[0:00:30] Voice 7: elected on thetis island on the territory of the laxon and penelope peoples and uh it's an honor
[0:00:37] Voice 7: I'm privileged to be here on Coast Salish Territory.
[0:00:41] Voice 7: Today, I find myself in Alberta, which is significant sub-zero temperatures, although
[0:00:48] Voice 7: I know it's been cold and snowing on the coast as well.
[0:00:51] Voice 7: But glad to be able to join all of us together here electronically today.
[0:00:57] Voice 7: And so I'm just going to turn to trustees.
[0:01:01] Voice 7: I see Toby Elliott and Susan Yates there in the meeting space.

[0:01:12] Voice 5: that chair like um i'd also like to make a quick acknowledgement of where we are meeting on the
[0:01:19] Voice 5: name of first nations territory and i am grateful to have lived all my life on first nations uh
[0:01:26] Voice 5: mostly coast salish territory musqueam slawatuth and then denny's kenny carrier laman and now
[0:01:34] Voice 5: territory and i don't take this for granted um the history the culture and the presence of first
[0:01:43] Voice 5: nations informs my learning wherever possible and chair luckham you remember may remember the
[0:01:49] Voice 5: meeting on galliano i think it was 2018 when we were given these paddles which i usually wear
[0:01:56] Voice 5: to council meetings and committee meeting and they were given to us so that we would promise
[0:02:02] Voice 5: us to be a witness for reconciliation at all islands trust meetings and so uh this paddle
[0:02:09] Voice 5: reminds me and it guides me to do this work carefully thank you very

[0:02:42] Voice 5: of first nation and many other coast salish peoples who have been living and working
[0:02:50] Voice 5: enjoying this territory and stewarding uh its precious beautiful resources since time immemorial
[0:02:57] Voice 5: rail. So we're cognizant of that every day, and aware of our
[0:03:01] Voice 5: responsibilities and obligations to steward in a good way. So we

[0:07:03] Voice 5: last meeting and um from the trans from a transportation ad hoc group and it was stephen
[0:07:09] Voice 5: earl who gave the presentation and he was asking if there was some way this ad hoc group could
[0:07:16] Voice 5: somehow become more legitimate in anything that they present to us um we did advise them at that
[0:07:24] Voice 5: time that you know if you want to be a transportation advisory planning committee
[0:07:29] Voice 5: committee then you do need to follow the guidance and you have to have public meetings a minute
[0:07:34] Voice 5: taker and so on and so forth and this and the same I believe was I believe director Craig pointed out
[0:07:41] Voice 5: the same thing if they wanted to be a commission under the regional district so I think I thought
[0:07:49] Voice 5: that I had made a motion to ask for staff advice on this but perhaps I didn't so does anyone
[0:07:55] Voice 5: when remember anything because i did not see anything at all in the minutes oh there's nothing
[0:08:01] Voice 7: in the minutes so nothing for nothing there was no specific direction given and nothing
[0:08:05] Voice 7: uh in the follow-up action list then is that correct well

[0:08:10] Voice 5: was recorded but as a public comment um if i recall mr earl actually had wanted to to present
[0:08:19] Voice 5: a delegation and submit his letter which i don't see was attached so there was a one-page letter

[0:08:31] Voice 5: confusion there so we have minutes recording briefly his presentation but then there was no
[0:08:38] Voice 5: discussion and follow-up um on the the um the request to add that the ltc create a transportation
[0:08:48] Voice 5: by the planning commission so great okay
[0:08:52] Voice 7: so obviously we don't have any materials here to
[0:08:55] Voice 7: reference today um we i don't know that there's necessarily an urgent necessity to do that but
[0:09:03] Voice 7: certainly there's an interest in the community um so i'm not 100 sure that we could address that
[0:09:08] Voice 7: today but certainly if the if it's desired um perhaps we could um get a motion specifically
[0:09:16] Voice 7: if that's what you want to do, to ask staff to bring back advice or a report on the establishment
[0:09:26] Voice 7: of a transportation committee. And perhaps that could...
[0:09:30] Voice 5: I have a suggestion, Chair Leckham. I can get back to Stephen Earle, and I can ask him if the six
[0:09:39] Voice 5: people in his transportation group actually want to be a formal Transportation Advisory Planning
[0:09:46] Voice 5: the committee and if they do then we can make a motion make a motion that maybe at our next meeting
[0:09:53] Voice 5: i'm not sure that they do so i don't want to spend staff time on this so i can do that and then i can

[0:10:24] Voice 7: establishment of a body but the only mechanism we we have would be through an advisory planning

[0:15:38] Voice 5: First of all, I wanted to mention,
[0:15:40] Voice 5: People may have heard already that the Chief Administrative Officer, Russ Pottenpiller, for the Islands Trust, who has been with us for eight years, is retiring in June.
[0:15:52] Voice 5: And I will miss him terribly.
[0:15:54] Voice 5: He has just provided stellar advice.
[0:15:57] Voice 5: And he has proved himself so worthy to the Islands Trust, especially at council meetings where there have been some very broad discussions.
[0:16:07] Voice 5: sessions. And he has just really helped us out. So I just wanted to say publicly how much I have
[0:16:14] Voice 5: appreciated Russ Hudson Teller's guidance over these. Well, especially for me this last year
[0:16:20] Voice 5: as a trustee, but even previously as a reporter, I could often go to him and get some really good
[0:16:26] Voice 5: advice, background advice. So I really want to say that publicly. The second thing I would like
[0:16:31] Voice 5: to report on is that I attended our MP Lisa Marie Barron session on Tuesday evening. It was
[0:16:40] Voice 5: excellent and I understand it was a follow-up from the afternoon session. Were you able to go to that
[0:16:45] Voice 5: Toby? Okay I couldn't go to that either. So briefly her evening presentation was to tell us about a
[0:16:56] Voice 5: private members bill which she is bringing forth in the house of commons bill mpd6 calling for the
[0:17:02] Voice 5: creation of an independent non-partisan national citizen assembly to study and make recommendations
[0:17:08] Voice 5: on federal electoral reform including an improved voting system so if this sounds familiar it's
[0:17:15] Voice 5: because it's the same promise that we were given by justin trudeau quite a few years ago which was
[0:17:21] Voice 5: just dropped like, I don't know, like a piece of lead,
[0:17:24] Voice 5: a piece of hot lead, as soon as he was elected.
[0:17:28] Voice 5: Anyway, M.D. Barron was, she just gave such a clear, concise,
[0:17:34] Voice 5: but yet comprehensive presentation on the benefits of electoral reform
[0:17:39] Voice 5: because it will strengthen this country's democracy,
[0:17:44] Voice 5: which at times is pretty shaky.
[0:17:46] Voice 5: at times we have so many imbalances as to how people are represented electorally but also just
[0:17:57] Voice 6: democratically so
[0:17:58] Voice 5: there was uh there was about i think 30 people attended despite the weather
[0:18:03] Voice 5: some very good questions and i think what really impressed me is that um mp baron was using
[0:18:11] Voice 5: information from Fair Vote Canada, which is completely impartial, non-partisan, not aligned
[0:18:17] Voice 5: with any political party. And I have worked with Fair Vote Canada in the past, and I really think
[0:18:23] Voice 5: they're amazing. So I hope she gets enough support. It sounds like she's got about 50-50
[0:18:30] Voice 5: support right now in the House of Commons, but she is a hard worker. So
[0:18:35] Voice 6: I
[0:18:36] Voice 5: think I'm hoping this
[0:18:37] Voice 5: will go ahead i'll do everything i can to help her out so there was that that was really inspiring
[0:18:44] Voice 5: and um not really related to that but tangentially related was a session i went to on salt spring on
[0:18:51] Voice 5: sunday afternoon with dr allison smith who is probably canada's best known expert on homelessness
[0:18:59] Voice 5: and she has written a book um on homelessness it's called multiple barriers the multi-level
[0:19:07] Voice 5: governance of homelessness in Canada and I am I intend to write a fairly comprehensive report on
[0:19:14] Voice 5: this I took a lot of notes and I can't get rid of any of them because they're all good and I
[0:19:20] Voice 5: will be sending it out to various housing groups and to all of us and maybe even to the sounder
[0:19:26] Voice 5: but I think the main point that Dr. Smith brought up at this meeting on Sunday afternoon
[0:19:33] Voice 5: is that the federal government has failed us miserably
[0:19:38] Voice 5: in talking about housing action plans for the last eight years
[0:19:44] Voice 5: and dispersing not one penny to the groups who really need it.
[0:19:49] Voice 5: She talked a little bit about the division of provinces,
[0:19:53] Voice 5: and she actually congratulated British Columbia
[0:19:55] Voice 5: because she teaches at U of T in Ontario.
[0:19:59] Voice 5: She said, as far as the provinces, BC is moving along quite nicely. But even still, the money doesn't get to the actual, usually local groups and agencies who could use that money to build for demand and not just make more supply.
[0:20:18] Voice 5: supply we are rich in supply with so-called housing um in in british columbia but it is
[0:20:26] Voice 5: not meeting the demand so i'll leave it at that and i have to say her her talk was really really
[0:20:32] Voice 5: inspiring it was a sold-out house i think it's about 150 people there including some homeless
[0:20:38] Voice 5: people who were kindly invited in and had a lot to say it was
[0:20:42] Voice 5: very good listening to them
[0:20:46] Voice 7: thank you susan toby i'm
[0:20:49] Voice 5: waiting for more she's always speaking so much there'll be more
[0:20:52] Voice 5: i've been writing um i will submit my report as well in friday um but actually i wanted to report
[0:20:59] Voice 5: out on a positive note on the housing uh front uh and peter i don't know if this is taking the
[0:21:06] Voice 5: wind out of your sails but on december 20th the islands trust received a letter from the deputy
[0:21:11] Voice 5: Minister of Housing that we will receive almost $130,000 by the end of January 2024. I'll send
[0:21:21] Voice 5: this to you, Lisa, to support updates to our housing needs reports. And so because of changes
[0:21:28] Voice 5: in legislation requiring that housing needs report be updated in an interim and then to be
[0:21:37] Voice 5: um to be current for up to 20 years i believe um they're providing from a 51 million dollar
[0:21:45] Voice 5: capacity fund uh local government's implementation of the legislative changes so this is one of the
[0:21:51] Voice 5: first legislative uh statutory changes that actually included the islands trust almost
[0:21:58] Voice 5: everything else we have been left out of um because of the restrictions of our act um but
[0:22:04] Voice 5: But it's a hopeful note because all of our housing needs assessments were due to be done this fiscal, and we had budgeted $110,000 roughly to do all of them except Salt Springs.
[0:22:16] Voice 5: And so that's not going to have to come out of the staff budget, but of course that's a discussion for Financial Planning Committee next week.
[0:22:24] Voice 5: So at least we are getting some money to help identify the problem that we already know exists.
[0:22:31] Voice 5: And rightly so, because we are required to update those housing age reports by the province now.
[0:22:37] Voice 5: So rightly so, that we should be getting funding for that.
[0:22:41] Voice 5: Another thing to note, the executive committee met for the first time this year yesterday, January 17th, despite the snow challenges.
[0:22:50] Voice 5: I was in my parka in a workshop trying to get getting cell service.
[0:22:55] Voice 5: and but it was a really good meeting and we discussed the policy statement amendment project
[0:23:02] Voice 5: which is going to come out probably this year we're going to see a new draft with up to
[0:23:11] Voice 5: 35 and net amendments which previous term of trustees had decided on but what's different
[0:23:18] Voice 5: about the approach is that the draft has gone out to the first nations in the trust area
[0:23:23] Voice 5: area first and so trustees will see the draft with the comments of nations in the trust area
[0:23:32] Voice 5: and if anyone wants to see the staff report was quite good um staff noted that a frequently
[0:23:39] Voice 5: raised topic during meetings with First Nations is the topic of governance staff are consistently
[0:23:45] Voice 5: hearing a desire for Islands Trust Council and local trust committees to more actively respect
[0:23:50] Voice 5: Indigenous rights to self-governance and co-governance and for Islands Trust to be
[0:23:56] Voice 5: actively working to find a path forward to implement the United Nations Declaration on
[0:24:00] Voice 5: the Rights of Indigenous People Act, even prior to being legislatively required to do so. So
[0:24:07] Voice 5: there is a real strong conversation and it's going to be very interesting to hear what is coming back
[0:24:15] Voice 5: in regards to the policy statement um not sure it may land on our council agenda in march
[0:24:23] Voice 5: or not also at executive committee uh we endorsed a resolution for submission to ubcm and abicc um
[0:24:35] Voice 5: talking about poop i don't want to bore you all requesting that the province review the manual
[0:24:41] Voice 5: of composting toilets and greywater practice and provide funding for demonstration projects

[0:24:54] Voice 5: rural areas. We know that servicing needs to be appropriate. So increasing housing where
[0:25:02] Voice 5: appropriate needs to have services and septic fields are not always appropriate in rural areas.
[0:25:08] Voice 5: So composting toilets, there is a manual but we've got a really strong background
[0:25:13] Voice 5: where they talk to industry sector professionals and provincial folk
[0:25:19] Voice 5: about updating that manual and making it easier for people to meet the guidelines.
[0:25:26] Voice 5: Finally culturally committed, I've been a personal member of this organization for over a year
[0:25:33] Voice 5: and they have been contracted to facilitate Reconciliation Learning Circle
[0:25:39] Voice 5: for trustees and staff so we had the first meeting last night it was a workshop
[0:25:46] Voice 5: with uh megan lewis on building meaningful engagement and relationships with indigenous
[0:25:52] Voice 5: peoples so it was well attended most of the trustees who had signed up uh were in attendance
[0:25:59] Voice 5: and i believe this is being funded by a grant we received from the ministry of municipal affairs
[0:26:05] Voice 5: for reconciliation. So this is really building a learning for trustees and staff so that we can
[0:26:12] Voice 5: create and work in culturally safe spaces with Indigenous peoples and put forward practices that
[0:26:19] Voice 5: are respectful and cognizant to the context we are working in. We just got an email in about
[0:26:31] Voice 5: three opportunities for awards and so i thought i'd put it out here um because as elected members
[0:26:40] Voice 5: we could nominate people from our community for uh awards of excellence so the bc achievement
[0:26:46] Voice 5: foundation's community award if there's any member of the community that we should be
[0:26:51] Voice 5: nominating i'd love to put forward a name of an extraordinary british colombian who is working
[0:26:58] Voice 5: keen to build a stronger more resilient community I can think of 20 um but there's an emerging leader
[0:27:04] Voice 5: award that recognizes youth making a difference in our communities too so um and that's about it
[0:27:11] Voice 5: it was a quiet winter I actually got some rest got in a little car accident had some whiplash
[0:27:19] Voice 5: and um but managed to travel and see family and so thankful to be back at work that was a long
[0:27:27] Voice 5: report sorry okay thank

[0:28:16] Voice 7: And coming up here actually over the weekend, well, starting next week actually early, is
[0:28:21] Voice 7: the Coast Salish Forum Conference being held by Transport Canada, a new opportunity for us to
[0:28:28] Voice 7: engage with like-minded partners and the government with respect to the work that's come
[0:28:37] Voice 7: ostensibly through the Ocean Protections Plan federal initiative to turn our focus onto
[0:28:43] Voice 7: protecting the coastline of British Columbia, as well as the coastlines all across the country.
[0:28:49] Voice 7: In this particular case, the focus will be on British Columbia, Sailor C, and looking
[0:28:56] Voice 7: forward to participating in that, hopefully that we can see some of our concerns associated
[0:29:01] Voice 7: with derelict vessels and freighter traffic and freighter anchoring and oil spill prevention
[0:29:09] Voice 7: and the like to protect our coast, which is so very important to all of us here and, of
[0:29:16] Voice 7: course first nations very strong uh partnership in these uh uh events with the ocean protection
[0:29:23] Voice 7: planet particularly in this uh salish sea forum uh strong uh connection with first nations there
[0:29:29] Voice 7: and participation and looking forward to that aspect of it so that's all i have to report today

[0:29:46] Voice 4: um being so welcoming to me because i i really enjoy this opportunity and and
[0:29:52] Voice 4: and i pay attention to as much of the islands trust uh stuff that's happening and uh toby
[0:30:00] Voice 4: sorry to hear about your accident, but I'm, I'm glad to hear your recovery. Um, I did send an
[0:30:05] Voice 4: update, um, in a little bit in advance this time, but I wanted to, uh, highlight just a couple of
[0:30:14] Voice 4: things, um, which is that as of tomorrow, the, um, the AAP process for the new health, potential
[0:30:24] Voice 4: new health and wellbeing coordinator officially starts underway. The get involved page is already
[0:30:30] Voice 4: up and running and it has information and so the way this an AEP works it's uh it's basically the
[0:30:37] Voice 4: counter petition process um a health and well-being service like this actually doesn't require a
[0:30:43] Voice 4: referendum if it was to be held for all of area b um because it's focused on gabriola um it it does
[0:30:50] Voice 4: does require because it's only a portion of the area so the the idea for the position is that it
[0:31:01] Voice 4: would form an administrative support for a lot of the work that's being done by these amazing
[0:31:06] Voice 4: groups that we have on the island more than 40 groups are members of the health and wellness
[0:31:12] Voice 4: collaborative and they work tirelessly for the well-being of our community and a lot of it is
[0:31:19] Voice 4: done by volunteers and what I've heard over the last couple of years pretty consistently is that
[0:31:26] Voice 4: they're starting to feel a bit of volunteer burnout and that you know they want to be able
[0:31:31] Voice 4: to focus on doing their work for the community but they're they're instead doing all of some
[0:31:38] Voice 4: administrative work and so they felt that this would be quite supportive as well as as a position
[0:31:43] Voice 4: like this can look at gaps that currently aren't being able to address by the by the groups and
[0:31:49] Voice 4: And there's, as we all know, there's many gaps where there's issues that are not quite directly tackled by groups on the island.
[0:31:59] Voice 4: And they can look for where groups can work together and also apply for grant funding.
[0:32:04] Voice 4: So the AEP requires, if you're opposed to the creation of the new service, that you submit a form indicating that you're opposed to it.
[0:32:14] Voice 4: And you can email it or mail it or drop it off in person, but it has to be received by the RDN by 4 p.m. Tuesday, February 20th, and the form is online.
[0:32:27] Voice 4: And I'm happy to answer any questions. There's an FAQ on the website as well.
[0:32:31] Voice 4: And then the other thing I just wanted to highlight that we've talked about a few times is the Coats Weir Project.
[0:32:36] Voice 4: project so the coats marsh weir concrete weir has been assessed as being it's in deteriorating
[0:32:45] Voice 4: condition and that there's a very industrious beaver or multiple beavers probably over years
[0:32:51] Voice 4: that have been working to create a big beaver dam and currently there's a large amount of water
[0:32:57] Voice 4: stored behind the beaver dam and it's actually higher more than a meter higher was more than a
[0:33:02] Voice 4: meter higher than the concrete weir so that if it ever let go the the the chance of damage was
[0:33:09] Voice 4: significant so when the RDN was looking at options to address this issue we had engineering studies
[0:33:16] Voice 4: and all of them suggested taking out the beaver dam and then either raising or or maintaining the
[0:33:22] Voice 4: the weir but in consultations with community members who were concerned about the the health
[0:33:28] Voice 4: of the marsh as well as the Nature Trust who are co-owners of Coates Marsh Regional Park.
[0:33:35] Voice 4: The alternate decision was made to actually remove the concrete weir and keep the beaver
[0:33:40] Voice 4: dam and then hopefully revert the marsh back to a more natural state. It may mean that the
[0:33:48] Voice 4: water level is actually a little bit lower than it has been historically because the concrete
[0:33:52] Voice 4: crete weir has been holding up and keeping keeping the water level higher and so because it's been
[0:33:59] Voice 4: blasted out there will be rocks and and other things placed along to to maintain water in the
[0:34:05] Voice 4: weir but it won't be the same as as a weir and there's actually a public consultation um session
[0:34:11] Voice 4: this saturday i know

[0:34:13] Voice 4: things happening on saturday but 11 a.m to 3 p.m it's

[0:47:05] Voice 5: In the February 2023 meeting in this hall, we had both the APC and the HAPC members here to get their thoughts on what would a community-led engagement process look like.
[0:47:23] Voice 5: And there was consideration of an idea of an Indigenous engagement coordinator, understanding that an OCP review contains many topical areas and it's going to advance at different times in our community.
[0:47:43] Voice 5: And having a coordinator who could support engaging with different First Nations who have potential interest in our OCP review might be an appropriate step.
[0:47:57] Voice 5: And so I had a conversation with our planner, Narissa Chadwick, just to understand where we're at with this process.
[0:48:06] Voice 5: And I had originally drafted a resolution because I really think we need to move this forward, not just because we do want input from First Nations,
[0:48:20] Voice 5: But our own community members are asking, where are we at?
[0:48:24] Voice 5: How have we engaged with other diversations with respect to this process?
[0:48:31] Voice 5: So I had indicated earlier that I'd like to do a terms of reference for an Indigenous engagement coordinator.
[0:48:41] Voice 5: But Planner Chadwick came back with a different suggestion.
[0:48:46] Voice 5: question um there's some wrong spelling in that resolution there um that instead
[0:48:56] Voice 5: um they're going they're happy to work staff to staff to set up some meetings prior to the end of
[0:49:05] Voice 5: March 2024 between that needs to change their will if it was on the

[2:01:53] Voice 7: And here we are on Gabriola Island, and we have a report from you with a recommended motion that we just received this information.
[2:02:03] Voice 7: And so, indeed, by the fact that it's on our agenda, we would do that.
[2:02:07] Voice 7: But I'll turn it over to you to give us a summary.

[2:02:13] Voice 8: Sure. So this report summarized the current shoreline structures and setback contraventions and legal action involving such structures.
[2:02:23] Voice 8: There's currently 14 files for the local trust area as a whole.
[2:02:28] Voice 8: And as I said, they're equally divided between Gabriel and Mudge, so seven on each island.
[2:02:34] Voice 8: Note that Mudge does have a greater setback from the sea than Gabriel.
[2:02:39] Voice 8: So there's more of a potential for setback contraventions.
[2:02:46] Voice 8: And I've also noted here that when we call these files, that even though these files involve structures on private property, the majority of the time and not actually on the foreshore, we use the foreshore reference in our filing system to reflect and identify those contraventions that are in that entire sensitive ecosystem area, the actual land below the natural boundary of the sea and just above it.
[2:03:15] Voice 8: so i also go on to the to document that we have issued violation notices
[2:03:20] Voice 8: uh for some of these contraventions uh many of them will move towards compliance without
[2:03:27] Voice 8: further action um what is not specifically noted here is uh for one of the files they have submitted
[2:03:37] Voice 8: a DVP application to try and get the structure legalized
[2:03:46] Voice 8: with that permit from the local trust area.
[2:03:49] Voice 8: And the remainder of the report really deals with the Mudge Island case
[2:03:55] Voice 8: involving Mr. Defonseca, for which there have been multiple court cases,
[2:04:01] Voice 8: and also where we're now involved in contempt of court proceedings
[2:04:06] Voice 8: proceedings as we have not been able to get compliance uh or in the contempt of court this
[2:04:14] Voice 8: comes down to the courts bc supreme court orders have not achieved compliance uh for that property
[2:04:21] Voice 8: but the work continues and there may be further content of court proceedings in order to get
[2:04:30] Voice 8: compliance and the removal of those structures on that property and you have the attached
[2:04:35] Voice 8: decision uh the court of appeal decision uh for the case of Fonseca versus the Gabriel and local
[2:04:42] Voice 8: trust committee um and in the final recommendation I note that um I don't I don't see any trends here
[2:04:52] Voice 8: this is just sort of a way unfortunately routine work I don't see uh some dramatic increase in the
[2:05:00] Voice 8: number of structures being built at least along within these setback areas we're not seeing a
[2:05:05] Voice 8: rapid increase in the number of complaints regarding the setback areas
[2:05:10] Voice 8: so in the end provided the report for information and in my opinion right now
[2:05:16] Voice 8: there's no action that's required by the LTC to address any ongoing issue with
[2:05:23] Voice 8: these four store structures and I that's the extent of my comments and I could
[2:05:29] Voice 8: take any questions i
[2:05:33] Voice 5: had a question um this is super helpful report thank you very much
[2:05:39] Voice 5: warren um i think it's definitely true that there is a misunderstanding among property owners
[2:05:44] Voice 5: regarding their rights and where they can build so it's good to have that stated um i'm thinking
[2:05:52] Voice 5: about those two properties on the strand and i i believe they're still asking for development
[2:06:00] Voice 5: with variance right correct
[2:06:03] Voice 8: they have they have open planning applications and planning staff
[2:06:07] Voice 8: are working on those files yeah
[2:06:12] Voice 5: and so to follow up on that um why why is the process this way
[2:06:20] Voice 5: somebody builds an illegal unlawful structure in the foreshore and then they go and open an
[2:06:27] Voice 5: application file they pay the money we go through the process and then we have to say
[2:06:31] Voice 5: no we don't
[2:06:33] Voice 5: approve this and now you have to take down the structure like it could we not
[2:06:38] Voice 5: enforce against this like i'm sorry but this just seems such a waste of runaround time because
[2:06:47] Voice 5: and further so
[2:06:48] Voice 8: i would say that the the property owners once we get the complaint and we discover
[2:06:52] Voice 8: the contravention they do they get i mean the opportunity to try and fix the problem
[2:07:00] Voice 8: and bring the property into compliance and one of their options is they do have
[2:07:06] Voice 8: the right to submit these applications and try and get approval from the local
[2:07:11] Voice 8: trust committee for the structures yes it's after the fact but and the courts
[2:07:18] Voice 8: have ruled on this these applications must be dealt with on their merits and
[2:07:25] Voice 8: And the local trust committee must give, you know, full consideration to the application,
[2:07:31] Voice 8: decide on its merits, whether or not they would grant the permit, and then proceed from
[2:07:38] Voice 8: there.
[2:07:38] Voice 8: And I think that's just part of procedural fairness that that option is available to
[2:07:44] Voice 8: the property owner.
[2:07:45] Voice 8: And I don't believe there's an option to say, okay, no, you cannot submit this application
[2:07:50] Voice 8: will.
[2:07:51] Voice 6: that just seems so
[2:07:53] Voice 5: contrary to common sense because just to give you an example the two on
[2:07:58] Voice 5: the strand i wouldn't even have known about these you know until we got the report except that one
[2:08:04] Voice 5: day when i was walking on the strand one of the neighbors came up to me just frantic saying you
[2:08:11] Voice 5: won't believe what's happening down there and blah blah like they were so upset about it and
[2:08:16] Voice 5: And then they didn't know what to do.
[2:08:19] Voice 5: And I said, well, you'll need to submit a complaint to the Islands Trust, which is kind
[2:08:24] Voice 5: of horrible because now the neighbor is responsible for reporting this.
[2:08:28] Voice 5: Meanwhile, all the
[2:08:29] Voice 5: building, all the cement moving, all this stuff is still happening
[2:08:33] Voice 5: on the foreshore.
[2:08:34] Voice 5: All the damage was being done on the foreshore.
[2:08:37] Voice 5: And then it's built and completed.
[2:08:40] Voice 5: And then they come to us and now we just look so bad if we say, well, actually, we don't
[2:08:46] Voice 5: to prove that when it just seems so it's it's awful it isn't procedurally fair if something
[2:08:54] Voice 5: is in contravention of our bylaw and then they're allowed to make an application for it after the
[2:09:00] Voice 5: fact and that may be a procedure but i don't see how it's a just because
[2:09:06] Voice 1: then of course
[2:09:07] Voice 5: they go to
[2:09:08] Voice 5: court and say well we've already spent all this money and we've already done all these major
[2:09:13] Voice 5: cement building and all this stuff and now what now we how can we possibly and it just seems
[2:09:17] Voice 5: that doesn't seem fair to them either yeah okay well thank you for this is the that that
[2:09:26] Voice 5: particular case was the reason i think well one of us had asked for the report and so
[2:09:31] Voice 5: the summary is really valuable and i think to understand the broader context and particularly
[2:09:39] Voice 5: particularly the analysis about the misunderstanding regarding the rights to build on the property
[2:09:46] Voice 5: in the setback from the sea.
[2:09:49] Voice 5: Some view the setback regulations as a seizure of land by Islands Trust and many maintain
[2:09:55] Voice 5: they have the right to protect their property from erosion.
[2:09:57] Voice 5: So this is going to become a more active conversation with climate change, yes, and I think having
[2:10:04] Voice 5: having this report puts us in a good position to be able to explain things to property owners
[2:10:10] Voice 5: on the waterfront and to look at our, we may need to look at the setback area as well. Why does
[2:10:20] Voice 5: Mudge have such a large setback and Gabriel is only 7.5 meters?
[2:10:27] Voice 8: I believe it's a newer land use
[2:10:29] Voice 8: use bylaw adopted in either 2007 or 2008 the work on the gabriola land use bylaw an official
[2:10:37] Voice 8: community plan would have happened in the 90s and then after you get past the turn of the century
[2:10:42] Voice 8: there's more awareness of any threat of sea level rise so uh that's you know my interpretation of
[2:10:51] Voice 8: what happened uh it's like after like a new generation of land use bylaws that came in in
[2:10:57] Voice 8: the 2000s put more consideration into do we need a greater setback area where the ones in the 90s
[2:11:04] Voice 8: primarily looked at okay what was the standard set in 1972 when a lot of regional in 1971 or
[2:11:10] Voice 8: 1972 when the regional district brought in their the first zoning and land use bylaws
[2:11:15] Voice 8: that just seems to have been a continuation for the next 25 to 30 years and then once you get
[2:11:22] Voice 8: into 2000s the local trust committee seemed to take more control and took a harder look at
[2:11:28] Voice 8: what an appropriate setback area is that's why you have some land use bylaws with the old seven
[2:11:34] Voice 8: and a half meters and some of those older regulations were just for buildings not all
[2:11:39] Voice 8: structures and you see the transition in the land use bylaw with the amendments from the seven and
[2:11:44] Voice 8: a half meter setback to a seven and a half meter setback for all structures buildings with all
[2:11:50] Voice 8: all structures and then for some miles an increase to 15 meters and then much has the 30 meter one
[2:11:57] Voice 8: it can be adjusted with a geotech report back to seven and a half meters but you do need that
[2:12:04] Voice 8: professional advice that it's safe to build below that 30 meters before it's lawful to do so
[2:12:10] Voice 8: oh
[2:12:11] Voice 5: and why a geotech report so it's not due to sensitive ecosystem it's due to
[2:12:18] Voice 5: stability or
[2:12:19] Voice 5: yes
[2:12:20] Voice 8: I can reference the
[2:12:21] Voice 8: bylaw but yeah I don't believe it was through
[2:12:23] Voice 8: protection of primarily protection

[2:13:10] Voice 8: the exact wording from the mudge island bylaw through the chair is that they
[2:13:15] Voice 8: They want, you can get it reduced to seven and a half meters
[2:13:19] Voice 8: where the frontage of the sea is adequately protected
[2:13:21] Voice 8: from erosion by natural bedrock
[2:13:23] Voice 8: as certified by a qualified professional.
[2:13:26] Voice 8: So it doesn't say exactly a geotech,
[2:13:29] Voice 8: but a qualified professional.
[2:13:31] Voice 8: And if they get that report, that certification,
[2:13:33] Voice 8: then the setback can be reduced to seven and a half meters.
[2:13:40] Voice 7: Maybe I'll just make a few remarks.
[2:13:42] Voice 7: Just starting from the last thing you said there,
[2:13:45] Voice 7: certainly it remains a decision of the LTC
[2:13:47] Voice 7: LTC as to whether or not they want to approve it. It's just that that engineering report
[2:13:51] Voice 7: would indicate that there wouldn't be any engineering reasons not to do that. But if
[2:13:59] Voice 7: there were environmental concerns that the LTC had, they're not obligated to issue that
[2:14:06] Voice 7: development permit, are they?
[2:14:08] Voice 8: So this is actually not, this is just right in the land use bylaw and it's a regulation
[2:14:13] Voice 8: that yes could be amended but right now the regulation is that it's a 30 meter setback
[2:14:19] Voice 8: unless you get this certification from a professional saying it can be reduced
[2:14:23] Voice 8: and if they're supposed to state that the properties is adequately protected from erosion
[2:14:30] Voice 5: yeah what i was referring to was whether we could put in place dvps for shoreline protection
[2:14:37] Voice 5: protection as a better measure to protect rather than increasing the setback area which would then
[2:14:45] Voice 5: incur costs by having to prove slope stability or whatever do what do you know any other islands
[2:14:51] Voice 5: which ones have shoreline um dvps i don't think maine um
[2:14:57] Voice 8: salt spring certainly does um galliano
[2:15:01] Voice 8: Galliano does off the top of my head, but I don't believe that North Pender has some,
[2:15:09] Voice 8: but not full shoreline, but certainly Galliano does and Salisbury.
[2:15:15] Voice 8: I think those are the most, I would say, detailed regulations for development of permit areas
[2:15:21] Voice 8: and protection of that foreshore areas.
[2:15:26] Voice 7: Certainly setting a setback is the simplest thing that we can do that provides protection.
[2:15:31] Voice 7: And I just wanted to add that, as Warren has indicated, that this is certainly a change from the 70s, we'll just say, as a demarcation in time up until the 90s, maybe 2000.
[2:15:43] Voice 7: But certainly from 2000 to now, time is fleeting, 2024 now, there's certainly a lot more rigor behind the science around environmental protection and that the science that we've come to understand associated with sea level rise is the marine environment impacts that occur from upland property uses.
[2:16:09] Voice 7: And so the 30 meters, although somebody said, well, why is it so large?
[2:16:14] Voice 7: It's actually 30 meters is actually a recommended best practice.
[2:16:19] Voice 7: And that seven and a half meters is why is it so small would be the question that I would ask,
[2:16:24] Voice 7: because it's the interaction between the shore, near shore habitat and the marine environment that supports the marine ecosystems.
[2:16:32] Voice 7: systems that's important to recognize. Not to mention, if you place a house within those
[2:16:38] Voice 7: proximities of the shoreline, you're placing the house in a vulnerable location or whatever
[2:16:45] Voice 7: building and placing them in a vulnerable location that is just also not considered to be a best
[2:16:51] Voice 7: practice with respect to storm surge and sea level rise and all the rest of it. So I'm glad that we
[2:16:57] Voice 7: have this report we could no doubt talk about it at length certainly in some respects we need to
[2:17:03] Voice 7: provide the opportunity to public to new property owners to know but actually i think what's
[2:17:07] Voice 7: important there is that changing the setbacks doesn't affect existing properties or buildings
[2:17:12] Voice 7: doesn't exist existing buildings they would be uh legal non-conforming it only affects new
[2:17:18] Voice 7: development and um and it's the new development that seems to be more problematic than um even

[2:39:21] Voice 1: if your development permit guidelines requires a report, your DAI bylaw would then go into the
[2:39:29] Voice 1: details about what that report must have in it uh the qualifications of the person so very very
[2:39:35] Voice 1: specific so that is the one problem with the dai um it does take some planner work to do that work

[2:39:43] Voice 1: one um yeah and i can't really speak to the advisory planning commission by law
[2:39:49] Voice 1: it would like it would be the administrative staff the legislative clerk that would probably

CALL TO ORDER “Please note, the order of agenda items may be modified during the meeting. Times are provided for convenience only and are subject to change.” Chair Luckham called the meeting to order at 10:30 am. He acknowledged that the meeting was held on the territory of the Coast Salish First Nations. Trustees Yates and Elliott introduced themselves and acknowledged the First Nations territories in which they live and work. 2. ADOPTED Gabriola Island ADOPTED 2 Local Trust Committee Minutes January 18, 2024 3. REPORTS 3.1 Trustee Reports Trustee Elliott reported the following: On December 20, 2023 the Islands Trust received a letter from the Deputy Minister of Housing confirming receipt of $127, 336 in funding to support updates to Housing Needs Reports; She attended the recent Executive Committee Meeting during which the Policy Amendment Project and engagement approaches were discussed. It was noted that a draft version has been sent to First Nations who have indicated interest in participating; She noted that the Executive Committee approved advancing a resolution for submission to the Union of BC Municipalities and the Association of Vancouver Island and Coastal Communities requesting that the Province review the “Manual of Composting Toilets and Greywater Practice” and provide funding for demonstration projects and professional development for practitioners; The Culturally Committed organization has been contracted to facilitate a Reconciliation Learning Circle for Trustees and staff; and She delivered a gift of locally grown squashes and donations of handmade crafts and gifts from community members to Snuneymuxw First Nation Chief Wyse, Council Members, and staff on behalf of the of the Local Trust Committee and community in congratulations of completion of their term in office. Trustee Yates reported the following: She acknowledged the upcoming retirement of Islands Trust Chief Administrative Officer Russ Hotsenpiller and thanked him for his contributions and guidance; She attended Member of Parliament (MP) Lisa Marie Barron’s discussion about private members motion M-86 Citizens’ Assembly on Electoral Reform during which MP Barron provided a concise presentation on the benefits of electoral reform; and She attended a talk at the Salt Spring Forum presented by Dr. Alison Smith who is an expert on homelessness and will be writing a summary about the session and forwarding it to various housing groups for their information. 3.2 Chair's Report Chair Luckham noted that: The Islands Trust Governance Committee and Financial Planning Committee are actively preparing for the upcoming 2024/2025 budget meetings; and He will be attending Transport Canada’s upcoming Salish Sea Strategy Symposium, which is being held to raise awareness and discuss issues related to protecting the coastline of BC. ADOPTED Gabriola Island ADOPTED 3 Local Trust Committee Minutes January 18, 2024 3.3 Electoral Area Director's Report Electoral Area Director Vanessa Craig attended the meeting electronically and submitted a written report from which she highlighted the following: The alternative approval process for hiring a new Health and Wellbeing Co-ordinator is underway. This new position will provide administrative support for work being done by many different groups within the Health and Wellness Collaborative. There is a form available on the Regional District of Nanaimo’s (RDN) website that can be submitted by community members that are opposed to the creation of the new position; and The concrete weir in Coats March has deteriorated and will be removed in the fall when water levels are low and when the amphibian breeding period has ended. There will be a public consultation session on January 20, 2024 and RDN parks and recreation staff will be present to answer questions and provide information. 3.4 First Nations Reports - none 4. PUBLIC COMMENTS - none 5. DELEGATIONS - none 6. MINUTES 6.1 Local Trust Committee Minutes dated November 30, 2023 – for adoption By general consent the Local Trust Committee meeting minutes of November 30, 2023 were adopted. It was noted that a member of the public, Steve Earle, is part of an ad hoc transportation group on Gabriola. He had intended to attend the November 30, 2023 meeting as a delegation; however, his comments were received during the public comments section of the meeting. A Trustee will request that he submit his comments as correspondence. 6.2 Section 26 Resolutions-Without-Meeting Report - none 6.3 Draft Advisory Planning Commission Minutes dated December 6, 2023 - for receipt Received for information. 7. BUSINESS ARISING FROM MINUTES 7.1 Follow-up Action List dated January 10, 2024= The following comments were noted: Completed items on the list will continue to have an in-progress status for at least one regular local trust committee meeting before they are shown as being completed; and ADOPTED Gabriola Island ADOPTED 4 Local Trust Committee Minutes January 18, 2024 A capacity agreement through staff-to-staff discussions with First Nations is no longer being pursued as First Nations staff have indicated that a formal capacity agreement is not required to facilitate response. 8. APPLICATIONS AND REFERRALS - none 9. LOCAL TRUST COMMITTEE PROJECTS 9.1 Official Community Plan and First Nations Engagement A Trustee indicated that there had been previous discussion regarding the potential to hire a First Nations co-ordinator to support engagement with First Nations that may have a potential interest in the Official Community Plan review. Discussion ensued. GB-2024-001 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee request staff set up a meeting, as soon as feasible, between Snuneymuxw First Nation staff and leadership, and Gabriola Local Trust Committee and Islands Trust staff, to discuss Snuneymuxw land use interests related to Gabriola and interests in engagement with the Official Community Plan review process. CARRIED 9.2 Community Engagement Discussion ensued regarding the Official Community Plan review community engagement events and how Trustees would receive feedback on the events. GB-2024-002 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee request staff to communicate the feedback related to the Official Community Plan engagement received from community engagement groups to the Local Trust Committee in writing. CARRIED 10. CORRESPONDENCE (Correspondence received concerning current applications or projects is posted to the LTC webpage) 10.1 Letter dated November 21, 2023 from Drs. J. & C. Johnstone regarding extensive tree removal on Gabriola Legends Development Discussion ensued and the following observations were made: The conservation agreement that was signed between BC, Ottawa, and First Nations that is mentioned in the letter, and that provides funding to protect and restore land, species, and biodiversity, is not likely available to Islands Trust or the Islands Trust Conservancy; and ADOPTED Gabriola Island ADOPTED 5 Local Trust Committee Minutes January 18, 2024 Additional protections in the form of Development Permit Applications (DPAs) are going to be considered in the Official Community Plan review and the letter writer’s comments might be considered during this consideration. GB-2024-003 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee request staff to add the letter from Doctors Don and Carol Johnstone to the Official Community Plan Review Project file. CARRIED 10.2 Letter dated January 4, 2024 from F. Weller, S. Earle, D. Ferens & G. Blee regarding Sue Big Oil Initiative Discussion ensued. GB-2024-004 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee request correspondence dated January 4, 2024 from Fay Weller, Steven Earle, Deb Ferens, and Greg Blee be forwarded to the Executive Committee to be added to material that Trust Council will be considering regarding the Sue Big Oil initiative. CARRIED 10.3 Email dated January 10, 2024 from T. Martin regarding Agricultural Co-op Rezoning Received for information. 11. NEW BUSINESS 11.1 Thetis Island Local Trust Area Bylaw Referral Form - Bylaw Nos. 113 and 114 GB-2024-005 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee respond to the Thetis Island Local Trust Committee regarding bylaw referral for Bylaws No. 113 and 114 that their interests are unaffected. CARRIED 11.2 Complaint - Gabriola Local Trust Committee by Centre Stage Holdings Chair Luckham stated that the complaint letter had been received, that an in-camera meeting will be conducted to discuss a response and legal opinion, and that said response to the letter writers will be made public at the time it is made. The meeting was recessed for a break at 11:55 am, and reconvened at 12:30 pm. ADOPTED Gabriola Island ADOPTED 6 Local Trust Committee Minutes January 18, 2024 12. REPORTS 12.1 Foreshore Structures - Staff Report Bylaw Enforcement and Compliance Manager Warren Dingman summarized the staff report and highlighted the following: There are currently seven shoreline bylaw contraventions on Gabriola and seven on Mudge Island; Mudge Island has a larger shoreline setback requirement than Gabriola; and Bylaw notices on the contraventions have been issued. Discussion ensued and it was noted that the summary report allows the Local Trust Committee an opportunity to educate the public about the importance of foreshore setback, and that any change in setback allowances would only affect new development. GB-2023-006 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee direct staff to include the foreshore structures report in the Official Community Plan Review / Update materials so that we do not lose focus on the importance of shoreline setback. CARRIED 12.2 Trust Conservancy Report – none 12.3 Applications Report dated January 10, 2024 The following updates were provided: The Planner working on Development Permit Variance (DVP) applications GB-DVP- 2022.3 and GB-DVP-2022.4 has received an environmental assessment and is waiting for a referral to be sent to, and a response from, Snuneymuxw First Nation; and Correspondence has been received from Snuneymuxw First Nation indicating an interest in reviewing Temporary Use Permit (TUP) application GB-TUP-2023.4 requesting that the applicant send a referral to them. 12.4 Trustee and Local Expense Report dated November, 2023 Received for information. 12.5 Adopted Policies and Standing Resolutions Received for information. 12.6 Local Trust Committee Webpage – no updates 12.7 Climate Change Action Update - none ADOPTED Gabriola Island ADOPTED 7 Local Trust Committee Minutes January 18, 2024 12.8 First Nations Relationship-Building Update 12.8.1 Seasonal Gifts Trustee Elliott stated that at the November 30, 2023 Local Trust Committee (LTC) Meeting she requested, and received, endorsement from the LTC to offer a gift to Snuneymuxw Council and Staff. While most of the contents of the gifts were donated, an additional expense was incurred when she purchased a locally made basket as part of the gift. Discussion ensued. GB-2024-007 It was MOVED and SECONDED that the Gabriola Island Local Trust Committee direct $150.00 to be repaid to Trustee Elliott for seasonal gift baskets delivered to Snuneymuxw Administrative offices on December 23, 2023, for Chief Wyse, Council members and administrative staff, on behalf of the Gabriola Local Trust Committee and Gabriola community. CARRIED 13. WORK PROGRAM 13.1 Active Projects Report dated January 10, 2024 Received for information. 13.2 Future Projects Report dated January 10, 2024 Received for information. 14. UPCOMING MEETINGS 14.1 Next Regular Meeting Scheduled for Thursday, February 22, 2024 at 10:30 am at the Gabriola Arts and Heritage Centre. 15. CLOSED MEETING 15.1 CLOSED MEETING GB-2024-008 It was MOVED and SECONDED that the meeting be closed to the public in accordance with the Community Charter, Part 4, Division 3, s.90(1)(g) for the purpose of considering: (g) litigation or potential litigation affecting the municipality; (i) the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose; and that the Recorder and Staff attend the meeting. CARRIED The meeting was closed to the public to go to an in-camera meeting at 1:15 pm. The regular meeting was recalled to order at 1:48 pm.
