[0:00:16] Chair Fast: so I want to begin by acknowledging that we're with respect we're meeting on and around the
[0:00:26] Chair Fast: Salish Sea and the traditional territories of the Comox and the Qualicum First Nations.

[0:00:44] Chair Fast: I'll say some few extra things that might seem tedious but please bear with us because we're
[0:00:50] Chair Fast: working in this unusual format and uh i'd like to introduce um the other uh denman island local

[0:03:21] Chair Fast: keep a atmosphere of um safety and respect especially because we're being uh we're being

[0:03:35] Chair Fast: I think. And so I appreciate everybody helping us have a healthy and respectful public meeting.

[0:04:28] Chair Fast: uh conducting community business and um we've got a lot on the agenda today we've got a break
[0:04:34] Chair Fast: around 12.05 and the agenda is at the website you can see it there on the screen for anybody
[0:04:40] Chair Fast: who's watching and I just want to reiterate again this is a we're in a participatory democracy
[0:04:48] Chair Fast: and we're all passionate about our homes and about our islands and and our visions for the
[0:04:56] Chair Fast: future and so I'd just like to ask everybody to bear with each other participatory democracy means
[0:05:03] Chair Fast: we're we're here as your elected representatives so please direct your
[0:05:08] Chair Fast: comments and suggestions and recommendations to us as your elected
[0:05:12] Chair Fast: representatives and we've also got with us our professional staff the expertise
[0:05:17] Chair Fast: that they bring with us is what we need to be able to conduct this community
[0:05:20] Chair Fast: business and then there's the public that's you and that are out there in
[0:05:26] Chair Fast: uh attendee uh category i can see 12 of you now and um we've got four delegations as well to get
[0:05:35] Chair Fast: through this morning uh so we're um we're a jam-packed agenda of democracy and i'm hoping
[0:05:41] Chair Fast: that we can all in that spirit um bear with each other and uh and try to um have a constructive
[0:05:48] Chair Fast: active, um, atmosphere that we can all work together in paddling forward. So, um, thank you

[0:07:32] Chair Fast: like to start um trustee critchley would you like to start uh
[0:07:39] Trustee Critchley (probable): certainly i can do that so um
[0:07:44] Trustee Critchley (probable): i've got quite an extensive list here because uh it seems i've been involved in a few different
[0:07:49] Trustee Critchley (probable): things which are kind of optional. So I'll start off with following our January meeting. January
[0:07:58] Trustee Critchley (probable): 22nd, I attended the special meeting of the Trust Programs Committee. This is a subcommittee of
[0:08:05] Trustee Critchley (probable): Trust Council, which is looking at revising the trust policy statement, which is kind of our
[0:08:13] Trustee Critchley (probable): overall constitutional document for the trust. It's a very important document, and we have been
[0:08:19] Trustee Critchley (probable): been engaged in a lot of extra meetings with regard to this. I'm also part of a subcommittee
[0:08:26] Trustee Critchley (probable): which deals specifically with affordable housing. We've actually broadened the mandate of that to
[0:08:32] Trustee Critchley (probable): be housing generally, but suffice to say it's a very important topic and we spend a lot of time on
[0:08:38] Trustee Critchley (probable): it. So there is that. On January 28th, I attended a meeting with Bain Sound
[0:08:45] Trustee Critchley (probable): around Lambert Channel Steering Committee,
[0:08:48] Trustee Critchley (probable): which my colleague Daniel Arbour is also part of that.
[0:08:54] Trustee Critchley (probable): And in fact, he is our chair on that subcommittee.
[0:09:00] Trustee Critchley (probable): We are moving forward with that organization
[0:09:03] Trustee Critchley (probable): to keep it as hopefully a permanent fixture in this area
[0:09:07] Trustee Critchley (probable): to bring together various interests
[0:09:10] Trustee Critchley (probable): and discuss basically a lot about preservation and protection as well.
[0:09:17] Trustee Critchley (probable): So our business there recently has been to set up things for permanency,
[0:09:25] Trustee Critchley (probable): including the establishment of a website and an email address,
[0:09:29] Trustee Critchley (probable): all that sort of housekeeping stuff.
[0:09:32] Trustee Critchley (probable): We've got a great committee, including representatives from provincial government.
[0:09:38] Trustee Critchley (probable): so I continue on with that. On February 1st I had a meeting of what we're calling the select
[0:09:47] Trustee Critchley (probable): committee. Sounds a bit pretentious to be a member of a select committee but I am and this is
[0:09:55] Trustee Critchley (probable): a committee struck to deal with a management review for the trust. There was a motion passed
[0:10:06] Trustee Critchley (probable): asked at Trust Council to conduct a management review.
[0:10:11] Trustee Critchley (probable): And so that involves engaging the services of a consultant,
[0:10:17] Trustee Critchley (probable): a professional advisor.
[0:10:19] Trustee Critchley (probable): And in order to do that, we are coordinating with the BC BID,
[0:10:24] Trustee Critchley (probable): which is an arm of the provincial government,
[0:10:27] Trustee Critchley (probable): which is charged with obtaining various services and products for
[0:10:34] Trustee Critchley (probable): government.
[0:10:34] Trustee Critchley (probable): So we've had numerous meetings with representatives of that organization and amongst ourselves to discuss the terms of reference for this.
[0:10:45] Trustee Critchley (probable): And I have to say it's worked very well.
[0:10:49] Trustee Critchley (probable): Our terms of reference, which started out, are not the terms of reference which have been now put forward.
[0:10:57] Trustee Critchley (probable): They've been amended substantially with input from staff.
[0:11:01] Trustee Critchley (probable): staff, our CAO, Russ Hotzenpiller, is a member of that select committee and has been very helpful
[0:11:08] Trustee Critchley (probable): in giving us his perspective. So that continues on. Just to give an update on that,
[0:11:14] Trustee Critchley (probable): there are other meetings of that committee that I've been involved in, but the current status is
[0:11:20] Trustee Critchley (probable): that the bid package has now been completed, went to BC Bid, has been posted on their site,
[0:11:28] Trustee Critchley (probable): and will be open for submissions till the early part of April.
[0:11:34] Trustee Critchley (probable): I think it was somewhere around April 6th.
[0:11:35] Trustee Critchley (probable): I don't have the date just noted down here.
[0:11:39] Trustee Critchley (probable): Also around February 1st, I don't have the exact date,
[0:11:42] Trustee Critchley (probable): I was involved in a Zoom meeting with BC Shellfish Growers Association
[0:11:49] Trustee Critchley (probable): who hosted an information session really on what they call their code of practice,
[0:11:58] Trustee Critchley (probable): Their Shellfish Farm Environmental Protection Plan, which is essentially a program that they have put together to try and ameliorate effects on the environment by establishing standards.
[0:12:15] Trustee Critchley (probable): standards. It's a voluntary program. They don't have the ability to go out and check on these
[0:12:22] Trustee Critchley (probable): things physically or to punish people, but they do keep track and they require people to file
[0:12:30] Trustee Critchley (probable): an annual report, essentially. So there's a lot more information on that on their website. It's
[0:12:41] Trustee Critchley (probable): just come into effect. February 5th, I had another meeting of the Trust Programs Committee.
[0:12:48] Trustee Critchley (probable): The 16th of February, I had a Bain Sound Steering Committee.
[0:12:53] Trustee Critchley (probable): The 16th, I also had another Select Committee meeting. On the 17th of February, I was involved
[0:13:01] Trustee Critchley (probable): with a presentation by Zoom on the Connected Coast. This is an initiative by a group called
[0:13:09] Trustee Critchley (probable): City West to look at high-speed internet service for Denman and Hornby in particular. They're
[0:13:18] Trustee Critchley (probable): looking, they're involved in other places as well, but the meeting was focused on the Hornby and
[0:13:24] Trustee Critchley (probable): Denman needs for higher speed internet. Very interesting discussion. These people feel that
[0:13:32] Trustee Critchley (probable): that they can get this project underway.
[0:13:36] Trustee Critchley (probable): Much to my surprise, it's not to be one of these Wi-Fi type of transmission systems,
[0:13:43] Trustee Critchley (probable): but rather cable, fiber optic cable, all the way to everybody's house,
[0:13:51] Trustee Critchley (probable): which they said, even for Denman, that most houses would qualify for this.
[0:13:59] Trustee Critchley (probable): There'll be a few that are too remote to make it practical,
[0:14:01] Trustee Critchley (probable): but it'll continue david can i
[0:14:04] Chair Fast: ask you to move a little quicker because we've we're running out of

[0:14:12] Trustee Critchley (probable): um so the rest are just uh select committee on march the
[0:14:18] Trustee Critchley (probable): 1st uh our community information meeting on march the 2nd on march the 5th they had the community
[0:14:25] Trustee Critchley (probable): community meeting hosted by the CVRD and the Comox First Nation, 9th through 11th. I had an
[0:14:33] Trustee Critchley (probable): exhaustive three days of trust council by Zoom. And on March 11th was also a ferry advisory
[0:14:42] Trustee Critchley (probable): committee meeting, which I was unable to attend, conflicted somewhat with the trust council.
[0:14:49] Trustee Critchley (probable): So the main thing from that was a shocking bit of news that we had been led to believe that the Hornby Ferry and the Denman Ferry would also be enlarged in the near future.
[0:15:04] Trustee Critchley (probable): But for the Hornby people, they are looking at 2034 before there is a replacement for the Koloki.
[0:15:12] Trustee Critchley (probable): Anyway, discussions continue on that topic.
[0:15:15] Trustee Critchley (probable): That's my report.

[0:15:25] Trustee Busheikin (probable): That's kind of a staggering amount of work and things you're involved in.
[0:15:31] Trustee Busheikin (probable): And I thank you for that.
[0:15:35] Trustee Busheikin (probable): So I, too, attended the Comox First Nation and CVRD meeting with all elected officials
[0:15:44] Trustee Busheikin (probable): from the whole Comox Valley, even school trustees, which was nice.
[0:15:48] Trustee Busheikin (probable): And there were two amazing presentations about DRIPA, which is the provincial legislation to implement the United Nations Declaration on the Rights of Indigenous Peoples in BC.
[0:16:01] Trustee Busheikin (probable): And it's not just a theory, it's a reality and it will be a reality.
[0:16:06] Trustee Busheikin (probable): So it was great. And I did send the links to those presentations to all trustees.
[0:16:11] Trustee Busheikin (probable): I recommend them. And in fact, I will put them on the Facebook page because they're available for the public.
[0:16:18] Trustee Busheikin (probable): Very interesting. And for anyone who wants to follow this stuff, important. Things are actually changing. I also attended the Trust Council. It was very intense and very full. And I think we did a lot of good and important work.
[0:16:37] Trustee Busheikin (probable): work, but I still haven't really caught up on my rest since then. I attended several
[0:16:44] Trustee Busheikin (probable): financial planning committee meetings and mainly to get that budget ready, which we
[0:16:50] Trustee Busheikin (probable): adopted at Trust Council. And I continue to chair the regional planning committee. We've
[0:16:55] Trustee Busheikin (probable): had, I think, two meetings since the last and the meeting, I'm not sure. And we have
[0:17:00] Trustee Busheikin (probable): one tomorrow. We're looking at revising policies on application fees and how those
[0:17:06] Trustee Busheikin (probable): are handled uh fees haven't gone up on most islands in oh i think over a decade uh and that's
[0:17:14] Trustee Busheikin (probable): causing some concern um so uh we're looking at you know how to make that uh happen but in an
[0:17:23] Trustee Busheikin (probable): equitable way in a fair way so uh that's what makes it complicated i think and it is very detailed
[0:17:29] Trustee Busheikin (probable): health um work um so uh and um also i participated in the first meeting of the trust wide water
[0:17:40] Trustee Busheikin (probable): sustainability strategy steering committee round table which is a group that's working on creating
[0:17:47] Trustee Busheikin (probable): a a freshwater uh strategy for the whole trust area this is very much in response to
[0:17:53] Trustee Busheikin (probable): with concerns about water and aquifers
[0:17:57] Trustee Busheikin (probable): and the water table due to climate change.
[0:18:03] Trustee Busheikin (probable): And this was a great meeting.
[0:18:06] Trustee Busheikin (probable): We're working in a bit of a different way.
[0:18:08] Trustee Busheikin (probable): So we've included, it's not just a meeting of trustees.
[0:18:13] Trustee Busheikin (probable): There's water system operators and developers
[0:18:18] Trustee Busheikin (probable): and people who like engineers
[0:18:22] Trustee Busheikin (probable): who you know work with viha and and clients to get water infrastructure in place but also there
[0:18:29] Trustee Busheikin (probable): i think three maybe four uh indigenous knowledge keepers who shared uh some of their experience
[0:18:38] Trustee Busheikin (probable): and views on groundwater and how we use it and how we manage it and all of that created a really
[0:18:43] Trustee Busheikin (probable): rich discussion and i think good things will come out of it um there's quite a number of
[0:18:49] Trustee Busheikin (probable): more meetings over the next few weeks and then on Dem and I continue to participate in monthly
[0:18:54] Trustee Busheikin (probable): meetings of the um there's a ad hoc committee that formed called DIRCON um uh to sort of trade
[0:19:03] Trustee Busheikin (probable): information about adapting to COVID and that continues to be a great uh group director
[0:19:09] Trustee Busheikin (probable): is there um and I continue to have many phone calls and emails with constituents about a variety
[0:19:15] Trustee Busheikin (probable): of issues and also just for anyone listening i am available for outdoor sit-downs uh one-on-one
[0:19:23] Trustee Busheikin (probable): with constituents have i've done a few of them to talk about issues just call me or email me okay
[0:19:30] Chair Fast: thank you trustee bruce shaken and uh we're running a little late but i don't want to
[0:19:34] Chair Fast: we we're happy to have with us daniel abour our our cvrd director who um we're glad to hear from

[0:19:44] Voice 2: thanks for having me um and uh i'll i'll be uh i'll try to be brief both
[0:19:49] Voice 2: for your sake and mine i'm double booked i'm supposed to be downstairs right now but it's all
[0:19:53] Voice 2: good really happy to be here for this update i'll i'll do rapid fire um around a few items uh that i
[0:20:01] Voice 2: think of interest to the allen trust and denman residence so i think some of the news people
[0:20:06] Voice 2: People already know the CVRD was able to free up $100,000 a year for the next three years to continue and grow the Hornby bus, but also add a pilot project on Denman Island.
[0:20:19] Voice 2: So from a trust perspective, I know in the next few months, there's a committee that's been set up and I think a lot of interest in the community, but it might mean that they might have to look at bus stops and things like that.
[0:20:32] Voice 2: So there might be some engagement with the Islands Trust around some of these things.
[0:20:36] Voice 2: The Cross Island Trail, the opening of the Corcoran Stairs, I think is just fantastic.
[0:20:43] Voice 2: It's good feedback from people.
[0:20:44] Voice 2: And in typical local government fashion, we're going to officially open it at the end of April.
[0:20:49] Voice 2: But people have already been using it for two months.
[0:20:53] Voice 2: I love it when you have an opening well after the fact.
[0:20:57] Voice 2: I think Trustee Creechley did a good job talking about the internet.
[0:21:03] Voice 2: Internet, it is a project of the Strathcona Regional District is holding the bag on that one.
[0:21:08] Voice 2: And we recently, last month, authorized 140,000 investment to secure the landing sites for Hornby and Denman.
[0:21:15] Voice 2: And our CVRD staff is currently working with City West for a major application for 90% funding for last mile infrastructure for the islands.
[0:21:25] Voice 2: Should we be successful, that would be amazing.
[0:21:28] Voice 2: If not, we'll try again.
[0:21:34] Voice 2: good words on the Bain Sound Ecosystem Forum as well from Trustee Critchley and I'd like to say
[0:21:39] Voice 2: that I really want to thank Allen's Trust because they've really held that initiative together for
[0:21:45] Voice 2: the last few years and it's really good to see I mean we have Adams as the secretary and we have
[0:21:51] Voice 2: the BC Shellfish Growers as a treasurer and it's a true multi-stakeholder group that is
[0:21:58] Voice 2: is, you know, working on contentious issues
[0:22:01] Voice 2: where sometimes you're on separate sides of the fence,
[0:22:04] Voice 2: but everyone is working so well
[0:22:07] Voice 2: and it's good to see the kind of constructive approach
[0:22:09] Voice 2: in that group.
[0:22:10] Voice 2: But I really want to thank Arlen Strass
[0:22:12] Voice 2: who kind of picked up the baton from WWF
[0:22:15] Voice 2: and we're currently working and hooking the CVRD
[0:22:17] Voice 2: for the long-term on this as well as a supporter.
[0:22:22] Voice 2: And as Trustee Boucherkin mentioned,
[0:22:25] Voice 2: the COVID group to me has been amazing.
[0:22:28] Voice 2: great leadership in there and for me it's been particularly useful to try to connect the dots
[0:22:34] Voice 2: when there's need so I would say the exchange of information over the last 12 months directly led
[0:22:39] Voice 2: to CVRD making some investments around the child care center the covered space hall supports so
[0:22:47] Voice 2: that that committee has been really good identifying needs in the community not only
[0:22:51] Voice 2: for now but for the long term in terms of you know building back better and all these different
[0:22:57] Voice 2: themes that we're exploring in that group. And the last one probably that I'm saving is
[0:23:05] Voice 2: around housing. So we know that in all communities in British Columbia right now,
[0:23:10] Voice 2: affordable housing projects are critical. The BC housing plan is well underway since

[0:23:47] Voice 2: I think time is of the essence.
[0:23:49] Voice 2: sense um you know we we know that provincial federal governments are heading into uh an era
[0:23:54] Voice 2: of deficit so i think even at the cvrd we're trying to to maximize um our push right now to
[0:24:00] Voice 2: get projects done and and in case i'll instruct i'm sure your planners have seen that uh but just
[0:24:06] Voice 2: in case something we talked about is on may 7th uh minister josie has born they've released a new
[0:24:12] Voice 2: fund to help local governments speed up uh the development approval processes um and so local
[0:24:18] Voice 2: Local government can apply to it by May 7th.
[0:24:21] Voice 2: This may not be a solution to all our short-term needs,
[0:24:27] Voice 2: but for the long-term, that whole question around
[0:24:29] Voice 2: how do we get those affordable housing to market in a timely way,
[0:24:33] Voice 2: it was good to see the province step up and provide a fund for that.

[0:31:21] Voice 9: for 25 years.
[0:31:23] Voice 9: I've raised two children on Denman
[0:31:25] Voice 9: and provided multiple essential services.
[0:31:27] Voice 9: services I contribute positively to my community and I keep Denman weird every day when I first
[0:31:34] Voice 9: submitted my delegation package I thought I would have 10 minutes to speak do I because I received
[0:31:39] Voice 9: an email saying I only get five is it five or ten if I may ask well
[0:31:44] Chair Fast: it's between uh seven and ten
[0:31:47] Chair Fast: so okay great all right
[0:31:49] Voice 9: so I just all right so um yeah so let's get to this is jam-packed full
[0:31:56] Voice 9: of housing goodness uh slide one you'll see i'm just going to go quickly through my slides you'll
[0:32:02] Voice 9: see at the top that the islands trust and local trust committee are already aware through the
[0:32:07] Voice 9: northern housing needs assessment uh done in 2018 that we have a need for a minimum of 80 units of
[0:32:14] Voice 9: affordable housing on denman island these 80 units are required to meet the housing needs of
[0:32:20] Voice 9: residents who already live here no one knows precisely how many people on denman island live
[0:32:26] Voice 9: and precarious or unlawful housing, extrapolating from the 80 affordable homes needed, as per that
[0:32:33] Voice 9: report, gives us approximately 13% of our island residents living in unlawful or precarious housing.
[0:32:42] Voice 9: These are folks who are already living here on Denman. They're tucked away out of sight
[0:32:46] Voice 9: while they continue to provide essential services to and mingle comfortably with
[0:32:51] Voice 9: the other residents of our community together all of us keeping denman beautifully weird every day
[0:32:57] Voice 9: if you jump ahead to the bottom of slide two it shows that the northern housing needs assessment
[0:33:04] Voice 9: of 2018 recommends that quote each island review their ocp to ensure that there are supportive
[0:33:10] Voice 9: policies for the development of safe secure appropriate and affordable rental housing
[0:33:15] Voice 9: at the top of slide three uh the comment that there are many reasons people live in precarious
[0:33:22] Voice 9: housing on Denman Island, despite the threat of bylaw enforcement. Over to the bottom of slide
[0:33:28] Voice 9: four, in reference to DE 2019-056, a standing policy, which is basically a partial moratorium.
[0:33:38] Voice 9: This means that bylaw enforcement can continue in cases where there's more than one complaint
[0:33:43] Voice 9: or more than one unlawful dwelling on a property. The fact is that unlawful dwellers already have
[0:33:51] Voice 9: homes here on denman island some are well established rentals other are illegal land shares
[0:33:58] Voice 9: and other demonstral configurations while many of those unlawful homes exist and have some
[0:34:05] Voice 9: done so for years they are not legal under current land use bylaws which brings us to slide five
[0:34:13] Voice 9: in light of the aforementioned as far as you know what i sent on march 5th or sorry second was that
[0:34:20] Voice 9: 540 members of the Denman Island community signed a petition. Those numbers in the intervening two
[0:34:28] Voice 9: weeks have gone up. We now have 600 members of the Denman Island community who have signed the
[0:34:35] Voice 9: petition asking the Denman Island Local Trust Committee to immediately put a moratorium on
[0:34:40] Voice 9: enforcement of land use bylaws that could result in eviction in any and all housing on Denman
[0:34:46] Voice 9: Island and to maintain that moratorium until the following are accomplished. A, holding an official
[0:34:54] Voice 9: community plan review in consultation with the representative cross-section of residents,
[0:34:59] Voice 9: including vulnerable renters, complete a targeted review of housing regulations in the Land Use
[0:35:05] Voice 9: Bylaw 186, and craft relevant and community-centered land use bylaws that support and prioritize
[0:35:12] Voice 9: affordable housing options, sustainable and environmentally sensitive approaches to any
[0:35:17] Voice 9: development, and reflect the needs of a healthy and diverse community in light of changing
[0:35:22] Voice 9: demographics and the impact of socioeconomic conditions on rural housing security.
[0:35:29] Voice 9: The mandate of the Islands Trust is not to provide housing.
[0:35:33] Voice 9: That housing is already being provided in creative and most often earth-loving ways
[0:35:38] Voice 9: by Denman residents and now by community initiatives
[0:35:42] Voice 9: like Pepper Lane and Denman Green.
[0:35:45] Voice 9: The mandate of the Islands Trust is to preserve and protect
[0:35:48] Voice 9: our island environment while making land use bylaw decisions
[0:35:51] Voice 9: that balance the wishes and needs of our community.
[0:35:55] Voice 9: As you yourself stated in your opening remarks of this meeting,
[0:36:00] Voice 9: Chair Fast, we all value people feeling safe at their homes.
[0:36:05] Voice 9: At least half of the community of Denman Island
[0:36:07] Voice 9: and wants a full moratorium against enforcement
[0:36:10] Voice 9: on all people's homes.
[0:36:12] Voice 9: We need to align our land use bylaws
[0:36:14] Voice 9: with the realities of how we actually live.
[0:36:17] Voice 9: Make earth smart decisions
[0:36:18] Voice 9: and prepare for the rocky future to come.
[0:36:22] Voice 9: We can feed ourselves as a community.
[0:36:25] Voice 9: We can survive and we can thrive.
[0:36:28] Voice 9: But not if 13% of us aren't safe at home.
[0:36:31] Voice 9: We need each other.
[0:36:33] Voice 9: That is how community works.
[0:36:35] Voice 9: That is why we're all here on this rock.

[0:37:42] Voice 1: introduce you to the new site for Denman Green. If you were meeting in person on Denman, it would
[0:37:49] Voice 1: be just across the road, therefore two minutes from the school and downtown stores, 10 minutes
[0:37:55] Voice 1: to the ferry. The site is compact but large enough to comfortably accommodate our originally
[0:38:02] Voice 1: planned 20 units of housing, along with all necessary infrastructure. Bordered by hardtop
[0:38:09] Voice 1: roads and hydro on two sides, site development costs will be relatively modest. The site also
[0:38:16] Voice 1: has a water well rated at three gallons a minute. Our rezoning application was sent to the Northern
[0:38:23] Voice 1: Trust Office on March the 4th, 11 days ago, along with an application for sponsorship of the
[0:38:30] Voice 1: the application fee. We would request your support for both of these. Before our application is
[0:38:38] Voice 1: initially considered by you, we hope at your next meeting on May 4, we plan to have completed
[0:38:44] Voice 1: a hydrogeological report, including a 72-hour well test and impact assessment of nearby wells,
[0:38:52] Voice 1: a wastewater assessment, an environmental report, and finally a detailed site plan.
[0:38:59] Voice 1: Having received conditional approval from Island Health for treating rainwater for potable purposes, we will also be developing an engineer-certified water plan, illustrating a year-round sustainable supply with the water well being a supplementary low-flow source.
[0:39:21] Voice 1: Finally, we can report that Denman Works Economic Enhancement Society, having consulted with business owners in downtown Denman, supports the rezoning from commercial to residential, support that has so far been universally voiced by the community at large.

[0:39:47] Voice 1: soon as possible and to bringing Denman Green a first step closer to reality. Thank you, Madam

[0:40:38] Voice 10: the Local Trust Committee. Basically, my purpose today is to summarize areas of concern within
[0:40:45] Voice 10: proposed Bylaw 228 in light of the need to protect wetlands and watershed areas.
[0:40:53] Voice 10: Protection that proposed Bylaw 228 will make difficult, if not impossible. Essentially,
[0:41:00] Voice 10: this bylaw would alter the official community plan, the OCP, to create a sustainability-free
[0:41:06] Voice 10: free area for land-zoned agriculture over half the island
[0:41:11] Voice 10: and including nearly every wetland area.
[0:41:15] Voice 10: The proposed bylaw is an unfortunate step to implementing the farm plan.
[0:41:21] Voice 10: Islanders who served on the steering committee created this farm plan vision statement,
[0:41:26] Voice 10: and I quote,
[0:41:27] Voice 10: an island where we feed each other abundantly because farming is a viable
[0:41:33] Voice 10: and valued foundation of our sustainable community.
[0:41:37] Voice 10: Note the word sustainable.
[0:41:40] Voice 10: The steering committee was allocated roughly four pages of the 95-page farm plan.
[0:41:47] Voice 10: I was a member of the steering committee until I resigned in protest of the Ministry of Agriculture's dominance over the final document.
[0:41:55] Voice 10: In our existing OCP, agriculture comes under the heading of sustainable resources.
[0:42:01] Voice 10: The proposed changes systematically list agriculture as separate from sustainable resources and go so far as to introduce agriculture as the lead item in the LCP list of guiding objectives.
[0:42:16] Voice 10: In addition, Policy 8 reads that land from the, sorry, Policy 8 reads, and I quote, the Local Trust Committee should only support applications for exclusion of land from the Agricultural Land Reserve where there is significant benefit for the greater community of Denman Island, a very high bar wherein environmental values are swept aside.
[0:42:43] Voice 10: side. And I refer you to the agenda package, page 19, for my annotated copy of the proposed
[0:42:50] Voice 10: Bylaw 228. It's pretty complex to read. And on page 22, which is page 5 of the document,
[0:42:59] Voice 10: you'll see a flat Denman Island with two lakes. No topography, no wetlands, no streams.
[0:43:06] Voice 10: Deep Swamp, which is my specific example, and it's an example that fits with all other areas
[0:43:13] Voice 10: of pretty well, is an example of 228's shortcomings.
[0:43:18] Voice 10: It doesn't exist on the map.
[0:43:21] Voice 10: Deep Swamp belongs to one of many complex water systems dependent on watersheds created
[0:43:26] Voice 10: by the topography of Denman Island.
[0:43:29] Voice 10: These water systems collect and distribute water to households, farms, forests, and critters
[0:43:35] Voice 10: that these need to survive.
[0:43:38] Voice 10: They are among nature's rainwater catchment cisterns, far more reliable and generous than any man-made hunk of plastic.
[0:43:48] Voice 10: In the posted map, and staff said they would get it posted and hopefully it's visible,
[0:43:54] Voice 10: the orange outlines areas zoned agriculture where deep swamp is located.
[0:44:00] Voice 10: This potential sustainability-free area encompasses the Madigan seasonally flooded field,
[0:44:06] Voice 10: the overflow ditch that historically drained and flooded the Madigan potato field,
[0:44:12] Voice 10: Deep Swamp, the two-pronged wetland lake,
[0:44:15] Voice 10: and a significant portion of Valensbrook, which is a designated salmon stream.
[0:44:21] Voice 10: My farm is located in the area in red, which backs onto Deep Swamp.
[0:44:26] Voice 10: I would like to dedicate a forest buffer along Deep Swamp.
[0:44:30] Voice 10: This effort will fail if Bylaw 228 is adopted.
[0:44:34] Voice 10: opted, and that's an example of some of the kinds of spin-offs. There would be no significant
[0:44:40] Voice 10: benefit to the greater community, and in fact, most islanders would be unfamiliar with deep
[0:44:45] Voice 10: swamp, which lacks recreational access. At present, owners of land in the agricultural
[0:44:51] Voice 10: zone can drain and alter wetlands. Proposed bylaw 228 would enshrine and extend that right.
[0:45:00] Voice 10: The Island Trust was created in part to protect the complex diversity of finite island ecosystems.
[0:45:07] Voice 10: In contrast, the responsibility of the Ministry of Agriculture to support and expand agriculture.
[0:45:14] Voice 10: The Trust has a by far more difficult task.
[0:45:18] Voice 10: I ask the Local Trust Committee to, one, set aside consideration of proposed Bylaw 228
[0:45:25] Voice 10: until protection of watershed and wetland areas is in place.
[0:45:29] Voice 10: Two, give priority to completing accurate mapping of water systems on Denman Island
[0:45:36] Voice 10: using island knowledge and expertise.
[0:45:39] Voice 10: Existing mapping misses wetlands and streams.
[0:45:42] Voice 10: For example, the key wetland that feeds to Roach Farm is not mapped
[0:45:48] Voice 10: because Google Earth can't see it with all the trees.
[0:45:51] Voice 10: The groundwater study undertaken by the trust staff may record fluctuations in groundwater,
[0:45:57] Voice 10: water, but surface water does not become groundwater if it's channeled into the ocean.
[0:46:03] Voice 10: Three, work with the Ministry of Transportation and Infrastructure regarding alternatives
[0:46:08] Voice 10: to its use of ditches and culverts to drain surface water, including wetlands.
[0:46:14] Voice 10: Four, encourage the farming community and the community in general to steward wetland
[0:46:20] Voice 10: areas.
[0:46:21] Voice 10: Exclusion from the ALR is not the only solution.
[0:46:24] Voice 10: and five support the mandate of the trust by recognizing that farming on denman is
[0:46:32] Voice 10: and can continue to be a compatible with island scale the farming encompasses productive gardens
[0:46:39] Voice 10: as well as income producing farms and that food sovereignty is a valid community goal thank you

[0:47:50] Voice 8: priorities and objectives and land use bylaw regulations unfortunately that hasn't happened
[0:47:56] Voice 8: and I'm just here today to encourage the trustees to put as a top priority item possibly to be able
[0:48:02] Voice 8: to accomplish it with what little time is left in this term but i i'm hoping that by the fall we
[0:48:08] Voice 8: should be able to sit down in our hall face to face and really talk for a good long time about
[0:48:14] Voice 8: the current uh policies objectives and regulations in our land use bylaw i also wholeheartedly
[0:48:20] Voice 8: support the actions requested by ryan's petition it's a lot of work that she's put into that and
[0:48:26] Voice 8: in particular i think she also reiterates the fact that we need a full review of our housing
[0:48:31] Voice 8: regulations that hasn't been done for gosh so many years and I think it's time that so much
[0:48:37] Voice 8: has changed since I moved here in 1993 people were living illegally then people are living
[0:48:43] Voice 8: illegally now and they will continue to live illegally and thus we could do a better job of

[0:50:44] Trustee Busheikin (probable): And I think that I think what we need to do is figure out where we want to go with it.
[0:50:49] Trustee Busheikin (probable): And then it will become clear if it needs to be a full OCP review or focus more on the LUV. I don't think, I think that that will all get dealt with once we get clear. And I will be talking more about some thoughts about that when we get to talking about our work program and our top priorities.
[0:51:05] Trustee Busheikin (probable): and the only hold up I think as has been said many times is simply um capacity and I think we may be
[0:51:13] Trustee Busheikin (probable): talking about that later as well um and if we want staff to focus mainly on housing applications
[0:51:21] Trustee Busheikin (probable): or pull back from those to start putting a amendment project underway um so and then in
[0:51:30] Trustee Busheikin (probable): In terms of a moratorium, I mean, it was discussed at the last meeting, and I will say for people
[0:51:36] Trustee Busheikin (probable): who don't know this, that until the public health order is lifted, there is a full moratorium
[0:51:43] Trustee Busheikin (probable): trust-wide on enforcing on housing, and maybe when the public health order is lifted, we
[0:51:51] Trustee Busheikin (probable): can have another discussion about that.
[0:51:54] Trustee Busheikin (probable): but that that for now um that uh that is in place and i just also will say just for clarity that
[0:52:02] Trustee Busheikin (probable): doesn't mean that um uh property owners might not be alerted if a bylaw enforcement complaint
[0:52:11] Trustee Busheikin (probable): comes in or that there might not you know there might be a site visit to see what's going on and
[0:52:15] Trustee Busheikin (probable): And this is part of, well, I mean, it's mainly so that the property owner knows what's going on and has time to strategize and understand that there's concern, but also the bylaw enforcement officer can see if there's validity in the complaint or not, which I think is important for everyone to know.
[0:52:37] Trustee Busheikin (probable): but that doesn't mean that enforcement would go ahead with requests to vacate any dwellings.
[0:52:47] Trustee Busheikin (probable): And Harleen Holm, I just wanted to thank you and ask if we could have that in writing,

[0:53:21] Trustee Critchley (probable): community in a timely manner. And that's because of institutional problems. It's not because of
[0:53:28] Trustee Critchley (probable): a planner or even our planners in the northern region it's uh it's an intensely frustrating
[0:53:36] Trustee Critchley (probable): aspect and it's experienced not just by denman but by a number of the islands and in fact
[0:53:43] Trustee Critchley (probable): it may be of interest to trust council just last week we had we had one trustee in particular
[0:53:51] Trustee Critchley (probable): particular, bring a motion to have more staff dedicated to working on projects and not on
[0:54:00] Trustee Critchley (probable): applications because of a frustration that the overall policies of that island, policy changes
[0:54:08] Trustee Critchley (probable): were not being paid any attention to because of lack of staffing resources. Now, that motion failed

Because we do have in our guidelines that we might limit the number of delegates, but that's difficult to do for me as a chair when I am not as familiar with how relevant everything is, how important, how timely it all is to the community.

[1:01:30] Chair Fast: when there may be other delegations requests come in for that one or do we prefer to handle it like

[1:01:47] Chair Fast: as long as they're uh solid and they're uh uh constructive and all those good things
[1:01:55] Chair Fast: um and proceed like we would be today so i'm wondering if um um local trustees have any

[1:56:44] Trustee Critchley (probable): concept. I was in favor of it because of the potential for saltwater intrusion, and I thought
[1:56:52] Trustee Critchley (probable): it would be a comfort to the neighbors and so forth to know that this was being monitored in a
[1:56:56] Trustee Critchley (probable): scientific way. But at that time, I think I probably put forward the motion to make that
[1:57:05] Trustee Critchley (probable): part of the covenant. But at no time then was it mentioned that there would be some sort of annual
[1:57:11] Trustee Critchley (probable): reporting other than to provide the data, the raw data to the honest trust. Now we're finding out
[1:57:19] Trustee Critchley (probable): from recent, I guess, the community information meeting that this would involve an annual expense
[1:57:27] Trustee Critchley (probable): to hire a professional to complete this report. And although there was no specificity as to the
[1:57:36] Trustee Critchley (probable): amount that it would cost but it was said between 100 and 200 dollars per hour and that it would
[1:57:43] Trustee Critchley (probable): involve somewhere between a couple of hours to you know a day sort of thing of a professional's time
[1:57:49] Trustee Critchley (probable): well i'm really concerned about the imposing an unreasonable financial burden on a community
[1:57:57] Trustee Critchley (probable): organization that raises funds through bake sales to do this, A, indefinitely, which is
[1:58:07] Trustee Critchley (probable): as proposed, or at all. So I'm thinking either I would strike that last part,
[1:58:14] Trustee Critchley (probable): not about providing raw data. I think that's reasonable. But presenting a professional
[1:58:22] Trustee Critchley (probable): professional certified report annually at substantial expense, I think that should be
[1:58:30] Trustee Critchley (probable): struck. Or an alternative, and I'm saying this for trustees to consider in the meantime,
[1:58:35] Trustee Critchley (probable): would be to put some limit on it for, say, three years. And then it's just providing raw data.

Trustee Busheikin provided information on the following meetings attended: Meeting of Comox Valley elected officials including from Comox Valley Regional District (CVRD, School District, and K'ómoks First Nation; Financial Planning Committee; Regional Planning Committee; Trust-wide Water Sustainability Steering Committee Round Table; Denman Island ad hoc group coordinating and sharing information regarding COVID- 19 response; Numerous phone calls and emails with constituents. 2.2 Chair's Report Chair Fast reported that her work included attending Executive Committee and Islands Trust Conservancy meetings. 2.3 Electoral Area Director's Report Director Arbour shared information on the following topics: CVRD has allocated $100,000 for the next 3 years for the Hornby Island bus and the Denman Island bus pilot project; The Kirk Road stairs addition to the Cross Island Trail has been well received; An update on the Connected Coast internet connectivity funding; Baynes Sound Ecosystem Forum multi-stakeholder group; The Island group discussing COVID-19 issues has helped identify needs; Grants from BC Housing are being secured and a new fund has been established to be used by local governments to assist in accelerating the approval process for affordable housing projects; CVRD Board has been asked to write a letter of support for Denman Green and will be considering requests from Denman Housing Association (DHA) and Denman Community Land Trust Association (DCLTA) to assist with development costs for their affordable housing projects. 3. TOWN HALL Support was expressed for the Agricultural Land Reserve Use Regulation that allows farmers to have up to 10 sleeping units; the Local Trust Committee (LTC) was asked to allow Denman Island farmers to accommodate up to 10 campsites and not to require a Temporary Use Permit for this purpose. 4. DELEGATIONS 4.1 Riane da Silva regarding Bylaw Enforcement and Housing Riane da Silva presented information on Denman Island housing needs, with the full address included in the LTC meeting agenda package. She expressed concern that even with the partial moratorium on bylaw enforcement of unlawful dwellings, vulnerable people living in precarious housing are being stressed. ADOPTED Denman Island ADOPTED 3 Local Trust Committee Minutes March 16, 2021 She presented a petition, signed by over 600 residents, asking the LTC to place a moratorium on enforcement resulting in eviction until: an Official Community Plan (OCP)review is conducted; a targeted review of Land Use Bylaw (LUB) housing regulations is completed; supportive LUB bylaws are created. 4.2 Simon Palmer for Denman Housing Association regarding New Plans for an Affordable Housing Rezoning Application Simon Palmer introduced the proposed new site for a Denman Green affordable housing project, noting that the plans are to accommodate 20 units of housing. He reported that a rezoning application has been submitted along with an application for sponsorship of the application fee; and he provided a summary of reports and plans in progress for this proposal. 4.3 Harlene Holm regarding Suggested Amendments to Bylaw 228 (Farm Plan) Harlene Holm addressed concerns with proposed Bylaw No. 228 that will make it difficult to protect wetlands and watershed areas on Denman Island. An annotated copy of the bylaw has been included in the LTC meeting agenda package. She requested that the LTC: set aside consideration of proposed Bylaw No. 228 until protection of watershed and wetland areas is in place; give priority to completing accurate mapping of water systems on Denman Island using Island knowledge and expertise; work with the Ministry of Transportation and Infrastructure regarding alternatives to its use of ditches and culverts to drain surface water including wetlands; encourage the farming community and the community in general to steward wetland areas; support the mandate of the Trust by recognizing that farming on Denman is and can continue to be compatible with island scale, that farming encompasses productive gardens as well as income-producing farms and that food sovereignty is a valid community goal. 4.4 David Graham regarding Bylaw Enforcement of Illegal Dwellings David Graham supported the petition created to request a moratorium on bylaw enforcement of unlawful dwellings. He reported that it was determined approximately eight years ago, when he was a Local Trustee, that the housing regulations did not align with the way people were choosing to live at that time; and it was thought that a full review of housing would occur, however, it has not. He encouraged the LTC to place a full review of Housing Regulations on the Top Priorities list in order to allow for consideration and community consultation on the topic. A Trustee responded that a review of LUB Housing Regulations is currently on the Top Priority list; however noted that a Standing Resolution to prioritize use of staff resources on affordable housing applications makes advancing other worthwhile projects difficult. They advised that a trust-wide moratorium on bylaw enforcement of unlawful dwellings is in effect until COVID-19 health and safety issues are resolved. APPLICATIONS, REFERRALS AND BYLAWS 7.1 DE-SUB-2019.2 (Nielsen) - Staff Report Planner Dubyna summarized the Staff Report that asks the LTC to consider accepting a water treatment covenant requiring water treatment to meet potable drinking water ADOPTED Denman Island ADOPTED 5 Local Trust Committee Minutes March 16, 2021 standards in accordance with the Denman Island LUB, as a condition of a proposed six lot subdivision. A Trustee confirmed that the Islands Trust Senior Freshwater Specialist had reviewed the information and had provided feedback; and that the covenant would cover all lots to ensure that potential purchasers of these lots are informed of the water quality issues in the area. DE-2021-020 It was MOVED and SECONDED, that the Denman Island Local Trust Committee, in respect of application DE-SUB-2019.2, accept a water treatment covenant under Section 219 of the Land Title Act from the registered owners of THE EAST ½ OF SECTION 28, DENMAN ISLAND, NANAIMO DISTRICT, EXCEPT PARTS IN PLANS VIP87737 AND VIP88293 (PID 006-660-495), attached as Attachment 1 to this Staff Report, dated March 16, 2021, and designate the Chair and additional Trustee of the Local Trust Committee to sign the covenant. CARRIED 7.2 PROPOSED BYLAW NOS. 233 and 234 (DE-RZ-2017.1) - consideration of further readings Planner Zupanec reported that the Public Hearing held on March 15, 2021 resulted in a small number of input for Trustees to consider relating to the proposed Bylaws and advised of the following: there are no staff recommendations for changes to Bylaw No. 233 (OCP); and the LTC may consider second and third readings at this time; a number of minor changes for Bylaw No. 234 have been identified for LTC consideration prior to advancing the Bylaw. DE-2021-021 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 233, cited as “Denman Island Official Community Plan, 2008”, Amendment No. 1, 2019”, be read a second time. Trustees commended members of Denman Community Land Trust Association and owner of the parent property for their work to bring this project to this point; the need for this housing was acknowledged and it was suggested that this project helps to meet that need in a sustainable way. A Trustee added that the project has had great support from the community; all comments received were appreciated; pointing out that this application needed to take precedence over the issue of removing land from the Agricultural Land Reserve given the need for affordable housing opportunity on Denman Island and that this parcel does not have high agricultural possibility. CARRIED DE-2021-022 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 233, cited as “Denman Island Official Community Plan, 2008”, Amendment No. 1, 2019”, be read a third time. CARRIED ADOPTED Denman Island ADOPTED 6 Local Trust Committee Minutes March 16, 2021 DE-2021-023 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 233, cited as “Denman Island Official Community Plan, 2008”, Amendment No. 1, 2019”, be forwarded to the Secretary of the Islands Trust for approval of Executive Committee. CARRIED DE-2021-024 It was MOVED and SECONDED, that Denman Island Local Trust Committee forward Bylaw No. 233, cited as “Denman Island Official Community Plan, 2008”, Amendment No. 1, 2019”, to the Minister of Municipal Affairs and Housing for approval. CARRIED Planner Zupanec identified two changes to proposed Bylaw No. 234 (LUB) for LTC consideration: the applicant has requested that in Table 8 the maximum gross floor area of a seniors affordable dwelling unit be amended from 60m 2 to 65m 2 ; Plan No. 1 be replaced with a plan that has the correct citation for the Affordable Housing Zone and removal of the “Conceptual Plan Only” text. DE-2021-025 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 234, cited as “Denman Island Land Use Bylaw, 2008, Amendment No. 1, 2019”, be amended by: 1. Table 8, item 9: the floor area be increased from 60m 2 to 65m 2 ; 2. Plan No. 1 be replaced with the following Plan and the words “conceptual plan only” be removed in the title of “Plan No. 1”. CARRIED ADOPTED Denman Island ADOPTED 7 Local Trust Committee Minutes March 16, 2021 DE-2021-026 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 234, cited as “Denman Island Land Use Bylaw, 2008, Amendment No. 1, 2019”, as amended, be read a second time. Trustees spoke to concerns raised that the R4 Zone might allow for large-scale multi-unit, urban style developments, by responding that this zone gives guidance, limits and requirements for any future rental multi-unit housing to ensure that they meet community needs; and this zone is an aid to further future affordable housing applications. CARRIED DE-2021-027 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 234, cited as “Denman Island Land Use Bylaw, 2008, Amendment No. 1, 2019”, be read a third time. CARRIED DE-2021-028 It was MOVED and SECONDED, that Denman Island Local Trust Committee Bylaw No. 234, cited as “Denman Island Land Use Bylaw, 2008, Amendment No. 1, 2019”, be forwarded to the Secretary of the Islands Trust for approval of Executive Committee. CARRIED Planner Zupanec identified changes to the Restrictive Covenant requested by the applicant, noting that minor modifications to the Restrictive Covenant might be considered at this time or at a future meeting without delaying the advancement of Bylaw Nos. 233 and 234: Clause (a) - allowing flexibility in the wording to permit vegetative buffer and fencing changes if approved by the Agricultural Land Commission; Clause (c) – consideration of a change in the wording to standardize the requirement to require fencing suitable to mitigate noise and dust to include the three other neighbouring properties that abut the project; Clause (d) – modification to extend the existing clause to create a buffer area for the regeneration of natural vegetation that was specific to one property to include the other three properties that abut the development. Trustees discussed possible amendments to the Restrictive Covenant with the following noted: A reconsideration of the requirement for an annual professional analysis of the well datalogger data was suggested to mitigate the expense that DCLTA would incur to meet that requirement; alternative suggestions included annual reporting of raw data to Islands Trust, or a graduated approach limiting the annual requirement of a professional analysis to a number of years; Suggestions from staff might be useful regarding construction and maintenance of fencing, including consideration of the noise abatement aspect. ADOPTED Denman Island ADOPTED 8 Local Trust Committee Minutes March 16, 2021 DE-2021-029 It was MOVED and SECONDED, that the Denman Island Local Trust Committee amend “Section 2 No Build” of the draft restrictive covenant for DE-RZ-2017.1 (DCLTA- Pepper Lane) by: 1. clause (a) – by adding the words “or amendments thereto approved by the ALC” after “..contained in the ALC Resolutions;” 2. clause (c) – by replacing the clause with “it constructs a solid fence suitable to mitigate noise and dust along both lengths of the driveway of the subject property and the full extent of the southern property lines of the subject property.” 3. Clause (d) – by replacing the clause with “it establishes an area for the regeneration of the natural vegetation to create a buffer along the full extent of the southern borders of the subject property adjacent to the neighbouring properties along Denman Road. CARRIED DE-2021-030 It was MOVED and SECONDED, that the Denman Island Local Trust Committee request staff to work with the applicant and address concerns with adjacent property owners with concerns to clauses (c) and (d) and return alternative language with respect to the Restrictive Covenant for Local Trust Committee consideration. CARRIED DE-2021-031 It was MOVED and SECONDED, that the Denman Island Local Trust Committee request staff to review clause 6 (c)(Water Champion Covenant Annual Report) of the draft Restrictive Covenant and to provide alternative suggestions to reduce or eliminate the burden of expense on the applicant. In speaking to the motion, a Trustee expressed concern with the financial burden to the applicant to complete the annual professional analysis of the datalogger data requirement, noting that the analysis is an amenity for the community; and suggested that some term of years might be more appropriate; the raw data collected and reviewed by the applicant would bring attention to any saltwater intrusion for mitigating measures to be taken. CARRIED Planner Zupanec advised that the applicant has requested a change to the Housing Agreement text, amending the affordable housing stipulation for maximum rent to reflect a similar formula of BC’s Shelter Aid for Elderly Renters. ADOPTED Denman Island ADOPTED 9 Local Trust Committee Minutes March 16, 2021 DE-2021-032 It was MOVED and SECONDED, that the Denman Island Local Trust Committee Bylaw No. 239, cited as “Denman Island Housing Agreement Bylaw No. 239, 2020”, Section E. Rental rates, subsection i., be amended by adding the following to the end of the clause: “provided ‘rent’ does not include any sums received by way of institutional rent subsidy or rent assistance available from time to time.” A Trustee requested clarification of the requested change and Chair Fast invited the applicant to respond. Doug Olstead explained that this change allows the additional funding from the government to be accessed. CARRIED A Trustee commented that the possibility of expanding the definition of qualified occupants in the Housing Agreement to include indigenous people was raised at the Special Meeting held last night and is beginning to be included in other Trust areas. DE-2021-033 It was MOVED and SECONDED, that the Denman Island Local Trust request staff bring back a draft amendment to the Housing Agreement to specify that the qualified occupant definition be expanded so that it includes but is not limited to on-reserve and off-reserve status and non-status and/or self-identified Indigenous, Inuit, or Native people. In speaking to the motion, a Trustee noted that this approach has been proposed on the advice of the Islands Trust Senior Intergovernmental Advisor. A Trustee commented that there are questions regarding some of the elements of the proposed definition; however it is supported in the spirit of reconciliation. CARRIED Chair Fast invited the applicant to speak and Doug Olstead’s comments including the following: DCLTA has recognized that the issue raised at the Community Information Meeting, regarding aging in place and becoming incapacitated, has not been adequately addressed in their tenant selection procedure. They would like to add an additional paragraph to the end of the Housing Agreement to stipulate that the owner may amend the tenant selection process from time to time in order to adapt when necessary. DE-2021-034 It was MOVED and SECONDED, that the Denman Island Local Trust Committee request staff to work with the applicant to add a phrase regarding the ability to adapt the tenant selection procedure. Trustees requested that staff provide the Staff Report and recommendation to Trustees in advance of the next Local Trust Committee meeting for their review of the suggested wording to address the issue to everyone’s satisfaction. CARRIED 8. LOCAL TRUST COMMITTEE PROJECTS ADOPTED Denman Island ADOPTED 10 Local Trust Committee Minutes March 16, 2021 8.1 Farm Plan Implementation Status Update – Memorandum Planner Zupanec summarized the Memorandum that provides a status update on the project. She advised that a new affordable housing application is forthcoming, and that staff will bring a more in-depth report on the Farm Plan Implementation project as resources allow. Trustees commented with the following noted: The Standing Resolution that gives priority to processing applications for affordable housing projects is still supported and the challenging task to balance resources and move ahead with projects that the community considers important was acknowledged; It was questioned whether the provincial grant for local governments reported by CVRD Director Arbour might be utilized by the Denman Island LTC to assist in the effort to advance affordable housing initiatives; Staff will discuss with the Islands Trust grant manager and report back. 9. CORRESPONDENCE (Correspondence received concerning current applications or projects is posted to the LTC webpage) 9.1 Letter dated January 21, 2021 from Hornby & Denman Community Health Care Society regarding Transportation Issues A Trustee advised that Denman Works!, the Denman Island Community Economic Enhancement Society, might be informed of this project as it has formed a transportation committee that may have overlapping issues and interests in this Active Transportation Network Planning project. 9.2 Email dated February 22, 2021 from W. Northcut regarding Permit Transparency Trustees discussed the suggestion to post all Siting and Use Permits on the Trust website. They identified difficulties with that approach and noted that contacting staff with questions is an efficient option that is always available. 9.3 Letter dated March 6, 2021 from B. Engleson regarding Support for Denman Housing Society New Proposal Received. 10. NEW BUSINESS 10.1 Denman Island Cross island Trail - for discussion Trustee Busheikin proposed that a letter be drafted encouraging the CVRD to hold public consultation prior to continuing with the next phase of the Cross Island Trail to determine community priorities that may involve preference for other recreational initiatives than the trail. ADOPTED Denman Island ADOPTED 11 Local Trust Committee Minutes March 16, 2021 DE-2021-035 It was MOVED and SECONDED, that the Denman Island Local Trust Committee send a letter signed by the Chair to the Comox Valley Regional District encouraging further public consultation before moving ahead with the next phase of the Denman Island Cross Island Trail. A Trustee and the Chair commented that it might be appropriate to bring this to Director Arbour as it is a Comox Valley Regional District project; and observed that the Cross Island Trail initiative fits with various Islands Trust policies concerning climate action and alternative transportation options. A Trustee noted as background information, that the Parks and Greenways Plan is a Comox Valley Regional District initiative, and supported discussing this topic directly with Director Arbour.
