[0:00:24] Trustee Luckham: Thetis Island is in Coast Salish Territory, Lyakson and Penelakut people's lands that I
[0:00:30] Trustee Luckham: enjoy living on and I'm grateful for that and broadly across the Coast Salish Territory we're
[0:00:37] Trustee Luckham: pleased to be able to live here but want to recognize the Coast Salish people that have
[0:00:43] Trustee Luckham: lived here for thousands of years and for which there has been a lot of joy but also a lot of
[0:00:49] Trustee Luckham: sadness associated with colonial activities and we're working hard towards knowing that

[0:03:42] Voice 4: Okay thank you. I do have a question in the the last LTC meeting which I believe was
[0:03:48] Voice 4: November 21st, Chair Luckham had expressed some concerns or opposition to either the decision or
[0:03:58] Voice 4: the process that was happening. I'm sorry, I didn't rewatch the meeting. And I'm just wondering
[0:04:02] Voice 4: if I could ask Chair Luckham to, if he could explain what some of his concerns were.
[0:04:09] Trustee Luckham: Sure, I would recommend you watch the session if you can. But my concerns, I'm not concerned with
[0:04:19] Trustee Luckham: With the potential application for installation of the fiber cable to Keats, there are certainly
[0:04:27] Trustee Luckham: some concerns that we need to turn our mind to with respect to that work, and we're going
[0:04:31] Trustee Luckham: to discuss that today.
[0:04:33] Trustee Luckham: It's unusual for an LTC to write amendments to bylaws.
[0:04:41] Trustee Luckham: Normally, we would refer that to staff and have them craft language that seems appropriate
[0:04:47] Trustee Luckham: to them in planner speak i'll just say and um and so i was just concerned about that process
[0:04:53] Trustee Luckham: and advancing that when uh wasn't identified in our projects lists and all the likes it's an
[0:04:59] Trustee Luckham: unusual process and i'm kind of a process guy um and so that was my objection so thank you for
[0:05:06] Trustee Luckham: asking okay
[0:05:07] Voice 4: thank you may i ask one more thing or say just say one more thing um when this connected
[0:05:12] Voice 4: coast came up i did look into the ecological and environmental impacts of this fiber optic cable
[0:05:23] Voice 4: and what came out is that it's extremely toxic on its mode of production that it uses sand mining
[0:05:29] Voice 4: and quartz mining and then when you look this up of what's happening around the world
[0:05:33] Voice 4: it is leading to the pollution of aquifers it's leading to the complete displacement
[0:05:38] Voice 4: replacement of villages you know and i'm not opposing i know that this is going to move
[0:05:44] Voice 4: forward but just as all of these meetings start with an acknowledgement of where we live and the
[0:05:49] Voice 4: privilege that we have i i do want it acknowledged that we have to make these decisions with humility
[0:05:56] Voice 4: you know and i think that there was a comment that you know a few crabs would be displaced
[0:06:01] Voice 4: but that is not the case and and i think that when we um that this is um another process of
[0:06:08] Voice 4: colonization and of imperialization and I just want that acknowledged that with all new technologies
[0:06:15] Voice 4: when everything it is destructive and it is destroyed and that we will continue to use
[0:06:21] Voice 4: these things this is the way that they are but I think it's extremely important that
[0:06:25] Voice 4: that that be acknowledged thank you thank
[0:06:30] Trustee Luckham: you very much for bringing that to our attention
[0:06:32] Trustee Luckham: and appreciate that and conversation as we move on goes in a direction that does recognize

[0:07:17] Trustee Luckham: general uh zone amendment and um i'm just going to turn this over to planner mccargar who's prepared
[0:07:24] Trustee Luckham: this for us and renee jamrat as you see fit to chime in um and uh just to introduce this um and
[0:07:32] Trustee Luckham: then we will have a discussion at the table here with respect to the recommendations five
[0:07:38] Trustee Luckham: which are listed on the first page over to you great
[0:07:42] Planner McCargar: thank you chair i'll just do a brief intro
[0:07:45] Planner McCargar: the purpose of the report is to introduce draft bylaw number 158 which seeks to permit the
[0:07:52] Planner McCargar: establishment and use of telecommunication utilities in the marine general zone on keats
[0:07:57] Planner McCargar: Island. This is an LTC initiated bylaw amendment and in the staff report there's a preliminary
[0:08:05] Planner McCargar: review of the proposal from Connected Coast. Connected Coast is proposing to place subsea
[0:08:11] Planner McCargar: fiber optic cable in the marine area adjacent to Keats Island. It doesn't permit marine
[0:08:19] Planner McCargar: marine um or cables or anything other than navigational aids in that zone so that is why
[0:08:27] Planner McCargar: the amendment is being contemplated the report also looks at some of the gaps and possible
[0:08:34] Planner McCargar: issues associated with moving forward with the amendment in an expedited timeline
[0:08:41] Planner McCargar: staff is recommending that the ltc proceed within the typical process and those recommendations
[0:08:48] Planner McCargar: are listed on page two of the package and that staff do conduct some analysis.
[0:08:56] Planner McCargar: So Connected Coast is proposing to lay a fiber optic cable in the Marine General Zone to connect
[0:09:03] Planner McCargar: Keats Island residents to the network, improving connectivity for residents of Keats Island.
[0:09:08] Planner McCargar: The marine cable will be encased in a split pipe armoring system and rest on the seabed floor.
[0:09:15] Planner McCargar: So the installation would bring the backbone fiber to the communities, but would stay at that stage until a service provider picked up the connection.
[0:09:26] Planner McCargar: And at that time, it would move to individual homes.
[0:09:29] Planner McCargar: So Connected Coast wouldn't actually be connecting to individual homes, just setting up the backbone.
[0:09:36] Planner McCargar: So the LTC requested that staff make very specific changes to the Marine General Zone.
[0:09:42] Planner McCargar: own. The changes have been outlined in red on page 12 of the agenda package. So I just wanted
[0:09:49] Planner McCargar: to highlight that telecommunications utilities could be broadly interpreted. Depending on the
[0:09:56] Planner McCargar: LTC's intention, you might want to consider more specific wording, specifically, you know,
[0:10:03] Planner McCargar: talking about underwater cables or something that more narrowly meets what the amendment
[0:10:11] Planner McCargar: amendment is trying to do. And as drafted in Section 0.1, the MG Zone permits telecommunication
[0:10:20] Planner McCargar: utilities, but then Section 0.2, the structures, is contradictory to that in that it does not permit
[0:10:28] Planner McCargar: permanent buildings or structures of any kind. So the LTC might want to consider amending the
[0:10:34] Planner McCargar: wording of Section 0.2, so it doesn't contradict. Staff didn't review the Islands Trust Policy
[0:10:43] Planner McCargar: Statement, OCP, or Land Use By-law. So typically, staff would identify any potential issues or
[0:10:51] Planner McCargar: opportunities arising from an amendment project, you know, looking at the environmental impacts,
[0:10:56] Planner McCargar: any legal issues, financial implications, First Nations, sensitive ecosystems, that kind of thing.
[0:11:03] Planner McCargar: In addition, staff will also typically identify any information gaps or opportunities for mitigation, adaptation, consultation, technical studies, that sort of thing.
[0:11:16] Planner McCargar: So, none of that has been done.
[0:11:19] Planner McCargar: As well, there's been no analysis done on this specific proposed change, aside from just a couple of things I flagged earlier.
[0:11:28] Planner McCargar: earlier. So for consultation, this amendment doesn't involve the OCP and therefore the LTC
[0:11:38] Planner McCargar: is not required by the Local Government Act to consider opportunities for consultation with
[0:11:43] Planner McCargar: persons, organizations, or authorities. However, in the spirit of relationship building, this is
[0:11:48] Planner McCargar: considered to be good practice. The LTC should consider if it wishes to undertake additional
[0:11:53] Planner McCargar: consultation and direct staff accordingly. Staff did hear from one resident recently since writing
[0:12:01] Planner McCargar: the report regarding the broad scope of the telecommunication utilities and concerns that
[0:12:07] Planner McCargar: this could permit cell phone towers. The LTC is not holding a public hearing for the draft bylaw
[0:12:15] Planner McCargar: number 158 under the authority granted in sections section 467 of the Local Government Act.
[0:12:24] Planner McCargar: If the LTC would like to meet the Connected Coast Partnership completion deadline of March 2024 and have final adoption of the bylaw possible in that timeframe, then an expedited approval process is required.
[0:12:41] Planner McCargar: Referrals, community consultation, and First Nation engagement would be very difficult in that short timeframe.
[0:12:46] Planner McCargar: frame. If the LTC wants to meet the expedited time, first, second and third reading would need
[0:12:55] Planner McCargar: to take place today and the bylaw would be forwarded to executive committee and then final
[0:13:00] Planner McCargar: adoption of the bylaw could take place through a resolution without meeting once EC approval is
[0:13:07] Planner McCargar: obtained. I just wanted to note that there is a risk that without the planning analysis, without
[0:13:13] Planner McCargar: out the islands trust policy statement checklist first nations and gave engagement referrals
[0:13:21] Planner McCargar: the bylaw might not make it through the executive committee approval process but if the ltc would
[0:13:28] Planner McCargar: like to proceed with this alternative the resolutions are listed below in the alternative
[0:13:33] Planner McCargar: section of the staff report and happy to answer um any questions um i
[0:13:44] Voice 5: have a question go ahead
[0:13:46] Voice 5: Um, I'm just wondering, have we heard anything from Connected Coast in terms of providing
[0:13:52] Voice 5: application for a zoning amendment?
[0:13:58] Planner McCargar: No, they have indicated that they will not submit an application as the LTC is proceeding
[0:14:04] Planner McCargar: with this amendment.
[0:14:11] Voice 5: And then if we are to proceed, I did read the report last night, but I just didn't notice
[0:14:18] Voice 5: If we proceed as recommended, what is the earliest possible timeline for this completion?
[0:14:30] Voice 5: Well,
[0:14:33] Planner McCargar: typically for referrals, we'll give a minimum of two months.
[0:14:40] Planner McCargar: I would say would probably for completion, we'd be looking at a three to four month window.
[0:14:55] Planner McCargar: sort of hard to hard to guess you know that would also be based on meetings and that type of thing
[0:15:01] Planner McCargar: but right yeah would would probably three to six months would be generous but yeah potentially
[0:15:06] Planner McCargar: three to four months
[0:15:07] Voice 5: okay okay thank you those are all the questions i have mr

[0:15:26] Voice 2: um yeah i i do have some questions um uh but from my understanding is that you know
[0:15:37] Voice 2: the the recommendations that are in this report are really no different than the position the
[0:15:43] Voice 2: staff took uh last time um when staff expressed some discomfort with uh proceeding outside of
[0:15:52] Voice 2: the usual practice um basically there's nothing new here um and if i understand you correctly
[0:16:07] Voice 2: planner mccarver uh you know from your preliminary remarks you're making the point that if we wanted
[0:16:15] Voice 2: to have an expedited timeline that would meet the march deadline we don't have much choice we have
[0:16:20] Voice 2: to proceed in this fashion the regular procedure that you're recommending that we follow is going
[0:16:26] Voice 2: going to cause us to miss the deadline isn't that right that's
[0:16:32] Planner McCargar: correct um just note that the
[0:16:35] Planner McCargar: deadline could be missed depending i can't advise on what executive committee will do with this
[0:16:40] Planner McCargar: information so if this doesn't that
[0:16:42] Voice 2: wasn't that wasn't that wasn't the question what executive
[0:16:45] Voice 2: committee does is not for us to speculate they'll do what they'll do i'll point out in passing
[0:16:50] Voice 2: however that's not the end of the debate um if executive committee was so bold as to deny people
[0:16:58] Voice 2: people in Keats Island access to broadband, you can be sure that the matter would be appearing
[0:17:04] Voice 2: before Trust Council, which of course has the authority to overrule any type decision the
[0:17:09] Voice 2: Executive Committee may make in terms of denying a bylaw. There's always that route of appeal to
[0:17:17] Voice 2: Trust Council. So
[0:17:19] Voice 6: when
[0:17:22] Voice 2: you're talking about Executive Committee, what you're really talking
[0:17:25] Voice 2: about is frankly a strenuous debate that depending on get committee's decision a
[0:17:35] Voice 2: strenuous debate that ends up happening on a trust council about the proper role
[0:17:40] Voice 2: of an executive committee and frankly about the proper role of staff those are
[0:17:45] Voice 2: all things that may or may not happen ideally they won't happen but what we
[0:17:52] Voice 2: We have here, appears to me, to be a conflict between bureaucratic practice, traditional practice, and the urgency of the situation.
[0:18:04] Voice 2: And we need to have a sense of proportion here.
[0:18:07] Voice 2: This project is being undertaken all up and down the coast and all around Vancouver Island for the express purpose of bringing broadband internet access to communities that otherwise have no possibility of getting it.
[0:18:22] Voice 2: that includes Keats.
[0:18:24] Voice 2: There's nothing unique about the situation that Keats is in.
[0:18:27] Voice 2: There's all sorts of islands, including Thetis,
[0:18:29] Voice 2: including all sorts of other islands within the Islands Trust area
[0:18:34] Voice 2: that are permitting the cable to hit their islands
[0:18:36] Voice 2: because they've already got that in their bylaws.
[0:18:39] Voice 2: They have that permission.
[0:18:40] Voice 2: We just happen to have a bylaw that is restricted.
[0:18:44] Voice 2: So nothing's changed from the situation that we were in last time,
[0:18:48] Voice 2: the last meeting, in the sense that there's urgency to get this done
[0:18:51] Voice 2: in order to allow broadband to get to Keats Island.
[0:18:55] Voice 2: Our current practices are simply,
[0:18:58] Voice 2: we can't meet all of the usual benchmarks
[0:19:02] Voice 2: that normal practice follows.
[0:19:05] Voice 2: So we're facing the common set situation
[0:19:08] Voice 2: and having to make a judgment call
[0:19:10] Voice 2: as to whether or not this amendment is of a nature
[0:19:15] Voice 2: that the LTC can safely say,
[0:19:18] Voice 2: okay, on our own initiative and our own wording,
[0:19:21] Voice 2: we're going to throw that out here because it's basically a consequential amendment
[0:19:24] Voice 2: that brings the mg zone into line with the rest of the zones and we made the decision last time
[0:19:30] Voice 2: that it was necessary to do that and as you pointed out planner mccarver it's unnecessary
[0:19:35] Voice 2: for the coast because of that it's unnecessary for connected coast to make an application
[0:19:41] Voice 2: so uh i would like us to proceed on the basis that we will will indeed go through first second
[0:19:46] Voice 2: and third reading today because that's our only way of making sure that keats gets access to um
[0:19:52] Voice 2: uh broadband now uh plan ricardo you had you had made some comments about
[0:20:00] Voice 2: some some potential issues um and there is a technical issue here uh well there's two of them
[0:20:06] Voice 2: there was a member of the public who expressed some concern about a cell phone tower being
[0:20:11] Voice 2: enabled i would like to point out that there is nothing about this amendment that would enable
[0:20:17] Voice 2: the construction of the cell tower because this amendment is strictly concerned with what happens
[0:20:23] Voice 2: in the marine general zone which is all water and so uh no one's going to be putting any cell
[0:20:30] Voice 2: towers anytime soon or even wanting to put any cell towers any soon anytime soon on the sea
[0:20:35] Voice 2: bottom that ain't happening and uh so we don't have to worry about that now there is a question
[0:20:42] Voice 2: here that plan mccartney raised about there being arguably a contradiction between the amendment
[0:20:48] Voice 2: in the first part of the marine zone the marine general zone which you know by speaking in terms
[0:20:58] Voice 2: of telecommunication utilities is to enable the laying of the undersea cable and you pointed out
[0:21:06] Voice 2: out that there's a prohibition on structures
[0:21:12] Voice 2: in the second section of the zoning section there
[0:21:15] Voice 2: from Ray General.
[0:21:17] Voice 2: I've looked at the definition of structure
[0:21:20] Voice 2: in respect of that, and we may need to make a change here,
[0:21:24] Voice 2: but I'm not persuaded yet because when you look
[0:21:28] Voice 2: at the definition of structure in the land use bylaw,
[0:21:34] Voice 2: the definition is that it is a thing
[0:21:37] Voice 2: that is constructed or erected and is laid down on the surface of the ground or rests on the ground
[0:21:48] Voice 2: or something like that but it's the marine cable will certainly be placed in the water and end up
[0:21:56] Voice 2: laying on the sea bottom so it meets half of the definition of structure but a marine cable is laid
[0:22:02] Voice 2: down. It's not constructed. It's not erected. It's not a building. And do you have any comments
[0:22:10] Voice 2: about that interpretation of it?
[0:22:14] Planner McCargar: I don't. This is all something that would be done as part of
[0:22:17] Planner McCargar: some planning analysis, which I haven't done.
[0:22:21] Voice 2: Okay. Well, that's all to say I'm not particularly
[0:22:26] Voice 2: concerned about it because I don't see a contradiction there because I don't see a
[0:22:30] Voice 2: C cable as falling under the definition of either being constructed or erected. So that's my point
[0:22:34] Voice 2: there in any event uh where i'm at and you know we do need to have some room for further debate here
[0:22:41] Voice 2: but um i'm hoping that we will get to a point where i can make a motion soon uh that we will
[0:22:48] Voice 2: then proceed on the basis of going through a first second and third reading um how that process works
[0:22:54] Voice 2: in doing all of those things all at once i'm not quite sure i might need some help in terms of
[0:23:00] Voice 2: wording of motion but that's where i'd like to get to thank you thank
[0:23:05] Trustee Luckham: you joe um i have a couple
[0:23:09] Trustee Luckham: of questions of my own and um i don't want to um block or restrict this uh um without reason
[0:23:19] Trustee Luckham: that's for sure um certainly understand the necessity to advance this um you know having
[0:23:28] Trustee Luckham: I'll just start off. By having no application, I have some questions that if we had received an application or more details from the company that's doing the work, we would maybe know more.
[0:23:41] Trustee Luckham: And some of my questions wouldn't necessarily be relevant, but because we don't have that reporting that would come to an application or through a planning analysis, I have a few questions.
[0:23:57] Trustee Luckham: Certainly, I guess it all comes down to the deadline, and I don't really fully understand what that deadline means.
[0:24:11] Trustee Luckham: There's lots of factors associated with the deployment of this.
[0:24:15] Trustee Luckham: And again, I don't know what the schedule of this is and the planning that's necessary,
[0:24:21] Trustee Luckham: but it seems a little arbitrary at this particular point in time
[0:24:25] Trustee Luckham: in order to pressure the LTC to advance this, but that's fine.
[0:24:30] Trustee Luckham: The other things that are of immediate concern is,
[0:24:33] Trustee Luckham: is there a foreshore permit required from the province,
[0:24:38] Trustee Luckham: from the Ministry of Forestry and Land and Resources?
[0:24:42] Trustee Luckham: And then the second item that is of concern is,
[0:24:46] Trustee Luckham: especially if we're not going to consult with forests and lands or consult with fisheries on

[0:34:19] Trustee Luckham: to the sea and um in this particular area is there a setback to the sea and would a permit be
[0:34:25] Trustee Luckham: required for this kind of work or is that already included all right so
