[0:01:09] Voice 14: island local trust committee today i'm joined by hornby island trustees grant scott and alex allen

[0:01:20] Voice 14: and we together we make up the hornby island local trust committee and we have staff members joining

[0:01:26] Voice 14: us today. We have Catherine Vogt as our minute taker. Rene Jamarat is the Regional Planning

[0:01:32] Voice 14: Manager for the Northern Office. Margot Thomaidis is our Island Planner. And Sonia Zupanek will be

[0:03:37] Trustee Allen: I haven't seen Grant Scott for a long time.

[0:03:43] Trustee Allen: I had terrible connection issues.

[0:03:46] Trustee Allen: I had to attend the RPC Housing Working Group,

[0:03:48] Trustee Allen: which I'm a member of, on Tuesday.

[0:03:50] Trustee Allen: So I'll just say we're working on a housing toolkit

[0:03:55] Trustee Allen: and looking at land analysis and baseline reports.

[0:04:01] Trustee Allen: And hopefully we're going to come up with some amazing ideas.

[0:04:04] Trustee Allen: Basically, we're just sort of compiling everything that's every housing examples from other islands.

[0:04:10] Trustee Allen: And hopefully it'll be helpful down the road.

[0:04:14] Trustee Allen: And then on the 19th, Monday, we're having our annual CVRD meeting.

[0:04:20] Trustee Allen: Denman Island attends as well.

[0:04:23] Trustee Allen: That's going to be Zoom.

[0:04:24] Trustee Allen: and uh what's exciting is our trust council is uh at the end of june and it's on gabriel island

[0:04:33] Trustee Allen: and that is the first time we've been on another island since march 2020 when we were sitting at

[0:04:38] Trustee Allen: salt spring island and uh the world changed so that's very exciting that we're actually going

[0:04:43] Trustee Allen: to go to one of our islands otherwise it's um i hope we can have more in-person meetings because

[0:04:49] Trustee Allen: because I have issues with always do see names

[0:04:53] Trustee Allen: and just a black box and not your faces.

[0:04:55] Trustee Allen: So hopefully the next meeting will be in person.

[0:05:08] Trustee Scott (probable): I was on Hornby Community Radio last Saturday with Albini

[0:05:13] Trustee Scott (probable): and to talk about trust issues

[0:05:15] Trustee Scott (probable): and the two main ones we discussed

[0:05:18] Trustee Scott (probable): or the cell tower by rogers and application and the apc recommendations the short-term

[0:05:28] Trustee Scott (probable): vacation rentals particularly and it's always very interesting talking to albini because he probes

[0:05:34] Trustee Scott (probable): and he pulls out you know and makes it quite interesting so on the cell tower issue it was um

[0:05:41] Trustee Scott (probable): i said i've spoken to a lot of people on the island i kind of canvassed about it what people

[0:05:46] Trustee Scott (probable): people take on it is there's a certain amount of objection to it for a number of different reasons

[0:05:51] Trustee Scott (probable): one is it's um too close to people too close to the Depot um and it's in the site of a potential

[0:05:58] Trustee Scott (probable): Community housing so those are the sort of the negatives I spoke to a lot of younger people who

[0:06:04] Trustee Scott (probable): are strongly for it because they don't have landlines anymore they tend to use cell phones and

[0:06:11] Trustee Scott (probable): And the fact that the Hornby Denman medical people sent a strong letter of support for it because they can't connect, people can't connect to the ambulance and some of the services that they need.

[0:06:24] Trustee Scott (probable): So it's been very interesting listening to different perspectives on the cell tower and the fact that many other islands have gone through the same thing.

[0:06:33] Trustee Scott (probable): So it's very interesting.

[0:06:34] Trustee Scott (probable): Short-term vacation rentals, similar.

[0:06:37] Trustee Scott (probable): There's fear and concern by some people about the fact

[0:06:42] Trustee Scott (probable): that they need the revenue to live on Runby,

[0:06:46] Trustee Scott (probable): which is obviously getting more and more expensive

[0:06:49] Trustee Scott (probable): all the time.

[0:06:50] Trustee Scott (probable): So it was just a very interesting conversation

[0:06:52] Trustee Scott (probable): on these two topics.

[0:06:54] Trustee Scott (probable): And so, Tim, I'll just leave it at that for now.

[0:09:46] Voice 1: to speak. My name is Ross Bertschall, managing partner of WCG. So we're a Victoria based

[0:09:53] Voice 1: consultancy. Our firm is supporting the Hornby Island Community Economic Enhancement Corporation

[0:09:58] Voice 1: or HI-SEEC and some of their economic development related work. We recently submitted an application

[0:10:05] Voice 1: for funding to ICT to prepare a comprehensive economic development strategy for Hornby Island,

[0:10:12] Voice 1: and which, of course, touches on multiple sectors.

[0:10:15] Voice 1: However, the community and local businesses have already pointed

[0:10:18] Voice 1: to the urgent need for workforce housing.

[0:10:22] Voice 1: We're working on several engagement pieces to ensure our own knowledge

[0:10:26] Voice 1: of the situation and that community input is current,

[0:10:30] Voice 1: as well as pre-feasibility and feasibility efforts

[0:10:33] Voice 1: for a potential diversified community development encompassing year-round,

[0:10:38] Voice 1: live work workforce retail commercial and seasonal workforce uses to attract and retain a consistent

[0:10:45] Voice 1: workforce housing aging and or retiring population segment and maintain a level of affordability for

[0:10:53] Voice 1: permanent housing as a group and and with high seek we've identified a couple of suitable parcels

[0:11:00] Voice 1: of land for this potential development and look forward to continuing exploring options such as

[0:11:07] Voice 1: crown land and potential partnership or joint venture opportunities with komox first nation

[0:11:14] Voice 1: so as we begin to move this proposal ahead high seek is approaching a variety of potential

[0:11:21] Voice 1: funders partners and potential stakeholders to assist in the various planning stages and

[0:11:27] Voice 1: we just wanted to take this opportunity in this venue to essentially put the concept in in front

[0:11:33] Voice 1: of the local trust committee and provide a this very high level more formal introduction to what

[0:11:39] Voice 1: we're working on i know it's already been mentioned in this meeting but of course just to formalize

[0:11:45] Voice 1: and welcome any collaboration research data any other information available to two organizations

[0:11:51] Voice 1: such as yours that may assist us in moving projects such as this forward i'm not sure if

[0:11:59] Voice 1: catherine and sheila are here as well from high seek but i'm sure we'd be happy to answer any any

[0:12:04] Voice 1: questions you may have uh knowing of course that we're still in the early stages at this point uh

[0:12:09] Voice 1: but thank you so much for your time okay

[0:12:28] Trustee Allen: of that particular grant but i didn't i i actually did not decide how does hornby fit into that

[0:12:33] Trustee Allen: because uh it just felt like more of a sort of large municipality type thing as opposed to

[0:12:38] Trustee Allen: hornby island when i looked at it um you have a minimum of three of four lenses housing

[0:12:44] Trustee Allen: transportation daily needs infrastructure and um yeah i wasn't quite sure how i thought we're kind

[0:12:52] Trustee Allen: of a small little goldfish in a big pond you know with this one so i just like to have maybe give me

[0:12:59] Trustee Allen: a little more update and how you can fit into that mold oh

[0:13:02] Voice 1: certainly yeah and this is in reference to

[0:13:04] Voice 1: the complete communities grant from ubcm correct yeah so um it i believe it was put out there for

[0:13:13] Voice 1: proposals may 16th or around that time so of course it was uh you know super rushed and uh

[0:13:20] Voice 1: the deadlines today so uh you know we're um and it high secret itself is not an eligible applicant

[0:13:28] Voice 1: so it would have to be um done either in partnership or with with an organization like

[0:13:33] Voice 1: islands trust or cvrd as the lead applicant and in terms of the eligibility criteria i mean certainly

[0:13:39] Voice 1: looking at the challenges with with servicing a development like this you know that would be the

[0:13:45] Voice 1: infrastructure piece um housing of course um and uh you know transportation which you know looking

[0:13:53] Voice 1: at ferry traffic and um logistics and you know who's working uh on island that comes from off

[0:14:01] Voice 1: off island, you know, these are all the types of pieces that would be considered. And, you know,

[0:14:05] Voice 1: I think at the end of the day, in this type of situation, what UBCM, the funder is looking for

[0:14:10] Voice 1: is basically a way to put together a more of a cohesive plan on, you know, how to address some

[0:14:17] Voice 1: of these issues to, you know, to get that end result in this case, you know, more permanent

[0:14:23] Voice 1: housing. But it looks like we may have missed the boat. So I thought

[0:14:29] Trustee Allen: you had an extension to

[0:14:30] Trustee Allen: the 30th or something uh

[0:14:32] Voice 1: the request for an extension has to be uh the request has to be

[0:14:38] Voice 1: made by an eligible applicant in this case high seek is not and so it would have to be made by

[0:14:43] Voice 1: either cvrd which you know fingers crossed that may happen today it may not um but it would have

[0:14:49] Voice 1: to be made by either cvrd or islands trust in this case yeah

[0:14:55] Trustee Allen: and then you know if we did it's

[0:14:57] Trustee Allen: too bad it was sort of at this short notice because if we had received this we would have

[0:15:02] Trustee Allen: We've had to get information from staff and, you know, carry it on a bit longer as well.

[0:16:09] Voice 6: needs affordable housing right now and unfortunately small communities are a bit

[0:16:13] Voice 6: at a bit of a disadvantage because a lot of the funding is directed towards the municipalities

[0:16:20] Voice 6: so uh we are passing around ideas some of them are not completely conventional

[0:16:29] Voice 6: but with the funding that will be available to us most likely we may have to look at something a

[0:16:35] Voice 6: little unconventional and we are really hoping that the trust will be open to exploring some

[0:16:41] Voice 6: new ideas that are not currently covered in any of the regulations and will help us to shepherd them

[0:16:48] Voice 6: through the process in a timely manner because i really feel that the hornby community is going to

[0:16:55] Voice 6: fall apart if we don't get workforce housing fairly quickly it's just uh it's so difficult

[0:17:03] Voice 6: for people to live here really uh the only people who can afford to buy here are people who work in

[0:17:11] Voice 6: the cities who make a different level of income from what we make here so

[0:18:47] Voice 9: what I called you about was um the cell tower and you know as we know Island's Trust is responsible

[0:18:56] Voice 9: to preserve and protect our islands and we need transparent oversight and we need the trustees to

[0:19:08] Voice 9: ask the hard questions and get the answers review the information and bring it to the residents so

[0:19:16] Voice 9: we're more informed the residents here are really uninformed with this whole project

[0:19:21] Voice 9: so question number one would be is 5g technology safe i know the cbrd is asking this same question

[0:19:32] Voice 9: whether it's safe for all living breathing and non-breathing um uh entities um so we need it

[0:19:42] Voice 9: to be proved by the proponents that it is safe and show us the peer-reviewed studies

[0:19:49] Voice 9: and the thing that is concerning me now is I hear that 5G technology is easily hackable

[0:19:59] Voice 9: and in the wrong hands that could be very dangerous. Another question is have we looked

[0:20:09] Voice 9: at alternatives? Is there any alternatives for Hornby Island to get better self-coverage

[0:20:16] Voice 9: other than this tower um so the third question is for residents and um others trust to ask the

[0:20:27] Voice 9: questions and know what this will be used for we know uh okay cell reception that that's the easy

[0:20:33] Voice 9: one to say yes to uh rogers calls it connectivity and this really likely means with your smart

[0:20:41] Voice 9: all your smart devices, track and trace, all of our interactions, and mining our data.

[0:20:51] Voice 9: So these things are a concern because we hear that we're moving towards AI, and AI needs

[0:20:58] Voice 9: this bandwidth from these towers.

[0:21:02] Voice 9: And so I think when Hornby Island and when our trustee makes this decision, we need to

[0:21:07] Voice 9: really slow down and think the whole thing through so we're not inviting um what the

[0:21:14] Voice 9: fox in the hen house or maybe that's not quite the right term but so thank you for considering this

[0:21:23] Voice 14: thank you anything from trustees those

[0:21:28] Trustee Allen: are big questions um

[0:21:29] Voice 14: um

[0:21:31] Trustee Allen: but there is there is a beyond

[0:21:34] Trustee Allen: i did a little research and so instead of a cell tower and you want a cell phone connection

[0:21:38] Trustee Allen: connection in a remote area, and as with that, you can get a WeBoost, it's called. WeBoost for your

[0:21:44] Trustee Allen: home, WeBoost for your RV, WeBoost, you know, it's three different gadgets, apparently. I don't have

[0:21:53] Trustee Allen: a cell phone, so I, well, I do, but it's a flip phone, and I only use it when I go off island.

[0:22:00] Trustee Allen: Yeah, so Heather, all those other questions, like, we don't know, we don't have the answers,

[0:22:05] Trustee Allen: there's but i will say that there's there's a lot of research on the effect on wildlife and birds

[0:22:10] Trustee Allen: and bats tons of research that's out there so um in terms of there's and there's not enough on in

[0:22:19] Trustee Allen: terms of what the effect on wildlife versus human beings because the whole rogers report there's

[0:22:23] Trustee Allen: nothing about the wildlife it's all about and even environment if you look at their um their

[0:22:30] Trustee Allen: annual report it's quite interesting they have a tiny little paragraph on biodiversity and it's

[0:22:34] Trustee Allen: basically saying they're not going to use uh insecticide in another section environment it's

[0:22:40] Trustee Allen: all about hybrid vehicles and uh smaller footprints in their buildings nothing to do with

[0:22:47] Trustee Allen: the people and uh and then i will add in terms of that stat that everybody's repeating like a mantra

[0:22:55] Trustee Allen: the 80 percent of 911 calls by our smartphones well do you know that actually came from a stat

[0:23:01] Trustee Allen: in california in 2016. and

[0:23:06] Trustee Allen: uh also 35 of those those particular calls were either non-emergency

[0:23:13] Trustee Allen: or unintentional so look at to figure those stats out and then when you look up on the internet

[0:23:18] Trustee Allen: every single cell phone supplier is repeating that same mantra 80 of 911 calls so um

[0:23:26] Trustee Allen: there's a lot of cherry picking out there and a lot of um information it's misinformation

[0:23:30] Trustee Allen: information so it's a hard one it's a it's a what do you call it it's a long and winding road with

[0:23:36] Trustee Allen: this power proposal i don't know where we're going to go with it at this point but we'll find out

[0:39:44] Voice 5: the Comox Valley Regional District I believe and then there's the Island's Trust

[0:39:49] Voice 5: and then there's in our case we're on provincial crown land and then we're under an exclusive

[0:39:55] Voice 5: federal jurisdiction as always regardless of where we are and so it's a great it's a great question

[0:40:01] Voice 5: and you know at the end of the day how it typically works is really only we have to kind

[0:40:08] Voice 5: of defer to ISED or Innovation Science and Economic Development Canada to sometimes make

[0:40:13] Voice 5: those determinations if there is any lack of of clarity however it has i do agree with um margo's

[0:40:22] Voice 5: uh comments it's it's our understanding through reviewing this that up to this point that because

[0:40:28] Voice 5: we are on provincial crown land for this particular proposal and because the province does

[0:40:33] Voice 5: have its own what they call land use operational policy for communication sites which does have

[0:40:40] Voice 5: have its own referrals and consultation requirements,

[0:40:43] Voice 5: including newspaper notices, referrals to First Nations,

[0:40:49] Voice 5: as well as other local stakeholders,

[0:40:52] Voice 5: including through to the Islands Trust,

[0:40:54] Voice 5: that typically that would be the applicable process

[0:40:57] Voice 5: on provincial Crown land.

[0:40:59] Voice 5: Now that doesn't mean in any way

[0:41:01] Voice 5: that we're trying to suggest that the Islands Trust

[0:41:03] Voice 5: wouldn't be fully consulted

[0:41:05] Voice 5: and an extremely important and critical stakeholder

[0:41:10] Voice 5: in all of this. However, on provincial crown land, obviously, the province does have, or maybe it's

[0:41:16] Voice 5: not so obvious, but the province does have authority to make land use decisions for this

[0:41:20] Voice 5: kind of thing. So we would have to get their support. But it's, you know, sort of my anticipation

[0:41:25] Voice 5: that they will weigh heavily the input of Islands Trust. So I don't know if that answers your

[0:41:34] Voice 5: your question uh i know that that was a lot of information but that's my understanding of of how

[0:41:42] Voice 5: it would work so we have to obtain approval and land use concurrence through the through the

[0:41:47] Voice 5: province but but via that process they're going to be you know consulting numerous stakeholders

[0:41:53] Voice 5: including the island's trust and i would think take that input into great consideration okay

[0:42:02] Trustee Scott (probable): Okay. So really what we are, in my language anyway, is advisory to the province, particularly, who then, they then give their input to ISIS, is it?

[0:42:43] Voice 5: So, so generally speaking, even though it's under the jurisdiction of the federal government, they do require proponents like Rogers to work with local governments and land use authorities to obtain that piece of paper of land use concurrence.

[0:42:57] Voice 5: At the end of the day, if we can't get that from a land use authority, there is always a possibility or an option of going to the federal government to make that decision, but that's extremely rare and not desirable.

[0:43:09] Voice 5: And so that's not sort of at all what we're saying here.

[0:43:13] Voice 5: So it's not to suggest that our first step would be to go to the federal government for a decision.

[0:43:19] Voice 5: The expected first step is to work with the local land use authorities through this process.

[0:43:26] Voice 5: But since we're on provincial crown land, we do have to get basically a license of occupation and support from the province.

[0:43:35] Voice 5: They are the land use authority and basically will issue the permit or the license to use the provincial crown land.

[0:43:42] Voice 5: Correct me if I'm wrong, but the Islands Trust doesn't really have the authority to be issuing licenses of occupation or approvals on crown land.

[0:43:51] Voice 5: So that's not to sort of downplay the importance of the Islands Trust input.

[0:43:56] Voice 5: I think we would like to obtain the support of the Islands Trust, and we intend to fully consult and work with the Islands Trust, as we've been doing right from the outset here, sharing information, welcoming input, hoping to arrive at a supportable outcome.

[0:44:10] Voice 5: But at the end of the day, this project cannot move forward without approval from the provincial Crown land authorities.

[0:44:20] Voice 5: that's the critical next step I said will not be intervening or getting involved unless they're

[0:44:26] Voice 5: requested to do so and if we get land use concurrence through through the the province

[0:44:31] Voice 5: they would almost certainly defer to that unless there's an error with the process

[0:44:36] Voice 5: or some some issue that they see okay

[0:44:42] Trustee Scott (probable): we would only go to the federal government

[0:44:43] Voice 5: for what if there was there's a process called the impasse process where if we've exhausted

[0:44:49] Voice 5: our efforts and we can demonstrate that as a proponent we've exhausted our efforts to try to

[0:44:54] Voice 5: work with a local government towards a resolution they do reserve the option to be to intervene

[0:45:01] Voice 5: basically and to make that land use decision through what's called an impasse process but

[0:45:07] Voice 5: that's extremely rare and not something that i think any party desires to do so i'm only bringing

[0:45:14] Voice 5: that up because there was the question it's not not something that we're at all at this time

[0:45:20] Voice 5: looking to do and really never is something that we desire to do that's really if only if the

[0:45:28] Voice 5: process really goes sideways and you know it's determined that it's becoming unreasonable

[0:45:35] Voice 5: then we can go to the federal government for for an intervening decision yeah

[0:45:42] Voice 14: i just add that in

[0:45:44] Voice 14: In more typical cases that don't involve a site on ground land, the local land use authority would be, you know, front and center and the province would essentially not have the role that they do in this case because of the ground land application there.

[0:46:04] Voice 5: Yeah, and Rogers, just for the record, I think it would result in a much clearer and a more desirable outcome, just to be clear, to have concurrence or support from the Islands Trust.

[0:46:16] Voice 5: So we would really appreciate if we could get to a stage where we've demonstrated that we've arrived at a good proposal and can get your support.

[0:46:25] Voice 5: You know, if that weren't the case, we would be sharing that with the decision makers at the province and through to ISED.

[0:46:34] Voice 5: and have them review it like we don't decide if we have approval or not you know i said we'll

[0:46:39] Voice 5: review all of that information and likely make a determination that yes they accept or do not

[0:46:45] Voice 5: accept the land use concurrence so all of this is to say i think it would be a much more positive

[0:46:51] Voice 5: outcome if if the islands trust was aligned with whatever decision the the crown proposes to make

[0:46:58] Voice 5: too um it's not an ideal situation if the parties are at odds with one another um so so that that's

[0:47:05] Voice 5: what we're trying to work towards uh ideally but i'm not i'm not sure um where the island's trust

[0:47:11] Voice 5: is at with all of this yeah

[0:47:42] Trustee Scott (probable): I get a much better idea now is that the key really is the license of occupation, because the federal government, if you get that, then that's sort of automatic, unless there's some extenuating circumstance, as you pointed out.

[0:47:55] Trustee Scott (probable): so the license of occupation is something that they will list because it's crown land they

[0:48:00] Trustee Scott (probable): they will take into account politically uh what what the islands trust comes up with but they

[0:48:07] Trustee Scott (probable): don't have to there's no absolute necessity for them to go along with but if if we voted down

[0:48:14] Trustee Scott (probable): they could still issue the permit nobody wants it that way but it's that's still possible is that

[0:48:23] Voice 5: So, it's our understanding through various discussions with ISED on other files as well as this one, and certainly, please feel free to reach out to them to satisfy yourselves and to have your own discussion.

[0:48:35] Voice 5: I don't want to speak out of turn on their behalf. It's not my place to do so, but generally speaking, what I've consistently been told is there can only be one land use authority when it comes down to granting land use concurrence.

[0:48:56] Voice 5: So a neighboring land use authority, as seems to be the case here,

[0:49:01] Voice 5: there's the provincial crown land with the island's trust surrounding it.

[0:49:06] Voice 5: But at the end of the day, from ISED's direction, as I've always understand it,

[0:49:11] Voice 5: we need land use concurrence from only one land use authority.

[0:49:14] Voice 5: unless our tower proposal was literally right sitting on the boundary of two land use

[0:49:22] Voice 5: authorities which isn't the case we're clearly entirely within provincial crown land so that

[0:49:28] Voice 5: makes it somewhat clear-cut as far as i can tell that at the end of the day we need land use

[0:49:37] Voice 5: concurrence and approval and a license from the crown in order to to proceed without that there's

[0:49:42] Voice 5: there's no way forward here. To put it in a different way, even if we got land use concurrence

[0:49:47] Voice 5: from the Islands Trust, that wouldn't be sufficient without approval from the Crown,

[0:49:52] Voice 5: if you see what I mean. So the province is a really key decision maker. Ultimately,

[0:49:59] Voice 5: in all of this, they don't have jurisdiction like the federal government does.

[0:50:04] Voice 5: But at the end of the day, they make the decisions for licensing and permitting,

[0:50:10] Voice 5: as well as the consultation process for this type of infrastructure on Crown land and that's all

[0:50:15] Voice 5: clearly laid out there in your package. So that's my understanding but again just to be really clear

[0:50:21] Voice 5: I anticipate that they're mindful of wanting input from the Islands Trust and I'm not sure

[0:50:29] Voice 5: how smoothly our application to the province will go in the absence of support from a key

[0:50:36] Voice 5: stakeholder like the islands trust for instance would would the province be seen to be granting

[0:50:42] Voice 5: rogers um approval effectively if the islands trust was at odds with that on hornby i'm not

[0:50:50] Voice 5: sure i haven't really seen this play out before so again ideally the outcome isn't um a conflicting

[0:57:47] Planner Zupanec (probable): these three topics do not necessarily advance simultaneously because one is of greater

[0:57:56] Planner Zupanec (probable): interest or requiring more analysis or support or consultation so this is an effort to ensure that

[2:27:03] Voice 14: putting together a business case for funding for the next fiscal to continue the work on the ocp

[2:27:10] Voice 14: lub beyond what we're presently doing but that's just my thoughts that's something for consideration

[2:27:17] Voice 14: If we don't have something before Trust Council in a timely manner for funding for next fiscal, we will only be permitted to do minor projects of under $5,000 and under.

[2:27:36] Voice 14: But if some of those items on the future projects list are contemplated to potentially be over $5,000, that's what we want to consider requesting a business case be advanced so that it can get to financial planning committee and then ideally by December to trust council.

[2:29:45] Trustee Allen: So that's been on there forever, this project, since 2011, since I first was elected, actually.

[2:29:55] Trustee Allen: And then when I look at the aquifer castigation system, that was based on something.

[2:30:00] Trustee Allen: wrong in uh in our our schedule map and i thought that was just a simple thing and then um so also

[2:30:11] Trustee Allen: there's something missing because i also had the downtown revitalization i didn't remember it was

[2:30:15] Trustee Allen: a four corner or something that's totally disappeared and i don't know where that was

[2:30:19] Trustee Allen: in discussion back in september and it's disappeared and i'm i don't remember it being

[2:30:24] Trustee Allen: voted out of the project's report so i remain blissfully confused here um okay

District (CVRD) meeting on June 19, 2023; to be hosted electronically and to be 
attended by Denman Island representatives also.

 Looking forward to attending the upcoming Trust Council meeting to be held in 
person on Gabriola Island in late June. 
 
Trustee Scott reported on the following: 
 Appearance on Hornby Community Radio last Saturday with Albini-Patrick Lapierre 
for a discussion on Trust issues.  
 Acknowledgement that the objections to the proposed cell tower are that it would 
be too close to people, to the recycling depot, and to future community housing; 
but that it is supported by many younger people who no longer have land lines, and 
by Hornby and Denman medical personnel who have sent a strong letter of support 
for the tower. 
 Acknowledgement that Short Term Vacation Rentals (STVRs) provide needed 
revenue for many locals. 
4.2 Chair's Report 
Chair Peterson reported on the following: 
 The recording of the previous Hornby Island Local Trust Committee (LTC) regular 
meeting on May 5, 2023 is unfortunately irretrievable due to technical difficulties. 
 Working as a member of the Executive Committee on the agenda for the upcoming 
June Trust Council meeting. 
 Looking forward to the next Hornby LTC meeting in September which will be held in 
person. 
4.3 Electoral Area Director's Report

5. PUBLIC COMMENTS 
Members of the public noted the following: 
 Ross Birchall, Founder and Managing Partner of Wellesley Consulting Group (WCG) based in 
Victoria, spoke on providing Trustees with a formal introduction to his working on behalf of 
the Hornby Island Community Economic Enhancement Corporation (HICEEC), noting that 
they had recently applied for funding to Island Coastal Economic Trust (ICET) to prepare a 
comprehensive economic development strategy for Hornby Island, highlighting the urgent 
need for workforce and other affordable housing for which two parcels of land have been 
identified. Other options being pursued are Crown Land and potential joint partner ventures 
with Kómox First Nation (KFN). Various other funders, partners, and stakeholder 
opportunities are being actively pursued by HICEEC. He welcomed any support that the LTC 
could provide in moving the HICEEC endeavors, still in their early stages, forward. 
o A Trustee asked how well Hornby could compete against much larger municipalities for 
the Union of BC Municipalities (UBCM) Complete Communities Grant funding. 
o Consultant Birchall responded that HICEEC itself is an ineligible applicant and must 
partner with an organization such as the Islands Trust or the Comox Valley Regional 
District (CVRD) to be considered for funding. The UBCM eligibility criteria are 
infrastructure and transportation requirements for servicing a housing development.

UBCM is looking for a cohesive plan. HICEEC has missed this year’s May 2023 application 
deadline and would need support from the LTC to request a deadline extension. 
o A Trustee responded that unfortunately no information for the LTC to consider had 
been received yet. 
 Another member of HICEEC noted that small communities are at a disadvantage for funding 
compared to large municipalities. Unconventional housing ideas are currently being looked 
at and it is hoped that the LTC will be supportive in shepherding such ideas through the 
regulatory process in a timely manner. The Hornby community is at risk of falling apart if 
workforce housing is not provided quickly. 
 The LTC needs to question the biological safety, hackability, and purpose of 5G technology in 
relation to artificial intelligence and surveillance applications; and to investigate if 
alternatives to 5G for cell coverage are available. 
o A Trustee noted that, in the absence of a cell tower in a remote location, there is a 
device called weBoost for homes and RVs; also, that the recent Rogers report does not 
adequately address wireless effects on wildlife; also, that the recent Rogers report 
repeats the same broadly used cell phone industry mantra statistic that 80% of 911 calls 
are made through a smart phone which is a 2016 California statistic, of which 35% of 
such calls were either non-emergency or unintentional.  
 A staff member of HICEEC requested that the LTC consider supporting the HICEEC Workforce 
Development Project with letters of support; by fixing zoning bylaws to allow housing on 
Public Use (PU) zones; and through the provision of wording for tiny homes, RVs, and other 
higher density developments. 
o The Chair invited that HICEEC could email pertinent information to the LTC prior to the 
upcoming September regular LTC meeting.

o Regional Planning Manager Jamurat clarified that an Indigenous Coordinator had 
been hired but would not be starting until this July; and, that efforts would be made 
to expedite letters to First Nations. 
8.2 Rogers Cell Tower Proposal - update for information 
Planner Thomaidis presented the staff memorandum: ‘Hornby Rogers Cell Tower 
Proposal,’ dated June 16, 2023, that updates Trustees that staff have received a 
summary package from Rogers that details their public consultation and 
correspondence to date. Staff will be analyzing the summary and preparing a report for 
the next LTC regular meeting in September. 
 
Consultant Brian Gregg noted the following: 
 The proposed tower for Hornby is on Provincial Crown Land, so Rogers must follow 
the provincial communication sites process to receive a License of Occupation.  
 Ideally, the Islands Trust would be aligned with the Province, which has the ultimate 
authority over land use. 
 The Federal Ministry of Science and Economic Development (ISED) would defer to

intervening land use decisions, but this option is undesirable and very rarely utilized.

10.2 OCP/LUB Review Project - Endorsement of Revised Project Charter 
Planner Zupanec presented the staff report that asks Trustees to consider endorsing an 
an updated draft Project Charter for the Official Community Plan (OCP) and Land Use 
Bylaw (LUB) review project noting the following: 
 The updated Project Charter clarifies which bylaws will be drafted by planning staff. 
 Komoks First Nation has indicated that they are interested in participating in this 
bylaw drafting process, the capacity funding for which will be clarified as soon as 
possible to meet with them. It is expected that First Nations referral staff would be 
going over the draft bylaws with Islands Trust planning staff over several meetings 
prior to endorsement by Chief and Council. This is a new collaborative process that 
is being piloted and has not been tried by the LTC before. 
 Planners will work on two draft bylaw amendments to the OCP and one to the LUB: 
1) regarding increasing housing options; 2) updating First Nations references; and 3) 
regarding restricting STVRs. 
 
HO-LTC-2023-029

that the Hornby Island Local Trust Committee amend the Official Community Plan/ Land 
Use Bylaw Review Project Charter Version 2.1 by removing the words under the In 
Scope Section “explore use of” and replacing with the words “to require a.”

The wording change amendment made in Motion HO-LTC-2023-029 pertains to 
temporary use permits for short term vacation rentals. 
 
HO-LTC-2023-030

that the Hornby Island Local Trust Committee amend the Official Community Plan/ Land 
Use Bylaw Review Project Charter Version 2.1 by adding a fifth bullet in the Deliverables 
Section that reads: “Post Bylaw Adoption Community Information Materials.”

Planner Thomaidis explained that the letter addressed to the LTC from BC Parks was 
received very recently and was regarding Class A park designation for two new lots 
around Tribune Bay. The letter allows comments for BC Parks until June 30, 2023. 
A Trustee appreciated that BC Parks previous consultation with the community was well 
done. 
Trustees received the letter for information.
