[0:01:25] Voice 3: uh in order to consider one event i want to take a moment to just uh just indicate what we're going
[0:01:35] Voice 3: to do but also acknowledge that of course we're grateful to be living in and working across the
[0:01:41] Voice 3: traditional territories of the coast salish peoples um and for those of you on uh galliano
[0:01:48] Voice 3: of course there's a deep tradition of the coast salish peoples of many uh from many um uh
[0:01:54] Voice 3: backgrounds, but also the
[0:01:56] Voice 3: Penelakut First Nation
[0:01:57] Voice 3: that has a long
[0:02:00] Voice 3: history in that area.
[0:02:02] Voice 3: I'm always struck by, as
[0:02:04] Voice 3: I go around and sort of read some
[0:02:06] Voice 3: of the histories of the various areas of how
[0:02:09] Voice 3: mobile the
[0:02:10] Voice 3: various Coast Salish
[0:02:12] Voice 3: First Nations and
[0:02:13] Voice 3: the groups were, that they were
[0:02:16] Voice 3: coming back and forth across the Salish
[0:02:18] Voice 3: Sea and around the Salish Sea from all
[0:02:20] Voice 3: parts of
[0:02:21] Voice 3: of this gorgeous area.
[0:02:25] Voice 3: And we're very privileged to be living and working here now.

[0:02:35] Voice 3: Jane Wolverton and Tahira Rockefeller.

[0:02:43] Voice 3: where we got to see each other in person for a while.
[0:02:45] Voice 3: Hopefully we'll be back there soon
[0:02:47] Voice 3: if this goes as the public health orders are very hopeful that it will be.
[0:02:53] Voice 3: We're taking this step, however, in the anticipation that the pandemic may continue.
[0:03:00] Voice 3: We know and note with some concern and sadness, of course,
[0:03:06] Voice 3: that the hospitalizations are going up quite rapidly in the province.
[0:03:10] Voice 3: And we're hoping for a quick plateau and reduction soon.
[0:03:16] Voice 3: soon, but we have to watch it and be careful, and we have to adapt, as we've been doing for
[0:03:23] Voice 3: 22 months now, almost exactly 22 months. It was March 16th, I believe, we started to enter into
[0:03:33] Voice 3: this new way of producing. Anyway, this is a special meeting. You'll also see Robert Kojima,
[0:03:38] Voice 3: who's the regional planning manager on the call. Thank you for joining us. I saw briefly Brad
[0:03:48] Voice 3: Smith in the background and Carly Emm is here. She's our minute taker. I'm not sure who else
[0:03:54] Voice 3: is here. I don't see anybody else on the list except in the background. I know we have Robin
[0:04:02] Voice 3: Elchuk who's running the controls. So as I said, today is going to be purely electronic. This is a
[0:04:08] Voice 3: special meeting for what are considered to be urgent matters under the provisions of the
[0:04:18] Voice 3: current administrative public participation bylaws, sorry, the meeting procedures bylaws
[0:04:26] Voice 3: to allow us to adopt new procedures so that we can go ahead and have electronic meetings as and
[0:04:34] Voice 3: when we need them uh in in the future um in short when we were doing this process in up until the
[0:04:43] Voice 3: end of september of 2021 we were doing so pursuant to uh the emergency uh orders from the province
[0:04:50] Voice 3: who effectively suspended our our legislative and and bylaw provisions to allow us to to do meetings
[0:04:58] Voice 3: in this format uh those emergency health orders or the emergency orders from the province expired
[0:05:05] Voice 3: at the end of september um we were in the process of working our way through to getting to the point
[0:05:10] Voice 3: where we could do what we're trying to do electronically uh but we were went back to
[0:05:16] Voice 3: in person meetings you if you've been you may know that we had two of them i believe
[0:05:21] Voice 3: correct me where that we had two i believe october and the end of november or was the
[0:05:26] Voice 3: the beginning of december yeah and so we had two in-person meetings um which was great to be back
[0:05:34] Voice 3: on the island we we truly felt that it was not the time to be having an in-person meeting on
[0:05:40] Voice 3: on our next scheduled meeting which is february the 7th is it i got that right um yes uh and so
[0:05:48] Voice 3: we felt this process to allow us to do that so we have an agenda which is basically to consider
[0:05:53] Voice 3: to consider the new bylaw, which is put forward as bylaw number, I'm sorry, I was researching around 282, which is in the agenda package to consider to allow us to have an electronic meeting going forward.
[0:06:13] Voice 3: So there's a very short agenda. So I've called us to order. Is there anything else that either of the trustees wish to add to the agenda?
[0:06:20] Voice 3: no okay so thank you we'll take the agenda approved as as um provided uh and and uh so
[0:06:29] Voice 3: the next thing is the only order of business then is the galeano bylaw 282 for consideration
[0:06:36] Voice 3: um rpm kojima do you want to introduce this and then we can have a conversation
[0:06:41] Voice 3: thank
[0:06:41] Voice 2: you chair so chair rogers outlined the context of this um the changes to the legislation
[0:06:49] Voice 2: and the ending of the ministerial order allowing for electronic meetings and so with the changes
[0:06:56] Voice 2: to the legislation local governments can now hold regular meetings electronically
[0:07:01] Voice 2: but to do that you need to amend your meeting procedures bylaws so with that this would be
[0:07:10] Voice 2: presents a new whole new meeting procedures bylaw rather than making an amendment to the existing
[0:07:16] Voice 2: The existing one was adopted quite some time ago and presents the latest version or the most recent version of the meeting procedures bylaw, which is based on Salt Springs version of the meeting procedures of their meeting procedures bylaw, which was adopted or substantially amended in 2014.
[0:07:37] Voice 2: So in addition to the electronic meeting provisions for regular meetings, there are some other
[0:07:47] Voice 2: there would be some other changes if the bylaws adopted some I'll just go through there in
[0:07:53] Voice 2: the bullets in the staff report.
[0:07:55] Voice 2: Some are fairly minor like that the first meeting of the term would be determined by
[0:08:01] Voice 2: by RWM rather than by the chair.
[0:08:04] Voice 2: With the electronic meeting provisions,
[0:08:06] Voice 2: it would establish that instead of a minimum
[0:08:08] Voice 2: of two meetings per year,
[0:08:09] Voice 2: there would be a minimum of two in-person meetings per year.
[0:08:14] Voice 2: The notice for electronic meeting provisions would be added.
[0:08:19] Voice 2: And then there's some new sections
[0:08:20] Voice 2: that come from the Salt Spring version
[0:08:23] Voice 2: that are proposed to be included in this.
[0:08:26] Voice 2: Section on delegations, section on order and decorum,
[0:08:29] Voice 2: section authorizing local trustees to invite presentations to the local trust
[0:08:34] Voice 2: committee a section on public participation procedures um also add i just sent an email
[0:08:42] Voice 2: to the to the ltc that chair rogers caught an error in the version of the bylaw it didn't
[0:08:50] Voice 2: include in section three the provisions in the current bylaw for uh posting a meeting meeting
[0:08:58] Voice 2: meeting notices on island in addition to at the island's trust office so i've sent a wording that
[0:09:05] Voice 2: would uh put that old language back in okay
[0:09:13] Voice 3: um so trustees i i uh i uh open for comments or
[0:09:20] Voice 3: questions from you um presuming uh we put that language back into section three and amend the
[0:09:26] Voice 3: bylaws uh do you have any commentary i have a bit but i'd like to hear what you have to say before

[0:09:38] Voice 5: meeting by giving notice uh by telephone or written notice and i wonder if we can uh add in

[0:10:30] Voice 5: um many delegations on a particular issue um or not so that i was a little concerned about that
[0:10:39] Voice 5: and um there is the same with the public participation um period being limited to 15 minutes
[0:10:51] Voice 5: it's in sorry in number 34 and then there was in number 50 the sentence there's I think there's a
[0:11:08] Voice 5: either a comma missing it goes to means that the that they okay so for the duration of the
[0:11:17] Voice 5: of an LTC meeting conducted by electronic or other communication means that is open to the public
[0:11:23] Voice 5: a designated staff member shall be in attendance and then it should be I think comma attend at the
[0:11:29] Voice 5: place or would that be also attend electronically no
[0:11:33] Voice 2: I think it's it's that's a dead error that's
[0:11:36] Voice 2: just to be one or the other attendance shall be in attendance and just strike out attend okay
[0:11:42] Voice 5: Okay. But would that include electronic attendance? Because

[0:11:54] Voice 3: So, and this is a question I have. So this, this new procedure bylaw still requires there to
[0:12:02] Voice 3: be a location that someone theoretically could show up at to watch the, and the idea would be,
[0:12:12] Voice 3: my understanding would be that if we were having an electronic meeting, in addition to making
[0:12:16] Voice 3: it available in this format over zoom or whatever electronic meetings we do they would they would
[0:12:22] Voice 3: still require that there would be a location uh normally would be the victoria office where
[0:12:28] Voice 3: someone theoretically could attend and watch if they wanted to correct
[0:12:33] Voice 3: and how would a staff what
[0:12:35] Voice 3: how would we stop that who would be the person
[0:12:37] Voice 2: so if the meeting is during business hours regular
[0:12:40] Voice 2: business hours the office would be open to the public you know there would be staff in attendance
[0:12:44] Voice 2: But it is a consideration for regular meetings that extend past business hours.
[0:12:51] Voice 2: So there would have to be a second, you know, the basically probably the planner would be in the office, but there would have to be a second person in the office as well to allow people to enter and just to be a second presence there.
[0:13:10] Voice 2: And that's a legislative requirement.

[0:13:14] Voice 3: it's still it's still the i mean i knew that was the legislative requirement that's still
[0:13:20] Voice 3: the registry you still have to have a location correct

[0:14:12] Voice 3: is oh oh we have a question um so is eden toff uh the answer is no
[0:14:22] Voice 3: um i did that the provisions of the bylaw would be that there uh that if we decide to have an
[0:14:32] Voice 3: electronic meeting um there would not be a an on island in-person venue to watch the meeting
[0:14:40] Voice 3: Yeah. I
[0:14:41] Voice 2: would just clarify this. It's not required, but doesn't preclude someone from, you know, setting up a space and having the Zoom call.
[0:14:52] Voice 3: Right. So the purpose of this is, frankly, is that, I mean, as a fallback, as a provision to allow us to do these meetings in a safe and inclusive way.
[0:15:08] Voice 3: way. So I have a broader consideration. Oh, yes.

[0:15:13] Voice 7: I just want to ask one question, chair. I'll just thank you, Robert.

[0:16:04] Voice 3: delegations, order and decorum,
[0:16:06] Voice 3: invited presentations and public participation
[0:16:09] Voice 3: patient are all new to the bylaw.
[0:16:12] Voice 3: The current bylaw contains nothing related to any of those.
[0:16:18] Voice 3: And they're drawn word for word from Salt Spring.
[0:16:22] Voice 3: And you said they were adopted in 2014.
[0:16:25] Voice 3: I thought they were more recent than that, but I could be wrong.
[0:16:28] Voice 3: It doesn't matter.
[0:16:30] Voice 3: They're drawn from Salt Spring.
[0:16:33] Voice 3: And I'm a little concerned, and frankly, I will be frank,
[0:16:39] Voice 3: um for public i was a little not i suppose surprised i was a little uh this is not they
[0:16:45] Voice 3: weren't this is not what i had sort of anticipated when we set up this meeting i sort of thought
[0:16:50] Voice 3: we're going to put the electronic provisions into alaska ahead and they do set in place some
[0:16:56] Voice 3: restrictions around both public participation and delegations that don't currently exist in
[0:17:04] Voice 3: a formal way we tend to do a bit more ad hoc um i make decisions or we may as a group make
[0:17:11] Voice 3: decisions about what can and can't come and i'm a little i'm i'm a i i'm a little um hesitant to
[0:17:18] Voice 3: adopt those without any public input um because they do put some limitations on public participation
[0:17:27] Voice 3: although they can
[0:17:28] Voice 3: be waived of course um by unanimous consent of the local trust committee
[0:17:32] Voice 3: but I hate to be I have to do that and I I not to complicate matters but I wondered what trustees
[0:17:39] Voice 3: would think about sort of removing those sections and have them come back to us in a public meeting
[0:17:44] Voice 3: to to talk through and and hear any considerations about it I know that this complicates things for
[0:17:53] Voice 3: um the RPM and the staff because it would mean we'd have to approve the bylaw that we we might
[0:17:59] Voice 3: might approve today um and then have to amend that bylaw later in in in our term and um and then and
[0:18:08] Voice 3: both of those would have to be approved by um uh by uh by the executive and the staff would have
[0:18:15] Voice 3: to bring another another uh amendment to the to the table but i must admit i am a little concerned
[0:18:22] Voice 3: about about approving restrictions on delegations uh time frames order and not so much the order
[0:18:29] Voice 3: and decorum and public participation without having the community have an opportunity to weigh
[0:18:37] Voice 3: in on those. So do you guys have any thoughts about those, my thoughts on that?
[0:18:45] Voice 5: I would agree,
[0:18:46] Voice 5: but I'd like to hear what Trustee Rockefeller has to say overall.
[0:18:54] Voice 4: I don't really, I mean,
[0:18:58] Voice 4: I think that they can be waived and I think that we often set limits with around that area. So
[0:19:03] Voice 4: So I'm not overly concerned because we often have public participation and we make it as long as it wants.
[0:19:11] Voice 4: So, I mean, I think it's if you guys have a problem with it, I'm happy to support, you know, more participation with the community, like to further this discussion.
[0:19:20] Voice 4: But I'm also I don't think it unfairly limits public participation because it can be waived at any opportunity.

[0:19:31] Voice 3: Yeah. RPM.

[0:19:34] Voice 2: another thought or suggestion, you know, we're constantly being encouraged to do everything
[0:19:41] Voice 2: consistently across local trust areas, particularly in terms of administrative bylaws, and this
[0:19:46] Voice 2: may be something that, you know, if these particular provisions, which came from Salt
[0:19:52] Voice 2: Spring, are not appropriate for other LTCs, it may be something for even trust counsel
[0:20:01] Voice 2: or perhaps executive to turn its mind to coming up with a whole new model bylaw
[0:20:09] Voice 2: that is more acceptable to the whole range of local trust areas.
[0:20:16] Voice 3: Yeah, and here's my consideration.
[0:20:21] Voice 3: It's not even so much that they're very problematical.
[0:20:24] Voice 3: Well, there's a few things that I want to think about.
[0:20:27] Voice 3: Like, for example, I can't think of a town hall slash public participation section that on Caliano that only lasted 15 minutes, which is, yeah, Christy Rockwell.
[0:20:41] Voice 4: Sorry, I think I misunderstood. I thought it was 15 minutes per delegation.
[0:20:45] Voice 3: No, no, if you go to the public participation, it says the
[0:20:48] Voice 4: public
[0:20:49] Voice 3: participation period limited to 15 minutes in duration.
[0:20:54] Voice 3: It's section 434.
[0:20:55] Voice 3: for?
[0:20:56] Voice 4: Yeah, I was reading that. I assumed it was just per person because we often give 10 to 15
[0:21:01] Voice 4: minutes. And that's why I was like, that seems like lots of time. It is
[0:21:05] Voice 4: lots of time.
[0:21:05] Voice 3: If I let
[0:21:07] Voice 3: delegates talk for 15 minutes, not delegates, town hall participants for 15 minutes, our meetings
[0:21:15] Voice 3: would last till the next day.
[0:21:17] Voice 4: Well, that's why I thought it seemed perfectly reasonable, but I
[0:21:19] Voice 4: guess because I just
[0:21:20] Voice 4: didn't assume. Yeah, I mean, that would be problematic on Galliano than having
[0:21:25] Voice 4: having those restrictions that tight.
[0:21:27] Voice 4: We would be waiving them every meeting.
[0:21:29] Voice 4: So my apologies, I misread that.
[0:21:33] Voice 3: Yeah, Trustee Wolford.
[0:21:35] Voice 5: Yeah, I also think that it sends a message,
[0:21:40] Voice 5: in my mind, it sends a message that we do not want
[0:21:43] Voice 5: to hear very much from the public.
[0:21:47] Voice 5: I mean, I would rather leave it open
[0:21:51] Voice 5: and then we determine at the meeting.
[0:21:54] Voice 5: I mean if we have 20 people who want to speak on a matter then that's one thing if we have two
[0:21:58] Voice 5: that's another issue but I don't think we want to um indicate at all that we are kind of reducing
[0:22:08] Voice 5: the um public participation that would be my my feeling right
[0:22:14] Voice 3: and and I you know I mean with all
[0:22:17] Voice 3: respect to Salt Spring it's a different dynamic in two ways one is um and even the order of
[0:22:24] Voice 3: public participation, which is in section 40, doesn't make a lot of sense for Galliano. It
[0:22:33] Voice 3: makes sense for Salt Spring, and I know they have a very defined way, but that's because their
[0:22:37] Voice 3: agendas, even compared to Galliano's, are huge. They'll often have 10 or 12 applications on their
[0:22:45] Voice 3: agenda for a day. I mean, they just have to have a much more rigorous approach to this, or they'll
[0:22:51] Voice 3: never get through their agenda um i mean just they'll never do it because i i only i chaired
[0:22:57] Voice 3: it once uh and because the chair uh luckham was away and i shared salt spring once it's and it's
[0:23:04] Voice 3: you know it's a it's like a small town right it's um it's very different and uh when you have a
[0:23:12] Voice 3: dozen applications on the agenda my my suggestion would be and i just and i know this is a bit
[0:23:19] Voice 3: administratively cumbersome for the for the rpm um is i guess my bigger concern is not even so much
[0:23:27] Voice 3: the content is is to pass those sections into our procedures bylaw without having any uh parts
[0:23:36] Voice 3: any input from the community about what might be appropriate is i think a bit i find a bit
[0:23:42] Voice 3: troublesome. And it's pretty clear to me that even compared to two years ago, although Galeano
[0:23:53] Voice 3: folks on the island pay attention to what the work we're doing is pretty carefully,
[0:24:02] Voice 3: but even compared to two years ago, the communities are watching what we're doing
[0:24:07] Voice 3: quite a bit more and want to have input into things so my suggestion would be to make the
[0:24:13] Voice 3: two small amendments that we talked about one in section three one in section um was it 50
[0:24:21] Voice 3: 50 uh and then um amend it by removing uh sections 18 to um to 40 and ask the staff
[0:24:35] Voice 3: and amend it by removing those, renumber it,
[0:24:38] Voice 3: and then bring it back, but bring those sections back
[0:24:41] Voice 3: to the local trust committee at a future local trust committee meeting
[0:24:45] Voice 3: for our consideration.
[0:24:47] Voice 3: And then we can hear in a town hall or from commentary
[0:24:51] Voice 3: from the community what they think of those provisions.
[0:24:54] Voice 3: There's a number of very experienced former trustees
[0:24:59] Voice 3: and people have been involved with the local trust committee
[0:25:02] Voice 3: for years on Galeano who occasionally often have very good ideas and so that's my suggestion I
[0:25:11] Voice 3: don't know what you I know that this makes difficulty for the staff but the intent of
[0:25:16] Voice 3: this meeting in my view was to allow us to have the electronic meeting on February the 7th
[0:25:21] Voice 3: put in place the the provision the the ability to do that and and then we can consider all of
[0:25:28] Voice 3: of these some of which are extremely good suggestions and then we can work our way
[0:25:33] Voice 3: modify them and put them in but it may end up with a scenario where we don't have exactly the
[0:25:38] Voice 3: same bylaw as salt spring and i know that staff would like us to have as much consistency as
