And I want to begin by acknowledging that we're fortunate to be able to gather today from locations across the traditional territories of the Coast Salish people.

[0:02:10] Trustee Fast: Komox Nation. And I'm joined here today by Denman Island trustees, Laura Bershaken, and

[0:08:40] Trustee Fast: So, I'm going to, just that we held an in-camera meeting on November the 2nd.

[0:08:46] Trustee Fast: And then we're going to move on to trustee reports, 4.1, and who would like to go first?

[0:08:54] Trustee Fast: You want to go first, David?

[0:08:55] Voice 3: Certainly.

[0:08:56] Trustee Fast: Okay.

[0:08:59] Voice 3: So, firstly, I attended the farm plan review meeting that we held in this very room, April 29th,

[0:09:13] Voice 3: a special electronic meeting.

[0:09:16] Voice 3: Also, a matter that isn't really a trust matter, but is of interest generally,

[0:09:22] Voice 3: That was the gentleman I held, a newcomer event.

[0:09:29] Voice 3: It hasn't been held for many years.

[0:09:32] Voice 3: It was very well attended, and the gymnasium here was able to meet various newcomers.

[0:09:43] Voice 3: It was done in a way that people who were newcomers had red-colored badges so they were identifiable.

[0:09:50] Voice 3: And it was just a meet and greet with food and beverages and extremely pleasant and very useful.

[0:10:00] Voice 3: We got actually very positive feedback on the trust from newcomers.

[0:10:05] Voice 3: I also attended a trust programs committee meeting which was largely concerned with trust policy statement review and how we proceed from here.

[0:10:18] Voice 3: That committee will be having a special meeting in June, which will be an in-person meeting

[0:10:27] Voice 3: at the time.

[0:10:28] Voice 3: At that meeting, we also made recommendations for community stewardship awards, which I

[0:10:37] Voice 3: can't tell you about because it was all confidential, but it will come on trust council.

[0:10:42] Voice 3: Also, I just want to give a little update on ferry advisory committee, which was, it's

[0:10:52] Voice 3: It's actually not the Ferry Advisory Committee per se, but it's sort of the parallel organization of FAC members.

[0:11:02] Voice 3: Some members were able to attend a meeting with the Minister of Transportation and also our MLA in Victoria,

[0:11:12] Voice 3: Victoria, which was reported back as being very, very well received that there were promises

[0:11:22] Voice 3: to take the concerns further to the BC Ferries Corp.

[0:11:29] Voice 3: That is, of course, the background being the great overwhelming wait times for ferries,

[0:11:37] Voice 3: especially during the summer season when the army, tourists in particular, arrive in large

[0:11:46] Voice 3: numbers. So although that meeting was reported as being very positive, we've since had a

[0:11:54] Voice 3: communication from BCFIS informing that essentially there's not much going to change before this

[0:12:01] Voice 3: year. So people are very unhappy with that, finding it unacceptable. So where we go from

[0:12:09] Voice 3: now, I don't know. That news was only received a couple of days ago. They are making a couple

[0:12:17] Voice 3: of things. They said that they would change or have different ferry fares, lower ferry fares to encourage traffic at the less than peak times, try to spread out the traffic. I don't think that's going to help much locally here at all. And they did undertake to continue with their shuttling policy, which really isn't news at all.

[0:12:44] Voice 3: situation so it's going to be bleak for this summer sort of gird yourselves for massive

[0:12:49] Voice 3: labs and have a novel or something handy to keep you occupied so that's what we're doing

[0:12:59] Trustee Busheikin (probable): i'll be brief because we started late and i have a lot of

[0:13:04] Trustee Busheikin (probable): business um i went to most of the same meetings as david farm plan or no farming regularly i went to

[0:13:13] Trustee Busheikin (probable): the newcomers meeting and had really good conversations it's um really good to get out

[0:13:20] Trustee Busheikin (probable): there as a trustee i think that um covid has uh had a really difficult impact on people's ability

[0:13:28] Trustee Busheikin (probable): we didn't even know what the trust is until we connected to it, you know, and yeah, so that was good.

[0:13:38] Trustee Busheikin (probable): I also attended a regional planning committee meeting, so for people who are listening, that's a trust-wide committee,

[0:13:46] Trustee Busheikin (probable): a trust council for the whole trust area, looking at the regional aspect of planning.

[0:13:54] Trustee Busheikin (probable): We talked a lot about all the scientific work done around groundwater mapping and protection.

[0:14:04] Trustee Busheikin (probable): A lot of trustees feel some frustration about that because we want to see the product, we want to get them working.

[0:14:11] Trustee Busheikin (probable): But it is kind of like groundwater. A lot is happening where we can't see it.

[0:14:15] Trustee Busheikin (probable): And it's like multi-year science projects that are starting to come to fruition and there will be reports that are starting to be put to use where they have come to fruition to help guide development and, you know, use decisions.

[0:14:31] Trustee Busheikin (probable): So, I was glad to learn that. We also talked a lot about this initiative to ask the provincial government to create some kind of housing authority or housing body for the trust area.

[0:14:51] Trustee Busheikin (probable): It's complex, like it's just a complex how to ask. Well, yeah, how to ask for that in a way that isn't just, you know, window dressing.

[0:15:01] Trustee Busheikin (probable): And what we're really asking for and why, how to make a case that the Islands Trust deserves, or the Islands Trust area, because it wouldn't be the Islands Trust, would deserve some kind of special treatment when the province is hearing continually from all over BC that, you know, really, you know, horrifying tales of the impacts of the housing crisis.

[0:15:29] Trustee Busheikin (probable): So that's a work in progress. And I continue to hold the occasional, I call it two in my trustee, I go to the cafe, people come and talk to me.

[0:15:39] Trustee Busheikin (probable): It's been great. I haven't done it lately because I've not worked on Saturdays and I've been away a lot, but I'll keep doing that.

[0:15:49] Trustee Busheikin (probable): I get a lot of calls, like regular people, about issues or what they want to do on their property.

[0:15:57] Trustee Busheikin (probable): Again, I really feel like there's a lot of opportunity for the Trust to get its story out more, and I know, and maybe you can answer this, I know that there was an initiative, I know very well, to send out information packages to newcomers, have those been sent out?

[0:16:20] Trustee Busheikin (probable): wonderful that's really good and I think I'll get in touch with those should be

[0:16:23] Trustee Busheikin (probable): I think everyone should know they're available because not all newcomers buy

[0:16:27] Trustee Busheikin (probable): property and that's I think how we identify those just yeah really seeing

[0:16:33] Trustee Busheikin (probable): that people want to know more about the trust and it really helps them okay

[0:16:42] Trustee Fast: thank you I am yeah just to continue with the information that was mailed out

[0:16:47] Trustee Fast: That was mailed in prior to the most recent public participation opportunities for the Trust Policy Statement,

[0:16:59] Trustee Fast: where the team with the consultants came to the Islands to speak to people.

[0:17:05] Trustee Fast: So that mailing is there. Yes, there's a new RAC card and a bunch of information about the Islands Trust,

[0:17:12] Trustee Fast: So please get in touch with Claire's team, or just the front desk even at the Islands Trust, and they will help with that.

[0:17:22] Trustee Fast: I'll just give a really brief report.

[0:17:24] Trustee Fast: Last week, I was on the board of the Islands Trust Conservancy, which is the nature arm of the Islands Trust.

[0:17:34] Trustee Fast: And they're up to, they've protected now 111 properties across the Islands Trust area.

[0:17:40] Trustee Fast: area, and last week we learned that the Species at Risk funding that we were receiving from

[0:17:48] Trustee Fast: the federal government had been extended for another three years, and they got a top-up

[0:17:54] Trustee Fast: of the grant for the current year.

[0:17:56] Trustee Fast: So good relationship there, they were happy with the, the federal government is happy

[0:18:03] Trustee Fast: with the partnership and the funding continues, and so anyway it's always very positive to

[0:18:08] Trustee Fast: to go to those meetings where you're protecting nature,

[0:18:12] Trustee Fast: refuges, and also conservation governments,

[0:18:17] Trustee Fast: including the Natural Areas Tax Exemption Program,

[0:18:20] Trustee Fast: for anybody who's interested in their options

[0:18:23] Trustee Fast: for protecting nature and how they can do it.

[0:18:29] Trustee Fast: That was Tuesday during the day,

[0:18:31] Trustee Fast: and then Tuesday at four o'clock,

[0:18:32] Trustee Fast: I entered Bowen Island Municipality as a councillor,

[0:18:37] Trustee Fast: a public hearing, a regular council

[0:18:39] Trustee Fast: meeting, a closed council meeting. So that was a

[0:18:41] Trustee Fast: 12-hour day, and

[0:18:43] Trustee Fast: although not much

[0:18:45] Trustee Fast: traveling because one of them was

[0:18:47] Trustee Fast: on Zoom. Then I had an executive committee

[0:18:49] Trustee Fast: the next day. So this is the

[0:18:51] Trustee Fast: four vice chairs

[0:18:53] Trustee Fast: and the chair

[0:18:54] Trustee Fast: meet together with senior staff

[0:18:56] Trustee Fast: and look at

[0:18:59] Trustee Fast: the bylaws coming and advance

[0:19:01] Trustee Fast: the general business of the trust.

[0:19:03] Trustee Fast: And then those agendas are

[0:19:05] Trustee Fast: all online too.

[0:19:07] Trustee Fast: And then I had Gambier, local trust committee, the next day.

[0:19:10] Trustee Fast: So that one we met in North Vancouver and held a meeting there.

[0:19:15] Trustee Fast: And I want to mention to everybody that trust council is coming up in June.

[0:19:19] Trustee Fast: It's going to be electronic on Zoom.

[0:19:22] Trustee Fast: So that will be, oops, there goes my pen.

[0:19:26] Trustee Fast: That will be the 21st to 22nd and the 23rd.

[0:19:30] Trustee Fast: and if you're interested in being a delegation there the timelines are

[0:19:59] Trustee Fast: trust council meeting, just so you can see that kind of area-wide, trust area-wide work

[0:20:39] Trustee Fast: So this is just a, what Sonia was saying is that because we had the public hearing yesterday

[0:20:47] Trustee Fast: about the Denman Housing Association project the laws of British Columbia say

[0:20:55] Trustee Fast: that we cannot hear more we cannot hear more about that particular project today

[0:21:03] Trustee Fast: so if you're going to say things in the town hall please try and avoid that

[0:21:10] Trustee Fast: because I will we won't be able to hear it but just there's a few guidelines

[0:21:18] Trustee Fast: guidelines here if anybody wants to see them. Did you put some in the back?

[0:22:30] Voice 2: I keep seeing notices, mother, daughter, looking for a place to live, can't afford a place to live, been here for a long time.

[0:22:37] Voice 2: There is a recognizably not adequate housing for people who are not well-to-do.

[0:22:45] Voice 2: I think we need to look at all the avenues we have, and look, try to be creative.

[0:22:52] Voice 2: How can we make it to people who are not affluent?

[0:22:59] Voice 2: And if we can, I encourage you to do that. That's my main point.

[0:23:22] Voice 4: I just wanted to make a comment about affordable housing. I've been here for just over 10 years now.

[0:23:27] Voice 4: When I first came, the housing I had immediately was threatened by the Bullings, by mistrust.

[0:23:33] Voice 4: I decided to back off on those Bullings. Since then, I've lived in about 9 different houses, and only one of them was legal.

[0:23:42] Voice 4: I was going to rent a studio apartment recently, and I've accepted the idea that I'm going to pay over $1,000 in rent,

[0:23:48] Voice 4: which is more than they ever have in my entire life, and yet just before actually renting the place,

[0:23:54] Voice 4: they wanted to check the rules and apparently I can rent it as a B&B but not as a rental. That to me

[0:24:01] Voice 4: seems kind of odd that we're allowed to encourage tourism and many other things but not locals to

[0:24:07] Voice 4: live and work on farms. So that's my issue with the current law that exists and I would encourage

[0:24:13] Voice 4: I would encourage island trusts to consider many other options for affordable housing other than building a compound or a new location that will actually do more damage to the island than letting someone live in one of the many thousands of houses that are empty because of the current asylum.

[0:24:29] Voice 4: Okay, so that's all I have to say. I would like to stay on this island if I can, but the current point of finding an illegal house is almost...

[0:27:05] Voice 8: The National Geographic Society writes, and I quote,

[0:27:10] Voice 8: carrying capacity can be defined as a species average population size in a particular habitat.

[0:27:17] Voice 8: The species population size is limited by environment factors like adequate food, shelter, water, and mates.

[0:27:25] Voice 8: If these needs are not met, the population will decrease until the resource rebounds, end of quote.

[0:27:32] Voice 8: Humans are not constrained by these limits, while non-human forms can neither travel to replace depleted nutrients nor purchase cisterns to provide water.

[0:27:44] Voice 8: However, humans can and do destroy environmental factors critical to the survival of plants and animals.

[0:27:52] Voice 8: If an environment becomes sufficiently degraded, humans have the option to live elsewhere.

[0:27:58] Voice 8: Thus carrying the passion needs to be defined in terms of protecting the environment.

[0:28:03] Voice 8: So what can the Local Trust Committee do?

[0:28:07] Voice 8: It can enact bylaws to set limits on land use and build out and update the official community plan, which is the OCP,

[0:28:15] Voice 8: to best represent the residents' collective stewardship of this finite island.

[0:28:20] Voice 8: Additionally, the Local Trust Committee represents three of 22 trustees who make up the Trust Council.

[0:28:28] Voice 8: And these voices should call for trust care and capacity safeguards,

[0:28:33] Voice 8: plus advocacy to extend safeguards to the policies and actions of other levels of government.

[0:28:39] Voice 8: So my first section is water, I then talk about land, and then I talk about housing and diversity.

[0:28:46] Voice 8: Underwater, the Local Trust Committee initiative to study freshwater sustainability is framed

[0:28:53] Voice 8: as, I quote, the first phase of determining carrying capacity of the islands, end quote.

[0:28:59] Voice 8: To me, quantifying aquifers in fractured rock is rather like counting unicorns.

[0:29:08] Voice 8: It's easiest to count and colorfully portray something no one can see using terms such

[0:29:15] Voice 8: such as Leniment TW1 Wetness Coefficient, and quote on top of it.

[0:29:22] Voice 8: Protecting wetlands and

[0:29:23] Voice 8: watersheds is both pragmatic and long overdue.

[0:29:26] Voice 8: A measure of the limits to carrying capacity can be seen with the growing number of water deliveries.

[0:29:33] Voice 8: The Farm Regulation Project could recommend changes to the bylaws and the OCP

[0:29:38] Voice 8: to protect sources of groundwater recharge on 46% of Denman Island,

[0:29:44] Voice 8: the area designated as agricultural land reserve unfortunately the project could also recommend

[0:29:52] Voice 8: further enshrining amr parcels as impervious to environmental protection the local trust

[0:30:00] Voice 8: could use local knowledge and accurate mapping as a basis, mapping that predates the current

[0:30:06] Voice 8: mapping by Google. Freshwater protection requirements could be introduced in parallel with subdivision

[0:30:13] Voice 8: and rezoning applications to reduce the impact of development, including the negative impact

[0:30:19] Voice 8: of roads, driveways, and ditches. Some general regulatory changes could also be redefined.

[0:30:26] Voice 8: One, what coverage? To include surfaces covered by non-permeable surfaces, and two, redefine structures to include non-permeable ground, level, pavement, driveways, vehicle parking, and sidewalks.

[0:30:43] Voice 8: The LTC could pressure the Trust Council to negotiate changes in the Ministry of Transportation approach to road construction and ditching, so as to neither drain nor disrupt wetlands and streams.

[0:30:57] Voice 8: Additionally, landowners could be required to obtain a permit to channel water into roadside ditches.

[0:31:04] Voice 8: Water that is directed into the ocean does not recharge groundwater.

[0:31:08] Voice 8: one section on land in 2019 state of the island report appears to be based on anthropocentric

[0:31:18] Voice 8: vision a combination of outdated outdated data and a bucket list of what scientific research

[0:31:26] Voice 8: might reveal the 2019 report sets a threshold of 30 to 40 percent for the natural areas

[0:31:34] Voice 8: converting, this is a quote, for human use in the island's trust area, end quote.

[0:31:41] Voice 8: As of 2019, 16.4% of land in the trust area has been converted into roads compared to

[0:31:49] Voice 8: that, quote unquote, protected area land accounting for 25%.

[0:31:55] Voice 8: Add to this the

[0:31:56] Voice 8: island's trust conservancy declaration that 25% of Denman Island is conserved

[0:32:01] Voice 8: land. To support climate diversity, how big an area is big enough if humans get to

[0:32:07] Voice 8: convert the rest? If damaged, conserved areas are open to recreational use for

[0:32:15] Voice 8: trail building, signage and toilets, does conservation merely translate into no

[0:32:20] Voice 8: residential or industrial use? Moreover, how much of the protected land has

[0:32:26] Voice 8: already been degraded by logging and there's little to protect or

[0:32:31] Voice 8: concern at this time. Parks clearly have a commercial aspect and a history of increasing

[0:32:37] Voice 8: commercialization. Past plans for destination camping facilities and RV parking have only

[0:32:44] Voice 8: been averted thanks to the community's strong negative response. As a consequence, the local

[0:32:52] Voice 8: trust committee should regularly meet with the regional and provincial park administrators as

[0:32:57] Voice 8: per ocp e3 conservation recreation atmosphere policies one to six as well as updating these

[0:33:06] Voice 8: policies in light of the adequate plan and the pressure of recreational tourism particularly

[0:33:12] Voice 8: with growing urban populations in the commons valley and climate change disasters in bc

[0:33:18] Voice 8: recreational areas the local trust committee should add a strong voice on trust council for

[0:33:25] Voice 8: for hiring a qualified expert in biodiversity

[0:33:27] Voice 8: to best protect existing reserves

[0:33:31] Voice 8: and to recommend and justify new reserves.

[0:33:34] Voice 8: Expert analysis would enable

[0:33:37] Voice 8: the local trust committee's implementation

[0:33:39] Voice 8: of development permit areas

[0:33:41] Voice 8: for protection of the natural environment.

[0:33:44] Voice 8: According to the Viridian report, quote,

[0:33:47] Voice 8: reserves should be representative

[0:33:49] Voice 8: of all the ecosystem present in an area.

[0:33:53] Voice 8: area. Today, the trust seems to focus on single specimens, for example, Coastal Douglas fir

[0:33:59] Voice 8: or eelgrass. The next section is housing and diversity. There's a real possibility that

[0:34:06] Voice 8: conserved land will be used to justify increased density elsewhere on the island, and that

[0:34:13] Voice 8: areas with adequate fresh water will be focused on clustered and using the RFR zoning condominiums.

[0:34:21] Voice 8: All decisions should be made with regard to hearing capacity in the way, one, population pressure will increase, two, land costs will continue to escalate, three, humans convert the natural environment either intentionally or by accident, and four, environmental degradation, pollution, road traffic, and demand for

[0:34:42] Voice 8: services increases as population increases.

[0:34:46] Voice 8: The present Local Trust Committee has consistently adopted measures that increase density without reference to care and capacity.

[0:34:55] Voice 8: Suites were allowed but not counted as densities. Enforcement of housing violence was suspended and currently the doubling of density and 46% of denmin in the ALR is contemplated.

[0:35:07] Voice 8: The OCP contains the affirmation, this affirmation is part of its vision statement, quote, we will use innovative options to promote the diversity of age and financial needs within the carrying capacity of the island, end quote.

[0:35:25] Voice 8: quote. What do you have? One more minute left. The OCP also states this objective, quote,

[0:35:31] Voice 8: to identify, preserve, and protect the integrity of the natural ecosystems on Denman Island

[0:35:37] Voice 8: and the adjacent islands, including the foreshore and intertidal areas. This object could be

[0:35:43] Voice 8: understood as a highest priority in land use planning, end quote. And then I have a series

[0:35:49] Voice 8: of things that I think the local trust committee should consider, and I would like to be able

[0:35:54] Voice 8: read those. Go ahead. Following your possibilities. Limit the square footage of houses to reduce

[0:36:01] Voice 8: the burden of starter casks. Reduce lot coverage in all zones to discourage overbuilding. Encourage

[0:36:09] Voice 8: imagination of lots, especially in R1. Create a more time on small lot subdivisions. Recognize

[0:36:17] Voice 8: that cluster housing is not a panacea. Clusters rarely benefit the environment,

[0:36:24] Voice 8: seldom suit a rural setting, and impose collectivity with strangers. Work with the

[0:36:30] Voice 8: bona fide farmers to seek a solution to the problem of succession, with the farmer retiring

[0:36:35] Voice 8: on the land in order to preserve existing farms. G, promote the housing option in the existing

[0:36:44] Voice 8: bylaw definition, quote, dwelling unit, one or more rooms in a building containing a single

[0:36:50] Voice 8: set of cooking facilities and used or intended to be used as a residence by an individual

[0:36:56] Voice 8: or a group of individuals living together in

[0:37:00] Voice 8: common occupancy. End quote. Low-income

[0:37:03] Voice 8: and retired residents might prefer this option to cluster housing. Last one, enforce existing

[0:37:09] Voice 8: existing regulations that disallow vacation rentals and short-term rentals other than

[0:40:22] Voice 6: which is remarkably quickly for government time they rolled back their decision as of january 1st

[0:40:28] Voice 6: 2022 the alc now allows greater flexibility for farmers to provide housing options on aur lands

I remember that part of the discussion was that development should pay for development and that there was concerns in the trustees that we had a policy that costs should be recovered so that taxpayers weren't paying for it through their, taxpayers in general weren't subsidizing development through their property taxes.

[0:58:40] Trustee Fast: So that's part of the reason for doing this whole project. I agree with your recollection and I'm going to ask Trustee Boucher to speak to her proposal and anything you want to say, please go ahead.

[0:58:54] Trustee Busheikin (probable): I'm, as you know, Chair of Regional Planning Committee, which is the committee that worked on this for really two years with a lot of discussion about all of those issues.

[0:59:05] Trustee Busheikin (probable): and a few things i could add um yes there was a um a goal to recover and i remember the percentage

[0:59:13] Trustee Busheikin (probable): but overall across the trust area a certain percentage um and um likewise uh when we asked

[0:59:24] Trustee Busheikin (probable): as a committee staff for could you bring in other um areas fees so we could compare staff

[0:59:31] Trustee Busheikin (probable): The staff group did not do that, and they said it's not comparable because we are so different, that we have, like, regional

[0:59:41] Planner Zupanec (probable): districts have completely

[0:59:42] Trustee Busheikin (probable): other sources of income, they also generally don't have limits on development the way we have, and there's a certain impetus in regional districts and municipalities, there can be a desire to develop.

[1:00:04] Trustee Busheikin (probable): and more people to come things.

[1:00:05] Trustee Busheikin (probable): And I think none of that operates in the test area.

[1:00:14] Trustee Busheikin (probable): they tend to be even more rural than many rural areas,

[1:00:17] Trustee Busheikin (probable): just a lot of differences.

[1:00:19] Trustee Busheikin (probable): And so there was a real reluctance

[1:00:21] Trustee Busheikin (probable): and the committee acquiesced to that,

[1:00:23] Trustee Busheikin (probable): that yeah, we're not gonna base this on comparisons.

[1:00:27] Trustee Busheikin (probable): It's also very different if you look at city versus rural,

[1:00:30] Trustee Busheikin (probable): and that kind of thing. So putting that aside, I mean, it came up again and again in the committee discussions that a lot of islands, most islands had not put their fees up for a decade, over a decade, not even at the rate of inflation, and that this could be a really drastic jump very suddenly.

[1:00:59] Trustee Busheikin (probable): And the question was posed, what if the island felt that this model of bylaw was too big of a change, too quickly, and the answer always was that they could bring something back to the executive committee and then it's up to the executive committee to decide.

[1:01:15] Trustee Busheikin (probable): And that's the road I think that an island should take.

[1:01:20] Trustee Busheikin (probable): I think that the idea that taxpayers don't want to subsidize development is fair enough,

[1:01:26] Trustee Busheikin (probable): but the fact is most of these applications are not from developers.

[1:01:31] Trustee Busheikin (probable): When we say development and developers, we think of something big and profit-oriented,

[1:01:36] Trustee Busheikin (probable): and then yes, it should be part of the developer's budget.

[1:01:40] Trustee Busheikin (probable): Most of the applications are single-family homes, small businesses.

[1:01:46] Trustee Busheikin (probable): I mean, I remember in the middle of this talking to our guest house in the middle of COVID and they put in an application to put a roof over their outdoor tables because it was COVID and that was the only way they could stay open and provide the service they provide, which isn't just coffee, it's also a gathering place and being employers.

[1:02:06] Trustee Busheikin (probable): lawyers, and they went through all of that, and yes, it was somewhat subsidized, but there's

[1:02:12] Trustee Busheikin (probable): other examples of people just doing things that are really in the community interest

[1:02:17] Trustee Busheikin (probable): or that are really minor, and also, I don't think that we're subsidizing development.

[1:02:23] Trustee Busheikin (probable): What it's actually paying for is professional staff to oversee development and make sure

[1:02:28] Trustee Busheikin (probable): that it falls within the preserve and protect mandate, that it follows all the rules, that

[1:02:33] Trustee Busheikin (probable): that all the environmental studies are done if necessary,

[1:02:37] Trustee Busheikin (probable): that public process is done,

[1:02:38] Trustee Busheikin (probable): we're actually paying for oversight on development

[1:02:41] Trustee Busheikin (probable): and not development.

[1:02:42] Trustee Busheikin (probable): So I don't really, I think it's more complex.

[1:02:46] Trustee Busheikin (probable): I think it's oversimplifying to say,

[1:02:47] Trustee Busheikin (probable): we think developers should pay for development.

[1:02:52] Trustee Busheikin (probable): So that's why I did go through this

[1:02:55] Trustee Busheikin (probable): and what I tried to do is,

[1:03:00] Trustee Busheikin (probable): I think, I believe, I set a limit that nothing will go up more than 50% as being just something that is, I mean, maybe it's random, but just psychologically and for the community, that's already a big job.

[1:03:20] Voice 1: there's actually a few items where what

[1:03:21] Trustee Busheikin (probable): I suggest is more than the model bylaw, but still within the 20%.

[1:03:28] Trustee Busheikin (probable): And otherwise, there's a few things that I think really

[1:03:32] Trustee Busheikin (probable): respond to

[1:03:33] Trustee Busheikin (probable): the needs and flavor of our community

[1:03:35] Trustee Busheikin (probable): that I think, which is continuing to have

[1:03:39] Trustee Busheikin (probable): a lowered rate for affordable housing applications.

[1:03:44] Trustee Busheikin (probable): We don't get very many.

[1:03:46] Trustee Busheikin (probable): I know they're very demanding on staff time

[1:03:49] Trustee Busheikin (probable): and really the difference between $1,000 or $500

[1:03:53] Trustee Busheikin (probable): or a couple thousand.

[1:03:55] Trustee Busheikin (probable): It's not going to pay for that amount anyways. And these are, you know, well, we've heard enough about it over the last 24 hours. I mean, the affordable housing projects are hugely demanding of volunteer time and community fundraising and all of that. And I think that they don't happen very often and they go very slowly. So this isn't going to make a measurable difference to the island's trust budget.

[1:04:22] Trustee Busheikin (probable): specific number beside that i put in 1500 which is a 50 jump of where it's at now

[1:06:10] Trustee Busheikin (probable): use permit that is supported by our regulation is for a secondary cottage uh with the goal of

[1:06:18] Trustee Busheikin (probable): providing more housing options uh it's relatively inexpensive and has only been used once um

[1:06:29] Trustee Busheikin (probable): And again, I don't think it's going to break the bank by just leaving this as it is.

[1:06:36] Trustee Busheikin (probable): So the draft bylaw that came from staff recommends removing this category, but this was one of

[1:06:44] Trustee Busheikin (probable): the most hotly discussed items in regional planning committee, and there was a real sense

[1:06:51] Trustee Busheikin (probable): that we wanted to have something

[1:06:54] Trustee Busheikin (probable): that would allow some kind of fees

[1:06:57] Trustee Busheikin (probable): to be waived for community benefit.

[1:06:59] Trustee Busheikin (probable): And this is what

[1:07:00] Trustee Busheikin (probable): staff came up with.

[1:07:02] Trustee Busheikin (probable): The director of planning came up with this as a mechanism.

[1:07:07] Trustee Busheikin (probable): And it's a small mechanism,

[1:07:10] Trustee Busheikin (probable): and just removing it takes away any option

[1:07:13] Trustee Busheikin (probable): to show some respect to applications

[1:07:18] Trustee Busheikin (probable): that provide community benefits.

[1:07:20] Trustee Busheikin (probable): So I'd like to put it in there,

[1:07:22] Trustee Busheikin (probable): send it to executive committee see what they think I think that the perhaps

[1:07:28] Trustee Busheikin (probable): there's some wording that could be done within the new regulation to specify

[1:07:33] Trustee Busheikin (probable): what community benefit is or it could be simply left that we're going to be able to see people do it so that's

[1:10:17] Voice 3: and invite them, in essence, to change the numbers plus or minus 20%.

[1:10:27] Voice 3: Because we have one budget in the trust.

[1:10:31] Voice 3: We have one set of staff and we are doing the same work on various islands, now there may be different rates at which that is done, different sorts of applications, but by and large we do the same work across the islands.

[1:10:54] Voice 3: And I appreciate the work that was put into this by the Regional Planning Committee and staff to come up with the numbers that they've come up with.

[1:11:07] Voice 3: To me, it would be very strange if you had the situation, say in Vancouver, where Vancouver said,

[1:11:15] Voice 3: Okay, we're going to create a separate set of fees, application fees for South Vancouver, East Vancouver, West Vancouver, and such like.

[1:11:30] Voice 3: How would that be justified?

[1:48:35] Voice 3: and I think we all recognize that there are some things that we take a little

[1:48:42] Voice 3: bit on faith here yes we'd like it so that all 20 units were going to be fully

[1:48:50] Voice 3: subsidized and there's just a number of issues that we could take issue with

[1:48:59] Voice 3: myth to take objection to. But overall, this is a good project and I commend to bringing

[1:49:14] Voice 3: this before us and responding to requests and concerns. I think the need for affordable

[1:49:23] Voice 3: housing on this island is great. It's well documented. In looking at the various written

[1:49:31] Voice 3: submissions, one thing that jumped out to me was the submission, I think, by the Army

[1:49:38] Voice 3: the Army Denman Health Care Society, which referred to rates of poverty throughout the

[1:49:43] Voice 3: Cobra Valley and other areas, and Denman Island, and it referred to child poverty, and that

[1:49:53] Voice 3: on Denman Island was, I believe, around 50%, and it was quite a bit higher than any of

[1:50:01] Voice 3: the other areas, and that's an especially troubling concern.

[1:50:05] Voice 3: So, overall, I recognize the objections that were made, the deficiencies, perhaps, in some

[1:50:16] Voice 3: respects, but I think this is a question of the greater good, and we have to do this.

[1:50:24] Voice 3: Hopefully, this, of course, doesn't finalize it, the building doesn't magically appear

[1:50:30] Voice 3: if we pass this, there's a lot yet to be done, including water supply confirmation by water

[1:50:38] Voice 3: water license, which all indications from hydrological studies are positive on that.

[1:50:46] Voice 3: But we will pause that for fourth reading adoption. We'll have that in hand. So those

[1:50:57] Voice 3: are kind of my reasons why I think we need to go forward with this.

[1:52:00] Trustee Busheikin (probable): organization and a profit-driven developer and another donor density's

[1:52:06] Trustee Busheikin (probable): that I don't know what the what the financial situation is there and that is

[1:52:13] Trustee Busheikin (probable): really our business our businesses land use and that how that impacts our

[1:52:18] Trustee Busheikin (probable): community and whether one person's making money or not making money or

[1:52:22] Trustee Busheikin (probable): what's inside isn't it's not what we're dealing with and it will pass whereas

[1:52:29] Trustee Busheikin (probable): whereas the housing will be there for decades.

[1:52:35] Trustee Busheikin (probable): and we have a real estate situation that is driven by the market,

[1:53:54] Trustee Busheikin (probable): say that we don't have that

[1:53:55] Trustee Busheikin (probable): tax now oh we don't have that tax no but there's discussion about asking the

[1:54:50] Trustee Busheikin (probable): The trust mandate doesn't actually, and it doesn't anywhere in the trust, I think the policy statement, OCP, speak against clustered areas.

[1:54:59] Trustee Busheikin (probable): And in fact, most islands have clustered areas, neighborhoods, residential villages.

[1:55:05] Trustee Busheikin (probable): Our village isn't a residential village, and that is part of rural development, villages are part of rural development, and it is absolutely, contrary to what some people say, it is absolutely a good way to minimize environmental impact and increase social cohesion.

[1:55:23] Trustee Busheikin (probable): So there's less density, or there will be if this all goes forward, in one part of the island and more in another.

[1:55:30] Trustee Busheikin (probable): other. So it's fairly neutral. It doesn't make those densities more, I would say, possibly

[1:55:37] Trustee Busheikin (probable): profitable. And in that sense, you could say that works against affordability. But I think

[1:55:42] Trustee Busheikin (probable): it's a very small change. And looking at what we're gaining, I think that's fine. So yeah,

[1:55:59] Trustee Busheikin (probable): hearing who spoke not just about the needs of the future tenants but the

question and answer session were conducted on the Farm Regulations Review 
project;

Trustee Busheikin provided a summary of activities and meetings attended including: 
 Two Special LTC meetings and the Newcomers Event mentioned in Trustee 
Critchley’s report; 
 Regional Planning Committee meetings - reviewing scientific work being done on 
groundwater mapping and protection; and an initiative requesting the provincial 
government to create a Housing Authority or Housing Body for the Islands Trust 
Area were discussed; 
 Tea with Trustee and calls from community members; 
 Information packages on Islands Trust are now available and have been sent out to 
newcomers. 
4.2 Chair's Report 
Chair Fast provided a summary of activities and meetings attended including: 
 Islands Trust Conservancy meeting – 111 properties in the Trust Area are now 
protected, and the Species at Risk funding from the Federal Government has been 
extended for three years; 
 Bowen Island Municipal Council; 
 Executive Committee; 
 Gambier Island LTC; 
 The next Trust Council meeting will be held in June. 
4.3 Electoral Area Director's Report - none 
5. TOWNHALL 
 The Islands Trust was encouraged to do all they can and to be creative to make more 
affordable housing options for people. 
 Finding a legal house to rent is almost impossible. Concern was expressed that it is possible 
to rent a B&B but not rental housing. The Islands Trust was encouraged to explore options 
other than new buildings, using existing buildings to improve the lack of legal rental housing. 
6. DELEGATIONS 
6.1 Harlene Holm regarding Carrying Capacity in All Local Trust Committee Decisions 
Harlene Holm presented her submission asking the LTC to enact bylaws to set limits on 
land use and build-out, and to update the Official Community Plan (OCP) to best 
represent residents’ collective stewardship of this finite island; and for Trust Council to 
call for Trust Area carrying capacity safeguards plus advocacy to extend safeguards to 
the policies and actions of other levels of government.

The presentation included discussion of water, land, housing and diversity in this 
context and provided options and possible solutions, pointing out that carrying capacity 
needs to be defined in terms of protecting the environment. 
6.2 Riane Da Silva regarding Agricultural Land Reserve (ALR) Regulations and Secondary 
Dwellings on ALR Lands 
Riane Da Silva presented a petition, signed by hundreds of Denman Island residents and 
non-resident property owners, asking the LTC to: 
1. Change Bylaw No. 228 (Land Use Bylaw (LUB)) and Bylaw No. 229 (OCP) to align 
with Provincial ALR regulations allowing secondary dwellings on all ALR lands; 
2. To impose no restrictions beyond the provincial ones, on these year around 
dwellings; 
3. To ensure that these dwellings are not used for vacation and other short term 
rentals. 
She asked the LTC to make the bylaw changes necessary to allow the secure housing of 
Denman Island residents and to remove the stress of potential bylaw enforcement at 
peoples’ homes.

8.2 Fees Bylaw No. 245 - Staff Report - for decision 
Regional Planning Manager Kauer presented the Staff Report that asks the LTC to 
consider three readings of Fees Bylaw No. 245 which updates the document, and 
provides fee options based on the Trust Council (TC) model and recommendations from 
Trustee Busheikin. She advised that Trust Council has indicated that the model fees

should not be modified by more than 20% and that, as many of the fees recommended 
by Trustee Busheikin constitute a variation of more than 20%, there is a risk that the 
bylaw could be rejected by the Executive Committee (EC) when presented to them for 
approval. 
She commented that although the term “Community Benefit” is referenced in the 
bylaw, she expressed concern that the Denman Island OCP does not define that term 
which would require staff to make subjective decisions as to what constitutes a 
community benefit. 
Trustee Busheikin spoke to her recommendations with the following noted: 
 As Chair of the Regional Planning Committee (RPC) she has worked on this initiative 
for two years; the intent of the RPC was to allow flexibility to LTCs in their suggested 
variations from the TC model; the process allows for LTCs to recommend changes 
and for EC to review and make a decision; 
 Many communities have not raised fees for many years and the TC model may 
represent a change that is too large, too fast; 
 Most of these applications are not for development, rather are single family homes, 
small businesses; 
 No increases proposed are more than 50% and respond to the needs of our 
community; 
 She proposed that the LTC forward her recommended changes to the EC and 
consider a gradual increase of fees over a few years. 
Other Trustees commented on the proposed fee changes: 
 Support was expressed for the TC model fees, preferring the fees to be uniform 
throughout the Trust Area;  
 A user-pay principal is supported; reducing the fees for applications places a burden 
on the taxpayers to subsidize development applications.

When asked by the Chair if there is any discussion on the motion, Trustees requested the following

 with the inclusion of a new type of application “Amendment for affordable housing 
inclusive of change to density or Official Community Plan or Zoning” to have a fee of 
$1,500; 
 and including the category “Temporary Use Permit for residential uses under 95 square 
metres through allowing secondary dwellings” and that the fee for this be $440; 
 
A Trustee commented that this option has only been used once, will be a part of discussion in the 
upcoming Farm Regulation Review and Housing Review projects. This reduced fee was recommended by 
the Regional Planning Committee.

Trustee Critchley commented that there was overwhelming support for these bylaws voiced at the 
Public Hearing. He noted that while some aspects, such as the subsidized rent, have not yet been 
finalized, overall this is a good project and he commended the applicants for the work that has gone into 
this proposal. He acknowledged that the need for affordable housing on Denman Island is well 
documented and significant; rate of child poverty is an issue of troubling concern. He observed that 
there is more to be done before actualizing the building. 
 
Trustee Busheikin remarked that the Public Hearing had been constructive. She responded to concern 
regarding the density transfer aspect of this application, indicating that this collaboration of parties will 
obtain the land which is the difficulty, result in a lasting project addressing a community need. She

explained that the density transfer does not increase density, rather moves them from one area to 
another.  
 
Chair Fast agreed on the value of this project, noting that communities need all sorts of people and all

have been many communications with those including at the Public Hearing, personally as a Trustee, the 
Advisory Planning Commission response, and through Denman Housing Association. She did recognize

10.1 Denman Island Farming Regulation Review Project - Staff Report - for decision 
Planner Zupanec presented the Staff Report that asks the LTC to consider endorsing a 
special LTC meeting to review the consultant’s findings and review proposed next steps. 
She suggested that the meeting could be held electronically with a limited agenda 
including the Farming Regulation Review project and a Town Hall.

special meeting for late June or early July to consider further steps in the Denman Island 
Farming Regulations Review project.

A Trustee commented that there is significant community interest in the topic of 
secondary dwellings and suites and there has been concern expressed that secondary

dwellings on ALR lands may not be used for the intended purposes of farm staff housing, 
extended family housing, or stable housing for community members.  Staff was asked to 
consider if there are tools or ways to shape the regulations to ensure secondary 
dwellings on ALR lands are not used for other purposes. 
Trustees suggested that discussing agenda item 11.1 at this time might be warranted. 
Trustee Busheikin declared a potential conflict of interest due to her position as a Director of Triple Rock 
Land Cooperative and left the meeting at 1:45 pm. 
Planner Zupanec advised that the email from R. Dickson on behalf of Triple Rock Land 
Cooperative (TRLC) requests expanding the scope of the Farming Regulations Review 
Project Charter to include a site specific zoning amendment for their parcel. She 
reported that this would normally be a site specific application, and has not been 
included as a part of the consultant’s work contract. 
LTC members discussed the request and process, noting that public consultation has 
already begun on this project, and expressed the preference to conduct and complete 
the Farming Regulation Review project as planned, and to look at individual properties 
on a separate basis. 
DE-2022-066

that the Denman Island Local Trust Committee request staff to write to the Triple Rock 
Land Cooperative advising them that the Local Trust Committee has decided not to 
proceed with an amendment to the Denman Island Farming Regulations Review Project 
Charter at this time and that they are encouraged to make a bylaw amendment 
application.

that the Denman Island Local Trust Committee endorse the following text for inclusion 
in the 2021-2022 Annual Report for approval by the Islands Trust Council and 
submission to the Minister of Municipal Affairs & Housing. 
“The Denman Island Local Trust Committee (DEILTC) held four regular business 
meetings, three special business meetings and one special meeting/Community 
Information Meeting in the 2021/22 fiscal year, for a total of eight meetings. 
 
Work for this period focused on advancing two bylaw amendment applications for 
affordable housing projects and reviving the Denman Farm Plan implementation 
project. The DEILTC was also successful in acquiring Trust Council budget approval to 
advance an Official Community Plan (OCP)/Land Use Bylaw project in 2022/23 focused 
on housing. 
 
The DEILTC also amended their Fees bylaw and Meeting Procedures bylaw to allow all 
LTC meetings to be electronic when needed. 
 
From April 1, 2021 to March 31, 2022, staff reviewed 15 siting and use permits, one 
crown lease referral, one Agricultural Land Reserve referral, and two subdivision 
referrals in the Denman Island Local Trust Area for a total of 19 referral reviews.”

Trustee Busheikin advised that at the March 22, 2022 meeting Standing Resolutions 
regarding bylaw enforcement of unlawful dwellings was deferred. She advised that 
there is no staff report to reference, however, she did speak to Bylaw Enforcement staff 
and received their concurrence that this suggested change provides clarity and makes 
explicit the way enforcement is currently carried out.

that the Denman Island Local Trust Committee amend Standing Resolution No. 7.  
DE-2021-015: 
by adding the following: after d) “and that the Islands Trust will not issue eviction 
notices and will balance the need for bylaw enforcement compliance with consideration 
of personal and community impacts of the current housing crisis, seeking to avoid 
contributing to homelessness, and that site inspection for the purpose of gathering 
information and communication with property owners will continue.” 
and 
by replacing the sentence "This Standing Resolution will be reviewed in one year's time" 
with the phrase "and that the Denman island Local Trust Committee may change this 
policy at any given time and may give direction to resume enforcement activities." 
 
Trustees debated the motion and expressed concerns regarding process, wishing to defer consideration 
of this resolution to a future meeting with Bylaw Enforcement input.  The motion was tabled and 
question on the motion was not called.
