[0:00:26] Trustee Luckham: And this morning, actually, mobile, I find myself in Palau Territory on the Chimenez River, and it's a real pleasure to be here in this particular place, but in the Salish Sea generally, to be able to live and work here and recognize the rich history of this place.

[0:04:52] Trustee Luckham: that the February 3rd encampment minutes were adopted materials for the closed

[0:04:57] Trustee Luckham: March 11th Trust Council session were approved and finally staff were advised

[0:05:02] Trustee Luckham: to develop policy for long-form prosecution of development permits and

[0:05:09] Trustee Luckham: and so we'll just report on those items.

[0:05:13] Trustee Luckham: Although I see you had it listed as 12,

[0:05:15] Trustee Luckham: but I think I'll just add that at the beginning

[0:05:17] Trustee Luckham: of the meeting and then that's dealt with.

[0:06:01] Trustee Patrick: request it's just the wrong word so i'm i don't i don't think i referred to it as a subdivision

[0:06:06] Trustee Patrick: request i just said the subdivision uh application on james island was coming before the north pender

[0:06:14] Trustee Patrick: and so i just think request is the wrong term okay and what bullet what number item number was that

[0:08:03] Trustee Luckham: report, and I'm going to ask the directors to be concise, and we'll continue on through the

[0:08:13] Trustee Luckham: list. So let's kick off with the CAO. Good morning, Russ. Nice to see you here this morning.

[0:08:21] Voice 3: Good morning to committee. Good to be with you. Yeah, I'll just respond to any questions on page

[0:08:27] Voice 3: 20, which outlines the fuel. Most of those items have been completed, or many of them anyway.

[0:08:34] Voice 3: um we've got the electronic meetings then going forward to trust council and um we still have

[0:08:45] Voice 3: item three forestry is appearing later on in this agenda and is appearing um i think that's a theme

[0:08:51] Voice 3: that we're going to be revisiting over the next number of days here including um a request to

[0:08:57] Voice 3: have an amendment to the strategic plan to include forestry so there's that and then so i just respond

[0:09:03] Voice 3: to any questions otherwise i'll move into my cao's report

[0:09:05] Trustee Luckham: anybody questions for the cao no not seeing

[0:09:11] Trustee Luckham: any then let's go to your reports okay

[0:09:13] Voice 3: a few meetings um over the last week since we last

[0:09:17] Voice 3: talked um one we met with um flynn rowe we're having we've managed to get a group of um

[0:09:25] Voice 3: provincial employees from uh forest lions um as well as uh municipal affairs they're called a new

[0:09:33] Voice 3: name now Muni so so I think it's Muni that's how we refer to municipal affairs because they've had

[0:09:40] Voice 3: transportation taken out or housing taken out so um so we met with those uh individuals on a couple

[0:09:48] Voice 3: fairly important matters um one was revisiting the foreshore question um that came of initially

[0:09:59] Voice 3: initially the Cowichan Valley Regional District,

[0:10:02] Voice 3: wanting to have conversations with the Islands Trust

[0:10:05] Voice 3: around jurisdiction and authority on the foreshore.

[0:10:08] Voice 3: And we started to do some work on this.

[0:10:11] Voice 3: There's a longstanding potential gap

[0:10:16] Voice 3: around some of those authorities.

[0:10:21] Voice 3: And the ministry took that in and have been working on it.

[0:10:23] Voice 3: So this was really a rekindling of that conversation.

[0:10:27] Voice 3: um i wouldn't um so i think it's their first entree back post pandemic to um some of these

[0:10:35] Voice 3: matters which we've asked of them and they're doing it um of course it matters quite a bit

[0:10:42] Voice 3: to couch and valley um we made a suggestion we did provide an illegal opinion and i don't know

[0:10:49] Voice 3: whether they're going to take our immediate advice they're in the midst of negotiating or

[0:10:53] Voice 3: or not negotiating, but having conversations with,

[0:10:56] Voice 3: I think there's 13 First Nations that

[0:10:59] Trustee Rogers: need

[0:11:00] Voice 3: to be consulted

[0:11:00] Voice 3: as we look at that, the Cowichan Valley Regional District

[0:11:03] Voice 3: and that foreshore authority.

[0:11:07] Voice 3: So I think that was a good meeting overall.

[0:11:09] Voice 3: Then, of course, later on that afternoon,

[0:11:11] Voice 3: we had the Freshwater Management Strategy meeting.

[0:11:14] Voice 3: It was, I think, around 30 people were in attendance for that meeting.

[0:11:20] Voice 3: And for the first time in my tenure here at the Trust,

[0:11:22] Voice 3: there were cultural knowledge holders First Nations representatives who were just bringing

[0:11:28] Voice 3: their perspectives to an issue that's important to the trust and important to them so I thought

[0:11:33] Voice 3: that was a fairly rare occurrence it wasn't necessarily representation from one particular

[0:11:40] Voice 3: government First Nations government or another but overall contribution was made and

[0:11:46] Voice 3: And despite the limitations of Zoom, I thought that there was some fairly robust conversation going there.

[0:11:53] Voice 3: So that was the first of those meetings.

[0:11:56] Voice 3: And then the last meeting of note was on Thursday around the private managed forest lands.

[0:12:04] Voice 3: We had Garth Weber, Steve Bombar, Patrick Russell, Chris Nichols, and then we had Lisa, myself, David, and Claire.

[0:12:16] Voice 3: and Andrea I'm not going to attempt her last name and that was reopening the discussion around

[0:12:24] Voice 3: the private man is forest lands how's their administered across the trust area a revisiting

[0:12:31] Voice 3: of the requests that were made through the UBCM conversations and if you'll recall we asked for

[0:12:39] Voice 3: that they were in the process of the review and the islands trust asked for

[0:12:46] Voice 3: an ability to step into the process after the first iteration of the report was ready

[0:12:55] Voice 3: to provide more specific comment I think that is substantially the meeting is the start of

[0:13:03] Voice 3: honoring that to some degree well once again I think it's it's a rekindling but they were

[0:13:11] Voice 3: out they asked some very specific questions about um the object the tr um how the trust relates to

[0:13:18] Voice 3: um its forest authorities um you know um community intention um environmental um protection species

[0:13:29] Voice 3: at risk cultural areas um ecological integrity so they were asking some fairly robust questions and

[0:13:36] Voice 3: And it's stay tuned.

[0:13:40] Voice 3: I think we have another meeting in the first couple of weeks of April to further the conversations around what may or may come of these conversations.

[0:13:50] Voice 3: So that's important just to have had it.

[0:13:53] Voice 3: It's taken this since the last UBCM.

[0:13:56] Voice 3: There was a meeting just pre-UBCM in July 20th where we had some of these conversations and we informed you.

[0:14:04] Voice 3: and that's part of us going into the meeting in September but this is the first meeting since and

[0:14:13] Voice 3: we're about to have another meeting on March 18th regarding tree cutting so there's another

[0:14:20] Voice 3: forestry type conversation we're having with the ministry that's it okay

[0:14:25] Trustee Luckham: that's a lot thank you for

[0:14:27] Trustee Luckham: all that any questions for the CAO Dan Rogers thanks

[0:14:33] Trustee Rogers: thanks for that report Russ I'm interested

[0:14:35] Trustee Rogers: interested am i i just want to make sure my my brain's telling me the right thing but i think

[0:14:40] Trustee Rogers: our isn't our position on pmfl mirrored by a number of other local governments around the

[0:14:45] Trustee Rogers: province asking for some ability to regulate pmfl we're not we're not out on our own on this issue

[0:14:52] Trustee Rogers: are we i

[0:14:53] Voice 3: would not think we're out we're out on our own and nor is this new um so they're

[0:14:58] Voice 3: they're contemplating that but i guess what the trust is sort of is moving into the the space of

[0:15:05] Voice 3: saying of separating ourselves from others who who are asking for this because we're saying we're

[0:15:10] Voice 3: special and we're different we have the object and we have a lot of coastal douglas fir and

[0:15:17] Voice 3: for those reasons um while swimming with the tide makes sense um being different from the tide might

[0:15:27] Voice 3: be something we can lean into and i expect later on in this conversation we're going to be having

[0:15:31] Voice 3: Having that later on today when we speak about the tree cutting piece, we'll be considering the same thing.

[0:15:38] Trustee Rogers: Right. And am I correct that these are sort of these are senior staff to senior staff type discussions?

[0:15:44] Voice 3: They are.

[0:15:45] Trustee Rogers: Right. Thank you. They

[0:15:46] Trustee Luckham: are. Anything else for the CEO on that?

[0:15:50] Trustee Luckham: that okay um yeah i think just to add to that i think that personally that the island's trust has

[0:15:59] Trustee Luckham: a much more compelling story than perhaps other governments might have because of the potential

[0:16:08] Trustee Luckham: conflict between an agency of the crown us and um those other authorities that are out there and so

[0:16:16] Trustee Luckham: i'm really pleased that we're engaging on this to have that conversation to come to understanding

[0:16:21] Trustee Luckham: on what that means.

[0:16:23] Trustee Luckham: It's hard to say how it will all unfold,

[0:16:24] Trustee Luckham: but I think the fact that that potential conflict

[0:16:28] Trustee Luckham: is being recognized is a good way to start the conversation.

[0:17:40] Voice 2: working session on the whole issue of project prioritization that's part of its mandate is

[0:17:46] Voice 2: is to look at how local planning services works.

[0:17:49] Voice 2: So that will be happening on March 17th.

[0:17:51] Voice 2: So that will help to inform whatever I report back

[0:17:55] Voice 2: to ECN on this item.

[0:17:56] Voice 2: And item eight is news from the last meeting.

[0:18:01] Voice 2: So Warren Dingman will be working on this

[0:18:05] Voice 2: and reporting back to a future meeting.

[0:18:07] Voice 2: So everything else on the file faction list is complete.

[0:18:10] Voice 2: And I do have a couple of short comments

[0:18:22] Voice 2: okay just want to let you know that we do have a new bylaw administrative position

[0:18:26] Voice 2: uh dion laforte has extent accepted our offer and we'll be starting on march 15th

[0:18:34] Voice 2: this is the administration for bylaw enforcement it also provides support to myself and we've also

[0:18:42] Voice 2: built into this position support to the Victoria office reception and to the southern planning

[0:18:49] Voice 2: team so this will provide some backup and some relief for the administrative pressures on Maple

[0:18:56] Voice 2: especially and Jazz to a smaller extent and then just finally the local planning services we have

[0:19:03] Voice 2: our professional development days three times a year the next one is on April 15th and we do this

[0:19:10] Voice 2: one with the viu students in the planning program at the vancouver university and they're going to

[0:19:18] Voice 2: actually take the lead on planning this one so we're looking at some interactive problem planning

[0:19:24] Voice 2: problem solving so breakout rooms uh probably a plenary session with a presenter as well as some

[0:19:32] Voice 2: student presentations as well um and yeah i'll leave it at that for now just in the interest of

[0:19:38] Voice 2: time and any questions I'll try and answer them.

[0:19:48] Trustee Rogers: arising out of your report but a question I have and if you'd rather talk about it offline we can

[0:19:54] Trustee Rogers: but I thought it would be interesting for us to at some point have this conversation. We recently

[0:20:00] Trustee Rogers: I recently had a scenario where a building permit referral in my local trust area had actually identified an archaeological site on a property.

[0:20:15] Trustee Rogers: And it's just a referral, I know. However, I wondered if there's any discussion going on about, and containing the referral is our standard language.

[0:20:25] Trustee Rogers: which the land owners should be made aware

[0:20:28] Trustee Rogers: of their responsibilities, et cetera, et cetera.

[0:20:31] Trustee Rogers: I wonder if there's any discussion going on

[0:20:34] Trustee Rogers: about what steps we might or should take in those situations

[0:20:40] Trustee Rogers: if we don't think the regional district

[0:20:42] Trustee Rogers: or whomever the referral agency

[0:20:44] Trustee Rogers: is actually doing anything active about the,

[0:20:48] Trustee Rogers: when we actually acknowledge

[0:20:49] Trustee Rogers: that there is actually an archeological site

[0:20:52] Trustee Rogers: on the property in question.

[0:20:54] Trustee Rogers: question and it seems to me that that that may be an evolution we may be looking towards in terms

[0:21:01] Trustee Rogers: of our referral process and our responses and I just wondered I did send you an email about that

[0:21:07] Trustee Rogers: but I know it's been busy and I can send it to you again if it's gone missing but I just wondered

[0:21:13] Trustee Rogers: if you had any thoughts on that.

[0:21:15] Voice 2: Sure and I do have your email and I intend to respond to that

[0:21:19] Voice 2: this week or as soon as possible so I haven't lost it. It's a good question and yes we are it's kind

[0:21:26] Voice 2: of an evolving area it is a referral from the building inspection department so our authority

[0:21:34] Voice 2: is really saying does this meet the land use regulations or not and we've always looked at

[0:21:40] Voice 2: the RAD and had a look at the archaeological data and we've advised the building inspector

[0:21:45] Voice 2: and the landowner in situations where we see something that's close by on the property we've

[0:21:52] Voice 2: been working uh with our senior intergovernmental policy advisor on can we improve this um you know

[0:22:00] Voice 2: can we do more without overstepping our authority and that is definitely an ongoing discussion

[0:22:07] Voice 2: so we don't have the perfect answer to that yet but we are definitely erring on the side of caution

[0:22:15] Voice 2: So if we think the building inspector is not going to do anything, there's nothing we can do about that.

[0:22:22] Voice 2: But we can make sure the First Nation is aware of it, that the archaeological branch is aware of it, and the landowner is aware of it.

[0:22:29] Voice 2: So we're doing everything we can to make sure that everybody's aware of what the issue is.

[0:22:34] Voice 2: But in the end, we still have to provide a report back to the building inspector on whether or not this meets the local zoning.

[0:22:43] Voice 2: and that gets further complicated when there's a development permit so development permits

[0:22:49] Voice 2: for a very specific reason usually environmental protection or form and character or

[0:22:58] Voice 2: protect development from hazard conditions none of the development permits allow us to protect

[0:23:31] Voice 2: site so that is an area that we're definitely focusing on on how can we improve that because

[0:23:45] Voice 2: but still meet the legislative requirement for the trust committee to have to

[0:23:50] Voice 2: consider a permit for the reasons it was established for.

[0:23:54] Voice 2: So it's a very complicated area, but we definitely are working on it.

[0:24:45] Trustee Rogers: that didn't surprise me but I'd never seen one where it had actually been identified on the

[0:24:50] Trustee Rogers: property that was being developed and I and I never but I didn't see anything that said that

[0:24:55] Trustee Rogers: this trust was actually flagging it for anyone other than the regional district and the property

[0:25:02] Trustee Rogers: owner. So I'm glad you're working on it but it did make me uncomfortable to see it.

[0:28:03] Voice 6: trustees to have an opportunity about 10 days to view the website and comment before it goes live.

[0:28:14] Voice 6: Island around the tax insert and the logistics. So I'll be working with their staff to develop a

[0:28:19] Voice 6: draft and we'll bring it to their council for approval in the coming weeks. They mail I believe

[0:28:24] Voice 6: in late April so we've got time to make that happen. We're also in the background here working

[0:28:30] Voice 6: on some communication items including a communication strategy and a corporate identity

[0:33:20] Trustee Rogers: the Gabriel LTC it's sort of a almost a clause by clause review of everything in some detail

[0:33:25] Trustee Rogers: but I'm hopeful that once we finish that work there that will assist on in other areas and

[0:33:33] Trustee Rogers: other islands in terms of a maybe a refreshed template for affordable housing agreement because

[0:33:39] Trustee Rogers: there's been a lot of work and put into it back and forth um i can the only other thing i can

[0:33:45] Trustee Rogers: report is in uh the how sound up katsum area on friday and and sue ellen of course was there as

[0:33:52] Trustee Rogers: well we had our we had an update from the ministry on the cumulative effects um project that's going

[0:33:58] Trustee Rogers: on in how sound it was again tended by probably 30 plus people from around the area and i was

[0:34:07] Trustee Rogers: pleased to see that the um the planner for uh for our area um planner de beno out of out of gabriola

[0:34:16] Trustee Rogers: was present then on so she could understand some of the background work related to

[0:34:21] Trustee Rogers: what's been a long-standing project in the area related to how they better assess

[0:34:28] Trustee Rogers: major projects as they come through our area uh and understand how they impact the and it's it's

[0:38:00] Trustee Patrick: it's important to hear the different perspectives of all the people that came to the table and to

[0:38:07] Trustee Patrick: to bring those tensions to the table because that's where the it's it's exciting when we can

[0:38:12] Trustee Patrick: find you know common ground and resolution and move forward so I thought everybody came with good

[0:38:17] Trustee Patrick: you know spirit and participated openly and said you know what they believed and thought we had

[0:38:24] Trustee Patrick: developers to water purveyors and they were very open and honest in their sharing and so I think

[0:38:31] Trustee Patrick: I think we're off to a good meaningful start on that work and I like I said I'm really grateful

[0:39:31] Trustee Patrick: seven people speak during the public hearing on the short-term vacation rental we had about 19

[0:39:37] Trustee Patrick: attendees that were on the zoom link no one spoke in favor they made a number of changes

[0:39:47] Trustee Patrick: to the bylaw and then it was given a second and third reading and moved on so we'll be seeing it

[0:41:32] Trustee Luckham: the day and how we would characterize the conversations and engagement and involvement

[0:41:38] Trustee Luckham: of trustees and sort of maintaining a very high level of respect and a high level of

[0:43:35] Trustee Fast: I might have been in the in the application they wanted they discovered that they needed to apply

[0:43:59] Trustee Fast: lot and trustees made a number of suggestions and so this is the result which comes up with

[0:44:06] Trustee Fast: what I thought were on behalf of the committee made a bunch of decisions and

[0:44:13] Trustee Fast: I think this is what's in front of us now I think it's a it's good I'll be voting for this.

[0:44:53] Trustee Rogers: when they went to get approval from the province the province said your zoning doesn't allow you

[0:44:58] Trustee Rogers: to have three docks and we went through as chair fast said a process to amend the zoning to provide

[0:45:06] Trustee Rogers: them with the ability to have three docks we took the opportunity to require a a marine ecological

[0:45:13] Trustee Rogers: assessment of these docks which is an interesting step that i don't know what's happened elsewhere

[0:45:18] Trustee Rogers: so they they did that um and uh and then we reduced the size limitations uh for multiple docks

[0:45:27] Trustee Rogers: for this particular piece of property so they're now if the zoning is passed that will allow them

[0:45:33] Trustee Rogers: to have three docks two private one community dock for the nine owners and nine residences

[0:45:40] Trustee Rogers: that are on this particular piece of property on on quito right

[0:48:15] Trustee Rogers: And that they want to be involved in that as a project

[0:48:18] Trustee Rogers: as opposed to the specific referral.

[0:48:23] Trustee Rogers: Glad to hear that, that that's the case.

[0:48:25] Trustee Rogers: So I guess I'm guessing we'll hear some, yeah, here's some.

[0:48:35] Trustee Rogers: what the subdivisions are like in Eastbourne.

[0:48:38] Trustee Rogers: and we're like a mini magic lakes there's 212 uh quarter acre lots in our in eastbourne um it's a

[0:48:46] Trustee Rogers: it's a crazy subdivision but that's the reality and this is the biggest piece of property in

[0:48:52] Trustee Rogers: eastbourne um and uh happened to be developed as a as a co on a co-op model and they don't allow

[0:49:01] Trustee Rogers: they don't allow roads on their property so that's why there's docks because they don't allow they

[0:49:07] Trustee Rogers: don't allow prop they don't allow vehicles onto their property

[0:49:10] Trustee Luckham: okay well we can have a conversation

[0:49:12] Trustee Luckham: offline about that it certainly sounds like an interesting property so um if there's no other

[0:51:43] Trustee Rogers: section to after the town hall i.e the next morning and i know that two of you have

[0:51:50] Trustee Rogers: it may have a view about that.

[0:51:53] Trustee Rogers: And I don't have a particular strong view one way or another.

[0:51:57] Trustee Rogers: I can see that there's a lot of people that want to speak,

[1:02:15] Voice 3: So David's ably prepared us a report.

[1:02:18] Voice 3: And I just want to provide the context by which you have it in front of you.

[1:02:21] Voice 3: Normally on a Monday before Trust Council, we don't have, we try to avoid having substantive pieces of work come because, Lord, the substantive pieces of work will be coming in the next few days.

[1:02:31] Voice 3: But you'll recall that Raincoast came to the Islands Trust and made a presentation.

[1:02:39] Voice 3: And during that presentation, at the end, they made a series of recommendations.

[1:02:42] Voice 3: And one of those recommendations was for the Islands Trust to pursue municipal tree cutting authority under Section 8.

[1:02:49] Voice 3: much like municipalities have and that passed so we now find ourselves the request was to ask the

[1:02:59] Voice 3: minister for that authority you know second thought might have been to receive this kind

[1:03:08] Voice 3: of reporting first and then consider the various implications of a strategy to extend the island's

[1:03:15] Voice 3: Trust after many many years of course authority over forest lands in some way but we are dealing

[1:03:23] Voice 3: with what we've been dealt with. Also you're aware that there's a variety of different initiatives

[1:03:30] Voice 3: at the Islands Trust around forestry that aren't combined in a complete strategy. Nevertheless we

[1:03:36] Voice 3: got a response back from the minister saying let's meet on March 18th and find out what you

[1:03:41] Voice 3: want to do with regard to tree protection? So we've got a short timeline and the challenge

[1:03:48] Voice 3: I think we've got, and in fact we could have some of this conversation now and some of it in fact

[1:03:52] Voice 3: we could go in camera if you wished, because it's the basis of potentially a negotiation with the

[1:03:58] Voice 3: province, is what are you wanting to communicate and ask of the minister on March 18th? And I'm

[1:04:09] Voice 3: actually a little less concerned about the the material in this report which is excellent um

[1:04:14] Voice 3: but that is informing chair luckham and anyone else who would be attending this meeting on march

[1:04:20] Voice 3: 8th with the minister the deputy minister and the assistant assistant deputy minister

[1:04:25] Voice 3: to delve into really what would be our applications of this on the ground

[1:04:30] Voice 3: right now we can only offer this we don't have a full project that we could present to the minister

[1:04:37] Voice 3: So I think the question is, there's two or three different approaches. What are the approaches that we'd like to take going into that meeting? And so we've got this supplemental material behind us.

[1:04:51] Voice 3: so I just wanted to say that I'm almost more concerned about process here as much as content

[1:04:59] Voice 3: and the process is today we're going to discuss this a little bit I expect so I think this is

[1:05:04] Voice 3: probably a 10 or 15 minute conversation because this will be your last time to discuss it

[1:05:09] Voice 3: a scheduled opportunity to discuss it before that meeting we would then take some notes and provide

[1:05:16] Voice 3: um following trust council where we've asked people to have this roundtable conversation

[1:05:22] Voice 3: we would condense those notes and claire myself and david would work to get something on monday

[1:05:27] Voice 3: or tuesday in front of chair luckham and anyone else you designate to go into that meeting

[1:05:30] Voice 3: there's two or three different approaches that we could take as we do it um and that's that so

[1:05:38] Voice 3: um you know we're doing some quick work on a long-term and important topic because the ministry

[1:05:46] Voice 3: is starting to respond to our um requests so i could talk more but um um i could turn it over

[1:05:54] Voice 3: for to david for a brief overview and i think what he's going to say in his overview is that

[1:05:59] Voice 3: um certainly when raincoast made their presentation it was uh you know this is an option

[1:06:07] Voice 3: um i don't think what was provided was an in-depth analysis and this is the beginnings

[1:06:13] Voice 3: of a more in-depth analysis whether this power this power with other powers or other powers

[1:06:20] Voice 3: would be the best way to get to where the islands trust wants to wants to go and indeed where does

[1:06:26] Voice 3: the islands trust want to go with regards to um control over forestry lands so uh david uh yes

[1:06:35] Voice 2: thank you a

[1:06:36] Voice 3: brief overview yeah

[1:06:37] Voice 2: through the chair i just want to highlight uh realize that you only

[1:06:41] Voice 2: received this late friday and it wasn't written until friday so there's any typos in there my

[1:06:46] Voice 2: apologies the thing i'd like to just comment is that the restrictions on the um the tree cutting

[1:06:55] Voice 2: bylaws or tree protection bylaws is very similar to the limitations for development permits so

[1:07:02] Voice 2: this is not going to solve the issue of pmfl land or woodlots or crown lands and in the islands

[1:07:09] Voice 2: trust area that i think is important because crown lands includes road right-of-ways so all the road

[1:07:15] Voice 2: right-of-ways on the islands would not be subject to the tree protection bylaw we're in a municipality

[1:07:23] Voice 2: the municipality generally owns all the road right-of-ways mostly they own the parks mostly

[1:07:28] Voice 2: or the regional district does so the the bylaws in the municipalities would apply to their road

[1:07:35] Voice 2: right-of-ways. The exception of things like numbered highways, like Highway 17, Highway 1,

[1:07:41] Voice 2: those kinds of things. So that's the one thing I just want to get across to you. The second

[1:07:47] Voice 2: is there's a lot of overlap with what you can do with the tree protection by-law in a development

[1:07:51] Voice 2: permit area. The difference is a tree protection by-law is not limited by the justification and

[1:08:00] Voice 2: the reasons for an establishment of a development permit area. So in a DPA for example you would have

[1:08:06] Voice 2: a requirement to protect a hazard area for example or to protect the ecosystem like an

[1:08:16] Voice 2: endangered species and that could be a reason then you set up your tree protection for that purpose

[1:08:22] Voice 2: or your vegetation protection. Under the Section 8 by-law you could have the protection for any reason

[1:08:29] Voice 2: and in municipalities it's generally for a variety of reasons some of them are that the trees form

[1:08:36] Voice 2: part of the character of the neighborhood or the trees are reducing the heat in the neighborhood

[1:08:42] Voice 2: they're providing shade or just for aesthetic reasons that they want the trees to be maintained

[1:08:48] Voice 2: so it's pretty much more open on the rationale and the bylaw itself unlike a development permit

[1:08:56] Voice 2: it could have a variety of means in it on how you do those protections so if you look at a tree

[1:09:02] Voice 2: protection bylaw and the city of victoria has a very extensive one there's a whole variety of

[1:09:09] Voice 2: things that they've included in there and in certain situations you require a permit to do

[1:09:15] Voice 2: something such as pruning certain types of trees or certain trees of certain size or locations

[1:09:21] Voice 2: So it can get really, really complicated.

[1:09:25] Voice 2: And then I think the final thing I'd like to comment on is that it would require some administration.

[1:09:32] Voice 2: This is not something that could be done by the planners.

[1:09:37] Voice 2: It's not really planning. This is tree protection.

[1:09:40] Voice 2: So you would likely need some kind of expertise in that area, such as an arborist or somebody who knows about trees and what the effects of some of these policies are.

[1:09:55] Voice 2: And then, of course, a whole system to administrate. If it's a permitting process, then a means to take in the permits, to process the permits and issue the permits.

[1:10:05] Voice 2: And these would be done at a staff level with an appeal to the local trust committee, for example, if a person disagreed with the staff decision.

[1:10:17] Voice 2: So those are a few things to keep in mind.

[1:10:20] Voice 2: So the briefing just kind of highlights if we had the authority, then how we would use it or what kinds of things we would have to do.

[1:10:33] Voice 2: I've included an appendix which is an excerpt from a 2020 report to trust council

[1:10:40] Voice 2: and the information is compiled mainly by uh and uh because you're uh our regional planning manager

[1:10:48] Voice 2: at the time in the north and this kind of just takes you through a little bit more detail about

[1:10:53] Voice 2: the benefits the risk and a few other things so I thought that was worth including in here

[1:10:59] Voice 2: so i'll leave it at that and try and answer some questions but this as the ceo indicated is to help

[1:11:05] Voice 2: to provide you a little bit more context about the practical implications of taking on that section

[1:11:13] Voice 2: 8 authority to regulate trees and the limitations around it thank you okay

[1:12:30] Trustee Luckham: just want to add that i think that that ross you and i at a minimum um and maybe david should have

[1:12:36] Trustee Luckham: a conversation before going into the minister and whomever is going to join us for that meeting so

[1:12:47] Trustee Luckham: interested is is in supporting us with this but we also need to advise them that this is a work

[1:13:52] Voice 3: voice a couple of different strategies for actually having that conversation um uh you know

[1:15:39] Trustee Fast: okay so it'd be just good to uh thank you okay and uh i just wanted to put forward a few

[1:15:46] Trustee Fast: few thoughts um is that i uh i think a um what i've seen when this idea of a tree um cutting

[1:15:55] Trustee Fast: bylaw comes forward on bowen which it has a couple of times is it gets a lot of pushback partly for

[1:16:01] Trustee Fast: the reasons that are in this report but mostly because people are thinking about the alders

[1:16:05] Trustee Fast: growing quickly on their property and uh how am i going to keep it out of the um from taking down

[1:16:11] Trustee Fast: my driveway or fallen on my roof. However, I think I can see the need for something like this

[1:16:24] Trustee Fast: regarding villages. Snug Cove, for example, where the ferry comes in, the tall evergreen trees have

[1:16:32] Trustee Fast: been slowly decreasing over time especially as buildings get bigger and the character of the

[1:16:43] Trustee Fast: cove of the landing place of the gateway to the island is changing so that might be a development

[1:16:50] Trustee Fast: permit area that could use some tree cutting and bylaw in some of the islands that I'm more

[1:16:57] Trustee Fast: familiar with as well as Bowen. When there's a big project like is coming to us as a delegation on

[1:17:07] Trustee Fast: Denman Island which is a affordable housing project with 20 units big block of a building

[1:17:13] Trustee Fast: will we have any way to make sure that if perhaps a big tree or two were left

[1:17:21] Trustee Fast: large developments like Kate's Hill or Cowan Point here on Bowen Island which took up

[1:17:26] Trustee Fast: big chunks of the island I remember one of those back in the day like 20 years ago was

[1:17:31] Trustee Fast: uh described as being a um uh a neighborhood within a forest but right now it looks a lot more

[1:17:40] Trustee Fast: like um Caulfield in West Vancouver you know um so when those things come forward um big

[1:17:50] Trustee Fast: developments and then the bit about individual trees or iconic trees or I know there's some

[1:17:56] Trustee Fast: protection already for trees that have a heron nest in them but uh eagle nesting trees other

[1:18:02] Trustee Fast: kinds of uh particular trees that bring something special are part of the unique amenity of an

[1:18:08] Trustee Fast: island some might say can we protect those it would be good to have the tools i think it would

[1:18:13] Trustee Fast: be good to get the tools thank you anybody

[1:18:17] Trustee Luckham: else uh just my screen here trustee patrick over to you

[1:18:26] Trustee Patrick: kind of look at this as sort of a chicken and egg thing um it it's clear that we have to do a

[1:18:39] Trustee Patrick: of you know we have lots of uh neighborhoods like magic lake and others that are very dense

[1:18:46] Trustee Patrick: suburban subdivisions and that would be good to that I know I live in a subdivision that has a

[1:18:57] Trustee Patrick: covenant that you can't cut a tree within a certain amount of meters to the property line

[1:19:01] Trustee Patrick: that's greater than a certain diameter and you can't cut species scary oak trees at all

[1:19:08] Trustee Patrick: but so I would almost look at the meeting as if there's zero appetite to go this direction then

[1:19:15] Trustee Patrick: then that's a good sign to know from the province,

[1:19:18] Trustee Patrick: then we shouldn't be doing the work.

[1:19:19] Trustee Patrick: So I think that, to me, it would be showing them

[1:19:23] Trustee Patrick: that we would be committed to wanting to do this work

[1:19:25] Trustee Patrick: before proceeding too deep into the conversation.

[1:19:32] Trustee Patrick: But if they're, like I said, if they have zero interest,

[1:19:35] Trustee Patrick: then we don't need to even consider doing that work.

[1:19:38] Trustee Patrick: So I think there is some benefit to getting that clarity

[1:19:43] Trustee Patrick: without having to you know and then um if if trust council is serious about this then you're right it

[1:19:50] Trustee Patrick: needs to become a project and there is a lot of work that would have to be done to to do that so

[1:19:54] Trustee Patrick: um that's sort of how i think is maybe just it's a fact-finding mission of where the interest lies

[1:20:01] Trustee Patrick: before we go and ask the question of do we make this a project yeah

[1:20:37] Trustee Rogers: And a lot of times people put their hand up and say,

[1:20:39] Trustee Rogers: say what are you going to do about this you know why are you you know what's the trust going to do

[1:20:45] Trustee Rogers: and we often bear the brunt of that and i know trustee patrick vice chair patrick would of course

[1:20:50] Trustee Rogers: be very familiar with that as it as it raised its head uh on salt spring and as as constant

[1:20:58] Trustee Rogers: communication and i've had it a bit on my island and um and i recognize that there are limitations

[1:21:03] Trustee Rogers: limitations to this. I mean, if I had a choice, I would rather have some resolution to the PMFL

[1:21:09] Trustee Rogers: issue than this, but that, I'm not sure it's a choice. So I'm going to just be a bit naive for

[1:21:16] Trustee Rogers: a moment and ask that the, knowing the limitations that are there, we're just going to ask this

[1:21:21] Trustee Rogers: question is, why would our message be any more sophisticated than, look, give us another tool

[1:21:29] Trustee Rogers: in our toolbox. And because we all know that if any tree cutting process was started by a local

[1:21:38] Trustee Rogers: trust committee who have the legislative authority to do this, impose this sort of thing, there's

[1:21:44] Trustee Rogers: going to be a robust local process to define what it looks like, how it looks, what the limitations

[1:21:52] Trustee Rogers: are. If you introduce it on Thetis or Salt Spring or Maine or anywhere, there's going to be an

[1:21:58] Trustee Rogers: an incredibly robust local conversation so so i guess i guess maybe it's a bit of a naive

[1:22:05] Trustee Rogers: congress question but my question would be why why is our message any more sophisticated than that

[1:22:11] Trustee Rogers: good

[1:22:13] Trustee Luckham: question dan and i see the cao is nodding his head um go ahead sir well

[1:22:22] Voice 3: this conversation you're starting to land on um um a reinterpretation of a desire of trustees

[1:22:45] Voice 3: a tree on someone's property but i have talked with them about landscape level clear-cutting

[1:22:52] Voice 3: industrial work on you know above a certain size and you don't have an ability to affect that and

[1:23:04] Voice 3: you want some ability to to keep the continuity and all of the integrity across the whole

[1:23:14] Voice 3: region in terms of forestry so yeah I think this is even this is informative just these

[1:23:22] Voice 3: these these ideas right here okay

[1:23:26] Trustee Luckham: um i noticed that my battery is starting to wane here and um

[1:23:32] Trustee Luckham: just want to comment that um obviously one of the questions that may or may not be posed to you

[1:23:38] Trustee Luckham: hudson pillar is um how does this fit in with the legislative amendments that we've already asked

[1:23:43] Trustee Luckham: for um are we risking or deferring any of that work in light of this or is this a relatively

[1:23:49] Trustee Luckham: as Dan has characterized we're just asking for another tool is this actually a relatively easy

[1:23:55] Trustee Luckham: request it was not on our list before so we haven't gotten opinion uh from yeah I

[1:24:50] Voice 3: amending the language to include first nations in part three which is supported by the province

[1:25:14] Trustee Fast: protected parcels, or other crown or forestry parcels, that connectivity part of protecting process ecological processes and ecosystems, rather than just fragmented places, I think is significant as well.

[1:25:33] Trustee Fast: And I just want to flag on. I don't know, Bowen here we've got.

[1:25:36] Trustee Fast: but I didn't even talk about it because it's so fresh is angst around

[1:25:41] Trustee Fast: cutting one tree down in the cove. Well, actually a bunch of trees,

[1:25:45] Trustee Fast: but one big Douglas fir that had been left and then later had to come down

[1:25:51] Trustee Fast: for the fire hall and man, am I catching it on the trail.

[1:25:54] Trustee Fast: So I think people's hearts are more with trees now than they perhaps used to

[1:26:00] Trustee Fast: be, but even individual trees can make a big difference in a community.
