed parcels number two

[1:12:14] Voice 1: and number three since they're contiguous. And she looked at mitigated damage by soil compaction

[1:12:20] Voice 1: by old drainage ditches and by repeated clear-cutting.

[1:12:25] Voice 1: She did a very thorough study and identified the land

[1:12:28] Voice 1: would now be considered Douglas Fir Zone Cedar Forest.

[1:12:33] Voice 1: So this is a very critical, it's one of the rarest areas

[1:12:36] Voice 1: of Douglas Fir Zones in the province

[1:12:40] Voice 1: due to conversion to agriculture and settlement.

[1:12:44] Voice 1: And in fact, 120 or 30 years ago,

[1:12:48] Voice 1: It was clear cut for the purpose of agriculture.

[1:12:52] Voice 1: The recommended goals include mitigation of surface runoff, the decompaction of logging roads and the sorting area,

[1:13:00] Voice 1: the reestablishment of a Douglas Fir Forest Cedar Forest Zone, install a water retention pond,

[1:13:09] Voice 1: increase the wildlife habitat in the forest and obviously the pond.

[1:13:13] Voice 1: This will increase the groundwater retention from what it is now.

[1:13:18] Voice 1: and it will manage also the the runoff water collected from buildings that will be roof

[1:13:23] Voice 1: collection uh and it will create an ecological reserve with walking trails uh the detailed

[1:13:29] Voice 1: report is anticipated uh within the next couple of weeks or so um she was very excited about it

[1:13:36] Voice 1: she said this is one of the smallest properties she's ever examined but it's also one of the most

[1:13:40] Voice 1: interesting so uh thank you chair for the opportunity and i'm happy to take any questions

[1:41:29] Voice 17: for some feedback from trustees on where we want to go from here. I have some suggestions.

[1:41:39] Voice 17: So I personally thought the meeting went very well. I was impressed to see how many people

[1:41:46] Voice 17: actually showed up to a Zoom meeting. And also I feel like we got a lot of really useful information

[1:41:56] Voice 17: from a number of different perspectives. So I did take notes and I went through my notes

[1:42:00] Voice 17: and pulled out, there seemed to me to be sort of three key themes. One being

[1:42:09] Voice 17: One being the question of density and water, and another being the idea of incentives and

[1:42:19] Voice 17: alternative ownership, that was something that came out.

[1:42:23] Voice 17: And then there would ultimately, if we move forward, there would be questions that we'd

[1:42:32] Voice 17: have to discuss around what a maximum square footage for distributed density would be and also

[1:42:40] Voice 17: I did hear some interest in looking at a maximum square footage for new buildings so that would

[1:42:48] Voice 17: also be a you know a discussion we'd want to look at so the question and I did discuss it a bit with

[1:42:53] Voice 17: Robert too and we think that it might be useful for the useful to have a couple more community

[1:43:01] Voice 17: meetings and we may want to focus those so the conversation around a maximum

[1:43:08] Voice 17: square footage and an overall maximum you know maybe a topic for for one

[1:43:15] Voice 17: specific meeting and then we could have another relating to density and water

[1:43:19] Voice 17: and that's I know I can bring information there were questions about

[1:43:23] Voice 17: sort of what what kind of area do we still have for build-out and questions

[1:43:28] Voice 17: about um you know looking at minimum and maximums you know if we were lot sizes if we were to move

[1:43:33] Voice 17: to this kind of model so um and then you know the idea of of uh incentives and and and ownership

[1:43:41] Voice 17: that could that could be tucked into either one of these meetings so i'm just sort of putting it

[1:43:45] Voice 17: out there those were my observations and the the topics that i saw you know if you want to move

[1:43:49] Voice 17: forward with um having some more community meetings we could break it out that way i'm

[1:43:53] Voice 17: interested to hear from from trustees what your feelings are um and if there are you know first

[1:43:57] Voice 17: of all about about doing maybe a couple you know a couple more community meetings and uh and the

[1:44:03] Voice 17: kinds of and whether these topics uh sort of resonate with you or whether you'd want to uh

[1:44:09] Voice 17: to focus on on um these in addition to others or others completely uh other to these so i'll leave

[1:44:26] Trustee Maude: with me and i do very much like the thoughts of having individual sort of focused uh meetings

[1:44:41] Trustee Maude: you know are going to be contentious and i think you know it's good to to sort of have a focused

[1:44:47] Trustee Maude: meeting on a focused topic so we can sort of not get lost in what's being discussed there

[1:45:06] Voice 18: at least two different topics but I suspect I think that the the biggest controversy we have

[1:45:12] Voice 18: is is with water districts which represent the majority of our settlement residential land

[1:45:17] Voice 18: so I think we should start with that group first and I did suggest that we look at

[1:45:23] Voice 18: that if it's a mapping that would show us for instance,

[1:45:27] Voice 18: how many size of lots,

[1:45:29] Voice 18: and that would give us a clear indication

[1:45:31] Voice 18: of what each water district has and we have size.

[1:45:34] Voice 18: We talked about minimum, maximum house size.

[1:45:37] Voice 18: I don't know that we touched on,

[1:45:39] Voice 18: but we need to touch on minimum lot size.

[1:45:43] Voice 18: There are simply going to be some lots that are simple.

[1:45:45] Voice 18: And that was mentioned that are going to be too small,

[1:45:48] Voice 18: but mapping will really give us a good idea

[1:45:51] Voice 18: where hard to map out what's actually been developed but all of our water districts know

[1:45:57] Voice 18: exactly how many undeveloped lots they have and so we could send out a email to the water

[1:46:04] Voice 18: districts requesting that information and then maximum lot size where we focus on settlement

[1:46:10] Voice 18: residential we may have some small lots that we will discover that are in rural or other

[1:46:16] Voice 18: there are zoning as well.

[1:46:19] Voice 18: So mapping is really helpful, having those visuals.

[1:46:22] Voice 18: Definitely agree that there's definitely

[1:46:26] Voice 18: Maximum house sizes is a huge one.

[1:53:50] Voice 17: to you know learn from their process so instead of initiating our own process we could essentially

[1:53:57] Voice 17: adopt whatever they come up with and tweak it so that process

[1:54:03] Trustee Rogers: so when we get to February and if

[1:54:06] Trustee Rogers: or when we get to the end of the bylaw technical amendments we'll have a discussion about capacity

[1:54:12] Trustee Rogers: and whether we can add another top priority project.

[1:58:36] Voice 18: in a fallow deer meeting

[1:58:39] Voice 18: that there was a community outreach meeting organized by CRD

[1:58:43] Voice 18: and actually it was really good,

[1:58:44] Voice 18: but unfortunately it was a working day for me.

[1:58:47] Voice 18: And so they had the conservation officer representative

[1:58:50] Voice 18: representative from the Ministry of the Environment to answer questions,

[1:58:54] Voice 18: RCMP detachment from Pender to answer questions.

[1:58:57] Voice 18: And they had a really good group of attendees and lots of fulsome questions

[1:59:04] Voice 18: about deer hunting and the mechanics, of course,

[1:59:08] Voice 18: the rules and regulations around hunting.

[1:59:11] Voice 18: They held this meeting because they had a third grant,

[1:59:15] Voice 18: and they were about to start another hunt through the CRD-funded program.

[1:59:19] Voice 18: the last weekend i met with eric kelch from the crd and the two first nations hunters

[1:59:24] Voice 18: who are have come the last past two years and are here again for the third year

[1:59:29] Voice 18: and they've slowly accumulated you know more and more properties built more relationships with local

[1:59:35] Voice 18: local landowners the first year they came which is three years ago they got 70 fallow last year

[1:59:41] Voice 18: they got 117 so this year i'm anticipating even bigger numbers and they finally released a whole

[1:59:47] Voice 18: a bunch of paperwork to our follow-up committee as well, which I think we're going to put up on

[1:59:52] Voice 18: our website. And it was a good conversation. The RCMP spoke about the fact that the hunters

[2:00:00] Voice 18: always text ahead when they're shooting.

[2:00:02] Voice 18: When people are concerned about hearing shots being fired,

[2:00:05] Voice 18: they can contact the RCMP.

[2:00:07] Voice 18: So that was sort of the major outside of the local trust area meetings that I

[2:00:13] Voice 18: attended. Lots of inquiries, lots of stuff going on.

[2:00:17] Voice 18: So it just seems like a gazillion emails and different issues.

[2:00:21] Voice 18: And then further on,

[2:00:22] Voice 18: we're going to discuss the CRD walking trail that I'm quite concerned about.

[2:00:30] Trustee Maude: would certainly echo Trustee Dodds and it's been very very busy with with emails and people coming

[2:00:38] Trustee Maude: up and asking questions and such people are very very active and involved in our community

[2:00:50] Trustee Maude: with the trail once a whole bunch of ribbons and thing flagging goes up it tends to get people

[2:00:57] Trustee Maude: excited so we have that um the only other issue i guess i can touch on it is that we're just

[2:01:03] Trustee Maude: starting with bc ferries into a consultation period um with a whole new schedule with this

[2:01:09] Trustee Maude: new salish ferry that's coming online next year to replace the main queen and bc ferries is looking

[2:01:16] Trustee Maude: an entire overhaul of southern gulf islands ferry schedules um which what they put forward

[2:01:24] Trustee Maude: word sounds quite exciting because we could actually see an additional two round trips a day

[2:01:29] Trustee Maude: we're waiting for the details but there seems to be a lot going that way which could make quite a

[2:01:34] Trustee Maude: game changer for the island thank you okay

[2:01:39] Trustee Rogers: thank you um it's been so long since i've been on a ferry

[2:01:47] Trustee Rogers: i used to live on them i

[2:01:49] Voice 18: think that i think that's really an unfair statement to make when both dave

[2:01:53] Voice 18: and i you know i know

[2:01:55] Trustee Rogers: you guys are always on the ferry but i mean i used to first two first year

[2:02:00] Trustee Rogers: and a half of this this job i was living on the ferries and learned the salish boats in and out

[2:02:07] Trustee Rogers: now i'd never go on them anymore anyway i know i know you two are in the in and out of uh victoria

[2:02:15] Trustee Rogers: every day or almost every day um okay well thank you for the trustee reports uh there's a trust

[2:02:23] Trustee Rogers: Trust Conservancy report dated, it's a little old now, November 24th, 2020.

[2:02:29] Trustee Rogers: So that's there for the information of trustees and for the community.

[2:02:34] Trustee Rogers: It's interesting as you go through it as to the work they're doing, because as we all know, the Conservancy is really one of the jewels of the Islands Trusted in terms of protecting properties.

[2:02:48] Trustee Rogers: I'm really pleased to say that the 30th property that they own is now on Keats Island, and it's been finalized.

[2:02:55] Trustee Rogers: There's a news report coming out on Thursday about that, a news release, so I'm not spreading it yet, except to you guys.

[2:03:05] Trustee Rogers: But it's pretty amazing, 30 properties they have across the Salish Sea and across the Island's Trust area.

[2:03:13] Trustee Rogers: area. The document that's attached to 12.9 is the communication that went to landowners

[2:03:23] Trustee Rogers: all across the Islands Trust area, encouraging them to protect their either Douglas fir or

[2:03:32] Trustee Rogers: hemlock coastal forests. This is the one that went to Main Island. Apparently, you can see

[2:03:39] Trustee Rogers: it went to only 11 properties on Main Isle.

[2:03:46] Trustee Rogers: So are there any questions about either of those documents

[2:04:40] Trustee Rogers: the salt spring local trust committee asking if uh you would be interested in moving having a joint

[2:05:27] Trustee Rogers: so that it's not a formal meeting of any of the LTCs,

[2:05:32] Trustee Rogers: but simply one of the trustees go to that.

[2:05:43] Voice 18: I think we've done a really good job with our STBRs.

[2:05:46] Voice 18: And this goes back to when I was first elected

[2:05:48] Voice 18: and people had no idea what STBRs were.

[2:05:55] Voice 18: when I say we've done a good job,

[2:05:56] Voice 18: is that what we, you know, we finally allowed legal cottages to be STBRs. We never outright

[2:06:01] Voice 18: allowed STBRs. So we kept a lid on them. Well, we know we have a few. I think we only had two files

[2:06:07] Voice 18: that are still maybe open, maybe not. And then we have looked at TUPs. We've given one, we gave one

[2:06:14] Voice 18: and we denied a few. So, but nonetheless, if they want some help, rather than have the special

[2:06:21] Voice 18: meeting I think they should have one appointee per LTC and I'm not really excited about volunteering

[2:06:27] Voice 18: for that job so that's my take on it.

[2:06:33] Trustee Maude: Trustee Mott? No I would again echo what Trustee Dodd said is

[2:06:37] Trustee Maude: you know I think that we've managed to maintain the peace on on Main Island and we're maintaining

[2:06:44] Trustee Maude: a balance that I believe has kept our community happy so as such maybe we have something to

[2:06:51] Trustee Maude: to contribute because I do know the other islands

[2:06:53] Trustee Maude: they are struggling with it.

[2:06:56] Trustee Maude: And either option works for me.

[2:07:52] Voice 18: Okay, so because, you know, you haven't been here and probably Nerissa hasn't been here, but we all know that the CRD got substantial amount of funding to build the much desired trail from Miners Bay to Village Bay.

[2:08:05] Voice 18: And then along came and they've done surveys and they've worked with the local trails committee and the trail committee actually put their own little trail in one part of it.

[2:08:14] Voice 18: But now a surveyor showed up about a week ago and started putting pink pins all along the side of the road.

[2:08:20] Voice 18: and so i stopped and said you know what what what does that mean what are the pink well the pink

[2:08:26] Voice 18: pins are the middle of the trail so they're the five foot mark from the edge of i presume it's

[2:08:33] Voice 18: it's it they're using i'm assuming they're using the road allowance and that this pink marker is

[2:08:39] Voice 18: somehow based on the survey of where the legal roads are the problem is if you actually come

[2:08:43] Voice 18: here and see where these pink pins are they are in a spot where if they and the pink pins mark a

[2:08:50] Voice 18: five foot center of the trail so we're talking a 10 foot trail on the side of the road huge number

[2:08:55] Voice 18: of trees i've been told by whoever's either in charge of building this trail they're going to

[2:09:00] Voice 18: remove 70 to 80 trees 70 to 80 trees is completely contrary to anything to do with our gas tax money

[2:09:09] Voice 18: being used to build a trail but the whole purpose of that is to reduce the carbon footprint so i

[2:09:15] Voice 18: would like to make a motion that we ask the chairman to write a letter to the crd asking

[2:14:16] Voice 13: suggested to him that he should maybe talk to the current landowners and the trail committee

[2:14:20] Voice 13: before they start doing that. The other issue is that where they've placed a lot of the

[2:14:26] Voice 13: pegs right now, the section that's built is on the front part of our property. It looks

[2:14:34] Voice 13: like they intend to completely ignore what has already been built. Perhaps that issue

[2:14:40] Voice 13: you should be brought into your letter to the CRD.

[2:14:45] Voice 13: Okay.

[2:14:48] Voice 13: Because what's built

[2:14:49] Trustee Rogers: is very nice.

Planner Chadwick reviewed the status of the recently received application and Planner 
Testemale is processing – question of fast tracking the application. 
Meaghan Feduck, representing the Day Care Program spoke to the application.  Centre 
has incurred a number of difficulties at school due to virus protocols and while in the 
process of constructing a Day Care Centre (target completion July 2022) has entered 
into a lease with a home owner which necessitates a Temporary Use Permit (TUP).  
Situation is causing significant financial impacts for Program. 
Planner Chadwick detailed two options:  moving Costello application to March LTC or 
“bumping” an application on another island to free Planner time to process this 
application. 
LTC agreed to discuss Costello application and then decide action to be taken.

10.2 MA-TUP-2020.2 (Costello)  
Planner Chadwick reviewed application.  Applicants are wanting to purchase a family 
property and use a TUP for Short Term Vacation Rental (STVR) to assist financially. 
Official Community Plan (OCP) currently lacks guidelines for this however Planner 
Testemale has reviewed OCPs from other islands and finds application to be reasonable. 
Applicants have done due diligence and to date there have been no concerns from 
neighbours. 
Trustee Dodds and Trustee Maude supported referral of application to Advisory 
Planning Commission (APC).   
Chair Rogers detailed the procedural processes and the function of the APC.   
After discussion it was determined application could be back on agenda for March. 
The applicants spoke in support of Day Care application going ahead of theirs and 
requested to be notified as to APC meeting to allow them to attend.

that the Mayne Island Local Trust Committee ask staff to refer application MA-
TUP-2020.2(Costello) to the Mayne Island Advisory Planning Commission.

that the Mayne Island Local Trust Committee accept a covenant under section 
219 of the Land Title Act from the registered owners of Lot 1 Section 12 Mayne 
Island Cowichan District Plan EPP72441 and designate the Chair of the Local 
Trust Committee to sign the covenant (MA-SUB-2018.3, 445 Garrick Road). 
               CARRIED 
 
Chair Rogers informed applicant that he will be signing Covenant January 26, 2021 and 
then it awaits Capital Regional District signature. 
Trustee Dodds acknowledged the long process involved with this application and 
congratulated the applicant’s efforts. 
 
10.4 MA-RZ-2020.1 (Mayne Island Housing Rezoning)  
Planner Chadwick presented draft Bylaws and asked for Trustees feedback. Current 
landowner has confirmed request for 3 lots and there are a few documents yet to be 
received.  Additions and modifications to Land Use Bylaws (LUB) and OCP were 
discussed. 
Trustee Dodds added that with 3
rd
 lot there could be 12 housing units and is concerned 
as to setbacks and privacy for neighbours.  There are also concerns regarding 
conservation, septic location and value of amenity rezoning. 
Trustee Maude supported these issues especially setbacks. 
Chair Rogers informed LTC that there are a number of affordable housing projects being 
considered in the Trust area and questioned that there is no reference to “affordable 
housing” – current phrasing is “multi-family rental housing.  Questioned Zoning Bylaw 
reflecting affordable component i.e. “housing subject to a housing agreement”. 
Planner stated could add definition. 
Deborah Goldman, representing MIHS, added the following” 
 Lot will be 3 acres 
 Need to resurvey as owner wants to redesign other 2 lots 
 Wetlands specialist report coming forward next 2 weeks 
 Working with professionals and reports to design according to 
recommendations

11.1 Housing Review Project  
Planner Chadwick expressed that the meeting had gone well, number of participants 
and much information.  Has spoken with Regional Planning Manager and they suggest 
one or two more meetings specific to the following themes: 
1. Density and Water; 
2. Incentives and Alternative Ownership; and

3. Square footage for new buildings and distributed buildings. 
Trustees agreed with themes and spoke to: 
 Need for mapping:  identify size of lots and what’s where; 
 Working with water districts; 
 Minimum lot size; 
 Maximum house size; and 
 Email to water districts to identify number of lots still undeveloped.

12.6 Chair's Report 
Trust Council working on budget – budget consultation has been sent out in addition to 
a Financial Planning Committee survey.  He encouraged public input.  As well a second 
survey has been distributed for public views on rewritten Trust Policy Statement.  Next 
Trust Council will be second week of March.  There will be new Education Sessions soon 
focused on Climate Change and Indigenous point of view.

Trustee Dodds spoke of a recent Fallow Deer Community Outreach meeting hosted by 
CRD.  Rules and regulations for hunting were reviewed, good attendance.  RCMP noted 
First Nations hunters always notify beforehand so if reports of gunshots made, they are 
aware of activity.   
Trustee Maude said there have been many inquiries primarily regarding trail on Village 
Bay Road.  BC Ferries Consultation has begun with reviewing schedules for the Southern 
Gulf Islands – ferry replacing Mayne Queen may improve service for island. 
12.8 Islands Trust Conservancy Report Date November 24, 2020

12.9 ITC Forest Conservation Outreach Campaign - Briefing November 25, 2020  
Chair Rogers noted that briefing was mailed out, with 11 island properties identified, 
regarding protection of Douglas-fir and Hemlock forests. 
13. NEW BUSINESS 
13.1 Advisory Planning Commission Memo

It was Moved and Seconded, 
that the Mayne Island Local Trust Committee request that prior to expiration of 
Advisory Planning Commission members terms of office, staff write to 
commissioners asking if they wish to be re-appointed and also advertise 
for expressions of interest for new commissioners.

13.2 Salt Spring Island STVR Letter 
Chair Rogers reviewed the correspondence which is exploring interest in an inter-island 
meeting regarding development of STVR Policies and Regulations. 
Discussion resolved that Mayne Island has achieved a balance and could contribute to 
session with a representative. 
Chair Rogers will notify Salt Spring Island that Trustee Maude would represent Mayne 
Island should meeting take place. 
 13.3 CRD Trail 
Trustee Dodds stated that CRD has received significant funding to develop trail from 
Miners Bay to Village Bay and surveying has begun.  A number of concerns have been 
raised regarding pin locations and siting would appear to necessitate removal of many 
trees – 70 to 80.  This project originated through the MI Pathways and Trails 
organization and to date there has been no consultation with group or with property 
owners impacted by trail.  What has been staked appears to ignore initial concept.

 It was Moved and Seconded 
that the Mayne Island Local Trust Committee ask Chair Rogers to write to the 
Capital Regional District requesting clarification of tree cutting along proposed 
Miners Bay to Village Bay Trail. 
CARRIED 
 
 Jon Hoff, who has a portion of the trail on his property installed by the Pathways and Trails 
Organization, also raised concerns as to number of stakes on private property.  It is felt that CRD 
is ignoring what has already been done and not communicating with Trail Committee and 
property owners.
