[0:02:22] Trustee Allen (probable): attended the Trust Council in March in Nanaimo, and we approved a very large budget.
[0:02:29] Trustee Allen (probable): It was very challenging because in the government, they always have these new collective agreements,
[0:02:34] Trustee Allen (probable): and so it just results in salary increases that we have no control over.
[0:02:38] Trustee Allen (probable): So it's a $9.7 million budget.
[0:02:42] Trustee Allen (probable): And we have a new governance committee and an accessibility committee,
[0:02:46] Trustee Allen (probable): committee, which is part of a BC government push to, I think everybody has to have an
[0:02:51] Trustee Allen (probable): accessibility committee now. And then our next trust council will be in June on Gabrielle
[0:03:00] Trustee Allen (probable): Island, which is, you know, since the pandemic, we haven't gone to any other islands other
[0:03:03] Trustee Allen (probable): than the Big Island. So this will be certainly fine, I guess. And then I'm on the sub-housing
[0:03:09] Trustee Allen (probable): committee on the regional planning committee. So there's three of us. And so we are going
[0:03:14] Trustee Allen (probable): We're going to be going to the UBC Housing Summit in Vancouver on April 4th to 5th.
[0:03:21] Trustee Allen (probable): We get to meet shoes with big politicians and what's particularly of interest to us
[0:03:27] Trustee Allen (probable): is there's going to be a session on the rural and northern challenges and opportunities
[0:03:32] Trustee Allen (probable): session which addresses, it doesn't quite address the islands quite, but hopefully we'll
[0:03:38] Trustee Allen (probable): be able to get our words out and get them to have more sort of initiatives that really
[0:03:45] Trustee Allen (probable): address our issues on our islands versus, you know, some rural town on Vancouver Island,
[0:03:50] Trustee Allen (probable): let's say. And also another session is the regulations of short-term rentals. And our
[0:03:57] Trustee Allen (probable): chair, Peter Luckham, is going to be on there. And just looking at what UBCM has put out,
[0:04:03] Trustee Allen (probable): They had some recommendations, I think, back in September.
[0:04:08] Trustee Allen (probable): No, maybe it was June.
[0:04:10] Trustee Allen (probable): And so basically just looking at regulations
[0:04:12] Trustee Allen (probable): and how local governments can address Asian mental illness as well.
[0:04:16] Trustee Allen (probable): So, yeah, it's a very big, fulsome, and robust,
[0:04:21] Trustee Allen (probable): I don't know what those terms are, two days.
[0:04:25] Trustee Allen (probable): And so that'll be interesting,

[0:05:01] Voice 7: cell tower is a big issue and I know a lot of people are on both sides of the issue so it's
[0:05:09] Voice 7: going to be interesting to see how that sorts out over time. The other big issue of course is the
[0:05:14] Voice 7: OCP and the land use bylaw to review. We got the recommendations from our advisory planning
[0:05:24] Voice 7: and it's gone on to consultants and we're going to be getting a report at the end of the month
[0:05:31] Voice 7: where we get the report that would be uh whether we have a special meeting on that or not
[0:05:36] Voice 7: some suggestion we wait until june we're hoping to get it before this meeting
[0:05:41] Voice 7: so it could be on this agenda and someone's actually said we're going to but sonya has
[0:05:47] Voice 7: she's going to give us a synopsis of what's in there i think so anyway we'll hear about that
[0:05:54] Voice 7: and um as you all know the fiber optics is on the way so that's going to be good but it's not going
[0:06:00] Voice 7: to help us the zooms in this location but so those are the issues i think are really facing us and

[0:07:32] Voice 9: acquainted with the issues that are important to Hornby so don't think we
[0:07:38] Voice 9: hang out here from Daniel Arbour today and so that would bring us to a public
[0:07:45] Voice 9: comment period so I'll just look for a show of hands if anyone wants to address
[0:07:49] Voice 9: trust the local trust committee okay I'm going to start on this side and was it

[0:08:07] Voice 1: like to speak to two matters first I encourage you to issue a development
[0:08:11] Voice 1: permit for the proposed art center so record as a trustee I was the one who
[0:08:16] Voice 1: proposed creating this development permit area. The 2002 geochemistry
[0:08:22] Voice 1: groundwater study objected that the upland recharge area extended into the
[0:08:27] Voice 1: public use zone and the community is concerned about specific proposed uses
[0:08:31] Voice 1: in the zone. Things that were proposed were a vehicle repair facility, light industrial
[0:08:36] Voice 1: uses in the community trades and services area, community housing such as
[0:08:40] Voice 1: live-work units or a trailer park, a hostel, a swimming pool, a new fire hall.
[0:08:45] Voice 1: and all these are permitted uses in the zone but they involve significant water use and discharge
[0:08:51] Voice 1: and or potential contaminants which is why the dp area was created i don't think we envisioned such
[0:08:57] Voice 1: scrutiny being applied to an art center that does not involve significant water or potential
[0:09:03] Voice 1: contaminants so i would like that to be considered when you look at this dp proposal which is pretty
[0:09:09] Voice 1: much the same as the one that you approved in 2020 except the building is
[0:09:13] Voice 1: smaller. Secondly, I encourage you to move forward on the APC's recommendations.
[0:09:18] Voice 1: These were made a year ago after a year's careful deliberations and I notice
[0:09:23] Voice 1: now 10 years since the Local Trust Committee added looking at community
[0:09:27] Voice 1: housing and residential density to the project list. I support the need for
[0:09:34] Voice 1: community input but in my 20 years as a trustee, despite us trying many
[0:09:38] Voice 1: many approaches, we would only hear from special interest
[0:09:41] Voice 1: and keeners in the early stages,
[0:09:43] Voice 1: and usually comments were all over the place.
[0:09:45] Voice 1: I think community gets much more involved
[0:09:49] Voice 1: and the input is much more valuable
[0:09:52] Voice 1: when it's in response to something concrete.
[0:09:54] Voice 1: And the best way to do this is to draft bylaws
[0:09:58] Voice 1: for the community to review based on
[0:10:00] Voice 1: what the APC has recommended,
[0:10:02] Voice 1: which is what I think you originally intended
[0:10:04] Voice 1: with a first reading to happen in November
[0:10:06] Voice 1: and then a public hearing in February.
[0:10:09] Voice 1: That hasn't happened.
[0:10:10] Voice 1: A lot of time has been lost,
[0:10:12] Voice 1: and I'd like to see the process get back on track
[0:10:14] Voice 1: by getting the APC's recommendations into bylaw form.
[0:10:18] Voice 1: I'd really encourage the Seafords to find a way
[0:10:20] Voice 1: for island planners to do this
[0:10:22] Voice 1: because they have experience with the islands.
[0:10:25] Voice 1: They know how to trust processes and procedures,
[0:10:27] Voice 1: can draw on how other islands have addressed the same issues
[0:10:31] Voice 1: rather than consultants.
[0:10:33] Voice 1: Yann's trust has a $3.8 million budget for planning staff and facilities, and I'd like
[0:10:39] Voice 1: to see a way for staff to be assigned to this work rather than consultants.
[0:10:42] Voice 1: Thank you.

[0:10:44] Voice 1: And is

[0:10:59] Voice 6: On June 7th, I attended a meeting, I think it was a meeting, yes I did, and wrote this letter to our trustees.
[0:11:07] Voice 6: I'm going to read it again because I've never heard a response.
[0:11:10] Voice 6: These are critical questions that must be addressed before you decide to support the recommendations of the APC
[0:11:16] Voice 6: to shut down one of the few economic activities available on the islanders' home sharing.
[0:11:20] Voice 6: This is especially punitive to seniors who are struggling to hang on to their homes.
[0:11:24] Voice 6: homes. This is reckless and insensitive behavior that lacks vigor on every level. These are
[0:11:29] Voice 6: the questions I would like to see addressed before we can realistically make a decision
[0:11:33] Voice 6: and go through due process. Who is engaged in home sharing? How important is it to our
[0:11:38] Voice 6: local economy? What are the overall impacts on the environment and our neighborhoods?
[0:11:43] Voice 6: How important to the security and stability of home ownership is this activity? How much
[0:11:47] Voice 6: homelessness and financial distress would ensue by removing a rare opportunity to survive
[0:11:51] Voice 6: economically on Humber Island, especially for those on fixed incomes. How is the income
[0:11:57] Voice 6: from home sharing being used to create jobs and support other important objectives, such
[0:12:01] Voice 6: as food growing and year-round housing? How would that summer rental stock be used if
[0:12:05] Voice 6: home sharing were to be banned? Could there be even more problems arising if other forms
[0:12:10] Voice 6: of earning income became necessary to desperate homeowners? The stated hope is that year-round
[0:12:16] Voice 6: low-cost housing would immediately replace it. That simply has no merit or logic to it
[0:12:20] Voice 6: as housing shortages exist on all the islands where home sharing is non-existent?
[0:12:24] Voice 6: Where would displaced homeowners and renters who can't afford Hornby leave and go
[0:12:29] Voice 6: if they lost a major source of income?
[0:12:32] Voice 6: How would potential first-time homeowners be impacted
[0:12:35] Voice 6: without the legal source of home sharing income in support of their mortgages?
[0:12:38] Voice 6: What would the impact be on all the families that have been visiting and supporting Hornby
[0:12:42] Voice 6: for generations and have become part of the Hornby family?
[0:12:45] Voice 6: Are all
[0:12:46] Voice 6: of the homes being rented seasonably suited for year-round living?
[0:12:48] Voice 6: How does the trust propose to replace what may be critical income to many people?
[0:12:53] Voice 6: What other economic activities may be deemed less impactful?
[0:12:57] Voice 6: How many homeowners are actually being forced to move out of their homes for the summer
[0:13:00] Voice 6: so they can afford to keep their homes?
[0:13:02] Voice 6: How will massive inflation pressures affect people who previously were able to survive
[0:13:06] Voice 6: on pension savings and mainly low-paying jobs?
[0:13:09] Voice 6: Home sharing has been a tried-and-true way to survive through tough times.
[0:13:12] Voice 6: tough times. How would local businesses dependent on the season be impacted if
[0:13:17] Voice 6: they lost a significant chunk of their customer base? I look forward to hearing
[0:13:21] Voice 6: about your plan to address the above critical questions. So I'm just shocked
[0:13:25] Voice 6: that nobody bothered to answer any of those questions and none of these
[0:13:28] Voice 6: questions were included in the APC report. I mean it blows my mind to think
[0:13:32] Voice 6: that such a major decision would be made without that fundamental research being
[0:13:36] Voice 6: done. Now having watched this process over many decades I recognize that the
[0:13:41] Voice 6: trust has never asked these questions or supplied answers to them it's strictly let's get rid of
[0:13:46] Voice 6: this let's get rid of this let's get rid of this and yet nothing to replace it and we're struggling
[0:13:50] Voice 6: here we always have and i just can't believe that you are not addressing these questions

[0:14:38] Voice 17: meeting with the CVRD asked for more clarification on safety from the federal
[0:14:43] Voice 17: government and two other recommendations they felt they could not give
[0:14:48] Voice 17: concurrence to these questions until these questions were dealt with
[0:14:52] Voice 17: properly as you know there are many concerns about the cell tower on Hornby
[0:14:57] Voice 17: Island please continue to make sure the answers are clear before doing something
[0:15:03] Voice 17: then you do not fully understand do you have an update on this larger cell tower and will you
[0:15:10] Voice 17: keep Hornby Islanders informed thank you thank

[0:15:39] Voice 14: that you would either go back to the drawing board,

[0:16:44] Planner Zupanec: update report for the local trust committee is because Rogers isn't asking
[0:16:47] Planner Zupanec: for concurrence of the local trust committee at this time the last meeting
[0:16:52] Planner Zupanec: that there is a presentation and information package provided was simply
[0:16:56] Planner Zupanec: to provide the notification so there's no advancement of their application to the point
[0:17:00] Planner Zupanec: where they're asking for concurrence yet they're not ready for that stage so we're not ready to
[0:17:06] Planner Zupanec: provide any information to the ltc yet because we're waiting for rogers to provide us with a
[0:17:10] Planner Zupanec: complete redacted package of all the public correspondence they received to date as well as
[0:17:16] Planner Zupanec: any of the first nations referrals and comments that they can include so that we can provide the
[0:17:21] Planner Zupanec: local trust committee with an analysis of the correspondence, the next steps, and what
[0:17:27] Planner Zupanec: parts of the strategy, the protocol strategy that the LTC endorsed last September, that
[0:17:34] Planner Zupanec: Rogers would still be required to adhere to in order to meet the protocol with the local
[0:17:40] Planner Zupanec: trust committee, so that if there are any gaps, that the LTC can consider what direction
[0:17:45] Planner Zupanec: they need to give to Rogers.
[0:17:46] Planner Zupanec: So it might feel like there's a gap in information, but in fact, their process, as they
[0:17:51] Planner Zupanec: they mentioned that their last meeting
[0:17:52] Planner Zupanec: is a multi-year approval process.
[0:17:54] Planner Zupanec: They're at the very early stages of notification
[0:17:58] Planner Zupanec: and initial public consultation.
[0:18:00] Planner Zupanec: And so it's premature for us to provide any information
[0:18:03] Planner Zupanec: at this point, because we're actually not sure
[0:18:06] Planner Zupanec: what they're doing with the public input
[0:18:09] Planner Zupanec: they've received to date.
[0:18:10] Planner Zupanec: It might actually inform their decision
[0:18:12] Planner Zupanec: to make amendments to their proposal.
[0:18:14] Planner Zupanec: So they're doing the analysis of the input they've received.
[0:18:17] Planner Zupanec: And they might come back and say,
[0:18:19] Planner Zupanec: they actually would have adjusted their application or amended it or done something different.
[0:18:23] Planner Zupanec: So we're waiting to see what that looks like.
[0:18:26] Planner Zupanec: And you will be part of that process because it will appear on the agenda.
[0:18:30] Planner Zupanec: So when you look at the agenda packages, it will be clear that it's on there.
[0:18:34] Planner Zupanec: There's likely going to be some other correspondence in advance with the community
[0:18:38] Planner Zupanec: to advise some of those opportunities to participate in actual engagement
[0:18:44] Planner Zupanec: versus just seeing what information is being given to the elected officials for decisions.
[0:18:48] Planner Zupanec: So you can always contact our office as well. If you're wondering about status, there's a planner assigned to these things
[0:18:55] Planner Zupanec: that is your conduit for up-to-date status on any application, any project. So we're
[0:19:01] Planner Zupanec: responsible to you to provide you with that clarity if you feel that you're not accessing it through the regular channels.

[0:19:30] Planner Zupanec: correspondence in its raw format because then we have to do all the redacting so I've asked
[0:19:35] Planner Zupanec: Rogers to do that work and then when we get the package of all the public correspondence redacted
[0:19:41] Planner Zupanec: then it's in an official format that i can share with your elected officials which then becomes a

[0:24:52] Planner Zupanec: that preliminary stage. These are multi-year projects, just to be clear. They're not expedited
[0:24:58] Planner Zupanec: at any level of government, as far as I understand, regardless of the community's appetite for
[0:25:05] Planner Zupanec: or against a tower. There is federal and provincial steps that just require time, and as the applicant
[0:25:15] Planner Zupanec: and in this case Rogers, addresses technical issues or referral questions,
[0:25:20] Planner Zupanec: it could stall the ability for the local government to actually provide their concurrence
[0:25:26] Planner Zupanec: because there's technical issues that have to be addressed that could change the height, the siting, the setbacks.

[1:22:57] Planner Zupanec: staff posts it to the website, redacts the personal information so that real-time,
[1:23:02] Planner Zupanec: almost real-time, you can see what's coming in on a project up until the date of the meeting,
[1:23:07] Planner Zupanec: which they consider that correspondence and decide if they need to take any direction.
[1:23:11] Planner Zupanec: So that project website for the official community plan review is up to date as of yesterday.

The Chair called the meeting to order at 11:38 am. He acknowledged that the meeting was
being held in territory of the Coast Salish First Nations. He welcomed Trustees, Staff, Recorder,
and members of the public.

3. RISE AND REPORT - In-camera meeting January 20, 2023
The Chair reported that the Local Trust Committee (LTC) had appointed members for the
Advisory Planning Commission (APC) and Board of Variance at the last in-camera meeting.

Trustee Allen reported on the following:
Attendance at Trust Council in March in Nanaimo working on the budget.
A new Trust Governance Committee and Accessibility Committee.

As a member of the Sub-Housing Committee of the Regional Planning Committee, will
be attending an upcoming Union of BC Municipalities (UBCM) Housing Summit in
Vancouver in April.
Trustee Scott reported on the following:
The recent Herring Fest on Hornby was very well attended and very enjoyable.
The cell tower issue is a big one.
A consultants’ report on the Official Community Plan (OCP)/Land Use Bylaw (LUB)
Review is expected at the end of the month.
Fibre optics is coming soon to Hornby and will allow the LTC to use Zoom from the
Room to Grow location.
Welcome to Planner Thomaidis; and acknowledgement that Planner Zupanec has
moved into a senior planning role.
4.2 Chair's Report
Chair Peterson reported on the following:
Very happy to be back in person on Hornby Island.
Invitation to the public to pick up business cards from the Chair for contact
information for corresponding about issues of concern to them.
4.3 Electoral Area Director's Report – None
5. PUBLIC COMMENTS
Members of the public asked or noted the following:
The LTC is encouraged to issue a permit for the Arts Centre, which will have low water usage
and discharge.
The LTC should move forward with drafting bylaws based on the APC recommendations so
that the Hornby community will have something more concrete to engage with at public
meetings. Island Planners, rather than consultants, should draft these bylaws because
planners are experienced with the islands. Planning staff has a $3.8 million budget to work
with.
The member of the public read out a letter that questions the various unknown economic
and ecological impacts of home-sharing that need to be accounted for and acknowledged in
an uncertain environment of high inflation and other macroeconomic forces. The Islands
Trust and the APC are not addressing these larger issues.
o APC Chair Burton requested that the Chair call a point of order to maintain a safe
and respectful working environment.
The Comox Valley Regional District (CVRD) has requested further information from the
Federal Government on the Dove Creek Cell Tower. Will the Hornby LTC keep up to date
with the Rogers Cell Tower proposal and keep Hornby Islanders informed?
Why is a report based on the last LTC meeting regarding the Rogers Cell Tower not available
for this meeting?
o Planner Zupanec updated that planning staff was waiting for Rogers to provide a
complete redacted package of all received public correspondence and First Nations

comments to their proposal, so that the LTC can be provided with a complete
analysis. Members of the public may contact the planner assigned to the Rogers
application for up-to-date status at any time; and future reports will appear on the
agenda package.
The last time a cell tower was proposed on Hornby Island, there was a referendum; is the
process different now?
o Planner Zupanec responded that a formal referendum was not a federal protocol
requirement and would involve considerable cost. It was uncertain if the former
Hornby referendum was an informal or formal one.
Has an application been made by Rogers to the Provincial Government for use of land? The
Provincial Government does not have to meet with locals. Will there be time for locals to
react?
o Planner Zupanec noted that Rogers had made the necessary federal and provincial
applications and First Nations’ referrals as part of their preliminary process. It is
premature for the LTC to give their concurrence to the application at this stage
when many technical issues are still to be worked through.
A 5G Tower is much stronger than 4G and the energy pulses emitted will reach the entirety
of Hornby Island including wildlife and no one will be able to get away from it. The long-
term health effects are unknown. This technology is about global connectivity to mine local
data which has become a commodity. We will lose our privacy and our economy. Hornby
should remain a refuge and adopt the precautionary principal while the implications are
considered.
o Some members of the public gave a round of applause.
A reporter and journalist who has been reporting on the effects of electromagnetic radiation
for 30 years noted that the LTC and planning staff have recently received correspondence
from the Concerned Residents of Hornby Island objecting to the process of the Rogers
application and have provided a briefing document on the environmental ramifications of
this tower and on the difference between 4G and 5G technology. These documents are
available at willthomasonline.net. Can the LTC confirm that they received this
correspondence?
o The Chair and other Trustees confirmed that they had received the information
package. The Chair noted that a much more extensive cell tower application was
taking place on Salt Spring Island and that as the Chair of Salt Spring Island, he had
reached out to the provincial representatives of the federal regulators and
succeeded with getting a meeting with them in the next week. A senior Islands Trust
staff member will also attend this meeting. To date, the federal regulators do not
seem to share the same health and environmental impact concerns being brought
up at today’s meeting. The Chair offered to bring up these concerns at the upcoming
meeting.

Trust Model Cell Tower Strategy says that the LTC can concur, not concur, or concur with

Staff noted that the drafting of an LTC letter to the new Chief and Council of K'omoks
First Nation was being coordinated by Trust Area Services staff; and the LTC would
receive a copy of the letter before it was sent.

9.1 HO-DP-2023.1 (Hornby Island Arts Council - 2115A Sollans Rd.) DP Amendment - Staff
Report (Late Submission)
A Planner presented the staff report that recommends that Trustees approve a
development permit amendment application for the construction of a new Hornby
Island Arts Council Arts Centre building, noting that the original building footprint had
been reduced; that the original proposed outdoor hardscaped stage area had been
changed to a landscaped courtyard; and that the required hydrology report had already
been waived for what was a much larger building footprint in the original development
permit approval of November 2020.
The applicant noted that they had been asked to provide a greywater containment
system for irrigation and would comply with this, if necessary, but would rather not
because the system is very expensive at $50,000 and the plan is to landscape with
indigenous plants that do not require watering.

10.1 Hornby Official Community Plan Project Status Update - verbal update
A Planner updated that the consultants’ final report was expected soon and could be
considered at the next regular business meeting in May or, more thoroughly, in a stand-
alone electronic meeting before then; likely in the third week of April.
Trustees recommended a late afternoon meeting on a Monday or a Friday.

The staff report from the Director of Legislative Services recommended that Trustees

A Planner noted that Trust Council had approved $8,000 for expenses for the Hornby
OCP Amendment Review for the current fiscal year. Further funds were available for a
minor project.

A Planner noted that administrative staff would be assisting in setting up a repository on
the LTC webpage for all correspondence received regarding the Rogers cell tower
application. She added that correspondence for active applications and projects do not
appear in the agenda packages rather, personal information is redacted before being
posted chronologically on the proper project or application page of the LTC website.
14. WORK PROGRAM
14.1 Active Projects Report dated March 14, 2023
A Planner clarified that an item recently added to the Comprehensive OCP Review
Project: “add consideration of steep slope area regarding heritage portion of Central
Road to Ford Cove and consideration of wetland categories,” could be added to the
major project; or be considered for a stand-alone minor project.
The APC Chair added that the APC had previously addressed the steep slopes issue in
the Riparian Areas section of their recent referral.
