[0:00:47] Trustee Patrick: begin with acknowledging how fortunate we are to be meeting in the traditional territories of the

[0:00:51] Trustee Patrick: the Coast Salish people, but I'm also so happy to see so many other organizations that are

[0:01:01] Trustee Patrick: taking the effort to reach out and work with Indigenous people. For example, the Salt Spring

[0:01:09] Trustee Patrick: Arts Council holds arts craft every year and invites artists from just the southern Gulf

[0:01:15] Trustee Patrick: Islands, and this year they made special effort to invite Indigenous artists, but through the

[0:01:20] Trustee Patrick: the traditional territories of the Coast Salish people,

[0:01:22] Trustee Patrick: not just the Southern Gulf Islands.

[0:01:24] Trustee Patrick: And I really appreciate organizations

[0:01:26] Trustee Patrick: that are taking the time to embrace

[0:01:29] Trustee Patrick: and think of how they can work better

[0:01:33] Trustee Patrick: with indigenous people.

[0:01:37] Trustee Patrick: I'm Laura Patrick, elected on Salt Spring Island

[0:03:11] Trustee Middleton: for new residents of which there are quite a few.

[0:03:16] Trustee Middleton: So just a point for discussion,

[0:03:18] Trustee Middleton: educational outreach to new residents under new business.

[0:03:23] Trustee Patrick: Any other additions?

[0:03:58] Voice 6: There is not much to report other than I think, you know, all things considered, given the pandemic and the various health orders that Saturna Island is doing remarkably well.

[0:04:12] Voice 6: And so it's very difficult on a lot of people. We all know that. I think everyone's affected, but there's a great deal of respect and support in this community.

[0:04:24] Voice 6: and so, yeah, it's an absolute delight to be here

[0:04:28] Voice 6: and have the kind of community support that we do.

[0:04:33] Voice 6: That's my report.

[0:04:35] Trustee Patrick: Thank you very much.

[0:04:38] Trustee Patrick: Trustee Middleton.

[0:04:40] Trustee Middleton: Sure, thank you.

[0:04:42] Trustee Middleton: Yes, the meetings that I've attended recently for the island

[0:04:47] Trustee Middleton: was the Southern Gulf Islands National Park Reserve Advisory Committee for Saturna.

[0:04:59] Trustee Middleton: It had a very good turnout.

[0:05:00] Trustee Middleton: It was about three weeks ago.

[0:05:02] Trustee Middleton: And we had an excellent update from the Park Reserve

[0:05:05] Trustee Middleton: in terms of their activities this summer.

[0:05:07] Trustee Middleton: And they're well into a hiring process for a superintendent of the Park Reserve.

[0:05:15] Trustee Middleton: and the former superintendent Marcia Marash is now the director general I think is her title

[0:05:25] Trustee Middleton: in southwestern Ontario for national parks and national historic sites so she was very helpful

[0:05:31] Trustee Middleton: in changing the relationship with the park that the park had with communities here and so we

[0:05:36] Trustee Middleton: We certainly will miss her, but we're on very good footing

[0:05:40] Trustee Middleton: in terms of our relationship with the park.

[0:05:44] Trustee Middleton: The trust as a whole, it's still unresolved from a governance perspective,

[0:05:48] Trustee Middleton: but there's really nothing the trust can do about that.

[0:05:50] Trustee Middleton: That's up to the federal government and their liaising and working

[0:05:54] Trustee Middleton: and identifying partnerships with First Nations

[0:05:57] Trustee Middleton: on whose traditional territory the park lies.

[0:06:01] Trustee Middleton: So basically the actual park liaison committee is in hiatus

[0:06:06] Trustee Middleton: um and so uh yeah and then further just been spending some time working with the uh select

[0:06:14] Trustee Middleton: committee on uh governance and management review who have um hired um from a bid process hired a

[0:06:22] Trustee Middleton: consultant um uh team who are basically i think we're all quite impressed with their um their

[0:06:30] Trustee Middleton: background and what i think they'll offer us in terms of particularly in the area of of um

[0:06:34] Trustee Middleton: of governance and so there'll be a more detail on that presented to uh in a report to trust

[0:06:40] Trustee Middleton: council but um so far it looks like we've been quite fortunate in in um who responded and what

[0:06:47] Trustee Middleton: who we were able to hire to do this work and i think it'll be quite a significant um achievement

[0:06:53] Trustee Middleton: that you know hopefully all of we can all look back on and and realize this was a really momentous

[0:07:00] Trustee Middleton: piece of work and so far it looks good so i think for me that's it all

[0:07:05] Trustee Patrick: right thank you trustee

[0:07:06] Trustee Patrick: middleton uh for my report i'll let you know trust council is coming up again in june june 8th through

[0:07:12] Trustee Patrick: 10th so um the agenda package will be coming out in the next i think after next week um and i just

[0:07:22] Trustee Patrick: there is some some circulation of comments regarding our previous uh trust council in march

[0:07:30] Trustee Patrick: of some concerns and of what some of the motions

[0:07:33] Trustee Patrick: that we made and I just want to assure people

[0:07:36] Trustee Patrick: that it was just an affirmation,

[0:07:39] Trustee Patrick: not a shift in direction or reordering of priorities.

[0:07:43] Trustee Patrick: It's a statement of clarification of motions

[0:07:45] Trustee Patrick: that we made in March regarding the object statement

[0:07:48] Trustee Patrick: for the trust.

[0:07:49] Trustee Patrick: I've always understood that the mandate of the trust

[0:07:53] Trustee Patrick: is to mean that we have a responsibility

[0:07:55] Trustee Patrick: toward our constituency, the people and the environment.

[0:07:58] Trustee Patrick: environment. The trust is different than any other local government in British Columbia because we

[0:08:03] Trustee Patrick: have a statutory and legal obligation to the environment in addition to all other jurisdictions.

[0:08:09] Trustee Patrick: And with that, it's now your turn to speak. And this is the town hall. We want to hear any of

[0:08:20] Trustee Patrick: your questions or comments. We do have one application on the agenda today. The applicant

[0:08:26] Trustee Patrick: in we'll have a time to to an opportunity to speak when we consider the application so

[0:08:31] Trustee Patrick: the applicant can wait um if uh please uh please be respectful direct your comments to the ltc

[0:09:51] Trustee Patrick: all right well then that will bring us to justine uh stark who's here from the crd and um if you can

[0:10:01] Trustee Patrick: move her over as a panelist maple that would be greatly appreciated she's here to talk to us today

[0:10:06] Trustee Patrick: about the southern gulf island transportation integration plan yes

[0:10:11] Voice 7: i'm justine uh stark has

[0:10:13] Voice 7: now moved over to the panelist side you can unmute yourself

[0:10:16] Trustee Patrick: perfect thank you good morning justine

[0:10:18] Trustee Patrick: the floor is yours. Good

[0:10:19] Voice 2: morning. Thank you for having me. I wish I were on sunny Saturna Island

[0:10:25] Voice 2: to present this in person. But, you know, I'm here today to introduce to you the Saturna Island

[0:10:34] Voice 2: Local Trust Committee, the Transportation Service Establishment Study that we're conducting.

[0:10:42] Voice 2: I think the name of the project is Transportation Integration Plan. And that's because

[0:10:48] Voice 2: We've hired Watt Consulting to support us in scoping out a multi-modal integrated transportation service for the southern Gulf Islands.

[0:10:58] Voice 2: And when I say multi-modal, I mean we're investigating public transit, inter-island passenger ferries,

[0:11:06] Voice 2: and the ability to have active transportation networks all interconnected to serve the islands as a region.

[0:11:16] Voice 2: obviously with links to salt spring and swartz bay perhaps as well or or sydney

[0:11:22] Voice 2: um so the direction to do this work came from the community economic sustainability commission

[0:11:29] Voice 2: um which is a regional commission looking out for the economic um interests of the southern

[0:11:37] Voice 2: gulf islands and uh actually trustee brent is your saturn island representative on what we call

[0:11:45] Voice 2: the CESC. So a couple years ago they requested that the CRD create a transportation commission

[0:11:52] Voice 2: and the way regional district services work, you establish commissions that have appointed

[0:11:57] Voice 2: representatives from the community to oversee and advise on a service. So if you want to have

[0:12:03] Voice 2: a transportation commission, first you need to establish a service and it's that work that we're

[0:12:07] Voice 2: are looking at now. So we're costing out and trying to define these three modes, these three

[0:12:15] Voice 2: service models, and looking into what will the role of the CRD be. And it would be probably

[0:12:22] Voice 2: different for each mode. As you can imagine, it's kind of a large and ambitious project to

[0:12:30] Voice 2: undertake, but we're doing so with the great advice of your local community groups who have

[0:12:37] Voice 2: have already been always been active on um advocating for transportation improvements so

[0:12:42] Voice 2: we're working um we've we've struck actually three advisory groups one per mode and um what's already

[0:12:48] Voice 2: done some initial engagement with those groups so you've got your trail societies and your parks

[0:12:53] Voice 2: commissions um and and others speaking to trail networks and active transportation and you've got

[0:13:00] Voice 2: your community bus societies and um the lions and uh trustee brent um uh speaking to community buses

[0:13:10] Voice 2: and public transit options on each of the islands um as and then for the inter-island transportation

[0:13:17] Voice 2: piece we've been working with water taxi providers and and just other um kind of nautical folks in

[0:13:23] Voice 2: the islands um the tour de zeal people have been putting put on the tour de zeal over the years and

[0:13:28] Voice 2: And so gathering all the local intel that we can,

[0:13:32] Voice 2: going through piles of background information,

[0:13:35] Voice 2: there have been previous studies.

[0:13:36] Voice 2: This isn't the first time we've looked at this,

[0:13:39] Voice 2: but it's the first time we've actually taken it forward

[0:13:42] Voice 2: and with the goal of proposing a service model.

[0:13:47] Voice 2: And so I think I'll leave it at that.

[0:13:50] Voice 2: Like it is, you know, each mode has its complexities

[0:13:53] Voice 2: and I'm sure trustees have questions.

[0:13:58] Voice 2: Oh, I guess I should also let you know that this is the beginning of our process, and so we're doing the stakeholder engagement and the advisory group information gathering first, so that when we go to the public with a broader community engagement process in the fall, we'll have a basis from which to speak, and we'll be able to dig deeper into the information we already have with community input.

[0:14:23] Voice 2: put so we will be having depending on COVID we'll be having some like in real life community

[0:14:31] Voice 2: engagement town halls or zoom town halls as well as open houses on each of the islands and we're

[0:14:37] Voice 2: developing a an online platform that will be interactive some community mapping tools

[0:14:43] Voice 2: yeah all that's kind of in the works and the goal is like what's contract what consultings

[0:14:49] Voice 2: their contract is uh to be all wrapped up by the end of this year um end of december 2021 so

[0:14:56] Voice 2: then we'll be looking towards 2022 to um be proposing the service um in order to establish

[0:15:06] Voice 2: a service uh you need voter assent and so we're planning to have a referendum question

[0:15:12] Voice 2: on the general election in 2022 October 15th 2022 where the Islanders will get

[0:15:19] Voice 2: to choose if this is a service they would like to take on like the CRD to

[0:15:24] Voice 2: take on so with that I'll turn it over to you chair Patrick to facilitate

[0:15:29] Voice 2: questions yes

[0:15:31] Trustee Patrick: are there any questions for Justine go ahead Trustee Middleton

[0:15:37] Trustee Patrick: and thanks

[0:15:38] Trustee Middleton: justine that's great and um when we there was a meeting in sydney uh some oh it's

[0:15:45] Trustee Middleton: probably a few years ago now maybe even longer i'm not sure but it was a similar concept to

[0:15:50] Trustee Middleton: potentially bc transit was um uh going to be a funding partner in in a similar foot uh ferry

[0:15:58] Trustee Middleton: service but one of the key drivers was the interest of the town of sydney in having a foot i guess

[0:16:06] Trustee Middleton: And this is my question, because you probably know a lot more than I do. I understood there was to be kind of a big redevelopment of the waterfront in Sydney. And one of the key features was a docking space that the mayor had at the time was promoting and was quite interested in a docking space for a Gulf Islands foot ferry.

[0:16:26] Trustee Middleton: And he was touting at the time that this was excellent for business in Sydney because the Gulf Islands were a great untapped source of affordable housing as compared with the

[0:16:36] Trustee Middleton: Saanich Peninsula for Sydney, so that people could actually commute on it, which is not a bad idea.

[0:16:42] Trustee Middleton: but i mean it would be an interesting new commercial route and so i'm just wondering if

[0:16:48] Trustee Middleton: there is what the update might be in regards sydney and it's it's um you know potential

[0:16:54] Trustee Middleton: development redevelopment or where they're at in their interest on this and and just whatever you

[0:17:00] Trustee Middleton: know that would be great yeah

[0:17:02] Voice 2: thank you um through the chair i'll respond and say that we're not

[0:17:06] Voice 2: engaging Sydney directly on this and it isn't a main driver to connect Sydney to the southern

[0:17:13] Voice 2: gulf islands with the passenger ferries however and it was interesting in our focus group our

[0:17:19] Voice 2: advisory group for the water transportation those in attendance were kind of less less into the idea

[0:17:26] Voice 2: or the need to integrate Sydney and I truly think there's mixed opinions about that I think from an

[0:17:33] Voice 2: operational perspective it's easier to just do navy channel right you connect hope bay and main

[0:17:38] Voice 2: island and um galliano island and saturn island all easily um probably in all seasons um it could

[0:17:47] Voice 2: be doable but when you start hopping over to salt spring or hopping over to sydney you're you're

[0:17:51] Voice 2: crossing open water and it's just a longer trip and it's the the business case isn't isn't as strong

[0:17:56] Voice 2: so there's all these kind of factors operational realities i think functionally and what we do know

[0:18:02] Voice 2: One of the reasons we're advancing the inter-island connections is because of the needs of the Southern Gulf Islanders to access the peninsula and access Sydney, you know, all the time.

[0:18:14] Voice 2: And BC Ferries doesn't always meet the needs of folks.

[0:18:18] Voice 2: And it would open up new economic opportunities and housing opportunities, sure, between Sydney and the Southern Gulf Islands.

[0:18:26] Voice 2: But even amongst the Southern Gulf Islands, if you could have somebody living on Galliano and working on Maine or living on Saperna and working on Pender like that, we know that Southern Gulf Islands are constrained with the housing crisis and the labor pool.

[0:18:41] Voice 2: And so there's not, you know, like Galliano can't find an early childhood educator.

[0:18:47] Voice 2: They had zero responses to their posting.

[0:18:49] Voice 2: And it's because those who did inquire, their first question was, where would I live?

[0:18:55] Voice 2: And there isn't anywhere to live.

[0:18:57] Voice 2: So it's all connected and all these issues are connected and the economic context of the Southern Gulf Islands is really related to better interrelationship.

[0:19:08] Voice 2: So I answered way more to your question there, but that's some of the rationale behind it.

[0:19:11] Voice 2: And I think we'll really get into that in the community.

[0:19:13] Voice 2: I'm interested to hear what the broader community thinks about the connection to Sydney.

[0:19:19] Voice 2: And it might be like further down the road as well.

[0:19:21] Voice 2: I think that we'll start small on the water program.

[0:19:26] Voice 2: um i expect that you know it's it's it's one that's very hard to cost out thank

[0:19:35] Trustee Patrick: you any further

[0:19:36] Trustee Patrick: question i see trustee rent it's

[0:19:38] Voice 6: not going to be a question it's going to be a comment just so that

[0:19:41] Voice 6: people know what consulting um is unlike some of the previous consultants that the crd engaged

[0:19:48] Voice 6: in that they have a lot of experience in small rural communities uh one of the consultants i

[0:19:55] Voice 6: I don't know if she's a lead consultant. Tanya Wegowitz was with B.C. Transit when B.C. Transit investigated transit in the southern Gulf Islands.

[0:20:05] Voice 6: So there is a lot of a lot of experience there. And it's it's appropriate to our islands and the size of our islands.

[0:20:15] Voice 6: And there is expertise in respect to the many challenges we face.

[0:20:21] Voice 6: So this is not an off-the-shelf study. Justine has done a remarkable job with the RFP because she got an outstanding group to respond successfully to it, much like the select committee has done with the management review of the trust.

[0:20:40] Voice 6: That's all I have to say. Thanks.

[0:20:42] Trustee Patrick: Thank you, Trustee Brent. Well, I think it's wonderful that you're taking the integrated approach of the various transportation elements, and I applaud you for taking that approach and look forward to the outcome of this work. So any final questions for Justine? Trustee Middleton?

[0:21:02] Trustee Middleton: Yeah, thank you. No, I think it's great too, Justine, and totally support going to a referendum if that's, you know, when the consultants can find a case to do so. I think that'd be great. And understand starting small and in a focused area, that makes sense too.

[0:21:16] Trustee Middleton: One thing that did come up last time as well was kind of leveraging the investment that the school district makes in its water taxi service.

[0:21:28] Trustee Middleton: I think that I found the operator was a little bit kind of misunderstood sort of what the intent was.

[0:21:34] Trustee Middleton: They were quite thorny about the whole thing.

[0:21:37] Trustee Middleton: But the idea being would not be to change what they do with the school district, but to supplement use of those vessels.

[0:21:48] Trustee Middleton: um if there's any opportunity if that's i mean i guess the consultants i guess would make

[0:21:53] Trustee Middleton: potentially look into that but so yeah that's kind of a kind of an open-ended question you

[0:21:59] Trustee Middleton: may not have an answer to that right right at the moment which is of course fine well

[0:22:04] Voice 2: i i have i

[0:22:05] Voice 2: have a small answer um and and that is we've identified the school district as as the most

[0:22:13] Voice 2: you know possible partner that would really it would be very efficient to bundle a service with

[0:22:21] Voice 2: the school district but there's a lot of obstacles and challenges in doing so we did do some

[0:22:26] Voice 2: preliminary consultation with them in the course of preparing the RFP so that we could make sure

[0:22:31] Voice 2: to ask the right questions in the RFP and so we put them on notice that you know we'd be interested

[0:22:38] Voice 2: did in a partnership down the road and should they enter into a new contract uh with a service

[0:22:43] Voice 2: provider that they um you know be building in some flexibility perhaps in that contract so there's

[0:22:51] Voice 2: there's um there's a lot of politics and there's a lot of challenges with um transporting school

[0:22:57] Voice 2: children and mixing school children with the general public um that we have to overcome but

[0:23:03] Voice 2: But in theory, you know, there should be some kind of efficiency there.

[0:23:08] Voice 2: The boats are going empty one way.

[0:23:12] Voice 2: Yeah, there's, it's so, and it is difficult to work across government agencies as well.

[0:23:20] Voice 2: But we're going to try.

[0:23:23] Trustee Patrick: Well, thank you.

[0:23:25] Trustee Patrick: It always starts with a conversation.

[0:23:28] Trustee Patrick: Thank you.

[0:25:40] Trustee Middleton: be in there and i may have missed it if so i apologize so they they talk quite a bit about

[0:25:45] Trustee Middleton: the remediation work required on the bluff edge and that's where in the photos you can see this

[0:25:50] Trustee Middleton: a fair bit of scotch broom and um and obviously displacement of uh of douglas fir and whatnot

[0:25:56] Trustee Middleton: not which was not obviously anything that the applicant did um and it certainly wasn't anything

[0:26:02] Trustee Middleton: that happened in the construction of the staircase as they the uh the the consultants make out but

[0:26:08] Trustee Middleton: they said the way it's framed they seem to indicate that as a condition of proceeding with

[0:26:14] Trustee Middleton: the the permit um that that there would be remediation on the on the bluff edge and i'm

[0:26:21] Trustee Middleton: wondering what um i mean that sounds like the property owner is very uh very much uh interested

[0:26:27] Trustee Middleton: in being compliant interested in natural remediation is motivated to participate but

[0:26:32] Trustee Middleton: there is no is is there a mechanism to uh observe and or um the

[0:26:40] Planner: the report does speak to the

[0:26:43] Planner: construction of the stairways having minimal additional impact to the uh to the habitat

[0:26:49] Planner: tab beyond the the obvious impacts of the blasting and land clearing in the past that essentially

[0:26:56] Planner: stripped all of the natural vegetation from the whole front edge of the property and uh right

[0:27:03] Planner: where the stairs go down there's obviously a blast hole there the report has pictures of the

[0:27:08] Planner: of the debris pile at the bottom uh so the report actually concludes that a restoration plan is not

[0:27:15] Planner: required specifically for the stairways itself and the recommendations are more broadly meant to

[0:27:22] Planner: speak to the broader restoration condition or activities that would be required to

[0:27:32] Planner: fix all the other impacts that were not caused by the stairs so in this case it would be

[0:27:39] Planner: a little bit beyond LTC's and I guess you could and push for him to submit a measurable restoration

[0:27:50] Planner: plan that actually identifies specific number of trees to plant and species types for example and

[0:27:58] Planner: a planting schedule and a site plan for the upper portion but because that's beyond the scope of

[0:28:06] Planner: of what impacts he's actually created himself

[0:28:10] Planner: through his stairways.

[0:28:11] Planner: It would seem to be a bit of a beyond the scope of,

[0:28:16] Planner: but the property owner has indicated

[0:28:19] Planner: he's interested in voluntarily restoring that site,

[0:28:23] Planner: but obviously that doesn't carry the same weight

[0:28:25] Planner: as a development permit

[0:28:27] Planner: with specific conditions tied to it.

[0:28:31] Planner: Yeah.

[0:28:31] Trustee Middleton: That's good.

[0:28:32] Trustee Middleton: Just because the consultant gives quite extensive detail

[0:28:36] Trustee Middleton: and how to complete a restoration and so obviously that's a helpful prescription but it's not a

[0:28:43] Trustee Middleton: mandatory condition then yeah

[0:28:46] Planner: so what staff did was i did i did my best to tease through the report

[0:28:50] Planner: and pull out actual measurable conditions specific to the stairway itself and kept the scope of the

[0:28:57] Planner: permit at that level as opposed to a broad entire restoration plan for which the property owner

[0:29:05] Planner: would probably have some avenue to push back and say this is way beyond the scope of the impact

[0:29:11] Planner: that i've created yeah

[0:29:13] Trustee Middleton: that's good clarification thank you yeah

[0:29:15] Trustee Patrick: i was just i have a couple questions

[0:29:18] Trustee Patrick: i'm not living there and is that is it common that people have blasted these steps down the

[0:29:25] Trustee Patrick: bluffs so

[0:29:26] Planner: the the blasting was just i'm not sure what the purpose of the blasting was uh but it was

[0:29:32] Planner: was done by previous owner and uh i would say that oh well i don't know if either uh the on

[0:29:40] Planner: island trustees have actually been there have you it is a thrilling structure to say the least and

[0:29:48] Planner: i highly recommend you connect with glenn and have a go go take a walk down it because uh

[0:29:54] Planner: i think it probably puts this new sky thing on the malahat to shame

[0:29:59] Planner: I'm trying.

[0:30:00] Planner: of uh of uh it is an incredible structure built on literally like a 70 meter

[0:30:07] Planner: uh ledge so it is highly uncommon it is it is a man's uh irrational dream come true is what it is

[0:30:19] Planner: because you get to the bottom of it and i mean it's a really impractical structure you get to

[0:30:24] Planner: the bottom of it and it's even as it's built now without removing the bottom portion it's probably

[0:30:29] Planner: a 15 foot drop down to the actual uh foreshore itself uh which he uses a ladder to get down so

[0:30:38] Planner: and then he all he does is go down there and fish is once a year or twice a year so it is a stairway

[0:30:44] Planner: it is a stairway to nowhere uh but uh it is it is a really really neat structure from a structural

[0:30:50] Planner: perspective yeah so i recommend you try to get there you could charge admission i think honestly

[0:30:55] Planner: it is breathtaking and i don't say that lately because i've been on i've done lots of pretty

[0:31:02] Planner: neat stuff in my life i'm

[0:31:05] Trustee Patrick: just concerned is it create does this create a precedence at all for

[0:31:09] Trustee Patrick: other people in that area that would want to build yeah i

[0:31:12] Planner: mean there's always demand for

[0:31:14] Planner: building stairways through uh to access for sure uh i guess in it could create a bit of a precedent

[0:31:23] Planner: And I guess at this point, given that it's there, do you make him completely remove it, which would probably cause more damage to the habitat?

[0:31:35] Planner: I think had he come seeking approval proactively, he probably would not have gotten it, or at least staff would not have recommended approval.

[0:31:44] Planner: and so I guess it's just this place where we get stuck in sometimes where we're retroactively

[0:31:52] Planner: trying to find solutions for property owners I mean there's certainly another solution would be

[0:31:57] Planner: for well I mean LTC could probably use the guidelines and say that it's inappropriate

[0:32:05] Planner: and lean on that to have him remove it altogether I guess but to what end thank

[0:32:13] Trustee Patrick: you trustee Brent

[0:32:15] Voice 6: think if LTC were to do that, we'd be subject to judicial review and we would lose based on my understanding of how these development permit permits work.

[0:32:26] Voice 6: The other point I'd like to make is there is a lot of disturbance in that bluff area by people.

[0:32:34] Voice 6: So we start doing that. We're going to be opening up the majority of people out there to that type of situation.

[0:32:43] Voice 6: situation so there's a lot of stuff that was done in the past that shouldn't have been done

[0:32:47] Voice 6: and it's up to us now to make sure it doesn't occur in the future and

[0:32:51] Planner: this is a really unusual

[0:32:52] Planner: structure in in in in its sighting and um and it also extends well into the the not beyond the

[0:33:01] Planner: natural boundary of the sea which is uh significant in having to remove that portion because it's

[0:33:09] Planner: essentially trespassing onto the crown land but i i i understand where you're coming from chair

[0:33:17] Planner: patrick but i i don't see uh it being hugely precedent setting given it's such if it was just

[0:33:24] Planner: a short straight run of stairs as traditional what other property owners would be doing

[0:33:29] Planner: that might be more of a question but in this case it it is literally like 70 meters six landings

[0:33:37] Planner: five five different directions as it navigates its way down down the cliff

[0:33:45] Planner: side so

[0:34:10] Trustee Middleton: because the cliff is actually quite significant and there is one other staircase that i have been

[0:34:15] Trustee Middleton: on that's near that lot um that it is is older uh and it just shows they just don't last it's

[0:34:26] Trustee Middleton: so i think precedent will show from people who look there

[0:34:30] Trustee Middleton: that that it would really reduce the motivation of anybody else wanting to do this because the

[0:34:35] Trustee Middleton: The two examples that have been done are just, you know, they're very rapidly decaying under the exposure in the winter.

[0:34:43] Trustee Middleton: And then the second point I'd make is people would generally want to do this if they were seeking access to the sea.

[0:34:55] Trustee Middleton: And what we've done here is this ladder, this staircase, as PlanetSmith points out, literally now goes nowhere.

[0:35:01] Trustee Middleton: so we've we've not if we were to approve this where the permit does not actually give the

[0:35:06] Trustee Middleton: the applicant access to the to the uh to the the foreshore it stops well short so that the

[0:35:14] Trustee Middleton: precedent if anything is of a viewing ladder more than a way of actually really is

[0:35:19] Planner: and so it is

[0:35:21] Planner: being uh with pulling that bottom section off and even being

[0:35:26] Planner: completely impractical to reach the foreshore really you're creating a viewing a viewing

[0:35:33] Planner: platform and like yeah and really just trying to come to some retroactive solution for i would

[0:35:40] Planner: guess and i don't think this is an exaggeration in today's uh with today's prices that it's

[0:35:48] Planner: probably a fifty thousand dollar staircase with the complexity of the work it being all cedar

[0:35:54] Planner: and all the metal cabling and everything else it's probably a 50 60

[0:37:50] Trustee Middleton: community plan. We've just in our, we, the last term we conducted a fairly extensive

[0:37:57] Trustee Middleton: technical review, which largely brought the land use bylaw and the official community plan up to

[0:38:02] Trustee Middleton: date given current regulatory context and role of, you know, changing names of ministries and

[0:38:10] Trustee Middleton: that type of thing and oversights and omissions or general errors that, you know, inevitably

[0:38:16] Trustee Middleton: creep into documents of that complexity, we've largely fixed. But there's a few things in

[0:38:22] Trustee Middleton: practice that we could perhaps clarify the definition of. And then secondly, a few instances

[0:38:28] Trustee Middleton: of eMERGE that do need attention. I think on the agenda has been the school property is

[0:38:35] Trustee Middleton: effectively half of it is miszoned that needs, I would consider that a technical matter for

[0:38:41] Trustee Middleton: correction. There's some issue that the zoning in the vineyard, which is an agricultural

[0:38:48] Trustee Middleton: property, of course, doesn't match the agricultural zoning in the neighboring farm.

[0:53:19] Trustee Middleton: that took some years to resolve and is now resolved so so we've now so i think that's okay is that does

[0:56:11] Trustee Middleton: residents. And the suspicion was, and we've heard this before, that people moved to the

[0:56:17] Trustee Middleton: Gulf Islands without necessarily any awareness of the island's trust, what it is and why it was

[0:56:23] Trustee Middleton: formed and what it's hoping to do, as a way of indicating that these islands have certainly

[0:56:29] Trustee Middleton: sensitivity around their carrying capacity of the ecosystems, and particularly groundwater.

[0:56:37] Trustee Middleton: Um, so I know the signs that the very used to be signed, they may still be there at the

[0:56:42] Trustee Middleton: various ferry terminals.

[0:56:44] Trustee Middleton: Uh, I know the trust has had pamphlets of some sort in the past that explain itself.

[0:56:50] Trustee Middleton: Um, they may be current, they may be perfectly adequate for this task.

[0:56:55] Trustee Middleton: I just haven't seen them recently and I don't know where they reside.

[0:56:59] Trustee Middleton: And, um, um, and that's the item really just to have a discussion about that.

[0:57:05] Trustee Middleton: There may be a perfectly good resource that already exists.

[0:57:07] Trustee Middleton: We just have to figure out how to get it to people.

[0:57:41] Voice 6: And then there's also a brochure that was produced by Saterna Island Residents and Ratepayers Association in conjunction with the Islands Trust,

[0:57:52] Voice 6: specific to the use of the scarcity of groundwater and the conservation efforts that are requested from people.

[0:58:02] Voice 6: and those are also provided to um people that operate uh bed and breakfasts and legal short-term

[0:58:10] Voice 6: vacation

[0:58:10] Trustee Middleton: rentals okay um so that the newcomer package would um sorry would seem to be uh um

[0:59:32] Trustee Patrick: Protection Alliance produced a know your well brochure that's electronically available on the

[0:59:38] Trustee Patrick: SWPA website it would be quite practical and good for anyone who has come from a urban area that has

[0:59:45] Trustee Patrick: never lived on a well before so it's just a short easy understanding and with some best practice

[0:59:50] Trustee Patrick: disinformation in there about owning a well or living on

[0:59:54] Voice 6: a well the other thing that this is

[0:59:56] Voice 6: it's a reality is um often

[1:00:00] Voice 6: the real estate agents will point to the trustees if prospective buyers have questions.

[1:00:07] Voice 6: And so I often take the opportunity to do my best to educate prospective buyers that if they do

[1:00:15] Voice 6: something bad to the environment, we're going to attack them with pitchforks and burning stakes.

[1:00:20] Voice 6: And that's exactly the terminology I use.
