[0:02:16] Voice 6: the Central Coast Salish peoples since time immemorial.

[0:02:20] Voice 6: And we wish to state just at the outset of every meeting

[0:02:25] Voice 6: that the South Pender Island Local Trust Committee

[0:02:27] Voice 6: is committed to reconciliation

[0:02:29] Voice 6: and the acknowledgement of Indigenous place and history,

[0:02:33] Voice 6: as well as to working with First Nations today

[0:02:37] Voice 6: in a contemporary context.

[0:10:03] Planner Stockdill (probable): Elliot, to give the LTC a little bit more information, the Ministry of Transportation

[0:10:11] Planner Stockdill (probable): and Infrastructure, MOTI, they plan to start the work on fixing the dip and their timeline

[0:10:21] Planner Stockdill (probable): is end of summer or early September.

[0:10:25] Planner Stockdill (probable): And through this process, MOTI would like to store some of the material that they're

[0:10:30] Planner Stockdill (probable): removing from the site and adding to the site, they want to store this material on private

[0:10:36] Planner Stockdill (probable): property. This private property is in the ALR and currently does not allow the use of a storage

[0:10:45] Planner Stockdill (probable): material. So a temporary use permit application and an ALR application is required. Due to the

[0:10:52] Planner Stockdill (probable): a tight timeline. The next regularly scheduled LTC meeting isn't until September. So staff's

[0:11:00] Planner Stockdill (probable): putting the suggestion forward to the LTC to schedule a electronic special meeting potentially

[0:11:06] Planner Stockdill (probable): sometime in July to address these two applications. We just received the applications and the applicant

[0:11:15] Planner Stockdill (probable): applicant is currently about to pay so once we've received that then the LTC will be sent the the

[0:11:22] Planner Stockdill (probable): formal applications I did circulate a draft motion for the LTC to consider which would give direction

[0:11:31] Planner Stockdill (probable): to staff to schedule electronic meeting to address these two applications thank

[0:12:52] Voice 6: the details we need to keep it all running. Okay, so 4.2, South Pender By-law number 123,

[0:13:03] Voice 6: project update. You'll find this on pages 13 to 25. I'm sure everybody's had a chance to read

[0:13:10] Voice 6: the staff report um so this is quite recent information and um so kim would you like to

[0:13:18] Voice 6: take us through this one thank

[0:13:19] Planner Stockdill (probable): you chair elliot yes i would uh this staff report is in front of

[0:13:24] Planner Stockdill (probable): you in regards to receiving a letter from the minister of municipal affairs in regards to bylaw

[0:13:30] Planner Stockdill (probable): one two three and that is a part of the minor official community plan project and the purpose

[0:13:37] Planner Stockdill (probable): The purpose of this project was to include two major amendments to the South Pender OCP, the first being a First Nation introductory or acknowledgement statement, and also the second are building design and citing guidelines, a public hearing was held last

[0:13:54] Planner Stockdill (probable): last year in July of 2022. Second and third reading was given in August of last year and

[0:14:02] Planner Stockdill (probable): the bylaw was actually sent to the minister in September of last year. As I mentioned, we did

[0:14:08] Planner Stockdill (probable): receive a letter from the minister and it's attached to the staff report for any community

[0:14:13] Planner Stockdill (probable): members that would like to see this letter. But the summary of the letter states that there's a

[0:14:21] Planner Stockdill (probable): a concern with the lack of response from First Nations and the Minister would like to see

[0:14:27] Planner Stockdill (probable): further meaningful engagement for First Nations. So in light of receiving this letter and in light

[0:14:35] Planner Stockdill (probable): of the fact that the LTC is post-public hearing for By-law 123, staff have outlined three options

[0:14:43] Planner Stockdill (probable): for the LTC to consider and this is on page 14 of the agenda or two of the staff report.

[0:14:50] Planner Stockdill (probable): The first option is to proceed no further with the project. So if the LTC feels as though that it would like to free up their work program for an alternative active project, there is an option for the LTC to proceed no further with this project, and that's option one.

[0:15:12] Planner Stockdill (probable): The second is to proceed with the project, but add additional engagement with First Nations

[0:15:19] Planner Stockdill (probable): and with community members. This option would then mean that this project would remain the

[0:15:27] Planner Stockdill (probable): active project for the LTC, and it would take most likely anywhere between six to 12 months

[0:15:34] Planner Stockdill (probable): to ensure that meaningful engagement is successful this option would also require

[0:15:41] Planner Stockdill (probable): a new public hearing and if the LTC wishes to move forward with this option I would recommend

[0:15:48] Planner Stockdill (probable): the LTC at this meeting rescind third reading of the bylaw what that would mean is that

[0:15:57] Planner Stockdill (probable): community members can then comment on bylaw 123 later in this uh commun or during the community

[0:16:04] Planner Stockdill (probable): information session the third option is to proceed with the project and um move forward with the

[0:16:13] Planner Stockdill (probable): comments received from first nations as is so the ltc could draft a letter to the minister stating

[0:16:20] Planner Stockdill (probable): stating that the LTC feels as though the legislative requirements have been completed

[0:16:25] Planner Stockdill (probable): and they'd like a response from the minister to either approve or not approve the bylaw.

[0:16:33] Planner Stockdill (probable): So I mentioned there's options laid out there for the LTC to consider in terms of draft motions.

[0:16:40] Planner Stockdill (probable): I've also sent a draft motion to the LTC to rescind third reading.

[0:16:45] Planner Stockdill (probable): If you decide to go for the option number two, which is to proceed with the application to keep it the main, the active project, and then further engage with the community and also with First Nations.

[0:17:08] Voice 6: just want to frame this discussion a little bit by saying this is an evolving arena in which processes are constantly being updated as we get feedback from both nations and from the Ministry of Municipal Affairs.

[0:17:28] Voice 6: So, to my mind, what came forward from the ministry was a fairly strong indicator that they consider meaningful consultation with First Nations to be actual engagement, rather than we've sent a referral and heard nothing back.

[0:17:53] Voice 6: and so I think just to recognize that we're in a time of changing as processes change and as

[0:18:00] Voice 6: nations get capacity to respond to our requests for the bylaws that we're considering

[0:18:09] Voice 6: it may take more time and in some cases maybe it's going to take less time because that engagement

[0:18:18] Voice 6: sort of the early engagement's already been done and those relationships are developing

[0:18:22] Voice 6: developing so i'm just yeah i'm just looking there's no fixed i don't think there's a fixed

[0:18:31] Voice 6: pathway it's what is the specific context for south pender steus area and the nations that

[0:18:43] Voice 6: are concerned with this air with this territory and how do we proceed in the best way possible

[0:18:49] Voice 6: So I just wanted to frame it as this is an evolving process, so we're going to do the best we can.

[0:18:57] Voice 6: Trustees, what are your thoughts, having considered the ministry's letter?

[0:19:06] Voice 11: Yeah, well, first of all, I want to say that First Nations reconciliation is important to me and everyone.

[0:19:16] Voice 11: everyone and that we need to find the best way to achieve that and I think it's quite

[0:19:24] Voice 11: challenging as we've seen, you know, we can't just send a letter off and get an answer back

[0:19:28] Voice 11: and that's probably not an appropriate reconciliation action in my view.

[0:19:33] Voice 11: It needs to go much deeper than that and it probably needs to include in-person communication

[0:19:40] Voice 11: and probably over quite some time and to me six months to a year is too short of a time

[0:19:46] Voice 11: for that to expect a lot of forward movement in that period. So that's kind of the background I

[0:19:56] Voice 11: want to start with from my perspective is that you know I'm in favor of continuing discussions

[0:20:03] Voice 11: and reaching for reconciliatory relations with First Nations and Indigenous people.

[0:20:13] Voice 11: people. How we achieve that within the frame that we've given right now in terms of accepting

[0:20:20] Voice 11: our options one to three, it's challenging. Obviously, we could do option two, which means

[0:20:29] Voice 11: we just kind of build on what we have. Option one would be starting over or not starting

[0:20:36] Voice 11: over you know this is just basically just ending it uh so um and and i maybe i'm not understanding

[0:20:45] Voice 11: quite clearly but option three seems to me like it's just kind of taking a breather and not making

[0:20:52] Voice 11: a decision right now accepted as is

[0:20:54] Voice 11: and so then what does that mean for the minister who said

[0:20:59] Voice 11: they weren't weren't satisfied with our level of consultation we're basically telling the

[0:21:06] Voice 11: minister would be to refine with us and so we override the ministry in that case we're saying

[0:21:12] Voice 11: thank you for your input oh yeah

[0:21:14] Voice 13: basically we'd send around to the minister thank you for your

[0:21:16] Voice 13: input but we're happy with it

[0:21:17] Voice 6: we the minister still has to approve okay

[0:21:21] Voice 11: so

[0:21:21] Voice 6: i'm proposed by

[0:21:22] Voice 6: law so we can't override if the minister then comes back and says well we don't think you've

[0:21:29] Voice 6: done sufficient engagement a second time we don't that doesn't pass the minister's desk i'm i'm

[0:21:36] Voice 6: guessing kim is that correct okay so

[0:21:40] Voice 11: then i'm taking option three off the table for myself

[0:21:44] Voice 11: and that's not an option i want to entertain uh i i i'm swayed by option one but like i say not

[0:21:55] Voice 11: to stop engaging in order there's a couple of reasons we didn't you know we are new trustees

[0:22:02] Voice 11: in a new term so we didn't build build the framework this to this point so if we're going

[0:22:10] Voice 11: to take over midstream and do this very challenging thing of actually having meaningful consultation

[0:22:18] Voice 11: with first nations with something that's built by somebody else that we may not sort of have a feel

[0:22:23] Voice 11: for that doesn't seem like a good starting point to me so i i favor option one and starting over

[0:22:32] Voice 11: work and being very patient with it, understanding that this is a big, big undertaking. So I don't

[0:22:39] Voice 11: want to be tied to a timeline. Thank you.

[0:22:44] Voice 13: From my perspective, I just remember how contentious

[0:22:48] Voice 13: this wording was. It didn't seem to have the full support of the entire community.

[0:22:56] Voice 13: community so I think in order to have a reconciliation statement it has to um the

[0:23:02] Voice 13: community has to be behind it as well as First Nations so I feel that reconciliation is super

[0:23:10] Voice 13: important but it has to work for all parties um and this is going to be a long conversation

[0:23:17] Voice 13: and I I would like to and and there's there's two pieces that are in this this one by law

[0:23:24] Voice 13: we have the reconciliation piece and we have the building deciding guidelines piece

[0:23:29] Voice 13: and i would like to separate those two out and start fresh with just one topic at a time

[0:23:35] Voice 13: rather than mixing things together um and i'm not saying that either is less than the other

[0:23:42] Voice 13: i'm saying that they both deserve a full discussion separately and finding out how we can get that

[0:23:51] Voice 13: done and if we're dealing with one thing at a time maybe we can get through things easier as a

[0:23:55] Voice 13: community and get everybody on side um i feel there was so many items in the last term that

[0:24:04] Voice 13: were being dealt with at the same time it became problematic and i think this is this is a result

[0:24:13] Voice 13: of that as well which i think is a good thing that now we deal with one minor project at a time and i

[0:24:18] Voice 13: think to keep that in mind i would like to start fresh um not necessarily from the very very

[0:24:25] Voice 13: beginning but uh but there's been a lot of work already done and we can continue building on it

[0:24:33] Voice 13: but i think we need to clean it up and separate it out and bring the conversation back to the

[0:24:38] Voice 13: community so i would opt for number one myself um and then put it out to the community but for

[0:24:48] Voice 13: or what do you want us to work on that that would that would be that would be my preference

[0:24:52] Voice 5: okay

[0:25:10] Voice 6: options you've listed kim number two request further engagement of first nations um an

[0:25:20] Voice 6: an engagement strategy to address concerns raised in the Minister of Municipal Affairs letter.

[0:25:27] Voice 6: Is it possible to set up a long-term engagement strategy that wasn't necessarily tied to a minor

[0:25:41] Voice 6: project or to Bylaw 123, but is, like, how could we set up a good First Nations engagement strategy

[0:25:53] Voice 6: Without it being tied to a particular project, because if reconciliation needs to inform and underpin all of our actions, it makes sense to my mind to have an engagement strategy, regardless of what project we're working on.

[0:26:16] Voice 13: regarding first nations for engagement i thought we were i thought we've already got a standing

[0:26:25] Voice 13: resolution so i could be wrong but i i thought i saw that we as south pender have a first nations

[0:26:36] Planner Stockdill (probable): didn't through the chair yes you're you are correct um there is

[0:26:40] Planner Stockdill (probable): is a standing resolution that the south pender has and i know that um the director of trust area

[0:26:48] Planner Stockdill (probable): services is currently reaching out on behalf of each ltc to um from nation to nation to um

[0:26:57] Planner Stockdill (probable): to try to improve the relationships between nation and nations to nations and those letters

[0:27:02] Planner Stockdill (probable): should be going out soon um but if the ltc feels as though that reconciliation can be actually its

[0:27:10] Planner Stockdill (probable): own active project itself that's something the ltc could consider okay thank

[0:42:47] Voice 11: meeting and i still don't like it and to be told to say that you still don't like it is now outside

[0:42:54] Voice 11: the bounds of sort of legal whatever is way too finicky too kicky too difficult for us to

[0:43:02] Voice 11: kind of function easily within i think uh i i was surprised to see this this whole way of doing it

[0:46:22] Voice 6: which we say, okay, we've heard all the perspectives on this version of the proposed bylaw.

[0:46:36] Voice 6: that public process. So I think there's just a logistical challenge to continually hearing

[0:46:44] Voice 6: hearing perspectives on the same material. I don't think we have the capacity to manage that

[0:46:51] Voice 6: in the space that the public would want. At some point, you have to call it and just say,

[1:22:30] Voice 13: gone forward with CRD funding and other funding so good progress has been made

[1:22:40] Voice 13: just a statement of introduction or acknowledgement but it's

[1:22:43] Voice 13: really establishing the relationship the important thing here is that in the

[1:22:49] Voice 13: letter from the minister he alluded to fund she alluded to funding that the ministry has provided

[1:22:57] Voice 13: the trust to move forward on this and to me this is a very timely issue there are resources available

[1:23:06] Voice 13: to proceed with this issue we have a framework within this

[1:23:10] Voice 13: LTC to move forward we are looking at an area in the trust the Bedwell Harbor Basin which is one

[1:23:20] Voice 13: of the most important areas for historical settlements of First Nations Coast Salish

[1:23:26] Voice 13: people well over 5,000 years of established settlement through archaeological records and

[1:23:32] Voice 13: certainly longer with First Nations stories, I would strongly encourage the trustees to consider

[1:23:40] Voice 13: this the minor project moving forward because it will require some staff resources, it will require

[1:23:47] Voice 13: some logistical arrangements, and I think that if we're serious about this we need to establish it

[1:23:55] Voice 13: it as a project moving forward. So thank you for considering my

[1:23:59] Voice 13: views.

[1:33:55] Voice 13: that again this is not funny. We have a plan and it should be in place until

[1:34:01] Voice 13: there is a need to review something. I expect in the next well maybe the provincial

[1:34:06] Voice 13: Provincial government is coming out with some maybe ideas that we will have to go back and

[1:34:12] Voice 13: change that plan, like in terms of housing.

[1:34:16] Voice 13: I don't think that every time we have a trustee, we have to go back and open that part.

[1:40:38] Voice 13: island 300 people we don't need a one-size-fits-all for everybody when it doesn't fit and i would say

[1:40:45] Voice 13: the same thing about house side and on the waterfront we put in a setback and i know at

[1:40:52] Voice 13: at least two people, about three people in the South,

[1:40:55] Voice 13: whose homes are well within that setback.

[1:50:30] Voice 11: you know start holding up everybody because we can find we find out through communication

[1:50:35] Voice 11: communication we're closer on the issues than we think we are and i can't see how we can move

[1:50:43] Voice 11: like ignore that um that tack of having that deeper communication i don't see how we can

[1:50:50] Voice 11: just skip that and say let's not review it or let's just do away with it i don't think we're

[1:50:56] Voice 11: going to achieve where we want to go by doing that because we had so many letters from both sides

[1:51:03] Voice 11: that means it's a problem, it's a really deep problem to everybody, one way or the other,

[1:51:09] Voice 11: right? It's equally intense, or not, who knows if it's equal, but it's strong on both sides.

[1:51:16] Voice 11: And so we think we need to address it. And so that's just my perspective.

[1:51:25] Voice 11: And I think what you said about, you know, misunderstandings,

[1:51:29] Voice 11: that gets everybody worked up. I think that's a result of not having taken the time to communicate.

[1:51:34] Voice 11: bravely you know it's difficult like you showing up and speaking for it it's brave and it's needed

[1:51:40] Voice 11: and there are people i'm sure i've been told there are people who aren't showing up here

[1:51:45] Voice 11: because they don't really want to take that on take the heat so to speak but that we've got to

[1:52:49] Voice 13: good lifestyle here and the community

[1:53:29] Voice 13: communication it wasn't sorry cameron but it's it wasn't but and so it it it set up a bad um

[1:53:39] Voice 13: dealing with a lot of people and we all think legal non-conforming does have an effect on this

[1:53:47] Voice 13: and it does have an effect on resale and it does have an effect on some insurance companies maybe

[1:53:52] Voice 13: not all of them but you know it it just seemed like so many rules were being thrown at us

[1:53:58] Voice 13: right up till the very last minute and so um it's going to take a while to get that communication

[1:54:04] Voice 13: like dave says to get us all working together and um and talking of working together dennis was

[1:54:12] Voice 13: talking about um bylaw 123 it is about working with first nations but it's not just us it's the

[1:54:21] Voice 13: whole trust policy that needs to be looked at as a whole not just our island or us and saturn or us

[1:54:29] Voice 13: in Maine, like we all are part of the trust and so the trust policy should be promoting

[1:54:38] Voice 13: these things and working with us and getting it to work with people. It's

[1:54:43] Voice 13: not just us and so for us

[1:54:46] Voice 13: to go and put a little bit in our OCP doesn't affect everything so that's a bigger issue.

[1:57:33] Voice 13: the best that we could at the time um i would like to speak a little bit uh initially about

[1:57:39] Voice 13: what i perceive as facts versus fiction and i know a lot of people have said including this

[1:57:44] Voice 13: room today that that you know that uh existing houses that are larger than the maximum house

[1:57:49] Voice 13: sizes are going to be legally non-conforming and and you know not now but later you can perhaps get

[1:57:54] Voice 13: a get your planner to give you some clarification on that because i do know that we took explicit

[1:57:58] Voice 13: steps to legally recognize uh houses that were larger than whatever the new maximum houses sizes

[1:58:05] Voice 13: were so they were actually provided for so they're not legally non-conforming i did also at that time

[1:58:11] Voice 13: send the wording of the bylaw to bfl which is one of the biggest insurance brokers in canada

[1:58:17] Voice 13: up and they reviewed it with their lawyers and they said we would have no issues providing

[1:58:20] Voice 13: insurance because you're not actually well they provide insurance for a lot of places

[1:58:24] Voice 13: legal non-conforming but in this place in this case it wasn't an issue of legal non-conforming

[1:58:29] Voice 13: so i just i would ask people one thing that we did do um and i think it's helpful as we go into

[1:58:35] Voice 13: this conversation is we did a red line with the bylaw and i believe it's still posted on the

[1:58:40] Voice 13: website it would be helpful for people in you know over a glass of wine or or a coffee or whatever

[1:58:45] Voice 13: your choice is to read through and see those explicit areas where bylaw 122 changed the land

[1:58:51] Voice 13: use bylaw to really understand whether or not the things that you believe are detrimental to

[1:58:56] Voice 13: your well-being or in fact that case it would just be something i would suggest because there

[1:59:00] Voice 13: is a lot of things that i've listened to people say that with respect or not are not actually

[1:59:06] Voice 13: aligned with what the bylaw is um i also would like to talk a little bit about just some other

[1:59:11] Voice 13: jurisdictions in our consultation process and it was tough during during covet i mean it was a

[1:59:16] Voice 13: unique period um we also had low interest rates and we had a a population surge we've had a new

[1:59:24] Voice 13: development new growth uh relative to the other islands we had a bigger net i mean we started with

[1:59:29] Voice 13: a small population to begin with but relative to the other islands we had a a bigger uh growth in

[1:59:34] Voice 13: population and so there were some efforts to try and safeguard what we what we did have and i know

[1:59:39] Voice 13: there were some people that said cameron i don't like bylaw 122 but you got to do something about

[1:59:43] Voice 13: that house and put down cell plants and it's it's tough because you're you're trying to you

[1:59:48] Voice 13: can't selectively choose where you're going to apply things that people do or do not like um

[1:59:53] Voice 13: i would also like to say that um in terms of you know one of the speakers talking about

[2:00:00] Voice 13: people's private property and their liberty and their peace and quiet.

[2:00:03] Voice 13: I respect all those things.

[2:00:05] Voice 13: And that was one of the underpinnings for why we brought about what we did

[2:00:08] Voice 13: because we felt like larger homes separated by 10 feet from your property

[2:00:13] Voice 13: line would be an infringement on your peace and quiet and would probably

[2:00:19] Voice 13: have a devaluation of your property.

[2:00:21] Voice 13: So I'm not saying that it is perfect.

[2:00:24] Voice 13: I would just ask people to look at things very carefully.

[2:00:28] Voice 13: I know the other thing about the idea that we should rescind By-law 122, we're in a housing crisis.

[2:00:36] Voice 13: We are in a housing crisis, but I don't, if you look at the homes that are on, the existing homes on this island that are quite large, they're occupied not by families, they're occupied generally by older couples.

[2:00:51] Voice 13: examples if somebody wants to look at this kind of comes back to the idea about secondary suites or

[2:00:57] Voice 13: or additional ways of providing housing perhaps there's a mechanism where we look at house size

[2:01:03] Voice 13: where it is correlated or tied to options for providing other other housing units within you

[2:01:12] Voice 13: know whether it's a secondary suite or whatever so it's not just an open-ended okay well we should

[2:01:17] Voice 13: go back to the house sizes that they were before without any criteria to help to understand how

[2:01:21] Voice 13: those larger house sizes um align with other targets that we might have in terms of again

[2:01:27] Voice 13: with the whole issue with with other forms of housing as you know the province brought in

[2:01:32] Voice 13: the housing supply act here recently and are starting to to who knows what where it's going

[2:01:37] Voice 13: to wind itself up but i do i know i wrote you on this i do believe that we do need to look at

[2:01:42] Voice 13: like i think we should find things we can come together on maybe we need to revisit aspects of

[2:01:46] Voice 13: the 122, but I think we should try and focus in on how we find ways, creative ways of finding

[2:01:52] Voice 13: ways of accommodating additional forms of housing, whether it's above an accessory building,

[2:01:57] Voice 13: above a garage, or maybe it's in a basement, you know, in a portion of the house. I think

[2:02:03] Voice 13: what I would really encourage you to do as trustees is to try and build consensus. I think

[2:02:08] Voice 13: that's your objective and your mandate. I certainly support that. But I would just suggest that just

[2:02:13] Voice 13: a wholesale tossing something out because there's there's a lot of misperceptions but i think it is

[2:02:18] Voice 13: the wrong way to go and i do hope if we find ways to again to like building a secondary suite about

[2:02:26] Voice 13: the garage has actually got nothing to do with bylaw 122. you could do that without changing

[2:02:30] Voice 13: bylaw 122 just like the comment about stdrs that has nothing to do with bylaw 1.2 that was

[2:02:36] Voice 13: bylaw 118 or 117 so those are my comments looking forward to working with you and uh and wish you

[2:05:07] Voice 13: fairly clear this is the topic that needs a good look at how we deal with it we haven't talked

[2:05:14] Voice 13: about it yet we don't know how we're going to deal with it we don't know what we're sitting

[2:05:17] Voice 13: we don't know but again this will still involve with you as a community should go forward with

[2:05:23] Voice 13: this this is going to still be a heavy community discussion to figure out you know if this really

[2:05:30] Voice 13: isn't working for people and it does get rolled back there's still an issue there right so if it

[2:05:36] Voice 13: doesn't get rolled back we will have a discussion and find a solution right so if it does roll back

[2:05:41] Voice 13: don't want people to feel afraid that it's not going to move forward. We will move it forward.

[2:05:45] Voice 13: The community isn't together on this. We need to find something that will make the community

[2:05:52] Voice 13: be together. That's why we're here. This is why I agreed to be nominated.

[2:06:01] Voice 13: it's um i want i want the community to feel strong and heard and represented as a whole

[2:07:19] Voice 11: communicating into the community community either by media social media word of mouth that sort of

[2:07:26] Voice 11: thing if you want to get people involved it has to be better it has to be much better so that's

[2:07:34] Voice 13: of my observations because of the controversy and it is controversy even amongst this group in

[2:07:44] Voice 11: this room clearly i think it demonstrates that 122 needs to be rescinded and needs to be discussed

[2:07:54] Voice 11: at length whether it's going back to the original bylaw and developing it into something different

[2:08:05] Voice 11: or completely different proposal this is so controversial to people and the emotions are

[2:08:13] Voice 11: high for many people who believe this could affect their family's inheritance it could affect

[2:08:21] Voice 11: redevelopment it could affect loss in a case of a fire i mean hey look around you what's happening

[2:08:29] Voice 11: happening right now across this country, large-scale fires that are impacting and destroying

[2:08:36] Voice 11: communities. Those communities have to be rebuilt. I know I was helping fight fires like that.

[2:08:43] Voice 11: I've seen how destructive it is. We don't want to go there, but if we already have our hands tied

[2:08:50] Voice 11: because of a bylaw

[2:08:53] Voice 13: that's in place that affects people's ability to rebuild their homes to what

[2:08:58] Voice 13: perhaps what they had I don't know it's clearly there are questions that have to be answered

[2:09:06] Voice 13: part of I all what I I'm noticing is about the emotion is people's freedom of choice

[2:09:12] Voice 13: is affected correct him to me if I'm wrong there the lawyer in the room section seven of the

[2:09:20] Voice 13: charter freedom of choice correct okay

[2:09:30] Voice 13: different things right that are clearly

[2:09:37] Voice 11: can we move forward and continue down a path with something

[2:10:45] Voice 13: experiences that's my two cents okay thank you um a couple of comments um whereas people are

[2:11:05] Voice 13: people on the spot and um like keep it keep it safe because okay um the other thing i was going

[2:11:19] Voice 13: honest and um that's what i'm passionate on this topic um but this this this is this is

[2:11:27] Voice 13: the reason for that for this meeting is to express what the minor project should be and

[2:11:36] Voice 13: how you are being affected by it and to do it in a manner that is um like safe for everyone

[2:13:58] Voice 13: decision and so i'd really like for there to be and whatever you're looking at going forward

[2:14:06] Voice 13: a very strong objective scientific reason for certain things for example related to shoreline

[2:14:15] Voice 13: setback water capacity those kinds of things because it's so easy for people to get emotional

[2:14:23] Voice 13: and say this is my land and this is what I want to do for me or for my family but we do live in

[2:14:31] Voice 13: community and sometimes we all have to accept things that we might not like in the greater

[2:14:38] Voice 13: common good and so I would ask when you are looking at things for going forward

[2:14:45] Voice 13: based on science and maybe you're never going to be able to say a setback of x number of feet

[2:14:53] Voice 13: because it is going to be different yes it's a small island but the shoreline is different

[2:14:59] Voice 13: in different places some places have a steep thing and some don't same thing with water

[2:15:07] Voice 13: on some roads boundary paths water is really really an issue on other places maybe you have

[2:15:16] Voice 13: access to a good well so going forward instead of just saying yes we will stick to these numbers

[2:15:27] Voice 13: from 114, or we'll stick to these numbers from 122, can we maybe get away from the blanket

[2:15:36] Voice 13: numbers and have it be more a case of what does science say is appropriate for that particular

[2:15:46] Voice 13: lot? I don't think we should just check everything out. I don't know if the word

[2:15:51] Voice 13: the sins is necessarily the right word or it's simply to say we need to re-look at it because

[2:15:58] Voice 13: I do know that moving forward nothing stays the same and as you yourselves have said you're going

[2:27:43] Voice 13: I can say that there are a number of people that don't think, and that there were a lot of concerns that were raised during the process.

[2:27:57] Voice 13: I think that the time hurried and took under consideration those, and they worked to try

[2:28:06] Voice 13: and accommodate things that were most contentious.

[2:28:12] Voice 13: And we ended up with something that was perfect, and because of the term duration, ultimately

[2:28:20] Voice 13: they needed to move it ahead.

[2:28:23] Voice 13: I think that there are many people that are disengaged from this process, that don't come

[2:28:34] Voice 13: They don't

[2:28:35] Voice 13: believe that their voice is going to be heard, and they believe that the loudest voices are the ones that are determined to help.

[2:28:43] Voice 13: So, you know, we keep hearing the same issues over and over, and all due respect, some of those have been dealt with, and they're no longer.

[2:28:55] Voice 13: And I had said this to the prior conference, and I still believe this.

[2:29:02] Voice 13: There is merit in one's voice.

[2:29:07] Voice 13: Everybody might not agree with it.

[2:29:08] Voice 13: part of the thing that's missing is that there wasn't the full-setting engagement process that

[2:29:14] Voice 13: enabled people that that are completely dead set there will always be people that are dead set

[2:29:20] Voice 13: against change or there are people that are poor but that's that's the reality in the nature the

[2:29:30] Voice 13: part that was missing was the ability for both sides to hear each other in a meaningful way

[2:29:38] Voice 13: because, for example, the issue of the setback, setbacks are important because of the shape

[2:29:46] Voice 13: of the building, the logical benefits, all those sorts of things, but there wasn't the

[2:29:51] Voice 13: opportunity for the community, perhaps, to get engaged through workshops and so forth

[2:29:55] Voice 13: to understand what the benefits are.

[2:29:58] Voice 13: So I would say to you that...

[2:30:00] Voice 13: rather than a wholesaler simply rejecting what's there.

[2:30:03] Voice 13: I mean, we've already had two applications come forward

[2:30:06] Voice 13: that were non-compliant with the bylaw,

[2:30:09] Voice 13: but they both got approved on their merits.

[2:30:11] Voice 13: And so there's a mechanism there to make something work.

[2:30:15] Voice 13: And so rather than just throw the hay in the bathwater,

[2:30:19] Voice 13: part of what I fear the both of you say,

[2:30:25] Voice 13: both prior to and since you were elected,

[2:30:28] Voice 13: was to improve engagement and that's like you can't get a hundred percent of

[2:30:37] Voice 13: the people that you bring it's just a fantasy but you can build towards that

[2:30:43] Voice 13: and so I would say to you that

[2:30:45] Voice 11: yes it's very contentious we have people that are

[2:30:48] Voice 11: still saying

[2:30:49] Voice 13: the same things that have been proven not to be actually valid

[2:30:53] Voice 13: anymore they're stressed but they still not because people still understand it

[2:30:57] Voice 13: as something else and so take the opportunity if that's a that's a work

[2:31:02] Voice 13: project scope put in place some mechanism some workshops whatever to try

[2:31:12] Voice 13: to understand what the issues are and how we've dealt with the community.

[2:31:57] Voice 11: or aren't showing up to meetings don't get heard and i i believe in democracy or to some degree in

[2:32:07] Voice 11: this context is that if you don't show up if you don't vote for instance if you don't go to the

[2:32:12] Voice 11: polls and vote you lost your opportunity to participate in democracy and if the reason

[2:32:18] Voice 11: and i've heard this that you know these meetings aren't safe i hope this meeting is safe and i hope

[2:32:23] Voice 11: every meeting that I'm in is safe and if it isn't I will do my darndest to address that

[2:32:29] Voice 11: because everybody has a right to participate and you can't participate in a democracy without

[2:32:35] Voice 11: showing up and so I plead for you to message to those people who you're representing perhaps or

[2:32:43] Voice 11: know that aren't here but have strong opinions opposing what many people are saying we need them

[2:32:50] Voice 11: to show up one way or another i think it can be through emails but that's not as perfect of course

[2:32:56] Voice 11: because it's more powerful to speak to something i think and if those who can show up please have

[2:33:02] Voice 11: them show up and please be we're going to continue to be nice and civil to each other we're hard on

[2:33:10] Voice 11: issues but we've got to be soft on people because that's what community is about and that's who was

[2:33:17] Voice 11: that I said that's the most important thing, like that getting through communication in a peaceful,

[2:33:23] Voice 11: harmonious way, even though we might strongly disagree on the topics, that

[2:33:28] Voice 11: is more important

[2:33:29] Voice 11: than anything else.

[2:33:31] Voice 13: Just an illustrious point though, so this wasn't a meeting to talk about

[2:33:36] Voice 13: rescinding bylaws 1222 and 123, this is a meeting to talk about the works projects and what capacity

[2:33:42] Voice 13: capacity there were a number of comments made about rescinding 122 and the letters that

[2:33:49] Voice 13: signed and sent in are about

[2:33:50] Voice 11: rescinding 122 and now this has become the meeting about rescinding

[2:33:54] Voice 13: 122 and so that's we just talked about this for the last hour and a

[2:34:01] Voice 13: uh we're determining the process based on so the people that are passionately speaking for me is

[2:34:11] Voice 13: this isn't a representation of everybody that is concerned about 1.23. This was a

[2:34:18] Voice 13: meeting to talk about a project, a work project, so we can't, like, to have a wholesome

[2:34:23] Voice 13: discussion around this, you need to create a different project. It needs to be, it needs to be, if people knew

[2:34:31] Voice 13: that that's what you were coming to do, those people that were in support of 1.23 would also

[2:34:36] Voice 13: come, because if this was a meeting specifically to talk about that, that's where they would come.

[2:34:42] Voice 11: Well, excuse me, I'm not quite following. So we are determining the priorities for us to work on,

[2:34:48] Voice 11: and people that are coming here to say that they want us to work on rescinding a bylaw,

[2:34:53] Voice 11: then that's their input. But somebody could have come here and said, we want you to work on First

[2:34:59] Voice 11: Nations reconciliation, or we want you to work on keeping one. So this meeting is not about

[2:35:10] Voice 11: rescinding a bylaw. It's needing to inform us so that we can make a decision on how best to move

[2:35:17] Voice 11: forward about what people care about the most, right? So yeah, I think everyone was welcome.

[2:35:26] Voice 11: I think the agenda was clear. I don't think anybody thought the agenda said we're coming

[2:35:32] Voice 11: here to discuss whether we're going to rescind a bylaw or not. Are

[2:35:36] Voice 4: we going to put that on the

[2:35:37] Voice 11: agenda or not? That's what's on the agenda. Are we going to put it on the priority of the

[2:35:41] Voice 11: it's worthless so everybody had the opportunity there might have been misunderstandings around

[2:35:46] Voice 11: that and we need to try to clear that up the misunderstanding engage if you're going to be

[2:35:51] Voice 11: part of a democracy you have to engage voice has to be put forward and if it isn't it's a really

[2:35:57] Voice 11: is a legitimate reason why somebody feels bullied or ill-treated i want to hear about it because

[2:36:03] Voice 11: that doesn't go in my book that's not allowed and

[2:36:07] Voice 6: as the chair if i may speak up if there is another

[2:36:10] Voice 6: If there's another way that we could come together to set priorities and you've got a better idea, please let me know. This is the most democratically convened meeting that the Islands Trust can provide. It's a public forum that is both electronic and in person. You've got your local trustees there.

[2:36:31] Voice 6: This is the second time that we are convening to discuss the work plan and to set priorities.

[2:36:39] Voice 6: So there has been ample time. This is not a meeting to discuss Bylaw 122, but those that show up do have the opportunity to speak to what they think the priorities should be.

[2:38:17] Voice 13: And there were a couple of meetings that have been further. I know there were, I think Cameron had a group that we were talking about. So, one of the things that I found that's quite effective

[2:38:38] Voice 11: to engage people in smaller groups,

[2:38:42] Voice 11: talk about the issues, have the opportunity to share ideas.

[2:38:46] Voice 13: kind of where things kind of went off the rail

[2:38:52] Voice 13: is we know 1-4-4, 1-1-4.

[2:38:56] Voice 13: We knew at 1-1-4 there was a lot of work that went on board,

[2:39:01] Voice 13: were

[2:39:01] Voice 11: part of a lengthy process to get there.

[2:39:05] Voice 13: Unfortunately, things aren't actually immutable,

[2:39:08] Voice 13: And things are changing around us, and there

[2:39:11] Voice 11: is a pressure to build with it.

[2:39:12] Voice 11: You spend a million dollars on essentially a teardown.

[2:39:16] Voice 11: The person that's buying that can afford to build a house.

[2:39:26] Voice 13: And I know the other group that wanted to buy our property we have

[2:39:29] Voice 13: wanted to tear down the house, flatten the lot, all that kind of stuff.

[2:39:39] Voice 13: And they would have been with us.

[2:39:43] Voice 13: But there is another way.

[2:39:44] Voice 13: There is, like talking about guidelines that encourage rainwater, encouraging solar, there's

[2:39:58] Voice 13: a whole lot of things that could be considered in this, and

[2:40:02] Voice 13: maybe in that process, you get

[2:40:06] Voice 13: closer to a meeting, because what we knew before, everybody knew, like they participated

[2:40:15] Voice 13: in that, people are telling me they didn't participate in the same way in the changes

[2:40:19] Voice 13: and so maybe that's the way forward is rather than just get rid of it engage people hear what

[2:40:28] Voice 13: they have to say how that affects them but also help them understand that there might be there

[2:40:33] Voice 13: might be benefit because as i say one two two is actually watered down version a lot of other

[2:40:41] Voice 13: people whether you agree with that or not that's just the reality we have a we have a to be candid

[2:40:52] Voice 13: of a strong almost libertarian and we have a much more kind of we

[2:41:08] Voice 11: clarifying just that thing and uh toby did you patch that because um there was some answers to

[2:41:17] Voice 11: the question that you put forward about in terms of what else can we do so it was smaller groups

[2:41:50] Voice 6: for in terms of a design guideline so at this at the housing summit the city planner presented

[2:41:58] Voice 6: some of their engagement process at pieces and if you go to the city of victoria's website i'm not

[2:42:06] Voice 6: going to go i mean we don't have the budget for that but some of the principles are you know if

[2:42:11] Voice 6: you want more green space less parking you're going to get less parking and here's your house

[2:42:18] Voice 6: size versus, you know, here are some other options. So I think there are some ways that

[2:42:24] Voice 6: we can definitely improve the conversation about how we, uh, develop, um, specifics around

[2:42:33] Voice 6: siting. So we can definitely do it better. It's, I'm not sure we've got the budget for, um,

[2:42:39] Voice 6: really strong as much as city of Victoria is doing, but anyway, sorry. Um, we'll need to wrap

[2:44:00] Voice 12: historic inherent rights and treaty rights. And so I would like to see us become a more

[2:44:10] Voice 12: welcoming community to the presence of the First Nations people of Hosea,

[2:44:17] Voice 12: whose lands, the traditional lands we are occupying. And I think you've all seen

[2:44:28] Voice 12: the 13-moon calendar installation down the road in front of the Church of the

[2:44:35] Voice 12: good shepherd that came about as a project in consultation with say of people in particular

[2:44:45] Voice 12: because the reserve is primarily theirs and it came about because relationships were developed

[2:44:54] Voice 12: between our community and theirs and so um i think there is a role for all of us i agree

[2:45:04] Voice 12: bag that that we all have a responsibility and there are things that we can do and so if you

[2:45:12] Voice 12: just think about shoreline setbacks for one thing they have indigenous people in this area

[2:45:24] Voice 12: that traditionally depended on crabs shellfish and we need for everyone's sake to preserve

[2:45:35] Voice 12: the help of the shoreline and not be polluting people's food sources. That's one thing.

[2:45:45] Voice 12: Another thing I know is that Indigenous people often don't feel welcomed in the islands,

[2:45:54] Voice 12: or some people will welcome them and others will be unwelcoming in various ways with words and

[2:46:08] Voice 12: sometimes with deeds and so i would encourage us all to think about how we can be welcoming

[2:46:16] Voice 12: um how we can increase awareness in our community of their historic presence here

[2:46:25] Voice 12: and their ongoing relationships to the audience and so that's that's the two levels there it's

[2:46:34] Voice 12: the government government relationship and it's our relationship with the people

[2:46:40] Voice 12: whose traditional lands wouldn't go on thank you so much we appreciate it it was uh like

[2:46:48] Voice 13: i said that ties in very nicely to what uh chair elliott brought up earlier which i'm

[2:46:52] Voice 13: very impressed and something i've been interested in a while i just didn't know how to go about it

[2:47:32] Voice 13: board. I never was given reasons why we achieved it, why we made it so strict. This was never

[2:47:40] Voice 13: apparent to me. And to me, 122 is a solution. I may be wrong. Maybe I'm not seeing it as other

[2:47:52] Voice 13: people see it, but that's how I saw it. And there was nothing convincing me otherwise.

[2:47:57] Voice 13: On the contrary, the behavior of the trustees, the form of discussion telling us that no,

[2:48:06] Voice 13: democracy doesn't have place here, you put me in this place, this is not supported, this

[2:48:12] Voice 13: is not how it is.

[2:48:14] Voice 13: I understand the sentiments of many that things do change and we need to improve things, but

[2:48:22] Voice 13: But if the community is not as a whole involved in something like this, then we don't have

[2:48:30] Voice 13: a big opportunity to actually exchange our ideas and articulate to each other, for which

[2:48:39] Voice 13: both of you call, why we need to change.

[2:48:42] Voice 13: I may not understand somebody's perception why they need bigger setbacks.

[2:48:47] Voice 13: As an engineer, I can easily prove that adding 10 feet of sand doesn't change anything in

[2:48:55] Voice 13: terms of noise.

[2:48:56] Voice 13: I can prove it to you mathematically.

[2:49:00] Voice 13: It's nothing.

[2:49:02] Voice 13: But anyways, so all what we are basically talking was that change will be possible.

[2:49:09] Voice 13: Alteration of things will be possible if from the beginning we actually involve community

[2:50:37] Voice 13: someone i've been wanting hearing from a lot of people uh the next person on the speaker list is

[2:50:49] Voice 13: helpful no i think so um one suggestion was for when we do have community

[2:50:56] Voice 13: i believe as more people come if it's a larger space we'll feel more comfortable

[2:51:09] Voice 13: one of them because I notice there's still people who are wearing masks and they they may need that

[2:51:14] Voice 13: space for their own personal well-being so I think that's kind of important. As a First Nations

[2:51:21] Voice 13: person myself I have experienced bigotry growing up. I was unfortunate enough to live in southern

[2:51:31] Voice 13: Alberta during the former Trudeau's years and as a French Canadian Mohawk I can tell you right now

[2:51:38] Voice 13: that I know what bigotry feels like. And you look at me and you don't see my

[2:51:45] Voice 13: heritage. My father used to call me a Windian, a white Indian, because I look like I do.

[2:51:52] Voice 13: However, coming to Pender and getting told that I can't call myself a Penderite

[2:51:57] Voice 13: until I've been here for 20 years for me is a kind of bigotry. So that's a community

[2:52:04] Voice 13: thing that everybody needs to wrap their brain around. You don't have to look

[2:52:09] Voice 13: like an ethnic minority to be treated like crap so attitudes need to change on this island about

[2:52:15] Voice 13: that kind of stuff so that was a valid point i really appreciate that but maybe we need to

[2:52:21] Voice 13: change our attitude about being a hinderer too um so there's that uh getting back to the 122

[2:52:31] Voice 13: um sorry i really do think it needs to be our small project or your small project

[2:52:39] Voice 13: um tasking because it was designed for a one-size-fits-all process and that's not working

[2:52:45] Voice 13: um and to you sir i believe that democracy works i've seen it work but my mother used to say

[2:52:52] Voice 13: back in the 60s if you don't vote can't pitch um also in the army used to say don't come to me

[2:53:01] Voice 13: complaining about something unless you're going to bring some solutions

[2:53:05] Voice 13: And one of those solutions that we mentioned before was that it was a one-size-fits-all thing, and we have to look at things on a case-by-case basis.

[2:54:12] Voice 13: bigger house if part of my square footage is going to be able to solve the housing prices

[2:54:24] Voice 13: extra square footage as long as i have sweet over my garage that's unfair and you're again

[3:02:36] Voice 13: scientific resource information linkage or data to establish it might have been

[3:02:42] Voice 13: there I don't know there wasn't presented to us and so I like to see the

[3:02:46] Voice 13: data so when we have even these little focus groups whatever I don't think it's

[3:02:51] Voice 13: of any value of somebody saying i support the trustees or something or i like that idea there's

[3:02:58] Voice 13: got to be something behind it if somebody says to me i just like that idea i'm not counting that as

[3:03:04] Voice 13: being valid for anything so no value to me they have to tell me why they like it what is it about

[3:04:51] Voice 13: the most part much much larger than the predominant houses that were built on the on the island and

[3:04:57] Voice 13: and again as i said before given the rapid uh escalation in property values and people with

[3:05:02] Voice 13: more money shown up and certainly that's obviously one of the actions that we took i think as i said

[3:06:41] Voice 13: participated in it i worked with authority on focus groups i coordinated one of the groups

[3:06:46] Voice 13: I was on the APC that came to the conclusion that the maximum house size should be 3,600 square feet.

[3:06:55] Voice 13: In the final analysis, when it came down to making a decision, the trustees were in a conundrum, and they opted for making sure nobody was nonconforming, so they opted, defaulted to the larger houses.

[3:07:09] Voice 13: That was a problem, as Cameron has pointed out in terms of the data. I agree. Let's look at the data. But the key thing I want to say is this. We've heard about rescinding bylaw 122, and we've heard about revisiting it.

[3:07:27] Voice 13: and I think the same path forward is if you want to revisit it that's one thing do not throw it out

[3:07:34] Voice 13: much good work was accomplished many steps forward were achieved I'm one of those people that believe

[3:07:40] Voice 13: that that there was a compromise on house size and like John said there's many people in this

[3:07:46] Voice 13: community who feel that compromise was too high but some feel it was too low but there was a

[3:07:52] Voice 13: compromise made if those issues have to be looked at again let's do it thoughtfully and not throw

[3:07:58] Voice 13: everything out let's see where the problems are i do not i think the chair has shown that

[3:08:07] Voice 13: legal non-conforming is not a substantial issue except in the minds of some people but in terms

[3:08:15] Voice 13: of empirically, in terms of facts it's not. Many other factors here need to be

[3:08:21] Voice 13: discussed in terms of the facts. So I would urge you not to rescind bylaw 122.

[3:08:29] Voice 13: I would urge you, if you consider that problems are brought forward, that those

[3:08:33] Voice 13: problems be analyzed and solutions to fix the problems identified be proceeded

[3:08:40] Voice 13: needed with and have that conversation that'll bring this community together

4.1  Scheduling an Electronic Special Meeting for review of special items. 
 Island Planner Stockdill noted the following: 
 The Ministry of Transportation and Infrastructure (MOTI) plans to begin work on 
repairs to “the dip” by early September 
 MOTI has requested to store materials on private property, which is located in the 
Agricultural Land Reserve (ALR) 
 The storage of materials is not a permitted use in the ALR therefore permits will be 
required 
 
SP-2023-026 
It was Moved and Seconded, 
that the South Pender Island Local Trust Committee request staff to schedule an 
electronic special meeting for the following applications: SP-TUP-2023.1 and  
SP-ALR-2023.1.

4.2 South Pender Bylaw No. 123 - Project Update 
 Island Planner Stockdill reviewed the Staff Report and highlighted the following: 
 Proposed Bylaw 123 was sent to the Minster for approval in September, 2022 
 Chair Elliott received a letter from the Minster noting that the Local Trust 
Committee (LTC) had sought early engagement with First Nations regarding the 
bylaw however there had been no reply, therefore the LTC should consider 
revisiting the matter with local First Nations for the purpose of engaging in 
meaningful discussion 
 
Discussion ensued and Trustees noted that: 
 The LTC has a standing resolution regarding engagement with First Nations 
 Following a public hearing the LTC can not hear any further submissions from 
community members regarding a matter 
 Both the reconciliation, and siting guidelines, aspects of the bylaw deserves further, 
and separate, discussion 
 It is important to allow deep engagement and extended public process before 
moving bylaws through second and third readings 
SP-2023-027 
It was Moved and Seconded, 
that the South Pender Island Local Trust Committee proceed no further with the 
Minor Official Community Project and Proposed Bylaw No. 123.

4.3 2023 – Work Program Discussion 
Trustees reviewed the May 5, 2023 Staff Report which summarized comments received 
from community members at the March 25, 2023 Community Information meeting, 
which was held, in part, to generate ideas for new LTC projects.  
Discussion ensued. 
It was noted that a significant amount of correspondence had been received regarding 
Bylaw 122. It was also noted that quite a bit of correspondence was received in the 
seven days prior to the meeting and while that correspondence is reviewed by Trustees 
it is not included in the meeting package due to staff time limitations. 
 
5. COMMUNITY INFORMATION MEETING 
5.1 Future Projects Discussion  
It was clarified that the purpose of the meeting is to determine, with community input, 
what the next minor project will be. 
Members of the public made the following comments: 
 Bylaw 122 should be rescinded or altered. It has had the effect of making many 
properties legal non-conforming which has the potential to affect property 
insurance, restrict enjoyment of property, and the bylaw assumes community 
members will not be environmentally responsible 
 Reconciliation activities should be the next minor project. The Ministry has provided 
funding to move forward with First Nations engagement and relationship building 
and there are resources available and a framework which allows the LTC to do so.  
 Bylaw 122 should be re-visited as the resulting building setbacks caused significant 
community contention 
 Bylaw 122 should be rescinded and Bylaw 114 reinstated. It took two LTC terms, 
engagement with focus groups, and multiple hearings to reach an accord on Bylaw 
114 and then incoming Trustees opened it up and changed it. The speaker would 
also like to see further engagement with First Nations 
 Bylaw 122 should be rescinded. The bylaw attempted to address housing shortages 
by restricting short term vacation rentals (STVRs), but the bylaw has not had an 
impact on housing. Accommodations options are in demand and the LTC should not 
regulate how people use their home. There are also issues with the bylaw in relation 
to water storage and waterfront setbacks

 Bylaw 122 should be rescinded. It has resulted in community members feeling that 
their homes are legal non-conforming which can affect home values and resale 
prices. The entire Islands Trust policy needs to look at First Nations reconciliation, 
and not just within the policies of South Pender Island 
 First Nations reconciliation and engagement needs to be driven by Islands Trust 
policy, but there are also local issues that the community needs to be involved with 
 Trustee Falck noted that a Trust Policy statement is presently being worked 
on and will be available for public review in approximately six months 
 Bylaw 122 should not be rescinded. There are misperceptions and division within 
the community. There were specific steps taken to ensure that existing housing 
would not be considered legal non-conforming. Efforts were made to safeguard land 
coverage during a population surge, and new larger homes that are too close to 
property lines can negatively impact neighbors. Instead of rescinding the bylaw 
during a housing crisis, consideration should be given to finding a mechanism to 
look at housing sizes tied to options such as secondary suites 
 Bylaw 122 needs to be rescinded or discussed at length. The bylaw could affect 
inheritances as well as a community member’s ability to rebuild their home if it 
were destroyed by fire. Freedom of choice is being affected 
 Bylaw 122 should be revisited. The specific one size fits all setback, and water, 
regulations do not make sense for every property. Decisions should be made on an 
objective, science based, view and a case-by-case basis for what is appropriate for a 
particular lot 
 Bylaw 122 should be rescinded. The community discussion regarding the bylaw was 
incomplete and rushed, in part due to COVID gathering restrictions. Bylaw 122 
makes existing houses legal non-conforming. Each insurance underwriter is going to 
evaluate and look at it differently 
 The Chair requested the Planner clarify the conforming versus non-
conforming issue. The Planner stated that if a Bylaw is amended then use 
and siting are protected under the Local Government Act. The previous LTC 
took a step further by including a clause that a house can be rebuilt in the 
exact location, at the same size as previous, even if this is not conforming to 
current land use bylaw 
 Bylaw 122 needs to be revisited. Bylaw 114 went through a six-year period of 
discussion and focus groups which resulted in stringent building restrictions. Bylaw 
114 should not have been re-opened 
 There needs to be consideration of how Bylaw 122 affects community members 
that bought property when the previous bylaw was in place but who have not built 
yet 
 Bylaw 122 should not be rescinded. There are many people who believe that the 
bylaw has merit, but they are disengaged with the discussion. There is a mechanism 
in place for community members to get approval for non-compliant plans and there 
needs to be a process put in place to better communicate and explain the bylaw 
 Trustee Falck noted that the meeting is being held to discuss work projects, 
and if community members are indicating that rescinding Bylaw 122 is a 
priority then they are giving voice to what they want the next work project 
to be. Everyone had the opportunity to attend and state what they want the 
priority to be

 Bylaw 122 should not be rescinded. There should be further engagement to help 
community members understand the bylaw. There is pressure to build larger homes 
and new buyers often want to build larger homes. Discussion should focus on 
guidelines to encourage water conservation and use of solar power 
 We are living on unceded First Nations territory where there are historic and treaty 
rights, and the community needs to be welcoming to the presence of First Nations 
peoples. The community has responsibility to protect the health of the shoreline 
and focus should be on increasing awareness of First Nations historic presence and 
improving relationships. The Trustees need to bring the community together, in a 
safe environment, to clarify the issues and work together to find solutions 
 Bylaw 122 should not be rescinded. Further discussion is needed and if the 
community is not involved then there is not opportunity to change. If there is 
opportunity for discussion, and effort made within a group to talk about the issues, 
then it will be easier for everyone to relate to other’s concerns 
 Bylaw 122 needs to be the minor project. It was designed for a one size fits all 
process that is not working. The development variance permit process takes time 
and costs money, and one should be allowed to build a larger house. It is not a 
solution to say a community member can be allowed to build a larger house only if 
part of the house is a solution to the housing crisis. This forces the homeowner to 
become a landlord 
 The community needs to understand what protections are already in place  and how 
to respect the land for themselves and for others 
 Since Bylaw 122 was put in place there have only been two applications made for a 
development variance permit. This does not mean that the bylaw has not caused 
any problems bur rather there have not been any problems yet 
 Bylaw 122 should be rescinded and Bylaw 114 reinstated. We were not presented 
with data or technical reasons for the changes in Bylaw 122 
 Bylaw 122 should be discussed. Bylaw 114 was not ideal, and Bylaw 122 is not the 
path forward either. Further discussion and workshops would be welcome, and 
Trustees need to find a community consensus 
 Bylaw 122 should be revisited but not rescinded. A lot of work was done with 
compromises made, and further analysis and dialogue is needed to identify the 
problems and create solutions to fix them 
 
The Trustees thanked everyone for providing their input and discussion ensued. 
The LTC noted that the following resolution was to demonstrate the intent of the LTC to 
move forward with reviewing the changes made under Bylaw 122.
