[0:00:26] Trustee Luckham (probable): on in the agricultural world and in the political world and how we can collaborate and work

[0:00:33] Trustee Luckham (probable): For those of you who don't know, I'm elected on Thetis Island,

[0:00:36] Trustee Luckham (probable): which is in L'Aix and in Penelope territory.

[0:00:38] Trustee Luckham (probable): And with that, I would just like to say I'm grateful to live here

[0:00:42] Trustee Luckham (probable): and be able to acknowledge the Coast Salish territory that we all enjoy

[0:00:47] Trustee Luckham (probable): and that the land and the sea is just so rich of stories and culture

[0:00:53] Trustee Luckham (probable): and history available to us to hear and see and, in fact,

[0:01:55] Voice 12: crops and i really appreciate all your expertise it's a wonderful opportunity to keep track of

[0:02:02] Voice 12: things like uh worries about climate change and uh economic viability of farming on these islands so

[0:03:51] Voice 2: timber um but we've been on our farm on trip road for 35 years i'm also an excavating contractor

[0:04:02] Voice 2: We've been in business for 50 years as of September and hoping to retire one day and take my farming a little more seriously.

[0:04:18] Trustee Luckham (probable): Yeah, it's one thing that I think most Islanders forget to do is retire.

[0:04:23] Trustee Luckham (probable): You just keep on going.

[0:05:34] Voice 13: Institute. I've been on island almost three years now, so kind of new to a lot of things here, but

[0:05:41] Voice 13: loving as much, loving what I'm learning, and live up in the Cranberry Valley on ALR land.

[0:05:50] Voice 13: Not farming as

[0:05:51] Voice 13: much as I want to yet, but I'm getting there.

[0:05:55] Trustee Luckham (probable): So also joining us, I'll just mention in the background is a planner, Christine

[0:06:34] Trustee Luckham (probable): frequency of these meetings and and as we come into your agricultural season how often you want

[0:06:39] Trustee Luckham (probable): to meet and whether or not there we should have special triggers that may be called for

[0:06:44] Trustee Luckham (probable): opportunities to meet on a maybe a less of a scheduled basis but nonetheless still on a

[0:06:50] Trustee Luckham (probable): Well, personally, I find these conversations with you very rewarding.

[0:06:55] Trustee Luckham (probable): It's amazing to have all of you with such long experiences on the island and in the

[0:07:01] Trustee Luckham (probable): areas that you work in to be able to have this opportunity to share with you.

[0:07:07] Trustee Luckham (probable): Maybe I'll just turn to Trustee Patrick if she has anything that she'd like to offer

[0:07:12] Trustee Luckham (probable): in terms of our meeting agenda.

[0:07:13] Trustee Luckham (probable): But otherwise, I would just adopt our meeting agenda and just have general conversation,

[0:07:56] Voice 10: a new bylaw proposal for the housing on the ALR?

[0:08:03] Voice 10: What is going forward in terms of the proposed bylaw?

[0:08:08] Voice 10: Is that pretty well reflecting everything

[0:08:11] Voice 10: that we've said in the last few months about this?

[0:08:14] Voice 10: I'm just curious as to whether or not

[0:08:17] Voice 10: that will be forwarded at the next trust meeting.

[0:08:22] Trustee Luckham (probable): Certainly, we'd be happy to hear from you

[0:08:24] Trustee Luckham (probable): if you have some specific thoughts,

[0:08:26] Trustee Luckham (probable): but we didn't have it on the agenda and i don't think we have the right staff member here

[0:08:36] Voice 6: considered on the uh at the local trust community meeting of the 15th and so we have put forward a

[0:08:43] Voice 6: bylaw proposal sorry draft bylaw for first reading and for re-referral back to agencies and first

[0:08:51] Voice 6: nations um so that is uh the recommendation that staff have put forward um the the local

[0:08:57] Voice 6: trust committee will will consider it we were potentially going to bring it to this meeting

[0:09:01] Voice 6: but felt that two separate discussions and separating the actual decision-making portion to

[0:09:08] Voice 6: tuesday's meeting might have been a bit confusing um but i can say on on behalf of uh myself and

[0:09:14] Voice 6: planner geordie gordon who have worked on um that sort of portion of the housing project that we

[0:09:18] Voice 6: We have absolutely taken all of the comments that you guys have provided to us over time in these meetings, and it's been extremely helpful.

[0:09:27] Voice 6: So I do want to absolutely express our gratitude from the planning staff for your work.

[0:09:34] Voice 10: I just want to add to that. I want to thank you for all the work you folks have done.

[0:09:38] Voice 10: This has been on the Agro Advisory Committee and APC since about 2002, 2003, right, Ken?

[0:09:46] Voice 10: and um it's it's it's been there i mean if it wasn't for the alc making the changes in terms

[0:09:54] Voice 10: of opening it up um we'd still be having some discussions about this so thank you for all your

[0:09:59] Voice 10: good work well

[0:10:03] Trustee Luckham (probable): thank you uh conrad appreciate that um anything else on that topic or anything

[0:10:09] Trustee Luckham (probable): else i see brian webster you have your hand up yeah

[0:10:13] Voice 8: i do uh on on that topic um we've uh only

[0:10:18] Voice 8: had a couple of days since we first saw the staff report and I guess a revised version of the

[0:10:28] Voice 8: proposed bylaw. So we haven't had a chance to have a thorough discussion of it. I can just observe

[0:10:34] Voice 8: that first of all, we very much appreciate the fact that clearly people were paying attention

[0:10:40] Voice 8: to some of the points that we raised and so we're really appreciative of that at the same time there

[0:10:49] Voice 8: are a few points I guess we'd say outstanding where there remain some concerns and issues

[0:10:57] Voice 8: and so I think it's fair to say once we have had a chance to discuss more thoroughly we will have

[0:11:06] Voice 8: some uh specific input but it was heartening to see that you know especially two or three of the

[0:11:13] Voice 8: uh of the more uh significant points we raised were fully reflected in the revisions and uh

[0:11:21] Voice 8: so that's very positive okay

[0:11:26] Voice 3: well thank you for that um trustee patrick yeah

[0:11:29] Trustee Patrick (probable): no i i want to assure

[0:11:31] Trustee Patrick (probable): you that if we'll be receiving it and we'll make a decision or not to give it first reading and

[0:11:37] Trustee Patrick (probable): proceed down the path if we give it the first reading that just uh that gets you the opportunity

[0:11:42] Trustee Patrick (probable): to give official you know responses referrals and we can still make changes to it before uh you know

[0:11:48] Trustee Patrick (probable): we even go to uh community information meetings and and uh public hearings if so and and what

[0:11:56] Trustee Patrick (probable): you have to say will will matter yeah

[0:12:02] Trustee Luckham (probable): i wholeheartedly endorse what trustee patrick has

[0:12:05] Trustee Luckham (probable): said that first reading often you know honestly is misunderstood is but it's the moment in

[0:12:11] Trustee Luckham (probable): time where the LTC says this is all we've heard this is what we've considered these are the

[0:12:16] Trustee Luckham (probable): professional advice we received and this is what we're thinking about now we want to

[0:12:22] Trustee Luckham (probable): start to hear further whether or not we got it right that's really the messaging part of it is

[0:12:27] Trustee Luckham (probable): have we got it right and then of course we go through the entire process two more readings

[0:12:31] Trustee Luckham (probable): public hearing and all the rest and we look forward to that so if you have a chance I realize

[0:12:37] Trustee Luckham (probable): there's not much time before our next meeting, the 15th.

[0:12:40] Trustee Luckham (probable): If you have the opportunity to reflect on that further

[0:12:43] Trustee Luckham (probable): and have some conversations amongst yourselves,

[0:12:46] Trustee Luckham (probable): indeed come to the meeting and speak at the town hall

[0:13:58] Trustee Luckham (probable): and feedback on work that we've conducted

[0:14:01] Trustee Luckham (probable): between now and then.

[0:14:02] Trustee Luckham (probable): So I'm presuming we'll just continue

[0:14:04] Trustee Luckham (probable): to maintain that schedule.

[0:14:06] Trustee Luckham (probable): And does that, has anybody else got any suggestions there?

[0:14:09] Trustee Luckham (probable): But otherwise we'll just continue on as we have been.

[0:14:18] Trustee Luckham (probable): Anything else on anybody's minds at all?

[0:14:30] Voice 8: We do have one

[0:14:31] Voice 8: other thing.

[0:14:32] Voice 8: Yeah.

[0:14:33] Voice 8: Yeah. Not directly related to any one topic, although somewhat related to everything we've

[0:14:42] Voice 8: talked about since these meetings have begun. We've had some discussions about how

[0:14:50] Voice 8: it seems that most of the positive things that have happened in recent months, and there have

[0:14:56] Voice 8: been a few uh that are uh beneficial for agriculture on salt spring um are uh pretty

[0:15:06] Voice 8: much entirely uh wrapped up in uh alr uh status and so for example the housing changes being a

[0:15:15] Voice 8: direct result of the province uh changing its rules um the discussions that we've had that

[0:15:22] Voice 8: I'm pretty sure are not finished around composting largely at least from the communication from staff

[0:15:32] Voice 8: to us was don't worry if you're in the ALR as we've discussed though half the farmland on

[0:15:41] Voice 8: Salt Spring that's being actively farmed is not in the agricultural land reserve and so we're

[0:15:49] Voice 8: We're concerned essentially about that half of the farmland

[0:15:55] Voice 8: and the farmers being left behind a little bit

[0:15:58] Voice 8: when there are positive steps, for example, around the housing.

[0:16:03] Voice 8: I fully acknowledge that there was also a provision

[0:16:06] Voice 8: that's been added in dealing with larger properties

[0:16:09] Voice 8: that are outside the ALR.

[0:16:11] Voice 8: But for the most part, most of the small farms not in the ALR

[0:16:16] Voice 8: are not affected by what's being proposed at all and likewise the concerns that we've had

[0:16:23] Voice 8: around composting which I understand that we've agreed to provide some specific proposals around

[0:16:31] Voice 8: that we haven't done so yet so I'm not holding your feet to the fire about that at this point

[0:16:37] Voice 8: but there as well it's like if you're in the ALR you're good if you're not in the ALR it's not so

[0:16:44] Voice 8: so clear. And I think the question that's on some of our minds is whether the trust or the

[0:16:52] Voice 8: trustees, I guess, because it's not really staff's job to tell us what their personal beliefs are,

[0:17:00] Voice 8: whether the trust, the local trust committee believes that it's important to enhance the

[0:17:06] Voice 8: viability of agriculture in all the zones where it's a permitted activity, as opposed to just the

[0:17:16] Voice 8: agriculturally, you know, the A1, A2 zones. And if it isn't, it would be, I think, important for us

[0:17:26] Voice 8: to acknowledge that, talk about it, and I think we would ask why. And if it is, I think the question

[0:17:33] Voice 8: is how then can we translate that commitment into action

[0:17:40] Voice 8: because it seems like the trust kind of hangs its hat

[0:17:43] Voice 8: quite a bit on ALR and ALC and positive changes

[0:17:51] Voice 8: that can come from there

[0:17:53] Voice 8: as opposed to being more proactive about it.

[0:17:56] Trustee Luckham (probable): I'll let trustee Patrick go with that question.

[0:17:59] Trustee Luckham (probable): no

[0:18:00] Trustee Patrick (probable): well no thank you brian and um i know things get garbled and you know the trust policy statement

[0:18:07] Trustee Patrick (probable): versus what's happening at the uh on salt spring and i have revisited our official community plan

[0:18:13] Trustee Patrick (probable): is very clear on recognizing the the importance of agriculture that is our official and not just

[0:18:20] Trustee Patrick (probable): in the alr it's it's it recognizes it as an important um you know use of the island um

[0:18:29] Trustee Patrick (probable): um the trust policy statement as you know had some language in there and the ag alliance did

[0:18:37] Trustee Patrick (probable): officially make a recommendation to restore that language i can tell you i had the amendments

[0:18:42] Trustee Patrick (probable): written and had given notice to the other trustees when we had seen that version come in that i was

[0:18:49] Trustee Patrick (probable): going to make those motions uh no amendments ended up being made in the in the document was

[0:18:54] Trustee Patrick (probable): is basically paused while we go back and redo consultation. So that's just about to get kicked

[0:19:03] Trustee Patrick (probable): off. There should be public notice of this engagement that's going to be starting soon.

[0:19:09] Trustee Patrick (probable): There's going to be focus conversations and particular conversations right here on Salt

[0:19:14] Trustee Patrick (probable): Spring. So you will, again, be able to get your voice heard, but I can still tell you I have those

[0:19:20] Trustee Patrick (probable): those written amendments, if that version is what's going to be amended, I don't know what

[0:19:25] Trustee Patrick (probable): the path forward is going to be yet on, on that, but I can, I can make it, I know I can say clearly

[0:19:31] Trustee Patrick (probable): that agriculture is important, you know, to me, and I think this LTC has shown that it cares

[0:19:38] Trustee Patrick (probable): and our official community plan is, is, is, is, is clear and there's no, no desire to change that.

[0:19:45] Trustee Patrick (probable): So your voice, and I think, you know, take that time, be heard when the engagement is open and the opportunities are open on the policy statement, make it clear.

[0:19:55] Trustee Patrick (probable): And I'm hearing this from other islands, so I don't think, you know, I'm not expecting that this is something that we have to fight for.

[0:20:01] Trustee Patrick (probable): I think the correction to the trust policy statement will be made readily to make it clear that agriculture in all zones is critically important.

[0:20:11] Trustee Patrick (probable): Yeah,

[0:20:15] Trustee Luckham (probable): no, I agree. And in fact, on our island, the agriculture that happens here is not an

[0:20:20] Trustee Luckham (probable): agricultural land reserve. It's all privately held land. It's a significant part of our

[0:20:25] Trustee Luckham (probable): sustainability. Marguerite, over to you.

[0:20:27] Voice 11: I just would like to support this concern,

[0:20:31] Voice 11: because that is the feedback we're getting from our agriculture members and our small farmers,

[0:20:38] Voice 11: is they don't want to be excluded

[0:20:41] Voice 11: from some of the benefits

[0:20:44] Voice 11: that are being allowed with this rewrite.

[0:20:47] Voice 11: And it's important that ALR

[0:20:54] Voice 11: and non-ALR agricultural use is considered together.

[0:21:00] Voice 11: Trustee

[0:21:04] Trustee Patrick (probable): We're about to consider,

[0:21:06] Trustee Patrick (probable): what we're about to consider and work on,

[0:21:08] Trustee Patrick (probable): Well, we already instructed that we want to look at what we called accessory dwelling units.

[0:21:16] Trustee Patrick (probable): And that would be, it could be like, you know, suites on garages, barns, you know, accessory buildings, not just suites and inside houses.

[0:21:27] Trustee Patrick (probable): And you may see there's been some articles in the paper saying, oh, my God, they're trying to, you know, create thousands of suites.

[0:21:34] Trustee Patrick (probable): What we're trying to do is cast a wide net on allowing those type of structures primarily to create rental housing, you know, not, you know, so we're still going to be having conversations of how we use this, you know, how, what controls or how mechanisms, because we don't want to just have the outright use so they become a whole bunch of Airbnbs.

[0:21:56] Trustee Patrick (probable): it's how do we make sure that these things are made available to people who want to be

[0:22:02] Trustee Patrick (probable): landlords whether you're a farmer that needs to have someone on your property or you're a good

[0:22:09] Trustee Patrick (probable): landowner that you know wants to have make that that that space over top of your garage turn that

[0:22:14] Trustee Patrick (probable): into a suite and make that available so that's what the purpose of what we're trying to do with

[0:22:20] Trustee Patrick (probable): this this bylaw that's coming that you're you're hearing some excitement about that

[0:22:25] Trustee Patrick (probable): that we have not gone rogue

[0:22:28] Trustee Patrick (probable): and we're going to use all the water up

[0:22:30] Trustee Patrick (probable): instead of using it on agriculture.

[0:22:31] Trustee Patrick (probable): We're just trying to cast a wide net

[0:22:33] Trustee Patrick (probable): and not exclude people that are willing to be landlords.

[0:23:53] Voice 6: we're looking for resumes up until I believe the end of April for June 1st appointments

1. CALL TO ORDER 
  
Chair Luckham called the meeting to order at 4:13 p.m. and welcomed everyone to an electronic 
meeting of the Salt Spring Island Local Trust Committee. Chair Luckham introduced himself, the 
Trustees, staff and attendees and humbly stated gratitude to live and work in Coast Salish First 
Nations treaty and traditional territory. Introductions were carried out.

3. BUSINESS ITEMS 
 
 3.1   Local Trust Committee Chair's Welcome and Opening Remarks  
 
 Chair Luckham advised this meeting is an opportunity for the  Salt Spring Island Local Trust 
Committee  to  have  a  discussion  with  the  members  of  the  Salt  Spring  Island  Agricultural 
Advisory   Planning   Commission   (AAPC)   and   representatives   of   the   Salt   Spring   Island 
Agricultural Alliance on agriculture related issues.  
 
3.2   AAPC Membership 
 
A notice entitled “The  Salt  Spring  Island  Local  Trust  Committee  (SS  LTC)  seeks  applications 
for its Advisory Planning Commissions and Board of Variance” was presented. Planner 
Mayes   reported the application  deadline  is  April  30,  2022 and  requested attendees 
circulate the notice to agricultural contacts. 
  
 3.3   Frequency of Meetings 
 
  The next meeting is scheduled on July 7, 2022. 
 
3.4   General Discussion 
 
There was a question regarding draft Bylaw No. 526 “Changes to Residential Permissions in 
the Agricultural Land Reserve and Bylaw Amendment Options for Dwellings on Large Farms.” 
Appreciation  was  expressed to  staff  for incorporating  the  AAPC  and Salt  Spring  Island 
Agricultural Alliance feedback regarding draft Bylaw No. 526. Planner Mayes reported draft 
Bylaw  No.  526  will  be  presented  at  the  February  15,  2022 SS  LTC meeting  and staff  have 
recommended the draft bylaw be re-referred to agencies following first reading.  
 
There  was  a  comment  that approximately  50% of  the  land  being  farmed  on  Salt  Spring 
Island is not within the Agricultural Land Reserve (ALR), and that the small farms not within 
the ALR are excluded from proposed updates regarding additional housing permissions and 
composting permissions. There  was  a  suggestion  that  ALR  and  non-ALR  agriculture  use  be 
considered together. 
 
Trustee  Patrick  spoke  to  the Salt  Spring  Island Official Community Plan No.  434 (OCP) 
priorities  regarding  farmland. The SS LTC  recognizes  that  agriculture  is  important in  all 
zones. It was noted the Islands Trust Policy Statement update public engagement will begin 
soon. Trustee Patrick encouraged everyone to participate in the public engagement survey 
and  provide  feedback regarding  agriculture. Trustee  Patrick  spoke  to  draft  Bylaw  No.  528 
and that the intention of the bylaw is to provide accessory dwelling units primarily to create 
additional rental dwellings.
