[0:00:44] Trustee Luckham: I'm elected here on Thetis Island, and that's in the Liax and in the Penelakut Territory.

[0:00:52] Trustee Luckham: I just want to reflect for a moment, as I think it's important that these acknowledgements

[0:00:57] Trustee Luckham: are taken in a serious vein with all due respect

[0:01:01] Trustee Luckham: and thoughtful consideration.

[0:01:04] Trustee Luckham: And just note that in conversation in the media

[0:01:09] Trustee Luckham: just recently is the Take Back the Land initiatives

[0:01:12] Trustee Luckham: and how that work is happening across the nation

[0:01:18] Trustee Luckham: and is indeed something for us to consider in our work

[0:01:22] Trustee Luckham: being land stewards with our preserve and protect mandate

[0:01:26] Trustee Luckham: mandate in the Island Trust area, so I just want to reflect on the serious thoughts and

[0:01:32] Trustee Luckham: ramifications of the history of colonial occupation of the territories of the Coast Salish people.

[0:01:44] Trustee Luckham: So just by way of introduction, I'll go around the table here, and if you'd like to make

[0:01:49] Trustee Luckham: a territorial acknowledgement in your area, that would be much appreciated.

[0:06:58] Voice 10: It's great to be with you again, of course.

[0:07:00] Voice 10: Starting out the new year,

[0:07:03] Voice 10: I'll go over the fuel items for you

[0:07:05] Voice 10: and then I've got five or six updates

[0:07:07] Voice 10: just on ongoing matters where you can ask questions

[0:07:10] Voice 10: and get into some detail if you wish.

[0:07:15] Voice 10: so looking at on page 12 of your agenda um you've got five items there under the cao

[0:07:23] Voice 10: the first one is obvious and is not occurring so that's being honored um you know item two

[0:07:30] Voice 10: regarding trust council meetings um we did get some emails recommending um consideration of

[0:07:36] Voice 10: north pender i believe so we've added north pender as one of the items for consideration

[0:07:42] Voice 10: I do make a note that, you know, we're pre-approval of the budget. So, though we do have that direction to have those live meetings, I guess there would be the possibility, given budgetary concerns for some movement there. So we're making those initial inquiries.

[0:08:01] Voice 10: I'll also point out that we're working on, or let's make it more specific, Laurie's working

[0:08:06] Voice 10: on the Nanaimo meeting in March coming up, which is also a live meeting.

[0:08:15] Voice 10: In terms of orientation sessions, those meetings are now being delivered online.

[0:08:21] Voice 10: The first one is tomorrow night, Thursday night, and then we'll follow the next.

[0:08:26] Voice 10: Next, the following Thursday is going to be, the first one, sorry, is around some of the mechanics of being a trustee in terms of professional management, you know, bias, conflict of interest, the open meeting rule, just FOI, just giving everyone to a basic level of understanding.

[0:08:49] Voice 10: so that's what these are set up as one-hour sessions and we given that we can do these

[0:08:56] Voice 10: electronic meetings there's always the opportunity to either hold another meeting if a trustee or

[0:09:00] Voice 10: trustees can't attend or I can do a one-on-one session or a one-on-three session with some

[0:09:05] Voice 10: trustees and we can organize that kind of timing so I think that's going to be satisfied and we're

[0:09:11] Voice 10: trying to get those done by January so that we can all collectively look at each other and say

[0:09:15] Voice 10: we have completed our basic orientation and you'll remember trustees um at the last trust

[0:09:22] Voice 10: council meeting began um deliberating and governing quite rapidly and and moved past

[0:09:28] Voice 10: orientation it is important to make sure that we have all of this in so on the following thursday

[0:09:33] Voice 10: will be um a land use planning session and then i don't think it's then the next week

[0:09:39] Voice 10: we'll have a session on the is it's on the website it's on the website and mapping

[0:09:49] Voice 10: uh that probably doesn't exhaust all of the orientation needs but at that point ec will

[0:09:57] Voice 10: sit i'll bring you some sort of reporting and say this is what we've done and you'll say okay

[0:10:02] Voice 10: um let's do a bit more of this or or we're good um keeping in mind one theme this year or this term

[0:10:09] Voice 10: is to have more continuous orientation elements

[0:10:13] Voice 10: as opposed to a big glut at the start

[0:10:15] Voice 10: and then returning to it infrequently.

[0:10:20] Voice 10: So that's item four.

[0:10:22] Voice 10: Item five, the incoming executive committee

[0:10:24] Voice 10: on the request of the province authority

[0:10:26] Voice 10: to do forest protection.

[0:10:28] Voice 10: So this is a summary report

[0:10:29] Voice 10: to get all trustees on the same page.

[0:10:54] Voice 10: to sort of my anecdotal work overview over the last week.

[0:11:05] Trustee Luckham: no no okay i i do have a couple of remarks uh cao um just noting um all you know alternate

[0:11:17] Trustee Luckham: locations obviously we've got some correspondence and that um just wanted to say that it's certainly

[0:11:23] Trustee Luckham: an expectation that as the next four years unfolds we certainly would be looking at moving

[0:11:28] Trustee Luckham: moving meetings to various Island locations as appropriate.

[0:11:35] Trustee Luckham: I'm sure that you concur with that.

[0:11:37] Trustee Luckham: But if I move on through the orientation sessions,

[0:11:42] Trustee Luckham: noting that some trustees have indicated

[0:11:45] Trustee Luckham: that they may not be able to attend those.

[0:11:48] Trustee Luckham: And indeed it's a challenge to get 26 people

[0:11:51] Trustee Luckham: into a room on short notice.

[0:11:53] Trustee Luckham: And so just wonder, have you considered

[0:11:56] Trustee Luckham: um uh not along with your generous offer of facilitating further conversations uh one-on-one

[0:12:04] Trustee Luckham: or in small groups with other uh council members uh simply uh recording the meetings in an informal

[0:12:12] Trustee Luckham: way and then providing those links maybe to trustees um and then supplementing that with

[0:12:18] Trustee Luckham: one-on-one conversations where necessary yeah

[0:12:42] Voice 10: And so we just want to make sure we get as much covered off as possible.

[0:12:52] Voice 10: our first meetings around the open meeting room,

[0:12:54] Voice 10: Um, we can have a meeting like this as long, um, this isn't a business meeting in this

[0:13:01] Voice 10: traditional sense.

[0:13:02] Voice 10: This is, um, an educational in, in informatic informatics kind of meeting and information

[0:13:09] provision for trustees.

[0:13:11] So, um, certainly we can

[0:13:12] Voice 10: do that and we, um, take the sessions and, and have them available.

[0:13:18] Trustee Luckham: Okay, great.

[0:13:19] Trustee Luckham: um and uh yeah just note that item five is also being conducted in respect of item number one

[0:13:27] Trustee Luckham: just so that's um clear um so uh vice chair elliott um

[0:13:35] Trustee Elliott: yeah i was going to note this during

[0:13:36] Trustee Elliott: our um chair report outs but um uh south pender trustee evans had requested an orientation

[0:13:45] Trustee Elliott: presentation on planning applications and processes prior to our first meeting in February,

[0:13:52] Trustee Elliott: because there were a few applications that were coming in and there was a lot of questions about

[0:13:59] Trustee Elliott: process. So Planner Stockdale has arranged for a short session with just us three on January 16th.

[0:14:07] Trustee Elliott: And so, yeah, just to feed back into the planning for orientation next time, it does seem that just general orientation on the business of LTC applications and processes might well be included before we launch into that business.

[0:14:29] Trustee Elliott: So, yeah, there's been a bit of back and forth about it, but I think it's good that people are asking for what they need.

[0:14:42] Voice 10: hardly agree that just we we do have to cover off all of the basics

[0:14:46] Voice 10: um and the basics are going to be some development permit or significant rezoning that gets in front

[0:14:53] Voice 10: of a trustee who will want to have had some basic training associated with those land use

[0:14:59] Voice 10: instruments so on the 19th we'll do a version of that and then um on a maybe a sub-regional

[0:15:06] Voice 10: basis there'll be some training or an ltc basis but that is a

[0:15:09] Voice 12: priority to get done yeah

[0:15:13] Trustee Luckham: that's

[0:15:14] Trustee Luckham: great um so thank you uh trustee elliott for raising that and just want to say and i'm hoping

[0:15:20] Trustee Luckham: to model that behavior is is even at the executive committee here is we just need to simply go a bit

[0:15:27] Trustee Luckham: slower at the outset here and provide the opportunities for uh questions um and then

[0:15:32] Trustee Luckham: And indeed, from the vice chair's perspective, you really want to work with staff in advance of the meeting when you've seen an agenda,

[0:15:41] Trustee Luckham: if you have questions, in order to facilitate a smoother public meeting.

[0:15:48] Trustee Luckham: So, yeah, just take your time, rely upon staff to answer your questions, and we'll do as much more training broadly as we possibly can.

[0:16:03] Trustee Luckham: with respect to executive committee chairs

[0:16:27] Voice 10: the number of meetings and committee meetings that we're trying to establish that's been a

[0:16:31] Voice 10: significant theme getting fpc ready to consider what came out of the deliberations in december

[0:16:40] Voice 10: around the budget um that's coming up on the 18th and i see julia's joined us here um at this

[0:16:46] Voice 10: meeting and we'll just do in a couple of minutes i'll just do a couple quick words on the budget

[0:16:50] Voice 10: process but so a focus has been the committees uh rpc meets on the 17th and on this monday trust

[0:17:00] Voice 10: programs committee matt and of course one of the key elements there is to get a chair elected and

[0:17:05] Voice 10: have that chair then sit at fpc so we're slowly becoming whole or rapidly becoming whole um on

[0:17:12] Voice 10: the 17th rbc will elect their chair and then that person will be getting some information overnight

[0:17:17] Voice 10: night because the meeting is occurring the budget the fpc meeting is occurring on the 18th

[0:17:23] Voice 10: we've got the same consideration with the governance committee um we had an initial

[0:17:27] Voice 10: meeting scheduled for the 16th which would have gotten us into that loop but we just couldn't get

[0:17:32] Voice 10: everyone um to agree on a meeting date so i believe they are now the 19th the governance

[0:17:40] Voice 10: committee so we won't have a governance committee representative at the first budget session

[0:17:48] Voice 10: of 2023 or the first fpc session but we're doing the best we can um given the schedule and

[0:17:56] Voice 10: hopefully um as the committees roll out um they do their their council committee orientation

[0:18:03] Voice 10: will have and they set their dates the spacing will spread out a little bit better so that's

[0:18:10] Voice 10: of committees the governance committee um bylaw enforcement you're seeing um a report we provided

[0:18:16] Voice 10: sort of an overview report for you today that we'll speak about but that's some work that we've

[0:18:21] Voice 10: been doing internally in the organization following the trust council meeting in december

[0:18:25] Voice 10: uh we're also turning our minds to the reconciliation um um committee uh options

[0:18:31] Voice 10: um please to get that ready for mark so we'll get that to you before um certainly well before the

[0:18:38] Voice 10: ec meeting that occurs prior to that as an overview i have a meeting with the north salt

[0:18:44] Voice 10: spring water district director um certainly turning my mind to the uh on salt spring um

[0:18:51] Voice 10: the community commission um developments there as they move to an lcc um how will um i've had

[0:18:59] Voice 10: some conversations with the trustee um and a few people have called in regarding you know how's

[0:19:04] How's that going to function?

[0:19:05] What's the relationship with the Allen's Trusts to an LCC?

[0:19:08] That kind of thing.

[0:19:09] So that's taking a bit of time.

[0:19:28] Voice 10: to the Executive Committee just in terms of what's happening

[0:19:31] Voice 10: around the budget as we move into – Julia's obviously quite busy

[0:19:36] Voice 10: with any refinements that have come through.

[0:19:40] Voice 10: from the conversations that occurred in December

[0:19:42] Voice 10: as we get to moving the budget in March.

[0:19:45] Voice 10: And of course, the big thing is, of course,

[0:19:47] Voice 10: we've got to set, we've received the assessed values,

[0:19:49] Voice 10: you've all had your property assessments,

[0:19:51] Voice 10: and that's provided a pretty significant change.

[0:19:54] Voice 10: Do you want to just briefly describe that,

[0:19:56] Voice 10: how that's playing out a little bit, Julia,

[0:19:58] Voice 10: and give the committee a bit of a heads up

[0:20:00] Voice 10: as to where we're going?

[0:20:02] Voice 2: Sure, so obviously everyone at this meeting

[0:20:06] Voice 2: will also be at Financial Planning Committee next week,

[0:20:07] Voice 2: so you'll get much more detail then but just very briefly the primary update to this version of the

[0:20:13] Voice 2: budget is for new BC assessment data so the BC assessment process every year has a completed

[0:20:20] Voice 2: role that's updated at the end of December and our policy says that we will use those figures

[0:20:26] Voice 2: in our budget draft so things like net converted assessment values impact our taxation and also

[0:20:32] Voice 2: So non-market change percentages that are provided by BC Assessment also impact our

[0:20:38] Voice 2: budget figures as well.

[0:20:40] Voice 2: So we've seen a pretty substantial change in the BC Assessment data that we've received

[0:20:45] Voice 2: this year from the assumed figures that were in the previous version of the draft budget.

[0:20:52] Voice 2: The largest one is around non-market change.

[0:20:54] Voice 2: So property values often increase for market factors, and then they can also increase due

[0:21:01] Voice 2: to non-market factors.

[0:21:02] Voice 2: And non-market factors are primarily things like new construction, new development, changes in land use, those sorts of things.

[0:21:08] Voice 2: And so we look at that value from BC assessment to understand how much of our property tax revenue in the next budget cycle will be collected on existing properties,

[0:21:19] Voice 2: which then, of course, would be coming from existing taxpayers or our property tax revenue that might be coming from new construction.

[0:21:28] Voice 2: And of course, if we're collecting an increase in our tax revenue from new construction, there is no increase or a lesser increase to existing homeowners.

[0:21:37] Voice 2: A little bit of background there, a bit confusing. I'm happy to answer questions either today or at FPC.

[0:21:42] Voice 2: But what we're seeing with the BC assessment data is a fairly significant increase in the non-market change value.

[0:21:47] Voice 2: So the previous version of the budget had around 1% that we thought would come from new construction.

[0:21:52] Voice 2: Now, BC assessment data is telling us that's 8%.

[0:21:55] Voice 2: So there's an 8% lift in non-market change factors, and that means a much larger percent of our tax increase will be collected on new construction or changes in land use and those factors, which means there's a much lower percentage of the tax increase that needs to be collected from your average existing taxpayer.

[0:22:16] Voice 2: pair. So it's great news for us. It does help with a lot of the budget pressures around the

[0:22:21] Voice 2: general tax increase that we see. So previously, the version of the budget was seeing about,

[0:22:26] Voice 2: I think it was an 8% increase, general tax increase to the general taxpayer. Now it's at 1.4%.

[0:23:56] numbers we've been discussing in substantially include most of those

[0:24:06] Voice 10: And with regards to the budget in terms of planning activities, those have been reconciled

[0:27:03] Voice 2: investment in our process and, you know, a deep desire to have good conversation to make sure the

[0:27:08] Voice 2: budget lands in a good place. So that always makes me feel motivated. So I'm always happy to receive

[0:27:13] Voice 2: those calls and help trustees along in that process. There's also been a lot of HR work

[0:29:14] Voice 6: of things going on by law enforcement in preparing to talk to you about by law enforcement. So that's

[0:29:19] Voice 6: been, you know, a lot of behind the scenes work going on. Very excited about some of the direction

[0:29:24] Voice 6: we're going with that and talking to these other agencies to help collate and educate and inform

[0:29:29] Voice 6: and learn and change. So very excited about that. We have started this week, Renee Jamarat has

[0:29:36] Voice 6: started as the new regional planning manager in the north. Today will be her first day stepping

[0:29:41] Voice 6: stepping into the Gabriola office so very excited about that she's a lovely person extremely

[0:29:47] Voice 6: confident we're very lucky to to attract somebody of that caliber and I think she's going to really

[0:29:54] Voice 6: complement our team really well so I'm very excited about that so welcome to Renee and if you you will

[0:30:00] Voice 6: north get a chance all of you i think have an ltc up there so you will all get a chance to meet her

[0:30:04] Voice 6: at one point or another and i know she's looking uh very much forward to um uh to meeting all of

[0:30:42] Voice 6: knowledge to review our procedures and policies for planning services administrative details

[0:30:53] Voice 6: and so we're taking that time to make sure we don't lose that institutional knowledge and we're

[0:30:58] Voice 6: going to we've got a program there to to harmonize some processes amongst the offices so everything

[0:31:04] Voice 6: you see looks the same everywhere you go and we're aware that there's subtle differences that have

[0:31:08] Voice 6: grown over time so we're looking to improve that um what else do we have oh and of course i've been

[0:31:14] Voice 6: stressing all the heck about the regional planning committee uh trying to get that up and running and

[0:31:18] Voice 6: make sure that works well that's my first one with uh you know the training wheels are off and

[0:43:40] Voice 6: I have very minor additions saying that I believe this is the second LTC to propose adopting a delegation authority for development permits.

[0:43:52] Voice 6: Internally, we're working out the process for that.

[0:43:54] Voice 6: I believe Galliano has a few permits that are heading towards this direction.

[0:44:00] Voice 6: It is designed for to be efficient and effective delivery of planning services.

[0:44:05] Voice 6: It was a policy that was adopted by previous Trust Council.

[0:44:10] Voice 6: And I would like to just simply inform you that this is the beginning of yet another wave of delegation bylaws, which was permitted in policy and supported by the previous Trust Council.

[0:44:22] Voice 6: And that is the delegation of development variance permits, something of small, minor issues.

[0:44:28] Voice 6: use. So executive committee will be hearing in the near future about proposed policy amendments

[0:44:34] Voice 6: that would then lead to proposed bylaws for various LTCs. So this is just the beginning of

[0:44:41] Voice 6: an example of how we can be more effective and efficient in delivering planning services. And

[0:44:46] Voice 6: I'm very excited to see that this come to the executive committee for your approval.

[0:47:25] Trustee Maude: island and what it's doing is um moving density from one property to another property um when

[0:47:32] it's converted over to the trust um the meeting that we had on december 14th it was very nice a

[0:47:41] with a few members of the public attended

[0:47:44] and spoke very, very favorably about it.

[0:47:49] And so there was even a suggestion of providing more density

[0:47:53] to the property that's being transferred to.

[0:47:56] Trustee Maude: So there's immense community support for this.

[0:47:59] Trustee Maude: And of course it's preserving an important piece of land

[0:48:02] for Saturna, the trust and the province as a whole.

[0:48:05] So I'm very, very pleased to be involved

[0:48:13] and took a lot of negotiations,

[0:48:15] a lot of effort by the trustees.

[0:50:01] Voice 10: One, the focus of the upcoming executive committee training.

[0:50:05] Voice 10: So what is the focus and content?

[0:50:07] Voice 10: and the second is just generally around timing so I'll start with the first one

[0:50:14] Voice 10: given that we've got new vice-chairs who are moving into a chairing role in the

[0:50:21] Voice 10: public realm I'm suggesting that the strong component is actually that the

[0:50:26] Voice 10: chairing function in public meetings the dealing with situations around public

[0:50:35] Voice 10: governance conflict resolution the whole the delicate balance between engaging

[0:50:41] Voice 10: the community and also providing governance of the meeting the

[0:50:46] Voice 10: understanding that this is your meeting and that in a chairing function that you

[0:50:52] Voice 10: aren't charging so it's development of that skill set or augmenting that skill

[0:50:56] Voice 10: set I just want general agreement from you that that that is a worthwhile

[0:51:01] well pursued um so that's

[0:51:04] Voice 10: why this is on the agenda so that would be one particular focus

[0:51:07] Voice 10: the second content focus that i think is of value is how to get to a decision the means by which in

[0:51:17] Voice 10: a public setting um you know traditionally information's gathered it's presented by staff

[0:51:23] Voice 10: perhaps it's refined based on direction by elected officials of the body it comes back

[0:51:29] Voice 10: is reviewed and then there's the moment of decision making so what how in a public forum

[0:51:36] Voice 10: do you move through the structured decision making process i think some consideration of

[0:51:41] Voice 10: that is a second um skill set to to develop so um those are the two themes initially i also think

[0:51:50] Voice 10: executive committee and i don't think an initial session would have enough time for it should be

[0:51:55] Voice 10: be investigating itself, it's leadership quotient,

[0:51:59] Voice 10: it's governance process, it's team building.

[0:52:03] So that would be a third theme

[0:52:06] that I think executive commission should consider.

[0:52:09] Voice 10: I'm meeting with, having some discussions

[0:52:11] Voice 10: with some consultants later on this afternoon

[0:52:15] Voice 10: and basically honing in on those pieces.

[0:52:19] Voice 10: So now Mr. Chair, I'd like to turn to you and go,

[0:52:21] Voice 10: does that generally sound appropriate?

[0:52:23] Voice 10: appropriate. It is being slightly different than previous EC trainings. There, we did a variety of

[0:52:31] Voice 10: different things. It was focused on team building, but I think in this, my recommendation to you is

[0:52:38] Voice 10: the folks that I've described. And then if you agree, or if you have some changes that you want

[0:52:43] Voice 10: to focus on, we then move into basically the timing question and the contingent, who will be

[0:52:52] Voice 10: beginning that training that would be our next topic briefly okay

[0:52:58] Trustee Luckham: so i'll turn to vice chairs

[0:53:00] Trustee Luckham: and just ask you uh based on what the cao has presented and asked there um um are you in

[0:53:08] Trustee Luckham: support of the general theme are there any other areas of um interest that you think we might want

[0:53:14] Trustee Luckham: to consider so um uh i'll just look to you to raise your hand if you have any additional remarks

[0:53:21] Trustee Luckham: or otherwise assume that you're in support of the process as outlined all right looks like that's

[0:53:30] Trustee Luckham: good um i'm just going to reflect on one of your remarks about uh cao the importance of it but

[0:53:37] Trustee Luckham: obviously you have support from the vice chairs at this point with respect to how to run an open

[0:53:43] Trustee Luckham: meeting and decisions in an open meeting i just recall as being a new vice chair um and in a in

[0:53:50] Trustee Luckham: in an LTC meeting and with the public right there

[0:53:55] Trustee Luckham: and having to have discussions that sometimes get awkward

[0:53:58] Trustee Luckham: because there are questions that need to be asked

[0:54:02] Trustee Luckham: that need answers in order to facilitate decisions.

[0:54:07] Trustee Luckham: And it's a requirement of the community charter

[0:54:10] Trustee Luckham: that all of our meetings and discussions happen in public.

[0:54:13] Trustee Luckham: And sometimes it gets awkward, but they're necessary

[0:54:16] Trustee Luckham: and we need to be comfortable with as chairs

[0:54:19] Trustee Luckham: facilitating that process and encouraging trustees

[0:54:22] Trustee Luckham: to ask all good questions.

[0:54:26] Trustee Luckham: There are no bad questions, all good questions

[0:54:29] Trustee Luckham: in order to ensure that the individuals are fully briefed

[0:54:34] Trustee Luckham: on what it is that they're being asked to decide upon.

[0:54:37] Trustee Luckham: So I'm excited about having a revisit on these themes

[0:54:41] Trustee Luckham: and thoughts from a fresh perspective.

[0:54:45] Trustee Luckham: So I'm in support also, CAO.

[0:54:49] Voice 10: um the reason i asked the question is one just to gauge your enthusiasm

[0:54:53] Voice 10: which i'm ranking very very high so that's uh that's exciting um two that to make the

[0:55:02] Voice 10: distinction between the training i'm recommending which we can get from outside expertise and

[0:55:07] Voice 10: training we can do internally around um vice the vice chair role and chairing in a public forum

[0:55:14] Voice 10: And what I mean by that is staff can work with you subsequent to this session around issues such as, quite often you'll find at the Islands Trust, you will likely experience it, that the vice chair vote or the vote of the chair of an LTC is somewhat of a lesser vote.

[0:55:31] Voice 10: Or what is your role in community?

[0:55:37] Voice 10: certainly the founders of the islands trust of the people who contemplated its development did

[0:55:42] Voice 10: not have that vote be any different than any other any other local vote that issue continuously comes

[0:55:48] Voice 10: up on a cycle and you really need to feel good about where you are and how you contemplate that

[0:55:55] Voice 10: as you move into some of the you know difficult conversations that chair let them describe so

[0:56:01] Voice 10: So that's a subset that we can also approach in the future,

[0:56:04] Voice 10: but we don't need and we wouldn't burden external expertise with addressing that.

[0:56:10] Voice 10: So the second item is one of timing and who would be at the session.

[0:56:17] Voice 10: We've heard that it's a good idea to have the chairs of council committees also attempt.

[0:56:23] Voice 10: So that would add four. And then there's requests to have their alternates also attend.

[0:56:30] Voice 10: attend. So we're getting pretty close to a quorum of trust council here. Certainly, I think the

[0:56:38] council committee chairs should be there. And I know Trustee Peterson has an opinion. I won't

[0:56:45] speak for him, but he's related to me,

[0:56:47] Voice 10: the vice chairs as well. We could certainly extend that.

[0:56:53] Voice 10: It makes it all more, there's just more to do more. So there's some options there. One,

[0:57:00] Voice 10: One, you could just have that training and then see whether you wanted the chairs of the council committees.

[0:57:05] Voice 10: We could automatically add the four council committee chairs and organize their schedules to sync with whatever consultant we end up with.

[0:57:14] Voice 10: And we could thirdly extend it to all of the vice chairs as well.

[0:57:20] Voice 10: And so I'd like to get your thoughts on that.

[0:57:22] the second and the next part of this is that I would like to get this done by

[0:57:28] Voice 10: the end of January beginning of February to have this this training in place so

[0:57:32] Voice 10: that you might have gone through one LTC meeting and taken his temperature but as

[0:57:37] Voice 10: you get into your rotunda or your your regular schedule that you would have

[0:57:42] Voice 10: some of that expertise to to lean on and all this training is just going to raise

[0:57:46] Voice 10: more questions that will have an opportunity to default so what is the

[0:57:50] Voice 10: Trustee, what is your interest?

[0:57:52] Voice 10: Do you want to make it?

[0:57:54] Voice 10: I think it would be

[0:57:58] Voice 10: there's some council committees and vice-chairs,

[0:58:01] Voice 10: just council committee chairs initially,

[0:58:05] Voice 10: or just yourselves as EC.

[0:58:07] Voice 10: Right now I'm getting the direction for sure

[0:58:10] Voice 10: that you want council committee chairs

[0:58:11] Voice 10: involved in the stream.

[0:58:19] Trustee Luckham: not necessarily all vice-chairs may feel

[0:58:22] Trustee Luckham: that they need to have that support.

[0:58:29] Trustee Elliott: in support of um the committee chairs getting the training as well there was some discussion last

[0:58:34] Trustee Elliott: ec meeting about investing considering investing in the committees um as sort of the work courses

[0:58:42] Trustee Elliott: of the organization and i think this would be in line with that and i'm supportive of that

[0:58:47] Trustee Elliott: could the training be recorded so that the vice chairs could then watch it afterwards if they're

[0:58:54] Trustee Elliott: in a position where they actually need that additional information because i do agree

[0:59:00] Trustee Elliott: making it too large or unwieldy could be counterproductive uh

[0:59:42] Voice 9: my own experience as a vice chair, where I ended up running quite a lot of meetings and and becoming

[0:59:48] Voice 9: the alternate on on fbc as well um so i i i recognize that i'm coming from a bias of my own

[1:00:00] Voice 9: based on that experience i i i felt like i feel like it would have been valuable for for the vice

[1:00:05] Voice 9: chairs to have access to that whether i'm i don't have a strong opinion whether it needs to be in

[1:00:10] Voice 9: tandem with ec um i do kind of feel like if the vice chairs aren't going to be included in the

[1:00:20] Voice 9: same session that maybe it would be best to include the chairs and vice chairs of committees

[1:00:27] Voice 9: in the same session, just throwing that out there

[1:00:31] Voice 9: as a thought, don't want to make things extra complicated

[1:00:35] Voice 9: for staff, but because chairs and vice chairs

[1:00:40] Voice 9: and of those committees are going to be working closely

[1:00:43] Voice 9: together, it might be a value for them to take

[1:00:48] Voice 9: that training together.

[1:00:50] Voice 9: Just that's my thoughts anyway,

[1:01:33] Trustee Luckham: building a relationship and this is an opportunity to get to know each other more to train together

[1:01:39] Trustee Luckham: to come to an understanding of the expectation how the organization operates and how information

[1:01:45] Trustee Luckham: and decisions flow through the three bodies being council executive committee and and trust

[1:01:53] Trustee Luckham: trust committees um and certainly having the vice chairs in those roles as well would be helpful

[1:02:00] Trustee Luckham: um however i think that um i wouldn't want the vice chair of committees training being separate

[1:02:08] Trustee Luckham: from that of the executive committee and i don't know what your expectation is their cao hudson

[1:02:14] Trustee Luckham: pillar but just my thoughts on that um

[1:02:18] Voice 10: my recommendation to you is to have yourselves

[1:02:21] Voice 10: and the council committee chairs and that we then subsequently train and provide training

[1:02:29] Voice 10: and insight to the vice chairs but um you are a leadership group um there's a cost element the

[1:02:36] Voice 10: more people that you bring in we don't want to have a second session repeating the first session

[1:02:41] Voice 10: um that there's a cost factor associated with that i think you take my recommendation is to

[1:02:47] Voice 10: take the eight um members who are the leadership group of the organization and just ensure that we

[1:02:54] Voice 10: address the vice chair training component but not necessarily at this initial session that would be

[1:03:00] Voice 10: my recommendation but i would like your your specific direction around that before i start

[1:03:05] Voice 10: negotiating and organizing times and so forth okay david mott

[1:03:12] Trustee Maude: um just to to confirm um when

[1:03:16] Trustee Maude: we talked about the the chair of the committees does that include um our uh islands trust

[1:03:24] conservancy and and also this new accessibility committee which

[1:03:29] Trustee Maude: they haven't right that doesn't

[1:03:31] Trustee Maude: even exist yet

[1:03:31] Voice 10: so i would just we would offer this to the conservancy us to attend and participate

[1:03:37] Voice 10: it's true uh the accessibility committee we're in the formulation stage we might end up with

[1:03:43] Voice 10: reconciliation committee um we probably can't get everything all things at all times um perfectly

[1:03:49] Voice 10: synced up but we just have to remember that we have to go back and bring whoever those individuals

[1:03:54] Voice 10: are and get them to a level um okay

[1:04:05] Voice 9: say that um i heard the cao suggesting that uh a sort of a second or supplementary round could

[1:04:21] Voice 9: that they have some opportunity

[1:05:24] Voice 10: you're getting that public interaction chairing um element um and building in the the council

[1:05:32] Voice 10: committee elements tends to lean towards structured decision making not extending a meeting for six

[1:05:37] Voice 10: six hours, getting business done in two and a half

[1:05:39] when you can, and some of those more mechanical pieces.

[1:05:43] So we're going to try and wrap all that into one session

[1:05:46] for those two groups.

[1:06:41] Voice 10: providing a bylaw enforcement service um part of that has been uh that many of these trustees

[1:06:48] Voice 10: uh you know even through the the election process and beforehand um we're showing interest in this

[1:06:56] Voice 10: particular area that's been manifest now at trust council we had a number of individuals

[1:07:02] Voice 10: individuals um come forward and say oh things things need to change so all of these are

[1:07:07] Voice 10: indicators of let's let's stop take a look see how we can make sure that we're delivering this

[1:07:12] Voice 10: service in the best way possible so given that um we're offering just a course of action with

[1:07:20] Voice 10: three or four different elements associated with it it says we thought we'd just provide you a

[1:07:24] Voice 10: briefing that summarizes those things and and it'll give us an opportunity for some reflection

[1:07:31] Voice 10: it's we do have a notice of motion in front of us that says let's get some

[1:07:37] Voice 10: independent assessment of how we're providing a service and in this

[1:07:43] Voice 10: briefing there are a couple of elements that address that we can bring in to

[1:07:49] Voice 10: Trust Council devote some time at our next Trust Council meeting in March to

[1:07:55] Voice 10: to diving a little deeper.

[1:07:58] Voice 10: We can have the ombudsperson come in.

[1:08:00] Voice 10: We can have a report by staff that's provided

[1:08:04] Voice 10: and the attorney general office.

[1:08:06] Voice 10: And maybe that will provide a deeper understanding

[1:08:08] Voice 10: of our policies and our procedures.

[1:08:11] Voice 10: And also, what are the nature of some of the complaints

[1:08:13] Voice 10: that we've had over time?

[1:08:16] Voice 10: What is that theme?

[1:08:17] Voice 10: Is there actions that we should undertake to improve?

[1:08:20] Voice 10: And how would we do that?

[1:10:51] Trustee Elliott: really helpful to know that this will be a work program that's going to be ongoing we're not going

[1:10:55] Trustee Elliott: to try to address all of this at trust council in march so it's something that should be developed

[1:11:00] Trustee Elliott: over time um and i wonder if we could spend a little bit of time discussing how we're going

[1:11:07] Trustee Elliott: to distinguish the nature of the problem, if it's systemic in nature, and what are the different

[1:11:13] Trustee Elliott: angles that we do need to investigate before we try to address it or create a presentation

[1:11:22] Trustee Elliott: that sort of says, well, this is what the system is, and this is what we're doing.

[1:11:26] Trustee Elliott: So the questions that I'd be asking is, do we have evidence that bylaw enforcement is being

[1:11:36] Trustee Elliott: applied unfairly or that there's a problem with how enforcement is enacted? Is there evidence

[1:11:44] Trustee Elliott: that there are a number of people complaining of bullying tactics and intimidation or is just

[1:11:49] Trustee Elliott: this like a single scenario? So I'd want to know number of cases. Is there a theme

[1:11:57] Trustee Elliott: of bylaw enforcement being applied unfairly? So that's one sort of area that I'd like to

[1:12:03] Trustee Elliott: to see investigated um whether the second area would be if there is a trend of enforcement

[1:12:12] Trustee Elliott: that has not been the cultural norm in some communities and now because of last term we've

[1:12:21] Trustee Elliott: heard by law enforcement we need to have more protection of the environment and um we're not

[1:12:27] Trustee Elliott: applying our bylaws we're not enforcing them and so now is there a trend of all of a sudden the

[1:12:33] Trustee Elliott: culture is sort of feeling like shocked this is this is not the norm um and then people feel

[1:12:42] Trustee Elliott: threatened and so we have a bit of a reaction because there's been a change in how our

[1:12:50] Trustee Elliott: enforcement is applied that makes sense and then the third area is um questioning whether

[1:12:58] Trustee Elliott: whether we're seeing this because bylaws are unfair and discriminatory or being implied in

[1:13:07] Trustee Elliott: an unfair manner. And if that's the case, then what needs to change are the bylaws. We need to

[1:13:12] Trustee Elliott: identify, okay, bylaws are not meeting the needs of citizens. And so we need to update our OCP and

[1:13:19] Trustee Elliott: LUBs. And so that's probably the case in a lot of the communities where there's been significant

[1:13:25] Trustee Elliott: population growth, but the OCPs and LEBs haven't kept track. So if we're trying to identify

[1:13:33] Trustee Elliott: whether this is a systemic issue, I'd want to know that we're investigating, is this a personnel

[1:13:41] Trustee Elliott: issue in the way that bylaw enforcement is being done? In that case, training or adjusting how we

[1:13:51] Trustee Elliott: we do that is this a cultural clash and or is this a discriminatory thing in which our bylaws

[1:13:58] Trustee Elliott: need to be addressed so um and i've had some i'll just say honestly from so that's from my side as

[1:14:07] Trustee Elliott: as just my observations what i'd like to see considered if we're going to have a briefing

[1:14:14] Trustee Elliott: um the an understanding of how we manage the oversight of enforcement would be helpful

[1:14:27] Trustee Elliott: and then how do we do mediation we don't have a description of the mediation process I think

[1:14:40] Trustee Elliott: and we don't anyway there's there's a few things that I think need to be added but I don't want

[1:14:46] Trustee Elliott: to wedge everything in there I just want to make sure that we're prepared for a real discussion

[1:14:52] Trustee Elliott: that is based on evidence so number of cases what kind of trends are we looking at

[1:14:59] Trustee Elliott: what do our policies say where are the policies deficient where does work actually need to be

[1:15:05] Trustee Elliott: done and i don't want to just see a justification of well this is our system and this is how it

[1:15:09] Trustee Elliott: works so does that make sense uh

[1:15:14] Trustee Luckham: well there's a lot there uh toby and certainly lots of elements

[1:15:18] Trustee Luckham: of it makes sense in terms of new questions that need to be answered but I'm not going to wade

[1:15:25] Trustee Luckham: into that I think CAO on a broad perspective what we're trying to do is get started on a

[1:15:31] Trustee Luckham: orientation session to understand about understand by law enforcement the way it is and so do you

[1:15:37] Trustee Luckham: have anything you'd like to add at this point or you would just receive that for information

[1:15:42] Trustee Luckham: to help you guide and develop this session?

[1:15:47] Trustee Luckham: Yeah, so

[1:15:48] Voice 10: my initial reaction is I expect exactly that kind of line of inquiry.

[1:15:56] Voice 10: But that is a description of the whole program I described 10 minutes ago.

[1:16:01] Voice 10: Like getting to those conclusions and any continuing in the way forward.

[1:16:07] Voice 10: I think the key question is, do you start with the premise that there is a problem?

[1:16:13] Voice 10: So I think that's one of the first questions is what is the concern, what is the problem and identify that clearly at the outset and that is indeed what you need to have.

[1:16:23] You need to have specifics and you need

[1:16:28] Voice 10: to have complaints and data and all those things and some consideration to determine what problem, if there is one, are we trying to address and we're very open to exactly that.

[1:16:39] Voice 10: but some of the outcomes that are described by vice chair that I think would occur over some

[1:16:44] Voice 10: period of time and indeed this is almost this becomes just hearing that this becomes a almost

[1:16:51] Voice 10: a strategic group or a project-based piece of work at the islands trust it's not a single report

[1:16:58] it's going to take some uh some um reflection and some work

[1:17:03] Voice 10: uh in terms you know we've got a bylaw

[1:17:08] Voice 10: legislative horizon that's got 13 different versions of how we do a bylaw enforcement i

[1:17:14] Voice 10: can tell you as the chief administrative officer i've been sternly spoken to at trust council

[1:17:18] Voice 10: um because we haven't enforced um and then to um you know to move a a process

[1:17:27] Voice 10: that where we react to the direction provided by a trust council to perhaps a new approach

[1:17:34] Voice 10: certainly it can be done and how to do it over what time.

[1:18:08] Voice 9: this is this is something that if we're going to uh diligently explore the issues here we're going

[1:18:15] Voice 9: to have to take some time to do it well so i appreciate that that's uh the approach that's

[1:18:21] Voice 9: being considered here and uh also just want to thank uh trust uh vice chair elliott um for

[1:18:28] Voice 9: bringing up some of those uh those additional questions and i think as we as we move um deeper

[1:18:35] Voice 9: deeper into the this program of work that um those are important considerations uh in terms

[1:18:42] Voice 9: of the initial uh sessions uh sort of outlined here uh in in the briefing I I just want to say

[1:18:50] Voice 9: that I think that that this is a good start uh as a way to approach um sort of some of the mechanics

[1:18:57] Voice 9: And I'm quite happy to see that we have the option to have the Ombudsman person and the Attorney General as resources to help us get some of the legal foundation.

[1:19:15] Voice 9: and and so I'm quite pleased at that as this being is sort of initial foray into

[1:19:25] Voice 9: this topic I think it's a good a good start and I'm quite satisfied with it as

[1:19:30] Voice 9: a beginning of a longer process okay

[1:19:39] Trustee Maude: more to add than what the other vice-chairs have expressed certainly I

[1:19:45] Trustee Maude: have heard concerns that pass them on but I think this is a really important

[1:20:14] Trustee Luckham: in context of what is required by local government

[1:20:19] Trustee Luckham: and the authorities that they have.

[1:20:21] Trustee Luckham: um and then indeed uh an analysis on whether or not the delivery of that service is as um expected

[1:20:31] Trustee Luckham: in policy and um and uh in fact indeed if bylaws need to be changed at the local trust committees

[1:20:39] Trustee Luckham: um if the complaints are uh considered unwarranted in terms of the community perspective then those

[1:20:46] Trustee Luckham: are issues that have to be handled at the ltcs as well as what is proactive enforcement on some very

[1:20:53] Trustee Luckham: few ltcs because normally a proactive proactive enforcement is not per se the norm um

[1:21:03] Trustee Luckham: vital enforcement other than environmental and health and safety issues is complaint

[1:21:08] Trustee Luckham: driven and that's also important to realize it but it's not the same in all ltcs and those were

[1:21:15] Trustee Luckham: decisions of LTCs, not a council. So I really look forward to having a session. It sounds like

[1:21:22] Trustee Luckham: the scope is good. Thank you, Stephan, for suggesting Anderson and Young also be an advisor

[1:21:28] Trustee Luckham: in this. And I'm really excited about having the provincial bodies that have offered to step up

[1:21:36] Trustee Luckham: and assist us in this. I think that's all very important. Okay, so David Maud, and then let's

[1:21:58] Voice 10: to organize that now so um stefan's um made those made that outreach and so we'll book those times

[1:22:06] Voice 10: and then we'll get into the specifics to get to that closer to the meetings the second is what

[1:22:13] Voice 10: is the role you know we're going to have challenges moving forward not challenges there's going to be

[1:22:17] Voice 10: subtleties around people across the islands trust who have enforcement actions underway

[1:22:25] Voice 10: and where they seek relief and if they don't agree with where we're going and

[1:22:31] Voice 10: And certainly we had a presentation or presentations in the past where people come to Trust Council where we need to select the global or common complaint and address those.

[1:22:42] Voice 10: But we cannot deal with specific LTC zoning bylaw individual complaints at a Trust Council level.

[1:22:50] Voice 10: It inflames Trust Council, but they have no legislative ability to do anything associated with that because they're not the constituted body.

[1:22:58] Voice 10: that has to as long as there's oversight that's appropriate those things need to go back to the

[1:23:04] Voice 10: ltc on a specific case basis so i expect we'll get um more people or returning to trust council

[1:23:12] Voice 10: but the challenge will be then to extract from that what is the global concern we can take here

[1:23:17] Voice 10: and not the specifics and i'm going to be particularly putting my mind to how we do that

[1:23:23] Voice 10: that. So the Trust Council is not spending time on things that it can't address, but is addressing

[1:23:29] Voice 10: the things that it can't in terms of how it directs the key themes of the service and whether

[1:23:36] Voice 10: it's being delivered appropriately. So thank you for that opportunity.

[1:23:47] Trustee Luckham: to add, just to be sure, you know, there's a subtlety there in what the CAO said, I think,

[1:23:58] Trustee Luckham: that is as a result of a local trust committee bylaw,

[1:24:22] Trustee Luckham: And so that's an important element of this, that Trust Council owns the policy around bylaw enforcement practices.

[1:24:35] Trustee Luckham: And so that's the part that council can change.

[1:24:47] Trustee Elliott: um so are we looking are we going to expect to see some global trends as in

[1:24:57] Trustee Elliott: what is the data how how many complaints not per ltc but broadly grouped um are you know based on

[1:25:09] Trustee Elliott: on STVRs, our zoning, our whatever they are?

[1:25:14] Trustee Elliott: Like, how do you anticipate that would be gathered in the, I think, the second part

[1:25:20] Trustee Elliott: of your, or the third, the review of current complaints and issues associated with a service?

[1:25:25] Trustee Elliott: Like, how do you imagine that would be compiled if each LTC has different bylaws?

[1:25:33] Trustee Luckham: Right. So I'll turn it over to the LTC, but remind us that we, I can't remember the frequency,

[1:25:40] Trustee Luckham: but I think quarterly or at least twice a year, we do get reporting from bylaw enforcement

[1:25:48] Trustee Luckham: specifically on an LTC basis, the number of complaints that are open and have been resolved

[1:25:54] Trustee Luckham: and the like. That does come to us on a regular basis. CAO, over to you.

[1:26:03] You can just aggregate those things and draw whatever themes there are, but there's layers

[1:26:16] Voice 10: Many people comply once they're in the enforcement process, what percentage of people do that.

[1:26:21] Voice 10: Then there's a number where they're unsatisfied with the actual process itself, what's the

[1:26:27] nature of that complaint.

[1:26:29] Voice 10: All of that will be drawn into exactly that.

[1:26:32] Voice 10: Yeah, so I think that there won't be a problem

[1:26:34] Voice 10: providing that information.

[1:26:38] Voice 10: It's more remedies.

[1:26:40] What I'm speaking about is a remedy

[1:26:44] associated with a given

[1:26:45] Voice 10: local trust committee

[1:26:47] Voice 10: who have the ability to step into the bylaw enforcement process

[1:26:51] Voice 10: and provide a range of different options versus trust now.

[1:47:30] Voice 9: I had hopes of attending this year's sessions, but unfortunately have conflicts on the dates. So

[1:47:40] Voice 9: if I hadn't had meeting conflicts, I would have been putting my name in there as well

[1:47:46] Voice 9: this time around, because I do think it's quite valuable.

[1:48:47] Voice 10: it staff do it at trust council meetings we're doing evening sessions this is another way to

[1:48:51] Voice 10: get there there's the scholarship program that uh vice chair peterson described and um so far we

[1:48:58] Voice 10: haven't hit the threshold but i don't know if i'd recommend you put thirty thousand dollars aside

[1:49:03] Voice 10: for the lgla every year and tax for it and then you end up with seven people going um and then

[1:49:09] Voice 10: we've got a bunch of overage so i think the system's okay as it is but no everyone couldn't go

[1:49:15] Voice 10: So you'd have to make some decisions.

[1:49:19] Trustee Luckham: Yeah, this budgeting is sort of based upon what other local governments do.

[1:49:24] Trustee Luckham: No local governments send everybody, but some send some people, some send no people based upon their financial circumstances.

[1:49:33] Trustee Luckham: So let us move on. I think I called the vote on that. That's done.

[1:51:26] Voice 7: are successful are broadly of interest to all local governments in British Columbia.

[1:51:32] Voice 7: And it can be on topics that you want to advocate to higher levels of government around. And by

[1:51:38] Voice 7: undertaking advocacy in this way, you leverage the additional staff power and horsepower of

[1:51:45] Voice 7: of Union of BC municipalities.

[1:51:48] Voice 7: So the way it works is you develop a resolution

[1:51:50] Voice 7: an executive committee, it has to go by a deadline

[1:51:53] Voice 7: which I think is February 6th or February 9th

[1:51:56] Voice 7: to AVICC with a one page backgrounder

[1:51:59] Voice 7: that justifies why you're making the asks.

[1:52:00] Voice 7: And as they used by them to determine

[1:52:04] Voice 7: their executive committee's recommendation

[1:52:06] Voice 7: of whether AVICC should recommend it and vote on it.

[1:52:10] Voice 7: If it is successful at that convention

[1:52:12] Voice 7: then it travels on to the UBCM agenda

[1:52:14] Voice 7: where the UBCM executive will make a recommendation

[1:52:17] Voice 7: of whether or not to endorse.

[1:52:18] Voice 7: When it comes to the convention itself,

[1:52:21] Voice 7: they are put into the convention booklet

[1:52:24] Voice 7: either as sort of ones that are sort of no-brainers,

[1:52:27] Voice 7: recommended for endorsement, ones for debate, and so on.

[1:52:30] Voice 7: And for the ones that are debate that aren't in a big block,

[1:52:32] Voice 7: there is an opportunity for the chair of the trust

[1:52:34] Voice 7: to get up to a microphone and speak to

[1:52:36] Voice 7: why the resolution should be endorsed

[1:52:38] Voice 7: and sort of make a compelling argument.

[1:52:41] Voice 7: If you're successful there and it's endorsed,

[1:52:43] Voice 7: then it becomes owned by UBCM and they then undertake that advocacy and they have meetings

[1:52:50] Voice 7: with the appropriate ministry to advocate for that issue and then later usually around November

[1:52:56] Voice 7: December or even into January the province will issue a response to all of the resolutions that

[1:53:01] Voice 7: were passed at the convention saying how they're addressing it or if they're not addressing it why

[1:53:05] Voice 7: so that's sort of the annual process that gets undertaken if we have a resolution that moves

[1:53:10] Voice 7: forward there is an opportunity to also request a meeting with the appropriate minister um at the

[1:53:16] Voice 7: bcm convention to raise the topic and you know advocate one-on-one and at that meeting we could

[1:53:22] Voice 7: also invite other members of other or other local governments to join us which we've done on

[1:53:26] Voice 7: topics in the past um so on an annual basis as per policy trust council's policy we circulate

[1:53:34] Voice 7: it to all trustees and staff inviting suggestions this year we had no suggestions from trustees we

[1:53:39] Voice 7: We just had two staff respond by the deadline

[1:53:41] Voice 7: and I've just been reminded now

[1:53:42] Voice 7: we have another one float in after the deadline.

[1:53:46] Voice 7: So this is over to you now.

[1:53:48] Voice 7: If you were to proceed today with selecting one of these,

[1:53:51] Voice 7: we would probably amend the recommended resolution

[1:55:09] Trustee Elliott: yeah so i just wanted to speak to whether we could amend

[1:55:25] Trustee Elliott: governments in general, with capacity funding to do early and meaningful engagement with First

[1:55:33] Trustee Elliott: Nations. I don't think the Islands Trust would be the only body to advance this. So perhaps there's

[1:55:42] Trustee Elliott: there's another resolution that we could get behind. But I guess in the training session,

[1:55:50] Trustee Elliott: And when we were listening to the legislated and the responsibilities of local governments to engage with First Nations, it was clear to me that while the province has enacted DRIPA, it's not clear to the municipalities or the local governments how DRIPA is to be responded to in these 3,000 statutes.

[1:56:18] Trustee Elliott: And so I'm just wondering if we could discuss it, if this would be of value as a forum to advance this and keep calling to the province to work with the municipalities and all the local governments on how are we to meet our obligations under DRIPA without capacity funding.

[1:56:45] Trustee Elliott: we need the province to be the lead in this and so that was sort of the aim of my

[1:56:52] Trustee Elliott: when i suggested this is a topic it's going to be a recurring theme you're going to hear from me a

[1:56:57] Trustee Elliott: lot about this um and if you don't support it that's totally fine but um that was just this

[1:57:05] Trustee Elliott: just might seem the forum where we keep advancing that conversation whether the island stress is

[1:57:10] Trustee Elliott: Is the lead on that or not?

[1:57:46] Voice 7: facilitate a conversation at the convention so i wanted to add that in terms of the capacity

[1:57:51] Voice 7: funding of course as you heard from reese harding at council um local governments have very few

[1:57:57] Voice 7: obligations different from alistair other local governments have few obligations right now under

[1:58:02] Voice 7: drippa it's emerging it's a it didn't we're very much in the gray zone um so it's a tricky time to

[1:58:08] Voice 7: be advocating for financial resources given that the lack of clarity to other local governments

[1:58:14] Voice 7: about what they need to undertake but certainly staff will support whatever you wish to do and

[1:58:19] Voice 7: will work um if you if you were to ask us to advocate for capacity funding for all local

[1:58:23] Voice 7: governments we'd likely have to reach out to different local governments and seek some insights

[1:58:27] Voice 7: around how that would work best for them okay

[2:02:40] Voice 7: over the years I would say um it's taken a hit since COVID so last term I think there was yeah

[2:02:46] Voice 7: we'd have to look in the briefing but not as many meetings and relationships I don't think were as

[2:02:50] Voice 7: strong as they had as I had previously witnessed and been party to prior to that um I would say

[2:02:55] Voice 7: at this over the last term very little staff to staff interaction I note on their website that

[2:03:00] Voice 7: the county clerk has changed and that all three councillors are new and we haven't met with any

[2:03:06] Voice 7: of them previously the last remaining councillor that we had a relationship with was jamie stevens

[2:03:11] Voice 7: who chose not to run for re-election so the current um chair is or yeah the current chair

[2:03:17] Voice 7: is christine minnie and um through this relationship there's been an opportunity to

[2:03:22] Voice 7: learn from each other exchange views on all things related to housing economic development

[2:03:26] Voice 7: environmental protection all manner of things so as staff i think we've seen value in this

[2:03:31] Voice 7: relationship but um we'll turn it to you to see if you'd like to um take any further steps this term

[2:03:37] Voice 7: to foster the relationship okay

[2:03:41] Trustee Luckham: thank you director freder and maybe i'll just add um indeed this

[2:03:45] Trustee Luckham: trans boundary relationship that we have formally in place um with the salmon county um over the

[2:03:52] Trustee Luckham: years has been very instrumental in uh understanding the meet the needs and concerns across the salish

[2:04:01] Trustee Luckham: see has actually facilitated joint letters and joint support to both provincial government and

[2:04:09] Trustee Luckham: the Washington State Legislature with respect to marine pollution and shipping,

[2:04:16] Trustee Luckham: derelict vessels, a number of other initiatives, and is indeed valuable. And we've had them join

[2:04:26] Trustee Luckham: to join us at council for a session.

[2:04:31] Trustee Luckham: And we've also visited them on the San Juan Islands

[2:04:35] Trustee Luckham: and they have indeed come up here and visited us here.

[2:04:39] Trustee Luckham: And I would think that it might be too soon

[2:04:42] Trustee Luckham: for us to do something in March,

[2:04:43] Trustee Luckham: but I would suggest that we make an outreach

[2:04:46] Trustee Luckham: to them for maybe June,

[2:04:50] Trustee Luckham: that they might like to join us at council electronically

[2:08:40] Trustee Elliott: reading up on it yesterday so then since 2017 they've embarked on a process of updating their

[2:08:46] Trustee Elliott: oh well theirs is called a comprehensive plan ours is an ocp and um there's a lot of commonalities

[2:08:52] Trustee Elliott: and some really interesting approaches that they've taken to planning

[2:31:34] Trustee Luckham: um it does we have been very strong on this file in the past i'm providing uh uh uh feedback and

[2:31:43] Trustee Luckham: i've even attended uh sessions associated with it and we've made statements at those sessions

[2:31:49] Trustee Luckham: and so certainly our the position of council if I'm not mistaken is that we're opposed to this

[2:31:56] Trustee Luckham: and certainly things have changed in the intervening years and I guess the question

[2:32:04] Trustee Luckham: would be is do you have budget in your consultant budget to be able to ask a consultant to create

[2:32:13] Trustee Luckham: create some kind of a summary of our position up to this point without any new research necessarily

[2:32:20] Trustee Luckham: that would maintain the Allen's Trust's interest in this on the table. Do you understand that

[2:32:30] Trustee Luckham: question?

[2:32:31] Voice 7: Yes. We, you, do not have an advocacy budget. So as needed, we pull from the communications

[2:32:39] Voice 7: budget. There is sufficient funding, you know, in the absence of having more communications

[2:32:44] Voice 7: projects between now and the end of March, there is sufficient funding in the communications budget

[2:32:48] Voice 7: for this purpose.

[2:32:50] Trustee Luckham: Okay. So then before I maybe suggest a motion there, obviously the coastal

[2:32:57] Trustee Luckham: marine strategy and the active vessel traffic management letters here also warrant some kind

[2:33:08] Trustee Luckham: kind of response in this same vein of the Allen's Trust's interest in the coastal marine protection.

[2:33:18] Trustee Luckham: Do you have any

[2:33:20] Trustee Luckham: remark there? Perhaps that could be one consultant that might be able to

[2:33:24] Trustee Luckham: provide a one-page letter iterating our interest and concerns of preserving and protecting

[2:33:39] Voice 7: in terms of oil spill recovery to assess

[2:33:43] Voice 7: is doing is sufficient for the Gulf Islands.

[2:33:46] Voice 7: With regard to the second, the letter notes that they will be reaching out

[2:33:50] Voice 7: with further engagement opportunities.

Chair Luckham called the first Executive Committee meeting of 2023 to order at 9:08 a.m., 
which started late due to Vice-Chair Maude’s traffic delays getting to the Victoria boardroom 
office from Mayne Island.  
 
Each Executive Committee (EC) member humbly acknowledged that this meeting was being held 
on the traditional and treaty territories of many Coast Salish First Nations.

5. FOLLOW UP ACTION LIST AND UPDATES 
5.1 Follow Up Action List (FUAL)/Director/CAO Updates 
 
CAO Hotsenpiller spoke to the status of FUAL items in progress, addressed Trust 
Council’s request for on-island meeting locations, and online trustee training sessions 
scheduled to make up for the deferral of these sessions at December’s Trust Council 
meeting. 
 
Planning applications and processes training requested by Trustee Evans for local trust 
committees (LTC’s), in particular South Pender, was noted by Vice-Chair Elliott. 
 
CAO Hotsenpiller gave a verbal update on the status of the Financial Planning 
Committee becoming whole with all chairs from the standing committees being 
on-boarded. 
 
DAS Mobbs spoke to the recent status of the draft budget touching on significant 
increase to non-market values of BC Assessment property tax revenue being collected 
for the Islands Trust.  Large % of our tax will be from new builds construction.  She spoke 
to business cases regarding computer needs.  Expense claim system information and 
other small pieces will be added in and massaged as the budget.  Spoke to outstanding 
FUAL item status in progress.  Connected with Financial Planning Committee (FPC) 
members, Human Resources (HR) work on the go, staffing updates. 
 
DPS Cermak spoke to FUAL items and the bylaw presentation slated for March Trust 
Council.  He welcomed the new Northern office Regional Planning Manager (RPM) 
Renee Jamurat. 
 
DTAS Frater spoke to the status of FUAL items and the coordination of correspondence 
going to Islands Trust-area jurisdictional elected officials and First Nations in the 
Trust-area.  She noted the elected chair of Trust Programs Committee is now South 
Pender Trustee, Kristina Evans with Hornby Trustee, Alex Allen as Vice-Chair. 
5.2 Local Trust Committee Chair Updates 
 
Chairs of their local trust committees (LTC) gave verbal updates anticipating their first 
LTC meetings scheduled to begin this month. 
5.3 Islands Trust Conservancy (ITC) Liaison Update 
 
EC representative to the Islands Trust Conservancy (ITC), Vice- Chair Elliott, gave a verbal 
update regarding the 3-year plan (rather than 5-year) which was submitted to the 
Ministry of Municipal Affairs, (MMA) just before the holidays.  January 24
th
 is the first 
ITC board meeting and will elect a chair and vice-chair.  She recognized the Link Island 
donation to the Conservancy with an upcoming celebration being held in Nanaimo.

6.1 Salt Spring Island Local Trust Committee Proposed Bylaw No.534 (Delegation Bylaw) –

Vice-Chair Peterson gave a summary of the bylaw which was mostly advanced by the 
previous term’s local trust committee; to delegate authority for development permits, 
where effective planning services are delivered by staff.

Committee Delegation Bylaw No. 534, cited as "Salt Spring Island Local Trust Committee

Vice-Chair Maude introduced the bylaws empowering the purchase of 7 acres of land by 
the BC Natures Trust, moving density from one property to another when it is converted 
over to the Trust and reported the bylaw was favourably received at the local trust 
committee (LTC) meeting.

marine pollution, shipping and signing joint advocacy letters. 
 
Discussion ensued to make an outreach with San Juan County 
Council for June.
