[0:00:17] Trustee Luckham: My name is Peter Lockham. I'm the chair of Alistair's Council. I'm elected on Thetis Island, which is in the Lyexin and Penelakut territory.
[0:00:28] Trustee Luckham: We are meeting broadly across the Coast Salish Territory today.
[0:00:34] Trustee Luckham: I'll get executive and staff to mention, make a territorial acknowledgement of where they are today.
[0:00:43] Trustee Luckham: It's looking like a beautiful morning here and a nice day ahead of us.
[0:00:49] Trustee Luckham: certainly many aspects of the wet coast which is such an amazing place to be to live and to be
[0:00:58] Trustee Luckham: and every day wake up to recognizing and realizing the rich history that has been in this place since
[0:01:06] Trustee Luckham: the beginning of time through the Coast Salish people for which there's many stories which can
[0:01:13] Trustee Luckham: can enhance your experience of this place if you have the opportunity to hear them and would
[0:01:19] Trustee Luckham: suggest that you do when the opportunity arises. So I'm going to just start with introductions.

[0:03:03] Trustee Luckham: areas, no decision making there. And I would like, if that's all right, to preserve that
[0:03:10] Trustee Luckham: opportunity for the sharing that we do after this electronic meeting because of
[0:03:15] Trustee Luckham: course we didn't include that on this agenda so we'll go through this agenda

[0:05:53] Voice 7: to a december live trust council meeting or not um we've worked up a couple of options here i think
[0:06:00] Voice 7: in total there's four options one is to simply have a live meeting which seems obvious um yes we
[0:06:07] Voice 7: can um the second is to um waive
[0:06:12] Voice 5: our requirement the
[0:06:20] Voice 7: next is to waive a requirement for um the
[0:06:23] Voice 7: limitation on the number of people that can attend and the you know basically the third is to do some
[0:06:28] Voice 7: significant administrivia to try and organize our way to having a fully electronic meeting
[0:06:34] Voice 7: and Carmen's come up with this report and she can kind of walk us through it and give you the
[0:06:41] Voice 7: results of the poll that supported this recommendation. Over to you Carmen.

[0:06:50] Voice 2: the SurveyMonkey poll showed us that 17 trustees confirmed they'd attend and plus two chair
[0:06:59] Voice 2: Chair Luckham and Vice Chair Fass. So 19 out of 26, six trustees indicated they would not attend
[0:07:05] Voice 2: in person and there was no response from one of the trustees. So it's a pretty good over a majority
[0:07:12] Voice 2: of folks, trustees said they would attend in person. So the recommendation is that we conduct
[0:07:22] Voice 2: an RWM to waive that requirement that there can't be more than four trustees attending
[0:07:28] Voice 2: attending electronically at the next regular meeting to allow the six or seven, however many
[0:07:34] Voice 2: have indicated they won't attend.
[0:07:41] Voice 7: So yeah, that's basically the recommendation. I'd probably
[0:07:44] Voice 7: recommend we go to 10 just in case or some number like that just to provide some flexibility. It's
[0:07:51] Voice 7: a one-off. And of course, keeping in mind at the December meeting, we will make those changes to
[0:07:58] Voice 7: the meeting procedures bylaw that we need so that any future meetings can be electronic right so
[0:08:04] Voice 7: that's the recommendation
[0:08:05] Voice 7: so this is
[0:08:07] Trustee Rogers: a one-off this is a
[0:08:08] Voice 7: one-off to sort of address the uncertainty
[0:08:11] Voice 7: we are just generally in the province around where people feel safe or don't but also
[0:08:21] Voice 7: honoring our schedule and it looks like the majority i think it's almost now 20 out of 26
[0:08:28] Voice 7: would indicate that they would would um actually come for the meeting i
[0:08:33] Trustee Rogers: know can i ask a question
[0:08:34] Trustee Rogers: just i know all of the um uh survey monkey was was an anonymous at least to us and we're just
[0:08:41] Trustee Rogers: numbers but will there can you can you advise whether there were is there any local trust area
[0:08:47] Trustee Rogers: that where both people said they wouldn't come
[0:08:49] Voice 7: that's a great question i'm going to turn that

[0:09:25] Trustee Fast: about actually leaving it open the way it is in the recommendation then you can respond to
[0:09:30] Trustee Fast: the changes because things are changing the masks in schools the borders opening the vaccines or do
[0:09:38] Trustee Fast: you want an actual number russ yeah

[0:09:43] Voice 7: is that if it was too flexible you could go past a majority and i think frustrate the intention of
[0:09:50] Voice 7: the provincial direction meaning very good and
[0:09:53] Voice 7: it's an example that we don't want to set for
[0:09:55] Voice 7: ltcs to um sort of pull the same maneuver very
[0:09:59] Trustee Fast: good that's what i
[0:10:01] Trustee Fast: just wanted to check about
[0:10:02] Trustee Fast: that because i was thinking about quorum if we should have a quorum in person okay so that then
[0:10:08] Voice 7: you would possibly amend the recommendation and i'd love carmen to nod that she agrees
[0:10:15] Voice 7: that the more that that be changed to 10 to
[0:10:20] Voice 2: allow up to 10 council members yes right
[0:10:23] Voice 7: Right. So I,
[0:10:27] Trustee Rogers: again, I'm ready to make that motion unless other vice chairs would like to wait for
[0:10:32] Trustee Rogers: the chair to get back. I am here. Oh,

[0:10:43] Trustee Luckham: I'm satisfied with the recommendation. You know,
[0:10:46] Trustee Luckham: something certainly less than quorum would ensure that the quorum would be maintained in the in
[0:10:53] Trustee Luckham: in-person aspect which is the CAO has indicated would respect the provincial intention so I'm
[0:11:00] Trustee Luckham: happy with that if you want to make the motion Dan unless there's some other discussion there's
[0:11:04] Voice 7: one more point I'd like to make every trustee who doesn't attend oh
[0:11:10] Trustee Luckham: please there will be some
[0:11:12] Voice 7: financial impact right because we booked a room and I don't know the minutiae of what those
[0:11:20] Voice 7: cancellations are so if we right now we have 26 and then we're going down to six lori will try
[0:11:26] Voice 7: and make those changes accordingly probably keep a couple rooms for mind changers and um but if it
[0:11:35] Voice 7: did go to 10 you know that's a third of the cost that we may have absorbed i don't know of an easy
[0:11:39] Voice 7: way to address that um so i think we just have to proceed on the basis that um we'll absorb whatever
[0:11:46] Voice 7: financial challenge there is for this and let Laurie do some magic.
[0:11:51] Voice 7: Maybe you'd want to say something about that, Laurie, before they vote.
[0:11:54] Voice 1: Sure. I'll just let you know that the drop dead room deadline with the hotel is October 29th.
[0:12:00] Voice 1: So this poll gives us the numbers that I'd be taking to the consultant I'm seeing on Friday
[0:12:06] Voice 1: to discuss all the details for our upcoming meeting.

[0:12:19] Trustee Rogers: i'll move that executive committee request staff to conduct a trust council resolution
[0:12:25] Trustee Rogers: without meeting to waive the requirements in section 4.4 c of trust trust council bylaw 101
[0:12:33] Trustee Rogers: to allow up to 10 council members to participate electronically in the november december 2021
[0:12:40] Trustee Rogers: 21 regular trust council meeting
[0:12:47] Voice 7: seconded by fast so that's

[0:12:56] Trustee Luckham: yeah yeah i can see um so if there's no further discussion i'll call the vote all those in favor

[0:13:11] Trustee Luckham: and then you're in favor in favor
[0:13:13] Trustee Luckham: so that carries unanimously and so excellent that was uh painless
[0:13:19] Trustee Luckham: uh trustee pence if you have a remark uh
[0:13:22] Trustee Patrick: i just wanted to follow up um i understand the cost
[0:13:27] Trustee Patrick: savings and that the hotel expires there at the 29th i i think that uh you know we have yes we
[0:13:33] Trustee Patrick: have to keep the rwm clean when it goes out for the vote but i think there needs to be an early
[0:13:37] Trustee Patrick: information package, but that may be trust, you know, even though you said, do you plan on
[0:13:42] Trustee Patrick: attending? I think there needs to be, you know, a little bit firmer question that, you know,
[0:13:48] Trustee Patrick: confirm your attendance. We are booking the hotel that, you know, because that's my concern is,
[0:13:56] Trustee Patrick: we do want to be responsible for the cost savings, but somebody may change their mind
[0:14:00] Trustee Patrick: at the last minute and say, oh, I can stay out now because there's up to 10.
[0:14:05] Voice 7: Excellent. That is good advice. And we will do that. We will indicate that because some of the responses were a bit quippy, I think would be a fair way to say it. So, or amusing. And we would want those to be firm so that we can plan. That's number one.
[0:14:26] Voice 7: And number two, Carmen, not to put you on the spot, could you take us through if this RWM is not successful, what the options we would be faced with are?
[0:14:39] Voice 2: I guess the fallback would be that up to four trustees can attend electronically.
[0:14:48] Voice 7: Right. So how would this fail then? How would the RWM not go forward?
[0:14:59] Voice 7: what what if
[0:15:01] Voice 2: you didn't achieve a majority of 13 out of 26 trustees voting yes for this
[0:15:08] Voice 2: or hang on a second the waiver the way the bylaw is written the waiver has to be unanimous
[0:15:16] Voice 2: unanimous
[0:15:17] Voice 7: that's right that's
[0:15:19] Voice 2: why we did that poll ahead of time so
[0:15:22] Voice 7: just in terms of the jeopardy
[0:15:24] Voice 7: we have is if one trustee votes against this this isn't an option uh

[0:15:34] Voice 2: trustees attend electronically no right
[0:15:37] Voice 7: so then we'd be down to the four so we would have a live
[0:15:41] Voice 7: meeting with four attendees or if the person who objected wanted discussion and i don't want to
[0:15:50] Voice 7: over complicate this then i guess we could call
[0:15:55] Voice 2: a special meeting call
[0:15:57] Voice 7: a special meeting of trust
[0:15:58] Voice 7: council to debate this matter and still arrive back at the 10 people at a vote at a special
[0:16:04] Voice 7: meeting is that muddy muddy
[0:16:06] Voice 7: enough for everybody i just don't want anyone to be surprised if we
[0:16:11] Voice 7: don't get one trustee who just doesn't feel like it or has a different view um could affect the
[0:16:20] Voice 7: outcome of the of the vote um
[0:16:24] Trustee Luckham: well you know it would be an interesting scenario for sure
[0:16:30] Trustee Luckham: um because i'm inclined to if it failed to not push the question and have a special meeting
[0:16:38] Trustee Luckham: and just leave it the way it is and four people will have the first four p you know the four
[0:16:44] Trustee Luckham: people will be offered the opportunity to uh okay out
[0:16:47] Trustee Luckham: of ten and then and then but i think that
[0:16:50] Trustee Luckham: that without, you know, I don't want to, it appear to be that there's any pressure to trustees to
[0:16:58] Trustee Luckham: vote in favor, because of course they can vote according to their will. However, I think that
[0:17:02] Trustee Luckham: it should be apparent to trustees that if they don't vote in favor, that we will go to four
[0:17:08] Trustee Luckham: attendees, and then that four attendees will have to be selected in some fashion. And I think we
[0:17:15] Trustee Luckham: should be, and maybe that's a discussion now, we should be clear about how that selection would
[0:17:20] Trustee Luckham: would happen. So it would strike me that one, it would be those with a medical or other necessity
[0:17:26] Trustee Luckham: unable to attend for not just pandemic issues, but any other health reason not able to attend
[0:17:34] Trustee Luckham: a meeting. And then two, it would
[0:17:37] Trustee Luckham: be those that have a health reason associated with wearing a
[0:17:44] Trustee Luckham: mask um and so then that would be it would seem to me to be the priority and that would only be
[0:17:51] Trustee Luckham: four people and
[0:17:54] Voice 7: potentially people who are not vaccinated uh
[0:17:59] Trustee Luckham: yeah and so that's a pandemic reason
[0:18:01] Trustee Luckham: but yeah it begs for me it begs a question here which is really interesting so it's four people
[0:18:09] Trustee Luckham: and those people get uh appointed in some fashion and then a fifth person does not show up at
[0:18:16] Trustee Luckham: council what does that do for us

[0:19:01] Trustee Fast: of uh checking people's vaccine status i don't know if we can do that and um how difficult it
[0:19:08] Trustee Fast: would be and whether we could be sure of answers anyway um but maybe that all goes away with what
[0:19:15] Trustee Fast: carmen just said so that's fine and
[0:19:18] Trustee Luckham: actually the vaccine passport is the uh is the method of
[0:19:24] Trustee Luckham: indication but we can't do that we
[0:19:26] Voice 7: can't we can't but we're having trustees volunteer that
[0:19:29] Voice 7: information to say i don't want to come to trust council because i'm not vaccinated and i don't
[0:19:35] Voice 7: want to put anyone else in an uncomfortable position it's not that we're asking them their
[0:19:38] Voice 7: status they're volunteering their status and
[0:19:42] Trustee Luckham: that's right yep thank you so i
[0:19:46] Trustee Rogers: was just going
[0:19:47] Trustee Rogers: to say okay thanks um yeah we don't want to make that i don't think we need to we should make that
[0:19:55] Trustee Rogers: public but um um i was going to say that um i i think when you send out the rwm and i think we
[0:20:05] Trustee Rogers: We need to make clear that if it's not unanimous, it fails.
[0:20:08] Trustee Rogers: It's the only way it passes if it's unanimous.
[0:20:11] Trustee Rogers: So we don't have anybody, I don't know that anybody would do that,
[0:20:14] Trustee Rogers: but sort of voting against it just because they don't like the process

[0:20:22] Trustee Rogers: And that's the only way we can waive the provision is if it's unanimous.

[0:21:19] Trustee Rogers: i was i had not connected the dots that it had to be unanimous

[0:21:28] Trustee Luckham: you might want to add as a point of clarity and i noticed that one trustee did ask what measures
[0:21:33] Trustee Luckham: were being taken to ensure that it's safe and maybe that could just be iterated in the
[0:21:38] Trustee Luckham: in the message for what you have based upon provincial guidelines yeah
[0:21:44] Voice 7: those are minimal
[0:21:47] Voice 7: so it's face masks okay
[0:21:50] Trustee Luckham: oh but the hotel will be conducting cleaning and all of these other
[0:21:55] Trustee Luckham: things right correct

[0:21:57] Trustee Luckham: so that's reasonable to consider in all of that hand sanitizer um etc
[0:22:04] Trustee Luckham: mr chair okay and now uh let me just ask are we because i see you holding a co2 sensor up there

[0:22:19] Trustee Fast: mention this co2 sensor is another thing we can have with us um but i wouldn't mention it i haven't

[0:22:31] Trustee Luckham: professional capability to make any judgment on co2 having any bearing on what is the i can send
