[0:02:54] Voice 5: by by acknowledging and recognizing with respect and um and and gratitude that we're meeting in

[0:03:00] Voice 5: in of course the uh the uh traditional territory of coast salish people um uh main island would

[0:03:09] Voice 5: have been and is a a traditional area for many coast salish people in particular uh and we're

[0:03:16] Voice 5: privileged and i'm always reminded as i come across the sailor's sea on the on the uh the

[0:03:22] Voice 5: ferry uh what a beautiful place it is as we enter into uh all of these um beautiful days and watching

[0:03:29] Voice 5: it i can imagine why why they've lived here for millennium um so thank you this is um our regular

[0:03:37] Voice 5: meeting let me introduce the people you see in front of you and for for those of you that are

[0:03:41] Voice 5: watching the live stream of this meeting um uh i'm my name is dan rogers and i'm the chair of the

[0:03:49] Voice 5: main island local trust committee i sit on the executive committee of islands trust and have

[0:03:55] Voice 5: done for the last three years and eight months um and i've had the privilege of chairing main island

[0:04:03] Voice 5: as well as Galeano and Gabriola's.

[0:04:06] Voice 5: And I come from Alcatsum, Housound and Keats Island.

[0:04:12] Voice 5: That's my home and that's my connection

[0:04:14] Voice 5: to the islands area.

[0:04:17] Voice 5: To my right and on the screen to your left

[0:04:19] Voice 5: are your two local trustees,

[0:04:21] Voice 5: Trustee Janine Dodds and Trustee David Maude.

[0:04:30] Voice 5: who is the uh who is the planner the island planner for main island uh hi narissa and of

[0:04:37] Voice 5: course pat todd uh who's our recorder for this meeting um so this meeting is being uh live

[0:04:45] Voice 5: streamed this is the continuation of our evolution of i mean i when you think about it just over two

[0:04:53] Voice 5: years ago the only way you could attend one of our meetings was the way the people there

[0:04:58] Voice 5: industry which is to be here uh and then the pandemic hit and we went virtually online and

[0:05:05] Voice 5: now we're on a a vaguely um hybrid format uh we have a high a format whereby we are recording

[0:05:14] Voice 5: our meetings that's what that cyclops thing in front of me is um and and where you'll hear uh

[0:05:21] Voice 5: if anybody's coming joining us online where you'll hear the voice come out and they're recording and

[0:05:27] Voice 5: And we're also live streaming this meeting.

[0:05:30] Voice 5: And I say live, I can't put it on here because it's about a 30 second delay and for whatever

[0:05:55] Voice 5: elect few like applicants, et cetera, and sometimes staff to join us remotely. I think that's our next

[0:06:06] Voice 5: it requires some more staffing issues that haven't been resolved yet. So I think that's all I really

[0:06:15] Voice 5: need to say is by way of introduction, we have an agenda in front of us and I'll turn to the

[0:06:24] Voice 5: uh the trustees uh and ask if there's anything that you wish to add or amend the one suggestion

[0:06:31] Voice 5: from the planner was that we might move the tup renewal ahead of the

[0:06:37] Voice 5: main island housing society

[0:06:39] Voice 5: although i don't think the applicant is here but anyway in any case that it well it's going to be

[0:06:44] Voice 5: a relatively shorter matter if that's okay we can move

[0:06:46] Voice 16: uh

[0:06:47] Voice 5: so that would move 10.3 ahead of 10.2 and

[0:06:51] Voice 5: we'll do them in that order as opposed to uh any other if that's okay is there anything else

[0:07:08] Voice 5: as we get to the appropriate place on the agenda uh so if there's nothing else with that amendment

[0:07:22] Voice 5: is what we refer to as a town hall someplace we're starting to move into a different comment called

[0:07:29] Voice 5: a different name called community commentary period but this is the opportunity for

[0:07:33] Voice 5: members of the community to address the local trust committee on uh anything that's sort of

[0:07:40] Voice 5: in our in our our orbit our whether it be our work program or something specifically that's on

[0:07:46] Voice 5: our agenda uh for for us to consider uh and um we have a few expectations related to town hall

[0:07:55] Voice 5: and i will say that my experience main island has been um invariably civil in its discourse

[0:08:02] Voice 5: in the three and a half years i've been here during a bit more than half years i've been here

[0:08:06] Voice 5: um but we do expect you to please ask you to address the trustees um not each other and uh

[0:08:14] Voice 5: not staff if it's a question that would be uh appropriately directed to staff we'll i'll do

[0:08:21] Voice 5: that for you um please address issues and not people so we're interested in what your thoughts

[0:08:27] Voice 5: are on particular issues that we're working on and and that uh or that you'd like us to work on

[0:08:32] Voice 5: and please keep your commentary civil and appropriate um as i like to say speak as if

[0:08:39] Voice 5: your grandma so that your grandmother would be proud of you um uh and i haven't met your

[0:08:44] Voice 5: grandmother but in

[0:08:45] Voice 13: most cases that's a

[0:08:46] Voice 5: fairly good litmus test so uh and and anyway those are

[0:08:51] Voice 5: requests for you um and uh with that um i'm going to suggest can i just see a show how many people

[0:09:00] Voice 5: wish to speak i'm just trying to decide whether i need to have any kind of time limitations on this

[0:09:05] Voice 5: and by the way if you're an applicant um like i for example i know you you are here you don't

[0:09:11] Voice 5: need to speak in town hall you'll have an opportunity during your application to talk

[0:09:14] Voice 5: to us we'll give you that opportunity and the same with the housing society um and i know that

[0:09:19] Voice 5: if she arrives that your representative has a oh i

[0:10:09] Voice 10: and for transparency i am a former board member of the main island housing society but now i'm

[0:10:16] Voice 10: speaking on behalf of myself i'd like to take two minutes to discuss an item of public discourse

[0:10:22] Voice 10: course, which has not been brought up, I think, very much. There is no need to justify affordable

[0:10:29] Voice 10: housing on Main Island. Multiple studies and reports by Island Trust staff, the CRD, contracted

[0:10:35] Voice 10: experts, and empirical observation make this abundantly clear. We agree that there's a screaming

[0:10:43] Voice 10: need for rental housing. Hundreds of Main Island residents say so. Members of the LTC have said so.

[0:10:50] Voice 10: and then in addition there's a very small group of people who are opposed to the application

[0:10:57] Voice 10: they say that they support affordable housing but not next to them i will call them nimbus

[0:11:04] Voice 10: yeah let's

[0:11:05] Voice 10: really

[0:11:07] Voice 5: let's not do

[0:11:08] Voice 10: the names well that

[0:11:10] Voice 5: is a name

[0:11:13] Voice 5: okay that's that's a

[0:11:14] Voice 5: derogatory that's seen often

[0:11:16] Voice 5: in many places the derogatory term so let's let's

[0:11:19] Voice 5: try not to characterize other people as they said let's just be these people

[0:11:50] Voice 17: hall should be if you have questions about projects that are going on but if you've got

[0:11:53] Voice 17: a statement of support or non-support that would be more appropriate to our public when we get to

[0:11:58] Voice 17: public here am i wrong on that well i

[0:12:01] Voice 5: don't mind people giving their points of view we've heard

[0:12:04] Voice 5: lots of points of view about that from both people opposed and in favor of the of the project i just

[0:12:10] Voice 5: do i i do uh object to uh labeling people i think we need to have a civil discourse about uh about

[0:12:22] Voice 5: um and and i know the word nimby is loaded it's totally loaded uh and the people who are called

[0:12:30] Voice 5: that uh feel offended so i would rather we didn't develop evolve into a speech that is viewed as

[0:12:37] Voice 5: effective so so so frankly i'm totally aware and i'm i know my my co-trustees are totally aware of

[0:12:47] Voice 5: the the reasons why and the people that are opposed to the application uh they've been

[0:12:52] Voice 5: identified very clearly in the apc report uh that the people the neighbors and uh i don't think it

[0:12:59] Voice 5: helped it's helpful for us to have them labeled in any way so i i would ask you not to continue

[0:13:05] Voice 5: you if that's the essence of your of your of your submission very

[0:14:37] Voice 5: and we appointed the Board of Variants

[0:14:45] Voice 5: for Maine Island, Burt Hall, Chuck Zuckerman

[0:14:47] Voice 5: and Priscilla Zimmerman.

[0:15:05] Voice 5: they they the board of variance is a statutory body that isn't used very much

[0:15:12] Voice 5: but it basically is available for people who want to appeal the denial of a variance

[0:15:17] Voice 5: um from this body um and generally it tends to be the same people uh in on most of the southern

[0:15:26] Voice 5: gulf islands yeah we share one i know

[0:15:29] Voice 5: we share one in the northern gulf islands and i've only

[0:15:32] Voice 5: ever seen them utilized at least in the northern gulf islands but three times in my eight years

[0:15:37] Voice 5: so they're not off anyway they've been appointed we've appointed those three people

[0:15:42] Voice 5: um so we have the minutes of uh march the 28th uh and i would ask the uh trustees whether there's

[0:15:56] Voice 5: any changes to any of those minutes anything to amend then we'll adopt those as presented

[0:16:01] Voice 5: um we also have the minutes of the apc uh that are here from 6.3 apc there's another

[0:16:12] Voice 5: the that's from april the 11th that's at page 12 of the agenda um so my question we don't have that

[0:16:20] Voice 5: the minutes are relation to the fees bylaw but that's not on our agenda correct so and we don't

[0:16:27] Voice 5: have a specific report we just have a uh a minute of the meeting that's

[0:16:35] Voice 12: so if i can tell you this is basically the apc came back in the series of questions for staff

[0:16:40] Voice 12: they're waiting for those responses before they have another meeting to make the recommendations

[0:16:45] Voice 5: and i and i have to say having read the questions i would have said they were much more

[0:16:52] Voice 5: appropriately asked to political leaders rather than staff because the of course the fees bylaw

[0:17:00] Voice 5: was developed by the regional planning committee not by staff per se i don't know uh planner um

[0:17:09] Voice 5: Chadwick, I don't know what you've thought

[0:17:12] Voice 3: Well, I mean, these are not difficult

[0:17:19] Voice 3: Because we've had the discussions already around,

[0:17:29] Voice 3: around the violence.

[0:17:39] Voice 3: to answer those questions yeah yeah oh i think

[0:18:02] Voice 5: these uh we now have seven local trust communities that have adopted the fees bylaw in in total um

[0:18:09] Voice 5: and then there are a couple that are still working through a process of how to adopt them and one or

[0:18:15] Voice 5: two are very close um but uh there's the you but there are a couple that have not yet adopted but

[0:18:21] Voice 5: seven have adopted them with a couple of very minor variations um and i know that because i

[0:18:28] Voice 5: asked the question at the last ec meeting so we knew where we were standing um okay so that that's

[0:18:35] Voice 5: so we'll just take those minutes for for uh information and go from there follow-up action

[0:18:40] Voice 5: list we have is on page 15. are there any questions from trustees for your staff or anything that the

[0:18:46] Voice 5: staff would like to bring to our attention related to the follow-up action listen

[0:18:49] Voice 5: and higher job with nothing and nothing rather than the trustees

[0:18:54] Voice 16: yeah it's a lawsuit um

[0:18:57] Voice 5: so uh

[0:18:59] Voice 5: we don't have a delegation but we have a do have it we'll have a presentation related from the

[0:19:04] Voice 5: main island housing society uh and um uh that's not really a delegation it's in response to the

[0:19:12] Voice 5: staff reporter um and then we have some correspondence here so let's work our way

[0:19:17] Voice 5: through the correspondence the first is mostly for people's information uh with some correspondence

[0:19:23] Voice 5: that i received i'm not sure if other trustees received it as well regarding the opening of the

[0:19:28] Voice 5: new sydney spill response base uh there was an invitation to an opening uh which i couldn't make

[0:19:35] Voice 5: but i think did you tell me you went and visited it no

[0:19:37] Voice 17: i've driven by a million times and it's very

[0:19:40] Voice 17: impressive and they have lots of lots of goodies in there and it's closer to to where we're going

[0:19:45] Voice 17: going to need it so very impressive but no i didn't go um certainly lots of lots of material

[0:19:51] Voice 17: in there

[0:19:52] Voice 9: yes and

[0:19:53] Voice 17: and like i said eight response vessels are moored at the van isle marina so it's

[0:19:57] Voice 17: getting the the actual before everything was out of broad inlet correct if there was first spill

[0:20:03] Voice 17: response so or nanaimo or

[0:20:05] Voice 17: nanaimo so for this area this is wonderful we have definitely got a

[0:20:09] Voice 17: much higher level of response um

[0:20:13] Voice 5: right so anyway that's there mostly for information about what

[0:20:18] Voice 5: that it exists and uh i don't know if there's anything trustees wish to do about it i wasn't

[0:20:25] Voice 5: able to make it i i think someone one of the trustees maybe it was jane wolverton told me

[0:20:29] Voice 5: she went for a tour afterwards and i think they're quite open to people going there

[0:20:34] Voice 5: the next matter is a letter from minister lisa bear regarding the connectivity

[0:20:41] Voice 5: infrastructure issue a few months ago we were asked and we did write a letter to the minister

[0:20:51] Voice 5: asking for her support related to connectivity issues and this is the response and there's also

[0:20:58] Voice 5: a response to adam olson that's in our package as well setting out where they're at in terms of the

[0:21:04] Voice 5: connectivity questions your commentary well

[0:21:06] Voice 12: it was a nice response

[0:21:08] Voice 16: um

[0:21:09] Voice 12: i think what the minister

[0:21:11] Voice 12: does not understand is that the the foundation of what she's saying for main island was based

[0:21:21] Voice 12: on Shaw Cable. But Shaw doesn't reach so much of the island. For instance, Shaw Cable works for me

[0:21:27] Voice 12: because I'm a Shaw Cable customer and they go by my door. Presti Dodds, she's how many kilometers

[0:21:33] Voice 12: away from the line. So for her to infer that the connectivity of the fiber optic cable to Shaw

[0:21:42] Voice 12: means that Maine is totally connected. There's a disconnect there.

[0:21:47] Voice 5: so so it's it's just it's important to understand that what and i think whoever is on the uh i know

[0:21:54] Voice 5: you are on the is that what we're talking about here is is the connected coast landing spot on

[0:22:00] Voice 5: the island not connectivity to homes because you need that you need a local uh provider to do that

[0:22:06] Voice 5: and if shaw's not going to do it somebody else will come along and do it and i see there i know

[0:22:12] Voice 5: you're on the group that is working on this is i don't know whether there's a plan to set up an isp

[0:22:18] Voice 5: on the island or something like that that uh uh to a provider on the island but or whether or not

[0:22:24] Voice 5: you're going to be looking to existing providers to do this we'll

[0:22:27] Voice 14: be responding to this letter we

[0:22:29] Voice 14: got a similar letter through um adam olson i think from the minister as well but that is the

[0:22:36] Voice 14: disconnect and we've mapped out the island about where shaw actually provides service and where it

[0:22:41] Voice 14: It actually doesn't, and so we're going to pursue that.

[0:22:44] Voice 14: What the minister is saying, it will either be Shaw or City West,

[0:22:48] Voice 14: and my understanding is that if there's no landing site,

[0:22:52] Voice 14: there may not be City West.

[0:22:54] Voice 14: So we are pursuing that with the Connected Coast folks

[0:22:57] Voice 14: as well as the minister.

[0:23:01] Voice 14: There is a disconnect in that and an assumption that Shaw

[0:23:05] Voice 14: is providing better service throughout the island,

[0:23:09] Voice 14: and we um they've been consistently asked if they are going to and they say no

[0:23:17] Voice 14: so it's a it's a problem for us i think that we do have a we have a box

[0:23:24] Voice 14: i'm not i'm not i'm not a web expert but there is a box to connect what she speaks to from pander

[0:23:33] Voice 14: to the south near near the ocean down there there's a box and so she's saying that and i think that

[0:23:42] Voice 14: that box is capable of providing internet services through the landing sites that are happening

[0:23:50] Voice 14: through connected coast on pander so we understand that that's capable but the linkage from there the

[0:23:55] Voice 14: last mile connectivity is not addressed adequately in the letter that she's provided

[0:24:01] Voice 5: okay

[0:24:01] Voice 14: well

[0:24:02] Voice 5: she does invite us if the trust committee wants wants us to and we we wrote a

[0:24:07] Voice 5: letter of advocacy related to this um she does say my door is always open for questions um um i don't

[0:24:16] Voice 5: know if trustees feel that we need to follow up or just leave the internet group to do it or adam

[0:24:21] Voice 5: it looks like adam it's up

[0:24:23] Voice 5: to you guys and

[0:24:24] Voice 17: i think and adam's meets with the southern island trustees

[0:24:27] Voice 17: these on a regular basis so i think you know we can write another letter but i think adam

[0:24:31] Voice 17: is aware of what's going on yeah

[0:24:33] Voice 14: so we will copy you in on the letter that we provide

[0:26:40] Voice 17: plan more focused towards our fallow problem but we were informed quite late in the day that they

[0:26:47] Voice 17: didn't get the funding to do the plan i've always maintained that we're trying to deal with the

[0:26:52] Voice 17: fallow deer without a plan it's like me trying to build a house without a plan i don't think

[0:44:43] Voice 7: So at this point, as you know, the project's been moved out of abeyance a couple of months

[0:44:48] Voice 7: During the time, the last six months, we've done a substantial amount of work, much of

[0:44:54] Voice 7: which is in your hands, including the thing that I'm going to talk about right now, some

[0:44:57] Voice 7: technical reports of the commission.

[0:45:00] Voice 7: There was a well logging report done, so putting a depth monitor, a pressure monitor into the

[0:45:06] Voice 7: well.

[0:45:06] Voice 7: It was in the well from September 30th to February 17th, and the motion here is to try

[0:45:12] Voice 7: and determine how the well behaves while it's not in use.

[0:45:18] Voice 7: The water level over that period of time rose about three meters, which is what you'd expect

[0:45:22] Voice 7: from backflow recharge in the winter.

[0:45:25] Voice 7: There was no interference from the neighboring wells, so there was no cycling up and down

[0:45:29] Voice 7: at Christmas time or the weekends, times of high occupancy and high water use. There were minor

[0:45:35] Voice 7: five to ten centimeter effects daily from tides, so that should show us proximity to the ocean,

[0:45:46] Voice 7: and there were no significant effects seen from the major rain events in

[0:45:50] Voice 7: November. So there's no all same increases in water level, so it indicates that aquifer is

[0:45:59] Voice 7: is well detached from surface water flows

[0:46:01] Voice 7: and it is being recharged naturally.

[0:46:04] Voice 7: So that's good news because it confirms the evaluation

[0:46:10] Voice 7: of the well as I'm producing one.

[0:46:12] Voice 7: Very unlikely to be affected by saltwater intrusion

[0:46:15] Voice 7: and very unlikely to affect any water loss.

[0:46:20] Voice 7: We also commissioned a water management plan

[0:46:22] Voice 7: which the trustees and staff have seen

[0:46:24] Voice 7: but it wasn't attached to the staff report

[0:46:29] Voice 7: for this meeting because it's under review but I just wanted to go over a little bit of what is in

[0:46:34] Voice 7: that because it's an important document for a lot of reasons. One of the things it does is deal with

[0:46:40] Voice 7: potable water usage, how much is needed, how it will be stored, how it will be treated and what

[0:46:48] Voice 7: are the monitoring requirements going on from now on but there is definitely an adequate supply of

[0:46:55] Voice 7: water the usage might vary from five to seven thousand meters a day but there's

[0:47:00] Voice 7: more than

[0:47:00] Voice 7: adequate supply and relatively straightforward plan to treat that water

[0:47:05] Voice 7: we also added in this report a significant section on storm water management

[0:47:12] Voice 7: you know that's a concern particularly for the neighbors of north this is a um is a wet site

[0:47:19] Voice 7: site and it's on the slope of the bottom of a steep mountain. So this is just a three

[0:47:25] Voice 7: acre site. It doesn't have a huge impact on the rest of the world, but uphill there's

[0:47:30] Voice 7: 20 to 30 acres of steep mountain slope that is bringing down towards Village Bay essentially.

[0:47:37] Voice 7: There's two culverts running underneath Village Bay Road, one to the east and one to the west

[0:47:43] Voice 7: of this property where this development is going on,

[0:47:46] Voice 7: both of those in high water

[0:47:48] Voice 7: discharge substantial amounts of water.

[0:47:51] Voice 7: That water flows adjacent to the parcel

[0:47:54] Voice 7: that the housing society is going to be using

[0:47:56] Voice 7: and ultimately across the bottom portion

[0:47:59] Voice 7: through the wetland,

[0:48:01] Voice 7: which is a subject of our wetland remediation plan.

[0:48:05] Voice 7: So the engineering analysis of the surface water situation

[0:48:12] Voice 7: which included an examination of the permeability of the soil

[0:48:18] Voice 7: and an estimate of the impact of development on water retention on the property.

[0:48:26] Voice 7: And they walked through the methodology that's used in an engineering sense

[0:48:32] Voice 7: to figure out what impact the development might have on surface water flows.

[0:48:37] Voice 7: They concluded that about 6,000, 6.7 cubic meters, 6,000 liters of water would need to be

[0:48:46] Voice 7: required, would need to be stored to accommodate a surge event according to the

[0:48:54] Voice 7: difference in the absorption of the water of the site because of the new development.

[0:49:01] Voice 7: It should be noted that that's about a hundredth of the area or the volume of the two retention

[0:49:07] Voice 7: But in addition, by this, there would be a surge capacity tied in to the rainwater from

[0:49:13] Voice 7: the water management system, so there would be the capability to store and then slowly

[0:49:18] Voice 7: release a surge of a stormwater that's required under the ... I'm not sure how clear that

[0:49:28] Voice 7: is without having the document in front of you, given that it's not yet available on

[0:49:33] Voice 7: on the Island Trust website.

[0:49:35] Voice 7: We will put it on our own website

[0:49:37] Voice 7: so people can have a look at it and see what's in there.

[0:49:41] Voice 7: They do make the point that the obligation of a development

[0:49:44] Voice 7: is to essentially not make things worse.

[0:49:48] Voice 7: They need to take care that nothing that is done

[0:49:51] Voice 7: on the site is going to make stormwater surges

[0:49:55] Voice 7: worse than they were before.

[0:49:58] Voice 7: However, given our remediation plan,

[0:50:00] Voice 7: wetlands plan, the decompaction,

[0:50:02] Voice 7: and additional we expect to substantially slow the flow of water across the land and there should be

[0:50:09] Voice 7: a net benefit for anybody downstream which is above and beyond what is typically required

[0:50:14] Voice 7: we're happy to consult with neighbors if you have questions about that and would like to have

[0:51:04] Voice 7: And that you can see on the drawing is just the fashion of that report.

[0:51:11] Voice 7: It shows the driveway coming in from the western corner of the lot and traversing towards the development.

[0:51:19] Voice 7: Instead of having a loop-wise driveway around the veteran tree at the center of this development,

[0:51:25] Voice 7: essentially a Y-shaped turnaround area.

[0:51:27] Voice 7: So a large firetruck moving the vehicle back into one of those Ys

[0:51:33] Voice 7: and then drive out so we've gotten away from the requirement of having a full loop around the tree

[0:51:41] Voice 7: so that'll keep traffic completely out of the subject and it also would mean that any

[0:51:46] Voice 7: headlights for people coming are not going to be directed onto the neighboring property

[0:51:51] Voice 7: so i think this is a more neighbor friendly version of the of the layout the exact location

[0:51:57] Voice 7: parking spots on this will be resolved during detail design

[0:52:02] Voice 7: i wouldn't spend too much time considering whether they're exactly at 90 degrees where they might be

[0:52:08] Voice 7: shifted but they'll be outside the three projection zone which is the ring you can see around the

[0:52:13] Voice 7: large tree and they'll be generally in fairly close to the places where they're indicated right

[0:52:20] Voice 7: now so i'm happy to take any questions okay

[0:52:28] Voice 17: it because why are we having so many parking places when we're going to be on the new CRD

[0:53:50] Voice 11: It's nice to be in the community and see faces in person.

[0:53:54] Voice 11: So I won't get too into detail about the housing agreement and the covenant that was covered in the staff report, and I have yet to go to a legal review.

[0:54:02] Voice 11: But I just want to clarify a few things that, from

[0:54:05] Voice 1: the Rhode Island

[0:54:06] Voice 11: Housing Society perspective, that perhaps weren't covered in the staff report.

[0:54:09] Voice 11: and I did also want to just cover a quick clarification based on my last presentation

[0:54:15] Voice 11: which I believe was two months ago via zoom about the new funding structure that we were working on

[0:54:20] Voice 11: and sort of the funding context for housing right now and I just wanted to be clear because I'm not

[0:54:27] Voice 11: sure if it was fully understood based actually on a name liner this month by the LTC it described

[0:54:36] Voice 11: to main island is not as a housing society not being successful at achieving pc housing funding

[0:54:41] Voice 11: but actually the society has not applied for that funding to date at the time of the last call

[0:54:47] Voice 11: because rezoning was not achieved um why the projects who i work with um we advise them not

[0:54:52] Voice 11: to apply um because to be competitive for those funding calls having the land secured and the

[0:54:57] Voice 11: rezoning in place is really important um but that being said um the society has been successful in

[0:55:03] Voice 11: a range of redevelopment funding opportunities through chc through the federation of canadian

[0:55:08] Voice 11: municipalities and several partnerships including one with gigards on galliano island through the

[0:55:14] Voice 11: community housing transformation fund to build capacity in the sector um so on the uh the next

[0:55:23] Voice 11: page of the presentation which is a flow chart um i just wanted to clarify uh the timing of the

[0:55:29] Voice 11: housing agreement um i i hope that everyone uh has an understanding of the affordability

[0:55:36] Voice 11: especially that we're proposing that would be included in the housing agreement um but because

[0:55:41] Voice 11: of the unique situation here where a third party is donating the land to the society and that third

[0:55:46] Voice 11: party um we prefer for them not to sign the housing agreement we've proposed um sort of a timing and

[0:55:52] Voice 11: a structure so that they don't have to sign the housing agreement but the housing agreement would

[0:55:57] Voice 11: be finalized and attached to the covenant prior to bylaw adoption. So in that flowchart during

[0:56:04] Voice 11: this process that we're in right now we work on the housing agreement and have something finalized

[0:56:09] Voice 11: prior to going to public hearing. I think that's my understanding of the preference of the process

[0:56:14] Voice 11: so that the public can see the housing agreement see what's included and comment on it.

[0:56:19] Voice 11: Assuming all things go well the housing agreement would be attached to the section 219 covenant

[0:56:24] Voice 11: and there would be a clause on there saying something like the housing agreement must be

[0:56:28] Voice 11: signed before any development occurs on the site after subdivision this would continue through the

[0:56:36] Voice 11: process which includes the referral to the executive committee and to the minister's office

[0:56:39] Voice 11: if all goes well then the covenant and any legal instruments so in this case the covenant only

[0:56:45] Voice 11: would be registered on title so the housing agreement would be in a final form attached to

[0:56:50] Voice 11: the covenant but not signed um at that time there would be a bylaw adoption and the society could

[0:56:56] Voice 11: proceed with the subdivision process which is through the ministry of transportation and

[0:56:59] Voice 11: infrastructure with a different jurisdiction if that was all successful and the property was

[0:57:06] Voice 11: divided at that time that's when the housing society would actually take possession of the land

[0:57:10] Voice 11: and at that time they would sign the housing agreement and that would be registered on title

[0:57:14] Voice 11: So there would be no changes to the housing agreement after, basically after third reading or whatever comes out of third reading in the public hearing.

[0:57:24] Voice 11: It would all be finalized, but just not fully signed and adopted until subdivision and possession is given to the society.

[0:57:32] Voice 11: And our hope and our understanding of what we propose is that it wouldn't actually delay bylaw adoption.

[0:57:38] Voice 11: how we propose that we hope that the bylaws for the rezoning could be adopted and the other

[0:57:45] Voice 11: agreement the covenant could be registered on title um it's basically all finalized but it

[0:57:51] Voice 11: just avoids that third party having to sign on um the other thing that i wanted to touch on um

[0:57:57] Voice 11: that uh was referenced in the society letter um with the covenant is that there has unfortunately

[0:58:05] Voice 11: been a slight change of circumstances with the third party donating the land a change in

[0:58:10] Voice 11: circumstances in health and family are taking over management of the estate and currently what's been

[0:58:18] Voice 11: proposed is a clause in the covenant that the second lot that's to be created lot two which

[0:58:26] Voice 11: would remain in the possession of the third party who's donating the land cannot be developed until

[0:58:30] Voice 11: until the housing, the affordable housing on lot three is completed, constructed and occupied.

[0:58:37] Voice 11: Because of some of the uncertainty around the family situation, they've requested that we request to the LTC to have some kind of sunset clause on this.

[0:58:46] Voice 11: Because once they donate the land, once that subdivision is complete, they have no control and no influence over the housing that's going to be built.

[0:58:55] Voice 11: They've contributed their amenity, which is the land, which is zoned for the housing.

[0:59:01] Voice 11: And then it's beyond their control what happens after that.

[0:59:04] Voice 11: So we've included in our latest draft of the covenant, which we provided to staff and LDC,

[0:59:11] Voice 11: that there would be a five-year sunset clause where if circumstances arise that the property

[0:59:16] Voice 11: lot three was not able to be developed in that time, that that restriction would drop

[0:59:22] Voice 11: and the family would be able to develop on lot two.

[0:59:27] Voice 11: and so i just wanted to really clarify that that request came from um the powers of attorney for

[0:59:33] Voice 11: the current landowner um we're open to discussion um we'd like to hear the trustee's thoughts on

[0:59:40] Voice 11: that if they're open to it um and we also want to stress that um any decisions moving forward

[0:59:46] Voice 11: we have to confer with those powers of attorney um and so we ask that there would be no no final

[0:59:53] Voice 11: decisions made today but a discussion would be useful for our purposes so that we can go back to

[0:59:58] Voice 11: the attorneys and decide what

[1:00:00] Voice 11: next steps are based on what we hear from you today so those are the the things that i wanted

[1:00:05] Voice 11: to clarify i'm happy to answer questions about those as well but i did just want to close by

[1:00:10] Voice 11: reminding everybody that the purpose of this project is to provide affordable housing for

[1:00:15] Voice 11: folks on main island as we all know the housing crisis will reach new peaks

[1:00:20] Voice 11: in all communities

[1:00:21] Voice 11: across this need and the faster this project can be approved on the rezoning front the more the

[1:00:29] Voice 11: the stronger the applications will be to funders such as CMHC and BC Housing.

[1:00:34] Voice 11: In the time this main island housing society is formed,

[1:00:38] Voice 11: they have a waiting list with at least 29 households that would be eligible for just 10 units

[1:00:43] Voice 11: that they are desiring to provide.

[1:00:46] Voice 11: And since the start of the pandemic,

[1:00:49] Voice 11: we're aware that several households have actually left the island

[1:00:52] Voice 11: because they haven't been able to find suitable housing

[1:00:54] Voice 11: and others are living in substandard housing that don't fit their needs.

[1:00:58] Voice 11: so i just want to bring it back to that core goal of what this project is trying to do which is

[1:01:03] Voice 11: to provide housing for members of the community so thank you and i'm happy to answer any questions

[1:01:11] Voice 5: trustees i have some questions but do you want to hear from the planner first or you want to

[1:01:16] Voice 5: um i

[1:01:19] Voice 17: think probably from the planner so and

[1:01:21] Voice 5: then i do have

[1:01:23] Voice 5: and perhaps for the planner but go ahead uh planner chat if you want to present your staff

[1:01:30] Voice 3: already yeah well I mean I think a number of things are covered so I'm

[1:01:34] Voice 3: um if there are specific things you'd like to provide some clarity on um or

[1:01:42] Voice 5: well I'll ask a few questions of clarity I just want to be clear what we're looking at here

[1:01:47] Voice 5: is um I think the draft of the of the so right now the staff has provided us with a draft housing

[1:01:56] Voice 5: agreement and a draft covenant and um one of the things that the when you get the combined

[1:02:04] Voice 5: draft housing agreement covenant from the from the applicant that's their proposal but that's

[1:02:10] Voice 5: because they want to include the um uh the provision of the uh of of the owner of the

[1:02:18] Voice 5: property not being included on the on the property is that is that the title on the

[1:02:23] Voice 5: on the agreement

[1:02:23] Voice 5: is that effectively the way

[1:02:25] Voice 5: that works i got confused as

[1:02:26] Voice 3: i was reading it it's all a bit

[1:02:28] Voice 3: confused a lot in this uh um so the the the october uh staff report provided the uh presented the the

[1:02:38] Voice 3: draft housing agreement and the draft covenant that as drafted by um our lawyer and there was

[1:02:44] Voice 3: some discussions back and forth with the uh with the um uh the housing society at that point in

[1:02:52] Voice 3: time um the previous staff report indicated some of their concerns and um um and uh there had been

[1:03:00] Voice 3: some discussion with the with legal counsel around some of their concerns and some um some

[1:03:05] Voice 3: options have been identified um and the housing society has pursued those options on two accounts

[1:03:13] Voice 3: And so what's provided in the current staff report is the drafts that they have had developed that have addressed a few things.

[1:03:26] Voice 3: So on the housing agreement, it's addressed the proposed removal of Sean Q's family name on the housing agreement.

[1:03:39] Voice 3: and that is also and that's reflected in the in the covenant that's also been provided by the

[1:03:44] Voice 3: housing society um they've also introduced a another approach to defining the um the rental

[1:03:53] Voice 3: structure which was also a few options were identified in the previous staff report in turn

[1:03:59] Voice 3: to address their concern about what was in the previous housing um uh housing agreement so they

[1:04:07] Voice 3: they have presented us with a new structure.

[1:04:09] Voice 3: So that's another sort of key thing

[1:04:11] Voice 3: in the housing agreement that was presented

[1:04:15] Voice 3: in this package which has come directly

[1:04:18] Voice 3: from the Main Island Housing Society.

[1:04:21] Voice 3: And then on the covenant side of things,

[1:04:27] Voice 3: the main changes there are,

[1:04:31] Voice 3: as indicated by Eleni,

[1:04:34] Voice 3: are the uh the clause which would essentially add the housing agreement to the government covenant

[1:04:39] Voice 3: so that's a process that we need to discuss that the ltc would need to discuss and decide

[1:04:44] Voice 3: how they like to proceed there if they if they want to support that direction or if they'd like

[1:04:49] Voice 3: to go support the direction that was previously um previously supported by staff um and the the

[1:04:58] Voice 3: other the other key piece on um on that covenant is uh is as when he had pointed out um the the

[1:05:07] Voice 3: placing a time limit on basically the the the freezing of development on lot two um so as they

[1:05:16] Voice 3: propose um if if uh if there's no development on on the land that's being zoned for affordable

[1:05:26] Voice 3: more housing than their uh their coverage is uh identifying that that lots you can then proceed

[1:05:34] Voice 3: to be built on um there are i would also identify in both of the in both the housing agreement and

[1:05:42] Voice 3: the covenant that were provided to us by the housing society there are a number of other

[1:05:46] Voice 3: uh changes that have been made and they've all been noted on the drafts that you were

[1:05:51] Voice 3: were provided with and noted in the staff report um i i've highlighted the key pieces that i think

[1:05:57] Voice 3: we need some clear decision making on and it would be my and if there are if there are other

[1:06:04] Voice 3: items in the in those those other areas that uh jump out to um just at this point um suggest you

[1:06:12] Voice 3: identify them other otherwise um you know following this conversation uh to legal counsel

[1:06:19] Voice 3: whenever we arrive including you know those cases that that were

[1:06:25] Voice 17: but

[1:06:26] Voice 16: i

[1:06:30] Voice 5: have two technical type questions i wanted to ask before i turn to the trustees

[1:06:35] Voice 5: for those i'm sorry to sort of take them because it might be helpful first of all do we have any

[1:06:39] Voice 5: formal um notification that the housing society can speak on behalf of the landowner and their

[1:06:50] Voice 5: well people will have the power of attorney we

[1:06:52] Voice 16: do yeah we do yeah okay

[1:06:53] Voice 5: because there was some

[1:06:54] Voice 5: confusion about that about a year ago yeah um and i wanted to be sure that we we had that formally

[1:07:00] Voice 5: that they are at edom so and i'm not i'm not discounting what we're being told i just want

[1:07:08] Voice 5: to make sure we have that one second thing is is the some of the changes to the um am i correct

[1:07:15] Voice 5: that some of the changes neither the changes to the housing agreement nor the the section 219

[1:07:20] Voice 5: covenant have been sent through our lawyers the

[1:07:23] Voice 3: trust lawyers they have not yet so um like from a

[1:07:27] Voice 3: you know uh efficiency uh point of view um i think uh uh it's important for trustees to to decide um

[1:07:36] Voice 3: what they're willing to support from those before we move it through legal counsel

[1:07:42] Voice 5: i've sort of taken questions from trustees i

[1:07:50] Voice 17: but i do think the whole point of this process is to actually get built housing and because

[1:07:56] Voice 17: the donor of the land um only wants wants us to limit their responsibility for five years

[1:08:04] Voice 17: but if the housing never gets built the owner of the land the family um will benefit from that

[1:08:12] Voice 17: third lot that they're getting and we may have no way of ensuring that we end up with the benefit

[1:08:19] Voice 17: of the housing like to me that it's time it's the two have to go together and uh i so i i i don't i

[1:08:28] Voice 17: don't agree with that i don't think that i think the community if in five years um saw that the

[1:08:34] Voice 17: land was still sitting and developed but meanwhile there was two parcels for sale that the owner

[1:08:39] Voice 17: benefited from i can't agree to that change and then my other concern sort of tied into all of

[1:08:47] Voice 17: that is like long term what happens because we already have properties zoned for high density

[1:08:54] Voice 17: city not not affordable housing but high density senior senior friendly that have never been

[1:09:00] Voice 17: developed so what happens at the end of this process if housing like is there ever a timeline

[1:09:07] Voice 17: or is there a backup plan for main island housing if they somewhere down the lane they just they

[1:09:14] Voice 17: can't get the funding or they can't proceed with the project concerns me that 5 10 15 years from

[1:09:20] Voice 17: now everybody's sitting in limbo so is there a way to come to an agreement too as to what the

[1:09:26] Voice 17: time frame would be on that to me that should be in here somewhere um great enthusiasm and all of

[1:09:32] Voice 17: that but i i kind of uh would like to know before i have to make a decision down the road here

[1:09:38] Voice 17: just what the backup plan is so a backup plan of some kind of time frame but also the expectation

[1:09:44] Voice 17: that the housing definitely is tied to a lot different if the McHugh family had said here

[1:09:49] Voice 17: take that half and I'll keep my half but they haven't they've asked for a lot and a lot is

[1:09:54] Voice 17: worth a lot of money in today's market so it's not really a question I think I understand most

[1:10:02] Voice 17: but

[1:10:02] Voice 12: I can follow up on that it's basically speaking like I think to to satisfy what

[1:10:09] Voice 12: of trustee dodge to say is that a sunset clause on block two which is the additional lot that

[1:10:15] Voice 12: the family is getting is tied to a sunset clause on lot three saying so if in five years time

[1:10:23] Voice 12: it's not developed for housing then if they want a sunset cause in their lot then there's a reversion

[1:10:29] Voice 12: back so it if it's not used for housing it could go down trust and servicing or something

[1:10:35] Voice 12: um there has to be a community that lock two is being granted to the family for an amenity

[1:10:44] Voice 12: to the community so if if amenity a can't be constructed within five years well then it's

[1:10:50] Voice 12: gonna have to be amenity and then you have the right to develop a lot number two because

[1:10:57] Voice 12: they're conjoined and so if the family wants this five-year timeline there has to be a like they

[1:11:04] Voice 12: have to you're uniquely tied um so that's something about if somehow that all has to

[1:11:13] Voice 12: jive together yeah

[1:11:14] Voice 17: so however the lawyers could put together a proposal but i think they expressed

[1:11:20] Voice 17: as well i don't know about the dates or the actual number of the time but i do think the two have to

[1:11:51] Voice 12: um my other sort of interesting concern was um based on some observation of trustee dodds

[1:11:59] Voice 12: last year of the perk holes on the property where they were full of water in September.

[1:12:07] Voice 12: So I look at these retention ponds, which have moved and seem to have gotten smaller.

[1:12:15] Voice 12: If the perk holes were full in September, and this is a water expert, I don't expect anybody

[1:12:21] Voice 12: to answer this, but if they were full in September, why wouldn't these water retention ponds,

[1:12:26] Voice 12: i.e. the surge capacity, also be full?

[1:12:30] Voice 12: so like surge capacity means something lower and then you get the surge or something and it

[1:12:35] Voice 12: has the capability but if the surface water is right at the surface then are these retention

[1:12:42] Voice 12: pods not going to be full i.e there's no search capacity i think that's a question for the

[1:12:48] Voice 13: applicant they

[1:12:49] Voice 16: should have an opportunity yeah we have the

[1:12:53] Voice 7: stormwater design we've gotten an email

[1:12:55] Voice 7: short-term search capacity so you can have a situation as we did last fall where the land

[1:13:05] Voice 7: is essentially it is it is in that case not as the as it exists right now that plan is not doing

[1:13:14] Voice 7: anything for the neighbors to the north. It's basically to be a parking lot. But if you start

[1:13:22] Voice 7: putting micro-topographies in ponds, those ponds fill up and drain. So if it's been raining for

[1:13:30] Voice 7: the last two weeks and there's a cessation in the rain, it drains. Any time it's drained,

[1:13:37] Voice 7: you have search capacity created by that topography, by those ponds. Which specifically

[1:13:42] Voice 7: specifically with the rainwater that's in the roof of the buildings,

[1:13:46] Voice 7: it would go into a retention area.

[1:13:48] Voice 7: That retention area would drain slowly over the next time.

[1:13:51] Voice 7: The next surge of rain that comes along fills it back up.

[1:13:55] Voice 7: So you have this damping capacity.

[1:13:58] Voice 7: When everything is full, it's true.

[1:14:00] Voice 7: Everything is full.

[1:14:01] Voice 7: That's the way it is right now.

[1:14:04] Voice 7: The design goal

[1:14:05] Voice 7: in a development does not make it worse.

[1:14:33] Voice 7: the bottom third of that block the bottom half of that block there will be actually an update

[1:14:38] Voice 7: capacity that's going to be built by virtue of the regeneration of that so over the long term this

[1:14:46] Voice 7: development with the remediation plan will make this more resilient to storm water than it is today

[1:14:54] Voice 17: questions for following up on that so like during the construction phase so would the remediation

[1:15:00] Voice 17: happen before your construction like thinking of it i'm thinking of anson road and so we all

[1:15:05] Voice 17: know what happens with massive and also does the water study which i somehow missed and haven't

[1:15:11] Voice 17: read because it takes into account the amount of water coming out of the well and going through the

[1:15:15] Voice 17: toilets so

[1:15:16] Voice 13: that's additional water because we're talking about that

[1:15:18] Voice 13: that's part of the

[1:15:19] Voice 17: part of it

[1:15:20] Voice 13: okay

[1:15:20] Voice 17: so but what is the plan during construction um

[1:15:25] Voice 7: the staging of the construction the wetland

[1:15:28] Voice 7: mediation is going to be done while the equipment is on the site so fundamentally it's going to be

[1:15:32] Voice 7: occurring around the time where construction footings are being dug and the major site works

[1:15:38] Voice 7: are being prepared what the engineers propose is that there's strong wattle dams and straw barriers

[1:15:44] Voice 7: there are well-accepted engineering solutions to make sure that i guess

[1:15:48] Voice 17: i just have to ask

[1:15:49] Voice 17: the what if it doesn't work is there like in terms of insurance like like if we're telling

[1:15:54] Voice 17: you know if there was a major overflow because i'm going back to anson road and it was engineered

[1:15:59] Voice 17: and obviously not well engineered.

[1:16:01] Voice 17: And now it's all fixed.

[1:16:03] Voice 17: So is there any sort of liability insurance?

[1:16:07] Voice 17: I mean, it all sounds good.

[1:16:09] Voice 7: But I have-

[1:16:10] Voice 7: I think the level of detail

[1:17:32] Voice 5: so you know there are ways you can flow slow the water down so that's

[1:17:37] Voice 5: one of the things that i think about about how you address the issue that trustee maude brought up

[1:17:42] Voice 5: which is if everything's full and but i think the reality is i think thank you for your honesty

[1:17:47] Voice 5: if everything's full everything's full um and uh what do you do then like we're all faced with that

[1:17:54] Voice 5: when we have those big water events uh such as november yes uh when a lake recreated itself out

[1:19:14] Voice 5: second lot would be eventually sold and don't money donated but now there's a clear that the

[1:19:20] Voice 5: idea is the second lot would become the owners of the current landowner and that's the that's

[1:19:26] Voice 5: the proposal um and reserve got two things going on here that you know there's possibility

[1:19:34] Voice 5: possibility the amenity might be a third lot that's zoned for affordable housing

[1:19:42] Voice 5: but i know you guys have a history of things not getting built uh the other amenity and what i'm

[1:19:48] Voice 5: hearing from if that's not built then there might be some some other amenity that would be more

[1:19:55] Voice 5: appropriate for that um and i don't know how you do that and do you have any thoughts around do

[1:20:01] Voice 5: understand that i think you understand the issue yeah yeah if

[1:20:04] Voice 5: there's going to be a second lot

[1:20:48] Voice 3: clearly different so um and so what i'm hearing is that the trustees uh from the trustee's point

[1:20:57] Voice 3: of view the housing is the amenity and if the housing isn't built then what is the amenity

[1:21:04] Voice 3: after that if the zoning is not the amenity then could the amenity be conservation right so

[1:21:16] Voice 3: that I think that how that would how that would happen is definitely something that

[1:21:23] Voice 3: we would have to ask the lawyer um because i think it you know it may be it may be easy

[1:21:29] Voice 3: it may be complicated but um but that's certainly um something that we can um we can we can ask and

[1:21:35] Voice 3: and uh but but you're but i'm i'm understanding what the interest is so we can we can explore

[1:21:41] Voice 3: that what the tool would be to um to address that okay

[1:21:47] Voice 5: to turn the applicant and see if they have any commentary related to that yeah

[1:22:07] Voice 11: will be able to be built there is affordable housing it's really tightly controlled and so

[1:22:12] Voice 11: if for some reason the housing is not able to be developed that land is just going to sit there

[1:22:17] Voice 11: as forest land and land is a scarce resource especially on the island and the challenge of

[1:22:26] Voice 11: finding land that you can build affordable housing on is challenging rezoning is challenging

[1:22:31] Voice 11: so let's just say worst case scenario main island is not able to build in the next five years

[1:22:37] Voice 11: there might be another organization that can come in and construct that in a longer time frame

[1:22:42] Voice 11: I don't think that there's necessarily a harm in having that land sit undeveloped until the

[1:22:47] Voice 11: circumstances are right that somebody can come in and develop it and as you can see it's a long

[1:22:53] Voice 11: process to rezone land there's a lot of risk and there's a lot of money involved so again just

[1:22:58] Voice 11: having land that's already zoned and ready to go is a huge asset whether it's to main island

[1:23:03] Voice 11: housing society or to another organization with a mandate to build housing without that zoning in

[1:23:10] Voice 11: place um the the reality of having a portable housing gets pushed a lot farther down the line

[1:23:16] Voice 11: because another site would have to be resolved yeah

[1:23:20] Voice 17: and i'm thinking of a longer time frame too

[1:23:23] Voice 17: i'm not thinking of five years because i know that this whole process is going to be a much

[1:23:28] Voice 17: longer process before you actually can get shovels in the ground but it's still always in the back

[1:23:33] Voice 17: certainly in my mind in terms of what the what-ifs and and i think we need to know the what-ifs and

[1:23:39] Voice 17: what possible backups it would be to go back to the community and say that we're already jumping

[1:23:46] Voice 17: into the you know first reading rezoning process but um to be able to say you know if at the end

[1:23:52] Voice 17: of the day um the local trust committee can choose of course to down zone at any time but also the

[1:23:59] Voice 17: community does need to know that it's at least being considered the what if so i think we have

[1:24:04] Voice 17: an obligation to do that but i hear what you're saying for sure and we should we should get a

[1:24:10] Voice 17: legal opinion or part of the like that because it's it's ties up that lot too as well so that's

[1:24:16] Voice 17: the other side of it i mean we see i see the housing as the amenity the housing five ten

[1:24:23] Voice 17: years from now is not built that leaves lot two in limbo two for the owners of that property so

[1:24:28] Voice 17: So it's a bit of a mix one way or the other.

[1:25:15] Voice 14: we would like to maintain that for the community and not have it transferred into parkland

[1:25:33] Voice 14: and and i think really we're talking black and white here i think really the situation is that

[1:25:40] Voice 14: perhaps in five years if there's no occupancy permit which is how it's stated in the covenant

[1:25:46] Voice 14: it right now um and it may be that we're just talking about a gray area where the building

[1:25:55] Voice 14: is going on but it's not yet at occupancy and that also needs to be considered yeah

[1:26:02] Voice 5: got to that point the reality is you'd come to the local trust committee and

[1:26:57] Voice 7: time when there's been a higher level of attention at all levels of government doesn't need for

[1:27:01] Voice 7: affordable housing if this plan can get to the point where it's going it stands a very good

[1:27:07] Voice 7: chance of attracting funding to put house upon it without this so as we're balancing all the

[1:27:15] Voice 7: risks up here what could or might not happen by the same year i think you also have to weigh the

[1:27:21] Voice 7: risk of it not happening at all because of the overhead involving all of the discussions in the

[1:27:26] Voice 7: back in the forest and then maybe this and then maybe that that it may be time just to move forward

[1:27:31] Voice 7: as a community take some risk for the potential benefit of having this done

[1:27:39] Voice 7: we can't tie ourselves up on on the the small details of what might happen that's not exactly

[1:27:45] Voice 7: right when there's something there to be grasped which is a vision of something that could happen

[1:27:51] Voice 7: and if we all put our focus and we want to make it happen yeah

[1:29:06] Voice 5: do that um are we prepared to agree that that's an appropriate thing to do um and i think what

[1:29:12] Voice 5: you're hearing is is if the original proposal was i'll give you three and a half acres for a park

[1:29:18] Voice 5: a conservation zone we'd be having one conversation um and but we're having a conversation

[1:29:25] Voice 5: about i'll give you a third of my property for housing development and

[1:29:30] Voice 5: you're saying effectively this will be if we zone it appropriately it'll be there and available

[1:29:36] Voice 5: available for when the right opportunity arises whether it's you or somebody else

[1:30:19] Voice 5: on the house agreement he'll come they're on the house it'll come off they'll come off when the

[1:30:23] Voice 5: subdivision occurs there's no obligation on it and i hear the applicant saying well we'll just

[1:30:29] Voice 5: added as a we don't really don't want that and i'd like to really understand what the

[1:30:34] Voice 5: from your perspective from our perspective or the planning it's like why it's a problem to do it the

[1:30:40] Voice 5: way the applicant wants and i like to hear from the applicant as to why it's a problem to do it

[1:30:45] Voice 5: the way that you want to do it because i think we have to give you some direction around that right

[1:30:50] Voice 3: right yeah yeah there needs to be some direction around that so um um we had previously

[1:30:55] Voice 3: previously brought this up with um with a lawyer um and that's that's where it was

[1:31:00] Voice 3: made quite clear to us that really they're having the uh the current so you you have to have the

[1:31:08] Voice 3: property owners on a housing agreement that's the starting point having uh the existing property

[1:31:14] Voice 3: owners on the housing um agreement does not in this case doesn't bind them to do

[1:31:24] Voice 3: it's really about the management of the actual built housing so there's no legal obligation

[1:31:45] Voice 3: um i did discuss this with uh with the regional planning manager uh kajima

[1:31:51] Voice 3: so in terms of process i mean you essentially have to go through uh an adoption process when

[1:31:59] Voice 3: you get to that point where where the uh the housing agreement is ready to be adopted so

[1:32:05] Voice 3: that's a full process which opens the housing agreement up to potentially potential debate and

[1:32:11] Voice 3: change and and so forth so it it can potentially it could potentially hold up the process um and

[1:32:19] Voice 3: it could potentially um it potentially opens up um there would be a lack of um of uh of

[1:32:30] Voice 3: um certainty both for the ltc as as well as the housing society so it just sort of opens it up

[1:32:38] Voice 3: for that for that additional process which could which could turn into something or or maybe it

[1:32:45] Voice 3: doesn't that's not something that we know because we don't you know we don't know who who would be

[1:39:38] Voice 12: said we have in in our documentation all about water management i want to see that level of

[1:39:44] Voice 12: information and undertaking going forward for wastewater so the level of undertaking

[1:39:54] Voice 7: this is a preliminary design we don't have the window for reading right now i don't think the

[1:40:00] Voice 7: level of engineering and extra expense that you're asking for is appropriate but i guess

[1:40:05] Voice 7: we're we were providing more than we've asked with respect to water and in particular responding to

[1:40:14] Voice 7: the concerns from the rainwater that they experienced the last fall so we've gone above

[1:40:19] Voice 7: and beyond what would normally be needed at this stage in the proposal there's a lot of

[2:48:46] Voice 5: process of reconsidering the trust policy statement uh not without some controversy

[2:50:29] Voice 5: of the way we operate in any in any case and and uh generically the idea is to have two virtual

[2:50:37] Voice 5: trust councils a year or two in person um so that that's june 21st 22nd 23rd there's always

[2:50:44] Voice 5: an opportunity for people to come and speak uh to trust council on the tuesday night there'll be a

[2:50:49] Voice 5: town hall of trust council um and there'll also be discussion there about uh implementation of the

[2:50:57] Voice 5: the steps related to the governance report that came out and there's lots of other things going

[2:51:03] Voice 5: on at the trust including a report on a couple of things when we get to the conservancy report

[2:51:40] Voice 12: they're getting less fearful of people.

[2:51:42] Voice 12: So they're coming out of every sort of crack and crevice.

[2:51:45] Voice 12: So that's sort of been a bit of a pain.

[2:51:48] Voice 12: The only other thing that's been happening with me quite a bit,

[2:51:50] Voice 12: and trying to explain to people with processes, are bylaw complaints.

[2:51:56] Voice 12: is people seem to think the trustees are the one-stop shop for resolving by-law issues.

[2:52:04] Voice 12: And a few people have referred to the online complaints form.

[2:52:09] Voice 12: And there's a lot of reluctance to that.

[2:52:12] Voice 12: They're saying, no, no, you just deal with it.

[2:52:14] Voice 12: And try to explain that we don't have anything to do with by-law enforcement.

[2:52:20] Voice 12: and there's I don't know why there's reluctance because if you take the time to sit down with

[2:52:27] Voice 12: the trustee and say you have a problem um it's simpler to sit down and type a few words out on

[2:52:33] Voice 12: online form and actually have a proper investigation take place because the best we can offer is

[2:52:40] Voice 12: interpretation whereas the bylaw officer actually they're they're they're there to provide the

[2:52:45] Voice 12: proper file enforcement so i but i i think this week i've had four so it's just quite a bit over

[2:52:53] Voice 12: to you

[2:52:54] Voice 17: well i just my my report will be fallow deer for basically basically the ad hoc fellow

[2:53:04] Voice 17: deer committee didn't meet for a couple of years and because i was overwhelmed with work and there

[2:53:12] Voice 17: there was only two of us basically so we've managed to commandeer a new member who's a

[2:53:18] Voice 17: retired lawyer and clearly didn't know what he was getting into and he volunteered to help us out so

[2:53:24] Voice 17: we we're now focused again on lobbying basically lobbying everyone we possibly can to have the

[2:53:31] Voice 17: government fund and step up to the plate and take responsibility for what they've done to us and

[2:53:38] Voice 17: And we're trying to stay out of the nitty gritty of, you know, how it should be done and rather focus on the fact that there's responsibility.

[2:53:45] Voice 17: So right now I've got emails all over the place.

[2:53:47] Voice 17: And actually, Salt Spring Transition, everybody's got back to me.

[2:53:51] Voice 17: It's quite impressive in terms of, you know, from Adam Olson and virtually everyone I've sent emails to.

[2:53:58] Voice 17: I love Trust Conservancy.

[2:53:59] Voice 17: So that's kind of where my energy is going right now.

[2:54:03] Voice 17: And frankly, environmental devastation is phenomenal.

[2:54:08] Voice 17: and it's not you know it's not helping with climate change it's just

[2:54:11] Voice 17: exasperating so that's basically but yes what dave was saying i think

[2:54:17] Voice 17: there's a lot more people on the island a lot more construction

[2:54:20] Voice 17: so there's a lot more complaints and people not understanding

[2:54:23] Voice 17: that there are rules around setbacks and there's rules around what you can and

[2:54:31] Voice 17: former remax that he's implying is a sleeping structure

[2:54:34] Voice 17: sure technically you're not supposed to sleep in an auxiliary building and i bite my chance there's

[2:54:51] Voice 17: the housing issues are ongoing but our population is it's booming and there's not as much available

[2:55:41] Voice 5: and there's been some some good conversations and then some smaller meetings in there

[2:55:53] Voice 5: items but i just wanted to point out that in july first week of july there's a meeting specifically

[2:55:59] Voice 5: set aside uh i think it's in person it's gonna

[2:56:05] Voice 5: talk about

[2:56:06] Voice 5: anchorages um from

[2:56:08] Voice 5: everybody's point of view and see whether there's some action that can be taken uh around just one

[2:56:15] Voice 5: thing i wanted to point out is that one of the programs that the trust programs committee has

[2:56:23] Voice 5: has adopted in the last little bit last year is um how i forgot what the name of it is i'm going to

[2:56:30] Voice 5: call it the living in the trust program but it's a mail out to uh new homeowners uh which is a mail

[2:56:38] Voice 5: out of a series of brochures about about the trust and about environmental how to how to live in the

[2:56:44] Voice 5: trust and about ecological perfect and it's a series of brochures that are mailed out and they

[2:56:50] Voice 5: They mailed to 1,000.

[2:56:54] Voice 5: I think that was done over every purchase over 18 months or something like that.

[2:57:02] Voice 5: And then we've now approved that there would be a new mailing every four months to all the new owners.

[2:57:08] Voice 5: So this is one way of trying to get people to understand that there are some roles and there's some ways to live in the trust.

[2:57:18] Voice 5: Just quickly, we now have the Islands Trust Conservancy report. It's in the package. Just two things I'll point out about the Islands Trust Conservancy. They have had a number of successful programs lately.

[2:57:43] Voice 5: whose last name I've forgotten.

[3:00:00] Voice 2: I just wanted to build on some concerns I raised at the last meeting, specifically on

[3:00:06] Voice 2: hydrology and hydrogeology of the proposed project.

[3:00:09] Voice 2: It was a great relief to hear some of those raised today up front in the room here, but

[3:00:14] Voice 2: really I'm just struck by some inconsistencies in the reports, the hydrogeology report in

[3:00:21] Voice 2: particular, which misrepresents a well location and well ownership.

[3:00:25] Voice 2: And then among the various documents we've seen, I just think of glaring emissions in terms of seasonality for water of all sorts, above ground, below ground, water supply, and wastewater.

[3:00:39] Voice 2: Some of those details were described earlier in this meeting by the applicants as small details.

[3:00:44] Voice 2: But I think for downstream neighbors, particularly on Maple Drive and other neighbors, those are major existential threats of flooding, water shortages, and contaminated wells.

[3:00:55] Voice 2: The challenge is not an issue of whether or not to have affordable housing.

[3:00:59] Voice 2: I think you find a lot of sympathy in the neighborhood for the concept of affordable housing.

[3:01:04] Voice 2: It's site selection.

[3:01:05] Voice 2: This is the inappropriate site for this project.

[3:01:07] Voice 2: This is a wetland.

[3:01:08] Voice 2: It's been described by the applicants as a wetland.

[3:01:11] Voice 2: But in a bit of a show of hubris last time, it was described as a wetland that wasn't a very good wetland.

[3:01:16] Voice 2: And that by fluffing up the soils and paving it, it would be made better.

[3:01:20] Voice 2: And I think just simply that just doesn't hold water.

[3:01:23] Voice 2: What we have are 30 acres draining into a bottleneck, coming out and affecting 19 downstream properties.

[3:01:30] Voice 2: That property is the sponge that prevents and retains that water and allows it to infiltrate and recharge the aquifer.

[3:01:37] Voice 2: By paving over it, you lose that resilience. This is an unacceptable risk.

[3:01:43] Voice 2: I think the idea of putting in 10 properties and jeopardizing 19 is just not something that should be tabled.

[3:01:49] Voice 2: The concept of paving over wetlands is something I'd expect to hear discussed in the Florida Everglades and not in a more progressive region like the Gulf Islands.

[3:02:00] Voice 2: With the hydrogeological assessment as a neighbor, I think we formally request that it be redone.

[3:02:05] Voice 2: I don't think the diligence by Hy-Geo meets standards.

[3:02:09] Voice 2: The maps misrepresent the location.

[3:02:12] Voice 2: The well was sampled after unseasonably high rains over a short window, and it simply does not capture the potential impact of this property on our groundwater.

[3:02:22] Voice 2: We've heard it described as a wet site at the bottom of a mountain, as a wetland, but not a good one.

[3:02:27] Voice 2: I just don't think these kind of descriptions of the property suggest something should be built there of the scale that's being proposed.

[3:02:34] Voice 2: I think it's kind of a potential to be a mega-project

[3:02:38] Voice 2: boondoggle where something like the flexible housing

[3:02:40] Voice 2: addresses the same concerns we have here on this island

[3:02:43] Voice 2: in a way that distributes the impact of those developments.

[3:02:47] Voice 2: Then simply as neighbors, I think, you know,

[3:02:49] Voice 2: before any discussion happens of subdivision,

[3:02:52] Voice 2: there are boundary issues on our property

[3:02:55] Voice 2: that have to be resolved.

[3:02:56] Voice 2: We've had productive negotiations with the owners,

[3:02:59] Voice 2: but there are existing encroachments onto our property

[3:03:02] Voice 2: be by buildings and other infrastructure will have to be resolved before there's any

[3:03:29] Voice 2: taking we've just metered the well during the wet season but we don't know what this would do

[3:03:34] Voice 2: year-round to this property I'm not sure why that data wasn't collected over the last year

[3:03:38] Voice 2: and a half and strengthening their position and achieve the goal of accelerating the project so
