[0:05:46] Voice 10: I'm very pleased that we received a large number of letters.

[0:05:52] Voice 10: People took the time to write with their concerns.

[0:05:56] Voice 10: um also the uh ferry our relief ferry is causing some issues with the public and i guess that was

[0:06:08] Voice 10: to be expected it's only for another month so i will live through it uh the other thing that's

[0:06:14] Voice 10: annoying is uh there seems to be a an increasing number of thefts on fetus which is not usual for

[0:06:21] Voice 10: our little community and people are starting to ask me what we can do about it so um i'm coming

[0:06:29] Voice 10: up with a bit of a plan for some surveillance uh perhaps and we'll see if we can find out who's

[0:06:38] Voice 10: actually causing all of this and

[0:06:41] Voice 5: that's about it for me okay thanks um ken um yeah that the

[0:06:50] Voice 5: the trouble with the theft.

[0:07:00] Trustee Luckham: There's people surveilling all over the place.

[0:07:04] Trustee Luckham: From a local perspective here, certainly lots of emails about abrupt shellfish and phone calls.

[0:07:13] Trustee Luckham: And then, of course, the other of a more local topic interest would be the Ocean Protection

[0:07:19] Trustee Luckham: protection plan conference was last week, virtual.

[0:07:24] Trustee Luckham: Quite a lot of people attending.

[0:07:25] Trustee Luckham: I attended for two and a half days, I guess.

[0:07:28] Trustee Luckham: And certainly there's plans afoot with respect

[0:07:32] Trustee Luckham: to the coastal marine strategy,

[0:07:35] Trustee Luckham: which touches on a lot of aspects of marine protection

[0:07:39] Trustee Luckham: that we're interested in, of course,

[0:07:40] Trustee Luckham: at the Islands Trust, as well

[0:07:47] Trustee Luckham: as derelict vessel recovery and remove uh open with the progress towards um what is completely

[0:07:55] Trustee Luckham: unclear on how it's gonna roll out but a um expansion of the either the port authority

[0:08:01] Trustee Luckham: of metro vancouver or a new port authority that might be responsible for managing these vessels

[0:08:08] Trustee Luckham: vessels better. However, that doesn't meet the needs that I can think of of Thetis Islanders

[0:08:13] Trustee Luckham: particularly and Islanders around the discontinuation of the necessity for vessels to

[0:08:23] Trustee Luckham: anchor in the Salish Sea as it's definitely disruptive, polluting, and dangerous from the

[0:08:31] Trustee Luckham: concerns expressed to me from the members of the public, and I concur.

[0:08:34] Trustee Luckham: occur. Other than that, lots of work at the Allen's Trust is the chair, but nothing on a

[0:08:42] Trustee Luckham: local context to report above and beyond that. Thank you.

[0:08:50] Voice 8: always interesting to hear what's going on in your community. However, very saddened to hear

[0:08:58] Voice 8: of the thefts. And so I hope there could be a collaborative solution to address that.

[0:09:05] Voice 8: For my chair's report, honestly, there isn't a lot to report beyond work I've sort of been doing behind the scenes in terms of tracking housing changes and legislation.

[0:09:21] Voice 8: and i was watching the bc legislature yesterday because bill 44 is in the house

[0:09:29] Voice 8: for up for debate and second reading and that is the housing statutes amendment bill which

[0:09:38] Voice 8: would bring considerable changes to how housing is addressed across bc and at the islands trust

[0:09:46] Voice 8: staff and planners are still researching how that might be applicable to communities in the

[0:09:52] Voice 8: island trust islands trust area and it may be possible for certain communities to opt in

[0:09:59] Voice 8: to certain programs but that would be at the local trust committee level um for my understanding so

[0:10:07] Voice 8: far so i've been watching that quite closely um it's going to be debated today uh it was supposed

[0:10:13] Voice 8: to be yesterday, but they ran out of time. And I believe Adam Olson, MLA Adam Olson from

[0:10:21] Voice 8: Saanich Peninsula has got sort of a speech prepared. I've been impressed with his speaking

[0:10:29] Voice 8: notes or his transcripts before. And he's been closely, he's been listening to communities in

[0:10:36] Voice 8: the Southern Gulf Islands, which is in his jurisdiction, and representing their concerns

[0:10:43] Voice 8: and interests at the legislature quite ably. So I've been appreciative of support from that

[0:10:50] Voice 8: quarter. As a member of the executive, we're deep into the budget cycle now. We'll be reviewing the

[0:11:02] Voice 8: second draft uh budget or second version of the draft budget uh at tomorrow's financial planning

[0:11:08] Voice 8: committee meeting and this all leads up to december when it'll be one of the main business

[0:11:14] Voice 8: topics at our trust council meeting which is in person in victoria and um yeah i don't think

[0:11:23] Voice 8: there's much else to report uh i've uh yeah on a personal level there's some other stuff that's

[0:11:31] Voice 8: That's been keeping my work-life balance a little hectic,

[0:11:36] Voice 8: but I'll save that for another time.

[0:11:39] Voice 8: So I think that's it for my chair's report.

[0:12:36] Voice 8: the local trust committee and then more broadly or regionally um and specific applications of course

[0:12:43] Voice 8: and whatever you want to speak to do be respectful and kind and remember this is a workplace

[0:14:33] Voice 8: could turn that question over to trustee luckham uh i believe that once the report is presented

[0:14:41] Voice 8: presented or sorry um published it is then presented at the bc legislature and the chair

[0:14:48] Voice 8: of the islands trust um uh peter will um formally present it i've never been part of that process so

[0:14:56] Voice 8: i'm not sure what sort of discussion there would be had but uh certainly it could be

[0:15:04] Voice 8: if you have questions or concerns uh peter do you have an idea how those might be addressed

[0:15:10] Voice 8: questions or discussion around our annual report when the public could address those questions?

[0:15:20] Trustee Luckham: Sure. The annual report is not like a corporate board reporting function.

[0:15:32] Trustee Luckham: It's just a reporting aspect necessary to meet the requirements of a single shareholder of this

[0:15:39] Trustee Luckham: company, which would be the province of British Columbia, I suppose. And so the report is compiled

[0:15:46] Trustee Luckham: over a number of months and assembled together and simply reported out to trust counsel. So

[0:15:57] Trustee Luckham: there's not an annual general meeting per se in the same context of a corporation with their

[0:16:04] Trustee Luckham: annual report um it certainly and and uh is submitted and approved by council and that

[0:16:12] Trustee Luckham: happened at the last um council meeting um in september um i'm more than happy to speak to

[0:16:22] Trustee Luckham: uh any items to anybody um to discuss the annual report itself um but there's not uh that

[0:16:30] Trustee Luckham: opportunity on today's agenda here and that time that opportunity to address that would have been

[0:16:38] Trustee Luckham: at the on the trust council meeting back in September and perhaps that wasn't clear to

[0:16:44] Trustee Luckham: everybody and of course it'll be presented to the legislature in the coming weeks or months

[0:16:50] Trustee Luckham: and and they just again the minister presents it and receives it there may be questions from

[0:16:57] Trustee Luckham: the legislature with respect to that which the minister would uh be the one that would answer that

[0:35:32] Planner McCargar: Good morning, everyone. So this application proposes to rezone approximately 14 hectares of the marine area in Preeti Harbour near Crescent Point to allow subtitle geoduck aquaculture.

[0:35:46] Planner McCargar: The application will require amendments to the Thetis Island OCP and the Thetis Island Land Use Bylaw, the LUB, to allow for a change in zoning from W4 to an appropriate zone for the proposed use.

[0:36:02] Planner McCargar: At this time, staff recommends that the application be closed and the appropriate refund be issued to the applicant.

[0:36:08] Planner McCargar: At the February meeting, the LTC advised the applicant that they should engage in meaningful consultation with Penelope Tribe, and after that, hold a public community information session in person on Thetis Island, and then come back to the LTC with the application.

[0:36:28] Planner McCargar: The applicant held an electronic community information meeting on October 23rd and indicated that they have attempted to get a response from representatives at Penelaket Tribe with no success.

[0:36:41] Planner McCargar: To date, the Islands Trust has received 29 pieces of correspondence in opposition and no correspondence in support of this application.

[0:36:51] Planner McCargar: You can view all those on the website.

[0:36:54] Planner McCargar: The main concerns that have been outlined in the correspondence consist of damaging environmental effects of the current lease area, inappropriate site selection, risk to the sensitive ecosystem, lack of meaningful community input, contradicts the Islands Trust mandate, does not support the economic or social development of the local community, would negatively impact public use of the area,

[0:37:21] Planner McCargar: area, increase microplastics into the ocean, noise and light pollution, and high archaeological

[0:37:28] Planner McCargar: value in this area and along the shoreline.

[0:37:32] Planner McCargar: So staff recommend that the Thetis LTC proceed no further with the application THRZ 2022.1

[0:45:44] Trustee Luckham: and adjacent upland tourism associated commercial activities, and the enjoyment of residential

[0:45:50] Trustee Luckham: properties, conflict with policy 2.7 mariculture, and there are potential conflicts with sections

[0:45:57] Trustee Luckham: Actions 3, 4, and 5 of the Allen's Trust Policy Statement.

[0:46:00] Trustee Luckham: When the Local Trust Committee received the application

[0:46:03] Trustee Luckham: for rezoning, it was reviewed at a public meeting on June,

[0:46:06] Trustee Luckham: and I don't have the exact date.

[0:46:08] Trustee Luckham: The applicant did attend the meeting

[0:46:10] Trustee Luckham: and answered questions from the LTC.

[0:46:13] Trustee Luckham: The most significant being what had changed

[0:46:15] Trustee Luckham: with this application that they thought

[0:46:17] Trustee Luckham: it may be well received by the community and the LTC

[0:46:21] Trustee Luckham: since the previous application that was turned down

[0:46:24] Trustee Luckham: and had the applicants consulted with the Penelakut Tribes and other First Nations.

[0:46:30] Trustee Luckham: The response to the questions was generally that nothing of significance had changed

[0:46:34] Trustee Luckham: and that they had not consulted the Penelakut Tribes.

[0:46:37] Trustee Luckham: The applicant was advised at the meeting that they should consult with the Thetis Island community

[0:46:42] Trustee Luckham: through a community information meeting and consult with Penelakut Tribes.

[0:46:48] Trustee Luckham: In the period of time leading up to today's meeting,

[0:46:51] Trustee Luckham: the LTC has received many letters, emails and phone calls

[0:46:54] Trustee Luckham: in opposition to the rezoning.

[0:46:57] Trustee Luckham: The applicant did hold a virtual community information

[0:47:01] Trustee Luckham: meeting for which there was about 30 attendees,

[0:47:03] Trustee Luckham: including the applicant and Theta's trustees.

[0:47:06] Trustee Luckham: I think it is fair to say most,

[0:47:08] Trustee Luckham: if not all members of the public were not in favor

[0:47:10] Trustee Luckham: of the application.

[0:47:12] Trustee Luckham: Many of the questions were regarding negative impacts

[0:47:16] Trustee Luckham: on the area and what benefits there would be

[0:47:18] Trustee Luckham: to Theta SOM community.

[0:47:19] Trustee Luckham: community. The questions were answered respectfully, not necessarily satisfactorily, to the members of

[0:47:24] Trustee Luckham: the public in attendance. There appeared to be little concern by the applicant for the impacts

[0:47:29] Trustee Luckham: that the community were concerned about. There appeared to be more interest in the industrial

[0:47:34] Trustee Luckham: and economic benefits to the applicant than to the community concerns. Since the community

[0:47:39] Trustee Luckham: information meeting, the LTC has received many more letters of concern and clear opposition to

[0:47:44] Trustee Luckham: the rezoning. The LTC thinks it is important to note that the current OCP amended in recent years

[0:47:51] Trustee Luckham: and the previous OCP both had restrictive zoning in place regarding marine aquaculture.

[0:47:58] Trustee Luckham: The Thetis community is very familiar with marine aquaculture as there are a number of oyster leases

[0:48:03] Trustee Luckham: already in place and that geoduck farming has been conducted on a converted lease not far from

[0:48:11] Trustee Luckham: the current rezoning location. There have been environmental issues associated with the plastic

[0:48:16] Trustee Luckham: pipe with this lease operation since 2019. The recent OCP review confirmed the community's

[0:48:22] Trustee Luckham: concerns regarding aquaculture and the community has purposefully retained restrictive zoning in

[0:48:29] Trustee Luckham: this regard. The Thetis community have concerns about the existing lease use and potential for

[0:48:35] Trustee Luckham: species changes with no notice to the public. There is no social or economic benefit to the

[0:48:43] Trustee Luckham: Theta Silent community and the community has made it clear to the LTC to not support this

[0:48:48] Trustee Luckham: application. The LTC asks the minister to respect this community and the LTC's rejection of this

[0:48:54] Trustee Luckham: application and cancel the permit that has been issued to the applicant which is subject to the

[0:49:00] Trustee Luckham: use being in conformance with local bylaws. The above denial to advance the application

[0:49:05] Trustee Luckham: does not provide the applicant with conformance of this work in the existing zoning and sincerely

[0:49:13] Trustee Luckham: hopefully that will be signed by Chair Elliott.

Chair Elliott called the electronic meeting to order at 9:33 a.m.  She acknowledged that the 
meeting was being held in the territory of the Coast Salish First Nations. She welcomed the 
public and introduced herself, Local Trustees, staff and recorder.

3.1 Trustee Reports 
Trustee Hunter reported on the following: 
 He has received many letters from community members expressing concern 
regarding the Abrupt Shellfish rezoning application. 
 The replacement vessel currently operating during the MV Kuper refit is causing 
some public concern; completion of the refit is anticipated in a month. 
 An increase in theft on the island is causing concern; a plan to address the issue 
is currently being considered. 
Trustee Luckham reported on the following: 
 He acknowledged the many emails, letters and phone calls he has received 
regarding the Abrupt Shellfish rezoning application.

 He attended the Oceans Protections Plan Conference electronically where 
topics of interest included coastal marine ecosystem protection strategies, 
impacts of marine shipping, derelict vessels and more. 
 He has been busy with his work as Chair of Islands Trust Council. 
3.2 Chair's Report 
Chair Elliott commented on the following: 
 She has been closely following the legislation regarding potential changes to 
housing regulations across BC; and staff are researching how these changes 
might be applicable in the Islands Trust area. 
 She reported that the second draft of the 2024/25 budget is scheduled to be 
reviewed at tomorrow’s Executive Committee meeting. 
3.3 Electoral Area Director's Report - none 
4. PUBLIC COMMENTS 
 Paul Duncan asked if there will be any discussion of the 2022/23 Annual Report where 
the public can ask questions or comment. 
o Trustees  explained the process, responding that the Annual Report was submitted 
and  approved at the Trust Council meeting with discussion in September; and will 
be presented to the legislature in the future. Trustee Luckham suggested he may be 
contacted with any further questions about the Annual Report.

future LTC meeting; he anticipates providing an update for the next Local Trust 
Committee (LTC) meeting. 
 The draft Letter of Understanding or Protocol Agreement between the Thetis LTC 
and the Cowichan Velley Regional District is in process; an update is anticipated for

Bylaw Compliance & Enforcement Manager Dingman responded to a request for an 
update on the Lot 88 enforcement issue for the community’s information. He reported 
that Mr. Pegg was found in contempt of court in September and was assigned fines. 
Serving Mr. Pegg with the sentencing order has been unsuccessful as he does not 
appear to be on island and his location is unknown. This may lead to delays; options 
provided by legal counsel have been provided and can be discussed In Camera. 
 
Trustees supported adding an In Camera meeting to the agenda at this time, given the 
importance of this issue to the community. 
 
By general consent item 15 Closed Meeting was added to the agenda. 
7. APPLICATIONS AND REFERRALS 
7.1 TH-RZ-2022.1 Abrupt Shellfish Inc - Preedy Harbour near Crescent Point - Staff Report 
Planner McCargar summarized the Staff Report that asks the LTC to consider proceeding 
no further with application TH-RZ-2022.2, provides supporting reasons, and background. 
She reported that at least 29 letters have been received in opposition to this application 
request. The correspondence may be viewed on the Islands Trust website with the main 
concerns outlined in the Staff Report. 
The applicant was in attendance at this meeting, and was given opportunity to speak to 
the application, however, declined. 
TH-2023-028 
It was MOVED and SECONDED, 
that the Thetis Island Local Trust Committee proceed no further with application TH-RZ-
2022.1 for the following reasons: 
a) Inconsistent with the Thetis Island Official Community Plan No. 88; 
b) Inconsistent with the Islands Trust Policy Statement; 
c) Incompatible with adjacent land and recreational uses; and 
d) Potential risk to sensitive ecosystem.

that the Thetis Island Local Trust Committee request staff and Chair to forward a letter 
and the supporting material received by the Local Trust Committee today to the 
Ministry responsible for issuance of the lease.

During discussion of the motion, Trustee Luckham read a draft letter to be signed by the 
LTC Chair, which he proposed might be sent to the Ministry responsible for the issuance 
of the lease to ask that the LTC decision to reject the application be respected and that 
the permit that has been issued to the applicant be cancelled. The letter includes the 
LTC’s resolution to proceed no further, summarizes background, observes the 
community’s opposition to the application, notes the lack of consultation with 
Penelakut Tribes, and expands on the reasons for denial. 
 
8. LOCAL TRUST COMMITTEE PROJECTS 
8.1 Minor Project: OCP/LUB Marine Areas Review Project - Staff Report 
Planner McCargar presented the Staff Report that asks the LTC to consider First and 
Second readings and referral of Proposed Bylaw Nos. 113 and 114 which amends both 
the Thetis Associated Islands Official Community Plan (OCP) and the Thetis Associated 
Islands Land Use Bylaw (LUB) to add zoning and land use designations to an 
unzoned/undesignated marine area.  
Comments included the following: 
 Planner McCargar confirmed that the W5 area, Burial Islet, is not affected by 
these amendments. 
 A Public Hearing will be necessary as it is a requirement for OCP amendments. 
 Staff was asked to ensure that the referrals include a notation that this action is 
resolving an outstanding oversight from a previous OCP review and is not a 
more specific, comprehensive amendment process.

12.1 Trust Conservancy Report  
 A positive meeting between Executive Committee and the Trust Conservancy Board 
occurred and more frequent meetings of this nature with more collaboration and 
sharing of processes is being encouraged. 
 Penelakut Tribe Council Member Ken Thomas has been appointed by the province 
to be a sitting board member of the Trust Conservancy, bringing welcomed 
perspective and contributions. 
12.2 Trustee and Local Expense Report dated August, 2023 
 LTC meeting expenses are not related to the frequency of meetings; and the LTC  
Meeting Facilitator position has not yet been filled, affecting budget numbers. 
 Trustee Hunter requested that hard copies of agendas be sent to him prior to 
electronic meetings; staff supported this request and will implement this procedure. 
 Trustees affirmed the value of in-person meetings; however, also considered that 
electronic meetings might be desirable when agendas are light and public interest is 
minimal.
