[0:00:13] Trustee Maude: i want to begin by acknowledging that we're fortunate to be able to gather today in locations
[0:00:19] Trustee Maude: across the traditional area of the coast salish people i'm david mott elected the main island and
[0:00:25] Trustee Maude: chair of the main pender island local trust committee i'm joined today by your trustees
[0:00:30] Trustee Maude: He's Aaron Campbell and Deb Morrison.
[0:00:33] Trustee Maude: Together, we make up the Fender Island Local Trust Committee.
[0:00:36] Trustee Maude: This meeting is being live streamed.

[0:00:46] Trustee Maude: We start off with Pat Todd, who's our Retirement Courtings Secretary.

[0:01:04] Trustee Maude: hopefully that covers everybody um and uh robin ilchuk is hosting our zoom meeting for us today
[0:01:12] Trustee Maude: um the meeting is an official forum for your local trust committee to make decisions about
[0:01:16] Trustee Maude: land use and planning matters and discuss relevant business all right so i guess we are starting off
[0:01:22] Trustee Maude: with a fairly simple agenda.
[0:01:26] Trustee Maude: I'm assuming that there's no additions
[0:01:28] Trustee Maude: or changes to the agenda.
[0:01:30] Trustee Maude: So by consensus, we'll adopt that
[0:01:33] Trustee Maude: unless anybody advises otherwise.
[0:01:35] Trustee Maude: And then I believe we are turning it over
[0:01:38] Trustee Maude: to the planners to seek input and information.

[0:01:46] Voice 2: is just go over a short PowerPoint presentation
[0:01:49] Voice 2: to highlight some of the items in the staff report.
[0:01:53] Voice 2: so I'm going to share my screen now perfect

[0:02:09] Voice 2: okay fantastic well I will um begin then so this
[0:02:13] Voice 2: is a special meeting for the North Pender LTC to chat about the final amendments um to the three
[0:02:21] Voice 2: bylaws that are associated with the land use bylaw review project and so there was a recommendation
[0:02:27] Voice 2: recommendation in the staff report for today's meeting and in the past week we've actually made
[0:02:33] Voice 2: some changes to that recommendation but I just wanted to highlight what was originally in the
[0:02:38] Voice 2: staff report. So in the staff report there were a number of draft motions for the LTC to consider
[0:02:44] Voice 2: and those were actually amendments to all three bylaws proposed bylaw 223, 224, and 229. I believe
[0:02:51] Voice 2: there was an error in the staff report because I said there was only proposed amendments to two
[0:02:57] Voice 2: bylaws but the amendments um or the motions would actually affect all three bylaws and so in the
[0:03:04] Voice 2: staff report i had mentioned that if the ltc wanted to make any amendments to these bylaws
[0:03:11] Voice 2: since they've been given first and second reading the first thing to do is to reset rescind
[0:03:18] Voice 2: second reading. Then the LTC can make amendments to these bylaws. And then after that, the bylaws
[0:03:28] Voice 2: could be read for a second time as amended. The issue with this is, to date, we haven't, so
[0:03:37] Voice 2: there are some amendments that need to be made to the subdivision regulations in proposed bylaw 224.
[0:03:44] Voice 2: And we don't have those amendments yet. One of our senior planners is working on those and should have them completed in the next week or so.
[0:03:53] Voice 2: And really our goal is to, at the Saturday, February 25th special meeting, is to present the final drafts of all three bylaws that incorporates all the changes made today and also the subdivision regulations.
[0:04:11] Voice 2: So we really wanted, it's important to present to the community that final draft for the Saturday meeting.
[0:04:19] Voice 2: So how do we get there?
[0:04:20] Voice 2: And so this is why we've changed the recommendations.
[0:04:23] Voice 2: We thought the best way forward is to first rescind second reading for all the bylaws that need changes,
[0:04:32] Voice 2: rescind first reading for all the bylaws that need changes,
[0:04:37] Voice 2: and that would make these bylaws then back in draft format.
[0:04:41] Voice 2: And then the LTC can give direction to staff to make changes.
[0:04:45] Voice 2: And I thought this was a really good opportunity to speak about, well, what's the difference between a draft bylaw and a proposed bylaw?
[0:04:52] Voice 2: And there are two very distinct differences.
[0:04:55] Voice 2: With a draft bylaw, that means that a bylaw has not been given first reading.
[0:05:01] Voice 2: So it's draft.
[0:05:03] Voice 2: And when you have a draft bylaw, LTC can give direction to staff kind of informally or by resolution to make changes to the draft bylaw.
[0:05:15] Voice 2: So I made an example there that says, oh, the North Pender LTC requests staff to update the subdivision regulations in the draft bylaw.
[0:05:22] Voice 2: It's pretty, it's an informal resolution, if you will.
[0:05:26] Voice 2: But for proposed bylaws, these are bylaws that have been given a reading of some sort.
[0:05:31] Voice 2: So either first, second, or third. And when an LTC wants to make an amendment to a proposed bylaw,
[0:05:39] Voice 2: this can only be done by resolution. And the resolution has to be very specific to what
[0:05:45] Voice 2: you're actually amending. And I've included that example. It's a very formal resolution.
[0:05:51] Voice 2: So the benefit of having a bylaw in a draft format is that the LTC can give direction to staff
[0:05:58] Voice 2: to amend the draft bylaw
[0:06:00] Voice 2: with actually not having the exact amendments in hand.
[0:06:03] Voice 2: So since we don't have those subdivision regulations
[0:06:06] Voice 2: in hand yet, it's best to have them in draft format.
[0:06:10] Voice 2: And so again, as I pointed out there,
[0:06:12] Voice 2: the outcome of these new recommendations
[0:06:15] Voice 2: for the LTC to consider
[0:06:17] Voice 2: is they would allow staff to make these necessary changes
[0:06:21] Voice 2: over the next few weeks
[0:06:22] Voice 2: in order to present those kind of final draft format
[0:06:26] Voice 2: format at the February 25th meeting. I just wanted to go over some of the draft motions in the staff
[0:06:33] Voice 2: report and just highlight those to the LTC and then we can have a discussion at the end if that
[0:06:40] Voice 2: works. So the LTC asked for further information on outhouses and who regulates outhouses and is
[0:06:48] Voice 2: this something that a local trust committee can include in their land use bylaw. So there is
[0:06:54] Voice 2: is provincial legislation around outhouses or it's called privies and they're actually not
[0:07:00] Voice 2: applicable to federal lands because federal lands are exempt from provincial legislation in this
[0:07:06] Voice 2: case. For provincial parks although the I think it's called the sewage oh gosh I can't think of
[0:07:14] Voice 2: the formal name I'll just call it the sewage regulation right now although the sewage regulation
[0:07:18] Voice 2: is applicable to provincial parks.
[0:07:22] Voice 2: There's a memorandum of understanding
[0:07:25] Voice 2: between the provincial parks and this legislation
[0:07:28] Voice 2: that allows privies or outhouses to be in provincial parks.
[0:07:32] Voice 2: The kind of gray area is for community parks.
[0:07:37] Voice 2: Would this regulation be applicable to CRD parks?
[0:07:44] Voice 2: parks. So the LTC could, although this is all regulated by Island Health and the provincial
[0:07:50] Voice 2: legislation, the LTC could perhaps put a prohibition on outhouses and privies in all zones
[0:07:59] Voice 2: in the land use bylaw, but the LTC may want to consider making exception to National Park,
[0:08:06] Voice 2: Community Park 1, and Community Park 2 zones. So if the LTC wanted to move forward with this
[0:08:13] Voice 2: amendment, it would just be to propose bylaw number 224. The next item, which we've been
[0:08:21] Voice 2: kind of going back and forth with over the last year or two, is to the Port Washington Road
[0:08:27] Voice 2: property. The new property owners, they have requested the LTC consider rezoning those two
[0:08:35] Voice 2: parcels from a commercial use, a site-specific commercial use, to a rural residential use.
[0:08:41] Voice 2: And the community benefit through this process would be that the informal parking that's there for the wharf, the Port Washington wharf there, would be formalized.
[0:08:52] Voice 2: So if the LTC did want to move forward with this, it is designated as commercial in the current OCP.
[0:09:02] Voice 2: So that would have to be changed to a rural residential OCP designation.
[0:09:07] Voice 2: So it would need bylaw number 223 would have to be amended to reflect that change.
[0:09:14] Voice 2: And also that we heard about a concern that, well, there's two properties there.
[0:09:21] Voice 2: I wonder if I could use my mouse. So there's two properties, a larger one in the small sliver.
[0:09:26] Voice 2: There was mentioned that there would be a concern that the property owner would be allowed two dwellings because there's two lots.
[0:09:33] Voice 2: Well, we would write or we would draft the site-specific rural residential two zone so that it would only allow one dwelling in the zone.
[0:09:46] Voice 2: So it would only allow one dwelling on these two parcels.
[0:09:52] Voice 2: And I know there was a concern raised.
[0:09:55] Voice 2: This is a orthophoto of the area.
[0:09:57] Voice 2: So these are the two properties I'm mentioning here.
[0:10:00] Voice 2: I think there was a concern that this Water 4 area would be re-zoned.
[0:10:04] Voice 2: No. The old shed that's there, it would retain that Water 4 zoning.
[0:10:09] Voice 2: So this shed, there wouldn't be any residential use allowed for that shed.
[0:10:14] Voice 2: It would just be for these upland portions.
[0:10:16] Voice 2: So the LTC may want to consider re-zoning those two properties to a site-specific Rural Residential 2 zone.
[0:10:27] Trustee Maude: Okay, Kim, if I maybe just step and I see both trustees have their hands up.
[0:10:31] Voice 2: Oh, okay, great.
[0:10:32] Voice 2: So
[0:10:32] Trustee Maude: I don't
[0:10:34] Voice 2: know if you
[0:10:34] Trustee Maude: want to monitor that and just sort of allow them to interject if you want me to do that.
[0:10:38] Voice 2: I think you're, yeah, you can do that because I'm focusing on my slides. That's great. We can stop and go for questions if you like.

[0:10:44] Trustee Maude: we'll start with Trustee Morrison.
[0:10:47] Trustee Morrison: Yeah, and so can you flip back, Kim, to the close image where you can see the Waterford? Yeah, thank you.
[0:10:53] Trustee Morrison: you. So a clarification and then a statement. So the upland portion, upland, upland portion of this
[0:11:02] Trustee Morrison: two lots, yeah, thank you, that area, is my understanding, having visited the site with
[0:11:08] Trustee Morrison: the landowner, that that's the intent on where they want to build a residential. And frankly,
[0:11:13] Trustee Morrison: that's the only space that seems reasonable with setbacks from the ocean, with other blah, blah,
[0:11:18] Trustee Morrison: blah, blah. Absolutely. And so then that little sliver of property that's in the second property
[0:11:24] Trustee Morrison: closest to the water, they did not need to, they did not ask for that to be rezoned into
[0:11:30] Trustee Morrison: residential, that if it was left as commercial, that that was appropriate. And I kind of would
[0:11:38] Trustee Morrison: like to do that, like as a site-specific commercial zoning, just to alleviate any concerns in the
[0:11:44] Trustee Morrison: the neighborhood that there would be a residential property adjacent to that water for property so
[0:11:49] Trustee Morrison: if i can understand if there's any different any problem with that any like what what is the issue
[0:11:54] Trustee Morrison: if if we do that i
[0:11:57] Trustee Maude: see robert's got his camp
[0:11:58] Voice 7: i'll jump in there yeah i've got some history with this
[0:12:01] Voice 7: site including the court case with hunt who the former owner so the portion of the shed that's
[0:12:09] Voice 7: over the up that little upland sliver property is is very small like it's if you've ever looked in
[0:12:15] Voice 7: the shed or kind of poked around there there's kind of that little enclosed porch in the back
[0:12:20] Voice 7: and that's the only portion that's over the land the rest is over the water so keeping that little
[0:12:27] Voice 7: sliver property commercial one with the site-specific zoning for this basically was for
[0:12:33] Voice 7: the store that used to be there it wouldn't be practical on that little tiny property to keep
[0:12:38] Voice 7: that commercial because there would be no there would be no commercial use that could occur there
[0:12:45] Voice 7: i
[0:12:46] Trustee Morrison: guess then the question is the water i mean there is a building sitting in the water four
[0:12:50] Trustee Morrison: zone so is that like what is the point of having that secondary sliver is it it's not everybody in
[0:13:00] Trustee Morrison: the community just so you know thinks that that second piece of the property is the one that holds
[0:13:07] Trustee Morrison: the shed per se and so if there's any portion of that that holds the shed then it needs to be in
[0:13:14] Trustee Morrison: commercial what's the water for zoning is it site specific for commercial use or
[0:13:18] Voice 7: doesn't allow any
[0:13:19] Voice 7: doesn't allow any commercial use and that was the basis the whole basis of the court case
[0:13:23] Voice 7: was that the then the then owner so the the little those those little sliver piece and the old store
[0:13:32] Voice 7: property used to be owned by separate owners and so the owner of the little sliver piece
[0:13:39] Voice 7: occupied the shed um and attempted to have the zoning the commercial zoning
[0:13:47] Voice 7: for that little upland sliver extend over the water to include the whole shed
[0:13:52] Voice 7: and we were successful in court at saying no the zoning the commercial zoning is only on the land
[0:14:02] Voice 7: The water zoning is on the water.
[0:14:05] Voice 7: Eighty percent of the shed is over the water.
[0:14:09] Voice 7: Therefore, it can have no commercial uses.
[0:14:13] Trustee Morrison: I guess my basic question is the shed is there.
[0:14:17] Voice 3: Yeah.
[0:14:18] Trustee Morrison: The what is the utility of the shed other than a historic building?
[0:14:23] Trustee Morrison: Like, can it be used by the community at any point?
[0:14:26] Trustee Morrison: Or is that something we have to take up with the province?
[0:14:28] Trustee Morrison: and like or is it's like is rezoning the upland portion to residential potentially causing any
[0:14:38] Trustee Morrison: future residential problem so
[0:14:41] Voice 7: the first part with the shed itself any viable use of that shed from
[0:14:47] Voice 7: a sort of practical point of view would require a lot of work depending on what was being proposed
[0:14:53] Voice 7: like different things have been proposed over the years there was actually an application to
[0:15:00] Voice 7: rezone it for like a kayak business like a kayak rental business is the one that was operating at
[0:15:06] Voice 7: a port browning at the time and that was unsuccessful it's not in very good shape
[0:15:11] Voice 7: the shed so we need a lot of work from sort of a practical point of view and to actually even if
[0:15:18] Voice 7: that those obstacles could be overcome like the you know the the practical obstacles um
[0:15:26] Voice 7: it would be up to the ltc to rezone it to some other use um and then the owner or the
[0:15:37] Voice 7: yeah the the person who wanted to use it would have to get tenure from the crown for the portion
[0:15:44] Voice 7: that's over the water and would have to come to some sort of agreement with the upland owner
[0:15:50] Voice 7: or remove the portion that's over the land okay
[0:15:57] Voice 3: that's all your questions trustee morrison okay
[0:16:00] Voice 3: so over trustee campbell i
[0:16:03] Voice 8: think i think most of what i was going to say um deb sort of addressed
[0:16:08] Voice 8: because when i had a chance to meet uh the property owner um he had said basically the same
[0:16:16] Voice 8: thing that he was more interested in being able to put a residence there on the on the upland
[0:16:24] Voice 8: part of it and that if there for any reason was concern from the community about protecting the
[0:16:32] Voice 8: building um that he you know they they would love to be able to use it because it's a cool
[0:16:40] Voice 8: building and i had an opportunity to go inside it and check it out and and see and you know like for
[0:16:45] Voice 8: for a yoga studio or something like that to be usable in there, it would be really cool.
[0:16:53] Voice 8: But it needs a lot of upgrading.
[0:16:56] Voice 8: And he was told by the CRD building inspector that they wouldn't even really be able to get a permit to do any renovations to it
[0:17:09] Voice 8: just because of how far out over the water it is.
[0:17:12] Voice 8: and to do it would just be wouldn't even be cost effective to um to to try to undertake
[0:17:19] Voice 8: a renovation of that structure so it sort of becomes a historic yeah
[0:17:25] Voice 7: hold
[0:17:26] Voice 8: on to it kind of
[0:17:27] Voice 8: a site so yeah and
[0:17:28] Voice 7: that's that's the way it's been for over a decade now is yeah it's just
[0:17:33] Voice 7: kind of a vacant structure that has some historic character and just history around it yeah
[0:17:40] Voice 3: okay so
[0:17:45] Voice 3: So I guess it's back to Planner Stock Day.
[0:17:47] Trustee Morrison: Maybe just one last clarification question.
[0:17:51] Trustee Morrison: Kim, if we go for both of those pieces
[0:17:54] Trustee Morrison: being rural residential at this moment,
[0:17:57] Trustee Morrison: if the community protests that,
[0:18:00] Trustee Morrison: because one of the things in our OCP
[0:18:02] Trustee Morrison: that this is pushing against
[0:18:03] Trustee Morrison: is dispersed commercial locations across the island.
[0:18:08] Trustee Morrison: And so we do have dispersed commercial locations
[0:18:11] Trustee Morrison: across the island, but this is potentially removing one.
[0:18:14] Trustee Morrison: and so um but it's at the will of the current landowner it is like anyway so if if we decide to
[0:18:22] Trustee Morrison: um suggest that it go into rural residential in this round and we do the second reading what
[0:18:28] Trustee Morrison: happens if at the community information meeting there's just an outpouring of like don't take
[0:18:33] Trustee Morrison: away the commercial property zoning yeah
[0:18:35] Voice 2: so go ahead robert uh
[0:18:38] Voice 7: yeah i was you're probably gonna
[0:18:39] Voice 7: say the same thing but one of the options and this was discussed early on with the owner was
[0:18:45] Voice 7: just some sort of mixed use um where they could have residential or commercial or both like say
[0:18:52] Voice 7: a commercial on the main floor and residential above um you know nathan's a doctor you know
[0:19:00] Voice 7: he might want to you know at some point have a clinic right on the on the ground floor and have
[0:19:05] Voice 7: his house above that's not his current plans but um the zoning could be crafted in such a way that
[0:19:11] Voice 7: would allow both uses but
[0:19:15] Trustee Morrison: we can adjust that after after second reading if we need to yeah but not
[0:19:20] Voice 7: after the public hearing because it would be a change of use yeah
[0:19:23] Trustee Morrison: and this isn't a public hearing
[0:19:25] Trustee Morrison: it's just a more community okay great
[0:19:26] Voice 2: hopefully the bylaws as i mentioned will be in draft format
[0:19:31] Voice 2: at the february 25th meeting so the ltc still has an opportunity to amend the zoning then
[0:19:37] Voice 2: Okay, so I will move on from that. The next item is 3334 Port Washington Road.
[0:19:51] Voice 2: Sorry, where Braden has the TUP. There's been a TUP issued for this portion of the property for
[0:19:59] Voice 2: at least the last eight years to authorize the use of storage and wholesale of aggregates, soils,
[0:20:06] Voice 2: And I would imagine that's going to be a use that is going to continue for quite some time it's quite it's formalized in that location.
[0:20:14] Voice 2: So staff again are recommending legalizing the uses allowed in the temporary use permit by rezoning that portion.
[0:20:25] Voice 2: So the lower portion of that property to a site specific general industrial zone.
[0:20:31] Voice 2: And it's worth mentioning that that whole property, the property that's high, well, the entire property actually itself, I believe, is already designated as industrial in the North Pender Official Community Plan.
[0:20:47] Voice 2: So the LTC may want to propose amending bylaw 224 to allow those uses as outlined in the temporary use permit to legalize those uses by rezoning to a site specific general zone.
[0:21:03] Voice 2: Or also, the LTC could consider allowing all uses in the general industrial zone for that portion of the property, because there actually isn't a parcel right now.
[0:21:16] Voice 2: If the bylaws were to be adopted, there's not a parcel that allows all the general industrial zone uses. They're all very much site specific general industrial uses.
[0:21:26] Voice 2: So that's one last item that I wanted to highlight in terms of the general industrial items.
[0:21:36] Voice 2: And again, I just wanted to highlight why are the subdivision regulations being changed again?
[0:21:42] Voice 2: So they were included as part of By-law 224, I think about a year ago.
[0:21:46] Voice 2: And those are based on the recommendations from the Groundwater Sustainability Project.
[0:21:51] Voice 2: And the Galliano Island LTC is actually going through a similar process.
[0:21:57] Voice 2: And through the Galliano process, the senior planner working on those bylaws actually noted
[0:22:04] Voice 2: just a few additional changes or little tweaks that needed to be made.
[0:22:08] Voice 2: And so those also need to be made to bylaw number 224.
[0:22:12] Voice 2: So these are amendments that I'd like to put into 224 to present at the February 25th special
[0:22:21] Voice 2: meeting.
[0:22:21] Voice 2: So there are a couple minor amendments I mentioned in the staff report, and that's by adding a definition of compost facility to bylaw number 224.
[0:22:39] Voice 2: And also the Pender Parks and Recreation have actually requested the allowance of a boat structure, a boat storage structure on the upland portion here.
[0:22:55] Voice 2: We've already talked about that and the LTC is supportive.
[0:22:58] Voice 2: This actually parcel here is oddly enough zoned rural residential.
[0:23:03] Voice 2: So the LTC has already said that this should be a rezone to a community park.
[0:23:09] Voice 2: but the Parks and Recreation would also like
[0:23:12] Voice 2: a boat storage structure to hold a non-motorized boats.
[0:23:21] Voice 2: So in order to make these changes, as I mentioned,
[0:23:27] Voice 2: staff recommend rescinding second and first rating
[0:23:30] Voice 2: for the bylaws.
[0:23:32] Voice 2: So these are two draft motions the LTC may wanna consider
[0:23:36] Voice 2: for bylaw 224 and bylaw 224, again,
[0:23:39] Voice 2: Again, it's the thicker bylaw that will entirely replace the land use bylaw number 103.
[0:23:46] Trustee Maude: Okay, if I can maybe jump in, because I think we kind of glazed over the outhouse situation.
[0:23:54] Trustee Maude: And I suspect that both trustees probably want to have a little bit more fulsome discussion of that before considering doing it.
[0:24:02] Trustee Morrison: And I have a couple other questions on some of the other things you talked about, too.
[0:24:06] Trustee Morrison: Yeah.

[0:27:57] Trustee Maude: through their tup with ian's trust and it's and it's also overseen by diha and approved by the
[0:28:03] Trustee Maude: health officer um so in the past diha has been quite happy even though the regulation seems to
[0:28:10] Trustee Maude: be dated from the the province they've been happy to accept and said it's the most ecologically
[0:28:16] Trustee Maude: friendly way of doing things so from my understanding it's a new health officer with
[0:28:21] Trustee Maude: a new interpretation i understand that also goes to your soups and other issues on the island so
[0:28:27] Trustee Maude: i think there's a bigger issue um it's an interpretation issue and i i just think the
[0:28:34] Trustee Maude: trust should sort of keep its nose out of it right now until we get it figured out

[0:42:42] Trustee Morrison: like shared and learned and thought with them and we're continuing those meetings and we moved it
[0:42:48] Trustee Morrison: into this term, Aaron, specifically to be able to ensure that we address some of these issues.
[0:42:53] Trustee Morrison: That doesn't mean reversing a decision because it just means opening up that conversation a
[0:43:01] Trustee Morrison: little bit more deeply. So I want us to be extremely careful before we completely reverse
[0:43:07] Trustee Morrison: something that's already written in here, because there's a lot of people that have written in that
[0:43:13] Trustee Morrison: have and like I actually think it's really important to go back and read all the correspondence
[0:43:18] Trustee Morrison: from the beginning of this file forward so that you get a really full vision because

[0:43:31] Trustee Morrison: the election that I didn't listen to community and that's frankly wrong it's just that I that

[0:43:43] Trustee Morrison: be staff report, other kind of knowledge that we're bringing to bear on this.

[0:43:57] Trustee Morrison: And so I just need us to be cautious about listening to a few voices that might be the

[0:44:04] Trustee Morrison: and to really if we're going to go back into community about this then we need to advertise
[0:44:08] Trustee Morrison: really clearly to everyone so we get all of those people out and hopefully we've done that yeah

[0:45:00] Voice 8: that there's you know we saw it in our first LTC meeting we had a very vocal group of people come
[0:45:07] Voice 8: to speak on an issue at the beginning of the LTC meeting and and that meeting played out and since
[0:45:15] Voice 8: I've had equal or more people come very strongly opposed to how the beginning of that meeting
[0:45:25] Voice 8: meeting started and so it's there are very very vocal factions in our community
[0:45:31] Voice 8: um not all of who are going to show up to a meeting to speak on something um and and we
[0:45:39] Voice 8: have to figure out how to get that get that those groups of people together to figure out what is
[0:45:46] Voice 8: going on and more more engagement and so to me the idea of rescinding it to start over again
[0:45:52] Voice 8: It only gives us two weeks, basically, to try to come up with something in draft bylaw that can be brought to a community meeting, but that's maybe what it needs to be.

[0:46:10] Voice 8: I don't have an answer for the length of time that it's taken because, for me, I've only been involved in it for three or four months, right?

[0:46:22] Trustee Morrison: Yeah. So two or three things to think about, like, as we go forward on this.
[0:46:26] Trustee Morrison: So one is and this is this is a pros and cons. Right.
[0:46:31] Trustee Morrison: So like when when I started in the LTC last term, I inherited a bunch of decisions I totally disagreed with.
[0:46:41] Trustee Morrison: And part of those I had to live with because they were already past motions of things that just had to live with.
[0:46:48] Trustee Morrison: And we had to do the next best thing that we could do.
[0:46:52] Trustee Morrison: Some of the things that we did were pushed back against like the, in particular, the things with James Island, we pushed back on a decision that was made in a way that we could, that was legally appropriate.
[0:47:06] Trustee Morrison: We can, because this is not past, we and, you know, like, we can by vote of the three of us decide to open these up and, you know, to make the best decision for community, there are things that I think we need to consider potentially opening them up for.
[0:47:21] Trustee Morrison: the concern I have is that we are not starting from the beginning and we did inherit regardless
[0:47:28] Trustee Morrison: of who we are as individuals we did inherit three years of work on this that was in our
[0:47:35] Trustee Morrison: community in conversations and we have to be respectful of that and so because it's not just
[0:47:41] Trustee Morrison: about me or my decisions or just about the last LTC and their decisions are just about you and
[0:47:45] Trustee Morrison: your knowledge and like you know comfort with these it is about understanding completely the
[0:47:52] Trustee Morrison: history of it before we tinker with it too much so I'm happy to like open it up to think very
[0:47:59] Trustee Morrison: specifically right now and then work with can listen to community on the 25th understand what
[0:48:06] Trustee Morrison: the concerns are I think David we should also have some clarification because this came up last term
[0:48:12] Trustee Morrison: too, that fortunately or unfortunately, we can only make decisions based on information that
[0:48:18] Trustee Morrison: we can rationalize in a public and transparent way. So we have to have community members voice
[0:48:25] Trustee Morrison: their concerns in a way that we can all see. I can't just take your word for it that you're
[0:48:30] Trustee Morrison: talking to people, nor can you take my word for it that I'm talking to people. We all three of us
[0:48:36] Trustee Morrison: need to see clearly and hear clearly that shared public information to be able to make real
[0:48:41] Trustee Morrison: decisions that are transparent so if we can have some clarification on that too that would be
[0:48:46] Trustee Morrison: helpful and it's and it's difficult because in a small community not everybody feels safe coming
[0:48:50] Trustee Morrison: forward when there are issues like this and that's the dilemma that people have been experiencing
[0:48:55] Trustee Morrison: and that's why we try to keep these meetings safe and respectful but at the same time like
[0:49:00] Trustee Morrison: it's a real thing yeah
[0:49:05] Voice 3: so i think the way that the staff wants to do is

[0:52:45] Trustee Morrison: people wanted industrial zoning to be a separate issue, not in a joint land use bylaw like this.

[0:57:23] Trustee Morrison: trucks but again most of those big trucks are it's not really like heavy dirty kind of stuff
[0:57:28] Trustee Morrison: Braden's yard is quite significant traffic relatively to those other two uses and a lot
[0:57:34] Trustee Morrison: more like dust pulled out because of the types of things they're moving and there are concerns up
[0:57:40] Trustee Morrison: and down that road about the the road quality and the weight of all that the actual because it's
[0:57:45] Trustee Morrison: heavy too like the stuff they're moving and so the weight up there and the dust it's throwing up on
[0:57:50] Trustee Morrison: the organic farm there there is there was a move at one point because ben had thought about like
[0:57:56] Trustee Morrison: well is that a hub up there the question is there's like multiple places are already zoned
[0:58:02] Trustee Morrison: on the island for that type of operation and there are other locations that it could be done it's
[0:58:08] Trustee Morrison: It's just that, so the temporary use permit there
[0:58:11] Trustee Morrison: isn't necessarily the intention of it being there.

[1:32:33] Trustee Morrison: have if your final occupancy of a building is 3 000 square feet that you can split it into smaller
[1:32:42] Trustee Morrison: buildings there's pros and cons about that depending on the lot size so i'm not actually
[1:32:47] Trustee Morrison: for that on small lot sizes necessarily like that's why we have secondary suites because the
[1:32:53] Trustee Morrison: the footprint becomes so big that you remove all the overstory and vegetation if you have two
[1:32:57] Trustee Morrison: separate buildings. So I have some concerns about that on small properties, but on bigger properties
[1:33:03] Trustee Morrison: like five acres and plus type properties, I kind of feel like it might be reasonable because it
[1:33:09] Trustee Morrison: might allow for more diverse housing options across the landscape over time that actually
[1:33:15] Trustee Morrison: allow people to think, oh, I don't have to build a 3,000, 4,000 square foot house. I could build
[1:33:21] Trustee Morrison: like three smaller houses and now we have like more rental properties or more like and they can't
[1:33:26] Trustee Morrison: be subdivided like they still have to be all owned single family owned but that it allows for sort of
[1:33:33] Trustee Morrison: some alternative options so we've been toying with that idea back and forth and I know Kim I think
[1:33:39] Trustee Morrison: you were involved in some of those conversations too I am I had a really great conversation with
[1:33:44] Trustee Morrison: Janine about the flexible housing options over on Maine and David of course know about that and I
[1:33:50] Trustee Morrison: I just think that on some of our bigger, like, you know, where we're not going to necessarily
[1:33:56] Trustee Morrison: hurt the overstory, that would be my one issue is like, overstory protection is actually
[1:34:03] Trustee Morrison: important from a lot of different reasons, not necessarily every stick of tree, right?
[1:34:08] Trustee Morrison: But overstory protection and forest integrity is actually an important feature.
[1:34:13] Trustee Morrison: So how we balance that, it's a question.

[1:37:29] Trustee Morrison: killing rural uh community thing it's like that's all we need to say right and it's not safe frankly
[1:37:36] Trustee Morrison: like on a human level like there's a safe and health and wellness issue we also like there's
[1:37:43] Trustee Morrison: a lot of challenges we have but the more we can diversify our housing options the more we're
[1:37:48] Trustee Morrison: likely to also get affordable housing options that are not big like singular residences but like
[1:37:55] Trustee Morrison: dispersed across the landscape and I think that's more in keeping with our official community plan
[1:37:59] Trustee Morrison: and like just what we need in our community um the tiny homes thing though I had a thought about that
[1:38:04] Trustee Morrison: um it would be really interesting and I don't know if we can do it as part of this land use
[1:38:09] Trustee Morrison: bylaw but it would be good to collect information on it at the meeting is um it would be really good

[1:39:07] Voice 8: it's built locally it has to be built it would that could be something that would be put in would
[1:39:12] Voice 8: be to say that it has to has to actually carry a csa approval which would stop then sort of
[1:39:21] Voice 8: everything becoming a home built just because it's a trailer means that it's a means that it's a tiny
[1:39:28] Voice 8: house at least for a for a pilot project to see how something like that would go is that if it
[1:39:34] Voice 8: is actually register registerable and insurable um then it would have gone through a certain
[1:39:43] Voice 8: amount of checks and balances and been built by an approved builder so i mean that's just

[1:56:13] Trustee Morrison: like one of the the arguments for reducing it down was related to the fact that we only do
[1:56:21] Trustee Morrison: land use bylaw work right and so if we as a LTC are not convinced that there is sustainable water

[1:56:34] Trustee Morrison: we should reduce density and require rezoning to be go forward,

Chair Maude called the meeting to order at 1:00 p.m. He acknowledged that the meeting was
being held in traditional territory of the Coast Salish First Nations.
2. APPROVAL OF AGENDA
By general consent the agenda was approved as presented.
3. BUSINESS ITEMS
3.1 Land Use Bylaw Review
Planner Stockdill informed the LTC that it is necessary to rescind First and Second
Readings to make further amendments to the bylaws. By rescinding First and Second
Readings the proposed Bylaws revert to Draft Bylaws. As Draft Bylaws the Trustees can
give specific directions to staff for changes – as proposed Bylaws a formal resolution is
required to make amendments.
Planner Stockdill highlighted the items in the Staff Report regarding proposed changes
to Bylaws No. 223, 224 and 229:
There is a Special Meeting scheduled for Feb. 25, 2023 to present all proposed changes
to the community.
1. Outhouses (privies)
Outhouses are governed by Provincial legislation;
Outhouses are permitted in Provincial parks;
Question of use of outhouses in Community Parks.

2. Port Washington Road
Including in LUB would allow informal parking would to be legitimized;
The change to Rural Residential 2 from Commercial (C1{a});
The rezoning would just affect the Upland portion of the property, not the
water zone and foreshore;
Site Specific Rural Residential 2 Zone would be applied;
Regional Planning Manager (RPM) Kojima reviewed the history of the sliver
of land near the foreshore; and
LTC can amend the zoning application until a Public Hearing is held.
3. 3334 Port Washington Road
Temporary Use Permit (TUP) has been in place for the past 8 years;
Could legalize TUP by rezoning to a site specific General Industrial Zone;
Site designated Industrial in Official Community Plan (OCP) however the
property is not zoned for Industrial; and
Proposed Bylaw 224 would allow changes in uses within TUP.
NP-2023-010
It was Moved and Seconded,
that the North Pender Island Local Trust Committee, direct staff to write a letter
to the Capital Regional District to address the issue of outdoor lighting as
described in the Staff Report dated February 10, 2023.

Discussion:
There has been a three year process to review and propose changes to bylaws
related to this project;
There have been a number of community meetings held regarding the bylaw
changes related to this project;
There should be careful consideration prior to further changes;
Need to balance decisions regarding changes with community voices and be
very clear with the community about any changes and the reasons for the
changes; and

o Question of inclusion of site;
o Number of neighbours concerned about the rezoning of this property
especially regarding heavy traffic;
o There are other sites where this operation could be located that would
be better suited;
o It is expected that the owner will be making an application to rezone;
o Address as a specific conversation with community regarding site; and
o A “red line” version of proposed changes to the Bylaws would facilitate
a conversation at a Special Meeting.
Planner Stockdill informed LTC that Power Point presentation would be added to the
Project List web site for reference

Bylaw No. 229 to rezone 1200 and 1201 Port Washington Road to a site specific
Rural Residential 2 zone that would only permit 1 dwelling within the zone and
to rezone the Upland Magic Lake area from Rural Residential 1 zone to a site
specific Community Park 2.

Format for the Special Meeting
Speak to the background of the review and reasons for solutions and
alternatives explored;
Budgetary feedback with the Trustees to be transparent with public
allocation of funds to be discussed; and
Share the information discussed on Facebook and through web
postings.
Discussion:
Regarding the allowed Square footage of a dwelling, there would be a split of
footage between the buildings on the property;
There is a diversity of housing options including larger lots e.g., 5 acres plus;
There has been discussion of zoning for tiny homes and one positive reason to
have tiny homes is that they have less of an environmental impact while
providing sufficient and safe housing. The LTC could look at zoning for tiny
houses;
Some tiny homes can have CSA approval;
CRD would issue permits for a Tiny Home;
The ‘Shed’ on Port Washington Road is within Provincial responsibility: RPM
Kojima reviewed the history of site and the Province does not seem to have the
capacity to tear the shed down; and
Tearing down the ‘Shed’ could be a question of liability for the province.

to the Province to request a conversation about the future of the Port
Washington Road shed.

Susan Bennett (public attendee) spoke to the McKinnon Road density which is included
as part of Bylaw 224 which is still in draft. There are concerns regarding water
availability for the density being discussed for this property.
The current density of this property is proposed to be decreased and the site will be
discussed at the LTC Special Meeting. Correspondence regarding concerns/issues may
be sent to southinfo@islandstrust.bc.ca.
