[0:00:35] Trustee Luckham (probable): and it looks like it's all working fine. So thank you very much, Heather, for the extra
[0:00:39] Trustee Luckham (probable): effort today. We had some staff away that would normally conduct this activity. Hence
[0:00:45] Trustee Luckham (probable): some of the troubles with hosting electronic meetings in every possible way we can. We'd
[0:00:52] Trustee Luckham (probable): certainly love to do that, but it does have its challenges and we had that demonstrated
[0:00:56] Trustee Luckham (probable): this morning. Anyway, my name is Peter Lockham. I'm elected on Thetis Island and that's in the
[0:01:03] Trustee Luckham (probable): Laiacson and Penelakut Territory. It's a beautiful place to be as throughout the entire Salish Sea,
[0:01:12] Trustee Luckham (probable): rich with history and culture, just waiting for you to, for us to learn about it and explore it
[0:01:21] Trustee Luckham (probable): and appreciate that the Coast Salish people have been on this coast since time immemorial.
[0:01:27] Trustee Luckham (probable): In fact, I heard just this morning, the northwest corner of Vancouver Island,
[0:01:35] Trustee Luckham (probable): they are now suggesting was not glaciated in the last glaciation, as was the Queen Charlotte Islands.
[0:01:44] Trustee Luckham (probable): And so the potential for discovering history in excess of, I think, 20,000 years,
[0:01:52] Trustee Luckham (probable): exists in those places. Of course a lot of things here were made of cedar which is not very long
[0:01:58] Trustee Luckham (probable): lasting but certainly there's lots of other archaeological sites that are available for us
[0:02:05] Trustee Luckham (probable): to understand what the communities and culture was like here since that memorial. I just want to

[0:11:21] Trustee Johnston: been such a long time since we met, except for that special meeting to do the meeting procedures by law.
[0:11:27] Trustee Johnston: It's hard to know to be in the train of progress.
[0:11:31] Trustee Johnston: progress. That meeting, I attended that meeting from the health center, partly because I had been
[0:11:40] Trustee Johnston: told by Mark that I didn't have sufficient bandwidth to do it from home, but that proves
[0:11:45] Trustee Johnston: not to have been correct, or maybe I've got more bandwidth now than I did then. So I'm at home
[0:11:52] Trustee Johnston: today, but I strongly believe, I attended that meeting from there. I was expecting one person
[0:12:00] Trustee Johnston: who told me they were going to come, they didn't come and it turned out that their car wouldn't
[0:12:05] Trustee Johnston: start and they couldn't get there. And I think it's important that people who don't have a
[0:12:09] Trustee Johnston: telephone or don't have internet connection should be able to attend the meeting without
[0:12:14] Trustee Johnston: having to travel to Gabriela Island. So my intention is to, other than today, to meet
[0:12:22] Trustee Johnston: electronically when we do have electronic meetings from the health center so that people can attend
[0:12:29] Trustee Johnston: and at least listen to the meeting there.
[0:12:31] Trustee Johnston: I had one person show up at the meeting, came in, sat down,
[0:12:36] Trustee Johnston: and when he saw me and my laptop computer at the table,
[0:12:41] Trustee Johnston: the back of it, all he could see, he said to me,
[0:12:44] Trustee Johnston: do you expect me to watch you watching television?
[0:12:48] Trustee Johnston: And I said, I have no expectations of you.
[0:12:51] Trustee Johnston: You can do as you like.
[0:12:52] Trustee Johnston: And he huffed out or went out in a huff.
[0:12:56] Trustee Johnston: So I don't know if you're aware,
[0:12:59] Trustee Johnston: but after one of our meetings it was discovered that the screen had been pulled totally out of
[0:13:05] Trustee Johnston: the holder and there's no screen there there's a wonderful projection uh that is just a great
[0:13:12] Trustee Johnston: thing and so you got the picture i don't know what is it 10 or 12 feet wide maybe a little more
[0:13:17] Trustee Johnston: but there's no screen so it doesn't work it doesn't working so i'm requesting uh a long time
[0:13:24] Trustee Johnston: time ago Heather told me that she thought there might be an extra monitor around somewhere we
[0:13:29] Trustee Johnston: could acquire one and I did once borrow a huge one relatively huge from the fire department
[0:13:36] Trustee Johnston: I could do that again but I'm reluctant to do that I don't have one myself so I'm requesting
[0:13:42] Trustee Johnston: that we consider either acquiring a monitor or perhaps making a contribution to the last
[0:13:49] Trustee Johnston: resort society to towards having the screen repaired or replaced so that when when there
[0:13:56] Trustee Johnston: is an electronic meeting the public could come there to see it and hear it

[0:14:10] Trustee Luckham (probable): uh we certainly have maybe ask uh regional planning manager carver about that monitor video

[0:15:47] Voice 7: You know, I think it's possible for the LTC to request a monitor, but the bigger picture is that the organization would then have to be able to offer monitors to every LTC, and then what do we, and we have to consider what we're going to be doing with them, you know, whether we can put them in the budget, where we're going to store them, who's responsible for them, etc., etc.
[0:16:14] Voice 7: et cetera. So all of those things have to be considered. I think that we as staff have
[0:16:22] Voice 7: contemplated a time in the future when we would be able to project the video or presentations
[0:16:32] Voice 7: and that sort of thing. But given the staffing constraints that we have for the system we have
[0:16:38] Voice 7: right now, we thought that that would be something we'd have to do. We'd have to kind of put into
[0:16:44] Voice 7: a future plan when we have it when we have a more fulsome ability um but at a very micro level yes
[0:16:51] Voice 7: the ltc could request um the purchase of a monitor and um and i don't know if that would come out of
[0:16:59] Voice 7: your ltc budget or if there's a i.t budget associated with it
[0:17:04] Trustee Luckham (probable): yeah um and i'm just going
[0:17:08] Trustee Luckham (probable): going to add from the ec's perspective um this is um the situation is completely in flux um we had
[0:17:18] Trustee Luckham (probable): a plan you know uh six months ago or somewhat and it's changed quite a bit and is continuing to
[0:17:28] Trustee Luckham (probable): change and it's things like this as we live and learn this reality um of going above and beyond
[0:17:35] Trustee Luckham (probable): what we're required to do in terms of in-person meetings,
[0:17:41] Trustee Luckham (probable): which is what we are expected to do.
[0:17:44] Trustee Luckham (probable): The government has provided us the ability to now meet electronically,
[0:17:48] Trustee Luckham (probable): but obviously that's added additional complexity.
[0:17:52] Trustee Luckham (probable): So, yeah, I don't know.
[0:17:56] Trustee Luckham (probable): I guess the thing there would be is that we could, I guess,
[0:18:03] Trustee Luckham (probable): have a motion.
[0:18:04] Trustee Luckham (probable): I guess you would want to have a motion that we would want to see some kind of video capability,
[0:18:11] Trustee Luckham (probable): but it's much a bigger question than that.
[0:18:14] Trustee Luckham (probable): And of course, I presume that we pay a fee for the use of the health center.
[0:18:18] Trustee Luckham (probable): And one would think that if a projector and a screen was part of the health center rental,
[0:18:23] Trustee Luckham (probable): that that might be actually something we would expect.
[0:18:28] Trustee Luckham (probable): But that's hard to say. I don't know.
[0:18:30] Trustee Luckham (probable): Heather, do you have any further advice on that or what would you like us to do?
[0:18:34] Voice 7: Yeah, well, I was just going to say that there are other things to consider.
[0:18:38] Voice 7: You know, if if we are using the hall as any kind of venue as an official part of meeting, we have to our administrative staff have to book that ahead of time and we have to pay for that use.
[0:18:52] Voice 7: But there's also this weird regulatory thing that is basically, we have to decide whether a staff person has to be present or not.
[0:19:04] Voice 7: If there are two or more trustees attending remotely to the meeting, then a staff person has to be present at the location where the public can see and hear the meeting.
[0:19:19] Voice 7: gang. So we might have a situation in which the chair and one of the trustees is attending
[0:19:25] Voice 7: remotely. One of the trustees is attending the hall, and that means that a staff person has to
[0:19:31] Voice 7: travel to the island and be at that physical location. They can't attend remotely. Well,
[0:19:37] Trustee Luckham (probable): if the location is designated as being on Leskete, if it's designated as being
[0:19:42] Trustee Luckham (probable): in Gabriola or somewhere else. That's
[0:19:45] Trustee Luckham (probable): right. That's right. Or Parksville, for that matter.
[0:19:48] Trustee Luckham (probable): Yeah.
[0:19:49] Voice 7: So there's all those logistical things to consider too.
[0:19:52] Trustee Luckham (probable): Yeah. And I think that maybe we're coming up into our budget debate here. There may
[0:19:56] Trustee Luckham (probable): very well be a topic of conversation there, financial planning committee in the next week or
[0:20:01] Trustee Luckham (probable): so about how it is that we're going to address this. But Mr. Johnson, more?
[0:20:08] Trustee Johnston: Well, I was just going to say that I wasn't thinking that the health center would be the
[0:20:12] Trustee Johnston: official location of the meeting. That would be an additional public access, but entirely
[0:20:17] Trustee Johnston: unofficial location so no need for a staff member to be there that the local the official location
[0:20:24] Trustee Johnston: would be gabriela the other thing is when i did borrow the monitor before the fire chief carried
[0:20:30] Trustee Johnston: it over from the fire hall which is quite close left it there and he had me leave it there and
[0:20:36] Trustee Johnston: he picked it up and took it back and that worked really well for me but i don't know how well it
[0:20:41] Trustee Johnston: works for him and i'm a little worried that if whoever is carrying it drops it we would be or
[0:20:47] Trustee Johnston: or I would be responsible for that.
[0:20:50] Trustee Johnston: Especially
[0:20:50] Trustee Luckham (probable): if you dropped it.

[0:20:53] Trustee Johnston: And I'm thinking that I will suggest to the board

[0:22:44] Trustee Johnston: just want to report briefly on the Liskiti Archaeology Project, which is continuing for a couple of more years.
[0:22:54] Trustee Johnston: We're planning for spring events and particularly around four weeks in the summertime centered on low tide because there are a lot of archaeological sites below the high tide line that we want to be able to explore and map the extent of and just to appreciate.
[0:23:18] Trustee Johnston: And we'll continue to have nations, the Ba'am and Comox nations have participated fully.
[0:23:25] Trustee Johnston: Qualicum is participants and others.
[0:23:29] Trustee Johnston: Not all of them have been able to be here, and we hope to expand that.
[0:23:34] Trustee Johnston: Dana recently wrote to many of the landowners with known and recorded sites on the Muskegon,
[0:23:40] Trustee Johnston: has had a variety of responses from them.
[0:23:44] Trustee Johnston: sort of, as you'd expect, from very enthusiastic to very reticent. And
[0:23:50] Trustee Johnston: there's a lot of uncertainty, I think, and mixed feelings about it. We're going to have a couple
[0:23:57] Trustee Johnston: of events. One is in March. Actually, it's the day after Trust Council. And I believe that the
[0:24:04] Trustee Johnston: trustees will all be invited to a webinar on First Nations heritage policy. Some nations have very
[0:24:12] Trustee Johnston: well-developed policies on how they want their heritage, their archaeological heritage to be
[0:24:20] Trustee Johnston: dealt with and controlled and some have not and are just beginning to think that. So we're planning
[0:24:27] Trustee Johnston: a panel and discussion on that to which I think that all the trustees and possibly some of the
[0:24:35] Trustee Johnston: staff or maybe all the staff will be invited to but there'll be follow-up from that and other
[0:24:40] Trustee Johnston: other events. And we found quite a number of culturally modified
[0:24:46] Trustee Johnston: trees on Lusketi, which is really interesting. And once
[0:24:49] Trustee Johnston: you've seen one, you tend to see more of them. So they keep
[0:24:52] Trustee Johnston: showing up. By and large, all of the sites we've looked at so
[0:24:58] Trustee Johnston: far, which is a handful, they've been much more extensive than we
[0:25:03] Trustee Johnston: thought they were, or than is recorded. And much more

[0:30:55] Voice 1: A lot has happened since October,
[0:30:58] Voice 1: so I will try to focus on a few high-level summary points.
[0:31:03] Voice 1: First, our postal services have been disrupted
[0:31:06] Voice 1: since the end of November,
[0:31:08] Voice 1: and with thanks to the Laskete Last Resort Society,
[0:31:11] Voice 1: starting today, a temporary post office will be operating
[0:31:15] Voice 1: out of the Judith Fisher Centre
[0:31:16] Voice 1: with a temporary postmaster for the time being,
[0:31:19] Voice 1: and this will help restore this vital service in mid-october i attended the virtual climate
[0:31:26] Voice 1: change summit organized by the climate caucus the panel on systemic changes in local government
[0:31:31] Voice 1: explored the concept of donut economics which provides a tool for assessing risks and shortfalls
[0:31:38] Voice 1: in an integrated manner this model has been adopted by the city of nanaimo which is downscaling it to
[0:31:44] Voice 1: the scale of a municipality. So it will be interesting to see how they make with that,
[0:31:49] Voice 1: and it might provide useful information for other governments. In late October, I attended a climate
[0:31:55] Voice 1: caucus meeting that hosted the mayors of Lytton and De Colliet for an open discussion. It was
[0:32:01] Voice 1: sobering to hear how their catastrophes led to many interacting issues and challenges for recovery.
[0:32:08] Voice 1: For example, in Lytton, many people did not have insurance. The release of contaminants will require expensive cleanup before any rebuilding can start, and the Municipal Council had nowhere nearby to meet to even get things going and first had to focus on building a temporary meeting place so they didn't have to meet in Kamloops where they were having to start.
[0:32:32] Voice 1: In November, I attended a webinar on the reconciliation and island communities organized by SFU professors Dana Leposki and Sean Markey as part of the Pauete Liskiti Archaeology Project that Trustee Johnson mentioned.
[0:32:48] Voice 1: This webinar included a very good presentation by Lisa Wilcox, the Island's Trust Senior Intergovernmental Policy Advisor, and it was quite well attended. It was a very good webinar.
[0:32:58] Voice 1: I would like to acknowledge the Liskiti Beach Cleanup Heroes who worked during the summer and autumn as part of a grant project where they picked up over 10,000 kilograms of marine debris from the shores of Liskiti and nearby islands, including as far away as Bolinas Island.
[0:33:13] Voice 1: Much appreciation to Mikayla, Anna, Heather, Kaya, Tayan, Julia, Carly, Chauvin, Farron, Agul, and Mark.
[0:33:23] Voice 1: The QRD put forward a resolution to Association of Vancouver Island Coastal Communities
[0:33:28] Voice 1: to request that the province ban the use of expanded polystyrene,
[0:33:32] Voice 1: commonly known as styrofoam, in the marine environment
[0:33:36] Voice 1: with the help of the Let's Talk Trash team and Ocean Legacy.
[0:33:39] Voice 1: I acknowledge that the Islands Trust put forward a related resolution in 2017
[0:33:43] Voice 1: to ask the province to regulate styrofoam in the marine environment,
[0:33:48] Voice 1: and that was endorsed.
[0:33:49] Voice 1: forced, this new resolution strengthens that one in recognition of the persistence of styrofoam
[0:33:55] Voice 1: marine pollution.
[0:33:57] Voice 1: At its November meeting, the Vancouver Island Regional Library Board decided to eliminate
[0:34:01] Voice 1: fines entirely for overdue material to improve equal and equitable access to library material.
[0:34:08] Voice 1: If items are not returned by 120 days after the due date, they will be deemed lost and
[0:34:14] Voice 1: replacement costs will be added to the cardholder's account and if charges are in excess of
[0:34:19] Voice 1: the $40 borrowing will be suspended, but it will make it much more accessible to people.
[0:34:25] Voice 1: And the overall assessment was that the cost of doing this, the lost recovery of fines,
[0:34:30] Voice 1: was negligible because it's just a challenging thing.
[0:34:36] Voice 1: So this is actually going to improve use of materials.
[0:34:39] Voice 1: In January, I attended a Liskiti Ferry Committee meeting.
[0:34:43] Voice 1: As with BC ferries, our ferry service is currently at risk of reduced capacity or runs
[0:34:48] Voice 1: if any crews are absent for any reason.
[0:34:51] Voice 1: As frontline workers, the ferry crew face the best and worst of individual behaviour
[0:34:56] Voice 1: and have been dealing with some challenging situations regarding their requirements
[0:35:00] Voice 1: to ensure that Transport Canada mask mandates are followed.
[0:35:04] Voice 1: I tip my hat to the ferry crew for continuing to operate our service safely.
[0:35:08] Voice 1: And finally, I note the item in the agenda on the Shoreline Protection Model By-law
[0:35:12] Voice 1: and hope the timing with the QRD shoreline flood risk mapping results,
[0:35:19] Voice 1: which should come this year, hopefully sooner than later,
[0:35:23] Voice 1: but that may be useful in that to help address shoreline erosion risk
[0:35:28] Voice 1: and assess that in the context of that shoreline protection project.

[0:37:08] Voice 6: and 14 um and trying to develop a company on the island um in that process um we have
[0:37:17] Voice 6: now come to a point that we're starting to build on the island um we're just for background we are
[0:37:26] Voice 6: 80 first nations owned it's funded by the by nadc which is the no chalet land development
[0:37:33] Voice 6: Corporation. I believe we're the second cannabis company to be funded by them. And we're funded by
[0:37:40] Voice 6: TAC, which is, we fit in an odd area within BC and we, that both of them cross over each other,
[0:37:49] Voice 6: as do many of the territorial rights in BC crossover Liskiti. And we are the first
[0:37:58] Voice 6: first cannabis company to be funded by TAC ever. And they are using us as a role model of what
[0:38:08] Voice 6: they would like to see further for the First Nations companies. Our company is based on two
[0:38:16] Voice 6: things. We will be starting out as a micro grow, which limits our liability or the amount of money
[0:38:25] Voice 6: put in before we start getting the cash flow in that but we have an end purpose to this company
[0:38:30] Voice 6: our end purpose is twofold one it is to use the facility as a training facility for first
[0:38:38] Voice 6: nations across canada to grow cannabis in the second uh area that we will be using is five
[0:38:50] Voice 6: percent of the gross revenues of this company will be used to uh study um addiction and mental
[0:39:01] Voice 6: health ptsd within the first nation community and how to treat it with cannabis um i was really
[0:39:12] Voice 6: this last week i've i've um you know up to hill tricks of people reporting us for you know not
[0:39:20] Voice 6: having electrical permits which i did not realize i had always been told that i don't need electrical
[0:39:27] Voice 6: permit on the island um i was informed this week that that was incorrect which was uh you know
[0:39:34] Voice 6: wholly um fixed right away we're not trying to do anything outside of the boundaries we just
[0:39:39] Voice 6: didn't want to use any money that we can use to develop this in government stuff but in my
[0:39:47] Voice 6: conversation uh with the uh warren dingham um he informed me that the language i was using
[0:39:57] Voice 6: was racist um the language i was using was uh the term grandfathered in because he's telling me that
[0:40:07] Voice 6: he will be the one to decide although i have a letter from islands trust stating that when we
[0:40:13] Voice 6: We applied for this license originally that our land use was the correct land use for cannabis growing.
[0:40:24] Voice 6: We then covered it in a meeting in 2018, I believe, that those exact terminology grandfathered in was stated that this medical facility was grandfathered in, that you guys could not change the rules.
[0:40:42] Voice 6: rules. His response was, I will be the judge of that. So in saying this, I would like two
[0:40:51] Voice 6: things from the Islands Trust. I would first of all like to know, because all the First
[0:40:59] Voice 6: Nations are talking to a few people of this, we all have grandfathers and our whole fight
[0:41:04] Voice 6: is uh in colonialism is that they took away what our grandfathers did so i don't know where
[0:41:16] Voice 6: grandfather din came from he talked about the slaves in the south um i would like a more
[0:41:24] Voice 6: extensive uh thing of whether that be a proper term or improper term to be used i would like
[0:41:36] Voice 6: you to educate your constituents so that they don't go away feeling that they're being called
[0:41:42] Voice 6: a racist because it was very disconcerting and i would like the islands trust to once again
[0:41:50] Voice 6: restate that they are aware of this facility we are about a million dollars into it
[0:41:59] Voice 6: and to be threatened well i guess it's not threatened to be told that i will be this
[0:42:06] Voice 6: that deciding thing uh was a little disconcerting to me and that is the end of my comments
[0:42:18] Voice 6: i would like comments from both the trustees on this if i could if that is permissible to ask

[0:47:31] Trustee Luckham (probable): beginning with Louisiana in 1898, states passed laws stating that unless one's grandfather was
[0:47:38] Trustee Luckham (probable): eligible, then one was not. These laws quickly spread and were not struck down until 1915
[0:47:45] Trustee Luckham (probable): Supreme Court ruling in the US. I won't believe that any further, but there is some context to
[0:47:53] Trustee Luckham (probable): that and that's uh informative so kathy bond thank you for enlightening us on this and and and and
[0:48:00] Trustee Luckham (probable): and indeed bringing that message from our bylaw enforcement officer who uh i would say that

[0:49:40] Trustee Luckham (probable): Although we are at the Honest Trust certainly committed to doing what we can to collaborate and work with First Nations and recognize that longstanding history.
[0:49:49] Trustee Luckham (probable): But certainly the notion about legal nonconforming is if something was never legal in the construct of our legislation, then it is still not legal.
[0:50:03] Trustee Luckham (probable): If it was legal at one time, again, in the construct of our legislation, and the bylaw changes, then it still remains legal.
[0:50:14] Trustee Luckham (probable): And that is well understood by many. And maybe I'll just turn to Heather, Regional Planning Manager of Cower, if we actually have some document or documentation on that concept that is readily available.

[0:53:35] Voice 4: or keeping blacks from voting. That's an aside. I want to comment on the fees bylaw.
[0:53:46] Voice 4: As I understand it, it's an average of all of the fees in all the islands. They've averaged it out
[0:53:54] Voice 4: and they've come up with a standardized fee. But the average of one to ten is five. And I'm pretty
[0:54:01] Voice 4: pretty sure that the Mesquite Island has the much cheaper process fees and costs than Salt
[0:54:11] Voice 4: Spring.
[0:54:12] Voice 4: And it doesn't seem right that our costs should go up and Salt Spring's should go down.
[0:54:18] Voice 4: Also I noticed in the fees by-law that they've introduced fees for development permit areas
[0:54:25] Voice 4: and there's just absolutely no support on Mesquite for development permit areas.
[0:54:32] Voice 4: areas. And I also think that our fees should reflect the lower costs that we have. I'm sure
[0:54:39] Voice 4: they're lower. Maybe
[0:54:40] Voice 4: the staff can establish that. Also, I'm objecting to this move towards
[0:54:48] Voice 4: electronic meetings. It just seems like it insulates the local trust committee from the public.
[0:54:56] Voice 4: And we have a near unanimous outcry from the public on Mesquite Island against electronic
[0:55:04] Voice 4: electronic meetings. Even people who don't attend the meetings don't like the idea of
[0:55:08] Voice 4: electronic meetings. I think you guys are making a mistake moving to all electronic
[0:55:14] Voice 4: meetings like you are. Also, the idea that the person has to send in their presentation
[0:55:20] Voice 4: to the local trust committee and have it pre-approved, or they do it. That's the kind of thing they
[0:55:26] Voice 4: do in a dictatorship, where only the accepted rhetoric is allowed at public meetings. And
[0:55:32] Voice 4: And that really plays into the hands of the rising populist sentiment
[0:55:36] Voice 4: that thinks that the governments are becoming dictatorial.
[0:55:39] Voice 4: I really think that that's not something, that's not a place you want to go.
[0:55:43] Voice 4: You can always cut a speaker off if what they're saying is inappropriate.

[0:55:57] Voice 4: This is about the sheep now and the term feral and the term exotic.
[0:56:02] Voice 4: In the current iteration of the OCP, the Ministry of Agriculture held an interdepartmental meeting concerning the domestic sheep on Leskeetee Island.
[0:56:13] Voice 4: Here's a summary of the conclusions of that interdepartmental meeting.
[0:56:18] Voice 4: The sheep on Leskeetee are domestic livestock.
[0:56:22] Voice 4: Essentially, they are escaped domestic sheep.
[0:56:25] Voice 4: For a species to be labeled feral, they must be specifically designated as feral, such as feral pigs.
[0:56:36] Voice 4: The sheep on Luskete Island have not been so designated, and they are not feral.
[0:56:43] Voice 4: They are, as I said before, domestic.
[0:56:47] Voice 4: They are livestock, domestic sheep.
[0:56:52] Voice 4: Exotic is another term that the Ministry of Agriculture uses.
[0:56:57] Voice 4: uses. They use it to designate specific species only. It's not used indiscriminately. Alligators,
[0:57:07] Voice 4: pit vipers, those are exotic species. The sheep on Laskete have not been so designated and thus
[0:57:14] Voice 4: are not considered to be exotic. So they are neither feral, this is the Ministry of Agriculture's
[0:57:23] Voice 4: opinion, they are neither feral nor are they exotic. And they should not be so labeled
[0:57:28] Voice 4: the term should not be used in our bylaw.
[0:57:33] Voice 4: Final point, the staff posted the change
[0:57:45] Voice 4: from an in-person meeting at 11 a.m.

[1:32:00] Voice 11: leeway. And if they start at that rate, we only have the ability to reduce it by, well, I believe

[1:32:09] Voice 7: Yeah. If I could just respond to that. You know, there was some
[1:32:14] Voice 7: recognition when this bylaw went out after it had been published and sent to LTCs that that line
[1:32:21] Voice 7: item in particular was problematic um because community benefit is so ill-defined and so um
[1:32:29] Voice 7: most of the ltcs have removed that item and that has that's been not been a problem and we have
[1:32:36] Voice 7: actually ended up recommending it sorry i didn't bring that up so

[1:32:47] Voice 11: i i you know having gone through the regional planning committee um with this uh the model
[1:32:52] Voice 11: bylaw a fair bit you know this was discussed a lot about how ltcs can um help enable and
[1:33:03] Voice 11: you know community benefit projects and so my question is based on what you just said like if
[1:33:11] Voice 11: we are if we're removing it then in then in what way are we able to um like doesn't that mean then
[1:33:22] Voice 11: And that a temporary use permit for community benefit would just fall under one of the other categories.
[1:33:30] Voice 11: Like, for example, if it fell under residential, commercial, industrial, which is, you know, a little over double what number 13 is there, number 12.

[3:06:13] Trustee Johnston: And I just really think that we're showing, I hope unintentionally, that we're not terribly serious about meeting with First Nations, or at least I'm not seeing that we're responding quickly or directly to requests for meetings.

[3:06:34] Trustee Johnston: I don't know what's happened with the, about meeting, electronic meeting with La Amon, with the Hague.

ADOPTED Lasqueti Island ADOPTED 1 Local Trust Committee Minutes February 7, 2022 Lasqueti Island Local Trust Committee Minutes of Regular Meeting Date: Location: February 7, 2022 Electronic Meeting Members Present: Peter Luckham, Chair Peter Johnston, Local Trustee Timothy Peterson, Local Trustee Staff Present: Heather Kauer, Regional Planning Manager Dave Olsen, Recorder Others Present: Regional Director Andrew Fall There were three (3) members of the public in attendance 1. CALL TO ORDER Chair Luckham called the meeting to order at 10:03 am. He acknowledged that the meeting was being held in territory of the Coast Salish First Nations and introduced the Trustees and staff. 2. APPROVAL OF AGENDA The following additions to the agenda were presented for consideration: 11.3 Safe Island Land Alliance 11.4 Meetings with First Nations 11.5 Electronic Meetings By general consent the agenda was adopted as amended. 3. REPORTS 3.1 Trustee Reports Trustee Johnston reported: The Lasqueti Archaeology Project is planning on some spring events and will focus on low tides to map existing sites and noted that more culturally modified trees have been found on island. He attended last month’s Special Meeting from the Health Centre, which no longer has a functional projection screen. He would like to request that a large monitor be purchased so that people without telephone or Internet access could attend. o Staff advised that the LTC could request a monitor, but then the Islands Trust would have to offer them to every LTC and storage would have to be considered. ADOPTED Lasqueti Island ADOPTED 2 Local Trust Committee Minutes February 7, 2022 o The Chair advised that the situation is in flux and speculated that the use of a screen could be added to the rental fee of the Health Centre. o Staff noted that if two or more Trustees are attending remotely, then a staff person has to be present for the public to attend the meeting. o Trustees added: That the Health Centre would not be the official location of the meeting; the official location would be Gabriola Island. They are concerned about dropping a borrowed monitor. They will advise the JFC to increase their rent in order to provide a screen, since Audio Visual equipment has not been officially part of the rental. Trustee Peterson reported: That he is continuing to hear from the public that they would like us to get back to in-person meetings as soon as possible. He is also getting a lot of questions about Provincial water licensing requirements. He is registered for the Salish Sea Ecosystem Conference in April. He has many Islands Trust Committee meetings coming up. 3.2 Chair's Report The Chair reported: The Islands Trust budget for the next fiscal year is in the public consultation phase and will advance to Trust Council on March 8, 9 and 10 in Nanaimo. Expecting the governance review report soon to advise on how to improve on the Islands Trust Preserve and Protect mandate. The Guiding Principles document of Islands Trust is going out for extensive public consultation. 3.3 Electoral Area Director's Report Director Fall reported: Local postal service has been disrupted since the end of November; a temporary service is to begin today in the Health Centre with a temporary Postmaster. He acknowledged that over 10,000 kg of beach debris was cleaned up this past summer on Lasqueti and the surrounding islands. qathet Regional District (qRD) put forth a resolution to the province to ban the use of polystyrene in the Salish Sea. In November, the Vancouver Island Regional Library decided to eliminate all late fees, since the recovery of fines was found to be negligible. In January, he attended a Lasqueti ferry committee meeting and noted that ferry capacity is reduced when crewing levels are reduced. Regarding the Shoreline protection bylaw item in today’s agenda package, he hopes that the qRD mapping results will be available soon. 4. TOWN HALL A member of the public spoke as a representative of the Lasqueti Cannabis Corporation, which is now at the point of building on island. She was informed this week that they did not have an electrical permit, which was quickly rectified. In the course of that discussion, an Islands Trust ADOPTED Lasqueti Island ADOPTED 3 Local Trust Committee Minutes February 7, 2022 (IT) Bylaw Officer, Warren Dingman, informed her that the language she used, “grandfathered in,” is racist. She asked for two things from LTC: 1. We all have grandfathers and our fight against colonialism is largely that they took away what our grandfathers did. She wants to know if that term is appropriate so that people do not go away feeling like they are being called a racist. 2. She also wants IT to restate that they are aware of this facility; her corporation has spent about a million dollars and it is disconcerting to be told that the IT will decide if it is legal. The Chair advised that legal, non-conforming is a better term to use than grandfathering and thanked the speaker for bringing the racist aspects of that term to our attention. If an activity was legal at one time and the bylaw changes, the activity remains legal. Staff advised that they could ask them to demonstrate activity before the bylaw change. Trustees added the following: Bylaw enforcement does decide whether to send the enforcement to the LTC, which then decides whether or not to send it to the Executive Committee, which ultimately makes the decision to take court action or not. Previous Trustees wrote a letter of support for this project. A member of the public addressed the LTC and the following was noted: Regarding the grandfather definition, the definition used in Louisiana in the 1800s is not relevant to Lasqueti. By averaging the cost for processing fees in the fee bylaw does not seem fair if our costs go up and Salt Spring’s go down; our fees should reflect our lower cost. Strong objection to this move to electronic meetings; it is isolating the LTC from the public and there is a near unanimous outcry against this. Even people that do not attend meetings are against it. The requirement to have information preapproved is a tool of dictatorships; the Chair can always cut people off if something inappropriate is said. Ministry of Agriculture (MoA) held an inter-departmental meeting; according to that meeting, the sheep on Lasqueti are considered “escaped domestic sheep”, they must be specifically designated as feral and that has not been done. “Exotic” is another term that the MoA has defined and which is not appropriate for the sheep on Lasqueti. They are neither feral nor exotic and these terms should not be used in our OCP. Staff announced that this meeting had been changed, from an in-person meeting to an electronic meeting and that the time was changed from 11am to 10am, three working days before the meeting; the LTC voted to authorize these changes two working days before this meeting. He questioned whether this meeting was lawfully convened. The Chair acknowledged the question and asked staff to respond. Staff advised that the Meeting Procedures Bylaw had to be adopted prior to the meeting and that there is no requirement for posting meeting information in advance of meetings. ADOPTED Lasqueti Island ADOPTED 4 Local Trust Committee Minutes February 7, 2022 The Chair stated that the meeting is in process and will continue. Trustees noted that anyone who goes to the Health Centre has reason to complain and that some folks may have missed the first part of the meeting. 5. MINUTES 5.1 Local Trust Committee Minutes dated October 4, 2021 - for adoption By general consent, the minutes of the Lasqueti Local Trust Committee Meeting of October 4, 2021 were adopted. 5.2 Local Trust Committee Special Meeting Minutes dated January 20, 2022 - for adoption By general consent, the minutes of the Lasqueti Local Trust Committee Meeting of January 20, 2022 were adopted. 5.3 Section 26 Resolutions-Without-Meeting Report dated January 31, 2022 Received. 5.4 Advisory Planning Commission Minutes dated July 27, 2021 - for receipt Received. BUSINESS ARISING FROM MINUTES 6.1 Follow-up Action List dated January 31, 2022 Trustees queried staff and the following was noted: Is there any update regarding “4. Staff to review FLNRORD's comments and get SIPAs comments on Crown Lands and reconciliation regarding the OCP bylaw No. 98”? Trustees have not received anything from FLNRORD. The public wishes to keep these policies in the Official Community Plan. Can we ask Director Marlor to attend the next meeting and explain FLNRORD’s position? Staff can make this request without a motion. 6.2 Model Fees Bylaw Update - Staff Report Staff introduced the item and noted that they were asked to draft this model fees bylaw. The Chair noted that one of the speakers during Town Hall rejected the Development Permit Area (DPA) idea. Staff noted that this would be a placeholder; a future LTC could create them at a later date. Trustees responded and the following was noted: To have a fee for something suggests that it will be created. ADOPTED Lasqueti Island ADOPTED 5 Local Trust Committee Minutes February 7, 2022 There have been two attempts in the past to create DPAs. There was a huge swell of opposition from the public. What is the difference between Development Variance Permits (DVP) and DPAs? Regarding Permit #13, related to applications with community benefit, a fee of $1,000 seems high, because the fee can only be adjusted by 20%. Are there any actuals that we can access to make available to the public? o Staff: yes Staff responded and the following was noted: o A copy of the bylaw is not included in the agenda package because only the fees were being brought forward for adjustment. o DPAs and DVPs are different; DVPs do not have anything to do with DPAs. DVPs are related to zoning. o It does make sense to remove #17 and #18 because without DPAs they are not relevant. o Other LTCs have removed #13 and staff recommends removing it. Trustees noted the following: If #13 was removed, then all projects would fall into #12, which has even higher fees instead of making the fee lower. This needs to be deferred to another meeting. We want to see the actual costs of processing applications for Lasqueti before making any changes. Staff advised: o That there is not good data for the actual cost of processing applications. o Staff collected that data for three months last year but that is the only data available. o That the word “average” reflects the actual cost of processing applications. o This is an attempt to move more of the cost from the general taxpayer to the applicant. LA-2022-008 It was MOVED and SECONDED, that the Lasqueti Island Local Trust Committee request staff to remove from Table 2 of Bylaw 99, Items 1-8 and items 17 and 18 and to bring a report back to our next meeting. CARRIED 7. APPLICATIONS, REFERRALS AND BYLAWS 7.1 Gambier Island Local Trust Committee Request for Referral Response - Bylaw Nos. 153 and 154 - for decision Staff explained that the Gabriola LTC is proposing to adopt a Shoreline Development Permit Area. LA-2022-009 It was MOVED and SECONDED, that the Lasqueti Island Local Trust Committee advised that their interests are not affected by this bylaw. ADOPTED Lasqueti Island ADOPTED 6 Local Trust Committee Minutes February 7, 2022 CARRIED The Chair recessed the meeting at 11:54am and reconvened the meeting at 12:32pm. Staff introduced the item and the following was noted: o The application does not meet the minimum requirements as outlined in the Local Government Act and the Lasqueti Island Land Use Bylaw. o Staff recommends waiving this minimum requirement. Trustees suggested that they expand the 10m access to the 20m minimum. Rachel Hamling, speaking on behalf of the applicant, advised that they could flare out the frontage to accommodate the minimum. The Chair noted that the LTC would still be required to waive the minimum requirement of 10%. Staff advised that they could work with the applicant to revise the application and suggested that the LTC make a motion to waive this requirement today. LA-2022-010 It was MOVED and SECONDED, that the Lasqueti Island Local Trust Committee waive the 10% highway frontage requirement, but retain the minimum 20 metre highway frontage requirement. CARRIED 8. LOCAL TRUST COMMITTEE PROJECTS 8.1 Lasqueti Island Official Community Plan (OCP) Comprehensive Review - Proposed Bylaw No. 98 – Memorandum Staff introduced the item and the following was noted: o Snaw-na-as First Nation requested that the LTC not move forward with the OCP until a meeting was held with them. o There has been no response to our letter asking for a date to meet. o The staff report memo outlines the comments that we have received with recommendations from staff. o “Neutral” means that staff has no objection to the recommendation. o Some recommendations are considered problematic if the document is updated in the recommended way. o Staff does not expect the LTC to make any motions today. The Chair advised that he is content to receive the report and wait for a meeting. Trustees continued the discussion and the following was noted: How important is it to finish the OCP Review before the end of this term? Would like to spend time to get this as good as it can be before the next term. Would like to move forward but there are new factors that we had not expected. Important to get it right rather than to get it done by a specific date. Noted that the numbering system has change and that it would be better if we all have the same numbering system. ADOPTED Lasqueti Island ADOPTED 7 Local Trust Committee Minutes February 7, 2022 Staff advised that second reading was given to a previous version and that the current version will be made more available. 9. DELEGATIONS - none 10. CORRESPONDENCE The Chair recognized that there was late correspondence received after the deadline. Trustees noted the following: That the agenda package directs the reader to the webpage for correspondence but it does not seem to appear there. All correspondence is not easily available. Much of the correspondence is not related to applications and projects. A chronological ordering of correspondence would be appropriate. Would like to ask staff to set up a correspondence page so that it is available to everyone. Staff advised that correspondence related to applications and projects is posted, but correspondence beyond that is not done due to staffing and website capacity limits. Correspondence is included in agenda packages so in that way it is posted to the website. The Chair noted that there is room for improvement but it would need to go all the way up the chain and may be in progress. He also noted that the complexity is significant. 11. NEW BUSINESS 11.1 Natural Area Protection Tax Exemption Program (NAPTEP) - Livingstone Forest NAPTEP Covenant - Information Item – Memorandum Received. 11.2 Shoreline Protection Model Bylaw Report - Briefing - for information The Chair advised that this came from Trust Council and is received for information. 11.3 Safe Island Land Alliance Trustee Johnston introduced the item and the following was noted: He has a concern that the land was listed as 160.8 acres and that the minimum land requirement per residence is 10 acres, but he has since learned that the developer now wishes to put 17 dwellings on the property. The conversion to metric changed the minimum to 4 hectares, which is less than 10 acres. He would like to revert the bylaw back to a full 10 acres. Staff responded and the following was noted: o Advised that the number of residences allowed for that parcel is 17. o She believes there is a misunderstanding about the amount of land available there, but does not have the information regarding how much land is involved. Trustees noted that it is the conversion to hectares, which allows this development to have 17 dwellings and that they would like to amend the LUB to accurately reflect what all discussions in the community are based on, which is 10 acres or 4.2 ha. ADOPTED Lasqueti Island ADOPTED 8 Local Trust Committee Minutes February 7, 2022 11.4 Meeting with First Nations Trustee Johnston introduced this item and the following was noted: A Tla’amin Hegus requested a meeting with us over a year ago. The K’omoks First Nation has asked to meet with us. The Snaw-na-as First Nation sent us a letter in September but our first reply was not sent until December. He is worried that our responses are not timely. Staff responded and the following was noted: o The K’omoks request was responded to quickly, but she understands that the K’omoks First Nation’s capacity is limited. o A recent email exchange indicated that their request for a meeting has been withdrawn. o Noted that Lisa Wilcox, Senior Intergovernmental Policy Advisor, has more work than she has capacity. o We do not know when the Snaw-na-as First Nation will be able to respond. o Lisa Wilcox is also dealing with the Tla’amin request. The Chair noted that we are making good progress. 11.5 Electronic Meeting Equipment The Chair advised that the IT does not want to move to all electronic meetings. Health measures prevent us from doing this. We need to deliver service homogenously across the Trust area. 12.
