[0:00:11] Trustee Fast: and crossing our fingers that this won't last forever. I think we'll be talking about that

[0:00:18] Trustee Fast: at the end of the meeting. My name is Sue Ellen Fast, and I'm the chair of the Local Trust

[0:00:28] Trustee Fast: Committee and I'm coming to you from Bowen Island over in Howe Sound, Alkitsam, and before we begin

[0:00:35] Trustee Fast: I'd just like to acknowledge with respect, deepest respect, that we're meeting digitally across the

[0:00:43] Trustee Fast: Coast Salish territories and especially the unceded traditional territory of the Comox First

[0:00:50] Trustee Fast: Nation. Thank you all for joining us here today, the electronic meeting of the Hornby Island Local

[0:00:57] Trustee Fast: local trust committee I want to begin I did that okay can you tell I've got a script I'm I'm joined

[0:01:04] Trustee Fast: here today by your local Hornby Island trustees Grant Scott if you can just wave their grant and

[0:01:10] Trustee Fast: Alex Allen there we go so these are the uh uh trustees elected on Hornby Island and uh together

[0:01:19] Trustee Fast: we make up the three of us make up the uh Hornby Island local trust committee and uh this meeting

[0:01:25] Trustee Fast: is being obviously conducted electronically it's also being recorded so that you can listen in

[0:01:31] Trustee Fast: later if you lose connectivity or for some reason you want to watch it again later it'll be on the

[0:01:37] Trustee Fast: islands trust website so when we get to the town hall portion of the meeting that's the time when

[0:01:48] Trustee Fast: you as members of the public can have a chance to speak because we're we're doing the participatory

[0:01:54] Trustee Fast: democracy model here this is what we have in Canada and British Columbia especially at the

[0:01:59] Trustee Fast: local government level so you have our three elected trustees which I've talked about we have

[0:02:04] Trustee Fast: you the public with your local information and your perspective and your opportunity to be involved

[0:02:11] Trustee Fast: and have your say in local decisions that are made about land use through this Islands Trust

[0:02:17] Trustee Fast: trust, uh, local trust committee. And, um,

[0:02:19] Trustee Fast: and we've got our professional staff who give us, uh, advice and,

[0:02:23] Trustee Fast: and we ask them to do things. Um, so when we get to the, um, um,

[0:02:29] Trustee Fast: town hall session, uh, please direct your ideas, your input, uh,

[0:02:34] Trustee Fast: to your local elected trustees. That's us, the local trust committee. Um,

[0:02:40] Trustee Fast: so we're, um, when we get, yes.

[0:02:45] Trustee Fast: Yes.

[0:02:46] Trustee Scott: I think it would be good for you to introduce the staff members and who they are so people know

[0:02:55] Trustee Fast: who they are.

[0:02:56] Trustee Fast: We will do.

[0:03:00] Trustee Fast: So I wanted to mention the role that the people, citizens of Hornby have.

[0:04:25] Trustee Fast: have accurate minutes for these kinds of decisions so um we've also got with us regional planning

[0:04:31] Trustee Fast: manager Heather Cower and uh thank you morning Heather and we're uh also she's also our acting

[0:04:38] Trustee Fast: Island Planner. So at Hornby Island Local Trust Committees, we get to see more of her than other

[0:04:44] Trustee Fast: local trust committees do. And we've got with us today, Planner Teresa Mahikwa. There she is. And

[0:04:51] Trustee Fast: she'll be presenting some of the items on our agenda today. And I think that might be who we

[0:04:58] Trustee Fast: are. So keeping in mind that staff are with us. So this is an official workplace. And in BC,

[0:05:05] Trustee Fast: see we have uh provincial laws about having a safe and respectful workplace so i'll be trying

[0:05:10] Trustee Fast: to keep that uh happening and um uh we're gonna ask uh yeah just checking that i've got everything

[0:05:20] Trustee Fast: oh yes and of course we're people are coming are working from home or from different offices

[0:05:25] Trustee Fast: so we're kind of like guests in their home so i want to be particularly respectful of uh um

[0:05:32] Trustee Fast: keeping care that we're all being friendly together thank you and I want to say that

[0:05:38] Trustee Fast: we're going to have a break during the meeting for lunch probably around noon and that's the

[0:05:45] Trustee Fast: way it usually works and we'll you know let's be hard on the issues and easy on each other

[0:05:57] Trustee Fast: uh begin with the um meeting then so um looking at the agenda get back to the top of my agenda

[0:07:09] Trustee Scott: okay okay thank you um well i think the most uh significant thing at least happened

[0:07:16] Trustee Scott: within the trust world is the trust council meeting i think it was last week or recently

[0:07:22] Trustee Scott: anyway and the policy statement the islands trust policy statement was proposed for

[0:07:31] Trustee Scott: for given first reading and it was uh 50 people presented on the night before on a town hall

[0:07:39] Trustee Scott: about it and um a lot of people spoke that they thought the process uh was too hurried it needed

[0:07:47] Trustee Scott: more time and others said that there was certainly a lot of people said there were things within the

[0:07:52] Trustee Scott: policy statement that they didn't particularly like so in my mind trying to divide this into

[0:07:57] Trustee Scott: pieces that i could kind of comprehend i think there's two basic things going on one is the

[0:08:03] Trustee Scott: policy statement itself which is a draft which is a lot of work and effort's been gone into it

[0:08:09] Trustee Scott: came from the 2050 process that went to the different islands to seek input and then it

[0:08:15] Trustee Scott: went through internal process and it came up with this document there was a survey done that people

[0:08:21] Trustee Scott: could fill out send in so all that was done that fed into this document but still a lot of people

[0:08:26] Trustee Scott: felt that they weren't aware for various reasons and in the midst of coven so there was a lot of

[0:08:32] Trustee Scott: discussion around that and uh kind of like the policy state itself and uh and i spoke to people

[0:08:41] Trustee Scott: on hornby island about that and a lot of people basically weren't even aware of so i think this

[0:08:48] Trustee Scott: this goes to point two which is the process and and in my mind the whole process thing is about

[0:08:56] Trustee Scott: how can people on hornby island uh become better informed about what this document's all about

[0:09:01] Trustee Scott: about what the trust is all about because i think right now it'd be fair to say and this might have

[0:09:06] Trustee Scott: been going on forever i'm not sure i've been around that long but um well i've been around

[0:09:10] Trustee Scott: a long time but not dealing with this quite so much detail and there's a lot of people saying

[0:09:15] Trustee Scott: saying has the trust lived out its usefulness and should we become part of the regional district and

[0:09:22] Trustee Scott: all these other kind of questions bigger questions than we're going to resolve right now but anyway

[0:09:27] Trustee Scott: the process right now is for people to become more informed about what the trust does and this

[0:09:32] Trustee Scott: policy statement so what I think we need to do on Hornby Island is we need to get a summary of

[0:09:40] Trustee Scott: this document we need to get it out to people we need to have town hall meetings we're going to be

[0:09:45] Trustee Scott: able to do that again i hope in the fall to get that information a out to the people

[0:09:50] Trustee Scott: and get their feedback which we can feed then back into this

[0:09:55] Trustee Scott: to the staff people who are putting this revision together so that the trust council

[0:10:02] Trustee Scott: can hopefully in december gather all that information review it get it out to folks and

[0:10:08] Trustee Scott: get it uh put through first reading so it can then go out through a formal process for third fourth

[0:10:15] Trustee Scott: and fourth reading so that's kind of a summary of what I've heard around the trust Hornby Island

[0:10:23] Trustee Scott: I don't think anything's changed from the from the last local trust committee meeting

[0:10:27] Trustee Scott: the concern about First Nations issues obviously and so Sue Allen that's a long

[0:10:34] Trustee Scott: piece there but I think people want to hear about the policy thank you.

[0:10:40] Trustee Fast: Thank you Trustee Scott

[0:10:41] Trustee Fast: lot and uh how about you trustee allen do you want to um add anything about the trust policy

[0:10:48] Trustee Fast: statement or do you want to uh report on other happenings i'm

[0:10:52] Trustee Allen: actually going to add on the policy

[0:10:54] Trustee Allen: statement as well um just to say that yes there was a dare i say it robust and fulsome discussion

[0:11:01] Trustee Allen: at the uh over the two days last week um i think what i really what made me really reflect over

[0:11:09] Trustee Allen: over this is the way we do community engagement and I think we really are not doing it well

[0:11:14] Trustee Allen: and I've been reading a lot about ways that you know ways we can or even ways that are

[0:11:20] Trustee Allen: not working and it's clear that so many people on our island and beyond did not feel they

[0:11:26] Trustee Allen: did not get the information out they did not feel listened they felt confused they had

[0:11:30] Trustee Allen: issues with that the whole engagement process and we can't just ignore that and so I voted

[0:11:37] Trustee Allen: against uh the first reading and you know as i quoted a letter writer one of the letter writers

[0:11:44] Trustee Allen: was that you know is that we have to look at why do they why did everybody feel unheard instead of

[0:11:49] Trustee Allen: just saying well we did this in 18 months we did that we have to really recognize the fact that we

[0:11:54] Trustee Allen: are not communicating properly with our constituents and we got to figure that out and i

[0:11:58] Trustee Allen: find that i find it exceptionally challenging on a hornby and i grant couldn't agree with me on this

[0:12:02] Trustee Allen: one is that both of us are not involved in facebook so we're missing a huge huge chunk

[0:12:08] Trustee Allen: of information out there and i just not into facebook and i'm i'm kind of almost reluctantly

[0:12:14] Trustee Allen: gonna maybe we do a trusty facebook i don't know i'm not a big social media fan but i do feel that

[0:12:22] Trustee Allen: we it is broken process and um and it's really and even locally i think we have an issue with

[0:12:30] Trustee Allen: and i was sort of reading there's this book for the love of community engagement

[0:12:34] Trustee Allen: that i want to get and read further i was just reading terms of it but it's just that um

[0:12:39] Trustee Allen: yeah we need to let go of simply broadcasting messages we need to embrace two-way dialogue

[0:12:45] Trustee Allen: with the people we serve more um and yeah i see community engagement has become really boring

[0:12:52] Trustee Allen: so i think we really need to and i know you suze ellen you're on the executive committee and you

[0:12:58] Trustee Allen: you guys are going to be looking at that right and so I really hope that you look at other ways we

[0:13:04] Trustee Allen: can do it I mean I agree with Grant it'd be great to get back into the hall but we still got to

[0:13:08] Trustee Allen: figure out what do we want to hear you know why and yeah so that's where I'm at and also

[0:13:15] Trustee Allen: if I like to tie into our local when we put an application we want comments from people within

[0:13:22] Trustee Allen: 100 200 meters or whatever just because we haven't heard from them does not mean they've agreed they

[0:13:27] Trustee Allen: They could have not picked up their mail.

[0:13:28] Trustee Allen: So we really have to be cognizant of that fact that just because we haven't heard, silence does not mean agreement.

[0:13:35] Trustee Allen: Thank you.

[0:13:38] Trustee Fast: Thank you, trustees.

[0:13:40] Trustee Fast: And I wonder, I'll just give a few notes, too, from my perspective so people know what I do.

[0:13:49] Trustee Fast: But on Hornby, did you folks receive both of the mailings, the anonymous one and then the one from the Islands Trust in your mailboxes?

[0:13:57] Trustee Scott: We did.

[0:13:58] Trustee Scott: Okay,

[0:13:59] Trustee Fast: thank you. I'm just curious. Some islands did not, like Liskiti. And anyway, I think you're totally right, Trustee Allen, is that social media is playing a huge role.

[0:14:13] Trustee Fast: and um in a way um i do look at some of the facebook uh things and it can be uh i think

[0:14:24] Trustee Fast: you mentioned the word information well there's an equal amount if not more of the other kind

[0:14:29] Trustee Fast: of information and the social media world and and it's changed um um the way public consultation

[0:14:37] Trustee Fast: consultation, and communities can engage. Anyway, I won't go into all that. I just will say that

[0:14:44] Trustee Fast: there's, I'll add a little bit to what Trustee Scott said, is that one of the things the

[0:14:50] Trustee Fast: Islanders Trust has been doing is also engaging with First Nations. So there is, in the first

[0:14:56] Trustee Fast: draft, which Trust Council did pass on July 8th, they passed it as a draft and referred it out

[0:15:04] Trustee Fast: um to regional districts and Bowen Island municipality and things like that um First

[0:15:12] Trustee Fast: Nations input is part of that and was incorporated into the uh the draft text so there's a whole

[0:15:19] Trustee Fast: bunch of reports um if you go to the uh find the the calendar or just contact one of us we can

[0:15:25] Trustee Fast: send anybody the links to the agenda where you can read about uh these kinds of things um just

[0:15:32] Trustee Fast: a few more things uh since our last meeting which was um may 21st we had another trust council

[0:15:38] Trustee Fast: meeting um and that was uh uh the highlights are in the information items i think that's item

[0:15:48] Trustee Fast: um 14.1 just so people can keep up with the the other business of the uh islands trust i mean

[0:15:55] Trustee Fast: we're we're not we're not just a an ordinary local government we're we're a special purpose

[0:16:02] Trustee Fast: purpose government, unique in the world, because we're about sustainability and health of ecosystems

[0:16:09] Trustee Fast: and communities and quite different. So it's a little, people might be interested that it's a

[0:16:19] Trustee Fast: different kind of government. Yeah, so we did that kind of thing. Oh, Islands Trust Conservancy,

[0:16:25] Trustee Fast: I had a meeting last week with, as part of the board of the Islands Trust Conservancy. So there's

[0:16:30] Trustee Fast: a report in our agenda today that we'll talk about and we also held our um uh annual joint

[0:16:36] Trustee Fast: meeting islands trust conservancy with executive committee uh there to sort of coordinate what

[0:16:42] Trustee Fast: what can we collaborate on how can we work better together and uh make sure each other was caught up

[0:16:48] Trustee Fast: and of course i had both hats on there and um yeah that's and i had a meeting with denman

[0:16:57] Trustee Fast: LTC last week so just so people are caught up and of course this is on top of regular

[0:17:02] Trustee Fast: bi-weekly Bowen Island council meetings in that other world of municipalities okay

[0:17:11] Trustee Fast: so if that's it for trustee reports then I've done my chair's report and electoral area

[0:17:21] Trustee Fast: Daniel Arbour is not able to be with us today so we're into the town hall section of our

[0:17:27] Trustee Fast: agenda and I can see seven attendees are with us one of them's got their hand up already

[0:17:33] Trustee Fast: and I'm just going to read from our public participation guidelines that invite

[0:17:41] Trustee Fast: the public to speak this is an opportunity for public comments typically offered

[0:17:45] Trustee Fast: town hall chance to inform trustees of topics relevant to the local trust area

[0:17:50] Trustee Fast: and um basically i thought it said number of minutes well a couple of minutes to speak

[0:17:59] Trustee Fast: and uh i'll say two and then um we'll uh um it's funny i thought i had that in there

[0:18:06] Trustee Fast: so uh if you want to uh raise your hand then i see two hands raised that's great and uh um

[0:18:14] Trustee Fast: Will Cottingham will promote you to be a speaker and then if you're on a phone it's star nine to

[0:19:02] Voice 5: to give you all some information about my experience

[0:19:06] Voice 5: trying to comment on the 2021.1 Laskin temporary use permit.

[0:19:14] Voice 5: On July the 5th, I saw in a flyer that the application

[0:19:18] Voice 5: and maps were available on July the 5th

[0:19:22] Voice 5: and that I could offer comments.

[0:19:25] Voice 5: On July the 8th, the application and the maps

[0:19:28] Voice 5: were not available.

[0:19:29] Voice 5: on July the 10th I communicated with the planner Ian Cox and he said the applications would be

[0:19:35] Voice 5: available soon and they were on July the 10th the map did not indicate what is now a new driveway

[0:19:45] Voice 5: close to our only four-way stop and busiest intersection on the island and across from the

[0:19:51] Voice 5: gas bar a very busy place with additional parking for the co-op and the ringside the map did not

[0:19:58] Voice 5: indicate a new fenced area which has just gone in the map did indicate trees

[0:20:04] Voice 5: grassland the map did not indicate the presence on the corner where this

[0:20:11] Voice 5: property is identified to be a Jeremy Payne's temporary use permit his storage

[0:20:18] Voice 5: container his food truck the stove a 20-foot pipe to divert smoke several

[0:20:26] Voice 5: several picnic tables, some umbrellas.

[0:20:28] Voice 5: When I spoke to Ian Cox by email about this,

[0:20:31] Voice 5: he appeared to be unaware that those structures were there.

[0:20:37] Voice 5: The map, therefore, seems to show that the Laskin property

[0:20:42] Voice 5: is contiguous with Central Shields Road and St. John's Point Road,

[0:20:49] Voice 5: and there is no evidence, no suggestion,

[0:20:53] Voice 5: that there is another food truck operating or apparently operating not only as a food truck

[0:20:59] Voice 5: but as a fish shop. When I pointed this out to Ian Cox I received an automated reply that the

[0:21:07] Voice 5: planner was away from the office until July 26th which means that I was not able to offer a

[0:21:15] Voice 5: meaningful response to the application. I have read the planner's report but I believe that there

[0:21:22] Voice 5: there are some significant pieces of information

[0:21:26] Voice 5: not available and I just wanted to be sure

[0:21:29] Voice 5: that the local trustees,

[0:21:32] Voice 5: although I'm sure Alex and Grant are aware

[0:21:35] Voice 5: of the structures that are being built right now.

[0:21:40] Voice 5: So I just wanted to kind of highlight my effort

[0:21:44] Voice 5: to be a good citizen, to offer my opinion about this

[0:21:48] Voice 5: and quite frankly was not able to.

[0:22:21] Trustee Scott: very aware of the issues on her and beyond and i think the way she speaks to the issues

[0:22:54] Voice 10: corners property uh where the application is in for john laskin to uh be allowed to have a

[0:23:01] Voice 10: liquor outlet there um i'm going to do this first but i have another little item after that please

[0:23:09] Voice 10: i don't have any specific objection to the liquor license application

[0:23:15] Voice 10: I've had a long discussion with John Laskin about all sorts of elements of the development of that property.

[0:23:23] Voice 10: And he satisfied me with many of his answers.

[0:23:27] Voice 10: but the thing that is so obvious is that the pedestrian traffic at that corner and back and

[0:23:35] Voice 10: forth between the pizzeria and the fish shop and the gas bar and the co-op is the traffic back and

[0:23:45] Voice 10: forth is not controlled so people pedestrian traffic is all over the road and I honestly

[1:38:12] Voice 6: minor semantic changes, but would have larger implications for both of the proposed by-laws.

[1:38:28] Voice 6: to consider only a portion of the subdivision to be dedicated for parkland or trail could have

[1:38:34] Voice 6: unintended consequences of density increase for the island and so such a change would also make

[1:38:40] Voice 6: the lub inconsistent with the ocp so any lub amendments would need to be made as well at that

[1:38:48] Voice 6: point, thereby the scope and work plan for the project would need to be extended.

[1:38:54] Voice 6: Staff note that the LTC's original rationale for this top priority project was to address

[1:39:00] Voice 6: the fact that there are applicants on Hornby Island who wish to subdivide but can't

[1:39:05] Voice 6: under the current bylaw wording and they're waiting for the minor amendment that is in bylaw 167.

[1:39:12] Voice 6: So just to, I guess, summarize briefly, after further analysis of the Wiseman letter, staff are not recommending changes to the OCP or the LEP that would be necessary to implement Wiseman's proposed amendments and staff's recommendations for the two bylaws that appear on page 81 of the agenda package.

[1:39:34] Voice 6: However, as an alternative, if the LTC wishes to make such amendments, staff recommend that

[1:39:44] Voice 6: the scope of the project be widened, the work plan be extended, and that a public hearing

[1:39:48] Voice 6: should likely be held for proposed bylaw 167 for the LUB amendments as well.

[1:39:55] Voice 6: So the recommended wording for that alternative appears on page 88 of the agenda package.

[2:34:40] Voice 2: a meetings hopefully face to face or by zoom it's been a difficult time for nations and they've been

[2:34:57] Voice 2: their own community so we're just working to ensure that we're here and working cooperatively

[2:35:04] Voice 2: and advocating for the things that are a concern for them we'll also be engaging further

[2:35:17] Voice 2: section on cultural heritage we'll be able to work collaboratively with comox to ensure that what we

We constantly mention Comox First Nation, but as I understand it, there's actually five First Nations who have Aboriginal rights and interests over Hornby Island.

[2:39:58] Trustee Scott: And I've heard Seashell, but I don't know whether that's, I'm not sure.

[2:40:03] Trustee Scott: So I just wonder, and I know the Comox have a treaty agreement with the others

[2:40:09] Trustee Scott: that Hornby is going to be their core territory for treaty negotiations

[2:40:15] Trustee Scott: from Deep Bay to Little River, where the ferry is.

[2:40:19] Trustee Scott: But beyond that, I don't know that there's any agreement, actually.

[2:40:22] Trustee Scott: So I kind of wonder why we focus pretty much solely on Comox when there's these other four.

[2:40:30] Trustee Scott: I'm not saying we shouldn't be focusing on Comox, but I just wonder where it leaves the others.

[2:40:39] Voice 2: We do focus on the other nations as well.

[2:40:44] Voice 2: And it might just be me focusing on the nations that I've had the most recent meetings with.

[2:40:50] Voice 2: But we have spoken and reached out to SLIAM, and they also participated in the policy statement amendment process and worked quite closely with us on their concerns.

[2:41:04] Voice 2: Some nations have let us know that they might be only interested in marine concerns and the rights in relation to their treaty in the marine area versus actual applications and land use decisions.

[2:41:21] Voice 2: And then other nations have informed us that they're concerned or want to be working collaboratively with us on land use decision making.

[2:41:31] Voice 2: So, in that sense, we are guided by how they would like to engage and but we are always ensuring that we're forwarding all of those different items and applications to them.

[2:41:45] Voice 2: Whether it's just Comox or that we've might have had a recent meeting with, or we might be engaging with them about this particular cultural heritage permit system.

[2:41:58] Voice 2: but if Sliamon or Sechelt came forward we would also engage with them on a similar permitting and

[2:42:05] Voice 2: cultural heritage concern.

[2:42:08] Trustee Scott: So then Lisa that means whenever we get an application for anything

[2:42:17] Trustee Scott: happening on Hornby we shouldn't be just referring it to I mean the staff shouldn't be just referring

[2:42:23] Trustee Scott: referring it to Comox it should go to these other four or five nations as well as not solely Comox

[2:42:32] Voice 2: so we we do not just send to Comox we do when we're sending out a formal uh

[2:42:38] Voice 2: referral process or working on a particular initiative we do send that to all the nations

[2:42:52] Voice 2: island so um but we may have more early and meaningful engagement with particular nations

[2:42:59] Voice 2: that have expressed that it's their core territory and that they are concerned about

[2:43:06] Voice 2: land use decisions on that particular territorial area or island other nations may be more interested

[2:43:13] Voice 2: in the marine as i mentioned so but each nation does receive all of the information that the

[2:43:20] Voice 2: islands trust is working on if it's a bylaw ocp policy statement amendment and if it's something

[2:43:28] Voice 2: that we've had discussions with them where they've noted that they have a particular concern in a

[2:43:33] Voice 2: particular area we would forward that to them even if we didn't have a particular um requirement to

[2:43:43] Voice 2: do it under the law we would simply do that as part of our relationship building and as part of

[2:43:49] Voice 2: of our obligation or not our obligation,

[2:43:52] Voice 2: but our commitment to UNDRIP.

[2:49:43] Voice 2: We're doing things that are helpful and help them with capacity, both for ourselves and for them and are efficient.

[2:49:56] Voice 2: But staff were very careful and diligent because they understood the importance of the site and the concerns that might arise.

3.1 Trustee Reports 
Trustee Scott reported that the Islands Trust Draft Policy Statement and process has left 
many Hornby residents feeling frustrated. It would be helpful for a summary of the Draft 
Policy Statement to be prepared and circulated for discussion at Town hall meetings in 
the fall, so that Trust Council can receive this information for review at their next 
December meeting. 
 
Trustee Allen reported that traditional community engagement does not seem to be 
working well, while social media discussion is increasingly common. Two-way dialogue 
needs to improve and silence from constituents does not equal agreement. 
3.2 Chair's Report

4. TOWN HALL  
 Members of the public commented with the following noted: 
 Regarding the 2021.1 Laskin Temporary use Permit (TUP), the Hornby resident experienced 
difficulties in attempts to comment on this TUP application. On July 5, 2021 the maps and 
application were supposed to be available; but could not be accessed on July 9, 2021. 
Planner Ian Cox indicated to the resident that the maps would be available soon and they 
were available on July 10, 2021. The map did not indicate a new driveway which is near a 4-
way stop, the gas bar, and the busiest intersection on Hornby Island. The map also did not 
indicate a new fenced area or other items related to the TUP operation such as a storage 
container, a food truck, a 20-foot pipe to divert smoke, several picnic tables and umbrellas. 
The applicant is also operating a fish shop at this site. Planner Cox, in email communication, 
seemed to be unaware that these structures were there.  The Hornby resident felt they 
were unable to offer a meaningful response to the TUP.  
 Regarding the 2021.1 Laskin TUP, the pedestrian and vehicle traffic around this busy site is 
dangerous and should be made safer with 4 crosswalks and appropriate signage. 
o A Trustee agreed that the traffic was very dangerous and offered to speak to local 
Constable Jones. 
 The Local Trust Committee should maintain a moratorium on implementing Bylaw 
Enforcement Notifications (BEN) on non-conforming housing for workers on Hornby until 
housing problems can be resolved.

(TUPs) for worker housing. The following 3 options were presented to the Local Trust 
Committee:
1.Under the current Official Community Plan (OCP) and Land Use Bylaws (LUB), directs
staff to prioritize TUP applications for temporary seasonal accommodations on 
properties within zones designated for TUPs under LUB Section 10.2.
2.Direct staff to batch process such TUP applications to be brought before the LTC for 
consideration together at the same regular business meeting for expediency,
providing all information was complete for each application. This could be
 
accomplished by letting the public know that applications would be accepted by a 
certain date.
3.Direct staff to utilize a combined public notice strategy for the batched TUP 
applications and investigate the potential for reduced individual application fees,
based on a non-refundable application fee and separate public notice fee structure.
Item 3 would necessitate the initiating of a project as it would be more work for 
staff.

availability of Temporary Use Permits for seasonal accommodation.

7.3 Letter dated May 15, 2021 from S. Stanford, Assistant Deputy Minister, Ministry of
Citizens' Services to Chair Fast regarding letter of support for Connected Coast 
Network
A Trustee noted that Karen Ross was a good contact person for this issue and that high 
quality internet was of vital importance to Hornby Island residents. No further action 
was deemed necessary at this time.
APPLICATIONS AND REFERRALS
8.1 HO-DVP-2021 (4280 Brigantine Crescent) - Staff Report
Regional Planning Manager Kauer provided an update on this Development Variance 
Permit application that would allow an existing carport to encroach 11 inches into a 
required 8 metre side-yard setback. The present encroachment was due to contractor 
error. The site is not subject to bylaw enforcement and there is minimal impact to the
neighboring property.

owner would have received a letter of information and would have been given at least 
10 days to respond, which is the minimum amount of time affected property owners 
must be given to react under the Local Governance Act. 
 
A trustee noted that ‘minimum’ time requirements for adjacent property owners to 
respond to applications may not be adequate. 
8.2 HO-TUP-2021.1 (Laskin - 3005 St. John's Road) - Staff Report 
Regional Planning Manager Kauer provided an update for this new TUP application to 
allow liquor sales in a beer garden as part of and in addition to an existing food service 
operation.

9.1 Minimum Average Lot Area Amendments Project (MALA) - Staff Report 
Planner Mahikwa presented the staff report dated July 16, 2021 that recommends 
options for the LTC to move forward with Draft Bylaw Nos. 166 and 167 and provides 
analysis of the Wiseman proposal to amend the bylaw to allow smaller than allowable 
minimum lot sizes if a ‘portion’ of the subdivision is dedicated to the community; staff 
concluded that such an amendment could allow unintended density increases and 
would involve substantial changes to the existing bylaws.  
 
Planner Mahikwa added that there are Hornby property owners desiring to subdivide 
whose plans are stalled while waiting for Bylaw Nos. 166 and 167 to pass. 
 
Regional Planning Manager Kauer clarified that R2 zoning presently and clearly disallows 
lots smaller than 1 ha for residential use. The Wiseman proposal would allow 
subdivisions of multiple residential lots smaller than 1 ha in exchange for a single 
dedicated ‘portion’ of community land in the subdivision. To consider lots smaller than 1 
ha, the R2 zoning would have to change. There is no minimum land size for community 
land dedications.

the Islands Trust Draft Policy Statement. Detailed updates could be provided as that 
work progresses.  
 The 2008 Protocol Agreements with Stz’uminus and Lyackson First Nations were still 
relevant though at different stages of being revitalized. 
 Formal referrals and other major initiatives are sent to all First Nations that have 
expressed rights and title and have treaty and territorial areas that encompass the 
island. Some First Nations may express particular interest in land use decisions in 
areas that they see as their core territory, while some may be interested only in 
marine issues. 
 For concerns regarding ancestral loved ones, or sacred or cultural sites, staff will 
notify the Archaeology branch if no response has been received by a First Nation. 
o Trustees requested further information on the existing Protocol Agreement with 
Kómoks First Nation. 
o Senior Advisor Wilcox offered to forward any found information back to the 
chair; and, to check that First Nations other than Kómoks had been 
informed of the finding of remains at the Thatch. 
Regional Planning Manager Kauer noted that only the K’ómoks First Nation has 
expressed interest in being proactively notified about Hornby Island permits and 
applications activity.

12.1 Trust Conservancy Report dated May 25, 2021 
Trustee Allen enjoyed that the video presentation from Carla Funk, Islands Trust 
Communications and Fundraising Specialist, was inspirational and motivating for 
conservation fundraising. Chair Fast added that the Natural Area Property Tax 
Exemption Program (NAPTEP) was only available in the Islands Trust. 
12.2 Applications Report dated July 8, 2021 
Trustees requested that the historical background information on Bradsdadsland be 
included in the upcoming staff report on the application. 
 
Regional Planning Manager Kauer offered to provide Trustee Allen with further 
clarification on the acronym NARU in the application HO-SUP-2021.1-Stead. 
 
Regional Planning Manager Kauer noted that regarding the application HO-TUP-2020.2-
Payne, the TUP permit has not officially been issued pending Vancouver Island Health 
Authority (VIHA) approval.
