[0:01:01] Trustee Luckham: Peter Luckham, of course, I'm the chair of Islands Trust Council.

[0:01:05] Trustee Luckham: This is Laiakson and Penelope Territory, specifically.

[0:01:08] Trustee Luckham: specifically. We're meeting today broadly across Coast Salish Territory to talk about a significant

[0:01:15] Trustee Luckham: piece of work associated with an agreement with the Coast Salish First Nation, the S'na-Nas

[0:01:20] Trustee Luckham: First Nation. I just want to recognize that this is where we live and work. It's been the home to

[0:01:28] Trustee Luckham: Coast Salish people since time immemorial. There's joy and sadness in this place as

[0:01:35] Trustee Luckham: a joy historically of family and friends and births and deaths and

[0:01:41] Voice 8: marriages and everything

[0:01:43] Trustee Luckham: else that comes along with society, but there's also the impact of the colonists that arrived

[0:01:50] Trustee Luckham: here, and we're certainly doing everything we can to reconcile that. Many of us are, and today's

[0:01:57] Trustee Luckham: work is part of that, so grateful to be here, and I know that you're all also glad to be here.

[0:02:05] Trustee Luckham: Just to include everybody as we go forward, I do have regrets from Joe Bernardo and Ken Hunter, and I do believe Janine Dodds is unable to join us today.

[0:07:46] Trustee Luckham: discuss so if there are no concerns i'll just ask for a motion to approve the agenda anybody raise

[0:08:34] Trustee Luckham: agreement between the island stress council and the snana us first nation um when we as we move

[0:08:41] Trustee Luckham: through this item staff are going to make some presentations um uh to us and then um ideally

[0:08:47] Trustee Luckham: if we get the motion on the table then we can have discussion and questions about it and then

[0:08:53] Trustee Luckham: advance accordingly and so if that's all right and electronic hands is what I want to use for

[0:09:01] Trustee Luckham: voting David Mahler is assisting me as the legislative services director he's going to do

[0:09:07] Trustee Luckham: the vote counting so once we get to that point by asking David to tally the votes and then we will

[0:09:14] Trustee Luckham: will declare what the outcome is. So before I introduce staff on this, I do want to say that

[0:09:21] Trustee Luckham: this is, I think, is a really special moment, a moment of joy, in fact, for us to be coming back

[0:09:27] Trustee Luckham: to protocol agreements with nations. We've had two protocol agreements for some time with Snenemo

[0:09:35] Trustee Luckham: and with LAX and First Nation. And although we may not have done a lot of work around that,

[0:09:43] Trustee Luckham: it's certainly a mechanism that has provided us the opportunity to have meetings and discussions

[0:09:48] Trustee Luckham: with nations when it's necessary and this one is no different than than that and um i think

[0:09:54] Trustee Luckham: for what's important here for me uh personally and i think for council is that um we are advancing

[0:10:01] Trustee Luckham: our our work our declaration um uh that we've made and our reconciliation work um to uh work

[0:10:10] Trustee Luckham: work with nations and enter into a time of respectful conversation and discussion to

[0:10:17] Trustee Luckham: recognize each other's needs and interests in the Island Trust area, which we have been provided

[0:10:26] Trustee Luckham: the opportunity to provide land use planning. But of course, there's so much more here. And so

[0:10:31] Trustee Luckham: with that, I'm going to turn it over to CAO Hotzenpiller to introduce the RFD, and he'll

[0:10:38] Trustee Luckham: I'll hand it off to Clare Brader.

[0:10:43] Voice 9: Good afternoon, Trust Council.

[0:10:44] Voice 9: Great to be with you as usual,

[0:10:46] Voice 9: particularly with this moment here

[0:10:49] Voice 9: where you're going to consider approval

[0:10:50] Voice 9: of a protocol agreement between yourselves

[0:10:53] Voice 9: and the Sminas First Nation.

[0:10:57] Voice 9: I'll just make some brief remarks, as will Clare,

[0:11:00] Voice 9: and then we'll turn it to you

[0:11:01] Voice 9: for your consideration and questions.

[0:11:03] Voice 9: This agreement, I think, could reasonably be considered

[0:11:07] Voice 9: to action our responsibilities to collaborate and work in cooperation with first nations governments

[0:11:12] Voice 9: i think it will make our life easier and better and more transparent as we do business between us

[0:11:19] Voice 9: from an administrative point of view we're thankful to be at this point

[0:11:25] Voice 9: along with the cooperative elements that will rise out of this agreement this is a means of

[0:11:31] Voice 9: being clearer timely more efficient and i believe over time this will be more cost efficient for the

[0:11:38] Voice 9: organization as we work with this nation and other nations as we as we develop the ability to

[0:11:44] effectively um

[0:11:46] Voice 9: work in a protocol agreement situation the agreement itself is is simple

[0:11:51] Voice 9: um i think it has room for a reasonable room for amendment um as time goes on and we discover the

[0:11:58] Voice 9: things that need to be tweaked so i think that's a positive uh there are some costs which i believe

[0:12:04] Voice 9: are justifiable um as we work towards furthering these agreements um i had the opportunity to sit

[0:12:10] Voice 9: in the negotiations with the nation um and i can tell you thematically that this is very practical

[0:12:17] Voice 9: discussions business oriented discussions um how to be clearer um practical timely um sort of

[0:12:25] Voice 9: address each other's business that seemed to be the flavor of the discussion for the most part

[0:12:30] Voice 9: uh and then finally i'd say that uh it's easy to sign a protocol agreement but it will be the

[0:12:35] Voice 9: maintenance of these agreements over time and as we measure them that that's really where the

[0:12:40] Voice 9: success is going to be and as you contemplate into the future of perhaps having more of these

[0:12:46] Voice 9: agreements um we'll be working with you and reporting back to you on um what is it what

[0:12:52] Voice 9: what does it take to be successful in this area?

[0:12:55] Voice 9: And sorry, the last thing I'll say is,

[0:12:57] Voice 9: generally I would say the administrative part

[0:13:00] Voice 9: of the organization and I believe that the political

[0:13:04] Voice 9: leadership over the last five or six years has invested

[0:13:09] Voice 9: time, interest, abilities and thinking

[0:13:13] Voice 9: to get us to a place where I think we can

[0:13:16] Voice 9: more effectively work in protocol agreements.

[0:13:18] Voice 9: This is a maturation of our work with nations

[0:13:20] Voice 9: over the last number of years.

[0:13:21] Voice 9: so happy to be at this moment and Claire who's been the principal on this agreement will

[0:13:26] Voice 9: provide some remarks now.

[0:13:29] Voice 15: Okay thank you CAO. So essentially we're pleased to present this for

[0:13:33] Voice 15: your consideration today. If you grant approval we'll forward it on to the minister for the

[0:13:39] Voice 15: minister's consideration of approval. Generally this sets out how we're going to work together

[0:13:44] Voice 15: and is meant to underpin positive and cooperative relationships. At the end of the day though as

[0:13:49] Voice 15: as the CAO mentioned, this is about relationships and it will be about the real work of working

[0:13:53] Voice 15: together that will prove the success. This is intended to be entered into by council and on

[0:13:59] Voice 15: behalf of the Leskeetee LTC. This is, although their territory may be broader, this is at the

[0:14:05] Voice 15: request of the nation that their primary interest is with Leskeetee, but it doesn't preclude other

[0:14:10] Voice 15: people coming to conversations and coming to meetings. So certainly there's a lot of flexibility

[0:14:14] Voice 15: provided for in the agreement generally this is a fairly simple agreement and it

[0:14:25] Voice 15: has been reviewed by the nation and now is with you for review and essentially

[0:14:30] Voice 15: it will not take effect until it's had approval of the minister and at that

[0:14:34] Voice 15: time once we've got that approval we would bring it back to you to appoint

[0:14:36] Voice 15: members of the working group and would then schedule those meetings thank you

[0:14:43] Voice 15: for that report and back to you chair luckham

[0:14:46] Trustee Luckham: okay thank you um so thank you very much for that uh

[0:14:50] Trustee Luckham: claire i appreciate that and the work that has gone into advancing this and uh i also want to

[0:14:56] Trustee Luckham: recognize um legal teams uh on both sides of the agreement have engaged uh on this to ensure that

[0:15:05] Trustee Luckham: it meets uh all of our needs and um just i will just note that uh in the um the our the request

[0:15:12] Trustee Luckham: for decision, the cover briefing on page three of that document, the first paragraph, there's

[0:15:20] Trustee Luckham: actually a word missing. There's another typo to do with dates, but that's less critical.

[0:15:26] Trustee Luckham: And this is only in the request for decision document, not the protocol. It says on the first

[0:15:33] Trustee Luckham: line of page three, meetings of the working group established under this agreement are committee

[0:15:39] Trustee Luckham: committee meetings, it should say are not committee meetings. And so, and then it follows

[0:15:45] Trustee Luckham: on to say, and therefore of not, are not public meetings. So just want to make sure that you're

[0:15:50] Trustee Luckham: aware of that. There was some conversation around that topic. So I would like to, if there's no

[0:15:58] Trustee Luckham: objection, to ask the chair of the Mesquite Island Local Trust Committee, Toby Elliott, to move the

[0:16:07] Trustee Luckham: motion and get that on the table um and then indeed start the discussion and questions and

[0:16:13] Trustee Luckham: debate on uh advancing this uh today or not so uh toby elliott uh would you like to uh advance

[0:16:21] Trustee Luckham: the motion um

[0:16:23] Voice 18: could i ask something first peter oh sure certainly sure i'm just wondering could

[0:16:29] Voice 18: we discuss it in general before the motion is put on the table because the motion then limits

[0:16:35] Voice 18: That's the discussion that I think, just a thought.

[0:16:41] Trustee Luckham: And I did think about that and considered that,

[0:16:43] Trustee Luckham: but given the timeliness and the nature of it,

[0:16:51] Trustee Luckham: but I wanna be fairly liberal in the discussion.

[0:16:53] Trustee Luckham: And I've used that word specifically

[0:16:55] Trustee Luckham: to permit that discussion to happen

[0:16:58] Trustee Luckham: during the context of the debate.

[0:17:23] Voice 21: protocol agreement between Islands Trust Council and Stanaas First Nation and request staff to

[0:17:28] Voice 21: forward the protocol agreement to the Minister of Municipal Affairs for approval. Thank you.

[0:17:46] Trustee Luckham: electronic hands. And I'm going to try and maintain a speaker's list, although it jumps around quite a

[0:17:53] Trustee Luckham: bit on that speaker's list. And after you've finished speaking, I'll just ask you to lower

[0:17:57] Trustee Luckham: your hand and that will ideally make it a little smoother for me. So my first two speakers are Tim

[0:18:04] Trustee Luckham: Peterson, Leskete Island and Michaela Laroni.

[0:18:09] Voice 5: Thank you chair and good afternoon trustees.

[0:18:14] Voice 5: I'd just like to start by saying I'm excited that we're taking on the verge of taking this

[0:18:21] Voice 5: this step towards furthering reconciliation goals.

[0:18:26] Voice 5: Just wanted to point out a couple of things here

[0:18:31] Voice 5: in terms of the agreement itself,

[0:18:37] Voice 5: you'll note that Liskety Island Local Trust Committee

[0:18:40] Voice 5: is specifically referred to multiple times,

[0:18:44] Voice 5: I think five or six, which reflects as Chair Luckham

[0:18:49] Voice 5: mentioned the specific desire in this agreement by Snanoas to start working with the Liskiti

[0:18:56] Voice 5: Island Local Trust Committee. A little bit of background. Last term, the Liskiti LTC was

[0:19:04] Voice 5: working on its official community plan project. We put out our normal referrals and did receive

[0:19:12] Voice 5: a referral response from Sinaloa's First Nation. At that time they were looking to open a dialogue

[0:19:20] Voice 5: with us and the decision of the LTC was to pause progress on our OCP until such time as we could do

[0:19:33] Voice 5: that. There was a little bit over a year I think at least that we paused the project in respect of

[0:19:41] Voice 5: of wanting to honor those wishes.

[0:19:43] Voice 5: So for me, this is exciting that we're on the brink

[0:19:48] Voice 5: of opening a formal working relationship.

[0:19:53] Voice 5: And for the folks on Luskeety Island,

[0:19:56] Voice 5: it's also exciting that we'll be able

[0:20:00] Voice 5: to have those discussions and move forward

[0:20:02] Voice 5: with our OCP project.

[0:20:05] Voice 5: Just wanted to add my personal level of confidence

[0:20:11] Voice 5: that our legal team at Young-Anderson

[0:20:14] Voice 5: has vetted this agreement.

[0:20:18] Voice 5: And also just note that on page 12 of the package,

[0:20:29] Voice 5: sections, let me just find it here for a moment.

[0:20:34] Voice 5: Jumping forward, sections 36 to 40

[0:20:42] Voice 5: under the effect of the agreement uh mentions that the agreement does not federally limit or

[0:20:49] Voice 5: restrict the jurisdiction of the parties and uh i'll just add the one where it says it does not

[0:20:55] Voice 5: create any rights or legal obligations between the parties does not create or give rise any

[0:20:59] Voice 5: contract contractual obligations to the parties um not being a lawyer uh but i take those parts uh

[0:21:09] Voice 5: 36 to 40 as certainly satisfying my questions

[0:21:15] Voice 5: about the scope of the agreement

[0:21:19] Voice 5: and I'm in support of the motion

[0:21:21] Voice 5: and I certainly hope that the majority here are as well.

[0:22:26] Voice 4: with this dishonest first nations so that um yeah we can have our community plan move forward and

[0:22:34] Voice 4: and we can be respectful of the First Nations' needs

[0:22:37] Voice 4: as we do have a lot of similar,

[0:22:39] Voice 4: the Ons Trust and First Nations' usage of lands

[0:22:41] Voice 4: has a lot of similarities.

[0:24:10] Voice 18: Is there an opportunity to take this agreement and make it a template,

[0:24:15] Voice 18: make it something that can be reused and reused by all parties,

[0:24:20] Voice 18: not reused as in individual multiple agreements,

[0:24:25] Voice 18: but that there is one agreement which then is updated and signed by all parties in an effort to somehow manage the resource demand that these will entail.

[0:24:46] Voice 18: So, yeah, in principle, I see that all the intentions are good, but I look at the complexity going forward, and I sort of scratch my head at how we're going to manage this.

[0:25:12] Voice 9: um i think there's a really a neighborliness that's being expressed here by the trust the

[0:25:17] Voice 9: nation asked us to consider their funding window which is similar to ours march 31st that they

[0:25:23] Voice 9: could get they had some funds they could allocate to this work um so that was the request and we're

[0:25:28] Voice 9: simply trying to um work with them to that regard um while you have seen this agreement for four or

[0:25:36] Voice 9: five days it's about two years of um discussion um initial discussion and subsequent meetings so

[0:25:44] Voice 9: um feel feel assured that the organization itself has been um expressing itself well uh over a

[0:25:51] Voice 9: reasonable period of time and i also think that the simplicity of the agreement itself

[0:25:56] Voice 9: speaks it's it's not um terribly complex so it's uh it's something that i think both parties can

[0:26:04] Voice 9: readily agree to giving the timelines at hand. In terms of an idea of an omni agreement around

[0:26:13] Voice 9: all parties, I think that we could spend lots of time talking about that. Initially, I would

[0:26:21] Voice 9: consider that that might be administratively interesting to the Islands Trust, but nations

[0:26:27] Voice 9: have their own interests that they're expressing. This nation has its own self-governance principles

[0:26:33] Voice 9: polls and they've come to the islands trust and have an agreement so that we can better share

[0:26:39] Voice 9: information and collaborate so we've responded to that and i think that that's something you'll

[0:26:45] Voice 9: consider into the future is working with individual nations for the most part that's not

[0:26:50] Voice 9: to say if you look back at the 2008 agreement or i think the 2002 there's lots of language that's

[0:26:57] Voice 9: similar to this. So I think that in consideration of it being a template, practically, I think that

[0:27:08] Voice 9: is the case. So yeah, I think that's about as much detail as I can provide for that series of

[0:27:14] Voice 9: questions. Thanks.

[0:27:15] Voice 18: So one follow-up, if you don't mind. So how does it affect islands other than

[0:27:21] Voice 18: the ski t so

[0:27:23] Voice 9: um trust council is entering into the agreement um and i i don't it's hard for me

[0:27:29] Voice 9: to pro i don't understand the word effect um this is uh there's no obligation created for

[0:27:36] Voice 9: saturn island that you have to undertake um one activity or another um the i what i think is one

[0:27:43] Voice 9: of the strengths disagreement is there's the ability to revisit and i'll draw i'll draw an

[0:27:47] Voice 9: example of. Right now there's particular interest in the Laskiti LTC because of their OCP process

[0:27:54] Voice 9: and interest in lands for them to have a focused conversation, but there's the ability in the

[0:28:00] Voice 9: future if that moved to an another area that the nation had interest in, maybe it was Gabriola or

[0:28:07] Voice 9: somewhere else, then you could add people, elected officials from Gabriola could come up, we could

[0:28:14] Voice 9: could change the the joint working group so you could bring other people in um so it would be

[0:28:19] Voice 9: under that premise that um any ltc or anyone or any other elected official would would come into

[0:28:25] Voice 9: the conversation and that would be something that trust council would be aware of because trust

[0:28:30] Voice 9: council appoints the joint working committees um but short answer well too late for a short answer

[0:28:35] Voice 9: there's nothing specific new responsibilities that are recorded saturnus specifically or anyone

[0:28:41] Voice 9: um ltc except obviously we've named um the trustees from uh war the ltc from the scheme

[0:29:35] Trustee Patrick: So I guess my question more would be regarding agreements. It is an interesting, you know, something that we're gonna have to map out and look at is, you know, do we have 36 agreements and we have this complex matrix of how we get involved?

[0:29:50] Trustee Patrick: I think there's, I think this has got to be given some thought on the various islands that will have, you know, one nation may have interest in multiple islands and how do we make sure.

[0:30:00] Trustee Patrick: having those that communication in a very effective way so that we don't come back to the

[0:30:05] Trustee Patrick: stuck place again um and or options of is it possible that trust council delegate the authority

[0:30:13] Trustee Patrick: to a particular uh trust uh local trust committee if the interest is exclusive to one nation or not

[0:30:19] Trustee Patrick: exclusive is probably not the right area but dominated uh one one local trust area so i i

[0:30:25] Trustee Patrick: I think it's more as we go into the future that we create a process that's going to be workable, understandable, not just from us as trustees, but from the people in our area.

[0:30:38] Trustee Patrick: And that would, so I guess be my questions is, and could you delegate it to a local trust committee?

[0:30:49] Trustee Luckham: Through the CAO, do you wish to address any of the questions there, sir?

[0:30:54] Voice 9: yes well certainly the overall point of how we maintain effectively um a variety of protocol

[0:37:09] Voice 6: rather than just going to say oh well you know we got a letter fine we heard you but you know

[0:37:14] Voice 6: nobody knows how we heard you um

[0:37:18] Trustee Luckham: and that's absolutely uh fair we we we shall address that

[0:37:25] Trustee Luckham: correspondence um because of course it came in late couldn't be added to the agenda and um

[0:37:31] Trustee Luckham: and will be received as correspondence at the next executive committee meeting i've already asked for

[0:37:38] Trustee Luckham: of that. I would say that some of the questions that were in there essentially didn't grasp all

[0:37:45] Trustee Luckham: of the particular surrounding a protocol agreement. I have read it, but I am not prepared

[0:38:44] Voice 17: And it isn't up to us to always figure out how to manage what they would like us to do.

[0:38:54] Voice 17: And I don't see anything like a template that would cover, you know, that would be relevant to all of the First Nations in the trust area.

[0:39:04] Voice 17: But certainly the more we do this, probably the better off we will get at working with items like this.

[0:39:15] Voice 17: So I say I'm just so pleased that we are able to work on this with this Nanas Nation.

[0:39:35] Voice 21: um trustee yates um i had a thought when i when i heard the word efficiency and sort of managing

[0:39:44] Voice 21: this complexity of agreements and one thing that i'd put out there is that efficiency

[0:39:50] Voice 21: Efficiency and the way that we tend to do things can be a very colonial construct, and it's a product of the way that our processes work, but it doesn't necessarily take into account where each First Nation is with their processes, their relationship to the land, where they're at with the federal and provincial governments, and how they would like to engage.

[0:40:14] Voice 21: age and so I believe it's only in seeking to learn and really having a learner's mind about this that

[0:40:24] Voice 21: we don't we kind of need to put away our preconceived notions of how things will go and we

[0:40:29] Voice 21: can only do this in a good way through relationship and spending time together so it is going to take

[0:40:36] Voice 21: time it is about building relationship first rather than a product first you know we've often

[0:40:43] Voice 21: and put our products of OCPs, we need to get these bylaws passed, we need to advance our

[0:40:48] Voice 21: community interests. And what we're talking about is neighbor to neighbor interests, shared

[0:40:56] Voice 21: areas of mutual interest on the same lands, that we now have to take nation's interests into

[0:41:03] Voice 21: account. That is the law. So that is the law to according to DRIPA. And as an agency of the

[0:41:11] Voice 21: the province. We are bound by DRIPA and the province has a reconciliation action plan with

[0:41:16] Voice 21: many steps that it is undertaking and that will be carried along with that. And then we have a

[0:41:22] Voice 21: responsibility as a local government and as citizens to undertake reconciliation in our

[0:41:28] Voice 21: land use planning processes. It's very clearly spelled out. So I don't think there's any

[0:41:33] Voice 21: ambiguity about our responsibilities here. The author of that letter, I read through those

[0:41:38] Voice 21: comments. And I just think there's some confusion between what is constitutional duty of the Crown

[0:41:44] Voice 21: to consult with Aboriginal rights and title and local government responsibility to consult with

[0:41:51] Voice 21: nations. So I'm very satisfied that this document is a reflection of really good conversation between

[0:42:00] Voice 21: the nation that's involved and the local LTC that it wants to engage with. That's all this is.

[0:42:06] Voice 21: It doesn't have to be more complex than that. It sets out the terms for how they want to engage together. So I'm really pleased with it. I love to talk about this stuff with anybody. And I look forward to more of these conversations because this is an evolving area of law and relationship building. But I think that's what we need to remember. This is about relationship building first and setting those terms. So letting go a little bit of our efficiency construct might be helpful.

[0:43:41] Voice 20: agreement that would be a one-size-fits-all I think that's going to be too constrictive and

[0:43:46] Voice 20: I really like how like I said open open this um protocol agreement is so I just wanted to speak

[0:43:53] Voice 20: my support and I'm going to keep it short because like I said trustee he spoke very eloquently about

[0:43:57] Voice 20: what I was thinking so thank you very much thank

[0:44:25] Trustee Middleton: a professional class so having said that i have a question that's probably somewhat naive uh

[0:44:32] Trustee Middleton: but I'm sure others have thought it.

[0:44:36] Trustee Middleton: The Slamet Nation expresses Aboriginal rights and title

[0:44:40] Trustee Middleton: to the territories also encompassing Leskeetee Island.

[0:44:44] Trustee Middleton: What does that mean in terms of our signing

[0:44:48] Trustee Middleton: protocol agreements with individual nations

[0:44:50] Trustee Middleton: where there is overlapping claim of right and title?

[0:44:53] Trustee Middleton: I know in some case there is obviously can be shared

[0:44:55] Trustee Middleton: right and title, but it's a genuine question.

[0:44:59] Trustee Middleton: I'm just curious what happens there or how do we navigate that or do we navigate that?

[0:45:13] Voice 15: nations and really it's for senior levels of government to establish final settlement of

[0:45:25] Voice 15: though, we have these relationships already. This is just formalizing how we're going to engage in

[0:45:30] Voice 15: conversation with the existing relationships that we have but certainly i'm sure the minister will

[0:45:35] Voice 15: be contemplating issues of rights and title and treaty negotiation as the minister contemplates

[0:45:40] Voice 15: approval of this agreement and if the province would like to see something tweaked then they'll

[0:45:44] Voice 15: certainly let us

[0:45:46] Voice 14: know and we'll work with them around that thank

[0:47:45] Voice 21: and then if we could move the question,

[0:47:51] Voice 21: I would just, in answer to Trustee Middleton's question, there's a pretty clear distinction between the local government engagement with First Nations and the province's constitutional duty to consult.

[0:48:04] Voice 21: They're very different. And that's so the engagement between local governments and First Nations and activities that could impact Aboriginal interests are considered a forum for exploring these opportunities for cooperation and collaboration.

[0:48:21] Voice 21: I'm reading literally from the province of BC's sort of directive. And so I think it's helpful to, we really need to put aside the question of treaty rights. That's not ours to consider. There are overlapping rights, of course.

[0:48:38] Voice 21: And as Director Frater said, that's up to the minister to sort of sort out the intent, I believe, of protocol agreements. And just like Trustee Fass said, is how do we work together? What are we talking about?

[0:48:52] Voice 21: And so it'd be great if we could have multiple protocol agreements with every nation in the Liskiti local trust area, because then we're going to be able to work out those potential disagreements or issues of discussion on a very friendly level, instead of sort of being afraid to engage because, oh, we're talking to one nation, but this nation has treaty rights.

[0:49:15] Voice 21: So I think it actually sets us up for better cooperation and lessens the potential of making mistakes and treading into areas that aren't our jurisdiction.

[0:49:28] Voice 21: So, yeah, again, these are all great questions, and I think this is a really exciting emerging area, as Trustee Yates said.

[0:49:37] Voice 21: And the Islands Trust can be on the leading edge because there is this complexity of all the nations in the mosaic.

[0:49:45] Voice 21: So are we okay to move the question?

Notice of this Special Electronic Meeting (SEM) was posted to the Islands Trust website and at all Islands 
Trust offices (Victoria, Salt Spring and Gabriola) on March 24, 2023, following carried resolution without 
meeting TC-RWM-2023-001 to schedule meeting. 
 
1. CALL TO ORDER / LAND ACKNOWLEDGEMENT 
 
At 1:02 p.m., Chair Luckham called the Special Electronic Meeting to order stating “it is a 
beautiful sunny day on Thetis Island where I live and am elected, on Lyackson and Penelakut 
First Nation territory and, that Trust Council is meeting broadly across Coast Salish territory.” 
 
Chair Luckham conducted trustee introductions, there were 19 trustees present when the 
meeting was called to order. 
 
2. APPROVAL OF AGENDA 
 
TC-2023-040 
It was Moved by Trustee Borthwick and Seconded by Trustee Graham, 
That the agenda be adopted as presented. 
 
CARRIED 
3. BUSINESS ITEMS 
 
3.1 Protocol Agreement between Islands Trust Council and Snaw-naw-as First Nation – 
RFD 
 
Trustee Hunter left the meeting at 1:15 p.m. 
 
Chair Luckham introduced the request for decision (RFD) as presented.   
 
Chief Administrative Officer (CAO) Hotsenpiller and Director of Trust Area Services 
(DTAS) Frater also reviewed the RFD with trustees. 
 
The motion was moved and seconded.   
 
Trustee Middleton joined the meeting at 1:23 p.m. 
 
Trustee Hunter joined the meeting at 1:31 p.m. 
 
Discussion ensued regarding the following: 
 Other First Nations having interests on Lasqueti Island. 
 Duty to engage First Nations by law. 
 Implementation, communications and other costs of the agreement.

That the Islands Trust Council approve the Protocol Agreement between Islands Trust

Agreement to the Minister of Municipal Affairs for approval.

Trustee Hunter requested that his OPPOSED vote be recorded in the minutes.
