[0:00:18] Trustee Luckham: and I'm Chair of Council and Chair of the Gambier Island Local Trust Committee. And I'm joined today
[0:00:24] Trustee Luckham: by our locally elected representatives, Trustee Bernardo, who would like to say good morning.

[0:00:38] Trustee Luckham: okay excellent so uh certainly uh i want to acknowledge that i i live here in as we all do
[0:00:45] Trustee Luckham: in the coast salish territory here on fetus island and laxman and penelope territory and
[0:00:51] Trustee Luckham: of course gambier keats are ostensibly in uh squamish territory and so i'm grateful for the
[0:00:59] Trustee Luckham: opportunity to be here and work here, work with nations and enjoy those opportunities.
[0:01:07] Trustee Luckham: So we have an agenda before us that was published on the website. Are there any additions or
[0:01:14] Trustee Luckham: deletions from the or changes of any sort in the agenda? No?
[0:01:23] Trustee Luckham: Okay, then I'm going to adopt
[0:01:25] Trustee Luckham: the agenda as presented by a general consent and I'm just going to touch base with staff

[0:01:56] Trustee Luckham: project presenters um and we will get to you at 10 20 after we've done our initial reporting
[0:02:04] Trustee Luckham: so um with that said let's move on to reports and trustee reports is where we'll start off and uh
[0:02:10] Trustee Luckham: trustee stanford trustee bernardo who would like to go first i can go first
[0:02:16] Trustee Bernardo: for once um

[0:02:18] Trustee Bernardo: can report a few things. Early in September we had a lovely ceremony on Sandy Beach on Keats Island
[0:02:29] Trustee Bernardo: to commemorate and celebrate turning that little patch of the island into a nature conservancy
[0:02:36] Trustee Bernardo: and that's what it is now and that was all due to the efforts of staff and
[0:02:43] Trustee Bernardo: preceding trustees who worked for many years to bring that about and those trustees of
[0:02:48] Trustee Bernardo: of course, would include Trustee Stamford, my predecessor, Dan Rogers, and my predecessor
[0:02:54] Trustee Bernardo: before that on Keats Island, Kim Benson. So many thanks for them for making that happen. I think
[0:03:03] Trustee Bernardo: that's a valuable contribution to the character of Keats Island, and it's a positive development.
[0:03:10] Trustee Bernardo: Other developments, and we'll get into this in more detail later, so I won't belabor it now,
[0:03:15] Trustee Bernardo: now, but after the August 29th Local Trust Committee meeting, there was a resolution
[0:03:22] Trustee Bernardo: that I was to work with staff to attempt to tune up the draft proposed bylaws for Keats
[0:03:28] Trustee Bernardo: with respect to the foreshore project and bring them back to this meeting.
[0:03:35] Trustee Bernardo: We've done that.
[0:03:36] Trustee Bernardo: We've worked together in part, but again, that's actually on the agenda, so it's better
[0:03:41] Trustee Bernardo: to talk about uh that there but uh we have made some progress so uh we'll be able to talk about
[0:03:46] Trustee Bernardo: that there then uh and i'll hand it over to trustee stamford now hi
[0:03:52] Trustee Stamford: there everyone um all right i'm
[0:03:55] Trustee Stamford: gonna be stuck with this single computer so it might be i might be joggling back and forth a
[0:04:01] Trustee Stamford: little bit um just a very brief update on the islands trust side um there is the community
[0:04:11] Trustee Stamford: was quite appreciative of how our local committee
[0:04:16] Trustee Stamford: provided closure to the temporary use permit.
[0:04:21] Trustee Stamford: Got a lot of comments about it.
[0:04:24] Trustee Stamford: And since then, there have been ongoing queries
[0:04:29] Trustee Stamford: about what happens next.
[0:04:31] Trustee Stamford: And I think this is something we can all continue to learn from
[0:04:35] Trustee Stamford: is how to inform the communities about what happens
[0:04:39] Trustee Stamford: after this kind of decision so i um i do know that the proponents um complied with the the
[0:04:49] Trustee Stamford: finding and decisions of the local trust committee through bylaw they are still working on um very
[0:04:58] Trustee Stamford: various aspects of coming to compliance um bet that they are no longer um have
[0:05:06] Trustee Stamford: have paying advertised guests at the proposed TUP.
[0:05:14] Trustee Stamford: And also they are working with Vancouver Coastal Health
[0:05:20] Trustee Stamford: to comply with the orders from them.
[0:05:26] Trustee Stamford: So it is ongoing, but it's all moving in the right direction.
[0:05:31] Trustee Stamford: I appreciate that.
[0:05:32] Trustee Stamford: um there has been um a little bit of movement on the new brighton dock and i can go into that
[0:05:38] Trustee Stamford: further with the regional district report um but also are very happy to say that our ramp
[0:05:45] Trustee Stamford: has a fix on it and it's working beautifully so um kudos to um mosquito creek marine group
[0:05:55] Trustee Stamford: um they they've done a great job and i'm hoping to see more fixes in the
[0:05:59] Trustee Stamford: the the next few days so i'll just leave that with our own stressed report okay

[0:06:08] Trustee Luckham: back to you uh after the chair's report from the electoral for your electoral area director's
[0:06:14] Trustee Luckham: report um so thank you to both of you for your updates um i don't have a lot to report on a
[0:06:21] Trustee Luckham: local gambier uh front i uh will just uh say that i certainly enjoyed my visit to gambier for the
[0:06:29] Trustee Luckham: the last local trust committee meeting and look forward to attending your islands there again
[0:06:37] Trustee Luckham: sometime in the future. I'll just report out that trust council was held on North Pender about two
[0:06:43] Trustee Luckham: weeks ago now where we conducted a significant amount of business by reviewing the section three
[0:06:54] Trustee Luckham: in our legislation and interpretation and also had a visioning exercise as well as processed
[0:07:02] Trustee Luckham: a number of other pieces of federation business.
[0:07:07] Trustee Luckham: The trust council and trust work at this time is preparation for the 2024-2025 budget and
[0:07:16] Trustee Luckham: indeed that package was released to financial planning committee in draft form.
[0:07:22] Trustee Luckham: just the other day and that work is about to be undertaken
[0:07:27] Trustee Luckham: to prepare that for our March council,
[0:07:31] Trustee Luckham: the location yet to be decided.
[0:07:35] Trustee Luckham: So let us, that's all for me and grateful to be the chair
[0:07:40] Trustee Luckham: of the Gambier-Keats Island Trust Area
[0:07:43] Trustee Luckham: and I'll turn to electoral area director's report,
[0:07:46] Trustee Luckham: Kate-Louise Stanford.
[0:07:47] Voice 9: Thank you, Chair.
[0:07:55] Trustee Stamford: From the regional district, we are very relieved to be out of stage four
[0:08:01] Trustee Stamford: water restrictions. We went from stage four to stage one in four days. And that is a huge relief
[0:08:11] Trustee Stamford: because we're not focusing so much on the emergency situation. That said, Eastbourne
[0:08:17] Trustee Stamford: and continues to be restricted with its water usage.
[0:08:20] Trustee Stamford: The wells are not filling like they usually are.
[0:08:26] Trustee Stamford: So there's some concern there.
[0:08:28] Trustee Stamford: The community is very used to maintaining conservation on their water.
[0:08:37] Trustee Stamford: But the idea that even with all this rain,
[0:08:39] Trustee Stamford: they are not getting a full recharge on their wells
[0:08:43] Trustee Stamford: provides an ongoing concern.
[0:08:47] Trustee Stamford: and the project to continue with more well research in the new locations
[0:08:54] Trustee Stamford: will be ongoing through the regional district.
[0:08:58] Trustee Stamford: And also I found out yesterday that Keats Landing dock has been closed to traffic.
[0:09:04] Trustee Stamford: It's just walk-ons only.
[0:09:06] Trustee Stamford: There's no vehicle traffic on there.
[0:09:08] Trustee Stamford: And that was based on a review of the dock structure by engineers.
[0:09:15] Trustee Stamford: So I don't know when that's going to be open for vehicle.
[0:09:19] Trustee Stamford: I know that's a big issue for the Keats Landing area because that's used a lot for ingress and egress.
[0:09:28] Trustee Stamford: The main thing that I'd like to report for the regional district is the tenants at UBCM.
[0:09:33] Trustee Stamford: The highlights included an amazing breakfast with Highlands Trust.
[0:09:38] Trustee Stamford: Thank you, Chair Luckham.
[0:09:40] Trustee Stamford: We always get good reviews on that.
[0:09:42] Trustee Stamford: And it was a really good discussion, too.
[0:09:45] Trustee Stamford: Um, at the UBCM, there's lots of attention, um, from communities, obviously around the
[0:09:51] Trustee Stamford: wildfire situation, um, trying to find a better way to, um, respond at a local level, provide
[0:09:59] Trustee Stamford: more, um, training and powers to local, um, fire fighters, um, both, um, professional
[0:10:07] Trustee Stamford: and volunteer.
[0:10:08] Trustee Stamford: tier um there was the regional district advanced motions on rural transit options more
[0:10:17] Trustee Stamford: fair funding formulas for regional districts when they get provincial funding
[0:10:22] Trustee Stamford: um deferral of liability fees um similar to how we or utility fees sorry similar to how we
[0:10:29] Trustee Stamford: do with property tax we'd like to see an option for that because some of these
[0:10:33] Trustee Stamford: utility fees are increasing exponentially. We also had minister meetings and had an encouraging
[0:10:43] Trustee Stamford: meeting with Minister Cullen about the the docks in in general across the regional district and we
[0:10:51] Trustee Stamford: did get specifically into the new Brighton dock and the concerns that we have and how it falls
[0:10:58] Trustee Stamford: between different ministries
[0:11:00] Trustee Stamford: as well as responsibilities of BC Ferries.
[0:11:02] Trustee Stamford: So I am still working on a follow-up.
[0:11:05] Trustee Stamford: They continue to express interest
[0:11:08] Trustee Stamford: in a way of trying to sort that out.
[0:11:10] Trustee Stamford: So nothing definite,
[0:11:12] Trustee Stamford: but certainly a lot more encouraging than what I've had.
[0:11:16] Trustee Stamford: The regional district continues to develop a strategic plan
[0:11:19] Trustee Stamford: and we are moving into the 2024 budget discussions.
[0:11:23] Trustee Stamford: Thank you.

[0:13:04] Voice 14: My name is Christina Owen. I am a project coordinator at Baylink Networks.
[0:13:08] Voice 14: Baylink Networks is the prime contractor of the Connected Coast.
[0:13:12] Voice 14: So we do the design, permitting, and installation of the infrastructure.

[0:13:20] Voice 16: Sure. My name is Cheryl Katnick. I work for the Connected Coast Partners,
[0:13:25] Voice 16: which is the Strathcona Regional District in City West.
[0:13:28] Voice 16: I'm the permitting and engagement lead,
[0:13:30] Voice 16: and I work on strategic planning, scheduling, engagement,
[0:13:35] Voice 16: and kind of a bit of everything
[0:13:37] Voice 16: with regards to this project.

[0:14:08] Voice 3: in the announcement for funding.

[0:14:22] Trustee Luckham: but my name is Peter Luckum.

[0:14:31] Trustee Luckham: and uh staff who you may or may not have been in touch with i'll go back to you thank you

[0:14:46] Voice 16: however just in recognition that we have 10 minutes so just in respect of everybody's time
[0:14:50] Voice 16: renee and i have shortened that we've abbreviated the presentation slightly um so that if uh we can
[0:14:57] Voice 16: make the most use of our time oops if you want to go back one more there we go thank you okay so
[0:15:06] Voice 16: connected coast i'm sure many of you have uh next slide have heard about the program it is an
[0:15:11] Voice 16: initiative that is uh going on across the the country as well as within the province of bc
[0:15:17] Voice 16: to bring backbone infrastructure to communities to improve access to internet for both rural
[0:15:24] Voice 16: rural and coastal, both in the interior and BC, but this particular project, coastal British
[0:15:29] Voice 16: Columbia. Thank you. Next slide. We have, many people have heard a lot about the various agencies
[0:15:38] Voice 16: that are providing funding. So there's various provincial programs that we have received funding
[0:15:44] Voice 16: from. With regards to this, the most regularly heard of is the Connect to Innovate program,
[0:15:52] Voice 16: universal broadband fund locally in the province the economic recovery intake
[0:15:58] Voice 16: next slide so the connected coast project is a partnership between the strathcona
[0:16:05] Voice 16: regional district and city west and this partnership was set up and designed into
[0:16:09] Voice 16: a partnership agreement for the design installation and operation of the network
[0:16:16] Voice 16: the pro the program is completely funded through federal and provincial authorities so we've got
[0:16:22] Voice 16: ICED, Department of Indigenous Services, NDIT from the province and then of course the the funding
[0:16:30] Voice 16: there is some funding from City West and Strathcona Regional District as well. Next slide.
[0:16:37] Voice 16: The project is far-reaching, it's got a very long footprint. We've got as far north as Lax-Qualams
[0:16:44] Voice 16: which is north of Prince Rupert over to Haida Gwaii all the way all the way down to Vancouver
[0:16:50] Voice 16: and around Vancouver Island.
[0:16:52] Voice 16: Currently, the installed program is fully installed
[0:16:57] Voice 16: between Prince Rupert over to Haida Gwaii,
[0:16:59] Voice 16: down to Port Hardy, and just north of Campbell River.
[0:17:03] Voice 16: And then we've got connectivity from Campbell River
[0:17:06] Voice 16: through the Discovery Islands into Vancouver.
[0:17:09] Voice 16: We're still currently permitting and working on completing,
[0:17:14] Voice 16: well, the design's complete.
[0:17:15] Voice 16: We're working on permitting for the remaining sections
[0:17:18] Voice 16: sections of the Vancouver Island and the Sunshine Coast.
[0:17:23] Voice 16: Next slide.
[0:17:26] Voice 16: The various regulatory approvals that we
[0:17:28] Voice 16: go through for this program, as you can imagine, are far reaching.
[0:17:31] Voice 16: We've got a number of federal agencies that we work with, as well as many, many
[0:17:35] Voice 16: provincial, municipal and First Nations stakeholders to achieve permitting as
[0:17:41] Voice 16: well. The tenure is with the province and we get federal approvals for navigable
[0:17:48] Voice 16: waters, sites where we're landing on IRs we receive approvals for, as well as many BC parks
[0:17:58] Voice 16: and ministry transportation for landings in the majority of our landings. Next slide.
[0:18:07] Voice 16: We've got a very strong engagement program. There's a large team that has spent a great
[0:18:11] Voice 16: deal of effort over the last couple of years to work with all of the coastal communities,
[0:18:16] Voice 16: Indigenous communities, regional districts, there's many tenure holders as you can imagine around the coast. We work with pilots to review the routing, fishing associations, local harbor authorities, Council BC Yacht Clubs, and we work with geoduck fishers as well.
[0:18:34] Voice 16: That is just some examples of who we need to speak with as we're completing the designs to minimize interactions and impact.
[0:18:42] Voice 16: impact. Next slide, please. So this is a quick photo of what the cable looks like. It's about
[0:18:48] Voice 16: the size of a pen. It's quite small. So it's deployed off a variety of vessels. This one in
[0:18:54] Voice 16: the top photo you see is the Ocean Destiny. It's a fishing saner. And it's been modified slightly
[0:19:00] Voice 16: to allow for the drums that hold the cable to be held on deck. And the cable is paid out from the
[0:19:06] Voice 16: back side of the vessel as it transit transits forward on a predetermined route next slide please
[0:19:16] Voice 16: and this is an example of what our shore landings can typically look like
[0:19:20] Voice 16: the landings as you can imagine are on a variety of beach from hard hard rocky
[0:19:29] Voice 16: bedrock at coast guard lighthouses to sandy beaches to cobbly beaches sometimes we're able
[0:19:36] Voice 16: to bury and our goal is that the cable is always within the orange conduit within steel split pipe
[0:19:43] Voice 16: and buried for protection and so it's just not visible. Some cases when it's rock we just can't
[0:19:50] Voice 16: not we can't bury it so we do have to bolt it to the rock on the shore. For the most part we do
[0:19:55] Voice 16: try to select landings if possible that are minimally invasive. We like to try to avoid
[0:20:03] Voice 16: private lands, we look for Mody right-of-ways, and we look for environmental places where we're not
[0:20:09] Voice 16: going to be having significant impact. Our surface signature quite often really is only the small
[0:20:18] Voice 16: pole, the cabinet you see here. Sometimes some landings are just a straight vault on the ground.
[0:20:23] Voice 16: There's no pole and cabinet, depending on what the equipment is needed. Next slide, please.
[0:20:30] Voice 16: and so we're currently working on through all the consultations and engagements for what we call
[0:20:38] Voice 16: block 9 and 10 and so we're here today to specifically talk about the Sunshine Coast
[0:20:44] Voice 16: segment and the landings on Gambier and Keats Island. Next slide please. So what we have is a
[0:20:54] Voice 16: number of landings in the area for connectivity to communities. You can see that on the Keats
[0:21:02] Voice 16: Island side where we're on the east side we've got Gambier Harbour and New Brighton for Gambier
[0:21:08] Voice 16: Island. What we have in place is we've been working with Marlis, thank you, with regards to
[0:21:17] Voice 16: the zoning and during our engagement with the province for our application for license of
[0:21:24] Voice 16: occupation so for seabed tenure that there are some challenges with regards to the marine general
[0:21:32] Voice 16: zone around the islands now we believe that that we're clear on the gambier island
[0:21:39] Voice 16: but we need some further discussion with the trust with regards to keats island
[0:21:44] Voice 16: so just as renee mentioned earlier that there was an announcement for last mile connectivity
[0:21:51] Voice 16: activity for the homes on these islands awarded to City West in 2022. So that provides the connection
[0:22:00] Voice 16: to the homes that would utilize Connected Coast, which is the backbone. And then as a separate
[0:22:07] Voice 16: project, there's where we connect up to Connected Coast and distribute the fiber to homes and
[0:22:12] Voice 16: businesses around the island. And next slide. So that's, I tried to condense this to leave us as
[0:22:23] Voice 16: much time for questions and discussions as possible. What we're here to do is to ask for
[0:22:29] Voice 16: your support and to engage folks on specifically with regards to Keats Island, some discussion
[0:22:35] Voice 16: around the Marine General Zone and ability to continue to work with the Island Trust on bringing
[0:22:42] Voice 16: the cables to shore on those islands. So I'm going to ask right now if Renee, if you have anything
[0:22:49] Voice 16: anything to add? I put her on the spot. Now she's stumbling for her mute button on her phone.
[0:22:58] Voice 3: Sorry, thanks Cheryl. Yeah, Cheryl mentioned we are, you know, working through this permitting
[0:23:05] Voice 3: process and looking for some direction and discussion on the Gambier and Keats landing
[0:23:17] Voice 7: landing
[0:23:17] Voice 3: site. And as Cheryl mentioned, there is some... Yeah, just wanting to know what
[0:23:25] Voice 3: next steps are for the Keats landing location. We will be going up to... The landing site

[0:25:24] Voice 14: There is a 1,000-meter buffer zone from the shore, and so unfortunately, there's only a few specific approved uses that's allowed within that 1,000 buffer, so we would need assistance getting a variance with the bylaw in order to install the cable.
[0:25:44] Voice 16: Or some other method, if there's some other way that that could be achieved is what we're looking for some discussion with.
[0:25:55] Voice 16: it's not it's not shown on this map but it is within the bylaw you can see a reference to
[0:26:01] Voice 16: the marine general zone for some reason the digital mapping it doesn't come up
[0:26:09] Voice 16: and the gambier the zone the marine zone there does allow for utilities um so we've we've

[0:27:47] Voice 16: make sense from a marine perspective so one of the things we look at can be cable protection
[0:27:54] Voice 16: so if we have all both cables sometimes we can't avoid this i'm not going to say it's perfect
[0:27:59] Voice 16: there's some instances where both cables can be away from each other ideally we have some
[0:28:04] Voice 16: separation there so that's
[0:28:05] Voice 16: part of what drives that uh with regards to the two landings on gambier
[0:28:11] Voice 16: i think it was probably and and renee maybe correct me if i'm wrong here but i think the
[0:28:16] Voice 16: landings were probably selected in advance of any kind of last mile funding and award
[0:28:22] Voice 16: and it's unsure sometimes if there will be funding to cross connect so looking at the density of
[0:28:29] Voice 16: housing this was a way that we could probably connect both parts of the island with unknowns
[0:28:35] Voice 16: about what may happen terrestrially okay
[0:28:40] Trustee Stamford: and i'll have follow-up questions but i can ask after
[0:28:43] Trustee Stamford: I

[0:28:50] Planner McCargar: wanted to speak to Trustee Bernardo's question and to just for clarification, so
[0:28:57] Planner McCargar: the MG, the Marine General MG zone in the Keats Land Use By-law goes all the way around
[0:29:03] Planner McCargar: Keats Island and it does not permit public utility or any structures aside from navigational
[0:29:10] Planner McCargar: aids and so in order to permit these cables to go through that zone it would require a rezoning
[0:29:18] Planner McCargar: so it's not just a variance that we're looking for it would be a rezoning process i just wanted
[0:29:23] Planner McCargar: to clear that up
[0:29:30] Trustee Luckham: okay louise stamford again
[0:29:32] Trustee Stamford: okay um there's um i'm looking at i'm wondering about
[0:29:39] Trustee Stamford: up timelines for when this comes in and also what steps you're taking to work
[0:29:46] Trustee Stamford: with the current local providers there's a couple in the area and one in
[0:29:52] Trustee Stamford: particular that works with off-grid connections so we're hoping
[0:30:00] Trustee Stamford: there be can be some kind of coordination recognizing that this service is only going
[0:30:04] Trustee Stamford: to be provided to houses that are on the hydro grid and we're hoping to be able to then
[0:30:12] Trustee Stamford: extend that using off-grid services to other parts of the island so is there some kind of
[0:30:21] Trustee Stamford: mechanism to work with local providers and also what what's the timeline for this project so far
[0:30:30] Voice 16: So the timeline is the easiest one. So I'll go for that one first. So we're currently in process with the provincial government for a license of occupation.
[0:30:38] Voice 16: We are working with them to try to determine, we would like to install this as soon as possible.
[0:30:47] Voice 16: We're currently, our effort is focused right now with the Seychelles First Nation with regards to SWIA and completing the process there with regards to archaeological reviews and joint decision making between the province and the Seychelles.
[0:31:02] Voice 16: So with that said, we are hoping to install this as soon as possible. Ideally, we'd be able to install it near the end of this year, but it's really dependent on the permitting.
[0:31:11] Voice 16: Now one thing that we're working with the province on is if we can't come to some immediate closure with regards to the Marine General Zone around Keats is what other opportunities do we have for still issuing, not holding up the entire section, but figuring out a path forward so that we can receive the license of occupation, but have some agreement that we won't install within that Marine General Zone until we've come to some kind of path forward with Island Trust.
[0:31:39] Voice 16: so it's going to be as soon as we can hopefully by the end of the year if not early 2024 with regards
[0:31:48] Voice 16: to installation now with regards to the off-grid a distinction that needs to be made is connected
[0:31:54] Voice 16: coast is the backbone so it's the the main pipe that brings everything to the various locations
[0:32:00] Voice 16: and we rely well we don't rely isps go to connected coast to apply for access to that
[0:32:07] Voice 16: So it can be any local provider with regards to that. In this particular case, City West applied for and received some funding for the fiber to the home. And so I think that would be an interesting conversation to have with regards to off-grid suppliers.
[0:32:24] Voice 16: And I would recommend that to start with, if there is somebody that has a question with regards to Connected Coast access for ISPs, that on the website there is a form to fill out for Connected Coast where we can help assist and direct any questions.
[0:32:44] Voice 16: But the premise of Connected Coast is to be the pipe, and then the ISPs apply for access too.
[0:32:50] Voice 16: So it's certainly a very interesting question.
[0:32:53] Voice 16: And I don't know that I've actually been asked that yet.
[0:32:55] Voice 16: So if there's somebody that would like to reach out
[0:32:57] Voice 16: to the program, we're more than happy to chat

[0:33:23] Trustee Bernardo: What kind of timing are we looking at to develop connectivity to all of the households on Keats Island after the cable's been established?
[0:33:31] Trustee Bernardo: After how long will that last mile effort, how long will that take?

[0:33:38] Voice 16: Yeah. So I unfortunately don't have a schedule for City West for the last mile, but I can certainly engage City West and have that answer sent through to you. That's no problem.

[0:33:49] Trustee Bernardo: of the things you mentioned was that the original plan here was in terms of identifying appropriate landing spots.
[0:33:59] Trustee Bernardo: That was developed before funding was secured for the last mile aspect of it.
[0:34:04] Trustee Bernardo: But I gather from that that with the funding secured, if it makes logistical sense and in other respects might be more efficient to have a different landing spot, I gather we could do that.
[0:34:25] Trustee Bernardo: Am I right?
[0:34:27] Voice 16: Yes, that is possible.
[0:34:29] Voice 16: But I'll be honest, it would include some significant delays to the landing.
[0:34:33] Voice 16: We would need to go back to consultations with First Nations.
[0:34:38] Voice 16: We'd need to go back to the province and talk to them to see what they would require for staking and advertising and reviews.
[0:34:48] Voice 16: But I will preface that and say it depends on how far we would want to move it to.
[0:34:53] Voice 16: And if the marine routing is possible in another location, we would have to go back out and do more environmental surveys.
[0:35:00] Voice 16: surveys. So I won't say anything's impossible, but it would result in some significant delays.
[0:35:07] Trustee Bernardo: Well, it certainly sounds like you've described factors that would, by their nature, procedural
[0:35:11] Trustee Bernardo: and regulatory factors that look like they would certainly add a lot of delays. And
[0:35:17] Trustee Bernardo: my simplistic looking at the map and saying, gee, the red line near Gibson's is closer to
[0:35:23] Trustee Bernardo: Keats Island than the one that comes from Gambier. So maybe it's better to do it that way. But
[0:35:30] Trustee Bernardo: I take your point that if we're interested in getting this project done, then for the
[0:35:38] Trustee Bernardo: benefit of residents on Keats, it probably makes sense not to mess around with the landing
[0:35:42] Trustee Bernardo: aspect of it.
[0:35:43] Voice 16: And the nice thing about having two cables in and out too, is it does provide, like if
[0:35:49] Voice 16: I'm interpreting a little bit here, so I hope I'm not off interpreting.
[0:35:53] Voice 16: If you were thinking a line from Gibson's to Keats, just a single connection, what this
[0:35:58] Voice 16: design does is that actually gives the residents a redundant uh link unless both cables were hit
[0:36:04] Voice 16: at the beach same time if there's a cable fault somewhere north or somewhere south of keats we
[0:36:10] Voice 16: just reroute everything and you won't even notice that there's some kind of a blip in service if
[0:36:16] Voice 16: it's just a single line that does present some risk to outages to the community so
[0:36:23] Trustee Bernardo: from that
[0:36:25] Trustee Bernardo: that uh I'm not sure I understand the practical significance of the observation like I I I get
[0:36:34] Trustee Bernardo: that we don't want to necessarily tinker with the existing uh route that has been uh regulatory
[0:36:42] Trustee Bernardo: approvals already been obtained for those so are you saying that one contingency or one potential
[0:36:49] Trustee Bernardo: option is to you know assuming the zoning can be done uh build the line as currently planned and
[0:36:58] Trustee Bernardo: then go through the time-consuming issue of permitting and then at a later time build the
[0:37:04] Trustee Bernardo: redundant line from gibson uh
[0:37:07] Voice 16: no so if you imagine that we if we were to for example drop the east
[0:37:14] Voice 16: Eastbourne landing in favor of on the Gibson side, we would run the cable past Keats Island there
[0:37:20] Voice 16: and only have a connection, a single point of connection from Gibsons to Keats. So in that
[0:37:26] Voice 16: instance, it would be a single line that if there was a failure of that line, all service would go
[0:37:31] Voice 16: down. With the design that we have right now with two cables coming in and out of Eastbourne,
[0:37:38] Voice 16: if there's damage to either of those two cables, we can reroute the service and continue uninterrupted
[0:37:44] Voice 16: service to the residents on keeps we wouldn't likely have the funding or money to do three
[0:37:50] Voice 16: landings on the or two landings sorry onto the island all
[0:37:54] Trustee Bernardo: right thank you for clarifying that
[0:37:55] Trustee Bernardo: i misunderstood what you said before but now i understand it so i mean you really added
[0:38:01] Trustee Bernardo: you know another factor here as to you know the robustness if that's the word for what the
[0:38:07] Trustee Bernardo: current plan is because we do end up with the current plan we end up with the two landing spots
[0:38:12] Trustee Bernardo: lots so um i'm i'm just wondering here um what you're hoping to achieve here today uh i'm getting
[0:38:24] Trustee Bernardo: the impression and please correct me if i'm wrong but that you're looking from for some kind of
[0:38:29] Trustee Bernardo: guidance perhaps before you make a zoning application for a rezoning uh is that is that

[0:39:01] Voice 16: or if there's some other at a staff level recommendation
[0:39:05] Voice 16: that can be made,
[0:39:07] Voice 16: that's what we're looking to bring familiarity
[0:39:10] Voice 16: to the program of the project to yourselves
[0:39:13] Voice 16: so you can have that discussion amongst yourselves
[0:39:15] Voice 16: and with staff.

[0:39:22] Trustee Bernardo: Where is staff on this project
[0:39:25] Trustee Bernardo: in terms of the level of inquiry and work
[0:39:29] Trustee Bernardo: that's gone into sort of assessing what the situation is?
[0:39:32] Trustee Bernardo: I'm assuming that the staff is anticipating
[0:39:35] Trustee Bernardo: an application is coming
[0:39:36] Trustee Bernardo: and so it's already been thinking about it.
[0:39:38] Trustee Bernardo: So, I'm wondering if staff is in a position to make any preliminary observations about what looks like we're going to be receiving a proposal at some point or an application for rezoning, and I'd like to know if staff has any preliminary thoughts. Thank you.

[0:39:58] Planner McCargar: so the staff received our crown lease referral back in April. So there was an extensive review done at that time. And at that time, it was noted that the zoning didn't, they didn't comply with zoning in this one area. And then since that, there's been some back and forth with the Connected Coast folks just kind of confirming and it's been confirmed that this zone does not permit.
[0:40:26] Planner McCargar: So I think one of the, aside from that, there hasn't been any more work. We haven't received an application and we wouldn't do any work until we do, but some of the issue is the timeline.
[0:40:40] Planner McCargar: line. So a rezoning process can take 12 months to 24 months kind of thing, depending on the
[0:40:49] Planner McCargar: complexity of the application. This looks to be a fairly straightforward application,
[0:40:57] Planner McCargar: but staff would have to do some analysis to really be able to determine the way forward
[0:41:04] Planner McCargar: once we receive the application. Is it just a simple text amendment in the zone? Is it more
[0:41:09] Planner McCargar: of a site-specific zone. I wouldn't be able to speak to that at this time, but that's sort of
[0:41:15] Planner McCargar: been the big significant issue is the timeline and really our timeline for rezoning does not fit with
[0:41:22] Planner McCargar: the timeline that the Connected Coast folks are hoping to get this set up. So even with a
[0:41:31] Planner McCargar: expedited, if the LTC decided that this was a priority and you know other applications were
[0:41:37] Planner McCargar: going to get put on hold for staff to focus on this particular rezoning I think six months would
[0:41:43] Planner McCargar: really be the shortest amount of time that we could get a rezoning done in and that would kind
[0:41:50] Planner McCargar: of be with a prioritization of this application over others thank
[0:41:54] Trustee Bernardo: you for that and in terms of
[0:41:57] Trustee Bernardo: providing some preliminary guidance that's a word for it I can tell you at least one trustee the one
[0:42:05] Trustee Bernardo: that's selected from keats uh would be extremely supportive of expediting any zoning application
[0:42:11] Trustee Bernardo: uh so that's accelerated as fast as possible to get this done uh the i don't have to repeat the
[0:42:18] Trustee Bernardo: reasoning behind the whole project of that's been extended by the province and the federal
[0:42:22] Trustee Bernardo: government to to to uh give all residents of british columbia uh proper access to the internet
[0:42:30] Trustee Bernardo: net uh that reasoning applies to keats applies to gambler applies to everywhere there's some
[0:42:36] Trustee Bernardo: urgency behind it it's the world we live in so i would certainly support uh expediting a zoning
[0:42:44] Trustee Bernardo: application um and certainly would look favorably to the idea of rezoning in order to implement this
[0:42:51] Trustee Bernardo: project approach subject to of course uh findings of staff uh and uh ensuring that um it's done with
[0:43:01] Trustee Bernardo: the least uh environmental impact uh that's feasible in the circumstances given the
[0:43:06] Trustee Bernardo: parameters and the specifications of the project uh but uh this is a positive development and uh
[0:43:15] Trustee Bernardo: at first on first impression i'd be supportive both of the project and of uh rezoning but you

[0:44:47] Voice 16: history of that themselves. There is not an opportunity to utilize the TELUS cable simply
[0:44:56] Voice 16: because there are two different fundamental networks. TELUS is an ISP that could utilize
[0:45:02] Voice 16: the cable, if that makes sense, that the network can be utilized by TELUS. With regards to cross
[0:45:11] Voice 16: use of infrastructure across the island um i'm not entirely sure what they've got in place if
[0:45:18] Voice 16: it was simply a cross island build or if there was some effort to place uh fiber within the
[0:45:24] Voice 16: community um i'd have
[0:45:26] Voice 16: no okay so that's why city west has received that funding for last mile
[0:45:30] Voice 16: yeah so um that that i think that answers your questions there okay and

[0:46:09] Voice 16: So we're taking the feedback that we receive

[0:46:50] Planner McCargar: know that it didn't comply with zoning that it could be as simple as that because there isn't
[0:46:54] Planner McCargar: a rezoning on file for the the past work that was done or a crown lease referral okay

[0:57:04] Voice 15: and then um there's no there's no way for them to know how those new owners might feel um and so
[0:57:11] Voice 15: we haven't made a big deal about this but we wanted to um we think it's uh pertinent for you
[0:57:17] Voice 15: to know that um that the the the house that's adjacent is owned by Patrick's parents it's a
[0:57:24] Voice 15: family cabin that they've owned uh for approximately 40 years on um Beaucroft Island um uh we bought
[0:57:33] Voice 15: the place adjacent to it when it it um came up for sale because we were running out of space
[0:57:39] Voice 15: Patrick's family is one of four children um everybody has grandchildren um we the all of
[0:57:46] Voice 15: the kids have grown up um having family vacations at Vaucroft and we got to the point where we
[0:57:53] Voice 15: didn't have enough space and there was um um an inability to for everyone to have time the time
[0:58:01] Voice 15: that they desired on the cat on bowcroft at the cabin especially with the grandchildren are now
[0:58:08] Voice 15: all about college age we they will have families of their own they are um very attached
[0:58:16] Voice 15: to that property as a family place we when patrick's parents pass that property will go
[0:58:24] Voice 15: to the next generation in equal division.
[0:58:27] Voice 15: So four kids, we will all have one quarter share
[0:58:31] Voice 15: and we expect that property then
[0:58:33] Voice 15: to move to the grandchildren.
[0:58:38] Voice 15: And so our two lots together form a family property.

[0:58:47] Voice 15: that they weren't able to see
[0:58:51] Voice 15: how it impacted the other property.
[0:58:53] Voice 15: but we it and the photos when we were asked for photos but we weren't it it wasn't explained to
[0:59:00] Voice 15: us exactly what who wanted what the issue was so we sent photos not really knowing what to actually
[0:59:06] Voice 15: show so so apologies that they didn't show what they wanted what you exactly needed from them but
[0:59:13] Voice 15: um we have the new deck is at the back of the property whereas um the family cabin as i'll
[0:59:21] Voice 15: refer to it as our joint adjacent lot they they tend to they have a deck at the front of their
[0:59:26] Voice 15: cabin and that's where they spend their time um so i'm going to leave it there and just ask if

[1:01:33] Trustee Bernardo: to the Interior Law line, the opposition staff is based on the hypothetical contingency that a

[1:01:41] Voice 9: landowner might object to it, who might object to the variance. Is that right?

[1:01:51] Voice 6: Through the chair, that's correct. It's never known what a future landowner might,

[1:03:47] Voice 6: the ltc has the um latitude if you will right there's a there's amount of discretion with
[1:03:53] Voice 6: dbps so it's up to the ltc to decide if it wants to formalize this sighting and
[1:04:01] Voice 6: the opinion of staff is just that in this case given the circumstance and
[1:04:06] Trustee Bernardo: i'm i'm aware of our
[1:04:07] Trustee Bernardo: discretion uh mr cox that's why we're here today uh but you haven't actually answered my question
[1:04:15] Trustee Bernardo: and what i'm really getting at is i don't understand how staff can make an objection
[1:04:20] Trustee Bernardo: on the basis of this hypothetical contingency when that theory can be applied to any variance

[1:06:59] Voice 11: it's a change or not we can talk about in terms of a process um but i i do um think that's a

[1:07:09] Voice 8: the direction of the ltc we can we can talk about some more

[1:08:04] Trustee Stamford: yesterday i was at a fire protection meeting and one of the biggest concerns that
[1:08:13] Trustee Stamford: firefighters have is limited side lot lines and they demonstrated what happens there was a fire
[1:08:20] Trustee Stamford: this weekend on the mainland and lot lines had been varied setbacks have been varied and three
[1:08:30] Trustee Stamford: houses were burned there is there's good reasoning for having those those side lot lines and it is
[1:08:39] Trustee Stamford: around safety but it's not covered here in the report and also these types of low level patios
[1:08:50] Trustee Stamford: are of specific concern for fire
[1:08:52] Trustee Stamford: because it drops under the wood on the deck
[1:08:57] Trustee Stamford: and you can't get at it because it's too low
[1:09:00] Trustee Stamford: and this is covering concrete.
[1:09:02] Trustee Stamford: So there's fire concerns here
[1:09:05] Trustee Stamford: that I hope the proponents are considering
[1:09:09] Trustee Stamford: and to look further at fire smarting their property
[1:09:13] Trustee Stamford: because they are very tight in this area
[1:09:18] Trustee Stamford: and I've seen several variances in this particular area especially along the
[1:09:22] Trustee Stamford: front lot lines with the the small road that goes through and understand why
[1:09:30] Trustee Stamford: this is required or is considered acceptable in this area I have walked
[1:09:36] Trustee Stamford: along there so I know what they're talking about but that is my comment to
[1:09:41] Trustee Stamford: to the proponents.
[1:09:43] Trustee Stamford: In this case, I do recognize that is a family property.
[1:09:48] Trustee Stamford: There's lots of these kinds of properties on Tharmanby.
[1:09:52] Trustee Stamford: And I don't have a concern about that specific request
[1:09:57] Trustee Stamford: for the side lot line
[1:09:58] Trustee Stamford: other than what I've just stated around fire.

[1:10:30] Trustee Bernardo: about the idea of any kind of variance in a particular context.
[1:10:40] Trustee Bernardo: Each application has to be decided on its objective merits.
[1:10:43] Trustee Bernardo: uh so i don't think staff's position and trustee sanford's is quite right uh uh the the staff
[1:10:56] Trustee Bernardo: report does not uh address the fire control issue uh but uh i would have reservations about uh
[1:11:05] Trustee Bernardo: objecting to the variance on the interior lot line on on the basis of a general
[1:11:10] Trustee Bernardo: a general principle or a general concern about fire control uh i think
[1:11:15] Trustee Bernardo: If I understand Trustee Sanford's point correctly, she's suggesting that the applicants might want to consider addressing the fire control issue in their application.
[1:11:30] Trustee Bernardo: And I certainly think that's, if that's what she's suggesting, I certainly think that's a good idea, because then we have some specifics on this application to deal with.
[1:11:40] Voice 9: it uh but uh i
[1:11:46] Trustee Bernardo: have to say that you know i'll be upfront about this i'm sympathetic to the
[1:11:50] Trustee Bernardo: application uh in its entirety uh i am remain perplexed by staff's position that it's based
[1:11:58] Trustee Bernardo: on this hypothetical contingency business uh and in any event i think if we can be practical about
[1:12:05] Trustee Bernardo: this there may be a way to simply eliminate that concern altogether and i've got a question
[1:12:10] Trustee Bernardo: of the applicants here is there a covenant in place among um the prospective beneficiaries
[1:12:18] Trustee Bernardo: and mr robotized parents about the disposition of the land uh uh when they um when they pass on
[1:12:27] Trustee Bernardo: and what i'm getting at here is addressing the complaint risk up front by eliminating it by
[1:12:35] Trustee Bernardo: basically getting the consent of not uh not just the parents but just of anybody who's going to
[1:12:41] Trustee Bernardo: to have an interest in it in the future now there's you know there's ways of having to deal
[1:12:46] Trustee Bernardo: with that legally but we don't have to get that into here to get into that here so uh to being
[1:12:51] Trustee Bernardo: to to barrel question here is there a covenant in place and if not would the applicants uh
[1:12:59] Trustee Bernardo: object to putting in a covenant in order to satisfy staff and i suppose there's a third
[1:13:04] Trustee Bernardo: question whether staff would be satisfied with that uh if you can follow all that gibberish

[1:13:19] Voice 5: no there's no formal covenant i know the terms of my parents will i've got power of attorney

[1:13:29] Voice 5: um but there's no there's no formal covenant the i'm one of four children the property is
[1:13:37] Voice 5: going to pass uh uh in equal shares to the four of us and my parents i've also um set up a sort
[1:13:46] Voice 5: of a sinking trust to um to pay the bills like to pay the property taxes and so for like the next
[1:13:52] Voice 5: 15 20 years kind of thing not a huge amount of money but taxes are not uh a lot so so
[1:13:59] Voice 5: i don't know if that answers your question or not well
[1:14:03] Trustee Bernardo: it answers the first part of the question but
[1:14:04] Trustee Bernardo: but assuming it would satisfy staff,
[1:14:08] Trustee Bernardo: would putting a covenant in place,

[1:19:20] Trustee Luckham: benefit to one individual. And in the future, it's not so much about whether or not the person
[1:19:25] Trustee Luckham: likes or has some concerns about the variance that was issued sometime in the past, but it may
[1:19:31] Trustee Luckham: actually hinder the ability for a future property owner there to actually apply for their own
[1:19:37] Trustee Luckham: variance and infringe even more. And indeed, I think the fire aspect is an important consideration
[1:19:43] Trustee Luckham: consideration because actually, although this is a rural neighborhood, these are very small lots.
[1:19:49] Trustee Luckham: And I was actually quite surprised by the size of the lot versus the coverage. But certainly,
[1:19:56] Trustee Luckham: that's what's covered in the bylaws and is perfectly acceptable. And I would just say
[1:20:01] Trustee Luckham: that your bill in the process of moving that shed didn't do you any favors there. And so that's
[1:20:06] Trustee Luckham: unfortunate. And I don't want this to be punitive based upon decisions that were made in your

[1:21:12] Planner McCargar: proposing to construct a three-floor addition with a building footprint of 856 square feet
[1:21:18] Planner McCargar: to the existing 800 square foot single-family dwelling the potential impact of citing the
[1:21:25] Planner McCargar: addition within the front lot line setback is relatively minor, particularly because Austin
[1:21:30] Planner McCargar: Road has limited traffic and there's a significant shoulder area. So I was able to do a site visit
[1:21:39] Planner McCargar: in the summer and I measured from the gravel edge of the road to the northwest corner of the
[1:21:46] Planner McCargar: property. So the shoulder area, it was 9.3 meters. So I just wanted to highlight that,
[1:21:52] Planner McCargar: that although they're asking for a significant setback reduction, there is a really large
[1:22:00] Planner McCargar: shoulder area. The front lot line also does not run directly parallel to the proposed addition.
[1:22:07] Planner McCargar: So the addition would be sited 0.23 meters from the front lot line on the northeast corner,
[1:22:13] Planner McCargar: and then 7.02 meters from the front lot line at the northwest corner of the lot.
[1:22:19] Planner McCargar: three neighboring property owners have indicated support for the proposal and those are attached
[1:22:25] Planner McCargar: so given this is not a through road has very little traffic and the location of the proposed
[1:22:31] Planner McCargar: addition will have little to no impact on neighboring properties staff are recommending
[1:22:35] Planner McCargar: approval approval of this variance request and i i did get word from the applicant that they

[1:25:07] Trustee Stamford: And the reason it's not two buildings is you can't have two buildings on a site of this size.
[1:25:16] Trustee Stamford: Is there anything ensuring that this actually is going to be one building other than sort of a breezeway between two buildings?
[1:25:25] Trustee Stamford: That was more my concern, looking at the plans as opposed to the the actual setback.

[1:25:35] Planner McCargar: they have applied for a building permit and have, you know, we have reviewed the building permit and they've gained approval. I didn't include the building elevations or the building plans in this permit, just didn't see that as relevant to the setback, but it does meet all other aspects of the land use bylaw.

[1:26:00] Trustee Stamford: And from, for the applicant, Lori, have you got permission, you are, sorry, not permission, response from the people right behind you? I get the sense these are all family, like to extent, this is, this part of Austin Road is all part of the same family, generally.

[1:26:31] Trustee Stamford: yes i
[1:26:33] Trustee Stamford: couldn't remember what what the family name was so

[1:27:32] Trustee Stamford: clearing the road itself is very narrow and there are issues about where the
[1:27:39] Trustee Stamford: the snow goes on the narrow parts of that road. So that
[1:27:43] Trustee Stamford: shoulder is important. But you know, just how the angle of that
[1:27:50] Trustee Stamford: proposed building is, it doesn't have a huge impact. But just
[1:27:54] Trustee Stamford: because the road isn't built out, it doesn't mean that Moody
[1:27:57] Trustee Stamford: doesn't use those those wider shoulders where they're
[1:28:00] Trustee Stamford: available. Because that road is always on the red alert when
[1:28:06] Trustee Stamford: we're talking about snow clearing um sometimes they won't clear if they feel there's too many
[1:28:12] Trustee Stamford: too much obstruction because of the narrowness of the built part of that road so it's just something
[1:28:18] Trustee Stamford: to keep in mind but that's not our particular jurisdiction that will come from modi so the

[1:32:23] Voice 17: sustainable solutions. So at this point in time, there's no decision for the LTC to make about
[1:32:28] Voice 17: whether or not you need to direct staff to do anything more with this. What I'm doing is
[1:32:33] Voice 17: providing background information to staff about existing policies and regulations that address
[1:32:39] Voice 17: each of these topic areas and opportunities throughout the Local Government Act and other
[1:32:45] Voice 17: avenues for the Local Trust Committee to implement progressive planning opportunities
[1:32:53] Voice 17: opportunities in these topic areas. And then we're discussing that with them and coming up with
[1:32:57] Voice 17: a menu of recommended options to move forward with that I would then be presenting to you
[1:33:04] Voice 17: early next year. So I just wanted to make you aware that this is also part of our
[1:33:10] Voice 17: portfolio of discussion items so that there's no surprise in the future. If you

[1:35:04] Trustee Stamford: um your contacts with the the staff that are working on this it does speak to land planning
[1:35:13] Trustee Stamford: its use it's it is a bit of an over it is definitely an overlap for gambier island um

[1:35:27] Trustee Stamford: in any way um i see it as complementary it's it's but it's fairly active and moving but
[1:35:33] Trustee Stamford: but they just haven't been able to connect with staff at the Squamish Nation.

[1:39:45] Planner McCargar: exemption for soft methods of shoreline stabilization so those seem to be kind of the four
[1:39:52] Planner McCargar: I don't know if you want to say sticking points but the four kind of issues
[1:39:57] Planner McCargar: between staff and trustee Bernardo that I think would be good for the LTC to consider
[1:40:04] Planner McCargar: and we could do that either at this meeting now or through a special meeting of you know an hour
[1:40:16] Planner McCargar: and a half kind of dedicated time but just I wanted to caution with with a special meeting
[1:40:22] Planner McCargar: that would definitely postpone the public hearing just given timelines staff doesn't see a way to

[1:42:00] Trustee Bernardo: uh i won't i don't think it's fruitful to sort of go into a lot of detail about it but uh
[1:42:06] Trustee Bernardo: i've got a notion that existing shoreline what if shoreline works these are like these
[1:42:12] Trustee Bernardo: hard constructions already in place that there may be a category of extremely minor repairs
[1:42:18] Trustee Bernardo: uh that it ought not to be necessary uh to get a development permit for that
[1:42:26] Trustee Bernardo: anything that would change the footprint, so to speak, or would have an effect in any way on the
[1:42:32] Trustee Bernardo: ecosystem, well no, then you'd still have to get the permit. I need to talk that out with the staff.
[1:42:40] Trustee Bernardo: I may be going down the wrong track. There may not be minor modifications or sort of minor repairs
[1:42:47] Trustee Bernardo: really that realistically would need an exemption. So I'd like to work that out with staff.
[1:42:52] Trustee Bernardo: out. The other three, the dock size issue is really a question of mathematics in terms of
[1:43:00] Trustee Bernardo: whether or not the exemption that we now have that permits shared docks to be a little bit
[1:43:08] Trustee Bernardo: bigger than a single dock, I think doesn't work in terms of providing incentives to encourage
[1:43:14] Trustee Bernardo: sharing. And I've got a long argument to make about that, but I don't think this is the time
[1:43:18] Trustee Bernardo: to make it really and then the and then um uh another point that this is probably the leading
[1:43:27] Trustee Bernardo: point my leading concern which is within the dpa i understand the need to have a permitting for any
[1:43:34] Trustee Bernardo: new construction but i think we need some flexibility here for additions and renovations of
[1:43:40] Trustee Bernardo: residential dwellings and i'm only talking about residential dwellings we're not talking about
[1:43:45] Trustee Bernardo: other structures that are pre-existing and already within the proposed dpa somebody wants to add on
[1:43:53] Trustee Bernardo: 200 square feet to that dwelling or is fiddling around uh with it and it's already uh in the dpa
[1:44:02] Trustee Bernardo: uh and it's uh it what we're really talking about those circumstances our land that's already
[1:44:09] Trustee Bernardo: disturbed we're talking about the surrounding land to an existing dwelling and it seems
[1:44:13] Trustee Bernardo: reasonable to me to to avoid imposing inconvenience on residents by creating a
[1:44:20] Trustee Bernardo: a development permit requirement when it really isn't necessary again that's something uh the
[1:44:27] Trustee Bernardo: parameters of that are something i'm not entirely certain about i recognize the need that you it
[1:44:31] Trustee Bernardo: can't simply be open-ended such that you have the renovation of an 800 foot square foot old cottage
[1:44:40] Trustee Bernardo: is renovated and it's like 3000 square feet well no the whole reasoning I've just shared with you
[1:44:46] Trustee Bernardo: doesn't work in that context so we have to sort of think that through again this is something to
[1:44:52] Trustee Bernardo: be worked out and I'm just sharing this information so you understand where at least where I'm at on
[1:44:57] Trustee Bernardo: this point and on the final thing on the green choice thing it's again my thinking there is along
[1:45:03] Trustee Bernardo: long incentives. There's uncertainty in the community about how to read the bylaws. I know
[1:45:09] Trustee Bernardo: staff doesn't think an exemption is needed for, or at least my understanding is that staff doesn't
[1:45:15] Trustee Bernardo: think that an exemption is needed to implement green shorts. That turns on a reading of the bylaw
[1:45:24] Trustee Bernardo: that isn't necessarily obvious to average people in terms of how the different mechanisms work.
[1:45:34] Trustee Bernardo: And I do think we wanna encourage people to do Green Shores.
[1:45:37] Trustee Bernardo: And I think if we're very clear
[1:45:38] Trustee Bernardo: about what counts as Green Shores and it's exempt,
[1:45:41] Trustee Bernardo: that will be encouraging to people.
[1:45:44] Trustee Bernardo: Again, there may be distinctions within Green Shores
[1:45:48] Trustee Bernardo: that I need to talk about with staff
[1:45:51] Trustee Bernardo: before I make the pitch that we ought to do it to the LTC.

[1:50:24] Trustee Bernardo: there's another similar change or related change uh with respect to um i'm trying to remember what

[1:50:41] Trustee Bernardo: think it keeps landing but i can't remember uh memory is a terrible thing to
[1:50:46] Trustee Bernardo: lose but uh i i think um i initially had hoped that we might be able to salvage the existing

[1:51:01] Trustee Bernardo: going to affect uh you know the properties uh within that zone by quite a bit uh you can see
[1:51:09] Trustee Bernardo: it's uh reducing the size of docks there which is in that zoning for reasons that i don't understand
[1:51:16] Trustee Bernardo: was originally 150 square meters is now being brought into conformity with the 47 square
[1:51:22] Trustee Bernardo: meters that would apply to all other docks in the other zones. And when I went through the
[1:51:30] Trustee Bernardo: bylaws, I was quite surprised to see that, in fact, PI2 had, in fact, this larger dock requirement
[1:51:39] Trustee Bernardo: or larger dock permission,
[1:51:44] Trustee Bernardo: even before these bylaws were even contemplated.
[1:51:49] Trustee Bernardo: There were some sort of differential treatment
[1:51:50] Trustee Bernardo: of the access residential dwellings
[1:51:53] Trustee Bernardo: to docks of a certain size.
[1:51:55] Trustee Bernardo: It was different than elsewhere.

[1:52:25] Trustee Bernardo: dwellings in the island are going to be treated the same way but having said that it is going to
[1:52:29] Trustee Bernardo: affect people who previously didn't if they'd read the previous versions of these proposed bylaws
[1:52:35] Trustee Bernardo: laws would be under the impression that they wouldn't be effective. From their perspective,
[1:52:39] Trustee Bernardo: it's a last minute material change. They need a chance to respond to this. So I don't know,
[1:52:50] Trustee Bernardo: the committee might want to drill into a little bit about, you know, why there was this original
[1:52:57] Trustee Bernardo: dock size for PI2 was so much larger than elsewhere. I'm not aware of a rationale for it.

[1:54:24] Planner McCargar: Green Shores program is 35 meters squared. And that was originally the
[1:54:29] Planner McCargar: recommendation, but that was changed by the LTC in September of 2022. And it was changed to 47.
[1:54:39] Planner McCargar: So it's larger than what is recommended, but that was what the LTC.

[1:59:54] Trustee Stamford: these are just background comments from the history of specifically
[1:59:59] Trustee Stamford: specifically.
[2:00:00] Trustee Stamford: the camps on Keats is that the way the zoning, more to do with the land zoning rather than
[2:00:09] Trustee Stamford: foreshore zoning, has played out on these camps is huge structures have been built with very little
[2:00:18] Trustee Stamford: understanding or knowledge with the public. It is private land. They are allowed to do things,
[2:00:26] Trustee Stamford: But the what they are allowed to do has quite significant impact on the community around them.
[2:00:32] Trustee Stamford: So whenever we can provide that connection by providing certain restrictions to allow public understanding of what's happening on the camps,
[2:00:43] Trustee Stamford: I find is beneficial in the long term. An example would be the the dining hall.
[2:00:50] Trustee Stamford: at keats camp um it was quite a bit bigger than was expected um and some of the the buildings at
[2:01:00] Trustee Stamford: barnabas same thing there's a lot of activity going on and um this is a way of of having that
[2:01:07] Trustee Stamford: connection with their long-term plans so it's just a general thought okay
[2:01:17] Trustee Luckham: do you want to continue now

[2:01:22] Planner McCargar: Yeah, so here we get into the DP.
[2:01:30] Planner McCargar: And for the applicability, this was just, again, no content was changed.

[2:01:38] Planner McCargar: This part was removed for redundancy.
[2:01:43] Planner McCargar: And then A, here there was a fair bit of discussion on repair and maintenance.
[2:01:48] Planner McCargar: at the community information meeting and just so there is there has always been an exemption for
[2:01:55] Planner McCargar: alterations provided that they're entirely within the footprint of the existing building
[2:02:00] Planner McCargar: so the minor repair and maintenance of lawful buildings structures or utilities provided there's
[2:02:05] Planner McCargar: no alteration of undisturbed land or vegetation and are entirely within the footprint of the
[2:02:11] Planner McCargar: existing building or structure so we've just cleaned up the language on that a little bit
[2:02:16] Planner McCargar: and hopefully that is more clear.
[2:02:21] Planner McCargar: So staff do feel that it's important
[2:02:24] Planner McCargar: that the development permit is obtained for any additions
[2:02:26] Planner McCargar: as they would be considered new soil disturbance.
[2:02:30] Planner McCargar: Essentially, the DPA is saying
[2:02:32] Planner McCargar: this is a really ecologically important and sensitive area.
[2:02:36] Planner McCargar: So we're really trying to guide people
[2:02:39] Planner McCargar: to build outside of the DPA.
[2:02:41] Planner McCargar: Staff will always recommend building outside
[2:02:44] Planner McCargar: as a first choice,
[2:02:45] Planner McCargar: But if there's no other options and they must build within the DPA, there's certain guidelines that they're going to need to follow.
[2:02:53] Planner McCargar: And, you know, so there is an exemption for alterations and renovations, but any addition is going to, staff recommends, requires a DP.
[2:03:06] Planner McCargar: So there are examples where an exemption exists for additions, examples in other DPA areas for additions in, I think, resulting in less than a 5% increase in floor area.
[2:03:22] Planner McCargar: However, these exemptions don't typically exist in environmental DPA areas.
[2:03:28] Planner McCargar: you're going to see them more in commercial DPA areas
[2:03:31] Planner McCargar: where it's a form and character,
[2:03:33] Planner McCargar: so not in the most sensitive ecosystems.
[2:03:37] Planner McCargar: So staff do feel that this really covers the intent
[2:03:42] Planner McCargar: and it cleans up the language on that.

[2:09:11] Trustee Stamford: to me, the clarity is in that there is no alteration of undisturbed land or vegetation.
[2:09:20] Trustee Stamford: that's that's how it can be defined and it actually gives the landowner a little
[2:09:27] Trustee Stamford: bit more leeway given that the focus of this whole bylaw is protection of the

[2:10:27] Trustee Bernardo: of that decking and all of the railing uh and but that doesn't change the footprint it's it doesn't
[2:10:35] Trustee Bernardo: involve adding new pilings or removing old ones or anything like that but it's a fairly substantial
[2:10:39] Trustee Bernardo: piece of work and the repair involves replacing the deck boards all of them and this is this is
[2:10:48] Trustee Bernardo: what i'm talking about that's the kind of thing that people would like to have some clarity about
[2:10:53] Trustee Bernardo: and not to put too fine a point on it uh the reason they and and by the way this this is every
[2:11:01] Trustee Bernardo: time this type of issue has been brought to my attention it always comes with the following some
[2:11:07] Trustee Bernardo: version of the following which is the reason people feel anxious about these things and want
[2:11:12] Trustee Bernardo: clarification is that we have a trust deficit uh a lot of residents don't trust the island's trust
[2:11:19] Trustee Bernardo: They're skeptical about the judgment of staff. They're skeptical about the intent behind these bylaws. That's one of the reasons I've been so particular and such a pest about sort of fiddling with the wording and trying to impose some clarity here about exactly what are we saying, just so people know where they stand.
[2:11:39] Trustee Bernardo: I appreciate we can't, you know, we can't cater to every suspicion. That's not a way to proceed. But we have to be honest with ourselves. When there's widespread skepticism about divide laws, we
[2:11:55] Trustee Bernardo: need to work harder to not so much persuade, but it's really a matter of communicating what our real intent here and our real purpose is.
[2:12:04] Trustee Bernardo: and just waving off this concern about saying oh look you know repair is what it means you know

[2:15:48] Trustee Luckham: with respect to alterations, that's the best way to put it.

[2:15:58] Trustee Luckham: because indeed there's not necessarily a clarity
[2:16:02] Trustee Luckham: between a structure on land and a building and a footprint associated with that, and that of a
[2:16:09] Trustee Luckham: marine structure footprint, that being a dock? And is it possible to have different language
[2:16:19] Trustee Luckham: associated with the permitting or the exceptions associated with those two different types of
[2:16:27] Trustee Luckham: structures because indeed they are different so that's one question so the other thing is that i
[2:16:33] Trustee Luckham: i like the language that has been tossed about here associated with disturbance of soil and
[2:16:43] Trustee Luckham: vegetation because indeed on the land-based side we are talking about what is a sensitive ecosystem
[2:16:50] Trustee Luckham: whether it's been historically disturbed or not it continues to be a sensitive ecosystem
[2:16:56] Trustee Luckham: And so I think the clarity around the intent to protect the ecosystem means not a renovation or alteration to the building does not include the disturbance or alteration of soil and vegetation.
[2:17:14] Trustee Luckham: Certainly, when a scenario exists where let's just say there's concrete footings or pads or something that they just simply need to be replaced or moved because there's a post that sits on top of them, as an example, then there needs to be some flexibility associated with that.
[2:17:35] Trustee Luckham: And I wonder about how we would accommodate that.
[2:17:40] Trustee Luckham: But I also can't help but reflect that there's language that's used in the trades associated
[2:17:46] Trustee Luckham: with building renovations and or deck renovations or anything else.
[2:17:51] Trustee Luckham: Like I think about for a renovation of a building that you go back to the studs, which doesn't
[2:18:00] Trustee Luckham: imply that the walls and the studs are being replaced.
[2:18:03] Trustee Luckham: But the renovation includes interior or exterior work and certainly a roof is you can't actually say that a roof is a minor repair.
[2:18:14] Trustee Luckham: A roof is a fairly major repair, but is building on an existing structure that essentially pulls it back to the studs.
[2:18:22] Trustee Luckham: And, you know, sure. And in fact, I'm about to launch into my own roof replacement here.
[2:18:27] Trustee Luckham: When you start peeling back those ugly asphalt shingles that I should have never put on that building, you end up impacting the surrounding soil and fauna.
[2:18:37] Trustee Luckham: And so there needs to be appropriate protection measures in place for that.
[2:18:42] Trustee Luckham: And we do have that where there's appropriate measures necessary to do that.
[2:18:47] Trustee Luckham: So just I don't see that kind of language in here at this point and wonder, Planner McCarger, is there potential for that kind of language to be included in here to help address Trustee Bernardo's concerns and provide some confidence in the public's understanding of the bylaws, about the bylaws?
[2:19:19] Planner McCargar: So what I'm hearing, are you asking for it to be split out?
[2:19:23] Planner McCargar: So an exemption specific to a building on land and an exemption specific to a marine structure?
[2:19:29] Trustee Luckham: Well, I'm asking if that's a possibility and would that address those concerns that folks seem to have specifically, which Trustee Bernardo has mentioned,
[2:19:39] Trustee Luckham: specifically associated with decking and railing replacements on docks versus decks and structures on land?

Yes, I just caution about getting too specific, because I think that there's so many different unique scenarios that when I started going down the road of making this a really specific exemption, you start to exclude things and include things and it just starts to get really messy and I think harder to interpret.
[2:20:15] Planner McCargar: So, but I, I could definitely put some more thinking into splitting them out and if trustee Bernardo, you know, is thinking that that might help for clarity as well.

REPORTS 3.1 Trustee Reports Trustee Bernardo reported on the following activities: Ceremony held in September on Sandy Beach, Keats Island, to celebrate turning that area into a nature conservancy, due to the efforts of staff and preceding trustees to bring that about – a valuable contribution to Keats Island. After August LTC meeting, worked with staff to tune up the draft bylaws for Keats foreshore project. Trustee Stamford reported on the following activities: ADOPTED Gambier Island ADOPTED 2 Local Trust Committee Minutes October 17, 2023 Received a lot of appreciative comments from community members regarding how the LTC provided closure to the recent Temporary Use Application. Applicant still working on compliance issues. New Brighton dock ramp has been fixed and now working well. 3.2 Chair's Report Chair Luckham reported he enjoyed the visit to Gambier for last LTC meeting and looked forward to attending meetings there in the future. At the recent Trust Council meeting on North Pender, they conducted a significant amount of business by reviewing Section 3 of Islands Trust legislation; had a visioning exercise and handled other business. Trust Council work at this time is preparing for the 2024-25 budget. Preparation for March Trust Council meeting has started, location to be determined. 3.3 Electoral Area Director's Report Area F (West Howe Sound) Director Stamford reported on the following: Water restrictions recently went from Stage 4 to Stage 1 in four days. In Eastbourne, there has been some concern the wells were not filling as they used to, not getting full recharge on wells in spite of the rain. Continuing with ongoing well research in new locations. Keats dock has been closed to vehicles, in light of a review of the dock structure by engineers; walk-ons only. Attendance at UBCM. Lots of attention on wildfire situation, finding better ways to respond at the local level, and providing more training to local firefighters. Sunshine Coast Regional District (SCRD) advanced motions on rural transport options and deferral of utility fees. Minister meetings included Minister Cullen about docks in the SCRD, including New Brighton dock and how it falls within responsibilities of different ministries and BC Ferries. SCRD continues to develop a strategic plan. Moving into 2023-24 budget discussions. 4. DELEGATIONS 4.1 Connected Coast Project Presentation – Christina Owen, Cheryl Katnick and Renee Laboucane Christina Owen and Cheryl Katnick of Baylink Networks, and Renee Laboucane of Strathcona Regional District introduced the Connected Coast Project, a joint venture between Strathcona Regional District and CityWest, that aims to bring high-speed internet to rural and remote communities along the BC coastline, Haida Gwaii and Vancouver Island. An overview was distributed to the LTC in the agenda package. ADOPTED Gambier Island ADOPTED 3 Local Trust Committee Minutes October 17, 2023 It was noted there are challenges with respect to bringing cables ashore through the Marine General Zone around Keats Island. The project team has been working with Planning staff regarding the zoning, and requested further direction and discussion with Trustees. The delegation responded to Trustee inquiries regarding details of the request. Points included: As the Marine General Zone around Keats Island does not permit public utility, rezoning to allow cables through this area would be required. Timeline: now working with Province for License of Occupation. Working with Sechelt First Nation and with the SCRD. Hope to install as soon as possible, near the end of 2023, but depends on permitting. Details regarding timing to develop connectivity to all Keats Island households once installed will be forwarded to LTC by proponent. A change in proposed landing spots is possible, but would incur delays and further consultation with First Nations and the Province, and further environmental surveys. Staff reported that Islands Trust received a Crown lease referral in April 2023; planning review was done at that time and the proponent was informed that a rezoning was required for one of the sites. Keats zoning does not permit the infrastructure installation. An application for the project had not been received by staff. Staff suggested that, if the LTC decided this was a priority over other applications, it would take six to twelve months at minimum for the rezoning. Trustees Bernardo and Stamford expressed support for expediting a rezoning application to implement the project. Chair Luckham thanked proponents for the presentation and level of detail provided. BUSINESS ARISING FROM MINUTES 7.1 Follow-up Action List dated October 10, 2023 Received for information. Trustee Stamford noted, with regard to trying to meet with the Ministry of Transportation and Infrastructure (MoTI), that they have some staffing issues on the Sunshine Coast. The LTC will continue to pursue a meeting, but should not expect one scheduled until they have more staff capacity. 8. APPLICATIONS AND REFERRALS 8.1 GM-DVP-2023.1 (Robitaille & Dawson) Planner 2 Cox reviewed the staff report on a variance request for 578 Vaucroft Road, North Thormanby Island, to reduce the minimum setbacks on the property for the Small Rural Residential (SRR) Zone as set out in the Gambier Associated Islands Land Use Bylaw No.120, 2013, for a lot line abutting a road (the “front” lot line) from 6.0 metres to 3.63 metres for a deck and stairs, and for an interior side lot line from 1.5 metres to 0.43 metres for a deck and 0.17 metres for an accessory building. Retroactive authorization was being requested for the existing siting within the setback areas. The applicants were present and spoke to the application. Points included: property adjacent is owned by applicants parents; that property will be passed on by parents to four family members; deck at back of property was built while applicant was off island attending to a family emergency; disagrees with staff concern regarding potential objection of future owner regarding side setback variance; noted retired Sechelt Fire Chief had seen the deck and was complimentary about the build, with no concerns. Points from trustees included: Do not share staff’s concern that a hypothetical future neighbour may object to the side lot line variance. There are safety concerns for having side lot line setbacks. Low level patios are a specific concern for fire, because it drops under the wood on the deck. Trustee recommend a further look at “fire smarting” the property. Properties are very close together in this area. Each application has to be decided on its objective merits. Have reservations about objecting to variance on the interior lot line on the basis of a general concern about fire control. CARRIED 8.2 GM-DVP-2023.3 (Wong) Island Planner McCargar reviewed the staff report on a variance request for 2431 Austin Road, Gambier Island, to reduce the minimum setbacks on the property for the Settlement Residential (SR) Zone, as set out in Gambier Island Land Use Bylaw No. 86, 2004 (LUB), for a lot line abutting a road from 7.5 metres to 0.23 metres for an addition to a single-family dwelling. Approval had been granted for a building permit. The applicant indicated the staff report covered their position, including the supporting documentation, neighbour support, and partner’s history on the lot. The building would not impede the road or its shoulder. GM-2023-033 It was MOVED and SECONDED that the Gambier Island Local Trust Committee approve issuance of Development Variance Permit GM- DVP-2023.3. CARRIED 9. LOCAL TRUST COMMITTEE PROJECTS 9.1 Major Project: Gambier Island Official Community Plan and Land Use Bylaw Review Project Island Planner Zupanec provided a verbal update on developments regarding the Gambier Island OCP and LUB Review Project. Staff were in the midst of finalizing the first set of meetings with Squamish Nation staff. This would include individual meetings with their topic experts for focused review: archaeology and cultural heritage protection; forest ecosystem protection; shoreline protection, and docks (private, public and community). Squamish had asked that two other topic areas be added: streams and watercourse protection; climate actions and sustainable solutions. Island Planner had been providing background information to Squamish Nation staff regarding policies and regulations that address topic areas, and opportunities throughout the Local Government Act and other avenues for the Local Trust Committee to implement progressive planning policies in these topic areas. A selection of recommended options to move forward is being developed, to be presented early next year to the Local Trust Committee. If the LTC were to receive recommendations that might be linked to other topics, at that point the LTC could decide to expand the scope and revise project charter. ADOPTED Gambier Island ADOPTED 6 Local Trust Committee Minutes October 17, 2023 The Island Planner is working with the Squamish until early 2024. They have an Advisory Commission to which they would like to refer some of their work; the Island Planner would be involved in information preparation for that. 9.2 Minor Project: Keats Shoreline Protection Project Island Planner McCargar introduced the staff report with an update on developments of the Keats Shoreline Protection Project. The Island Planner reviewed the “track changes” copy of proposed amendments to Draft Bylaw No. 154 that were a result of community feedback, Trustee discussions and minor staff edits of grammatical errors, formatting and omissions. A lengthy discussion ensued. Trustees provided feedback on some proposed amendments and identified areas for which they felt clarification was required. Trustee Bernardo noted there were some points where he disagreed within the proposed bylaw, or for which he needed clarity on the rationale. Trustees requested that Trustee Bernardo develop a list, for distribution to staff and Trustees, of items that he considered needed further discussion, clarification or change, and to identify specific concerns or suggest potential solutions. There was discussion of postponing the scheduled public hearing on Draft Bylaw Nos. 153 and 154, and scheduling a Special Meeting for further detailed consideration of the bylaw amendments. ~ BREAK 12:45 PM - 1:15 PM ~ GM-2023-034 It was MOVED and SECONDED that the Gambier Island Local Trust Committee request staff to schedule an electronic Special Meeting to discuss and give direction for additional amendments to Proposed Bylaw No. 154. Trustee Stamford explained that this was referred to Islands Trust. She proposed a motion as the document did not recognize the unique position of the Local Trust Committee in the region. Trustee Stamford indicated she would be forwarding additional recommended language to the SCRD. Chair Luckham noted neither Gambier nor Keats were mentioned in the report and were not included in the mapping.
