[0:00:00] Trustee Luckham: All right. Good morning, everyone. Welcome to the Executive Committee meeting of August the 25th, 2023.
[0:00:10] Trustee Luckham: Where's the year going and where's the summer going?
[0:00:14] Trustee Luckham: Certainly here in the broad expanse of Coast Salish Territory, where I wake every day,
[0:00:21] Trustee Luckham: I'm grateful to be able to live here and work here and the opportunities to learn
[0:00:28] Trustee Luckham: about the people that have lived here since time immemorial.
[0:00:32] Trustee Luckham: And certainly this summer has been interesting.
[0:00:35] Trustee Luckham: Our hearts and thoughts go out to all those impacted
[0:00:39] Trustee Luckham: by wildfire throughout the province.
[0:00:42] Trustee Luckham: There have been a couple of close calls here
[0:00:46] Trustee Luckham: within the islands of the trust and on Vancouver,
[0:00:50] Trustee Luckham: not within the trust that I know of,
[0:00:52] Trustee Luckham: but within the islands on Vancouver Island region.
[0:00:55] Trustee Luckham: and of course on Vancouver Island and we have to remember the care that we, the responsibilities we have to care for this place as the nations have done since time immemorial.
[0:01:12] Trustee Luckham: I can't help but also want to acknowledge at this time what's happened on Hornby Island in a midden site near the ferry terminal.
[0:01:22] Trustee Luckham: I don't want to judge at this point the activities that caused the disturbance of this midden but
[0:01:31] Trustee Luckham: clearly BC Ferries is concerned about that and the contractor involved is no doubt concerned
[0:01:38] Trustee Luckham: about that and it's incredibly unfortunate it's more than unfortunate that such a thing has
[0:01:44] Trustee Luckham: happened and this is what I worry about waking up to every day is the disturbance of middens that
[0:01:50] Trustee Luckham: that may or could contain the remains of ancestors
[0:01:55] Trustee Luckham: and loved ones.
[0:01:56] Trustee Luckham: And so indeed, we have to be incredibly cautious
[0:02:01] Trustee Luckham: around the shoreline and other locations
[0:02:03] Trustee Luckham: where there's known archeological sites.
[0:02:06] Trustee Luckham: So I didn't say my name is Peter Locke.

[0:02:11] Trustee Luckham: I am the Chair of Trust Council, Chair of this committee.

[0:03:38] Trustee Luckham: And so I'll just go directly to the agenda at this point.
[0:03:43] Trustee Luckham: We have a not a too heavy agenda today, but some definitely some thoughtful items for us to consider.
[0:03:49] Trustee Luckham: I'll just ask if there's any additions or deletions from the agenda.
[0:03:53] Trustee Luckham: And of course, I want to acknowledge. Thank you very much, Laurie, for managing all of the correspondence associated with the Bowen Island Municipality OCP amendment bylaws.

[0:04:09] Trustee Luckham: but we have certainly received more than 126
[0:04:13] Trustee Luckham: individual pieces of correspondence on that matter.
[0:04:16] Trustee Luckham: And that is in a folder for us.
[0:04:19] Trustee Luckham: And perhaps we might discuss how some of that might end up
[0:04:23] Trustee Luckham: in the public realm,
[0:04:24] Trustee Luckham: but we'll cover that when we get to discussing that bylaw.

[0:05:43] Trustee Luckham: okay yeah that i that came in this

[0:07:30] Trustee Luckham: meeting that the july 12 2023 in-camera minutes were adopted as presented and a legal opinion
[0:07:36] Trustee Luckham: summary letter will be made public regarding a galliano galliano island local trust committee
[0:07:42] Trustee Luckham: development permit exemption. And I do believe that letter has, that public, that has been done
[0:07:53] Trustee Luckham: at this point. And so that's out in the public realm. And so thank you very much for all of you

[0:09:37] Voice 11: i think there's some reasonable progress that's indicated here item two we're just on the
[0:09:42] Voice 11: precipice of the learning group um being put forward we've had an exciting and uh um wonderful
[0:09:49] Voice 11: start with robin kellen in uh syrup position so that's uh that's been a a great mid-summer boost
[0:09:56] Voice 11: to our first nations thinking and work um she's getting settled and i think that i believe that
[0:10:02] Voice 11: this is one of the um the things that we're going to move forward reasonably quickly for item three
[0:10:09] Voice 11: i responded so you might want to i've responded to the senior ministry officials saying exactly
[0:10:17] Voice 11: this that trust council will revisit the request for review of the mandate governance and structure
[0:10:21] Voice 11: at september trust council and then subsequently update the minister um i think that suffices um
[0:10:30] Voice 11: i've mentioned it to them a couple of times and they said great let us know how it plays out
[0:10:34] Voice 11: that's in the absence of you writing directly to the to the minister on the matter um which we can
[0:10:39] Voice 11: certainly do as well but uh i think operationally that's taken care of and really uh item five's
[0:10:48] Voice 11: around the visioning exercise.
[0:10:49] Voice 11: And I might just take a few minutes
[0:10:51] Voice 11: when we get to the schedule
[0:10:52] Voice 11: for the upcoming September Trust Council
[0:10:55] Voice 11: to walk you through some thinking there.
[0:11:00] Voice 11: I think you can consider item seven
[0:11:02] Voice 11: has also functionally occurred.
[0:11:05] Voice 11: We have brought these three elements
[0:11:08] Voice 11: into our strategic planning process.

[0:11:49] Voice 11: the team uh covering off for the last about i noticed noticeable uptick in progress so uh
[0:11:55] Voice 11: so maybe we should do this more often um that being said we move into a busy time
[0:12:02] Voice 11: we have both the ubcm and we have another thought provoking trust council i say thought provoking
[0:12:07] Voice 11: because there's a number of sort of key thinking pieces that i think is going to set trust council
[0:12:11] Voice 11: into the rest of the term and concurrent with that is our our raft of committee
[0:12:19] meetings that are occurring just prior to Trust
[0:12:23] Voice 11: Council itself so we're well
[0:12:26] Voice 11: aware of that but there's a lot of work that's going on right now I'm sure you
[0:12:30] Voice 11: are as well and looking forward to even though this meeting is you know somewhat
[0:12:36] Voice 11: it's got some a couple items of significance certainly the meeting on
[0:12:40] Voice 11: the 13th you'll see the full uh the full wage of the various pieces of work that are going forward
[0:12:44] Voice 11: that being said i don't think there's any surprises um associated with those and we'll
[0:12:49] Voice 11: be able to briefly go over them when we get to um item 712 that's

[0:13:21] Voice 8: four about the round table on housing i note that obviously we've um slipped past the six
[0:13:28] Voice 8: months recommended in the resolution and i'm just wondering if there um is anything we can
[0:13:35] Voice 8: and report out to trustees on a projected timeline on that.

[0:13:44] Voice 9: have to turn to Stefan to give

[0:14:04] Voice 1: meeting. And we're in that RFD, I've got collating all the housing actions that are sort of from
[0:14:12] Voice 1: trust council to executive committee to regional planning committee. The recommendations will be
[0:14:17] Voice 1: there. As noted earlier, staff had earlier proposed that some of the roundtables that
[0:14:23] Voice 1: had been engaged in in April amongst UBCM and I believe on Gabriola with the, sorry, I forget the
[0:14:30] Voice 1: the name of the meeting that was held there,
[0:14:32] Voice 1: but it was a rural economic forum with islands,
[0:14:36] Voice 1: did partially address that.
[0:14:37] Voice 1: Now, I recognize that the EC did not feel the same way at that time,
[0:14:41] Voice 1: and hence why you're going to get a report back recommending next steps.
[0:14:44] Voice 1: And the regional planning committee is working on a housing strategy
[0:14:49] Voice 1: with housing toolkits, with communication materials
[0:14:51] Voice 1: and engagement materials.
[0:14:53] Voice 1: So I'm trying to put that all together for you to put into one package
[0:14:57] Voice 1: so we can advance housing in a cohesive manner,
[0:14:59] Voice 1: as opposed to sort of scattering it amongst the various committees and councils.
[0:15:03] Voice 1: So my answer is there's a more robust response coming next meeting.

[0:15:48] Trustee Luckham: Okay. Are there any questions on follow-up action list stuff? No. So CEO,
[0:15:54] Trustee Luckham: Oh, sorry, you almost got a promotion there.

[0:16:08] Voice 1: So all the local chess committees, I've been talking to the RPMs.
[0:16:13] Voice 1: There have been a lot of staff.
[0:16:14] Voice 1: You would think that having August as the downtime was noted,
[0:16:18] Voice 1: it's been noted that it's still very busy as we all prep up for busy times
[0:16:23] Voice 1: with further meetings and further actions a lot of exciting movement happening at in regards to
[0:16:28] Voice 1: first nations in terms of various agreements taking place and meetings happening various
[0:16:34] Voice 1: plans and business cases moving forward addressing first nations so i i think this is a really
[0:16:40] Voice 1: positive time that we're we're changing how we do business and we're figuring it out um and on the
[0:16:46] Voice 1: other side of that is regional planning committee is gearing up for their meeting coming up the next
[0:16:50] Voice 1: couple weeks and we're talking about business cases and we're talking about housing we're
[0:16:54] Voice 1: talking about fresh water and and other projects so all in all we're and staffing is we're starting
[0:16:59] Voice 1: to staff up it looks like we're we're starting to gain more than we lose so that's a really good
[0:17:04] Voice 1: sign and um yeah i think the probably the most significant other thing i can report back on
[0:17:10] Voice 1: is the local government development application program i think lgdap the city view software
[0:17:17] Voice 1: We're going to start testing the new software that's going to do our application processing
[0:17:23] Voice 1: and all our information processing.
[0:17:25] Voice 1: We're going to try to break the new software we've got and then once we can stop breaking
[0:17:30] Voice 1: it, we're going to start training and implementing it and we're on track to making that go live
[0:17:35] Voice 1: in the new year.
[0:17:36] Voice 1: So that's it.
[0:17:37] Voice 1: That's a very busy activity to be doing.

[0:18:48] Voice 6: agenda and we're moving now into the executive committee agenda we've continued to be focused
[0:18:53] Voice 6: on the bay project so there's not been a lot of action on the various items on your list here
[0:18:57] Voice 6: you can expect your legislative number two here you can expect your legislative monitoring report
[0:19:02] Voice 6: on the council agenda i'm happy to take questions though about anything that might be on here

[0:19:19] Voice 6: Yes I can just let you know we're happily settling in our new staff on the team
[0:19:24] Voice 6: so Robin Caffey has joined us as the Senior Indigenous Relations Advisor and she's now
[0:19:32] Voice 6: spent a month through orienting to the Islands Trust and I think you'll start to hear from her
[0:19:37] Voice 6: more from organizing such things as the Reconciliation Learning Group and other initiatives
[0:19:42] Voice 6: so she's about to start stepping out and meeting with all of you and beginning to work on some
[0:19:48] Voice 6: projects and also we've got mary storzer who's currently on vacation um we've been really digging
[0:19:54] Voice 6: into the policy statement project so we're starting to see the movement on that project
[0:19:58] Voice 6: as well and hope to have a draft to share with first nations um in september um with the and
[0:20:03] Voice 6: then we'll be working on communication materials with the hope of bringing it out to you in the new
[0:20:08] Voice 6: year although we've had a request from a nation to look at the project and consider how they might be
[0:20:15] Voice 6: more deeply involved in it so we'll be talking to them about that and we'll report back any outcome
[0:20:20] Voice 6: of that conversation with regard to other initiatives we're working on a business case
[0:20:27] Voice 6: for you for your next meeting possibly to consider around funding for next year's policy statement
[0:20:31] Voice 6: project and consideration of what the engagement might look like on that so we'll work on that for
[0:20:37] Voice 6: you we're also working on a communication strategy for the trust we'll be bringing to you and we have
[0:20:43] Voice 6: number of other um items that have been requested by trust council that are in motion right now
[0:20:48] Voice 6: so busy hopping team and uh looking forward to bringing some of that forward for you in the
[0:20:54] Voice 6: future thank

[0:21:14] Trustee Elliott: and Jillian and it was such a wonderful meeting and it's going to be so helpful to have a
[0:21:20] Trustee Elliott: communication strategy and I'm super happy with their responsiveness the kind of questions they
[0:21:27] Trustee Elliott: asked and their interest in creating a strategy that works for the various needs of the LTC so
[0:21:33] Trustee Elliott: congratulations we finally have that position filled I think it's going to make a huge difference
[0:21:38] Trustee Elliott: with regard to engagement with the public
[0:21:40] Trustee Elliott: and how we communicate generally.
[0:21:43] Trustee Elliott: So super happy about that.

[0:28:19] Trustee Maude: few things. One that's indirect to my responsibilities, which is Ornby Island, which as I was involved in the issue with B.C. Ferries with the tree cutting on Denman at Gravely Bay, when the issue came up with the midden disturbance this week, I seemed to be the first point of contact on that.
[0:28:44] Trustee Maude: that and fortunately at that time I was involved in BC Ferries meetings and I will reassure you
[0:28:51] Trustee Maude: that BC Ferries senior management I to say that they were mortified would be an understatement
[0:28:59] Trustee Maude: they have been very reactionary to this issue exceptionally apologetic it's a very significant
[0:29:08] Trustee Maude: significant thing that happened that never should have happened um moving next sort of to them and
[0:29:14] Trustee Maude: their housing um the privacy committee has been meeting weekly they've been um asking really good
[0:29:21] Trustee Maude: questions getting really good feedback um we have a meeting coming up in October which I look forward
[0:29:28] Trustee Maude: to because uh I think there's going to be quite a substantial amount of reporting coming out of that
[0:29:33] Trustee Maude: organization saturn i believe it was last week had a meeting with the ministry of highway staff over
[0:29:42] Trustee Maude: that street cutting issue it was well attended by representatives of crd the residence association
[0:29:52] Trustee Maude: local landowners i believe that they have a path forward with communications and consult
[0:30:00] Trustee Maude: the community before anything like this happens again and again i would say there's ministry staff
[0:30:05] Trustee Maude: there who are exceptionally apologetic for what happened it was out of their control and they have
[0:30:14] Trustee Maude: reassured us that there are policies in place that will never ever happen again so i'll

[0:32:00] Voice 8: salt spring local trust committee and seo and uh the galliano local trust committee and uh
[0:32:06] Voice 8: penelope tribe so i think those are those are some positive um positive opportunities to look forward
[0:32:14] Voice 8: to um i'll just quickly add that here on luskete yesterday i hosted uh uh john and sybil from the
[0:32:24] Voice 8: the Gabriel Ola Island Land Stewards Society.
[0:32:28] Voice 8: And we had a little brief discussion and Q&A here on Laskete Island
[0:32:34] Voice 8: with community members talking about community land trusts
[0:32:39] Voice 8: and what it takes to put one together
[0:32:42] Voice 8: and how the Gabriel Ola Island Land Stewards Society,
[0:32:47] Voice 8: what their sort of goals and thoughts were.

[0:33:51] Trustee Elliott: them and nothing to rise and report um but everything else seems quiet in the four ltcs

[0:34:01] Trustee Luckham: that's good news um thank you for your all of you uh thank you for
[0:34:07] Trustee Luckham: your work um so from my area um since our last telecon anyway there hasn't been any other
[0:34:15] Trustee Luckham: other meetings. Certainly next week is certainly going to be a busy week on a number of the
[0:34:21] Trustee Luckham: islands, Gambier included. It's quite the adventure, actually, to travel all the way to the
[0:34:27] Trustee Luckham: Sunshine Coast and Gambier Island, but looking forward to that opportunity.

[0:34:39] Trustee Luckham: ground with general inquiries. Just want to do a little shout out here from Thetis Island
[0:34:47] Trustee Luckham: for our nature conservancy. We on Thetis and their nature conservancy have learned so much
[0:34:54] Trustee Luckham: from some of the other islands as is happening between Gabriola and Laskiti now and we've
[0:34:59] Trustee Luckham: certainly learned a lot from Laskiti about recycling and seniors housing work and just
[0:35:05] Trustee Luckham: Just make note, Tim, that the activities and the work that's going on here with our Nature Conservancy, which is relatively new, maybe six or seven years now, has a full summer program.
[0:35:20] Trustee Luckham: They hire a staff person through summer months to run a youth program.
[0:35:25] Trustee Luckham: And, in fact, we just had a walk sponsored by them with Augie Sylvester and Councillor Thomas from Penelakut talking about the Penelakut history on Thetis.
[0:35:41] Trustee Luckham: And those things are so important to raise awareness about the natural environment and the rich cultural history here.
[0:35:52] Trustee Luckham: But of course, also recognizing the impact colonialism has had upon innocent people that were here since time immemorial.

[0:36:09] Trustee Luckham: And I'm grateful every day to be working in this role with the Islands Trust and conducting the work of preserving and protecting both communities and environment.

[0:36:46] Trustee Elliott: board for a three-year term ending August 21st, 2026. Charles Kahn will join our special meeting
[0:36:53] Trustee Elliott: which is coming up August 29th. The special meeting is just to review and approve the audit report
[0:37:00] Trustee Elliott: and have the auditors present their findings. We haven't yet elected a vice chair but
[0:37:08] Trustee Elliott: we're probably, yeah, I think we're going to conduct an election at the August 29th special
[0:37:13] Trustee Elliott: meeting and that's about it for the itc board oh there is a celebration of the first um covenant
[0:37:22] Trustee Elliott: property on the skidi island that's next it conflicts with our fpc meeting so i'm going
[0:37:30] Trustee Elliott: to request that um because both trustee yates and i are on fpc and then trustee peterson you are as
[0:37:39] Trustee Elliott: as well i'm wondering if we can if i can go to luskete attend the celebration which is at 11
[0:37:46] Trustee Elliott: and then be late to fpc so i hope that's okay with everybody but i think it's important that somebody
[0:37:52] Trustee Elliott: is there representing uh the conservancy yeah
[0:37:59] Trustee Luckham: um what immediately concerns me there's the quorum
[0:38:03] Trustee Luckham: of the fbc um but um i would suggest uh vice chair elliott that you communicate that directly with
[0:38:10] Trustee Luckham: the trustee Bernardo he holds the reins to that body so thank you for that heads up I think that
[0:38:21] Trustee Luckham: concludes our initial activities and we can move on now with our important work of the executive
[0:38:29] Trustee Luckham: committee to approve bylaws and I'll just note here that the approval of our consideration of
[0:38:37] Trustee Luckham: of bylaws and advancing our comments to respective local trust committees and municipalities
[0:38:44] Trustee Luckham: is limited to whether or not the bylaws are compliant with the policy statement.
[0:38:54] Trustee Luckham: And indeed, there's a long list of directives that is used.
[0:38:59] Trustee Luckham: We have a checklist that we use to determine whether or not the political body has considered all of the potential directives within the policy statement as it relates to the OCP.
[0:39:17] Trustee Luckham: And so it's rather specific, but it's also gray on many areas.
[0:39:24] Trustee Luckham: and certainly this bylaw as with others in the past are challenging for us to determine
[0:39:31] Trustee Luckham: whether or not they are compliant or not we've received 126 pieces of correspondence with
[0:39:40] Trustee Luckham: respect to this and that in itself is a heavy read not to mention the significant
[0:39:47] Trustee Luckham: you know one of the considerations of course is about the whether it's a high impact or a low
[0:39:53] Trustee Luckham: impact and not to lessen the topic or disrespect the topic at all but simply reading through
[0:40:00] Trustee Luckham: all the reports from Metro Vancouver with a high impact study in itself and that's interesting.
[0:40:11] Trustee Luckham: I think we don't have a member from the Bowen Island municipality here to represent this
[0:40:19] Trustee Luckham: and so it falls to director of trust of regional planning committee to advance this to us
[0:40:29] Trustee Luckham: and so indeed the question to us is whether it complies with the policy statement
[0:40:36] Trustee Luckham: we did raise the issue about high impact and there has been a response from the municipality
[0:40:43] Trustee Luckham: and that's included, I'll allow Director Cermak to summarize the report and the other materials
[0:40:53] Trustee Luckham: if it's necessary. There is, I think, a necessity to consider this very carefully, as always,
[0:40:59] Trustee Luckham: but I also want to raise, and I'll ask Director Mahler to perhaps address that as well,
[0:41:06] Trustee Luckham: Well, it strikes me that at the LTC level, compared to the municipality level, although
[0:41:15] Trustee Luckham: the bodies are similar in my mind in many respects, it's the political body that endorses
[0:41:22] Trustee Luckham: the recommendation from staff that the prospective bylaw is in compliance with the policy statement.
[0:41:34] Trustee Luckham: And indeed, in all cases at the LTC, that is a motion that is carried and advanced by the LTC to say that, yes, the political representatives believe that the bylaw is compliant with the policy statement.
[0:41:49] Trustee Luckham: That opportunity does not appear to have, and that was just raised late, does not appear to have happened with the LTC.
[0:42:00] Trustee Luckham: The two trustees particularly have not had an opportunity to weigh in on that in a meaningful way.
[0:42:08] Trustee Luckham: I might be wrong about that, but that's the impression I have at this time.
[0:42:12] Trustee Luckham: And so I think that that has an implication of its own, which is a process question, not a political question.
[0:42:20] Trustee Luckham: question or with respect to the merits of the bottle itself so um that's just kind of a quick
[0:42:26] Trustee Luckham: summary for you and i apologize for being lengthy i don't usually go on like this but i'll i'll turn
[0:42:31] Trustee Luckham: this over if that's all right with everybody to director sermac to assist us in uh the important
[0:42:37] Trustee Luckham: role we um have at this time so director sermac over to you thank

[0:42:45] Voice 1: good job summarizing the key points and i was trying to be short myself so i'll start at the
[0:42:51] Voice 1: beginning and i'll work my way through it so the purpose of the briefing that the ec has before
[0:42:55] Voice 1: them is of course to consider the further information that you all requested from the
[0:43:02] Voice 1: bowen island municipal staff specifically you asked questions about how the proposed camping
[0:43:07] Voice 1: was assessed as low impact recreational use versus high impact recreational use and how were the
[0:43:14] Voice 1: social impacts of the proposal addressed so staff's uh response is attached in the appendix
[0:43:20] Voice 1: of the of the briefing but i tried to summarize them briefly in the report for you so they're up
[0:43:26] Voice 1: front and if you wish to speak to it a little bit that you i heard you chair requesting me to do so
[0:43:33] Voice 1: and that is in terms of low impact versus high impact um you know there is no definition found
[0:43:39] Voice 1: found in the policy or in their Bowen Islands Municipality regarding high or low impact.
[0:43:46] Voice 1: And they, in fact, found supportive policies about enhancing visitors' enjoyment of the
[0:43:52] Voice 1: island's natural amenities without detracting from those amenities. In conversation with the planner,
[0:43:58] Voice 1: I spoke to them before we gave the written response and talked about low impact versus
[0:44:04] Voice 1: versus high impact, and we sort of compared high impact being traditionally organized sports and
[0:44:10] Voice 1: mechanized vehicles, that type of high impact, where it's baseball, softball, ATV use, those are
[0:44:15] Voice 1: definitely high impact, whereas traditionally camping and hiking are low impact. And of course,
[0:44:20] Voice 1: the density of, you know, you could argue that one per hectare, one per hectare campsite is not
[0:44:27] Voice 1: high. Of course, there's a question there about the intensity of that, how they're concentrated
[0:44:31] Voice 1: in smaller areas. In regards to the social impacts, their response was a little bit more,
[0:44:38] Voice 1: this is what led to having all your reports attached. I apologize for attaching the reports.
[0:44:43] Voice 1: That was the entire response by their staff. So I felt obliged to attach it to this report.
[0:44:47] Voice 1: It was, those reports were hyperlinked in your RFD that you considered August 2nd.
[0:44:52] Voice 1: And their summary about how they evaluated social impacts were based on the feedback they received
[0:44:58] Voice 1: received from the community, summarized as, you know, in high level as ferry capacity, fire hazard,
[0:45:05] Voice 1: traffic concerns, water use, and access. And so those were the supportive reports that you have
[0:45:12] Voice 1: brought to you about how those issues were addressed. And again, if you read the policy
[0:45:17] Voice 1: statement, that's what's required is addressing the issue, not necessarily solving it, but at
[0:45:21] Voice 1: least addressing it, turning their minds to it, turning your minds to it. So you have those
[0:45:26] Voice 1: reports attached and then after that I would draw your attention back then to the question at hand
[0:45:34] Voice 1: which of course is as you know or pardon me I should note that the correspondence you received
[0:45:39] Voice 1: over 126 correspondence clearly stating they're not in favor of camping not less so the park but
[0:45:46] Voice 1: the camping was the critical issue for them and even more so on car camping or anything related
[0:45:51] Voice 1: to it. And one in support with the caveat that they also would encourage the EC to support
[0:45:59] Voice 1: as low impact as possible camping or use. So they use the term sustainable and use this sort of
[0:46:07] Voice 1: economic, social and environmental proposal. So staff's assessment is that the key decision
[0:46:16] Voice 1: before the EC is whether or not the proposed bylaws are at variance with or contrary to the
[0:46:20] Voice 1: the island's trust policy statement. Staff's assessment is that the bylaws are not contrary
[0:46:25] Voice 1: to or variance with the policy statement. And recognizing the volume of consideration and the
[0:46:33] Voice 1: depth of consideration from other sources reminds you that in your request for decision, your RFD,
[0:46:38] Voice 1: which is on page 280 of your agenda package, there are alternative recommendations proposed there.
[0:46:44] Voice 1: And the way they're drafted for the executive committee's decision is such that if
[0:46:50] Voice 1: If the executive committee decides that the bylaws are in fact contrary to our variance with the Islands Trust Policy Statement,
[0:46:58] Voice 1: that the EC must provide the municipality with clear reasons and directions as to changes to the bylaw that would be required for your approval.
[0:47:07] Voice 1: And so I'm going to stop there and I'm happy to answer any questions.
[0:47:12] Voice 1: I think most of you have really dove into what it's like to receive a Bowen Island Municipality bylaw.
[0:47:18] Voice 1: And you know what the key decision is and you know what your options are.
[0:47:21] Voice 1: Happy to answer any questions.

And perhaps if you don't mind, Director Cermak, I might just ask for remarks from Legislative Services Manager with respect to the process that I identified with regards to the political body endorsing that, in their opinion, the bylaw is in compliance with the policy statement.

[0:47:52] Trustee Luckham: about what we'd like to do here,
[0:47:53] Trustee Luckham: unless there's some recommendations out of the process.

[0:48:01] Voice 4: Yeah, so with local trust committees,
[0:48:04] Voice 4: they do require that they pass a resolution
[0:48:07] Voice 4: to indicate that they believe it's not contrary
[0:48:09] Voice 4: to it bearings with the Alice Trust Policy Statement.
[0:48:12] Voice 4: And that change was made so that it was clear
[0:48:15] Voice 4: that it wasn't staff just doing the work
[0:48:18] Voice 4: working then at the local trust committee, not really taking the time to look at it and
[0:48:24] Voice 4: take a position on it. So it was really put in place more as a way to protect staff and
[0:48:31] Voice 4: make sure that it was the political body that was making that interpretation. Bowen Island,
[0:48:38] Voice 4: we don't have any control over how they run their internal procedures. But the way I would
[0:48:45] Voice 4: take this is that Bowen Island Municipality received a staff report from the staff and
[0:48:52] Voice 4: in that staff report was an analysis or at least a checklist that considers the policy
[0:48:58] Voice 4: statements and indicates whether or not staff believe it's consistent or not. So by receiving
[0:49:03] Voice 4: that staff report and proceeding with the bylaw I would take the assumption that the
[0:49:08] Voice 4: Bowen Council has considered it and agrees with the staff position and if they didn't
[0:49:14] Voice 4: they should be obviously passing resolutions to say they don't agree with the staff

[0:50:14] Trustee Luckham: body, how do you feel you want to proceed with an analysis of this and providing, endorsing the
[0:50:25] Trustee Luckham: bylaws or approval of the bylaws in the limited extent that we do? Or is there some alternative

[0:51:17] Trustee Maude: I get, the more concerns I have.
[0:51:18] Trustee Maude: And so what I've done is I've sort of flagged a couple of lines within the policy statement
[0:51:24] Trustee Maude: that i either weren't concerned uh considered or perhaps i disagree with the interpretation
[0:51:31] Trustee Maude: so if like starting on page 37 if we just sort of wanted to to look at each one of my concerns
[0:51:40] Trustee Maude: and and see if whether or not there's endorsement for that or not i would appreciate that
[0:51:43] Trustee Maude: that. My first concern was Directive Policy 4.4.2, which basically talks about considering
[0:51:56] Trustee Maude: the effect of groundwater, water quality, etc., as you can see there. It's ticked off as being
[0:52:06] Trustee Maude: not applicable um given the the correspondence that we received in the last days about the water
[0:52:16] Trustee Maude: quality and quantity in that area i'm questioning why that that is ticked off as not applicable
[0:52:24] Trustee Maude: because it sounds to me um from a layman's standpoint and the and the the information
[0:52:30] Trustee Maude: that i have been provided it sounds like it actually is a serious concern in that location

[0:52:54] Trustee Luckham: fact one might suggest depending upon the camper that there might be more water usage for cleaning

[0:54:21] Trustee Maude: signatories on a petition that perhaps it has not been properly addressed okay
[0:54:30] Trustee Maude: so that's that's my next one uh next is 5.2.4 um where it says ensure that land use is compatible
[0:54:40] Trustee Maude: compatible with preservation protection of the environment natural amenities resources and
[0:54:44] Trustee Maude: Community character um we did see from the Metro Vancouver reports that there seemed to be some
[0:54:52] Trustee Maude: pretty substantial environmental concerns there but I didn't really see the overall and competency
[0:54:59] Trustee Maude: and encompassing of any protections there and it's ticked off as being not applicable
[0:55:04] Trustee Maude: applicable. So we've given a report saying that there are substantive environmental issues
[0:55:12] Trustee Maude: there, but for some reason it's being not applicable.

[0:55:51] Trustee Maude: numbers that have been repeatedly quoted is that this campground is going to have capacity of up to
[0:55:56] Trustee Maude: to 460 individuals.
[0:55:59] Trustee Maude: That sounds like an excessive addition of density,
[0:56:04] Trustee Maude: no matter what the existing zoning is.
[0:56:08] Trustee Maude: So I'm questioning again,
[0:56:10] Trustee Maude: why that is picked off as not applicable and not addressed.

[0:56:48] reports that we we have um about the environmental sensitive
[0:56:51] Trustee Maude: areas the foreshore and such i don't
[0:56:55] Trustee Maude: understand what that's ticked off as being not applicable okay 5.5.6 um which has been ticked
[0:57:05] Trustee Maude: off as being in compliance with trust policy um speaks of low impact um recreational activities
[0:57:13] Trustee Maude: and discourages facilities and opportunities for high impact recreational
[0:57:17] Trustee Maude: activities this i believe is an interpretation issue and again i'm weighing on that 460 number
[0:57:26] Trustee Maude: on the impact on the community um this i just i i don't understand the logic where somebody's
[0:57:38] Trustee Maude: saying this is living compliance as a low impact because 460 people getting off a ferry on a friday
[0:57:46] afternoon to go camping um talking to the people of bowen islands
[0:57:50] Trustee Maude: and interestingly um the people
[0:57:53] Trustee Maude: from bc ferries have reached out to me this week they see it as being substantial and significant
[0:58:00] Trustee Maude: um just that one aspect of impact on the community um i understand there's no
[0:58:07] Trustee Maude: bike path it's a narrow road access from one end to the island to the other end
[0:58:10] Trustee Maude: where this campground is is located again i can't see how that can be a sort of seen as being
[0:58:19] Trustee Maude: low impact. The impact on the retail outlets, everything on the island.
[0:58:26] Trustee Maude: The number of 460 in any one of our islands, I can't see any type of development that we would
[0:58:37] Trustee Maude: talk about and have the number 460 attached to it, and we would suggest that that is low impact.
[0:58:42] Trustee Maude: impact. So I am seriously questioning why that is ticked as being in compliance.
[0:58:52] Moving on, the next policy is 5.5.7, where it says that they
[0:59:00] Trustee Maude: need to address the planning
[0:59:01] Trustee Maude: for bicycle, pedestrian, equestrian and trail systems, which what they're suggesting is
[0:59:08] Trustee Maude: is much of the traffic to this campground will be via those means.
[0:59:14] But again, I don't see
[0:59:16] Trustee Maude: anything within the plan that actually says
[0:59:20] Trustee Maude: that when they open up this campground,
[0:59:22] Trustee Maude: there's going to be any of these facilities in place.
[0:59:24] Trustee Maude: There's talk about planning and such, but I don't see a timeline.
[0:59:29] Trustee Maude: I don't see anything that says that this is going to be addressed.
[0:59:34] Trustee Maude: So I'm concerned that that has been ticked off.
[0:59:39] Trustee Maude: My final one is 5.7.2, which addresses economic opportunities that are compatible with conservation of resource and protection of community character.
[0:59:57] Trustee Maude: My concern is that this is severe.
[1:00:00] going to change the character of the community. Goan
[1:00:02] Trustee Maude: Island traditionally has been a no camping
[1:00:06] Trustee Maude: island. My understanding has been an activity that's been actively discouraged by the municipality
[1:00:11] Trustee Maude: up until this time. So again, opening up a substantial campground with potential for 460
[1:00:22] Trustee Maude: occupants, I think changes the character of the community. So I'll leave it at that. Thank you.

[1:00:35] Trustee Luckham: number of the concerns that i have and i'll just go to other trust other vice chairs at this moment
[1:00:41] Trustee Luckham: to see if they uh uh share the same concerns or have other concerns and then i'll weigh in at the
[1:00:48] Trustee Luckham: at the end about what i i'm thinking here but uh vice chair elliott thank

[1:00:56] Trustee Elliott: Yes, thank you, David Maud. That was a really good summary. I would add also that it's really tricky to assess how the protection of cultural and natural heritage is being addressed if they haven't actually moved ahead and gained support or evidenced support from Squamish Nation.
[1:01:21] Trustee Elliott: And so Policy 5.6.3, the preservation and protection of the heritage value and character of historic coastal settlement patterns and remains, this is really difficult for us because we're in a new age.
[1:01:37] Trustee Elliott: We're trying to amend our policies to be in line with the Declaration Act.
[1:01:48] Trustee Elliott: And so how do we interpret how they're going to protect Indigenous cultural heritage if there isn't real consultation yet with the Squamish Nation?
[1:02:06] Trustee Elliott: So that was one of my concerns.
[1:02:09] Trustee Elliott: I do think this fails the test, to be honest, of complying with the Islands Trust Policy Statement on three points.
[1:02:21] Trustee Elliott: It's we don't have the evidence of protection of cultural heritage and the support of Squamish Nation yet.
[1:02:28] Trustee Luckham: Can you cite a section of the policy statement directive?
[1:02:33] Trustee Luckham: It's the
[1:02:34] Trustee Elliott: cultural and natural heritage, but unfortunately, it specifies historic coastal settlement patterns and remains. And so, what is our duty and responsibility to ensure that Indigenous cultural heritage is being protected through this OCP amendment? It's ambiguous.

[1:02:59] Trustee Luckham: well it is and so thank you for addressing that ambiguity because indeed the
[1:03:03] Trustee Luckham: policy statement is silent on that but what you're suggesting is in section uh what is

[1:03:31] Trustee Elliott: if 50 of the campground proposed campground is supposed to be bicycly accessible by bicycle or
[1:03:39] Trustee Elliott: walk-in we're talking about a 12 kilometer distance um and i hadn't realized how far that
[1:03:45] Trustee Elliott: was until i looked at it in the context and that would be on gabriela island people walking or
[1:03:50] Trustee Elliott: cycling from our ferry terminal from one end of the island to the other. And that is just, it's not
[1:03:57] Trustee Elliott: feasible, perhaps in three to five years. And if the bike path or the proposed active transportation
[1:04:04] Trustee Elliott: path is extended to that, the Cape Rogers location, that would be feasible. But to expect
[1:04:12] Trustee Elliott: that people are going to walk 12 kilometers or bicycle along a single road that hasn't been
[1:04:19] Trustee Elliott: expanded to accommodate that traffic is to me that hasn't been thought through yet and then
[1:04:25] Trustee Elliott: finally the social impact this is 5.2.3 which I referred to in our first meeting I think there's
[1:04:35] Trustee Elliott: demonstrated the demonstrated opposition from long-term residents this is not a typical letter
[1:04:44] Trustee Elliott: letter-writing campaign that I have seen before, in which there's just a template and a bunch of
[1:04:50] Trustee Elliott: people say, you know, I'm in agreement with this. There are very specific concerns from long-term
[1:04:56] Trustee Elliott: residents that range from water to ferry capacity to safety to roads to just the overburdening of
[1:05:04] Trustee Elliott: all the amenities on the island that I don't believe have been sufficiently addressed in the
[1:05:10] Trustee Elliott: the public engagement to date and that to me fails the test it does not address the social impact
[1:05:17] Trustee Elliott: because those who are who should be consulted the most on a project of this scale are the long-term
[1:05:27] Trustee Elliott: residents and the ones who have seen what development does and what the trends could
[1:05:32] Trustee Elliott: potentially lead to paid consultants on traffic on on everything else are wonderful but if you
[1:05:39] Trustee Elliott: haven't addressed the legitimate concerns of long-term residents I think it fails the test
[1:05:44] Trustee Elliott: of the social impacts of a project of this size and needs more work okay

[1:09:02] Trustee Luckham: of the other questions that have come forward I can't help but think that I don't know how many
[1:09:06] Trustee Luckham: individuals it might be but I'm thinking of a significant number of families of four uh
[1:09:12] Trustee Luckham: So parents and children bicycling that length of road all at once when the ferry comes in would, I think, be challenging for the community, as well as challenging for the safety and well-being of the cyclists.
[1:09:27] Trustee Luckham: And indeed, we are often in a difficult position where we're trying to represent First Nations interests, because that's not clarified in the policy statement at this time.
[1:09:39] Trustee Luckham: And I look forward to the day that that is.
[1:09:43] Trustee Luckham: And I just want to say that on 5.56, which is the one that we rose, that was spoken to at our last meeting, I think that still exists with respect to low impact or high impact.
[1:09:55] Trustee Luckham: I think the magnitude of the report, particularly the traffic analysis and the ferry analysis and all the beautiful graphs and all the rest of it, I think there is an understanding that there is a high impact associated with this because otherwise we wouldn't be doing these reports.
[1:10:13] Trustee Luckham: I'm not against camping. I think actually camping on that location is a fantastic opportunity for
[1:10:18] Trustee Luckham: all of us. It's the magnitude of it, especially, and I understand the whole thing about Cape
[1:10:26] Trustee Luckham: Roger Curtis. No, I don't understand it. I have some understanding of the whole Cape Roger Curtis
[1:10:31] Trustee Luckham: thing. And indeed, we're taking, I think it's 26 lots out of a very large development, which has
[1:10:37] Trustee Luckham: has been controversial and creating a recreational opportunity for everyone um not just vancouverites
[1:10:45] Trustee Luckham: but it would be available to everyone i assume um which is a good thing but it is the number of
[1:10:50] Trustee Luckham: campsites in a res what is essentially a residential neighborhood surrounding that
[1:10:55] Trustee Luckham: property is another uh if i'm not mistaken 23 or 33 other lots 33 other lots i think it is
[1:11:04] Trustee Luckham: that indeed, as all those campers on bicycles and the fuel and cars and the group campsites,
[1:11:11] Trustee Luckham: even I don't know whether or not there's numbers attached to the population that might attend as a group.
[1:11:17] Trustee Luckham: I didn't see that. Maybe I missed it. There are significant impacts.
[1:11:22] Trustee Luckham: So unless so, I'd maybe just ask a question of staff at this point.
[1:11:28] Trustee Luckham: Certainly it would sound like one of the options
[1:11:32] Trustee Luckham: to return this to the Bowen municipality,

[1:13:12] Trustee Luckham: addressed the way in on so turn to staff to advise us i'm thinking that a motion that's uh one of the
[1:13:19] Trustee Luckham: the first alternative in the package that we had last week or last month um would need to list

[1:14:14] Voice 4: committee because the LCP will be coming back to you for approval so that's with the LCP the
[1:14:20] Voice 4: land use bylaw is a little different and for that one the Boeing Council would notify the minister
[1:14:29] Voice 4: of your concerns and the minister could then determine either override essentially or they
[1:14:37] Voice 4: they could require that Boeing and Executive or Trust Council go through some kind of dispute
[1:14:46] Voice 4: resolution process to figure out who's right, who's wrong. Now that is set up because usually
[1:14:53] Voice 4: you'll get some bylaws that have no LCP tied to it. This land use bylaw requires the LCP
[1:14:59] Voice 4: to be approved. So I think your concerns around the LCP are probably the ones to focus on.

[1:43:10] Trustee Luckham: bona municipality staff is uh superb and um this isn't a criticism it's just we want to see some
[1:43:16] Trustee Luckham: of those issues addressed that we have ourselves and we have heard from members of the public
[1:43:21] Trustee Luckham: and the community at large and um so we're thankful for that um so we're now gonna roll

[1:46:56] Voice 11: So it's almost like the irony of a structured decision-making process, ironically, in trying to assist us in making structured decisions.

[1:47:10] Voice 11: I think there's some really interesting ideas associated with it.
[1:47:13] Voice 11: I won't have time between now and then to provide real advice to you, so I hope it would be a conversation and not conclude necessarily without having some thought.
[1:47:26] Voice 11: But one of the key thoughts is, I was talking with a staff person the other day, I'm guessing across the country, we would have more corporate entities with more meetings than any bodies of a similar size.
[1:47:41] Voice 11: So every time you add a meeting, you have to figure out how you're going to do that.
[1:47:47] Voice 11: That's why it's a significant exercise every year getting all of those coordinated and put forward.
[1:47:59] Voice 11: Now, that's not to say that there might be some good changes out there that we have to undertake.
[1:48:03] Voice 11: And maybe that's exactly what this is for.

[1:55:01] Voice 8: is to look into this in depth in in a more timely manner perhaps uh i'd certainly take uh trustee
[1:55:07] Voice 8: maude's advice that governance committee may or may not choose to deal with us uh in the in the
[1:55:13] Voice 8: timely fashion that other trustees may want to deal with thank you

[1:56:38] Voice 11: we've taken some of that work and tried to organize it and we're delivering that
[1:56:42] Voice 11: by the governance committee and i think i'm not saying anything um controversial here but there's
[1:56:48] Voice 11: also another mechanism that we're using to address the same issues and that is um interesting
[1:56:53] Voice 11: abilities of any given trustee around something that needs to be addressed or should be addressed
[1:56:58] Voice 11: is then brought to the table and we discuss it so how do we do that and not redo things
[1:57:05] Voice 11: or how do we do those things so they're in sequence um or is it all okay you know that
[1:57:11] Voice 11: that's uh i think that's we have like two or three more profound questions around you know
[1:57:19] Voice 11: how we internally work things through we'd have to step back and go how are we managing these new
[1:57:24] Voice 11: ideas collectively and and trying to come to it like what outcome and part of that is maybe
[1:57:31] Voice 11: discussing the governance review um sort of at another level or lead
[1:57:37] Voice 9: most of that work with the
[1:57:38] Voice 9: governance committee who are putting that time in well
[1:57:43] Trustee Luckham: thank you for that advice and indeed we've
[1:57:48] Trustee Luckham: talked about that um a number of us have talked about that very concept of council has never
[1:57:56] Trustee Luckham: really sat down and talked about the governance review, which elements of it we agree with or
[1:58:01] Trustee Luckham: don't agree with, and where the emphasis should be. We have handed that off to the governance
[1:58:06] Trustee Luckham: committee. And presumably, and that, you know, I sit on that as an ex officio, that conversation is
[1:58:13] Trustee Luckham: fulsome, and indeed engages with others, accordingly. But yeah, I would agree with you
[1:58:23] Trustee Luckham: that in context of this as it's all evolving and we're and all trustees are now settling into their
[1:58:29] Trustee Luckham: roles and evolving into a place of wanting to actually take on some work now I have always
[1:58:35] Trustee Luckham: said that the first year of our term should be that opportunity for us to inform ourselves and
[1:58:40] Trustee Luckham: understand our roles and then the following three years is when we get on with work and indeed there
[1:58:45] Trustee Luckham: are folks that are interested in getting on with some work. I also always say when we're looking
[1:58:51] Trustee Luckham: at change i wonder what the change i my question is what does change actually look like and so
[1:58:57] Trustee Luckham: indeed that dovetails into a conversation about the governance review and if we're changing the
[1:59:02] Trustee Luckham: meeting schedule to a more regular basis and talking about focus topic discussions to inform
[1:59:07] Trustee Luckham: decisions i can't help but wonder what are those decisions and what are those topics and are they
[1:59:13] Trustee Luckham: defined and is it reasonable to change the entire process in order to facilitate conversations that
[1:59:21] Trustee Luckham: may be of a shorter term scope than a longer term business as usual scope um so yeah um so it
[1:59:30] Trustee Luckham: strikes me that coming out of this what maybe i'm hearing is that um this should come to council
[1:59:37] Trustee Luckham: so and find some time to have a brief discussion to determine support for it being advanced to the
[1:59:47] Trustee Luckham: governance committee for consideration on their uh list of action items um and that that be
[1:59:55] Trustee Luckham: We recommend that this briefing be forwarded with a recommendation from
[2:00:00] Trustee Luckham: me see that uh it be advanced to uh to the governance committee with council's um discussion
[2:00:09] Trustee Luckham: involved somehow in that i'm not sure how the word that i i think that's where we are at um
[2:00:17] Trustee Luckham: but of course both uh things uh a brief discussion about this to determine whether
[2:00:24] Trustee Luckham: there's support for it to go to the governance committee to initiate more work at whatever
[2:00:29] Trustee Luckham: whatever time frame it seems appropriate, is one thing.
[2:00:33] Trustee Luckham: A full some conversation about the governance review is another thing, both of which I suspect is inadequate time in September.
[2:00:41] Trustee Luckham: However, December is coming along, which, of course, is also a pre-budget kind of session.
[2:00:48] Trustee Luckham: I anticipate. And so, you know, we're in post vision session, which we're hosting in September.
[2:00:57] Trustee Luckham: and and policy statement work there's a lot of business on the docket already um and how do we
[2:01:07] Trustee Luckham: and so that's an open well that's an open question to everybody or indeed the trust council draft
[2:01:12] Trustee Luckham: schedule is coming up um here next um but i suspect there's little room to have one additional
[2:01:21] Trustee Luckham: conversation there's inadequate room for two full conversations uh vice chair maude um could i
[2:01:30] Trustee Maude: suggest the trustee boland's proposal in my roundtable suggestion that we actually make it
[2:01:36] Trustee Maude: the topic for the trustee roundtable um that way we could sort of keep our the proposed agenda

[2:29:01] Trustee Luckham: um uh an executive decision i'll call it um the theodosan local trust committee
[2:29:08] Trustee Luckham: asked for the publication of an in-camera legal opinion with respect to enforcement regarding
[2:29:21] Trustee Luckham: fire, high-risk fire activities on our island in particular. And that opinion has been received,
[2:29:31] Trustee Luckham: Well, was received. And now there's a public version of that that's going out.
[2:29:37] Trustee Luckham: It was felt in conversation with Director Frater that there wasn't necessarily a significant benefit to all of Trust Council.
[2:29:50] Trustee Luckham: So it wouldn't go out as a news release or a broad publication to everyone because it has a much more local context, a local.
[2:30:00] Trustee Luckham: advocacy opportunity and there are sensitivities around it that involve individuals mental health
[2:30:09] Trustee Luckham: matters enforcement generally and the intention of the ltc and director of vice chair elliott
[2:30:17] Trustee Luckham: you'll recall the intention of that was to inform the other local authorities being the regional
[2:30:24] Trustee Luckham: district and the improvement district about and the islands trust about what those shared
[2:30:30] Trustee Luckham: responsibilities or lack of ability to do enforcement outside of the avenue that is
[2:30:35] Trustee Luckham: being undertaken and so i just want you to be aware of that um not that i want to preclude
[2:30:41] Trustee Luckham: anybody but given the nature of the situation it seemed that that would be published locally
[2:30:48] Trustee Luckham: And of course, it could flow from there. But there was the intention was just for it to be used locally. All right. So with that said, if there's nothing further, then I'm going to continue on down the agenda to 9.4.1.

[2:31:35] Voice 8: Essentially what happened was that there was litigation
[2:31:40] Voice 8: authorized in the previous term
[2:31:41] Voice 8: uh and um the new ltc was uh uh somewhat surprised when the court action actually
[2:31:52] Voice 8: launched which you know the delays in in these actions are not surprising but there was uh some
[2:32:01] Voice 8: consideration and i was asked if i would bring this up for for discussion with ec um just to
[2:32:08] Voice 8: to consider ways that that we might be able to um inform especially ltcs in a in a new term of
[2:32:19] Voice 8: action that um comes to fruition from a previous term so that they're not a sort of in a position
[2:32:27] Voice 8: of surprise and particularly uh in a case where it's high profile enough that uh there might be
[2:32:34] Voice 8: media reports on on such litigation um essentially to help support local trustees uh so they're not
[2:32:43] Voice 8: in a position of being asked for comment about something that they're suddenly surprised about
[2:32:49] Voice 8: so i i don't know what we have in terms of of a procedure that could follow the progress of this
[2:32:57] Voice 8: And when we stick up a red flag to let the LTC know that this is imminent, clearly this is going to be an issue that's only going to be happening when it's a holdover from last term's decision to proceed with litigation and the litigation actually doesn't start until the new term.
[2:33:19] Voice 8: So I'm not certain what can be done about addressing this kind of a situation and of course I would look to staff for any advice that they might have on how we could flag this so that essentially so that trustees are not somewhat taken by surprise when this sort of situation arises.
[2:33:41] Voice 8: rises.
[2:33:43] Trustee Luckham: Okay, thank you, Justice Peterson. Certainly interested in seeing staff's understanding of what
[2:33:51] Trustee Luckham: the process might be there. I can't help but reflect, however, that we've had three or four
[2:33:58] Trustee Luckham: council meetings since the beginning of this term. And we used to get much more significant
[2:34:04] Trustee Luckham: reporting from bylaw enforcement with respect to bylaw enforcement activities. There was a table
[2:34:10] Trustee Luckham: and we used to know what was going on in a briefing and of course we cut back a lot of
[2:34:14] Trustee Luckham: those briefings and staff reports and it may not be it may have been obvious if you looked at the
[2:34:20] Trustee Luckham: documents that that activity was pending um but obviously has been missed um because maybe what
[2:34:26] Trustee Luckham: our attention wasn't drawn to it so that it's interesting that this is i i'm thinking that
[2:34:32] Trustee Luckham: there's some missed opportunity this council hasn't realized in its wisdom of wanting to
[2:34:38] Trustee Luckham: to reduce the amount of reporting out
[2:34:42] Trustee Luckham: that maybe that this is one of the consequences of that,
[2:34:44] Trustee Luckham: but I might be wrong.
[2:34:45] Trustee Luckham: So look towards, I'm not sure who would want to address that,
[2:34:49] Trustee Luckham: but-
[2:34:52] Trustee Luckham: I'll start and then I'll say

[2:35:00] Voice 6: that trustees were caught off guard by learning about,

[2:35:05] Voice 6: we just we haven't made any like written procedural changes but certainly the bylaw
[2:35:10] Voice 6: enforcement manager now when we're going to encourage lawyers to make sure they let us know
[2:35:14] Voice 6: and then quickly we'll be in touch with the communication specialist just to produce a
[2:35:18] Voice 6: quick background or an update for trustees when you know when things are being filed in public
[2:35:23] Voice 6: court such that the trustees can be aware of what's happening and have some key messaging
[2:35:27] Voice 6: and background so we've instituted that internally and i've already seen it instituted once since the
[2:35:33] Voice 6: first situation arose so i have some confidence there's good relationships now and we'll do a
[2:35:38] Voice 6: better job in the future yeah
[2:35:41] Voice 9: um well
[2:35:44] Voice 11: first of all we so we do do our litigation reports we have not
[2:35:49] Voice 11: stopped doing those and each ltc as the trustees were onboarded would have had a briefing on
[2:35:57] Voice 11: whatever legal files that are in place it's a quest so it's not a surprise factor unless
[2:36:04] Voice 11: something was egregiously missed it's just is this important right now factor and then i think what
[2:36:10] Voice 11: happened is quite often we don't even know like there'll be there'll be this will be in some
[2:36:18] Voice 11: process and then we'll be notified that oh yeah i know we you know we're on the docket or something
[2:36:24] Voice 11: like that so for sure people should be uh given the opportunities to uh understand what's coming
[2:36:34] Voice 11: coming up and we have to put a process in place.
[2:36:36] Voice 11: It's completely reasonable information
[2:36:39] Voice 11: and we'll see what we can do,
[2:36:40] Voice 11: but it's a few little factors together.
[2:36:44] Voice 11: The biologic litigation report does exist.

[2:38:49] Trustee Elliott: thank you um I guess um trustee Patrick is looking for
[2:38:54] Trustee Elliott: an indication from executive committee if the Salt Spring LTC might consider supporting the CRD
[2:39:03] Trustee Elliott: if they choose to be included in a new area tax for the CRD area.
[2:39:18] Trustee Elliott: So this does have broader regional considerations.
[2:39:23] Trustee Elliott: And so is this an issue that Trust Council needs to consider going forward?
[2:39:31] Trustee Elliott: I'll note that there are several new cities and districts that have been
[2:39:38] Trustee Elliott: included for the 2024 year Duncan, North Cowichan, Squamish, Ladysmith, Lake
[2:39:45] Trustee Elliott: Cowichan and the village of Lyons Bay so I don't know if the inclusion
[2:39:52] Trustee Elliott: criteria has changed or the towns that were previously excluded chose to change
[2:39:59] Trustee Elliott: that and get in on the speculation and vacancy tax.

[2:41:13] Voice 8: to consider supporting that request yet uh but i believe it's it's uh it's supposed that um we
[2:41:22] Voice 8: may be at the crd may ask the salt spring local trust committee uh to consider supporting that
[2:41:28] Voice 8: that request and so I believe what Trustee Patrick
[2:41:33] Voice 8: is looking forward some clarity on whether at this time,
[2:41:39] Voice 8: whether it's appropriate for Salt Spring LTC
[2:41:41] Voice 8: to consider such a request if it does arrive from the CRD.

[2:41:54] Voice 11: I don't think it's a question
[2:41:56] Voice 11: EC can answer, it's an advocacy position of trust council.
[2:42:02] Voice 11: And I think that you'd have to have that conversation at Trust Council, and it might be wise to have that at this point.
[2:42:11] Voice 11: But I don't know whether the EC can, and I don't know offhand, I don't think they can provide assurances to any one LTC that they can take a separate opinion to a Trust Council advocacy position in the past.
[2:42:30] Voice 11: And of course, this was discussed at Trust Council a number of years ago. The points made that I think times changed and maybe needs to be revisited.
[2:42:39] Voice 9: But I would think that that's, I think that's the most likely avenue forward.
[2:42:47] Voice 9: forward. Yeah. The only thing I would add to this is the
[2:42:58] Trustee Luckham: topic of taxation in the past
[2:43:01] Trustee Luckham: brought just generally, not anything to do with speculation tax, any kind of tax.
[2:43:06] Trustee Luckham: It does occur to me that the conversation that has transpired is that the province has little
[2:43:13] Trustee Luckham: ability to micromanage which islands would be taxed in a regional district. It would be a
[2:43:20] Trustee Luckham: a regional district, because it's not coming from the regional district, which can provide
[2:43:24] Trustee Luckham: discrete taxation to areas, but the province does it broadly by larger areas.
[2:43:31] Trustee Luckham: So obviously, I think that an LTC can certainly advocate on its own behalf for its own interest
[2:43:37] Trustee Luckham: in that, but they would want to be cognizant of the fact that a regional district taxation
[2:43:42] Trustee Luckham: through the provincial taxation may apply to other islands that may or may not be interested
[2:43:48] Trustee Luckham: in that.
[2:43:49] Trustee Luckham: And so you'd want to be sure that the interests of Salt Spring are not adversely affecting other islands.
[2:43:58] Trustee Luckham: And then, of course, the obvious thing is, is that that money doesn't come back to the regional district or the LTC.
[2:44:05] Trustee Luckham: It goes to the province. And so it's a it's a it's a mechanism to deter certain activities that may or may not.
[2:44:16] Trustee Luckham: And then, of course, I don't actually think it would require somebody smarter than me to remember a better memory than I. Council doesn't really have a position on the speculation tax. It was actually withdrawn from the Islands Trust area when it came in.
[2:44:32] Trustee Luckham: And the minister at the time had expressed, because it was a bit of a concern, expressed right at the get-go.
[2:44:39] Trustee Luckham: And the minister clarified the decision that was being made by the province that the intention was that the Island's Trust Area not be included in it.
[2:44:49] Trustee Luckham: And so, yeah, and that begs the question whether or not it would apply to all the Island's Trust Area, not just the regional district of the Capital Regional District.
[2:45:00] Trustee Luckham: So, certainly, I would suggest the LTC is free to advocate for anything it wants, but would have to be cognizant of that broader impact.

[2:46:22] Voice 6: that staff did analysis for council around the number of part-time and vacation properties in
[2:46:28] Voice 6: the trust that would then become subject to the tax but this was quite a long time ago so we
[2:46:33] Voice 6: likely have to look back at what we provided council and perhaps upon request rerun that
[2:46:39] Voice 6: analysis so you can make informed decisions that is also part of your advocacy policy is that your
[2:46:44] Voice 6: advocacy be based on you know sufficient amount of information and so we'd be happy to support

[2:51:39] Voice 11: that's going to be a topic for this trust council meeting given how much is on the agenda and yeah
[2:51:45] Voice 11: working here is on the strategic planning i think you're informed as to where we are we're bringing
[2:51:50] Voice 11: the program planning report forward to um this trust council for approval the framework at least
