[0:01:34] Voice 5: I'm the chair of the Maine Local Trust Committee.
[0:01:37] Voice 5: I want to acknowledge that we are privileged and grateful and humble to be working and
[0:01:44] Voice 5: living across the um the traditional territories of the coast salish peoples uh in particular the
[0:01:51] Voice 5: cyrus flip and all all the other uh first nations and indigenous folks that live in
[0:01:57] Voice 5: and have lived for millennium in the in the southern gulf islands um it's a beautiful day
[0:02:03] Voice 5: here you can understand why every people have lived here for for thousands and thousands of
[0:02:08] Voice 5: years. This is a special meeting of the Maine Local Trust Committee. We have cancelled our
[0:02:14] Voice 5: regular meeting because of a variety of reasons, but mostly related to the fact that we had to do
[0:02:22] Voice 5: two things. One is, as everybody will know, the surge in the pandemic over Christmas,
[0:02:33] Voice 5: over the holiday period and into January
[0:02:37] Voice 5: and the caution about having in-person meetings, et cetera.
[0:02:43] Voice 5: And Maine, as well as most of the local trust communities
[0:02:47] Voice 5: had not yet caught up with the regulatory requirements
[0:02:53] Voice 5: of our meeting bylaws in order to have meetings
[0:02:58] Voice 5: by Zoom, by fully electronic basis.
[0:03:03] Voice 5: So we determined that there was not sufficient urgency to have a full meeting or an in-person meeting and we could wait until the next scheduled one.
[0:03:11] Voice 5: And in the meantime, we scheduled this meeting in order to adopt the bylaws in order to allow us in the future, if need be.
[0:03:22] Voice 5: And we can all just hope that we don't need to, but that we can have these on a fully electronic basis.
[0:03:28] Voice 5: I'm just going to take a moment because I get asked this question all the time because people ask us, well, why were you doing fully Zoom electronic meetings for 18 months starting in May of 2020 through until September?
[0:03:42] Voice 5: That was because there were provincial public health orders, emergency orders that suspended our requirement to have in-person and in-person meeting places until the end of September.
[0:03:56] Voice 5: But those emergency orders expired as of the end of September.
[0:03:59] Voice 5: And so we were in the process of putting in place the bylaws to allow us to implement the new provincial legislation that allowed us to have regulations, but we hadn't got there to do electronic meetings, but we hadn't got to the end of that process.
[0:04:22] Voice 5: So we're taking this opportunity today to consider the the bylaws proposed by staff.
[0:04:29] Voice 5: Let me take a moment to just introduce the faces that you see in front of you and welcome them.
[0:04:35] Voice 5: Of course, you see your two trustees from Maine Island, Janine Dodds and David Maud.

[0:04:49] Voice 5: and Patricia Todd who is our recorder and island specialist and I say that because every once in a
[0:04:58] Voice 5: while Patricia knows something about something that the rest of us don't know anything about

[0:06:17] Voice 1: outlined this purpose of this meeting is to allow the local trust committee to consider adopting a
[0:06:22] Voice 1: new meeting procedures by law meeting procedures by law would do a number of things but primarily
[0:06:28] Voice 1: in the the main purpose of this is to allow for regular meetings to be held electronically
[0:06:33] Voice 1: electronically. The provisions would allow electronic meetings to be conducted. A minimum
[0:06:42] Voice 1: of two in-person meetings, though, would be required a year. That's just to ensure that an
[0:06:48] Voice 1: LTC doesn't hold all of their meetings electronically. I don't anticipate that that
[0:06:53] Voice 1: would be an issue. One corollary of the legislation is that if you do hold a regular electronic
[0:07:01] Voice 1: electronic meeting, there still has to be a place that's accessible to the public to come and watch
[0:07:07] Voice 1: and to hear or watch and hear the meeting proceedings. And there has to be a staff
[0:07:12] Voice 1: person in attendance at that public place. So at this point, if we do proceed with regular
[0:07:18] Voice 1: business meetings electronically, anticipation, that would be the boardroom here in the Victoria
[0:07:23] Voice 1: office for the Southern Gulf Islands, the Salt Spring meeting boardroom for the Salt Spring LTC
[0:07:29] Voice 1: and the Gabriela boardroom
[0:07:31] Voice 1: for the Northern Local Trust Committees.
[0:07:34] Voice 1: And those boardrooms have the facilities
[0:07:36] Voice 1: for people to, a small number
[0:07:38] Voice 1: of people anyway,
[0:07:39] Voice 1: to attend and to watch and listen to the meetings.
[0:07:41] Voice 1: And the other
[0:07:42] Voice 1: thing is this bylaw
[0:07:44] Voice 1: that's attached to the staff report
[0:07:46] Voice 1: is based on the most recent meeting procedures bylaw
[0:07:50] Voice 1: in the trust area, stopped it in 2014 by Salt Spring.
[0:07:54] Voice 1: And it includes another number of sections
[0:07:55] Voice 1: on delegations order and decorum public presentations public participation section
[0:08:02] Voice 1: and um those are sections 18 through 40 and um some other local trust well all the so far all
[0:08:11] Voice 1: the southern local trust committees have taken those sections 18 through 40 out by revising the
[0:08:17] Voice 1: draft bylaw um some have said well we'll bring it back at a later date when we can have a more
[0:08:22] Voice 1: full some discussion about it and by simply revising the draft bylaw to take those sections
[0:08:27] Voice 1: out if the main island local trust committee wanted to do that it has no
[0:08:30] Voice 1: effect on the rest
[0:08:31] Voice 1: of the bylaw it would not affect the electronic meeting provisions at all and so um it's on the
[0:08:39] Voice 1: agenda for first three readings um today and if it receives the first three readings then we would
[0:08:45] Voice 1: send it to executive committee to consider by resolution without meeting um and then back to
[0:08:53] Voice 1: the local trust committee to adopt by resolution without meeting all so that if necessary the next
[0:08:59] Voice 1: scheduled regular ltc meeting could be held electronically just
[0:09:07] Voice 5: uh two things as further
[0:09:08] Voice 5: context um if it's okay with the rpm and the trustees one is i note that this draft does
[0:09:14] Voice 5: doesn't um remember we amended it on galliano to include a posting on a bulletin board on the
[0:09:21] Voice 5: island as well it
[0:09:22] Voice 7: doesn't appear to
[0:09:23] Voice 5: be doesn't appear to be in this draft and in section three
[0:09:26] Voice 5: uh so this was the original draft which was to make sure it was posted there as well as at the
[0:09:32] Voice 5: victoria office so we could maybe make that amendment that was relatively i think that was
[0:09:36] Voice 5: just an oversight um the other thing you should know um is yes i gather some of the northern
[0:09:43] Voice 5: southern islands. We haven't done Gambier yet, but I've done Gabriola. It's been a bit of a
[0:09:51] Voice 5: mixed bag. Some local trust areas have stripped the 18 through 40 out. Gabriola did. I think
[0:09:59] Voice 5: Denman and Hornby and Liskiti didn't. They adopted it as it was presented. But they are also passing
[0:10:06] Voice 5: a form of a motion requesting that FPC consider
[0:10:13] Voice 5: ensuring that staffing's in place
[0:10:15] Voice 5: to make the electronic meetings work
[0:10:18] Voice 5: because there's concern about the fact
[0:10:21] Voice 5: that there is no position in place for that.
[0:10:24] Voice 5: So those LTCs, those motions have taken a couple of forms.
[0:10:31] Voice 5: One is to FTPPC to ask them to consider it.
[0:10:36] Voice 5: One draft of the motion was to ask FPC to consider adding a new position in
[0:10:42] Voice 5: to make this happen, a full-time equivalent.
[0:10:44] Voice 5: It's taken a number of different forms in those different local trust areas.
[0:10:49] Voice 5: It is on the FPC agenda in any case for February the 16th.
[0:10:55] Voice 5: They'll be thinking about how to deal with this because there's considerations
[0:10:58] Voice 5: and concerns about how we're going to staff it.
[0:11:01] Voice 5: staff electronic meetings, if we have to have them going forward.
[0:11:05] Voice 5: So just so you know, that's also been on the agenda elsewhere.
[0:11:09] Voice 5: But the main consideration for Trustee Dodds and Trustee Maude
[0:11:13] Voice 5: and this local trust committee, in my mind, is the one that you raised,
[0:11:17] Voice 5: which is what you want to do about the parts of the proposed new bylaw
[0:11:22] Voice 5: that are there that came from Salt Spring that are not related
[0:11:28] Voice 5: to the electronic meetings portion.
[0:11:30] Voice 5: and it's true on galliano north pender south pender i don't know if saturn has considered
[0:11:37] Voice 5: them yet not yet but
[0:11:39] Voice 5: they all stripped them out questions straight stripped them out they
[0:11:42] Voice 5: they all took them amended them out of the of the bylaw i know galliano asked that they be
[0:11:48] Voice 5: brought back at a later meeting to be considered
[0:11:51] Voice 3: for but but um uh anyway i don't know if trustee
[0:11:56] Voice 3: or Trustee Mott, have any thoughts about that?

[0:11:59] Voice 2: I just, I would tend to sort of agree
[0:12:02] Voice 2: with my fellow trustees that I was a little bit
[0:12:05] Voice 2: uncomfortable with the only sort of format.
[0:12:10] Voice 2: I understand the need for electronic,
[0:12:12] Voice 2: but I personally was a little bit reluctant
[0:12:14] Voice 2: to be carrying forward with all the other stuff
[0:12:17] Voice 2: outside of a public meeting.
[0:12:19] Voice 2: Not that I don't think that we would approve it,
[0:12:23] Voice 2: but I think it would be a little bit more appropriate
[0:12:26] Voice 2: to do it in a proper public meeting.
[0:12:29] Voice 2: I guess I was uncomfortable
[0:12:31] Voice 2: because there's a lot of words there
[0:12:32] Voice 2: and there might be concerns.
[0:12:36] Voice 2: My only other thing was that I pointed out earlier
[0:12:40] Voice 2: was section 29.3.

[0:14:21] Voice 5: considerations of at least of the galliano um ltc i can't tell you what other ltc said but that
[0:14:28] Voice 5: they didn't that the the intent of those sections was good but that they
[0:14:32] Voice 5: they were uncomfortable with adopting them
[0:14:35] Voice 5: in a non-public meeting,
[0:14:37] Voice 5: where nobody from the community has had an opportunity
[0:14:40] Voice 5: to weigh in on any of the provisions.
[0:14:42] Voice 5: And they may work for Salt Spring,
[0:14:44] Voice 5: but may need to be tweaked for Main Island.
[0:14:47] Voice 5: That was sort of the thought of many folk,
