[0:00:37] Trustee Fast (probable): is a meeting of the islands trust which is has uh meets across many places i'm not sure where

[0:00:45] Trustee Fast (probable): you're all uh zooming in from today and uh if you feel like um mentioning that i'll give you a chance

[0:00:51] Trustee Fast (probable): to speak in a moment i'm just going to introduce the uh meeting today it's being held electronically

[0:00:56] Trustee Fast (probable): of course because of another COVID situation so this is going to be a brief meeting we can't

[0:01:08] Trustee Fast (probable): this is just to do urgent things like adjust our meeting bylaws so that we can always have

[0:01:15] Trustee Fast (probable): electronic meetings when needed and so we'll have a limited agenda today and but it is being

[0:03:56] Trustee Fast (probable): This is the main topic on our agenda today, meeting procedure bylaw number 155.

[0:04:02] Trustee Fast (probable): Please take it away, Heather.

[0:04:05] Voice 2: Yeah, so essentially, we're bringing your meeting procedures bylaw to you to amend it

[0:04:12] Voice 2: so that it is consistent with new provincial regulations that allow for all of your meetings

[0:04:18] Voice 2: to be electronic for you to attend those electronically.

[0:04:22] Voice 2: We just need to amend the local bylaw to allow for that.

[0:04:25] Voice 2: So the bylaw before you will, the proposal is to amend sections that would allow that.

[0:04:31] Voice 2: There's also some added sections that are regarding decorum, delegation, and public participation.

[0:04:39] Voice 2: Those have been added as well because we're opening up your meeting procedures bylaw, and those are things staff have recognized to be useful in meeting procedures bylaws.

[0:04:50] Voice 2: us. You are the last LTC to be discussing this in the North. And so there has been some discussion

[0:05:00] Voice 2: about those new sections regarding public participation and delegations and some concern

[0:05:06] Voice 2: that, you know, you be discussing adding those sections without public participation or, you

[0:05:13] Voice 2: know, people being able to speak at the meeting regarding those. So one of the alternatives is to

[0:05:20] Voice 2: to remove those sections, and those are sections 18 through 40, to kind of postpone discussion

[0:05:28] Voice 2: about that at another time. If you remove those sections, it doesn't change the ability for you to

[0:05:34] Voice 2: still have electronic meetings. All of that stays the same. But we are recommending that you keep

[0:05:40] Voice 2: those sections in part because they're useful, but also because, you know, bylaw amendments take

[0:05:46] Voice 2: take time it becomes this another project right but yeah that we have to go through so um so that's

[0:05:53] Voice 2: that the recommendations that we have in the staff report one through four are associated with um

[0:05:59] Voice 2: first second and third reading of the bylaw and um moving that on to executive committee for

[0:06:04] Voice 2: approval um it doesn't require a public hearing because it's an administrative bylaw recommendation

[0:06:10] Voice 2: recommendation number five has also had a lot of discussion and then um across the trust now

[0:06:16] Voice 2: with the executive committee yesterday, I think, but the recommendation is essentially recognizing

[0:06:24] Voice 2: that while updating the meeting procedures by law would allow for you to, from a legal perspective,

[0:06:32] Voice 2: to conduct electronic meetings, there's some recognition that we aren't necessarily fully

[0:06:38] Voice 2: fully staffed to an extent that we can we can resource fully hybrid meetings and so there is

[0:06:47] Voice 2: a recommendation there from me that you have trust council consider adding staffing resources

[0:06:57] Voice 2: to next year's budget so the discussion in the northern region has there's there have been

[0:07:05] Voice 2: resolutions from each ltc that is some iteration of this um some were not quite ready to ask for

[0:07:12] Voice 2: a full fte and so they said you know maybe we can just ask for some resources of some sort

[0:07:18] Voice 2: funds maybe but maybe not an fte and there was a recognition that whatever is considered it has to

[0:07:27] Voice 2: start with the financial planning committee so um so so the the latter iterations of the resolution

[0:07:34] Voice 2: said, we recommend that the FPC consider adding resources to next year's budget for electronic

[0:07:44] Voice 2: meetings. So that's sort of the latest iteration. I didn't watch the executive committee meeting

[0:07:50] Voice 2: yesterday. I don't know if you, if Chair Fast or trustee Rogers want to speak to that, but

[0:07:55] Voice 2: I think there was some discussion about it. Anyway, that's the summary and glad to answer

[0:08:13] Trustee Fast (probable): went through our meeting, our public participation guidelines that we did a couple of years ago.

[0:08:25] Trustee Fast (probable): We did, in terms of public process, we did look at these through two public meetings.

[0:08:34] Trustee Fast (probable): and uh so i don't i just wanted to put that out there that i've got notes if anybody's interested

[0:08:39] Trustee Fast (probable): and um i can tell you what's different and uh and that we did uh discuss delegations and town hall

[0:08:47] Trustee Fast (probable): public comments and things like that in session so that's just my input there kate wees can i just

[0:08:59] Trustee Fast (probable): sorry this is the um uh guidelines for publication public participation that uh gambier keats local

[0:09:14] Trustee Fast (probable): ago and um this is where this is what becky sends to anybody who asks to be a delegation

[0:09:21] Trustee Fast (probable): um it's got the town hall uh this is an opportunity to uh public comments that kind of thing

[0:09:28] Trustee Fast (probable): delegations correspondents and applicants just so everybody knows what to expect and they feel

[0:09:33] Trustee Fast (probable): invited uh to participate in in the meetings um kate louise your camera has just gone off so i

[0:11:06] Trustee Fast (probable): as i marked up in red the differences between um what's in front of us in the bylaw and uh and what

[0:11:13] Trustee Fast (probable): we had decided as a local trust committee before or what i think might be more efficient is we just

[0:11:21] Trustee Fast (probable): adopt what's in the um draft bylaw if people agree and then we can we can deal with these

[0:11:30] Trustee Fast (probable): these guidelines again later in public anyway there's just a couple of suggestions and could

[0:11:37] Trustee Rogers: you explain that last option because how do we deal with the guidelines if we now have a bylaw

[0:11:42] Trustee Rogers: um

[0:11:43] Trustee Fast (probable): the uh bylaw doesn't include anything about applicants we might want to um adjust these

[0:11:57] Trustee Fast (probable): to fit with what's over there in the bylaw or we might like to adjust the bylaw to fit with what

[0:12:06] Trustee Fast (probable): we decided earlier

[0:12:07] Trustee Rogers: which leads us

[0:12:09] Trustee Rogers: to the same issue that the vire pm said is that we then have

[0:12:15] Trustee Rogers: to amend the bylaw later anyway yeah

[0:12:18] Trustee Fast (probable): so that's why i'm thinking we could adopt it today and then just

[0:12:22] Trustee Fast (probable): just these guidelines are simple.

[0:12:28] Trustee Rogers: So, Kate Lee, sorry, did you have a question?

[0:12:31] Trustee Rogers: Because I have some context.

[0:12:33] Trustee Stamford: Please go ahead.

[0:12:35] Trustee Stamford: I'm just thinking that I, sorry,

[0:12:37] Trustee Stamford: I should have looked at the guidelines.

[0:12:38] Trustee Stamford: I forgot that we had passed those.

[0:12:41] Trustee Stamford: Is there anything that is completely in contravention

[0:12:45] Trustee Stamford: between the two?

[0:12:47] Trustee Fast (probable): Contravention.

[0:12:48] Trustee Fast (probable): I'll run through the sheet here.

[0:12:50] Trustee Fast (probable): The differences is,

[0:12:53] Trustee Fast (probable): um that delegations have up to five minutes to speak in the draft bylaw whereas our guidelines

[0:13:01] Trustee Fast (probable): we said 10 minutes per each delegation to speak the bylaw has a 15-minute delegation period

[0:13:10] Trustee Fast (probable): whereas we didn't have a specific period in these guidelines but then that's what staff would do

[0:13:17] Trustee Fast (probable): and they put the agenda together um that's the big one the other one is uh the um bylaw specifies

[0:13:30] Trustee Fast (probable): three minutes per person in the public comments town hall um and we didn't have a uh anything

[0:13:41] Trustee Fast (probable): about timing for we just had a 10 minute period oh okay um

[0:13:49] Trustee Stamford: but in all these cases as a committee

[0:13:53] Trustee Stamford: we can adjust those times for a specific situation.

[0:13:58] Trustee Stamford: Yes,

[0:13:59] Trustee Fast (probable): I believe in the bylaw.

[0:14:01] Trustee Fast (probable): It says if everybody agrees, if it's unanimous.

[0:14:05] Trustee Rogers: So we can only adjust them once we're in the meeting, though,

[0:14:10] Trustee Rogers: is the challenge I have.

[0:14:13] Trustee Rogers: Let me, this is the, if you don't mind,

[0:14:21] Trustee Rogers: the context of this is a little complicated

[0:14:24] Trustee Rogers: and it's become challenging.

[0:14:29] Trustee Rogers: And it actually ended up in the executive committee

[0:14:33] Trustee Rogers: not agreeing on them.

[0:14:38] Trustee Rogers: I think that a number of

[0:14:42] Trustee Rogers: the local trust committees

[0:14:43] Trustee Rogers: were a little surprised to see all of these procedures,

[0:14:51] Trustee Rogers: bylaws starting in Section 18 and running through Section 40,

[0:14:54] Trustee Rogers: included in this because the intent the understanding was including my understanding

[0:14:59] Trustee Rogers: at that time um was that these special meetings were to deal with the electronic nature of the

[0:15:05] Trustee Rogers: meetings and and i don't want to indicate who what it where it came from but as a as a

[0:15:12] Trustee Rogers: inefficiency staff perspective the idea became well let's include a bunch of stuff that was

[0:15:18] Trustee Rogers: developed on and for salt spring in a public process let's include all those in the bylaw

[0:15:25] Trustee Rogers: so they were because that was the most recent meeting procedure bylaw that was was done so

[0:15:31] Trustee Rogers: they were those four sections of the bylaw were extracted and dropped into all of these bylaws

[0:15:40] Trustee Rogers: all of the southern gulf islands have removed those sections and said we're not prepared we

[0:15:44] Trustee Rogers: We're happy to do a meeting procedures bylaws.

[0:15:52] Trustee Rogers: However, and of course,

[0:15:54] Trustee Rogers: to adopt the electronic meetings portions,

[0:15:57] Trustee Rogers: which are the ones before section 18 and after 40.

[0:16:02] Trustee Rogers: But we wanna have an ability to have public commentary

[0:16:07] Trustee Rogers: upon what our codes of conduct would look like.

[0:16:11] Trustee Rogers: just like we did on gambier we we discussed it openly in public meetings and had some commentary

[0:16:18] Trustee Rogers: and some redrafting and back and forth etc etc um and so they removed them so did gabriola

[0:16:25] Trustee Rogers: and then all of the other local trust committees in the north um put them in as per with a couple

[0:16:33] Trustee Rogers: of minor amendments i think on denman so we've got this sort of split process that's going on

[0:16:39] Trustee Rogers: on right now where some local trust committees are are adopting all of these and it seems to

[0:16:46] Trustee Rogers: depend on who the vice chair is to some extent and i'm not being facetious because i i was

[0:16:51] Trustee Rogers: sort of one that thought this should not be done in this in this way um and sue allen thought and

[0:16:59] Trustee Rogers: peer chair luckham thought it was fine the way it was and laura anyway so um i'm sort of still

[0:17:05] Trustee Rogers: of the view even though i think it's a minimal impact in gambier uh local trust area as it would

[0:17:13] Trustee Rogers: have been on on um uh bolinas win chelsea where we don't have a lot of public input

[0:17:20] Trustee Rogers: that um like a public people at our regular meetings um we get a lot when there's a big

[0:17:29] Trustee Rogers: issue on the table but we don't get a lot normally is um is that we shouldn't do this in this fashion

[0:17:37] Trustee Rogers: that it's it's that's so it's sort of a matter of um uh a principle in my view is that we should not

[0:17:45] Trustee Rogers: be putting into a bylaw how the meeting is conducted plus there's some section there that

[0:17:50] Trustee Rogers: i just don't think should apply in our way like section 40 just doesn't doesn't make any sense

[0:17:56] Trustee Rogers: to most local trust communities except Salt Spring.

[0:18:00] Trustee Rogers: So I have taken the position up until now

[0:18:04] Trustee Rogers: that they should be removed

[0:18:06] Trustee Rogers: and then put on, asked to be brought back

[0:18:08] Trustee Rogers: when we can discuss them line by line,

[0:18:11] Trustee Rogers: give us a chance to redraft them.

[0:18:13] Trustee Rogers: And we do have our procedures policy in place

[0:18:16] Trustee Rogers: that we can fall back on

[0:18:18] Trustee Rogers: until we decide to include them into the bylaw.

[0:18:21] Trustee Rogers: And I recall, in fact, RPM Cowher,

[0:18:24] Trustee Rogers: that that was always intended to be the next step of the once we decided the policy was to then

[0:18:32] Trustee Rogers: amend the bylaw to include them in in the um in the bylaw or a form of them in the bylaw

[0:18:39] Trustee Rogers: but once they're in they're sort of then it'll be more i think it'll be more difficult to get

[0:18:45] Trustee Rogers: them out so i'm sort of of the view that we just we don't put them in given that we have the

[0:18:50] Trustee Rogers: procedure that's even though i don't think it makes a big practical difference in this local

[0:18:56] Trustee Rogers: trust area and i know that chair fast and i don't agree on this and um because we've had a chance to

[0:19:04] Trustee Rogers: go around it um yes uh we talked about not about this issue but about the how the how the um the

[0:19:15] Trustee Rogers: The other issue that the RPM brought up about number five

[0:19:19] Trustee Rogers: and the motion number five at executive committee

[0:19:23] Trustee Rogers: and I can explain what that conversation was about

[0:19:26] Trustee Rogers: because interestingly, the director and the CAO

[0:19:31] Trustee Rogers: have recommended that we not do what that motion number five.

[0:19:35] Trustee Rogers: So they've actually wrote a report saying

[0:19:37] Trustee Rogers: they don't recommend we add a position

[0:19:39] Trustee Rogers: at this point in time.

[0:19:42] Trustee Rogers: so we've got this I it's this it's this odd scenario where we have a number of different

[0:19:48] Trustee Rogers: points of view and we talked about it a lot at the executive committee yesterday

[0:19:54] Trustee Rogers: about what to do about staffing and effectively we came down to the point where

[0:20:00] Trustee Rogers: we're going to make it through the next six weeks using current staff and we'll figure it out after

[0:20:05] Trustee Rogers: that and I'm paraphrasing a little bit but that's sort of where I think very nice chair fast or

[0:20:10] Trustee Rogers: or chair faculty degree, that's sort of where we ended up at the end of the day.

[0:20:13] Trustee Rogers: The CAO said, we'll make it work for the next 21 meetings, which was six weeks,

[0:20:19] Trustee Rogers: and we'll electronically, and then we'll figure out what to do going forward. And I think the

[0:20:25] Trustee Rogers: hope is we'll be back into the vice chair model again, that we'll be back into in-person by then,

[0:20:30] Trustee Rogers: but we'll see. Anyway, it's complicated, and that's all of the context from my perspective.

[0:20:37] Trustee Rogers: if i'm not particularly in favor of putting provisions like this in a special meeting

[0:20:43] Trustee Rogers: called to deal with the electronic thing and so it's more a matter of principle than it is a

[0:20:49] Trustee Rogers: matter of the actual although i went through it last night and found probably seven or eight of

[0:20:54] Trustee Rogers: them that i i would like to amend um i don't like the 15 minute timeline i think the chair should

[0:21:01] Trustee Rogers: have should have a discretion not whoever the deputy secretary is i guess that's becky at this

[0:21:06] Trustee Rogers: moment is it is that is that her title i think the chair should have the discretion to decide

[0:21:11] Trustee Rogers: um whether people should be uh heard or not uh i think that the putting in strict timelines is

[0:21:18] Trustee Rogers: always problematic in my view i think we should be a little bit more flexible and that the chair

[0:21:23] Trustee Rogers: should have some discretion to to do that before the meeting actually starts rather than wait for

[0:21:30] Trustee Rogers: the three of us to get together and make that decision so there's some things i'd like to tweak

[0:21:34] Trustee Rogers: weekend and some and take out and change so that's my view but we can do we can spend the time doing

[0:21:42] Trustee Rogers: that right now but I that that's I think that should be a public process frankly okay

[0:21:50] Trustee Fast (probable): you Dan and uh now that we're back to the uh Gambier local trust committee and the COVID

[0:21:56] Trustee Fast (probable): situation that has put us into this electronic meeting uh situation where we have to cope um

[0:22:04] Trustee Fast (probable): And I'm wondering, Kate Louise, do you have any thoughts?

[0:22:08] Trustee Fast (probable): Are you willing to pass, for example, big chunks of this to allow us to have electronic meetings?

[0:22:16] Trustee Fast (probable): Or would you be interested in just going ahead with it?

[0:22:22] Trustee Fast (probable): Or what's your take, Kate Louise?

[0:22:24] Trustee Fast (probable): I've sent around the, by the way, the guidelines are in your email.

[0:22:28] Trustee Stamford: Okay, I, you know, because it is a special like I'm six and one half does in the other, as always, because it's a special meeting. It's not the same process as we would and I thought the whole point of special meeting was more administrative straightforward type of items, as much as possible.

[0:22:47] Trustee Stamford: I think it's kind of weird that you compared us, Trustee Rogers, to Bolinas v. Chelsea when we are quite a different structure and participation.

[0:23:02] Trustee Stamford: But I do understand we don't often get a lot of people here attending our meetings, but it depends on the subject, right?

[0:23:13] Trustee Stamford: We can't get a lot coming in.

[0:23:16] Trustee Stamford: So I think the guidelines themselves and the procedures are the important part.

[0:23:59] Trustee Stamford: It's interesting. This is a topic that came up, I think, yesterday on the CBC morning show about, you know, codes of conduct and what is it trying to do? Is it trying to stifle proper debate or is it trying to stifle hatred?

[0:24:23] Trustee Stamford: or the Islands Trust.

[0:24:24] Trustee Stamford: So I think for me, I would just like to go ahead with the procedure or the actual electronic

[0:38:29] Voice 2: It's under Section 8 of the Forest Act, the chief forester must review the timber supply for each timber supply area at least once every 10 years and determine an appropriate allowable annual cut of forest land.

[0:38:54] Voice 2: and there are some documents associated with that and there's a comment period that ends on february

[0:38:59] Voice 2: 15th um we did yeah we did um we did get contacted by scrd they have they've been referred those

[0:39:21] Voice 2: to the referral, like as a joint response with SCRD.

Chair Fast called the meeting to order at 10:32 am.  She acknowledged that the meeting was 
being held in territory of Coast Salish First Nations. 
Chair Fast introduced staff and trustees. 
Chair Fast outlined the nature of the Special Meeting, which was being live streamed and 
recorded. 
2. APPROVAL OF AGENDA

By general consent the agenda was approved as amended. 
3. BUSINESS ITEMS 
3.1 Meeting Procedure Bylaw No. 155 - for consideration and decision 
Regional Planning Manager Kauer summarized the staff report on a proposed updated 
meeting procedure bylaw to: incorporate provincial regulation changes permitting local 
government regular business electronic meetings; and add provisions for public 
participation and meeting decorum. As this was an administrative bylaw, no public 
hearing would be required. 
There was discussion of proposed recommendation number 5 regarding staffing support 
for electronic meetings.

Chair Fast drew attention to the meeting participation guidelines developed by the Local 
Trust Committee a few years ago, that discussed delegations, town hall, public 
comments, correspondence and applicants. Chair Fast compared some aspects of the 
guidelines with those proposed in the draft bylaw. 
Points of ensuing discussion on the draft bylaw included: 
 Response of other Local Trust Committees to the draft bylaw; 
 There had been a range of views throughout the Trust regarding Recommendation 5 
on staffing. The Executive Committee had determined to review this issue over the 
next six weeks. It would be on the agenda of the Financial Planning Committee; 
 Support for flexibility around timelines at meetings (e.g., for delegations and Town 
Hall sessions); 
 Applicability of some sections in the bylaw may vary on different islands; example: 
difference in public participation on Salt Spring and Gambier; 
 Support for public comment on sections 18 to 40; 
 Support for a focus on aspects of the draft bylaw dealing with electronic meetings.

to the Secretary of the Islands Trust for approval by the Executive Committee.

3.2 GM-CL-2021.6 (New Brighton Barge Ramp) 
Chair Fast advised that staff would follow up on the letter regarding the New Brighton 
dock that was on the Executive Committee agenda the previous day. 
Trustee Stamford clarified that the current item of discussion pertained to the ramp that 
is beside the dock. The comment period on the application had closed. A planner had 
made a submission on behalf of Islands Trust regarding the zoning that suggested a 
rezoning would be required. 
Regional Planning Manager Kauer (RPM) reported that, after staff had sent the referral 
to the Province, upon further assessment it appeared possible the ramp might be zoned 
properly. RPM Kauer recommended that staff take another look to confirm that the 
zoning is appropriate.  
Trustee Stamford noted that there had been a lot of consternation in the community 
due to uncertainties pertaining to the dock and the ramp. The New Brighton dock 
committee was starting to become more active, and was moving toward a request for 
support from the Sunshine Coast Regional District (SCRD). Trustee Stamford planned to 
meet with BC Ferries. 
RPM Kauer will reconfirm the zoning and advise the LTC as soon as possible on the 
outcome. 
3.3 Timber Supply Review - verbal report 
RPM Kauer announced that the Ministry of Forests, Lands, Natural Resource Operations 
& Rural Development (FLNRORD) was conducting a review of the Sunshine Coast Timber 
Supply Area. Under Section 8 of the Forest Act, the Chief Forester must review the 
timber supply every ten years and determine the allowable timber cut.  
There is public process for that process; the comment period ends February 15. Islands 
Trust was contacted by the SCRD who were referred those documents. They asked if 
Islands Trust wanted to submit a response with the SCRD referral; RPM Kauer indicated 
there was not staff capacity to look at this in detail. This is a Crown function on Crown 
land. Islands Trust does not have much capacity to influence, but now has that 
background information. 
RPM Kauer noted her office has a new planner, who had received the information on 
the review. The new planner was asked to make sure it was considered as part of the 
Gambier OCP project. 
Discussion ensued about forestry and the OCP, and background pertaining to the 
designation of two large cutblocks on Gambier.
