[0:00:31] Voice 4: november the 30th it's so close to december here it's a little scary i'm solving it's on the back

[0:00:38] Voice 4: road from Ximénez I saw the Grinch and a sleigh on the side of the road. It's coming, it's a holiday season.

[0:00:48] Voice 4: Before we get too far along, I want to recognize that we're meeting here in Côte d'Azur

[0:00:54] Voice 4: territory. It's an opportunity to wake up every day here and be cognizant of the

[0:01:02] Voice 4: a long, long, deep history here, which has tragedy attached to it, as well as lots of

[0:01:11] Voice 4: other good things, and the continuity and resurfacing of culture that has been here

[0:01:18] Voice 4: for tens of thousands of years, and it's a pleasure to be able to participate in that

[0:01:24] Voice 4: and work towards reconciliation as an LTC and as a community, and we will continue to

[0:01:30] Voice 4: endeavor along that road um i'll introduce uh everybody in the table i'm going to start at

[0:02:11] Trustee Elliott (probable): acknowledgement in a roundabout way because this past week i've been listening to the 2023

[0:02:16] Trustee Elliott (probable): massey lectures on cbc radio and i've been enthralled and terrified by canadian american

[0:02:23] Trustee Elliott (probable): American documentary filmmaker, musician, and author, Afra Taylor, and her lectures on predatory

[0:02:30] Trustee Elliott (probable): politics and corporate finance schemes. And they're collected in a book entitled The Age

[0:02:36] Trustee Elliott (probable): of Insecurity, which perfectly describes how too many people feel in the world today.

[0:02:42] Trustee Elliott (probable): And over the past two months, I've also been reading some really interesting essays

[0:02:46] Trustee Elliott (probable): by Haudenosaunee people on the other side of this continent, and thinking about the many ways they

[0:02:52] Trustee Elliott (probable): honor a timeless way of understanding the human place in the natural world.

[0:02:58] Trustee Elliott (probable): My interest in reading and listening to First Nations stories have expanded over the past

[0:03:04] Trustee Elliott (probable): few years, particularly when I think of how I reside on Snuneymux territory, how I may

[0:03:12] Trustee Elliott (probable): honor reconciliation by taking care instead of taking more, and working to ensure we all

[0:03:19] Trustee Elliott (probable): We all feel secure in this place we call home.

[0:04:08] Trustee Elliott (probable): to join as a non-cinema member i i asked and they said i'd be welcome and it's been transformative

[0:04:14] Trustee Elliott (probable): So I'm going to try and just, just to say that we all can start somewhere. It's not, doesn't have to be perfect, doesn't have to be, you know, but we have to demonstrate our intent by trying on the right way. So here we go.

[0:05:54] Trustee Elliott (probable): There was an endeavor from truth to reconciliation.

[0:06:01] Trustee Elliott (probable): And it was Hul'qa Minim language classes.

[0:06:03] Trustee Elliott (probable): So we don't want to oppose.

[0:06:05] Trustee Elliott (probable): The teaching should be first the name of people first and revitalize this language for their

[0:06:11] Trustee Elliott (probable): people.

[0:06:11] Trustee Elliott (probable): absolutely but as as if they become available and that opportunity presents itself i know there's

[0:06:18] Trustee Elliott (probable): lots of gabriel of people who want to learn and i think that's our duty to learn the language of

[0:07:06] Voice 4: as culture has been for tens of thousands of years.

[0:07:09] Voice 4: years. So I really appreciate you making that effort. And indeed, we should be conscious

[0:07:45] Voice 4: the region thank renee for that management so welcome steven to your first in-person meeting

[0:07:51] Voice 4: of this ltc you joined us on lots of other meetings in the past so it's great um i also

[0:07:58] Voice 4: wanted to just recognize that we had a meeting two days ago which was a special local trust

[0:08:02] Voice 4: committee meeting just to get an update from marissa chadwick uh the planner responsible

[0:08:06] Voice 4: for the OCP work and we also had a presentation with respect to water work. It was a very detailed

[0:08:15] Voice 4: comprehensive presentation by William talking essentially about water budgets and water

[0:08:22] Voice 4: balancing and coming to understand what that means to Gabriola and Denman particularly

[0:08:28] Voice 4: with respect to land use development so that has happened prior to this meeting here today.

[0:08:35] Voice 4: um so um thank you everybody for joining us and um so we'll start off with our agenda i'll just

[0:08:42] Voice 4: ask if there's any additions or deletions to the agenda at this time okay there's a number of

[0:08:49] Voice 4: additional pieces of correspondence that have come in regarding a temporary use permit that

[0:08:53] Voice 4: are not on our agenda today and they are

[0:08:55] Voice 4: on our web tab and will be publicly available on the

[0:08:58] Voice 4: website in a new course as well as other materials that correspond particularly that gets applied to

[0:09:08] Voice 4: applications and ends up on the uh in the recording when it comes to us or is available

[0:09:13] Voice 4: on the website for you if you don't feed on today's agenda so um with that we'll adopt the

[0:09:20] Voice 4: agenda as uh presented by general consent and we'll move to trustees reports is the first thing

[0:09:26] Voice 4: And who would like to go first today?

[0:09:31] Trustee Elliott (probable): Okay, so Toby and I both attended a financial planning committee meeting on February 8th.

[0:09:39] Trustee Elliott (probable): And it was a long meeting.

[0:09:43] Trustee Elliott (probable): And that was in preparation for council's decisions on the unstressed budget coming up very soon.

[0:09:50] Trustee Elliott (probable): next week, in fact, is when we will do our almost finalized budget for 2024-25, I guess.

[0:10:00] Trustee Elliott (probable): We are looking at an increase in taxation, as every local government is, and we will be

[0:10:07] Trustee Elliott (probable): discussing it in detail next Tuesday, Wednesday, and Thursday. I

[0:10:13] Trustee Elliott (probable): was very grateful for my

[0:10:15] Trustee Elliott (probable): Co-Trustee Elliott's participation in that meeting, a big difference.

[0:10:21] Trustee Elliott (probable): I was going to mention the background notes that we got, information notes on Bill 44,

[0:10:27] Trustee Elliott (probable): the housing statutes, and Bill 35, Short-Term Rental Accommodation Act.

[0:10:33] Trustee Elliott (probable): They will have huge implications in British Columbia.

[0:10:36] Trustee Elliott (probable): And even though we, the local trust areas, for the most part, seem to be exempt from

[0:10:43] Trustee Elliott (probable): some of this, we are going to be discussing this in great detail as to how we may best make use

[0:10:50] Trustee Elliott (probable): of these new acts and the following regulations. I'm really actually feeling really positive about

[0:10:58] Trustee Elliott (probable): how they will help us. It's definitely a struggle in the island's trust area. Housing and short-term

[0:11:04] Trustee Elliott (probable): vacation rentals, of course, they are intimately tied together. One tends to preclude the other

[0:11:10] Trustee Elliott (probable): at school times so the other um really interesting event that i attended on monday was the regional

[0:11:19] Trustee Elliott (probable): district of nanaimo recreation and parks master plan meeting and we were discussing the what we

[0:11:26] Trustee Elliott (probable): heard summary report and that was it's it's a summary of public input over the past few months

[0:11:33] Trustee Elliott (probable): It was very

[0:11:34] Trustee Elliott (probable): informative. A few little surprises. I think one of my biggest surprises was that there was not, in this report, input from SNEMO First Nations, but that was answered immediately because at the meeting, Desiree Thomas attended from the land manager from SNEMO.

[0:11:55] Trustee Elliott (probable): up and um she was pretty direct about how they need to be included before these reports come out

[0:12:05] Trustee Elliott (probable): and they will be i there was they did a lot they are definitely they um i mean she pointed out you

[0:12:12] Trustee Elliott (probable): know we may not live here on gabriel in this local test area we may not live here uh visibly anymore

[0:12:19] Trustee Elliott (probable): more but that does not mean that we want to be uh to be regulated to be relegated to history and

[0:12:27] Trustee Elliott (probable): they are coming back to live here of course they will be coming back when they need to live um and

[0:12:34] Trustee Elliott (probable): as director craig uh pointed out a lot of the information in this report uh people commenting

[0:12:41] Trustee Elliott (probable): on water access, for example.

[0:12:45] Trustee Elliott (probable): Area B has not done a lot of development

[0:12:48] Trustee Elliott (probable): in the water access areas

[0:12:50] Trustee Elliott (probable): because those are the prime areas

[0:12:53] Trustee Elliott (probable): for historical First Nations existence

[0:12:58] Trustee Elliott (probable): and food gathering and transportation on the water.

[0:13:03] Trustee Elliott (probable): So that will be very interesting to see what comes of that.

[0:13:07] Trustee Elliott (probable): I'll just very briefly,

[0:13:09] Trustee Elliott (probable): there were there were like nine areas of really interesting sort of public comments sort of

[0:13:15] Trustee Elliott (probable): how they move them together but one of the most interesting ones to me was that people who lived

[0:13:22] Trustee Elliott (probable): in the gabriel the local trust area for less than a year have very different perspectives

[0:13:28] Trustee Elliott (probable): on recreation and park needs including paved trails and swimming pools so it would be interesting to

[0:13:38] Trustee Elliott (probable): see whether any of those desires change over the next little while and what we

[0:13:44] Trustee Elliott (probable): might do with them.

[0:13:44] Trustee Elliott (probable): There was very strong support for trails and accessibility and alternate transportation modes,

[0:13:56] Trustee Elliott (probable): being able to walk and cycle and hike all over the local test area. So I was really heartened

[0:14:04] Trustee Elliott (probable): to hear that and it was an excellent excellent meeting full participation from all of the

[0:14:12] Trustee Elliott (probable): agencies and people who disappointed so that was it was great to attend um oh right the fabulous

[0:14:23] Trustee Elliott (probable): meeting we had on november 28th on the water balance assessment i won't say much on that

[0:14:29] Trustee Elliott (probable): that, except for I really appreciated William Shergill's comments.

[0:14:34] Trustee Elliott (probable): He is the senior freshwater specialist who works for the Islands Trust.

[0:14:39] Trustee Elliott (probable): He works for other agencies as well.

[0:14:42] Trustee Elliott (probable): And he was so good about saying the climate emergency and reconciliation are

[0:14:49] Trustee Elliott (probable): essential for consideration of how we determine the water balance in this

[0:14:55] Trustee Elliott (probable): trussed area so water in water out and we have a responsibility i i really appreciated how william

[0:15:03] Trustee Elliott (probable): shelbert said we have a responsibility to the islands trust act to do the right thing when we

[0:15:10] Trustee Elliott (probable): are looking at how much water is available how much water is used and how we make land use

[0:15:17] Trustee Elliott (probable): decisions based on those so that that was just a great session i really appreciate that and i'll

[0:15:25] Trustee Elliott (probable): leave it at that over to you trustee oh yeah thank

[0:15:35] Trustee Elliott (probable): point there will be more discussion on um water balance assessments and so for those that didn't

[0:15:43] Trustee Elliott (probable): catch the special meeting two days ago um i encourage you to watch the recording because

[0:15:49] Trustee Elliott (probable): there was a focus on um the the reason gabriola as as a as a community might be ideally positioned

[0:15:59] Trustee Elliott (probable): to be a pilot project to develop the methodology for water balance throughout the island's trust

[0:16:06] Trustee Elliott (probable): area and so there's um so william chova and he's got really close relationships with the rdn he's

[0:16:13] Trustee Elliott (probable): spoke very highly of the RDN's data monitoring and we had some of the strongest in well we've

[0:16:22] Trustee Elliott (probable): got the best relationship with the RDN that I would trust local trust area has with any

[0:16:28] Trustee Elliott (probable): regional district and so we can work together with the RDN with the monitoring and the data

[0:16:34] Trustee Elliott (probable): that's been collected for over decades I guess and the six monitoring wells around the island

[0:16:40] Trustee Elliott (probable): mainland to understand how water is collected we know a lot about that what we need to do in this

[0:16:47] Trustee Elliott (probable): pilot project is understand how is it being used um where is it going what are the big users so

[0:16:54] Trustee Elliott (probable): that we can develop a plan to um to um to balance that creative budget it's called um so there'll

[0:17:03] Trustee Elliott (probable): be more discussion of that at trust council and susan and i will be advocating strongly for

[0:17:09] Trustee Elliott (probable): the 50 000 um is a proposed business case to do the water balance on gabriola i believe on

[0:17:17] Trustee Elliott (probable): potentially on denman no well focus on gabriola and this is part of our ocp review so we're going

[0:17:24] Trustee Elliott (probable): into our ocp review um next year we need to get the trustees support for that money because it's

[0:17:32] Trustee Elliott (probable): a decision of trust council and uh and so we'll be making the case that the water balance must be

[0:17:39] Trustee Elliott (probable): be included in that so and gabriella will provide an ideal template yeah so it's a really good

[0:17:45] Trustee Elliott (probable): conversation i encourage constituents to watch that if you're interested in water and how it's

[0:17:50] Trustee Elliott (probable): going to be it is critical to determining uh where we do more intensive development and where we don't

[0:17:58] Trustee Elliott (probable): want to develop so um i've participated in the gabriella health and wellness collaborative um

[0:18:04] Trustee Elliott (probable): the last couple of meetings and i brought forward an idea that i'd like to discuss at a later time

[0:18:12] Trustee Elliott (probable): in our agenda um i have a community uh gift to um and i sort of put the idea out there and i'm

[0:18:23] Trustee Elliott (probable): letting other community groups run with it so it's not a political thing at all but a community gift

[0:18:28] Trustee Elliott (probable): to the name and specifically the chief and council that have been serving for the last term because

[0:18:34] Trustee Elliott (probable): they're going into an election and just sort of recognizing their service to their community

[0:18:40] Trustee Elliott (probable): and in particular the elders who've been so kind and coming over and sharing teachings and doing

[0:18:47] Trustee Elliott (probable): protocol and openings and doing ceremony here so that's a discussion that's happening sort of as a

[0:18:54] Trustee Elliott (probable): community to community level and I wanted to chat about whether this LTC might consider that as a

[0:19:02] Trustee Elliott (probable): political body the chief and council sort of but we'll leave that discussion for later um i

[0:19:08] Trustee Elliott (probable): participated in financial planning committee meetings regional planning committee meeting

[0:19:12] Trustee Elliott (probable): conservancy meetings um executive committee meetings there's lots of meetings this month

[0:19:19] Trustee Elliott (probable): um i would say that the big news from the regional planning committee is the release

[0:19:25] Trustee Elliott (probable): of the housing toolkit and this is a significant piece of work that staff and I applaud the regional

[0:19:34] Trustee Elliott (probable): planning team Robert Kojima, Marissa and Sonia and many others worked on this and so it's basically

[0:19:43] Trustee Elliott (probable): a compendium of all the different policy and bylaw approaches that are have been tried might

[0:19:51] Trustee Elliott (probable): potentially be tried that LTCs can draw from as we go into our

[0:19:55] Trustee Elliott (probable): OCP process. So it includes tools like suitability, land

[0:20:00] Trustee Elliott (probable): suitable land analysis, and methodology for determining

[0:20:04] Trustee Elliott (probable): where to build, where not to build, and different policy

[0:20:07] Trustee Elliott (probable): options that you might want to put in your OCP so that you can

[0:20:11] Trustee Elliott (probable): draw from when the time's appropriate. So I won't go into

[0:20:13] Trustee Elliott (probable): it, but it's on the website. Now, if you go to affordable

[0:20:16] Trustee Elliott (probable): housing under the program section, it's a huge document,

[0:20:20] Trustee Elliott (probable): but really rich and I'm super proud of staff and the trustees who worked on that so

[0:20:28] Trustee Elliott (probable): oh yes and I've been participating culturally committed for the last year as you know and I

[0:20:36] Trustee Elliott (probable): do understand that this potentially is the group that's going to help trustees with our

[0:20:41] Trustee Elliott (probable): reconciliation learnings we've got three mentors who would be assigned to violence trust and work

[0:20:50] Trustee Elliott (probable): with us in the organization so that is also a big piece of work that it's taken a year so i made that

[0:20:56] Trustee Elliott (probable): motion to council in september saying we wanted a reconciliation committee to how we address all

[0:21:02] Trustee Elliott (probable): these complex interrelated issues it turned into a reconciliation learning group and um and i'm

[0:21:09] Trustee Elliott (probable): really pleased that culturally committed is is going to be working with us so that's coming in

[0:21:13] Trustee Elliott (probable): new year thanks so certainly what's going on back to you chair

[0:21:21] Voice 4: you with too much um um uh as a member of executive committee as toby is um we share the responsibility

[0:21:28] Voice 4: of uh being trustees on other islands and uh chairing those meetings and uh the two islands

[0:21:35] Voice 4: that i do uh chosen to do is gabriola and uh gambier so i've done a couple of meetings on

[0:21:40] Voice 4: Gambier and they're doing some important shoreline work over there. So I've attended those this past

[0:21:47] Voice 4: month. The session forum that I attended was ocean protection program by the federal government

[0:21:55] Voice 4: for Canada ostensibly dealing with all matters across the nation associated with the oceans

[0:22:02] Voice 4: and so that was an insightful forum. One of the best ones over the 12 years that I've been

[0:22:08] Voice 4: attending those i think that was the most interesting one that i have attended and in

[0:22:13] Voice 4: particular what has come out of that is um the incredible amount of work that is going on in

[0:22:18] Voice 4: collaborating and working with first nations to engage them in that that shared interest into

[0:22:24] Voice 4: oceans uh surrounding canada um and they've established a uh a new uh strategy they call

[0:22:32] Voice 4: it actually rather than calling it a form because i think there's some confusion over the naming

[0:22:35] Voice 4: But they call it now the Coast Salish Strategy, which is going to be bringing together agencies and bodies to develop strategies for ongoing protection and conservation of the marine environment.

[0:22:47] Voice 4: And I'm hoping that the Onstrup will be involved in that as well.

[0:22:51] Voice 4: And so that's coming.

[0:22:53] Voice 4: In the intervening number of weeks, as Toby has said, there's been many meetings.

[0:22:58] Voice 4: And that's all in preparation of us getting to Trust Council, which is December 5th to 7th in Victoria.

[0:23:04] Voice 4: Victoria, you're welcome to join us, either electronically or in person down there.

[0:23:08] Voice 4: There's a limited amount of public space there, but we always enjoy having folks attending

[0:23:13] Voice 4: if you happen to be in Victoria.

[0:23:17] Voice 4: I want to also note that our annual report, long and slow in its processes, finally ended

[0:23:33] Voice 4: Islands Trust whenever there's an opportunity. I also had the chance to meet with Minister Khan

[0:23:38] Voice 4: and a number of other ministers by chance that I've gotten to know over the years that I've been

[0:23:44] Voice 4: the chair of trust council and repeated the invitation to our minister to attend council

[0:23:51] Voice 4: in the future. She has again confirmed her interest in doing that. So that might happen

[0:23:56] Voice 4: in a year, which would be a great opportunity for our council to meet the minister in person

[0:24:01] Voice 4: and and have and have that kind of a conversation she

[0:24:04] Trustee Elliott (probable): wants to come to

[0:24:05] Trustee Elliott (probable): one of the islands right

[0:24:09] Voice 4: that's up to council um and then ultimately in the end but um we'll see how that all goes right

[0:24:16] Voice 4: i think she looks after her own travel stuff change probably won't be

[0:24:20] Voice 4: but anyway uh we've been uh extended a sector second time an invitation for her to join us

[0:24:26] Voice 4: And we did have conversations about the most recent legislation amendments in housing, and that certainly there's interest in the islands.

[0:24:34] Voice 4: Above that, although we've been not included, there are options for us to participate in this, and we'll see how that all unfolds for the future.

[0:24:44] Voice 4: at the provincial level, that's for sure.

[0:24:46] Voice 4: So that's it for me and my reporting.

[0:24:53] Voice 4: Before I turn it over here, I just want to say that echoing what the trustees have said about willing to share those remarks about working with the Niagara Regional District.

[0:25:05] Voice 4: And I think what's significant about that is acknowledging that the area directors that have represented Gabrielle Island on the regional district for many, many years have obviously facilitated the regional district recognizing what's important over here and establishing budget and making these things happen.

[0:25:26] Voice 4: because it doesn't just happen everywhere across the Alps Trust.

[0:25:30] Voice 4: Some islands don't get very much attention at all or the representation is limited.

[0:25:35] Voice 4: But having your own elected representative here on Gabriel, I think really has paid off.

[0:25:41] Voice 4: And of course, Vanessa, you're doing some amazing work for the community here as well as wearing the hat as the regional district chair.

[0:26:22] Trustee Elliott (probable): potentially parks or trails on the island as well as an analysis current recreation facilities and

[0:26:36] Trustee Elliott (probable): join us um for the advisory committee uh she was appointed um a while ago by a chief uh chief wise

[0:26:44] Trustee Elliott (probable): and um so it was really great to to have her there and i think it's um it's going to give us

[0:26:52] Trustee Elliott (probable): a different area of conversation and communication that information will start happening directly as

[0:27:00] Trustee Elliott (probable): well so that was um that was good to see her there um the water budget it's it's great to hear that

[0:27:08] Trustee Elliott (probable): you're going ahead with the broader budget we're actually going to be starting the third water

[0:27:11] Trustee Elliott (probable): budget for the rdn um in the area we're just finishing up area g and area a is next on the

[0:27:20] Trustee Elliott (probable): list so those were the three areas with what were considered vulnerable aquifers and water systems

[0:27:26] Trustee Elliott (probable): and so yeah it's quite an in-depth report so if you wanted to see the ones that the rdn has done

[0:27:31] Trustee Elliott (probable): for some of the areas they're on the on the website and it looks at that uh that's the

[0:27:37] Trustee Elliott (probable): spectrum of where the water is coming from how it's flowing you know where is it going um those

[0:27:42] Trustee Elliott (probable): types of things and then how would it be used to go to uh go to your point um the the other thing

[0:27:50] Trustee Elliott (probable): that we're coming up with that i've been working on for quite a bit is the proposed new health and

[0:27:54] Trustee Elliott (probable): well-being coordinator for gabriela so we are a draft bylaw came to the board and we did approve

[0:28:00] Trustee Elliott (probable): it so it's at the ministry municipalities for approval um every new service like this has to

[0:28:06] Trustee Elliott (probable): have its own bylaw that's part of the way the regional district any regional district has the

[0:28:11] Trustee Elliott (probable): governance so it's all service oriented so every service has its own bylaw

[0:28:18] Trustee Elliott (probable): approved by the minister we would go into an aap an alternative approval process in the new year

[0:28:25] Trustee Elliott (probable): which is basically another word for it is called a counter petition so it will provide information

[0:28:31] Trustee Elliott (probable): and we've had numerous public engagement but there'll be additional public engagement and

[0:28:37] Trustee Elliott (probable): if you're opposed to the creation of this new position and service on the island you would

[0:28:42] Trustee Elliott (probable): submit a form by either email fax mail in person it will be fairly open how you manage to register

[0:28:49] Trustee Elliott (probable): register your opposition and then if um I think they've calculated the number of electors that

[0:28:57] Trustee Elliott (probable): we need to to um respond to the survey at 300 and I think it's 392 it might be might be lower than

[0:29:07] Trustee Elliott (probable): that and then um that's ten percent and then if there's more than ten percent of the population

[0:29:14] Trustee Elliott (probable): relationally registered electors that are qualified electors, then you'd be able to

[0:29:19] Trustee Elliott (probable): either move to a full referendum or, you know, reconsider the program.

[0:29:24] Trustee Elliott (probable): So one thing I wanted to highlight is because of the way that AAP go, AAPs go, the question

[0:29:32] Trustee Elliott (probable): will ask about a full amount for a full-time position, whereas we're only planning to start

[0:29:38] Trustee Elliott (probable): for a part-time position to do it as a pilot project and see how it facilitates work within

[0:29:44] Trustee Elliott (probable): the community. But if you were to increase it within five years, you'd have to go back through

[0:29:51] Trustee Elliott (probable): the process. And so just to give more flexibility, an example is when we did Gertie Bus when we had

[0:30:00] Trustee Elliott (probable): uh referendum in 2016 i believe it was for up to 250 000 and we're not there yet and that's seven

[0:30:07] Trustee Elliott (probable): years ago so it would be a referendum asking for authorization up to a certain amount but we

[0:30:13] Trustee Elliott (probable): wouldn't start at that amount for 2020. so

[0:30:17] Trustee Elliott (probable): uh i mean i could continue talking we're a deep in

[0:30:20] Trustee Elliott (probable): budget conversation very well we're having a special budget meeting next week um but uh

[0:30:34] Trustee Elliott (probable): might um the protocol meeting that all three four of us were and so finally the RDM and the

[0:30:41] Trustee Elliott (probable): we had our protocol meeting which is supposed to happen once annually and I don't know if it

[0:30:47] Trustee Elliott (probable): has been uh we didn't meet last year it's actually up to twice it's up to twice yeah

[0:30:53] Trustee Elliott (probable): So that was a really good meeting in which we discussed housing approaches.

[0:31:01] Trustee Elliott (probable): that involves the regional district and the local traffic area where we can support each other.

[0:35:29] Voice 12: um the title of what i'm going to say is why does gabriela need a transportation commission

[0:35:36] Voice 12: gabriela doesn't need a transportation advisory planning commission all in capitals

[0:35:43] Voice 12: but we do need a body that is made up of dedicated gabrielans that have expertise in

[0:35:49] Voice 12: various aspects of transportation fairies vehicles on roads transit taxis roadside trails sidewalks

[0:35:59] Voice 12: and off-road connecting trails and the time activity that also has the time to work on

[0:36:07] Voice 12: gabriel's specific transportation issues and this is the most important part that also has some

[0:36:15] Voice 12: standing in the eyes of governing agencies like the ministry of transportation infrastructure

[0:36:20] Voice 12: infrastructure, the regional district, the NIMO, excuse me, and the Iowans Trust.

[0:36:28] Voice 12: Many Gabriola organizations have and continue to study transportation issues,

[0:36:35] Voice 12: petition for changes and make things happen.

[0:36:37] Voice 12: And to the note taker, I will give you this.

[0:36:41] Voice 12: Some examples include Sustainable

[0:36:46] Voice 12: Gabriel with its climate 12 initiative that's still ongoing the cycle paths that wrote this

[0:36:53] Voice 12: document in 2010 which is now part of the official community plan and it talks about shared roadways

[0:37:01] the

[0:37:01] Voice 12: village vision planning commission committee sorry commission

[0:37:07] that wrote his final report in 2017 which was taken by the local trust committee

[0:37:18] Voice 12: The Gabriela Community Bus Foundation that has operated the Gurney Bus since 2013 at arm's length from, but with support from, the Regional District of the Nanticoke, and it's a good

[0:37:32] Voice 6: example of the Gurney Bus.

[0:37:33] Voice 6: us. The

[0:37:38] Voice 12: Gabriola Land and Trails Trust, which has done amazing work on this island, creating

[0:37:46] Voice 12: trails for recreational use, but some of those trails are also part of our transportation

[0:37:50] Voice 12: network. So lots of different groups have done lots of great things around transportation,

[0:37:56] Voice 12: all of them are going to take groups. We need a transportation body with credibility and

[0:38:02] Voice 12: standing so that agencies that make decisions for us regarding road maintenance, speed limits, lane

[0:38:08] Voice 12: widths, shoulder widths, sidewalks, crosswalks, roadside trails and bicycle and footpaths have a

[0:38:15] Voice 12: credible body from which to seek advice and an obligation to do that so that they can learn what

[0:38:23] Voice 12: it is that Gabrielians actually need rather than just what they think. I know you're thinking we

[0:38:33] need to have a formal

[0:38:34] Voice 12: body in order for this to happen but I'll give you an example of one that

[0:38:39] Voice 12: works that is not formal and that is the ferry advisory committee or the ferry advisory

[0:38:45] Voice 12: committees around this coast.

[0:38:48] Voice 12: BC Ferries is perfect, we all know that.

[0:38:52] But they know that they don't know enough

[0:38:56] Voice 12: about each individual island's needs.

[0:38:59] Voice 12: And so they've established the ferry advisory committees to provide advice

[0:39:03] Voice 12: and to act as a conduit for feedback from the public.

[0:39:08] Voice 12: So I urge the LTC to either create a Transportation Advisory Planning Commission

[0:39:15] Voice 12: or better still work with RDN and MOTI and with transportation related

[0:39:21] Gabriel organizations

[0:39:23] Voice 12: to create a transportation advisory committee this falls under the LTC's

[0:39:30] Voice 12: mandate because it is for the trust that holds the agreement with the Ministry of Transportation

[0:39:37] Voice 12: on our road standards and so on and because the LTC has a responsibility to make decisions that

[0:39:45] Voice 12: reduce our contribution to climate change. Transportation is our greatest source for

[0:39:51] Voice 12: greenhouse gas emissions. So I am asking you, the LTC, to help us, local organizations,

[0:39:59] Voice 12: to form a credible Transportation Committee and then help make it work by ensuring that

[0:40:06] Voice 12: the Committee has a role in improving any transportation-related work that gets done.

[0:40:12] Voice 12: i'll be there thank you thank

[0:40:42] Trustee Elliott (probable): But if we do this through the Gabriel Island Local Trust Committee, it has to be a formal transportation advisory planning committee, and it has to follow the guidelines that our committees have to use.

[0:40:57] Trustee Elliott (probable): So you have to have public meetings, and you have to have a minute taker, and you have to follow APC guidelines.

[0:41:03] Trustee Elliott (probable): And normally, you would get a referral from a local trust committee.

[0:41:06] Trustee Elliott (probable): But I do believe, just like the Housing Task Force worked independently and very productively,

[0:41:12] Trustee Elliott (probable): that you could do the work

[0:45:13] Voice 8: Thank you for receiving me. My name is Stephen Usher. I'm a hydrogeologist, a fellow that studies groundwater, and I was much encouraged when I found that we were looking at the water budget issue through the Islands Trust, because that's a good place for it.

[0:45:30] Voice 8: um the reason i chose to come today is i have probably 30 years experience doing water budgets

[0:45:37] Voice 8: in other jurisdictions and have indeed done some in british columbia notably called cobble hill

[0:45:43] Voice 8: three or four years ago and so i have it's really close to my heart i'm a resident on the island

[0:45:49] Voice 8: here and i just wanted to commend you for uh putting the water budget forward um i get have

[0:45:55] Voice 8: the opportunity of giving in this room a public presentation on the geology and groundwater of

[0:46:02] Voice 8: the island from my perspective as a resident and applying my science to where I'm living

[0:46:07] Voice 8: and I have a rather pleasant conclusion in that when I looked at the amount because the water

[0:46:15] Voice 8: budget is what's available and in this case on an island it's what's coming from the sky

[0:46:19] Voice 8: getting into the ground and then what's the use and what's the potential use

[0:46:24] Voice 8: and also what the I don't mean to lecture you your own papers talk about this it's very good

[0:46:30] Voice 8: and then what is contributing to the ecosystem and how all those things are linked so water

[0:46:37] Voice 8: taking can be very site specific but it has to be thought of regionally so I'm interested in what

[0:57:47] Voice 2: that have an ARC site and my understanding is it hasn't been formalized but my understanding

[0:57:52] Voice 2: is the branch responded didn't have any concerns and I'm not sure what

[0:58:01] Voice 10: the trust's position

[0:58:03] Voice 10: is with respect to the other issues we're raising that resolution and it would be helpful

[0:58:08] Voice 10: to know because I know what

[0:58:10] Voice 2: remaining issues are in front of us. So I think one of the issues was

[0:58:16] Voice 2: whether the trust had the jurisdiction to be able to issue a deed over archaeological lands

[0:58:24] Voice 2: and I'm assuming that's been addressed by

[0:58:26] Voice 10: the Heritage Branch or by the legal department and

[0:58:30] Voice 10: my understanding is the conclusion is the trust can issue a development permit and as I've tried

[0:58:36] Voice 10: to say before my understanding is

[0:58:39] Voice 2: an active specific that AEDP is still subject to the

[0:58:45] Voice 2: protections of the heritage conservation so that

[0:58:51] Voice 10: kind of leads me to I'm

[0:58:53] Voice 6: going to skip through

[0:58:53] Voice 6: some of this it may not be important um I've

[0:59:04] Voice 5: expressed before that I am concerned about the

[0:59:09] Voice 5: public protection. And the

[0:59:13] Voice 10: protection, when I looked at the meeting by video, I

[0:59:17] Voice 2: actually saw

[0:59:18] Voice 2: the public comments at the last meeting. And the

[0:59:24] Voice 6: sense I have is that public protection from these

[0:59:27] Voice 6: meetings that the sites are not protected. And I think it's important to reconfirm again

[0:59:36] Voice 6: that our position isn't to not protect the sites. Our position is we've done everything we can

[0:59:45] Voice 10: And with any information we have, we've developed the site in a way that all of these sites are protected naturally by being placed on one large lot, by having covenants.

[1:00:00] Voice 10: but the grants that would be ready for the public and when I say this public perception issue I

[1:00:08] Voice 10: think the example is that at the last meeting a lady got up I think her name was Sybil Frey

[1:00:14] Voice 10: I couldn't quite hear her in the notes but I think it was Sybil Frey and I heard that she suggested

[1:00:22] Voice 10: that the DG bylaw wasn't satisfactory because the first patients hadn't been consulted when it was

[1:00:29] Voice 10: was created.

[1:00:30] Voice 10: And I think she was suggesting that the trust not issue a DP

[1:00:35] Voice 10: until that consultation took place.

[1:00:37] Voice 10: Or if they were going to issue it,

[1:00:39] Voice 10: they have conditions on it that would require

[1:00:43] Voice 2: monitoring.

[1:00:46] Voice 2: I think she went as far as to say

[1:00:48] Voice 2: that it should require the presence of the archaeologist

[1:00:53] Voice 2: from the Senegal.

[1:00:54] Voice 2: And

[1:00:55] Voice 6: I think what perhaps she missed, and

[1:01:01] Voice 10: leaves on the record missed, is that all of those

[1:01:04] Voice 10: protections are there under the heritage contribution.

[1:01:08] Voice 10: And when work is to be done in an area

[1:01:14] Voice 6: that might be impacted by work, the heritage branch

[1:01:20] Voice 6: requires its own conditions, one

[1:01:24] Voice 10: of which is site monitoring by First Nations cultural

[1:01:28] Voice 10: monitors. And others may be other requirements of our own archaeologists,

[1:01:34] Voice 2: but I've never seen

[1:01:36] Voice 2: a requirement that compels us to hire and pay for an archaeologist from the First Nation.

[1:01:43] Voice 10: To me it's always been our archaeologists in conjunction with the monitors presenting all

[1:01:52] Voice 10: of the information to the heritage branch

[1:01:54] Voice 10: and under their direction.

[1:01:57] Voice 10: So I

[1:01:58] Voice 10: just want to make sure that

[1:01:59] Voice 10: if

[1:02:00] Voice 5: there's

[1:02:01] Voice 2: any misprotection,

[1:02:03] Voice 2: one is, and I think we've expressed it before,

[1:02:07] Voice 2: we respect the First Nations history and culture here

[1:02:37] Voice 10: and I'm anticipating, I don't know for sure, because then I don't make them back and say they

[1:02:43] Voice 10: don't have any more concerns about the protections that they think is sufficient. So the

[1:02:50] Voice 5: The objection is that all of the sites are protected by all of the methods we've done to do that.

[1:03:03] Voice 5: And I think that the by-law, when it was created,

[1:03:08] Voice 10: although it didn't

[1:03:10] Voice 2: consult the First Nations in those days, that wasn't required.

[1:03:13] Voice 2: I'm not sure it is now required, but it's certainly a good part of reconciliation.

[1:03:17] Voice 2: reconciliation.

[1:03:20] Voice 6: That misses the bigger part of the issue, that

[1:03:24] Voice 2: when that was created,

[1:03:26] Voice 5: the

[1:03:27] Voice 2: Heritage Conservation Act was also created. And so your bylaw, in my opinion, doesn't

[1:03:35] need to have these criteria in it, because they're

[1:03:39] Voice 2: already in place with heritage conservation.

[1:03:41] Voice 2: So the issue, what I'm feeling is, I may be wrong here, but I think the trust is trying

[1:03:49] Voice 2: trying to engage with the First Nation to better understand if there's other protections

[1:03:58] Voice 2: they require that may or may not be in place with the Heritage Conservation Branch.

[1:04:04] Voice 2: And in 20 years of dealing with the First Nation and the sub-nations, there's been three

[1:04:11] Voice 2: applications, three referrals to the First Nations, three AIAs, monitoring by the First

[1:04:21] nation but quite happily having them there frankly and

[1:04:26] Voice 10: i've never heard one objection or concern

[1:04:30] Voice 10: that the sites

[1:04:33] Voice 2: need some extra protection forward about what's been presented so and

[1:04:40] Voice 2: it's from a positive point i want to say that's where our frustration is not having the information

[1:04:48] Voice 2: after all these years, and we can't

[1:04:53] Voice 10: even, we've tried to think of every possible way

[1:04:55] Voice 10: we can protect these settlements.

[1:04:57] Voice 10: We haven't gone way past what the Heritage Protection Station had required.

[1:05:03] Voice 2: We thought we had support of the First Nation, apparently not, and the sooner they can tell

[1:05:11] Voice 2: us what other protections they might need, the sooner we know whether we can do that

[1:05:17] Voice 2: or not.

[1:05:19] Voice 2: but we do think that

[1:05:21] Voice 10: all those protections are the responsibility and the jurisdiction of the

[1:05:26] Voice 10: heritage conservation branch.

[1:05:28] Voice 2: That doesn't mean that the first legion should be engaged by the

[1:05:32] Voice 2: trust heritage

[1:05:34] Voice 10: branch or by the province of the British Columbia, all of whom have the same

[1:05:39] Voice 10: obligation and are in the middle of that process too. I think that's the principal comment. I hope

[1:05:48] Voice 10: I hope I haven't said the thing there that is thought to be an issue of the Morgan Orguin

[1:05:55] Voice 10: or of the interests of the First Nation

[1:05:58] Voice 11: are frustrated simply as we have

[1:06:02] Voice 2: time getting the First Nation to be specific rather than general about the concerns we

[1:08:21] Trustee Elliott (probable): help clarify our legislative framework so that we can do justice to landowners and to Indigenous

[1:08:34] Trustee Elliott (probable): landscape now than 20 years ago when those laws were created. So we're struggling with this. We

[1:13:16] Trustee Elliott (probable): and definitely uh since i was 20 years old when i started helping first nations people

[1:13:26] Trustee Elliott (probable): people on their path to claiming their status and then helping the First Nations with which

[1:13:35] Trustee Elliott (probable): artists is familiar with the elites in First Nation. Chief Rocky turned out eventually

[1:13:41] Trustee Elliott (probable): to be Chief Rocky Wilson with whom I worked and with whom I did consultation work in the

[1:13:48] Trustee Elliott (probable): Huffington treaty group. So this is not news to me. I have a library of probably 2,000 books,

[1:14:00] Trustee Elliott (probable): Indigenous authors, Indigenous topics, Indigenous information that I've collected over the years.

[1:14:15] Trustee Elliott (probable): My husband and I raised our granddaughter, and she grew up a lot of the time on Gabriel Island

[1:14:23] Trustee Elliott (probable): of listening and was very much affected by the mouse woman and that which um as to who created

[1:14:36] Trustee Elliott (probable): it etc is in my opinion and from my understanding from other elders uh over the debate or

[1:14:46] Trustee Elliott (probable): pornography uh my granddaughter was so concerned over her grandfather's condition

[1:14:53] Trustee Elliott (probable): through this stress, because you're bankrupting us,

[1:15:00] Trustee Elliott (probable): that she wanted to come and speak to you today.

[1:15:03] Trustee Elliott (probable): But she can't because she's in Ottawa.

[1:15:08] Trustee Elliott (probable): Because she's on the Hill meeting with Prime Minister

[1:15:10] Trustee Elliott (probable): Kudo's staff regarding Indigenous youth.

[1:15:17] Trustee Elliott (probable): She is, I haven't got it all, but she is the co-chair,

[1:15:24] Trustee Elliott (probable): She's the youth advisor to the Fraser Regional Aboriginal Friendship Centre Association.

[1:15:31] Trustee Elliott (probable): She's the national youth executive for the Association of the Friendship Centres and

[1:15:36] Trustee Elliott (probable): the Board of Directors of the National Youth Council.

[1:15:40] Trustee Elliott (probable): She's the Surrey Indigenous Youth Advisory Council, i.e. she works with the City of Surrey,

[1:15:50] Trustee Elliott (probable): She's the co-chair of the Surrey Urban Indigenous Leadership Council.

[1:16:03] Trustee Elliott (probable): She sat on the board as an Indigenous representative for the Board of Governors for Kwantlen University.

[1:30:45] Voice 11: know what to do they're just heading for the light i see that there was a thing to protect the bats

[1:30:50] Voice 11: and i'm going well they're one of the vulnerable ones for this lighting too because they don't

[1:30:55] Voice 11: there's too much light and so it's an ongoing process that's very damaging to our psyche

[1:31:01] Voice 11: because when you use certain types of light people will not be able to sleep afterwards

[1:31:06] Voice 11: the blue light wakes people up and yellow light relax person and so there's so many

[1:31:13] Voice 11: involvements with this different thing so i'd like to hear more about it about what you think

[1:31:17] Voice 11: about it i hear that you say that you've seen some information maybe this island you're talking

[1:31:21] Voice 11: about and go online so i would like to be able to introduce the idea to the rest of the residents of

[1:31:29] Voice 11: the violence so that we know that we're damaging each other's i

[1:31:36] Voice 4: would just say you're free to do

[1:31:38] Voice 4: any public consultation as an individual block within the community there are working groups

[1:31:43] Voice 4: that we're planning on establishing you can see that in our agenda where there would be

So it's, you know, this is all a bit of an experiment for us. We've never done anything like this in the Islands Trust.

[2:46:33] Planner Chadwick: but it's looking, you know, we have like, you know, staff are feeling pretty confident about

[2:46:38] Planner Chadwick: the process, just seeing the kind of, you know, the caliber of applications that we got

[2:46:45] Planner Chadwick: and the kind of enthusiasm that's out there. So the memo that you have before you identifies

[2:46:50] Planner Chadwick: the folks that have, that are receiving funding. So all of the, all of the applicants that we

[2:46:59] Planner Chadwick: received were um have received uh some amount of funding um so that's it's nice not to have to turn

[2:47:08] Planner Chadwick: anybody away um they're all they're all um a good good ones so um you can see you can see the people

[2:47:16] Planner Chadwick: the names in front of you there so it's it's over a dozen i think it's about 15 there i did count

[2:47:21] Planner Chadwick: um it was also pointed out um to us by community members that uh you know maybe there are some

[2:47:28] Planner Chadwick: people that aren't being captured by this process which is we didn't expect that everybody would be

[2:47:32] Planner Chadwick: captured through this process um and staff are actually making some efforts to reach out to

[2:47:37] Planner Chadwick: um some of the gaps that that um kind of are are sort of clear to us so we uh we're looking at a

[2:47:44] Planner Chadwick: process which will engage um um uh some children teens uh seniors um um uh one of our staff members

[2:47:58] Planner Chadwick: we'll we'll visit the the is it the soup kitchen the food bank or

[2:48:06] Planner Chadwick: whatever whatever it's called

[2:48:07] Planner Chadwick: yeah so so yeah so Chloe our assistant planner is very engaged in the community so is going to

[2:48:16] Planner Chadwick: to help us with reaching some of those other groups in this visioning process so that's

[2:48:20] Planner Chadwick: that's that's also very exciting yeah so we've we're also working on some communications

[2:48:28] Planner Chadwick: We have the intention to do some video communications on some very specific questions, like what is a visioning process, for example?

[2:48:40] Planner Chadwick: What is an OCP? What is a land use bylaw?

[2:48:44] Planner Chadwick: So just some of the questions that people might have so that when we get to engaging further,

[2:48:50] Planner Chadwick: further, you know, folks will have an opportunity to, you know, watch a small video so that

[2:48:56] Planner Chadwick: they're aware of the things that we're talking about and how they can become engaged.

[3:29:33] Trustee Elliott (probable): that reflect the trust council's priorities and I know there's strategic planning coming up so

[3:29:40] Trustee Elliott (probable): all of that is is looking at it through policy statements support so this is a good way to

[3:29:48] Trustee Elliott (probable): have conversations and encourage these conversations but I was trust back to happen

[3:30:53] Voice 4: to implement it and so it's it really is a conversation that's evolving we're going in

[3:30:58] Voice 4: the right direction at the pace that is sustainable by all of us um certainly there's some

[3:31:04] Voice 4: shortage capacity shortfalls on our side but um the work is happening staff are on it and then

[3:31:10] Voice 4: there's a number of staff members i'm not going to name by name at the moment um is that are doing

[3:31:15] Voice 4: tremendous work

[3:31:17] Voice 4: i really feel good about it actually so what would you yeah

[3:54:27] Trustee Elliott (probable): law. The big update for this DAI bylaw, maybe call it a rewrite instead and give that the attention

Trustee Yates reported the following: 
 Attendance at the recent Financial Planning Committee meeting in preparation for 
Trust Council’s upcoming budget decisions, the Regional District of Nanaimo (RDN) 
Recreation and Parks Master Plan meeting in which public input summary reports

were reviewed, and a meeting on water balance assessment presented by Senior 
Freshwater Specialist William Shulba; and 
 She noted that the Local Trust Committee (LTC) will be discussing the possibility of 
inclusion in Bill 44 (Housing Statutes Amendment Act) and Bill 35 (Short-Term Rental 
Accommodations Act).  
 
Trustee Elliott reported the following: 
 Attendance at the LTC Special Meeting to discuss the water balance assessment, 
noting that the public can view the recording of the meeting that will be available 
on the LTC website for further information; 
 Attendance at the Health and Wellness Collaborative, Financial Planning Committee, 
Regional Planning Committee, RDN Recreation and Parks Master Plan, and Islands 
Trust / RDN Protocol meetings; and 
 She continues to participate in the Culturally Committed group gatherings. 
 
3.2 Chair's Report 
Chair Luckham reported the following: 
 He also Chairs Gambier Island LTC meetings and noted that island is doing important 
shoreline work; 
 He attended a presentation on the Ocean Protection program that is being 
developed by Transport Canada to deal with nation-wide matters concerning 
oceans; and 
 He attended at the legislature when the Islands Trust annual report was put onto 
the floor and spoke with the Minister of Municipal Affairs, Anne Kang, whom he 
invited to attend a Trust Council meeting. 
 
3.3 Electoral Area Director's Report 
Electoral Area Director Vanessa Craig submitted a written report for information and 
noted the following: 
 Desiree Thomas, Snuneymuxw Frist Nation, has been appointed to the Recreation 
and Parks Master Plan Committee; 
 The RDN will be starting a water budget analysis in Area A; and 
 The proposed new Health and Wellbeing Coordinator for Gabriola part-time 
position has been approved by the RDN and is under consideration for approval by 
the Ministry of Municipal Affairs and, if approved, will enter into an alternative 
approval process, which will provide opportunity for additional public engagement. 
 
3.4 First Nations Reports - none 
Trustee Elliott noted the Snuneymuxw Frist Nation publishes a monthly newsletter,

4. PUBLIC COMMENTS 
 A member of the public stated that Gabriola requires a body made up of dedicated 
community members that have expertise in various aspects of transportation. This 
transportation body requires credibility and standing so that agencies that make decisions 
regarding road maintenance, speed limits, sidewalks, roadside trails, and bicycle and 
footpaths have a credible body from which to seek advice. They urge the LTC to create a 
Transportation Advisory Planning Commission. 
 A member of the public introduced themselves as a retired hydrologist and noted they have 
extensive experience in doing water budgets in other areas. They indicated that, in their 
opinion, there is more than enough water on the islands, but the issue is lack of water 
storage. They are encouraged to learn that there will be consideration of a water balance 
assessment in the upcoming budget. 
 A member of the public noted that they had an application for redevelopment before the 
LTC and had previously been granted an extension to submit required reports. They stated 
that the reports were now available and requested the LTC move the extension into the new 
year. 
o Staff replied that the reports had been received but not soon enough for discussion 
at today’s meeting; however, the deadline period can be extended. 
 A member of the public expressed disappointment that their development application was 
not on the agenda. They noted they have respect for the process and if there are any 
concerns brought forward by First Nations regarding artifact protection they would like to 
know what those concerns are so that they can address them. They also indicated that the 
public might believe that the sites are not protected; however, all the protections required 
under the Conservation Act and the Heritage Branch are in place. It was reiterated that First 
Nations representatives conducted site monitoring at the time the protections were put into 
place.   
 Another member of the public, who is part of the same development permit application, 
stated the ongoing delays are causing the applicants hardship. They noted that they have 
practiced First Nations reconciliation throughout their life’s work, and that their 
granddaughter works extensively as a representative on multiple committees as an 
Indigenous youth advisor. They indicated that they have been told repeatedly that they 
would receive a decision at a following LTC meeting; however, this has not occurred. 
 A member of the public stated that they had submitted correspondence regarding light 
pollution and the Chair noted they would receive and review when it comes up on the 
agenda.

 A draft report on the June 8, 2023 Activity No. 1 (shoreline structures and setbacks 
bylaw) has been prepared and will be ready for presentation at an upcoming 
meeting.

Status Update 
A Planner provided a verbal update. It was noted that an environmental impact report 
and additional supporting documents had been received and are under review. Staff 
and Trustees will conduct a site visit and share information about the applications with 
the Snuneymuxw First Nation. 
 
8.2 GB-DVP-2023.3 (Miller) - 880 Horseshoe Rd - Request to Waive Survey Requirement - 
Staff Report 
A Planner summarized the staff report and the Bylaw Compliance and Enforcement 
Manager confirmed that the shed in question was not over the lot line. 
 
The applicant was present and indicated that the shed was built over 30 years ago, that 
it is not over the property line, and that the owner of the neighbouring property had a 
survey done in 2018 as part of a development permit application and at that time did 
not mention a concern about the location of the shed. 
 
Discussion ensued.

A Planner summarized the staff report and highlighted the following: 
 The setback variance application relates to the existing cottage, deck, tent platform 
and underground septic tank;

 The variance is consistent with the permitted uses of the lot; 
 Granting the variance will not be detrimental to the natural environment or public

Discussion ensued and it was noted that: 
 Most letters received that were not in favour of the variance permit were related to 
health concerns about the septic system being sited too close to the sea; however, 
the septic field is 35 metres above the setback which meets requirements; 
 Provincial sewerage requirements are being met for this lot; 
 It is the septic tank that is sited within the setback area not the field; and 
 The system is an updated septic-engineered system.

9.1 Major Project: Gabriola Island Comprehensive OCP and Land Use Bylaw Review: 
Results of Community Engagement Event Recipients – Memorandum 
 
A Planner highlighted the following: 
 Funds have been made available to support community members in hosting 
engagement events; 
 Several applications were received, and the memorandum identifies the individuals 
and groups that will receive the funding; 
 Some community members have not been captured in this process and staff will 
facilitate meetings with those groups that are underrepresented; 
 There will be a series of videos released which will focus on specific topics of 
interest to the community such as identifying what a community vision is, what land 
is, what an OCP is, and what a LUB is; and 
 Postcards with QR codes directing people to the project website, as well as a survey, 
will be sent out. 
 
9.2 Major Project: Gabriola Island Comprehensive OCP and Land Use Bylaw Review: 
Gabriola Visioning - Verbal Update 
 A Planner provided a verbal update and stated that the deadline for feedback from the 
engagement groups and survey responses has been extended to March 1, 2024.

Trustee Yates noted that the current system of determining Advisory Planning 
Commission (APC) meeting dates is inefficient and suggested that the APC determine a 
regular monthly meeting day and time each month and if there are no referrals to 
review the pre-scheduled meeting can be cancelled.

Trust Council. 
 
Trustee Elliott said that she will be putting together a gift to present to the outgoing 
Snuneymuxw First Nation Chief and Council as a gesture of thanks and for their work.
