[0:06:16] Voice 7: where you would do a regular business, I would think.

[0:06:19] Voice 7: And so I think as we look at the follow-up action list,

[0:06:23] Voice 7: this is a good opportunity to clean this list up.

[0:06:25] Voice 7: If there's some things that have been there, maybe events have gone, have addressed the issue at hand, or indeed indicating that no further information is needed and a future executive committee

[0:06:40] Voice 7: So I would encourage us as we go through there, through this list over the next few minutes, we just take a little bit of extra time and look at

[0:07:07] Voice 7: protection briefing uh i think that you know we've had some information come back from trust council

[0:07:15] Voice 7: Council we've had a letter back from the province this is a significant piece probably the next

[0:07:21] Voice 7: executive committee or yourselves are going to you could provide some direction we know we have

[0:07:26] Voice 7: a trust Council resolution to continue this work which would necessarily have a meeting a report

[0:07:34] Voice 7: for the executive committee associated with that there isn't an imminent report for you between now

[0:07:40] Voice 7: now in the end of term associated with this.

[0:07:43] Voice 7: So I don't know whether you want to have it stay there

[0:07:45] Voice 7: and be a signal to the next executive committee or not.

[0:07:49] Voice 7: And you can see the next two items are completed.

[0:07:53] Voice 7: So I'll just briefly turn to my CAO comments, is that okay?

[0:08:09] Voice 7: Well, thanks, primarily the last couple of weeks

[0:08:11] Voice 7: or last week uh certainly we spoke uh last week and there's an update at the teleconference but

[0:08:16] Voice 7: it's been working towards uh the orientation process um developing the the first session

[0:08:25] Voice 7: and syncing it with the second i've had some good conversations with anita and it's looking like

[0:08:32] Voice 7: his offering now is an electronic offering um and uh he he thinks it's best served in sort of a

[0:08:40] Voice 7: a half day, two to three hour chunk.

[0:08:43] Voice 7: And at this point it's being tentatively scheduled

[0:08:47] Voice 7: for the eighth or the last day

[0:08:49] Voice 7: of the second session of Trust Council.

[0:08:54] Voice 7: We're working, or let's correct that,

[0:08:56] Voice 7: Laurie's working with the hotel

[0:08:58] Voice 7: around the specifics of the inaugural,

[0:09:01] Voice 7: the first day on the 17th

[0:09:03] Voice 7: and the specific associated with that,

[0:09:07] Voice 7: as well as the First Nations Address

[0:09:09] Voice 7: and a First Nations session to be provided early on the second day.

[0:09:16] Voice 7: So with that, that's a moving target.

[0:09:18] Voice 7: I think our work on the actual orientation process itself,

[0:09:22] Voice 7: we have some key themes or principles as opposed to an overarching

[0:09:28] Voice 7: this is everything that exists in your world from a legal context.

[0:09:33] Voice 7: It's more about getting up and getting going.

[0:09:35] Voice 7: and then so that's going to be the key theme practicality simplicity opportunities for

[0:09:41] Voice 7: trustees to get together so there's some rhythm and room in the in that first three-day session

[0:09:48] Voice 7: and then we'll bring the the heavy concepts as time goes on

[0:09:56] Voice 7: so there's been that work

[0:10:01] Voice 7: and really I would leave it there and respond to any questions from an elections perspective

[0:10:06] Voice 7: I've had very few calls we've sent out a couple emails just guardrail emails around

[0:10:14] Voice 7: you know incoming trustees and use of potential any of the resources of the trust making sure

[0:10:19] Voice 7: that we're in a good place there and we had a great update from David yesterday around the

[0:10:25] Voice 7: the election process and we look like we're in a good stead.

[0:10:29] Voice 7: So with that, I'll respond to any questions.

[0:10:31] Voice 7: Just keeping my remarks brief today.

[0:10:33] Trustee Luckham: Thank you, CAO Hatchim-Pillard.

[0:10:41] Trustee Rogers: Thanks, I have a couple of questions.

[0:10:45] Trustee Rogers: One is, I feel like I've been at a time warp,

[0:10:51] Trustee Rogers: but I know there was a tentative agreement.

[0:10:55] Trustee Rogers: Have you heard anything as to whether

[0:10:56] Trustee Rogers: that big collective agreement's been ratified

[0:10:58] Trustee Rogers: or where it's at or what we might know or has it actually been ratified i don't think it has

[0:11:03] Trustee Rogers: my understanding it has not and do we know the time frame for that so we have some i

[0:11:14] Trustee Rogers: soon well soon would be a good thing um certainty

[0:11:22] Trustee Rogers: hear radio ads and uh and it confused me uh when i thought that there was a deal with that

[0:11:29] Trustee Rogers: it was still going on and certainly in fact how our how our budget is built um i think that's

[0:12:18] Trustee Fast: my question is whether we want to, when will we talk about the CAO's question regarding number one on his list, the forest protection, do we want to leave it there? Or do we want to ask him to take it off? I'm looking at page 10.

[0:12:40] Trustee Luckham: um yeah at the top there um well i think that that conclusion there would be whether or not

[0:12:48] Trustee Luckham: the work of council is done or or not or whether or not it needs to be advanced um ceo do you have

[0:12:54] Trustee Luckham: any remarks on sue ellen's suggestion there well

[0:12:59] Voice 7: i think mr chair that this is ec saying

[0:13:02] Voice 7: follow-up with this work yeah

[0:13:05] Trustee Luckham: and

[0:13:06] Voice 7: there has been some follow-up but the overriding direction from

[0:13:11] Voice 7: trust council still is in place yeah i

[0:13:16] Voice 7: think it's sort of self-evident that executive committee

[0:13:19] Voice 7: would be receiving a briefing on force protection as it matures so then the question is what is the

[0:13:28] impetus to continue work

[0:13:30] Voice 7: and i believe it's the trust council resolution to go and get

[0:13:34] Voice 7: until it's different to get section eight um authorities uh the conversations matured a bit

[0:13:44] Voice 7: with the province trust council's direction around section eight they're not warm to that one um

[0:13:51] Voice 7: but there might be the opportunity for a similar ability if there was a comprehensive

[0:13:56] Voice 7: a handsome alternative provided to the province around amending the act perhaps um and less about

[0:14:03] Voice 7: a direct section eight type of authority but i think that's going to be a conversation trust

[0:14:07] Voice 7: council is going to have as they're storming norming and working through their pieces so

[0:14:14] Trustee Fast: okay thank you that answers my question more now i think we'll see what the new trust council has

[0:14:20] Trustee Fast: to say in their strategic plan but i'd be in favor of uh leaving it there i was just checking

[0:14:27] Trustee Luckham: Right. That's worthwhile. And actually, if I don't see any other hands up, I'll get you to lower your hand, Sue Ellen.

[0:14:35] Trustee Luckham: I appreciate, Dan, that little summary you've just done there.

[0:14:41] Trustee Luckham: And that actually in and of itself is helpful and maybe is a helpful message that could be a memorandum or something,

[0:14:49] Trustee Luckham: thing, an information piece, short like you just did, that could go to a future council in order

[0:14:58] Trustee Luckham: for them to consider whether or not they want to keep this on the list or not. And then maybe that

[0:15:04] Trustee Luckham: would allow us to remove it from our follow-up action report. So I would just say that and leave

[0:15:11] Trustee Luckham: that there. And unless you wanted some direction from us, then that may or may not show up on our

[0:15:18] Trustee Luckham: next executive committee agenda and may or may not show up on a december council meeting um so

[0:15:25] Trustee Luckham: what do you think about that notion i

[0:15:29] Voice 7: think you should direct me to provide a briefing to the

[0:15:31] Voice 7: incoming executive committee regarding this the status of this project

[0:16:07] Trustee Rogers: Well, first of all, I know you probably misspoke you

[0:16:09] Trustee Rogers: that I summarized, but it was,

[0:16:11] Trustee Rogers: I don't want to take credit for Russ's good words.

[0:16:13] Trustee Rogers: and i was sitting here trying to figure out given i hadn't said anything what i said but

[0:16:18] Trustee Rogers: anyway my view is is that that's an okay way forward i would not remove like the issue of

[0:16:25] Trustee Rogers: protection at all from our work program because it's a correction of trust council

[0:16:30] Trustee Rogers: and you'll recall mr fair and i think the report out was that well there was a recommendation from

[0:16:37] Trustee Rogers: from the RPC to trust council to remove it as part of the trust policy

[0:16:43] Trustee Rogers: statement.

[0:16:44] Trustee Rogers: The context of that was that doesn't mean we can't continue on in other

[0:16:49] Trustee Rogers: forums besides the trust policy statement to advocate for this kind of tree

[0:16:53] Trustee Rogers: protection. It just may be more Island specific.

[0:16:57] Trustee Rogers: And I think it's obviously a far more, I wouldn't say far more.

[0:17:01] Trustee Rogers: It's a,

[0:17:02] Trustee Rogers: it's a more current and pressing issue on some islands than it is on others

[0:17:06] Trustee Rogers: where it's seen as a problem so i could um say i guess i could try and make something up as i

[0:17:15] Trustee Rogers: move that the executive committee remove activity one from the cao follow-up action list

[0:17:24] Voice 3: and add, quote, the CAO will provide a report to the incoming executive committee on the status of a request to the province for authority to do forest protection.

[0:19:14] Voice 1: executive committee, probably a prioritization of the policies and which ones need to be

[0:19:22] Voice 1: updated sooner than later. So I'll be doing that assessment as soon as possible. So that's it for

[0:19:51] Voice 1: local governments across British Columbia. So, everybody has the opportunity. Polls open

[0:19:56] Voice 1: open 8 till 8 today. And then there'll be some optional ones available for local trust

[0:20:05] Voice 1: committees, local trust areas. Probably not on all the islands, but definitely in the

[0:20:11] Voice 1: regional district close proximity next week. And then the general election day is Saturday,

[0:20:17] Voice 1: October 15th. So we are getting ready for welcoming the newly elected and acclaimed

[0:20:24] Voice 1: trustees. So we're busy getting a letter with information that you need to know out to them

[0:20:31] Voice 1: as soon as we can after October 15th. That will depend partly on how close the races are in some

[0:20:39] Voice 1: of the trust areas. So we'll see how that goes. We'll also be updating our website to reflect the

[0:20:47] Voice 1: results of the election on the close of polls on October 15th. And then we're planning for

[0:20:53] Voice 1: the swearing in ceremony which will be on november 17th as well that's really all i have and any

[0:21:00] Voice 1: questions i'll try to answer them

[0:22:55] Voice 7: points um with you know today you're going to get the first blush of some recommended budget items

[0:23:02] Voice 7: and you're going to have some comments um for us going forward that's going to go towards um the

[0:23:09] Voice 7: first draft of the budget it's unlikely it's going to be ready in its uh full form for um the meeting

[0:23:15] Voice 7: the fpc meeting so that will go to the first ec meeting after um the taking of the oath on the

[0:23:24] Voice 7: 17th 18th 19th for some comments by executive committee so that's the more full budget

[0:23:31] Voice 7: and um subsequent to that it's going to go to fpc the week after and from fpc there will be

[0:23:38] Voice 7: a recommendation for a provisional budget going to the december 8 9 10. that's the that's the

[0:23:45] Voice 7: primary piece of work as julia rejoins us and it is uh weighty as uh she pulls all those together

[0:23:53] Voice 7: so I think that's what she would communicate to you there is going to be an FPC meeting but it's

[0:39:26] Trustee Fast: about whether people think that Bowen Island Municipality

[0:45:46] Trustee Rogers: other things um and had a good meeting we then canceled the last meeting of the year uh on

[0:45:54] Trustee Rogers: galliano which would have been sometime before trust council but it was like november the 8th

[0:46:00] Trustee Rogers: so that meeting is uh not going ahead um and then on the 29th no i don't know yeah 29th of september

[0:46:12] Trustee Rogers: i last thursday i was on gabriola um for what i thought might be the last local trust committee

[0:46:20] Trustee Rogers: um we had a very fulsome agenda including um uh moving forward with the ecological protection

[0:46:28] Trustee Rogers: zone on the island dealing with a couple of applications uh there's a a lot of discussion on

[0:46:36] Trustee Rogers: on Gabriela related to an adaptation of the Salt Spring

[0:46:43] Trustee Rogers: RWM around enforcement on unlawful dwellings

[0:46:49] Trustee Rogers: that I gather has been through Salt Spring and North Pender.

[0:46:53] Trustee Rogers: We had a very long discussion

[0:46:55] Trustee Rogers: and lots of submissions around that.

[0:46:57] Trustee Rogers: There's a staff report that you might want to see

[0:47:00] Trustee Rogers: trustee Patrick from the bylaw enforcement

[0:47:03] Trustee Rogers: recommending alternative language it's been referred back to the HAPC and to the APC for

[0:47:46] Trustee Rogers: the on the um agenda for the next local trust committee um and then we had a long discussion

[0:48:43] Trustee Rogers: invited. We had an Indigenous Truth and Reconciliation event. It was a gathering

[0:48:54] Trustee Rogers: over at Keats Camp with Squamish elders by the name of Wendy Charbonneau who

[0:49:01] Trustee Rogers: sang a quite powerful trilogy that had been written for her or written with her

[0:49:10] Trustee Rogers: and storytelling about her upbringing in North Vancouver as a member of the Squamish.

[0:49:15] Trustee Rogers: She was a residential school survivor.

[0:49:57] Trustee Patrick: Good morning, good morning. I had a North Pender meeting last Thursday.

[0:50:06] Trustee Patrick: there was um a development permit on little shell island it's a very small island that

[0:50:16] Trustee Patrick: had changed hands roughly within the last year the owner um despite no information being shared

[0:50:28] Trustee Patrick: with the owner regarding potential for archaeological site the owner did due diligence

[0:50:33] Trustee Patrick: agents hired went to the archaeological branch got himself educated they did a study and also

[0:50:40] Trustee Patrick: found that there was a burial ground that was an imminent danger of it was being eroded away

[0:50:47] Trustee Patrick: he proceeded he got a heritage permit and then got talking with the island's trust staff and

[0:50:57] Trustee Patrick: worked through the various development permits and things that needed to have for the for the

[0:51:01] Trustee Patrick: project as well as contacting the say out and had a letter from say out full agreement to

[0:51:07] Trustee Patrick: to do immediate restoration on that site to protect it from further erosion

[0:51:14] Trustee Patrick: the the planner did give the trustees a heads up in the summer that this permit was coming and that

[0:51:20] Trustee Patrick: highly likely when that the permit finally was in their hands that the restoration work was likely

[0:51:25] Trustee Patrick: going to be well underway, if not completed, when they received the application due to

[0:51:31] Trustee Patrick: the urgency of getting the repair, the protection in place for this low-lying burial ground.

[0:51:40] Trustee Patrick: That indeed was the case when we saw the permit last Thursday.

[0:51:44] Trustee Patrick: The owner and his consultant had flown in to be at the meeting and present, very engaged

[0:51:51] Trustee Patrick: in understanding of the island.

[0:51:54] Trustee Patrick: where trustees were were a little rough on them because of the the fact that the work had already

[0:52:01] Trustee Patrick: started and they were a little little rough on staff as well of why why they were seeing this

[0:52:05] Trustee Patrick: in such a delayed state however when we had our development permit delegation by law later in the

[0:52:14] Trustee Patrick: meeting they chose not to move on it so that continues to be a challenge there there was

[0:52:21] Trustee Patrick: Also, Sydney Island, there's been a change in the strata governance there, or the people that are managing the island, as well as they've seen changes since the pandemic.

[0:52:35] Trustee Patrick: Sydney Island has had much, much greater interest and growth on the vacant lots that were there, and they have requested a kind of a cleaning up of some of the issues in the land use bylaws, primarily around the use of trailers on the property,

[0:52:57] Trustee Patrick: as well as they have some common cabins for lack of another word that are in the common land that

[0:53:05] Trustee Patrick: they wanted to be able to increase because they were finding because people there were no you

[0:53:11] Trustee Patrick: know there's no temporary place for someone to to stay when they're deciding what to do with their

[0:53:17] Trustee Patrick: lot and how to develop it that they you know people were hauling on trailers and various

[0:53:22] Trustee Patrick: equipment and they wanted to put some controls around that so I think it's good to see the

[0:53:29] Trustee Patrick: ongoing relationship with the Sydney Island Strata and cleaning up some of these these issues

[0:53:37] Trustee Patrick: and as I as I said the development the delegation of development permits did not occur and has been

[0:53:48] Trustee Patrick: deferred to the new term they do have one more meeting coming up on october 27th they had earlier

[0:53:56] Trustee Patrick: in the meeting decided that they didn't want any conversations on the land use bylaw to occur in

[0:54:01] Trustee Patrick: that meeting and then they changed their minds and they want to do some house further resolutions

[0:54:07] Trustee Patrick: to leave leave the land use bylaw in a kind of state of their you know where they would like to

[0:54:15] Trustee Patrick: to see it um for the next term i will not be able to chair that meeting on october 27th as i'll be

[0:54:22] Trustee Patrick: away um i'm hoping so well and fast is my backup person it will be a virtual meeting we did we did

[0:54:28] Trustee Patrick: move that to be a virtual meeting on the 27th and of course the october 1st meeting that was going

[0:56:19] Trustee Luckham: by two advocacy groups, I guess,

[0:56:23] Trustee Luckham: would be the way to phrase it,

[0:56:25] Trustee Luckham: is a lot of concern expressed about the ongoing work

[0:56:30] Trustee Luckham: on what are now Malahat lands at the old Bamberton quarry site,

[0:56:35] Trustee Luckham: as apparently there's some clear cutting going on on the side of the mountain

[0:56:40] Trustee Luckham: and a lot of concern about erosion and contaminants blowing into Saanich Inlet.

[0:56:52] Trustee Luckham: Anyway, I'll just leave that there.

[0:56:53] Trustee Luckham: The other item, happy to talk to anybody further about the details of it,

[0:56:59] Trustee Luckham: but the other item was the biosolid waste disposal from the sewage effluent

[0:57:05] Trustee Luckham: that's processed that was originally planned to be trucked by barge to some other location for

[0:57:13] Trustee Luckham: proper disposal or use or recapturing the fuel or energy content of such waste. That apparently

[0:57:26] Trustee Luckham: has not been successful. So the bulk of that is actually getting re-diverted to the Heartland

[0:57:31] Trustee Luckham: on dump. And that has a lot of folks upset as well. There were a couple of other items on the

[0:57:39] Trustee Luckham: agenda, one of which that I spoke to, and in fact, just really acknowledged the work of John Rowe

[0:57:49] Trustee Luckham: and the Dead Boat Society. He gave a presentation and an update on the work that they've been doing,

[0:57:54] Trustee Luckham: which is obviously ongoing, but did take the opportunity to stand up

[0:58:01] Trustee Luckham: and acknowledge the championing work that John Rowe has done all these years.

[0:58:09] Trustee Luckham: And that received a hearty length of applause and thanks to John Rowe

[0:58:18] Trustee Luckham: for all the work he's done all these years.

[1:02:35] Trustee Luckham: implements a maximum dwelling unit size and provides the opportunity to increase density

[1:02:41] Trustee Luckham: for farm worker housing on non-agricultural land by utilizing unrealized subdivision potential.

[1:02:50] Trustee Luckham: So this went to a public hearing. Certainly, we had some feedback, and that's listed here,

[1:02:59] Trustee Luckham: but the LTC is choosing to advance this. So certainly, we'd seek any questions.

[1:04:33] Trustee Luckham: Well,

[1:04:35] Trustee Patrick: I think this piece came, as you know, we have lots of farms that are farms that are not on ALR, but are still critical to the rural nature of what our islands are.

[1:04:46] Trustee Patrick: And the farm families there, they're still concerned about how generational transfer of farms, how do they get the dwellings that they can have.

[1:04:56] Trustee Patrick: And so this was a way of addressing that by, because we, it does two things to try to keep those farms whole, but a lot of them have subdivision potential. So this offered them an opportunity to exchange by through covenant, sort of give up that subdivision potential and exchange that for dwellings in the hopes that it remains the farm whole and gives additional dwellings to allow that generational or farm worker housing.

[1:05:26] Trustee Fast: Thank you. Saying exchange by covenant clarifies that for me because it wasn't, I couldn't get it.

[1:05:34] Trustee Fast: Okay, thank you. And then on page 20, the comments from the Agricultural Land Commission speak about inconsistencies with bed and breakfast uses in the ALR.

[1:07:27] Trustee Rogers: Or at least that's the way I understand it. But as I understand it, you at the end of the day, this only addresses housing related to agriculture. Am I correct? There, I see Trustee Patrick.

[1:07:43] Trustee Patrick: Yes, this was, this actually was a staff initiated project when the ALC changed their housing permissions.

[1:07:54] Trustee Patrick: and um and so you know the project from the beginning was more or less just trying to

[1:08:01] Trustee Patrick: catch up with what the ALC now allowed and through our ongoing we we have uh you know

[1:08:08] Trustee Patrick: worked hard to improve the communications with the agricultural community on the island we hold

[1:08:12] Trustee Patrick: four meetings a year especially with them um I think they they want to address a lot more than

[1:08:19] Trustee Patrick: the issues from the ALC. So this project will not end the day with working on agricultural

[1:08:25] Trustee Patrick: housing on the island. It resolves and brings the two rules closer together, but we still need to

[1:08:33] Trustee Patrick: do more work to resolve the ongoing challenges of how do we get more farm workers on this island

[1:08:38] Trustee Patrick: that can be housed.

[1:08:41] Trustee Rogers: But at the end of the day, am I correct that this, other than the maximum

[1:08:46] Trustee Rogers: square footage it only addresses agricultural house correct

[1:08:50] Trustee Patrick: yes the the

[1:08:51] Trustee Patrick: farmlands i think they

[1:08:53] Trustee Patrick: have to have their bona fide you know something so there's a test okay

[1:08:58] Trustee Rogers: so my other question i'm

[1:08:59] Trustee Rogers: just curious how the 500 meters maximum house size got put in here because that as i understand it

[1:10:51] Trustee Rogers: it's 231 and 232 was a very i'll call it a very short project of the ltc we got to the beginning

[1:10:59] Trustee Rogers: of this year and said well we have a little bit of space on our agenda what can we do

[1:11:02] Trustee Rogers: uh there were four identifiable f1 lots forestry one lots on galliano um which for a variety of

[1:11:12] Trustee Rogers: reasons um we thought could be put into nature protection um they're either owned by the crown

[1:11:19] Trustee Rogers: or owned by the Conservancy, they were still zoned F1, though.

[1:11:25] Trustee Rogers: And so we did this project to take these four large lots on the island

[1:11:30] Trustee Rogers: and we rezoned them to nature protection.

[1:11:35] Trustee Rogers: And that's what this does.

[1:11:36] Trustee Rogers: It was well received on the island.

[1:11:42] Trustee Rogers: And as a result, they've now been rezoned.

[1:11:46] Trustee Rogers: And the only question that came up, I will say,

[1:11:48] Trustee Rogers: that came up a couple of times more than once uh and it's clearly understood is that rezoning them

[1:11:54] Trustee Rogers: in this fashion has no impact on uh first nations claims on these properties or or whatever rights

[1:12:01] Trustee Rogers: they may have or whatever they're in it's simply a a use rezoning and of course we recognize

[1:12:07] Trustee Rogers: whatever their historical and um uh rights are etc so anyway and that question was asked and

[1:14:13] Trustee Rogers: housing project uh known as galley uh those that have been around the trust for a while would have

[1:14:19] Trustee Rogers: recognized this is the same land that galliano green used to be on which was a project of about

[1:14:25] Trustee Rogers: eight years ago uh this is a traditional i'll call it traditional whereas galliano green was a

[1:14:32] Trustee Rogers: unique sort of a project this was a traditional project for multi-family rental housing um and

[1:14:40] Trustee Rogers: And so these bylaws, so the land itself, it doesn't have to go to the minister because the land itself is already zoned community housing one.

[1:14:48] Trustee Rogers: What this does is provide for a bylaw that sets out the terms and the conditions of rezoning the land and allowing for this development.

[1:15:01] Trustee Rogers: It was extremely well supported in the community.

[1:15:05] Trustee Rogers: There were some questions mostly around water.

[1:15:08] Trustee Rogers: and a few people thought that it was too large because it's 20 units proposed 20 units however

[1:15:17] Trustee Rogers: it was well supported it was a very professionally done application with many of the reports and

[1:15:25] Trustee Rogers: there's water reports and and sewage reports etc and there's still work to be done obviously

[1:15:31] Trustee Rogers: The second bylaw is the then the housing agreement for this, which is similar to the one at the other Galeano project and similar to the one on Maine and it's a housing agreement that provides a framework for how these projects may be developed.

[1:15:51] Trustee Rogers: It's an interesting concept because one of the things we learned, as I think I've said before, is that proponents needed to have sufficient flexibility to access all sorts of funding.

[1:16:04] Trustee Rogers: I guess it's one thing to have the land.

[1:16:06] Trustee Rogers: It's another thing to have the funding to build this thing.

[1:16:08] Trustee Rogers: It contains two basic components.

[1:16:11] Trustee Rogers: It puts an income maximum on the property, and it also then puts a maximum rental structure on the property in the sense that it can't be above 30% of a certain units of a certain income threshold as comes from CPI.

[1:16:28] Trustee Rogers: So we have sort of those two controls.

[1:16:30] Trustee Rogers: There were questions about that, but at the end of the day, we know that whoever the funder is will put more specific controls on what the housing rental structure looks like.

[1:16:41] Trustee Rogers: and this is intended to ensure this doesn't become purely market housing and and uh it will stay with

[1:16:48] Trustee Rogers: a not-for-profit so that's what those two are i'm very pleased by this project uh this is the second

[1:16:54] Trustee Rogers: of the two affordable housing rezonings on on galliano thank

[1:33:05] Voice 7: That budget is seen in its broadest form as a draft budget.

[1:33:11] Voice 7: we would look to that being identified pre-Christmas because then we would take

[1:33:18] Voice 7: whatever whatever the budget recommendations are in terms of services

[1:33:25] Voice 7: and funding levels and you go out and have a budget consultation process over

[1:33:31] Voice 7: the next month or two of course as you can appreciate when you have it's not a

[1:33:37] Voice 7: complicating factor but it is a factor we have to consider we will have new trustees and we're going

[1:33:44] Voice 7: to have a process of walking through the budgetary responsibilities and the actual provisional or

[1:33:49] Voice 7: early draft budget hopefully we'll get to that point as a first blush of the budget by december

[1:33:57] Voice 7: 8th after we've done some some training and walking through the other council committees

[1:34:02] Voice 7: and put requests in and they've gone forward into the provisional budget and earlier today i talked

[1:34:09] Voice 7: about uh the development of that budget and it will go forward first in its full form um i think

[1:34:18] Voice 7: ec on november 23rd we'll get an initial look at it and it will also go forward to financial

[1:34:23] Voice 7: planning committee and that budget will have your comments um as it does as the other committees

[1:34:30] Voice 7: have provided direction to development programming so when we turn to you've

[1:34:38] Voice 7: got a report in front of you it's on page 127 and we can go through these or

[1:34:44] Voice 7: answer your questions some of these you be well versed in and of course we've

[1:34:49] Voice 7: got business cases associated with each of those you'll make this recommendation

[1:34:54] Voice 7: a future EC may or may not support or they will refine this list as they move

[1:34:59] Voice 7: move forward so it's this is an opportunity to ask some questions around

[1:35:05] Voice 7: the business cases to see whether you have support for all 12 of these or some

[1:35:11] Voice 7: subset of it and or provide us direction to get more information to develop a

[1:35:16] Voice 7: business case so this is an opportunity for your initial recommendations I don't

[1:35:21] Voice 7: know how you want to proceed I could kind of go through in general each one

[1:35:26] Voice 7: one of those, and we have the various managers available to you for the discussion. We could do

[1:35:32] Voice 7: a brief review of each one, or we could go into each of the business cases individually. How would

[1:35:39] Trustee Luckham: Well, my inclination is maybe to flag ones that vice chairs want to

[1:35:47] Trustee Luckham: speak to rather than maybe going through all of them, because indeed we are familiar with some of

[1:35:51] Trustee Luckham: of the requests, but I'm happy to do what the vice chairs feel is the most appropriate, but

[1:36:49] Voice 7: we reduced that budget somewhat and this is putting it back at a level where we

[1:36:53] Voice 7: think it's going to satisfy the need or that or the number of applications but

[1:36:57] Voice 7: we'll have to see as we move forward the reconciliation budget in the past it was

[1:37:03] Voice 7: also had a reduction associated with it this is an increase it reflects that the

[1:37:12] Voice 7: The Islands Trust is invested in its reconciliation work

[1:37:17] Voice 7: and it provides some administrative support

[1:37:20] Voice 7: and some support as we work through

[1:37:23] Voice 7: a process of major applications and different applications,

[1:37:30] Voice 7: providing some sort of funding associated

[1:37:34] Voice 7: with getting detailed work from nations if it's requested.

[1:37:37] Voice 7: it also provides some more robust funding for protocol if needed and really is the first time

[1:37:47] Voice 7: other than the staffing of the position that reconciliation budget is pressed in say $15,000

[1:37:55] Voice 7: so that's the rationale there the communications budget stays the same we've heard on a continuous

[1:38:01] Voice 7: basis. Probably if this was a communications focused budget you would

[1:38:07] Voice 7: see more. We have had comment for the last couple of years of course that

[1:38:11] Voice 7: communications really needs to be something that the Islands Trust focuses

[1:38:15] Voice 7: on in the future. You'll see the NAPTEP applications. We do have a new committee

[1:38:20] Voice 7: coming on board that we have to prepare for an accessibility committee so we

[1:38:25] Voice 7: have to plan for that and that will include people who are appointees outside of the

[1:38:30] Voice 7: islands trust so there's going to be some process associated with bringing them in we've got a gis

[1:38:36] Voice 7: layer that we need to update the policy statement amendment project this reflects a recommendation

[1:38:45] Voice 7: from trust programs committee where we're pre-first reading what would it look like as we

[1:38:52] Voice 7: get a more refined draft and it's brought forward i understand the trust programs committee wanted

[1:38:59] Voice 7: to have a another round of public engagement around that document before it came back to

[1:39:08] Voice 7: Trust Council in a first reading by law form that's what this represents and we can get

[1:39:13] Voice 7: the more detail if you want the contract management database I don't want to prioritize these but this

[1:39:21] Voice 7: is absolutely an important element that's missing here at the islands trust in terms of tracking

[1:39:28] Voice 7: and we're trying to sync all elements of the islands trust as we as we develop

[1:39:33] Voice 7: this this is a means a sophisticated means of organizing and sequencing the

[1:39:40] Voice 7: people that we work with reach out to that this is very important to the

[1:39:44] Voice 7: Conservancy as I understand they need a sophisticated piece of software that

[1:39:50] Voice 7: will allow them to contact donors and do their work the same can be said of our

[1:39:56] Voice 7: first nations contacts right now it's done on an ad hoc basis it's done thoroughly in some

[1:40:03] Voice 7: circumstances but having a trust-wide contract database would allow us to have organized

[1:40:09] Voice 7: conversations and relationships with everyone we deal with so that's why that's important um

[1:40:17] Voice 7: the bylaw portal licensing you'll recall that we did get significant funding in the 350 to 400 000

[1:40:25] Voice 7: dollar range for the provision of development application software what

[1:40:32] Voice 7: what an incredible opportunity that's allowing us to get current or past

[1:40:36] Voice 7: current it did not include a component for bylaw previously this was in front

[1:40:43] Voice 7: of Trust Council they chose not to move it forward I think this budget name has

[1:40:48] Voice 7: has now gone up $30,000 from the potential decision last,

[1:40:54] Voice 7: the last opportunity, the last time we discussed it.

[1:40:57] Voice 7: The digitization of paper records project,

[1:41:00] Voice 7: we're still working on a business case there.

[1:41:02] Voice 7: And there's two staffing requests.

[1:41:04] Voice 7: One is fairly well-worn, that's the meeting administrator

[1:41:07] Voice 7: for the provision of electronic meetings.

[1:41:10] Voice 7: We will see whether the incoming trust council

[1:41:12] Voice 7: had the same feeling that this trust council did,

[1:41:15] Voice 7: where and of course we lived through a pandemic that required a lot of this capacity development

[1:41:22] Voice 7: we'll see whether there's the same desire to have an ltc meeting basis this the ability to to have

[1:41:32] Voice 7: interactive electronic meetings if that's the case a meeting administrator the business cases

[1:41:37] Voice 7: is attached would be quite important there is also a request for an administrative coordinator

[1:41:46] Voice 7: hopefully the case is is developed in the business case that you see later on

[1:41:51] Voice 7: we are missing sort of that middle administrative oversight at the islands trust i think the case

[1:41:59] Voice 7: could reasonably be made that we have advanced many of the program areas of the trust but we

[1:42:04] Voice 7: have not advanced the administrative capacity of the organization this is an attempt to have that

[1:42:10] Voice 7: conversation with trust council this person would oversee the contract management work would assist

[1:42:16] Voice 7: with first nations administration we're doing enough first nations engagement that just the

[1:42:22] Voice 7: primary outreach is one element of that relationship building and working towards

[1:42:27] Voice 7: agreements but there's a whole bunch of administration that goes with that that in

[1:42:32] Voice 7: in its absence provides challenge.

[1:42:38] Voice 7: Standard operating procedures, of course,

[1:42:40] Voice 7: and we have at the direction of council

[1:42:44] Voice 7: and the requirements by the province,

[1:42:46] Voice 7: we have two new committees at the Allens Trust

[1:42:48] Voice 7: and we don't have any staff to take up

[1:42:51] Voice 7: those new committees at this point.

[1:42:52] Voice 7: If this doesn't go forward, which it may or may not,

[1:42:55] Voice 7: hopefully it does, we'll just be absorbing new work

[1:42:59] Voice 7: in reordering it and dropping some current work off which is an unfortunate reality and finally

[1:43:06] Voice 7: around there's some adjustments being provided around the grid levels around administration

[1:43:09] Voice 7: we've had really we've been running on grid nine compensation levels for the last number of years

[1:43:17] Voice 7: and i think we can reasonably make the case that the work has gotten more complex and

[1:43:23] Voice 7: there's more of it, and that should be reflected in some of the grid levels.

[1:45:11] Trustee Fast: keep track of all the different islands trust people who are and and letters and things like

[1:48:51] Trustee Rogers: executive committee in a time when the election is, I wouldn't say dominated, but there's certainly

[1:48:57] Trustee Rogers: a lot of narrative out there that this, the organization needs to cut back. I've seen

[1:49:01] Trustee Rogers: campaigns that say, oh, we've got to cut 10% is a bit, I don't know, problematic for me to get my

[1:49:11] Trustee Rogers: head around so um so here's my question i have a question and one other comment first of all

[1:49:18] Trustee Rogers: um i saw in the trust policy statement a line item uh for plain speak contracting and

[1:49:29] Trustee Rogers: i are words to that effect i think that's what it says five thousand for plain language editorial

[1:49:38] Trustee Rogers: editorial services i i'm sorry i i guess i sort of rue the day that when you're at the pace i want

[1:49:45] Trustee Rogers: to tell you how to speak in plain language but perhaps that's something that i'm just a dinosaur

[1:49:51] Trustee Rogers: and can't get my head around um the other thing is i wanted to say was uh where is and where will

[1:50:00] Trustee Rogers: will live the Cultural Heritage Mapping Project because, as I told you, there was a bit of

[1:50:11] Trustee Rogers: a disconcerting comment from one of the staff at my Gabriel LTC that, oh, their understanding

[1:50:20] Trustee Rogers: is that project is sort of being, I don't want to paraphrase, but it didn't say shelved,

[1:50:25] Trustee Rogers: but may not go ahead and that's been a fairly high profile discussion point for me in a number

[1:50:33] Trustee Rogers: of occasions with various um with the first nations and local trust committees about how

[1:50:40] Trustee Rogers: that that project will provide for a a basis for engagement with first nations a particular

[1:50:48] Trustee Rogers: indigenous folk on on heritage cultural sites on the various islands and i've actually said that

[1:50:53] Trustee Rogers: to for a couple of first nations as well i said okay we don't need to build that into this project

[1:50:58] Trustee Rogers: because it's coming to the trust generally uh so can someone tell me where that project is is it

[1:51:05] Trustee Rogers: not here is it in the rpc is it uh or is it ours and what's the status of that so i can attempt

[1:51:13] Voice 7: to do that so i agree completely with your sentiment that that is an important piece of

[1:51:18] Voice 7: work we did stage one of that work and got our first report um i will be candid by saying we

[1:51:25] Voice 7: have had challenges moving forward with the second portion of that work meaning um the next phase was

[1:51:34] a relationship building with

[1:51:36] Voice 7: nations to the degree that we could provide a service to our

[1:51:41] Voice 7: land-use planning function but also to nations around the location of important

[1:51:49] Voice 7: cultural heritage areas and so forth moving forward into that project we have

[1:51:56] Voice 7: been unable to re-engage with the contractor to a degree where they feel

[1:52:01] Voice 7: comfortable working with us on that on that project because we can't assure

[1:52:05] Voice 7: sure that those, to the degree that they're comfortable, that those regulations will be

[1:52:13] Voice 7: put into place ultimately based on some intimate conversations with nations around specifics

[1:52:19] Voice 7: and then brought to a regulatory place by the Islands Trust and that that would be sustained

[1:52:26] Voice 7: over time, which indicates that we have to do a lot more work on a relationship basis

[1:52:31] Voice 7: and we have to probably success in this project which was very ambitious would

[1:52:38] Voice 7: will be to do a smaller version of it in a location with a nation that we've

[1:52:45] Voice 7: established trust with and thinks that this will be a benefit to as of course

[1:52:49] Voice 7: to the more wide-ranging second level of this project as it was anticipated last

[1:52:54] Voice 7: year so I wouldn't say it's the project as a whole has been is not in play the

[1:53:04] Voice 7: breadth that it was initially considered might be unrealistic and two we're gonna

[1:53:11] have to get a contractor if it's not the contract of the work on stage one to to

[1:53:18] help us redefine it and what we're gonna have to get a SEPA in place who can

[1:53:24] to assist us with that so between now and march um we'll we'll see whether we can get a more refined

[1:53:30] version um included in the budget process but that

[1:53:34] Voice 7: that's the frankly the status of that project

[1:53:36] right now it

[1:53:37] Voice 7: is important um it will be a tactile practical thing if we can pull it off at some

[1:53:43] Voice 7: point we may have gone into it with too much ambition um so

[1:53:50] Trustee Rogers: just two things one is i don't see

[1:53:54] Trustee Rogers: is is the SEPA position I guess is currently in the budget so it doesn't need to be budgeted

[1:54:00] Trustee Rogers: and second law I think that challenge is we're going to have to find a way to communicate that

[1:54:12] Trustee Rogers: to local trust committees and the trust council if if that challenge is going to be and I don't

[1:54:20] Trustee Rogers: disagree that perhaps it was overly ambitious i always wondered about it but um i'm not trying to

[1:54:28] Trustee Rogers: say that i was prescient or anything i just said i always wondered how we were going to go about

[1:54:32] Trustee Rogers: doing all of that um but uh i i think it's it's important because i as i said uh i have used it

[1:54:41] Trustee Rogers: as a number of occasions so if it's going to be pared down or it's going to be in a different

[1:54:47] Trustee Rogers: and I guess I don't want to know where it lives.

[1:55:21] Trustee Patrick: Yeah, I look at the reconciliation, the communications, and I look at the positions that you had said aren't in the budget and underneath and, you know, our challenges and that we've added the communications and engagement as well as First Nations engagement to the assumptions and principles for the budget.

[1:55:44] Trustee Patrick: it um and then i look at the uh trust policy statement big dollar item there and right in

[1:55:52] Trustee Patrick: the risks section it discusses the you know the risk of not having communication plans and all of

[1:55:58] Trustee Patrick: that um my hope is that you know communications and engagements is going to be strategically

[1:56:08] Trustee Patrick: of high importance i hope to the next trust council um and and and going forth and i and

[1:56:14] Trustee Patrick: And I just look at, you know, are we arranging the money around the right asks?

[1:56:20] Trustee Patrick: What, you know, it's sort of the what, the chicken and the egg there.

[1:56:23] Trustee Patrick: What comes first?

[1:56:25] Trustee Patrick: You know, if we don't have a robust communications plan and we don't have an engagement strategy

[1:56:32] Trustee Patrick: doing these large projects without that, just carry on being, you know, at risk as it identifies

[1:56:39] Trustee Patrick: itself in the trust policy statement.

[1:56:41] Trustee Patrick: So that's what I know. Well, I know the Reconciliation Action Plan and we're devoted to it, but even it's getting a few years old, are the priorities in the right place? Are we working on the things that will give us the most benefit to improving our relationships?

[1:57:00] Trustee Patrick: And I think of the referral process and is that the highest priority? Where are we going to move, address some of these major challenges? Because I know here on Salt Spring, we need to address how we communicate with First Nations, how we, at the early stages of our project, how we fix this referral process so that it's effective and working.

[1:57:25] Trustee Patrick: working. And I don't know if we're the only island that's having this, I don't think so.

[1:57:31] Trustee Patrick: So that's, I'm just, I'm just worried that I don't, when I look at this, I mean, I generally

[1:57:36] Trustee Patrick: understand all of this, but I see some risks and potentially some efficiencies if we bundle

[1:57:41] Trustee Patrick: the engagement and communications and deal with it in an effective way that the other

[1:57:48] Trustee Patrick: projects will all benefit.

[1:57:54] Trustee Luckham: think justy patrick um any other remarks on this um otherwise how do we want to advance this

[1:58:22] Trustee Rogers: We can justify what I actually that's not true. You can justify all of those things, but we're not going to propose a communications manager.

[1:58:30] Trustee Rogers: We also know how challenging it's been to keep communications people at that particular and clear shop.

[1:58:39] Trustee Rogers: So my guess the question is, are you going to add something?

[1:58:42] Trustee Rogers: thing and i frankly i'm not really that comfortable by sending a hundred and forty thousand dollar

[1:58:49] Trustee Rogers: budget request on the trust policy statement to the tpc to the to the financial planning committee

[1:58:56] Trustee Rogers: um we've already i have to sit down and add it all up uh but we've already budgeted like

[1:59:07] Trustee Rogers: Like, I'm going to say pushing $400,000 on that project, $350,000,

[1:59:15] Trustee Rogers: and to add another $140,000 when we're hopefully near the end,

[1:59:26] Trustee Rogers: nearer the end than at the beginning anyway, is challenging for me.

[1:59:31] Trustee Rogers: And I appreciate that the senior policy analyst is gauged pretty much full time on this and that that puts a lot of stress on Claire with her team when she doesn't have other activities.

[1:59:46] Trustee Rogers: But I think the Trust Council, if it was me on Trust Council, I'd probably be going, you know what, if we have to put a pause on some other activities of trust area services while we complete that first draft.

[2:01:59] Trustee Rogers: a never-ending process is that something that just will always be in the budget and so therefore we

[2:02:05] Trustee Rogers: should just put in the budget and get over it or is it something that because i can remember

[2:02:10] Trustee Rogers: talking about this any number of times about about uh about this digitization and we always

[2:02:17] Trustee Rogers: always granted it. It was always somewhere between $8,000 and $12,000. Anyway, can someone

[2:02:23] Trustee Rogers: address that for me? Because it's surprising to me it's still there, but maybe it's an

[2:02:28] Trustee Rogers: ongoing expense that I somehow have overlooked.

[2:03:03] Voice 7: 40 boxes of material that could be digitized we could not say that we are a digital organization

[2:03:10] Voice 7: at this point to the degree we need to it's like Wendy when do we want to move

[2:03:19] Voice 7: forward you either dedicate a fair amount of funds at one time and we make

[2:03:23] Voice 7: it a major project of the organization will become a fully electronic

[2:03:26] Voice 7: organization which for us would be fantastic because we have so many

[2:03:30] Voice 7: different jurisdictions and so many requirements for storing paper or you do

[2:03:35] Voice 7: this version which is every year we we take a chunk of it and and develop it so that's the

[2:03:40] Voice 7: first consideration um thank you for actually going you know i think that the process by you

[2:03:46] Voice 7: going through these things and going what you're comfortable with and what you're not comfortable

[2:03:49] Voice 7: with or what's the opportunity cost of doing one thing and not the other is exactly it um

[2:03:56] Voice 7: the 140 000 for the policy statement project um claire may wish to speak to this or not i

[2:04:01] Voice 7: understand is was a direct request from trust programs committee to undertake some costing

[2:04:08] Voice 7: associated with and the request was another round of engagement between now and any formal

[2:04:24] Voice 7: a hundred and forty thousand dollars of further communications um that was something that was

[2:04:30] Voice 7: brought up at the staff table um around that around that work uh we know that there will be

[2:04:36] Voice 7: a subsequent round of referral and engagement after you get to a first and second reading

[2:04:42] Voice 7: perspective so there would be at this point two more engagement processes but um tpc is close to

[2:04:49] Voice 7: the to the project and um if there's some more thinking around that likely it'll happen in the

[2:04:57] Voice 7: next draft of the budget um in terms of communications and prior prioritization um

[2:05:05] Voice 7: yeah those are those are opportunity cost discussions that that we're having right now and

[2:05:12] Voice 7: um what you know if you if you're looking for that sort of capacity or refinement um and the

[2:05:19] Voice 7: numbers too big what do we remove from here to um bring that in um i think that's part of this

[2:05:25] Voice 7: conversation but uh claire would you say anything else around the the 140 000 i i do believe that

[2:05:33] Voice 7: this if this was added in we'd be in the 400 plus range for um engagement over the last couple of

[2:05:39] Voice 7: years on the project uh

[2:05:46] Voice 10: programs committee did make a couple of requests um the engagement component was not one of them

[2:05:50] Voice 10: we did hear that through the discussion at trust council that there were a number of trustees sort

[2:05:55] Voice 10: of indicating a desire for further engagement before first reading the specific requests from

[2:06:00] Voice 10: trust programs committee were for robust communication strategy and for plain language

[2:06:04] Voice 10: editorial for the specific requests on in your business case at the top it itemizes the various

[2:06:11] Voice 10: constituent elements um that make up sort of the the next phase of the policy statement work

[2:06:17] Voice 10: in there we've got thirty thousand for capacity funding for nations um twenty thousand for

[2:06:21] Voice 10: communication so that's 50 000 right there then 5 000 for legal 5 000 plain language which would

[2:06:27] Voice 10: take you to around 60 we ballparked 5 000 for graphic design and then we have sort of the other

[2:06:33] Voice 10: more discretionary pieces which would be the backfilling of the senior policy advisor for 40

[2:06:38] Voice 10: and then further engagement which we estimated at another 30 for just the engaging of local

[2:06:45] Voice 10: trust committees and other municipalities and getting contract survey design so if you were

[2:06:50] Voice 10: can you can you tell me what backfilling means that would mean hire someone else to come in and

[2:06:56] Voice 10: take on all the other duties of the senior policy advisor so we've been um cobbling along for quite

[2:07:01] Voice 10: some time now with me taking on a lot of those duties or a lot of the duties not happening so

[2:07:06] Voice 10: this is everything from advocacy work agreements work um assisting with you know all the various

[2:07:11] Voice 10: duties legislative monitoring all of that we've been juggling off side of the desk thinking that

[2:07:15] Voice 10: this project wasn't going to take the span of time that it's taken um and so i think we need

[2:07:19] Voice 10: to be more clear with council around the burden that that's having on colleagues to try and pick

[2:07:25] Voice 10: that work up so the policy senior policy advisor can really lead the policy statement project and

[2:07:31] Voice 10: undertake the focus that that project needs so that's what that would represent on the in the

[2:07:37] Voice 10: business case on page 137 of your package we've outlined a number of options around different ways

[2:07:44] Voice 10: to proceed and this is you know council has assigned this project to you with tpc so i think

[2:07:49] Voice 10: if there was a different direction that you wanted to recommend we could happily rewrite the business

[2:07:52] Voice 10: case to forward to financial planning committee if you wanted to take out for example the public

[2:07:58] Voice 10: engagement piece or the backfilling to reduce the costs that certainly is an option and those

[2:08:03] Voice 10: options are laid out there for you and we would rewrite it as requested

[2:08:48] Trustee Fast: there. I had a couple of other questions before we go on. I like the biologist position

[2:08:56] Trustee Fast: that's suggested there as the very last bullet. It's always strange to me how environment always

[2:09:01] Trustee Fast: comes at the very end of lists. But I think a biologist to assist professional planners

[2:09:12] Trustee Fast: planners, is a really good idea for an organization like ours.

[2:09:26] Trustee Fast: It's my understanding that BC Assessment has digital mapping and records that relate to

[2:09:34] Trustee Fast: the footprint of buildings.

[2:09:36] Trustee Fast: Is this something, I don't know if there's anybody there that can comment on this, but

[2:09:41] Trustee Fast: I see there's a consultant position.

[2:09:46] Trustee Fast: Has BC Assessment been approached about this?

[2:09:48] Trustee Fast: Because when I've talked to them about other kinds of mapping, they often have it.

[2:10:39] Trustee Luckham: So I'll just make a few remarks. Certainly, it's politically problematic to advance budget requests of this kind. However, I think what we have to really recognize here is that staff have told us this is what we need to do this work.

[2:11:02] Trustee Luckham: work and the thing that we struggle with the most is not funding the work that needs to be done

[2:11:07] Trustee Luckham: and it puts staff and the islanders trust in a position of compromise where um you know we

[2:11:15] Trustee Luckham: learned a lot through the pulse to date we learned an awful lot about what we do and particularly

[2:11:22] Trustee Luckham: about communications and particularly how expensive it is if you want to do it right

[2:11:27] Trustee Luckham: Um, and, um, it's, uh, uh, it's, uh, it certainly is, uh, a challenge to want to think that

[2:11:39] Trustee Luckham: we're going to, uh, ask for this much money, but it's also a challenge to think that we're

[2:11:43] Trustee Luckham: not going to do other work that Trust Area Services in particular normally does and hasn't

[2:11:50] Trustee Luckham: actually been doing, um, late because they, their energies have been redirected elsewhere

[2:11:56] Trustee Luckham: elsewhere with insufficient resources. And certainly there's been some staff issues with

[2:12:03] Trustee Luckham: absent seats and billing in. However, nonetheless, I just want to say that there is a cost. It is

[2:12:13] Trustee Luckham: expensive. It's not getting any cheaper. 10% budget reduction is interesting when what we're

[2:12:18] Trustee Luckham: seeing is um inflation is at eight percent um so that means you're going to do it 18 say a 20

[2:12:25] Trustee Luckham: reduction in in the work that we do at the end of the day because we don't have sufficient funding

[2:12:30] Trustee Luckham: for it so um however you know what this is is a draft it goes to fpc fbc can certainly

[2:12:39] Trustee Luckham: consider the request and come up with what they might recommend as a budget request and

[2:12:44] Trustee Luckham: in the big picture of things, it does strike me that I would want to be calling this a draft

[2:12:53] Trustee Luckham: recommendation from executive conversation. The only remark with all of the business cases I think

[2:13:02] Trustee Luckham: that I would make is that in the situations where there's the opportunity and language is used to

[2:13:08] Trustee Luckham: that effect throughout that, whether or not there's a staff position or a contractor position,

[2:13:13] Trustee Luckham: It might be beneficial to consider using contractors where we can. Certainly, there's additional costs associated with that, but there's also potentially some savings associated with that with respect to office space and those other kinds of things.

[2:13:32] Trustee Luckham: but I think what for me is that that sends a message that this is one-time work that will

[2:13:39] Trustee Luckham: get done and it's not an ongoing staff position which has always historically been the biggest

[2:13:45] Trustee Luckham: concern of council and if there's opportunity to change some of that language I'd appreciate that

[2:13:51] Trustee Luckham: but I'm also not about to make any amendments today to the document don't want to get into

[2:13:55] Trustee Luckham: to that level um so i would suggest we advance what's in front of us um and uh indeed it'll be

[2:14:03] Trustee Luckham: a future executive committee a future financial planning committee that will ultimately make the

[2:14:07] Trustee Luckham: decisions around what the next budget looks like but i don't think it hurts to tell that what we

[2:15:00] Trustee Rogers: we need that and that's fair i have no problem with that um i guess i'm a little concerned about

[2:15:05] Trustee Rogers: the compressed nature of what's going to occur between now and when the budget goes out to

[2:15:11] Trustee Rogers: uh to um public commentary there i guess there might be an fpc meeting after the election

[2:15:18] Trustee Rogers: there probably is there's probably a trust programs committee meeting but you might have

[2:15:23] Trustee Rogers: have a series of trustees that really are just really getting their feet under themselves as to

[2:15:30] Trustee Rogers: what it is they're going to be able to do. So I think it's really important we bring

[2:15:34] Trustee Rogers: more than the usual type of scrutiny to those requests, because the four of us have been around

[2:15:42] Trustee Rogers: for the last at least four years, in some cases much longer. And we've been around and watched

[2:15:49] Trustee Rogers: the budget evolve and uh so we i think it's important that we do bring a little bit more

[2:15:54] Trustee Rogers: scrutiny than i would normally say well i'll just send it off to fpc and they can decide what to do

[2:15:59] Trustee Rogers: with this this is our request so um i i think i'm fine with everything there uh except i have

[2:16:11] Trustee Rogers: another question what happens if we don't do number 10 what if we don't do the bylaw portal

[2:16:15] Trustee Rogers: portal licensing and implementation project?

[2:16:17] Trustee Rogers: What's the outcome of that?

[2:16:20] Trustee Rogers: I can speak to that.

[2:16:31] Voice 2: So the risk of not doing it, as I think you're aware,

[2:16:38] Voice 2: we were awarded in May,

[2:16:40] Voice 2: we were awarded the Local Government Development Application Program

[2:16:45] Voice 2: program funding grant totaling $370,000 to implement a new information system for the

[2:16:52] Voice 2: planning development application processing and includes a review of that process and so the risk

[2:16:59] Voice 2: of not proceeding with bylaw would be bylaw would then be separated from that process bylaw would

[2:17:06] Voice 2: remain in what we refer to as tapas a trust area property information system it's an in-house

[2:17:12] Voice 2: House developed application. It's antiquated in that the public has no access to it. So

[2:17:20] Voice 2: it's an information system which allows the bylaw officers to track

[2:17:26] Voice 2: tickets, the ticketing system, their ticketing system. The risk would be that the planners then

[2:17:33] Voice 2: have a development application system that includes a portal for the public to track,

[2:17:39] Voice 2: to do payments, to do transactions online, to communicate directly with the planners in regards

[2:17:45] Voice 2: to applications and such and by-law would then be I guess blocked out of that feature and that

[2:17:52] Voice 2: function. So what we're proposing is to bring them back together which was always the intention.

[2:17:57] Voice 2: We had hoped actually to bring by-law in initially into that grant but the granting body said

[2:18:02] Voice 2: this is specific to planning and development applications. So our intention was to bring by-law

[2:18:07] Voice 2: in next give them the portal give them the um the the transaction online transaction

[2:18:14] Voice 2: capability um and tracking for the public so it's really about bringing bringing the bylaw

[2:18:22] Voice 2: in finally or bringing them up to speed with the the planning and development application processing

[2:18:27] Voice 2: and then um ultimately retiring the tapas information system that we maintain in house

[2:18:34] Voice 2: And a last little piece to that is the ITC, the Conservancy is in that system as well, is currently being supported by TAPIS, and we're working for next fiscal to give them a new product called Landscape.

[2:18:51] Voice 2: So really, our goal is to retire TAPIS and moving bylaw into CityView, which is the application, is part of that process.

[2:19:04] Voice 2: of retiring so

[2:19:06] Voice 7: i guess the context is mark uh does the world end um if you know some context

[2:19:15] in terms of the decision making associated with this can we carry on can we not how significant

[2:19:19] is it i think that's

[2:19:21] Voice 7: some of the questions the considerations as the ec grapples with the numbers

[2:19:25] Voice 2: yeah i would say that the sky doesn't fall we can certainly carry on um we have we have in-house

[2:19:33] Voice 2: development skills so that we can maintain tapas and support it for the coming fiscal that's not

[2:19:41] Voice 2: a problem the the real problem is that it's disconnected so bylaw becomes disconnected

[2:19:48] Voice 2: from planning so that information system is no longer integrated currently before we do the

[2:19:55] Voice 2: implementation with city view for the development applications bylaw planning and itc are all

[2:20:01] Voice 2: integrated and what will happen if we don't proceed with this funding is we'll end up with

[2:20:07] Voice 2: three separate information systems for ITC bylaw and planning so it'll just be in my language

[2:20:17] Voice 2: kludgy or clunky in the the communications so bylaw will not be directly tied that information

[2:20:23] Voice 2: system will not be directly tied to the application system so it's it's certainly more work for the

[2:20:30] Voice 2: for the bylaw officers to sort of access tapas to to track their um ticketing their tickets

[2:20:40] Voice 2: their violations and then to go over to the to city view and that application and to to

[2:20:47] Voice 2: be aware of development applications associated with the product or property so it's just a

[2:20:53] Voice 2: disconnect that is not ideal ideally we're tightly coupled because well bylaw is part of planning

[2:34:38] Trustee Luckham: Thetis Island LTC hosted that meeting on the island this week.

[2:34:42] Trustee Luckham: in fact, on Monday. It was very well attended. That included a tour of the waterfront where

[2:34:50] Trustee Luckham: the ferry terminal comes in to address traffic and safety issues. And I've characterized it as

[2:34:58] Trustee Luckham: public safety, cultural safety, and spiritual safety, as all three of those elements exist

[2:35:08] Trustee Luckham: at that ferry terminal, one coming and going of vehicles and people that are at risk of being

[2:35:15] Trustee Luckham: injured by vehicular traffic. There's a trail that comes off of the ferry terminal that traverses

[2:35:23] Trustee Luckham: down to the beach, and it crosses a burial site of the ancestors of the Penelakut Nation, and

[2:35:30] Trustee Luckham: that's the cultural piece. We're desecrating that area by creating significant amounts of bank

[2:35:37] Trustee Luckham: bank erosion, as well as public safety, accessing a completely unsafe trail head to get to the

[2:35:44] Trustee Luckham: waterfront. And then the spiritual safety of individuals that are traversing across the tops

[2:35:50] Trustee Luckham: of those ancestors. There's definitely an element of risk associated with the health and well-being

[2:36:00] Trustee Luckham: of individuals who are trespassing on in that area and so um essentially all of the parties

[2:36:07] Trustee Luckham: agreed that they would uh would discuss this and we continue to advocate for improvements at the

[2:36:15] Trustee Luckham: ferry terminal here on theta sound with respect to those elements so that's just out there i want to

[2:36:20] Trustee Luckham: thank some of the staff that were involved in helping us pull that meeting together particularly

[2:36:24] Trustee Luckham: Claire pulling the Zoom part together at the last minute. And if the future LTC will advise you on

[2:41:38] Trustee Luckham: make a remark however with respect to this letter that letter was received by me addressed to me

[2:41:46] Trustee Luckham: alone i have advice that tells me that that letter would have not been copied to anybody else

[2:41:54] Trustee Luckham: and that the province does not blind carpet copy let correspondence of this nature

[2:42:01] Trustee Luckham: and would not have been circulated to anybody else, other agencies, without it being identified

[2:48:42] Trustee Rogers: that whoever the property owner is is ignoring orders or ignoring is the wrong word not following

[2:48:49] Trustee Rogers: the directives of the CVRD and that's why they're going to court over this whole thing and I see

[2:48:53] Trustee Rogers: trustee fast who's the chair there nodding along and thus it has escalated um so thank you i

[2:49:37] Trustee Luckham: only say I'm sure there may be some great aspects to the report. It is disappointing. And in fact,

[2:49:44] Trustee Luckham: Anchorage is only mentioned once in a link. Somebody came up with a phrase called

[2:49:54] Trustee Luckham: called Vessels That Rest, and they have completely ignored the entire issue, in my mind.

[2:50:04] Trustee Luckham: Certainly, it's mentioned in a couple of graphics as an impact, but I don't think that it was

[2:50:15] Trustee Luckham: addressed as a cumulative effect, which I think, and in fact, the community, although there's a

[2:50:26] Trustee Luckham: number of graphics that indicate interested parties, community is not mentioned as one of

[2:50:31] Trustee Luckham: those parties that's interested. And I just feel I just needed to say that. And I don't know,

[2:50:38] Trustee Luckham: Claire, if you've had the chance to analyze this report at all, and would definitely seek your

[2:50:44] Trustee Luckham: your advice, what sort of a response we might make with respect to a lot of things that might

[2:50:51] Trustee Luckham: be contained in that report. But given that this is specifically to do with marine shipping,

[2:50:58] Trustee Luckham: the cumulative effects of vessels of anchor in the Salish Sea.

[2:51:03] Voice 10: I have not had time to look at it yet.

[2:51:05] Trustee Luckham: Yeah. And I knew that was the answer and I know why. And I appreciate and respect that.

[2:51:15] Trustee Luckham: I might suggest that this, perhaps that's what I think should happen, is that this report should

[2:51:25] Trustee Luckham: be forwarded to a future executive committee to consider its interest in marine shipping.

[2:51:34] Trustee Luckham: So if there's no objection to that, and this is a future executive committee,

[2:51:41] Trustee Luckham: I'll do that by general consent if that's all right.

[2:51:45] Trustee Luckham: I'm not seeing any opposed, so let's do that.

[2:51:48] Trustee Luckham: And hopefully I'm around to speak to it at some point.

[2:51:53] Trustee Luckham: Endorsement, that was already sent.

[2:51:55] Trustee Luckham: So the next one here I wanted to speak to, 10.7.

[2:52:00] Trustee Luckham: And certainly, Trustee Bouchakin, her remarks are welcomed.

[2:52:05] Trustee Luckham: That was a difficult moment at council.

[2:52:07] Trustee Luckham: Council. And indeed, the advice that I was provided at the moment when a disruption in our

[2:52:21] Trustee Luckham: process began, I did have advice from staff that was out of order and that the process

[2:52:30] Trustee Luckham: was not being respected. Quite honestly, the aggressive nature of the trustee

[2:52:38] Trustee Luckham: could have sent us down an avenue of some kind of dispute, ongoing dispute, of which

[2:52:49] Trustee Luckham: I was not prepared to be bullied. I may have inadvertently allowed counsel to be bullied,

[2:52:58] Trustee Luckham: but it's something that one can give if one wants to. And in that situation, I made the ruling that

[2:53:05] Trustee Luckham: that I did, because I wasn't prepared to escalate what appeared to me to be the hostility that was

[2:53:11] Trustee Luckham: being created. And so in respect of our process going forward, and the composure of our council,

[2:53:19] Trustee Luckham: we move forward. I did ask council, specifically, if anybody wanted to overturn the chair,

[2:53:26] Trustee Luckham: the ruling of the chair, which is indeed part of the process. And nobody chose to overrule the

[2:53:31] Trustee Luckham: the chair. I wouldn't have been unhappy if that had happened. And so business continued on in

[2:53:38] Trustee Luckham: admittedly a little bit of a fractious moment. And indeed, we spent 45 minutes of valuable time.

[2:53:46] Trustee Luckham: That's a lot of hours if you add up all the time of everybody, including staff that were sitting

[2:53:51] Trustee Luckham: there, that indeed, fortunately, we were able to conclude our meeting that day without too much

[2:53:58] Trustee Luckham: much time. But I did want to respond to the letter. I want to thank Trustee Bush-Sakin for

[2:54:02] Trustee Luckham: raising it. And I will certainly consider that as I move forward in any decisions that I, or

[2:54:09] Trustee Luckham: opportunities I have to make decisions of that nature. And certainly anybody else in this role,

[2:54:15] Trustee Luckham: I would suggest that they consider the dynamics of these kinds of situations that arise.

[2:54:21] Trustee Luckham: eyes that's all i have to say dan rogers um

[2:54:26] Trustee Rogers: thank i think it's important to note the recommendation

[2:54:29] Trustee Rogers: that perhaps the uh what was it i think very um um i don't like what's the right word well

[2:54:41] Trustee Rogers: not not particularly well thought out suggestion in the governance report about a secretary

[2:54:47] Trustee Rogers: uh to the trust council but i thought we're trustee bushaken's making a very interest a

[2:54:54] Trustee Rogers: good suggestion that part of what was contemplated by that what would be a new position could be

[2:54:59] Trustee Rogers: filled by the director of legislative services um it is not an unusual phenomena as we all know

[2:55:07] Trustee Rogers: at local governments to have somebody sitting with the chair uh i think it happens at bowen

[2:55:12] Trustee Rogers: for example i think the i don't know if the cao or somebody else that sits with the with the chair

[2:55:18] Trustee Rogers: and advises in in real time as to how to handle issues as they come up i've seen it there it

[2:55:24] Trustee Rogers: probably occurs elsewhere and i think it might be a very useful uh suggestion that the director of

[2:55:31] Trustee Rogers: legislative services could uh could take that role on uh as part of and incorporate some of

[2:55:38] Trustee Rogers: of the suggestions from the governance review as to other so thanks i wanted to thank trustee

[2:55:43] Trustee Rogers: because she was not just suggesting there was a problem uh which she did suggest there was a

[2:55:50] Trustee Rogers: problem but she also suggested a potential way forward so thanks to her for that

[2:55:55] Trustee Luckham: sure and thank

[2:55:57] Trustee Luckham: you dan but i would like to recognize that indeed the legislative director of legislative services

[2:56:03] Trustee Luckham: did provide that service and did provide that advice in real time in the meeting, I chose to

[2:56:15] Trustee Rogers: wasn't suggesting staff didn't do it. I'm just

[2:56:18] Trustee Rogers: suggesting it could be a more formalized process. My experience in the last eight years is it's a

[2:56:23] Trustee Rogers: bit ad hoc. And occasionally we look to it, but I think if we inculcated it into the process of

[2:56:31] Trustee Rogers: trust council you could get you would get some acceptance from the trust council that that kind

[2:56:37] Trustee Rogers: of um advice from staff of a person specifically designed to give it would be more acceptable to

[3:05:45] Voice 7: think that's it and this that could always change that's why there's a meeting on the last day the

[3:05:50] Voice 7: saturday um the 19th in case there's a different perspective but uh you'll recall at least for one

[3:05:58] Voice 7: committee there was too many people who wanted to be a member of it so there's some decisions

[3:06:02] Voice 7: and discussions had to be made that's hard to make those in a very very short period of time

[3:06:06] Voice 7: and some would say that committee appointments four or five days in is pretty quick anyway so

[3:06:12] Voice 7: um that's uh one point and the other final point um that if you'll allow me is

[3:06:21] Voice 7: there's a number related to the calendar but not to this particular issue which hopefully you're

[3:06:28] Voice 7: going to agree with this recommendation is that there's a number of uh trust council meetings

[3:06:33] Voice 7: that I mean local trust committee meetings in November post-election that

[3:06:40] Voice 7: we are reaching out to the local trust committees to consider whether they want

[3:06:44] Voice 7: to hold those meetings or not given the obvious challenge associated with well

[3:06:51] Voice 7: there's current trustees in place they may or may not have run or be the the

[3:06:56] Voice 7: representatives to the future so I'm just going to briefly summarize the

[3:07:01] Voice 7: The South Pender meeting on November 4th

[3:07:03] Voice 7: is potentially being not moved forward.

[3:07:06] Voice 7: The meeting just before the old taking on Salt Spring

[3:07:11] Voice 7: on the 15th, obviously the meeting on Gambier,

[3:07:15] Voice 7: which is the day of the trust council session,

[3:07:17] Voice 7: the inaugural trust council session,

[3:07:18] Voice 7: the meeting on Maine on the 21st,

[3:07:22] Voice 7: the 24th in North Pender, 28th in Muskegee

[3:07:25] Voice 7: and 29th on Thetis is likely that the 29th on Thetis

[3:07:28] Voice 7: this would be the first one we could practically have

[3:07:31] Voice 7: a functioning LTC, meaning there's some training

[3:07:34] Voice 7: that's required and some discussions and access to staff.

[3:07:38] Voice 7: So I just wanted to highlight those things.

[3:10:00] Voice 7: committees what they do and also the um the intention of presumably with ec support for

[3:10:06] Voice 7: staff to hold a live session with uh trustees to answer any of their questions to meet the senior

[3:10:16] Voice 7: staff and we would do that on a zoom basis and provide maybe a couple of opportunities for that

[3:10:21] Voice 7: prior to the actual NOGTO meeting 19th from the 17th and 19th of November.
