[0:04:03] Voice 3: report, but I'm aware that we have some big issues that we're deciding we're going to try to tackle.

[0:04:10] Voice 3: And I know there's a lot of different perspectives on it. What's important and what I want is I want

[0:04:18] Voice 3: us to make sure we think about the process that we're doing under and that we make sure that that

[0:04:25] Voice 3: process is inclusive, open, and that we listen to each other and that we keep a good community

[0:04:31] Voice 3: community atmosphere throughout this whatever it is we do and I'm more attached to that and

[0:04:37] Voice 3: you know that's what I care about and the other stuff I also care about but that is secondary to

[0:04:44] Voice 3: how we do it so I'm looking forward to testing all of our skills at doing that because I think

[0:04:52] Voice 3: we have some you know pre-charged pockets at hand so we have to really keep ourselves

[0:04:58] Voice 3: ourselves um as civil as we can and as have as much goodwill as possible and i'm positive that

[0:05:06] Voice 3: we can do that

[0:05:06] Trustee Elliott (probable): so much appreciated trustee park um for the chair report um i have been

[0:05:16] Trustee Elliott (probable): i've almost had two weeks off although there's been lots of um at-home work as everybody gets

[0:05:24] Trustee Elliott (probable): busy in the summer uh executive committee did meet on july the 12th and again um gosh i'm sorry

[0:05:35] Trustee Elliott (probable): it's been a lot of some sometimes meetings but um i met with our senior policy advisor a new

[0:05:43] Trustee Elliott (probable): member of the team robin keffie on um on tuesday the 29th just for an informal meeting and

[0:05:51] Trustee Elliott (probable): to get to know one another and we're sort of strategizing how to approach the trustees

[0:05:57] Trustee Elliott (probable): reconciliation learning group and so that's been an initiative that I brought forward to our first

[0:06:05] Trustee Elliott (probable): trust council looking for sort of a home for how do we discuss reconciliation initiatives across

[0:06:12] Trustee Elliott (probable): trust council and my original motion was to request that a committee be struck it was decided

[0:06:19] Trustee Elliott (probable): that a committee wasn't the best for it but a learning group a reconciliation learning group

[0:06:26] Trustee Elliott (probable): and sort of trustees would be invited to participate and so we're still structuring

[0:06:32] Trustee Elliott (probable): how that might work and the model that I'm looking at and we're exploring is a group called

[0:06:40] Trustee Elliott (probable): culturally committed I've been a part of that for about a year and it's developed with an aim to

[0:06:49] Trustee Elliott (probable): to cultivate cultural safety in professional workplaces,

[0:06:53] Trustee Elliott (probable): mainly healthcare fields.

[0:06:56] Trustee Elliott (probable): And it's been an excellent model,

[0:06:58] Trustee Elliott (probable): bringing in Coast Salish mentors and teachers.

[0:07:02] Trustee Elliott (probable): We sit together twice a month on Zoom.

[0:07:06] Trustee Elliott (probable): One meeting is a workshop.

[0:07:08] Trustee Elliott (probable): Another is sort of a community call,

[0:07:11] Trustee Elliott (probable): just talking to one another

[0:07:13] Trustee Elliott (probable): and working through different questions

[0:07:15] Trustee Elliott (probable): and issues that we have.

[0:07:16] Trustee Elliott (probable): so it's been a great learning space and that's what I'm looking forward to

[0:07:21] Trustee Elliott (probable): seeing how we can advance that and and I'll create a learning environment together that's

[0:07:28] Trustee Elliott (probable): what I'm very keen on um and I was just on Liskiti on Wednesday for their very first

[0:07:35] Trustee Elliott (probable): covenant area celebration of a covenanted property which is a first for Liskiti Island so

[0:07:42] Trustee Elliott (probable): So it was really lovely to take part in and property owners were long time, worked for

[0:07:50] Trustee Elliott (probable): the trust for a long time as consultants and environmental sort of on the ground monitoring.

[0:07:57] Trustee Elliott (probable): And so it was, yeah, it's really lovely to see these things come to fruition.

[0:08:02] Trustee Elliott (probable): Sometimes it takes decades.

[0:08:04] Trustee Elliott (probable): I think in this case, it took seven years to negotiate the covenant area because it

[0:08:10] Trustee Elliott (probable): was in the ALC.

[0:08:11] Trustee Elliott (probable): So lots of other work, but I think we'll get down to the business of the local trust committee.

[0:08:19] Trustee Elliott (probable): We don't have our electoral area director here today, do we?

[0:08:24] Trustee Elliott (probable): I don't believe we've got a report.

[0:12:52] Voice 2: attended any meetings so far this term and i wish you guys all the best of luck being a trustee is

[0:12:56] Voice 2: very challenging job it's and all the respect for you guys uh taking on this job that pays

[0:13:02] Voice 2: you know for 40 cents an hour basically

[0:13:04] Voice 2: thank you for this work i really appreciate you guys taking the time to listen um so i'm just

[0:13:13] Voice 2: Just noticing if I can offer a suggestion as a former trustee, I mean, just approve all the variances you want on this House floor thing.

[0:13:22] Voice 2: Move past this debate. You guys are getting stuck in a debate that continually kind of seems to be on an election cycle.

[0:13:29] Voice 2: You got elected. Everyone knew that you guys didn't like the bylaw.

[0:13:32] Voice 2: So when I was a trustee, I just I approved. I didn't agree with all the laws and I just approved the variances.

[0:13:37] Voice 2: So going back and rescinding or whatever Planner Kijima said, it's not rescinding, it's I'm making amendments to the land use bylaw.

[0:13:44] Voice 2: I mean, you could spend your time doing that. Or instead, as a trustee, as a leader in the community, you know, we don't have a community hall here.

[0:13:51] Voice 2: Like, I mean, this isn't adequate. You guys have the only First Nations land on Pender Island, right?

[0:13:58] Voice 2: Clay Winok is the name right down there, right by Poets Cove. And Director Howe, Dave Howe, he donated a number of logs from the CRD project.

[0:14:07] Voice 2: to help build a longhouse where's the reconciliation efforts there like that's kind of a positive step

[0:14:13] Voice 2: to help build our community i noticed this is the wealthy according to the stats in the staff

[0:14:18] Voice 2: report this is the wealthiest community in this in the gulf islands it's also one of the oldest

[0:14:22] Voice 2: communities in the gulf islands and it's got the highest housing needs assessment in the gulf

[0:14:26] Voice 2: islands so i just i didn't hear much in your reports with with stuff that you can do with

[0:14:31] Voice 2: advocacy you know you guys can get ahead of your agenda and really work for some positive change

[0:14:37] Voice 2: with the island which is what this island really needs is a there's a number of positive projects

[0:14:42] Voice 2: to rally on so i encourage the local trust committee to not get bogged down in too much

[0:14:47] Voice 2: in making amendments and bringing up these issues just to prove the variances and if the community

[0:14:52] Voice 2: doesn't want to support you in the next one you'll get to get up elected you'll be able to elect a

[0:14:56] Voice 2: couple trustees to support uh the bylaw so i i hope you take my comments into consideration i

[0:15:27] Voice 13: that when we have the minutes of the meeting we very helpfully have the staff present listed

[0:15:37] Voice 13: But if the staff are not going to be present for the whole meeting, ought it not to be

[0:15:42] Voice 13: made clear at which point the staff members withdraw, as this may have a material effect,

[0:15:49] Voice 13: at least on the form in which the business is conducted?

[0:16:58] Trustee Elliott (probable): cannot be rescinded. It would have been helpful to the community present at that meeting

[0:17:04] Voice 12: uh that this essential fact had been made clear at the beginning of the meeting because a lot of

[0:17:11] Voice 12: that meeting really proceeded on the whole issue of whether or not to rescind bylaw 122 in the

[0:17:18] meeting so that would have been helpful at the outset um it's my view that it

[0:17:24] Voice 12: would be very

[0:17:25] Voice 12: divisive for the trustees to set in motion a process to repeal all the changes to the land

[0:17:31] Voice 12: use bylaw on 122 and i'm really echoing the comments of uh former trustee matanki here

[0:17:38] Voice 12: in our august 28th letter and i'll just read this like a paragraph because it still hasn't

[0:17:46] Voice 12: been posted even

[0:17:48] Trustee Elliott (probable): though others sent any subsequent internet one posted we oppose any initiative to

[0:17:55] Trustee Elliott (probable): repeal all of the changes to our land use bylaw enacted to bylaw

[0:18:02] Voice 2: to our community as a whole, we will support carefully considered initiatives by our trustees

[0:18:07] Voice 2: designed to address demonstrated problems with fair and cost-effective solutions that meet the

[0:18:15] Voice 2: preserve and protect mandate of the trust, comply with our OCP regulations, and support our

[0:18:24] Voice 2: vision statement in the OCP. And thank you, all three of you, for your good work in the planet

[0:18:50] Trustee Elliott (probable): agenda with regard to First Nations. I don't know what the conversation will be, but it'll be past

[0:18:55] Trustee Elliott (probable): this time when we would have an opportunity. So First Nations reconciliation is important to

[0:19:02] Trustee Elliott (probable): everybody. There's no doubt about it. We all understand that history and that we need to do

[0:19:09] Trustee Elliott (probable): better. But with regard to where you intend to go with that agenda item, I just wanted to offer

[0:19:17] Trustee Elliott (probable): that there is a standing resolution by the South Pender LTC, and I don't know how that's going to

[0:19:23] Trustee Elliott (probable): play into your conversation. So that was just wondering if you were going to do something

[0:19:28] Trustee Elliott (probable): something different or if you're going to speak to that more generally I could just speak to it

[0:19:34] Trustee Elliott (probable): right now some LTCs have a section in their reports just like applications report trustee

[0:19:44] Trustee Elliott (probable): local expense report sort of a reconciliation relationship building report and so it's just

[0:19:50] Trustee Elliott (probable): a question of this LTC do you want to add that so that there's any conversation on reconciliation

[0:19:55] Trustee Elliott (probable): initiatives, whether they be community-driven or through the LTC,

[0:19:59] Trustee Elliott (probable): but there is a standing place to talk about them.

[0:20:32] Voice 12: were having a discussion about something that wasn't on an agenda item. It was a very important

[0:20:38] Voice 12: item. And I was schooled on democracy and how, if that issue was important to people, that they

[0:20:46] Voice 12: would be in the room. And in a democratic process, if you don't think it's important enough to show

[0:20:52] Voice 12: up then you definitely have a voice and the meeting proceeded to where actions were taken

[0:20:58] Voice 12: that were quite significant in terms of the community of interest and so there is a

[0:21:09] Voice 12: accountability requirement so while we can talk about respectful communication

[0:21:16] Voice 12: and the need for consultation and engagement actions also have to reflect that and so

[0:21:26] Voice 12: i'm i'm hoping that the error is being cleared and we can have a respectful discussion around it

[0:21:33] Voice 12: but i'm also uh acknowledging that um the actions also have to reflect the commitment

[0:23:02] Voice 14: and it's a component right up to the meeting when somebody's making the decision um and um there's no

[0:23:12] Voice 14: uh obligation on the part of the trustee to you know vote um in accordance with what the neighbors

[0:23:21] Voice 14: said it's information they receive so they'll receive you know the application they'll hear

[0:23:27] Voice 14: for the applicant they'll give them neighbors they'll get a staff report all that goes into

[0:23:33] Voice 14: decision making so

[0:50:00] Voice 2: never been done in the history of the islands and so what I'm saying is yeah okay you've got

[0:50:05] Voice 2: a decision you can use your time however you want as a trustee but you only got three years almost

[0:50:09] Voice 2: left right and you've got basically a breakaway pass in this room you have some of the people

[0:50:14] Voice 2: that are super connected to the lasagna and you have an opportunity like no uh no other historical

[0:50:20] Voice 2: time to really make a strong effort into bringing staff into play and and bringing them to make this

[0:50:27] Voice 2: leadership and reconciliation that's where i think your attention should be you're welcome to open up

[0:50:31] Voice 2: this discussion do whatever you want the last item i just want to discuss is the governance committee

[0:50:36] Voice 2: i'm hoping you guys can really crack the whip on this committee um i'm i was one of the founding

[0:50:42] Voice 2: along with other trustees we worked really hard to get that committee going and i don't see anything

[0:50:47] Voice 2: really a substantive coming from that discussion uh like we were hoping for big changes to the

[0:50:53] Voice 2: trust this was a big ambitious project and what i see are very small minute committee discussions

[0:50:59] Voice 2: So I'm hoping at Trust Council in September, which is on North Pender this year, you guys can speak up and really get the Governance Committee to really get thinking more ambitiously about how to improve the Islands Trust, rather than it just become another

[0:55:16] Voice 12: not only the environment but neighbours and things so I think that's something that really

[0:55:21] Voice 12: should be looked at maybe some regulations put in around that. Second is because of what's happened

[0:55:30] Voice 12: recently now emergency kind of response management things like wildfires

[0:55:39] Voice 12: kind of floods all these kind of things which are starting to come about by climate change

[0:55:45] Voice 12: I think it would be really useful for the trustees to work with whoever to look at

[0:55:51] Voice 12: what would be some safe ways to deal with some of these emergencies on the island.

[0:55:57] Trustee Elliott (probable): so addressing blasting and emergency response management there are going to be some webinars

[0:56:07] Trustee Elliott (probable): coming out through the trust progress committee as well on some of those topics that's true

[0:56:12] Trustee Elliott (probable): there's actually a call for um information so there's a call

[0:56:20] Trustee Elliott (probable): regarding um wildlife prevention so if you have any um information resources that could be helpful

[0:57:40] Trustee Elliott (probable): importance and yeah i'm very sorry i was we were so thrilled when we moved here and we were asked

[0:57:47] Trustee Elliott (probable): by our realtor to read you know vision statements of so can we yes this is great and then we were

[0:57:54] Trustee Elliott (probable): so welcomed by so many people and then we learned about this divisiveness which is i'm one of those

[1:00:22] Trustee Elliott (probable): this one perhaps it was a mistake um i also recognize i'm a new chair i'm new to the business

[1:00:29] Trustee Elliott (probable): of crafting drafting bylaws and the whole process we did get advice from staff

[1:00:36] Trustee Elliott (probable): um about this and we tried to clarify what would be the process if if we chose to reopen

[1:00:46] Trustee Elliott (probable): bylaw 122 or the contents of bylaw 122 the wording of that advice as i reread it today

[1:00:55] Trustee Elliott (probable): day um i interpreted it as you can't rescind a bylaw but you can repeal it and that was my

[1:01:05] Trustee Elliott (probable): misinterpretation and then our planner planner stockdale had to leave the meeting the meeting

[1:01:10] Trustee Elliott (probable): went on another hour and by then it was just this constant sort of well this seems to be what

[1:01:18] Trustee Elliott (probable): what everybody wants. And so in answer to your question, why did I not abstain? It is not best

[1:01:26] Trustee Elliott (probable): practice to abstain. You either vote yes or no. And I chose to vote with the local trust committee

[1:01:33] Trustee Elliott (probable): because it seemed to be their will and they were responding to what seemed to be the will of the

[1:01:38] Trustee Elliott (probable): community. So it was the best information at the time. It was imperfect and it was a process that

[1:01:44] Trustee Elliott (probable): it was very flawed, and we could have definitely used guidance. And so I regret the fact that we

[1:01:50] Trustee Elliott (probable): didn't have a planner there, and that we landed at a place where we made a resolution that was

[1:02:55] Voice 3: the intent that we are stating here and that didn't get recorded in the in the motion of course

[1:43:27] Voice 14: wants to do. The LCC indicated they wanted to look at changes

[1:43:35] Voice 14: staff to come back. This is the staff work as a result. So the recommendation is that if you

[1:43:41] Voice 14: do still want to proceed with that, that you use a minor project, one active minor

[1:53:19] Voice 3: that's what we need to do we need to experience so we can do this differently okay and i'm concerned

[1:53:24] Voice 3: about leaving it behind i mean for me personally the issues there are not something that i feel

[1:53:30] Voice 3: like we absolutely have to solve like we could just step away and say well you know whatever

[1:53:35] Voice 3: we're not totally happy with it we could walk away and say let's just move on from here

[1:53:39] Voice 3: i don't think we can solve our our community issues by doing that

[1:53:45] Voice 4: so

[1:53:46] Voice 3: that would be just kind

[1:53:48] Voice 3: of pushing the problems ahead and not resolving it. So I feel like we don't have an opportunity

[1:53:54] Voice 3: to do that if we

[1:53:56] Voice 3: want to actually resolve it, because then we're just making a portion of

[1:54:00] Voice 3: people happy. That's all I want to make. Everybody feel like they can live with whatever we come up

[1:54:11] Trustee Elliott (probable): scope, and process. And I'm hearing both of you are in favour of making the project a minor,

[1:54:25] Trustee Elliott (probable): and offer my perspective right if that's okay of course um just from from hearing what what I have

[1:54:35] Trustee Elliott (probable): um and I am wondering if perhaps embarking on a different project that has a broader

[1:54:45] Trustee Elliott (probable): broader um base of potential for consensus building where the issues are not already fraught

[1:54:57] Trustee Elliott (probable): and have a history of divisiveness may be a better foundation to build a process from

[1:55:05] Trustee Elliott (probable): and so i would just i've been thinking about this quite a lot i am very passionate about

[1:55:12] Trustee Elliott (probable): reconciliation and about engagement with First Nations, I do hear that there's been a lot of

[1:55:18] Trustee Elliott (probable): community initiative and relationship building with the Wissanik peoples and the school board.

[1:55:27] Trustee Elliott (probable): That's one potential project that would be something that I would wholeheartedly cheer

[1:55:32] Trustee Elliott (probable): embarking on and it has been championed by some of your community members

[1:55:40] Trustee Elliott (probable): today but more importantly than the choice of the project i wonder if it would be helpful to

[1:55:48] Trustee Elliott (probable): get away from this history or give it some breathing space and develop a process that

[1:55:57] Trustee Elliott (probable): works for this community develop some trust in the process and then come back and revisit your

[1:56:04] Trustee Elliott (probable): your LEB amendments. And in the meantime, the amendments, we can, it's a testing ground that

[1:56:11] Trustee Elliott (probable): you could see, are they working? Are they not? What is actually the problem? Are these problems

[1:56:17] Trustee Elliott (probable): of an imaginary nature that we're worried about what could happen? Or the actual problems that

[1:56:25] Trustee Elliott (probable): we really do need to address, you know, and in two years, that's a project. Now we have a very

[1:56:30] Trustee Elliott (probable): very clear idea of what the issues are. So I just submit that as a different view. I'm not going to

[1:56:40] Trustee Elliott (probable): vote against the will of this LTC and the community, but my job is to bring the regional

[1:56:47] Trustee Elliott (probable): perspective, is to bring a bit of an outside perspective. And this is what I see is this is

[1:56:53] Trustee Elliott (probable): a contentious issue and it will be really tough to get through because we're already stuck in the

[1:57:00] Trustee Elliott (probable): the nitty-gritty of very they feel really important but I feel like we got stuck here

[3:04:44] Voice 12: So firstly, the LTC's reframing of the minutes of that meeting, I don't believe accurately reflect what transpired.

[3:04:54] Voice 12: I do not recall a discussion about not being able to pursue consultation of Bylaw 122 without rescinding.

[3:05:04] Voice 12: What I recall was a motion being made by Trustee Evans to consult, and then I will paraphrase, but what about the people that are going to experience hardship if we leave 122 in place?

[3:05:19] Voice 12: So we should take a further step to rescind.

[3:05:24] Voice 12: That's the way that it evolved in my recollection.

[3:05:28] Voice 14: so

[3:05:29] Voice 12: um the way that that's been reframed is that your intent was that you can't do the consultation

[3:05:37] Voice 12: without first rescinding wasn't part of the discussion it came up differently in terms of

[3:05:43] Voice 12: my recollection so i just i wanted i wanted to state that for the record and i do not believe

[3:05:47] Voice 12: that was the case um secondly and this is not um a defense necessarily of the prior trust council

[3:05:57] Voice 12: but there were something like 18 meetings to talk about bylaws 122 and 123,

[3:06:03] Voice 12: what eventually became those meetings.

[3:06:05] Voice 12: Because of COVID, those

[3:06:07] Voice 12: were online meetings,

[3:06:08] Voice 12: and I think poorly attended, some of them.

[3:06:13] Voice 12: There wasn't a lot of opportunity for sharing.

[3:06:19] Voice 12: I think it happened at different stages in terms of rationale,

[3:06:21] Voice 12: and I think Dag has pointed out that there were requests for rationale

[3:06:26] Voice 12: for certain items, why they were deemed to be important,

[3:06:31] Voice 12: why the changes were necessary.

[3:06:33] Voice 12: And I think that's at the crux of the matter

[3:06:35] Voice 12: because I think that there are changes that were brought on by it

[3:06:40] Voice 12: that are not well understood why those changes were made.

[3:06:44] Voice 12: So, for example, talking about house size,

[3:06:47] Voice 12: there are many consequences of house size, right,

[3:06:49] Voice 12: from using materials, the number of trucks on the road that go on

[3:06:55] Voice 12: where you build a bigger house it takes four years to build it here which is two years

[3:06:59] Voice 12: uh then use of groundwater so there's lots that comes behind that

[3:07:07] Voice 12: uh helps um uh define or or helps people understand what the rationale behind those

[3:07:16] Voice 12: are i think will go a long way towards people seeing things a bit differently because i think

[3:07:22] Voice 12: that i think that we stop at self-interest we don't how does this affect me but i don't really

[3:07:28] Voice 12: understand the further consequence of it reality is climate change the reality of you know there's

[3:07:34] Voice 12: many other considerations so i would encourage that aspect of it and that's an education process

[3:07:40] Voice 12: and that at that whether you do it however your process is workshops or whatever but drawing those

[3:07:46] Voice 12: things out because even there's things that i heard that came up where i went why would you do

[3:07:51] Voice 12: that but then when you talk about it you see a different perspective on it you may see it

[3:07:57] Voice 12: differently and for those people that are um you know completely opposed to certain like you will

[3:08:03] Voice 12: never get consensus that's just a fact um but you may find that there are people that with that

[3:08:10] Voice 12: perspective see things differently so i encourage that process share share the information develop

[3:08:15] Voice 12: to rationalize because i think it'll help i

[3:08:19] Trustee Elliott (probable): think that's our intent here is to open it up for

[3:08:23] Trustee Elliott (probable): discussion again get gain understanding for everybody and it like for items we may wind up

[3:09:11] Voice 9: The other thing, I think one of the other things are we are all adults here. Community animosity is not necessary. It's gotten to this point, unfortunately, because what we've been staring at is our side and their side.

[3:09:30] Voice 9: and it's not that way compromise is a misnomer when you compromise somebody loses out instead

[3:09:41] Voice 9: what our aim needs to be is finding common ground

[3:09:46] Voice 9: in coming to that dag saying show me the

[3:09:51] Voice 9: evidence that's what i've been saying since the beginning it is a fact that a house with a smaller

[3:09:58] Voice 9: footprint is going to have less of an environmental impact on that property because if you go up

[3:10:04] Voice 9: instead of out you're not tearing down more trees you're not affecting groundwater as much because

[3:10:11] Voice 9: that roof size is just the same as it's going up so there's these things that we know are facts

[3:10:17] Voice 9: so that needs to be taken into consideration we can't just blanket everything you know some

[3:10:24] Voice 9: Some properties are going to have better water than others.

[3:10:27] Voice 9: So you can't apply the same principles all across the board.

[3:19:52] Voice 11: is I heard a lot of people who are frustrated also frustrated maybe a plurality of those

[3:19:57] Voice 11: comments were frustrated that we're still mired in this and why can't we just get on to something

[3:20:05] Voice 11: else beginning with Ben uh Mr. Conkey my comments were simply defensive because the same old stuff

[3:20:13] Voice 11: was coming up again and again so I had to go and provide the same old countervailing view

[3:20:18] Voice 11: you and i think that we need to actually stick to have your say and do it once and then not come

[3:20:25] Voice 11: back to it as much as possible because that will allow me not to have to say the same thing and to

[3:20:32] Voice 11: actually say that my interest is to move on about ecological preservation to talk about safety

[3:20:39] Voice 11: public safety fire safety uh to talk about the bridge uh i would rather us be doing those

[3:20:46] Voice 11: projects rather than then rehashing this this one again however if you hear the same information

[3:20:52] Voice 11: from one side you're going to hear the same information from the other side of a specific

[3:20:58] Trustee Elliott (probable): so i'm hoping that through this process we can put a lot of these conversations to bed

[3:21:54] Voice 11: moving we're having one of the driest years on record we had a under average precipitation for

[3:22:00] Voice 11: an entire year since last december uh one of the driest years on record and it would be nice to be

[3:22:07] Voice 11: talking about uh water conservation the impacts of water use on adjacent properties all of those

[3:22:14] Voice 11: things and the time is ticking. Our well is going dry. Our neighbour's well is already dry.

[3:22:21] Voice 11: We would like to have community approaches on those topics that are time sensitive and not

[3:22:29] Voice 11: to be mired for another three to four years in bylaw 122, bylaw 114, all of these things which

[3:22:37] Voice 11: actually aren't as consequential as losing your water.

[3:22:43] Trustee Elliott (probable): are two webinars coming out January and February on water and well and everything surrounding that

1. CALL TO ORDER 
Chair Elliott called the meeting to order at 10:30 a.m. She acknowledged that the meeting was 
being held on the territory of the Coast Salish First Nations. 
2. APPROVAL OF AGENDA

Chair Elliott made the following comments in her report:  
 A recent meeting with the new Senior Indigenous Relations Advisor, Robyn Kefi, 
included discussion on how to structure the Trustee’s Reconciliation Learning Group 
 The Chair recently attended an event on Lasqueti Island celebrating a newly achieved

5. ELECTORAL AREA DIRECTOR'S REPORT – none 
6. TOWN HALL AND QUESTIONS 
Town hall was held and the following comments were made: 
 
 Concern was expressed about the process leading up to the resolution to repeal Bylaw 
122 
 At the June 3 meeting, Bylaw 122 was part of the Work Program discussion and became 
a preponderant part of the discussion in a way that was not anticipated by the agenda 
 Rather than making quick decisions, we need to go through lengthy processes that 
provide fact-based information on the issues and allow for community input 
 Opposition to Bylaw 122 was expressed for how it infringes on people 
 Changes from Bylaw 122 improved the protection of the threatened sensitive cliff 
ecosystem 
 The Local Trust Committee (LTC) should leave the changes from Bylaw 122 in place and 
move forward, work towards reconciliation and find projects that bring the community 
together 
 We need to review Bylaw 114 with the community and work something out that 
appeases everyone, rather than implementing a top-down approach 
 Reviewing Bylaw 114 could divide the community 
 Bylaws should assess how many people will be impacted by making a change 
 Making decisions based on who is present at the meetings is not ideal 
 Meetings have been divisive and voices have not been clearly heard 
 Meeting minutes should record staff members present at each meeting and the time at 
which they leave 
 Variances should be approved to avoid getting bogged down in debate 
 Pender Island has high housing needs and Trustees can get ahead of the agenda and 
work for positive change on the island 
 Allowing variances is up to the discretion of the LTC 
 The Board of Variance is an appointed body that considers minor variances based on 
hardship 
 Leaving problematic bylaws in place and dealing with them through variances is a poor 
solution; problems should not be dealt with by countless variances 
 It would be helpful if staff provided an overview of variance applications to clarify what 
is being asked 
 Actions taken by LTC members must reflect the commitment to maintain respectful 
communication, consultation, and accountability

SÁNEĆ Leadership Council organized a reef net fishery this summer and held a salmon 
welcoming ceremony 
 Letters submitted are to be directed at decision-makers (not used as a forum for

Discussion was held and the following comments were made: 
 Staff left the June 3 meeting and advice from staff was subsequently 
misinterpreted by LTC who thought Bylaw 122 needed to be repealed in order 
to open a project 
 LTC stated its intent to look at the issues people have with Bylaw 122 
 Discussion on the intent of the LTC in making motion SP-2023-028 that repealed 
Bylaw 122 is missing from the June 3 minutes 
 The Trust system’s processes are cumbersome and difficult to navigate 
 
The following amendments to the minutes were presented for consideration: 
 
 On page 5 of the June 3, 2023 meeting minutes (page 7 of the current agenda 
package), following "The Trustees thanked everyone for providing their input 
and discussion ensued," add: “The resolution that is following is to demonstrate 
the intent of the LTC to move forward with reviewing the changes made under

It was Moved and Seconded, that South Pender Island LTC request that the Executive 
Committee authorize the public release of the legal opinion on non conformity of dwelling size 
and siting that the South Pender LTC obtained last term.  
 
Discussion was held about the relevance of the legal opinion since it predates the bylaw, and 
whether it would be more beneficial to seek a new opinion.  
 
Further discussion on the matter was tabled to Item 16 New Business.

held on the process of defining and making progress on projects and different 
approaches were assessed.

The LTC returned to discussion on business arising from the minutes. Because the legal opinion 
does not seem to address the questions that are anticipated as important to South Pender 
stakeholders, support was expressed for drafting a new legal opinion rather than releasing the 
one previously obtained.

18. TOWN HALL  
A second Town Hall was held and the following comments were made:  
 The LTC amending the minutes of the June 3 meeting does not accurately reflect what 
transpired (the intent of the motion is not believed to have been a part of the 
discussion) 
 The many meetings held to discuss Bylaw 122 were poorly attended because of COVID-
19, and there was not a lot of opportunity for sharing; resulting changes are not well 
understood 
 There are many environmental consequences of increased house size including use of 
materials, roads, and groundwater  
 An effective process involves education, shared information, and developing rationale 
that goes beyond self-interest 
 Community animosity is unnecessary and our aim needs to be finding common ground 
 A good place to start in establishing common ground would be to have staff provide a 
summary fact sheet about each of the issues related to legally nonconforming sites and 
variances 
 Reconciliation requires a First Nations representative giving input at the meetings 
 There is a distinction between W

SÁNEĆ Leadership Council and Elders within a 
community who guide community-to-community relationships 
 The LTC is urged to move on and not to get caught up in reviewing everything 
everywhere all at once  
 Community members can take leadership on prioritizing issues
