[0:00:30] Trustee Maude: I would like to begin the meeting by acknowledging that we are fortunate to be able to gather today in locations across the territory of the Sanford people.

[0:00:38] Trustee Maude: I'm David Maude, elected of Maine Island and chair of the Deming Island Local Trust Committee.

[0:00:42] Trustee Maude: it. I'm joined today by Delano Local Trust Committee members David Graham and Sam Borthwick.

[0:00:49] Trustee Maude: Together we make up Delano Local Trust Committee. This meeting is being live streamed and recorded

[0:01:04] Gerlach from Regional Planning Manager from Gabriola.

[0:01:20] So it's a little bit different format today, because we're going to 1230, and we're going

[0:01:24] to break for lunch.

[0:01:25] And then at one o'clock, we

[0:01:26] Trustee Maude: have an in-camera meeting with the Hornby and Local Trust Committee

[0:01:31] Trustee Maude: to discuss some issues, which should take about 45 minutes.

[0:01:34] Trustee Maude: then we're coming back um approximately 1 45 to to have discussion um a joint discussion with

[0:01:42] Trustee Maude: the hornby island trustees about the bc paris issues so we're so this could be kind of like

[0:01:48] Trustee Maude: a longer lunch break than what's normal because we'll be coming back here for the in-camera

[0:01:52] Trustee Maude: portion uh but as i say 145 will be reconvening and and finishing up the meeting um uh the meeting

[0:02:02] Trustee Maude: is an official format for your trust committee to make decisions about land use planning matters

[0:02:07] and discuss what business i want to have displaced employment despite many of the staff are in their

[0:02:13] own homes our staff have the right to the state and respect the workplace so we will move forward

[0:02:19] now um we have an agenda for us are there any additions or changes so by consent we'll adopt

[0:02:29] off the agenda and then we have

[0:02:32] Voice 6: our trustee reports

[0:02:46] Trustee Maude: yeah

[0:02:47] Trustee Borthwick: i mean i obviously have me anyway um and then i came down so i stayed a little bit out

[0:02:52] Trustee Borthwick: of connection for the last little while uh and i don't have a ton of reports directly um but i and

[0:03:00] Trustee Borthwick: and this is definitely gone only ever so slightly.

[0:03:03] Trustee Borthwick: I just wanna say that I am extremely,

[0:03:07] Trustee Borthwick: extremely appreciative to our housing advisory planning

[0:03:11] Trustee Borthwick: commission and all of the work that they've done

[0:03:12] Trustee Borthwick: on compiling the report for today.

[0:03:15] Trustee Borthwick: It is a tremendous document of work

[0:03:18] Trustee Borthwick: and it is the result of a lot of long hours of work.

[0:03:22] Trustee Borthwick: And I'm really excited to see where we can take it

[0:03:24] Trustee Borthwick: because I think there's a lot of gold in there.

[0:03:27] Trustee Borthwick: Yeah, that's my 10 cents.

[0:03:31] Trustee Graham: um the only activity that i've participated in germain to the trust as i did in the

[0:03:37] Trustee Graham: regional district committee of the whole and um that's where all the elected individuals

[0:03:43] Trustee Graham: within the homox valley get together once a year and talk about stuff there were two topics

[0:03:49] Trustee Graham: conversation one was the the work of the reconciliation advisory committee that

[0:03:54] Trustee Graham: in the Comox Valley Regional District at Stroud and a presentation by Nick Chowdhury, who

[0:04:00] Trustee Graham: is the principal of the company that was hired to do the work on that.

[0:04:06] Trustee Graham: The advisory committee is really well made up of Comox, First Nations, Indigenous Women's

[0:04:13] Trustee Graham: Charity Society, Cultural Society, Native Association, Accessible Society for Island

[0:04:20] Trustee Graham: Women of Native Manchester City, working with Comox Development Company.

[0:04:24] Their task is delaying the foundation for the work, and they've reported that they are now ready to

[0:04:31] Trustee Graham: make suggested activities to the Co-Obs Region District.

[0:04:36] Trustee Graham: And one of the ones I found interesting was their suggestion that we as Councils remove the word Chief from our government titles, like Chief Executive Ops.

[0:04:46] Trustee Graham: It's not a word that's appropriate anymore. Of course, renaming it Streets and Public Buildings is something that's on its own.

[0:04:54] um at lunch and then we came back and then we heard from the core mox valley regional

[0:04:59] district managers revolving involving addressing affordable housing and emergency housing

[0:05:05] and their goal of creating a regional housing action plan worked and we broke into four groups

[0:05:11] and we did our best to solve an unsolvable problem um the chrome regional

[0:05:17] Trustee Graham: district requisitions

[0:05:19] Trustee Graham: almost $500,000 each year for affordable housing in the Valley.

[0:05:25] Trustee Graham: And, yeah, that was good.

[0:05:28] Trustee Graham: I wish that there had been some silver bullet solutions,

[0:05:33] Trustee Graham: but we're all facing the same.

[0:05:35] Trustee Graham: That's my report.

[0:06:52] Trustee Maude: so from from a trust counselor's perspective we're looking at how trust council

[0:06:56] Trustee Maude: functions um is we're looking at locations number of meetings and the flight meetings

[0:07:03] format everything um because there's a bit of frustration that's been expressed by many of

[0:07:09] Trustee Maude: whether the trust councils that we're not really accomplishing a lot of things

[0:07:14] so everything's on the radar and i think in december when we

[0:07:19] Trustee Maude: gather in victoria

[0:07:21] Trustee Maude: there will be quite a bit um being discussed from that aspect um otherwise um really we haven't been

[0:07:31] doing too much in the past month uh other than the trust council issues so i'll leave it at that

[0:07:38] and I must welcome Sam back

[0:08:09] Voice 6: um i am really impressed by the amazing amount

[0:08:15] Voice 16: of work that the housing committee has done i

[0:08:18] Voice 16: totally support it and i'm awestruck but i've also noticed a couple of policies that

[0:08:26] Voice 16: are not in our land use bylaws or ocps but it will definitely affect housing and so i copied

[0:08:35] Voice 16: something to me

[0:08:35] Voice 6: so here's

[0:08:38] Voice 6: one there's some of the budget requests

[0:08:42] Voice 17: this year a new mapping software

[0:08:46] Voice 17: and some of their macro software will end up creating more development permit areas

[0:08:52] Voice 16: and so this is about development delegation on this premise the director or any of his

[0:09:00] Voice 16: or her absence the regional planning monitor

[0:09:03] Voice 16: is also delegated the power to require an intersection

[0:09:07] Voice 16: an applicant to provide security and being stated in the permit by the way of an irrevocable

[0:09:16] Voice 16: letter of credit or the deposit of securities uniform satisfactory to the director of the

[0:09:22] Voice 16: the director of planning the amount of security to be provided in the section

[0:09:29] Voice 16: in relation to a development permit issued by the develop delegate shall be

[0:09:35] Voice 16: 125 percent of the cost

[0:09:38] Voice 16: of cyberspace restoration landscaping remediation of damage to the natural environment for

[0:09:46] Voice 16: and improvements including materials and installation as determined by a professional

[0:09:51] Voice 16: landscape architect either to represent a landscape contractor or

[0:09:56] Voice 6: another percent of

[0:09:59] Voice 6: approval by the director to provide so if that's clear and looks just as it's written it's obviously

[0:10:07] Voice 6: obviously a huge impediment to these affordable housing projects and um another policy um

[0:10:19] Voice 6: these so this is for development permit applications

[0:10:28] Voice 17: and as we have more and more development permit

[0:10:31] Voice 17: areas the development permit application policies are likely to affect groups

[0:10:38] Voice 6: that are looking

[0:10:39] Voice 6: thing to develop housing and there's something else in this revised policy

[0:10:47] Voice 16: that these are policies under the uh housing section or the housing section

[0:11:02] Voice 16: that local trust committees and by the news of how they shall and their official community plans

[0:11:11] Voice 16: and regulatory bylaws ensure that growth and development of any scale or for any purpose is

[0:11:18] Voice 16: compact energy efficient sustainable and appropriately situated in order to minimize

[0:11:24] Voice 16: greenhouse gas emissions and to save our protected area network threat for sustainability

[0:11:31] Voice 16: sustainability, a healthy marine environment, and indigenous cultural heritage in the trust

[0:11:37] Voice 16: area.

[0:11:38] Voice 16: This is a new policy, and I think that once these policies are passed, it's required that

[0:11:47] Voice 16: they will be included in our land use bylaws in some form.

[0:11:53] Voice 16: It's not optional, but required.

[0:11:56] Voice 16: environment for these um so these new developments should also prioritize the protection of tree

[0:12:03] Voice 16: cover scenic areas and distinctive

[0:12:06] Voice 17: features and include policies related to the aesthetic

[0:12:10] Voice 17: environmental and social impacts of development so this is a lot of new stuff that can be

[0:12:16] Voice 16: used to curtail personal projects i just wanted to remind

[0:12:21] Voice 6: you thank you very much

[0:12:29] Voice 16: Hello, thank you. I would like to speak about the staff report about bylaw enforcement that's coming later in the meeting.

[0:12:40] Voice 16: On page 145 of the staff report, it states that, quote, trustees currently have limited involvement in the enforcement process, end quote.

[0:12:49] Voice 16: And it goes on to list things that the staff is concerned about.

[0:12:53] Voice 16: But nowhere in their list of concerns is our community or the effect of enforcement upon our community.

[0:12:58] Voice 16: All the views done to date of the Islands Trust mandate have concluded that community

[0:13:04] Voice 16: is one of the unique amenities that is protected by the mandate.

[0:13:10] Voice 16: The ongoing oversight by enforcement staff and administration, the ongoing neglecting

[0:13:20] Voice 16: of our community is both insulting to our island community and it's also direct opposition

[0:13:25] Voice 16: of the Islands Trust mandate.

[0:13:31] Voice 16: The staff report shows that all levels

[0:13:34] Voice 16: of the Islands Trust staff don't seem to understand

[0:13:38] Voice 16: that we want to preserve and protect our community

[0:13:40] Voice 16: and our island.

[0:13:44] Voice 16: And that continues to be really difficult

[0:13:49] Voice 16: to receive these staff reports and see them.

[0:13:52] Voice 16: Schedule A of the staff report,

[0:13:55] Voice 16: 1.3.5, non-permitted use in any zone

[0:13:59] Voice 16: is too broad my understanding is that if something is not specifically permitted in the OCP it's

[0:14:06] Voice 16: prohibited is that correct yes having sexual relationship with my partner in my home is not

[0:14:15] Voice 16: permitted is not a permitted use does that mean that the bylaw enforcement can come that's a

[0:14:20] Voice 16: ridiculous example but to take that kind of approach that if it's not specifically spelled

[0:14:27] Voice 16: out in our bylaws it's not allowed is an example of oversight sorry overreach on behalf of

[0:14:36] Voice 16: enforcement staff and that's very clear in the non-committed use in any zone so that would mean

[0:14:44] Voice 16: that my partner and I cannot have sexual relations because it's not permitted in our OCP or our land

[0:14:49] Voice 16: use bylaws uh 2.1.2 non-committed use of dwelling for paying guests uh i suggest i understand that

[0:14:59] Voice 16: they're accountable for short-term vacation rental but the way that it's written it can be used

[0:15:03] Voice 16: against anybody providing a room rental um and i suggest that that definitely needs reworking um

[0:15:11] Voice 16: As a member of the Housing APC, I would also suggest that all of what staff is asking for in this meeting be deferred until there is committee struck to look at enforcement issues.

[0:15:29] Voice 16: But as a member of the community, I would like to ask for, again, for our trustees to create a standing order requiring a minimum of 24 hours notice before any staff person attends any property on Denman Island that they make a 24 hours notice with time so that people,

[0:15:53] Voice 16: So that landowners can fulfill their requirements under the residential tenancy branch, which is 24 hours notice for legal or illegal tenants.

[0:16:03] Voice 16: It doesn't matter that landowners required to get 24 hours notice and just a basic decency.

[0:16:10] Voice 16: For those reasons, I'm requesting that local trust committee, please make that a standing order.

[0:21:56] Planner Chadwick (probable): the titles changed but um she was um the one that was helping us you know um work through the

[0:22:03] Planner Chadwick (probable): engagement process and she's now moved on um mary storzer is um is here with us um on temporary

[0:22:13] Planner Chadwick (probable): assignment, and so she has been doing some of the follow-up work with that. I did have a

[0:22:18] Planner Chadwick (probable): conversation with her last week, and she did indicate that she was still working towards

[0:22:27] Planner Chadwick (probable): moving that forward. So as of yet, we don't have any dates identified for that potential

[0:22:37] Planner Chadwick (probable): presentation, but the information, as far as I understand, is being forwarded to the Comox.

[0:22:57] Trustee Maude: move on to local trustee projects. We have the Denman Housing Advisory Committee, and I just wanted to start out expressing what everybody else has said.

[0:23:16] Very much appreciated the depth and the detail

[0:23:21] are beyond what anybody would have expected.

[0:23:26] There's some very solid recommendations.

[0:23:29] And I think this is sort of the grease on the skins

[0:23:36] Trustee Maude: actually make things happen.

[0:23:37] Trustee Maude: happen. This is very, very, very well done. And I know everybody who have forwarded this

[0:25:14] Voice 16: like to thank our current trustees we would like to thank the previous trustees who got the budget

[0:25:19] Voice 16: request going for this entire project to be happening uh this is something that was recommended

[0:25:26] Voice 16: We recommended in 2003 that this committee be struck.

[0:25:31] Voice 16: So what a relief 20 years later to finally have it happen.

[0:25:35] Voice 16: And I am really pleased with the report we've prepared.

[0:25:40] Voice 16: We've prepared this after extensive weeks, hours,

[0:25:44] Voice 16: months of consultation with our community.

[0:25:47] Voice 16: We had an open door and everybody was welcome at our table.

[0:25:52] Voice 16: People came, people spoke, and we're not unanimous in our community, but we're all really close,

[0:26:02] Voice 16: actually.

[0:26:03] Voice 16: We want to see how can we support housing and preserve and protect our island.

[0:26:09] Voice 16: So getting into, we've got page two, we've got a brief overview.

[0:26:14] Voice 16: This is also for members of the community who may not want to read 125 pages.

[0:26:21] Voice 16: So that's, we're going to jump past how we got here, what the challenges are, what we're asked to do, because this is all old news for our trustees and staff.

[0:26:35] Voice 16: Going past page six, what we wanted to community, I do want to point out that there are voices from our community in here.

[0:26:43] Voice 16: I also want to thank our the minute taker through the chair through the trustees if you can thank

[0:26:51] Voice 16: the minute taker on our behalf I noticed that they're including voices of our community from

[0:26:57] Voice 16: the town halls and that is really beautiful to see that was missing for a long time thank you

[0:27:03] Voice 16: for getting that back in um all right right on page seven the direction we recommend one we

[0:27:11] Voice 16: recommend creative housing options two we recommend red tape slowing down approval sorry

[0:27:18] Voice 16: we removed red tape slowing down approvals for much needed housing three we recommend

[0:27:24] Voice 16: that we minimize the environmental impact of housing four uh and this four about enforcement

[0:27:47] Voice 16: faster development and long-term affordable housing six simplify and clarify the ocp and

[0:27:53] Voice 16: lub lub uh people can't follow rules they don't understand uh seven advocate to other levels of

[0:28:01] Voice 16: government if you flip the page we've got a slight breakdown of what those mean and is it okay if i

[0:28:08] Voice 16: couldn't go through that before questions uh one create housing options we're recommending

[0:28:13] Voice 16: that all existing affordable housing be legalized we are uh would like to encourage landowners to

[0:28:19] Voice 16: convert existing buildings into affordable housing allowing builds we would like to allow a full

[0:28:26] Voice 16: range of housing types as we already have on denman island we have a full range of housing

[0:28:32] Voice 16: types already but they're not permitted by current bylaws we would like them to be permitted

[0:28:39] Voice 16: on almost all zones except for conservation park r4 and the water zones we'd like to allow

[0:28:46] Voice 16: accessory dwelling units whatever that looks like secondary suites room rentals and secondary

[0:28:52] Voice 16: dwelling units uh we recommend some change uh for in the requirements for primary dwelling units

[0:29:01] Voice 16: there's more on that in the environmental section uh we'd like to allow more residential options

[0:29:07] Voice 16: within a vital downtown um we also this was the one area of contention we had the most contention

[0:29:15] Voice 16: was about ensuring affordability and uh that was because um people are concerned about more rules

[0:29:27] Voice 16: but from our I believe that it is well I don't just believe that the provincial government

[0:29:34] Voice 16: believes that it's our duty that's local government's duty to meet affordable housing

[0:29:40] Voice 16: needs that's in section 473 so it may or may not be it's kind of a false acquit Lindsay in my

[0:29:48] Voice 16: opinion but I'm just speaking as one person I think that affordability is imperative you'll

[0:29:54] Voice 16: see on page nine, there's more about that discussion and

[0:30:00] Voice 16: that split we were evenly split for what it's worth um on affordability that was our most

[0:30:06] Voice 16: contentious um and there was a lot more detail in appendix one of the report about how to ensure

[0:30:13] Voice 16: affordability and i want to make a special note that section 482 of the local government act

[0:30:20] Voice 16: allows um density bonus zoning so we could keep all our two properties you're allowed one house

[0:30:30] Voice 16: but if you have affordable housing you're allowed to have more it's actually simple

[0:30:34] Voice 16: lmb change um and it's totally doable moving on to page 10. do i need to slow down or is it

[0:30:44] Voice 16: good that we're freezing through do

[0:30:47] Voice 15: you want to add anything to i would like to um emphasize that

[0:30:52] Voice 15: the whole commission was agreed that we needed to have um affordable available housing on down

[0:31:00] Voice 15: month and i think it was a matter of tactic that the disagreement broke down on one which

[0:31:06] Voice 15: was to use the bonus density um provisions to have some affordability controls within it and

[0:31:14] Voice 15: the other one was the concern that if there were no control if the controls were in place

[0:31:20] Voice 15: place then the buildings would not be built and therefore there would be no housing no and no

[0:31:26] Voice 15: affordable housing so it was uh a discussion that took place over five different meetings

[0:31:35] Voice 15: it was fairly intense I just want to make sure

[0:31:38] Voice 15: that um while I voted with Rihanna on

[0:31:41] Voice 15: the affordability controls I wanted to make sure both sides and I continue to contend that it's a

[0:31:47] Voice 15: fault. Yes.

[0:31:56] Trustee Borthwick: And crucially, just I think the nuance there too, is

[0:31:59] Trustee Borthwick: that it's not. And this is what Virginia said, but that everyone

[0:32:03] Trustee Borthwick: has agreed that affordability is important. Yes, about how you

[0:32:07] Trustee Borthwick: achieve it. Yes. Thank you.

[0:32:10] Voice 16: Page 10. We're recommending to remove red tapes, looking down

[0:32:14] Voice 16: approvals for much needed housing we recommend removing the temporary use permit as a condition

[0:32:19] Voice 16: for housing we recommend eliminating the density bank we did a lot of research into the creation

[0:32:26] Voice 16: of the density bank and the conclusion is quite clear the density bank has stopped affordable

[0:32:34] Voice 16: housing from happening it has not supported affordable housing which was its initial

[0:32:38] Voice 16: intention it has not reached its intention after 16 years it's time to retire it is our belief

[0:32:47] Voice 16: this again was the subject

[0:32:49] Voice 15: of quite a discussion um at the commission and um there was uh some

[0:32:56] Voice 15: discussion about whether or not we replaced the density bank with another some other type of

[0:33:02] Voice 15: control and group discussion was very much that we needed to just eliminate it and that's why

[0:33:11] Trustee Borthwick: And

[0:33:12] Voice 16: I think one of the important points with the density bank is the fact that housing is not being used traditionally as it was, there is not a single family in the house there's one or two retired people is what's predominantly happening on our island so allowing more housing will not necessarily increase population.

[0:33:33] Voice 16: population. 2C, we recommend to align the residential options on ALR with the maximum

[0:33:41] Voice 16: number of dwellings allowed under provincial agricultural land reserve regulations. We

[0:33:47] Voice 16: included this even while the farm regulations plan continues to lumber wherever it's going

[0:33:52] Voice 16: because we want to be very clear this is the part that needs to happen, whereas the farming

[0:33:59] Voice 16: regulation there's a lot of debate whether or not that actually continues forward or not

[0:34:04] Voice 16: uh so we wanted to make sure that we got the housing here into our report uh d support

[0:34:11] Voice 16: multi-tenant affordable housing projects and advocate for streamlining their approval e

[0:34:18] Voice 16: um investigate how pre-zoning pre-zoning might help to minimize the amount of time and money

[0:34:24] Voice 16: that are required to implement the new zones and housing options page 11 uh three minimize the

[0:34:33] Voice 16: environmental impact of housing we are recommending a maximum combined floor area not distributed

[0:34:39] Voice 16: square footage because no accounts in square footage anymore that's why we came up with a

[0:34:44] Voice 16: new name combined floor area to minimize the impacts of all housing across the island preserve

[0:34:50] Voice 16: B, we recommend rainwater catchment for all new builds, housing placements, anything where someone's living new requires a minimum water catchment in order to preserve groundwater.

[0:35:06] Voice 16: C, encourage the reuse of existing buildings and alternative forms of housing.

[0:35:11] Voice 16: I'm going really quick through the reading guide. There's so much more detail in the report.

[0:35:16] Voice 16: I'm encouraging people at home, people in the audience,

[0:35:20] Voice 16: we will get the report out.

[0:35:22] Voice 16: D, encourage the use of natural building materials

[0:35:25] Voice 16: and off-grid systems.

[0:35:27] Voice 16: E, encourage and promote conservation focused innovation.

[0:35:31] Voice 16: And this is like, let's encourage the mud girls

[0:35:35] Voice 16: to build more.

[0:35:36] Voice 16: We've already got a bunch of cob houses on Denman.

[0:35:39] Voice 16: Let's find ways to encourage that.

[0:35:41] Voice 16: That is the perfect, cob housing is the perfect marriage

[0:35:47] Voice 16: of the mandate to preserve and protect both the communities and our island, to preserve

[0:35:55] Voice 16: and enhance public walkways and cycle paths, and G, allow as many safe and affordable ways

[0:36:02] Voice 16: of dealing with human waste as possible.

[0:36:04] Voice 16: This is the euphemism for POOF.

[0:36:06] Voice 16: And you'll find lots of information about, well, not lots of information, but a nice

[0:36:11] Voice 16: extensive list of the ways that humans deal with POOF.

[0:36:15] Voice 16: And we would like to see more of those allowed in our local land use bylaws. Page 12, sorry,

[0:36:27] Voice 16: four. Again, this is the area where we had the most cohesion on our committee, was to ensure

[0:36:34] Voice 16: that enforcement is trauma-informed and respectful of human rights. We heard from another number of

[0:36:40] Voice 16: people who had very negative experiences being enforced on they spoke about the surprise they

[0:36:48] Voice 16: spoke about the lack of uh local knowledge while they were talking to enforcement officers

[0:36:53] Voice 16: they spoke about a whole bunch of things that were very disturbing for them to experience at their

[0:36:59] Voice 16: home um back to the request requiring a minimum of 24 hours notice before any site visits by

[0:37:08] Voice 16: by bylaw enforcement officers.

[0:37:09] Voice 16: B, we request that all bylaw enforcement officers undergo

[0:37:13] Voice 16: some kind of trauma informed practice

[0:37:15] Voice 16: so that they can change the way

[0:37:17] Voice 16: that they are approaching people at their homes.

[0:37:20] Voice 16: C, we'd like to have an investigation

[0:37:23] Voice 16: of alternative bylaw complaint processes

[0:37:26] Voice 16: based on principles of restorative and community justice.

[0:37:29] Voice 16: We'd like the priorities about bylaw enforcement,

[0:37:32] Voice 16: both content and penalties to be decided

[0:37:35] Voice 16: and changed by denman islanders not by people who don't actually live on our island and don't

[0:37:41] Voice 16: no offense but they don't understand uh e enforcement actions must not be taken against

[0:37:48] Voice 16: a person's housing regardless of what type of housing uh so we're recommending that um new bylaws

[0:37:55] Voice 16: would have that reflected we are not making anybody homeless through enforcement actions

[0:38:01] Voice 16: uh f this was very well supported that all bylaw complaints must originate from an island resident

[0:38:10] Voice 16: and must be accompanied by the complainant's full name and contact information anonymous

[0:38:16] Voice 16: complaints will not be accepted or processed we are not suggesting that you publish the names of

[0:38:21] Voice 16: the complaint complainant we are suggesting that the trustees need to know who's making the

[0:38:26] Voice 16: complaints because the trustees have local community contacts and

[0:38:31] Voice 15: not only the trustees

[0:38:32] Voice 15: the enforcement officers need to know who's making the complaints so they can find out a little bit

[0:38:38] Voice 15: more about the complaint and whether before they start to stir up and um cause a lot of problems

[0:38:47] Voice 15: for an individual there's too many um too much potential in the anonymous system for vexatious

[0:38:54] Voice 15: complaints and for neighbor versus neighbor complaints and it just doesn't work out and

[0:39:01] Voice 15: if the enforcement officers don't know who made the complaint and there's no way that they can

[0:39:06] Voice 15: find out whether or not it was resolved to their satisfaction it's for all of the parties involved

[0:39:16] Voice 15: in the enforcement process but it's really really critical that names are known people have raised

[0:39:23] Voice 15: the issue of um what if somebody's in like a witness protection kind of moment like they're

[0:39:31] Voice 15: complaining against their biker neighbors yes in some cases sure name may be um what's held from

[0:39:38] Voice 15: the public but that doesn't mean that the enforcement staff don't know who made the

[0:39:43] Voice 15: complaint and that the trustees don't when they were viewing it we'll touch on that

[0:39:49] Voice 15: that so

[0:39:49] Trustee Maude: spirits well they don't we have the enforcement manager here we'll touch on that

[0:39:54] but my understanding is well complaints you have to when you make a complaint there's a name

[0:39:59] attached to it so you fill the file enforcement form

[0:40:03] Trustee Maude: it's not anonymous anonymous basically it

[0:40:06] Trustee Maude: gets part with file enforcement so the names are never disclosed to anybody else and we're

[0:40:11] Trustee Maude: suggesting

[0:40:11] Voice 16: that the names are disclosed to trust

[0:40:13] Trustee Maude: so that

[0:40:15] Voice 16: there's some community context for what

[0:40:17] Voice 16: the what's happening with the complaint and

[0:40:19] Voice 16: to minimize vexatious complaints yeah so so the

[0:40:22] Trustee Maude: violent forces as far as i know they they do know who is complaining so lots and lots of but i think

[0:40:29] Trustee Maude: it's a very good point that if if we go for option one as um suggested by the violent enforcement

[0:40:35] Trustee Maude: officer if the trustee is going to be involved a little more while of course that probably is one

[0:40:40] Trustee Maude: of those things that needs to be attached to that so thank you and

[0:40:44] Voice 15: then if we are also looking at

[0:40:46] Voice 15: potential for alternative um by the way completed processes that are based on a restorative and

[0:40:54] Voice 15: community justice type situation um then that becomes really um who's being restored this

[0:41:03] Voice 15: becomes really important in that discussion so we need to change the um basic um attitude

[0:41:14] Voice 15: attitude behind enforcement and look at it as something that's a restorative process dealing

[0:41:20] Voice 15: with people who have got issues issues are valid let's let's work out a solution rather than let's

[0:41:28] Voice 15: see how much fine we can

[0:41:31] Voice 16: yeah

[0:41:33] Voice 15: rather than complain

[0:41:34] Voice 16: I'm I'm gonna keep going um uh currently so GE

[0:41:40] Voice 16: ensure bylaw enforcement officers do not

[0:41:43] Voice 16: have more power than police officers in attending

[0:41:44] Voice 16: properties. At this point in

[0:41:47] Voice 16: time, bylaw enforcement officers do

[0:41:49] Voice 16: have a little bit more

[0:41:51] Voice 16: power, and that

[0:41:52] Voice 16: seems unusual

[0:41:54] Voice 16: and strange. They are allowed to

[0:41:56] Voice 16: ask for entry

[0:41:59] Voice 16: into somebody's home,

[0:42:01] Voice 16: which I believe police are

[0:42:02] Voice 16: as well, but police are not allowed to enter

[0:42:05] Voice 16: without a search warrant,

[0:42:07] Voice 16: whereas the bylaw enforcement

[0:42:08] Voice 16: officer can

[0:42:10] Voice 16: Can enter a property, can't enter the home without permission, but can wander around the property looking for evidence, which police officers are not allowed to do.

[0:42:22] Voice 16: So that seems unusual that they have more power.

[0:42:25] Voice 16: and H we recommend that for not for all of these but for many of these that you form a commission

[0:42:32] Voice 16: to review these recommendations how do we move forward as a community with a different paradigm

[0:42:38] Voice 16: on how to enforcing our rules rather than our current uh anonymous complaint and then punish

[0:42:48] Voice 16: paradigm uh moving on to number five we've recommended a few new zones uh to create to

[0:42:57] Voice 16: facilitate faster development and long-term affordable dwelling units ecozone which is a

[0:43:02] Voice 16: shared zone um land share and we've got specific ideas attached to that in our report the tiny

[0:43:12] Voice 16: house zone which may be a shared land zone, or it could be a private owner who is renting out pads for tiny houses.

[0:43:22] Voice 16: It could be either medium density family multifamily zone, we didn't get too much detail on that we're just thinking, turning that over to staff and come up with more and also, we believe that a home based assisted living zone is really a good thing

[0:43:40] Voice 16: for us to have for our future and our aging community um six we're asking for a simplified

[0:43:47] Voice 16: and clarified official community plan land use bylaws update and increase community engagement

[0:43:53] Voice 16: and then we have a number of recommendations for advocacy um and we keep coming up with more

[0:44:02] Voice 16: now that we separate from the report we're like oh yeah and this and that um the next steps we

[0:44:10] Voice 16: just put this out as different discussion this is on page 14 um really the next steps will be

[0:44:17] Voice 16: determined by the local trust committee uh what the next steps are we have some requests uh about

[0:44:25] Voice 16: about next steps we would like to see for example before any community information meeting uh we

[0:44:32] Voice 16: would like to actually sorry first next steps um we ask that you receive this report we would also

[0:44:41] Voice 16: like to um ask that you get this published to the website the report uh to the honest trust website

[0:44:51] Voice 16: Right now, currently under this project on the Denman Island page, under projects, it says community consultation, none, community process, I can't remember what the words were, none, which is really, you know, we've had a community process.

[0:45:09] Voice 16: We have one of our appendices is a whole lot of letters from our community.

[0:45:15] Voice 16: We tried to get them received through minutes.

[0:45:17] Voice 16: They were removed from minutes.

[0:48:52] have picked a group that we do all agree that doesn't reflect this diverse 14 1500 person island

[0:49:00] um you know so that's good we didn't hide we didn't hide from the fact that some of these

[0:49:07] ideas are tough to wrap our heads around and there will be a full range of opinions so thank you for

[0:49:16] doing it thank you for doing it so well and thank you for presenting

[0:50:19] Trustee Graham: An accessory dwelling unit can be a building on a foundation, a bus, a year, a band, a whole range of things that people have chosen by history, by example, to live on.

[0:50:42] I didn't worry about the differences.

[0:51:57] Trustee Graham: in a trust area and this one of our prime mandates is to preserve the natural environment so that's

[0:52:03] Trustee Graham: great very very good um your number a requiring a maximum combined floor area does it add or

[0:52:11] Trustee Graham: detract what you're talking about if i insert the word residential between combined and floor area

[0:52:17] Trustee Graham: in other words if i as a landowner have a huge barn i don't want to have that floor area to

[0:52:25] Trustee Graham: impact my residential options so let's look at a combined residential floor area as opposed

[0:52:32] Trustee Graham: just Florida. This is just

[0:52:34] Voice 6: a suggestion. And then enforcement. This is a big one.

[0:52:43] Trustee Graham: And some great ideas here. I'm starting to think this might end up being its own project,

[0:52:58] Trustee Graham: ombudsperson organization to facilitate or to help us with that conversation we've already as the

[0:53:05] Trustee Graham: trust council uh gone out to the ombudsperson uh organization for a review of our enforcement

[0:53:12] Trustee Graham: practices so this might be an interesting way to have them involved have us involved in

[0:53:18] Trustee Graham: violent enforcement to kind of tailor this i think is what you're looking at a tailor-made

[0:53:23] Trustee Graham: denman solution to bylaw enforcement in particular when it affects people i don't think we're worried

[0:53:29] Trustee Graham: about signage i don't think we're worried about the heightened fences saying the areas how things

[0:53:36] Trustee Graham: are situated on the land with regards to setback that's black and white but people are not black

[0:53:41] Trustee Graham: and white we're all coming from all shades and all that's just my i'm just starting to think

[0:53:47] Trustee Graham: HAB-Masyn Moyer- Think about how we can deal with this in a more holistic way, as opposed to that.

[0:53:53] Trustee Graham: HAB-Masyn Moyer- Your your new zones, the ego tiny hosts medium and home is great pull them right out of the housing toolkit example, I believe.

[0:55:13] Voice 16: required before seeking a sighting and use permit uh the suggestion being that an accessory dwelling

[0:55:20] Voice 16: unit could be a temporary uh like a school bus or a year something that's not there forever and that

[0:55:28] Voice 16: it wouldn't require a signing and use permit because it may be temporary it may last five

[0:55:33] Voice 16: years it may be there forever we don't know uh we don't it's a small enough footprint it's below a

[0:55:40] Voice 16: certain size um 400 square feet uh so it's got it's being treated differently because of the

[0:55:48] Voice 16: size of it whereas a secondary dwelling unit could be up to whatever size through the combined

[0:55:55] Voice 16: residential floor area, which I think is a very good addition. I agree. So the secondary dwelling

[0:56:03] Voice 16: unit is more permanent. It has a foundation and it requires a siting and use permit. So those

[0:59:46] Trustee Borthwick: be able to feed back and sort of work on it bit by bit.

[0:59:50] Trustee Borthwick: We don't have to recreate all of the work of the HAPC, and I don't want to have like

[0:59:53] Trustee Borthwick: a ton of extra, you know, time and work to how we're doing this.

[1:01:11] Trustee Borthwick: this is sort of part of the nature of bureaucracy but it's very it tends to be reactive it tends to

[1:01:17] Trustee Borthwick: be something that happens and we respond to it which is a is responding in a play from a place

[1:01:22] Trustee Borthwick: a fear of the same thing happening again and it's uh and i know it's not all that but but it's uh

[1:01:28] Trustee Borthwick: it's important to me that we start to um focus on the on the future we want to build and not run

[1:01:35] Trustee Borthwick: from the past we care um so that's that's important to me and i'd say a lot of that in this

[1:03:01] Planner Chadwick (probable): some of the other um uh ltcs uh that that have uh bylaws that we can look to like um alternative

[1:03:09] Planner Chadwick (probable): alternative dwellings, Saturna, for example, allows a lot. So there are some models out there

[1:03:15] Planner Chadwick (probable): to look at. Floor area maximums have been contemplated by North Pender and same with

[1:03:21] Planner Chadwick (probable): cisterns. And that's some work we've done some analysis on that already. So that's really

[1:03:26] Planner Chadwick (probable): going to be useful in terms of providing analysis on what's been proposed.

[1:03:32] Planner Chadwick (probable): The density bonus approach is a tricky one. I've been having extensive discussions

[1:03:38] Planner Chadwick (probable): with that about that with Justine Stark who's our contact at CRD who actually happened to be the

[1:03:47] Planner Chadwick (probable): the one to do some of the initial work on housing here at the trust so a lot of these ideas that

[1:03:55] Planner Chadwick (probable): are in here we are we've been talking about for a while internally and also with other colleagues

[1:04:01] Planner Chadwick (probable): I'm also you know in touch with planners in other rural areas and so there's there's

[1:04:08] Planner Chadwick (probable): opportunities to to use their experiences as well to inform analysis around some of these

[1:04:15] Planner Chadwick (probable): um i was really impressed that uh the the little page that that identifies provincial advocacy

[1:04:22] Planner Chadwick (probable): it basically mimics the list that we have over here um some of which i think are going to be

[1:04:28] Planner Chadwick (probable): contained in a letter that's going to be going to the um the province shortly around some of the um

[1:04:34] Planner Chadwick (probable): um, uh, the things for them to think about, such as looking at health regulations related to, um,

[1:04:41] Planner Chadwick (probable): to, um, um, uh, refuse, human refuse. Um, uh, I can also speak to a couple of things that, uh,

[1:04:52] Planner Chadwick (probable): an interest that's, that, that, that came up that, um, Rhian pointed to, um, we can, we have for the,

[1:05:02] Planner Chadwick (probable): For Gabriola's OCP process, we've created a separate page that connects from the project page that is specifically related to their OCP project.

[1:05:19] Planner Chadwick (probable): That's something we could consider doing for Denman and that would be an opportunity to post information that would be additional to what we would ordinarily share on our projects page.

[1:05:31] Planner Chadwick (probable): on our projects page where we where we do have the list of like where the you know as you went

[1:05:37] Planner Chadwick (probable): down the list there that that is that's traditionally used for information that's

[1:05:43] Planner Chadwick (probable): that's specific to the process so in terms of public letters and such it's really the only

[1:05:56] Planner Chadwick (probable): of the process. So that's something that could be considered and how we've actually been introduced

[1:06:08] Planner Chadwick (probable): for this project. There's some great advocacy and education actions that are identified here. And

[1:06:20] Planner Chadwick (probable): I think that's where there'll be real value in having a housing action plan to accompany

[1:06:26] Planner Chadwick (probable): company um the rest of the projects where that that those things can be um can basically be

[1:06:34] Planner Chadwick (probable): landed so that that that good work isn't um isn't lost and that that some momentum can be

[1:06:40] Planner Chadwick (probable): gathered in terms of addressing the things that are outside the ltc's direct um um

[1:06:48] Planner Chadwick (probable): influence i mean to some extent those things can't like you know the development of um

[1:06:53] Planner Chadwick (probable): education programs and that sort of thing is, I think, more of a trust-wide, potentially

[1:07:01] Planner Chadwick (probable): trust in coordination with the regional district. And as, you know, housing

[1:07:09] Planner Chadwick (probable): is on the forefront of everybody's mind, and so these conversations around collaboration are

[1:07:14] Planner Chadwick (probable): happening. So those are just sort of some of my general highlights and just ways that we can

[1:07:22] Planner Chadwick (probable): address some of that sharing of information um specifically in terms of next steps um i i have

[1:07:30] Planner Chadwick (probable): um i have shared um on screen so that the trustees can see some of the ideas that i have around

[1:08:18] Planner Chadwick (probable): So we can be developing an action plan that, like I said,

[1:08:22] Planner Chadwick (probable): would also include those advocacy and education actions.

[1:08:38] Planner Chadwick (probable): and that's an option to have the HAPC organize a public meeting

[1:08:48] Planner Chadwick (probable): So, I'm thinking the earliest that a report could be prepared is February and that's being ambitious, just given the other responsibilities that that I'm personally engaged with.

[1:09:06] Planner Chadwick (probable): Like I said, there's another option could be if you are interested, LTC, in some public engagement prior to that point, you could consider having the HAPC organize a public meeting.

[1:09:31] Planner Chadwick (probable): room. I've also, so I've got, I've put up a resolution with respect to the, those next

[1:09:47] Planner Chadwick (probable): analysis of the HAPC recommendations and schedule a second, a special meeting via Zoom at the

[1:09:53] Planner Chadwick (probable): beginning of 2024 to discuss options and next steps. And then I've also put an additional

[1:18:40] um because the workshopping has been done um and it's been done you know to a great degree

[1:54:06] Trustee Borthwick: concern that i have is that none of those requests have had like i have not

[1:54:12] Trustee Borthwick: heard from any of those and part of that's with me like i can reach out as well and that's my

[1:54:17] Trustee Borthwick: intention um but but this and i understand that like policies are changing and how we're doing

[1:54:24] Trustee Borthwick: stuff is evolving and that's very well and good my concern is that not like if this is currently

[1:54:29] Trustee Borthwick: our policy um if it's not the way we're doing things then maybe we should remove it from

[1:54:33] Trustee Borthwick: about policies or a debt or amend how it's presented in our policies uh and if there isn't

[2:14:22] Manager of Bylaw Compliance and Enforcement: cases. So this proposal will be, this LTC would say, okay, we want to hear, have a report on all

[2:14:30] Manager of Bylaw Compliance and Enforcement: files where there's a completed investigation. So in the past, it's just been happening really

[2:14:36] Manager of Bylaw Compliance and Enforcement: ad hoc or piecemeal where a local trustee says, okay, we want to hear about this specific case

[2:14:41] Manager of Bylaw Compliance and Enforcement: only. Instead of reviewing all of the enforcement files where there's a completed investigation,

[2:14:46] Manager of Bylaw Compliance and Enforcement: they've been doing them one by one and then making decisions, well, okay, yes, we wish to

[2:14:50] Manager of Bylaw Compliance and Enforcement: take this person to court or we don't wish to proceed or you know what we wish you to proceed

[2:14:56] Manager of Bylaw Compliance and Enforcement: using the bend system to try and gain compliance so yes this would add a little bit of an extra

[2:19:12] Trustee Graham: foreshore. Those all make sense to me. And then, of course, Schedule B is the failure to obtain a

[2:19:18] Trustee Graham: setting. So other than the first one, I'm quite happy to consider adding those to Schedule A.

[2:19:27] Trustee Graham: i'd like to hear from my co-trust yeah

[2:19:29] Trustee Borthwick: and i would want to know so just the i would share

[2:19:33] Trustee Borthwick: your concerns with with 1.3.5 um but uh i would like some clarity on what um the technical

[2:19:46] translation of non-permitted use is

[2:19:48] Trustee Borthwick: in this instance just making sure i understand so

[2:19:53] Manager of Bylaw Compliance and Enforcement: So what I've specifically referenced in the staff report is the Denman land use bylaw does not list specific prohibitions, say, in the dumping of waste materials on land or water.

[2:20:04] Manager of Bylaw Compliance and Enforcement: And so that's my intention of using that section or any other uses that are considered harmful to the natural environment or pose a risk to health and safety.

[2:20:15] Manager of Bylaw Compliance and Enforcement: So as with you adopted a motion that says you're going to review these files and determine whether or not you proceed with enforcement.

[2:20:21] Manager of Bylaw Compliance and Enforcement: enforcement having this option in there gives you you're not left with just okay we're gonna

[2:20:28] Manager of Bylaw Compliance and Enforcement: have to go to court you can give someone a fine if someone decides to use their property as a

[2:20:33] Manager of Bylaw Compliance and Enforcement: garbage dump especially a commercial garbage dump because most most of the other land use

[2:20:39] Manager of Bylaw Compliance and Enforcement: bylaws do have a regulation say you can't dump waste on land or in water denman island does not

[2:20:45] Manager of Bylaw Compliance and Enforcement: have that prohibition so that was the reason why i suggest leaving it in there or having it that

[2:20:53] Trustee Maude: so and perhaps there should be some additional wording in there saying not

[2:20:58] Trustee Maude: been induced in any zone uh related to environmental concerns so something to make

[2:22:24] Trustee Borthwick: we're we're educating them that someone is in contravention of the bylaw and we're encouraging

[2:22:28] Trustee Borthwick: them to do it now the the the stick behind that is is that yes we might advance those to court

[2:22:34] Trustee Borthwick: but it's important to me that we recognize that the band is not our only tool and a lot of this

[2:22:40] Trustee Borthwick: language seems to be that the band is our only way to get compliance whereas actually there's

[2:22:44] Trustee Borthwick: you know informing people and and you know there you know there are people who just don't know but

[2:22:49] Trustee Borthwick: But also, yeah, if it's the case that someone maybe does know that what they're doing is wrong, but they're then informed that actually, you know, we're aware of what you're doing, you know, that is also another opportunity.

[2:23:01] Trustee Borthwick: And I understand that when you're trying to force compliance in that thing, being able to wave the bat at them in that front, in that arena, feels like one of their only tools.

[2:23:16] Trustee Borthwick: but it is important to remember that we do have other there are other components of our

[2:23:20] Trustee Borthwick: enforcement and i i know that you know this uh uh that award so i'm not trying to

[2:23:28] Trustee Borthwick: get you over the head with it but i i'm concerned that that that approach is not reflected in

[2:23:32] Trustee Borthwick: language uh with enough frequency i would love to see some change in language to be a little bit

[2:23:40] Trustee Borthwick: more specific on non-permitted use in any zone personally but i'd be open to my fellow trustees

[2:32:37] Trustee Borthwick: slap on the wrist uh being told to take it back and do your homework again um we we made motions

[2:32:44] Trustee Borthwick: we we passed them on if we're not able to in confidence pass resolutions and know that they're

[2:32:50] Trustee Borthwick: going to be advanced through the system it profoundly under undercuts undermines my confidence

[2:32:56] Trustee Borthwick: in our ability to make resolutions and it's deeply frustrating um so i i understand what happened

[2:35:32] Trustee Borthwick: community it undermines their confidence in us and it undermines our confidence in being able

[2:35:36] Trustee Borthwick: to make decisions and i'm not this is not you know i'm looking at you renee but it's not correct

[2:35:41] Trustee Borthwick: it's this is a broader this is a we're all part of a team here and part of being a team is that

[2:35:47] Trustee Borthwick: we need to be able to be seen to do the work that we set out to do and we need to be able to to to

[2:35:52] in order for us to provide leadership to this organization that leadership needs to be uh

[2:35:59] needs to be respected and needs to be moved forward in

[2:36:04] Trustee Borthwick: instance it did not feel like it felt like i was being undercut and that this body was being

[2:36:08] Trustee Borthwick: undercut and um the particular instance is is less an issue than the broader systemic culture of it

[2:36:16] which it bodes ill for our ability to work as a group and for us

[2:36:23] Trustee Borthwick: we need to be also be respected by staff and it's and and you know i have tremendous respect for

[2:36:29] Trustee Borthwick: director like you know he works really hard and he does a lot of stuff like that's not in question

[2:36:40] wanted to make sure that that is captured

[2:54:58] Trustee Borthwick: so i was across all the time you know on the colloquia and i've watched this route i live

[2:55:03] Trustee Borthwick: on the main drag i live on mcfarland road so i'm like getting all of that stuff coming right past

[2:55:08] Trustee Borthwick: my house i i think um in terms of like traffic buildup at brownfield bay over the course of

[2:55:16] Trustee Borthwick: summer having another kunitsa on route 22 has been great um like it that has massively reduced

[2:55:22] Trustee Borthwick: the amount of waiting that happens there just having that bigger ferry having that bigger

[2:55:25] Trustee Borthwick: capacity widens that bottleneck um my feeling and then i've expressed this at the fac

[2:55:32] Trustee Borthwick: is that the speeding question is not going to get resolved um

[2:55:38] Trustee Borthwick: over a short period of time because it's a cultural phenomenon at this point it doesn't

[2:55:43] it doesn't matter what the specifics of the situation are people still think that they need

[2:55:48] to race across um and that's you know and like even you

[2:55:54] Trustee Borthwick: know recently i've seen corby residents

[2:55:56] Trustee Borthwick: saying oh you know you know i've raced across and i still wound up behind you know people who

[2:56:03] Trustee Borthwick: got let off the ferry on the other end after me. So there's a cultural element. And also,

[2:56:12] Trustee Borthwick: I want to be clear, it's not just Hornby residents. They're definitely demonites whose speed, but the

[2:56:18] Trustee Borthwick: impetus and the drive to drive that quickly definitely is fueled by the desire to try and

[2:56:30] Trustee Borthwick: and get onto the ferry.

[2:56:31] Trustee Borthwick: So I'm concerned about what happens

[2:56:33] Trustee Borthwick: when the quinance goes off that route.

[2:56:36] Trustee Borthwick: You know, I think that's definitely

[2:56:37] Trustee Borthwick: going to impact things again.

[2:56:39] Trustee Borthwick: But in the quieter months,

[2:56:41] Trustee Borthwick: it's not really the problem.

[2:56:42] Trustee Borthwick: People race because they think

[2:56:43] Trustee Borthwick: they have to race

[2:56:44] Trustee Borthwick: because they think they have to race.

[2:56:46] Trustee Borthwick: That's been established

[2:56:47] Trustee Borthwick: as a cultural phenomenon.

[2:56:49] Trustee Borthwick: And I think with several years

[2:56:51] Trustee Borthwick: of larger capacity,

[2:56:52] Trustee Borthwick: yeah, maybe that would go down.

[2:56:54] Trustee Borthwick: The reality is, though,

[2:56:55] Trustee Borthwick: that I think that,

[2:56:56] Trustee Borthwick: and there's a drive

[2:56:58] Trustee Borthwick: from certain elements

[2:56:59] Trustee Borthwick: in the community to just increase the capacities of our ferries and that's never going you know

[2:57:05] Trustee Borthwick: increasing the capacity is never going to address the problems that we have in the interim and i

[2:57:12] Trustee Borthwick: mean i've talked with bc ferries people and i've you know i've had good conversations with i think

[2:57:16] Trustee Borthwick: there's some like uh you know real room for collaboration with some of the bc ferries people

[2:57:21] Trustee Borthwick: they do want to see a change but it's not their jurisdiction they have no control over what

[2:57:25] Trustee Borthwick: happens in the eye on the roads in between and it's not really their place to fix it um and

[2:57:30] Trustee Borthwick: while they undeniably have an influence on it um they can't really be held to account for how

[2:57:37] Trustee Borthwick: how drivers act that's the choices of individuals and it's it's a tricky one to unpick and yeah i

[2:57:44] Trustee Borthwick: mean i the other big piece of this discussion is this whole thing of there's a there's a large

[2:57:50] Trustee Borthwick: body of people who just whenever you know there's a lot of people who are saying yeah we need this

[2:57:53] Trustee Borthwick: other ferry. The other ferry could come from Buckley Bay or it could come from Little River.

[2:57:58] Trustee Borthwick: There's different ways to do it. Depending on the size of the ferry, it could go fewer times a day.

[2:58:03] Trustee Borthwick: There's all sorts of ways to solve that problem. The discussion that's had overwhelmingly at the

[2:58:07] Trustee Borthwick: FAC level and certainly comes from BC Ferries is that it's just not possible. There's no possible

[2:58:15] way to do it.

[2:58:16] Trustee Borthwick: I'm very frustrated with that narrative. I don't think it's got a lot of

[2:58:22] Trustee Borthwick: depth and usually the people who are making that argument really are the people who just sort of

[2:58:28] Trustee Borthwick: bring their hands of what's going to happen on the roads in between um not exclusively but that's

[2:58:33] that's a big part of the conversation um and expanding the bain sound connector and then

[2:58:39] all of the issues of the bain sound connector which is a whole other conversation um but but

[2:58:45] just expanding capacity is never going to solve the problems and we don't have the means to

[2:58:50] upgrade the infrastructure to the point where they could be speedways between uh

[2:58:54] Trustee Borthwick: and nor do we want

[2:58:55] Trustee Borthwick: to that's not that's not our thing and that that's what's housed in rocp um you know is this desire

[2:59:01] Trustee Borthwick: to reduce the amount of traffic across island and you know that's that's or you know at least keep

[2:59:07] Trustee Borthwick: it to a level that's that's reasonable so increasing the capacity ad nauseum and and you

[2:59:13] Trustee Borthwick: know it's on behalf or in service to an industry that doesn't benefit down in the slightest none

[2:59:19] Trustee Borthwick: None of that money stops here, which, you know, whatever, that shouldn't be the only thing.

[2:59:23] Trustee Borthwick: And I want to live in collaboration and want to facilitate the businesses and livelihoods of our neighbors on Airbnb because I think Airbnb is great.

[2:59:31] Trustee Borthwick: I love Airbnb. I've got lots of good people right out there.

[2:59:35] Trustee Borthwick: But we're paying the price for an industry in which we have no part and we get no benefit back from.

[2:59:43] Trustee Borthwick: and so I think it's really important that actually that this request for a direct ferry,

[2:59:48] Trustee Borthwick: even if it's just through the summer months, I think could make a huge difference. I don't think

[2:59:53] Trustee Borthwick: it would be an awful thing now that BC Ferries is like always going to say oh we don't have the

[3:00:00] boats we don't have the money we don't know they are facing mounting costs and all that sort of

[3:00:04] stuff and um they have a duty to these communities and it's not just

[3:00:10] Trustee Borthwick: um there's a lot of focus on

[3:00:12] Trustee Borthwick: serving the tourist industry but actually there's a duty they they take the place of our highways

[3:00:17] Trustee Borthwick: in terms of getting to the islands their infrastructure they're they're required

[3:00:21] Trustee Borthwick: um and there's a higher duty of care and i think there's problems with monopolies on that kind of

[3:00:28] Trustee Borthwick: of industry but but i i they there there is a duty to be responsive and responsible to our

[3:00:33] Trustee Borthwick: communities and we're the voice of our communities that say actually this is this is too much and

[3:00:39] Trustee Borthwick: it's dangerous and i've yeah i've seen people in accidents i i had to i had a friend's child's cat

[3:00:50] Trustee Borthwick: that i discovered that had been hit and i had to bring up to the house and do that sort of stuff

[3:00:54] Trustee Borthwick: but it's like these these uh these concerns are not um they're not frivolous uh and they're not

[3:01:01] Trustee Borthwick: made and a lot of the people who are who are you know speaking vocally here and and too and we've

[3:01:06] Trustee Borthwick: had rba's too we've talked about it too they're not the concerns of people who are just like

[3:01:11] Trustee Borthwick: complaining for the sake of complaining most of these people you'd never hear them

[3:01:15] say boo about anything for any reason um so it's it's indicative of a serious issue anyways

[3:01:24] Trustee Graham: frustration of course is that bc paris just says the same thing every time this has been asked

[3:01:29] Trustee Graham: 1995 i'm sure that local trust committee got the same answer no we can't do it but when they were

[3:01:37] Trustee Graham: here not that long ago and they brought all of their people and they even hired a communications

[3:01:42] Trustee Graham: company to to facilitate the discussion they were very very clear that we want to listen to you and

[3:01:49] Trustee Graham: And we want to find solutions.

[3:01:51] Trustee Graham: So that's what we hear at one end.

[3:01:53] Trustee Graham: But there isn't even an attempt to examine the possibility of going from Buckley Bay to Hornby.

[3:01:59] Trustee Graham: And there certainly isn't a pilot opportunity.

[3:02:02] Trustee Graham: Like, try it for a month.

[3:02:04] Trustee Graham: I mean, yeah, it might cost you a bit of money, but let's try it for God.

[3:02:08] Trustee Graham: Show us that your words mean something when you say you really want to hear us and you really want to find solutions.

[3:02:16] Trustee Graham: And the only one, as Trustee Bartholomew says, making the ferries bigger on either end just makes the amount of time that we have to stay off our roads that much longer because there'll be more cars flying across.

[3:02:32] Trustee Graham: And it's not cars.

[3:02:33] Trustee Graham: It's cars and trailers.

[3:02:34] Trustee Graham: There's SUVs and bicycles and cabins and God knows what.

[3:02:38] Trustee Graham: All that aid at Harvey.

[3:02:40] Trustee Graham: And we just think, as a community, for God's sakes, we want you to go to Harvey.

[3:02:45] Trustee Graham: And we really do.

[3:02:46] Trustee Graham: We just don't want you to go across them.

[3:02:48] Trustee Graham: It's as simple as that.

[3:02:50] Trustee Borthwick: And it's hurting Hornby too.

[3:02:52] Trustee Borthwick: Like the back house and the choke on that is brutal.

[3:02:57] Trustee Borthwick: If you want to get work done anytime between March and November on Hornby,

[3:03:03] Trustee Borthwick: like you pay a premium to get cement brought over.

[3:03:06] Trustee Borthwick: It's ridiculous.

[3:03:07] Trustee Borthwick: And if there was any alternative, it would, I mean,

[3:03:11] people are already backed up years for getting work to come over.

[3:03:16] Trustee Borthwick: lot of trades people from from courtney won't even go to orby um you know that it's it's

[3:03:21] Trustee Borthwick: you know yeah so this is i think it's to both of our benefits and there's certainly elements

[3:03:27] Trustee Borthwick: of community and industry who want to push it in a different direction but they're overwhelmingly

[3:03:32] Trustee Borthwick: not the ones who bear the brunt of of the the cost um so it's

[3:03:39] Trustee Graham: it's a tricky conversation what would

[3:03:41] Trustee Graham: would really help them is if Hornby joined them in their ask to BC Ferries to at least take the

[3:03:49] Trustee Graham: request seriously put some money into looking at what the scheduling would be looked like the cost

[3:03:55] Trustee Graham: and maybe even be brave enough to try it for a month or whatever if Hornby was on alongside with

[3:04:02] Trustee Graham: them and I think that we have maybe an opportunity a chance to have BC Ferries say okay fine we'll

[3:04:09] Trustee Graham: go try it. Because right now, we get nowhere. Anyway, that's our frustration. And we want

[3:04:16] Trustee Graham: you to be a partner. Okay, you

[3:04:43] Voice 9: get off and they're number 16, 15 and all the tourists get to go off ahead of

[3:04:48] Voice 9: them. And I'm hearing this all the time. Yes,

[3:04:52] Voice 9: we don't board you the same way on and off, but we on,

[3:04:57] Voice 9: on Hornby ferry, you're, you're number three on, you're number three off.

[3:05:02] Voice 9: That's the way it is. But on your side, it's, it's totally willy nilly.

[3:05:05] Voice 9: And it's really frustrating to people. So my thing was like,

[3:06:35] Voice 9: ramp for the other ferry it could go right around i hear it's it's not an issue with crew anymore

[3:06:46] Voice 9: went around crow island that's not an issue now but i would definitely you know try and get some

[3:06:53] Voice 9: sort of little survey or something in the paper or whatever just to find out what how many people

[3:06:58] Voice 9: will feel that way but as i said the very argument or the conversation is just the same as vacation

[3:07:04] Voice 9: rentals and um it's um because we did pass making vacation rentals illegal in september

[3:08:59] Trustee Graham: a gigantic holiday island, and Quadrant is so massive that any traffic that goes on the

[3:10:15] Voice 11: road condition and bc ferries hasn't been putting people out of the flag and it's it's just quite

[3:10:20] Voice 11: unsafe so they they did it okay during the week but they didn't line it up to when the hornby

[3:10:25] Voice 11: people come back over the weekend or holiday mondays um so it's that's quite frustrating

[3:10:42] Trustee Borthwick: put our employees off of our property at all just for insurance reasons or whatever and I just they

[3:10:48] Trustee Borthwick: had a contractor last year like this year they didn't have flaggers at gravity Bay which you

[3:10:53] Trustee Borthwick: know they didn't need with the higher capacity but the flagger they had in the previous year

[3:10:56] Trustee Borthwick: was phenomenal um Josh was fantastic and I personally I was of the opinion that we should

[3:11:04] Trustee Borthwick: just as an island hire him privately to manage the traffic across the island because he does

[3:11:08] Trustee Borthwick: a great job but um and like one of those days uh last year traffic was up into into the downtown

[3:11:16] Trustee Borthwick: gary of denman because the bc ferry at the bc baytown connector broke down until one in the

[3:11:21] Trustee Borthwick: morning and josh was coming home from having done his day of flagging and he kept the whole line

[3:11:26] Trustee Borthwick: like he found water he like he like found power for people to charge phones he like was there

[3:11:32] Trustee Borthwick: cheering people up doing all this stuff says but yeah no i mean and the the the question of like

[3:29:27] Trustee Borthwick: five times but um i mean it seems like we should give narissa a chance to chew it over

[3:29:34] Trustee Borthwick: yeah okay so we'll go i think i think there's there's stuff to be worked into and i think we

[3:29:39] Trustee Borthwick: should talk about like because it'd be there and there's elements too which i'm looking at

[3:29:44] Trustee Borthwick: it and there's a recommendations like well some of these exist at the ltc level but some of these

[3:29:47] Trustee Borthwick: exist at the trust council level um so you know like talking about about you know human waste

[3:29:55] based, that's a VHAR decision.

[3:30:00] Trustee Borthwick: in terms of an advocacy piece we can request it but it should happen at the trust council level

[3:30:05] Trustee Borthwick: you have more weight um and then i think like uh there's talking about like trauma enforced

[3:30:10] Trustee Borthwick: training for for by law enforcement that's a trust council level request not an ltc request

[3:30:17] Trustee Borthwick: um so there's some events which live elsewhere but there's a lot that needs to be

[3:30:21] Trustee Graham: chewed up i'd

[3:30:22] Trustee Graham: rather introduce these changes as they become workable so that the community can see change

[3:30:33] Trustee Graham: minor project. It requires careful

3.1 Trustee Reports 
Trustee Borthwick expressed his appreciation for the Housing Advisory Planning 
Commission’s (HAPC) work and report on the Denman Island Housing Project referral. 
Trustee Graham reported on his attendance at the Comox Valley Regional District 
Committee of the Whole. He summarized topics discussed there, which included First 
Nations Reconciliation and an affordable and emergency housing action plan. He 
provided notes with more information from the meeting for the record.

Chair Maude reported on the following: 
 He expressed appreciation for staff member, Wil Cottingham, for the assistance 
she provides with the electronic meetings.  
 He reported that Executive Committee is reviewing the effective functioning of 
Trust Council including locations, number, and format of meetings. 
3.3 Electoral Area Director's Report-none 
4. PUBLIC COMMENTS 
 The HAPC Housing Report is impressive and supported. Items that might affect affordable 
housing that have not been addressed in the report include mapping software in the Islands 
Trust budget requests which will create more Development Permit Areas, and policies 
requiring applicants to provide security for Development Permits. The draft Housing Section 
of the revised Islands Trust Policy Statement includes a new policy, which will establish 
many new requirements. These new policies will require changes to the Official Community 
Plan (OCP) and Land Use Bylaw (LUB) and concern was expressed that these can be used to 
curtain affordable housing projects. 
 Two of the proposed Land Use Bylaw No. 186 Contraventions and Penalties listed in 
Schedule A of the Bylaw Enforcement Notice Amendment Bylaw, 2019, Amendment No. 1, 
2023 Staff Report were opposed: 1.3.5 Non Permitted Use in Any Zone – too vague and 
might be used against housing infractions; 2.1.2 Non Permitted Use of Dwelling for Vacation 
Rental/Paying Guests – paying guests might include those renting a room for housing.  
Bylaw Enforcement oversight is an ongoing concern; the Local Trust Committee (LTC) was 
asked to create a Standing Resolution to require Bylaw Enforcement to give 24-hours’ notice 
before conducting a site visit. 
 Support for the HAPC Final Report findings was expressed and the HAPC members were 
thanked for their hard work.

Housing Review Project.” 
o Planner Chadwick responded that this activity is in process. She reported that 
K'ómoks First Nation has requested a comprehensive package of requests for 
comments, including the Islands Trust Policy Statement, be forwarded as one 
package and not for each matter separately; and that respecting their request 
for engagement comments and working with this protocol is taking time.

Final Report.” 
Discussion of the HAPC Final Report, Guide, and next steps included the following: 
 Chair Maude and Trustees thanked the HAPC members for their comprehensive 
work;

Secondary Dwelling Units and rationale for addressing them separately was

 In Recommendation 3a of the report, Trustees suggested inserting the text 
“residential” after “combined” to read: Require a maximum combined 
residential floor area to minimize impacts of all housing; 
 There are many educational opportunities within the report that might translate 
into published information for the public; 
 Enforcement recommendations in the report might be best focused as a stand-
alone project; 
 HAPC inclusion in public discussions of the report was requested;

 Status of Policy No. 6a) regarding introduction of Trustees and staff and providing an

updating. 
 Concern was expressed that Policy No. 10 initiated in 2021 regarding visitor 
accommodation is a temporary policy until the regulation is reviewed. Addressing 
this regulation might be considered when there is capacity to undertake a new 
project in the work program.

Planner Chadwick confirmed that the remaining cumulative total of residential densities

with respect to the available residential densities resulting from Section E.1, policy 11 
and Appendix D, “Residential Density Bank” of the Denman Island Official Community

Whereas the Local Trust Committee sets out the current available residential densities 
in this density register and that the register be updated from time to time to show 
additions and withdrawals as they occur:  
a. The Denman Island Official Community Plan “Residential Density Bank” in Appendix 
D has last added or transferred to the bank on February 7, 2023 and has a 
cumulative total of residential densities of 7; 
b. The Denman Island Official Community Plan Housing Policy 11 in Section E.1 allows 
for a residential density increase of approximately 5 percent beyond that permitted 
by existing zoning at the time of adoption of the Official Community Plan on May 15, 
2009 to accommodate zoning amendments for special needs and affordable

Bylaw Compliance and Enforcement Manager Dingman presented the Staff Report that 
asks the LTC to consider amendments to the contravention schedule for the Denman 
Island Bylaw Enforcement Notification Bylaw, 2019 and enforcement options to provide 
additional oversight for the system.

Discussion followed on the proposed amendments to the contraventions and penalties 
Schedule A: 
 Trustees expressed concern that including 1.3.5 “Non Permitted Use in Any 
Zone” in the contravention schedule was too broad and might be used for any 
bylaw infraction.  
 The purpose of inclusion of 1.3.5 “Non Permitted Use in Any Zone” was 
explained by Bylaw Compliance & Enforcement Manager Dingman as a tool to 
prohibit environmental contraventions such as dumping of waste on land or in 
water not specifically addressed in the LUB. 
 Adding a regulation to the LUB to address dumping of waste on land or in water 
might be considered as a future project.

In discussion, Bylaw Enforcement Compliance & Enforcement Manager Dingman pointed out that Bylaw 
Enforcement staff do follow the existing law that a dwelling inspection requiring entry into a residence 
requires 24 hours notice and obtaining the occupant’s consent, noting that most of their work involves 
land inspections with in-residence inspections rarely occurring. There are occasional necessary 
exceptions requiring on-site serving a letter of notice of a future inspection.

13. NEW BUSINESS 
13.1 Joint Discussion with Hornby Island Local Trust Committee on mutual BC Ferries 
Concerns 
Discussion among Denman Island Trustees and Hornby Island Trustee Allen included the 
following points: 
 The Denman Island LTC is drafting a letter to BC Ferries advocating for direct 
sailings to Hornby Island in response to the Denman Island Community’s 
ongoing concern with Hornby traffic speeding across the island causing unsafe 
conditions. 
 The larger ferry capacity is helping with the vehicle backup at Gravelly Bay; 
however, is not resolving the speeding problem. 
 Denman Island has advocated for this change for many years with BC Ferries 
and has recently discussed with the Ferry Advisory Committee with no success. 
 Hornby Islanders are frustrated with the boarding and offloading 
inconsistencies. Perhaps discontinuing the Hornby Island lane designation might 
reduce the perceived need to speed. 
 The Denman Island LTC solicited input as to the Hornby Island community’s 
position on the issue of a direct sailing to Hornby Island. 
 If Hornby Island joins Denman Island with their request that BC Ferries research 
a direct sailing schedule and cost for a trial period it might strengthen the 
initiative. 
 Trustee Allen commented that the Hornby Island community is divided on the 
issue of a direct sailing. To gather more information, he offered to canvas the 
Hornby Island community on an informal basis and, if a direct sailing is 
supported, could bring a motion to the Hornby Island LTC for action.
