[0:01:53] Trustee Luckham: Trust Committee for the Bolinas Winchelsea Islands. This is a special meeting today in

[0:02:00] Trustee Luckham: order to consider meetings by law. My name is Peter Lockham. I'm elected on Thetis Island. I'm

[0:02:11] Trustee Luckham: the chair of the executive committee and I just want to recognize that we're all meeting broadly

[0:02:17] Trustee Luckham: here today across the Coast Salish Territory here in the Bolinas Winchelsea Islands.

[0:02:24] Trustee Luckham: The nations that I know have direct interest in that area are, of course, the Sinemo and

[0:02:31] Trustee Luckham: Snananas, but I imagine the Klayaman probably reach out that far, as well as many other

[0:02:36] Trustee Luckham: nations that would have traversed the Salish Sea since the beginning of time.

[0:02:43] Trustee Luckham: and so grateful to be here and live and work here and uh indeed belenus winchelsea

[0:02:50] Trustee Luckham: islands are a special place and and with very small population and that's why the executive

[0:02:59] Trustee Luckham: committee is manages that region on everybody's behalf um i have with me today a trustee uh

[0:03:07] Trustee Luckham: Councillor Sue Ellen Fast from Bowen Island.

[0:03:10] Trustee Luckham: Trustee Laura Patrick, elected on Salt Spring Island.

[0:03:14] Trustee Luckham: Trustee Dan Rogers on Keats Island, but in the Gambier-Keats Trust area.

[0:03:21] Trustee Luckham: And in territory is Laurie Foster, ably managing our meeting today.

[0:03:27] Trustee Luckham: And Heather Cowher, who may be over on the other side of the pond

[0:03:32] Trustee Luckham: And in somebody else's territory, maybe if anybody wants to make a territorial recognition of where they're coming from, that'd be terrific.

[0:03:45] Trustee Luckham: Okay, so we have a meeting agenda here before us.

[0:03:49] Trustee Luckham: And I'll just, out of formality, ask if there's any additions or deletions to the agenda.

[0:03:55] Trustee Luckham: I'm not seeing any.

[0:03:57] Trustee Luckham: Then I will adopt the agenda as presented.

[0:04:01] Trustee Luckham: and so the first item on our agenda is the meeting procedures bylaw number 36 for consideration and

[0:04:10] Trustee Luckham: decision and I know that most of you have seen this or a version of it at the LTCs that you

[0:04:21] Trustee Luckham: chair and so I will just maybe ask Heather out of formality for members of the public that

[0:04:28] Trustee Luckham: that might be viewing or watching this from afar or later

[0:04:34] Trustee Luckham: to a brief summary on what the meeting procedures

[0:04:39] Trustee Luckham: by-law update is here for.

[0:04:41] Trustee Luckham: Okay.

[0:04:42] Voice 1: Yeah, so provincial legislation

[0:04:46] Voice 1: and the Islands Trust electronic meeting regulation

[0:04:49] Voice 1: were recently updated to allow all regular meetings

[0:04:54] Voice 1: of LTCs to be conducted electronically.

[0:04:57] Voice 1: They were allowed under temporary emergency orders during COVID, but those were memorialized permanently.

[0:05:05] Voice 1: And so the local meeting procedures bylaw had to be updated in order to be consistent with that, to allow

[0:05:13] Voice 1: for regular meetings.

[0:05:14] Voice 1: So this bylaw amendment would allow for you to have any and all of your meetings electronically if you so chose.

[0:05:21] Voice 1: chose um you will also note that there are some new sections recommended and regarding delegations

[0:05:30] Voice 1: and public participation those are not directly related to the electronic meeting regulation they

[0:05:37] Voice 1: were they were at it because um we don't open up this bylaw very often and we don't know when we'll

[0:05:44] Voice 1: open it up again and there have been some other kinds of topics that staff have have felt um

[0:05:53] Voice 1: would benefit by being in a bylaw um so that everybody's clear on what the procedures are so

[0:05:59] Voice 1: delegations is one of those things public participation are all is another um i will

[0:06:05] Voice 1: note that if you're not ready to put those kinds of provisions in the bylaw um those can be removed

[0:06:13] Voice 1: and I've made a note in the staff report to that effect,

[0:06:16] Voice 1: I hope, that sections 18 through 40

[0:06:20] Voice 1: can be removed from the by-law

[0:06:24] Voice 1: and it won't affect any of the other parts of the by-law.

[0:06:28] Voice 1: So that is a thing.

[0:06:30] Voice 1: And then also you may have note recommendation number five,

[0:06:37] Voice 1: which is not related to the by-law specifically,

[0:06:40] Voice 1: But it's to clarify that while this meeting procedures bylaw would allow for you to have electronic meetings from a regulatory standpoint, our staffing levels are still such that technologically, we don't necessarily have the staff support to have a full electronic meeting.

[0:07:04] Voice 1: And one of the most labor-intensive parts of an electronic meeting is allowing the public to speak, so the public who is attending remotely.

[0:07:16] Voice 1: And of late, we've had LTC meetings where the public has not been able to speak, and it's because of this staffing issue.

[0:07:24] Voice 1: So, the LTC will recognize that this past year, Trust Council was presented with the option of putting a full time staff person into their into the budget for next year and they declined to do that.

[0:07:41] Voice 1: um uh however if if this staffing position is not put into the budget for next year

[0:07:49] Voice 1: um we will continue to have this this issue where we won't be able to to fully function during

[0:07:55] Voice 1: electronic meetings in one way or another or at least that's a potential impact because we just

[0:07:59] Voice 1: don't have the staffing levels to do it so that is what that recommendation is related to um so

[0:08:05] Voice 1: So far, the way that we've had Denman and Moschitti

[0:08:09] Voice 1: pass that resolution and that their resolutions

[0:08:13] Voice 1: there will go to the next FPC meeting for consideration.

[0:08:17] Voice 1: So that's that part.

[0:08:20] Voice 1: And I can answer any questions.

[0:08:51] Voice 8: recommendation five but uh the southern gulf islands as we've been processing um have not

[0:08:56] Voice 8: had this recommendation so we're not going to get a consistent uh approach nor nor do i support this

[0:09:02] Voice 8: that motion, certainly from a WinChelsea Bolaeus standpoint, because of the size of the local trust

[0:09:08] Voice 8: area and issues that we're facing. And I mean, I know, again, where this is not 100% relevant. I

[0:09:22] Voice 8: mean, I'm still concerned on page three of the agenda package where we said, I still think we

[0:09:27] Voice 8: need more work to understand APCs. Just because the regulations are perhaps silent on APCs,

[0:09:33] Voice 8: I'm not certain that that's a mistake, and certainly it's not something that only us are suffering from.

[0:09:40] Voice 8: My reading of the provincial websites, it's very clear that APCs follow the same open meeting rules of councils and local trust committee meetings.

[0:09:51] Voice 8: I mean, that's what's referred to as the same.

[0:09:53] Voice 8: So I think APCs meeting rules come about in a very different way than councils and local trust committees,

[0:10:02] Voice 8: And I think we need to do more work because I don't think it was the intent to just drop them off through legislation and leave them floating without the ability to meet in pandemics.

[0:10:14] Voice 8: And I'll just stop there. I'll point out more comments on the bylaw itself.

[0:10:36] Voice 5: okay uh great so um good morning everyone so uh just reiterate what um

[0:10:43] Voice 5: vice chair patrick said is that those off that option wasn't presented to galliano um and uh

[0:10:52] Voice 5: and we didn't discuss it um the issue of staffing and not being able to have

[0:10:59] Voice 5: uh public participation if we adopted this bylaw that this wouldn't do that and i appreciate the

[0:11:05] Voice 5: fact that the the the cao has flagged this from time to time out of this is an issue can i can i

[0:11:12] Voice 5: get some clarity and maybe some of the vice chairs can answer this for me as well as the rpm my

[0:11:19] Voice 5: understanding is that the issue is that there's a belief that it that there has to be a staff person

[0:11:26] Voice 5: to let people in and out of meetings in order to speak i.e to to allow them to to uh to speak

[0:11:34] Voice 5: during the meetings to promote them and deep and unpromote them etc and that that's the function

[0:11:39] Voice 5: that we say has to be have a staff to it because vice chairs are have too much else on their plate

[0:11:46] Voice 5: in order to do that is that is that the issue for everybody's uh consideration um

[0:11:54] Voice 5: because i've never quite sort of well it's very useful to have uh a staff person there particularly

[0:12:01] Voice 5: particularly when there's technological issues.

[0:12:04] Voice 5: That's the biggest thing.

[0:12:06] Voice 5: I mean, I'm walking through and promoting people in my head anyway,

[0:12:10] Voice 5: and verbally saying that's the next person, promote that person.

[0:12:14] Voice 5: If it's just a matter of clicking a button to do that,

[0:12:19] Voice 5: I've never quite gotten what the problem is.

[0:12:22] Voice 5: Do you know, RPM Cowler, or one of the other vice chairs, what the issue is?

[0:12:28] Voice 1: i can speak from a staffing point of view that um it's not necessarily just as easy as pushing

[0:12:34] Voice 1: a button because especially when the audience members have technological issues or can't get

[0:12:40] Voice 1: in so then you're waiting you know so then that person has to call the staff person behind the

[0:12:47] Voice 1: scenes to try and work out their technical difficulties so there's there's more involved

[0:12:52] Voice 1: in it than that, than just pushing a button. And that, I mean, that is the primary function

[0:13:00] Voice 1: that we're talking about that we've just not been able to do. But what we're also finding

[0:13:05] Voice 1: is that there is more staffing, there still is more staffing needed for what we're doing right

[0:13:13] Voice 1: now than we thought there would be. Like there still is a staffing function behind all of this

[0:13:18] Voice 1: to set up the meetings to help you know pre set up the meeting and deal with um attendees so that's

[0:13:27] Voice 1: my response from a staff perspective yeah

[0:13:29] Voice 5: and that will have to happen anyway yeah the

[0:13:32] Voice 5: setup of the

[0:13:33] Voice 5: meeting and the technological support will happen

[0:13:35] Voice 1: right what

[0:13:36] Voice 5: what the the as i understand the one

[0:13:39] Voice 5: piece that's missing with the public participation for example we had an electronic meeting on

[0:13:45] Voice 5: on Galliano and we were able to allow a delegation

[0:13:52] Voice 5: and an applicant to attend,

[0:13:53] Voice 5: but the town hall participants were not allowed to do that.

[0:13:58] Voice 5: And it was awkward and

[0:14:00] Voice 3: it

[0:14:01] Voice 5: happened on Gabriola.

[0:14:03] Voice 5: It was awkward too.

[0:14:04] Voice 5: And I appreciate it's always been seamless

[0:14:07] Voice 5: with the staffing piece behind the scenes.

[0:14:10] Voice 5: And I appreciate also that the staff

[0:14:13] Voice 5: have a whole bunch of other things to do um but i'm i i do think there is a belief

[0:14:22] Voice 5: that if we change these bylaws to allow for electronic meetings that solves the problem

[0:14:28] Voice 7: and it

[0:14:28] Voice 5: and um and that's going to be problematic when i get to galliano next

[0:14:36] Voice 5: a week two weeks today and if we're not able to have town hall folks coming in that's going to

[0:14:44] Voice 5: be very problematic anyway I just I just putting that out there and I don't know how the other

[0:14:50] Voice 5: vice chairs feel about that as well and I I know FTC touched briefly on this and says let us talk

[0:14:58] Voice 5: about it in in February but we saw the challenges of getting this through trust through trust

[0:15:08] Voice 5: Trust Council to approve $100,000 in June,

[0:15:13] Voice 5: and particularly with the strong considerations

[0:15:17] Voice 5: about the current budget,

[0:15:19] Voice 5: I'm a little concerned how this is going to land

[0:15:22] Voice 5: at Trust Council and Mark.

[0:15:28] Voice 2: Sue Ellen Fast.

[0:15:31] Voice 7: Yeah, I agree with recommendation number five,

[0:15:39] Voice 7: all the other ones as well.

[0:15:41] Voice 7: and um number five about needing a full-time staff position here's my experience in the north to add

[0:15:48] Voice 7: to um uh what heather has mentioned um some of the islands have low bandwidth so people

[0:15:55] Voice 7: are there and then they're not there or they think they're there or they're frozen in some awkward

[0:16:02] Voice 7: um um it's almost a privacy thing because they're trying they're struggling or they could freeze

[0:16:10] Voice 7: like this you know and it's it's unfair um to have them frozen like that and recorded um and not be

[0:16:19] Voice 7: able to assist um and that's one of the times when um admin have been able to assist also as heather

[0:16:27] Voice 7: says when people have to call in um it's not just uh town hall it's also the um delegations

[0:16:34] Voice 7: applicants and staff and all of these people are trying to come into a meeting and like Dan I'm

[0:16:42] Voice 7: thinking about the order of people ahead of time and I've had I've run one successful meeting by

[0:16:46] Voice 7: myself uh all by myself uh but that was in uh North Vancouver um where uh I was confident

[0:16:54] Voice 7: in the bandwidth of the facility I was in and uh uh and I had staff in the room with me too

[0:17:02] Voice 7: Jamie was there, and Heather, you were there. And I think there's an issue here about

[0:17:15] Voice 7: open meetings and public participation that goes beyond the technology. And it has some people are

[0:17:23] Voice 7: on other people's phones. There's all kinds of issues. And I noticed that Bowen Island

[0:17:29] Voice 7: municipality and all other municipalities received funding from the province to help

[0:17:34] Voice 7: make adjustments to COVID and but Islands Trust and I believe regional districts

[0:17:41] Voice 7: did not and maybe there's a case to be made for the province to pitch in some funding for

[0:17:50] Voice 7: smaller far-flung communities to come together using this kind of technology if

[0:17:58] Voice 7: um if we have the admin support so uh that's that's my point i think we do need staff and i'm

[0:18:07] Voice 7: i'll be voting for number five recommendation thank

[0:18:13] Trustee Luckham: you so much i see trustee patrick's hand

[0:18:17] Voice 8: i just wanted to i mean i just wanted to follow up on the questions that

[0:18:20] Voice 8: the uh trustee um rogers had posed um i understand uh that the frustrations and the needs that the

[0:18:29] Voice 8: that staff are reporting in regards

[0:18:31] Voice 8: and that the changes to this by-law

[0:18:32] Voice 8: only implement the ability to have the by-laws

[0:18:35] Voice 8: does not solve our problems.

[0:18:37] Voice 8: I think this isn't on, we do need to solve this.

[0:18:40] Voice 8: Is it worse?

[0:18:41] Voice 8: I don't know.

[0:18:42] Voice 8: I like what trustee Fasta just mentioned with,

[0:18:48] Voice 8: you know, that we weren't eligible for that funding

[0:18:51] Voice 8: and how these meetings were.

[0:18:52] Voice 8: We will need to solve this regardless of the pandemic

[0:18:55] Voice 8: going forward.

[0:18:56] Voice 8: There's been a shift in the way we meet

[0:18:58] Voice 8: and we need to find a successful way to make this work um and um it's going to take some time

[0:19:05] Voice 8: and i like said it's uh it's a it's a it's a to me a much broader and bigger issue than just simply

[0:19:11] Voice 8: asking for more staff at this time okay

[0:19:18] Voice 2: um you'll lower your hand there trustee patrick um

[0:19:22] Trustee Luckham: i'm just going to chime in for a bit here you know i agree this is a much bigger

[0:19:26] Trustee Luckham: bigger issue and probably not to be resolved at the Bolinas-Winchelsea Local Trust Committee.

[0:19:35] Trustee Luckham: But it's not, it's not coincident that executive committee sits as a body with a different hat on

[0:19:42] Trustee Luckham: with a vast amount of experience that may not be obvious in other LTCs, not to discount the

[0:19:50] Trustee Luckham: the natural experience that LTC trustees are having as well.

[0:19:56] Trustee Luckham: But it is a much bigger issue.

[0:19:59] Trustee Luckham: I think it is a federation executive committee potentially engaged conversation to resolve.

[0:20:10] Trustee Luckham: And the APC piece is a significant part of that.

[0:20:13] Trustee Luckham: that. And I think what my take on this whole thing is the reason this is here today and we're

[0:20:21] Trustee Luckham: having this special meeting is a business continuation activity. And we don't know

[0:20:28] Trustee Luckham: what's going to happen next with COVID or anything else for that matter. And we just need to

[0:20:36] Trustee Luckham: get something that enables whatever it is we want to do. And absolutely, Dan and Laura,

[0:20:42] Trustee Luckham: This is not the solution that everybody's looking for.

[0:20:46] Trustee Luckham: It's simply a business continuation model, I guess what I call it.

[0:20:51] Trustee Luckham: I can't grasp what the right wording is there.

[0:20:54] Trustee Luckham: I do support recommendation number five, because I think that as chairs of LTCs, we've got,

[0:21:11] Voice 2: honestly, other things sideways.

[0:21:16] Voice 2: I don't recall

[0:21:17] Trustee Luckham: the last one, but I'm thinking of a particularly nightmarish situation where people weren't able to get in.

[0:21:23] Trustee Luckham: I guess it must have been Salt Spring.

[0:21:25] Trustee Luckham: And then, of course, I think about, you know, all of us have actually honed our skills here and learned and have that ability and desire to learn.

[0:21:35] Trustee Luckham: That may not necessarily be something that future vice chairs or the chair maybe has that ability or experience.

[0:21:44] Trustee Luckham: and the chair's focus should be on the meeting not managing the meeting component and so I'll

[0:21:52] Trustee Luckham: just say that but you know I think that maybe there is a however it is that you wish to advance

[0:21:58] Trustee Luckham: this but certainly the one thing that hasn't come forward on the LTC two LTCs that I sit on

[0:22:04] Trustee Luckham: with respect to this is actually a motion from the LTC to ask executive committee or others

[0:22:13] Trustee Luckham: to contemplate more broader solutions for the future

[0:22:19] Trustee Luckham: that include additional staffing for meeting support.

[0:22:22] Trustee Luckham: But it's not to say that that isn't going on

[0:22:24] Trustee Luckham: in the background anyway, I think we know that.

[0:22:27] Trustee Luckham: So that's my two cents and as chair,

[0:22:31] Trustee Luckham: it's my pleasure to lead or follow

[0:22:35] Trustee Luckham: where you wish to lead us here.

[0:22:37] Trustee Luckham: And so that's sort of a general,

[0:22:40] Trustee Luckham: I think we've maybe had a general conversation here

[0:22:43] Trustee Luckham: hear about the report. And so now I think I'd like to open the floor up to any specific

[0:22:49] Trustee Luckham: questions or amendments associated with the bylaw itself, if you're ready for that. And

[0:22:55] Trustee Luckham: if you're not ready for that, maybe just say so, and we can have some further conversation.

[0:23:01] Trustee Luckham: Otherwise, I'd entertain any discussion or amendments on the actual bylaw amendments

[0:23:59] Voice 8: the right direction but i just think the timing for for this and also doubled by when chelsea

[0:24:05] Voice 8: Los Ibeleos being an area that has a whole population of, I think, two, that it's just not necessary.

[0:24:11] Voice 8: And I don't think the special meeting should be used to standardize these meeting bylaws.

[0:24:31] Voice 7: I have run into situations as a vice chair where I wished we had policies in place at the time, ahead of time, because I don't think leaving a gap in policy around the idea of what is a delegation, order and decorum, defamatory remarks, invited presentations, public participation,

[0:24:58] Voice 7: All of these things, I think, is really helpful to have policy around so that people can feel invited and know what to expect and to be able to run a good community business meeting.

[0:25:14] Voice 7: I have needed them in the northern region.

[0:31:16] Trustee Luckham: and that worries me because i know i've experienced that where people say i didn't come to the meeting

[0:31:23] Trustee Luckham: because i i couldn't do it i wasn't feeling safe and that said maybe the meeting was safe but it's

[0:31:30] Trustee Luckham: nonetheless that fear is out there and so then um so that that's the first point but the other

[0:31:37] Trustee Luckham: thing that's insignificant to note is sure there's only two or three people maybe only two actually

[0:31:46] Trustee Luckham: that are actually full-time residents of the area but i don't know day to day how many people are

[0:31:52] Trustee Luckham: actually out on the islands um but it's difficult to predict who else might come to the meeting

[0:31:58] Trustee Luckham: And again, when there's a significantly controversial issue, it could be anything from where we've seen kayaking operations that want to come into the islands, issues that want to come into the islands, development on Winchelsea, Bolinas-Winchelsea islands that might come into play.

[0:32:19] Trustee Luckham: And there may be other citizens of British Columbia feel it's necessary, or even other citizens within the Islands Trust area that feel that it's necessary to come.

[0:32:27] Trustee Luckham: And they may want to say things that may, and I'm not sure it's all what-if scenarios, I understand that completely.

[0:32:35] Trustee Luckham: But there are other people.

Vice Chair Patrick spoke to an inconsistency with Advisory Planning Committees holding 
electronic meetings. 
Discussion about recommendation 5 in the agenda package - to consider adding a 
full-time staff (FTE) position to support electronic meetings - followed.
